Decision: 2019-2238 Case File: 16-000420-0597-PE(17) CRIMINAL JUDGMENT APPEALS COURT. Second Judicial Circuit of San José. Goicoechea, at fourteen hours and fifty minutes, on diez de diciembre de dos mil diecinueve.- APPEAL (recurso de apelación) filed in the present proceeding against Nombre01, of legal age, Costa Rican, identity card number CED01, born in Limón, on 10 de enero de 1988, son of Nombre02 and Nombre03, married, a merchant by occupation, resident of Limón, Talamanca, Sixaola; for the offense of VIOLATION OF THE LAW IN THE FORM OF ILLEGAL TRANSPORTATION OF TIMBER, to the detriment of THE LEY FORESTAL AND FOREST RESOURCES. Judge Roy Antonio Badilla Rojas and Judges Elizabeth Montero Mena and Alejandra Valenciano Chinchillla participated in deciding the appeal. Attorney Marlon Poyser Watson appeared before this Court on behalf of the Prosecutor’s Office.
RESULTS:
I.By judgment number 309-2019, issued at seven hours and thirty minutes on treinta de abril de dos mil diecinueve, the Criminal Trial Court of the First Judicial Circuit of the Atlantic Zone, Bribri, ruled: “THEREFORE: Based on the foregoing and pursuant to Articles 39 and 41 of the Constitution, 1, 2, 6, 9, 142, 265, 267, 360, 364, 365, and 366 of the Code of Criminal Procedure, 1, 45, and 110 of the Criminal Code, and Articles 56 and 63(a) of Ley Forestal number 7575, Nombre01 is acquitted of all punishment and liability for the offense of ILLEGAL TRANSPORTATION OF FOREST PRODUCTS, to the detriment of THE LEY FORESTAL AND FOREST RESOURCES. No special award of costs is imposed; such costs shall be borne by the State. REGARDING FORFEITURE (comiso): If the timber seized in this proceeding was not auctioned, information that may be verified in the case record, it is ordered that it be returned to the person who claims ownership thereof and proves it with the corresponding documentation.
Likewise, the following items are ordered returned: two chainsaws, one STHIL 660, serial number 174203878, and one chainsaw with an aluminum frame. For this purpose, a period of 30 business days is granted for their claim; otherwise, if that period elapses without any interested party coming forward, forfeiture in favor of the State is ordered. It is hereby stated that the foregoing is a summary of the Comprehensive Oral Judgment issued in this proceeding and that the entire hearing and all events occurring therein were recorded digitally, an electronic record to which the parties may have access if required. III.After conducting the corresponding deliberation in accordance with Article 465 of the Code of Criminal Procedure, the Court considered the issues raised in the appeal.
Drafted by Criminal Judgment Appeals Judge Badilla Rojas; and,
CONSIDERING:
Sole Ground.- Lic. Marlon Poyser Watson, in his capacity as representative of the Public Prosecutor’s Office (Ministerio Público), filed an appeal (recurso de apelación) against Judgment No. 309-2019, issued by the Trial Court of the First Judicial Circuit of the Atlantic Zone, Talamanca seat, at 07:30 on 30 de abril de 2019. FIRST GROUND: VIOLATION OF THE PRINCIPLE OF EVALUATION OF THE EVIDENCE (PRINCIPIO DE VALORACIÓN DE LA PRUEBA). Articles 181, 227, and 228 of the Code of Criminal Procedure (Código Procesal Penal). He explains that, in the present case, the trial judge erred in evaluating the evidence and even stated that the case should not have reached that court because the charged conduct did not satisfy the statutory elements of an offense (tipicidad). This was despite the fact that the Public Prosecutor’s Office based its case on Article 61 of the Ley Forestal, insofar as the accused was stopped while transporting a forest product without the corresponding permit.
The accused was stopped while transporting 48 pieces of fruta dorada wood, and when questioned about the required documentation—either the transport permit (guía de transporte) or the corresponding invoice—he did not have it with him. Therefore, in the opinion of the Public Prosecutor’s Office, the objective and subjective elements of the referenced criminal offense (tipo penal) were satisfied, particularly because officer Nombre05 testified and explained the details of the detention and seizure (decomiso) of the evidence. This was corroborated by the testimony of witnesses Nombre06 and Nombre07, who clarified the matter: the former regarding the seizure and the latter regarding the inspection of the seized property in his capacity as the official responsible for Minaet. According to the Public Prosecutor’s Office, the judge incorrectly evaluated the evidence because, considered as a whole, it established the objective and subjective elements of the charged offense.
