ANNEX A.- At thirteen hours and thirty minutes on catorce de setiembre de dos mil doce.- Ordinary proceedings brought by Nombre81703, identity card number CED112216, on behalf of INSTITUTO DE DESARROLLO AGRARIO (IDA, now Instituto de Desarrollo Rural, Inder, but referred to throughout this judgment as IDA), against COOPERATIVA DE SERVICIOS MÚLTIPLES COOPERATIVOS COTO 63 R.L. (SERMUCOOP R.L.), legal entity identification number CED112217, represented by its General Manager, Nombre142863, who is of legal age, holds identity card number CED112218, and has authority to act as its legal representative in judicial and extrajudicial matters. Also participating are attorney Wilfred Solís M., whose personal particulars are unknown, as counsel of record (abogado director) for the defendant cooperative, and attorney Alex Benjamín Gen Palma, Costa Rican Bar Association membership number 6484, as IDA’s general judicial attorney-in-fact (apoderado general judicial).
BACKGROUND (RESULTANDO):

REASONS (CONSIDERANDO)
Before proceeding to analyze the substantive elements of this matter, this Court considers it essential to address three issues arising during the proceedings: the summary dismissal of the counterclaim (contrademanda), the dismissal without a hearing of the objection based on the improper joinder of parties (excepción de indebida integración de la litis), and the failure to rule on the interim relief (medida cautelar) requested by the plaintiff, which was provisionally granted in part. Regarding the dismissal of the counterclaim, notwithstanding the ruling issued by the Proceedings Judge in the order entered at 10:39 hours on 17 de enero de 2012—a decision with which this Court disagrees because it reveals an error in the interpretation of the rule contained in artículo 173 párrafo sétimo de la Ley General de la Administración Pública (hereinafter LGAP)—the fact remains that the defendant did not file any motion seeking review of that decision, which was duly served through the designated means for receiving notices (see folio 211 del espediente judicial), by means of an appeal in cassation (recurso de casación) (numeral 62 en relación con el 134 del Código Procesal Contencioso Administrativo, hereinafter CPCA).
In this regard, because important procedural remedies were available to the defendant to correct the judicial decision and it failed to exercise them in a timely and proper manner, this Court cannot override the party’s decision, demonstrated through its procedural inaction, to accept those rulings. In any event, this Chamber considers that the summary dismissal does not impair the party’s right, in light of the ruling issued in this judgment, to seek again in these proceedings the compensation that formed the basis of the counterclaim, on such terms as it deems appropriate; therefore, no state of defenselessness arises that would require the annulment of the judicial proceedings. With respect to the dismissal of the objection based on the improper joinder of parties, issued in the same decision identified above, it meets the same fate as the summary dismissal of the counterclaim: although this Court considers that it is inconsistent with the rules of artículo 71 CPCA, the fact remains that the party did not exercise the appellate rights provided for in that same article (appeal (recurso de apelación)); therefore, as already stated, its inaction cannot be remedied by the Court.
In any event, this Chamber considers that the participation of the notary who authenticated the deed is not required, because no conduct or liability is alleged against that notary, and the claim seeking annulment of the deed by which ownership was transferred to the defendant does not directly affect the notary. Lastly, regarding the interim relief requested by the plaintiff, the Court shall rule on that application based on the following reasoning. In its complaint, the plaintiff requests two interim measures: 1. Entry of a notice of the complaint (anotación de la demanda) against the property registered in the Province of Puntarenas under folio number Placa28104, owned by IDA; and 2. An order requiring Sermucoop R.L. to refrain from any conduct, whether by act or omission, that could harm the ecosystem existing on the property in question. As already noted, the first request was provisionally granted by the Proceedings Judge in the order entered at 13:30 hours on 28 de julio de 2011.
In that same ruling, the defendant was granted a hearing to respond regarding the interim measures. However, the defendant did not respond within the allotted period and did not address this issue when answering the complaint. The record does not show that the Proceedings Judge ruled on this application in accordance with artículo 25 CPCA; therefore, this Court shall rule on the requested interim relief and determine whether to deny, maintain, or modify what was provisionally ordered. As developed by the Sala Constitucional, interim judicial protection (justicia cautelar) responds to the need to guarantee the constitutional principle of prompt and effective justice by preserving the factual conditions essential for the issuance and enforcement of the judgment (Resolución 7190-1994, de las 15:24 horas del 6 de diciembre). In the same vein, artículo 19 del CPCA establishes that the purpose of ordering interim relief is to protect and provisionally safeguard the subject matter of the proceedings and the effectiveness of the judgment.
