Heard before the Agrarian Court of the Second Judicial Circuit of the Southern Zone, sitting in Corredores.-* WHEREAS:* * I.- The plaintiff, [Nombre1],* filed* this ordinary proceeding, valued at fifty million colones, seeking a judgment declaring as follows: “a) That this* ordinary complaint be granted in all respects. b) That the causal link (nexo causal), as narrated in the facts, be deemed proven and that liability therefor be attributed to the* defendant company. c) I request that the defendant company be ordered to* pay damages and losses (daños y perjuicios) as stated, which are calculated* as follows: Damages for lost profits (daño lucro cesante): Once the causal link has been established, the* defendant’s direct liability is determined; the normal yield from one* hectare of Palmar 18 rice is normally 60 dry and clean sacks* weighing 73.6 kilograms, with a value of C 22.604.41, which* was not achieved due to the ineffectiveness of the herbicides supplied by the* defendant and recommended at the dosages specified by the defendant’s technical* representative; the total area treated and affected was 18 hectares,* resulting in a loss of C 196.153.01 per hectare, which for* the entire plantation amounts to C 3.530.754.18 (three million* five hundred thirty thousand seven hundred fifty-four colones and eighteen* céntimos).

Losses:* In addition to the amount corresponding to the lost* profit, as stated above, the losses also* consist of the initial costs of leasing the parcel of land, the* price of the seed that had been set aside for planting, plus the costs* of agricultural services on the plantation for that first crop of 2012; therefore,* the losses claimed amount to a total of C 7.470.000.00* (seven million four hundred seventy thousand colones exactly), as* stated in the sixteenth fact of this complaint. Non-pecuniary* damage (daño moral): This item must be determined by the judge hearing the proceeding, but* account must be taken of the profound sadness experienced by my* principal and how this affected his state of mind and his performance* as a result of losing the plantation that has supported his* family for years; having to attend constant meetings to prevent the* commercial firms from instituting judicial collection proceedings against him; having to resort to private loans* from friends to meet his family’s needs;* being unable to obtain the projected profits; and, furthermore, having to endure* constant calls from employees of the defendant itself* demanding payment of invoices for products that were used on the plantation* but did not work.

Taken together, these circumstances have caused* both psychological and emotional harm to my* principal, because he is not a person accustomed to facing debts,* as has occurred due to the harm caused by using the* defendant’s products. This has resulted in his being almost unable to sleep during recent* months and experiencing constant mood* swings, because at times he feels sad and overwhelmed by the situation,* while at others he is irritable and anxious for most of the day, constantly thinking about* all the financial obligations he must meet. His immediate family* and several of his friends and* coworkers have witnessed this and can testify as to how it* has affected his emotional health and quality of life. We provisionally assess this* non-pecuniary damage at C [...] (fifteen* million colones). Grand total of damages and losses: The foregoing* damages and losses yield a grand total of* C 26.000.754.90 (twenty-six million seven hundred fifty-four colones and ninety céntimos). d) That the defendant* company be ordered to pay interest at the statutory rate, from the dates on which* the invoices for supplies provided by third parties were issued or, alternatively, from the date* the judgment becomes final until payment in full. e) That the* defendant company be ordered to pay both categories of costs (ambas costas) in this proceeding. f) That the* invoices submitted for collection against my* principal by the defendant company, corresponding to the first* harvest of the [Telf1] period, when he suffered the harm as* a consequence of the complete ineffectiveness of the defendant’s products that* were used and caused damage to the plantation, be deemed extinguished,”* (folios 9 to 25).-* * II.-* After being duly served, the defendant company answered this* action in the terms set forth in its brief at folios 65 to 79 and raised the* defenses of lack of legal entitlement (falta de derecho) and lack of standing as defendant (falta de legitimación pasiva).-* * III.-* Judge Carlos Eduardo Rojas Rojas of the* Agrarian Court of the Second Judicial Circuit of the Southern Zone,* by judgment No.* 183-2018,* issued at thirteen hours and fifty-eight minutes on dieciséis de noviembre del año dos mil dieciocho,* ruled: “THEREFORE:* In accordance with the foregoing, Articles 2 subsection h), 6, 26, 54, 55, and 79 of the Ley* de Jurisdicción Agraria, and the other provisions of the statutes, regulations, and case law* cited, the defenses of lack of standing as defendant and lack of* legal entitlement raised by the defendant are rejected.

This* complaint filed by [Nombre1] against Industrias Bioquim* Centroamericana S.A. is partially granted, as set forth below; any relief not* expressly granted shall be deemed denied, and the relevant aspects shall be deemed modified in light of the* matters disputed and the claim upheld. The request for payment of* interest at the statutory rate from the dates on which the invoices for supplies provided by* third parties were issued or, alternatively, from the date the judgment becomes final until payment in full, and the request that* the invoices submitted for collection against the plaintiff by the defendant* company, corresponding to the first harvest of the [Telf1] period (requests for relief* 4 and 6), be deemed extinguished, are rejected because they were not even described* in the statement of facts and because no reliable evidence was submitted in that regard. Specifically, the following relief is granted: 1) The causal* link concerning the facts and the liability attributed to the defendant company is declared* established. 2) Industrias Bioquim Centroamericana S.A. is declared directly liable for the* damages and losses caused to the plaintiff, the former consisting of the loss of the amount* invested to produce the sacks of rice not obtained from the affected harvest* (the value of the production costs): ten million six hundred two thousand two hundred four* colones and seventy céntimos (¢10.602.204,70); non-pecuniary damage: two million colones* (¢2.000.000); and the losses consisting of the profit not obtained from the sacks of rice* that the [Telf1] harvest failed to produce: three million five hundred thirty thousand seven hundred* fifty-four colones and eighteen céntimos (¢3.530.754,18).

The* defendant is ordered to pay the plaintiff, as damages and losses, the total sum of* sixteen million one hundred thirty-two thousand nine hundred fifty-eight colones* and ninety céntimos (¢16.132.958,90), which Industrias Bioquim Centroamericana S.A.* shall ultimately pay within five days,* under warning that enforcement shall be levied against its assets should it* fail to comply. The defendant shall bear the attorney’s fees and court costs (costas personales y procesales) of this matter,”* (See Escritorio Virtual del Juzgado Agrario de Corredores, Bandeja de Escritos, file dated 16/11/18 at 13:58:28 p.m.).-* * IV.- Attorney Georgia Lorena Mont Villacura, special judicial attorney-in-fact for the defendant entity, filed* an appeal (recurso de apelación), expressly stating the grounds relied upon to challenge the trial court’s reasoning,* (See Escritorio Virtual del Juzgado Agrario de Corredores, Bandeja de Escritos, file dated 20/11/18 at 4:26:04 p.m.).-*

V.In the conduct of the proceeding,* the statutory requirements have been observed, and there are no errors or omissions capable of rendering the judgment null and void.-*

Drafted by Judge FISHER GONZÁLEZ; and* CONSIDERING* * I.* The expert evidence (prueba pericial) offered by the appellant as evidence to assist the Court in reaching its decision (para mejor resolver) is rejected because this Court finds that sufficient elements exist to decide the matter and that the parties had sufficient opportunity at first instance to offer all evidence relevant to their interests.* * II. The Court adopts the proven facts set forth in the judgment under appeal because they reflect the evidence contained in the record, except for fact 11), as there is insufficient evidence regarding it.* * III. The first fact deemed unproven is not adopted because it is considered irrelevant to deciding the merits of this matter. The second is not approved in view of the manner in which it is worded and what will be decided at this instance. The third unproven fact is not adopted because it does not concern matters relevant to deciding the claims asserted in the complaint. * * * * * * * * * IV. The defendant filed its appeal based on the following grounds of appeal (agravios): 1)* Through the expert evidence (prueba pericial), testimonial evidence (prueba testimonial), and party testimony (declaración de parte), it was established that there was no causal link (nexo causal) between the conduct of the party I represent and the outcome of the plaintiff’s harvest.*

