CONSIDERING
II.In appealed judgment 9 of 6 de febrero 2020, the proceeding was approved and registration of the land in the petitioner’s name was ordered. The PGR appeals on the following grounds: 1) The appealed judgment fails to address the environmental damage caused by the drainage of two lagoons. Registration of title to the property was approved without due consideration, based merely on ten years’ possession, without assessing the legislation governing the damage caused or the qualified technical opinions supporting denial of the application. It states vaguely that this is not the proper proceeding in which to raise the issue. It emphasizes that official letter SINAC-ACLA-P-SRBA-607-2019 from SINAC, Área de Conservación la Amistad Pacífico, subregión Buenos Aires, among others, addressed the environmental damage caused at: a. Laguna Bruja. That area appeared as Laguna Bruja on the Buenos Aires map sheet.
“…today it [sic] has been reduced to a deep channel; the remainder of the area once occupied by the lagoon is devoted to pineapple production, and there are no records of when the land-use change (cambio de uso) occurred.” An artificial channel was constructed on the property for which title is sought, through which the wetland (humedal) known as laguna Bruja, which had once existed on the property to be registered, was drained and dried out without any concession or administrative authorization whatsoever (which, of course, must be supported by a statutory provision). In this regard, it quotes opinion C-100-95, under which, because public-domain property is normally designated for general public use, private possession is exceptional and, to legitimize it, an affirmative act by the Administration is required to verify whether the requested use is detrimental to the integrity of the public property and the law.
It states that the petitioner did not substantiate the actions undertaken with the required permits from the corresponding authorities to drain ecosystems, much less permits to benefit from the water of the affected lagoon. It adds that lagoons are in the public domain pursuant to article 3 of Ley de Aguas. b) Unnamed lagoon. It maintains that it suffered the same fate as the previous lagoon. It has been severely affected, there is a sizable channel, and an internal farm road crosses it; but for some reason the area was not subjected to such a severe change and retained its shape. 2) The activities carried out on the property for pineapple cultivation, including drainage, drying, and filling, contributed to disrupting the natural cycles of the lagoon ecosystems; they altered and caused the deterioration and elimination of those ecosystems, whereby the applicant for title violated the restrictions of the Ley de Conservación de Vida Silvestre (articles 98, 100 and 128) and may have committed the offense of unlawful occupation of public-domain property (usurpación de bienes de dominio público) (Código Penal, article 227, subsection 1).
It quotes an excerpt from judgment 178-2008 of the Criminal Cassation Court of the Third Judicial Circuit of Alajuela, which analyzes the protection of wetlands, whether or not they are located within protected wildlife areas (áreas silvestres protegidas). It requests that the appealed judgment be annulled and the proceeding denied, not only because of the presence of a large number of wetland areas on the property to be registered—part of the State Natural Heritage (Patrimonio Natural del Estado), public-domain property not subject to private appropriation (articles 2 and 3 of Decreto 35803), apparently excluded—but also because of the serious and difficult-to-remedy damage to the ecosystem (article 45 LOA (sic) 7554, articles 98, 100 and 128 of Ley de Conservación de Vida Silvestre, and 7 and 11 of Ley de Informaciones Posesorias).
III.In the introduction to the appeal (apelación), the appellant claims that the proceeding was approved “…hastily, allowing registration of title to the property based on mere ten-year possession, without assessing… the qualified technical criteria supporting the denial.” Although the PGR does not specifically highlight that aspect in the appeal, if true, in light of what occurred in this case, it constitutes grounds for nullity (nulidad) of the judgment, not because of problems in the assessment of evidence (valoración de prueba), but because, in proceedings such as this one, the failure to duly analyze reports from public authorities concerning the public domain (dominio público) constitutes a problem that may affect due process (debido proceso) for the party seeking title (parte titulante) (by denying that party the opportunity to exclude those areas so that it may exercise the fundamental right to private property over that which is not public-domain property (demanial)) and because a private right would be formalized over property that cannot be subject to such a right.
In this regard, it must be borne in mind that section 502 Código de Trabajo, in the version in force when this proceeding was conducted, applied by reference pursuant to article 60 Ley de Jurisdicción Agraria, provides that once the record reaches the Tribunal on appeal, the Tribunal shall first review the proceedings to determine whether any nullity affects the proceeding or the challenged judgment. Likewise, article 26 Ley de Jurisdicción Agraria, insofar as relevant, provides: “When appropriate, the courts may, on their own initiative, declare nullities and order procedural steps to be repeated in order to correct irregularities that could affect the validity of the proceeding.” Therefore, if any formality capable of causing actual denial of the right to be heard (indefensión) or affecting due process has been omitted, the proceedings or rulings must be declared null to the extent necessary to restore the proceeding to its normal course.
Based on those rules, this Court has maintained that a declaration of procedural nullity (nulidad procesal) is appropriate when such a ruling is absolutely indispensable to prevent denial of the right to be heard or to restore the proceeding to its normal course (articles 194 a 198 Código Procesal Civil, applied supplementarily, which currently correspond to sections 31 and 32). A failure to state reasons (falta de fundamentación), in addition to being a defect affecting the legitimacy of the judgment, prevents the parties from properly exercising their right of defense (derecho de defensa). The statement of reasons is insufficient when the grounds for deciding the matter in the manner specified in a Por tanto cannot be known or derived because the judgment does not contain information permitting one to determine and review how the judge reached and formulated the conclusions. This is considered a defect that cannot be remedied on appeal (vicio insubsanable en segunda instancia), first because it infringes the parties’ right of defense and due process, and second because of the principle of immutability of judgments (principio de inmutabilidad de la sentencia), which requires effective drafting to ensure clear understanding and guarantees the right to challenge (derecho de impugnación) as part of due process (see judgments of this Tribunal 572-2003, 821-2003, 658-2003, 235-2003, 178-1999, 434-2002).
In cases where the failure to state reasons is serious and evident, warranting annulment on that ground, this Court could not remedy the omissions of the first-instance judge, because doing so would result in a failure to perform judicial duties through the delegation of functional jurisdiction (competencia funcional) to this Court (178-99), apart from violating due process and the opportunity for technical defense (defensa técnica) (206-99). In this regard, the Sala Constitucional has held that “an important dimension of the principle of congruence (principio de congruencia) is also the detailed reasoning of the judgment, specifically identifying and justifying the evidence on which it relies and the evidence it rejects” (judgment 1739-92 of 1° de julio 1992). And in judgment 5563 of 3 de mayo de 2011, it added: “…proper reasoning or justification is itself a procedural guarantee (garantía procesal) necessary to convey to the interested parties the full content of a judicial decision and, at the same time and essentially, to enable them, through that knowledge, to exercise their right of defense and the opportunity to file such challenges as they deem appropriate”…
“It must therefore be reiterated that every judicial body has the inescapable constitutional duty to duly explain and substantiate its decisions and must accordingly state the factual and legal grounds on which they are based. Indeed, the reasoning of the decision makes it possible to understand the reasoning used by the judge to resolve the matters submitted for adjudication, thereby seeking to ensure that the determinations are based on reasonable and objective criteria and also allowing the decision to be reviewed by a higher court.”
IV.In addition to the foregoing, given the substance of the grounds of appeal (agravios), it is important to clarify the following regarding the protection of lagoons, since they enjoy protection through a dual dedication to the public domain (afectación demanial) (when they are natural lagoons or when they are declared protected wildlife areas (áreas silvestres protegidas), under the wetland category) and also as ecosystems connected with water resources:
Wetlands are not limited to coastal or marine settings (they also exist in areas far removed from such places). Under our legal system, certain infrastructure works may be carried out in them, provided that aquatic ecosystems are not harmed and natural cycles are not interrupted, because they are assets of public interest for multiple uses (articles 39 a 45 Ley Orgánica del Ambiente; 2, 97, 98 Ley de Conservación de Vida Silvestre; 11 Decreto 25721-Reglamento a la Ley Forestal; 9, 13 Ley de Pesca y Acuicultura; Decreto 40244 Oficialización de la Política Nacional de Humedales; Decretos 22550 y 23247; judgment 1885-2016 Sala Constitucional). Wetlands remain temporarily or permanently flooded and are considered the most productive ecosystems on Earth. They provide essential ecological services and regulate water regimes, as well as serving as a source of biodiversity. Therefore, as ecosystems, they are protected regardless of whether they have been declared protected wildlife areas (Sala Constitucional judgments 14288-2009, 1170-2014, 1885-2016).
Despite their importance, they are not always identified or officially designated, sufficient resources have not been allocated for that purpose, and private persons do not protect them properly; on the contrary, they quite often attempt to drain or damage them in order to make the land productive.
The Sala Constitucional has explained that such a declaration is unnecessary for them to be considered public-domain property as a protected wildlife area only if they are located within property belonging to state institutions, because even if they are situated within privately held state land, those areas must be segregated and, by operation of law, become part of the PNE. The latter is “…public-domain property whose conservation and administration are entrusted by law to the Ministerio del Ambiente y Energía, through the Sistema Nacional de Áreas de Conservación (Ley Forestal, arts. 6… and 13…; Ley Orgánica del Ambiente, article 32…). It comprises two important components: a) Protected wildlife areas, regardless of their management category, declared by law or executive decree: forest reserves, protective zones, national parks, biological reserves, national wildlife refuges, wetlands, and natural monuments (Ley Forestal 7575, arts. 1…, 3…; Ley Orgánica del Ambiente 7554, article 32; Ley de Biodiversidad 7788, arts. 22 and… 58; Ley del Servicio de Parques Nacionales 6084, article 3… in relation to the Ley Orgánica del MINAE… and its Reglamento; Ley de Conservación de la Vida Silvestre N° 7317, article 82…). b) All other forests and forest lands or lands suitable for forestry belonging to the State and public institutions… it is clear… that all wetlands located on State-owned property (belonging to any state entity, body, or agency) form part of that estate, given that they are classified as forest lands” (judgment 16975 of 12 noviembre 2008 and 21258 of 22 de diciembre 2010).
