Decision: 2019-1453 Case file: 11-002910-0485-PE(15) CRIMINAL JUDGMENT APPEALS COURT. Second Judicial Circuit of San José. Goicoechea, at eight thirty-five a.m., on veintitrés de agosto de dos mil diecinueve.- APPEAL (RECURSO DE APELACIÓN) filed in these proceedings against Nombre01 , of legal age, Costa Rican, identity card number CED01 , born in Cartago on 5 de Nombre01 de 1938, son of Nombre02 and Nombre03, married, retired, resident of Limón, Guápiles; for the offense of VIOLATION OF THE LEY FORESTAL, to the detriment of THE LEY FORESTAL. Judges Gustavo Adolfo Rojas Gutiérrez and Alberto García Chaves and Judge Hannia Soto Arroyo participated in deciding the appeal. Attorney David Retana Jiménez, public defender for the accused, entered an appearance before this Court.
WHEREAS:
I.By judgment number 07-2019, issued at seven thirty a.m. on diez de enero de dos mil diecinueve, the Criminal Trial Court of the Second Judicial Circuit of the Atlantic Zone, Pococí Seat, ruled: “POR TANTO: Pursuant to the foregoing, Articles 39 and 41 of the Political Constitution, 1, 360, 361, 363 through 366 of the Code of Criminal Procedure, 1045 of the Civil Code, 2, 6, 10, 19, and 38 of the Ley Forestal, 52 of the Soil Use, Management, and Conservation Law, 53, 54, and 55 of the Organic Law of the Environment, and 53 and 54 of the Biodiversity Law, Nombre01 Nombre01 is acquitted of all punishment and liability for the acts charged by the Public Prosecutor’s Office and the Office of the Attorney General of the Republic. In the criminal proceedings, no special award of costs (costas) is made. The lifting of any precautionary measure (medida cautelar) imposed on the accused by reason of the acts at issue in these proceedings is hereby ordered.
The civil damages action (acción Civil Resarcitoria) brought by the Office of the Attorney General of the Republic against civil defendant (Demandado Civil) Nombre01 is declared partially sustained, and an unliquidated award (condena en abstracto) is entered for payment of the damage caused to the environment, as well as for payment of the statutory and default interest accruing from the date the judgment becomes final until payment in full. The civil defendant is ordered to pay attorney fees and court costs (costas personales y procesales). It is ordered that, for a period not exceeding quince años, the affected area shall remain free from any type of human intervention that could affect the natural regeneration of the forest within the area at issue in these proceedings. Accordingly, Mr. Nombre04 is hereby warned that he must not permit any type of activity in the referenced area and that, should he do so, he could commit the offense of Disobedience of Authority and could be prosecuted for that offense. The Ministry of Environment and Energy (MINAE) shall conduct periodic inspections, at least once cada seis meses, to verify that the natural regeneration of the forest in the
affected area is being allowed. The parties are hereby orally notified of the judgment.” (sic.).
III.Following the corresponding deliberation in accordance with Article 465 of the Code of Criminal Procedure (as amended by Laws Nº 8837 and Nº 9021 and following the numbering specified in the Errata adopted by resolution of the legislative
directorate published in La Gaceta Nº 51 of 12 de marzo de 2012, which is the numbering used in this text), the Court considered the issues raised in the appeal.
Criminal Judgment Appeals Judge Rojas Gutiérrez drafts the opinion; and,
CONSIDERING:
I.Attorney David Retana Jiménez, in his capacity as public defender for the accused Nombre01, filed an appeal against judgment N°07-2019, issued by the Criminal Trial Court of the Second Judicial Circuit of the Atlantic Zone, Guápiles Seat, at 07:30 hours on 10 de enero 2019, which acquitted the accused Nombre01 of all punishment and liability; however, the civil damages action brought by the Office of the Attorney General of the Republic was declared partially sustained, and an unliquidated award was entered. In addition, human intervention on the affected property was prohibited for a period of no less than quince años. A review of the record shows that the appeal was filed timely, within the statutory period, and in accordance with the requirements necessary for the challenge (impugnación) to permit proper and correct consideration of the objections raised by the appellant, as part of a comprehensive review of the challenged judgment, as established by Article 8.2h of the American Convention on Human Rights and Articles 458, 459, 460, and 462 of the Code of Criminal Procedure.
II.As the first ground for appeal, the defense claims that the court below violated the principle of legality by imposing limitations on Mr. Nombre04’s property rights, thereby exceeding its powers and authority. It adds that, in the present case, his client, defendant Nombre01, was prosecuted for the offense of land-use change (cambio de uso de suelo) on property belonging to his son, Nombre04, the latter having had the case against him dismissed and not having been a party to the adversarial proceedings. It further states that the trial resulted in a favorable outcome for his client, Mr. Nombre01, who was acquitted of all punishment and liability for the offense charged against him and that, despite this, the judge ordered in the judgment that no changes could be made to that property for the next fifteen years, which is contrary to the property rights governed by the Código Civil and the Constitución Política.