  • 2)The second fact deemed proven is partially true, because it was not demonstrated that the land* had been properly prepared; however, it was demonstrated that the seed had been retained from the previous harvest. The expert opinion (dictamen pericial) of expert German Barrantes Elizondo demonstrated the following:* -That first-generation certified seed, which is truly certified (seed from the previous harvest is no longer certified seed, free of contaminants or exposure to external agents), has an 80% germination rate and a certification or suitability period of no more than 6 months. -That stored seed loses its qualities and may result in low or no germination.* -In his report, he presents a study from the certified rice seed program of the national seed office, which, insofar as relevant, states: “the use of uncertified seed increases weed-control costs because it contains a high proportion of weeds, which increases control costs and reduces production.”
  • 3)The party I represent has operated successfully throughout the national territory for more than 30 years, not merely since the 2012 harvest; evidence of this is that Eng. Carlos [Nombre3] himself acknowledges that the products of the party I represent are effective and recommends them. Engineer [Nombre3], in his testimony, states that the products had even been recommended to them by COOPEARROSUR.
  • 4)The fourth fact deemed proven is untrue. The party I represent sent [Nombre4] and Engineer [Nombre5] to guide and advise the plaintiff at the farm, offering him the product needed and suitable for his harvest, specifically Diazinon and Bispiribac. The party I represent neither sells nor manufactures Talcor. This demonstrates that a product from another company, recommended by another professional, was used and that the strict recommendations of the party I represent were not followed. The testimony of [Nombre4] and [Nombre6] is transcribed. Both statements indicate that the plaintiff told them that he used the product “Clincher” with “Talcor,” that Engineer Juan Diego Barrantes recommended it, and that [Nombre1] * applied those products rather than what the party I represent had recommended in the manner indicated to him. Engineer [Nombre7] was responsible for advising on the recommended use of the products of the party I represent; however, he could not control: - Whether they were applied correctly. - Whether only those products, and no additional products, were used. The testimony of both [Nombre4] and [Nombre6] demonstrates that the plaintiff used other products based on other recommendations. 5)* It is true that Engineer [Nombre5] [Nombre7] made recommendations; however, as [Nombre4] states, Engineer [Nombre5] reproached [Nombre1] for failing to apply the second dose, meaning that [Nombre1] * did not follow those recommendations. The plaintiff told [Nombre4] that he trusted Eng. Juan Diego Barrantes more and that, in any event, it had not worked, which was why he returned to [Nombre5], while clearly acknowledging that he had not followed [Nombre1]’s recommendations because he was late in applying the specified product. Witness [Nombre4] stated that [Nombre1] told him that he applied “Clincher con Talcot” following [Nombre8]’s instructions.* Witness [Nombre6] explained that delaying the application of the correct and recommended product may affect the result. Part of the testimony is transcribed. Witness [Nombre3] himself recommends the products of the party I represent, states that the products were standard, and that they were effective if properly and timely applied and produced results if properly monitored. Part of the testimony is transcribed.
  • 6)The judgment fails to consider that the plaintiff did not follow [Nombre2] Ordoñez’s recommendations; that is, this is deemed proven despite the existence of testimony to the contrary. The diagnosis clearly indicates that the application failed, meaning that neither the product nor the prescription or recommendation failed, precisely because application does not depend on the technical manager (regente) or the party I represent, but solely on the farmer. In this case, the witness statements agree that the only person responsible for preparing the product for application was the plaintiff himself in these proceedings. Portions of the testimony of witnesses [Nombre3], [Nombre4], [Nombre9], and [Nombre10] are cited.* In other words, the variables identified in Engineer German Barrantes Elizondo’s report could have affected not only the seed but also the product to be applied, through possible environmental contamination and variation in the water’s PH. In their testimony, the operator [Nombre11] and [Nombre9], a farmer, state that the person who handles the product is [Nombre1], that [Nombre10] only applies it with the “bum,” and that [Nombre3] prepares the land; accordingly, he likewise has no direct knowledge that the product was properly prepared for application.
  • 7)It is not a proven fact that the plaintiff followed [Nombre2] [Nombre7]’s recommendations. On the contrary, there is abundant evidence to the contrary, both because no one was present when [Nombre1] prepared the mixtures and because there are slips and recommendations from another engineer. Portions of the testimony of [Nombre3], [Nombre4], [Nombre9], and [Nombre10] are cited.
  • 8)Fact 11) is disputed because no representative of the defendant was present at the referenced meeting at COOPROAROSUR R.L. Mr. Abraham Fonseca is not the company’s legal representative (see the certification filed in the record by the plaintiff),* nor did he send or receive any notice concerning the payment of compensation. The plaintiff submits no evidence in this regard. Although this would appear to have been admitted as true through the examination on confession (confesional), the remaining evidence does not support this assertion. In his complaint, specifically in the fourteenth allegation of fact, the plaintiff himself states that he had been receiving calls from personnel of the party I represent precisely to collect the outstanding invoices, totaling C 4.152.041. This proves that the party I represent never agreed not to collect those invoices. The ruling expressly deems it unproven that “The plaintiff agreed with the defendant that the invoices for the products would not be collected”; conversely, this reaffirms that the party I represent never agreed to compensate the plaintiff or to forgive the debts that he still owes under the invoices identified in the response to this complaint.
  • 9)Regarding the assessment of the evidence from the examination on confession, it cannot constitute conclusive evidence (plena prueba)* merely because it was deemed to have been answered affirmatively when doing so is contrary to common sense, reasoned sound judgment (sana crítica racional), and, moreover, the testimonial, technical, or documentary evidence submitted by the parties in these same proceedings.
  • 10)There is no causal link.* In these proceedings, both the expert and testimonial evidence established that: - If the product of the party I represent had been applied correctly, there should have been no weed problems. (Opinion of Eng. Alexander Mendoza Luna, dated 19 de octubre del 2017, DITT/45-2017, which states in its conclusion: “It bears emphasizing that, to issue a conclusive technical opinion, it is important to know the conditions under which the mixture was prepared (dose used, water ph, cleanliness of the application equipment) and the weather conditions existing at the time of application, because a stress condition could cause different effects on the plant. It is also important to know whether products other than those consulted about were applied.”* The seed used was not certified (it came from the previous harvest, according to the complaint filed). - That the product was prepared by [Nombre1] and that there is no evidence that it was properly prepared. - That the plaintiff did not follow Engineer [Nombre7]’s instructions. - That he applied other products and followed instructions from other professionals employed by other commercial firms.
  • 11)No one can be required to do the impossible.* It is a proven fact that the plaintiff was solely responsible for preparing the product for application. If the party I represent played no active role in preparing and applying the product to his crop, it cannot possibly be responsible for the resulting damage, particularly since it was demonstrated that, in addition to applying other products suggested by other professionals unrelated to the party I represent, the instructions of professional [Nombre5] were not followed.
  • 12)There is no causal link between the sale of the product, the recommendations of our professionals, and the poor outcome of his planting, because the most important determining factor cannot be proven or ascertained—namely, both the suitability of the seed and the manner in which the recommended products were prepared and applied. This is the primary and fundamental stage for proving the damage. Dozens of farmers apply these products, which we sell and whose application we recommend, with excellent results because they follow the suggested instructions, which apparently did not occur in this particular case. It was not demonstrated that the germination outcome and proliferation of weeds in the rice grain planted by the plaintiff resulted from the product proposed by the party I represent or from the application recommendations. Therefore, the party I represent cannot be held responsible for the abandonment of his crop, considering that many other variables were demonstrated here to have contributed to the loss of his harvest and had nothing to do with the party I represent. My request that the judgment be affirmed is supported not only by testimonial evidence but also by the expert evidence, which in its entirety corroborates the facts stated by the party I represent in its response.
  • 13)In view of the foregoing and based on the evidence in the record, the party I represent requests that the judgment be reversed and, in the alternative, requests that, if this appeal is not granted as presented herein, the matter be decided without a special award of costs (especial condenatoria en costas), since the judgment does not grant all the relief sought by the plaintiff. * * V. In summary, in its complaint, the plaintiff alleges that, for the 2012 rice harvest on an 18-hectare farm, the defendant sold it a package of products customarily applied after planting to control weeds, known as the “rice package.” The plaintiff asserts that, despite following the relevant instructions, the products did not work from the first application, causing the weeds to overtake the crop and the crop to be lost. The defendant, in turn, alleges that the probable reasons the products did not work were that the plaintiff did not use certified rice seed, did not apply the products correctly, and also applied a product recommended by a third party without following the defendant’s specifications. As the trial judge reasoned, this particular case involves a claim for damages under a strict-liability regime, as stipulated by the Plant Health Protection Law. Thus, Article 28 of that law provides as follows: “Liability of the technical manager. The technical managers referred to in the preceding article shall be technically responsible for ensuring that chemical, biological, or related substances that are repackaged, relabeled, imported, manufactured, formulated, distributed, mixed, stored, or sold are duly registered and labeled and comply with all provisions of this law and its regulations. The technical manager’s recommendations shall be binding upon the natural or legal person to whom the technical manager provides services. The technical manager shall bear the same liability with respect to application equipment for agricultural use.” Article 31, in turn, provides: “Liability for damages. Those who conduct research, experimentation, movement, release into the environment, importation, exportation, propagation, or commercialization of plants or of the organisms or products referred to in Article 41 shall be liable for the damages they cause to agriculture, the environment, and human and animal health.” Likewise, Article 32 of that body of law provides: “Compensation for damages. Those who import, manufacture, formulate, repackage, relabel, distribute, store, transport, sell, or apply chemical, biological, or related substances for agricultural use shall be required to compensate for the damages that, through their acts or omissions, they cause to agriculture, livestock farming, human health, and the environment.” This is undoubtedly such a liability regime; therefore, the appropriate inquiry is not whether intent or fault existed, but rather whether there was damage and a causal nexus. * * * VI. Upon careful analysis of this matter, it is concluded that the appellant’s grounds of appeal (agravios) are without merit. The central issue in these proceedings concerns the causal link (nexo de causalidad). There is sufficient evidence in the record, assessed on the basis of the principle of free evaluation of evidence (principio de libre valoración probatoria) provided for in Article 54 of the Ley de Jurisdicción Agraria, as well as the principle of unity of evidence (principio de unidad de la prueba), establishing that the reason why the products applied to control weeds in the plaintiff’s rice field did not work is not attributable to him, but rather to the lack of effectiveness of the product itself, which was supplied and recommended by the defendant. From facts 9 and 10 of the complaint (pages 11 and 12 of the physical case file), as well as the form issued by the defendant’s technical professional, No. 408* dated April 24, 2012*, and supplemented on the reverse on May 8 of that same year (page 3), it may be inferred that the defendant, Industrias BioQuim Centroamericana S.A., through its technical supervisor (regente), [Nombre5], supplied and recommended to the plaintiff a series of agricultural inputs, which, according to that form, consisted of the substances known as Talcord (Permethrin/insecticide), Biokil (Glyphosate), Peguno, Butamax, Toro (Pendimethalin), Bispiribac, Cytozyme, and Diazynon. This is abundantly clear; therefore, the defendant’s contention in its appeal (ground 4) that it never recommended or supplied Talcord is without merit. Although the defendant states in its answer that those forms do not have a legally established date (fecha cierta) and that it has no knowledge of when they were issued, the fact remains that, generally, in its answer it admits that it sold products to the plaintiff to control weeds in the rice crop; moreover, the form bears that company’s letterhead, and the hand-printed lettering appearing on it is the same on the front and reverse. Accordingly, this Court finds it established that those were the products recommended, particularly given that, in its answer to the complaint, the defendant submitted commercial brochures for Bioquim (Bispiribac Sodium), Bioquim (Toro), Bioquim (Diazinon), and Biokil (pages 81 to 84 of the physical case file) in support of its arguments. It is clear that the existence of an agricultural contract (contrato agrario) for the sale of agricultural inputs, which also entailed recommendations for their use, is not disputed between the parties, since that contract is governed by rules of public policy (normativa de orden público), namely the Ley de Protección Fitosanitaria. This is so because, pursuant to Article 28 cited above, companies that sell these types of agricultural inputs must also be responsible for stating the technical and agronomic specifications and instructions, as well as the methods to be applied; given the hazardous nature of that activity, they may not limit themselves solely to selling the product. There is ample evidence that the plaintiff, [Nombre1], carried out the applications known as the initial and repeat sealing treatments (“sello” and “resello”) to prevent the weeds from sprouting, with entirely unsuccessful results in controlling them. The expert report (peritaje) in the record indicates that these initial and repeat sealing treatments are applications made very close to, or almost concurrently with, planting to prevent weeds from sprouting, and that a subsequent chemical application may be made if any weeds escape control (pages 116 and 117 of the physical case file). The testimony of witness [Nombre3] is fundamental and is deemed credible by this Court because he has no direct interest in the matter and does not work for either party; furthermore, he is an employee of Corporación Arrocera Nacional (CONARROZ), whose purpose, according to Article 1 of Law No. 8285 of May 30, 2002, is to establish a framework for relations between rice producers and agro-industrial operators to ensure the equitable and rational participation of both in that activity, which entails responsibility for protecting and promoting the rice sector, including agricultural production, agro-industrial processing, local trade, exports, and imports. The witness stated that the plaintiff had grown rice for many years, including in 2012, and that CONARROZ provides technical assistance to all producers. He further stated that the plaintiff applied Bioquim products (the defendant’s products), which he knew because the identification appeared on the prescriptions, and that Coproarrosur had recommended agrochemicals to him. The connection between BIOQUIM and COPROARROSUR is established by reviewing fact 13 of the complaint, which, at least in that respect, was not denied by the defendant and states that the defendant’s products were stored at that Cooperative. Continuing with this witness’s testimony, he stated that an initial sealing treatment and a repeat sealing treatment are performed first, corresponding to the first applications, and that if any weeds subsequently escape control, another application using specific herbicides is made; however, in this case, “the control was entirely unsuccessful with respect to the weeds” and “weeds covered the entire plot, and the crop was lost due to the weed infestation.” He likewise stated that, although he was not present when the products were applied, “he was able to observe that the weeds remained as though nothing had been applied.” He knew all of this because, in the course of his duties, he had known the plaintiff as a rice farmer for nine years and had therefore visited him to verify the planted area. He explained that it is customary to make four to five visits during the production cycle, specifically at planting, fertilization, weed control, panicle irrigation, and harvest. He then explained that the land preparation was suitable for planting, that the germination or vigor of the plants was good, and that the product “Bispiribac” should, in principle, have worked, since it is used for weed control. He added that the defendant, BIOQUIM, uses generic products that, in his opinion, are of poor quality, and stated that “that year, some other producers had the same problem with that product because it apparently had not worked for them” (record of the taking of evidence (acta de recepción de prueba), pages 216 and 217 of the physical case file). This testimony must be considered together with the expert report submitted in the record by Engineer Douglas Sosa Sánchez, who explained that the eighteen hectares on which the plaintiff grows rice possess the soil-geographic and agroclimatological conditions suitable for rice farming and that the crop performs well in terms of adaptation, growth, and production in the area where the land is located, resulting in good phytosanitary and productive conditions for rice cultivation. He also explained that herbicides must be used during the “pre-emergence” and “post-emergence” sealing stages; in this case, Biokil (glyphosate) and Toro (pendimethalin) were used during the former, while Butamax (machete), as well as Bispiribac, which is a post-emergence product, were used during the latter. These are the products prescribed on prescription or form No. 408 on page 3, signed by the defendant’s Engineer [Nombre5]. In this regard, the expert explained that “if the applications were made in accordance with the Engineer’s recommendations, there should have been no weed problem; some weeds might have escaped control, but the second application ensures almost 90% or 95% weed control.” Thus, according to the expert opinion, as this adjudicative body understands it, the initial and repeat sealing treatments should have produced substantial results; according to the testimony of witness [Nombre3], however, they did not, since the purpose of a subsequent intervention would be to address weeds that had escaped control, on the understanding that the preceding stage had already had a significant impact, as the later treatment is a supplementary application. It has been established that the initial applications had no effect whatsoever. This caused the loss of the entire rice crop and the economic harm represented by the profits not received (ganancia dejada de percibir). This is where the issue of causation arises, since the defendant contends that the plaintiff did not apply the products properly or follow the recommendations, because its principal “at no time controlled the environment or the precise time of application” and “it is impossible for it to verify that the suggested dosages were applied as instructed” (pages 41 and 42). However, at least in its answer, the defendant does not specify what it alleges may have been done incorrectly during the application. The appellant is certainly correct that it is not required to prove the impossible; nevertheless, documentary evidence (prueba documental) consisting of a form dated June 19, 2012, issued by Engineer [Nombre5], was submitted with the complaint, unequivocally stating: “Bispiribac application failed” and “Diagnosis: Bispiribac + Drazinon was applied; Bispiribac did not work on any weeds” (page 4). Thus, there was documentary evidence in which the defendant’s own Engineer—who had recommended the products, their respective dosages, and the method of application to the plaintiff—acknowledged in situ that the product had not worked. This is not a matter of his having meant that there was an application error, since he stated that the product had not worked at all. In light of this item of evidence, the defendant was required to do more than insinuate a possible general failure in the application of the product; it had to properly rebut that evidence, whether by offering testimony from its employee explaining what, in his technical judgment, he believed may have been done incorrectly, rather than merely asserting in its answer that the producer had failed to follow the recommendations. It must also be borne in mind that this documentary evidence must be considered together with the testimony of the CONARROZ employee that other producers in the area had experienced similar problems with the defendant’s products. The deemed admission by default (confesional ficta) is also applicable because the defendant failed to appear as summoned, pursuant to Articles 338 and 343 of the former Código Procesal Civil, which applies to the case at bar (subjúdice) because these proceedings were commenced before the reform that entered into force on October 9, 2018 (Transitorio I), and the party was summoned to give such evidence under the former legislation. Likewise, Article 47 of the Ley de Jurisdicción Agraria applies, permitting a party required to appear to be deemed to have admitted the facts if it unjustifiably fails to do so. Based on the interrogatories submitted at the relevant time, and as the trial judge found, the defendant entity may be deemed to have admitted that Engineer [Nombre7] was the technical supervisor appointed to provide direct guidance and advice to the plaintiff at the farm regarding the use of* the products and inputs, and that said technical supervisor submitted reports stating that the products and inputs failed in both their application and effectiveness. (See scanned copy of the questions in the filing incorporated on January 15, 2018 at 05:59:46). The defendant evaded the examination for admissions (prueba confesional), thereby limiting the plaintiff’s ability to establish such complex facts concerning the effectiveness of the products from which the defendant profits. Accordingly, its attempt to avoid liability by arguing that it is impossible to prove whether the plaintiff applied the products correctly or incorrectly cannot be accepted, since it did not contribute to the evidentiary process (dinámica probatoria). Contrary to what the appellant contends in ground 9), this is not an attempt to rely on the deemed admission by default without weighing the other aspects of the body of evidence; as noted, other corroborating evidence was also established.