Article 3º.- The following are likewise national property: …II.- The basins of nationally owned lakes, lagoons, and estuaries.” The same law defines the “basin of a lake, lagoon, or estuary” (vaso de un lago, laguna o estero) as: the reservoir having the capacity necessary to contain the waters of the largest ordinary floods… (Article 69). Section 70 confirms the designation as public-domain property (bien demanial) by providing: “70.- The Nation owns the waters specified in Article 1º of this law, the beds or channels, beaches, and basins referred to in Article 3º, as well as their banks. Consequently, the Nation, through the Ministry of Environment and Energy, is the only entity that may grant and regulate the use of the aforementioned property, in accordance with the provisions of this law. The use of the property in question shall be granted to individuals, civil or commercial companies recognized under the laws of the Republic, or public-law corporations, on the condition that the concessionaires establish regular operations for its exploitation...” Section 72 adds: “72.- Judges responsible for issuing title to vacant or untitled lands shall make the corresponding reservation regarding waters and the beds or channels and basins of waters that are in the public domain, recording it in the judgment awarding the lands, and the Public Registry shall take note of those national reservations.
Failure to comply with that requirement confers no right whatsoever over such property upon the claimant or possessor.” Consequently, a body of water considered a natural lagoon and recognized as such in official documents (maps, cartographic sheets, etc.), even if it is not a protected wild area, is public-domain property by virtue of the designation established in those provisions of Ley de Aguas, which complement one another and must be read together. This Court ruled to the same effect in judgment 451 of 20 de mayo 2010 and 555 of 15 de junio de 2016.
- Within the boundaries of plan P-1708293-2013 (used to commence the proceeding), based on its overlay with the Buenos Aires cartographic sheet, Sheet 3543 IV, Scale 1:50000 from IGN, an unnamed lagoon is located in its entirety. According to the polygon, it measures 3,867 hectares. In 2017, that ecosystem had been severely drained by the deep channels along its edges, as had the area immediately adjacent to the banks of the stream originating from it and the banks of the El Peje stream. Together they form a single block that, in that year, occupied an area of approximately 9,8 hectares with forest cover (cobertura de bosque).
- There was a second lagoon, identified as Laguna Bruja, approximately 1,85 hectares of which was affected by plan P-1708293-2013. According to the cartographic sheet and Atlas de Costa Rica 2008, this lagoon had a total area of 7,2 hectares and was included in the Inventario de los Humedales de Costa Rica, code 810 (subsequently corrected), prepared that year by UICN (Unión Mundial para la Naturaleza). In 2017, that area was used entirely for pineapple cultivation and contained large channels.
- Neither of the aforementioned lagoons was included in any decree.
- It emphasizes that the forested areas must be analyzed in accordance with Article 13 of Ley Forestal 7575, which establishes that forests and forestlands (bosques y terrenos forestales) within national reserves (the 9,8 hectares and the 1,85 hectares of Laguna Bruja affected by the plan) automatically become State Natural Heritage (Patrimonio Natural del Estado, PNE).
It stated that it had no intention of closing it, given the importance of that road to it and to neighboring residents; vii) It requested time to make the corrections to the plan and coordinate with SINAC, and requested that, once the report had been clarified, a new order incorporating the changes be issued; viii) It reported that SINAC personnel had conducted a field visit on 7 de diciembre 2017.
It should be emphasized that the SINAC 2017 Report does not mention any “Laguna Larga,” contrary to the erroneous assertion by the party seeking title. The two lagoons cited in that report are documented, and the polygon of the unnamed lagoon was still reported as evident even in 2018. Therefore, the claimant’s (promovente) assertion that the 2017 report contained incorrect or confusing information is unfounded, apart from what will be stated concerning the evidentiary value (valor probatorio) of that type of document.
- On 7 de diciembre 2017, the site was visited with the interested parties, and primarily the areas identified in official communication SINAC-ACLA-P-SRBA-059-2018 (sic) (meaning the SINAC 2017 Report) were inspected. This was done to determine whether those areas could in fact be considered Patrimonio Natural del Estado under Article 14 of Ley Forestal 7575.
- An area corresponding to an unnamed lagoon shown in the cartography was located, and a forest also exists on both sides of the Peje stream. The two areas (lagoon and forest) cover 107667,00 square meters (10,7667 hectares), according to a topographic survey (levantamiento topográfico) conducted by the claimant company.
- The area shown on the Cartographic Sheet as part of Laguna Bruja, covering 1,85 hectares, could not be located in the field at that time because it was entirely occupied by pineapple cultivation.
- There is a duly established “private” road (surfaced with gravel and equipped with bridges), 8 meters wide, connecting a public road leading to Volcán with the plant located on the adjoining property. That road crosses the lagoon area and the unlocated area of Laguna Bruja, and the report requests that the appropriate decisions be made.
- On the day of the field inspection, the possible areas to be segregated (segregar) from the original plan (6-1708293-2013) were demarcated. The area corresponding to Laguna Bruja was not requested to be segregated because, in addition to not being located in the field, it would be landlocked and enclosed by private properties.
- The total area to be segregated is 10,7667 hectares, leaving the original area divided into three tracts (as shown in the proposed plan).
- The combined area of the two tracts into which the property had been divided, without affecting the Patrimonio Natural del Estado, was 53,3310 hectares. Once the plans were approved by Catastro Nacional, the corresponding title proceeding could continue in favor of the appropriate party.
- The 10,7667-hectare area considered PNE must undergo the process of registration in the name of the State or SINAC.
- Report SINAC-ACLA-P-SRBA-059-2017 identifies the code for Laguna Bruja as 810, but the correct code is 812, according to the Inventario de los Humedales de Costa Rica prepared by UICN in 2008.
The following must be clarified with respect to the information recorded on plan P-2117056-2019:
- What is marked as the “lagoon protection area” must be understood to include the lagoon’s body of water (cuerpo de agua). Technically, the lagoon and the shoreline constituting its protection area should have been drawn. These are legally distinct concepts with different effects (articles 33-c and 34 Ley Forestal; 3 and 69 Ley de Aguas). It is understood that this is a naming error.
- Section 34-e of Reglamento a la Ley de Catastro Nacional 34331 of 29 de noviembre de 2007, in force since setiembre de 2008, provides that the following must be indicated within the body of the plan: “Details: Without the need to conduct the corresponding survey, the plan must indicate, graphically and in writing, any physical feature, such as channels, rivers, streams, irrigation ditches, lagoons, reservoirs, estuaries, quarries, tunnels, bridges, dikes, dams, sewer systems, spillways, curbs, gutters, shoulders, roadways, and any other similar features, except where they border or cross the boundary, in which case a detailed survey must be conducted.” The unnamed stream (quebrada sin nombre), which was depicted as such on the 2013 plan, is not properly marked on the plan; it runs from northeast to southwest, crosses the entire property, and passes under the bridge located between coordinates 3 and 5 thereof.
Regarding the existence of this second stream, it must be borne in mind that José Roberto Granados Bermúdez (witness) stated, somewhat unclearly, in 2015 that he “believes there is a stream and an irrigation ditch, an outlet built by the company itself” (folio 64). He does not specify whether he is referring to two bodies of water and an outlet or whether the latter is the outlet. Asdrúbal Campos Cambronero (witness) is more precise, stating that the land has two streams, Peje and another one. He states that the former has its protection zone preserved; the other is small and dries up in the summer (folio 65). The Informe SINAC 2017 refers to two streams: Peje and the other one originating in the unnamed lagoon. The Informe Sinac 2019 confusingly states that, under plan P-2117056-2019, the forest area adjacent to Quebrada Peje and the “stream that formed the outlet of the unnamed lagoon” was segregated.
But, as indicated, that plan records only one stream (Peje). Despite the statements made by the witnesses and the documentation in the SINAC reports, there is no explanation—and the Court did not request the corresponding explanations—as to why that “unnamed stream” does not appear within the body of the 2019 plan. On that plan, passing under the same bridge but at a different location, what is depicted is the outlet of what is called a “channel,” which flows from the unnamed lagoon. Given the context of the case, clarification of this point and the relevant reports should have been requested to determine whether what is marked as a channel on the 2019 plan is the unnamed stream identified on the 2013 plan or whether they are different features. These matters must be properly defined by the corresponding SINAC authorities because, if what is identified as a channel is actually that stream or a natural watercourse (curso de agua natural), this must be corrected on the plan.
A channel and a stream are not the same, nor do they have the same effects or legal protection. Indeed, in the context of this case, a stream (natural channel (cauce natural)) would not entail problems in connection with the outlet of the unnamed lagoon. A channel, however, is an artificial structure that, if used to drain a lagoon—particularly without authorization or permits—may entail not only environmental damage that must be prevented but also administrative and criminal penalties. Consequently, the protection afforded to a natural watercourse (whether permanent or intermittent) is very different from that afforded to a channel. Given the context of the case and the land-use changes (cambios del uso de suelo), which were proven to have occurred with respect to the ecosystems existing within the area claimed by the applicant for title, it is relevant and necessary for the plan to properly record the nature of that watercourse (unnamed stream), or for the corresponding matter to be clarified, before the judgment resolving these proceedings is issued.
