Goicoechea, at fourteen hours and twenty-five minutes, on tres de octubre de dos mil trece.- APPEAL (recurso de apelación) filed in the present proceedings against Nombre01, of legal age, Costa Rican, holder of identity card number CED01, an economist by profession, born in San José on 13 de agosto de 1971, son of Nombre02 and Nombre03, resident of Escazú; Nombre04, of legal age, Costa Rican, holder of identity card number CED02, an attorney by profession, born in Puerto Viejo de Sarapiquí on 27 de diciembre de 1962, son of Nombre05 and Nombre06, resident of Nicoya; and Nombre07, of legal age, Costa Rican, holder of identity card number CED03, a forestry engineer by profession, born in San José on 31 de octubre de 1975, son of Nombre08 and Nombre09, resident of Nicoya, for the offense of VIOLATION OF THE LEY FORESTAL AND OTHER OFFENSES, to the detriment of NATURAL RESOURCES AND OTHERS.

The following appeared before this Court: attorneys Rafael Ángel Guillén Elizondo, private defense counsel for defendants Nombre04 and Guillén Monge; Mario Antonio Rivera Garbanzo, private defense counsel for accused Nombre10; Nombre11, in the capacity of Criminal State Attorney; attorney Amy Román Bryan, prosecutor for the Public Prosecutor’s Office; and Mr. Nombre12, Attorney-in-Fact with Full Powers for Sociedad Condominios Naturalia.

BACKGROUND:

I.By judgment (sentencia) number 195-2013, issued at eleven hours and fifteen minutes on siete de mayo de dos mil trece, the Criminal Court of the Second Judicial Circuit of San José ruled: “THEREFORE (POR TANTO): In accordance with the foregoing; Articles 39 and 11 of the Political Constitution; Articles 8 and 9 of the American Convention on Human Rights; Articles 1, 2. 11. 30, 350.360,365 of the Criminal Code; Articles 1, 2. 3, 4, 5, 6, 9, 12. 13. 31, 33. 34, 37, 40. III a 116, 141, 142, 175, 178. 179. 180 al 184, 267 a 270, 360 al 366 of the Code of Criminal Procedure; and Articles 1, 3, 19, 27, 58, 61 of the Ley Forestal; IT IS UNANIMOUSLY RULED: Each and every claim of defective procedural acts (actividades procesales defectuosas) submitted by the defense is denied, as is the statute-of-limitations defense (excepción de prescripción) regarding the offenses of violating the Ley Forestal in the forms of illegal logging and land use.

Defendants Nombre01, Nombre07 V1LLEGAS, and Nombre04 are acquitted of all punishment and liability for the offenses of violating the Ley Forestal in the forms of illegal logging and land-use change (cambio de uso de suelo). Nombre07 is acquitted of all punishment and liability for two offenses of MAKING FALSE STATEMENTS IN A PUBLIC DOCUMENT (FALSEDAD IDEOLÓGICA); Nombre04, for one OFFENSE OF MAKING FALSE STATEMENTS IN A PUBLIC DOCUMENT and two offenses of MALFEASANCE IN OFFICE (PREVARICATO); and Nombre01, for one offense of USE OF A FALSE DOCUMENT (USO DOCUMENTO FALSO), all of which had been charged against them to the detriment of Natural Resources and others, pursuant to the universal principle of in dubio pro reo. The civil claim for damages (acción civil resarcitoria) is granted, and the civil co-defendants are held jointly and severally liable for payment of the damage caused, which is fixed at sixteen million two hundred thirty-four thousand thirty colones and eleven céntimos, plus interest calculated on the basis of the interest rate for six-month certificates of deposit issued by Banco Nacional de Costa Rica, from the date of judgment until payment in full.

The civil co-defendants are ordered to pay the attorney’s fees and procedural costs (costas personales y procesales) of the civil action, with attorney’s fees assessed at three million one hundred eighty-five thousand one hundred colones pursuant to decree 32493-J. The real property is ordered restored to the condition in which it existed immediately before the land-use change occurred; accordingly, all permits granted and the administrative acts that gave rise to those permits are annulled. Once this judgment becomes final, notice shall be given to the appropriate institutions and offices. NOTICE SHALL BE GIVEN BY READING ALOUD. (sic.)”

II.Attorneys Rafael Ángel Guillén Elizondo, private defense counsel for defendants Nombre04 and Guillén Monge; Mario Antonio Rivera Garbanzo, private defense counsel for accused Nombre10; Nombre11, in the capacity of Criminal State Attorney; attorney Amy Román Bryan, prosecutor for the Public Prosecutor’s Office; and Mr. Nombre12, Attorney-in-Fact with Full Powers for Sociedad Condominios Naturalia, filed appeals against the foregoing ruling.

III.Upon completing the corresponding deliberation in accordance with Article 465 of the Code of Criminal Procedure, the Court considered the issues raised in the appeal.

IV. The relevant statutory requirements have been observed throughout the proceedings

Drafted by Judge Vargas Rojas; and, CONSIDERING (CONSIDERANDO):

I. APPEAL BY THE MINISTERIO PUBLICO

Licenciada Amy Román Bryan, representative of the Ministerio Público, files an appeal against the judgment (recurso de apelación de sentencia). As the first ground for the challenge, she alleges failure to state reasons (falta de fundamentación) because the judgment did not address issues submitted for the Tribunal’s consideration. She argues that, in its closing arguments, the Ministerio Público asserted that the statements of Nombre13 and Nombre14, as well as the reports issued by them, were essential to resolving the case, insofar as they indicated that there was understory vegetation (sotobosque) on the property, where lianas, vines, and flora could be observed. All of this was alleged to demonstrate that, when defendants Nombre15 and Nombre04 conducted the field visits to the property, they should have noticed its existence and should not have proceeded to grant the logging permit (permiso de corta).

When witness Nombre16 was asked about the photographs, he acknowledged that they did indeed appear to depict understory vegetation. Another matter that was not analyzed concerns the visual inspection (inspección ocular) recorded at folio 631, in which Nombre16 participated and during which it was noted that the Naturalia property borders a forest with a wetland and a municipal forest. The appellant argues that if the witness observed the forest when he conducted the inspection, it was evident that the property bordered a secondary forest (bosque secundario) and that there was therefore continuity with that forest. Although these matters were raised at trial, they were not resolved in the judgment. As the second ground, she alleges a violation of the rules of sound judicial reasoning (sana crítica), particularly the rules of logic and derivation. With respect to the expert evidence (prueba pericial), the judge found Nombre16’s account credible without verifying the quality standards required for that report to be deemed valid.

The ruling acknowledges that the methodology used to prepare the report was not even mentioned; nor did it indicate that measurement plots had been established or that the circumference of the trees had been measured, and there are no attachments or photographs establishing that this was done. It states that cartographic sheets, templates concerning the State’s natural heritage, and mapping of the park and buffer zone were used, but none were attached. In contrast, the prosecution’s expert reports substantiate the information they provide. It can be inferred from the expert report at folios 687 to 689 that the expert concluded that this was not a forest area because continuity was interrupted by a dwelling, even though at trial he stated that continuity was not a parameter he used at the time of the events. The witness said that he had consulted Nombre17 and Nombre18 by telephone and that they had reviewed the satellite images and indicated that it was a wooded pasture (potrero arbolado).

This demonstrates that he did not use all the technical tools available to determine whether the site was a forest. With respect to the visual-inspection report, the Tribunal merely referred to it and did not analyze it in depth. The Tribunal also erred in finding Nombre17’s testimony credible, because it was inconsistent and he did not appear to conduct the field inspection of the property, even though the ruling states that he was found credible because he accompanied Nombre04 to the property. The document at folio 50 of evidentiary file 3 demonstrated that this was not true. The documents admitted into evidence and contained in evidentiary file No: 2 state that the inspections were conducted on March 6 and 27, 2007, that is, on the same day that the forest inventory and its addendum were submitted and the logging permit was requested. No weight was given to Nombre19’s testimony that, on the 2 occasions when the Minae official visited the property, he was alone, carried no equipment, and remained for no more than 15 minutes, thereby demonstrating that Nombre17 never accompanied the defendant to conduct the inspection.

She requests that the grounds be upheld, the judgment vacated, and the case remanded for new proceedings (reenvío para la nueva sustanciación). The appeal is granted. Defendants Nombre15, Nombre04, and Nombre01 were charged with the offenses of violating the Ley Forestal, felling trees, land-use change (cambio de uso del suelo), false statements in an official instrument (falsedad ideológica), use of a false document, and breach of official duty (prevaricato). The judgment found it proven that defendant Nombre20 was the manager and legal representative of Condominio Naturalia Las Orquídeas, which owned a property located in Playa Tamarindo. On February 27, 2007, defendant Nombre01 retained Nombre07’s professional services to provide forest oversight (regencia forestal). On March 5, 2007, Nombre07 issued a certification stating, in his capacity as forest manager (regente forestal), that the area of the property belonging to the aforementioned company, where it was intended to cut the 116 trees identified in the forest inventory, was not a forest area or part of one.

This was incorrect because, as of that date, it was indeed a forest. This made it possible to process a logging permit, causing serious environmental harm: a forested area was clear-cut (tala rasa), resulting in land-use change. On March 6, 2006, Nombre01 appeared before the Área de Conservación Tempisque, Oficina de Santa Cruz, where he requested authorization to cut 116 trees for the purpose of carrying out a real-estate development. On that same March 6, 2007, co-defendant Nombre04, an official of the Oficina Subregional de Santa Cruz del área de Conservación del Tempisque, conducted a field visit to the property and issued report 33-07, in which he stated that the land was suitable for construction when it was in fact a forest, thereby enabling the logging permit to be obtained. On March 27, 2007, the Oficina del Área de Conservación Tempisque received a request to expand the permit granted, in which defendant Nombre04 inventoried 42 additional trees and recommended authorizing their cutting.

Although the Tribunal found that the area was forested, it acquitted the defendants on the ground that they may have acted under a mistake (error). In this regard, it reasoned that a real-estate project was to be developed at the site where the forest was located and that the project’s manager, Mr. Nombre21, therefore retained forest engineer Nombre13 so that, through the appropriate forest oversight, she could obtain the permits for cutting and processing the timber. In accordance with the duties inherent in her role as forest manager, she visited the site, located it using both the cadastral plans and the global positioning system, hereinafter GPS, and, after conducting various studies such as plot surveys and taking photographs, determined that the area was covered by two tropical dry-forest environments, one severely disturbed and the other undergoing secondary succession. She prepared a report on this matter, which is attached to the case file (expediente).