He asserts that, because the judgment was delivered orally, Mr. Nombre04 was admonished in the courtroom, as he was there accompanying his father, the defendant. The appellant asks: What may the owner do if he wishes to sell to a third party? What happens to that 15-year restriction? Would it remain in force for the new owner? Could this new owner be prosecuted for an offense? In addition to all the foregoing, it must be considered that the defendant was acquitted of the alleged acts and that it was also established that, had those acts occurred, prosecution of them would have been time-barred. He argues that the judgment creates prejudice in two respects: first, because it limits property rights and, second, because it affects the rights of third parties. He therefore requests that the property restriction imposed and the consequences of the admonition given to Mr. Nombre04 be removed from the judgment.
The parties were given an opportunity to respond to the appeal. No one made any submissions in that regard. This ground is denied. Although this Chamber could simply declare the claim inadmissible because the appellant lacks standing, given that what is presented is a disagreement with the application of the principle of forest-cover permanence (principio de irreductibilidad de los bosques) to Mr. Nombre04’s property and that the ruling neither affects nor causes prejudice to the interests of defendant Nombre01, this Court considers it important to address the matter. In the oral judgment contained in digital file 110029100485PE-10012019073743-2_Multi--0, beginning at minute 01:14:10 according to the counter, the judge states that, although the defendant’s criminal participation in the commission of the offense was not proven, the existence of the land-use change, illegal logging (tala ilegal), and environmental damage (daño ambiental) in the forest was proven; therefore, applying the principle of forest-cover permanence, he deemed it proportionate, in accordance with the expert report submitted, to prohibit any activity on that property for a period of no less than fifteen years, as recommended by the environmental expert.
By virtue of the foregoing, he ordered the owner, in this case Mr. Nombre04, to refrain from engaging in any activity, on pain of committing the offense of disobedience of authority. This Chamber agrees with the court below because, in Costa Rica, the system of ownership of real property is subject to a series of restrictions arising precisely from the provisions of Article 50 of the Constitución Política and from the Fundamental Right to a Healthy and Ecologically Balanced Environment (Derecho Fundamental a un Ambiente Sano y Ecológicamente Equilibrado). Accordingly, restrictions have been imposed on property rights, as reflected in Articles 13 and 14 of Ley número 7575 (Ley Forestal), which state: “ARTICLE 13.- Establishment and administration. The State’s natural heritage (patrimonio natural del Estado) shall consist of the forests and forest lands of national reserves, areas declared inalienable, properties registered in its name, and those belonging to municipalities, autonomous institutions, and other bodies of the Administración Pública, except for real property securing credit transactions with the Sistema Bancario Nacional that becomes part of its assets.
The Ministerio del Ambiente y Energía shall administer this heritage. When appropriate, acting through the Procuraduría General de la República, it shall register the lands in the Registro Público de la Propiedad as individually identified properties owned by the State. Nongovernmental organizations that acquire real property containing forest or suited for forestry, using funds from donations or the public treasury that were obtained in the name of the State, shall transfer such property into the State’s name. ARTICLE 14.- Exemption from attachment and inalienability of the natural heritage. The forest lands and forests constituting the State’s natural heritage, as detailed in the preceding article, shall be exempt from attachment and inalienable; their possession by private parties shall create no rights in their favor, and the State’s action to recover those lands shall not be subject to any statute of limitations.
Consequently, they may not be registered in the Registro Público through possessory information proceedings (información posesoria), and both their invasion and occupation shall be punished in accordance with this law.” The provision establishes the absolute exclusion of private parties from exercising property rights over what is known as the State’s natural heritage, that is, the forests and forest lands of national reserves, areas declared inalienable, properties registered in the name of the State, and those belonging to municipalities, autonomous institutions, and other bodies of the Administración Pública. The law itself declares such real property inalienable and exempt from attachment and even provides that it comprises assets over which private parties, even when in possession thereof, may not perfect any right, for example through adverse possession (usucapion) or acquisitive prescription (prescripción positiva).
Likewise, Article 19 of the aforementioned law imposes limitations on the private-property regime applicable to land with forest cover (cobertura boscosa) and states: “Forest management (Manejo de bosques). ARTICLE 19.- Authorized activities. On forest-covered land, changing the use of the soil or establishing forest plantations shall not be permitted. Nevertheless, the Administración Forestal del Estado may grant permits in those areas for the following purposes: a) Constructing dwellings, offices, stables, corrals, nurseries, roads, bridges, recreational and ecotourism facilities, and other similar improvements on privately owned land and properties where forests are located. b) Carrying out public or private infrastructure projects of national interest. c) Cutting trees for reasons of human safety or scientific interest. d) Preventing forest fires, natural disasters, or other similar causes or their consequences.
