That a certified enforceable copy of the judgment be issued so that the plan may be canceled before Catastro* Nacional," (See Escritorio Virtual del Juzgado Agrario de San Carlos, under Bandeja de Escritos, file dated 20/06/13 at 8:12:51 a.m.).-* *4.- The counterclaim defendants Plantaciones de Naranja del Norte S.A. and Cítricos de la Zona Norte CZN S.A., having been duly served, denied the claim filed against them by defendants [Nombre2] and [Nombre3] and raised no defenses (See Escritorio Virtual del Juzgado Agrario de San Carlos, in Bandeja de Escritos, file dated 30/10/13 at 7:25:26 a.m.).-* *5.- Counterclaim defendants [Nombre6] and [Nombre4] denied the counterclaim filed against them by defendants [Nombre2] and [Nombre3] and raised no defenses (See Escritorio Virtual del Juzgado Agrario de San Carlos, at [Dirección8], file dated 18/03/14 at 1:34:04 p.m.).-* *6.- Licenciado Alejandro Li Ruiz, Judge of the Juzgado Agrario del Segundo Circuito Judicial de Alajuela, in judgment Nº 176-2018 rendered at seventeen hours and twelve minutes on trece de diciembre del año dos mil dieciocho, ruled: “POR TANTO: With respect to the examination of [Nombre6] as a party (confesional), question 2 is partially admitted and he is deemed to have partially confessed as to that question; questions 1, 3, 4, 5, 6, 7, 8, and 9 are rejected. Based on the foregoing and on the cited legislation and case law, the defenses of lack of standing to sue and be sued (falta de legitimación activa y pasiva) and statute of limitations (prescripción) are rejected; the defense of failure to state a legally cognizable right (falta de derecho) is partially upheld with respect to the claim for the ancillary relief of damages (daños y perjuicios) asserted by defendants [Nombre2] and [Nombre3]; and the present ordinary action brought by PLANTACIONES DE NARANJA DEL NORTE, SOCIEDAD ANONIMA, and CÍTRICOS DE LA ZONA NORTE CNZ, SOCIEDAD ANONIMA, both represented by [Nombre1], against [Nombre2] AND [Nombre3] is hereby declared PARTIALLY GRANTED as to the following, and denied as to any relief not expressly indicated: a) Plantaciones de Naranja del Norte, Sociedad Anónima, and Cítricos de la Zona Norte, Sociedad Anónima, hold a legitimate and exclusive right of possession (derecho de posesión) over the disputed land, which defendants [Nombre2] and [Nombre3] possess unlawfully.- b) Restitution of the disputed area unlawfully possessed by the defendants is ordered. That area measures thirty-five hectares and is located in the southwestern portion of the plaintiffs’ land, comprising an area of forests and wetlands (humedales), adjoining [Dirección2], and bounded as follows: to the Northeast: the remainder of the plaintiffs’ land; Southeast: [Nombre2]; Northwest: the plaintiffs’ land, formerly R & G Teleconsulting RGC, Sociedad Anónima; Southwest: Río Medio Queso.- Pursuant to Articles 26 and 55 of the Ley de Jurisdicción Agraria and Article 222 of the Código Procesal Civil, which applies supplementally in this matter, this case shall be decided without a special award of costs (especial condenatoria en costas). With respect to the counterclaim (reconvención) filed by [Nombre2] and [Nombre3] against PLANTACIONES DE NARANJA DEL NORTE, SOCIEDAD ANONIMA, and CÍTRICOS DE LA ZONA NORTE CNZ, SOCIEDAD ANONIMA, both represented by [Nombre1], and AGAINST [Nombre6] and [Nombre4], the Court, on its own motion, finds a failure to state a legally cognizable right; likewise, the Court, on its own motion, rejects the existence of a lack of standing to sue and be sued and finds a lack of a current legal interest (falta de interés jurídico actual) in pursuing the counterclaim; consequently, the present counterclaim is declared WITHOUT MERIT in all its principal and alternative prayers for relief. Given the manner in which this proceeding is decided and pursuant to Articles 26 and 55 of the Ley de Jurisdicción Agraria and Article 222 of the Código Procesal Civil, which applies supplementally in this matter, this case shall be decided without a special award of costs. The soil study conducted by the Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA), appearing