Ordinary proceedings (proceso de conocimiento) instituted before the Juzgado de Trabajo del Segundo Circuito Judicial de San José by Nombre110791, forestry engineer, against Nombre110793, Nombre165824, social worker and resident of San José, the STATE, represented by its counsel Nombre2400, married, and Nombre165825, single, engineer. Also appearing as special litigation counsel (apoderados especiales judiciales) for defendant Nombre165825 are attorney Luis Antonio Álvarez Chaves, married, and attorney Milagro Quirós Rodríguez, single. The natural persons are of legal age and, except as otherwise stated, are in domestic partnerships, are attorneys, and reside in Heredia.

FINDINGS OF FACT 1. Based on the facts he set forth and the legal provisions he cited, the plaintiff instituted ordinary proceedings seeking a judgment declaring: “That the termination of my duties and my dismissal be declared unlawful. / That personnel action No. 211079118 be annulled. / That I be reinstated to position 105595. / That I be awarded back pay (salarios caídos) from February 28, 2011 until my actual reinstatement. / That the amount owed to me be adjusted for inflation (indexación). / That I be awarded statutory interest (intereses legales) and default interest (intereses moratorios) on the amount owed. / That I be awarded the sum of thirty million colones as compensation for non-pecuniary harm (daño moral), consisting essentially of the damage to my professional reputation that I have suffered. / That the defendants be ordered to pay the procedural and professional costs (costas procesales y profesionales) of these proceedings.” During the preliminary hearing held on April 25, 2014, regarding the claims brought against Nombre165825 and Nombre110793, it was clarified that the action against them would concern only the non-pecuniary harm claim, so that they might be held jointly and severally liable (solidariamente) with the State.- 2.

On its own motion, the Juzgado de Trabajo del Segundo Circuito Judicial de San José declared that it lacked subject-matter jurisdiction (incompetencia en razón de la materia) and ordered the matter transferred to the Tribunal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José.

3. Defendant Nombre165824, defendant Nombre165825, and the State’s representative opposed the complaint. The State and defendant Nombre165825 raised the defense of lack of legal entitlement (Falta de Derecho) and stated that they were unwilling to settle. Defendant Nombre110793 was declared in default (rebelde).

4. The preliminary hearing was conducted on four occasions. The first took place on May 17, 2013, when the parties were heard and the proceedings were regularized (saneó el proceso) by granting defendant Nombre165824 a period within which to correct her answer to the complaint. The second took place on April 25, 2014, at which procedural stage the relief sought regarding non-pecuniary harm was clarified, and the State raised the preliminary defense of limitation (prescripción). The third took place on June 11, 2014, at which procedural stage the proceedings were regularized by granting defendant Nombre165824 a period within which to provide or identify her legal counsel (patrocinio de letrado). The fourth took place on August 22, 2014, at which procedural stage the plaintiff maintained his request to discontinue (desistimiento) the action against defendant Nombre165824; the Judge granted the request and declared the proceedings against defendant Nombre165824 terminated. Consideration of the limitation defense raised by the State was reserved for judgment.

5. The oral and public trial was held on May 18, 2015, with the participation of the parties.

6. The Tribunal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José, Sección Cuarta, Anexo A, composed of Judges Felipe Córdoba Ramírez, Ricardo Madrigal Jiménez, and Francisco Muñoz Chacón, ruled in judgment No. 51-2015-IV, issued at 16:00 on May 28, 2015: “The limitation defense raised by the State is unanimously dismissed. By majority decision, the defense of lack of legal entitlement is upheld and declared well-founded, respectively, in favor of Nombre165825 and Nombre110791. Likewise, by majority decision, the defense of lack of legal entitlement raised by the State’s representative is partially upheld. Consequently, the claims in the complaint are declared partially well-founded, with all relief not expressly granted deemed denied. The decision finding that the plaintiff had failed the probationary period (período de prueba), contained in memorandum DRH-806-2010 dated November 3, 2010, of the Dirección de Recursos Humanos del Ministerio de Ambiente, Energía y Telecomunicaciones, is annulled, as are the decisions addressing the administrative appeals (recursos administrativos) against that decision and those implementing it.

Upon this judgment becoming final, Nombre110791 is ordered reinstated as a permanent employee (en propiedad) to a position identical in nature to the position he held at the time of termination. The defendant is ordered to pay back pay for the period during which he was removed, together with all benefits and salary supplements (pluses) to which he was entitled, and to submit extraordinary payroll reports for those periods to the Caja Costarricense del Seguro Social and other social welfare entities, as well as to make the applicable deductions. Inflation adjustment and statutory interest are awarded on those amounts from the time they should have been paid until actual payment. The State shall bear the costs with respect to the plaintiff. Judge Córdoba Ramírez dissents and states his reasons separately.” 7. The State’s representative filed an appeal on points of law (recurso de casación), expressly stating the grounds on which she relied to challenge the Tribunal’s position.

8. The procedures before this Tribunal have complied with all statutory requirements.

Opinion drafted by Justice Escoto Fernández CONSIDERATIONS OF LAW

I.Nombre110791 sued the State, Nombre110793, and Nombre165825, the latter having been joined to the litigation (litis) by the court on its own motion. He stated that, beginning on December 3, 2007, he was appointed to position 105595, professional class 1, specializing in forestry engineering, and assigned to the Secretaría Técnica Ambiental (hereinafter SETENA) of the Ministerio de Ambiente, Energía y Telecomunicaciones (then MINAET and, as of the present and hereinafter, MINAE). He added that, on August 16, 2010, through personnel action No. 810065779, he was appointed as a permanent employee, subject to a three-month probationary period. He stated that, through memorandum DRH-806-2010 dated November 3, 2010, he was notified of the termination of his duties pursuant to sections 30 and 31 of the Estatuto del Servicio Civil (hereinafter ESC). He asserted that the probationary-period and annual evaluations conducted by Nombre110793 were cited as the grounds for that action.

He alleged that his appeals against the termination were denied. He explained that report DGSC-ARSP-028-ECPP-11 recommended his removal from the Register of Eligible Candidates (Registro de Elegibles), but failed to mention that he had been appointed since December 2007 and had undergone two evaluations in 2008 and 2009. He stated that, through personnel action No. 211079118, he was terminated effective February 28, 2011. He emphasized that his interim appointment (nombramiento como interino) had been extended from December 2007 to August 2010, during which period he fully performed his responsibilities and therefore received excellent annual ratings in 2008 and 2009. He asserted that he had received only one warning. He claimed that the revocation of his appointment resulted from three situations. He stated that the first concerned his opinions regarding “Proyecto La Arboleda,” case file No. 205-2007-SETENA, because he had opposed its environmental feasibility (viabilidad ambiental), for which reason he was described as insubordinate and a poor performer who disregarded the technical opinions of others.

