Proceeding heard before the Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, sitting in Corredores.- BACKGROUND:
Judge Ruiz Ramírez drafts the opinion; and,
CONSIDERING:
I.The list of proven facts is adopted because it is well supported by the record, with the exception of item 6, because it pertains to a procedural requirement and not to a fact of this category. The following evidence is added at this stage to the evidentiary support for fact 2): (initial pleading at folio 8 and witness testimony at folios 60 a 61 vuelto); and the following is added as fact 9): The petitioner has exercised possession over the land in accordance with the Land Use Classification (Uso de Suelos) (see soil study at folios 82 a 86).
II.In the challenged judgment 30-2014, issued at trece horas veinte minutos del veinticinco de marzo del dos mil catorce (folio 264 a 266), the possessory information was approved and registration of the described real property was ordered, subject to the limitations established by the Ley de Caminos Públicos, Ley de Aguas and Ley Forestal (folio 108). The Procuraduría General de la República (PGR) appeals (folios 273 a 283) on the following grounds: It alleges that the land to be titled is forested in nature (mountain forest). It contends that, because such lands are located in national reserves, they have formed part of the Patrimonio Natural del Estado since the Ley Forestal 4465 de 1969 (artículo 33), as amended by the Ley Forestal 7174 de 1990 (artículos 32 y 33), and that their status as public-domain property (carácter demanial) is maintained by Ley 7575 (artículos 13 y 14). It argues that the Law permits real property outside protected wilderness areas (áreas silvestres protegidas) to be titled if the petitioner proves legitimate rights arising from ten years of possession, together with the other conditions required for that purpose, such as having protected the resource and having the real property duly bounded.
According to the PGR, however, title may be granted only if acquisitive prescription (usucapión) was completed before the lands became part of the Patrimonio Natural del Estado. It maintains that the witnesses’ testimony did not establish ten years of possession sufficient for acquisitive prescription in the petitioner’s favor. In support, it cites decisions [Telf1], 15753-2005, [Telf2], 783-2003 of the Sala Constitucional, as well as other judicial precedents and opinions issued by the PGR itself (dictámenes C-321-2003 y C-146-2008), which essentially concern: i) the continued application of repealed law to regulate legal situations that arose under it, with respect to protecting the right of public forest ownership established by prior legislation against retroactive applications detrimental to that right, and binding case law of the Sala Constitucional establishing the need to prove ten years of possession sufficient for acquisitive prescription; ii) the bar against private parties exercising possession as owners over public-domain property, given that its inalienability precludes its transfer and private possession; iii) the inadmissibility of acquisitive prescription and titling against the public domain; iv) the principle of inalienability, because such property is withdrawn from private commerce; v) property that cannot be acquired through possession; and vi) the property’s immunity from prescription as a direct consequence of the principle of inalienability, because, since it cannot be privately possessed or owned, it is legally impossible to acquire it through acquisitive prescription.
All these arguments are intended to establish that, because forests are public-domain property, they cannot be possessed by private parties or acquired through acquisitive prescription. Because the petitioner seeks title to public-domain property, including the Patrimonio Natural del Estado and public roads, the PGR requests that these proceedings be denied pursuant to artículos 11 de la Ley de Informaciones Posesorias, 13 y 14 de la Ley Forestal.
III.The appellant’s grounds for appeal are without merit. Regarding the objection that the witnesses’ testimony failed to establish the petitioner’s ten years of possession, it must be emphasized that [Nombre7], identity card CED6, [Nombre8], identity card CED7, and [Nombre3], identity card CED8 (folios 60 a 61 vuelto), confirmed that they had known the property for more than ten years, knew what was located on it, and knew that it had been possessed by the petitioner for longer than that period when the possession of [Nombre9] and [Nombre10] was added; accordingly, they recognized those persons as the owners. In the pleadings filed on 02 de febrero 2009, the petitioner states that he acquired the land from [Nombre9] and [Nombre10], a statement having the force of an affidavit (declaración jurada) (artículo 3 de la Ley de Informaciones Posesorias), in addition to submitting an authenticated instrument documenting the purchase of the possessory rights (derechos posesorios) (see initial pleading: folio 8 and deed: folio 3). Therefore, contrary to the appellant’s assertion, the testimonial and documentary evidence received does contain sufficient elements to deem the petitioner’s ten years of possession duly established.
