in the entirety of the text - Full Text of Regulation 39319 Sets the amount of per diems for the members of the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) Full Text of record: 172113 Nº 39319-MAG (This executive decree was repealed by Article 3 of Executive Decree N° 44836 of October 22, 2024, "Setting the amount of per diems for members of the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA)") THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred by Articles 140, subsections 3), 8), 18) and 20) and 146) of the Political Constitution and Articles 25, 27.1, 28.2b of Law 6227 of May 2, 1978, General Law of Public Administration, Law Nº 7138 of November 16, 1989, Law Nº 7384 of March 16, 1994, Law Creating the Costa Rican Institute of Fisheries and Aquaculture, and Law Nº 8436 of March 1, 2005, Fisheries and Aquaculture Law.

1st—That Article 60 of Law Nº 7138 of November 16, 1989, establishes the power of the Executive Branch to remunerate the per diems (dietas) of the members of the Boards of Directors of Autonomous Institutions and other Boards of Directors appointed by the Executive Branch, in accordance with the inflation index determined by the Central Bank of Costa Rica.

2nd—That the per diems for the members of the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture have not received the annual increases for the periods 2011, 2012, 2013, and 2014.

3rd—That according to the applicable regulatory provisions, in relation to the accumulated variation amounts corresponding to the inflation indices (consumer price index) as of December of the years 2011, 2012, 2013, and 2014; data that were provided by the Statistics Section of the Central Bank of Costa Rica and by the National Institute of Statistics and Censuses (INEC); and in adherence to the principles of logic and convenience, it is necessary to adjust the per diems for the members of the Board of Directors of INCOPESCA, in order to compensate for the increase in the cost of living and inflation, and therefore they must be set at the sum of ¢50,475.00 (fifty thousand four hundred seventy- five exact colones), a sum that includes the inflation of the aforementioned periods 2011, 2012, 2013, and 2014.

4th—That the effective date of the increase to the per diems established in this Decree shall be as of its publication, for which purpose INCOPESCA has the necessary and approved budgetary resources to cover their payment.

5th—That the Cost-Benefit Evaluation Form was completed in Section I, denominated Prior Control of Regulatory Improvement, and the result was negative and the proposal does not contain procedures or requirements. Therefore, THEY DECREE:

SETTING THE AMOUNT OF PER DIEMS FOR MEMBERS OF THE BOARD OF DIRECTORS OF THE COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE

Considering:

en la totalidad del texto - Texto Completo Norma 39319 Fija monto de las dietas para los miembros de la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura (INCOPESCA) Texto Completo acta: 172113 Nº 39319-MAG (Este decreto ejecutivo fue derogado por el artículo 3° del decreto ejecutivo N° 44836 del 22 de octubre de 2024, "Fijación del monto de las dietas para miembros de la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura (INCOPESCA)") EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AGRICULTURA Y GANADERÍA En uso de las facultades conferidas por los artículos 140, incisos 3), 8), 18) y 20) y 146) de la Constitución Política y los artículos 25, 27.1, 28.2b de la Ley 6227 del 2 de mayo de 1978, Ley General de la Administración Pública, la Ley Nº 7138 del 16 de noviembre de 1989, la Ley Nº 7384 del 16 de marzo de 1994, Ley de Creación del Instituto Costarricense de Pesca y Acuicultura y la Ley Nº 8436 del 1º de marzo del 2005, Ley de Pesca y Acuicultura.

1. 1Que el artículo 60 de la Ley Nº 7138 de 16 de noviembre de 1989, establece la potestad del Poder Ejecutivo de remunerar las dietas de los miembros de las Juntas Directivas, de las Instituciones Autónomas y demás Junta Directivas nombradas por el Poder Ejecutivo, de conformidad con el índice de inflación que determine el Banco Central de Costa Rica.
2. 2Que las dietas a los miembros de la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, no se les ha aplicado los aumentos anuales de los periodos 2011, 2012, 2013 y 2014.
3. 3Que según las disposiciones normativas aplicables, en relación con los montos de variación acumulada correspondiente a los índices de inflación, (índice de precios al consumidor), a diciembre de los años 2011, 2012, 2013 y 2014; datos que fueron suministrados por la Sección de Estadísticas del Banco Central de Costa Rica y por el Instituto Nacional de Estadísticas y Censos (INEC); y en apego a los principios de lógica y conveniencia, se hace necesario ajustar las dietas a los miembros de la Junta Directiva del INCOPESCA, en aras de compensar el aumento en el costo de vida y la inflación, por lo que deberán de fijarse las mismas en la suma de ¢50.475,00 (cincuenta mil cuatrocientos setenta y cinco colones exactos), suma que incluye la inflación de los períodos 2011, 2012, 2013 y 2014 citados.
4. 4Que el rige del aumento a las dietas establecido en el presente Decreto, será a partir de su publicación, para lo cual el INCOPESCA cuenta con los recursos presupuestarios necesarios y aprobados, para atender el pago de las mismas.
5. 5Que se procedió a llenar el Formulario de Evaluación Costo Beneficio en la Sección I denominada Control Previo de Mejora Regulatoria, siendo que el mismo dio resultado negativo y que la propuesta no contiene trámites ni requisitos. Por tanto,