- The plan does not show—and therefore there is no certainty regarding—the exclusion of the affected area of Laguna Bruja (1,85 hectares according to Informe SINAC 2017). This was ordered in the decision of 20 de noviembre 2017 and is a matter that cannot be deemed resolved, especially given the lack of precision in the data contained in the 2018 and 2019 SINAC reports in this regard (insofar as they do not locate that lagoon on the land because the entire area is planted with pineapples and because, in the field, it would remain landlocked and enclosed within private properties, without specifying whether there is any technical or ecological impediment to doing so based on the official documentation used in Informe SINAC 2017). It must be borne in mind that the 2017 report specifies the total area of Laguna Bruja, based on the official documentary evidence used, as well as the fact that 1,85 hectares of it were affected by the 2013 plan; the location and impact are even depicted in a sketch.
Furthermore, Ley de Aguas expressly establishes in articles 1 through 3 that the bodies of water protected by those provisions, as public-domain property (bienes demaniales), “are national property, and ownership thereof is not and has not been lost when their natural characteristics are or have been altered through the execution of artificial works or prior uses.” In matters involving forests and land-use change (cambio de uso de suelo), this corresponds to what is now known as the principle or rule of lifetime tenure (irreductibilidad). Under that principle, forested areas may not be reduced either by human action (intentionally set fires, illegal logging, etc.) or by natural events (floods, earthquakes, fires, etc.). The cited legislation adopts the same position with respect to wetland ecosystems (ecosistemas de humedales), such as lagoons, by establishing that the alteration of their natural characteristics through human causes does not deprive them of their status as public-domain property.
Furthermore, the unauthorized use or occupation of this type of property confers no rights whatsoever. Nor does the time taken by the State Administration to counteract the violations confer any rights, because the statute-of-limitations defense (excepción de prescripción) cannot be asserted, given the nature of the public domain (inalienable, not subject to acquisitive prescription, and not subject to attachment) (article 262 Código Civil, applied supplementarily).
- In addition to the foregoing, the existence and restoration of Laguna Bruja is not a matter that may be disregarded and must be analyzed and resolved before the judgment concluding these proceedings is issued. First, because its existence is recorded in official documentation (Hoja Cartográfica Buenos Aires, sheet 3543 IV, scale 1:50000). Second, because in 2008 it existed as an ecosystem and was sufficiently significant to be included in the Inventario de Humedales de Costa Rica, code 812, prepared by UICN (Unión Mundial de la Naturaleza). This inventory has been compiled since Costa Rica became a contracting party to the Convention on Wetlands of International Importance Especially as Waterfowl Habitat (Ramsar) in 1991. To fulfill the commitments undertaken pursuant to Ramsar, Ministerio del Ambiente y Energía (MINAE) requested the assistance of Unión Mundial para la Naturaleza (UICN/ORMA) in developing a proposal to implement a national wetland conservation strategy (Estrategia nacional de conservación de humedales).
That proposal established the need to collect information for the preparation of an Inventario de los Humedales de Costa Rica, thereby addressing the lack of knowledge about these ecosystems and providing the country’s Áreas de Conservación with an appropriate instrument for the continuous updating of existing information about them (Córdoba, Rocío; Windevoxhel, Néstor; Romero, Juan; Inventario de los humedales de Costa Rica, 1998, at http://hdl.handle.net/11606/374). Third, as an ecosystem, it must be determined whether it is capable of recovering its conditions of environmental balance (equilibrio ambiental), which logically have been affected by pineapple cultivation. If so, the appropriate measures must be ordered for that purpose, provided they are environmentally feasible. But this matter was likewise not clearly determined during the proceedings because SINAC was not asked, as it should have been, to issue an opinion or provide the relevant clarification.
In this regard, the 2015 soil study, which cites the 2013 plan, states that the property is located in a premontane very humid forest life zone (zona de vida de bosque muy húmedo premontano) (folio 23), which means that annual precipitation at that location is high, a factor that may favor the natural restoration of bodies of water if soil conditions and other factors permit.
- The 2019 survey plan depicts a road that was not shown on the 2013 plan, as well as a channel running from the Unnamed Lagoon toward the public road. The first of these features, even though the area supposedly occupied by that lagoon was excluded, nevertheless constitutes, as the PGR argues, an act contrary to what may lawfully be done in an ecosystem of that type. The party seeking title acknowledges the existence of that internal road in briefs filed between December 2017 and July 2018, but adds that it “has no intention of closing it” because it is used by neighboring residents and by that party to reach a processing plant located on an adjoining property. Aside from the fact that whether that structure may remain does not depend on that party’s wishes if it is illegal and causes environmental damage, the justification offered is not a legally admissible reason for maintaining it, particularly because, according to Informe SINAC 2018, it was constructed without permits and also divides a wetland (humedal), which contravenes the environmental regulations protecting ecosystems of that type, whether or not they are protected wilderness areas (áreas silvestres protegidas).
The same applies to the channel shown on that plan, which, as discussed above, has not yet been clearly identified as either the Unnamed Creek or an artificial structure. This is another issue that remains to be analyzed and clarified because, as depicted on the plan, it is a structure that drains the Unnamed Lagoon. Therefore, pursuant to the provisions requiring the exercise of agrarian possession (posesión agraria) in order to obtain title in a manner consistent with environmental balance (articles 7 and 11 Ley de Informaciones Posesorias and the regulations cited in considerando IV), SINAC should have been asked to clarify what was required to address all those issues, thereby giving the party seeking title an opportunity to make the necessary corrections to protect the aforementioned environmental assets (bienes ambientales) within the applicable period. If it failed to do so, the judicial authority, while respecting due process (debido proceso), could subsequently assess the effects of that noncompliance in its judgment.
This is necessary in this particular case because, although the area of the Unnamed Lagoon was excluded from the property for which title is sought, those structures undeniably affect the ecosystem contained within it. The impact is undeniable because the road divides the Unnamed Lagoon in two and is logically an artificial barrier that interrupts natural cycles. And because the “channel” is shown as running out of the lagoon, it is logical to conclude that it drains the lagoon.
- In Informe SINAC 2018, even without considering what was stated regarding Laguna Bruja, it is asserted that the area to be segregated (segregar) is 10,7667 hectares, with reference to a barely legible sketch indicating an area of 533810 square meters. Neither the polygon nor the area shown on that sketch was retained or corresponds to what is depicted on survey plan P-2117056-2019, which, although it reduces the area, changes the depicted shape, despite the fact that, according to the documentary evidence submitted, it was prepared on the basis of what had been submitted to SINAC specifically for the purpose of changing the plan.
That ruling does not state the grounds for deeming the order complied with. Moreover, it was issued without an SINAC report confirming that the requirements stated in the 2017 and 2018 official communications had been satisfied in the 2019 plan. Given the context of the case, due process and the protection of environmental assets required that, before deeming the order issued in noviembre del 2017 complied with, the Court at a minimum should have notified SINAC of that plan and requested a report confirming that it complied with what that agency had required for the protection of the PNE.
- The area of Laguna sin nombre was partially segregated, but only as to at least 2/3 of what can be measured according to Hoja cartográfico Buenos Aires. It is clarified that this is the only official document available to certify the actual area occupied by that wetland.
- The forest sector adjacent to Quebrada Peje and the “creek draining” Laguna sin nombre is segregated because it constitutes the protection area (área de protección) of those creeks (artículo 33 de la Ley Forestal). The cited plan shows only Laguna Peje.
- It is stated that the portion of Laguna Bruja (1.85 ha) identified in report SINAC-ACLA-P-SRBA-059-2017 could not be located in the field. However, the technical or other reason preventing its location is not clarified.
- Regarding the environmental damage caused and its current condition, the following is specified:
Laguna Bruja: The area shown as the lagoon on Hoja cartográfico de Buenos Aires had, as clarified in 2019, been reduced to a deep channel. The remainder of the area once occupied by the lagoon is devoted to pineapple production, and there are no records indicating when the land-use change (cambio de uso) occurred.
Laguna sin nombre: It is severely impacted. There is a substantial channel, and an internal road on the property crosses it. For some reason, that area did not undergo such a severe change and retained its shape.
Quebrada Peje: There is clear evidence that its original channel was altered through the use of machinery (channel re-excavation and straightening (recava y rectificación de cauce)). This occurred a long time ago, which is why those areas regenerated naturally and may be considered to be in good condition.
Forest in the areas adjacent to Quebrada el Peje and the “drainage creek” of Laguna sin nombre: It is in a good state of conservation.
The fact remains that, in this case, the requirements established by Ley de Informaciones Posesorias have been satisfied, and the arguments or claims concerning civil liability must be heard in another proceeding” (underlining not in the original). Regarding this issue, the findings of fact state only: “e) In exercising possession, the plaintiff caused damage to Laguna sin nombre and Laguna Bruja (sic), which were located within the area depicted on the original survey plan of the property, including the construction of channels and the drainage of natural waters (see reports of MINAE SINAC ACLA P SRBA 608-2019 (see pages 110-111).”
While the precise date on which this occurred is unknown, the reports do conclude that it was caused by the pineapple-growing activity carried out by the applicant for title and its predecessor in title (transmitente). In this regard, the technical reports issued by the competent administrative authorities are public documents (Articles 368, 370, and 377 of the Código Procesal Civil, applied supplementally, which now correspond to Articles 45.1 and 45.2). Their contents cannot be disproved merely by arguing that their grounds or assessments may contain an error, except where there are clerical errors or they concern different property. Nor may the veracity or relevance of their contents be challenged in a non-contentious proceeding, or rebutted through reports from other authorities that lack jurisdiction to determine the matter. In the three referenced official communications, SINAC reiterated that Laguna Bruja existed in 2008; moreover, the 2017 Report specifies its dimensions, the affected area or the area included in the 2013 cadastral survey plan, and that the UICN assigned it code 812.
What the 2018 and 2019 reports fail to specify is its location, and the reasons given by the SINAC authorities for this omission and for “not requesting its segregation” are neither comprehensible nor justified, as analyzed in the preceding recital (considerando) (point 14).