IV.With regard to the Procuraduría’s opposition to granting title (titulación) to forested areas (zonas boscosas), it must be borne in mind that persons have the right to register land with such forest cover (cobertura boscosa), whether within or outside protected wild areas (áreas silvestres protegidas), provided they satisfy all legal requirements established in the various applicable bodies of law (see, in this regard, judgment 51 of 26 de mayo de 1995 of the Sala Primera de la Corte Suprema de Justicia). In view of the arguments made by the appellant, it is important to clarify that the State Natural Heritage (Patrimonio natural del Estado) is “composed of the forests and forestlands (terrenos forestales) of national reserves, areas declared inalienable, properties registered in its name, and those belonging to municipalities, autonomous institutions, and other agencies of the Public Administration, except for real property securing credit transactions with the Sistema Bancario Nacional and becoming part of its assets” (Article 13 of the Ley Forestal).
Such forestlands and forests are indeed exempt from attachment and inalienable (Article 14 of that Law). Possession thereof by private parties confers no right upon them, and the State’s action for recovery of such land is not subject to a statute of limitations. Consequently, they may not be registered in the Registro Público through a possessory-information proceeding (información posesoria) (Article 33). Article 7 of the Ley de Informaciones Posesorias, for its part, permits title to be granted to forested areas, subject to the specific requirements—additional to the general requirements of the Ley de Informaciones Posesorias—of proving lawful rights arising from ten years of possession (posesión decenal), having protected the natural resource, and ensuring that the property is duly demarcated and enclosed by fences or cleared boundary lanes. It must therefore be concluded that the aforementioned Article 7 addresses two different situations: a) The possibility of granting title to land located within protected wild areas.
In such cases, the provision permits title to be granted provided the right of ownership was consolidated at least ten years before the declaration of the protected wild area, since such areas form part of the public domain (dominio público). b) The possibility of granting title to forested land located outside protected wild areas. In this situation, the provision requires only that the petitioner prove “that he or she holds lawful rights arising from ten years of possession, exercised for at least ten years, and has protected that natural resource, with the understanding that the property must be duly demarcated and enclosed by fences or cleared boundary lanes.” Unlike the rule applicable to protected wild areas, it does not specify that possession must have existed for ten years prior to the declaration of the State’s forest heritage, first made in the repealed Ley Forestal N°4465. This is understandable, since otherwise what the legislature permitted in this regard would be self-contradictory.
In other words, if its intention had been to prohibit the granting of title to such forested areas after the enactment of the Ley Forestal of 1969—which contains the first declaration of the State’s forest heritage—the proper course would have been not to include or permit this second situation. As analyzed, however, the legislature has maintained a different position. Accordingly, contrary to the position maintained by the PGR, it must be concluded that Article seven of the Ley de Informaciones Posesorias (amended upon enactment of the current Ley Forestal 7575) expressly authorized title to forested real property to be granted through this type of proceeding.
V.Regarding the application and interpretation of the aforementioned Article 7 of the Ley de Informaciones Posesorias, this Court has emphasized: “The constitutionality of that provision and of the interpretation previously given to it by this Court was challenged, resulting in the issuance of judgment 4587-97 of the Sala Constitucional, which was specifically cited by the appellant. In that judgment, the Chamber upheld the constitutionality of the provision, which therefore remained in force. In light of this, the appropriate course in this case is to affirm the Judge’s ruling, since the petitioner proved compliance with the requirements established by that article, namely: ten years of possession, protection of the natural resource, and demarcation of the property by fences or cleared boundary lanes” (Voto 573-F-09). Likewise, the Sala Constitucional again rejected the constitutional challenge submitted by this Court against Article seven of the Ley de Informaciones Posesorias in expediente EXPN2, and that provision and its effects therefore remain in force.
This Note sets forth the reasons why the grounds of appeal asserted by the appellant are not accepted, not for reasons relating to the application of Article 7 of the Ley de Informaciones Posesorias concerning the granting of title to forested land, but because approval of title is appropriate in this case since the land has been reforested: The soil study prepared by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA) indicates that the described property consists of reforested land and secondary forest (bosque secundario) (see folio 82).- Although it is true that a majority of a differently constituted panel of this Court has held that the ten-year possession period for forested land must be calculated from before the land became subject to the public domain under the Ley Forestal of 1969, that rule does not apply to this specific case. It should be noted that the property consists entirely of reforested land and secondary forest, which means that the land was regenerated by its possessor; moreover, the judicial inspection shows that this resource has been cared for.
