in the entirety of the text - Complete Text of Norm 44397 Declares of public utility for the interests of the State the Association Friends of the Río Torres N° 44397-MJP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Law of Associations N° 218 of August 8, 1939, and articles 27 and following of the Regulation to the Law of Associations N° 29496-J, published in La Gaceta N° 96 of May 21, 2001, as well as the provisions of article 3, subsection ch) of the Income Tax Law N° 7092 and articles 103 and 104 of the Code of Tax Norms and Procedures N° 4755.
I.—That article 32 of the Law of Associations N° 218 of August 8, 1939, and its amendments, grants the Executive Branch the power to declare of public utility simple, federated, or confederated associations, whose development and activities are particularly useful for the interests of the State, and which thereby contribute to solving a social need.
II.—That the Association Friends of the Río Torres, legal identification number 3-002-684122, was registered in the Registry of Associations of the National Public Registry on July 9, 2014, volume two thousand fourteen, entry fifty-five thousand six hundred ninety-four.
III.—That the purposes pursued by the Association, according to its bylaws, are: "(…) To promote initiatives for the recovery and protection of the Río Torres micro-watershed (microcuenca) and its banks, as well as to support environmental, social, economic, scientific, and cultural research focused on the conservation of the River. Said initiatives include, among others, the recovery, cleanup and protection of the river and its surroundings, as well as the preservation of the Río Torres Interurban biological corridor (corredor biológico), through the mapping and containment of the pollution sources that affect the river. The Association will ensure the education and awareness of the population about the current situation of the Río Torres, in order to generate changes in the lifestyle of the inhabitants that directly impact the healing of the river, for the benefit of present and future generations (…) responsibly and sustainably utilize the ecosystem resource of the Río Torres. The Association will instill values that include respect for nature, socio-environmental sustainability, the restoration and preservation of the environment, the inclusion of diverse sectors of society, the promotion of art, culture, and education, among others. Likewise, the Association may promote the development of enterprises that contribute to the recovery and socio-environmental sustainability of the micro-watershed, that encourage visits to museums, conference centers, art galleries, amphitheaters, cafés, and other recreational centers in its surroundings (…)" IV.—That such purposes solve a social need of the first order, for which they deserve the support of the Costa Rican State. en la totalidad del texto - Texto Completo Norma 44397 Declara de utilidad pública para los intereses del Estado la Asociación Amigos del Río Torres N° 44397-MJP EL PRESDENTE DE LA REPÚBLICA Y EL MINISTRO DE JUSTICIA Y PAZ Con fundamento en lo dispuesto en los artículos 140, inciso 18) y 146 de la Constitución Política, en el artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones N° 29496-J, publicado en La Gaceta N° 96 del 21 de mayo del 2001, así como lo establecido en el artículo 3, inciso ch) de la Ley de Impuesto sobre la Renta N° 7092 y en los artículos 103 y 104 de Código de Normas y Procedimientos Tributarios N° 4755.
II.-Que la Asociación Amigos del Río Torres, cédula de persona jurídica número 3-002-684122, se inscribió en el Registro de Asociaciones del Registro Público Nacional desde el día 9 de julio del 2014, tomo dos mil catorce, asiento cincuenta y cinco mil seiscientos noventa y cuatro.
III.-Que los fines que persigue la Asociación, según sus estatutos son: "(.) Promover iniciativas de recuperación y protección de la microcuenca del Río Torres y sus riberas, así como apoyar la investigación ambiental, social, económica, científica y cultural, enfocada en la conservación del Río. Dichas iniciativas incluyen, entre otros, la recuperación, limpieza y protección del río y sus alrededores, así como, la preservación del corredor biológico Interurbano del Río Torres, a través del mapeo y contención de las fuentes de contaminación que afectan el río. La Asociación velará por educar y concientizar a la población sobre la situación actual del Río Torres, con el fin de generar cambios en el estilo de vida de los pobladores que impacten directamente en la sanación del río, en beneficio de las generaciones presentes y futuras (...) aprovechar de manera responsable y sostenible el recurso ecosistemático del Río Torres. La Asociación inculcará valores que incluyen el respeto por la naturaleza, la sostenibilidad socioambiental, la restauración y preservación del medio ambiente, la inclusión de diversos sectores de la sociedad, el fomento del arte, la cultura y la educación entre otros. Asimismo, la Asociación podrá promover el desarrollo de emprendimientos que contribuyan a la recuperación y sostenibilidad socioambiental de la microcuenca, que fomenten la visita a museos, centro de conferencias, galerías de arte, anfiteatros, cafés y otros centros recreativos en sus alrededores (...)" IV.-Que tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado costarricense. Por tanto,
