  1. 1The applicant instituted these possessory title proceedings so that, through this procedure, the land described as follows may be recorded in the Public Property Registry: Land consisting of pasture and primary forest, corresponding to cadastral plan SJ-un millón quinientos cuatro mil quinientos noventa y ocho - dos mil once (SJ-1504598-2011), in the name of the title applicant, dated trece de junio de dos mil once, located at [Dirección1], ( ), ( ), in the province of San José. It measures eight thousand four hundred sixty-seven square meters (8467m²) and has the following boundaries: NORTH: [Nombre1], SOUTH: [Nombre2], EAST: [Nombre2], and WEST: [Nombre2],” (folios 14,38,103, 116 and reverse).-
  2. 2The Procuraduría General de la República entered an appearance in the proceeding under the terms set forth at folios 33 to 36; the Instituto de Desarrollo Rural likewise did so at folio 103, neither stating any opposition to these proceedings.-

  5. 5Attorney Bernardo Solano Solano, Judge of the Juzgado Agrario de Cartago, ruled as follows in judgment number 111-2013 issued at thirteen hours and ten minutes on nueve de octubre de dos mil trece: “POR TANTO: These POSSESSORY TITLE PROCEEDINGS instituted by [Nombre1], of legal age, married, business administrator, resident of Cartago, identity card CED4 - - , ARE APPROVED; the proceeding was conducted in accordance with the Ley de Informaciones Posesorias number ciento treinta y nueve of catorce de julio de mil novecientos cuarenta y uno, as amended and supplemented.- Accordingly: a) Free of encumbrances and property charges (cargas reales), without co-owners, and without prejudice to third parties having a superior right, the Public Registry, Real Property Section, shall record in the name of the title applicant the property described as follows: Land consisting of pasture and primary forest, corresponding to cadastral plan SJ-un millón quinientos cuatro mil quinientos noventa y ocho - dos mil once (CED5), in the name of the title applicant, dated trece de junio de dos mil once, located at [Dirección1], ( ), ( ), in the province of San José.It measures eight thousand four hundred sixty-seven square meters (8467m²) and has the following boundaries: NORTH: [Nombre1], SOUTH: [Nombre2], EAST: [Nombre2], and WEST: [Nombre2]. b) The applicant acquired the property for which title is sought on dos de mayo de dos mil once, by purchase from [Nombre2], documented in public deed five hundred forty-five of the protocol of notary public José Angel Piedra Vargas. In that instrument of conveyance (título traslativo), the seller stated that he was transferring the possession acquired from [Nombre3], who in turn had possessed the property for more than ten years. The title applicant currently uses the land for pasture and primary forest and keeps it demarcated. Possession has been exercised over the property in compliance with the land’s permitted use (uso conforme del suelo) for the activity conducted there, in accordance with the approved methodology.The applicant must comply with the technical recommendations of the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria to preserve the primary forest areas and maintain vegetation cover (cobertura vegetal) on the soil to prevent its degradation. The property is not recorded in the Public Registry, lacks a registrable ownership title, and the possessory title proceeding is not intended to evade the consequences of probate proceedings (proceso sucesorio). The applicant valued the property for which title is sought and these proceedings at six million colones (¢6.000.000,00). c) The Public Registry is ordered to record that an easement of passage (Servidumbre de Paso) has been established for the benefit of the property for which title is sought, with the following characteristics: purpose: passage on foot, by motor vehicle, or by cart; total length: nine hundred nineteen meters and thirty-five linear centimeters; width: seven meters; direction or bearing: east or [Dirección2]; dominant estate (fundo dominante): property for which title is sought, described in plan SJ-1504598-2011; servient estate (fundo sirviente): property of the San José Registry District under registration number [Placa1] - (), owned by [Nombre1]; assessed value: two thousand colones.The Registro Nacional is ordered to record that the land is subject to the reservations prescribed by the Ley General de Caminos Públicos, insofar as the minimum width of highways is twenty meters and that of local roads is fourteen meters. Once this decision becomes final, the corresponding certified enforcement copy (ejecutoria) shall be issued at the applicant’s request (folios 112 to 116 and reverse).-
  6. 6Attorney Lydiana Rodríguez Paniagua, in her capacity as Deputy State Attorney, filed an appeal (recurso de apelación), expressly stating the reasons for challenging the trial court’s position (folios 123 to 128).-

7. In the conduct of the proceeding, the statutory requirements have been observed, and the judgment contains no apparent errors or omissions capable of rendering it null and void.- Drafted by Judge ULATE CHACÓN, and

CONSIDERING:

I. The Agrarian Court concurs with the findings concerning the proven facts, as they are well supported by the record.-

II.Deputy State Attorney Lydiana Rodríguez Paniagua filed an appeal, arguing that the record establishes, and the judgment finds proven, that the property for which title is sought is forested land (mountain), and therefore forms part of the national reserves and has been dedicated to the public domain (dominio público) since Ley Forestal 4465 de 1969; consequently, it is not subject to prescription and is inalienable, and cannot be acquired through acquisitive prescription (prescripción positiva), citing as authority, among others, judgment No. 4587-97 of the Constitutional Chamber.- She further argues that the witness testimony does not establish possession sufficient for adverse possession (usucapir) on the applicant’s part (submission at folios 123 to 128).