at image 890 of the electronic case file, certifies that the property contains a forty-hectare sector designated as the Río Medio Queso wetlands, which “are maintained as a natural reserve because, by law, they may neither be drained nor exploited.” This is consistent with the record of the judicial inspection (reconocimiento judicial) conducted at ten hours on 16 de febrero del 2010 (image 685), which noted the existence of an area of wetlands and swamps with water and mud up to one meter deep; it is also consistent with the sketch appearing at image 684. Judgment 63-2010, issued in the summary possessory proceeding (proceso interdictal) between the same parties by the court of origin at 07:03 hours on 08 de junio del 2010, deemed proven the wetland nature of the property, its boundary with Río Medio Queso, and its status as a wetland, and ordered that notice be given “to the corresponding authorities so that the wetlands in these areas may be placed at the disposal of the State” (image 658). Contrary to what was held in Voto No. 670-F-12 by a differently constituted panel of this Court, this area is indeed State Agricultural Property (Propiedad Agrícola del Estado), first because it is unregistered land and, second, because it falls within Article 7(h) of the Ley de Tierras y Colonización, which provides: “Artículo 7.- (...) the following shall be deemed inalienable and not subject to acquisition by prescription (inalenables e imprescriptibles): (...) h) Land that becomes inundated during the rainy season or as a result of rivers overflowing and that retains water during the summer which can be used as a watering place, when such land constitutes the only local water resource that can be used as a watering place for the livestock of local residents.” The Sala Constitucional has stated as follows: “In this regard, an important clarification should be made: Although not all wetlands form part of the State Natural Heritage (patrimonio natural del Estado, PNE), but only those located on public-domain property—because wetlands may exist on private property—all wetlands are of public interest and are subject to a special legal protection regime. Thus, regardless of their location (on public- or private-domain property), wetlands are of public interest. It is therefore clear that the only wetlands considered part of the State Natural Heritage are those located on public-domain property, irrespective of whether they have been designated as protected wilderness areas (áreas silvestres protegidas). In other words, even if they have not been designated as protected wilderness areas, wetlands located on public-domain property are part of the State Natural Heritage, subject to the exception noted below. See what this Chamber held in judgment number 2011-016938 at 14:37 hours on 07 de diciembre del 2011 (Sala Constitucional composed of Magistrates Armijo, Mora, Cruz, Rueda, Pacheco, Araya, and Ulate), when it clearly stated that wetlands located on State-owned properties form part of the State Natural Heritage even if they have not been designated as protected wilderness areas: ‘… the first point that must be made is that the petitioner is incorrect in asserting that there are mangroves or wetlands that do not form part of the State Natural Heritage. More specifically, it is clear from the statutory considerations cited by the parties, including the petitioner, that all wetlands located on State-owned properties (belonging to any State entity, authority, or agency) form part of that heritage (…) —first— it is not true that the only wetland ecosystems forming part of that public heritage are those that have been designated as protected wilderness areas (…) VI.