He stated that Nombre110793 required him to conduct the environmental impact study (estudio de impacto ambiental), even though doing so violated Decree No. 25902-MIVAH-MP-MINAE, and that he expressed his disagreement. He added that, in the Mar Serena project, case file 1101-2007, his technical report on vegetation cover (cobertura vegetal) was disregarded. He stated that, in this matter, he sought support from a group of SETENA forestry engineers because he had been pressured by an adviser to the Ministerio de la Presidencia; nevertheless, his recommendations were not followed. He asserted that the third reason was the Plaza Comercial Lincoln project, case file 1805-2005, processed by the same company that had previously promoted Proyecto La Arboleda. He explained that he was one of the environmental analysts with the highest number of approved projects in 2010. He requests a judgment declaring: a) that the termination of his duties was unlawful; b) that personnel action No. 211079118 is null and void; c) that his reinstatement to position 105595 is warranted; c) that the State must pay him back pay from February 28, 2011 through the date of his reinstatement, with those amounts adjusted for inflation, plus statutory and default interest; d) that the co-defendants must pay ¢30.000.000,00 for non-pecuniary harm; and costs.

During the preliminary hearing, he limited his action against co-defendants Nombre165825 and Nombre110793 to payment for non-pecuniary harm, jointly and severally with the State. Co-defendants Nombre165825 and the State opposed the complaint and raised the defenses of limitation and lack of legal entitlement. Co-defendant Nombre110793 did not answer and was declared in default. The Tribunal unanimously dismissed the limitation defense. By majority decision, it upheld the defense of lack of legal entitlement in favor of Nombre165825 and Nombre110793, and partially upheld it with respect to the State. It declared the complaint partially well-founded. It annulled the decision finding that the plaintiff had failed the probationary period, as well as the related decisions. It ordered the plaintiff reinstated to a position identical in nature to the position he held at the time of termination.

It ordered the State to pay back pay for the period of termination, together with the statutory benefits and salary supplements, and to submit extraordinary payroll reports for those periods to the Caja Costarricense del Seguro Social, subject to the applicable deductions. It awarded inflation adjustment and statutory interest on those amounts from the time they should have been paid until actual payment. It imposed costs on the State, which, disagreeing with the decision, now appeals on points of law.

II.Although the State’s representative raises five substantive grounds, given the manner in which this matter is decided, only the first will be analyzed. In her challenge, the State’s representative alleges the failure to apply sections 191 and 192 of the Political Constitution, as well as sections 20(f), 30, and 31 of the Estatuto del Servicio Civil (hereinafter ESC). She argues that the probationary period (período de prueba) in public employment is based on the principles of legality and suitability, the legal basis for which is found in constitutional provision 191. She notes that, pursuant to section 20 of the ESC, public officials must be selected in accordance with the objective criteria of “merit” and “ability,” that is, proven suitability (idoneidad comprobada). As relevant here, she states that, under subsection (f) of the aforementioned section 20, passing the probationary period is a requirement for entering the Civil Service.

She asserts that sections 30 and 31 of the ESC govern that probationary period. She adds that section 25 of the Reglamento governing that Statute (hereinafter RESC) establishes the formalities applicable to administrative appointment actions (actos administrativos de nombramiento), which must be issued by the competent authority and specify “the effective date,” on which the employee’s rights and obligations depend. She states that the term of the probationary period is a regulated matter, as are any payments that must be made, in accordance with the principle of budgetary legality. She transcribes sections 30 and 31 of the ESC. She contends that the claimant’s lack of suitability follows from the principle of legality—an express rule establishing the parameters of the concept of “proven suitability”—and from the background of this case (the probationary-period evaluation form and its extension).

She states that, in the matter under review, exclusive jurisdiction rests with the Human Resources Directorate and the Director General of the Civil Service, and that such jurisdiction cannot be construed as deriving from the Ley General de la Administración Pública (hereinafter LGAP). She adds that, based on the relationship among the cited provisions, the judges’ argument concerning the protection afforded by the “principle or guarantee of job security” is inapplicable, since it is established that the termination occurred during the “probationary period.” Consequently, she emphasizes, he was not covered by the “guarantee of job security.” She cites decisions of the Second Chamber in support of her position. She asserts that the Tribunal’s conclusion that, during that period, Mr. Nombre110791 was protected by the “guarantee of job security” is not only contrary to the ESC but also erroneous, as it distorts the probationary period at issue.

She stresses that the Tribunal’s erroneous application and interpretation occurred when the judges found that the “guarantee of job security” had been violated by terminating the claimant during that period without first sanctioning his misconduct or conducting an administrative proceeding (procedimiento administrativo). She maintains that, according to the Second Chamber, the claimant did not enjoy job-security status because, at the time of termination, his permanent appointment (nombramiento en propiedad) had not become final.

III.The Tribunal cited several decisions of the Second and Constitutional Chambers in support of its position. It added that there are two lines of case law regarding the probationary period. On the one hand, it stated, the Constitutional Chamber has held that terminating an official’s appointment during the probationary period is lawful provided that the decision is clearly substantiated. It has likewise held that dismissal during the probationary period does not require the Administration to follow a procedure before termination, insofar as it has the authority to assess whether public servants should remain in a position—provided that its determination is objectively substantiated—as a means of safeguarding the principle of “proven suitability.” It added that the Chamber has also found that the rationale for the probationary period lies in the need to evaluate officials’ performance and their ability to hold public office, as a means of ensuring compliance with that principle; accordingly, dismissal during that phase does not constitute a sanction in the strict sense.

However, it noted that a divergent line of authority also persists within the Constitutional Chamber, holding that, in all cases, the Administration must afford both the formal and substantive guarantees of due process (debido proceso), which are inherent in the right of defense, before terminating the appointment of a person in such circumstances. It referred to a dissenting opinion of the Constitutional Chamber in support of that position. It then found that a standard requiring recourse to an administrative proceeding has gradually prevailed and, in its view, also applies to the probationary period. Regarding the specific case, it stated that, through official letter no. DRH-806-2010 of the MINAE Human Resources Directorate dated 3 de noviembre de 2010, Mr. Nombre110791 was informed of the reasons underlying the termination of his appointment and was granted three business days to respond.