At trial, in response to questions from the parties, she expanded upon that report, stating that she had no doubt whatsoever in immediately determining that one of the areas was unquestionably a forest, while the other appeared to be a disturbed forest (bosque intervenido). It was with respect to this second segment that she recommended conducting a more extensive, detailed study using photo-verification tests to ensure that no forest existed or had existed in the area. After the clear-cutting had occurred, several technical reports were prepared, including one by engineer Nombre14, who is also a forest manager. He visited the site, observed the clearing, established a working methodology, and concluded “..without any doubt that the area evaluated was a disturbed primary forest or mature secondary forest, which was cleared in its entirety.” This conclusion was not only set forth in the report but was also confirmed by him at trial, where he explained how he had reached that determination, including a GPS survey, followed by overlaying it with the available cartographic information and three additional sources (googleearth, aerial photographs, and the official FONAFIFO map), all three of which confirmed the existence of the forest.

In addition, report SINAC-DE_GMRN-292, dated June 9, 2008, was considered. It was prepared by Nombre22 and Nombre23, who, using the same coordinates used by engineer Nombre13 and engineer Nombre14, determined that this was a forest area from which the vegetation had been cleared. Witness Nombre23 even provided an additional fact, indicating that the property bordered a wetland, specifically a mangrove swamp. Both explained in detail the methodology followed and their visit to the site, concluding that the forest existed. Against this background, and despite an expert’s categorical statement that one area was unquestionably a forest and another appeared to be one, the company decided to retain defendant Nombre15, who prepared a report and determined that no forest existed or had ever existed, proceeded to conduct a forest inventory, and applied for the permit to cut the trees. That report was supplemented by the actions of Nombre04, Head of the Área de Conservación del Tempisque, who not only endorsed Nombre07’s conclusion but also authorized the cutting of the trees.

On the one hand, there is the opinion of a specialist in the field, engineer Nombre13, who visited the site, conducted technical studies, and concluded that there was no doubt that one sector constituted a forest, although she had doubts regarding the other area. After the clearing, a group of experts scientifically and with thorough documentation established that this had been a forested area that was cleared. Faced with this evidence, the Tribunal found that doubt existed because professional Nombre16, also a forest engineer, appeared at trial and stated that he had visited the area and observed that the land was not a forest but rather a wooded pasture, and that, when he consulted engineer Nombre17, who was responsible for ACT’s geographic information system, and Nombre18, ACT’s natural resources and wildlife manager, they told him that it was a wooded pasture. However, as asserted in the challenge, the Tribunal failed to analyze several matters of crucial importance in assessing that evidence.

First, the foregoing experts, whose findings have already been described, explained the methodology used and their use of instruments such as GPS, plot surveys, aerial photographs, cartographic sheets, and others, which enabled them to support the conclusions they had reached. In contrast, Mr. Nombre16’s report, which consists of a single page containing four paragraphs, has no methodology section and does not explain the methodology used; its conclusions therefore lack scientific rigor. Indeed, the credibility of an expert opinion (dictamen pericial) depends on whether any other expert following the methodology used would reach the same conclusions. If no such methodology exists, there is no way to corroborate the information. Later, when he appeared at trial and was questioned by the parties, the witness stated that he had indeed followed a methodology involving measurement plots and the examination of photographs and cartographic sheets, but these materials were never introduced into the adversarial proceedings (contradictorio) and, moreover, even assuming hypothetically that they existed, they would contradict the documented reports of engineer Nombre13 and experts Nombre22 and Nombre23.

Apart from the methodological problem affecting Nombre16’s report, it is important to note the visual inspection at folio 631, at which he was present. That document states directly and specifically that the land observed, where the clearing occurred, borders to the east “a forest with a wetland,” reasonably suggesting that the cleared area also formed part of that forest.

Another important aspect, which was likewise not considered in the assessment of that evidence, is the fact that Mr. Nombre16’s report concludes that the property measures “1526 square meters, and therefore this is not a forest area; its continuity is interrupted by two dwelling houses...” (folio 687). Both assertions have been disproved. First, although the property where the logging (tala) occurred is smaller than two hectares, the concept of forest (bosque) is defined in Article 3(d) of the Ley Forestal, which literally states: “d) Forest: A native or indigenous ecosystem, whether disturbed or undisturbed, regenerated through natural succession or other forestry techniques, occupying an area of two or more hectares and characterized by the presence of mature trees of different ages, species, and sizes, with one or more canopies covering more than seventy percent (70%) of that area and containing more than sixty trees per hectare with a diameter of fifteen or more centimeters measured at breast height (DBH) (diámetro medido a la altura del pecho, DAP).” Thus, the two hectares must not be viewed from the land-registry perspective (punto de vista registral).

That is to say, regard should not be given to the size of the property intended to be logged or to its registration in the land registry, but rather to the existence of the entire ecosystem, regardless of its owner or owners. What matters is that the ecosystem—the forest in its entirety and in accordance with the principle of continuity (principio de continuidad)—measures two or more hectares. At the apex of our country’s legal system is the Political Constitution (Constitución Política), whose principles and rules inform the entire legal order. Articles 45 and 50 of the Constitution are fundamental to the interpretation of these cases. The first paragraph of Article 45 establishes the right to private property. Constitutional interpretation has clarified that private property includes the bundle of rights encompassed by that right, such as possession, usufruct, use, or habitation. Under our law, property rights are not absolute; they may be restricted for reasons of public interest and social interest so that property may fulfill its social function (función social) (on this matter, see decisions 479-90 and 3822-13, both issued by the Sala Constitucional).

In this regard, it is harmonized with Article 50, which establishes every inhabitant’s right to a healthy and ecologically balanced environment. It has been said that this wording of the provision leads us to recognize sustainable development (desarrollo sostenible) as a premise of our legal order because, although the right of all persons to acquire property is recognized, it also requires that such use be balanced for the benefit of the community. Therefore, fundamental rights such as private property and the environment must be harmoniously balanced, with the understanding that our law protects access to property through all permitted means but imposes corresponding duties upon that power. It would be very easy for a registered owner to circumvent the law merely by subdividing (segregar) the property into lots smaller than two hectares and then transferring them to different persons. As stated, what is protected is the forest as an ecosystem, not as a land-registry measurement.

In this case, the Trial Court accepts that the concept of forest must be understood in the terms described above and not according to the argument advanced by Mr. Nombre16, who, as Head of the Santa Cruz Regional Office, Área de Conservación Tempisque, should also be aware of this. On this matter, the judgment states: “the experts speak of the existence of a principle of forest continuity, such that, in this case, behind Naturalia’s property, on one of its sides, there was forest on both properties; therefore, even though the property measured less than two hectares, there was continuity that clearly extended to two hectares, despite the fact that no measurements of the site were taken; it was also established that behind the property are the San Francisco mangrove and Parque Nacional Marino Las Baulas, such that forest continuity exists at the site...” The second aspect is that, during the trial, Mr.

Nombre16 recanted his assertion that the presence of two houses interrupts the continuity of the forest, since that concept is no longer applicable. In addition to the reasons given, it should be noted that the conclusions of the defendants and engineer Nombre16 are inconsistent with the photographs of the area, which show a significant number of trees, lianas, vines, and other elements characteristic of the understory (soto bosque). In light of the foregoing, the representative of the Public Prosecutor’s Office (Ministerio Público) is correct in finding that the judgment contains significant deficiencies in its reasoning (fundamentación), because it failed to analyze comprehensively and coherently the account provided by one of the essential components of the body of evidence (elenco probatorio), namely Mr. Nombre16’s report and testimony, a circumstance that affected the issuance of the acquittal. Accordingly, the appeal is granted, the acquittal entered in favor of Nombre15, Nombre04, and Nombre01 is vacated, and the case is remanded for new proceedings (reenvío para la nueva sustanciación).

II. APPEAL BY ATTORNEY RAFAEL ÁNGEL GUILLEN MONGE

In the sole ground of the appeal filed by counsel for the accused, Nombre07, he alleges a violation of the rules of sound judicial reasoning (sana crítica), because he believes that the accused should have been acquitted with certainty and not on the basis of doubt. The Trial Court assumes that Nombre15 proceeded from the erroneous premise of whether or not the property was forest and, when in doubt, should have applied the principle of resolving doubt in favor of nature (in dubio pro natura); in reality, however, the accused was always certain that no forest existed on the property, as stated by the witness Nombre16. For land to constitute a forest, it must cover an area greater than 2 hectares, which is not the case here. The experts “preferred by the prosecution” concluded that it was a forest whose trees had been razed, with only 42 of them left standing. He maintains that, in this case, the adjacent land was not measured to determine whether the entire tract contained 2 or more hectares of forest.

Although the witnesses stated that, “to the naked eye,” it appeared to exceed 2 hectares, the fact remains that no measurement was taken. The expert Nombre16 established that the land measures 1526 meters; therefore, it is not a forest, and its continuity is interrupted by the presence of 2 homes. The case file contains the SINAC certification establishing that the land is located outside any protected wilderness area (área silvestre protegida), all of which demonstrates that Nombre15 did not proceed from any erroneous premise and that no offense was committed because there was no forest. The offenses attributed to his client can be committed only with criminal intent (dolo), and no such intent was proven in this case. He objects that the Trial Court confused the factual doubt (duda factorial) as to whether the property was forest with the lack of evidence regarding criminal intent. Doubt exists only as to whether or not a forest existed at the site when the events occurred, arising from the differing opinions expressed by the experts.

On one side are Nombre13; the engineer Nombre17, who accompanied the defendant Nombre04; and the accused Nombre07. The first stated that a more thorough study using aerial photographs and other instruments was necessary; Nombre17 told Nombre04 that there was no forest there; and Nombre07 determined that no forest existed on that property. The second group, which analyzed the land after the events, consisted of the engineers Nombre22, Nombre23, Nombre24, and Nombre25, who testified under oath that it was a forest. They reached that conclusion based on the estimates of other professionals and a measurement made by eye. In contrast, the forestry engineer Nombre16, at folio 687, stated that the land measured 1526 meters and was not part of the forest because continuity was interrupted by the presence of 2 houses that had been built at the site. He requests that his client be acquitted with certainty and not on the basis of doubt.