Moreover, two chainsaws bearing wood residue were found inside the truck, showing that the forest product had recently been sawn into raw material. All of this should have resulted in a conviction rather than the ultimate outcome challenged in this appeal. The claim cannot be sustained: This Criminal Judgment Appeals Chamber has reviewed the judgment in its entirety, as required by Section 459 of the Code of Criminal Procedure, and finds none of the deficiencies identified by the appellant. This is because the Public Prosecutor’s Office presents a confusing argument. The conduct charged against defendant Nombre01 was that he was stopped while transporting 48 pieces of the fruta dorada species, but the act of transporting a forest product is not described in Article 61 of the Ley Forestal (Ley 7575). Section 61(a) refers to the exploitation (aprovechamiento) of one or more forest resources on private property without the permission of the State Forestry Administration (Administración Forestal del Estado), or in a manner inconsistent with the authorization granted even when such permission has been obtained.
This subsection concerning exploitation cannot be applied to the accused’s conduct, because exploitation cannot be interpreted in isolation; instead, the origin of the forest product must be determined, specifically whether it came from private property. In this particular case, the prosecution evidence (prueba de cargo) cited by the Public Prosecutor’s Office established the detention and seizure of the product, but not its origin. The prosecution evidence is therefore insufficient in this respect. As for subsection (b) of Article 61, it covers the prohibited acts of acquiring or processing the forest product. At this point, it must not be overlooked that the prosecution evidence established that defendant Nombre01 was stopped while transporting the product, not while acquiring or processing it. Subsection (c) of the same provision refers to a change in the condition of the land. In this case, no activity involving the land on which the forest product was being generated could be established, since it must be remembered that the accused was stopped on a public road.
The single-judge court conducted a similar analysis in its judgment when it began its reasoning at timestamp 00:27:30, first examining whether the conduct satisfied the statutory elements of the offense. If that analysis had resulted in a complete correspondence or subsumption (subsunción) of the conduct under the legal provision, the analysis could have continued, but no such result was reached. The court clearly explained the basis for its evaluation and judicial decision. That reasoning is consistent not only with the charged conduct but also with the prosecution and defense evidence (prueba de descargo) admitted in the proceedings. It therefore satisfies the reasoning requirements under Section 142 and the requirements governing the evaluation of evidence under Sections 180 through 184 of the Code of Criminal Procedure. This Court does wish to emphasize that the Public Prosecutor’s Office bases its claim solely on the prosecution evidence, whereas the trial judge also considered the defense evidence, which presents a broader picture of the context in which the conduct occurred. That analysis is therefore legally sound, and this ground of appeal must be denied.
SECOND GROUND: ERRONEOUS EVALUATION OF THE EVIDENCE UNDER THE RULES OF SOUND JUDICIAL REASONING (SANA CRÍTICA). He explains that the judge was misled by the defense’s stratagem of submitting as documentary evidence (prueba documental) an invoice identifying a sawmill as the seller and the accused as the purchaser of the wood, but that this does nothing to change the fact that the accused was caught transporting a forest product without a permit, and it was therefore erroneous to deem that document credible. He emphasizes that the court did not thoroughly analyze the origin and context in which the document was produced, why it was offered after the events, or the fact that it does not contain the seller’s signature. According to the Public Prosecutor’s Office, it therefore fails to meet the legal requirements for consideration as a valid invoice, at least for tax-administration purposes, and the court erred by according the document full credibility in this case.
The claim cannot succeed: This Criminal Judgment Appeals Chamber cannot agree with the prosecutor’s position insofar as he characterizes the defense position as a “stratagem.” Although that characterization is respected, it cannot be endorsed, because the defense also has a position concerning the evaluation of the evidence, which in many cases may coincide with the Public Prosecutor’s Office’s evaluation. That does not make it a stratagem; rather, it is a defense theory (tesis defensiva) deserving of the same analysis as the positions of the other legal professionals participating in the criminal proceedings. Furthermore, the invoice is not the only evidence supporting the defense’s position. Several witnesses also testified, including Mr. Nombre08, the owner of the sawmill, who explained that his customer Nombre09 had contracted with him to purchase the 48 pieces of Fruta Dorada and had told him that he had arranged for Nombre02 to pick them up and deliver them to him.