It partially transcribed the official letter in question. It found that the foregoing clearly involved misconduct or breaches arising from the employment relationship and that he was also informed that he had failed the probationary period, without any indication that a prior administrative proceeding had been conducted. It stated that not even warnings had been submitted to ensure that the allegations of misconduct were not unexpected. It explained that only the alleged misconduct was identified, that he was deemed responsible for it, and that, on that basis, the probationary period was deemed “unsatisfactory.” Thus, it emphasized, the minimum requirements of due process were not met in this case. It continued that, in the opinion of the Tribunal’s majority, that circumstance alone creates an incurable defect in the action, rendering it null and void (nulidad). It asserted that, in employment relationships, the employer is required to prove whether the misconduct underlying the punitive action actually occurred.

Nevertheless, it observed that, in this case, the only information in the record is the communication stating the reason for the “unsatisfactory” assessment under review. It therefore held that his culpability could not be presumed and used as the basis for finding that he had failed the probationary period in the complete absence of any proceeding. It asserted that the administrative action (acto administrativo) was consequently affected by two defects: first, the absence of an administrative proceeding and, second, a presumption of culpability based on the supervisor’s complaint contained in the evaluation of the claimant’s probationary period. Accordingly, it added, the grounds (motivo) for the administrative action were also defective. It contended that, although sections 31 and 32 of the ESC refer to the possibility of discretionary removal (libre remoción), this “discretion” is not synonymous with arbitrariness.

It held that, because the conduct attributed to him constituted breaches of the employment relationship, the minimum requirement was compliance with the basic elements of due process and objective proof of the alleged misconduct.

IV.In this regard, this Chamber has reiterated its position concerning the lawfulness of terminating the appointment (cese del nombramiento) of a public official during a probationary period (período de prueba), provided that such termination includes an adequate statement of reasons (motivación) (See, along these lines, the decisions of this adjudicative body, no. 1266-F-S1-2012 of 10 hours 5 minutes on 4 de octubre de 2012 and 835-2015 of 3 hours 15 minutes on 23 de julio de 2015). The foregoing is likewise consistent with opinions expressed by the Tribunal Constitucional, to the effect that the right to “improper job stability” (“estabilidad laboral impropia”) is not violated when the official is serving a probationary period (See, along these lines, judgments 892-2009 of 13 hours 18 minutes on 3 de enero de 2009; no. 6997-2011 of 14 hours 49 minutes on 31 de mayo de 2011 and 1265-2015, of 9 hours 5 minutes on 30 de enero de 2015).

Indeed, in the view of this adjudicative body, provisions 20 subsection f); and 30 of the ESC establish, as one of the requirements for obtaining a permanent appointment (ingresar en propiedad) under the civil service system (régimen del servicio civil), the requirement of “satisfactorily completing” the probationary period. In turn, provision 31 of that body of law stipulates: a) that, at the discretion of the respective Head, a probationary period may be required in all cases of promotion or transfer in order to ensure the best public service; b) that the authorized Minister or Head may “freely dismiss” the employee during the probationary period, provided that the Director General is informed of the reasons for doing so; and c) that the Director General may order the removal of any civil servant during the probationary period in cases of evident fraud, confusion, or clerical error, in which event the interested party shall first be heard.

Accordingly, it is undeniable that a public official must “satisfactorily” complete the probationary period as an indispensable requirement for obtaining a permanent appointment under the civil service system. Likewise, in order to guarantee the principle of suitability (principio de idoneidad) that must govern appointments under the statutory system (régimen estatutario) during that period, the Administration’s powers permit the “free” dismissal of the official, provided that reasons are given for it. In that regard, concerning the statement of reasons for an administrative act (acto administrativo), this Chamber of the Court has held: “On this matter, it must be considered that the statement of reasons constitutes a formal element of every administrative act, from which it follows that any decision by the Administration must be supported by reasons, which may be more or less detailed depending on the subject matter of the competent body’s decision.

In this regard, there is an intrinsic relationship between the statement of reasons and the grounds (motivo) (an objective substantive element), since the former must make the latter ascertainable, insofar as this is essential to understanding and reviewing the content prescribed in the act, which ultimately defines its effect. Now, pursuant to provision 136 of the LGAP, the statement of reasons may be ‘concise’ and may even ‘consist of an explicit or unequivocal reference to the grounds for the application submitted by the person subject to the Administration, or to prior proposals, opinions, or decisions.’ Clearly, the provision under discussion also states that, in the latter circumstance, these must be communicated; this is intended to permit knowledge and assessment of the factual and legal grounds on which the adopted decision is based. It follows from the foregoing that the absence of a statement of reasons would vitiate the act insofar as the reasons for ordering a particular legal effect (the content of the act) cannot be ascertained.” In light of the foregoing, it is beyond dispute that, in the specific case, on 16 de agosto de 2010, the claimant, Nombre110791, received a permanent appointment to position number 105591, as a Civil Service Professional 1-A specializing in forestry matters and assigned to SETENA, after having been selected from shortlist number 178010.

Furthermore, in the performance of his duties, he was evaluated by his immediate supervisor, Mr. Nombre110793, who found him unsuitable for the position (official letter DRH-806-2010 dated 03 de noviembre del 2010). That decision determined that: “1. Assistance and cooperation among the Different Directorates of MANAET (sic) and other institutions are fundamental to achieving timely solutions; however, Eng. Nombre110791 did not understand his role within the machinery of public service. Official letter SG-192-2010 of 06 de mayo de 2010 is attached as evidence. / 2. The official fails to comply with working hours, despite having been reprimanded in that regard on repeated occasions in the presence of the Technical Director of SETENA (on 22 de junio del 2010), a situation that he did not correct. / 3. Eng. Nombre110791 has demonstrated problems with multidisciplinary and interdisciplinary teamwork, which is essential to the environmental impact assessment (evaluación de impacto ambiental) review process.