No ruling is issued for lack of legal interest (interés). As decided in the preceding recital, this Court granted the appeal filed by the representative of the Ministerio Público and vacated the judgment of acquittal entered in favor of the accused. Accordingly, whether the defendants are responsible must be adjudicated in a new trial.

III. APPEAL AS TO CIVIL MATTERS

The appellant alleges a violation of the rules of sound judicial evaluation (sana crítica), lack of reasoning, inadmissibility of the civil damages action (acción civil resarcitoria), lis pendens (litis pendencia), and lack of evidence regarding the causal nexus (nexo causal). He argues that, in this case, the civil damages action was granted and the defendants were held jointly and severally liable for payment of the damage caused, which was assessed at more than 16 million colones; they were also ordered to pay costs and to restore the property to its prior condition. The judgment does not contain a clear and precise account of the facts deemed proven. It did not state that a condominium existed, nor was it shown that Nombre01 was the representative of the 62 limited liability companies. The evidence was improperly assessed because the judgment states that a forest existed, when in fact its existence was not proven.

The existence of necessary passive joinder (litisconsorcio pasivo necesario) was raised because the action was brought only against company No: 62, excluding the other 61 and leaving them without a defense, even though they own an undivided interest (derecho indiviso). Because judgment was entered against all of them, the other 61, who were not summoned to trial, were denied an opportunity to defend themselves. According to the appellant, the conclusion reached by the judges is not legally, logically, or factually correct, since this is not a condominium but rather multiple co-ownership (copropiedad múltiple) by independent persons, each with its own corporate identification number. He believes that the Court was confused by the trade name, but no condominium exists under the law governing condominiums. A condominium is not presumed; it must be proven. He requests that the ground of appeal be granted and the civil damages action declared inadmissible.

Regarding the assessment of the evidence, he argues that the acquittal was based on doubt as to whether the accused knew that the land was a forest or wooded land (terreno arbolado). In the civil proceeding, however, the Court found fault-based liability (responsabilidad subjetiva) based on the existence of a causal nexus between the act and the resulting damage, due to a failure to act diligently and a failure to apply the in dubio pro natura principle. He insists that the existence of a forest was not proven, nor was it proven that the area exceeded 2 hectares, and that the registered survey plan clearly identifies it as building land measuring 10.016,77 square meters. He further argues that the Environmental Prosecutor’s Office’s premise—that the entire forest must be considered regardless of who owns the land—has no legal basis, particularly since the adjoining area was not measured in this case.

He again emphasizes the expert evidence, such as that of forestry engineer Nombre16, who determined that it was an area of wooded pasture (potrero arbolado), without forest; together with the SINAC certification establishing that the land was outside any protected wilderness area (área silvestre protegida), which certification was not challenged, this leads to the absolute conviction that no offense occurred because the land was not forest and there is no evidence establishing otherwise. He also challenges the technical report assessing the environmental damage (daño ambiental), because it states, on the one hand, that there were 435 trees, while engineer Nombre13 states that there were 200. The report acknowledges that few methodologies exist for assessing environmental damage. In this case, the experts had not even known the site beforehand, and therefore their conclusions are inconsistent, subjective, and even arbitrary.

The assessment was based on the premise that 158 trees had been cut, whereas the document states that 142 standing trees were found marked with red paint and numbered from 1 to 42, without deducting their economic value. He requests that the appeal be granted and the civil damages action denied. The appeal is denied. As stated in the preceding recitals (considerandos), the Trial Court had no doubt whatsoever regarding the occurrence of the act. Indeed, according to the statement of proven facts, which apply to both the criminal and civil matters, it was established that the logged area was in fact a forest. The Trial Court’s doubt, on the basis of which it acquitted the accused and which, as held in the first recital, was not properly substantiated, concerned whether the defendants knew that the land was a forest, based on the erroneous premise that it was wooded pasture. Essentially, the Trial Court questioned the existence of intent (dolo), concluding that the accused had acted negligently and caused environmental damage.

There can be no doubt that the defendants’ actions directly resulted in the clear-cutting (tala rasa) of an area of forest. Accordingly, the argument concerning causation has no legal basis. There is an inseparable relationship between the defendants’ conduct and the cutting of the trees. Indeed, although already stated, it bears repeating that the company represented by defendant Nombre01 intended to develop a real estate project in the area and therefore hired a forestry manager (regente forestal) to conduct the study and process the tree-cutting permits. This engineer determined that at least one area was forest and the other was disturbed forest (bosque intervenido). In response, engineer Nombre07 was hired, and he had no objection to certifying that no forest existed and that the land was wooded pasture. The same occurred with Mr. Nombre04, who ultimately issued authorization for the cutting and change in designated land use (cambio de destino del suelo).

From all the foregoing, the conclusion regarding liability is evident, since the civil defendants definitively participated in obtaining an opinion contrary to the actual facts, certifying that the forest did not exist and thereby securing authorization for the logging. Both circumstances undoubtedly contributed to causing the damage, since no exemption from liability (eximente de responsabilidad)—fault of the victim, unforeseeable event or force majeure, or fault of a third party—has been established. Regarding the existence of necessary passive joinder, this issue was correctly decided by the Trial Court. Point six of the substantive recital, specifically subsection a), sets forth the reasons for rejecting the defense. As the judges held, a conclusion also endorsed by this Chamber, the defendants legally constitute a legal entity with capacity to appear and act in proceedings. In such cases, representation is exercised by an administrator vested with the powers established by civil law.

For practical purposes, various corporate forms may be adopted, as occurred here with limited liability companies. As the Trial Court correctly stated, and as confirmed by the Public Registry certifications, in this case the legal status (personería jurídica) is registered under Real Folio 5-87864, interests 001 through 062, and the legal representative is Mr. Nombre01, who holds unlimited general power of attorney (apoderado generalísimo sin límite de suma). Moreover, a comparison of the certifications appearing at folios 520 through 627 of the principal case file clearly shows that Mr. Nombre01 is the legal representative of the condominium and of the 62 units. The civil complaint was served on that representative, and therefore the alleged denial of an opportunity to defend did not occur. Regarding the quantification of damages, the Trial Court relied on the expert assessment, which, regardless of the number of trees cut, found that substantial environmental damage had occurred that was extremely difficult to quantify, but prudently assessed it at sixteen million two hundred thirty-four thousand thirty colones.

That expert report, appearing at folios 191 through 209 of the principal case file and prepared by four specialists—engineers Nombre22, Nombre23, Nombre24, and Nombre25—set forth the stated objectives and the methodology, which included reviewing the administrative case files, conducting a field visit, examining forest-cover maps (FONAFIFO 2000), global positioning, surveying plots, and evaluating the area. After analyzing the impact in accordance with the established parameters, the damage was prudently assessed at sixteen million two hundred thirty-four thousand thirty colones. The experts even concluded that this estimate “does not cover the entirety of the administrative cost generated by this case up to that stage of the proceedings, much less the cost of the subsequent judicial proceedings; nevertheless, the purpose here is to express what the accused—if found responsible for the alleged acts—should cover solely under the item known as ‘management costs’ in determining the amount of this assessment” (folio 205).

In any event, this was an important forest bordering a wetland and a leatherback sea turtle protection area, which entailed the existence of a biological corridor (corredor biológico) of critical importance to the fauna and flora. It follows from the foregoing that the determination of damages was neither arbitrary nor subjective, but was reasonably supported by the expert assessment entered into evidence. For the foregoing reasons, the ground of appeal is denied.

IV. APPEAL BY Nombre12

As the first ground, he alleges a lack of reasoning and a violation of the right to a defense. The amendment to the civil action for damages (acción civil resarcitoria) was disregarded as to its existence, and no ruling was issued on it. Furthermore, the company Condominio Naturalia número 62 was not joined to the proceeding or notified of the civil action for damages. He argues that the State’s representative filed an amendment to the civil action for damages and that it went unnoticed by the Court, which disregarded its existence. The ruling ordering that the civil defendants be notified of the action filed appears at folio 16; however, as may be inferred from folios 17 and 18, the destination fax number was 22 31-7442, which does not belong to Nombre10 or his defense counsel. Moreover, to provide notice of the amendment to the civil action, a completely unknown person, Nombre26, was summoned.

He reiterates that his client was not joined to the proceeding because she was not served, summoned, or notified of the civil action. The ground is denied. As indicated in the preceding recitals (considerandos), the civil action for damages was properly brought. The legal representative was personally served. Mr. Nombre10 is the legal representative of the co-defendants and had knowledge of, and the opportunity to learn of and contest, the civil claim filed. As to the amendment to the civil action, the appellant himself acknowledges that it was disregarded by the Court, and therefore it could not have caused him prejudice. Consequently, the ground is denied. As the second ground, he alleges that the criminal court is precluded from ordering the nullification of administrative acts and permits as a consequence of restoring the property to the condition it was in before the events. Furthermore, an action challenging constitutionality (acción de inconstitucionalidad) questions the case-law standard concerning the application of Article 492 of the Code of Criminal Procedure (Código Procesal Penal).

In this case, when ruling on the merits, the Court ordered the permits nullified, which has no legal basis and constitutes an encroachment upon the jurisdiction and powers specific to administrative litigation. In addition, although there has been a line of case law in which courts have applied Article 492 by nullifying and canceling registrations and permits, that line of case law has been challenged before the Sala Constitucional, which admitted the corresponding action for consideration; accordingly, the merits of the matter could not be decided until a ruling on that issue had been issued. He requests that the appeal be granted and that the civil action filed be denied. The ground is denied. It is true that Article 492 of the Code of Criminal Procedure and the case law derived from it by the Sala Tercera de la Corte Suprema de Justicia were challenged before the Sala Constitucional of our country.

However, that court, through vote 2013-1205, at 14:45 hours, on 11 de setiembre del año en curso, summarily dismissed the action filed. Therefore, there is no legal impediment to the courts’ application of the cited provision. Under the article invoked, “When a judgment declares a public instrument to be false, the court that issued it shall order that the instrument be reconstructed, canceled, or amended. Where appropriate, it shall order the corresponding corrections to the registry records. If the document was removed from an archive, it shall be returned thereto, with a marginal notation on each page, and a copy of the judgment establishing its total or partial falsity shall be attached. If it is a notarized document, the declaration made in the judgment shall be noted in the margin of the original instrument, on the certified copies that have been submitted, and in the corresponding registry.” In the present matter, it was established with absolute certainty that the information provided by engineer Nombre07, stating that the land was not forest but rather wooded pasture, was false.