To ensure due process, before declaring the evidentiary phase concluded, the Área de Conservación la Amistad Pacífico, SINAC should have been asked to clarify the imprecise and confusing information analyzed above and to specify, based on the corresponding topographic map sheet (Hoja cartográfica), the location of Laguna Bruja in relation to cadastral survey plan P-2117056-2019. This issue remains unresolved because the SINAC 2019 Report does not make clear whether that cadastral survey plan encompasses the area occupied by that ecosystem. Clarification should also have been requested regarding whether that severely affected ecosystem could be restored and what measures would be required to do so. In this regard, the applicant for title states that it has been implementing an agreement for the “gradual eradication of pineapple planting,” the existence of which was not proven; moreover, according to its explanation, the agreement is directed toward restoring the forest, not the wetland ecosystem (ecosistema de humedal) identified as Laguna Bruja (and likewise not toward restoring the unnamed lagoon).
The foregoing is important for 4 reasons: i) For legal certainty and due process, in light of the matters disputed in this case; ii) Because the disappearance of the lagoon’s open-water surface and the severe harm to it as an ecosystem were not caused by natural forces, but by works undertaken by the applicant for title or its former predecessor in title over a period of less than 10 years. When this proceeding was initiated, and in the year in which the applicant claims to have acquired the land (2015), only 7 years had elapsed since 2008, when the lagoon existed and was sufficiently important to have been included under code 812 in the Inventario de Humedales de Costa Rica prepared by the UICN. iii) Natural lagoons, as Laguna Bruja has been determined to be, are public-domain property (bienes de dominio público) pursuant to the Ley de Aguas; therefore, their surface area must be excluded from the body and measurements of land depicted in cadastral survey plans used to identify private property, particularly when those plans are used to obtain title.
In this regard, Articles 1 and 11 of the Ley de Informaciones Posesorias require that the property for which title is sought must neither already be registered nor include public-domain property (bienes demaniales). iv) Whether the open-water surface within the ecosystem polygons of both lagoons, which were severely affected by pineapple-growing activity, can be restored—and, if so, how—also remains unresolved and requires an answer so that the appropriate determination can be made before the evidentiary phase of this proceeding is concluded. This is required to fulfill the ecological social function applicable to agricultural property and to promote sustainable rural development, pursuant to the environmental regulations explained in recital IV and Article 50 of the Constitution.
Nevertheless, in the decision dated 20 de noviembre 2017, the trial judge ordered that the lagoon areas encompassed by the 2013 cadastral survey plan be excluded, but did so on the basis that they were PNE. Despite this, when issuing the judgment, the judge did not verify whether that order had been duly complied with or explain the reasons for deeming it fulfilled. As explained in the preceding points, the official documentary evidence (SINAC reports) provides express information contradicting that conclusion.
VII.Because due process was violated by the premature issuance of the judgment and because the judgment also lacks adequate reasoning, it must, as requested by the PGR, be declared null and void. The matters identified below must be analyzed, and the Court cannot perform the work of the trial judge, who must verify compliance with agro-environmental regulations and order any measures deemed appropriate for that purpose. Before continuing the proceeding, the Trial Court shall consider the information that, as indicated, must be clarified by the competent SINAC authorities or other appropriate authorities in order to determine what orders should be issued and complied with by the applicant for title. This includes, with respect to the base cadastral survey plan, the location and exclusion of the affected areas of Laguna Bruja and the unnamed lagoon; the determination of whether the Laguna Bruja ecosystem can be restored and the measures required for that purpose, if such measures must be ordered under regulations concerning environmental interests; and, with respect to the unnamed lagoon, the existence of works (the road and “canal”) that affect its balance and what orders should be issued in that regard, which may include their removal if environmentally necessary and feasible.
Likewise, the existence of the “Quebrada sin nombre,” which appeared on the canceled 2013 cadastral survey plan but is not shown on the latest cadastral survey plan submitted, must be clarified. Once the reports have been submitted and the appropriate measures ordered, compliance must occur within a reasonable period; in the event of noncompliance, the Trial Court shall issue a final decision in this proceeding based on the evidence in the record.
DISSENTING OPINION OF JUDGE SÁNCHEZ BLANCO:
The undersigned judge respects but does not concur with the majority opinion. The Possessory Information proceeding (Información Posesoria) originates in Law N.139 of 1941, which established its purpose as securing registration in the Registro Público of land lacking a title already registered or eligible for registration, subject to compliance with a series of requirements. Chief among those requirements is possession for ten years exercised with all the necessary attributes defined in Articles 853 and 856 of the Código Civil. These requirements were defined in this manner to prevent the improper titling not only of areas already registered in the names of third parties and of public and public-domain areas, but also, more generally, of all Patrimonio Nacional del Estado. Given its nature, the requirements governing such possession have evolved over time, and a gradual body of law has developed under which compliance with other rules, including environmental rules, has also become indispensable—principally the regulations contained in Articles 33 and 34 of the Ley Forestal and Articles 41 and 45 of the Ley Orgánica del Ambiente.- The present case contains a series of items of evidence that make it readily apparent that the applicant company’s possession of the entire property for which title is sought has not been exercised within a framework of sustainable development, but has instead severely affected the water resources located on the property, specifically Laguna Bruja, La Laguna Sin Nombre, and Quebrada Peje, which this Court cannot disregard.- In this regard, a new cadastral survey plan, 6-2117056-2019, was submitted with the intention of excluding the areas comprising the polygons of both lagoons.
This, however, is insufficient to permit approval of these proceedings because, as the prosecutorial authority notes, the reports issued by the Sistema Nacional de Áreas de Conservación in 2019 and 2017 showed that the lagoons had been drained and dried and that works affecting them had been constructed on the property, including an internal road and what may be artificial canals. It should be noted in this regard that the reports clearly state that, at the times of the inspections of the property, severe harm to the lagoons was observed, as was the re-excavation and channel rectification (rectificación de cauce) of Quebrada Peje, which had been carried out years earlier using machinery. Therefore, it is my view that, beyond any clarifications that may or may not be requested from the respective authorities and the issuance of orders to protect those areas, the fact remains that there is overwhelming evidence of actual harm already caused to the water resources by the applicant’s own exercise of possession and by that of its predecessor in title, which likewise engaged in pineapple cultivation.- For these reasons, the judgment approving the proceedings must be reversed and, in its place, the present proceedings must be denied approval.
THEREFORE
Judgment (sentencia) 9-2020 of 6 de febrero 2020 is vacated. Before continuing with the proceeding, the Court must cure the procedural defects. To that end, it must first request the relevant reports so as to obtain the information that must be clarified by the authorities of MINAE, SINAC, or the appropriate entity, for the purpose of ruling on or ordering:

VOTO N° 887-F-2020 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las ocho horas cincuenta y tres minutos del veinticinco de setiembre de dos mil veinte.- PROCESO DE INFORMACIÓN POSESORIA, promovido por CORPORACIÓN BANDECO CR S.A., cédula jurídica tres-ciento uno-ciento veintitrés mil novecientos cuarenta y ocho, representada por Rodrigo Jiménez Rímolo, mayor, casado, ingeniero, vecino de San José, cédula uno-quinientos cuatro-ciento ochenta y cinco. Intervienen en el proceso la PROCURADURÍA GENERAL DE LA REPÚBLICA (PGR), representada por Lydiana Rodríguez Paniagua, mayor, soltera, abogada, vecina de Alajuela, cédula dos-cuatrocientos sesenta y seis-cero sesenta y cinco; y el INSTITUTO DE DESARROLLO RURAL (Inder), cédula jurídica cuatro-cero cero cero-cero cuatro dos uno cuatro tres- once, representado por Marjorie Madrigal Muñoz, mayor, casada, abogada, vecina de Alajuela, cédula uno-quinientos noventa y ocho-ciento uno. Actúa como apoderado especial judicial de la promovente Álvaro Estrada Chavarría, carné dieciocho mil trescientos ochenta y nueve. Tramitado ante el Juzgado Agrario de Buenos Aires.-
RESULTANDO:
Redacta la Juez Alpízar Rodríguez, y;
CONSIDERANDO
II.En la sentencia impugnada 9 de 6 de febrero 2020, se aprobó el proceso y se ordenó inscribir el terreno a nombre de la parte promovente. La PGR apela, con base en lo siguiente: 1) La sentencia impugnada es omisa en cuanto al daño ambiental ocasionado por el drenaje de dos lagunas. Se aprobó con ligereza la inscripción del inmueble a titular, basándose en una simple posesión decenal, sin entrar a valorar la legislación sobre el daño ocasionado ni los criterios técnicos calificados que respaldan la improbación. Vagamente se indica no ser la vía para ser alegada. Resalta, el oficio SINAC-ACLA-P-SRBA-607-2019 del SINAC, Área de Conservación la Amistad Pacífico, subregión Buenos Aires (entre otros) señaló sobre el daño ambiental producido en: a. Laguna Bruja. Dicha área se mostraba como Laguna Bruja en la hoja cartográfica de Buenos Aires. “…hoy en día esta [sic] reducida a un profundo canal, el resto del área que en algún momento ocupó la laguna está dedicado a la producción de piña, no existen registros del momento en que se dio el cambio de uso”.
Se realizó en el inmueble a titular un canal artificial, mediante el cual se drenó el humedal (laguna Bruja), que en algún momento estuvo presente en el inmueble a inscribir y fue desecada sin concesión o autorización administrativa alguna (la cual, por supuesto, debe encontrarse respaldada en norma de ley). Transcribe al respecto el dictamen C-100-95, según el cual, dado que normalmente los bienes demaniales se destinan al uso público genérico, la detentación privada es excepcional y se requiriere para legitimarla, un acto asertivo de la Administración, que verifique si el uso solicitado no es lesivo a la integridad del bien público y la ley. Indica, la promovente no respaldó los actos realizados con los debidos permisos de las autoridades correspondientes, para desfogar ecosistemas ni mucho menos los permisos para beneficiarse del agua de la laguna intervenida. Agrega, las lagunas son de dominio público, según artículo 3 de Ley de Aguas. b) Laguna sin nombre.