Nombre09 himself also testified, confirming that he was the person who purchased the formwork pieces and instructed Nombre02 to pick them up from Mr. Nombre08’s sawmill. When these accounts are considered together with the document that the Public Prosecutor’s Office challenges as invalid, they lend it a measure of credibility, particularly because there is no evidence casting doubt on the truthfulness of the information contained in the document. Beginning at timestamp 00:38:27, the trial judge discussed the invoice and its validity, emphasizing two matters. First, the Public Prosecutor’s Office made no forensic effort to discredit the document or establish its falsity on the basis of a technical opinion. Second, its validity for tax purposes cannot be challenged insofar as the information it contains does not establish that it is fraudulent. Indeed, the trial judge took care to point out that the document states at the bottom, “covered by the simplified regime,” which explains why it is an unstamped invoice.
At the very least, even though it bears no signatures, it clearly establishes the existence of a wood transaction. That would be sufficient to authorize the transportation, even though defendant Nombre01 did not have it with him when stopped. Accordingly, the trial judge’s evaluation is deemed comprehensive and consistent with the requirements governing the evaluation of evidence under Sections 180 through 184 of the Code of Criminal Procedure, and this ground of appeal must therefore be denied.
THIRD GROUND: ERRONEOUS FACTUAL REASONING (FUNDAMENTACIÓN INTELECTIVA): He explains that the court stated in its judgment that the prohibited conduct could not be prosecuted because there was no certificate of origin (certificado de origen), a conclusion with which the appellant disagrees. Determining the place where the trees were cut is important for the offense of illegal logging (tala ilegal), because forestry or agroforestry plantations are exempt from that offense, provided that they are not located in a protected area (zona de protección). It is clear that, for transportation purposes, determining the origin is unnecessary; what is required is the necessary documentation, namely the transport permit, which the accused did not have in this case. The appellant therefore requests that the judgment be vacated and the matter remanded (reenvío) to a differently constituted court. The claim is unfounded.
Throughout this appeal, it has become apparent that the Public Prosecutor’s Office did not properly direct the proceedings. Under the first ground, it argues that the charged conduct should fall within the act described in Article 61 of Ley 7575. It then returns to the issue of transporting wood, while under this third ground it suggests that the case involves illegal logging. It invokes various operative verbs appearing throughout the Ley Forestal, overlooking the fact that the conduct investigated with respect to Nombre01 is quite straightforward: he was stopped while driving a small enclosed-bed truck in which he was transporting 48 sawn pieces of the fruta dorada species; when asked for the required documentation, he did not have it with him at that time, but he subsequently produced it before the charging instrument (pieza acusatoria) was filed. From the outset of her reasoning, as discussed under the first ground of this appeal, the trial judge determined that the conduct could not be characterized as any of the activities or acts referred to in Article 61 of the cited law.
Instead, it appears to fall more closely under Section 63(a), which provides for punishment of the conduct set forth in Article 56 of the same law. Article 56 states verbatim: “Article 56 Transportation of Wood (Movilización de Madera). Logs, squared timber, or sawn wood originating from a forest or plantation may not be transported without the corresponding documentation.” It is clear that the accused’s transportation of the wood constitutes a form of transportation of wood, but the quoted provision requires documentation only in two cases: when the wood comes from a forest or from a plantation. This is what the judge refers to when questioning the absence of a certificate of origin, because it is necessary to determine whether the wood originated within either of these categories—a forest or a plantation—before the required documentation can be questioned. In the present matter, the officers stopped the accused and, because he did not have the documentation with him, seized the wood, after which an MINAET official conducted the corresponding inspection.
That inspection determined the species and the wood’s possible value and quantity, but no inquiry whatsoever was made into its origin. This detail is important because origin is part of the relevant offense, which includes transportation, since not every act of transportation is punishable. Given the impossibility of determining that origin, the judge’s conclusion that the conduct did not satisfy the statutory elements of the offense is logical. Accordingly, that conclusion is consistent with the law and the record, and this ground of appeal must therefore be denied.
