FINDINGS:

  1. 1The petitioner instituted a possessory title proceeding seeking registration in his name, in the Registro Público de la Propiedad, of the property described as follows: “Land consisting of secondary scrubland (tacotal), undergoing natural regeneration, located in: Flores, La Unión, [Dirección1], in the province of Limón. Area: siete hectáreas, ocho mil seiscientos once metros cuadrados. Bounded to the North by: [Dirección2], [Dirección3], with cuatrocientos dieciséis metros y veintiún centímetros lineales of frontage thereon; to the South by: Río Molinete; to the East by: Quebrada Betel; and to the West, currently by the property of Mr. [Nombre3]. Depicted on Cadastral Survey Plan (Plano Catastrado) Number L - Un millón seiscientos cuarenta y nueve mil cuatrocientos setenta y nueve - dos mil trece,” (folios 8, 9, 12, 13, 30, 54, 116, 124, 168, 173, 216 y 236).-
  2. 2The Procuraduría General de la República entered an appearance in the proceeding under the terms set forth at folios 20 a 24; the Instituto de Desarrollo Rural likewise did so at folio 29, with neither expressing opposition to these proceedings.-
  3. 3Attorney Ronald Rodríguez Cubillo, judge of the Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, by judgment number 95-16 issued at siete horas veintidós minutos del veintisiete de junio del año dos mil dieciséis, ruled: “THEREFORE (POR TANTO): Based on the foregoing, pursuant to the LEY DE INFORMACIONES POSESORIAS N° 139 del 14 de julio de 1941 and its amendments, these POSSESSORY TITLE PROCEEDINGS brought by [Nombre1], widowed, merchant, resident of La Unión de Guápiles, Pococí, Limón, identity card number CED5 – – , ARE APPROVED. The REGISTRO PUBLICO DE LA PROPIEDAD, Real Property Section, shall register in his name, without prejudice to third parties having superior rights and subject to the statutory limitations stated below, the property described as follows: Land consisting of secondary scrubland, undergoing natural regeneration, located in: Flores, La Unión, [Dirección1], in the province of Limón.Area: siete hectáreas, ocho mil seiscientos once metros cuadrados. Bounded to the NORTH by: [Dirección2], [Dirección3], with cuatrocientos dieciséis metros y veintiún centímetros lineales of frontage thereon; to the SOUTH by: Río Molinete; to the EAST by: Quebrada Betel; and to the WEST, currently by the property of Mr. [Nombre3]. The property was valued at dieciséis millones de colones, as all requirements established for such purpose by the Ley de Informaciones Posesorias have been met. A certified copy of this judgment shall serve to register the aforementioned property in the Registro de la Propiedad. Such registration shall advise the titleholder that the area adjacent to Río Molinete and Quebrada Betel, or to any other watercourses that exist or may exist along the boundaries or on the property of Mr. [Nombre1], as specified in artículo 33 de la Ley Forestal Nº 7575, constitutes protected areas (áreas de protección), and the cutting or removal of trees is prohibited.It shall likewise state that the beds and waters of those watercourses are in the public domain (dominio público), as established by the Ley de Aguas, artículo 1, inciso IV, y 3, inciso III. It shall also state that the right-of-way (derecho de vía) of the public road adjoining the northern side of the property to be titled is cincuenta metros de ancho, since it is [Dirección4], [Dirección5], San José – Guápiles, which fully complies with artículo 4 de la Ley General de Caminos Públicos y 19 inciso "a" de la Ley de Informaciones Posesorias. Also applicable are artículos 1, 2, 3, 4, 5, 6, 7 de la Ley de Informaciones Posesorias y 1, 2, 7 y 25 de la Ley de Jurisdicción Agraria, as well as the Ley General de Caminos Públicos, Ley de Conservación de Vida Silvestre y Ley Orgánica del Ambiente. Once this ruling becomes final, the corresponding formal certified judgment (ejecutoria) shall be issued and this matter shall be closed and archived.The participants are hereby advised that this ruling may be challenged; therefore, if any party intends to file an appeal against it, the appeal should also be submitted electronically to the address [...] This is due to the introduction of oral proceedings in agrarian matters. Furthermore, if a party wishes the appellate court to grant an oral hearing, it must so state in the same appellate brief. The parties are likewise advised to designate, as a matter of priority, an email address at which to receive service of notices, because documents recorded in audio or video format (oral judgment) may be sent to them by that means,” (folios 233 al 236 y vuelto).-
  4. 4Deputy Attorney General [Nombre4] filed an appeal, expressly stating the reasons for challenging the trial court’s position (folios 241 al 243).-

5. In the conduct of the proceeding, all legal requirements have been observed, and the judgment contains no errors or omissions capable of rendering it null and void.- Drafted by Judge Darcia Carranza, and

CONSIDERING:

I. The Court concurs with the fact found to have been proven

II.Deputy Attorney General Susana Fallas Cubero appeals the judgment on the following grounds: 1.- The appellant states that the lands for which title is sought were national reserves (reservas nacionales), and therefore the period required to acquire ownership by adverse possession (usucapir) has not been established, since possession is shown only from 1960 onward. 2.- In the initial pleading, the petitioner stated under oath that he acquired the property through original possession (posesión originaria) in 1962, and the testimonial evidence (prueba testimonial) is insufficient to establish occupancy capable of supporting adverse possession; witness [Nombre5] places the title claimant on the property for a longer period. The judgment does not analyze this issue. 3.- Witness [Nombre6] stated that there is a spring (naciente) on the land; however, no report was obtained to determine whether it supplies drinking water to any community or whether it would be advisable to reserve it for that purpose. Based on the foregoing, she requests that the judgment be vacated and that these proceedings subsequently be denied.

III.Currently, it is important to mention that there has been a regulatory evolution regarding lands within national reserves. This evolution has led to a special rule governing the current legal status of untitled lands located in protected areas and belonging to private parties, as is the case with the Ley Forestal and the Ley de Informaciones Posesorias. For its part, the Ley Orgánica del Ambiente, in section thirty-seven, establishes that, although the Executive Branch of our State governed by the rule of law is responsible for determining which lands shall be protected wildlife areas (áreas silvestres protegidas), regardless of their management category, such lands shall become part of state protected areas only once they have been paid for or legally expropriated, unless they are voluntarily placed under the established forestry regime. None of these circumstances has occurred in the case at issue; therefore, the property should not be deemed part of the Patrimonio Natural del Estado.

There is a long line of case law concerning attempts to obtain title to lands located within protected forest areas, and the prevailing position of our Tribunal Agrario is that it must first be shown that the forest resource has been protected through ecological possession (posesión ecológica), while maintaining the ecological function of the property and the forestry suitability of the lands in question; and, second, that possession for at least ten years before the respective decree or law creating the protected forest area in which the property to be titled is located has been demonstrated. These requirements have been fully satisfied in the case before us, making it abundantly clear that the title applicant meets the substantive and formal requirements for obtaining a title eligible for registration in the Registro Público and thereby enjoying the property rights enshrined in our Constitución Política.