Likewise, there have been constant verbal complaints regarding his inappropriate vocabulary, as well as his improper treatment of users of the services provided by SETENA. Similarly, he has repeatedly shown disrespect for technical opinions issued by coworkers who are specialists in specific fields. / 4. From a technical standpoint, the environmental assessment instruments (instrumentos de evaluación ambiental) prepared by Eng. Nombre110791 had to be substantially corrected at weekly departmental meetings by the Department Coordinator or by the Comisión Plenaria. In many cases, Eng. Nombre110791 recommended requesting arbitrary and unsupported requirements, including some that had already been submitted, in contravention of Ley 8220,” and he was evaluated as follows: “Initiative: the civil servant’s willingness to address the various processes and propose timely solutions”: Fair; “Cooperation: the willingness to accept duties related to the position in order to achieve the objectives of the process”: Good; “Discipline: compliance with laws, regulations, circulars, and orders, as well as the civil servant’s punctuality and regular attendance”: Fair; “Personal appearance: orderliness, propriety, and cleanliness in the civil servant’s attire and person, in accordance with the requirements of the position”: Good; “Human relations: the civil servant’s ability to relate to and get along with the public, coworkers, supervisors, and other officials”: Fair; “Quality of Work: the degree of thoroughness, accuracy, and efficiency of the civil servant’s work product”: Fair.” Likewise, under the terms of that official letter, the claimant was notified of the termination of his permanent appointment because he had not successfully completed the probationary period, having been declared unsuitable for the position by the Coordinación del Área de Gestión Administrativa and the Jefatura de la Dirección de Recursos Humanos del Ministerio (facts deemed proven 2 through 4).

On 11 de noviembre de 2010, said individual filed a “motion for reconsideration, with a subsidiary appeal and concomitant nullity claim” (“recurso de revocatoria, con apelación en subsidio y nulidad concomitante”); accordingly, on 15 de noviembre del 2010, at the request of the Dirección de Recursos Humanos, the Coordinador del Departamento de Evaluación Ambiental de SETENA submitted an expanded probationary-period evaluation addressing various aspects of his performance of services. It highlighted his lack of a spirit of cooperation and assistance, his disrespect toward high-ranking officials, and several late arrivals for which he had been reprimanded. It further stated that, on one occasion, he modified the legal content of draft decisions without the approval of the Departamento de Asesoría Jurídica de SETENA or the Comisión Plenaria Institucional. It added that the claimant exhibited shortcomings in SETENA’s “multidisciplinary and interdisciplinary” work.

It also stated that his conduct had caused annoyance and that he appeared uncomfortable with the comments made by his colleagues, in addition to his use of inappropriate and overly familiar language during working hours. It further stated that his work did not meet the required standard of quality, exhibiting contradictions and noncompliance with the provisions of current decisions, such that his recommendations were rejected. It also added that, during his probationary period, the individual evaluated analyzed only a low percentage of the projects assigned to his unit or department—in fact, only 3,75% of the cases analyzed—(facts deemed proven 5 and 6). For those reasons, by official letter R-DRH-AJ-243-2010 of 8 hours on 7 de diciembre de 2010, the Dirección de Recursos Humanos del MINAE ordered the denial of the motion for reconsideration and, by decision no. R-E-017-2011-MINAE of 7 hours 15 minutes on 24 de enero de 2011, the Ministro de Ambiente, Energía y Telecomunicaciones upheld the termination of the claimant’s appointment, thereby exhausting administrative remedies (agotada la vía administrativa).

Based on the foregoing, this adjudicative body finds it indisputable that, in the case under review, the Administration acted in accordance with the cited statutory rules. It not only terminated the claimant during the probationary period in which he was serving, as a stage preceding the acquisition of his permanent appointment, but also adequately stated the reasons for the administrative acts through which it notified him of and upheld the termination of his duties. Thus, this case concerns the revocation of an appointment during the evaluation period because the Administration determined that the official had not met the requirements of the position; no violation of due process (debido proceso) arises therefrom, nor was the defendant required to conduct an administrative disciplinary proceeding (procedimiento administrativo sancionatorio) for that purpose. For the reasons stated, the claim of error (agravio) must be sustained, and, because it is unnecessary, this Chamber will refrain from analyzing the remaining claims.

V.Based on the foregoing reasoning and discussion, the appeal must be granted. The judgment shall be quashed. Ruling on the merits, the defense of lack of entitlement (excepción de falta de derecho) shall be sustained. The complaint shall be dismissed, with costs assessed against the claimant pursuant to provision 193 of the Código Procesal Contencioso Administrativo. Needless to say, given the manner in which the matter is resolved, no ruling is issued on the remaining claim of error raised by the appellant in cassation (casacionista).

THEREFORE

The appeal filed is granted. The judgment is vacated. Ruling on the merits, the defense of lack of entitlement is sustained. The complaint is dismissed. Costs shall be borne by the claimant.

*110024451178LA* RES: 000160-F-TC-2016 TRIBUNAL DE CASACIÓN DE LO CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA. San José, a las nueve horas cuarenta minutos del siete de diciembre de dos mil dieciséis.

Proceso de conocimiento establecido en el Juzgado de Trabajo del Segundo Circuito Judicial de San José, por Nombre110791 , ingeniero forestal; contra Nombre110793 , Nombre165824 , trabajadora social, vecina de San José, el ESTADO, representado por su procuradora, Nombre2400 , casada, y Nombre165825 , soltero, ingeniero. Figura además, como apoderados especiales judiciales del accionado Nombre165825 , el licenciado Luis Antonio Álvarez Chaves, casado, y la licenciada Milagro Quirós Rodríguez, soltera. Las personas físicas son mayores de edad y, con las salvedades hechas, en unión libre, abogadas, vecinas de Heredia.

RESULTANDO

1. Con base en los hechos que expuso y disposiciones legales que citó, el actor estableció proceso de conocimiento, a fin de que en sentencia se declare: "Se declare ilegal el cese de funciones y mi despido. / Se anule la acción de personal N° 211079118. / Se me reinstale en el puesto 105595. / Se me reconozcan los salarios caídos desde el 28 de febrero del 2011 y hasta mi efectiva reinstalación. / Se me indexe la suma adeudada. / Se me reconozcan intereses legales y moratorios sobre la suma adeudada. / Se me reconozca la suma de treinta millones de colones, por concepto de daño moral, el cual básicamente consiste en el desprestigio profesional de que he sido objeto. / Se condene a los demandados (sic) pago de costas procesales y profesionales de esta causa". Durante la audiencia preliminar celebrada el 25 de abril de 2014 y en relación con lo que la demanda fue dirigida en contra de los señores Nombre165825 y Nombre110793 , se aclaró que la demanda se habría de tener direccionada en su contra en cuanto al daño moral, únicamente para que sea condenados solidariamente con el Estado.- 2. De oficio el Juzgado de Trabajo del Segundo Circuito Judicial de San José se declaró incompetente en razón de la materia, y ordenó el envío del asunto al Tribunal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José.