In such cases, forest cutting shall be limited, proportionate, and reasonable for the purposes stated above. A preliminary screening questionnaire must first be completed before the Administración Forestal del Estado to determine whether an environmental impact assessment (evaluación del impacto ambiental) may be required, as provided by the regulations to this law.” (Boldface supplied.) As may be seen, the restrictions on private-property rights include: i.- the prohibition against land-use changes; ii.- the mandatory application for and granting of permits to cut the forest, and the restriction of that activity through proportionality criteria; iii.- the required preparation of management plans (planes de manejo), subject to mandatory prior approval by the Administración Forestal del Estado, when a private party seeks to exploit a forest located on real property, among others. Further examples of limitations on real-property rights include the designation of protection areas (áreas de protección) alongside springs (nacientes); on the banks of rivers, creeks, and streams; around natural and artificial lakes and reservoirs; and in recharge areas and spring aquifers (Article 33 of Ley Forestal).
In those areas, even when located on privately owned land, there are prohibitions against exploitation, logging, or tree removal and, as is relevant to the proper resolution of this issue, there is also a prohibition against encroachment (and therefore construction) both in conservation areas and in the aforementioned protection areas (Article 58 of Ley Forestal). It may be concluded with certainty from this statutory prohibition that no one could legitimately assert a right to exploit forest resources or to encroach upon those spaces located within a protection area. On that basis, no third party may claim a legitimate right to prevent or hinder the restoration of those areas, given the legal restrictions governing property rights. Now, considering the foregoing and given that the property owner, Mr. Nombre04, is already aware that the affected forest must be restored, even though he is under no obligation to carry out the restitution, he is required to comply with the order and permit the property’s natural regeneration for those purposes, without thereby affecting other legitimate aspects of his property rights.
Accordingly, although in the present matter it was not possible to determine who committed the violation and, therefore, who is directly obligated to carry out the restitution and restoration of the affected forest, in light of the Costa Rican State’s duty to provide effective protection for the Fundamental Right to a Healthy and Ecologically Balanced Environment, such restoration of the affected area must occur in every case involving environmental damage, as in this case. In view of the foregoing, there was no violation of the principle of legality, nor did the judge exceed his powers and authority as a judicial official, because he was obligated to address the restoration of matters to their prior condition, even though the persons responsible for the charged unlawful acts were not identified. The order is a consequence arising in the present matter from the principle of forest-cover permanence, which requires the reparation of damage caused to the environment, as the judge properly explained in the judgment. By virtue of the foregoing, the asserted ground is denied.
III.As the second ground for challenge, the appellant claims that the a quo failed in its duty to provide reasons when partially granting the civil damages action (acción civil resarcitoria), given that his client was acquitted of all criminal liability and responsibility, because it was established only that the action carried out by the accused consisted of undergrowth clearing (socola) (clearing or cutting part of the understory), without this being considered a criminal offense, together with the fact that the accused had no involvement whatsoever in the property where the land-use change (cambio de uso del suelo) was detected; nevertheless, the existence of damage was found without specifically establishing how it was possible to determine such damage, given that the assessment of the property damage was conducted based on the area of 841 meters, which has nothing to do with the acts for which the accused was acquitted.
By virtue of the foregoing, he requests that the claim be granted and the civil judgment be set aside. As alternative relief, he requests that the case be remanded for new proceedings concerning the challenged issue. The parties were given an opportunity to respond to the appeal. No one submitted a response. The claim is denied. Upon review of the oral judgment contained in digital file 110029100485PE-10012019073743-2 _Multi--0, beginning at minute 01:04:01 according to the counter, the judge stated that, although the acts charged as the offense of land-use change could not be attributed to the accused, the factual allegations underlying the civil damages action were nevertheless partially established: “1. On diez de mayo del año dos mil once, at approximately diez horas, the defendant Nombre01 was caught by MINAE officials, machete in hand and within a forest area, clearing undergrowth at the site over an area of at least 526 square meters, without authorization from the State Forestry Administration (Administración Forestal del Estado).