To provide some background regarding this position, which has developed into an entire line of case law governing matters of this kind, we will mention several noteworthy decisions. Among them is an initial group of decisions in which possessory-information proceedings (diligencias de información posesoria) were rejected for various reasons, but all of the decisions consistently hold that possession beginning ten years before the creation of the Protected Wildlife Area must be demonstrated. In this case, that area is the Reserva Forestal Cordillera Volcánica Central, created by decreto Ejecutivo N° 5386 - A del 26 de junio de 1975 (see folio 3). Based on the foregoing, it is clear that this circumstance was known and that, consequently, the applicant was required to demonstrate ten years of possession before the stated date on which that Reserve was created. In accordance with the foregoing and section 7 of the Ley de Informaciones Posesorias, the petitioner must demonstrate that the right had vested at least 10 years before the declaration of that forest reserve.

In this case, the testimony must refer to possession exercised beginning 10 years before 1975. Note that [Nombre7] stated that he had known the property since 1960, that the petitioner possessed part of it, and that he had purchased another portion of land from Mr. [Nombre8]. He also stated that there are no springs (nacientes) on the property (see folio 198). The witness [Nombre9] has known the property since 1962, when it already belonged to Mr. [Nombre1]. He also stated that there are no springs on the property, but that its rear boundary adjoins the Molinete River and that, to the east, there is a ditch through which water flows, which is a small creek (folio 199). Lastly, the witness [Nombre10] stated that he had known the property since 1963, when Mr. [Nombre1] was already on it. He also indicated that there are no springs, that there is only a ditch or creek through which water flows in the eastern sector, and that the rear of the property also adjoins the Río Molinete (see reverse of folio 199).

It is important to mention that the witnesses state that Mr. [Nombre1] uses the property for natural regeneration. Regarding the assessment of testimonial evidence intended to demonstrate possession in protected areas, this Tribunal has held: “Article 6 of the Ley de Informaciones Posesorias provides: ‘Proof of possession shall be established through the testimony of three witnesses residing in the canton where the property is located.’ Likewise, Article 7 of the aforementioned law states: ‘When the property to which the information relates is located within a protected wildlife area, regardless of its management category, the title applicant must demonstrate that he or she holds the legal rights to ten-year possession (posesión decenal), exercised for at least ten years before the effective date of the law or decree that created that wildlife area.’- The requirements set forth for obtaining title to land are clear in the Ley de Informaciones Posesorias, as well as in special laws such as the Ley de Suelos, among others.

One of those requirements is the necessary demonstration of ten-year possession through three witnesses; if even one of them is lacking, the possessory-information proceeding must be denied.” (Tribunal Agrario, Voto No. 118-F-06 de las catorce horas treinta minutos del dieciséis de febrero de dos mil seis).- In the case under review, the property is located within the Reserva Forestal Cordillera Volcánica Central, created by decreto Ejecutivo N° 5386 - A del 26 de junio de 1975. Testimony was received from three witnesses, who established the requirements for ecological possession beginning before 1962; therefore, the requirements necessary to obtain title to the property have been satisfied. This Tribunal has repeatedly held that: “... A possessory-information proceeding (Información Posesoria) is a non-contentious judicial proceeding for formalizing a registrable title to a property right acquired through adverse possession (usucapión), upon compliance with the corresponding legal requirements.

Possession under claim of ownership, exercised quietly, publicly, peacefully, and continuously, must be demonstrated (sections 1 of the Ley de Informaciones Posesorias and 856 of the Código Civil). In addition to lacking a title registered or eligible for registration in the Registro Público, the title applicant must expressly state that the property has not previously been registered in the Registro Público. For reasons of public interest, to prevent duplicate registration of the same property, and to protect third parties having superior rights to those of the title applicant, the Law requires notice to certain persons. It also establishes a procedure for filing objections within the Información Posesoria proceeding if any interested party believes that the titling would cause harm (section 8). The Ley de Informaciones Posesorias directs the Judge to treat adjoining landowners as parties and therefore to serve them personally from the outset of the proceeding, because the titling could encompass part of the lands belonging to them... notice must be served on co-owners or condominium owners.

Likewise, to safeguard the interests of the State, the Procuraduría General de la República and the Instituto de Desarrollo Agrario must be treated as parties in order to protect property subject to the public domain and state agricultural property (section 5). Lastly, the law requires all interested parties who may have a legitimate interest in the proceeding to be summoned through publication of a Notice in the Boletín Judicial. (See section 5 of the Ley de Informaciones Posesorias) ... Article 7 of the Ley de Informaciones Posesorias, as well as the Leyes Forestales, has sought to protect forest resources from human activity by subjecting them to various forms of forest management. Although titling of such areas has been permitted, once they have been declared conservation areas and become part of the Patrimonio Forestal del Estado, compliance with additional, more stringent requirements is required.

This leads us directly to the concept of ecological possession and to the principle of the ecological function of forest property... X. The Ley Forestal N° 7575 also retained the restrictions contained in the Ley de Informaciones Posesorias governing the titling of lands located in protected areas. In this regard, the current provision states: ‘Article 7.- When the property to which the information relates is located within a protected wildlife area, regardless of its management category, the title applicant must demonstrate that he or she holds the legal rights to ten-year possession, exercised for at least ten years before the effective date of the law or decree that created that wildlife area.’ (Emphasis added). In other words, the legislature intended that these areas be kept protected and conserved throughout that entire period, including before the creation of the Reserves and protected areas ...” (Resolución de las 14:50 horas del 20 de febrero de 1998 que responde al Voto No 113).

Based on the foregoing, the petitioner must demonstrate ten-year possession before the declaration of the Reserva Forestal Golfo Dulce as a protected wildlife area, which in this case was created on 28 de abril de 1978. In addition, under section 6 of the Ley de Informaciones Posesorias, she must prove this through the testimony of three witnesses. VII.- From its analysis of the testimonial evidence received in this case, the Tribunal reaches the same conclusion as the lower-court judge: the petitioner failed to demonstrate ten-year possession before the declaration of the Reserva Forestal Golfo Dulce. It is important to note what the Sala Constitucional stated in this regard: “... The challenged first paragraph of Article 7 of the Ley de Informaciones Posesorias, whose text predates the latest amendment by Ley Forestal N° 7575 de 13 de febrero de 1996, governs the titling of real property located within an area declared to be a national park, biological reserve, forest reserve, or protective zone.