The Comisión Nacional de Certificación Forestal de Costa Rica defines secondary forest as “... land with woody vegetation of a secondary successional nature that develops after the original vegetation has been removed by human activities or natural phenomena; with a minimum area of 0,5 ha and a density of no fewer than 500 trees per ha of all species, with dbh (dap) of no less than 5 cm” (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999. Estándares y procedimientos para el manejo sostenible y la certificación forestal en Costa Rica. San José,. Costa Rica. 54 p.) Based on this definition and the evidence referred to above, the original forest was converted into pastures or its vegetation was removed to make way for grasslands that subsequently became regenerating forest. Declaring this type of secondary forest to be public-domain property (bien demanial) would discourage this kind of forest-regeneration activity, since possessors would prefer to keep their land as pasture so that it would remain part of their property and they would not run the risk of having it declared State-owned.
Silvicultural activity and the regeneration of secondary forests are necessary activities for capturing carbon from the atmosphere and therefore constitute environmental measures against global warming. These activities benefit the environment, and it would thus be inconsistent to penalize possessors who undertake this type of forest-regeneration activity by denying them title to their property. Furthermore, the land for which title is sought is not an aquifer recharge area (recarga acuífera) that is useful for supplying water to any population, nor is it located within any protective zone (zona protectora) such that it should be declared public-domain property; on the contrary, it is located outside protected wild areas.-
POR TANTO

VOTO N° 000513-F-2014 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las catorce horas y cuarenta y ocho minutos del veinticuatro de junio de dos mil catorce.- PROCESO DE INFORMACIÓN POSESORIA promovida por [Nombre1] , mayor, casado una vez, agricultor, vecino de Ciudad Cortes de Osa, cédula de identidad número CED1 - - . Intervienen como partes la PROCURADURÍA GENERAL DE LA REPÚBLICA representado por la licenciada Lydiana Rodríguez Paniagua, en su condición de procuradora adjunta, y el INSTITUTO DE DESARROLLO AGRARIO, actual INSTITUTO DE DESARROLLO RURAL, cédula de persona jurídica número CED2 - - - , representada por su apoderada general judicial Carmelina Vargas Hidalgo, mayor, divorciada una vez, abogada, vecina de Guachipelín, Escazú, cédula de identidad número CED3 - - , colegiada número cinco mil trescientos setenta y dos. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, con sede en Corredores.-
RESULTANDO:
Redacta la jueza Ruiz Ramírez, y;
CONSIDERANDO
I.Se comparte el elenco de hechos probados por tener buen sustento en los autos; a excepción de los numerales 6, por corresponder a un requisito del procedimiento y no a un hecho de esta categoría. Se agrega en esta instancia como elenco probatorio del hecho 2) (escrito inicial a folio 8 y declaraciones testimoniales de folios 60 a 61 vuelto); y como hecho 9) El promovente ha ejercido la posesión sobre dicho terreno de acuerdo al Uso de Suelos (ver estudio de suelos a folios 82 a 86).
II.En la sentencia impugnada 30-2014 de las trece horas veinte minutos del veinticinco de marzo del dos mil catorce (folio 264 a 266), se aprobó la información posesoria y se ordenó inscribir el inmueble descrito, con las limitaciones que establece la Ley de Caminos Públicos, Ley de Aguas y Ley Forestal (folio 108). La Procuraduría General de la República (PGR) apela (folios 273 a 283) con base en los siguientes argumentos: Alega el terreno a titular es de naturaleza boscosa (montaña). Considera que esos terrenos, por ubicarse en reservas nacionales, forman parte del Patrimonio Natural del Estado, desde la Ley Forestal 4465 de 1969 (artículo 33), reformada por la Ley Forestal 7174 de 1990 (artículos 32 y 33) y su carácter demanial lo mantiene la Ley 7575 (artículos 13 y 14). Argumenta, la Ley permite titular inmuebles fuera de las áreas silvestres protegidas si la parte promovente demuestra sus legítimos derechos de posesión decenal, con las demás condiciones exigidas al efecto, como haber protegido el recurso y tener el inmueble debidamente deslindado.