Certainly, there is no direct evidence in the record (autos) establishing that anyone observed the moment when the plaintiff prepared the mixture by following the exact instructions, since the witness testimony (declaraciones testimoniales) contained in the record is from his workers, who proceeded to apply the product once it was ready; the fact remains that, under the rules of logic, psychology, and human experience, it may be concluded that the product and recommendations supplied to the plaintiff had effectiveness problems, for the reasons extensively stated.* The causal relationship (relación de causalidad) is not foreign to strict liability (responsabilidad objetiva). It is true that, given the nature of the activity of applying chemical products in agriculture, proof of the causal nexus (nexo causal) regarding the damage that such activity may cause is often indirect or mediate, or circumstantial, which lends its own particular nuances to matters concerning the burden of proof (carga de la prueba) and the assessment of evidence (valoración de la prueba).

Traditional evidentiary requirements are relaxed. Furthermore, legal scholarship, with respect to strict liability for environmental damage (daño ambiental), has already developed principles that this Court considers applicable to hazardous activities (actividades riesgosas), since they logically share the same foundation or structure of strict liability. These new criteria tend to break with rigid or excessively stringent formulas inherited from fault-based civil liability (responsabilidad civil subjetiva), which have evolved into concepts such as “adequate causation” (causalidad adecuada) (Mosset, Tomo I, 1999, p.110 y 111). Demonstrating the causal nexus does not mean that “complete assurance or certainty” is required, since it may validly be presumed or inferred from certain conduct or facts, as what is involved is a definite possibility, a probability meeting a standard of reasonableness (Mosset, Tomo I, 1999, p.113).

Others state that the probability criterion is based on the universal rules of experience; that is, in order to “establish a cause-and-effect connection between two events, it is necessary to make a retrospective judgment of probability or suitability, formulated as follows: is the act or omission being judged, per se, capable or suitable normally to cause that consequence? That judgment must be made not from the perspective of the acting party, but in the abstract, on an objective plane, irrespective of what actually occurred, and with regard to what usually occurs” (Goldenbert, 2001, p 28).* By virtue of the foregoing, grounds of appeal (agravios) 1), 3), 6), 10), 11) and 12), summarized above, must be rejected, since the causal nexus has been proven in accordance with this Chamber’s interpretation of the evidence, and not according to the weight or assessment that the appellant seeks to assign to the body of evidence cited. * * VII.

On the other hand, the objections alleging that the problem arose because certified seed was not used (ground of appeal (agravio) 2) are likewise unfounded. Admittedly, in the complaint, the plaintiff acknowledges that he used seed saved from the previous harvest (third fact at folio 10), and although the defendant has maintained in its defense that the seed’s low quality made it more vulnerable to weeds (in this regard, it submitted a scientific article written on the subject, “Seed Certification and Quality Control,” appearing at folios 148 to 157), the fact remains that, according to logic and the “technical facts of agriculture” as a source for interpreting Agricultural Law (Derecho Agrario), the quality of the seed is unrelated to the effectiveness of the product in this case. According to the witness [Nombre3] and the declarants [Nombre9] and [Nombre10] (record at folios 214 to 226 of the physical case file), the seed germinated well and vigorously, and the problem affecting the crop after germination was that the weeds were not controlled.

The product’s failure or loss was not caused by an issue with seed quality; rather, the weeds did not respond at all to the products recommended and sold to the plaintiff by the defendant. The crop was damaged because the uncontrolled weeds overtook it, not because, once the weeds had been controlled, the seed weakened or failed to withstand them; it is therefore unacceptable to attempt to disclaim liability through this argument. Another challenge to the judgment, or central issue in this matter, is the appellant’s argument that the plaintiff applied products supplied by a third party (grounds of appeal 4 and 5) without following the recommendations of its technical specialist, [Nombre5],* which is likewise unfounded for the reasons set forth below. In its answer to the complaint, when addressing fact twelve, the defendant asserted that the plaintiff used products from other commercial suppliers and did not apply the recommended products (folio 69).