- CONCLUSION. The State Natural Heritage is a legally protected interest, defined and individualized in our legal system, and the lands comprising it under environmental legislation do not require designation as a protected wilderness area in order to receive protection from the Administration …’ Sala Constitucional Voto No.3855-2016 at 16:10 hours on 15 de marzo del 2016. Emphasis not in the original). In the case under review, the relief sought in the complaint is a determination of a superior right over land that constitutes public-domain property (bien demanial) under the legislation set forth above. Accordingly, the foregoing demonstrates that the land in question has the characteristics of public-domain status (demanialidad), in which the State plainly has an interest; and, given the request made by the counterclaimants for a declaration that the land has been acquired by positive prescription (prescripción positiva), it follows that the Contentious-Administrative Jurisdiction (Jurisdicción Contencioso Administrativa) is responsible for protecting public interests, particularly public assets. Consequently, this matter falls within the jurisdiction of the Tribunal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José, as consistently held by the Sala Primera de la Corte Suprema de Justicia in Voto No. 989-C-2017 at 11:45 hours on 17 de agosto del 2017. También participa como abogado director de los demandados [Nombre2] y [Nombre3] el letrado* Ronald Córdoba Artavia, mayor, divorciado,* abogado, cédula de identidad número CED11 - - .* Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Alajuela, con sede en San Carlos.-* R E S U L T A N D O:* * 1.- Las* sociedades actoras, Plantaciones de Naranja del Norte* S.A., y Cítricos de la* Zona Norte CZN S.A., plantearon demanda ordinaria, estimada en la suma de diez millones de colones para que en sentencia se declare: "* 1).- Que a Plantaciones de Naranja y* Cítricos de la Zona Norte CZN, Sociedad les asiste derecho de posesión legítimo y exclusivo* sobre el terreno en conflicto, respecto del cual los demandados, señores [Nombre2] * y [Nombre3] , ejercen posesión ilegitima. 2).- En consecuencia, se ordene la* restitución de dicha parcela poseída ilegítimamente por los demandados, cuya medida es de* treinta y cinco hectáreas, ubicada en la parte suroeste dentro de los terrenos de las actoras,* configurando un área de bosques y humedales, colindante con el [Dirección1] Medio Queso, lindante* Noreste: Resto de Terreno de la parte actora, Sureste: [Nombre2] , Noroeste: parte* actora, anteriormente* RAG Teleconsulting RGC, Sociedad Anónima, Suroeste: Río Medio* Queso.- 3.- Se condene a los demandados al pago de los Daños y Perjuicios, los cuales* consisten en la imposibilidad de tramitar la respectiva información posesoria, desde que los* demandados levantaron subrepticiamente, en el mes de de marzo de 2009, la cerca dentro de la* propiedad de las actoras, la cual suscitó el presente conflicto.

Dichos perjuicios, los cuales han* impedido operar financieramente con el respaldo del inmueble, se estiman en la suma de veinte* mil dólares. 4.- Se condene a los demandados al pago de ambas costas.- En cuanto al cobro de* Daños y Perjuicios: Tocante a Daños, éstos consisten en el terreno del cual está siendo privado* la parte actora, lo que se origina en el despojo por medio de la invasión de que ha sido objeto,* cuyo valor se estima en la suma de diez mil dólares.- En cuanto a perjuicios, éstos consisten en* haberle impedido a mis representadas tramitar la respectiva información posesoria y* consiguientemente operar financieramente con el respaldo del inmueble, ello se origina* subreticiamente (sic) en el mes de marzo de 2009, y se estima en la suma de diez mil dólares," (Ver Escritorio Virtual del Juzgado Agrario de San Carlos, en Documentos Asociados, archivo del 19/03/13 de las 2:32:05 p.m., imágenes de la 3 a la 11, folios 1 al 9 y ver archivo del 19/03/13 de las 2:33:33 p.m., imagen 40, folio 101).-* * 2.- Los demandados reconventores contestaron negativamente la demanda incoada en su contra, oponiendo las excepciones de falta de derecho y falta de legitimación activa y pasiva y la de prescripción positiva,* (Ver Escritorio Virtual del Juzgado Agrario de San Carlos, en Bandeja de Escritos, archivo del 20/06/13 de las 8:12:48 a.m.).-* * 3.- Asimismo los demandados* [Nombre2] y [Nombre3] * entablaron a su vez contrademanda en contra de: Plantaciones de Naranja del* Norte S.A., Cítricos de la Zona Norte C Z N* S.A.,* ambas representadas por [Nombre1] ; [Nombre4] ,* y en contra de [Nombre6] ,* a fin de que este despacho judicial declare: "*

