I.That article 50 of the Political Constitution enshrines the right of all persons to a healthy and ecologically balanced environment, and it is the duty of the State to guarantee, defend, and preserve that right.
II.That article 46 of the Political Constitution establishes the constitutional right of consumers and users to the protection of their health, environment, safety, and economic interests, as well as to receive adequate and truthful information, to freedom of choice, and to equitable treatment.
III.That, the Ministry of Agriculture and Livestock, the State Phytosanitary Service, the Ministry of Environment and Energy, and the Ministry of Health are responsible for issuing the directives, guides, or guidelines for the evaluations that the ministries apply for the review provided by applicants for agrochemicals, in the matters specific to their competencies.
IV.That it is convenient and necessary to reform Transitory Provision Two of Executive Decree No. 43838-MAG-S-MINAE of December 14, 2022, and its reforms; titled: "RTCR 509:2022. Agricultural Inputs. Formulated Synthetic Pesticides, Technical-Grade Active Ingredient, Adjuvants, Physical Vehicles, and Related Substances for Agricultural Use. Registration", to extend the deadline for submission of applications for updating Technical-Grade Active Ingredient.
V.That in accordance with the second and third paragraphs of article 12 of the Regulation to the Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures, Executive Decree No. 37045-MP-MEIC of February 22, 2012, this Decree neither creates nor modifies procedures, requirements, or processes, and therefore does not require the regulatory improvement process.
Therefore; They Decree:
Reform of TRANSITORY PROVISION TWO of Executive Decree No. 43838-MAG-S-MINAE, RTCR 509:2022. Agricultural Inputs. Formulated Synthetic Pesticides, Active Ingredient Technical Grade, Adjuvants, Physical Vehicles and Related Substances for Agricultural Use.

CONSIDERING:

43838-MAGS- MINAE of December 14, 2022, and its reforms, so that it shall henceforth read as follows:
"TRANSITORY PROVISION TWO.-Every registration of a technical-grade active ingredient registered as such or as a component of a formulated synthetic pesticide granted prior to the entry into force of this regulation must submit the information indicated in sections 10.1, 10.2, 10.3, 10.4, according to the modality that applies to its product, and the procedure of section 11 of this regulation shall be applied, with the exception of section 11.1.5 for those technical-grade active ingredients (IA GT) that have a registration number.
The information and studies cited above must be specific to the product subjected to the updating process, according to the modality selected, and must present all information by November 30, 2025, otherwise, the cancellation of the registration of the technical-grade active ingredient (IAGT) and formulated products associated with the IAGT shall proceed, based on the provisions of section 16.12 of this regulation.
The registration shall be considered valid during the time in which the updating application is resolved.
The update established in this transitory provision does not apply to those registrations of IAGT granted by means of this decree, as well as those granted by Executive Decree No. 33495 MAG-S-MINAE-MEIC "Regulation on the Registration, Use and Control of Formulated Synthetic Pesticides, Technical-Grade Active Ingredient, Adjuvants and Related Substances for Agricultural Use", in Executive Decree No. 42769-MAG-S-MINAE "Regulation to opt for the Registration of Technical-Grade Active Ingredient through the recognition of the evaluation of technical studies approved by the Regulatory Authorities of the OECD member countries and the OECD adhering countries", and Executive Decree No. 43469 MAG-MINAE-S "Regulation for the Registration of Agricultural Inputs. Formulated Synthetic Pesticides, Technical-Grade Active Ingredient, Adjuvants, Related Substances and Physical Vehicles for Agricultural Use." To every update of a technical-grade active ingredient as a component of a formulated synthetic pesticide, the registration of the technical-grade active ingredient shall be granted upon compliance with this transitory provision, as long as the analysis and evaluation of the information submitted results in conformity with the provisions of this regulation.
Note: Likewise, the applicant may provide any additional documentation to that required in this transitory provision, in order to provide further information on the technical-grade active ingredient, registered as such or as a component of a formulated synthetic pesticide."