That fact was not acknowledged by the plaintiff in his reply to the answer (folio 106) or in the testimony given during his examination as a party (confesional) (folio 214). Two witnesses offered by the defendant—repeatedly cited by the appellant in its appeal—who work for the defendant, Messrs. [Nombre4] and [Nombre6], addressed this matter. Thus, [Nombre4] (the defendant’s sales representative) stated that when he visited the plaintiff in response to the latter’s complaints that he was unable to control the weeds, he saw a form issued by an engineer named [Nombre8], who had recommended a product that did not work (folio 219). However, even considering this witness’s interest in the matter as the defendant’s sales representative, the overall context of that testimony must be taken into account, pursuant to the principle of the unity of evidence (unidad de la prueba) and free assessment of evidence (libre valoración) established in Article 54 of the Ley de Jurisdicción Agraria.

First, he stated that he went to the farm when the plaintiff was already dissatisfied because a product prescribed by [Nombre5] (the defendant’s engineer) had not worked, and that by the time he made the visit, the weeds had already overtaken the crop. Accordingly, it is understood that the initial applications had already been made without results and that, under the rules of logic and psychology, the dissatisfaction arose precisely from that circumstance. It is understood that, when this visit occurred, the process had already reached the subsequent control stage, after the weeds had emerged, when specific herbicides had to be applied. Therefore, even assuming that the plaintiff did not make the second application after the weeds had emerged, as the aforementioned [Nombre5] had instructed on 19 de junio, this does not disprove the fact that the initial sealing and resealing applications (aplicaciones de sello y resello) were completely ineffective.

It should be noted that the record contains documentary evidence (prueba documental), specifically a second form issued by [Nombre5] himself, dated 19 de junio del 2012, recording the product’s failure. Considering that the truly post-emergence application was not recommended until 19 de junio, and that the initial applications had been prescribed between 24 de abril -8 de mayo and did not work at all, it was understandable that the plaintiff, seeking to save his crop at such a vulnerable stage and facing financial distress, might seek the advice of a third party as a remedial measure. It is evident that the defendant intervened belatedly, since by the time its representatives visited, the weeds had already overtaken the crop, as can be inferred simply by comparing the dates on the forms at folios 3 and 4. Even if the plaintiff had followed those belated recommendations issued in June by [Nombre7], there is evidence that, because the pre-emergence applications were entirely ineffective, the possibility of control was considerably lower.

As has been reiterated at this level of review, although there is no conclusive evidence that the plaintiff applied other products not recommended by the defendant, there is evidence that the sealing and resealing applications were completely ineffective; consequently, the most reasonably probable cause of the failure to control the weeds was the defendant’s defective product or recommendation. In any event,* the defendant was required to demonstrate that the inclusion of other substances, such as “clincher,” in combination with its products, could be the probable reason why the weeds could not be controlled, rather than merely suggesting such causation, given the proof of such a compelling fact as the failure of the initial applications recommended by the defendant and the belated timing of the subsequent applications. It should also be noted that the declarant [Nombre6] (an agricultural engineer employed by the defendant company) stated that he observed on the form issued by that third engineer a reference to the product “clincher” for controlling “echonocloa,” and that it was similar to Bispiribac Sodium (folio 223), the latter having been recommended by the defendant.

In other words, they were similar products. This is without overlooking the contradiction in the defendant’s appeal, in which it asserts that it never recommended “Talcord,” even though it was included on the form issued by its technical officer (folio 3). It should be noted that this witness, [Nombre4], did not visit the farm until June, and he himself stated that the weeds had overtaken the crop; furthermore, the form formalizing [Nombre5]’s own diagnosis is dated 19 de junio. Accordingly, that witness’s account—that the plaintiff did not wish to follow the recommendations for a subsequent application or intervention and that this caused the weeds to become uncontrolled—is unpersuasive, because his visit to the farm coincided with [Nombre5]’s second technical intervention, in a context in which the weeds were already significantly out of control. The expert report (peritaje) indicates that the second application was intended more to control weed escapes, rather than to remedy, once the crop was already advanced, the complete ineffectiveness of the sealing and resealing stage.

It must also be taken into account that the diagnosis of the product’s failure, made by Engineer [Nombre5] himself, occurred on a date when the weeds had already overtaken the crop; therefore, the probable cause of the crop loss was not the failure to follow the subsequent recommendations. In any event, the record contains documentary evidence, specifically an email sent to the lower court by Cooproarrosur through its Administrative Manager, Hazel Elizondo D., stating that the plaintiff did not purchase the product “Clincher” from them. This was provided in response to the court’s request in the ruling issued at catorce horas con seis minutos del diecisiete de febrero del dos mil dieciséis (folios 257 and 255), and was disclosed to the parties for a period of tres días in the ruling issued at catorce horas con veintiocho minutos del veintinueve de febrero del dos mil dieciséis (folio 257), without the defendant making any statement in that regard. * * * * * IX.

In another vein, the statement by the witness [Nombre4] that “the nozzles on the BUM” were not working properly and that this may have affected the effectiveness of the application is likewise unpersuasive. The witness [Nombre9], who was hired by the plaintiff to prepare and maintain the rice planting and was responsible for ensuring that the machinery and irrigation were ready on time, stated that, in this case, he verified that the irrigation equipment was in good condition, the engines were properly sealed, and the nozzles were in good condition, and that applications were performed from five in the morning until ten in the morning at the latest because of the wind conditions (folio 221). Likewise, [Nombre10], an agricultural operator hired by the plaintiff, stated that he participated in the sealing and resealing and that it was done using a new BUM (folio 225). The only person who stated that there was a problem with the BUM nozzles was Mr. [Nombre4], the defendant’s sales representative; however, he could not actually attest that they were in poor condition during the applications because he was never present when they were performed.

Rather, he heard that on one day the BUM could not be used because of the nozzles, but that fact cannot in any way establish that this caused the product’s lack of effectiveness, particularly when two witnesses testified to the contrary. On the other hand, regarding the finding that the defendant agreed to pay for the damage caused (ground of appeal 8), which the appellant argues cannot be deemed proven, the appellant is correct, but this does not alter the decision reached at this level of review. This is because there is indeed no evidence, other than the deemed admission due to failure to appear (confesional ficta), establishing an admission of or consent to paying damages (daños y perjuicios). The form dated 19 de junio, mentioned so many times, acknowledges that the product failed; it is quite another matter to conclude that the defendant agreed to pay the items claimed here. Therefore, on this particular point, it is inappropriate to rely on the deemed admission as the sole evidence. * * * * * * * * * X. Lastly, the objection concerning costs (costas) is likewise unfounded.

This matter commenced before the new Código Procesal Civil entered into force; therefore, the former code applies pursuant to Transitional Provision I (transitorio I). Specifically, Article 222 of the former statute provides for the possibility of exemption, but only when some of the complaint’s principal claims have been rejected. Here, most of the damages claimed have been awarded; therefore, exemption is inappropriate, and the ruling on that matter must be affirmed. * * XI. Perjuicios:* Aparte del monto que corresponde a la pérdida* de la utilidad como se expuso anteriormente, los perjuicios también* consisten en los costos iniciales de alquiler de la parcela de terreno, el* precio de la semilla que había reservado para la siembra, más los costos* por servicios agrícolas en la plantación para esa primera del 2012, por lo* que los perjuicios reclamados ascienden a la suma total de C 7.470.000.00* (siete millones cuatrocientos setenta mil colones exactos) tal y como se* expuso en el hecho décimo sexto de la presente demanda. Daño* Moral: Este rubro debe ser determinado por el juez del proceso, pero* debe tenerse en cuenta la profunda tristeza que experimentó mi* poderdante, y la manera en que esto afectó su ánimo y su desempeño* como resultado de haber perdido la plantación que es el sustento de su* familia por años, el tener que recurrir a constantes reuniones para que las* casas comerciales no lo lleven a cobro judicial, tener que recurrir a créditos* privados con sus amistades para hacer frente a las necesidades familiares,* no poder obtener las utilidades proyectadas y además, tener que soportar* las constantes llamadas de los empleados de la misma demandada* cobrándole las facturas de los productos que se utilizaron en la plantación* y no sirvieron, circunstancias que en su conjunto han provocado una* afectación tanto en el aspecto psicológico como emocional de mi* poderdante, pues no es una persona acostumbrada a enfrentar deudas,* como le ha sucedido producto del perjuicio ocasionado al emplear los* productos de la demandada, esto le ha llevado a que durante los últimos* meses casi no pueda dormir, experimentando constantes cambios de* humor, pues en ocasiones se encuentra triste y abrumado por la situación,* en otras se muestra irritable y ansioso la mayor parte del día, pensando en* todo momento en las obligaciones económicas que debe afrontar, de lo* cual son testigos su núcleo familiar inmediato* y varios de sus amigos y* compañeros de trabajo, quienes pueden referirse en la forma en que esto* le ha afectado en su salud emocional y en su calidad de vida.

Fijamos este* daño moral en forma provisional en la suma de C [...] (Quince* millones de colones). Gran total de daños y perjuicios: De la suma de los* daños y perjuicios anteriormente expuestos obtenemos un gran total por la* suma de C 26.000.754.90 (veintiséis millones setecientos cincuenta y* cuatro colones noventa céntimos). d) Se condene a la sociedad* demandada al pago de los intereses al tipo legal, desde que se emitieron* las facturas de insumos proveído por terceros o en su defecto, desde la* firmeza de la sentencia y hasta su efectivo pago. e) Se condene a la* sociedad demandada al pago de ambas costas de este proceso. f) Se* tengan por extinguidas las facturas puestas a cobro en contra de mi* poderdante por la sociedad demandada, correspondientes a la primera* cosecha del período [Telf1], cuando se le causó el perjuicio como* consecuencia de la nula efectividad de los productos de la demandada que* se utilizaron y que causaron el perjuicio en la plantación,"* (folios 9 a 25).-* * II.-* La sociedad demandada debidamente notificada contestó la presente* acción en los términos de su escrito de folios 65 a 79 e interpuso las* excepciones de falta de derecho y falta de legitimación pasiva.-* * III.-* El Juez Carlos Eduardo Rojas Rojas, del Juzgado* Agrario del Segundo Circuito Judicial de la Zona Sur,* mediante la sentencia Nº* 183-2018* de las trece horas cincuenta y ocho minutos del dieciséis de noviembre del año dos mil dieciocho,* resolvió: “POR TANTO:* De conformidad con lo expuesto, y los artículos 2 inciso h), 6, 26, 54, 55, 79 de la Ley* de Jurisdicción Agraria, y demás numerales de las leyes, reglamentos y jurisprudencia* citados, se rechazan las excepciones de falta de legitimación pasiva y la de falta de* derecho interpuesta por la demandada.