Specifically, the defendant was found within the property located in the Sector de Buenos Aires de Pococí, between vertical coordinates N 1123861, horizontal coordinates E: 523418 (CRTM 05 projection), owned by co-defendant Nombre04. 2. As a consequence of the aforementioned activity within the site in question, considerable damage to the environment was caused. Land-use change may occur only with the express authorization of the State; accordingly, any conduct involving land-use change has serious consequences for our forests, their flora and fauna, and climate change. (Copied verbatim from the minutes on the reverse of folio 168). Based on the foregoing factual foundation, although the described conduct did not constitute the offense, it is nevertheless true, as the a quo properly reasoned, that it was established—and there was no dispute in this regard—that the defendant cleared undergrowth (cutting part of the understory) in a forested area.
Although this cannot be considered conduct constituting the offense of land-use change, environmental damage did result from the intentional conduct of the civil defendant, and on that basis the civil liability of Mr. Nombre01 was justified. There was no failure to provide reasons: the judgment stated that the duty to compensate arose under Article 1045 of the Civil Code (Código Civil), which provides: “Anyone who, through willful misconduct, fault, negligence, or imprudence, causes harm to another is required to repair it, together with the resulting losses.” Although the conduct was intentional, it is true that it was not criminal; nevertheless, the defendant’s clearing of undergrowth in a forest area damaged the environment, as the a quo noted. What could not be determined at trial, considering that the expert report (informe pericial) was generic, was the amount of environmental damage caused by that conduct; because there was no objective evidence with which to determine it, liability was imposed with the amount of damages left undetermined (condena en abstracto).
The judgment analyzed standing to sue and be sued (legitimación activa y pasiva), the duty to compensate, and the existing causal nexus (nexo causal), and explained the basis for each of these aspects. The appellant confuses the civil liability that might have arisen from the existence of the offense—which could not be proven against his client and for which he was acquitted and the civil claim denied—with the fact that the clearing of undergrowth did occur and caused damage that could not be quantified when the judgment was issued. In this regard, it is necessary to refer to the holding of the First Chamber of the Supreme Court of Justice (Sala Primera de la Corte Suprema de Justicia): “It is likewise important to consider, because of its bearing on evidentiary matters, that the determining elements for civil liability to arise, whether subjective or strict liability (responsabilidad civil subjetiva u objetiva), are: harmful conduct (which may be active or passive, lawful or unlawful), the existence of damage (that is, injury to a protected legal interest), a causal nexus connecting the preceding two elements, and, in most cases, verification of a basis for attribution (criterio de atribución), which will depend on the specific legal regime.
Regarding causation, it must be noted that this is a case-specific assessment conducted by the adjudicator, who determines, based on the facts, whether a relationship exists between the claimed damage and the conduct carried out by the economic agent. Although various theories exist on the subject, the one considered most consistent with the Costa Rican legal regime is the theory of adequate causation (causalidad adecuada), under which damage and conduct are connected when the former arises from the latter, if not necessarily, then at least with a high degree of probability in light of the specific circumstances bearing on the matter (in this regard, see, among others, decisions 467-F-2008 at 14 horas 25 minutos on 4 de Nombre01 de20085, and 1008-F-2006 at 9 horas 30 minutos on 21 de diciembre de 2006). On this point, it is important to clarify that proof of exonerating causes (causas eximentes)—fault of the victim, an act of a third party, or force majeure—operates upon the causal nexus, ruling out the possibility that the conduct attributed to the defendant was what caused the injury sustained.” (Decision number 399-F-2009, at 10:45 horas on 23 de abril de 2009; to the same effect, see decision 398-F at 10:40 horas on the same day and year) (Boldface added). Accordingly, all the elements required to establish the defendant’s subjective civil liability were addressed and justified, and the claim therefore cannot succeed.
THEREFORE:
The appeal filed by attorney David Retana Jiménez, as public defender for defendant Nombre01, is denied. Resolución: 2019-1453 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las ocho horas treinta y cinco minutos, del veintitrés de agosto de dos mil diecinueve.- RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra Nombre01 , mayor, costarricense, cédula de identidad número CED01 , nacido en Cartago el 5 de Nombre01 de 1938, hijo de Nombre02 y Nombre03, casado, pensionado, vecino de Limón, Guápiles; por el delito de INFRACCIÓN A LA LEY FORESTAL, en perjuicio de LA LEY FORESTAL. Intervienen en la decisión del recurso los jueces Gustavo Adolfo Rojas Gutiérrez, Alberto García Chaves y la jueza Hannia Soto Arroyo. Se apersonó en esta sede el licenciado David Retana Jiménez, defensor público del encartado.