Accordingly, interim judicial protection is not intended to declare a fact or liability, create a legal relationship, enforce an order and satisfy an undisputed right, or adjudicate a dispute, but rather to prevent harm that the litigation may cause or that may arise from an abnormal situation. Pursuant to artículo 21 CPCA, when determining whether a request for interim relief is warranted, the judge or Court must verify that the claim in the proceedings on the merits is not frivolous or manifestly lacking in seriousness. This constitutes a preliminary assessment of the merits to determine whether the case presents what legal scholarship and case law have called a likelihood of success on the merits (apariencia de buen derecho or fumus boni iuris). Moreover, numeral 21 of the Code provides that interim relief is warranted when the implementation or continuation of the conduct under review causes serious actual or potential harm or loss, a circumstance defined in legal scholarship as periculum in mora, or danger in delay (peligro en la demora); that is, where the pathological delay of judicial proceedings gives rise to a present, real, and objective risk of serious harm to the moving party.
Lastly, artículo 22 CPCA establishes the adjudicator’s obligation, in light of the principle of proportionality, to balance the interests at stake; that is, the individual’s circumstances, on the one hand, against the public interest and the interests of third parties that may be affected by the adoption of the interim relief, on the other. Only when all three elements are present—that is, likelihood of success on the merits, danger in delay, and a determination, based on the balancing of interests, that the harm suffered by the individual must be protected over the other interests at stake—may the Court grant the requested interim relief. Having reviewed the record in light of the evidence and arguments presented by both parties, the Court finds that the elements required to grant the requested interim relief are indeed present, for the reasons set forth below. As to the likelihood of success on the merits, the Court considers that this is not a measure that might result in a frivolous complaint or one manifestly lacking in seriousness because, according to the party’s allegations, it concerns a legally cognizable matter properly subject to adjudication in these proceedings: specifically, the annulment of an administrative act (acto administrativo) declared injurious to the public interest (lesivo) by the Public Administration itself.
Having established the first element, and turning to danger in delay, this Court considers that there are grounds for finding that, if the provisionally granted measure is not maintained and the other requested safeguard is not ordered, the subject matter of the proceedings could be affected in a manner that would render the final disposition of this judgment futile. Although the Court has consistently held that the plaintiff bears the burden of presenting evidence establishing danger in delay, there are cases, such as this one, in which the harm is so evident that no further evidence is required for the Court to be satisfied that, unless measures are adopted—such as entering notice of the complaint against the property’s registry entry and prohibiting the current titleholder from engaging in any conduct, whether by act or omission, that affects the property’s current condition—the subject matter of the proceedings could be seriously harmed.
Regarding entry of notice of the complaint, it should be borne in mind that this measure seeks to notify third parties that a particular asset is the subject of judicial proceedings. Generally speaking, a plaintiff does not request entry of notice against property that it itself owns; however, because the transfer of property 95299-000 to the defendant cooperative was never registered in this matter, it is logical that the requested relief would be the entry of notice against IDA’s own property, to inform third parties and the Registry itself that ownership of that property is in dispute. If that circumstance were not disclosed, registry transactions could occur that might in some way restrict or preclude a ruling favorable to IDA’s claims, which, in the Court’s view, would constitute serious harm to the interests represented by the institution. As to the second interim measure, the Court considers that, although there may be no imminent threat that the Cooperative will alter the property, there is nevertheless a potential risk that changes to the property could occur, whether by act or omission.
Therefore, to avoid harm to the property that is the subject matter of the proceedings that could be irreversible, it is prudent to find that danger in delay has also been established on this point. It should be taken into account that, according to the reports contained in the administrative record (folios 163 y 164 del expediente judicial), this property has forest cover (cobertura forestal) and serves as a water-catchment area supplying the neighboring community; therefore, it is not unreasonable to find danger in delay based on the existence of a risk that current conditions may be altered. Regarding the balancing of the interests at stake, this Court considers that priority must be given in this matter to the public interests identified by the plaintiff institution, which seeks to recover an asset that it alleges belongs to the State’s natural heritage (patrimonio natural del Estado) (hereinafter PNE), and to preserve it in its current condition, both physically and in the registry, over the interests of a cooperative that, although it alleges that it has not harmed the property but instead has managed it responsibly to protect the environment, cannot be entrusted with the public purposes established in Ley 7575.
Accordingly, because the three requirements for granting interim relief have been established, the requested interim relief must be granted in both respects, thereby confirming entry of notice of the complaint against the property registered in the Province of Puntarenas under folio Placa28104 and ordering Sermucoop R.L. to refrain from any conduct, whether by act or omission, that could harm the ecosystem existing on the property in question. These measures shall remain in effect until this judgment becomes final.
The following facts of this nature and of importance to the resolution of this matter have been established during the proceedings: 1. By agreement number XIV of session number 037-98, dated 6 de mayo de 1998, the IDA Board of Directors unanimously resolved: “In accordance with official letter DRB-573-98 dated 30 de abril de 1998, signed by the Brunca Regional Directorate, and pursuant to Article 67 of Ley No. 7097, (...) to segregate, award, and transfer as follows: (...) 2. Dirección17326 (150 Has) to Cooperativa de Servicios Múltiples de Coto 63 (Sermucoop R.L.), legal entity identification number CED112217, represented by its Manager (...). To award said non-subdividable area, which is located in Dirección16305” (folios 147 to 151, 161, and 165 of the judicial record). 2. By deed number 16 in the notarial protocol of notary Julio Sánchez Carvajal, executed at 11:45 on 19 de mayo de 1998, the general attorneys-in-fact (apoderados generalísimos) of IDA and Sermucoop R.L. appeared for the purpose of formalizing, among other acts, the transfer of the property, which was described as follows: “a parcel of land located in Dirección17327, , in the seventh canton, Golfito, Province of Puntarenas, consisting of pastureland and secondary scrub growth (tacotales), with an approximate area of one hundred fifty hectares.
This land is part of the property in the Puntarenas registry district, recorded under real-property folio registration Placa28103 - in the Puntarenas registry district (sic).” The terms of the transaction were as follows: “The sale price of each of the parcels mentioned herein is the sum of one colón and is made pursuan (sic) to Article sixty-seven of Ley seven thousand ninety-seven (...) The second appearing party is advised that registration of this document requires submission of the corresponding cadastral plans for the areas that actually correspond to the transfer made herein, which he accepts and undertakes to submit in due course; therefore, he releases the undersigned notary and the Institute from all liability both for the failure to register the document and for the correct area being transferred to him, which shall be certified once the respective plan is submitted to the notary and the Institute.
The parcels transferred herein shall remain subject to the limitations, prohibitions, and restrictions of Ley two thousand eight hundred twenty-five (...) The purpose for which the parcels identified herein are transferred is their protection and conservation, as established by the Board of Directors in the agreement cited above” (folios 57 and 58 of the judicial record). 3. On 12 de junio de 2002, plan P-796176-2002 was entered in the cadastre; it corresponds to an area of 68 hectares, three thousand two hundred seventy-five square meters and eighty square decimeters, was prepared by surveyor José Luis Jiménez Alfaro, and indicates that the property described belongs to IDA for transfer to Sermucoop R.L. (folios 166 and 167 of the judicial record). 4. In agreement number 29 of session 009-06, dated 6 de marzo de 2006, as amended by agreement number 12 of session 003-07, dated 22 de enero de 2007, the IDA Board of Directors resolved, in its second provision, to authorize Lic. Nombre81703, in coordination with the Legal Affairs Directorate, to serve as the directing body (órgano director) of the administrative proceeding (procedimiento administrativo) for the purpose of commencing absolute-nullity proceedings intended to restore to the institution’s assets, among other properties, the unnumbered property awarded to Sermucoop R.L. in Ganadera Guaycará, Golfito, with an area of 150 hectares (folios 78 and 79 and 155 and 156 of the judicial record). 5.
In official letter number AJRB-B-039-2006, dated 20 de marzo de 2006, the directing body requested that the head of Minaet’s Coto Subregion provide a technical report “determining whether the cover of the properties listed in the following table qualifies as forest (Bosque), what its characteristics are, and whether the properties may be considered State Natural Heritage (Patrimonio Natural del Estado), as well as (sic), based on their condition, in which sectors it may be determined whether they had the same classification in 1998.” The properties for which information was requested included the Guaycará settlement property awarded to Nombre142864. (folios 169 and 170 of the judicial record). 6. In response to the preceding official letter, the Coto Subregional Head of Minaet, by official letter ACOSA-SRC-303 dated 7 de agosto de 2006, replied to IDA by forwarding a report on the inspection conducted on 11 de junio de 2006 concerning the property awarded to Sermucoop R.L., which concluded: “1-) During the inspection, it was determined that the property consists of forests in different stages of succession. 2-) Most of the land has steep slopes, from 47% to 76%, except for a very narrow strip approximately (sic) 30 meters wide, which is the crest of the ridge crossing the property in a Southwest/Northeast direction. 3-) According to reports from neighboring residents, a water pipeline supplying the IDA settlement of La Esperanza draws water from this property. 4-) According to the classification provided by the 2000 Land-Use Map, prepared by Fonafifo, and based on the GPS points taken in the field, the property is classified as forest, meaning that in 1998 those lands were forests. 6-) (sic) During the inspection, no recently worked or logged areas were found; according to the neighboring residents themselves, this property has remained unworked for several years (more than fifteen), which explains the composition and development of the forests sampled” (folios 162 to 164 of the judicial record). 7.