Se declara parcialmente con lugar la presente* demanda planteada por [Nombre1] contra Industrias Bioquim* Centroamericana S.A, en la forma que se dirá, entendiéndose por denegado lo que no* se conceda expresamente y por modificados los aspectos pertinentes en función de lo* debatido y la acción acogida. Se rechaza lo concerniente a la pretensión del pago de* los intereses al tipo legal, desde que se emitieron las facturas de insumos proveído por* terceros o en su defecto, desde la firmeza de la sentencia y hasta su efectivo pago y* por extinguidas las facturas puestas a cobro en contra del actor por la sociedad* demandada, correspondientes a la primera cosecha del período [Telf1] (petitorias* 4 y 6) ya que ni siquiera fueran descritas en los hechos y por no haberse aportado* prueba fehaciente al respecto. Concretamente se concede: 1) Se declara el nexo* causal respecto a los hechos y la responsabilidad atribuida a la Sociedad demandada.* 2) Se declara a Industrias Bioquim Centroamericana S.A. responsable directa por los* daños y perjuicios ocasionados al actor, consistentes los primeros en la pérdida de lo* invertido para producir los sacos de arroz dejados de obtener en la cosecha afectada* (valor de su costo de producción): diez millones seiscientos dos mil doscientos cuatro* colones con setenta céntimos (¢10.602.204,70), Daño moral: dos millones de colones* (¢2.000.000) y los perjuicios en la ganancia dejada de obtener por los sacos de arroz* que no produjo la cosecha [Telf1]: tres millones quinientos treinta mil setecientos* cincuenta y cuatro colones con dieciocho (¢3.530.754,18) y se condena a la* demandada a pagar al actor por concepto de daños y perjuicios la suma total de* dieciséis millones ciento treinta y dos mil novecientos cincuenta y ocho colones* con noventa céntimos (¢16.132.958,90), suma que en definitiva deberá cubrir la* Sociedad Industrias Bioquim Centroamericana S.A. en un plazo de cinco días para* proceder a su pago, bajo apercibimiento de ser ejecutado en sus bienes en caso de* que no cumpla.

Son las costas personales y procesales de este asunto a cargo de la* demandada,"* (Ver Escritorio Virtual del Juzgado Agrario de Corredores, Bandeja de Escritos, archivo del 16/11/18 de las 13:58:28 p.m.).-* * IV.- La licenciada Georgia Lorena Mont Villacura, apoderada especial judicial de la entidad demandada, interpuso* recurso de apelación con indicación expresa de las razones en que se apoyaron para refutar la tesis del juzgado de instancia,* (Ver Escritorio Virtual del Juzgado Agrario de Corredores, Bandeja de Escritos, archivo del 20/11/18 de las 4:26:04 p.m.).-*

V.En la substanciación del proceso* se han observado las prescripciones legales, y no se observa la existencia de errores u omisiones capaces de producir la nulidad del fallo.-*

Redacta la Jueza FISHER GONZÁLEZ y; * CONSIDERANDO* * I.* Se rechaza la prueba pericial ofrecida para mejor resolver por la parte recurrente, por considerar este Tribunal existen elementos suficientes para resolver, y haber tenido las partes oportunidad suficiente en la primera instancia para ofrecer todas las probanzas de su interés. * * II. El Tribunal prohija los hechos probados contenidos en el fallo recurrido por ser el reflejo de las probanzas que constan en autos, con excepción del 11) en virtud de no existir prueba suficiente en cuanto al mismo.* * III. En relación al primer hecho tenido por no probado no se avala por considerarse irrelevante para resolver el fondo de este asunto. El segundo no se aprueba dada la forma como está redactado y en virtud de lo que será resuelto en esta instancia. El tercer hecho indemostrado no se prohija por no ser parte de lo que sea importante para resolver las pretensiones deducidas en la demanda. * * * * * * * * * IV. La parte demandada interpuso su recurso de apelación con base en los siguientes agravios: 1)* Mediante la prueba tanto pericial, como testimonial, y la declaración de parte se determinó que no existió un nexo causal entre la actuación de mi representada y el resultado de la cosecha del actor.*