3. La accionada Nombre165824 , el accionado Nombre165825 , y la representación del Estado contestaron negativamente la demanda. El Estado y el demandado Nombre165825 opusieron la defensa de Falta de Derecho y manifiesto su negativa en conciliar. El accionado Nombre110793 fue declarado rebelde.

4. La Audiencia Preliminar se llevó a cabo en cuatro oportunidades. La primera se realizó el 17 de mayo de 2013, oportunidad en que las partes hicieron uso de la palabra y se saneó el proceso al conferírsele un plazo a la demanda Nombre165824 a fin de que corrigiera la contestación de la demanda. La segunda se realizó el 25 de abril de 2014, momento procesal en el cual se aclaró la pretensión con relación al daño moral, y el Estado interpuso la defensa previa de prescripción. La tercera se realizó el 11 de junio de 2014, momento procesal en el cual se saneó el proceso otorgándosele un plazo a la accionada Nombre165824 para que aporte o indique su patrocinio de letrado. La cuarta se realizó el 22 de agosto de 2014, oportunidad procesal en que la parte actora mantiene solicitud de desistimiento de la demanda contra la accionada Nombre165824 , la Jueza acogió la solicitud y declaró terminado el proceso con relación a la demandada Nombre165824 . Con respecto a la defensa de prescripción planteada por el Estado, se reservó para ser conocida en sentencia.

5. El juicio oral y público se realizó el 18 de mayo de 2015, con la participación de las partes.

6. El Tribunal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José, Sección Cuarta, Anexo A, integrada por los jueces Felipe Córdoba Ramírez, Ricardo Madrigal Jiménez y Francisco Muñoz Chacón, en sentencia n.° 51-2015-IV de las 16 horas del 28 de mayo de 2015, dispuso: “Por unanimidad se rechaza la excepción de prescripción interpuesta por el Estado. Por mayoría, se acoge y se declara (respectivamente) la defensa de falta de derecho en beneficio de los señores Nombre165825 y Nombre110791 . Igualmente, por mayoría se acoge parcialmente la defensa de falta de derecho interpuesta por la representación estatal. En consecuencia, se declara parcialmente con lugar los extremos de la demanda, entendiéndose rechazada en todo aquello que no sea otorgado expresamente. Se anula el acto de pérdida del período de prueba del señor actor contenido en el oficio DRH-806-2010 de fecha 3 de noviembre del 2010 de la Dirección de Recursos Humanos del Ministerio de Ambiente, Energía y Telecomunicaciones; así como los actos en los cuales se conocieron los recursos administrativos contra dicho acto y los que la ejecutaron.

Se ordena la reinstalación en propiedad del señor Nombre110791 a un puesto de idéntica naturaleza que el que presentaba al momento del cese, a partir de la firmeza de la presente sentencia. Se condena a la demandada al pago de salarios caídos por el período que se ha encontrado cesado, con todos los beneficios y pluses a que tuviera derecho, al igual que hacer las planillas extraordinarias de reporte por esos períodos ante la Caja Costarricense del Seguro Social y demás entes de interés social; así como las deducciones que correspondan. Sobre estas sumas se reconocen indexación e intereses legales desde el momento en que debieron ser canceladas hasta su efectivo pago. Corren las costas a cargo del Estado con respecto al señor actor. El Juez Córdoba Ramírez salva su voto y lo razona por separado.” 7. La representante del Estado formuló recurso de casación indicando expresamente las razones en las que se apoya para refutar la tesis del Tribunal.

8. En los procedimientos ante este Tribunal se han observado las prescripciones de ley.

CONSIDERANDO

I.Nombre110791 , demandó al Estado, a Nombre110793 y a Nombre165825 (este último incorporado de oficio a la litis). Manifestó, fue nombrado en el puesto 105595, clase profesional 1 con especialidad en ingeniería forestal, destacado en la Secretaría Técnica Ambiental (en adelante SETENA), del Ministerio de Ambiente, Energía y Telecomunicaciones (entonces MINAET a la fecha y en lo que sigue MINAE), a partir del 3 de diciembre de 2007. Agregó, el 16 de agosto de 2010, por acción de personal no. 810065779, fue nombrado en propiedad, sujeto a un período de prueba de tres meses. Señaló, por oficio DRH-806-2010, del 3 de noviembre de 2010, le fue comunicado el cese de funciones, acorde a los cánones 30 y 31 del Estatuto del Servicio Civil (en lo sucesivo ESC). Aseguró, como fundamento se citó las evaluaciones del período de prueba y anuales realizadas por el señor Nombre110793 . Acusó, sus recursos contra el cese fueron declarados sin lugar.

Explicó, el informe DGSC-ARSP-028-ECPP-11, recomendó su exclusión del Registro de Elegibles, mas, omitió mencionar que estuvo nombrado desde diciembre de 2007 y que fue objeto de dos valoraciones en 2008 y 2009. Expresó, por acción de personal no. 211079118 fue cesado desde el 28 de febrero de 2011. Enfatizó, su nombramiento como interino fue prorrogado desde diciembre de 2007 a agosto de 2010, plazo en el cual cumplió a cabalidad con sus responsabilidades, por lo cual tuvo calificaciones anuales excelentes, en el 2008 y 2009. Aseveró, solo tuvo una llamada de atención. Afirmó, su revocatoria del nombramiento responde a tres situaciones. La primera, apuntó, se debe a sus opiniones sobre el “Proyecto La Arboleda”, expediente no. 205-2007-SETENA, por haberse opuesto a la su viabilidad ambiental, motivo por el cual se dijo que, era indisciplinado y de bajo rendimiento, e irrespetaba los criterios técnicos de otros.

Mencionó, el señor Nombre110793 , le obligaba a realizar el estudio de impacto ambiental, a pesar que violentaba el Decreto no. 25902-MIVAH-MP-MINAE, ante lo cual mostró su inconformidad. Agregó, en el proyecto Mar Serena, expediente 1101-2007, se desechó su informe técnico sobre la cobertura vegetal. Comentó, en este caso solicitó apoyo de un grupo de ingenieros forestales de SETENA, por cuanto recibió presión de un asesor del Ministerio de la Presidencia, no obstante, sus recomendaciones no fueron acatadas. Aseveró, la tercera razón fue el proyecto Plaza Comercial Lincoln, expediente 1805-2005, tramitado por la misma empresa que antes promovió el proyecto La Arboleda. Detalló, fue uno de los analistas ambientales con más proyectos aprobados en el año 2010. Solicita en sentencia se declare: a) la ilegalidad de su cese de funciones; b) nula la acción de personal no. 211079118; c) procedente su reinstalación en el puesto 105595; c) el Estado debe cancelarle los salarios caídos desde el 28 de febrero del 2011 y hasta la data de su reinstalación, sumas a indexar, más intereses legales y moratorios; d) los codemandados deberán reconocer daño moral por ¢30.000.000,00; mas costas.

Durante la audiencia preliminar limitó su demanda contra los coaccionados Nombre165825 y Nombre110793 , al pago del daño moral, solidariamente con el Estado. Los codemandados Nombre165825 y el Estado, contestaron en forma negativa, opusieron las excepciones de prescripción y falta de derecho. El codemandado Nombre110793 , no contestó, declarándose su rebeldía. El Tribunal rechazó por unanimidad la excepción de prescripción. Acogió por mayoría la falta de derecho en beneficio de los señores Nombre165825 y Nombre110793 , y parcialmente en cuanto al Estado. Declaró parcialmente con lugar la demanda. Anuló el acto que tuvo por fracasado el período de prueba del actor, así como de los actos conexos. Ordenó reinstalar al accionante, a un puesto de idéntica naturaleza al que ostentaba al momento del cese. Condenó al Estado al pago de salarios caídos por el período del cese, más los beneficios y pluses de ley, así como a presentar las planillas extraordinarias de esos períodos ante la Caja Costarricense del Seguro Social; con las deducciones correspondientes. Reconoció indexación e intereses legales sobre esas sumas, desde el momento en que debieron ser canceladas y hasta su efectivo pago. Impuso las costas al Estado, quien inconforme acude a casación.

II.Aunque la representación estatal endilga cinco motivos por el fondo, por la forma en que se resuelve, solo se entrará al análisis del primero. En su censura, la representante estatal acusa desaplicación de los numerales 191 y 192 de la Constitución Política, así como de los cánones 20 inciso f), 30 y 31 del Estatuto del Servicio Civil (en lo sucesivo ESC). Alega, el período de prueba en el empleo público está basado en los principios de legalidad e idoneidad, cuyo sustento legal se encuentra en el mandato 191 Constitucional. Apunta, acorde al ordinal 20 del ESC, la selección de funcionarios públicos debe hacerse conforme a los criterios objetivos de “mérito" y “capacidad”, es decir, de idoneidad comprobada. En lo de interés, dice, para ingresar al Servicio Civil, según el inciso f) de la norma 20 citada, se requiere pasar el periodo de prueba. Asevera, los ordinales 30 y 31 del ESC regulan ese espacio de prueba.

Adiciona, el cardinal 25 del Reglamento a ese Estatuto (en adelante RESC), dispone las formalidades de los actos administrativos de nombramiento, los cuales deben ser emitidos por autoridad competente, fijando “el rige”, aspecto del cual dependen los derechos y obligaciones del trabajador. Refiere, la vigencia del plazo de prueba es un tema reglado, tanto como los pagos que deban hacerse, acorde al principio de legalidad presupuestaria. Transcribe los numerales 30 y 31 del ESC. Relata, del principio de legalidad, -norma expresa que establece los parámetros dentro del concepto de “idoneidad comprobada”-, y de los antecedentes de este caso (formulario de evaluación del periodo de prueba y su ampliación), se desprende la inidoneidad del actor. Señala, en el asunto de examen, la competencia exclusiva corresponde a la Dirección de Recursos Humanos y al Director General del Servicio Civil, sin que pueda interpretarse, derive de la Ley General de la Administración Pública (en lo siguiente LGAP).

Agrega, conforme a la relación de los preceptos citados, no tiene cabida el argumento de la tutela del “principio o garantía de estabilidad” que invocan los jueces, toda vez que se constata, el cese laboral acaeció durante el “período de prueba”. Por consiguiente, recalca, no estaba cubierto por la “garantía de estabilidad”. Cita fallos de la Sala Segunda en apoyo de su tesis. Asegura, la tesis del Tribunal en el sentido que, durante ese lapso, el señor Nombre110791 se encontraba protegido de la “garantía de estabilidad” no solo es contraria al ESC sino que es además equívoca, desnaturalizando el plazo de prueba en cuestión. Resalta, la errónea aplicación e interpretación del Tribunal se dio cuando los jueces consideraron que la “garantía de estabilidad” fue vulnerada al cesar al actor dentro de ese periodo, sin sancionar previamente sus faltas ni efectuarle un procedimiento administrativo. Afirma, acorde a la Sala Segunda, el accionante no contaba con la condición de estabilidad, puesto que, al momento del cese, no se había consolidado su nombramiento en propiedad.

III.El Tribunal citó varios fallos de la Salas Segunda y Constitucional en apoyo de su tesis. Agregó, sobre el período de prueba existen dos corrientes jurisprudenciales. Por un lado, refirió, la Sala Constitucional ha manifestado, el cese de un nombramiento durante el período de prueba de un funcionario resulta legítimo siempre que se encuentre claramente fundamentado. Asimismo que, la destitución durante el plazo de prueba, no obliga a la Administración a seguir un procedimiento previo al cese en tanto ésta cuenta con la potestad de valorar la permanencia de los servidores en un puesto -siempre y cuando lo fundamente de manera objetiva- como medio para salvaguardar el principio de “idoneidad comprobada”. Agregó, también ha estimado esa Sala, que el período de prueba encuentra su razón de ser en la necesidad de evaluar el desempeño de los funcionarios y sus habilidades para ocupar un cargo público, como una forma de garantizar el respeto al principio dicho, por lo cual, el despido en esa fase no constituye una sanción propiamente dicha.

Ahora bien, apuntó, en la misma Sala Constitucional subsiste una corriente divergente en el sentido de que la Administración debe, en todos los casos, otorgar en su sentido formal y material, las garantías del debido proceso, consustancial al derecho de defensa, para cesar el nombramiento de una persona en tal situación. Aludió a un voto salvado de la Sala Constitucional en apoyo de esa tesis. Luego, estimó, se ha ido imponiendo un criterio sobre la necesidad de acudir al procedimiento administrativo, que en su entender también repercute en el período de prueba. Sobre el caso concreto, alegó, mediante oficio de la Dirección de Recursos Humanos del MINAE no. DRH-806-2010 de 3 de noviembre de 2010, se le indicó al señor Nombre110791 , las razones que privaron para el cese del nombramiento, confiriéndole el plazo de tres días hábiles para que se manifestase al respecto. Transcribió parcialmente el oficio en cuestión.

Consideró, de lo expuesto es claro, se está en presencia de faltas o incumplimientos propios de la relación laboral, comunicándosele además que reprobó dicho período, sin que se indique, se haya realizado un procedimiento administrativo previo. Relató, ni siquiera se aportan llamadas de atención, para garantizar que tales faltas no resultaran intempestivas. Explicó, solo se indica la supuesta falta, de la cual se le considera culpable y sobre esa base se procede a la “improbación” del período de prueba. Así, subraya, en la especie no se satisface el respeto mínimo al debido proceso. Continuó, en criterio de la mayoría del Tribunal, ese solo aspecto genera un vicio insostenible en el acto, que determina su nulidad. Aseguró, en relaciones de empleo, el patrono está en la obligación de demostrar si las faltas que motivan el acto sancionatorio ocurrieron en la realidad. Sin embargo, comentó, en este caso la única información constante es la que comunica el motivo de la “improbación” objeto de examen.

De esa manera, afirmó, no es posible presumir su culpabilidad y sobre esa base sustentar que malogró el plazo de prueba, con ausencia absoluta de procedimiento. Aseveró, por ello, se está ante dos vicios del acto administrativo, por un lado la ausencia de procedimiento administrativo, por el otro, una presunción de culpabilidad a partir de la denuncia del jefe que consta en la valoración del período de prueba del actor. De esa suerte, agregó, el motivo de la actuación administrativa también se encuentra viciado. Adujo, si bien las normas 31 y 32 del ESC referencian la posibilidad de la libre remoción, esta "libertad" no es sinónimo de arbitrariedad. Estipuló, al endilgarse situaciones que constituyen faltas a la relación laboral, lo mínimo era cumplir con los elementos básicos del debido proceso y la acreditación objetiva de las supuestas faltas.

IV.Al respecto esta Cámara ha reiterado su criterio en cuanto a la licitud del cese del nombramiento del funcionario público en período de prueba, siempre y cuando aquel cuente con la debida motivación (Véanse en esa línea las resoluciones de este órgano decisor, no. 1266-F-S1-2012 de las 10 horas 5 minutos del 4 de octubre de 2012 y 835-2015 de las 3 horas 15 minutos del 23 de julio de 2015). Lo anterior se ajusta igualmente a opiniones expresadas por el Tribunal Constitucional, en el sentido de que no se rompe el derecho a la “estabilidad laboral impropia”, cuando el funcionario se encuentra en período de prueba (Ver en esa línea, los fallos 892-2009 de las 13 horas 18 minutos del 3 de enero de 2009; no. 6997-2011 de las 14 horas 49 minutos del 31 de mayo de 2011 y 1265-2015, de las 9 horas 5 minutos del 30 de enero de 2015). En efecto, para este órgano decisor, los preceptos 20 inciso f); y 30 del ESC, establecen como parte de los requisitos para ingresar en propiedad al régimen del servicio civil, el “pasar satisfactoriamente” el período de prueba.

Por su parte, el canon 31 de dicho cuerpo normativo, estipula: a) que a juicio del Jefe respectivo podrá exigirse en todos los casos de promoción o traslado a fin de garantizar el mejor servicio público; b) que el Ministro o Jefe autorizado, podrá “despedir libremente ” al empleado, durante el período de prueba, siempre y cuando informe al Director General acerca de los motivos que tuvo para hacerlo; y c) el Director General podrá ordenar la remoción de cualquier servidor durante su período de prueba, en casos de fraude, confusión o error material evidentes, en cuyo caso el interesado será escuchado de previo. De esa suerte, resulta innegable, el funcionario público debe superar “satisfactoriamente” el período de prueba, como requisito indispensable para acceder en propiedad al régimen del servicio civil. Asimismo, en aras de garantizar el principio de idoneidad que ha de gobernar los nombramientos en el régimen estatutario durante dicho periodo, las potestades de la Administración permiten el despido “libre” del funcionario, siempre y cuando, éste sea motivado.

En ese sentido, respecto a la motivación del acto administrativo, esta Sala de la Corte, ha señalado: “Sobre el particular debe considerarse que la motivación constituye un elemento formal de todo acto administrativo, de lo que se sigue que cualquier decisión de la Administración debe estar fundamentada, la cual puede ser más o menos detallada según el objeto sobre el cual verse la decisión del órgano competente. En este sentido, existe una intrínseca relación entre motivación y motivo (elemento material objetivo), toda vez que la primera debe permitir el conocimiento del segundo, pero ello en la medida en que resulta esencial para la comprensión y revisión del contenido dispuesto en el acto, y que a la postre define su efecto. Ahora bien, de conformidad con el numeral 136 de la LGAP, la motivación puede ser “sucinta” e incluso “podrá consistir en la referencia explícita o inequívoca a los motivos de la petición del administrado, o bien a propuestas, dictámenes o resoluciones previas”.

Claro está, también se dispone en la norma de comentario que en este último supuesto, estas deben ser comunicadas; ello con la finalidad de permitir el conocimiento y la apreciación de los sustentos, fácticos y jurídicos, sobre los que se basa la decisión adoptada. De lo expuesto se sigue que la falta de motivación viciaría el acto en la medida en que resulten incognoscibles las razones por las cuales se dispuso un determinado efecto jurídico (contenido del acto).” A la luz de lo expuesto en el caso concreto, resulta incontestable, el 16 de agosto de 2010, el accionante, Nombre110791 , fue nombrado en propiedad en el puesto número 105591, como Profesional de Servicio Civil 1-A con especialidad en materia forestal, destacado en la SETENA, por haber sido escogido de la terna número 178010. Además, en el desempeño de sus funciones fue valorado por su superior inmediato, el señor Nombre110793 , quien lo consideró no apto para el puesto (oficio DRH-806-2010 de fecha 03 de noviembre del 2010).

Dicha resolución determinó que:"1. La ayuda y cooperación entre las Diferentes Direcciones del MANAET (sic) y otras instituciones es un elemento fundamental para el logro de soluciones oportunas, sin embargo el Ing. Nombre110791 no comprendió su función en el engranaje del servicio público. Se adjunta el oficio SG-192-2010 del 06 de mayo de 2010 como elemento de prueba. / 2. El funcionario incumple el horario de la jornada laboral, a pesar de habérsele llamado la atención en ese sentido en reiteradas ocasiones, en presencia del Director Técnico de la SETENA (día 22 de junio del 2010), situación que no corrigió. / 3. El Ing. Nombre110791 ha demostrado problemas con el trabajo en equipo, multi e interdisciplinario, acción que es fundamental por el proceso de análisis de evaluaciones de impacto ambiental. De igual forma. Las constantes quejas verbales recibidas por el vocabulario inadecuado, así como el trato inapropiado para con los usuarios de los servicios que brinda la SETENA.

De igual forma son constantes los irrespetos de criterios técnicos emitidos por los compañeros de trabajo, especialistas en temas específicos. / 4. Técnicamente los instrumentos de evaluación ambiental elaborados por el Ing. Nombre110791 , tuvieron que ser corregidos substancialmente en reunión semanal departamental por el Coordinador del Departamento o bien por la Comisión Plenaria. En muchos casos el Ing. Nombre110791 ha recomendado la solicitud de requisitos arbitrarios y sin fundamento, además de algunos que ya han sido aportados, contraviniendo la Ley 8220", y una vez que fue valorado de la forma que sigue: "Iniciativa: disposición del servidor para enfrentar los diferentes procesos y proponer soluciones oportunas" : Regular; "Cooperación: es la voluntad de aceptar funciones afines a su puesto para lograr los objetivos del proceso" : Bueno; Disciplina: Es la observancia de las leyes, reglamentos, circulares y órdenes, así como la puntualidad y asiduidad del servidor": Regular; "Presentación personal: es orden, correcciones y aseo en la vestimenta y persona del servidor, de acuerdo con las exigencias del puesto" : Bueno; "Relaciones humanas: es la capacidad del servidor para relacionarse y congeniar con el público, sus compañeros, jefes y otros funcionarios" : Regular; "Calidad de Trabajo: es el grado de perfección, exactitud y eficiencia de lo producido por el servidor" : Regular”.

Igualmente, conforme a los términos del oficio dicho, le fue comunicado al actor el cese de su nombramiento en propiedad, por no haber superado con éxito el período de prueba al haber sido declarado por la Coordinación del Área de Gestión Administrativa y la Jefatura de la Dirección de Recursos Humanos del Ministerio, no idóneo para el puesto (hechos tenidos por demostrados 2 al 4). El 11 de noviembre de 2010, dicho señor formuló “recurso de revocatoria, con apelación en subsidio y nulidad concomitante”, por lo cual, el 15 de noviembre del 2010, el Coordinador del Departamento de Evaluación Ambiental de SETENA, rindió a solicitud de la Dirección de Recursos Humanos una ampliación de la evaluación del período de prueba, la cual abordó diversos aspectos de su prestación de servicios, de la cual destacó, la falta de espíritu de cooperación y ayuda, el irrespeto para con funcionarios de alta jerarquía, varias llegadas tardías por las cuales fue objeto de llamadas de atención.

Además, que cierta ocasión modificó el contenido legal de los borradores de resolución, sin contar con el aval del Departamento de Asesoría Jurídica de SETENA, ni de la Comisión Plenaria Institucional. A ello agregó, que el accionante, presentaba fallas en el trabajo “multi e interdisciplinario” de la SETENA. También, que sus comportamientos habían generado molestias y se mostraba incómodo con las observaciones que le hacían sus colegas, agregando a ello el uso de un vocabulario inadecuado y de extrema confianza en horas laborales. Adicionó que en su trabajo no presentaba la calidad requerida, mostrando contradicciones e inobservancia con lo estipulado en resoluciones vigentes, de modo que sus recomendaciones eran rechazadas. A ello añadió, que durante su período de prueba, el evaluado solo analizó un porcentaje bajo de los proyectos a cargo de su unidad o departamento -en efecto, solo un 3,75% de los casos analizados- (hechos tenidos por probados 5 y 6).

Por tales razones, mediante oficio R-DRH-AJ-243-2010 de las 8 horas del 7 de diciembre de 2010, la Dirección de Recursos Humanos del MINAE dispuso el rechazo del recurso de revocatoria y mediante resolución no. R-E-017-2011-MINAE de las 7 horas 15 minutos del 24 de enero de 2011, el Ministro de Ambiente, Energía y Telecomunicaciones, confirmó el cese del nombramiento del actor, dándose por agotada la vía administrativa. De lo expuesto, en criterio de este órgano decisor, resulta inobjetable, en el caso de examen, la Administración actuó con apego a las reglas legislativas de cita. No sólo cesó al accionante durante el período de prueba en el cual se encontraba, como estadio previo a la adquisición de su nombramiento en propiedad, sino que motivó adecuadamente los actos administrativos mediante los cuales, le comunicó y confirmó el cese de sus funciones. Así, se está ante un supuesto de revocatoria del nombramiento durante el plazo de evaluación, por considerar la Administración que el funcionario no cumplió con los requerimientos propios del cargo, sin que de ello derive, violación alguna al debido proceso, ni existiera obligación del demandado, de tramitar para ello un procedimiento administrativo sancionatorio. Por las razones expuestas, el agravio deberá ser acogido y por innecesario, se omitirá entrar al análisis de los demás cargos.

V.Con base en lo razonado y expuesto, procede acoger el recurso. Se casará la sentencia. Fallando por el fondo, se acogerá la excepción de falta de derecho. Se declarará sin lugar la demanda, con las costas a cargo del accionante conforme al canon 193 del Código Procesal Contencioso Administrativo. Demás está indicar que dada la forma cómo se resuelve, se omite pronunciamiento sobre el restante agravio formulado por la casacionista.

POR TANTO

Se declara con lugar el recurso interpuesto. Se anula la sentencia. Fallando por el fondo se acoge la excepción de falta de derecho. Se declara sin lugar la demanda. Son las costas a cargo del accionante.