RESULTANDO:
I.Que mediante sentencia número 07-2019, de las siete horas treinta minutos, del diez de enero de dos mil diecinueve, el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, Sede Pococí resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política, 1, 360, 361, 363 a 366 del Código Procesal Penal, 1045 del Código Civil, 2, 6, 10, 19 y 38 de la Ley Forestal, 52 de la Ley de Uso, Manejo y Conservación de Suelos, 53, 54 y 55 de la Ley Orgánica del Ambiente, 53 y 54 de la Ley de Biodiversidad, se absuelve de toda pena y responsabilidad a Nombre01 Nombre01 por los hechos acusados por el Ministerio Público y la Procuraduría General de la República. En lo penal se falla sin especial condenatoria en costas. Se ordena el levantamiento de cualquier medida cautelar que pese sobre el encartado en razón de los hechos objeto de esta causa. Se declara parcialmente con lugar la acción Civil Resarcitoria incoada por la Procuraduría General de la República en contra del Demandado Civil Nombre01 y se condena en abstracto el pago de los daños ocasionados al ambiente así como al pago de los intereses legales y moratorios que se generen hasta el pago efectivo y desde que la sentencia quede en firme.
Se condena al demandado Civil al pago de las costas personales y procesales. Se ordena que por un plazo no mayor a quince años. Se mantenga la zona afectada sin ningún tipo de intervención humana que afecte la regeneración natural del bosque, dentro del área objeto de este proceso. Por lo anterior, se apercibe al señor Nombre04, de que no debe permitir ningún tipo de actividad en la zona referida y de hacerlo podría incurrir en delito de Desobediencia a la Autoridad y se le podrá seguir causa por dicho delito. En Ministerio de Ambiente y Energía (MINAE), deberá realizar inspecciones periódicas, al menos una cada seis meses, para comprobar que se está permitiendo la regeneración natural del bosque en la zona
afectada. Quedan las partes informadas de la sentencia en forma oral." (sic.).
II.Que contra el anterior pronunciamiento interpuso recurso de apelación el licenciado David Retana Jiménez, defensor público del encartado.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal (reformado por leyes Nº 8837 y Nº 9021 y siguiendo la numeración indicada en la Fe de Erratas adoptada mediante acuerdo del directorio
legislativo publicado en La Gaceta Nº 51 del 12 de marzo de 2012, que es la que se usará en este texto), el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.
Redacta el juez de Apelación de Sentencia Penal Rojas Gutiérrez; y,
CONSIDERANDO:
I.El licenciado David Retana Jiménez, en su condición de defensor público del encartado Nombre01, interpuso recurso de apelación en contra de la sentencia N°07-2019, dictada por el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, sede Guápiles, de las 07:30 horas del 10 de enero 2019, en la que se absolvió de toda pena y responsabilidad al encartado Nombre01, sin embargo se declaró con lugar parcialmente la acción civil resarcitoria, incoada por la Procuraduría General de la República, y fijándose la condena en abstracto. Además se ordenó la prohibición de intervención humana en la propiedad afectada por un plazo no menor a quince años. Del estudio del sumario se colige que dicho recurso se presentó en tiempo, conforme al plazo de ley, y de acuerdo con los presupuestos que se requieren para que dicha impugnación posibilite el adecuado y correcto conocimiento de las inconformidades planteadas por el gestionante, en orden al examen integral de la sentencia impugnada, tal y como lo establece el artículo 8.2h de la Convención Americana sobre Derechos Humanos, y los artículos 458, 459, 460 y 462 del Código Procesal Penal.
II.La defensa, como primer motivo de impugnación reclama que el a quo, violentó el principio de legalidad, al imponer limitaciones al derecho de propiedad del señor Nombre04, con lo que el juzgador se extralimitó en sus competencias y atribuciones. Agrega que en el presente caso, se persiguió a su representado el imputado Nombre01 por un delito de cambio de uso de suelo, en la propiedad de su hijo Nombre04, éste último quién fue sobreseído y no formó parte del contradictorio. Adiciona que el juicio resultó favorable a su representado el señor Nombre01, a quien se le absolvió de toda pena y responsabilidad del delito que se le atribuyó y, pese a ello, el juez ordenó en sentencia que no se puede realizar ningún cambio en dicha propiedad por los próximos quince años, y ello, es contrario al derecho de propiedad, regulado en el Código Civil y en la Constitución Política. Estima que al haberse dictado la sentencia en forma oral, se le previene al señor Nombre04, en la sala de juicio, dado que el mismo se encontraba acompañando a su padre, el imputado.