  • 1)Que desde hace diez años los* contrademandantes [Nombre3] y [Nombre2] poseemos como dueños, en forma* pública, ininterrumpida, de buena fe, un terreno sin inscribir situado en El Cachito de Los Chiles,* Alajuela. Este fundo lo dedicamos a la actividad ganadera sostenible, con nuestra marca de* ganado JT2 se identifican debidamente los semovientes. Esta propiedad mide aproximadamente* treinta y cinco hectáreas, es de naturaleza de pastos, palmeras y tacotal, conocida en algunas* partes como “llanos”. Los linderos son: Al Norte: La Sociedad demandada Plantaciones de* Naranja del Norte S.A., al Sur: Riveras del Río Medio Queso, al Este, con terrenos de los* suscritos, al Oeste, con [Nombre7] .-
  • 2)Que en forma ilegítima las* sociedades demandadas pretenden apoderarse de dicho inmueble, mediante actos perturbatorios* y de despojos que se dieron a inicios del mes de abril del año 2009, y actualmente aducen en* forma equivocada que les pertenece.*
  • 3)Que las sociedades reconvenidas no les asiste derecho* alguno, ni de posesión, ni de uso, ni de propiedad, ni del dominio, en el terreno antes dicho.- 4)* Se declare nula la escritura pública número 41-6 otorgada ante el Notario Edgar Quirós* Cavallini, el 24 de febrero del año 2009, en la cual se estipula que el señor [Nombre6] vende a Plantaciones de Naranja del Norte S.A., un terreno de pastos y humedal,* descrito en el plano catastrado A-1314026-2009; con linderos, al Norte, R y G Teleconsulting y* servidumbre, al Sur, con el [Dirección2] , al Este y al Oeste, con Plantaciones de Naranja del* Norte S.A.- 5)* Se declare la nulidad del plano catastrado número A-13140206-2009, por* abarcar el terreno de treinta y cinco hectáreas de nuestra propiedad descrito en el hecho primero* de esta contrademanda. Se extienda ejecutoria a fin que se realice la cancelación del mismo ante* Catastro Nacional. 6)* Se declare la nulidad de la escritura pública número 37-6 otorgada ante* el Notario Edgar Quirós Cavallini, a las diez horas cuarenta y cinco minutos del 24 de febrero del* año 2009, en la cual se estipula que el señor [Nombre4] vende a Plantaciones de* Naranja del Norte S.A., un terreno de cítricos y pastos, descrito en el plano catastrado A-* 1318470-2009; con linderos al Nororeste R y G Teleconsulting S.A., al Suroeste con [Dirección3] , al Noreste con [Nombre8] , al Sureste con [Nombre2] y [Nombre8] , servidumbre.-* 7)* Se declare la nulidad del plano* catastrado número A-1318470-2009, por abarcar el terreno de treinta y cinco hectáreas de* nuestra propiedad descrito en el hecho primero de esta contrademanda. Se extienda ejecutoria a* fin que se realice la cancelación del mismo ante Catastro Nacional.- 8)* Que por haber poseído* los reconventores el terreno antes citado, como dueños originarios en partes iguales, en forma* pública, pacífica, ininterrumpida, de buena fe, adquirimos el derecho de propiedad por* prescripción positiva sobre esta finca descrita en el apartado 1 de la presente petitoria.- 9) Que* en ese sentido nos asiste a los contrademandantes derecho a obtener título inscribible sobre esa* finca.- En forma SUBSIDIARIA,* solicitan* se declare:* 1).-* Que desde hace diez años los* contrademandantes [Nombre3] y [Nombre2] poseemos como dueños, en forma* pública, pacífica, ininterrumpida de buena fe, un terreno sin inscribir situado en El Cachito de* Los Chiles, Alajuela. Este fundo lo dedicamos a la actividad ganadera sostenible, con nuestra* marca de ganado se identifican debidamente los semovientes. Esta propiedad mide* aproximadamente treinta y cinco hectáreas, de naturaleza de pastos, palmeras y tacotal, conocida* en algunas* partes como “Llanos”. Los linderos son al Norte: la sociedad demandada* Plantaciones de Naranja del Norte S.A., al Sur, [Dirección4] , al Este, con* terrenos de los suscritos, al Oeste, con [Nombre7] .-
  • 2)Que en forma* ilegítima las sociedades demandadas pretenden apoderarse de dicho inmueble, mediante actos* perturbatorios y de despojo que se dieron a inicios del mes de abril del año 2009, y actualmente* aducen en forma equivocada que les pertenece.
