throughout the entire text - Complete Text of Norm 44720 Amendment to the Technical Regulation for the Registration of Invertebrate Organisms (Arthropods and Nematodes) for Agricultural Use N° 44720-MAG THE PRESIDENT OF THE REPUBLIC, AND THE MINISTER OF AGRICULTURE AND LIVESTOCK Based on the powers and authorities conferred in Articles 50, 140 sections 3) and 18), and 146 of the Political Constitution; Articles 27 section 1) and Article 28 section 2) subsection b) of the General Public Administration Law, N° 6227 of May 2, 1978; and Articles 4, 5 subsection b of the Phytosanitary Protection Law N° 7664 of April 8, 1997, and the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Law N° 8220 of March 4, 2002.

1. 1That, in accordance with the provisions of the Phytosanitary Protection Law, the registration, control, and use of chemical, biological, or related substances for agricultural use has the essential purposes of providing information on the characteristics, quality, identity, and efficacy of these substances; as well as ensuring their correct use and not generating unacceptable risks to human health and the environment, even when used in accordance with the recommendations for use.
2. 2That the use of biological control agents, particularly arthropods and nematodes, constitutes an important tool in Integrated Pest Management, which must be regulated so that they do not cause harm to agriculture and the environment.
3. 3That, pursuant to Article 4 of the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Law N° 8220 of March 4, 2002, every procedure or requirement that the administered party must fulfill must be set forth in a law, a decree, or a regulation and be published in the official gazette La Gaceta.
4. 4That through Directive N° 021-MEIC, published in La Gaceta N° 133 of Friday, July 21, 2023, deadlines are established for issuing or amending administrative rules or provisions required so that procedures and their instructions, manuals, forms, and annexes that do not meet the requirements for publication in the National Procedure Catalog (Catálogo Nacional de Trámites) do so.
5. 5That the State Phytosanitary Service (Servicio Fitosanitario del Estado) processes the Registration of Invertebrate Organisms (Arthropods and Nematodes) procedure in the Department of Agrochemicals and Equipment, which has its legal basis in Executive Decree N° 33103-MAG, called the Technical Regulation for the Registration of Invertebrate Organisms (Arthropods and Nematodes) for Agricultural Use of May 2, 2006; but it fails to indicate that the user must present proof of payment of the fee established in Executive Decree N° 27763 Setting Fees for Services of the Ministry of Agriculture and Livestock, of March 10, 1999, in order to comply with the aforementioned Directive 021-MEIC.
6. 6That in accordance with the second and third paragraphs of Article 12 of the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree N° 37045-MP-MEIC of February 22, 2012, this Decree does not create or modify procedures, requirements, or processes, therefore it does not require the Regulatory Improvement Procedure (Trámite de Mejora Regulatoria). Therefore,

They Decree:

AMENDMENT TO ARTICLE 4, NUMERAL 4.2 OF THE TECHNICAL REGULATION FOR THE REGISTRATION OF INVERTEBRATE ORGANISMS (ARTHROPODS AND NEMATODES) FOR AGRICULTURAL USE, EXECUTIVE DECREE N° 33103 OF MAY 2, 2006.

Considering:

en la totalidad del texto - Texto Completo Norma 44720 Reforma Reglamento Técnico para el Registro de Organismos Invertebrados (Artrópodos y Nematodos) de Uso Agrícola N° 44720-MAG EL PRESIDENTE DE LA REPÚBLICA, Y EL MINISTRO DE AGRICULTURA Y GANADERÍA Con fundamento en las atribuciones y facultades conferidas en los artículos 50, 140 incisos 3) y 18) y 146 de la Constitución Política; los artículos 27 inciso 1) y artículo 28 inciso 2) acápite b) de la Ley General de la Administración Pública, N° 6227 del 2 de mayo de 1978; y los artículos 4, 5 inciso b de la Ley de Protección Fitosanitaria N° 7664 del 08 de abril de 1997 y la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Ley N° 8220 del 4 de marzo de 2002.

1. 1Que, de conformidad con lo dispuesto en la Ley de Protección Fitosanitaria, el registro, control y uso de las sustancias químicas, biológicas o afines para uso agrícola, tiene como propósitos esenciales disponer de la información sobre las características, calidad, identidad y eficacia de estas sustancias; así como velar por su correcta utilización y no generar riesgos inaceptables a la salud humana y al ambiente, aun cuando se utilice conforme a las recomendaciones de uso.
2. 2Que la utilización de controladores biológicos, en particular artrópodos y nematodos, constituye una importante herramienta en el Manejo Integrado de Plagas, que debe estar regulada a fin de que no causen perjuicios a la agricultura y al ambiente.
3. 3Que, conforme al artículo N° 4 de la Ley de Protección al Ciudadano del Exceso de Trámites y Requisitos Administrativos, Ley N° 8220 del 04 de marzo de 2002, todo trámite o requisito que el administrado debe cumplir debe constar en una ley, un decreto o un reglamento y estar publicado en el diario oficial La Gaceta.
4. 4Que mediante la Directriz N° 021-MEIC, publicada en La Gaceta N° 133 del viernes 21 de julio del 2023, se establecen plazos para emitir o reformar normas o disposiciones administrativas que se requieran para que los trámites y sus instructivos, manuales, formularios y anexos que no cumplen con los requisitos para ser publicados en el Catálogo Nacional de Trámites, lo hagan.
5. 5Que el Servicio Fitosanitario del Estado realiza el trámite de Registro de Organismos Invertebrados (Artrópodos y Nematodos) en el Departamento de Agroquímicos y Equipos, que tiene su fundamento legal en el Decreto Ejecutivo N° 33103-MAG, denominado Reglamento Técnico para el Registro de Organismos Invertebrados (Artrópodos y Nematodos) de Uso Agrícola del 02 de mayo del 2006; pero al mismo le hace falta indicar que el usuario debe presentar el comprobante de pago de la tarifa que se encuentra establecida en el Decreto Ejecutivo N° 27763 Fijación de tarifas de los servicios del Ministerio de Agricultura y Ganadería, del 10 de marzo de 1999, para poder cumplir con la Directriz 021-MEIC indicada anteriormente.

line-height: 107%'>6°-Que de conformidad con los párrafos segundo y tercero del artículo 12 del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero de 2012, el presente Decreto no crea ni modifica trámites, requisitos o procedimientos por lo que no requiere del Trámite de Mejora Regulatoria. Por tanto,

REFORMA AL ARTÍCULO 4, NUMERAL 4.2 DEL REGLAMENTO TÉCNICO PARA EL REGISTRO DE ORGANISMOS INVERTEBRADOS (ARTRÓPODOS Y NEMATODOS) DE USO AGRÍCOLA, DECRETO EJECUTIVO N° 33103 DEL 02 DE MAYO DE 2006.