FOURTH GROUND: FAILURE TO PROVIDE REASONING REGARDING THE PROTECTED LEGAL INTEREST (BIEN JURÍDICO TUTELADO). The appellant explains that the trial court did not adequately analyze the protected legal interest in this case, taking into account its importance to the canton of Talamanca and the environmental, social, and economic harm caused by damage to the forest resource (recurso forestal). Accordingly, the appellant requests that the judgment be vacated and that the case be remanded for retrial before a differently constituted trial court. The appellant requests that the appeal be admitted, that it be granted in all respects, and that a retrial be ordered so that a differently constituted trial court may decide the case (see appeal at folios 8 to 12). The claim is without merit. As established under the First and Third Grounds of this appeal, the trial judge correctly explained why the conduct attributed to the accused, Nombre01, does not satisfy the requirements of offense classification (tipicidad) necessary to bring it within the proposed criminal offense (tipo penal).
In this case, the examination of offense classification did not even establish that the objective elements of the offense were met; it is therefore entirely unnecessary to provide reasoning regarding the protected legal interest, insofar as that concept falls within the theory of criminal liability (teoría del delito), at the level of unlawfulness (antijuridicidad), specifically substantive unlawfulness (antijuridicidad material). The theory of criminal liability, however, entails a progressive analysis in which one stage must first be exhausted or satisfied before proceeding to the next. In this case, as stated supra, the analysis of the first stage—offense classification—was not satisfactorily completed, which precludes or renders unnecessary an examination of the subsequent stages, because such an exercise would be incomplete. For these reasons, the appellant’s challenge is without merit, and the ground of appeal raised must be denied.
THEREFORE:
The appeal filed by the Public Prosecutor’s Office in the present case is denied. I.Que mediante sentencia número 309-2019, de las siete horas treinta minutos del treinta de abril de dos mil diecinueve, el Tribunal Penal del Primer Circuito Judicial de la zona Atlántica, Bribri, resolvió: "POR TANTO: De lo expuesto y conformea los artículos 39 y 41 de laConstitución, 1, 2, 6, 9, 142, 265, 267, 360, 364, 365 y 366 del Código Procesal Penal, 1, 45 y 110 del Código Penal, artículos 56 y 63 inciso a) de la Ley Forestal número 7575 se absuelve de toda pena y responsabilidada Nombre01 por un delito de TRANSPORTE ILEGAL DE PRODUCTO FORESTALES en perjuicio de LA LEY FORESTALY LOS RECURSOS FORESTALES. Se resuelve sin especial condenatoria en costas, estas son a cargo del Estado. SOBRE EL COMISO: Sí la madera decomisada en ésta causa no fue rematada, información que es corroborable en autos, se ordena que sea devuelta a quien ostente ser su proipietario y así lo demuestre con la documentación respectiva, en este mismo sentido se ordena la devolución de: dos motosierras una marca STHIL 660 con serie 174203878 y una motosierra serie con un marco de aluminio.
Para lo anterior se otorga el término de 30 días hábiles para su reclamo, de lo contrario transcurrido dicho plazo sin interés de parte se ordena el Comiso a favor del Estado. Se hace constar que lo anterior es una minuta de la Sentencia Oral Integral dictada en este proceso, y que la totalidad de la audiencia y todas sus incidencias fueron grabadas en formato digital, registro electrónico al que las partes podrán tener acceso en caso de requerirlo. III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.
Redacta el juez de apelación de sentencia penal Badilla Rojas; y,
CONSIDERANDO:
Único.- El Lic. Marlon Poyser Watson, en su condición de representante del Ministerio Público, ha promovido recurso de apelación en contra de la sentencia No. 309-2019 dictada por el Tribunal de Juicio de Primer Circuito Judicial de la Zona Atlántica, sede Talamanca de las 07:30 horas del 30 de abril de 2019. PRIMER MOTIVO: VIOLACIÓN AL PRINCIPIO DE VALORACIÓN DE LA PRUEBA. artículos 181, 227, 228 del Código Procesal Penal. Explica que en la presente causa la juzgadora se equivoca en la valoración probatoria, incluso refiere que la causa no debió llegar a esa instancia, por carecer de tipicidad la acción acusada. Lo anterior a pesar de que la fiscalía planteó su caso con respaldo en lo dispuesto en el artículo 61 de la Ley Forestal, en el tanto se detuvo al acusado transportando producto forestal sin contar con el permiso respectivo. Siendo que el acusado fue detenido transportando 48 piezas de madera de la especie fruta dorada, al ser cuestionado sobre la documentación necesaria ya sea la guía de transporte o la factura respectiva no la portaba.