Sostiene corrió igual suerte que la anterior. Está severamente impactada, existe un canal considerable y es atravesada por un camino interno de la finca, pero por alguna razón el área no fue sometida a un cambio tan severo y conservó su forma. 2) Las actividades ejecutadas en el inmueble para la siembra de piña, drenajes, desecamiento y rellenos, contribuyeron a interrumpir los ciclos naturales de los ecosistemas de las lagunas; alteraron y provocaron el deterioro y la eliminación de esos ecosistemas, con lo cual la titulante irrespetó las restricciones de la Ley de Conservación de Vida Silvestre (artículos 98, 100 y 128) y pudo cometer el delito de usurpación de bienes de dominio público (Código Penal, artículo 227, inciso 1). Transcribe un extracto del voto 178-2008 del Tribunal de Casación Penal del Tercer Circuito Judicial de Alajuela, que analiza la tutela de humedales, estén o no dentro de áreas silvestres protegidas.
Pide se anule la sentencia impugnada y se rechace el proceso, no sólo por la presencia de gran cantidad de áreas de humedal en la finca a inscribir, Patrimonio Natural del Estado, bien demanial no susceptible de apropiación por particulares (artículos 2 y 3 del Decreto 35803), en apariencia excluidas), sino que también por los daños graves y de difícil reparación en el ecosistema (artículos 45 LOA (sic) 7554, artículos 98, 100 y 128 Ley de Conservación de Vida Silvestre, 7 y 11 de Ley de Informaciones Posesorias).
III.En la introducción de la apelación, la parte apelante reclama que se aprobó el proceso “…con ligereza la inscripción del inmueble a titular, basándose en una simple posesión decenal, sin entrar a valorar… los criterios técnicos calificados que respaldan la improbación”. Aunque la PGR no destaca puntualmente ese aspecto en la apelación, de ser cierto, en función de lo acontecido en este caso, constituye una causal de nulidad de la sentencia, no por problemas de valoración de prueba, sino porque en procesos como el presente, el que los informes de autoridades públicas que versen sobre el dominio público no sean analizados debidamente, constituye un problema que puede afectar el debido proceso para la parte titulante (al no darle la oportunidad de excluir esas áreas para que haga efectivo el derecho fundamental de propiedad privada sobre lo que no es demanial) y porque se estaría formalizando un derecho privado sobre bienes que no pueden ser objeto de tal.
En ese sentido, debe tenerse presente que el numeral 502 Código de Trabajo, en la versión vigente a la fecha de tramitarse este proceso, aplicado por remisión del artículo 60 Ley de Jurisdicción Agraria, dispone que llegados los autos en apelación el Tribunal revisará, en primer término, los procedimientos, para determinar si existe alguna nulidad que afecte el proceso o la sentencia impugnada. Asimismo, el artículo 26 Ley de Jurisdicción Agraria, en lo que interesa establece: "Cuando sea del caso, los tribunales podrán, por iniciativa propia, declarar nulidades y disponer la reposición de trámites, a fin de corregir irregularidades que pudieran afectar la validez del proceso". Por ende, si se ha omitido alguna formalidad, capaz de causar efectiva indefensión o afectar el debido proceso, debe decretarse la nulidad de las actuaciones o resoluciones, hasta donde sea necesario para orientar el curso normal del proceso.
Con base en dichas reglas, esta Sede ha mantenido el criterio de que la declaratoria de nulidad procesal procede cuando sea absolutamente indispensable su pronunciamiento, para evitar indefensión o para orientar el curso normal del procedimiento (artículos 194 a 198 Código Procesal Civil, aplicados supletoriamente, que actualmente corresponde a los numerales 31 y 32). La falta de fundamentación, además de ser un vicio que afecta la legitimidad de la sentencia, impide a las partes ejercer debidamente su derecho de defensa. Existe insuficiente fundamentación cuando no se pueden conocer o derivar los motivos por los cuales se resuelve en la forma que se indica en un por tanto, al no contener la sentencia datos que permitan concluir y revisar cómo obtuvo y realizó la persona juzgadora sus conclusiones. Se considera un vicio insubsanable en segunda instancia, porque se infringe el derecho de defensa de las partes y el debido proceso y segundo por el principio de inmutabilidad de la sentencia, que exige una redacción eficaz para su claro entendimiento y garantiza el derecho de impugnación como parte del debido proceso (ver votos de este Tribunal 572-2003, 821-2003, 658-2003, 235-2003, 178-1999, 434-2002).
En casos en que la falta de fundamentación sea grave y evidente, lo cual amerite amerita anular por este motivo, no podría subsanar las omisiones de la persona juzgadora de instancia, por generarse un incumplimiento de deberes, al delegarse la competencia funcional en éste (178-99), aparte de que se viola el debido proceso y la posibilidad de defensa técnica (206-99). En ese sentido, la Sala Constitucional ha dispuesto que “una dimensión importante del principio de congruencia es, además, la de la circunstanciada motivación de la sentencia, señalando y justificando especialmente los medios de convicción en que se sustenta y los que desecha” (sentencia 1739-92 de 1° de julio 1992). Y en voto 5563 de 3 de mayo de 2011 agregó: “…la debida motivación o fundamentación es en sí misma una garantía procesal necesaria para transmitir a los interesados el contenido pleno de una decisión judicial, al mismo tiempo y esencialmente, para permitirles a través de ese conocimiento el ejercicio de su derecho a la defensa y la posibilidad de interponer las impugnaciones que estimen adecuadas”…
"Por lo que debe reiterarse que todo órgano jurisdiccional tiene el deber constitucional ineludible de motivar y fundamentar debidamente sus decisiones, por lo que debe expresar los motivos de hecho y de derecho en que se apoya. Y es que la motivación de la resolución permite conocer los razonamientos que utiliza el juez para resolver los asuntos sometidos a su conocimiento, con lo que se procura garantizar que sus determinaciones se sustenten en criterios razonables y objetivos, y se posibilita, además, que tal decisión pueda ser controlada en alzada".
IV.Además de lo explicado, dado el contenido de los agravios, es importante aclarar lo siguiente sobre la tutela de las lagunas, dada que tiene protección por doble afectación demanial (cuando son lagunas naturales o bien cuando se les declaran áreas silvestres protegidas, categoría humedal) y además como ecosistema que se relaciona con el tema hídrico:
Los humedales no se limitan a ámbitos costeros o marinos (existen también en zonas alejadas de dichos lugares). Conforme a nuestro ordenamiento jurídico, en ellos pueden llevarse a cabo ciertas obras de infraestructura, siempre que no se dañen los ecosistemas acuáticos ni se interrumpan los ciclos naturales, por ser bienes de interés público para uso múltiple (artículos 39 a 45 Ley Orgánica del Ambiente; 2, 97, 98 Ley de Conservación de Vida Silvestre; 11 Decreto 25721-Reglamento a la Ley Forestal; 9, 13 Ley de Pesca y Acuicultura; Decreto 40244 Oficialización de la Política Nacional de Humedales; Decretos 22550 y 23247; voto 1885-2016 Sala Constitucional). Los humedales permanecen temporal o permanentemente inundados y se consideran los ecosistemas más productivos de la Tierra. Prestan servicios ecológicos fundamentales y son reguladores de los regímenes hídricos, así como fuente de biodiversidad.
Por ello, como ecosistemas, son tutelados independientemente de que hayan sido declarados o no Áreas Silvestres Protegidas (Sala Constitucional votos 14288-2009, 1170-2014, 1885-2016). Pese a su importancia, no siempre están identificados u oficializados, no se han destinado recursos suficientes para ello y las personas privadas no los protegen en la forma debida; por el contrario, no en pocas ocasiones tratan de desecarlos o dañarlos para tornar los terrenos productivos.
Tal es “…un bien de dominio público cuya su conservación y administración están encomendadas, por la ley, al Ministerio del Ambiente y Energía, mediante el Sistema Nacional de Áreas de Conservación (Ley Forestal, arts. 6… y 13…; Ley Orgánica del Ambiente, artículo 32…). Lo integran dos importantes componentes: a) Las Áreas Silvestres Protegidas, cualquiera sea su categoría de manejo, declaradas por Ley o Decreto Ejecutivo: reservas forestales, zonas protectoras, parques nacionales, reservas biológicas, refugios nacionales de vida silvestre, humedales y monumentos naturales (Ley Forestal 7575, arts. 1…, 3…; Ley Orgánica del Ambiente 7554, artículo 32; Ley de Biodiversidad 7788, arts. 22 y… 58; Ley del Servicio de Parques Nacionales 6084, artículo 3… en relación con la Ley Orgánica del MINAE… y su Reglamento; Ley de Conservación de la Vida Silvestre N° 7317, artículo 82…). b) Los demás bosques y terrenos forestales o de aptitud forestal del Estado e instituciones públicas… está claro... que todos los humedales que se encuentren en propiedades del Estado (que pertenezcan a cualquier ente, órgano u organismo estatal), forman parte de ese patrimonio, dado que se les clasifica como terrenos forestales” (sentencia 16975 de 12 noviembre 2008 y 21258 de 22 de diciembre 2010).