III.Although it is true that the Ley de Tierras y Colonización de 1961 and the Ley Forestal de 1969 provided that forest-covered lands without private occupation formed part of the national reserves, that dedication to the public domain has changed in accordance with the evolution of Human Rights, specifically through the incorporation of third-generation rights, which include the human right to a healthy and ecologically balanced environment. The Ley Forestal de 1996 amended Article 7 of the Ley de Informaciones Posesorias to allow acquisition by adverse possession (usucapión) of forest-covered lands, provided that ecological possession (posesión ecológica) is established through conservation of the forest resource for more than ten years, with the transferred possession being available for tacking (see judgment of the Constitutional Chamber No. 4587-97). The Agrarian Court had held that such possession had to be personal in nature, but the Chamber declared that requirement unconstitutional.

IV.Regarding the interpretation of Article 7 of the Ley de Informaciones Posesorias and the Natural Heritage of the State (Patrimonio Natural del Estado), the Court has repeatedly stated: “The Ley de Informaciones Posesorias, in Article 7 thereof, as well as the Leyes Forestales, have sought to protect forest resources from human activity by subjecting them to various forms of forest management (manejo forestal). Although titling of such areas has been permitted, once declared conservation areas they become part of the Forest Heritage of the State (Patrimonio Forestal del Estado), and compliance with other, more stringent requirements is required. This leads us directly to the concept of ecological possession (posesión ecológica) and the principle of the ecological function of forest property (función ecológica de la propiedad forestal). In repeated judgments, both the First Chamber of Cassation and the Higher Agrarian Court itself have established the principles that must govern the resolution of this type of agro-environmental situation.

Our country has pioneered the development of the legal institutions of agrarian possession (posesión agraria) and ecological possession. The case law itself has recognized and developed these institutions, as well as the life cycle of agrarian possession and, more recently, of ecological possession (within the broader principle of the ecological function of forest property). The case law itself has sought to distinguish business property and possession, where an activity aimed at cultivating the forest is carried out, from property and possession where merely extractive or solely conservation activities are conducted. The latter cases would involve forest property or possession (without an enterprise). It is precisely in these cases that the Ley Forestal establishes an entire legal regime for the protection of forest resources, subjecting the owner to the forestry regime (régimen forestal), mandatorily in some cases and voluntarily in others.

Thus, in forest possession, de facto control is exercised over land suitable for forestry or land primarily intended to protect forest resources, without any intention of exploiting them, or else the land is devoted merely to extracting timber species through management plans designed to achieve the natural regeneration of the forest. In neither case would there be the development of a plant or animal biological cycle, nor would any risk be assumed by humans. That is why the law does not protect—and instead penalizes—possession through which forest resources in protected areas are destroyed. It also denies the possibility of acquiring possessory rights over lands in national reserves when harmful action against forest resources has been carried out. Today, part of agrarian legal scholarship recognizes the existence of Forest Law, with the characteristics of an organic and comprehensive system in which the institutions of forest property and possession occupy an important place.

In Costa Rica, forest property, as well as forest possession as a real right derived therefrom or conceived independently, began to take shape in the Código Fiscal de 1885, which establishes an entire chapter on forests whose regulations are intended to ensure their conservation. Subsequently, the Ley de Terrenos Baldíos No. 13 del 6 de enero de 1939 incorporated those principles. The Ley de Tierras y Colonización then expanded national reserves for the protection of such resources in Article 7 thereof.- VII. Special legislation governing the protection of forest property and possession has passed through three stages in our country. The first stage of forest property is framed by Ley No. 4465 del 35 de noviembre de 1969. The second began with more effectively conceived regulations under Ley No. 7032 del 7 de abril de 1986, which was subsequently declared unconstitutional. The final stage began with the enactment of Ley Forestal No. 7174 del 28 de junio de 1990, recently amended by Ley No. 7575 del 13 de febrero de 1996 (published in Supplement 21 of La Gaceta No. 72 del martes 16 de abril de 1996).

These laws contain various forest-property regimes and restrict the use and exploitation of resources by private parties. Ownership of land with forest cover (cobertura boscosa) cannot be acquired unless it is shown that the forest resource has been protected. Its constitutional basis is found in the second paragraph of Article 45 of the Constitution. The institutions of forest property and possession are protected through restrictions in the public interest. Forest property is not the same as civil or agrarian property; it is property intended for conservation, and therefore the possessory acts carried out upon it must serve that purpose.- VIII. Forest possession has been governed by the aforementioned Leyes Forestales. It applies to a specific type of property: land covered by forests or suitable for forestry. The owner or possessor of such property is obligated to conserve its forest resources and may not exploit them economically except under the restrictions or limitations imposed by law.

Legal disputes arising from the exercise of forest possession must be resolved by applying that special legal regime and the principles of Forest Law. The Ley Forestal establishes as an essential function and priority of the State the duty to ensure the protection, conservation, exploitation, industrialization, administration, and promotion of the country’s forest resources, in accordance with the principle of rational use of renewable natural resources. (Article 1). All land suitable for forestry and all forests in the country, whether State-owned or privately owned, are subject to the purposes of the law. The forestry regime is the body of legal, economic, and technical provisions, among others, established by the law, its regulations, and other rules governing the conservation, renewal, exploitation, and development of the country’s forests and land suitable for forestry. Consequently, acquiring forest property by adverse possession (usucapión) requires the exercise of forest possession.

Before its amendment, Article 7 of the Ley de Informaciones posesorias, as amended by the Ley Forestal, provided: “Article 7.- When the immovable property referred to in the non-contentious titling proceeding (información) lies within an area declared to be a national park, biological reserve, forest reserve, or protective zone, the applicant for title must demonstrate that ten-year possession was exercised at least ten years before the effective date of the respective law or decree creating the relevant wilderness area. Properties located outside those areas that contain forests may be titled only if the petitioner demonstrates possession thereof for ten years or more and protection of that natural resource, it being understood that the property must be duly demarcated by fences or cleared boundary lines.” In other words, de facto control in forest possession is exercised over the natural resource consisting of “forests” or “land suitable for forestry,” and the possessory acts must be directed toward its protection and conservation.