Por lo que a criterio de la fiscalía se cumplió con con los elementos objetivos y subjetivos del tipo penal aludido, en especial porque se contó la declaración del oficial Nombre05, quien explicó los detalles de la detención y decomiso de la evidencia, lo anterior fue reforzado por las declaraciones de los testigos Nombre06 y Nombre07, quienes aclararon sobre el tema, el primero acerca del decomiso y, el segundo sobre la inspección de los bienes decomisado como encargado del Minaet. Para la fiscalía la jueza hace una incorrecta valoración de la prueba, en el tanto la misma de manera integral permitía determinar los elementos objetivos y subjetivos del tipo acusado, por cuanto incluso se ubicó dentro del camión dos motosierras con residuos de madera, lo que evidencia que el producto forestal había sido recién aserrado para transformarlo en materia prima, todo ello debió llevar a una sentencia condenatoria y no al final resultó y que objeta en este recurso.
El reclamo no es atendible: Esta Cámara de Apelación de Sentencia Penal ha revisado la sentencia de manera integral, conforme lo dispone el numeral 459 del Código Procesal Penal, sin que se encuentren las falencias que apunta el recurrente. Lo anterior porque el planteamiento que hace el Ministerio Público es confuso, en tanto el hecho que se le acusó al encartado Nombre01, fue ser detenido transportando 48 piezas de la especie fruta dorada, esa acción de transportar producto forestal, no se encuentra descrito en el artículo 61 de la Ley Forestal (Ley 7575), en dicho numeral 61, en su inciso a) menciona del aprovechamiento de uno o varios recursos forestales, en propiedad privada, sin el permiso de la Administración Forestal del Estado, o aunque cuente con el permiso no se ajuste a lo autorizado. Este inciso del aprovechamiento, no puede ajustarse a la acción del acusado, por cuanto no se puede interpretar de manera aislada como aprovechamiento, sino que se debe determinar el origen del producto forestal, específicamente si es de una propiedad privada, en este caso particular, la prueba de cargo que refiere el Ministerio público permitió establecer la detención y el decomiso del producto, más no el origen, por ello la prueba de cargo en cuanto a este aspecto se queda corta.
En cuanto al inciso b del mismo artículo 61, se contempla las acciones típicas de adquirir o procesar el producto forestal, en este punto no se puede perder de vista que la prueba de cargo determina que el encartado Nombre01 fue detenido transportando, no adquiriendo o procesando. Ahora bien, en cuanto al inciso c de la misma norma hace referencia a un cambio en el si de la tierra, en este caso no se pudo determinar actividad alguna con la tierra en que se estaba generando el producto forestal. porque no olvidemos que el acusado es detenido en vía pública. Un análisis similar realiza el tribunal unipersonal en su sentencia cuando inicia su fundamentación a partir de la secuencia horaria 00:27:30, haciendo primero un análisis de tipicidad del hecho, si este análisis obtiene como resultado una absoluta adecuación o subsución del hecho en el precepto normativo entonces se puede continuar, pero ese resultado no se obtuvo, explicando de manera diáfana lo que motiva valoración y decisión jurisdiccional, esa fundamentación no solo es acorde con el hecho acusado, sino que también es ajustada al resultado de la prueba de cargo y descargo recibida en el sumario, por lo que se cumple con los presupuestos de fundamentación del numeral 142 y valoración de la prueba de los artículos 180 a 184 del Código Procesal Penal.