Pero para la PGR solo es posible titular si la usucapión se consolidó antes de que los terrenos formasen parte del Patrimonio Natural del Estado. Sostiene, con la declaración de los testigos, no se demostró la posesión decenal apta para usucapir en cabeza de la parte promovente. Cita en su apoyo los votos [Telf1], 15753-2005, [Telf2], 783-2003 de la Sala Constitucional, también otros precedentes jurisprudenciales y pronunciamientos emitidos por la misma PGR (dictámenes C-321-2003 y C-146-2008), que en lo medular se refieren a: i) la supervivencia del derecho derogado para regular las situaciones jurídicas que nacieron a su abrigo, en lo que respecta a la protección del derecho de dominio público forestal establecido por la legislación anterior contra aplicaciones retroactivas en su perjuicio y jurisprudencia vinculante de la Sala Constitucional que establece la necesidad de demostrar una posesión decenal apta para usucapir. ii) el impedimento de los particulares de ejercer la posesión con ánimo de dueños sobre los bienes de dominio público, dado que la inalienabilidad de tales imposibilita su traspaso y posesión privada. iii) la improcedencia de la usucapión y titulación contra el dominio público. iv) el principio de la inalienabilidad, por cuanto esos bienes se substraen del comercio de los hombres. v) los bienes no susceptibles de adquirirse por posesión. vi) la imprescriptibilidad de tales bienes como consecuencia directa del principio de inalienabilidad, pues al no ser objeto de posesión ni de dominio privado, existe imposibilidad jurídica para usucapirlos. Todos esos alegatos giran en torno a argumentar que al ser los bosques bienes de
dominio público, no son susceptibles de ser poseídos por particulares ni adquiridos por usucapión. Al pretenderse titular bienes de dominio público, como lo es el patrimonio natural del Estado y las vías públicas, solicita la improbación de estas diligencias, conforme a los artículos 11 de la Ley de Informaciones Posesorias, 13 y 14 de la Ley Forestal.
III.Los agravios reclamados por la parte recurrente no son de recibo. Con respecto a lo objetado en cuanto a que con la declaración de los testigos no se demostró la posesión decenal de la parte promovente, debe resaltarse que [Nombre7] cédula de identidad CED6, [Nombre8] cédula de identidad CED7 y [Nombre3] cédula de identidad CED8 (folios 60 a 61 vuelto), confirmaron conocer la finca desde hace más de diez años, lo que existe en ella y que ha sido poseída por la promovente más de ese plazo, sumando la posesión de su [Nombre9] y [Nombre10] por lo que es a tales a quienes reconocen como dueños. En el escritos presentados el 02 de febrero 2009, la parte promovente afirma que adquirió el terreno de [Nombre9] y [Nombre10] , manifestación que tiene el valor de declaración jurada (artículo 3 de la Ley de Informaciones Posesorias), aparte de presentar testimonio de la compra de los derechos posesorios (ver escrito inicial: folio 8 y escritura: folio 3). Por ende, de la testimonial y documental evacuada, contrario a lo que afirma la recurrente, si se desprenden elementos para tener por debidamente demostrada la posesión decenal de la parte promovente.
IV.En relación con la oposición de la Procuraduría para titular zonas boscosas, debe tenerse presente que las personas gozan del derecho de inscribir terrenos con dicha cobertura, dentro o fuera de áreas silvestres protegidas, siempre y cuando cumplan todos los requisitos legales exigidos en los diversos cuerpos normativos aplicables (consúltese al respecto el voto 51 del 26 de mayo de 1995 de la Sala Primera de la Corte Suprema de Justicia). Dado lo argumentado por la parte recurrente, es importante aclarar que el Patrimonio natural del Estado esta "constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio " (artículo 13 de la Ley Forestal).
Dichos terrenos forestales y bosques son efectivamente inembargables e inalienables (artículo 14 de dicha Ley). Su posesión por los particulares no les otorga derecho alguno y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no son susceptibles de inscripción en el Registro Público mediante información posesoria (artículo 33). Por su parte, el artículo 7 de la Ley de Informaciones Posesorias, permite la titulación de zonas boscosas, exigiendo como requisitos específicos (adicionales a los generales de la Ley de Informaciones Posesorias) demostrar los derechos legales de posesión decenal, haber protegido el recurso natural y que el inmueble esté debidamente deslindado y con cercas o carriles limpios. De esta forma, debe concluirse que el artículo 7 citado, contempla dos situaciones diferentes: a) La posibilidad de titular terrenos comprendidos dentro de áreas silvestres protegidas.
En estos casos, la norma permite se titule siempre y cuando se haya consolidado el derecho de propiedad al menos diez años antes de la declaratoria de área silvestre protegida, pues tales forman parte del dominio público. b) La posibilidad de titular terrenos fuera de áreas silvestres protegidas y que tengan bosques. En este supuesto, la norma exige únicamente que el promovente demuestre "ser el titular de los derechos legales de posesión decenal, ejercida por lo menos durante diez años y haber protegido ese recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado y con cercas o carriles limpios". No se especifica, como sucede con las áreas silvestres protegidas, que la posesión deba ser anterior a diez años antes de la declaratoria de patrimonio forestal del Estado, realizada por vez primera en la derogada Ley Forestal N°4465. Ello es entendible, pues si no sería un contrasentido lo permitido por el legislador al respecto.