Such land may be acquired or registered in favor of those possessors only if this is demonstrated. Otherwise, it would become part of the natural heritage of the State (Article 13 of the new Ley Forestal), would be immune from attachment and inalienable, and possession thereof would create no rights in favor of private parties (Article 14 of the new Ley Forestal).- IX. Before Article 7 of the Ley de Informaciones Posesorias was amended by the new Ley Forestal, the Agrarian Court had interpreted it as requiring personal possession exercised at least ten years before the creation of the forest reserve or protected area (see, to that effect, Votos No. 169 de las 9 horas 40 minutos del 22 de marzo de 1991 y No. 251 de las 14 horas del 17 de abril de 1991)...”. However, that interpretation of Article 7 of the Ley Forestal was challenged as “unconstitutional” by the applicant for title herein, and the Constitutional Chamber, in Voto No. 4587-97 (published in Boletín Judicial No. 188 de fecha 1 de octubre de 1997), held, insofar as relevant, as follows: “The action is partially granted and, consequently, the interpretation of Article 7 of Ley de informaciones Posesorias No. 139 del 14 de julio de 1941, whose text corresponds to the amendment introduced by Ley Forestal No. 7174 del 28 de junio de 1990, is declared unconstitutional insofar as, under that interpretation, titling land located within national parks, biological reserves, forest reserves, or protective zones requires personal possession for ten years before the effective date of the law or decree creating the protected wilderness area, and possession transferred by prior possessors does not benefit the applicant in such cases.

This judgment is declaratory and has retroactive effect, without prejudice to rights acquired in good faith...”. Accordingly, current possessors may avail themselves of transferred possession...X. Ley Forestal No. 7575 also retained the restrictions in the Ley de Informaciones Posesorias governing the titling of land located within protected areas. In this regard, the current provision states: “Article 7.- When the immovable property referred to in the non-contentious titling proceeding lies within a protected wilderness area, regardless of its management category, the applicant for title must demonstrate that the applicant holds the legal rights to ten-year possession exercised at least ten years before the effective date of the law or decree creating that wilderness area.” (Emphasis added). That is, the legislature intended for those areas to have remained protected and conserved throughout this entire period, including before the creation of the Reserves and protected areas...”. (Decision of 14:50 hours on 20 de febrero de 1998, corresponding to Voto No. 113).

V.In more recent cases, the Court has rejected the arguments now reiterated by the appellant concerning the alleged retroactive interpretation or application of Article 7 of the Ley Forestal. In a case similar to the one before us, it was stated: V.- Regarding the appellant’s claim that the lower court judge erred in applying Article 7 of the Ley de Informaciones Posesorias, which the appellant considers to have been declared unconstitutional and therefore argues that the proceeding should be analyzed in light of Article 1 of that Law, this Court finds that the appellant is incorrect, because the cited Article 7 was not declared unconstitutional; rather, what was declared unconstitutional was the interpretation previously applied by the Court, under which possession exercised by prior transferors was not counted. Thus, because Section 7 of the Ley de Informaciones Posesorias remains in force, the petitioner must demonstrate ten years of possession predating the declaration of the protected wildlife area (área silvestre protegida), as indicated by the Sala Constitucional in decision No. 4587-97 (published in Boletín Judicial No. 188 dated 1 de octubre de 1997).

It is important to note that the law would not be applied retroactively, as the appellant claims, because the ten-year period of possession required for acquisitive prescription (usucapión) is established in the Código Civil, and the challenged provision merely highlights certain elements inherent to acquisitive prescription that are also defined in the general legislation, namely: the subject matter of possession and the conditions under which possession must be exercised for it to qualify for acquisitive prescription. In that regard, it is important to note what the Sala Constitucional stated on the matter in the cited decision: “…The first paragraph of Article 7 of the challenged Ley de Informaciones Posesorias, the text of which predates the most recent amendment by Ley Forestal No.7575 of 13 de febrero de 1996, governs the titling of real property located within an area declared to be a national park, biological reserve, forest reserve, or protected zone.

That article provides that the applicant for title must demonstrate ten years of possession commencing at least ten years before the effective date of the law or decree that created the wildlife area. The challenged provision governs the titling of real property that has been dedicated to the public domain (dominio público) through its designation as a protected wildlife area, regardless of its particular classification. It must now be determined whether, under the scenario contemplated by the challenged provision and in light of the doctrinal and case-law criteria governing the doctrines of acquisitive prescription and the possession required for acquisitive prescription, as discussed above, the challenged provision regulates a special form of possession required to acquire ownership of real property that imposes specific requirements capable of infringing the right to property or the principle against retroactive application of the law to the detriment of vested rights or settled legal situations, as protected by the Constitution.

First, it must be noted that the challenged article does not modify—increase or decrease—the ten-year period of possession required for acquisitive prescription, established in Article 860 of the Código Civil for cases generally involving the acquisition of real-property ownership through positive prescription (prescripción positiva). The extension of the period alleged by the claimant as an infringement of the right to property does not occur because, given the nature of the property for which title is sought (public property), the period of possession qualifying for acquisitive prescription must elapse before the property is dedicated to the public domain. In other words, the declaration of a protected wildlife area prevents possession subsequent to that dedication from being counted and precludes completion of the requirements for acquisitive prescription if the right has not been acquired by that time; that is, if the ten years of possession qualifying for acquisitive prescription under the conditions established by law have not elapsed.