Si quiere destacar este tribunal que la Fiscalía plantea su reclamo solo considerando la prueba de cargo, pero la juzgadora integra también la prueba de descargo, que presenta un panorama más amplio de como entender el contexto en que se desarrolla el hecho, por ello es que ese análisis es adecuado a derecho y debe ser declarado sin lugar el presente motivo de apelación. SEGUNDO MOTIVO: ERRÓNEA VALORACIÓN DE LA PRUEBA A LA LUZ DE LAS REGLAS DE LA SANA CRÍTICA. Explica que la jueza fue inducida a error por el ardid de la defensa en presentar como prueba documental una factura en la que se determina un aserradero como vendedor y el acusado como adquirente de madera, pero eso en nada elimina que el imputado fue sorprendido transportando producto forestal sin permis,. siendo equívoco darle credibilidad a ese documento. Destaca que el tribunal no analiza a fondo el origen y contexto dentro del cual se genera ese documento, el porqué fue ofrecido después de los hechos, y como no contiene la firma del vendedor, para la fiscalía no cumple con los requisitos legales para ser considerado como una factura legal, al menos a nivel de administración tributaria y por ello es un error brindarle a este documento total credibilidad como lo hizo el tribunal en la presente causa.
El reclamo no puede prosperar: Esta Cámara de Apelación de sentencia Penal, no puede compartir el criterio del señor fiscal, en el tanto se califica la posición defensiva como "ardid", es un calificativo que se respeta pero no es posible replicarlo, en el tanto la defensa también tiene una posición respecto a la valoración probatoria, que en una gran cantidad de casos puede co coincidir con la valoración de la Fiscalía, pero no por eso se le puede llamar ardid, sino que es una tesis defensiva, que merece el mismo análisis que los demás operadores del derecho que intervienen en el proceso penal. Por otra parte la factura no es el único elemento que apoya la propuesta de la defensa, sino que también se contó con varias declaraciones, dentro de ellas la de don Nombre08, propietario del aserradero, quien explicó que su cliente Nombre09 le contrató la compra de las 48 piezas de Fruta Dorada y le dijo que había coordinado con Nombre02 para que las recogiera y se las hiciera llegar.
También se contó con la declaración del propio Nombre09, quien ratificó que fue quien compró las piezas de formaleta y le encargó a Nombre02 que se las recogiera en el aserradero de don Nombre08, ahora, estas versiones si se valoran de manera conjunta con el documento que cuestiona la Fiscalía de inválido, le da cierta credibilidad, especialmente porque no hay un elemento que permita dudar de la veracidad de lo indicado en el documento, siendo que a partir de la secuencia horaria 00:38:27 se hacen comentarios sobre la factura y su validez, destacando dos cosas la señora juzgadora, primero que el Ministerio Público no realizó ningún esfuerzo a nivel criminalísticos forense para desacreditar ese documento, o establecer con respaldo en un criterio técnico su falsedad, un segundo aspecto es que no se puede cuestionar su legalidad tributaria, en el tanto la información que contiene, no permite establecer que sea un engaño, es más la juzgadora se preocupa por resaltar que el documento indica al pie de la misma "acogido al régimen simplificado", eso explica el porqué es una de las factura que no es timbrada, por lo menos y aun cuando no tenga firmas, deja evidente la existencia de una transacción sobre madera, ese sería suficiente para autorizar el transporte, aun cuando no fue al momento de ser detenido el encartado Nombre01, por ello se estima que la valoración realizada por la juzgadora al menos si es integral y se ajusta a los presupuestos que sobre la valoración probatoria indican los numerales 180 a 184 del Código Procesal Penal, por lo que se debe declarar sin lugar el presente motivo de apelación planteado.
TERCER MOTIVO: ERRÓNEA FUNDAMENTACIÓN INTELECTIVA: . Explica que el tribunal menciona en su sentencia que la acción típica no es perseguible porque no se cuenta con el certificado de origen, situación que no comparte el recurrente. En realidad la determinación del lugar de la corta es importante para el delito de tala ilegal, por cuanto está exenta de dicho delito las plantaciones forestales o agroforestales, siempre que no sea zona de protección. Queda claro que para el transporte no es necesario determinar el origen, sino contar con la documentación necesaria, la guía de transporte, que en el presente caso el imputado no portaba, por lo que se solicita la nulidad de la sentencia y el respectivo reenvío con otra integración del tribunal. El reclamo es improcedente. A lo largo de este recurso se ha podido notar que el Ministerio Público no ha orientado bien el proceso, por cuanto en el primero motivo se defiende que los hechos acusados deben encuadrarse dentro de la acción descrita en el artículo 61 de la ley 7575.