Cuestiona el recurrente, ¿qué podrá hacer el propietario si quiere vender a un tercero? o ¿qué pasa con esa restricción de 15 años?, ¿Estaría vigente para el nuevo propietario? ¿Se le podría seguir delito a este nuevo propietario?. Aunado a todo lo anterior, debe considerarse que se absolvió de los hechos al imputado, y que además se estableció que de haberse dado los mismos, estarían prescritos. Fustiga que, la sentencia genera un gravamen en doble sentido, primero porque limita el derecho de propiedad y, segundo, dado que afecta el derecho de terceras personas. Por ello, solicita se suprima de la sentencia, la limitación de propiedad impuesta y, las consecuencias respecto de la prevención que se le realizó al señor Nombre04. Se dio audiencia a la partes del recurso. Nadie se manifestó al respecto. Se declara sin lugar el motivo. Si bien esta Cámara podría optar en forma sencilla, por declarar el reclamo inadmisible, al no contar con legitimación el impugnante, dado que lo que se expone es una inconformidad con la aplicación del principio de irreductibilidad de los bosques, en la propiedad del señor Nombre04, y que lo decidido no afecta ni genera agravio en los intereses del acusado Nombre01, considera éste Tribunal, que es importante referirse al respecto.
En la sentencia oral que consta el archivo digital 110029100485PE-10012019073743-2_Multi--0, a partir del minuto 01:14:10 según el contador, se sostiene por parte del juez, que aunque no se demostró la participación criminal del acusado en la comisión del delito, si fue probado la existencia del cambio de uso de suelo, la tala ilegal y el daño ambiental en el bosque, y por ello, en aplicación del principio de irreductibilidad de los bosques, estimó proporcional conforme al peritaje rendido, imponer la prohibición de no realizar ninguna acción en dicha propiedad por un plazo no menor a los quince años, como lo recomendó el perito ambiental. En virtud de lo anterior, ordenó al propietario, en este caso al señor Nombre04, se abstenga de realizar cualquier actividad so pena de cometer el delito de desobediencia a la autoridad. El criterio del a quo es compartido por ésta Cámara, dado que en Costa Rica, el régimen de propiedad sobre bienes inmuebles tiene una serie de restricciones que devienen, justamente, de la regulación que ha hecho la Constitución Política, en su artículo 50, y del Derecho Fundamental a un Ambiente Sano y Ecológicamente Equilibrado.
Así las cosas, se han impuesto restricciones al derecho de propiedad, y, como consecuencia de lo anterior, se aprecia, lo establecido en la Ley número 7575 (Ley Forestal) en los artículo 13 y 14, que dicen: "ARTÏCULO13.- Constitución y administración. El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio. El Ministerio del Ambiente y Energía administrará el patrimonio. Cuando proceda, por medio de la Procuraduría General de la República, inscribirá los terrenos en el Registro Público de la Propiedad como fincas individualizadas de propiedad del Estado.
Las organizaciones no gubernamentales que adquieran bienes inmuebles con bosque o de aptitud forestal, con fondos provenientes de donaciones o del erario, que se hayan obtenido a nombre del Estado, deberán traspasarlos a nombre de este. ARTICULO 14.- Condición inembargable e inalienable del patrimonio natural. Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley." Se extrae de la norma, la exclusión absoluta de ejercicio de aquel derecho patrimonial para particulares, que se hace respecto del denominado patrimonio natural del Estado, es decir, los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a nombre de dicho Estado y de las pertenecientes a las municipalidades, instituciones autónomas y demás organismos de la Administración Pública; inmuebles para los cuales la propia ley declara su condición de inalienables e inembargables, e incluso estipula que se trata de bienes sobre los cuales los particulares, aún cuando los posean, no podrán consolidar derecho alguno, verbigracia por vía de usucapion o prescripción positiva.
De igual forma, el artículo 19 de la citada ley, impone limitaciones al régimen de la propiedad privada en terrenos con cobertura boscosa, y dice: "Manejo de bosques. ARTICULO 19.- Actividades autorizadas. En terrenos cubiertos de bosque, no se permitirá cambiar el uso del suelo, ni establecer plantaciones forestales. Sin embargo, la Administración Forestal del Estado podrá otorgar permiso en esas áreas para los siguientes fines: a) Construir casas de habitación, oficinas, establos, corrales, viveros, caminos, puentes e instalaciones destinadas a la recreación, el ecoturismo y otras mejoras análogas en terrenos y fincas de dominio privado donde se localicen los bosques. b) Llevar a cabo proyectos de infraestructura, estatales o privados, de conveniencia nacional. c) Cortar los árboles por razones de seguridad humana o de interés científico. d) Prevenir incendios forestales, desastres naturales u otras causasanálogas o sus consecuencias.