This is merely the natural result of applying the concepts governing the subject matter of possession and the requirement that it be exercised in the capacity of an owner, which are necessary for possession for acquisitive prescription (posesión ad usucapionem). It should be recalled that property dedicated to the public domain, regardless of its particular classification, cannot be acquired by acquisitive prescription if the conditions required for acquisition of the right were not satisfied before the dedication occurred. Accordingly, although the challenged provision appears to govern a specific case of acquisitive prescription, it does not create a regime with requirements different from those established in the Código Civil for cases generally. Likewise, the alleged retroactive effect of the provision does not occur, because the ten-year period of possession required for acquisitive prescription is established in the Código Civil, and the challenged provision merely highlights certain elements inherent to acquisitive prescription that are also defined in the general legislation, namely: the subject matter of possession and the conditions under which possession must be exercised for it to qualify for acquisitive prescription.

In other words, the provision does not establish any different principle—or more stringent requirement—regarding the application of the general rules of acquisitive prescription. It merely specifies how those rules must be applied, which is consistent with the logical result dictated by the status of the property for which title is sought as public-domain property (bien demanial). Accordingly, the amendment to Article 7 of the Ley de Informaciones Posesorias, whose text is challenged, is not deemed to have introduced a different regime governing the requirements for acquisitive prescription that could have worsened the position of persons exercising possession for acquisitive prescription on land declared to be of public interest. (Tribunal Agrario, No. 173 at 16:29 hours on 31 de marzo del 2003).

VI.Therefore, a possessor seeking to acquire by acquisitive prescription land covered by forest that formed part of the national reserves must demonstrate ten years of possession, whether original or transferred, and must have conserved the forest resource (recurso forestal). In this particular case, the requirement imposed by Articles 1, 6, and 7 of the Ley de Informaciones Posesorias has been proven. Indeed, the applicant for title submitted Cadastral Plan (Plano Catastrado) number 1- 1504548-2011 , indicating that most of the property is devoted to pasture and forest (folio 1), which means that natural regeneration has been allowed and the forest has been conserved. Thus, the INTA certification (folios 3 and 4) states that, pursuant to Article 58 of the Reglamento a la Ley de Uso, Manejo y Conservación de Suelos and based on the field inspection, it was determined that the land has been used in accordance with the activity, and that “Most of the property is used as natural pasture, with adequately covered soil; there are also some naturally regenerating trees, and avocado, fig, and certain native highland trees are being planted; another portion consists of Primary Forest, without commercial exploitation...” (FOLIO 3).

This means that, far from adversely affecting the resource, a sustainable agroforestry activity has been conducted, and it is therefore concluded that sustainable possession (posesión sostenible) has been exercised. The record of the judicial inspection (reconocimiento judicial) conducted on 14 de agosto del 2012 (hearing dvd) clearly shows that the land consists of natural grazing areas undergoing natural regeneration and primary forest. In addition, the property for which title is sought measures less than one hectare and therefore does not fall within the definition of “forest” established by the legislature in the Ley Forestal (Article 3, subsection b). Furthermore, the witnesses heard at the same hearing, namely [Nombre4] , [Nombre5] and [Nombre6] , attest to the exercise of ten years of possession by both the applicant for title and her transferors, [Nombre2] and [Nombre3] . The appellant’s assignments of error are therefore without merit, and the judgment under appeal must be affirmed.

POR TANTO:

The judgment under appeal is affirmed as to the matters appealed.

VOTO N° 052-F-14 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las trece horas y treinta y tres minutos del veintidós de enero de dos mil catorce.- INFORMACIÓN POSESORIA promovida por [Nombre1] , mayor, casada una vez, administradora de empresas, vecina de Cartago, cédula de identidad número CED1 - - en el proceso, la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Lydiana Rodríguez Paniagua, de calidades desconocidas en autos, en su condición de procuradora adjunta; y el INSTITUTO DE DESARROLLO RURAL, cédula jurídica CED2 - - - , representado por Carmelina Vargas Hidalgo , mayor, divorciada, abogada, cédula de identidad número CED3 - - , vecina de San José, Actúa como abogado director de la promovente, el licenciado Lenin Mendiola Varela, colegiado número tres mil setecientos noventa y seis. Tramitada ante el Juzgado Agrario de Cartago.-

RESULTANDO:

  1. 1La parte promovente interpuso las presentes diligencias de información posesoria para que por medio de esta vía se proceda a inscribir en el Registro Público de la Propiedad el terreno que se describe así:Terreno de potrero y bosque primario, corresponde al plano catastrado SJ-un millón quinientos cuatro mil quinientos noventa y ocho - dos mil once (SJ-1504598-2011), a nombre de la titulante, fechado trece de junio de dos mil once, situado en [Dirección1], ( ), ( ), de la provincia de San José. Mide ocho mil cuatrocientos sesenta y siete metros cuadrados (8467m²) y tiene los siguientes linderos: NORTE: [Nombre1] , SUR: [Nombre2] , ESTE: [Nombre2] y OESTE: [Nombre2] ," (folios 14,38,103, 116 y vuelto).-
  2. 2La Procuraduría General de la República se apersonó al proceso en los términos que corren de folio 33 a 36; a su vez el Instituto de Desarrollo Rural lo hizo en el folio 103, sinmanifestar ambos su oposición a las presentes diligencias.-
  3. 3Los colindantes [Nombre2] y [Nombre1] , se apersonan a los autos dándose por notificados de las presentes diligencias de información posesoria, (Ver apersonamientos a folios 10 y 11).-
  4. 4El edicto relativo a estas diligencias salió publicado en el boletín judicial número 121 de fecha 22 de junio de 2012 (ver publicación a folio 60).-
  5. 5El licenciado Bernardo Solano Solano, juez del Juzgado Agrario de Cartago, mediante sentencia número 111-2013 de las trece horas diez minutos del nueve de octubre de dos mil trece, resolvió: “POR TANTO: SE APRUEBAN las presentes diligencias de INFORMACIÓN POSESORIA promovidas por [Nombre1] , mayor, casada, administradora de empresas, vecina de Cartago, cédula de identidad CED4 - - ; trámite que cumplió apegada a la Ley de Informaciones Posesorias número ciento treinta y nueve del catorce de julio de mil novecientos cuarenta y uno, sus reformas y adiciones.- En consecuencia: a) Libre de gravámenes y cargas reales, sin condueños y sin perjuicio de terceros con mejor derecho, proceda el Registro Público, Sección Propiedad Inmueble, a inscribir a nombre de la titulante el inmueble que se describe así: Terreno de potrero y bosque primario , corresponde al plano catastrado SJ-un millón quinientos cuatro mil quinientos noventa y ocho - dos mil once (CED5), a nombre de la titulante, fechado trece de junio de dos mil once, situado en [Dirección1], ( ), ( ), de la provincia de San José.Mide ocho mil cuatrocientos sesenta y siete metros cuadrados (8467m²) y tiene los siguientes linderos: NORTE: [Nombre1] , SUR: [Nombre2] , ESTE: [Nombre2] y OESTE: [Nombre2] . b) La promovente adquirió el inmueble a titular el dos de mayo de dos mil once, por compra hecha a [Nombre2] , plasmada en la escritura pública quinientos cuarenta y cinco del protocolo del fedatario José Angel Piedra Vargas. En ese título traslativo el vendedor dijo trasmitir la posesión adquirida de [Nombre3] , quién a su vez había poseído la finca por más de diez años. Actualmente, la titulante dedica el terreno a pasturas, bosque primario y lo mantiene delimitado. En la finca se ha ejercido la posesión cumpliendo con el uso conforme del suelo para la actividad que realiza de acuerdo con la metodología aprobada. Debe la promovente cumplir con las recomendaciones técnicas del Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria, de mantener la zonas de bosque primario y mantener el suelo con cobertura vegetal para evitar su degradación.El bien no se encuentra inscrito en el Registro Público, carece de título inscribible de dominio y con la Información Posesoria no se pretende evadir las consecuencias de un proceso sucesorio. La promovente estimó el inmueble a titular y las presentes diligencias en seis millones de colones (¢6.000.000,00). c) Se ordena al Registro Público, se consigne que a favor de la finca a titular existe constituida una Servidumbre de Paso con las siguientes características: fin: transitar a pie, en vehículo automotor o en carreta; longitud total: novecientos diecinueve metros con treinta y cinco centímetros lineales; ancho: siete metros; dirección o rumbo: este o [Dirección2]; fundo dominante: finca a titular descrita en el plano SJ-1504598-2011; fundo sirviente: finca del Partido de San José con matricula [Placa1] - (), propiedad de [Nombre1] ; estimación: dos mil colones. Se ordena al Registro Nacional se consigne que el terreno queda afecto a las reservas que indica la Ley General de Caminos Públicos, en cuanto a que el anchomínimo de las carreteras es de veinte metros y de los caminos vecinales de catorce metros. Una vez firme esta resolución, a solicitud de la promotora, expídase la ejecutoria correspondiente, (folios 112 a 116 y vuelto).-
  6. 6La licenciada Lydiana Rodríguez Paniagua, en su condición de Procuradora Adjunta, formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia, (folios 123 a 128).-

7. En la substanciación del proceso se han observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad.- Redacta el Juez ULATE CHACÓN, y,

CONSIDERANDO:

I. El Tribunal Agrario comparte lo dispuesto en relación con los hechos probados, por tener buen sustento en los autos.-

II.La Procuradora Adjunta, Lydiana Rodríguez Paniagua, interpuso recurso de apelación, aduciendo, que consta en autos y la sentencia lo tiene por acreditado, que la naturaleza del bien a titular es boscoso (montaña), por lo cual forma parte de las reservas nacionales y está afecto al dominio público desde la Ley Forestal 4465 de 1969, siendo por ende imprescriptible e inalienable, y no susceptible de prescripción positiva, citando como fundamento, entre otras la sentencia No. 4587-97 de la Sala Constitucional.- Además, aduce, que las declaraciones de los testigos no demuestran la posesión apta para usucapir en cabeza del promovente (Escrito de folios 123 a 128).

III.Si bien es cierto, la Ley de Tierras y Colonización de 1961 y la Ley Forestal de 1969, establecían que los terrenos cubiertos de bosque, sin ocupación privada eran parte de las reservas nacionales, dicha afectación al dominio público ha venido cambiando conforme la evolución de los Derechos Humanos, y específicamente con la incorporación de los de tercera generación, en los cuales se incluye el derecho humano a un ambiente sano y ecológicamente equilibrado. La Ley Forestal de 1996 reformó, el artículo 7 de la Ley de Informaciones Posesorias, para permitir la usucapión, en terrenos cubiertos de bosque, pero demostrando una posesión ecológica, a través de la conservación del recursoforestal, durante más de diez años, pudiéndose aprovechar la posesión trasmitida (ver sentencia de la Sala Constitucional No. 4587-97). El Tribunal Agrario sostuvo el criterio de que dicha posesión debía ser de carácter personal, pero la Sala declaró que el mismo era inconstitucional.

IV.Sobre al tema de la interpretación del artículo 7 de la Ley de Informaciones Posesorias, y el Patrimonio Natural del Estado el Tribunal en reiteradas resoluciones ha expresado: “La Ley de Informaciones Posesorias, en su artículo 7, así como las Leyes Forestales han procurado proteger los recursos forestales de la acción humana, sometiéndolos a diversas formas de manejo forestal. Aunque se ha permitido la titulación de dichas áreas, que ya declaradas como áreas de conservación pasan a formar parte del Patrimonio Forestal del Estado, se exige el cumplimiento de otros requisitos más calificados. Eso nos conduce, directamente al concepto de posesión ecológica, y al criterio de la función ecológica de la propiedad forestal. En reiteradas sentencias, tanto de la Sala Primera de Casación, como del mismo Tribunal Superior Agrario, se han establecido los principios que deben regir para resolver éste tipo de situaciones agro-ambientales.

Nuestro país ha sido pionero en la construcción de los institutos de la posesión agraria y la posesión ecológica. La misma jurisprudencia ha reconocido y desarrollado estos institutos, así como el ciclo de vida de la posesión agraria y, recientemente de la posesión ecológica (dentro del más amplio criterio de la función ecológica de la propiedad forestal). La misma Jurisprudencia ha querido distinguir la propiedad y posesión empresarial donde se ejercita una actividad dirigida al cultivo del bosque, de aquella donde simplemente se realiza una actividad extractiva o bien, meramente conservativa. En estos últimos casos se estaría en presencia de una propiedad o posesión forestal (sin empresa). Precisamente es en estos casos donde la Ley Forestal viene a establecer todo un régimen jurídico para la protección de los recursos forestales, sometiendo algunas veces al propietario en forma obligatoria al régimen forestal y en otros casos en forma voluntaria.

De esa forma, en la posesión forestal el poder de hecho se ejerce sobre un bien de vocación forestal o en su mayor parte destinado a proteger los recursos forestales, sin miras a su explotación o bien, dedicándolo a la simple extracción de especies maderables, a través de planes de manejo para lograr la regeneración natural del bosque. En uno y otro caso no existiría el desarrollo de un ciclo biológico vegetal o animal, ni asumiría el hombre ningún riesgo. Es por eso que la ley no tutela, al contrario reprime, la posesión a través de la cual se destruyan los recursos forestales de áreas protegidas. Además niega la posibilidad de adquirir derechos de posesión sobre tierras de las reservas nacionales cuando se ha ejercido una acción dañina en contra de los recursos forestales. Hoy, parte de la doctrina agrarista afirma la existencia de un Derecho forestal, con particularidades de sistema orgánico y completo, donde ocupan un lugar importante los institutos de la propiedad y posesión forestal.

En Costa Rica la propiedad forestal, y también la posesión forestal como derecho real derivado de aquella, o bien concebido en forma independiente, se comienza a perfilar desde el Código Fiscal de 1885, que establece todo un capítulo en cuanto a bosques cuyas regulaciones tienden a su conservación. Posteriormente la Ley de Terrenos Baldíos No. 13 del 6 de enero de 1939 incorpora dichos principios. Luego la Ley de Tierras y Colonización en su artículo 7 amplía las reservas nacionales para la protección de tales recursos.- VII. La legislación especial en cuanto a la tutela de la propiedad y posesión forestales tiene tres etapas en nuestropaís. La primera etapa de la propiedad forestal se enmarca con la Ley No. 4465 del 35 de noviembre de 1969. La segunda se abre a través de una normativa mejor concebida a través de la Ley No. 7032 del 7 de abril de 1986, la cual fue posteriormente declarada inconstitucional.

La última opera con la promulgación de la Ley Forestal No. 7174 del 28 de junio de 1990, reformada recientemente, por Ley No. 7575 del 13 de febrero de 1996 (publicada en el alcance 21 de La Gaceta No. 72 del martes 16 de abril de 1996). En ellas, se contienen diversos regímenes de propiedad forestal, y limita el uso y aprovechamiento de los recursos por los particulares. No es posible adquirir la titularidad sobre terrenos con cobertura boscosa si no se demuestra haber protegido el recurso forestal. Su fundamento constitucional se encuentra en el párrafo segundo del artículo 45 de la Constitución. A través de limitaciones de interés social se protege el instituto de la propiedad y la posesión forestal. Esta no es igual a la civil, ni a la agraria, se trata de una propiedad para conservar, y por tanto los actos posesorios que en ella se realicen deben tener esa finalidad.- VIII. La posesión forestal ha tenido su régimen jurídico en las Leyes Forestales mencionadas.

Recae sobre un bien específico: los terrenos cubiertos de bosques o de aptitud forestal. El propietario o poseedor de tales bienes tiene la obligación de conservar los recursos forestales y no los puede aprovechar económicamente sino bajo las restricciones o limitaciones impuestas por la ley. Para la solución jurídica de conflictos que nazcan del ejercicio de la posesión forestal, se debe aplicar ese régimen jurídico especial y los principios del Derecho forestal. La Ley Forestal establece como función esencial y prioridad del Estado, velar por la protección, la conservación, el aprovechamiento, la industrialización, la administración y el fomento de los recursos forestales del país, de acuerdo con el principio de uso racional de los recursos naturales renovables.(Artículo 1). Todos los terrenos de aptitud forestal y los bosques del país, ya sea estatales o que estén reducidos a dominio particular, quedan sometidos a los fines de la ley.

El régimen forestal es el conjunto de disposiciones, entre otras, de carácter jurídico, económico y técnico, establecidas por la ley, su reglamento y demás normas, que regulen la conservación, la renovación, el aprovechamiento y el desarrollo de los bosques y terrenos de aptitud forestal del país. Por ello, para adquirir la propiedad forestal por usucapión, se requiere el ejercicio de la posesión forestal. El artículo 7 de la Ley de Informaciones posesorias, reformado por la Ley Forestal, establecía, antes de su reforma: "Artículo 7.- Cuando el inmueble a que se refiere la información esté comprendido dentro de una zona declarada parque nacional, reserva biológico, reserva forestal o zona protectora, el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la respectiva ley o decreto en que se creó la respectiva área silvestre.

Las fincas que estén fuera de esas áreas y que tengan bosques, solo podrán ser tituladas si el promovente demuestra haberlas poseído por diez años o más y haber protegido dicho recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado con cercas o carriles." En otros términos, el poder de hecho en la posesión forestal recae sobre el recurso natural "bosques" o "terrenos de aptitud forestal", y los actos posesorios deben ir encaminados a su protección y conservación. Sólo si se demuestra eso podría adquirirse o inscribirse terrenos a favor de dichos poseedores. De lo contrario,quedarían formando parte del patrimonio natural del estado (artículo 13 de la nueva Ley Forestal), con carácter inembargable e inalienable, y su posesión no causará ningún derecho a favor de los particulares (artículo 14 de la nueva Ley Forestal).- IX. El Tribunal Agrario, había interpretado el artículo 7 de la Ley de Informaciones Posesorias, antes de ser reformado por la nueva Ley Forestal, en el sentido de exigir unaposesión personal, ejercida con diez años de antelación a la creación de la reserva forestal o área protegida (Véase en tal sentido los Votos No. 169 de las 9 horas 40 minutos del 22 de marzo de 1991 y No. 251 de las 14 horas del 17 de abril de 1991)...".

Sin embargo, esa interpretación del artículo 7 de la Ley Forestal, fue cuestionada de "inconstitucional", por la aquí titulante, y la Sala Constitucional, en Voto No. 4587-97 (publicado en el Boletín Judicial No. 188 de fecha 1 de octubre de 1997) declaró, en lo que interesa, lo siguiente: "Se declara parcialmente con lugar la acción y, en consecuencia, que es inconstitucional la interpretación del artículo 7 de la Ley de informaciones Posesorias No. 139 del 14 de julio de 1941, cuyo texto corresponde a la reforma producida por la Ley Forestal No. 7174 del 28 de junio de 1990, de acuerdo con la cual para titular terrenos comprendidos en parques nacionales, reservas biológicas, reservas forestales o zonas protectoras, se requiere posesión personal con diez años de antelación a la fecha de vigencia de la ley o decreto que crea el área silvestre protegida, y que no favorece en estos casos la posesión transmitida por anteriores poseedores.

Esta sentencia es declarativa y sus efectos retroactivos, sin perjuicio de derechos adquiridos de buena fe...". De manera tal que los poseedores actuales pueden aprovechar la posesión trasmitida...X. La Ley Forestal No. 7575, también mantuvo las restricciones en la Ley de Informaciones Posesorias, para poder titular terrenos comprendidos en áreas protegidas. Al respecto dispone el actual numeral: "Artículo 7.-Cuando el inmueble al que se refiera la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser titular de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre."(La negrita es nuestra). Es decir, la intención del legislador es que esas áreas se hayan mantenido protegidas, conservadas durante todo este tipo, incluso antes de la creación de las Reservas y áreas protegidas...". (Resolución de las 14:50 horas del 20 de febrero de 1998 que responde al Voto No. 113).

V.En casos más recientes, el Tribunal ha rechazado los alegatos que ahora reitera el apelante, sobre la supuesta interpretación o aplicación retroactiva del artículo 7 de la Ley Forestal. En un caso similar al que nos ocupa se dijo: V.- En cuanto a lo alegado por el recurrente respecto a que el juzgador de instancia comete un error al aplicar el artículo 7 de la Ley de Informaciones Posesorias, el cual considera fue declarado inconstitucional por lo que debe analizarse las diligencias a la luz de lo dispuesto por el artículo 1 de dicha Ley, considera este Tribunal no lleva razón pues el artículo 7 citado no fue declarado inconstitucional, sino lo fue la interpretación que venía haciendo el Tribunal en cuanto no se contabilizaba la posesión ejercida por los anteriores transmitentes. De ahí, al estar vigente el ordinal 7 de la Ley de Informaciones Posesorias, debe el promovente demostrar una posesión decenal antes de la declaratoria del área silvestre protegida según lo indicó la Sala Constitucional en el voto No. 4587-97 (publicado en el Boletín Judicial No. 188 de fecha 1 de octubre de 1997).

Es importante mencionar que tampoco se estaría aplicando retroactivamente la ley como lo indica el recurrente, porque el plazo de diez años de posesión para usucapir se encuentra establecido en el Código Civil y la disposición cuestionada simplemente destaca ciertos elementos propios de la usucapión que también están definidos en la normativa general, como son: el objeto de la posesión y las condiciones en que ésta se debe ejercer para ser apta para la usucapión. En ese sentido es importante señalar lo dicho por la Sala Constitucional al respecto en el voto citado “…El artículo 7 párrafo primero de la Ley de Informaciones Posesorias impugnado, cuyo texto es anterior a la última reforma por Ley Forestal No.7575 de 13 de febrero de 1996, regula el caso de la titulación de bienes inmuebles comprendidos dentro de un área declarada parque nacional, reserva biológica, reserva forestal o zona protectora.

Señala ese artículo que el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la ley o el decreto que creó el área silvestre. La disposición cuestionada regula el caso de titulación de un bien inmueble que ha sido afectado al dominio público con la declaratoria de área silvestre protegida, cualquiera que sea su especificidad. Corresponde ahora determinar si de acuerdo con la hipótesis que contempla la norma impugnada, a la luz de los criterios

doctrinarios y jurisprudenciales que informan los institutos de la usucapión y de la posesión necesaria para usucapir, expuestos anteriormente, la norma cuestionada regula un tipo especial de posesión necesaria para adquirir la propiedad sobre los bienes inmuebles, que impone requisitos específicos que pueden infringir el derecho de propiedad o el principio de irretroactividad de la ley en perjuicio de derechos adquiridos o situaciones jurídicas consolidadas, regulados en la Constitución. En primer término, debe señalarse que el artículo cuestionado no modifica -aumenta o disminuye- el plazo de diez años de posesión necesario para usucapir, fijado en el artículo 860 del Código Civil para la generalidad de los casos en que se pretende adquirir la propiedad de los bienes inmuebles por prescripción positiva. La ampliación del plazo que alega el accionante como infractor del derecho a la propiedad no se produce, porque dada la naturaleza del bien que se pretende titular (cosa pública), el plazo de posesión apta para la usucapión debe transcurrir antes de que se produzca la afectación del bien al dominio público.

Es decir, la declaratoria de área silvestre protegida evita que cuente la posesión posterior a la afectación, e impide concretar los requisitos de la usucapión si a ese momento no se ha adquirido el derecho, o sea, no han transcurrido los diez años de posesión apta para usucapir con las condiciones que establece la ley. Lo anterior es únicamente el resultado natural de aplicar los conceptos sobre el objeto de la posesión y su condición de ejercicio en calidad de titular, necesarios para la posesión ad usucapionem. Recuérdese que los bienes afectados al dominio público, tengan las especificaciones que tengan, no son susceptibles de adquisición por usucapión, si antes de producirse la afectación no se dieron las condiciones necesarias para la adquisición del derecho. En ese sentido, la disposición cuestionada, a pesar de que en apariencia regula un caso específico de usucapión, no crea un régimen con requisitos diferentes a los establecidos en el Código Civil para la generalidad de los casos.

En ese sentido, tampoco se produce el alegado efecto retroactivo de la norma, porque el plazo de diez años de posesión para usucapir se encuentra establecido en el Código Civil y la disposición cuestionada simplemente destaca ciertos elementos propios de la usucapión que también están definidos en la normativa general, como son: el objeto de la posesión y las condiciones en que ésta se debe ejercer para ser apta para la usucapión. Es decir, la norma no viene a establecer ningún principio diferente -o requisito más riguroso- en relación con la aplicación de las reglas generales de la usucapión. Simplemente especifica la forma en que deben aplicarse esas reglas, lo que coincide con un resultado lógico dada la condición de bien demanial del objeto a titular. De ahí que no se considere que la reforma al artículo 7 de la Ley de Informaciones Posesorias, cuyo texto se impugna, haya introducido un régimen diferente en relación con los requisitos de la usucapión, que haya podido agravar la situación de personas que se encontraban ejerciendo posesión ad usucapionem en terrenos que fueron declarados de interés público. (Tribunal Agrario, No. 173 de las 16:29 horas del 31 de marzo del 2003).

VI.De manera que el poseedor que pretenda adquirir por usucapión un terreno cubierto de bosque, que formaba parte de las reservas nacionales, deberá demostrar la posesión decenal (originaria o trasmitida), y haber conservado el recurso forestal. En este caso particular, se tiene por demostrado el requisito exigido por la Ley de Informaciones Posesorias, en sus artículos 1, 6 y 7. En efecto, el titulante, aportó Plano Catastrado número 1- 1504548-2011 , donde se indica que el inmueble está dedicado en su mayor parte a pastos y bosque (folio 1), lo que significa que se ha permitido la regeneración natural y se ha conservado el bosque. De ahí que la certificación del INTA (folios 3 y 4), indica que conforme al artículo 58 del Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, y con base en la visita de campo se determinó que se ha ejercido el uso conforme a la actividad, que "Se tiene la mayor parte de propiedad en uso pasto natural, suelo con adecuada cobertura, además se tienen algunos árboles de regeneración natural y se está plantando árboles de aguacate, higo y algunos nativos de altura, se tiene otra parte de Bosque Primario, sin explotación comercial..." (FOLIO 3).

Ello significa que, lejos de afectar el recurso, se ha dado una actividad agroforestal sostenible, por lo cual se concluye que se ha ejercido la posesión sostenible. En el acta de reconocimiento judicial practicado el 14 de agosto del 2012 (dvd de la audiencia) se observa con claridad que se trata de terrenos de repasto natural, en regeneración natural, y bosque primario. Aunado a lo anterior, véase que el inmueble a titular mide menos de una hectárea, por lo que no se aproxima al concepto de "bosque" establecido por el legislador, en la Ley Forestal (artículo 3 inciso b). Por otra parte, los testigos recibidos en la misma audiencia, a saber, [Nombre4] , [Nombre5] y [Nombre6] , dan fe del ejercicio de una posesión decenal, tanto de la titulante como de su trasmitente, [Nombre2] y [Nombre3] . De ahí que no lleve razón la recurrente en sus agravios, debiendo confirmarse la sentencia apelada.

POR TANTO:

Se confirma la sentencia apelada, en lo que fue objeto de apelación.