The same was true of the report issued by co-defendant Nombre04. That false information enabled the issuance of a series of permits that led to the cutting of trees. Thus, the legal consequence is the nullification of those permits, which were based on false premises. It is clear that there is no jurisdictional issue, since the legislature, in the cited provision, authorized the Court, once falsity has been established, to nullify, cancel, modify, or reconstruct the instrument. That is precisely what occurred in this case, where the permits based on false facts were nullified. For the foregoing reasons, the ground is denied.

V. APPEAL BY ATTORNEY MARIO RIVERA GARBANZO

Attorney Mario Rivera Garbanzo, privately retained defense counsel for Nombre01, files an appeal against the judgment. As the first ground, he challenges the improper interpretation of criminal law. He argues that the definition of forest in the Ley Forestal and its implementing regulations does not encompass the facts of this case because the property at Dirección01 does not meet the required area. According to the case law of the former Tribunal de Casación Penal that he cites, environmental protection should not lead to an expansion of criminal conduct that violates the principle of minimum criminal-law intervention. The cutting of trees that do not constitute a forest is not legally punishable, and the interpretation of the law must respect the principle of legality. The evidence submitted in the proceeding established that the property does not reach the surface area of 2 hectares required by subsection d) of Article 3 of the Ley Forestal; therefore, there is no civil liability.

He argues that, even assuming the position of the Ministerio Público set forth in the Propuesta de Política de Persecución de los Delitos Ambientales, to the effect that forestland must be considered as a whole rather than by individual property, the fact remains that no evidence was received to determine the existing forest area; therefore, because no causal link was established, the civil judgment is unwarranted. He requests that the appeal be granted and that the civil action for damages be denied. The grounds are denied. The matters raised by the appellant were already presented and resolved in the preceding recitals.

VI. APPEAL BY ATTORNEY RAFAEL ÁNGEL GUILLEN MONGE

In the sole ground of the appeal filed by defense counsel for Nombre04, he alleges a violation of the rules of sound judicial reasoning (sana crítica), because he believes his client should have been acquitted on the basis of certainty rather than doubt. The Court assumes that Nombre04 proceeded from an erroneous premise as to whether the land was a forest and that, in the face of doubt, he should have applied the in dubio pro natura principle; in reality, however, the accused was always certain that no forest existed on the property, as witness Nombre16 testified. For land to constitute a forest, it must cover an area greater than 2 hectares, which is not the case here. The expert witnesses “preferred by the prosecution” concluded that it was a forest whose trees had been razed, leaving only 42 of them standing. He contends that, in this case, the adjacent land was not measured to establish whether the entire tract comprised 2 or more hectares of forest.

The offenses attributed to his client can be committed only with criminal intent (dolo), and no such intent was established in this case. He objects that the Court confused factual doubt as to whether the land was a forest with the lack of evidence regarding criminal intent. Doubt exists only as to whether, at the time of the events, a forest existed at that location, and this doubt arises from the differing opinions expressed by the experts.

On one side are Nombre13; engineer Nombre17, who accompanied defendant Nombre04; and accused Nombre07. The first stated that a more thorough study using aerial photographs and other instruments was necessary; Nombre17 told Nombre04 that there was no forest there; and Nombre07 determined that no forest existed on that property. The second group, which analyzed the land after the events, consisted of engineers Nombre22, Nombre23, Nombre24, and Nombre25, who, under oath, stated that it was a forest—a conclusion they reached based on the estimates of other professionals and a measurement made by eye. In contrast, forestry engineer Nombre16, at folio 687, stated that the land measured 1526 meters and was not part of the forest because continuity was interrupted by the existence of 2 houses built at the location. He requests that his client be acquitted on the basis of certainty rather than doubt.

No ruling is issued due to lack of standing. As decided in the first recital, this Court granted the appeal filed by the representative of the Ministerio Público and annulled the acquittal entered in favor of the accused. Accordingly, whether the accused bear criminal liability must be determined in a new trial.

VII. APPEAL AS TO CIVIL MATTERS

The appellant alleges a violation of the rules of sound judicial evaluation (sana crítica), insufficient reasoning, inadmissibility of the civil action for damages (acción civil resarcitoria), lis pendens (litis pendencia), and lack of evidence regarding the causal link (nexo causal). He argues that, in this case, the civil action for damages was granted and the defendants were held jointly and severally liable for payment of the damage caused, which was assessed at more than 16 million colones; they were also ordered to pay costs and to restore the property to its prior condition. The judgment does not contain a clear and precise account of the facts deemed proven. It did not state that a condominium existed, nor was it proven that Nombre01 was the representative of the 62 limited liability companies. The evidence was improperly assessed because the existence of a forest was asserted, when in fact its existence was not proven.

The existence of necessary passive lis pendens (litis pendencia pasiva necesaria) was raised because the action was brought only against company No: 62, excluding and leaving the remaining 61 without a defense, given that it was proven that they own an undivided interest (derecho indiviso). By entering a judgment against all 62, 61 of them, who were not summoned to trial, were left without a defense. According to the appellant, the conclusion reached by the judges is not legally, logically, or factually correct, since this is not a condominium but rather multiple co-ownership (copropiedad múltiple) by independent persons, each with a separate corporate identification number. He considers that the Court confuses the trade name with a condominium, although no condominium exists under the law governing it. A condominium cannot be presumed but must be proven. He requests that the ground be granted and the civil action for damages declared inadmissible.

Regarding the assessment of the evidence (valoración probatoria), he argues that the acquittal was based on the existence of doubt as to whether the defendants were uncertain about whether the property was a forest or wooded land (terreno arbolado). Nevertheless, with respect to civil liability, the Court found that subjective liability (responsabilidad subjetiva) existed because of the causal link between the act and the resulting damage, arising from a failure to act diligently and a failure to apply the in dubio pro natura principle. He insists that the existence of a forest was not proven, nor that the area exceeded 2 hectares, and that the registered cadastral plan (plano catastrado) clearly indicates that it is land intended for construction, measuring 10.016,77 square meters. He further argues that the premise advanced by the environmental prosecutor’s office—that the entire forest must be considered regardless of who owns the land—has no legal basis, in addition to the fact that, in this case, the adjoining area was not measured.

He emphasizes the expert testimony, including that of forestry engineer Nombre16, who established that the area was wooded pasture (potrero arbolado), without forest; this, together with the SINAC certification—which established that the land was outside any protected wilderness area (área silvestre protegida) and was not challenged—leads to the absolute conviction that no forest exists, because it was not a forest and there is no evidence establishing otherwise. POR TANTO:

The appeal filed by the representative of the Public Prosecutor’s Office is granted. The judgment acquitting Nombre07, Nombre04, and Nombre01 is vacated, and the case is remanded for new proceedings. For lack of interest, no ruling is issued on the cassation appeal (recurso de casación) concerning the criminal matters raised by defense counsel Guillén Elizondo, Guillén Monge, and Rivera Garbanzo on behalf of their clients. The appeals filed by the legal representatives regarding the civil claims are denied. Intervienen en la decisión del recurso, el juez Omar Vargas Rojas, el co-juez Ronald Salazar Murillo y la co-jueza Patricia Vargas González. RESULTANDO:

I.Que mediante sentencia número 195-2013, de las once horas quince minutos, del siete de mayo de dos mil trece, el Tribunal Penal del Segundo Circuito Judicial de San José, resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 39 y 11 de la Constitución Política, artículos 8 y 9 de la Convención Americana sobre Derechos Humanos, artículos 1, 2. 11. 30, 350.360,365 del Código Penal. artículos 1, 2. 3, 4, 5, 6, 9, 12. 13. 31, 33. 34, 37, 40. III a 116, 141, 142, 175, 178. 179. 180 al 184, 267 a 270, 360 al 366 del Código Procesal Penal, artículos 1, 3, 19, 27, 58, 61 de la Ley Forestal; POR UNANIMIDAD SE RESUELVE: se rechazan todas y cada una de las actividades procesales defectuosas presentadas por la defensa así como la excepción de 'prescripción respecto de los delitos de infracción a la ley forestal en su modalidad de tala ilegal y uso de suelo. Se absuelve de toda pena y responsabilidad a los aquí imputados Nombre01, Nombre07 V1LLEGAS Y Nombre04 por los delitos de infracción a la ley forestal en su modalidad de tala ilegal y cambio de uso de suelo.

Se absuelve de toda pena y responsabilidad a Nombre07 por dos delitos de FALSEDAD IDEOLÓGICA a Nombre04 por un DELITO DE FALSEDAD IDEOLÓGICA, y dos delitos de PREVARICATO y a Nombre01 por un delito de USO DOCUMENTO FALSO que se le han venido atribuyendo en perjuicio de los Recursos Naturales y otros; en aplicación del principio universal del in dubio pro reo. Se declara con lugar la acción civil. resarcitoria. y se condena solidariamente a los codemandados civiles al pago del daño causado que se fija en la suma de dieciséis millones doscientos treinta y cuatro mil treinta colones con once céntimos más el pago de los intereses calculados con base en la tasa de interés de los certificados de depósito a seis meses plazo del Banco Nacional de Costa Rica, a partir del dictado de la sentencia y hasta su efectivo pago. Se condena al pago de las costas personales y procesales de la acción civil a los codemandados civiles, liquidando las personales en un monto de tres millones ciento ochenta y cinco mil cien colones conforme al decreto 32493-J.

Se ordena la restitución del bien inmueble a su estado inmediato anterior al momento que se produjo el cambio de uso de suelo, y por ello se anulan lados los permisos otorgados. y los actos administrativos que dieron origen a dichos permisos. Una vez firme esta sentencia. se ordena comunicar a las instituciones y oficinas correspondientes. NOTIFIQUESE MEDIANTE LECTURA. (sic.)".

II.Que contra el anterior pronunciamiento interpusieron recursos de apelación os licenciados Rafael Ángel Guillén Elizondo, defensor particular de los imputados Nombre04 y Guillén Monge, Mario Antonio Rivera Garbanzo, defensor particular del encartado Nombre10, Nombre11, en calidad de Procurador Penal, la licenciada Amy Román Bryan, fiscal del Ministerio Público y el señor Nombre12, Apoderado Generalísimo de la Sociedad Condominios Naturalia.