Artículo 3º.- Son igualmente de propiedad nacional: …II.- Los vasos de los lagos, lagunas y esteros de propiedad nacional”. La misma ley define como “vaso de un lago, laguna o estero”: el depósito de la capacidad necesaria para contener las aguas de las mayores crecientes ordinarias… (artículo 69). El numeral 70 ratifica la afectación como bien demanial, al disponer: “70.- La Nación tiene la propiedad de las aguas que se determinan en el artículo 1º de esta ley, de los álveos o cauces de las playas y vasos indicados en el artículo 3º, así como el de las riberas de los mismos. En consecuencia, la Nación, por medio del Ministerio del Ambiente y Energía, es la única que puede otorgar y regular el aprovechamiento de los bienes indicados, de acuerdo con las disposiciones de esta ley. Los aprovechamientos de los bienes de que se trata, se concederán a los particulares, a sociedades, civiles o comerciales admitidas por las leyes de la República, o a corporaciones de derecho público, con la condición de que los concesionarios establezcan trabajos regulares para su explotación...”.
El numeral 72 agrega: “72.- Los Jueces encargados de extender títulos de propiedad sobre tierras baldías o no tituladas, deberán hacer la reserva consiguiente en cuanto a las aguas, álveos o cauces y vasos de las aguas que sean de dominio público, haciéndolo constar en la sentencia de adjudicación de las tierras y debiendo el Registro Público tomar nota de esas reservas nacionales. La omisión de ese requisito no confiere derecho alguno al denunciante o poseedor sobre esos bienes”. Por consiguiente, un cuerpo de agua que se considere laguna natural, que esté reconocido como tal en documentos oficiales (mapas, hojas cartográficas, etc.), aunque no sea área silvestre protegida, es bien demanial por la afectación dispuesta en esas normas de la Ley de Aguas, que se complementan entre sí y deben leerse de manera conjunta. En igual sentido este Tribunal se pronunció en voto 451 de 20 de mayo 2010 y 555 de 15 de junio de 2016.
- Dentro del cuerpo del plano P-1708293-2013 (usado para iniciar el proceso), en función del montaje con la hoja cartográfica Buenos Aires, Hoja 3543 IV, Escala 1:50000 del IGN, se ubica, por completo, una laguna sin nombre. Según el polígono mide 3,867 hectáreas. En el 2017, ese ecosistema estaba muy desecado por los profundos canales existentes en sus bordes, al igual que el área inmediata a los bordes de la quebrada que de ella se origina y en los bordes de la quebrada El Peje. Se forma un único bloque que ese año ocupaba una superficie de aproximadamente 9,8 hectáreas con cobertura de bosque.
- Existía una segunda laguna, identificada como Laguna Bruja, afectada por el plano P-1708293-2013 en aproximadamente 1,85 hectáreas. Esta laguna, según la hoja cartográfica y el Atlas de Costa Rica 2008, tenía una superficie de 7,2 hectáreas en total y fue incluida en el Inventario de los Humedales de Costa Rica, código 810 (luego corregido), realizado ese año por la UICN (Unión Mundial para la Naturaleza). En el 2017, dicha área estaba dedicada completamente al cultivo de piña y con grandes canales.
- Ninguna de las lagunas referidas estaba incluida en algún decreto.
- Resalta que lo relativo a las zonas boscosas debe ser analizado conforme al artículo 13 Ley Forestal 7575, que establece que los bosque y terrenos forestales de las reservas nacionales (las 9,8 hectáreas y las 1,85 hectáreas de la Laguna Bruja que afectaba el plano) automáticamente se constituyen Patrimonio Natural del Estado (PNE).
Indica no tiene intención de cerrarlo, dada la importancia de ese camino para ella y para las personas vecinas; vii) Pide tiempo para hacer las correcciones al plano y coordinar con el SINAC; y una vez aclarado el informe se emita una nueva resolución con las variantes; viii) Informa se hizo visita de campo de las personas funcionarias del SINAC el 7 de diciembre 2017.
Debe resaltarse que en el Informe SINAC 2017 no se cita ninguna “Laguna Larga”, como mal lo indica la parte titulante. Las dos lagunas que ese informe cita, existen documentadas y la que no tiene nombre, aún en el 2018, se indica aún era evidente su polígono. Por ende, es improcedente la afirmación de la promovente de que el informe del 2017 contenía datos incorrectos o confusos, aparte de lo que se dirá sobre el valor probatorio de ese tipo de documento.
- El 7 de diciembre 2017 se visitó el lugar con las personas interesadas y se recorrieron principalmente las áreas señaladas en el oficio SINAC-ACLA-P-SRBA-059-2018 (sic) (se trata del Informe SINAC 2017). Se hizo para determinar si esas áreas efectivamente se podían considerar o no Patrimonio Natural del Estado, según el artículo 14 de la Ley Forestal 7575.
- Se localizó un área que corresponde a una laguna sin nombre que aparece en la cartografía y además existe un bosque a ambos lados de la quebrada Peje. Las dos zonas (laguna y bosque) ocupan una superficie de 107667,00 metros cuadrados (10,7667 hectáreas) según levantamiento topográfico realizado la empresa promovente.
- Lo indicado en la Hoja Cartografía como parte de la Laguna Bruja y que ocupaba una superficie de 1,85 hectáreas, no fue posible ubicarlo en el campo en ese momento, por estar ocupado en su totalidad por el cultivo de piña.
- Existe un camino "privado", debidamente consolidado (lastreado y con puentes), de 8 metros de ancho, que comunica una vía pública que conduce a Volcán con la planta que se encuentra en finca colindante. Ese camino atraviesa el área de laguna y el área no ubicada de la Laguna Bruja y pide se tomen las decisiones pertinentes - Ese día de la inspección de campo, se demarcaron las posibles áreas a segregar del plano original (6-1708293-2013). No se solicitó segregar el área correspondiente a la Laguna Bruja ya que además de no ubicarse en el campo quedaría enclavado y encerrado en propiedades privadas.
- El total del área a segregar corresponde a 10,7667 hectáreas, quedando una superficie original segmentada en tres porciones (tal y como quedo plasmado en el plano propuesto).
- La suma de las dos porciones de la finca ya dividida, sin afectar el Patrimonio Natural del Estado, correspondía a 53,3310 hectáreas. Una vez aprobados los planos por parte del Catastro Nacional, podría seguirse el trámite de titulación correspondiente a quien corresponda.
- El área de 10,7667 hectáreas que se considera PNE debe seguir el proceso de inscripción a nombre del Estado o SINAC.
- En el informe SINAC-ACLA-P-SRBA-059-2017, se indica como código de la Laguna Bruja el 810, pero el correcto es el 812, según el Inventario de los Humedales de Costa Rica, realizado por la UICN en el 2008.
Debe puntualizarse lo siguiente con respecto a lo consignado en el plano P-2117056-2019:
- Debe entenderse lo marcado como “área de protección de la laguna” comprende el cuerpo de agua de la misma. Debió técnicamente dibujarse la laguna y la orilla que corresponde a su área de protección. Son conceptos legalmente diferentes, con efectos diversos (artículos 33-c y 34 Ley Forestal; 3 y 69 Ley de Aguas). Se interpreta que lo que existe es un error de denominación.
- El numeral 34-e del Reglamento a la Ley de Catastro Nacional 34331 del 29 de noviembre de 2007, vigente desde setiembre de 2008, dispone que en el cuerpo del plano deben indicarse: "Detalles: Sin necesidad de hacer el levantamiento respectivo, en el plano se debe indicar gráfica y literalmente, cualquier accidente físico, tales como canales, ríos, quebradas, acequias, lagunas, embalses, esteros, tajos, túneles, puentes, diques, represas, alcantarillados, vertederos, cordones, cunetas, espaldones, calzadas y cualesquiera otros similares, excepto cuando colinden o atraviesen el lindero, en cuyo caso, será necesario realizar levantamiento detallado. No se marca debidamente en el plano la quebrada sin nombre que se dibujó como tal en el plano del 2013, que va noreste a suroeste, cruza todo el terreno y pasa por el puente ubicado entre las coordenadas 3 a 5 del mismo. Sobre la existencia de esa segunda quebrada debe tenerse presente que José Roberto Granados Bermúdez (testigo), dice en forma poco clara en el 2015, que “cree que hay una quebrada y una acequia, un desfogue que lo hizo la misma compañía” (folio 64).
No precisa si hace referencia a dos cuerpos de agua y un desfogue o que lo segundo es el desfogue. Asdrúbal Campos Cambronero (testigo) es más preciso, al indicar que el terreno tiene dos quebradas, la del Peje y otra. Indica que la primera tiene la zona de protección conservada; la otra es pequeña y en el verano se seca (folio 65). En el Informe SINAC 2017 se hace referencia a dos quebradas: Peje y la otra que se origina en la laguna sin nombre. En el Informe Sinac 2019 se cita en forma confusa que en el plano P-2117056-2019, se segregó el área de bosque aledaña a la Quebrada Peje y la “quebrada que formaba el desfogue de la Laguna sin nombre”. Pero ese plano solo consigna, como se indicó, una Quebrada (Peje). Pese a lo dicho por las personas testigas y lo documentado en los informes del SINAC, no se explica ni el Juzgado pidió las explicaciones respectivas, el por qué esa “quebrada sin nombre” no aparece en el cuerpo del plano del 2019.
En tal, pasando por ese mismo puente pero en otra ubicación, lo que se dibuja es la salida de lo que se denomina “canal”, el cual sale de la laguna sin nombre. Por el contexto del caso, debió pedirse aclaración sobre lo indicado y los informes pertinentes para determinar si lo que en el plano del 2019 se marca como canal es la quebrada sin nombre señalada en el del 2013, o se trata de aspectos diversos. Esos aspectos deben ser debidamente definidos por las autoridades del SINAC respectivas, pues si lo indicado como canal en realidad es esa quebrada o un curso de agua natural, eso debe ser corrido en el plano. No significa lo mismo ni tiene iguales efectos ni tutela legal un canal que una quebrada. Incluso, en el contexto del caso, una quebrada (cauce natural), no implicaría problemas en relación con el desfogue de la laguna sin nombre. Pero un canal es una obra artificial, que si se usa para desfogar una laguna, máxime sin autorización ni permisos, puede implicar no solo daños ambientales que deben ser evitados, sino también sanciones administrativas y penales.