  • 2)El segundo hecho tenido por probado es parcialmente cierto, pues no se logró demostrar que el terreno* estuviera correctamente preparado, y sin embargo sí se demostró que la semilla era reservada de la cosecha anterior. Mediante el dictamen pericial del perito German Barrantes Elizondo se demostró lo siguiente:* -Que la semilla certificada de primera generación, realmente certificada, (la semilla de cosecha anterior ya no es semilla certificada, sin contaminantes, ni expuesta a agentes externos) tiene un 80% de germinación, y tiene un plazo de certificación o idoneidad, máximo de 6 meses. -Que la semilla almacenada pierde sus condiciones y puede generar baja germinación o nula germinación.* -En su informe, presenta estudio del programa de semilla certificada de arroz de la oficina nacional de semillas, que en lo que interesa, indica: “el uso de semilla no certificada aumenta los costos en el control de malezas, ya que presenta una alta proporción de malezas que aumentan los costos de control y disminuyen la producción".
  • 3)Su representada opera desde hace más de 30 años con éxito en todo el territorio nacional, no solamente a partir de la cosecha del 2012, prueba de ello es que el Ing. Carlos [Nombre3] inclusive, reconoce que los productos de su representada son eficaces y los recomienda. El Ingeniero [Nombre3] , en su declaración indica que inclusive los productos les fueron recomendados por COOPEARROSUR.
  • 4)El cuarto hecho probado no es cierto. Su representada apersonó a [Nombre4] y al Ingeniero [Nombre5] para orientar y asesorar en la finca al actor, ofreciéndole el producto necesario y adecuado para su cosecha, específicamente Diazinon y Bispiribac. Su representada no vende ni produce Talcor. Esto demuestra que se utilizó producto de otra empresa, recomendado por otro profesional, que no se siguieron las recomendaciones estrictas de su representada. Transcribe declaración de [Nombre4] y de [Nombre6] . Ambas declaraciones indican que el actor les indicó que utilizó el producto “Clincher” con “Talcor”, que el Ingeniero Juan Diego Barrantes, lo recomendó, y que [Nombre1] * aplicó estos productos, no lo recomendado por su representada en la forma que se le indicó. El Ingeniero [Nombre7] se encargó de asesorar en la recomendación de los productos de su representada, sin embargo no podía controlar: - Que se aplicaran correctamente. - Que se utilizaran solo esos productos y no otros productos adicionales. Tanto en la declaración de [Nombre4] , como de [Nombre6] , queda demostrado que el actor utilizó otros productos, atendiendo otras recomendaciones. 5)* Es cierto que el Ingeniero [Nombre5] [Nombre7] hizo recomendaciones, sin embargo, como indica [Nombre4] , el Ingeniero [Nombre5] le recriminó a [Nombre1] , la falta de aplicación de la segunda dosis, es decir, [Nombre1] * no acató estas recomendaciones. El actor le indicó a [Nombre4], que confiaba más en el Ing. Juan Diego Barrantes, y que en todo caso, eso no había funcionado, que por eso volvió con [Nombre5] , pero teniendo claro que no había seguido las recomendaciones de [Nombre1] , pues se atrasó en la aplicación del producto indicado. Indicó el testigo [Nombre4], que [Nombre1] le manifestó que aplicó “Clincher con Talcot” siguiendo las instrucciones de [Nombre8] .* Explicó el testigo [Nombre6] , que atrasar la aplicación del producto correcto y recomendado, puede afectar el resultado. Se transcribe parte de la declaración. El propio testigo [Nombre3] recomienda los productos de su representada, indica que los productos eran normales, y buenos si se aplican correctamente con tiempo y surten efecto si se lleva un buen control. Se transcribe parte de la declaración.
  • 6)En la sentencia no se considera que el actor no siguió las recomendaciones del [Nombre2]. Ordoñez, es decir se tiene como demostrado pese a que existe prueba testimonial en contrario. El diagnóstico es claro en indicar que falló la aplicación, es decir no falló el producto, ni tampoco la receta ni recomendación, precisamente porque la aplicación no depende del regente, ni de su representada, sino únicamente del agricultor. En este caso, las declaraciones testimoniales coinciden en que el único encargado de la preparación del producto para aplicar, fue el propio actor en este proceso. Cita parte de las declaraciones de los testigos [Nombre3] , [Nombre4] , [Nombre9] y [Nombre10] .* Es decir, las variables que señala el informe del Ingeniero German Barrantes Elizondo, pudieron haber afectado no solo a la semilla, sino también al producto a aplicar, al variar por posible contaminación del ambiente y variación del PH del agua. El operario [Nombre11] , así como [Nombre9] , agricultor, en su declaración indican que quien manipula el producto es [Nombre1] , que [Nombre10] solamente lo aplica con el “bum”, [Nombre3] prepara el terreno, es decir, tampoco le consta que el producto haya sido correctamente preparado para su aplicación.
  • 7)No es un hecho probado que las recomendaciones del [Nombre2] [Nombre7]. hayan sido acatadas por el actor, por el contrario, hay abundante prueba en contrario, tanto por no estar ninguna persona cuando el [Nombre1]. preparó las mezclas, como el hecho de existir boletas y recomendaciones de otro ingeniero. Cita parte de las declaraciones de [Nombre3] , [Nombre4] y [Nombre9] y [Nombre10] .
  • 8)No se comparte el hecho 11), pues ningún representante de la demandada estuvo presente en la indicada reunión en COOPROAROSUR R.L. que ahí se refiere. El señor Abraham Fonseca no es representante legal de la empresa, (ver certificación presentada en autos por la actora)* ni tampoco envió ni recibió ningún comunicado de pago de indemnización. El actor no aporta prueba al respecto. Si bien es cierto dentro de la confesional pareciera darse como cierto, el resto de prueba no respalda esta afirmación. El propio actor en su demanda, concretamente en el hecho décimo cuarto, indica que estuvo recibiendo llamadas de personeros de mi representada precisamente para el cobro de las facturas adeudadas, que suman C 4.152.041. Prueba de que su representada jamás aceptó no hacer el cobro de estas facturas. En el fallo, efectivamente se tiene por no probado, que “El actor haya acordado con la demandada que no le cobrarían las facturas de los productos”, de manera que en sentido contrario, reafirma el hecho de que su representada nunca ha acordado indemnizar al actor, ni tampoco condonar las deudas que aún tiene, producto de las facturas señaladas en el escrito de contestación de esta demanda.
  • 9)En cuanto a la valoración de la prueba confesional, ésta no puede ser plena prueba* al tenerse por contestada afirmativamente si va en contra del sentido común, la sana crítica racional y aún más, si es contraria a las declaraciones testimoniales y prueba técnica o documental de las partes dentro del mismo proceso.
  • 10)No existe nexo causal.* En este proceso, la prueba tanto pericial como testimonial ha determinado que: - Si el producto de mi representada se hubiera aplicado correctamente, no deberían haber existido problemas de maleza. (Dictamen del Ing. Alexander Mendoza Luna, de 19 de octubre del 2017, DITT/45-2017, que en su conclusión, indica: “Cabe recalcar que para poder emitir un criterio técnico concluyente, es importante conocer las condiciones en la que se realizó la mezcla (dosis utilizada, ph de agua, limpieza del equipo de aplicación) y las condiciones climatológicas presentes en el momento de la aplicación, ya que una condición de estrés podría ocasionar diferentes efectos en la planta. Además es importante conocer si se aplicó otros productos adicionales a los consultados.”* La semilla aplicada, no era certificada (de la cosecha anterior, de acuerdo a la demanda presentada). - Que el producto fue preparado por el [Nombre1]. y que no consta su correcta preparación. - Que el actor no siguió las instrucciones del Ingeniero [Nombre7]. - Que aplicó otros productos y que siguió instrucciones de otros profesionales de otras casas comerciales.
  • 11)Nadie puede ser obligado a lo imposible.* Es un hecho demostrado que el actor fue el único responsable de la preparación del producto para su aplicación. Si mi representada no fue parte activa en la preparación y aplicación del producto en su siembra, es imposible que sea responsable, de los daños ocurridos en ella, máxime que se logra demostrar que además de aplicarse otros productos sugeridos por otros profesionales ajenos a mi representada, no se siguieron las instrucciones del profesional [Nombre5] .
  • 12)No existe nexo causal entre la venta de producto, la sugerencia de nuestros profesionales y el mal resultado de su siembra, pues el factor determinante, más importante, no se puede demostrar, ni se determina, que es precisamente tanto la idoneidad de la semilla, como la forma de preparación y de aplicación de los productos sugeridos. esta es la fase primordial y fundamental para demostrar el daño. Existen decenas de agricultores que aplican estos productos que nosotros vendemos y cuyas aplicaciones recomendamos y con excelentes resultados, pues siguen las instrucciones sugeridas, lo cual pareciera ser que no ocurrió en este caso particular. No se logra demostrar que el resultado de la germinación y proliferación de la maleza en la granza de arroz que el actor sembró sea resultado del producto que propuso mi representada, ni tampoco consecuencia de las recomendaciones de aplicación. Por lo tanto, no se puede achacar a mi representada la responsabilidad del abandono de su plantación, considerando que existe muchas otras variables, que quedaron aquí demostradas, que influyeron en la pérdida de su cosecha que no tienen que ver con mi representada. No ha sido solamente la prueba testimonial la que respalda mi solicitud de confirmación de la sentencia, sino también la prueba pericial que en su totalidad ha avalado los hechos por mi representada contestados.
  • 13)En vista de lo anterior, con base en la prueba que consta en autos, solicita se revoque la sentencia y subsidiariamente se solicita que en caso de no ser acogido este recurso de apelación de la forma aquí planteada, se resuelva sin especial condenatoria en costas, toda vez que la sentencia no concede la totalidad de lo pedido por el actor. * * V. En síntesis, en su demanda, la parte actora alega que para la cosecha de arroz correspondiente al año 2012, en una finca de 18 hectáreas, la demandada le vendió un paquete de productos que se acostumbran aplicar después de la siembra, a efectos de controlar las malezas, conocido como "paquete arrocero". Aduce que pese a seguir las instrucciones del caso, los productos no funcionaron desde la primer aplicación, lo que provocó la maleza sobrepasara el cultivo y se perdiera. Por su parte, la demandada alega que los motivos probables por los cuales no funcionó es porque el actor no utilizó semilla de arroz certificada, no hizo las aplicaciones correctamente y además aplicó un producto recomendado por un tercero, sin seguir especificaciones de su representada. Tal y como lo argumentó el Juez de primera instancia, en este caso en particular se está en presencia de un reclamo de daños y perjuicios bajo el régimen de responsabilidad objetiva, por estipularlo así la Ley de Protección Fitosanitaria. De esta forma el artículo 28 de esa normativa, dispone lo siguiente: "Responsabilidad del regente. Los regentes mencionados en el artículo anterior serán responsables técnicos de que las sustancias químicas, biológicas o afines que se reenvasen, reempaquen, importen, fabriquen, formulen, distribuyan, mezclen, almacenen o vendan, estén debidamente registradas, etiquetadas y se ajusten a todas las disposiciones de esta ley y los reglamentos. Las recomendaciones del regente serán vinculantes para la persona física o jurídica a la cual presta sus servicios. Igual responsabilidad le competerá al regente en lo relativo a los equipos de aplicación para uso agrícola". Por su parte el ordinal 31 establece: "Responsabilidad por daños y perjuicios. Quienes realicen investigación, experimentación, movilización, liberación al ambiente, importación, exportación, multiplicación y comercialización de vegetales o de los organismos o productos referidos en el artículo 41, serán responsables de los daños y perjuicios que ocasionen a la agricultura, el ambiente y la salud humana y animal". Asimismo el 32 de ese cuerpo legal: "Resarcimiento de daños y perjuicios. Quienes importen, fabriquen, formulen, reenvasen, reempaquen, distribuyan, almacenen, transporten, vendan y apliquen sustancias químicas, biológicas o afines para uso agrícola, estarán obligados a resarcir los daños y perjuicios que, con sus acciones u omisiones, ocasionen