I.Que el artículo 50 de la Constitución Política consagra el derecho de todas las personas a un ambiente sano y ecológicamente equilibrado, siendo el deber del Estado garantizar, defender y preservar ese derecho.
II.Que el artículo 46 de la Constitución Política establece el derecho constitucional de los consumidores y usuarios a la protección de su salud, ambiente, seguridad e intereses económicos, así como a recibir información adecuada y veraz, a la libe11ad de elección y a un trato equitativo.
III.Que, el Ministerio de Agricultura y Ganadería, el Servicio Fitosanitario del Estado, el Ministerio de Ambiente y Energía y el Ministerio de Salud son los responsables de emitir las directrices, guías o lineamientos para las evaluaciones que los ministerios aplican para la revisión ap011ada por los solicitantes de agroquímicos, en las materias propias de sus competencias.
IV.Que se hace conveniente y necesario reformar el Transitorio Segundo del Decreto Ejecutivo No. 43838-MAG-S-MINAE del 14 de diciembre del 2022 y sus reformas; denominado: ';RTCR 509:2022. Insumos Agrícolas. Plaguicidas Sintéticos Formulados, Ingrediente Activo Grado Técnico, Coadyuvantes, Vehículos Físicos, Sustancias Afines y de Uso Agrícola. Registro", para ampliar el plazo de presentación de las solicitudes de actualización de Ingrediente Activo Grado Técnico.
V.Que de conformidad con los pán-afos segundo y tercero del artículo 12 del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº 37045-MP-MEIC del 22 de febrero de 2012, el presente Decreto no crea ni modifica trámites, requisitos o procedimientos, por lo que no requiere del trámite de mejora regulatoria.
Por tanto;
Reforma del TRANSITORIO SEGUNDO del Decreto Ejecutivo Nº 43838-MAG-S-MINAE, RTCR 509:2022. Insumos Agrícolas. Plaguicidas Sintéticos Formulados, Ingrediente Activo Grado Técnico, Coadyuvantes, Vehículos Físicos y Sustancias Afines de Uso Agrícola.
Registro y sus reformas.
CONSIDERANDO:

"TRANSITORIO SEGUNDO-Todo registro de ingrediente activo grado técnico registrado como tal o como componente de un plaguicida sintético formulado otorgado con anterioridad a la entrada en vigencia del presente reglamento, deberá presentar la información indicada en los numerales 10.1, 10. 2, 10. 3, 10. 4, según la modalidad que se adapta a su producto y se le aplicará el procedimiento del numeral 11 del presente reglamento con excepción del numeral 11.1. 5 a aquellos IA GT que posean número de registro.
La información y estudios anteriormente citados deberán ser propios del producto que se somete al proceso de actualización, de acuerdo a la modalidad que se seleccione y deberán presentar toda la información al 30 de noviembre de 2025, caso contrario. se procederá a la cancelación del registro del IAGTy formulados asociados al IAGT, con fundamento en lo establecido en el numeral 16. 12 del presente reglamento.
El registro se considerará vigente durante el tiempo en que se resuelva la solicitud de actualización.
La actualización establecida en este transitorio no aplica para aquellos registros otorgados de IAGT mediante el presente decreto así como también los otorgados por los Decreto Ejecutivo N º 33495 MAG-SJ\;JJNAE- MEIC "Reglamento sobre Registro, Uso y Control de Plaguicidas Sintéticos Formulados, Ingrediente Activo Grado Técnico, Coadyuvantes y Sustancias A. fines de Uso Agrícola", en el Decreto Ejecutivo N º -12769-MAG-S-MINAE "Reglamento para optar por el Registro de Ingrediente Activo Grado Técnico mediante el reconocimiento de la evaluación de los estudios técnicos aprobados por las Autoridades Reguladoras de los países miembros de la OCDE y los países adherentes de la OCDE", el Decreto Ejecutivo Nº43469 MAG-MINAE-S "Reglamento para el Registro de Insumos Agrícolas. Plaguicidas Sintéticos Formulados, Ingrediente Activo Grado Técnico, Coadyuvantes, Sustancias afines y Vehículos Físicos de Uso Agrícola".
A toda actualización de ingrediente activo grado técnico como componente de un plaguicida sintético formulado, se le otorgará el registro de ingrediente activo grado técnico al cumplir con el presente transitorio, siempre y cuando del análisis y evaluación de la información presentada resulte conforme a lo establecido en este reglamento.
Nota: Asimismo, el solicitante podrá aportar cualquier documentación adicional a la solicitada en el presente transitorio, a efecto de que se acredite una mayor información sobre el ingrediente activo grado técnico, registrado como tal o como componente de un plaguicida sintético formulado. "