III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta el Juez Vargas Rojas; y,

CONSIDERANDO:

I. RECURSO DEL MINISTERIO PUBLICO

La licenciada Amy Román Bryan, representante del Ministerio Público, interpone recurso de apelación de sentencia. En el primer motivo de la impugnación alega el vicio de falta de fundamentación por no pronunciarse sobre cuestiones sometidas a conocimiento del Tribunal. Aduce que el Ministerio Público planteó en sus conclusiones que resultaba esencial para la solución del caso las declaraciones de Nombre13 y Nombre14, así como los informes emitidos por ellos en el sentido de que existía un sotobosque en la finca, donde se apreciaba la existencia de lianas, bejucos y flora, todo lo cual se alegó para demostrar que los encartados Nombre15 y Nombre04, al realizar las visitas de campo en la propiedad, debieron percatarse de la existencia del mismo y no proceder a conceder el permiso de corta. Al consultarse al testigo Nombre16 sobre las fotografías, reconoció que efectivamente parecían un sotobosque.

Otro aspecto no analizado es con relación a la inspección ocular de folio 631 donde participó Nombre16 y en la cual se anotó que la propiedad de Naturalia colinda con un bosque con humedal y con bosque municipal. Argumenta la recurrente que si el testigo observó el bosque cuando se presentó a realizar la inspección, era evidente que la propiedad colindaba con un bosque secundario y por ende existía continuidad del mismo. Aspectos que a pesar de ser planteados en el debate no fueron resueltos en la sentencia. Como segundo motivo reclama la violación a las reglas de la sana crítica, es especial a la lógica y derivación. Con relación a la prueba pericial, el juzgador le otorgó credibilidad al dicho de Nombre16, apartándose de verificar los parámetros de calidad requeridos para tener por válido dicho informe. El fallo reconoce que ni siquiera se mencionó la metodología utilizada para rendir el informe, tampoco señaló que hiciera parcelas de medición, midiera la circunferencia de los árboles, no hay anexos que así lo establezcan, fotografías.

Se dice que usó hojas cartográficas, plantillas del patrimonio natural del Estado, mapeo del parque y zona de amortiguamiento, pero no se adjuntan. Contrario a ello, las pericias de cargo respaldan la información que suministran. De la pericia de folio 687 a 689 se colige que el perito llega a la conclusión de que no es un área de bosque, porque la continuidad se pierde por una vivienda, cuando en el debate señaló que la continuidad no era un parámetro que utilizara a la fecha de los hechos. El testigo dijo que había consultado con Nombre17 y Nombre18 por teléfono y que ellos verificaron las imágenes satelitales, indicando que era un potrero arbolado. Ello demuestra que no utilizó todas las herramientas técnicas para establecer si el sitio era o no un bosque. En relación con el informe de la inspección ocular, el Tribunal únicamente hizo una referencia, no la analizó a fondo. El Tribunal también se equivocó al darle credibilidad a la declaración de Nombre17, pues no fue coherente, no compareció a realizar la inspección de campo a la finca, pese a que en el fallo se dice que se le otorga credibilidad porque acompañó a Nombre04 a la finca.

Se demostró con el documento de folio 50 del legajo de prueba 3, que ello no fue cierto. Los documentos admitidos como prueba y que constan en el legajo de prueba No: 2 señalan que las inspecciones se hicieron el 6 y el 27 de marzo de 2007, o sea el mismo día en que se presentó el inventario forestal y el adendum al mismo y se solicitó el permiso de corta. No se ponderó que Nombre19 declaró que el funcionario del Minae en las 2 ocasiones que visitó la finca fue solo, no llevaba equipo, no duró más de 15 minutos, con lo que se demuestra que Nombre17 nunca fue con el encartado a realizar la inspección. Solicita se declaren con lugar los motivos, se anule la sentencia y se ordene el reenvío para la nueva sustanciación. Con lugar el recurso . Los encartados Nombre15, Nombre04 y Nombre01 fueron acusados de los delitos de infracción a la ley forestal, tala de árboles, cambio de uso del suelo, falsedad ideológica, uso de documento falso y prevaricato.

En la sentencia se tuvo por demostrado que el imputado Nombre20 era el gerente y representante legal de la empresa Condominio Naturalia Las Orquídeas, la cual era propietaria de una finca ubicada en Playa Tamarindo. El 27 de febrero de 2007, el imputado Nombre01 contrata los servicios profesionales de Nombre07 para una regencia forestal. El 5 de marzo de 2007, Nombre07 emite una certificación donde afirma, como regente forestal, que el área de la finca perteneciente a la empresa indicada y en la cual se pretendía cortar la cantidad de 116 árboles señalados en el inventario forestal, no correspondía a un área de bosque o parte de éste, lo que no era correcto, porque para la fecha sí correspondía a un bosque. Con ello se logró tramitar un permiso de corta, con lo que se ocasionó un grave perjuicio al ambiente, se hizo una tala rasa de una zona boscosa, produciendo un cambio de uso de suelo.

El 6 de marzo de 2006, Nombre01 se presenta ante el Área de Conservación Tempisque, Oficina de Santa Cruz, donde pide autorización para cortar 116 árboles con el fin de realizar un desarrollo urbanístico. Ese mismo 6 de marzo de 2007, el coimputado Nombre04, funcionario de la Oficina Subregional de Santa Cruz del área de Conservación del Tempisque, realizó una visita de campo a la propiedad y emitió el informe 33-07 donde señaló que se trataba de un terreno apto para construir, cuando en realidad era un bosque, con lo que se obtuvo el permiso para la corta de los árboles. El 27 de marzo de 2007, la Oficina del Área de Conservación Tempisque recibe una ampliación del permiso otorgado, donde el encartado Nombre04 inventarió 42 árboles más, recomendando autorizar la corta de los mismos. El Tribunal, pese a tener por acreditado que se trataba de una zona boscosa, absolvió a los encartados al estimar que pudieron actuar bajo la existencia de un error.

En ese sentido argumenta que en el sitio donde se ubicaba el bosque se iba a desarrollar un proyecto inmobiliario, por lo que el Gerente del mismo, señor Nombre21 contrata a la ingeniera forestal Nombre13 con el propósito de que a través de la regencia pertinente, obtenga los permisos para la corta y procesamiento de la madera. De conformidad con las funciones propias de la regente forestal, ella se apersona al lugar, hace una ubicación del sitio, tanto con los planos catastrados como a través del sistema de posicionamiento global, en lo sucesivo GPS por sus siglas en inglés y luego de realizar diversos estudios, tales como levantamiento de parcelas y toma de fotografías, determina que el área está cubierta por dos ambientes boscosos de bosque tropical seco, uno intervenido severamente y otro en sucesión secundaria. De ello levantó un informe que se encuentra adjunto al expediente. En el debate, a preguntas de las partes, amplió dicho informe señalando que ella no tenía duda alguna en establecer inmediatamente que una de las áreas sin duda alguna se trataba de un bosque, mientras que la otra parecía ser un bosque intervenido.

Es sobre este segundo segmento que recomienda realizar un estudio más profundo, pormenorizado, con pruebas de foto-verificación para asegurarse que no existía o existió un bosque en la zona. Con posterioridad a que se procediera con la tala rasa, se efectuaron diversos informes técnicos, dentro de los cuales se encuentra el elaborado por el ingeniero Nombre14, quien también es regente forestal, hace una visita al lugar, observa la tala, establece una metodología de trabajo y concluye "..sin ninguna duda que el área evaluada era un bosque primario intervenido o secundario maduro, el cual fue arrasado en su totalidad". Conclusión que no sólo se estableció en el informe, sino que además ratificó en el debate, explicando la forma en que llegó a dicha determinación, tales como levantamiento con GPS, luego la sobreposición con la información cartográfica disponible y tres fuentes adicionales (googleearth, fotos aéreas y el mapa oficial de FONAFIFO) y las tres confirmaron la existencia del bosque.

Además, de lo anterior, se tuvo el informe SINAC-DE_GMRN-292, del 9 de junio de 2008, realizado por Nombre22 y Nombre23, quienes, sobre las mismas coordenadas sobre las cuales trabajó la ingeniera Nombre13 y el ingeniero Nombre14, establecieron que se trataba de un área de bosque que había sido barrida su vegetación. Incluso, el testigo Nombre23 aporta un elemento adicional indicando que la propiedad colindaba con un humedal, propiamente un manglar. Ambos explicaron con detalle la metodología seguida y la visita al lugar, concluyendo sobre la existencia del bosque. Es sobre este contexto, con una afirmación categórica de una experta que señalaba que una zona era sin duda un bosque y otra semejaba serlo, que la empresa decide contratar al imputado Nombre15, quien hace un informe y determina que no existe, ni existió bosque, procediendo a realizar un inventario forestal y gestiona el permiso para la tala de los árboles.

Informe que se complementa con la actuación de Nombre04, Jefe del Área de Conservación del Tempisque, quien no solo avala la conclusión de Nombre07, sino que autoriza la corta de árboles. Por un lado tenemos la tesis de una especialista en la materia como es la ingeniera Nombre13, quien visita el lugar, hace estudios técnicos y concluye que no hay duda de que un sector constituye un bosque, teniendo duda sobre la otra área. Con posterioridad a la tala, un grupo de expertos establecen, de forma científica y bien documentada, que se trataba de una zona boscosa que fue arrasada. Frente a esa prueba, el Tribunal considera que existe una duda, porque al debate compareció el profesional Nombre16, también ingeniero forestal, quien indicó que se apersonó a la zona y pudo apreciar que el terreno no era un bosque, sino un potrero arbolado y que al consultarle al ingeniero Nombre17, encargado del sistema de información geográfica de ACT y Nombre18, gerente de recursos naturales y vida silvestre de ACT le indicaron que era un potrero arbolado.

Sin embargo, conforme se reclama en la impugnación, el Tribuna omite analizar una serie de aspectos que resultaban de capital importancia para la valoración del mismo. En primer lugar, los anteriores expertos, cuyos resultados ya han sido expuestos, explicaron la metodología empleada, el uso de instrumentos tales como GPS, levantamiento de parcelas, fotografías aéreas, hojas cartográficas y otros, que les permitieron fincar las conclusiones a las que habían llegado. Contrario a ello, el informe del señor Nombre16, el cual se expresa en una página con cuatro párrafos, no contiene un acápite ni explica la metodología empleada, por lo que sus conclusiones carecen de rigor científico. Precisamente, la credibilidad de un dictamen pericial depende de la posibilidad de que cualquier otro experto, siguiendo la metodología empleada, llegue a las mismas conclusiones. Si no existe esa metodología, no existe forma de corroborar la información.