En estos casos, la corta del bosque será limitada, proporcional y razonable para los fines antes expuestos. Previamente, deberá llenarse un cuestionario de preselección ante la Administración Forestal del Estado para determinar la posibilidad de exigir una evaluación del impacto ambiental, según lo establezca el reglamento de esta ley." (La negrita se suple). Como se desprende, dentro de las restricciones al derecho de la propiedad privada, están: i.- las prohibición para el cambio en el uso de suelos; ii.- la obligatoria solicitud y concesión de permisos para cortar el bosque, y la restricción de esa acción mediante criterios de proporcionalidad; iii.- la necesaria conformación de planes de manejo, de obligatoria aprobación previa por la Administración Forestal del Estado, si lo que se pretende un particular es aprovechar un bosque ubicado en una propiedad inmueble, entre otras. Existen más ejemplos de limitación al derecho de propiedad sobre inmueble, la declaratoria de áreas de protección junto a nacientes, en las riberas de los ríos, quebradas y arroyos, así como también de los lagos y embalses naturales y artificiales, así como en las áreas de recarga y en los acuíferos de los manantiales (artículo 33 de la Ley Forestal).
Para esas zonas, aún cuando estén ubicadas en terrenos de dominio particular, existen prohibiciones de aprovechamiento, de tala o eliminación de árboles y, en lo que resulta relevante para la adecuada resolución de este tema, también existe una prohibición de invadir (ergo, de construir) tanto en zonas de conservación, como en las zonas de protección indicadas (art 58 de la Ley Forestal). De esta prohibición legal puede derivarse, con certeza, que nadie podría esgrimir legítimamente un derecho con el fin de aprovechar los recursos forestales, o para invadir esos espacios ubicados en una zona de protección. Con fundamento en ello, no puede ningún tercero alegar un derecho legítimo para impedir u obstaculizar que dichas áreas sean restauradas, en razón del régimen de restricción legal del derecho de propiedad. Ahora bien, tomando en consideración lo expuesto, y partiendo de que el propietario del inmueble, el señor Nombre04, ya tiene conocimiento de que se debe restaurar el bosque afectado, aún y cuando no tiene la obligación de restituir, sí está obligado a obedecer y permitir la regeneración natural del inmueble para tales efectos, sin que con ello se puedan afectar otros extremos legítimos de su derecho de propiedad.
Así las cosas, aunque en el presente asunto no se pudo determinar quién fue el infractor y por ello, quién es el obligado directo a cumplir con la restitución y restauración del bosque afectado, partiendo del deber que tiene el Estado costarricense de dar tutela efectiva del Derecho Fundamental a un Ambiente Sano y Ecológicamente equilibrado, tal restauración en la zona afectada, debe proceder en todos los casos en que se da un daño ambiental, como lo es, en este caso. Dicho lo anterior, no existió violación alguna al principio de legalidad, ni se extralimitó el juzgador en sus competencias y atribuciones como autoridad judicial, dado que era su obligación referirse sobre la restitución de las cosas a su estado anterior, ello a pesar, de que no se determinó quienes fueron los autores responsables de los ilícitos acusados. Lo dispuesto, es una consecuencia que surge en el presente asunto del principio de irreductibilidad del bosque, que establece la necesaria reparación de los daños causados al ambiente, como bien, lo desarrolló el juez en sentencia. En virtud de lo anterior, se declara sin lugar el motivo esgrimido.
III.El recurrente, como segundo motivo de impugnación, reclama que el a quo, faltó a su deber de fundamentación para acoger parcialmente la acción civil resarcitoria, dado que se absolvió de toda pena y responsabilidad a su representado, por cuanto sólo se tuvo por demostrado que la acción realizada por el endilgado consistió en realizar una socola (chapear o cortar parte del sotobosque), sin que esto fuera considerado delito, aunado a que en la propiedad donde se detectó el cambio de uso del suelo, el sindicado no tuvo participación alguna, pero a pesar de ello, se acogió la existencia de un daño, sin establecer en forma concreta cómo fue posible establecerlo, dado que la valoración del daño patrimonial, se realizó sobre el área de 841 metros, la que no tiene nada que ver con los hechos por los cuales se absolvió el acusado. En virtud de lo anterior, solicita se declare con lugar el reclamo y se deje sin efecto la condena civil.
Presenta, como petición subsidiaria, que se ordene el reenvío para nueva sustanciación sobre el extremo impugnado. Se dio audiencia a la partes del recurso. Nadie se manifestó al respecto. Se declara sin lugar el reclamo. Revisada la sentencia oral, que consta en el archivo digital 110029100485PE-10012019073743-2 _Multi--0, a partir del minuto 01:04:01 según el contador, se expuso por parte del juzgador que, a pesar de que los hechos acusados del delito de uso de cambio de suelo no se le pudieron atribuir al endilgado, sí se tuvo por demostrado parcialmente el cuadro fáctico de la acción civil resarcitoria: "1. El día diez de mayo del año dos mil once, al ser aproximadamente las diez horas, el encartado Nombre01 fue sorprendido por los funcionarios del MINAE, con machete en mano y dentro de un área de bosque, realizando un socola del sitio en al menos 526 metros cuadrados, sin permiso de la Administración Forestal del Estado.
