I.-That Law No. 8591, Law for the Development, Promotion, and Fostering of Organic Agricultural Activity, in force since August 14, 2007, and its regulation, seek to ensure compliance with the objectives of development, promotion, fostering, and management of organic agricultural activity, to strengthen the control and promotion mechanisms for products derived from organic agricultural activity, as well as to ensure the competitiveness and profitability of said products.
II.-That Executive Decree No. 35242-MAG-H-MEIC, in Article 34, specifically in the Procedure for the Recognition of the Environmental Benefit, indicates that formalization must be done through an agreement, which generates high costs for the administration and the administered party; therefore, an amendment is proposed that eliminates procedures and makes the process more expeditious.
III.-That in official communication DAR-OF-090-2023 dated August 7, 2023, the Directorate of Regulatory Improvement of the Ministry of Economy, Industry, and Commerce indicated that, in accordance with the second and third paragraphs of Article 12 of the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC of February 22, 2012, this Decree does not create or modify procedures, requirements, or processes, and therefore does not require the Regulatory Improvement Process. Therefore,

I.-Que la Ley Nº 8591, Ley de Desarrollo, Promoción y Fomento de la Actividad Agropecuaria Orgánica vigente desde el 14 de agosto del 2007 y su reglamento, busca asegurar el cumplimiento de los objetivos de desarrollo, promoción, fomento y gestión de la actividad agropecuaria orgánica, fortalecer los mecanismos de control y promoción de los productos derivados de la actividad agropecuaria orgánica, así como procurar la competitividad y rentabilidad de dichos productos.
II.-Que el Decreto Ejecutivo Nº 35242-MAG-H-MEIC, en el artículo 34, específicamente en el Procedimiento para el Reconocimiento del Beneficio Ambiental, se indica que para la formalización deberá ser por medio de convenio, lo cual genera altos costos para la administración y el administrado, por lo cual se propone una modificación que elimina trámites y hace el procedimiento más expedito.
III.-Que en oficio DAR-OF-090-2023 de fecha 7 de agosto de 2023 la Dirección de Mejora Regulatoria del Ministerio de Economía, Industria y Comercio indico que de conformidad con los párrafos segundo y tercero del artículo 12 del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero de 2012; el presente Decreto no crea ni modifica tramites, requisitos o procedimientos por lo que no requiere del Trámite de Mejora Regulatoria. Por tanto,