a la agricultura, la ganadería, la salud humana y el ambiente". Sin duda se está en presencia de un régimen de este tipo de ahí que no proceda analizar si ha existido dolo o culpa, sino la existencia del daño y el nexo causal. * * * VI. Analizado con detenimiento este asunto se concluye que no lleva razón el recurrente en sus agravios. El punto medular de este proceso gira en torno al nexo de causalidad. Existe prueba suficiente en autos, valorada con base en el principio de libre valoración probatoria contemplado en el artículo 54 de la Ley de Jurisdicción Agraria, así como el principio de unidad de la prueba, que acredita el motivo por el cual no funcionaron los productos aplicados para el control de malezas en el arrozal del actor, no son achacables a éste, sino a la falta de efectividad del producto mismo, suministrado y recomendado por la parte demandada. Según los hechos 9 y 10 de la demanda (folios 11 y 12 del expediente físico), así como la boleta expedida por el profesional técnico de la demandada, No. 408* de fecha 24 de abril del 2012* y complementada al dorso con fecha 8 de mayo de ese mismo año (folio 3), se infiere que la demandada Industrias BioQuim Centroamericana S.A., por medio de su regente [Nombre5] , suministró y recomendó a la parte actora una serie de insumos agrícolas, de los cuales según esa boleta, correspondían a las sustancias denominadas Talcord (Permetrina/insecticida), Biokil (Glifosato), Peguno, Butamax, Toro (Pendimentalina), Bispiribac, Cytozyme y Diazynon. Eso se desprende con suma claridad, de ahí que no lleve razón la demandada en su recurso de apelación (agravio 4), de que nunca recomendó y suministró el Talcord. Aunque la parte demandada indica en su contestación que esas boletas no tienen fecha cierta y que no le consta la época en la que fueron emitidas, lo cierto es que en general en la contestación, admite que le vendió productos al actor para controlar las malezas del arroz, de manera que la boleta tiene el membrete de esa compañía, y la letra en imprenta estampada a mano es la misma en el frente y el dorso. Así las cosas, este Tribunal tiene por demostrado que esos fueron los productos recomendados, pues nótese incluso, que en la contestación a la demanda, la parte accionada aporta Panfletos comerciales de Bioquim (Bispiribac Sodio), Bioquim (Toro), Bioquim (Diazinon) y Biokil (folios 81 a 84 del expediente físico), para sustentar sus argumentaciones. Es claro que no es un hecho controvertido entre las partes que existió un contrato agrario de venta de insumos agrícolas que implicó a su vez recomendaciones de uso, pues ese contrato se encuentra regulado en normativa de orden público como lo es la Ley de Protección Fitosanitaria. Ello resulta de esa manera pues de conformidad con el artículo 28 supra citado, las empresas que venden este tipo de insumos a la agricultura, deben a su vez de ser responsables de hacer constar las especificaciones e indicaciones técnicas, agronómicas y los métodos que deberán aplicarse; no pudiendo limitarse únicamente a vender el producto, dada la naturaleza riesgosa de esa actividad. Existe prueba abundante de que el actor [Nombre1] , procedió a hacer las aplicaciones denominadas de sello y resello, para evitar el brote de la maleza, con resultado completamente nulo para el control de las mismas. Del peritaje que consta en autos se infiere que ese "sello y resello" son aplicaciones que se hacen con bastante proximidad o casi paralelismo a la siembra para evitar el brote de la maleza, pudiendo hacerse otra aplicación química posterior por si ha existido escape de maleza (folio 116 y 117 del expediente físico). La declaración del testigo [Nombre3] , es fundamental, y le merece fe a este Tribunal, pues no tiene interés directo en el asunto, no trabaja para ninguna de las dos partes, además de que es empleado de la Corporación Arrocera Nacional (CONARROZ), la cual según artículo 1 de Ley No. 8285 del 30 de mayo del 2002, tiene como objetivo establecer un régimen de relaciones entre productores y agroindustriales de arroz para garantizar participación equitativa y racional de ambos en esa actividad, lo que implica la responsabilidad en la protección y promoción de la actividad arrocera, tales como la producción agrícola proceso agroindustrial, comercio local, exportaciones e importaciones. Dicho deponente refirió que el actor ha sembrado arroz por muchos años, incluido el 2012, y que en CONARROZ le dan asistencia técnica a todos los productores. Asimismo que éste aplicó productos Bioquim (de la demandada), lo que le consta porque en las recetas aparecía la identificación, y que se le recomendaron agroquímicos de parte de Coproarrosur. La conexión entre BIOQUIM y COPROARROSUR se logra establecer al observarse el hecho 13 de la demanda, que al menos en ese aspecto no fue desmentido por la demandada, en el que se indica que los productos de la accionada los almacenaban en esa Cooperativa. Continuando con este testigo, refirió que primero se hace un "sello" y "resello" que corresponde a las primeras aplicaciones, y luego si hay escape de malezas se coloca otra aplicación con herbicidas específicos, pero que en este caso "el control fue totalmente negativo en cuanto a malezas" y que "la maleza fue total en todo el lote y la plantación se perdió por la invasión de las malezas". De igual modo señaló, que aunque no estuvo presente en las aplicaciones "si pudo apreciar que la maleza se mantuvo igual como sino se hubiese aplicado nada". Todo ello le consta porque en razón de sus funciones, conoce al actor desde hace nueve años como arrocero, de manera que lo ha visitado para verificar el área de siembra, y detalló, se acostumbra hacer de cuatro a cinco visitas durante el ciclo productivo, que es el momento de la siembra, fertilización, control de malezas, riego de espigas y cosecha. Luego explicó, que la preparación estaba apta para la siembra, que la germinación o vigor de la planta era bueno, y que el producto "Bispiribac" en principio debía de funcionar, pues se usa para esos fines de controlar malezas. Añadió que la demandada BIOQUIM usa productos genéricos, que a su criterio son de baja calidad, y refirió que "en ese año algunos otros productores tuvieron el mismo problema con ese producto porque aparentemente no les había funcionado" (acta de recepción de prueba a folios 216 y 217 del expediente físico). A esta declaración hay que sumar lo indicado en el peritaje rendido en autos por el Ingeniero Douglas Sosa Sánchez, quien explicó las dieciocho hectáreas donde se siembra arroz, por parte del actor, reúnen las condiciones edáfico-geográficas y agroclimatológicas apropiadas para la actividad arrocera, y que en la zona donde están ubicadas presenta un buen comportamiento en cuanto adaptación, crecimiento y producción, lo cual repercute en un buen estado fitosanitario y productivo para el cultivo de arroz. Asimismo, detalló deben de usarse herbicidas en la etapa de sello "pre-emergencia" y "pos-emergencia", de forma tal que para este caso en los primeros se usó biokil (glyphosate) y toro (pendimenthalin) y en los segundos butamax (machete), además de Bispiribac que es post emergente. Esos productos son los que se prescriben en la receta o boleta No. 408 de folio 3 suscrita por el Ingeniero de la demandada [Nombre5] . En este orden de ideas, explicó el perito, que "si las aplicaciones se hicieron acordes con las recomendaciones del Ingeniero, no debería de haber problema de maleza, que puede haber un poco de escape de maleza, pero con la segunda aplicación se garantiza casi el 90% o 95% de control de las malezas". De esta manera, de acuerdo a la experticia, según entiende este órgano jurisdiccional, con los procesos de sello y resello deberían de evidenciarse resultados sustantivos, y de acuerdo a la declaración del testigo [Nombre3] ello no fue así, pues una intervención posterior tendría como función atacar el escape de malezas, pero en el entendido de que la etapa anterior haya hecho un impacto importante, pues es una aplicación complementaria. Ha sido acreditado que los efectos de las primeras aplicaciones fueron completamente nulos. Ello provocó el daño de pérdida de todo el cultivo de arroz y el perjuicio económico que implica en la ganancia dejada de percibir. He aquí el tema del nexo causal pues la parte demandada aduce que el actor no hizo bien las aplicaciones ni siguió recomendaciones, pues su representada "en ningún momento controlamos el medio ni el momento efectivo de la aplicación" y "que les es imposible comprobar que las dosificaciones sugeridas fueron aplicadas conforme se indicó" (folios 41 y 42). Sin embargo, al menos en la contestación no se especifica qué es lo que la demandada alega pudo haber estado mal en la aplicación. Ciertamente lleva razón el apelante que no está obligado a probar lo imposible, pero desde la demanda se aportó como prueba documental una boleta de fecha 19 de junio del 2012, emitida por el Ingeniero [Nombre5] , en la que se consigna en forma indubitable "Fallo aplicación Bispiribac" y "Diagnóstico: Se aplicó Bispiribac + Drazinon; no trabajó bispiribac en ninguna maleza" (folio 4). Había una prueba documental en el que el propio Ingeniero de la demandada, que había recomendado los productos y sus respectivas dosis y modo de aplicación al actor, in situ, reconoce que el producto no funcionó, y no es un tema de que éste quiso decir que era un fallo de aplicación, pues indica no trabajó del todo el producto. Ante este elemento probatorio, debía la parte demandada ir más allá de insinuar una posible falla general en la aplicación del producto, sino controvertir de la debida manera esa prueba, ya fuera ofreciendo el testimonio de su funcionario para que explicara qué fue lo que bajo su criterio técnico estimó se pudo haber hecho mal, y no una mera afirmación en la contestación de que el productor no cumplió recomendaciones. No se puede dejar de lado que a este elemento documental hay que añadir lo que declaró el testigo funcionario de CONARROZ, de que otros productores tuvieron problemas similares en la zona con los productos de la demandada. Asimismo es aplicable la confesional ficta (por no haber comparecido la demandada conforme fuese convocada), de conformidad con los artículos 338 y 343 del anterior Código Procesal Civil, aplicable al subjúdice por tratarse de un proceso iniciado con anterioridad a la reforma que entró en vigencia el 9 de octubre del 2018 (Transitorio I), y fue bajo la legislación anterior que se citó a la parte a rendir dicha prueba. De igual modo, resulta aplicable lo estipulado en el artículo 47 de la Ley de Jurisdicción Agraria, que permite tener por confeso si se produce inasistencia injustificada de la parte que debía comparecer. En el interrogatorio que se aportó en su momento, conforme lo hiciera el juzgador de instancia, se puede tener por confesa a la entidad demandada, en el sentido de tener por acreditado que el Ingeniero [Nombre7] era el regente designado para orientar y asesorar directamente al actor en la finca en la utilización de* los productos e insumos, así como que dicho regente envió informes indicando que los productos e insumos no funcionaron en su aplicación y efectividad. (ver copia escaneada de preguntas en escrito incorporado el 15 de enero del 2018 a las 05:59:46). La parte demandada evadió la prueba confesional, y ello limitaba la posibilidad de la parte actora de acreditar hechos tan complejos en los que se cuestionaba la efectividad de los productos con los que lucra la demandada, de ahí que no sea atendible pretenda descargarse de que le es imposible probar que el actor aplicó bien o mal los productos, pues no ha contribuido a la dinámica probatoria. No es como lo sostiene el apelante, en su agravio 9), que se pretenda hacer valer la confesional ficta sin ponderar otros aspectos del universo probatorio, pues tal y como se indicó también se acreditaron otras probanzas que complementan. Ciertamente no hay prueba directa en autos que acredite que alguien observara el instante en que el demandante hizo la mezcla siguiendo las instrucciones exactas, pues las declaraciones testimoniales que constan en autos son de sus trabajadores que procedieron a aplicar el producto ya listo; lo cierto es que de acuerdo a las reglas de la lógica, la psicología y la experiencia humana, se concluye que el producto y recomendaciones que se le suministraron al actor tuvieron problemas de efectividad, por las razones ampliamente dichas.