  • 3)Que a las sociedades reconvenidas no les* asiste derecho alguno, ni de posesión, ni de uso, ni de propiedad, ni del dominio, en el terreno* antes dicho.-
  • 4)Que nos asiste a los reconventores mejor derecho de posesión en el terreno* antes citado.- 5)* Que en ese sentido, nos asiste a los contrademandantes derecho a obtener* título inscribible sobre esa finca.- 6)* Se declare nula la escritura pública número 41-6 otorgada* ante el Notario Edgar Quirós Cavallini el 24 de febrero del año 2009, en la cual se estipula que el* señor [Nombre6] vende a Plantaciones de Naranja del Nore S.A. un terreno* de pastos y humedal, descrito en el plano catastrado A-1314026-2009; con linderos al Norte R y* G Teleconsulting y servidumbre, al Sur, con el [Dirección2] , al Este y al Oeste con* Plantaciones de Naranja del Norte S.A.. Ello por abarcar el terreno de nuestra propiedad y por* tratarse de una venta ajena, negocio simulado.- 7)* Se declare la nulidad del plano catastrado* número A-13140206-2009, por abarcar el terreno de treinta y cinco hectáreas de nuestra propiedad* descrito en el hecho primero de esta contrademanda. Ello por incluir área de nuestra propiedad,* violatorio de nuestro derecho. Se extienda ejecutoria a fin que se realice la cancelación del* mismo ante Catastro Nacional. 8)* Se declare la nulidad de la escritura pública número 37-6* otorgada ante el Notario Edgar Quirós Cavallini a las diez horas cuarenta y cinco minutos del 24* de febrero del año 2009, en la cual se estipula que el señor [Nombre4] vende a* Plantaciones de Naranja del Norte S.A., un terreno de cítricos y pastos, descrito en el plano* catastrado A1318470-2009; con linderos al Noroeste, R y G Teleconsulting S. A., al [Dirección5],* [Dirección6] , al [Dirección7], con [Nombre8] ,* servidumbre. Ello por abarcar el terreno de nuestra propiedad, y por tratarse de una venta ajena,* negocio simulado.- 9)* Se declare la nulidad del plano catastrado número A-1318470-2009, por* abarcar el terreno de treinta y cinco hectáreas de nuestra propiedad descrita en el hecho primero* de esta contrademanda. Ello por incluir área de nuestra propiedad, y violatorio de nuestro* derecho. Se extienda ejecutoria a fin que se realice la cancelación del mismo ante Catastro* Nacional," (Ver Escritorio Virtual del Juzgado Agrario de San Carlos, en Bandeja de Escritos, archivo del 20/06/13 de las 8:12:51 a.m.).-* * 4.- Las sociedades reconvenidas Plantaciones de Naranja del Norte S.A. y Cítricos de la Zona Norte CZN S.A., debidamente notificados contestaron de forma negativa la demanda* establecida en su contra por los demandados [Nombre2] y [Nombre3] y no* opusieron excepciones, (Ver Escritorio Virtual del Juzgado Agrario de San Carlos, en Bandeja de Escritos, archivo del 30/10/13 de las 7:25:26 a.m.).-* * 5.- Los reconvenidos [Nombre6] , y [Nombre4] , contestaron de forma negativa la contrademanda establecida en su contra por los demandados [Nombre2] y [Nombre3] y no opusieron excepciones, (Ver Escritorio Virtual del Juzgado Agrario de San Carlos, en [Dirección8] , archivo del 18/03/14 de las 1:34:04 p.m.).-* * 6.- El* licenciado* Alejandro Li Ruiz, Juez del Juzgado* Agrario del Segundo Circuito Judicial de Alajuela, en sentencia Nº 176-2018 de las diecisiete horas y doce minutos del trece de diciembre del año dos mil dieciocho,* resolvió: “POR TANTO:* En relación con la confesional de [Nombre6] , se admite parcialmente la* pregunta 2 y se tiene parcialmente por confeso en dicha pregunta, se rechazan las preguntas 1, 3,* 4, 5, 6, 7, 8, y 9. Con fundamento en lo expuesto, normativa y jurisprudencia de cita, se rechazan* las excepciones de falta de legitimación activa y pasiva, y prescripción, se acoge parcialmente la* excepción de falta de derecho en cuanto al cobro de las pretensiones accesorias de daños y* perjuicios, interpuestas por los demandados [Nombre2] y [Nombre3] y se* declara PARCIALMENTE CON LUGAR la presente demanda ordinaria establecida por* PLANTACIONES DE NARANJA DEL NORTE, SOCIEDAD ANONIMA, y CÍTRICOS* DE LA ZONA NORTE CNZ, SOCIEDAD ANONIMA, ambas representadas por [Nombre1] , en contra de [Nombre2] Y [Nombre3] en los siguientes extremos, negándola en lo que en forma expresa no se indique: a)* Que a Plantaciones de Naranja del Norte, Sociedad Anónima, y a Cítricos de la Zona Norte,* Sociedad Anónima, les asiste derecho de posesión legítimo y exclusivo sobre el terreno en* conflicto, respecto del cual los demandados, señores [Nombre2] y [Nombre3] , ejercen posesión ilegítima.