Luego, cuando comparece al debate y es interrogado por las partes, el deponente asegura que sí siguió una metodología, tales como parcelas de medición, estudio de fotografías y hojas cartográficas, pero que nunca fueron aportadas al contradictorio y que además, en el hipotético caso de existir, resultarían contrarias a los informes documentados de la ingeniera Nombre13 y de los expertos Nombre22 y Nombre23. Aparte del problema metodológico que tiene el informe de Nombre16, es importante anotar la inspección ocular de folio 631, en la cual él estuvo presente. En ese documento de forma directa y concreta se hace constar que el terreno observado (donde ocurrió la tala) colinda por el este con "un bosque con humedal", lo que razonablemente sugiere que la zona talada también formaba parte de ese bosque. Otro aspecto importante, que tampoco fue considerado en la valoración de esa prueba, es el hecho de que el informe del señor Nombre16 arroja como resultado que el terreno mide "1526 metros cuadrados, por lo que ésta no es un área de bosque, su continuidad se pierde con dos casas de habitación..."(folio 687).

Ambas afirmaciones se encuentran descartadas. En primer lugar, aunque el terreno donde ocurre la tala es menor a dos hectáreas, el concepto de bosque se encuentra definido en el artículo 3, inciso d) de la Ley Forestal que literalmente señala: "d) Bosque: Ecosistema nativo o autóctono, intervenido o no, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o mas hectáreas, caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del setenta por ciento (70%) de esa superficie y donde existan más de sesenta árboles por hectárea de quince o más centímetros de diámetro medido a la altura del pecho (DAP)". De manera que las dos hectáreas deben verse, no desde el punto de vista registral. Valga decir, sin atender al tamaño del terreno que se pretende talar o la inscripción registral del mismo, sino más bien a la existencia del ecosistema integral, independientemente del propietario o propietarios del mismo.

Lo que interesa es que el ecosistema, el bosque en su integridad y conforme al principio de continuidad, mida dos o más hectáreas. Nuestro país, tiene en su vértice superior la Constitución Política, cuyos principios y normas informan todo el ordenamiento jurídico. Son fundamentales en la interpretación de estos casos los numerales 45 y 50 constitucionales. El artículo 45 establece en un primer párrafo el derecho a la propiedad privada. La interpretación constitucional ha permitido aclarar que cuando se habla de propiedad privada se incluye el haz de derechos que este derecho contempla, como por ejemplo la posesión, el usufructo, el uso, o la habitación. En nuestro derecho la propiedad no es absoluta, permite limitaciones de interés público e interés social, para cumplir con la función social de la misma ( Sobre el particular véase los votos 479-90 y 3822-13, ambos de la Sala Constitucional).

En este sentido se armoniza con el artículo 50, que establece el derecho de todo habitante a tener un ambiente sano y ecológicamente equilibrado. Se ha dicho que esta formulación de la norma, lo que nos conduce es a reconocer el desarrollo sostenible como premisa de nuestro ordenamiento, pues si bien se admite el derecho de todas las personas a acceder a la propiedad, por otra parte obliga a que ese uso, sea equilibrado en beneficio de la comunidad. Por tanto, derechos fundamentales como la propiedad privada y el ambiente deben estar equilibrados armónicamente entendiendo que nuestro derecho tutela el acceso a la propiedad a través de todos los medios permitidos, pero establece a ese poder deberes correlativos. Resultaría muy simple para un propietario registral burlar la ley con solo segregar el terreno en lotes inferiores a dos hectáreas, luego traspasarlo a diversas personas. Como se dijo, lo que se protege es el bosque como ecosistema y no como medida registral.

En este caso, el Tribunal de sentencia acepta que el concepto de bosque debe verse en los términos dichos y no bajo el argumento que presenta el señor Nombre16, quien como Jefe de la Oficina Regional de Santa Cruz, Área de Conservación Tempisque, también debería conocerlo. Sobre el particular el fallo señala: " los peritos hablan de que existe un principio de continuidad del bosque, de tal forma que en este caso, detrás de la propiedad de Naturalia en uno de los lados de la misma, en ambos existía bosque, por lo que a pesar de que la propiedad midiera menos de dos hectáreas, existía una continuidad que evidentemente alcanzaba las dos hectáreas, ello a pesar de que no se realizaron ninguna medición del lugar, pero también se acredita que detrás de la propiedad existe el manglar San Francisco y el Parque Nacional Marino Las Baulas, de tal forma que existe en el lugar una continuidad del bosque.." El segundo aspecto es que en el debate el señor Nombre16 se desdijo en cuanto a que la existencia de dos casas no hace que se pierda la continuidad del bosque, pues ese concepto ya no resulta aplicable.

Además de las razones indicadas, conviene apuntar que las conclusiones de los encartados y del ingeniero Nombre16 no concuerda con las fotografías de la zona donde se aprecia una importante cantidad de árboles, lianas, bejucos y demás elementos propios del soto bosque. En razón de lo anterior, lleva razón la representante del Ministerio Público al estimar que la sentencia contiene importantes problemas de fundamentación, pues no analizó de forma integral y armoniosa la versión de uno de los elementos esenciales del elenco probatorio, como fue el informe y la declaración del señor Nombre16, situación que repercutió en el dictado de la sentencia absolutoria. En consecuencia, se declara con lugar el recurso, se anula la sentencia absolutoria dictada en favor de Nombre15, Nombre04 y Nombre01, ordenándose el reenvío para la nueva sustanciación.

II. RECURSO DEL LIC

RAFAEL ÁNGEL GUILLEN MONGE . En el único motivo del recurso de apelación interpuesto por el defensor del acusado Nombre07, alega violación a las reglas de la sana crítica, pues considera que debió absolverse por certeza y no por duda. El Tribunal asume que Nombre15 partió de una premisa errónea de si era o no bosque y ante la duda debió aplicar el in dubio pro natura, pero en realidad el acusado siempre estuvo seguro de que en la finca no existía bosque, conforme lo declaró el testigo Nombre16. Para que un terreno sea bosque, el mismo debe ocupar una superficie mayor a las 2 hectáreas, lo que no se da en la especie. Los peritos "preferidos por la acusación" concluyeron que se trataba de un bosque cuyos árboles fueron arrasados, quedando únicamente 42 de ellos en pie. Sostiene que en este caso no se realizó la medida del terreno adyacente para establecer si la totalidad del terreno medía 2 o más hectáreas de bosque.

Si bien los testigos hicieron referencia que a "vista de ojo " parecía que eran más de 2 hectáreas, lo cierto es que no se hizo la medición. El perito Nombre16 estableció que el terreno mide 1526 metros, por lo que no es un bosque y su continuidad se pierde con la existencia de 2 casas de habitación. En el expediente consta la certificación del SINAC que estableció que el terreno se ubica fuera de cualquier área silvestre protegida, todo lo cual demuestra que Nombre15 no partió de alguna premisa errónea y no existió delito alguno en razón de que no había un bosque. Los delitos que se le atribuyen a su representado sólo pueden darse a título de dolo y en la especie no se acreditó el dolo. Reprocha que el Tribunal confundiera la duda factorial en cuanto a si era no bosque con la falta de elementos probatorios en cuanto al dolo. La duda solo existe en cuanto a si al momento de los hechos existía o no un bosque en el lugar, lo que surge por la existencia de diversos criterios vertidos por los expertos.

Por un lado están Nombre13, el ingeniero Nombre17, quien acompañó al encartado Nombre04, el imputado Nombre07. La primera dijo que había que hacer un mejor estudio utilizando fotografías aéreas y otros instrumentos, Nombre17 le dijo a Nombre04 que allí no había bosque y Nombre07 dictaminó que en esa finca no existía un bosque. El segundo grupo que analizó el terreno después de los hechos fueron los ingenieros Nombre22, Nombre23, Nombre24 y Nombre25 quienes juramentados dijeron que eso era un bosque. Conclusión a la que llegaron basados en las estimaciones de otros profesionales y con una medida hecha a ojo. Contrario a ello, el ingeniero forestal Nombre16, folio 687, señaló que el terreno medía 1526 metros y no estaba dentro del bosque porque perdía continuidad con la existencia de 2 casas que estaban construidas en el lugar. Solicita se absuelva por certeza a su representado y no por duda.

Por falta de interés se omite pronunciamiento. Conforme se resolvió en el considerando anterior, este Tribunal acogió el recurso de apelación interpuesto por la representación del Ministerio Público y anuló la sentencia absolutoria dictada en favor de los acusados. De manera que en un nuevo juicio debe ventilarse la responsabilidad o no de los encartados.

III. RECURSO DE APELACIÓN EN CUANTO A LO CIVIL

Reclama la violación a las reglas de la sana crítica, falta de fundamentación, inadmisibilidad de la acción civil, litis pendencia y la falta de prueba en cuanto al nexo causal. Aduce que en este caso se declaró con lugar la acción civil resarcitoria y se condenó solidariamente al pago del daño causado, el cual se fijó en más de 16 millones de colones, se les condenó al pago de costas y la restitución del inmueble al estado anterior en que se encontraba. El fallo no contiene una relación clara y precisa de los hechos que se estiman acreditados. No se dijo que existía un condominio, ni se demostró que Nombre01 fuera el representante de las 62 sociedades de responsabilidad limitada. Se valoró inadecuadamente la prueba pues se dice de la existencia de un bosque, cuando la verdad es que no se demostró el mismo. Se planteó la existencia de una litis pendencia pasiva necesaria dado que sólo se accionó contra la empresa No: 62, dejando por fuera e indefensa a las 61 restantes, quienes son dueños de un derecho indiviso.

Al existir una condena contra todos, se dejó en indefensión a los otros 61 quienes no fueron llamados a juicio. Para el apelante, la conclusión a la que llegan los juzgadores no es jurídica, lógica y factorialmente acertada, toda vez que no se está en presencia de un condominio, sino de una copropiedad múltiple de personas independientes, cada una con cédula jurídica independiente. Estima que el Tribunal se confunde con el nombre de fantasía pero no existe un condominio según la ley que lo regula. El condominio no se presume, sino que exige prueba. Solicita se declare con lugar el motivo y se declare inadmisible la acción civil resarcitoria. Respecto a la valoración probatoria argumenta que la absolutoria se da por la existencia de una duda respecto a si los encartados conocían o no si se trataba de un bosque o un terreno arbolado. Sin embargo, en lo civil consideran que existe responsabilidad subjetiva ante la existencia del nexo causal entre el hecho y el daño producido, por un actuar sin diligencia y por no aplicar el in dubio pro natura.

Insiste en que no se demostró la existencia de un bosque, que la superficie fuera mayor a 2 hectáreas, que el plano catastrado claramente indica que es terreno para construir con una medida de 10.016,77 metros cuadrados. Además, que la premisa de la fiscalía de asuntos ambientales sobre que debe tomarse la totalidad del bosque independientemente del dueño del terreno es un asunto que no encuentra asidero legal, amén de que en este caso no se hizo la medición al área contigua. Insiste el la existencia de peritos, como el ingeniero forestal Nombre16 quien estableció que es un área de potrero arbolado, sin bosque, lo que, junto a la certificación de SINAC, que estableció que el terreno estaba fuera de cualquier área silvestre protegida, certificación no cuestionada, se llega al convencimiento absoluto de que no existe delito alguno porque no era bosque y no hay elementos de prueba que así lo determinen.

Cuestiona también el informe técnico sobre la valoración del daño ambiental, pues por un lado dice que habían 435 árboles, mientras la ingeniera Nombre13 señala que eran 200. El informe reconoce que existen pocas metodologías para valorar el daño ambiental. En este caso los peritos ni siquiera conocieron el lugar con antelación por lo que las conclusiones son inconsistentes, subjetivas y hasta arbitrarias. Se hace la valoración partiendo de que se cortaron 158 árboles, mientras que en el documento se establece que encontraron 142 árboles de pie marcados con pintura roja, numerados del 1 al 42, sin rebajar el contenido económico de los mismos. Solicita se declare con lugar el recurso y se declare sin lugar la acción civil resarcitoria. Se declara sin lugar el recurso. Como se indicó en los considerandos anteriores, el Tribunal de sentencia no tuvo duda alguna en cuanto a la existencia del hecho.

En efecto, de acuerdo con la relación de hechos probados, los cuales son comunes en lo penal y en lo civil, se tuvo por demostrado que efectivamente el área talada correspondía a un bosque. La duda del Tribunal y por la cual absolvió a los encartados, la que, de acuerdo con lo resuelto en el primer considerando, no se encuentra debidamente sustentada, radicaba en que no se tenía certeza de que los imputados tuvieran conocimiento de que se trataba de un bosque, partiendo de la premisa errónea de que estaban frente a un potrero arbolado. Básicamente, el Tribunal puso en duda la existencia del dolo, concluyendo que existió un actuar negligente de los acusados que produjeron un daño ambiental. No cabe la menor duda que la acción de los encartados provocó, de forma directa, que se hiciera una tala rasa de un área de bosque. De allí que el argumento respecto a la causalidad no tiene asidero legal.

Existe una inescindible relación entre la actuación de los encartados y la corta de los árboles. En efecto, aunque ya se indicó, se reitera que la empresa representada por el encartado Nombre01 pretendía desarrollar un proyecto inmobiliario en la zona, razón por la cual contrata a una regente forestal para que ésta haga el estudio y tramite los permisos de corta de árboles. Esta ingeniera determina que por lo menos una zona era un bosque y la otra un bosque intervenido. Ante esa situación se contrata al ingeniero Nombre07, quien no tiene inconveniente en certificar que no existe bosque y que se trata de un potrero arbolado. Lo propio ocurre con el señor Nombre04, quien finalmente extiende la autorización para la corta y cambio de destino del suelo. De todo lo anterior resulta evidente la conclusión en cuanto al tema de la responsabilidad, pues los demandados civiles, concurrieron definitivamente a obtener un dictamen, contrario a la realidad de los hechos, donde se certificaba la inexistencia del bosque y con ello que se autorizara la tala.

Ambas circunstancias, indudablemente, concurrieron a la producción del daño causado, pues no se ha demostrado algún eximente de responsabilidad (culpa de la víctima, caso fortuito o fuerza mayor, o culpa de un tercero). Respecto a la existencia de una litis consorcio pasiva necesaria, se trata de un aspecto que fue correctamente resuelto por el Tribunal de instancia. En el punto sexto del considerando de fondo, propiamente en el acápite enumerado con a) se ofrecen las razones por las cuales se rechaza la excepción. Según resolvieron los juzgadores, lo que también avala esta Cámara, los demandados jurídicamente constituyen una persona jurídica con capacidad para comparecer y actuar dentro de un proceso. En estos casos la representación la ejerce un administrador con las facultades propias que establece la legislación civil. Luego, para efectos prácticos es posible que se asuma diversas formas societarias, como en este caso, Sociedades de Responsabilidad Limitada.

Como bien lo señala el Tribunal y se comprueba con las certificaciones del Registro Público, en este caso la personería jurídica se encuentra inscrita a folio Real 5-87864, derechos 001 al 062 y el representante legal es señor Nombre01 con facultades de apoderado generalísimo sin límite de suma. Es más, al confrontar las certificaciones que obran de folios 520 a 627 del legajo principal, se puede observar con toda claridad, que el señor Nombre01 es el representante legal del condominio y de las 62 filiales. Representante al cual le fue notificada la demanda civil por lo que no existe la alegada indefensión. Respecto a la cuantificación del daño, el Tribunal se basó en la pericia practicada, que, con independencia del número de árboles talados, consideró que se produjo un importante daño ambiental que resulta de muy difícil cuantificación, pero que prudencialmente se fijó en la suma de dieciséis millones doscientos treinta y cuatro mil treinta colones.

Dicho dictamen pericial, el cual rola de folios 191 a 209 del legajo principal, levantado por cuatro especialistas, a saber, los ingenieros Nombre22, Nombre23, Nombre24 y Nombre25, establecieron los objetivos planteados, la metodología, la cual incluyó la revisión de los expedientes administrativos, visita al campo, estudio de mapas de cobertura boscosa (FONAFIFO 2000), posicionamiento global, levantamiento de parcelas y evaluación del área. Una vez analizado el impacto de acuerdo con los parámetros establecidos se determinó un daño prudencial de dieciséis millones doscientos treinta y cuatro mil treinta colones. Incluso, los expertos concluyen que esa estimación "no cubre la totalidad del costo administrativo generado con este caso hasta ese momento del proceso, mucho menos el costo del proceso judicial posterior, sin embargo, se pretende expresar aquí lo que debería cubrir el encausado -de encontrarse responsable de los hechos imputados-solo por el rubro denominado "costos de gestión" para determinar la cuantía de la presente valoración" (folio 205).

En todo caso, se trataba de un bosque importante que colindaba con un humedal y una zona de protección de la tortuga baula, lo que implicaba la existencia de un corredor biológico de capital importancia para la fauna y flora. De lo anterior se colige que la determinación del daño no es arbitrario o subjetivo, sino que se encuentra razonablemente sustentado en la pericia incorporada. Por lo expuesto, sin lugar el motivo.

IV. RECURSO DE Nombre12

Como primer motivo aduce la falta de fundamentación y violación al derecho de defensa. La ampliación de la acción civil resarcitoria fue ignorada en cuanto a su existencia y omitida su resolución. Además, la sociedad Condominio Naturalia número 62 no fue vinculada al proceso y puesta en conocimiento de la acción civil resarcitoria. Alega que la representación del Estado promovió una ampliación de la acción civil resarcitoria y que la misma pasó inadvertida por el Tribunal, el cual ignoró su existencia. A folio 16 consta la resolución en la cual se dispuso poner en conocimiento de los demandados civiles la acción formulada, pero, según se colige de los folios 17 y 18, el fax de destino fue el 22 31-7442 el cual no corresponde a Nombre10 o a su defensor. Aparte de ello, para poner en conocimiento de la ampliación de la acción civil se citó a una persona totalmente desconocida como fue Nombre26.

Reitera que su representada no ha sido vinculada al proceso al no haber sido notificada, citada o puesta en conocimiento de la acción civil. Sin lugar el motivo. Como se indicó en los considerandos anteriores, la acción civil resarcitoria fue correctamente entablada. Se le notificó personalmente al representante legal. El señor Nombre10 es el representante legal de los codemandados y tuvo conocimiento y posibilidad de conocer y rebatir la demanda civil interpuesta.En cuanto a la ampliación de la acción civil, el propio recurrente reconoce que fue ignorada por el Tribunal de forma que no le puede causar agravio al apelante. En consecuencia, sin lugar el motivo. Como segundo motivo alega que al Tribunal penal le está vedado ordenar la nulidad de actos y permisos administrativos como consecuencia de la restitución del bien a su estado anterior al momento del hechos. Además, existe una acción de inconstitucionalidad que cuestiona el criterio jurisprudencial sobre la aplicación del artículo 492 del Código Procesal Penal.

En ese caso, al resolver el fondo del asunto, el Tribunal dispuso la anulación de los permisos, lo que no encuentra amparo legal y constituye una invasión de las competencias y atribuciones propias de la materia contencioso administrativas. Además de lo anterior, si bien ha existido un criterio jurisprudencial en el cual los tribunales han aplicado el artículo 492 anulando y suprimiendo inscripciones y permisos, ello se encuentra cuestionado ante la Sala Constitucional, que le dio curso a la acción correspondiente, por lo que no se podía resolver el fondo del asunto hasta tanto exista una resolución sobre el punto. Solicita se declare con lugar el recurso y se declare sin lugar la acción civil interpuesta. Sin lugar el motivo. Ciertamente, el artículo 492 del Código Procesal Penal y la jurisprudencia que de él derivó la Sala Tercera de la Corte Suprema de Justicia fue cuestionada ante la Sala Constitucional de nuestro país.

Sin embargo, dicho tribunal, mediante voto 2013-1205, a las 14:45 horas, del 11 de setiembre del año en curso, rechazó de plano la acción interpuesta. De manera que no existe impedimento legal para que los tribunales de justicia apliquen la norma citada. De acuerdo con el artículo invocado, "Cuando una sentencia declare falso un instrumento público, el tribunal que la dictó ordenará que el acto sea reconstruido, suprimido o reformado. Si es del caso ordenará las rectificaciones registrales que correspondan. Si el documento ha sido extraído de un archivo, será restituido a él, con nota marginal en cada página, y se agregará copia de la sentencia que hubiera establecido la falsedad total o parcial. Si se trata de un documento protocolizado, la declaración hecha en la sentencia se anotará al margen de la matriz, en los testimonios que se hayan presentado y en el registro respectivo". En el presente asunto se estableció con certeza absoluta que la información brindada por el ingeniero Nombre07, donde indicaba que el terreno no correspondía a un bosque, sino a un potrero arbolado, era falsa.

Lo propio ocurrió con el informe que emitió el coencartado Nombre04. Esa información falsa permitió que se concedieran una serie de permisos que llevaron a la tala de árboles. De manera, que la consecuencia jurídica es la anulación de esos permisos que se sustentaron en premisas falsas. Es claro que no existe un problema de competencia por el cuanto el legislador, en la citada norma, autorizó al Tribunal, para que, una vez comprobada la falsedad, se proceda a la anulación, supresión, modificación o reconstrucción del acto. Precisamente eso fue lo que ocurrió en este caso, donde se anulan los permisos basados en hechos falsos. Por lo expuesto, sin lugar el motivo.

V. RECURSO DEL LICENCIADO MARIO RIVERA GARBANZO

El licenciado Mario Rivera Garbanzo, defensor particular de Nombre01 presenta recurso de apelación de sentencia. En el primer motivo reclama la indebida interpretación de la ley penal. Aduce que el concepto de bosque en la ley forestal y su respectivo reglamento no encuadra en los hechos del caso pues el terreno Dirección01 no cumple con la extensión requerida. De acuerdo con la jurisprudencia del entonces Tribunal de Casación Penal que cita, la protección del medio ambiente no debe llevar a una inflación de las conductas delictivas que atenten contra el principio de derecho penal mínimo. Legalmente no resulta punible la corta de árboles que no constituyan bosque, la interpretación de la ley debe respetar el principio de legalidad. La prueba aportada al proceso estableció que el inmueble no alcanza las 2 hectáreas de superficie conforme lo exige el inciso d) del artículo 3 de la Ley Forestal, por lo que no existe responsabilidad civil.

Argumenta que aún asumiendo la posición del Ministerio Público sostenida en la Propuesta de Política de Persecución de los Delitos Ambientales, en el sentido de que el terreno de bosque se debe considerar en masa y no por propiedad, lo cierto es que no se evacuó prueba que determinara el área de bosque existente, por lo que al no existir el nexo causal no resulta procedente la condena en lo civil. Solicita se declare con lugar el recurso y se declara sin lugar la acción civil resarcitoria. Sin lugar los motivos. Lo aspectos reclamados por el impugnante ya fueron planteados y resueltos en los considerandos anteriores.

VI. RECURSO DEL LIC

RAFAEL ÁNGEL GUILLEN MONGE . En el único motivo del recurso de apelación interpuesto por el defensor de Nombre04, alega la violación a las reglas de la sana crítica, pues considera que debió absolverse por certeza y no por duda. El Tribunal asume que Nombre04 partió de una premisa errónea de si era o no bosque y ante la duda debió aplicar el in dubio pro natura, pero en realidad el acusado siempre estuvo seguro de que en la finca no existía bosque, conforme lo declaró el testigo Nombre16. Para que un terreno sea bosque, el mismo debe ocupar una superficie mayor a las 2 hectáreas, lo que no se da en la especie. Los peritos "preferidos por la acusación" concluyeron que se trataba de un bosque cuyos árboles fueron arrasados, quedando únicamente 42 de ellos en pie. Sostiene que en este caso no se realizó la medida del terreno adyacente para establecer si la totalidad del terreno medía 2 o más hectáreas de bosque.

Si bien los testigos hicieron referencia que a vista de ojo parecía que eran más de 2 hectáreas, lo cierto es que no se hizo la medición. El perito Nombre16 estableció que el terreno mide 1526 metros por lo que no es un bosque y su continuidad se pierde con la existencia de 2 casas de habitación. En el expediente consta la certificación del SINAC que estableció que el terreno se ubica fuera de cualquier área silvestre protegida, todo lo cual demuestra que Nombre04 no partió de alguna premisa errónea y no existió delito alguno en razón de que no había un bosque. Los delitos que se le atribuyen a su representado sólo pueden darse a título de dolo y en la especie no se acreditó el dolo. Reprocha que el Tribunal confundiera la duda factorial en cuanto a si era no bosque con la falta de elementos probatorios en cuanto al dolo. La duda solo existe en cuanto a si al momento de los hechos, existía o no un bosque en el lugar, lo que surge por la existencia de diversos criterios vertidos por los expertos.

Por un lado están Nombre13, el ingeniero Nombre17, quien acompañó al encartado Nombre04, el imputado Nombre07. La primera dijo que había que hacer un mejor estudio utilizando fotografías aéreas y otros instrumentos, Nombre17 le dijo a Nombre04 que allí no había bosque y Nombre07 dictaminó que en esa finca no existía un bosque. El segundo grupo que analizó el terreno después de los hechos fueron los ingenieros Nombre22, Nombre23, Nombre24 y Nombre25 quienes juramentados dijeron que eso era un bosque, conclusión a la que llegaron basados en las estimaciones de otros profesionales y con una medida hecha a ojo. Contrario a ello, el ingeniero forestal Nombre16, folio 687, señaló que el terreno medía 1526 metros y no estaba dentro del bosque porque perdía continuidad con la existencia de 2 casas que estaban construida en el lugar. Solicita se absuelva por certeza a su representado y no por duda.

Por falta de interés se omite pronunciamiento. Conforme se resolvió en el considerando primero, este Tribunal acogió el recurso de apelación interpuesto por la representación del Ministerio Público y se anuló la sentencia absolutoria dictada en favor de los acusados. De manera que en un nuevo juicio debe ventilarse la responsabilidad penal o no de los encartados.

VII. RECURSO DE APELACIÓN EN CUANTO A LO CIVIL

Reclama la violación a las reglas de la sana crítica, falta de fundamentación, inadmisibilidad de la acción civil, litis pendencia y la falta de prueba en cuanto al nexo causal. Aduce que en este caso se declaró con lugar la acción civil resarcitoria y se condenó solidariamente al pago del daño causado, el cual se fijó en más de 16 millones de colones, se les condenó al pago de costas y la restitución del inmueble al estado anterior en que se encontraba. El fallo no contiene una relación clara y precisa de los hechos que se estiman acreditados. No se dijo que existía un condominio, ni se demostró que Nombre01 fuera el representante de las 62 sociedades de responsabilidad limitada. Se valoró inadecuadamente la prueba pues se dice de la existencia de un bosque, cuando la verdad es que no se demostró el mismo. Se planteó la existencia de una litis pendencia pasiva necesaria puesto que sólo se accionó contra la empresa No: 62, dejando por fuera e indefensa a las 61 restantes, dado que se demostró que son dueños de un derecho indiviso.

Al existir una condena contra los 62 se dejó en indefensión a 61, quienes no fueron llamados a juicio. Para el apelante, la conclusión a la que llegan los juzgadores no es jurídica, lógica y factorialmente acertada, toda vez que no se está en presencia de un condominio sino de una copropiedad múltiple de personas independientes, cada una con cédula jurídica independiente. Estima que el Tribunal confunde el nombre de fantasía pero no existe un condominio según la ley que lo regula. El condominio no se presume, sino que exige prueba. Solicita se declare con lugar el motivo y se declare inadmisible la acción civil resarcitoria. Respecto a la valoración probatoria argumenta que la absolutoria se da por la existencia de una duda respecto a si los encartados tenían duda con relación a si se trataba o no de un bosque o un terreno arbolado. Sin embargo, en lo civil consideran que existe responsabilidad subjetiva ante la existencia del nexo causal entre el hecho y el daño producido, por un actuar sin diligencia y por no aplicar el in dubio pro natura.

Insiste en que no se demostró la existencia de un bosque, que la superficie fuera mayor a 2 hectáreas, que el plano catastrado claramente indica que es terreno para construir con una medida de 10.016,77 metros cuadrados. Además, que la premisa de la fiscalía de asuntos ambientales sobre que debe tomarse la totalidad del bosque independientemente del dueño del terreno es un asunto que no encuentra asidero legal, amén de que en este caso no se hizo la medición al área contigua. Insiste en la existencia de peritos como el ingeniero forestal Nombre16 quien estableció que es un área de potrero arbolado, sin bosque, lo que, junto a la certificación de SINAC, que estableció que el terreno estaba fuera de cualquier área silvestre protegida, certificación no cuestionada, se llega al convencimiento absoluto de que no existe alguno porque no era bosque y no hay elementos de prueba que así lo determinen.

Cuestiona también el informe técnico sobre la valoración del daño ambiental, pues por un lado, dice que habían 435 árboles, mientras la ingeniera Nombre13 señala que eran 200. El informe reconoce que existen pocas metodologías para valorar el daño ambiental. En este caso, los peritos ni siquiera conocieron el lugar con antelación por lo que las conclusiones son inconsistentes, subjetivas y hasta arbitrarias. Se hace la valoración partiendo de que se cortaron 158 árboles, mientras que en el documento se establece que encontraron 142 árboles de pie marcados con pintura roja, numerados del 1 al 42, sin rebajar el contenido económico de los mismos. Solicita se declare con lugar el recurso y se declare sin lugar la acción civil resarcitoria. Sin lugar los motivos. Lo planteado ya fue resuelto en los considerandos anteriores, por lo que, con el fin de evitar repeticiones innecesarias, se remite a lo allí resuelto.

POR TANTO:

Se declara con lugar el recurso de apelación interpuesto por la representante del Ministerio Público. Se anula la sentencia absolutoria dictada en favor de Nombre07, Nombre04 y Nombre01, ordenándose el reenvío para la nueva sustanciación. Por falta de interés se omite pronunciamiento sobre el recurso de casación, sobre los aspectos penales, planteados por los defensores Guillén Elizondo, Guillén Monge y Rivera Garbanzo en favor de sus representados. Se declaran sin lugar los recursos de apelación, en cuanto a los extremos civiles, planteados por los representantes legales.