That article provides that the title applicant must demonstrate having exercised ten-year possession beginning at least ten years before the effective date of the law or decree that created the wildlife area. (...) In other words, declaration as a protected wildlife area prevents possession after the designation from being counted and precludes satisfaction of the requirements for adverse possession if the right had not been acquired by that time—that is, if the ten years of possession legally sufficient for adverse possession under the conditions established by law had not elapsed. The foregoing is merely the natural result of applying the principles governing the object of possession and its exercise in the capacity of a rights holder, which are necessary for possession for purposes of adverse possession (posesión ad usucapionem). It should be recalled that assets dedicated to the public domain, whatever their specific characteristics, cannot be acquired through adverse possession if the conditions necessary to acquire the right were not met before that dedication occurred.

Accordingly, although the challenged provision appears to govern a specific case of adverse possession, it does not create a regime with requirements different from those established in the Código Civil for cases generally. Nor does the provision have the alleged retroactive effect, because the ten-year period of possession required for adverse possession is established in the Código Civil, and the challenged provision merely emphasizes certain elements inherent to adverse possession that are also defined in the general legislation, namely the object of possession and the conditions under which possession must be exercised to qualify for adverse possession. In other words, the rule does not establish any different principle—or more stringent requirement—regarding the application of the general rules of adverse possession.

It merely specifies the manner in which those rules must be applied, which is consistent with a logical result given that the property to be titled is public-domain property (bien demanial). Accordingly, the amendment to Article 7 of the Ley de Informaciones Posesorias, the text of which is challenged, is not deemed to have introduced a different regime regarding the requirements for acquisitive prescription (usucapión), one that could have worsened the situation of persons who were exercising possession for purposes of acquisitive prescription (posesión ad usucapionem) over lands that had been declared to be of public interest ...” (Voto 4587). For the reasons set forth above, the appellant’s argument is unfounded, because the appellant failed to demonstrate, through the testimony of three witnesses, ten years of possession prior to the declaration of the Reserva Forestal Golfo Dulce, created on 28 de abril de 1978.

It is important to note that none of the deponents whose testimony was received addressed whether the title applicant (titulante) or the previous possessors had protected the resource, which is another requirement that must be satisfied in order to obtain title in this type of area, where ecological possession (posesión ecológica) must be assessed, since the factual control inherent in forest possession (posesión forestal) is exercised over the natural resource of “forests” or “lands suitable for forestry” (terrenos de aptitud forestal), and the possessory acts (actos posesorios) must be directed toward its protection and conservation. (...) Therefore, Article 7 of the Ley de Informaciones Posesorias requires proof not only of ten years of possession prior to the creation of the respective protected area, but also that the forest has been conserved. The requirement of ten years prior to its creation exists precisely to protect those private parties who had consolidated their right of possession ten years before the area was created—that is, before the property became subject to the public domain” (See, among others, Tribunal Agrario, No.l24 at 11:30 on 14 de marzo del 2003).

In the case before us, the appellant bases her argument on the fact that the lands for which title is sought were national reserves and that, therefore, ten years of possession prior to 1961 must be demonstrated. This Chamber does not share that view, considering that the amendments made to Article 7 of the Ley de Informaciones Posesorias have changed that standard and permit title to be obtained over protected wildlife areas (áreas silvestre protegidas) if ten years of possession prior to their creation is demonstrated, together with proof that the resource has been protected and that the property has been duly demarcated by cleared boundary lines or fences. In this regard, the Sala Constitucional has stated: “IV.- Thus, a possessor seeking to acquire by acquisitive prescription land covered by forest that formed part of the national reserves must demonstrate ten years of possession, whether original or transferred, and that the forest resource was conserved.

That standard was recently reaffirmed by the Sala Constitucional in Voto No. [Telf1], at 9 hours on 7 de enero del 2015, in answering a judicial constitutional consultation concerning titling in the national reserves: “VI.- THE TITLING OF LAND IN THE NATIONAL RESERVES, THE STATE’S NATURAL HERITAGE, THIRD PARTIES WITH SUPERIOR RIGHTS, AND PRIVATE PROPERTY. For purposes of the consultation submitted for its consideration, this Tribunal Constitucional deems it necessary to draw a clear distinction between the concept of National Reserves and that of the State’s Natural Heritage (Patrimonio Natural del Estado), formerly known as the State’s Agricultural Heritage (Patrimonio Agrícola del Estado). Article 7 of the Ley de Tierras y Colonización, No. 2825 of 14 de octubre de 1961, established the so-called Patrimonio Agrícola del Estado, based on a conception of agrarian property as originating in the Nation.

The Patrimonio agrícola del Estado comprised all inalienable lands that could not be acquired through a claim to untitled land (denuncio) or possession, including, among others, the maritime-terrestrial zone, the Islands, the border strip, the strips along navigable rivers, and the [Dirección6] National Parks (Articles 7 through 10). In other words, the Heritage comprises lands characterized by inalienability, subject to the public domain, and included within some management category, such as National Parks. The Law subsequently introduces a broad concept of National Reserves in Article 11, stating that: “Unless proven otherwise, the following belong to the State as national reserves: a) All lands located within the boundaries of the Republic that are not registered as private property or as the property of Municipalities or Autonomous Institutions; b) Those not protected by ten years of possession; c) Those that have not been designated by special laws for the establishment of agricultural colonies; and d) In general, all those that, while not privately owned, are not occupied for public services.” It follows from the foregoing that lands forming part of the national reserves, as lands suitable for agriculture, livestock raising, or forestry, possessed by private parties for more than ten years and not forming part of the Patrimonio agrícola del Estado, were eligible for legal recognition.

Private parties obtained such recognition through possessory-information proceedings (procesos de Información Posesoria) or through the mechanism created under the Titulación Múltiple de Tierras, subsequently known as “Titulación de Tierras Ubicadas en las Reservas Nacionales.” Subsequently, the Ley Forestal No. 4465 of 1969 introduced the concept of the State’s Forest Heritage (Patrimonio Forestal del Estado), assigning the Dirección General Forestal the forestry administration of forest reserves, national parks, State forest nurseries, protected zones, and biological reserves. At that time, the Public Administration realized that the two regimes coexisted within the so-called “national reserves”; accordingly, in 1972, representatives of the Ministerio de Agricultura y Ganadería, to which the Dirección General Forestal reported, the Instituto de Tierras y Colonización, and the Instituto Costarricense de Turismo entered into an agreement that precisely defined the powers of the three agencies over the national reserves (Convenio MAG-ITCO-ICT), 7 marzo 1972, La Gaceta No. 89 of 10 de mayo de 1972).