Por ende, la tutela es muy diferente si se brinda a un curso de agua natural (permanente o intermitente) que si se trata de un canal. Por el contexto del caso y los cambios del uso de suelo, que quedaron demostrados se han dado respecto a los ecosistemas existentes dentro del área pretendida por la titulante, resulta relevante y necesario que en el plano se consigne debidamente la naturaleza de ese curso de agua (quebrada sin nombre) o se aclare lo que corresponda al respecto, previo a emitirse la sentencia que resuelva este proceso.
- No se evidencia en el plano y por ende, no se tiene certeza al respecto, lo relativo a la exclusión del área afectada de la Laguna Bruja (de 1,85 hectáreas según el Informe SINAC 2017). Eso fue ordenado en resolución del 20 de noviembre 2017 y es un aspecto que no se puede tener por resuelto, máxime ante la imprecisión de los datos de los informes del SINAC del 2018 y 2019 al respecto (en el sentido de que no ubican esa laguna en el terreno porque todo está cultivado de piña y porque en el campo quedaría enclavada y encerrada en fincas privadas, sin precisar si existe algún impedimento de orden técnico o ecológico para hacerlo, con base en la documentación oficial que se usó en el Informe SINAC 2017). Debe tenerse presente que ese informe del 2017 específica el área total de la Laguna Bruja, conforme a la documental oficial utilizada, así como que quedaba afectada por el plano del 2013 en 1,85 hectáreas e incluso se grafica en un croquis la ubicación y afectación dichas.
Pero además, expresamente la Ley de Aguas, en sus artículos 1 a 3 establece que los cuerpos de agua tutelados en tales normas, como bienes demaniales, “son de propiedad nacional y el dominio sobre ellas no se pierde ni se ha perdido cuando por ejecución de obras artificiales o de aprovechamientos anteriores se alteren o hayan alterado las características naturales”. Ello corresponde a lo que modernamente se conoce, en materia de bosques y cambio de uso de suelo, como principio o regla de la irreductibilidad. De acuerdo con tal, los espacios boscosos no pueden reducirse ni por acción humana (incendios provocados, talas ilegales, etc.) ni por hechos naturales (inundaciones, terremotos, incendios, etc.). La normativa citada sostiene una posición igual tratándose de ecosistemas de humedales como las lagunas, al establecer que la alteración de sus características naturales, por causas humanas, no las hace perder la calidad de bien demanial.
Pero además, el uso o la ocupación de este tipo de bienes, sin autorización, no otorga ningún derecho. El tiempo que dilate la Administración estatal en contrarrestar las transgresiones tampoco, al no poder alegarse la excepción de prescripción, dado que no lo permite la naturaleza del dominio público (bienes inalienables, imprescriptibles e inembargables) (artículo 262 Código Civil, aplicado supletoriamente).
- Además de lo indicado, la existencia y recuperación de la Laguna Bruja no es un tema que se pueda obviar y debe ser analizado y resuelto antes de emitirse la sentencia que ponga fin a este proceso. Primero, porque consta su existencia en documentación oficial (Hoja Cartográfica Buenos Aires, hoja 3543 IV, escala 1:50000). Segundo, porque en el 2008 existía como ecosistema y era de tal relevancia que fue incluida en el Inventario de Humedales de Costa Rica, código 812, realizado por la UICN (Unión Mundial de la Naturaleza). Este inventario se levanta desde la incorporación de Costa Rica como parte contratante de la Convención sobre los humedales de importancia internacional especialmente como hábitat para aves acuáticas (Ramsar) en 1991. Para lograr el cumplimiento de los compromisos adquiridos con Ramsar, el Ministerio del Ambiente y Energía (MINAE), solicitó la colaboración de la Unión Mundial para la Naturaleza (UICN/ORMA), para plantear una propuesta para llevar a cabo una Estrategia nacional de conservación de humedales.
Dentro de tal propuesta se implementó la necesidad de recopilar información para el levantamiento de un Inventario de los Humedales de Costa Rica y así solventar la falta de conocimiento sobre estos ecosistemas y dar a las Áreas de Conservación del país un instrumento adecuado para una actualización constante de la información existente sobre éstos (Córdoba, Rocío; Windevoxhel, Néstor; Romero, Juan; Inventario de los humedales de Costa Rica, 1998, en http://hdl.handle.net/11606/374). Tercero, como ecosistema, debe analizarse si es posible que pueda recuperar sus condiciones de equilibrio ambiental, que lógicamente se han visto afectadas por el cultivo de piña. Si ello es así, deben ordenarse las medidas pertinentes con ese fin, de ser ambientalmente viables. Pero ese tema tampoco no fue claramente determinado durante el proceso, porque no se pidió, como era lo debido, que el SINAC se pronunciase o aclarase lo pertinente al respecto.
En ese sentido, el estudio de suelos del 2015, que cita el plano del 2013, indica que la finca se ubica en una zona de vida de bosque muy húmedo premontano (folio 23), lo cual implica que en dicho lugar la precipitación anual es alta, aspecto que puede favorecer la restauración natural de los cuerpos de agua, si las condiciones del suelo y otros factores lo permiten.
- En el plano del 2019 se dibuja la existencia de un camino que no se dibujó en el del 2013 y también un canal que sale de la Laguna sin nombre con dirección a la calle pública. El primer aspecto, aunque se haya excluido el área que supuestamente ocupa dicha laguna, no deja de constituir, como lo reclama la PGR, un acto que va en contra de lo que se permite realizar en un ecosistema de tal tipo. La parte titulante reconoce la existencia de ese camino interno, en memoriales presentados entre diciembre de 2017 y julio 2018, pero agrega que no “tiene intención de cerrarlo” porque es de uso de personas vecinas y suyo, para llegar a una planta procesadora ubicada en una finca colindante. Aparte de que no depende de su voluntad el que esa obra se mantenga si es ilegal y causa daño ambiental, lo que expresa como justificación no es motivo legal admisible para mantenerle, máxime si es una obra realizada sin permisos, según Informe SINAC 2018, que además divide un humedal, lo cual va en contra de la normativa ambiental que tutela ese tipo de ecosistemas, sean o no áreas silvestres protegidas.
De igual forma sucede con el canal que en ese plano se consigna y que como se analizó anteriormente, aún no está claro si se trata de la Quebrada sin nombre o de una obra artificial. Es otro punto pendiente de analizar y aclarar, dado que por lo que se marca en el plano, es una obra que desfoga la Laguna sin nombre. Por ende, en función de las normas que exigen el ejercicio de una posesión agraria para titular acorde con el equilibrio ambiental (artículos 7 y 11 Ley de Informaciones Posesorias y normativa citada en el considerando IV), se debió solicitar al SINAC que aclarase lo que se requería para dar respuesta a todos esos aspectos y poder dar así la oportunidad a la parte titulante de hacer las correcciones para la tutela de los bienes ambientales citados, en el plazo pertinente. De no ser así, pero respetando el debido proceso, la autoridad judicial podría posteriormente valorar los efectos del incumplimiento en sentencia.
Eso es necesario en este caso en concreto, porque aunque el área de la Laguna sin nombre se excluyó de la finca a titular, dichas obras impactan innegablemente el ecosistema que quedó inmerso en tal. La afectación es innegable, dado que el camino divide en dos la Laguna sin nombre y es por lógica una barrera artificial que interrumpe los ciclos naturales. Y el “canal”, como se marca que sale de la misma, es lógico se concluya la desfoga.
- En el Informe SINAC 2018, aún sin tomar en cuenta lo indicado sobre la Laguna Bruja, se afirma que el área a segregar corresponde a 10,7667 hectáreas y se remite a un croquis poco legible, que indica una medida de 533810 metros cuadrados. Ni el polígono ni el área de ese croquis se mantiene o corresponden a lo que se grafica en el plano P-2117056-2019, que aunque reduce la medida, cambia la forma graficada, pese a que según la documental aportada, se realizó con base en lo que se presentó ante el SINAC para precisamente cambiar el plano.
Dicha resolución no fundamenta el por qué se tiene por cumplido lo prevenido. Pero además, se emitió sin que constar con un informe del SINAC, que confirmase que lo indicado en los oficios del 2017 y 2018, se cumplía en el plano del 2019. Dado el contexto del caso, por debido proceso y en función de la tutela de los bienes ambientales, lo mínimo que el Juzgado debió hacer antes de tener por cumplido lo prevenido en noviembre del 2017, era poner en conocimiento del SINAC dicho plano y pedir un informe que confirmase que tal cumplía con lo que dicha entidad solicitaba para la tutela del PNE.
- Se segregó parcialmente el área de la laguna sin nombre; solo en al menos 2/3 de lo que se puede medir, según la Hoja cartográfico Buenos Aires. Se aclara ese es el único documento oficial con que se cuenta para dar fe del área real que ocupa ese humedal.
- Se segrega el sector de bosque aledaño a la Quebrada Peje y a la “quebrada que desfoga” la Laguna sin nombre, por conformar el área de protección de esas quebradas (artículo 33 de la Ley Forestal). El plano citado solo marca la Laguna Peje.
- Se indica que la sección de la Laguna Bruja (1.85 ha), señalada en el informe SINAC-ACLA-P-SRBA-059-2017, no fue posible ubicarla en el campo. Pero no se aclara el motivo técnico o de otra índole que lo impida.