- b) Se ordena la restitución del área en conflicto poseída* ilegítimamente por los demandados, cuya medida es de treinta y cinco hectáreas, ubicada en la* parte Suroeste dentro de los terrenos de las actoras, configurando un área de bosques y* humedales, colindante con el [Dirección2] , lindante al Noreste: Resto de terreno de la* parte actora; Sureste: [Nombre2] ; Noroeste: Parte actora, anteriormente R & G* Teleconsulting RGC, Sociedad Anónima; Suroeste: Río Medio Queso.- De conformidad con los* artículos 26 y 55 de la Ley de Jurisdicción Agraria y 222 del Código Procesal Civil de aplicación* supletoria en esta materia, deberá de resolverse el presente asunto sin especial condenatoria en* costas. Con respecto a la Reconvención establecida por el señor [Nombre2] , y [Nombre3] , en contra de PLANTACIONES DE* NARANJA DEL NORTE, SOCIEDAD ANONIMA, y CÍTRICOS DE LA ZONA NORTE* CNZ, SOCIEDAD ANONIMA, ambas representadas por [Nombre1] , y en* CONTRA DE [Nombre6] , y [Nombre4] , de oficio se declara una falta de derecho, de igual forma se rechaza de oficio la* existencia de una falta de legitimación activa y pasiva, y se declara una falta de interés jurídico* actual, en el ejercicio de la reconvención promovida; en consecuencia, se declara SIN LUGAR* todos sus extremos petitorios, principales y subsidiarias, la presente contrademanda. Por la forma* en que se resuelve este proceso y de conformidad con los artículos 26 y 55 de la Ley de* Jurisdicción Agraria y 222 del Código Procesal Civil de aplicación supletoria en esta materia,* deberá de resolverse el presente asunto sin especial condenatoria en costas. Se les hace saber a* los intervinientes que esta resolución es impugnable, por lo que si alguna de las partes va a* presentar recurso de apelación contra la misma, favor remitir además, el recurso de apelación* por formato electrónico a la dirección [...] Ello por motivo de la* inserción de la oralidad en materia agraria. Además si es el deseo de la parte que el Tribunal de* alzada les confiera una audiencia oral, deberán de hacerlo saber en el mismo escrito de* apelación. En igual sentido se le recomienda a las partes señalar prioritariamente un correo* electrónico donde recibir notificaciones, ello porque a través de este medio, se les puede enviar* documentos grabados en audio o video (sentencia oral), (Ver Escritorio Virtual del Juzgado Agrario de San Carlos, en Documentos Asociados, archivo del 13/12/18 de las 17:12:15 p.m.).-* * 7.- Los codemandados [Nombre2] y [Nombre3] ,* interpusieron* recurso de apelación con indicación expresa de las razones en que se apoyaron para refutar la tesis del juzgado de instancia, (Ver Escritorio Virtual del Juzgado Agrario de San Carlos, en Bandeja de Escritos, archivos del 20/12/18 de las 10:40:27 a.m.).-* * 8.-* En la substanciación del proceso* se han observado las prescripciones legales, y no se nota la existencia de errores u omisiones capaces de producir la nulidad del fallo.- * Redacta el juez Picado Vargas, y;* CONSIDERANDO* * * * * * * * * * * * * * I.- El presente proceso ordinario tiene una demanda de mejor derecho de posesión con una contrademanda o reconvención de usucapión de un terreno de pastos y humedal con aguas anegadas de setecientos cuarenta y cinco mil quinientos setenta y ocho metros cuadrados ubicado en Los Chiles de Alajuela que colinda al sur con Llanos Nacionales de Río Medio Queso. Del estudio de suelos realizado por el Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA) a imagen 890 del expediente electrónico se certifica que la finca tiene un sector a de cuarenta hectáreas que son humedales del río Medio Queso que "se mantienen en reserva natural pues por ley no se pueden drenar ni explotar". Ello concuerda con lo consignado en el reconocimiento judicial practicado a las diez horas del 16 de febrero del 2010 (imagen 685) donde se inidicó la existencia de una zona de humedales y zuampos con profundidades de hasta de un metro de agua y lodo, lo cual también concuerda con el croquis a imagen 684. En la sentencia 63-2010 dictada en el proceso interdictal entre las mismas partes por el Juzgado d origen a las 07:03 horas del 08 de junio del 2010, se tuvo por probado la naturaleza de humedal de la finca y la colindancia con el Río Medio Queso y la calidad de humedal, ordenándose comunicar "a las autoridades correspondientes para que los humedales de estas zonas sean puestos a la orden del Estado" (imagen 658). Contrario a lo que se estableció en el Voto No. 670-F-12 de este Tribunal pero con otra conformación, esta zona sí es Propiedad Agrícola del Estado, primero, por ser un terreno sin inscribir, y segundo por estar comprendido en el artículo 7 inciso h) de la Ley de Tierras y Colonización, que indica: "Artículo 7.