WHEREAS
I.In its complaint filed on September 23, 2015, the plaintiff alleges that, as owner of property registered under number CED5, said property holds an aqueduct and stormwater easement (servidumbre de acueducto y aguas pluviales) in its favor and burdening the property registered under number CED6, and that at the end of August the defendant unjustifiably proceeded to remove the piping belonging to that easement. This Tribunal hears the present matter by virtue of an objection for lack of jurisdiction (excepción de falta de competencia), raised by the defendant in its filing submitted on February 15, 2016, in which it alleges, among other matters, that this possessory proceeding is improper and that the case must instead proceed as an ordinary proceeding (ordinariarse).
II.First, it should be noted that the parties do not dispute the agricultural nature (agrariedad) of the properties (fundos) involved, and it is important to indicate that cadastral survey plan (plano catastrado) C- 949643-2004 was attached to the complaint, stating that the designated use of the property registered under number CED5 is crops. Accordingly, this is not strictly a lack of subject-matter jurisdiction (competencia material) under Article 16 subsection h) of the Ley de Jurisdicción Agraria. Nevertheless, Article 26 of the Ley de Jurisdicción Agraria authorizes the Agrarian Courts to correct defects that may affect the validity of the proceeding. Following this line of reasoning, the matter intended to be litigated in this proceeding concerns water law; in this Tribunal’s judgment, this agrarian possessory proceeding is improper because Article 212 of the Ley de Aguas No. 276 of August 27, 1942 provides: “In water matters, a possessory action shall not be available.
Any disputes that arise shall be resolved in accordance with the provisions of this law”; therefore, this type of proceeding may not be used to litigate such claims. National legal scholarship has likewise established: “If disputes arise between private parties concerning the use of flowing waters, springs, streams, standing waters, and groundwater, as well as claims arising from the use of easements, whether natural, statutory, or voluntary—established by contract—through acquiescence for more than one year or through the running of the acquisitive-prescription period, as well as disputes assigned in cases involving protective works, drainage, or irrigation, the interested parties may resort to administrative or judicial proceedings, but through ordinary proceedings, not through summary possessory proceedings, in accordance with Articles 186 through 193 and 205 through 212 of the Ley de Aguas (...).” (ARTAVIA BARRANTES and PICADO VARGAS, “Los Interdictos en materia civil, agraria y ambiental” 2007, p 517).
III.Because the complaint is legally untenable (demanda improponible), in the interests of procedural speed and simplicity, and so that the parties and the Administration of Justice itself do not continue processing a proceeding that is plainly inadmissible, the appropriate course is to declare the complaint inadmissible and order the proceeding closed. The foregoing is ordered without a specific award of costs (especial condenatoria en costas), because the court served the complaint without reviewing the procedural prerequisites, which led the plaintiff to believe that it had grounds to continue litigating through this procedural avenue (Article 55 of the Ley de Jurisdicción Agraria). The objection for lack of jurisdiction must be denied because, since the property is agricultural, it is the courts specializing in this subject matter that have jurisdiction to declare the filed complaint inadmissible.

The objection for lack of jurisdiction is denied. The complaint is declared inadmissible, the proceeding is ordered closed, and the matter is decided without a specific award of costs.

CONSIDERANDO
I.En su escrito de demanda presentado el 23 de septiembre del 2015, la parte actora alega que como propietaria de la finca matrícula CED5, la misma tiene una servidumbre de acueducto y aguas pluviales a su favor y en contra de la finca matrícula CED6, y que a finales del mes de agosto la demandada procedió de manera injustificada a sacar la tubería propia de esa servidumbre. Conoce este Tribunal del presente asunto en virtud de excepción de falta de competencia, interpuesta por el demandado en su escrito presentado el 15 de febrero del 2016, en el que alega no es procedente esta vía interdictal, sino que debe de ordinariarse, entre otros aspectos.
II.En primer término debe de indicarse que las partes no están controvirtiendo el punto en cuanto a la agrariedad de los fundos involucrados, siendo importante indicar que en la demanda se adjuntó el plano catastrado C- 949643-2004 en el cual se consigna que la naturaleza de la finca matrícula CED5 es de cultivos. Así las cosas no se trata propiamente de una inexistencia de competencia material en los términos del artículo 16 inciso h) de la Ley de Jurisdicción Agraria. Sin embargo, el artículo 26 de la Ley de Jurisdicción Agraria faculta a los Tribunales Agrarios para corregir vicios que puedan afectar la validez del proceso. Bajo este orden de ideas, se tiene que se pretende discutir en el presente proceso un asunto relacionado con materia de aguas, a juicio de este Tribunal no es procedente esta vía interdictal agraria, ya que el artículo 212 de la Ley de Aguas No. 276 del 27 de agosto de 1942 dispone : "En materia de aguas no será posible la acción interdictal.
Las cuestiones que se susciten se resolverán de acuerdo con las previsiones de esta ley", de ahí que no sea posible acudir a este tipo de proceso a discutir ese tipo de pretensiones. Asimismo la doctrina nacional ha establecido: "Si se suscitan diferencias entre particulares con motivo del aprovechamiento de aguas vivas, manantiales, corrientes, aguas muertas y subterráneas, así como las reclamaciones provenientes del uso de servidumbres, ya sean naturales, legales o voluntarias - establecidas por contrato-, por la tolerancia durante más de un año o por el transcurso del término de la prescripción adquisitiva, lo mismo que las discusiones asignadas en casos de obra de defensa, desecación o regadío, los interesados pueden recurrir a la vía aministrativa o la judicial, pero en la vía ordinaria, no en la sumaria interdictal, de conformidad con los artículos 186 a 193 y 205 a 212 de la Ley de Aguas (...)." III.Al ser una demanda improponible, por celeridad y sencillez procesal, y a fin de que las partes y la misma Administración de Justicia no continúen con la tramitación de un proceso evidentemente inadmisible, lo procedente es declarar la inadmisibilidad de la demanda y ordenar el archivo del proceso. Lo anterior sin especial condenatoria en costas dado que el juzgado otorgó traslado a la demanda sin revisar los presupuestos, lo que motivó que el actor considerara tenía motivos para continuar litigando en esta vía (artículo 55 de la Ley de Jurisdicción Agraria). La excepción de incompetencia deberá de rechazarse en virtud de que al ser un fundo agrario, son los Tribunales de la materia a los que corresponde declarar la inadmisibilidad de la demanda interpuesta