Luego retoma el tema del transporte de madera, ahora en este tercer motivo refiere la idea de que se está ante una tala ilegal, se lanzan diferentes verbos contenidos a lo largo de la Ley Forestal, dejando de lado que el hecho que se investiga en contra de Nombre01 es muy básico, haber sido detenido conduciendo un camión pequeño, de cajón cerrado en el que transportaba 48 piezas aserradas de la especie fruta dorada, que al ser requerido sobre la documentación necesaria, no la portaba en ese momento pero la aportó con posterioridad y antes de que fuera formulada la pieza acusatoria. La juzgadora desde un inicio de la fundamentación, tal y como se refirió en el primero motivo de este recurso, no puede calificarse como ninguna de las actividades o acciones referidas en el artículo 61 de la referida ley. Por el contrario parece ajustarse más al inciso a) del artículo 63 en el que se refiere que se castiga las conductas previstas en el artículo 56 de la misma ley.
El artículo 56 en mención textualmente indica: "Artículo 56 Movilización de Madera. No se podrá movilizar madera en trozas, escuadrada ni aserrada, proveniente de bosque o de plantación, si no se cuenta con la documentación respectiva". Es claro que el transporte que realizaba el acusado es una forma de movilización de madera, pero la norma transcrita requiere la documentación solo en dos caos cuando provenga de bosque o de plantación, esto es lo que la jueza cuestiona como el certificado de origen, porque es necesario determinar si el origen de la madera se encuentra dentro de esta categoría, bosque o plantación, para cuestionar la documentación necesaria. En el presente asunto los oficiales actuantes detienen al acusado y como no la porta se le decomisa y se procede luego a la inspección respectiva por parte del funcionario del MINAET, inspección que determina la especie y posible valor y cantidad de la madera, pero no se hizo indagación alguna sobre el origen de la misma, este detalle es importante porque es parte del tipo penal que interesa y que incluye la movilización, ya que no toda movilización es sancionada, es ante la imposibilidad de determinar ese origen que tiene lógica la determinación de atipicidad de la conducta que la jueza concluye.
Por ello esta conclusión es adecuada a derecho y al mérito de los autos, debe entonces ser declarado sin lugar este motivo de apelación. CUARTO MOTIVO: FALTA DE FUNDAMENTACIÓN DEL BIEN JURÍDICO TUTELADO. Explica que el tribunal no realizó un adecuado análisis del bien jurídico tutelado en la presente causa, tomando en cuenta la importancia que representa para el cantón de Talamanca y el perjuicio que el daño recurso forestal causa a nivel ambiental, social y económico. Por ello solicita la nulidad de la sentencia y que se ordene el respectivo reenvío ante una diversa integración del tribunal. Solicita se admita el recurso planteado, que el mismo se declare con lugar en todos sus extremos, se ordena el juicio de reenvío para que un tribunal resuelva con diversa integración (ver recurso de folios 8 a 12). El reclamo no es procedente. Como se ha establecido en los motivos Primero y Tercero de este recursos, la juzgadora fundamentó de manera correcta como la acción atribuída al acusado Nombre01, no cumple con las condiciones de tipicidad necesaria para encuadrar esta figura dentro del tipo penal que se ha propuesto.
El examen de la tipicidad, en este caso no alcanzó siquiera la adecuación de los elementos objetivos del tipo, entonces se hace absolutamente innecesario hacer una fundamentación del bien jurídico tutelado, en el tanto dicha figura se ubica dentro de la teoría del delito, en el plano de la antijuridicidad, específicamente en la antijuridicidad material, sin embargo, la teoría del delito presenta un análisis progresivo, en el que se hace necesario agotar o cumplir primero con una etapa para luego pasar a la segunda, en este caso como se dijo supra, no se logró completar de manera satisfactoria el análisis del primer estadio o etapa que es la tipicidad, esto impide o hace que sea innecesario hacer un estudio de las posteriores por que sería un ejercicio incompleto. Por lo indicado no es procedente el cuestionamiento hecho por el recurrente y debe ser declarado sin lugar el motivo de apelación planteado
POR TANTO:
Se declara sin lugar el recurso de apelación planteado por el Ministerio Público en la presente causa.