This occurred because the Ley de Tierras y Colonización, which remains in force, entrusts the administration of national reserves suitable for agriculture and livestock raising to the Instituto de Tierras y Colonización, the agency responsible for land subdivision into parcels (parcelación) and colonization. The Ley Orgánica del Ambiente No. 7554 of 1995, for its part, incorporates the concept of protected wildlife areas, stating that they form part of the Patrimonio Natural del Estado and establishing their irreducible status (carácter irreductible) (Articles 32 through 38). Subsequently, the current Ley Forestal No. 7575 of 1996 incorporates the concept of Patrimonio Natural del Estado in Title Two, Sole Chapter, even clarifying what it comprises within the national reserves: “The State’s natural heritage shall consist of the forests and forest lands within the national reserves, areas declared inalienable, properties registered in its name, and those belonging to municipalities, autonomous institutions, and other agencies of the Public Administration, except for real property securing credit transactions with the Sistema Bancario Nacional that becomes part of its assets.

The Ministerio del Ambiente y Energía shall administer the heritage.” Because they are not forest lands, the foregoing excludes from the State’s natural heritage lands suitable for agricultural and livestock use, which remain part of the national reserves and may be acquired by private parties through acquisitive prescription. Finally, the same Ley Forestal of 1996 amended Article 37 of the Ley Orgánica del Ambiente and Article 7 of the Ley de Informaciones Posesorias to authorize acquisitive prescription and, consequently, registration through possessory information (información posesoria), as well as through the repealed procedure for titling in national reserves, of lands belonging to the national reserves and suitable for forestry, and even lands under private possession that became included within a protected-wildlife-area management category (Patrimonio Natural del Estado), provided that ten years of possession prior to the date on which the respective area was created was demonstrated and that the agrarian possessory acts (actos posesorios agrarios) consisted of activities aimed at forest or ecological protection.

In light of all the foregoing, it is therefore clear that the administrative procedure created by the Ley de Titulación Múltiple de tierras, subsequently the Ley de Titulación en las Reservas Nacionales, was intended to expedite titling procedures for agrarian possessors who had completed a short period of acquisitive prescription—first three years and later five years—so that they could obtain title to property and gain access to land, agricultural credit, and decent housing. This was without prejudice to third parties with superior rights (terceros de mejor derecho), understood as those private parties who could have brought an action asserting a superior right of possession within areas deemed national reserves. They had only three years in which to assert that right; otherwise, the title would become fully consolidated, because the limitation period for extinguishing claims (prescripción negativa) was shortened by the legislature.

A different situation arises, however, with respect to private property affected by those multiple-land-titling proceedings. It was logical that, when a Programa de Titulación Múltiple was created, property established and registered in the name of the Instituto de Tierras y Colonización, and later the Instituto de Desarrollo Agrario, would overlap with properties registered in the names of private parties, since the requirement was that at least 20% of the land within the defined geographical area lack a title registered in the public registry. Consequently, this meant that the title granted by the ITCO covered lands within the national reserves, not lands previously registered as the private property of individuals. The foregoing clarifies that if titling was authorized and the title fell, wholly or partially, upon previously registered private real property, the registered owner would have the right to recover the property (reivindicar), as the same provision establishes, but not within the three-year period applicable to third parties with superior rights; rather, within the ten-year period.” (END OF QUOTATION, Voto No. [Telf1], at 9 hours on 7 de enero del 2015,).

All of the foregoing was duly demonstrated by the testimonial evidence collected and the judicial inspection (reconocimiento judicial) conducted; therefore, her arguments in that regard are unfounded. The land has been used in a manner consistent with its designated land use (uso conforme del suelo) for the activity carried out under the approved methodology, according to the certification issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (see pages 80 through 90). The land is forest in nature. In the present case, it is necessary to assess the evidence, as well as the case law issued in relation to certain cases, according to principles of equity and law, because the purpose of titling is not merely to have land registered in our name in the Registro Público de la Propiedad, but to ensure legal certainty and provide agricultural producers and campesinos with the opportunity, through access to land ownership, to become holders of legal rights and attain better living conditions.

In the words of our legislators: “those are truly the purposes underlying Substantive Agrarian Law”; this requires compliance with certain special requirements arising from the location of the land within a protected wildlife area, such as possession before nineteen seventy-five and having cared for the forest resource, the year in which the Reserva Forestal Cordillera Volcánica Central was created.

Under the current Ley Forestal, the Possessory Information Law (Ley de Informaciones Posesorias), and the case law cited above, a solution is provided to the legal uncertainty faced by many of our farmers and peasants: they own land but do not know whether they will ever be able to register it in their names; they do not know whether they have a vested right to retain the land they have cared for and protected; and they fear that one day the government may arrive and order them to leave their properties without any compensation, solely because they lack a title eligible for registration (título inscribible) in the Public Registry. Were it not for these hardworking peasants, such land would remain unprotected, since it is no secret that the State lacks sufficient personnel to safeguard the expanses of land throughout our country, and it is people such as my client who watch over and endeavor to protect the existing natural resources. For the reasons set forth above, the substantive and formal requirements have been satisfied, and there is an established line of case law specifying the date from which possession must be demonstrated—a requirement that has been met in these proceedings. Accordingly, the judgment approving the present proceedings is affirmed.

THEREFORE:

The judgment appealed from is affirmed.

RESULTANDO:

  1. 1El promovente interpuso proceso de información posesoria con el fin que se inscriba a su nombre en el Registro Público de la Propiedad la finca que se describe así: " Terreno de tacotal, en regeneración natural, ubicado en: Flores, La Unión, [Dirección1] , de la provincia de Limón. Mide: siete hectáreas, ocho mil seiscientos once metros cuadrados. Linda al Norte: con [Dirección2] , [Dirección3] , con un frente a ella de cuatrocientos dieciséis metros y veintiún centímetros lineales, al Sur: con Río Molinete, al Este: con Quebrada Betel y al Oeste: actualmente con propiedad del señor [Nombre3] . Graficado en el Plano Catastrado Número L - Un millón seiscientos cuarenta y nueve mil cuatrocientos setenta y nueve - dos mil trece ," (folios 8, 9, 12, 13, 30, 54, 116, 124, 168, 173, 216 y 236).-
  2. 2La Procuraduría General de la República se apersonó al proceso en los términos que corren de folios 20 a 24; a su vez e l Instituto de Desarrollo Rural lo hizo en el folio 29 , sin manifestar ambos su oposición a las presentes diligencias. -
  3. 3El licenciado Ronald Rodríguez Cubillo, juez del J uzgado Agrario de l Segundo Circuito Judicial de la Zona Atlántica, mediante sentencia número 95-16 de las siete horas veintidós minutos del veintisiete de junio del año dos mil dieciséis , resolvió: “ POR TANTO: Por lo expuesto, de conformidad con la LEY DE INFORMACIONES POSESORIAS N° 139 del 14 de julio de 1941 y sus reformas, SE APRUEBAN estas diligencia de INFORMACIÓN POSESORIA promovidas por [Nombre1] , viudo, comerciante, vecino de La Unión de Guápiles, Pococí, Limón, cédula de identidad número CED5 – – . Proceda el REGISTRO PUBLICO DE LA PROPIEDAD, Sección Bienes Inmuebles, a inscribir a su nombre sin perjuicio de terceros de mejor derecho y con las limitaciones de Ley que se dirá, la finca que a continuación se detalla: Terreno de tacotal, en regeneración natural, ubicado en: Flores, La Unión, [Dirección1] , de la provincia de Limón.Mide: siete hectáreas, ocho mil seiscientos once metros cuadrados. Linda al NORTE: con [Dirección2] , [Dirección3] , con un frente a ella de cuatrocientos dieciséis metros y veintiún centímetros lineales, al SUR: con Río Molinete, al ESTE: con Quebrada Betel y al OESTE: actualmente con propiedad del señor [Nombre3] . Graficado en el Plano Catastrado Número L - Un millón seiscientos cuarenta y nueve mil cuatrocientos setenta y nueve - dos mil trece. Inmueble que fue estimado en la suma de dieciséis millones de colones, por cuanto ha cumplido con todos los requisitos que al efecto establece la ley de Informaciones Posesorias. Sirva la certificación de esta sentencia para inscribir en el Registro de la Propiedad la finca citada. Dicha inscripción deberá hacerse advirtiendo a su titulante que el área contigua al Río Molinete y a la Quebrada Betel o demás corrientes de agua que existan o puedan existir en las colindancias o en la propiedad del señor [Nombre1] y que señala el artículo 33 de la Ley Forestal Nº 7575, constituyen áreas de protección y queda prohibida la corta o eliminación de árboles.De igual forma se hace constar que el cauce y las aguas de esas corrientes son de dominio público, tal y como lo establece la Ley de Aguas, artículo 1, inciso IV, y 3, inciso III. Se hace constar también que el derecho de vía de la calle pública que colinda por el costado norte del inmueble a titular es de cincuenta metros de ancho ya que es [Dirección4] , [Dirección5] , San José – Guápiles, el cual cumple a cabalidad con lo establecido en el artículo 4 de la Ley General de Caminos Públicos y 19 inciso "a" de la Ley de Informaciones Posesorias. Además artículos 1, 2, 3, 4, 5, 6, 7 de la Ley de Informaciones Posesorias y 1, 2, 7 y 25 de la Ley de Jurisdicción Agraria así como la Ley General de Caminos Públicos, Ley de Conservación de Vida Silvestre y Ley Orgánica del Ambiente. Una vez firme esta resolución, expídase la ejecutoria respectiva y archívese el presente asunto. Se les hace saber a los intervinientes que esta resolución es impugnable, por lo que si alguna de las partes va a presentar recurso de apelación contra la misma, favor remitir además el recurso de apelación por formato electrónico a la dirección [...] Ello por motivo de la inserción de la oralidad en materia agraria.Además si es el deseo de la parte que el Tribunal de alzada les confiera una audiencia oral, deberán de hacerlo saber en el mismo escrito de apelación. En igual sentido se le recomienda a las partes señalar prioritariamente un correo electrónico donde recibir notificaciones, ello porque a través de este medio, se les puede enviar documentos grabados en audio o video (sentencia oral). ," (folios 233 al 236 y vuelto).-
  4. 4La procuradora adjunta l icenciad a [Nombre4] , formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia, ( folio s 241 al 243 ). -

5. En la substanciación del proceso se ha observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad. - Redacta el Juez Darcia Carranza y,

CONSIDERANDO:

I. El Tribunal comparte el hecho tenido por demostrado

II.La procuradora Susana fallas Cubero apela el fallo dictado indicando los siguiente: 1.- Dice la apelante los terrenos pretendidos titular fueron reservas nacionales por lo que no se demuestra el tiempo necesario para usucapir, ya que solo se demuestra una posesión desde 1960. 2.- El promovente manifestó en el escrito inicial, con caracter de declaración jurada que adquirió por posesión originaria en 1962 y la prueba testimonial es insuficiente para demostrar una ocupación apta para usucapir, y el deponente [Nombre5] ubica al titulante por más tiempo en el inmueble. La sentencia no entra a analizar tal punto. 3.- El testigo [Nombre6] indicó que en el terreno hay una naciente, sin embargo no se recabó informe para descartar si surte de agua potable a alguna población o si es conveniente reservarla para tal fin. Con base en lo anterior solicita se anule el fallo dictado y posteriormente se denieguen estas diligencias.

III.Actualmente, es importante mencionar ha existido una evolución normativa en relación a los terrenos de la s reservas nacionales, esa evolución mencionada nos ha llevado a tener una norma especial que regula la situación jurídica actual de los terrenos sin titular, que se encuentren en áreas protegidas pertenecientes a sujetos privados, tal es el caso de la Ley Forestal y de la Ley de Informaciones Posesorias. Por su parte, la Ley Orgánica del Ambiente, en su numeral treinta y siete, establece que si bien es cierto, el Poder Ejecutivo de nuestro Estado de Derecho es el encargado de dictar cuales terrenos serán áreas silvestres protegidas, cualquiera que sea su categoría de manejo, dichos terrenos quedarán comprendidos dentro de las áreas protegidas estatales, solo a partir del momento en que se hayan pagado o expropiado legalmente, salvo que en forma voluntaria se sometan al régimen forestal creado, situaciones que en el caso en cuestión no se han dado, por lo que no se debe de tener como un terreno que forme parte del Patrimonio Natural del Estado.

Existe una larga línea jurisprudencial referente a los casos en que se pretende titular terrenos ubicados dentro áreas forestales protegidas, y el criterio prevaleciente de nuestro Tribunal Agrario, es que se debe de cumplir primero con demostrar que se ha protegido el recurso forestal, cumpliendo con una posesión ecológica, manteniendo el criterio ecológico de la propiedad y vocación forestal de los terrenos en cuestión, y segundo, que se haya demostrado por lo menos una posesión decenal anterior al respectivo decreto o ley que crea el área forestal protegida donde se encuentra el fundo a titular, situación que el caso que nos ocupa se han cumplido cabalmente, dejando meridianamente claro, que el titulante cumple con los requisitos materiales y de forma para obtener el título inscribible en el Registro Público, y así gozar de los derechos de propiedad, consagrado en nuestra Constitución Política.

Para hacer un poco de referencia a la línea de criterio, con lo que se ha creado toda una línea jurisprudencia, que ha dominado este tipo de asuntos, haremos mención de algunos votos destacados, dentro de los cuales tenemos un primer grupo de votos en los cuales se han improbado diligencias de información posesoria por diversas situaciones, pero todos los votos son consistentes en que se debe demostrar posesión con diez años antes de la creación del Area Silvestre Protegida, la cual en este caso, es la Reserva Forestal Cordillera Volcánica Central creada según decreto Ejecutivo N° 5386 - A del 26 de junio de 1975 (ver folio 3). Partiendo de los expuesto es claro tal circunstancia era de conocimiento y por lo tanto era su obligación demostrar una posesión decenal con anterioridad a la fecha indicada en que se creó al Reserva dicha. De acuerdo a lo anterior y de conformidad con el ordinal 7 de la Ley de Informaciones Posesorias el promovente deberá demostrar haber consolidado su derecho al menos 10 años antes de la declaratoria de la reserva forestal dicha.Para este caso, la testifical de referir la posesión ejercida desde 10 años antes de 1975, nótese la declaración de [Nombre7] manifestó conocer la finca desde 1960, que una parte la poseía el promovente y que compró otro pedazo de terreno a don [Nombre8].

Dijo también que en el inmueble no existen nacientes (ver folio 198). El testigo [Nombre9] conoce el fundo desde el año de 1962, y ya era de don [Nombre1]. Manifestó también en el inmueble no existen nacientes pero si que colinda con el río Molinete por el fondo. y al este existe un zanja por la que baja agua, y se trata de un crique pequeño (folio 199). Por último el deponente [Nombre10] manifestó conocer desde el año de 1963, siendo que don [Nombre1] ya estaba en la propiedad. Indicó también no existen nacientes, que lo que hay es una zanja o crique por la que baja agua por el sector este y colinda también con el Río Molinete por el fondo del terreno (ver folio 199 vuelto). Es importante mencionar que los testigos indican que el señor [Nombre1] dedica el fundo a regeneración natural. En cuanto a la valoración de la prueba testimonial cuyo objeto sea la demostración de la posesión en áreas protegidas, ha dicho este Tribunal: "El artículo 6 de la Ley de Informaciones Posesorias reza: "La justificación de la posesión se acreditará con la declaración de tres testigos vecinos del cantón donde se halle situado el imnueble, Así mismo el artículo 7 de la citada ley expone: " Cuando el inmueble al que se refiera la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre la posesión decena/, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre".- Los requisitos expuestos para la titulación de tierras son claros en la Ley de Informaciones Posesorias, así como en leyes especiales como la Ley de Suelos entre otras, siendo uno de esos requisitos la necesaria demostración de la posesión decena/ con tres testigos, a falta de uno sólo de éstos, la información posesoria deberá denegarse." (Tribunal Agrario, Voto No. 118-F-06 de las catorce horas treinta minutos del dieciséis de febrero de dos mil seis).- En el caso bajo examen, el inmueble se encuentra ubicado tanto dentro de la Reserva Forestal Cordillera Volcánica Central creada según decreto Ejecutivo N° 5386 - A del 26 de junio de 1975.

Se recibió la declaración de tres testigos, y estos acreditan los requisitos de una posesión ecológica desde antes del año 1962, por lo que cumplen con los requisitos necesarios para titular el inmueble. Este Tribunal de forma reiterada ha considerado que: " ... La Información Posesoria es un trámite de actividad judicial no contenciosa para la formalización de un título registrable sobre un derecho de propiedad que se ha llegado a adquirir por la usucapión, cumpliendo para ello con los requisitos legales correspondientes. Se exige demostrar la posesión a título de dueño, en forma quieta, pública, pacífica e ininterrumpida (artículos 1 Ley de Informaciones Posesorias y 856 del Código Civil). El titulante, aparte de carecer de título inscrito o inscribible en el Registro Público, debe manifestar expresamente que la fmca no ha sido inscrita en el Registro Público anteriormente. Por razones de interés público, y para evitar una doble inscripción registra! sobre un mismo bien, o bien, para tutelar a terceros de mejor derecho que el titulante, la Ley exige notificar a ciertos sujetos.

También estableció un trámite de oposición dentro de la Información Posesoria, en caso de que alguno de los interesados se sienta perjudicado por la titulación (artículo 8). La Ley de Informaciones Posesorias ordena al Juez tener como partes y por tanto notificarles personalmente desde el inicio de las diligencias, a los colindantes, ello por cuanto la titulación podría abarcar parte de las tierras que les pertenecen... se ordena notificar a los condueños o condóminos. Igualmente, en resguardo de los intereses del Estado, se ordena tener como parte a la Procuraduría General de la República y al Instituto de Desarrollo Agrario, para el resguardo de la propiedad sujeta al dominio público, y de la Propiedad Agraria estatal (artículo 5). Finalmente, la ley manda a citar a todos los interesados, mediante la publicación de un Edicto en el Boletín Judicial, que puedan tener un interés legítimo en el proceso.

(Ver numeral 5 de la Ley de Informaciones Posesorias) ... La Ley de Informaciones Posesorias, en su artículo 7, así como las Leyes Forestales han procurado proteger los recursos forestales de la acción humana, sometiéndolos a diversas formas de manejo forestal. Aunque se ha permitido la titulación de dichas áreas, que ya declaradas como áreas de conservación pasan a formar parte del Patrimonio Forestal del Estado, se exige el cumplimiento de otros requisitos más calificados. Eso nos conduce, directamente al concepto de posesión ecológica, y al criterio de la función ecológica de la propiedad forestal...X. La Ley Forestal N° 7575, también mantuvo las restricciones en la Ley de Informaciones Posesorias, para poder titular terrenos comprendidos en áreas protegidas. Al respecto dispone el actual numeral: "Artículo 7 .-Cuando el inmueble al que se refiera la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser titular de los derechos legales sobre la posesión decena(ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre.

"(La negrita es nuestra). Es decir, la intención del legislador es que esas áreas se hayan mantenido protegidas, conservadas durante todo este tiempo, incluso antes de la creación de las Reservas y áreas protegidas ... ". (Resolución de las 14:50 horas del 20 de febrero de 1998 que responde al Voto No 113). Partiendo de lo anterior se hace necesario que la promovente logre demostrar la posesión decena! antes de la declaratoria de área silvestre protegida Reserva Forestal Golfo Dulce, la cual en este caso se creo en fecha 28 de abril de 1978. Además de ello debe probar de conformidad con el numeral 6 de la Ley de Informaciones Posesorias con la declaración de tres testigos. VII.- Del análisis de la prueba testimonial evacuada en el presente caso, el Tribunal llega a la misma conclusión del juzgador de instancia, en cuanto a que no logró demostrar la posesión decenal previa a la declaratoria de la Reserva Forestal Golfo Dulce.

Es importante señalar lo dicho por la Sala Constitucional al respecto " ... El artículo 7 párrafo primero de la Ley de Informaciones Posesorias impugnado, cuyo texto es anterior a la última reforma por Ley Forestal N° 7575 de 13 de febrero de 1996, regula el caso de la titulación de bienes inmuebles comprendidos dentro de un área declarada parque nacional, reserva biológica, reserva forestal o zona protectora. Señala ese artículo que el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la ley o el decreto que creó el área silvestre,(...) Es decir, la declaratoria de área silvestre protegida evita que cuente la posesión posterior a la afectación, e impide concretar los requisitos de la usucapión si a ese momento no se ha adquirido el derecho, o sea, no han transcurrido los diez años de posesión apta para usucapir con las condiciones que establece la ley.

Lo anterior es únicamente el resultado natural de aplicar los conceptos sobre el objeto de la posesión y su condición de ejercicio en calidad de titular, necesarios para la posesión ad usucapionem. Recuérdese que los bienes afectados al dominio público, tengan las especificaciones que tengan, no son susceptibles de adquisición por usucapión, si antes de producirse la afectación no se dieron las condiciones necesarias para la adquisición del derecho. En ese sentido, la disposición cuestionada, a pesar de que en apariencia regula un caso específico de usucapión, no crea un régimen con requisitos diferentes a los establecidos en el Código Civil para la generalidad de los casos. En ese sentido, tampoco se produce el alegado efecto retroactivo de la norma, porque el plazo de diez años de posesión para usucapir se encuentra establecido en el Código Civil y la disposición cuestionada simplemente destaca ciertos elementos propios de la usucapión que también están definidos en la normativa general, como son: el objeto de la posesión y las condiciones en que ésta se debe ejercer para ser apta para la usucapión.

Es decir, la norma no viene a establecer ningún principio diferente -o requisito más riguroso- en relación con la aplicación de las reglas generales de la usucapión. Simplemente especifica la forma en que deben aplicarse esas reglas, lo que coincide con un resultado lógico dada la condición de bien demanial del objeto a titular. De ahí que no se considere que la reforma al artículo 7 de la Ley de Informaciones Posesorias, cuyo texto se impugna, haya introducido un régimen diferente en relación con los requisitos de la usucapión, que haya podido agravar la situación de personas que se encontraban ejerciendo posesión ad usucapionem en terrenos que fueron declarados de interés público ... "(Voto 4587). Por las razones anteriormente expuestas no lleva razón el recurrente, pues no logró demostrar con la declaración de tres testigos la posesión decenal previa a la declaratoria de la Reserva Forestal Golfo Dulce, creada el 28 de abril de 1978.

Es importante hacer mención al hecho de que ninguno de los deponentes cuyos testimonios fueron evacuados, se refieren a si el titulante o los anteriores poseedores han protegido el recurso, el cual es otro requisito debe ser cumplido para poder titular tratándose de este tipo de áreas en la que debe estimarse la posesión ecológica, pues el poder de hecho de la posesión forestal recae sobre el recurso natural "bosques" o "terrenos de aptitud forestal", y los actos posesorios deben ir encaminados a su protección y conservación. (...) Por ello la Ley de Informaciones Posesorias en su artículo 7 exige demostrar, no solo la posesión decenal anterior a la creación de la respectiva área protegida, sino también que se ha conservado el bosque. Los diez años anteriores a la creación se exige justamente, para proteger a aquellos sujetos privados que habían consolidado su derecho de posesión diez años antes de la creación del área, es decir, antes de que ocurriera la afectación al dominio público" (Ver, entre otros, Tribunal Agrario, No.l24 de las 11:30 horas del 14 de marzo del 2003).

En la causa que nos ocupa, la apelante como fundamento de su tesis el hecho de que los terrenos pretendidos titular fueron reservas nacionales por lo que se debe demostrar una posesión anterior decenal a 1961, tesis no compartida por esta Cámara, al considerar que con las reformas hechas al artículo 7 de la Ley de Informaciones Posesorias dicho criterio ha evolucionado y se permite la titulación de áreas silvestre protegidas si se demuestra la posesión decenal previa a la creación de esta, haber protegido el recurso y tenerlo debidamente deslindado, con carriles o cercas. Al respecto la Sala Constitucional ha dicho "IV.- De manera que el poseedor que pretenda adquirir por usucapión un terreno cubierto de bosque, que formaba parte de las reservas nacionales, deberá demostrar la posesión decenal (originaria o trasmitida), y haber conservado el recurso forestal. Dicho criterio, fue ratificado, recientemente por la Sala Constitucional, en el Voto No. [Telf1], de las 9 horas del 7 de enero del 2015, al responder una consulta judicial de constitucionalidad, relacionada con la titulación en las reservas nacionales: "VI.- LA TITULACIÓN DE TIERRAS EN LAS RESERVAS NACIONALES, EL PATRIMONIO NATURAL DEL ESTADO, LOS TERCEROS CON MEJOR DERECHO Y LA PROPIEDAD PRIVADA.

Este Tribunal Constitucional, a propósito de la consulta sometida a conocimiento, considera necesario hacer la distinción clara entre el concepto de Reservas Nacionales, y aquél de Patrimonio Natural del Estado, antes denominado Patrimonio Agrícola del Estado. La Ley de Tierras y Colonización, No. 2825 del 14 de octubre de 1961, en su artículo 7, estableció el llamado Patrimonio Agrícola del Estado, partiendo de una concepción de la propiedad agraria como originaria de la Nación. El Patrimonio agrícola del Estado comprendía todas las tierras inalienables y no susceptibles de adquirirse por denuncio o posesión, entre otras, la zona marítimo terrestre, las Islas, la franja fronteriza, las franjas de los ríos navegables, los [Dirección6] Parques Nacionales (artículos 7 al 10). Es decir, el Patrimonio comprende aquellos terrenos con características de inalienabilidad, sometidos al dominio público, y contenidos en alguna categoría de manejo, como los Parques Nacionales.

Posteriormente la Ley introduce un concepto amplio de Reservas Nacionales, en el artículo 11, al indicar que “Mientras no se pruebe lo contrario, pertenecen al Estado en carácter de reservas nacionales: a) Todos los terrenos comprendidos dentro de los límites de la República que no estén inscritos como propiedad particular, de las Municipalidades o de las Instituciones Autónomas; b) Los que no estén amparados por la posesión decenal; c) Los que, por leyes especiales, no hayan sido destinados a la formación de colonias agrícolas; y d) En general todos los que, no siendo de propiedad particular, no estén ocupados en servicios públicos.” De lo anterior se desprende que los terrenos que forman parte de las reservas nacionales, como terrenos de vocación agrícola, ganadera o forestal, poseídos por los particulares durante más de diez años y que no formen parte del Patrimonio agrícola del Estado, eran susceptibles de reconocimiento jurídico.

Tal reconocimiento lo alcanzan los particulares, a través de los procesos de Información Posesoria, o bien, mediante el instrumento que se creó a través de la Titulación Múltiple de Tierras, posteriormente denominada “Titulación de Tierras Ubicadas en las Reservas Nacionales”. Luego, la Ley Forestal No. 4465 de 1969, introduce el concepto de Patrimonio Forestal del Estado, confiriéndole la administración forestal, de las reservas forestales, los parques nacionales, los viveros forestales del Estado, las zonas protectoras y las reservas biológicas, a la Dirección General Forestal. En ese momento, la Administración Pública se percata de que dentro de las llamadas “reservas nacionales”, conviven los dos regímenes, por los que en 1972, suscriben un convenio representantes del Ministerio de Agricultura y Ganadería (de quien dependía la Dirección General Forestal), el Instituto de Tierras y Colonización y el Instituto Costarricense de Turismo, que definió con precisión las facultades de los tres organismos sobre las reservas nacionales (Convenio MAG-ITCO-ICT), 7 marzo 1972, La Gaceta No. 89 del 10 de mayo de 1972).

Lo anterior ocurre, porque la Ley de Tierras y Colonización, aún vigente, le confía la administración de las reservas nacionales, con vocación agropecuaria, al Instituto de Tierras y Colonización, órgano encargado de la parcelación y colonización. Por su parte, la Ley Orgánica del Ambiente No. 7554 de 1995, incorpora el concepto de áreas silvestre protegidas, indicando que forma parte del patrimonio natural del Estado y estableciendo su carácter irreductible (artículos 32 al 38). Posteriormente, la Ley Forestal vigente No. 7575 de 1996 incorpora, en el Titulo segundo, capítulo único el concepto de Patrimonio Natural del Estado, aclarando incluso, qué es lo que comprende de las reservas nacionales: “El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.

El Ministerio del Ambiente y Energía administrará el patrimonio.” Lo anterior excluye como parte del patrimonio natural del Estado, por no ser forestal, los terrenos de aptitud agropecuaria, que siguen siendo parte de la reservas nacionales, y susceptibles de usucapión por parte de particulares. Finalmente, la misma Ley Forestal de 1996, modificó el artículo 37 de la Ley Orgánica del Ambiente, y el artículo 7 de la Ley de Informaciones Posesorias, para autorizar la usucapión, y por ende la inscripción mediante información posesoria (y el procedimiento derogado de la titulación en reservas nacionales), terrenos que pertenecen a las reservas nacionales, con vocación forestal e, incluso, terrenos en posesión privada, que quedaron comprendidos dentro de alguna categoría de área silvestre protegida (Patrimonio Natural del Estado), siempre y cuando se demostrara una posesión decenal anterior a la fecha de creación de la respectiva área, y los actos posesorios agrarios consistieran en actividades tendientes a la protección forestal o ecológica.

Con todo lo antes expuesto, resulta claro, entonces, que el procedimiento administrativo creado en la Ley de Titulación Múltiple de tierras (posteriormente, la Ley de Titulación en las Reservas Nacionales), vino a permitir agilizar los trámites de titulación de los poseedores agrarios, que habían cumplido una usucapión corta (primero de tres y luego de cinco años), para que pudieran obtener un título de propiedad, y tener posibilidades de acceso a la tierra, al crédito agrario y a la vivienda digna. Lo anterior, sin perjuicio de terceros de mejor derecho, entendiendo como tales, aquéllos particulares que pudieron haber ejercido una acción de mejor derecho de posesión, dentro de las zonas consideradas como reservas nacionales, para lo cual tenían solo tres años para reclamarlo, de lo contrario el título quedaría totalmente consolidado, pues el plazo de la prescripción negativa, fue reducido por el legislador.

Sin embargo, situación distinta ocurre con la propiedad privada afecta en esos procesos de titulación múltiple de tierras. Era lógico que al crear un Programa de Titulación Múltiple, la propiedad constituida e inscrita a nombre del Instituto de Tierras y Colonización, luego Instituto de Desarrollo Agrario, se sobreponía con propiedades inscritas a nombre de particulares (pues el requisito era que en la zona geográfica delimitada hubiera, al menos un 20% de terrenos sin título inscrito en el registro público). Ello suponía, en consecuencia, que el título que otorgaba el ITCO, lo era sobre terrenos de las reservas nacionales, no sobre terrenos inscritos anteriormente en propiedad privada de particulares. Lo anterior permite aclarar que si se autorizaba una titulación, y ese título recaía, total o parcialmente, sobre un inmueble particular anteriormente inscrito, el propietario registral tendría derecho a reivindicar, tal y como lo establece la misma norma, pero no dentro del plazo de tres años, aplicable a los terceros con mejor derecho, sino dentro del plazo de los diez años." (HASTA AQUÍ LA CITA, Voto No. [Telf1], de las 9 horas del 7 de enero del 2015,).

Todo lo anterior fue debidamente demostrado con la prueba testimonial recabada, y el reconocimiento judicial practicado, por lo que carece de razón sus alegatos en dicho sentido. En dicho bien se ha ejercido el uso conforme del suelo para la actividad que se realiza de acuerdo a la metodología aprobada, según certificación emitida por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria,(ver folios 80 a 90). La naturaleza de los terrenos es de bosque. En el presente caso, es necesario valorar la prueba, así como la jurisprudencia que se ha dictado referente a determinados casos, con criterio de equidad y derecho, pues es el objetivo de la titulación no es solo tener un terreno inscrito en nuestro nombre en el Registro Público de la Propiedad, sino el garantizar seguridad jurídica y de darle la posibilidad a los productores agropecuarios y campesinos que accediendo a la propiedad de la tierra sean sujetos de derecho y puedan accesar a una mejor condición de vida, citando las palabras de nuestros legisladores: "son esos realmente los fines que están detrás del Derecho Agrario Sustantivo"; cumpliendo ciertos requisitos especiales por la ubicación del terreno al ubicarse dentro de un área silvestre protegida, tal es el caso de la posesión antes de mil novecientos setenta y cinco y haber cuidado el recuso forestal, fecha en la que se crea la Reserva Forestal Cordillera Volcánica Central.

Con la Actual Ley Forestal, la Ley de Informaciones Posesorias, y La Jurisprudencia indicada anteriormente, se viene a dar solución a una incertidumbre jurídica que viven muchos de nuestros agricultores y campesinos, la cual es el tener un terreno y no saber si algún día lo lograrán inscribir a su nombre, el no saber si tienen un derecho consolidado de tener el terreno que han cuidado protegido, si el día de mañana llegará el gobierno y les ordenará salir de sus propiedades sin ninguna indemnización solo por el hecho de no tener un titulo inscribible en el Registro Público, terrenos que de no ser por estos campesinos laboriosos, estaría sin protección, ya que para nadie es un secreto que el estado no tiene el recurso humano suficiente para velar por las extensiones de terrenos que abarca nuestro país, y son las personas como mi representado los que velan e intentan proteger los recurso naturales existentes.

Por los razonamientos expuestos anteriormente, se cumplió con los requisitos materiales y de forma, que existe toda una línea jurisprudencial que indica desde cuando tiene que demostrarse la posesión, lo cual se ha cumplido en este proceso, por lo que se confirma la sentencia dictada, que aprueba las presentes diligencias.

POR TANTO:

En lo apelado se confirma la sentencia dictada.