- En cuanto al daño ambiental ocasionado y su estado actual, se especifica:
Laguna Bruja: El área que se mostraba como tal en la Hoja cartográfico de Buenos Aires, se aclara en el 2019 se redujo a un profundo canal. El resto del área que en algún momento ocupó la laguna está dedicado a la producción de piña y no existen registros del momento en que se dio el cambio de uso.
Laguna sin nombre: Está severamente impactada. Existe un canal considerable y está atravesada por un camino interno de la finca. Por alguna razón esa área no fue sometida a un cambio tan severo y conservó su forma.
Quebrada Peje: Existe clara evidencia de transformación de su cauce original (recava y rectificación de cauce) por medio de uso de maquinaria. Eso sucedió hace mucho tiempo, razón por la cual esas áreas se regeneraron de modo natural y se pueden considerar en buen estado.
Bosque en las áreas adyacentes a la Quebrada el Peje y “quebrada de desfogue” de la Laguna sin nombre: se encuentra en buen estado de conservación.
En los hechos probados, sobre el tema, únicamente se expone. “e) En el ejercicio de la posesión, la actora ha generado daños a las lagunas sin nombre y la bruja (sic) que se ubicaban dentro del área que representa el plano original de la propiedad tales como construcción de canales y drenado de las aguas naturales (ver informes de MINAE SINAC ACLA P SRBA 608-2019 (ver páginas 110-111)”.
En ese sentido, los informes técnicos de las autoridades administrativas competentes son documentos públicos (artículos 368, 370, 377 del Código Procesal Civil, aplicado supletoriamente, que hoy corresponden al 45.1 y 45.2). Para desvirtuar su contenido no basta con argumentar que puedan tener un error en sus fundamentos o apreciaciones y además, salvo que se trate de errores materiales o se refiera a bienes diferentes. Tampoco se puede en un proceso no contencioso tratar de combatir la veracidad o pertinencia de su contenido ni refutarse a través de informes de otras autoridades que no tengan competencia para definir el tema. En los tres oficios referidos el SINAC se reiteró que la Laguna Bruja existía en el 2008, e incluso en el iInforme del 2017 se cita su medida, zona afectada o incluida en el plano del 2013 y que la UICN le otorgó el código 812. Lo que no se precisa en los informes del 2018 y 2019 es su ubicación, sin que los motivos dados por las autoridades del SINAC para ello y para “no pedir su segregación” sean comprensibles ni justificados, según se analizó en el considerando anterior (punto 14).
Por debido proceso, se debió, antes de dar por concluida la fase probatoria, solicitar al Área de Conservación la Amistad Pacífico, SINAC aclarar los datos imprecisos y confusos analizados, así como especificar, conforme a las Hoja cartográfica correspondiente, la ubicación de la Laguna Bruja en relación con el plano P-2117056-2019, punto no resuelto aún, pues en el Informe SINAC 2019 no queda claro si tal comprende o no el área abarcada por dicho ecosistema. También se debió solicitar se aclarase la posibilidad de regeneración de ese ecosistema tan gravemente afectado y qué medidas debían tomarse para ello. En ese sentido, la parte titulante cita que ha estado ejecutando un acuerdo de “desarraigo paulatino de siembre de piña”, cuya existencia no se probó, pero además por su explicación, va dirigido a la recuperación del bosque, no del ecosistema de humedal que se identifica como Laguna Bruja (de igual forma tampoco en lo que respecta a la Laguna sin nombre).
Lo indicado es importante por 4 motivos: i) Por seguridad jurídica y debido proceso, en función de lo debatido en el caso; ii) Porque la desaparición del espejo de agua de esa laguna y su afectación grave como ecosistema, no se debe a causas naturales, sino a obras de la parte titulante o su anterior transmitente, realizadas en un espacio de menos de 10 años. A la fecha de plantearse este proceso y en el año que la promovente afirma adquirió el terreno (2015), solo habían transcurrido 7 años desde el 2008, época en que la laguna existía y era de tal importancia que fue incluida con el código 812, en el Inventario de Humedales de Costa Rica, realizado por la UICN. iii) Las lagunas naturales, como se concluye lo es Laguna Bruja, son bienes de dominio público, conforme lo establece la normativa de la Ley de Aguas, por lo que su superficie debe ser excluida del cuerpo y medida de los terrenos graficados en planos para identificar propiedad privada, máxime si son utilizados para titularlos.
Los artículos 1 y 11 de la Ley de Informaciones Posesorias exigen en ese sentido, que la finca a titular no debe estar inscrita ni tampoco incluir bienes demaniales. iv) Lo relativo a si es posible la recuperación del espejo de agua del polígono del ecosistemas de ambas lagunas y de qué forma, gravemente afectados por la actividad piñera, tampoco es un tema aclarado y que requiere respuesta, para determinarse lo pertinente antes de darse por terminada la etapa probatoria de este proceso. Esto en cumplimiento de la función social ecológica que debe cumplirse en bienes de naturaleza agraria y en pro del desarrollo sostenible rural, conforme la normativa ambiental explicada en el considerando IV y el artículo 50 constitucional.
VII.Por debido proceso al dictarse la sentencia en forma anticipada y además tener problemas de falta de fundamentación, procede, como lo solicita la PGR, declarar su nulidad. El análisis de los aspectos que se indicarán, es necesario y el Tribunal no puede suplir la labor del juzgador de instancia, quien debe verificar el cumplimiento de la normativa agroambiental y dictar las medidas que considere oportunas para ello. Previo a continuar con el proceso, tome en cuenta el Juzgado los datos que se indican deben ser aclarados por las autoridades del SINAC competentes o las que corresponda, para determinar lo que procede ordenar y que deben ser cumplida por la parte titulante, en cuanto al plano base, en función de la ubicación y exclusión de las áreas afectadas de las lagunas Bruja y la innominada; la determinación de la recuperación del ecosistema de la Laguna Bruja y las medidas para ello, , en caso de tener que ser ordenadas conforme a la normativa de interés ambiental; así como lo que respecta a la Laguna sin nombre, en cuanto a la existencia de obras (camino y “canal”) que afectan su equilibrio y lo que proceda ordenar al respecto, que puede incluir su remoción en caso de que ambientalmente sea necesario y viable.
De igual forma, debe aclararse lo referido a la existencia de la “Quebrada sin nombre” que se señalaba en el plano cancelado del 2013 y que en el último plano aportado no se consigna. Rendidos los informes y ordenado lo que proceda, que se debe cumplirse en un plazo razonable, en caso de incumplimiento el Juzgado deberá resolver este proceso en definitiva, con los elementos probatorios que consten.
VOTO SALVADO DE LA JUEZA SÁNCHEZ BLANCO:
La suscrita jueza respeta más no comparte el voto de mayoría. El proceso de Información Posesoria se origina a partir de la ley N.139 de 1941, estableciéndose como su finalidad, el lograr la inscripción registral de aquellos terrenos que carecieren de título inscrito o inscribible en el Registro Público, cumpliendo para ello una serie de requisitos, en los que se exige fundamentalmente, una posesión decenal ejercida con todos los atributos necesarios definidos en el artículo 853 y 856 del Código Civil. Estos requisitos se han definido así, para evitar no sólo la titulación indebida de áreas ya inscritas a nombre de terceros, áreas públicas y demaniales sino también en general para todo el Patrimonio Nacional del Estado. Por su concepción, los requisitos de esa posesión a lo largo del tiempo, han ido evolucionando y se ha generado una construcción gradual en la que se torna imprescindible también, la observancia de otras normas, entre ellas las ambientales; principalmente las regulaciones contenidas en los artículos 33, 34 de la Ley Forestal, y los artículos 41, 45 de la Ley Orgánica del Ambiente.- El presente caso, presenta una serie de evidencias que tornan notorio considerar, que la posesión ejercida por la sociedad titulante en función de todo el inmueble a titular, no ha sido ejercida en el marco de un desarrollo sostenible, sino más bien con una afectación severa en el recurso hídrico que presenta el inmueble, puntualmente en lo que a las Laguna Bruja, La Laguna Sin Nombre y la Quebrada Peje respectan; las cuales este Tribunal no puede dejar de observar.- En este sentido, existe el nuevo plano aportado 6-2117056-2019, mediante el cual se pretende la exclusión de las áreas que conforman el polígono de ambas Lagunas, sin embargo, esta situación no resulta suficiente para permitir la aprobación de estas diligencias, por cuanto, tal y como lo señala el ente procurador, se evidenció mediante los informes del Sistema Nacional de Áreas de Conservación del 2019 y del 2017 que existido drenaje y secamiento de las lagunas, así como la construcción de obras como un camino interno y lo que podría ser canales artificiales dentro del inmueble que los afectan.
Nótese al respecto, que se refiere en los informes de manera clara, para los momentos de las visitas realizadas al inmueble, se observó la afectación severa a las lagunas; así como la recava y rectificación de cause de la Quebrada Peje, la cual fue hecha años atrás por medio de uso de maquinaria. Por ello, es criterio que en este caso, más allá de las aclaraciones que se puedan o no requerir a las instancias respectivas y la formulación de prevenciones para la protección de esas áreas, lo cierto del caso es que se evidencia de manera inmensurable, una afectación real ya realizada al recurso hídrico que proviene de la misma posesión ejercida por la promovente, derivada además de su transmitente quien también, se dedicaba al cultivo de piña.- Por tales motivos, la sentencia debe ser revocada en cuanto a que se aprueba las diligencias y en su lugar, improbarse las presentes diligencias.
POR TANTO
Se anula la sentencia 9-2020 de 6 de febrero 2020. Previo a continuar con el proceso, deberá el Juzgado sanear procedimientos. Para ello primero deberá pedir los informes pertinentes para contar con los datos que deben ser aclarados por las autoridades del MINAE o del SINAC o a quien corresponda, con el fin de resolver u ordenar:
