SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At eleven twenty-eight a.m. on April sixteenth, two thousand eighteen.- ORDINARY PROCEEDING, brought by [Nombre1], of legal age, businessperson, United States national, holder of passport number CED1 issued by his country, resident of Puerto Viejo de Talamanca, Limón, against [Nombre2], of legal age, merchant, resident of Puerto Viejo, Limón; [Nombre3], of legal age, married, merchant, resident of Puerto Viejo, Limón, Nicaraguan national, passport number CED2; the State, represented by the PROCURADURÍA GENERAL DE LA REPÚBLICA, through Víctor Bulgarelli Céspedes, of legal age, married, attorney, resident of Heredia, identity card CED3 - - . Judge Ruiz Ramírez writes the opinion; and,

WHEREAS

I- In a ruling of March sixth, two thousand eighteen, the trial judge declared herself disqualified (inhibida) from hearing this matter in order to prevent future nullities, given the position stated by the Sala Primera in decision 959-2013. This was because the matter involves land alleged to form part of the State’s natural heritage (patrimonio natural del Estado), as it lies within the Refugio de Vida Silvestre Gandoca-Manzanillo and Zona Marítimo Terrestre (Carpeta Doc. Asociados, 06/03/2018 ).

II.Subject-matter jurisdiction in agrarian matters (competencia agraria por razón de la materia) is generally defined in Articles 1 and 2, subsection h), of the Ley de Jurisdicción Agraria. Those provisions authorize judges in this field to adjudicate or resolve disputes related to the conduct of agrarian or agro-environmental activities (actividades agrarias o agroambientales), or activities connected thereto. Agrarian land (fundo agrario) is deemed to be land devoted to such activities or capable of being devoted to them. In the latter case, it is important to consider the size and location of the land and the type of production that may be carried out on it. The foregoing criteria must also be adapted to the needs and requirements arising from modern technologies and scientific advances in agricultural development. For example, land that previously could not be devoted to agrarian activities—because of its size or the prevailing climate in the area—may now be used for such purposes if hydroponic agriculture or other technologies are employed in which the “earth or soil” substrate is not essential.

Moreover, the fact that land forms part of the State’s natural heritage does not prevent any judge from reviewing and applying the laws protecting it, nor is there any provision specifying that only the Jurisdicción Contenciosa Administrativa may do so. This is because environmental protection and the safeguarding of the constitutional right to a healthy environment fall within the jurisdiction of every court, regardless of subject matter, as this is a fundamental right (Articles 50 and 69 of the Constitución Política). Furthermore, environmental law is characterized precisely by its cross-cutting and multidisciplinary nature, which entails not only that various disciplines relate to or influence one another to achieve effective environmental protection, but also that environmental matters affect several different branches of law. For that reason, it would be unconstitutional to interpret that only the Jurisdicción Contenciosa Administrativa may apply laws intended to safeguard the environment and protect collective interests, or to conclude that it alone is authorized to protect the assets comprising the environment.

Therefore, to determine subject-matter jurisdiction in cases such as this one, the analysis must take into account not only the nature of the assets involved—public or private—which is also an issue that must be resolved or determined when the merits are examined, since the record shows that the land remains registered in the name of a private individual; the other claims must also be assessed in light of the causes of action asserted by the parties. The foregoing is based on Article 108 of the Ley de Biodiversidad.-

III.The complaint requests a ruling upholding the declaration of superior possessory rights (declaratoria de posesión de mejor derecho) and ordering the defendants not to disturb possession of the property at issue; a declaration that the defendants have not exercised quiet, public, peaceful, uninterrupted, good-faith possession, under a claim of ownership, over the property; an order requiring the defendants to refrain from interfering with the plaintiff’s free enjoyment of the property as its owner in possession; and a declaration that, having acquired the related property through acquisitive prescription (prescripción positiva), the plaintiff is entitled to obtain title through possessory-information proceedings (información posesoria), with the instrument transferring title (documento de título traslativo de dominio) being fully valid and effective. These are claims which, given the nature of the property involved, may and must be decided by agrarian courts, which are also required to apply environmental laws in cases warranting their application.

Therefore, because the first-instance judge’s ruling was improper, the declared disqualification must be rejected. This matter is declared to fall within the jurisdiction of the Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, seated in Limón, to which the case file must be returned for proper processing once this decision becomes final. The trial court shall note that the complaint is brought against the State and not against the Procuraduría General de la República, even though the plaintiff incorrectly refers to that party as such, and shall correctly identify that party and make the corresponding changes in the Sistema de Gestión and on the covers of the physical case file.

THEREFORE:

The disqualification for lack of subject-matter jurisdiction (inhibitoria por razón de la materia) declared by the Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, seated in Limón, is rejected, and the case file shall be returned to that court for proper processing once this decision becomes final. The trial court shall note that the complaint is brought against the State and not against the Procuraduría General de la República, correctly identify that party, and make the corresponding changes in the Sistema de Gestión and on the covers of the physical case file.

CONSIDERANDO

I- En resolución del seis de marzo del dos mil dieciocho, la persona juzgadora se declaró inhibida para conocer de este asunto para evitar futuras nulidades, dado el criterio expuesto por la Sala Primera en voto 959-2013. Lo anterior por estar de por medio un terreno que se afirma forma parte del patrimonio natural del Estado, al estar inmerso en el Refugio de Vida Silvestre Gandoca-Manzanillo y Zona Marítimo Terrestre (Carpeta Doc. Asociados, 06/03/2018 ).

II.La competencia agraria por razón de la materia está definida genéricamente en los artículos 1 y 2 inciso h) de la Ley de Jurisdicción Agraria. Dichas normas facultan a los jueces y a las juezas de esta disciplina para dirimir o resolver los conflictos relacionados con el ejercicio de actividades agrarias o agroambientales, o conexas a éstas. Se considera fundo agrario aquél destinado a dichas actividades, o que pueda destinarse a ellas. Para éste último supuesto, es importante tomar en cuenta la medida, la ubicación del terreno y el tipo de producción que se puede desarrollar en él. Los anteriores criterios deben además ajustarse a las necesidades y requerimientos que las tecnologías modernas y avances científicos planteen en materia de desarrollo agropecuario. Por ejemplo, terrenos que antes no podían destinarse a actividades agrarias -por su tamaño o el clima imperante en la zona-, actualmente pueden serlo, si se desarrolla agricultura hidropónica o con otras tecnologías, en las cuales el sustrato "tierra o suelo" no es fundamental.

Por otro lado, el que un terreno forme parte del patrimonio natural del Estado, no imposibilita que toda persona juzgadora pueda y esté facultada para revisar y aplicar la normativa que lo tutela, sin que exista normativa que especifique que solo la Jurisdicción contenciosa administrativa lo pueda hacer. Lo anterior por cuanto la protección del ambiente y la tutela del derecho constitucional a un ambiente sano es competencia de toda tribunal jurisdiccional, independientemente de la materia, por tratarse de un derecho fundamental (artículos 50 y 69 de la Constitución Política). Además, la materia ambiental precisamente se caracteriza por su transversalidad y multidisciplinariedad, que implica no solo el que varias disciplinas se relacionan o influyen entre sí para lograr una tutela efectiva del ambiente, sino también el que aquella incide en varias y diversas ramas jurídicas. Por ese motivo, resultaría inconstitucional interpretar que únicamente la Jurisdicción Contenciosa Administrativa es la que podría aplicar normativa para la tutela del ambiente y la protección de intereses colectivos, así como el considerar que serían la única facultada para tutelar los bienes que componen el ambiente.

Por ende, para definir la competencia material en casos como el presente, debe analizarse y tomarse en cuenta no solo la naturaleza de los bienes involucrados (público o privado) -aspecto además que deberá ser resuelto o determinado al analizarse el fondo del asunto, dado que el terreno, según consta en autos, aún se encuentra inscrito a nombre de una persona privada-; también deben valorarse las otras pretensiones, en función de las acciones planteadas por las partes. Lo anterior, con base en lo dispuesto por el artículo 108 de la Ley de Biodiversidad.-

III.En la demanda se solicita se declare con lugar la declaratoria de posesión de mejor derecho y se ordene a los demandados no perturbar la posesión del inmueble de marras; que los demandados no han ejercido la posesión en forma quieta, pública, pacífica, ininterrumpida, de buena fe, y a título de dueños, sobre el inmueble; que se ordene a los demandados se abstengan de perturbar el libre goce que tiene la parte actora como propietario poseedor del inmueble y se declare que por haber adquirido mediante prescripción positiva, la finca relacionada, tiene el derecho a titular mediante información posesoria, siendo totalmente valido y eficaz, el documento de título traslativo de dominio. Se trata de pretensiones, que por la naturaleza del bien implicado puede y debe ser resueltas por tribunales agrarios, quienes además están obligados a aplicar la normativa ambiental en los casos que lo ameriten.

Por ende, al ser improcedente lo dispuesto por la persona juzgadora de primera instancia, debe improbarse la inhibitoria decretada. Se declara este asunto compete tramitarlo al Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, con sede en Limón, al cual debe devolverse el expediente para su debido trámite, una vez firme esta resolución.