* La relación de causalidad no es extraña a la responsabilidad objetiva. Es lo cierto que por el tipo de actividad de aplicación de productos químicos en la agricultura, la prueba del nexo causal en cuanto a los daños que ésta pueda producir muchas veces es indirecta o mediata, o indiciaria, lo que impregna de matices propios o particulares lo referente a la carga de la prueba y a la valoración de la misma. Se flexibilizan los requerimientos tradicionales de prueba. A mayor abundamiento, ya la doctrina, en cuanto a la responsabilidad objetiva por daño ambiental, ha desarrollado principios, que estima este Tribunal son extendibles a los supuestos de actividades riesgosas, toda vez lógicamente comparten el mismo tronco o estructura de la responsabilidad objetiva. Esos nuevos criterios tienden a romper con fórmulas certeras o en extremo rigurosas heredadas de la responsabilidad civil subjetiva, que han evolucionado a conceptos como el de "causalidad adecuada" (Mosset, Tomo I, 1999, p.110 y 111). La demostración del nexo causal no significa que se requiera "seguridad o certidumbre total" pues es válido se presuma o infiera de determinadas conductas o hechos, ya que se trata de una posibilidad cierta, de una probabilidad en grado de razonabilidad (Mosset, Tomo I, 1999, p.113). Otros refieren, que el criterio de probablidad se funda en las reglas universales de la experiencia, es decir, para "establecer la vinculación de causa a efecto entre dos sucesos, es necesario realizar un juicio retrospectivo de probabilidad o idoneidad cuya formulación es la siguiente: ¿la acción u omisión que se juzga per se es apta o adecuada para provocar normalmente esa consecuencia ? Ese juicio debe emplazarse no desde la óptica del sujeto actuante, sino en abstracto, en un plano objetivo, con prescindencia de lo efectivamente sucedido, atendiendo a lo que usualmente ocurre" (Goldenbert, 2001, p 28).* En virtud de lo anteriormente expuesto procede rechazar los agravios 1), 3), 6), 10), 11) y 12) supra resumidos, pues se ha probado el nexo causal conforme a la interpretación de la prueba que se ha hecho en esta Cámara, y no con el valor o ponderación que pretende darle el recurrente al conjunto probatorio que cita. * * VII. Por otro lado, en cuanto a los reproches atinentes a que el origen del problema sea porque no se utilizó semilla certificada (agravio 2), tampoco resultan de recibo. Ciertamente en la demanda, la parte actora reconoce que utilizó semilla que reservó de la cosecha anterior (hecho tercero a folio 10), y pese a que la parte demandada ha sostenido su defensa argumentando que por la baja calidad de la semilla, ésta era más vulnerable a malezas (al respecto aportó un artículo científico escrito sobre el tema "Certificación de semillas y control de calidad" visible a folio 148 a 157), es lo cierto que de acuerdo a la lógica y el "hecho técnico de la agricultura" como fuente de interpretación del Derecho Agrario, esa calidad de la semilla no se relaciona con la efectividad del producto en este caso. Según el testigo [Nombre3] , y los declarantes [Nombre9] y [Nombre10] (acta a folios 214 a 226 del expediente físico), la semilla germinó bien, con buen vigor, y que el problema que afectó al cultivo ya germinado, fue que no se controlaron las malezas. No era un tema de calidad de semilla lo que provocó el producto no sirviera o se perdiera, sino que las malezas del todo no respondieron a los productos recomendados y vendidos por parte de la demandada al actor. El cultivo se dañó porque la maleza no controlada la sobrepasó, y no porque una vez controlada, la semilla se debilitara o no resistiera, es por ello inaceptable que se pretenda descargar responsabilidad a través de este argumento. Otra censura al fallo o punto medular en este asunto es el argumento de la parte apelante que el actor aplicó productos de un tercero (agravios 4 y 5), sin seguir recomendaciones del técnico de su representada [Nombre5] ,* el cual por los motivos que se indicarán también resulta improcedente. Se tiene que en la contestación a la demanda, la parte demandada adujo al referirse al hecho doce, que la parte actora utilizó productos de otras casas comerciales y no aplicó los productos recomendados (folio 69). Ese hecho no ha sido reconocido por la parte actora en su réplica a la contestación (folio 106) ni en la confesional que rindiera (folio 214). Son dos testigos ofrecidos por la parte demandada -citados reiteradamente por la parte recurrente en su recurso de apelación- que laboran para la misma, señores [Nombre4] y [Nombre6] , quienes refirieron este tema. Así [Nombre4] (agente de ventas de la demandada), expuso que cuando visitó al actor por reclamos de éste por no poder controlar las malezas, observó una boleta expedida por un Ingeniero de nombre [Nombre8] , que le había recomendado un producto que no funcionó (folio 219). Sin embargo, aún considerando el interés en el asunto que tiene este testigo por ser agente de ventas de la parte demandada, debe de tomarse en cuenta el contexto general de esa declaración, conforme al principio de unidad de la prueba y libre valoración contemplado en el artículo 54 de la Ley de Jurisdicción Agraria. En primer término, señala que se apersona a la finca cuando ya había un disgusto del actor, en virtud de que un producto prescrito por [Nombre5] (Ingeniero de la demandada), no había funcionado y que cuando hizo la visita ya la maleza había sobrepasado el cultivo. Así las cosas, se entiende que ya se habían hecho las primeras aplicaciones, sin resultado, y de acuerdo a las reglas de la lógica y la psicología el disgusto provenía precisamente de ello. Se entiende que cuando se hace esta visita se estaba en la fase de control posterior cuando ya la maleza ha brotado, y que deben de aplicarse herbicidas específicos. Es por ello, que aún considerando que el actor no hiciera la segunda aplicación, cuando ya la maleza había brotado, conforme lo indicara el citado [Nombre5] el 19 de junio, es lo cierto que esto no desvirtúa el hecho de que la efectividad de las primeras aplicaciones de sello y resello fueron completamente nulas. Nótese que consta en autos, prueba documental, propiamente una segunda boleta expedida por el propio [Nombre5], de fecha 19 de junio del 2012 en la que se consignó el fallo del producto. Considerando que la aplicación ya verdaderamente post-emergente, se recomienda hasta el 19 de junio, y que las primeras aplicaciones se habían prescrito entre el 24 de abril -8 de mayo, que no funcionaron del todo, era comprensible, el actor, para pretender salvar su cultivo en una etapa tan vulnerable, y su zozobra económica, pudiese acudir al consejo de un tercero como plan remedial. Es evidente que hubo una intervención tardía de la demandada, pues cuando van a visitar ya la maleza había sobrepasado el cultivo, lo que se colige con solamente comparar las fechas de las boletas de folios 3 y 4. Aún cuando el actor hubiese seguido esas recomendaciones tardías emitidas en junio por parte de [Nombre7], existe prueba de que al haber cero efectividad de las aplicaciones preemergentes, la posibilidad de control era muchísimo más reducida. Conforme se ha reiterado en esta instancia, aunque no hay prueba contundente de que el actor hubiese aplicado otros productos no recomendados por la demandada, lo cierto es que sí hay elementos de que las aplicaciones de sello y resello fueron completamente ineficaces, de manera que la causa de mayor probabilidad razonable del porqué la maleza no se pudo controlar fue el producto o recomendación defectuosa de la demandada. En todo caso,* debía la parte demandada demostrar que la inclusión de otras sustancias, como el "clincher" en combinación con sus productos puede ser el motivo probable, por el cual no se podría controlar la maleza, y no meramente insinuar esa causalidad, dada la acreditación de un hecho tan contundente como que las primeras aplicaciones recomendadas por la demandada no funcionaron, y de que las segundas fueron ya tardías. Nótese además que el declarante [Nombre6] (Ingeniero Agrónomo que labora para la sociedad accionada), refiiró que observó en la boleta de ese tercer ingeniero la referencia del producto "clincher" para controlar la "echonocloa" y que era similar al Bispiribac Sodio (folio 223) Este último recomendado por la demandada. Es decir, productos similares. Lo anterior sin dejar de lado la contradicción de la parte demandada en su recurso de apelación al afirmar que nunca recomendó "Talcord", y en la boleta que emitió su regente sí se incluyó (folio 3). Nótese este testigo [Nombre4] , va a la finca hasta el mes de junio, y él mismo señala la maleza había sobrepasado cultivo, y en la boleta en que se formaliza el propio diagnóstico de [Nombre5] es del 19 de junio, de forma tal que no resulta atendible la versión de ese testigo que el actor no quiso seguir recomendaciones para una posterior aplicación o intervención, y que esa fuera la causa del descontrol de la maleza, pues cuando va a la finca coincide con la segunda intervención técnica de [Nombre5], bajo un contexto de maleza significativamente descontrolada. Del peritaje se puede desprender que la segunda aplicación es más para controlar escapes de malezas, pero no para sustituir, ya avanzado el cultivo, la eficacia nula de la etapa de sello y resello. Además debe de tomarse en cuenta que el diagnóstico de fallo del producto, valorado por el propio Ingeniero [Nombre5], se da en una fecha que ya estaba sobrepasada la maleza, de ahí que la causa probable de pérdida del cultivo no fue la inobservancia de las recomendaciones sobrevinientes. En todo caso hay prueba documental en autos, propiamente correo electrónico enviado al Juzgado de origen por parte de Cooproarrosur, de parte de su Jefa Administrativa Hazel Elizondo D. de que el actor no les compró el producto "Clincher", a raíz de solicitud del despacho en resolución de las catorce horas con seis minutos del diecisiete de febrero del dos mil dieciséis (folios 257 y 255), puesto en conocimiento de las partes por el plazo tres días en resolución de las catorce horas con veintiocho minutos del veintinueve de febrero del dos mil dieciséis (folio 257), sin que la parte demandada se manifestara al respecto. * * * * * IX. En otro orden de consideraciones, tocante a lo que refirió el testigo [Nombre4] , de que "las boquillas del Bum" no estaban funcionando bien y ello pudo haber influido en la efectividad de la aplicación, tampoco son atendibles. El testigo [Nombre9] , quien fue contratado por el actor para hacer la preparación y mantenimiento de la siembra de arroz, y qué él se encargaba de que las máquinas y riegos estuvieran a tiempo, y que en ese caso el equipo de riego él constataba que estuviera en buen estado, los motores empacados, las boquillas en buen estado, y que las horas de aplicación eran de cinco de la mañana a más tardar diez de la mañana por la situación del viento (folio 221). Asimismo [Nombre10] , operador agrícola contratado por el actor, manifestó que participó haciendo el sello y el resello, y que se hizo con un BUM nuevo (folio 225). El único que refiere que refiere que hubo un problema con las boquillas del BUM fue el señor [Nombre4] , quien es agente de ventas de la demandada, pero en realidad no da fe de que estuvieran en mal estado durante las aplicaciones, pues nunca estuvo presente en las mismas, sino que escuchó que en un día no se pudo usar Bum por lo de las boquillas, pero es un dato que en forma alguna puede venir a acreditar que esa sea el motivo de la falta de efectividad del producto, si se considera hay dos testigos que acreditan lo contrario. Por otro lado, en cuanto se tuviera por demostrado que la parte demandada aceptó pagar los daños ocasionados (agravio 8), que según la apelante no es dable tenerlo por probado, lleva razón la parte, pero ello no cambia lo resuelto en esta instancia. Lo anterior porque ciertamente no hay otros elementos, distintos a la confesional ficta, que acrediten una admisión o anuencia a pagar los daños y perjuicios. Una cosa es la boleta del 19 de junio, tantas veces mencionada, que reconoce el producto falló, y otra que la parte demandada accediera a pagar los extremos acá reclamados. de ahí que para este punto en particular no sea procedente aplicar la confesional como única prueba. * * * * * * * * * X. Por último en cuanto al reproche de las costas, tampoco resulta atendible. Este asunto inició antes de la entrada en vigencia del nuevo Código Procesal Civil, de ahí que se aplique el anterior, conforme al transitorio I. Propiamente el ordinal 222 del anterior cuerpo legal, dispone la posibilidad de eximir pero cuando se hayan rechazado parte de las pretensiones fundamentales de la demanda. Acá se han acogido la mayoría de los daños y perjuicios reclamados, de ahí que no proceda la exención y deba de confirmarse lo resuelto en ese sentido. * * XI.