- (...) se considerarán inalenables e imprescriptibles los siguientes: (...) h) Los terrenos que se anegan durante la estación lluviosa o como consecuencia del desbordamiento de los ríos y que conservan agua durante el verano, aprovechable como abrevadero, cuando tales terrenos constituyan el único recurso hídrico del lugar, utilizable como abrevadero para el ganado de los vecinos del lugar". La Sala Constitucional ha indicado lo siguiente: "En este sentido conviene realizar una precisión relevante:* Aunque no todos los humedales forman parte del patrimonio natural del Estado (PNE), sino sólo aquellos que están en bienes de dominio público -pues pueden existir humedales en propiedad privada- todos los humedales son de interés público y están sometidos a un régimen jurídico especial de protección. Así que, independientemente de su ubicación (en bienes de dominio público o privado), los humedales son de interés público. Queda claro entonces que, los únicos humedales que se consideran parte del patrimonio natural del Estado son aquellos que se encuentran en bienes de dominio público, independiente de que hayan sido reconocidos como áreas silvestres protegidas. En otras palabras, pese a no ser declarados como áreas silvestres protegidas, los humedales que están dentro de bienes de dominio público, son parte del patrimonio natural del Estado, con la excepción que se dirá. Véase lo que esta Sala estableció mediante el voto número 2011-016938 de las 14:37 horas del 07 de diciembre del 2011 (Sala Constitucional integrada por los Magistrados Armijo, Mora, Cruz, Rueda, Pacheco, Araya y Ulate), cuando claramente indica que los humedales que se encuentren en propiedades del Estado son parte del Patrimonio Natural del Estado, aunque no hayan sido declarados áreas silvestres protegidas: “… lo primero que debe decirse es que no lleva razón el accionante cuando afirma que hay manglares o humedales que no forman parte del Patrimonio Natural del Estado. Más concretamente, está claro, de acuerdo con los elementos normativos de juicio que citan las partes, incluyendo a la accionante, que todos los humedales que se encuentren en propiedades del Estado (que pertenezcan a cualquier ente, órgano u organismo estatal), forman parte de ese patrimonio (…) -en primer lugar- no es cierto que los ecosistemas de humedales que forman parte de ese patrimonio público, son solo, los que cuentan con una declaratoria de área silvestre protegida (…) VI.- CONCLUSIÓN. El Patrimonio Natural del Estado es un bien jurídico, definido e individualizado en nuestro ordenamiento jurídico, cuyos terrenos que lo conforman según la legislación ambiental, no necesitan de una declaratoria de área silvestre protegida para ser objeto de protección por parte de la Administración …” Sala Constitucional Voto No.3855-2016 de las 16:10 horas del 15 de marzo del 2016. El resaltado no corresponde al original). En el caso de estudio, lo que se pretende en la demanda es la fijación de un mejor derecho respecto de un terreno que está comprendido como bien demanial conforme a la normativa expuesta. En ese sentido, lo anterior permite advertir que se está en presencia de terrenos con características de demanialidad, sobre los que evidentemente existe un interés estatal, y en virtud de la solicitud planteada por la parte reconventora para que se declare la prescripción positiva del terreno; se colige, la Jurisdicción Contencioso Administrativa le corresponde la tutela de los intereses públicos, y en particular el patrimonio público, siendo en consecuencia este asunto de conocimiento del Tribunal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José, tal y como lo ha mantenido la Sala Primera de la Corte Suprema de Justicia en el Voto No. 989-C-2017 de las 11:45 horas del 17 de agosto del 2017.