Es decir, si su intención hubiese sido no permitir la titulación de esas zonas boscosas luego de promulgarse la Ley Forestal de 1969 (que contiene la primera declaratoria de patrimonio forestal del Estado), lo correcto hubiese sido no incluir o no permitir ese segundo supuesto. Pero como se analizó, el legislador ha mantenido una posición diferente. Por consiguiente, debe concluirse, a diferencia de la posición que mantiene la PGR, que el artículo sétimo de la Ley de Informaciones Posesorias (modificado al emitirse la vigente Ley Forestal 7575), autorizó en forma expresa la titulación de bienes inmuebles boscosos mediante este tipo de proceso.
V.Sobre la aplicación e interpretación del citado numeral 7 de la Ley de Informaciones Posesorias este Tribunal ha destacado: "La constitucionalidad de dicha norma y de la interpretación dada en algún momento por este Tribunal fue cuestionada de constitucionalidad, gestión que generó la emisión del voto de la Sala Constitucional 4587-97, precisamente citado por la recurrente. En dicho voto la Sala declaró la constitucionalidad de la norma, manteniendo su vigencia. Ante tal situación, lo procedente en este caso es confirmar lo resuelto por el Juzgador, al haber acreditado el promovente el cumplimiento de los requisitos que dispone ese artículo, a saber: la posesión decenal, protección del recurso natural y delimitación del inmueble mediante cercas o carriles limpios " (Voto 573-F-09). De igual forma, la Sala Constitucional rechazó nuevamente la consulta de inconstitucionalidad contra el artículo sétimo de la Ley de Informaciones Posesorias realizada por este Tribunal, en el expediente EXPN2, quedando vigente tal norma y sus efectos.
Esta Nota se consigna para indicar los argumentos por los cuales no se comparten los agravios expuestos por la apelante, no por las razones en cuanto a la aplicación del artículo 7 de la Ley de Informaciones Posesorias referida a titulación en terrenos boscosos, sino que en este caso procede la aprobación de título pues se trata de un terreno reforestado: Del estudio de suelos elaborado por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA), se desprende que el inmueble descrito es terreno reforestado y con bosque secundario (ver folio 82) .- Si bien es cierto, por mayoría de otra integración de Tribunal se considera el conteo el plazo decenal de posesión de terrenos boscosos los es antes de la afectación de dominio público según Ley Forestal de 1969, ello no es de aplicación a este caso concreto, pues nótese se trata de un inmueble compuesto en su totalidad por reforestación y bosque secundario, lo que implica ese terreno fue regenerado por parte de su poseedor además del reconocimiento judicial se desprende se ha cuidado ese recurso.
La Comisión Nacional de Certificación Forestal de Costa Rica define el bosque secundario como “... aquella tierra con vegetación leñosa de carácter sucesional secundaria que se desarrolla una vez que la vegetación original fue eliminada por actividades humanas o fenómenos naturales; con una superficie mínima de 0,5 ha y una densidad no menor a 500 árboles por ha de todas las especies, con dap no menor a 5 cm” (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999. Estándares y procedimientos para el manejo sostenible y la certificación forestal en Costa Rica. San José,. Costa Rica. 54 p.) Partiendo de esta definición y prueba referida supra, el bosque original fue convertido en potreros o su vegetación fue eliminada, para dar cabida a pastizales que luego a bosque en regeneración, declarar ese tipo de bosque secundario como bien demanial sería no incentivar ese tipo de actividad regeneradora de bosques, pues los poseedores preferirían mantener sus terrenos de naturaleza de potreros para tenernos bajo su patrimonio y no correr el riesgo le sean declarados estatales.
La actividad silvícola y la regeneradora de bosques secundarios son actividades necesarias para la captación de carbono en la atmósfera y por ende medidas ambientales contra el calentamiento global, actividades beneficiosas para el medio ambiente por lo que sería incoherente castigar a los poseedores que tienen ese tipo de actividad regeneradora de bosques denegándoles la obtención de su título de propiedad. Aunado a lo anterior, el terreno a titular no es un inmueble de recarga acuífera que sea de utilidad para abastecer de agua a alguna población y tampoco el mismo está dentro de alguna zona protectora como para declararlo bien demanial, por el contrario está ubicado fuera de áreas silvestres protegidas.-
POR TANTO