Propiamente el encartado fue hallado dentro del inmueble ubicado en el Sector de Buenos Aires de Pococí, entre las coordenadas verticales N 1123861, Horizontales E: 523418 (proyección CRTM 05), propiedad del co encartado Nombre04. 2. Como consecuencia de la actividad dicha dentro del sitio en cuestión, se generó un daño considerable al ambiente. El cambio de uso de suelo sólo puede darse por autorización expresa del Estado, de modo que cualquier conducta que implique cambio de uso, trae consecuencias graves a nuestros bosques, su flora y fauna y el cambio climático. (La copia es textual de la minuta de folio 168 vuelto). Partiendo de la anterior plataforma fáctica, si bien la acción descrita no configuró el delito, es lo cierto, como bien lo fundamentó el a quo que, se pudo acreditar y no existió contención en ello, que el demandado realizó una socola (cortar parte del sotobosque) en zona boscosa, y si bien, esto no puede ser considerado una acción propia del delito de cambio de uso de suelo, si existió un daño ambiental con el actuar doloso del demandado civil, y a partir de este fundamento, se justificó la responsabilidad civil del señor Nombre01.
No existe falta de fundamentación, el fallo expresó la existencia del deber de resarcir a partir del artículo 1045 de Código Civil que establece: "Todo aquel que por dolo, falta, negligencia o imprudencia, causa a otro un daño, está obligado a repararlo junto con los perjuicios". Dado que la acción fue dolosa, si bien es cierto no es delictiva, con la socola realizada por parte del demandado en una zona de bosque, se dañó el medio ambiente, como lo puntualizó el a quo, lo que no se pudo determinar en el juicio, tomando en cuenta que el informe pericial es genérico, fue cuantificar el daño ambiental, que produjo dicha acción, y al no existir prueba objetiva para determinarlo, se condenó en abstracto. El fallo analizó la legitimación activa y pasiva, la obligación de resarcir y el nexo causal existente, y desarrolló el fundamento de cada de uno de estos aspectos. El recurrente confunde la responsabilidad civil que pudo haber surgido de la existencia del delito, que no se pudo demostrar a su representado y por el cual se le absolvió y declaró sin lugar el reclamo civil, sin embargo, el daño realizado por la socola existió y generó un daño que al momento de emitir la sentencia no era cuantificable.
Al respecto, resulta necesario referir lo dicho por la Sala Primera de la Corte Suprema de Justicia: “Asimismo, es importante considerar, por su influencia en el tema probatorio, que los elementos determinantes para el surgimiento de la responsabilidad civil, sea esta subjetiva u objetiva, son: una conducta lesiva (la cual puede ser activa o pasiva, legítima o ilegítima), la existencia de un daño (es decir, una lesión a un bien jurídico tutelado), un nexo de causalidad que vincule los dos anteriores, y en la mayoría de los casos la verificación de un criterio de atribución, que dependerá del régimen legal específico. En cuanto a la causalidad, es menester indicar que se trata de una valoración casuística realizada por el juzgador en la cual, con base en los hechos, determina la existencia de relación entre el daño reclamado y la conducta desplegada por el agente económico. Si bien existen diversas teorías sobre la materia, la que se ha considerado más acorde con el régimen costarricense es la de causalidad adecuada,según la cual existe una vinculación entre daño y conducta cuando el primero se origine, si no necesariamente, al menos con una alta probabilidad según las circunstancias específicas que incidan en la materia, de la segunda (en este sentido, pueden verse, entre otras, las resoluciones 467-F-2008 de las 14 horas 25 minutos del 4 de Nombre01 de20085, o la 1008-F-2006 de las 9 horas 30 minutos del 21 de diciembre de 2006).
En este punto, es importante aclarar que la comprobación de las causas eximentes (culpa de la víctima, de un hecho de tercero o la fuerza mayor), actúa sobre el nexo de causalidad, descartando que la conducta atribuida a la parte demandada fuera la productora de la lesión sufrida.” (Resolución número 399-F-2009, de las 10:45 horas del 23 de abril de 2009; en el mismo sentido, pueden consultarse la resolución 398-F de las 10:40 horas del mismo día y año) (La negrita se suple). Así las cosas, todos los elementos requeridos para determinar la responsabilidad civil subjetiva del demandado fueron abordados y justificados y, por ello, el reclamo no puede prosperar.
POR TANTO:
Se declara sin lugar el recurso de apelación que ha sido interpuesto por el licenciado David Retana Jiménez, como defensor público del encartado Nombre01.