During the oral, private hearing in the administrative proceeding, held on 28 de mayo de 2007, testimony was received from Mr. Nombre17601, who was the Manager of Sermucoop R.L. at the time of the award. The record of his testimony states that Mr. Nombre17601 declared the following regarding the nature of the property received: “the Cooperative submitted the request for that land to the IDA Board of Directors following an offer by the Institution, specifically by members of the Board of Directors who informed us about those areas and stated that it would be important for the Cooperative to become involved in forestry (...) and what [the Cooperative] has done is safeguard it because the land is unsuitable for agriculture; indeed, most of the area is forested (...) To safeguard that land, what the Cooperative has done is patrol the property, clear boundary paths, and make occasional visits to the property, because it is a forest area” (folios 63 and 64 of the judicial record). 8.
In agreement number 72 of ordinary session 025-2010, dated 16 de agosto de 2010, the IDA Board of Directors, based on the report submitted by the directing body, decided that there were insufficient grounds to declare the evident and manifest nullity (nulidad evidente y manifiesta) of the award of the Guaycará property to Sermucoop R.L., but that there were sufficient grounds to declare “the prejudicial effect on the public interest (lesividad) of the agreement adopted by the Board of Directors in Article XIV, Session 037-98, dated 6 de mayo de 1998, which approved the award, segregation, and transfer to Cooperativa de Servicios Múltiples Cooperativos Coto 63 R.L. (SERMUCOOP R.L.) (...), of non-subdividable land forming part of Finca Ganadera Guaycará, with an area of one hundred fifty hectares” (folios 16 to 26 and 28 to 56 of the judicial record).
There are no unproven facts relevant to the resolution of these proceedings.
In accordance with its complaint, and given that no significant clarifications or modifications were made to the relief sought at the preliminary hearing, IDA seeks a declaration of nullity (nulidad), first, of the agreement adopted by the IDA Board of Directors in Article XIV of session 037-98 dated 6 de mayo de 1998, insofar as it concerns the award and transfer of Finca Ganadera Guaycará to Sermucoop R.L.; and second, of public deed number 16, volume 38, executed before notary Julio Sánchez Carvajal and authorized at 11:45 on 19 de mayo de 1998, which formalized and entered into the notarial protocol the transfer of Finca Ganadera Guaycará. IDA further seeks an order directing Archivo Nacional to enter a notation in the original protocol of the aforementioned notary recording the nullity of this deed insofar as it concerns the transfer of Finca Ganadera Guaycará. The plaintiff argues that the act awarding this property is absolutely null because the transferred asset constitutes PNE, and therefore IDA had no authority to dispose of it.
In support of the public-domain status (demanialidad) of this asset, IDA states that the report requested from Minaet (folios 162 to 164 of the judicial record) is conclusive in indicating that, at the time of the transfer, the property was forest, since Fonafifo had classified it as such. This public-domain status, together with the failure to request Minaet’s opinion before disposing of the property (Article 15 of Ley 7575), leads IDA to conclude that the transfer is absolutely null. Lastly, it states that the property’s very status as a public-domain asset renders the State’s action to recover this type of property not subject to limitation (imprescriptibilidad). The defendant Cooperative, for its part, alleges that the transfer was intended to protect and conserve the property and that the Cooperative fully accomplished those purposes. The defendant rejects the conclusions of Minaet’s technical report insofar as they state that the land could be regarded as forest in 1998, and alleges that, pursuant to Article 194 LGAP (sic), the four-year period for asserting the nullity of the property transfer has already elapsed. It therefore raised the statute-of-limitations defense (excepción de prescripción), which was reserved for determination on the merits because it was not evident and manifest.
Before addressing the merits of this matter, it is important to review compliance with the various requirements imposed by the legal system for bringing adverse-to-public-interest proceedings, since the absence of any one of these elements would preclude and render unnecessary an examination of the merits. Regarding this issue, judgment number 014-2012-VI, issued at 16:20 on 30 de enero, established the general parameters, which may be summarized as follows. The analysis of these requirements is a matter to be undertaken sua sponte (de oficio) by the adjudicator, because they are essential elements of the action. In general, adverse effect on the public interest (lesividad) constitutes a judicial mechanism through which the Administration seeks to set aside an act of its own that, in principle, produces a favorable effect for a third-party recipient. From this perspective, in disputes of this kind, the adverse effect is subjective in nature, insofar as it seeks the annulment of administrative conduct that grants a right or, more generally, a beneficial legal position to a person.
This mechanism is currently codified in Article 34 CPCA, which establishes its preliminary elements and procedural rules. It is also referenced in Article 173 subsection 6), in conjunction with Article 183 LGAP. From the standpoint of procedural prerequisites (presupuestos procesales), subjective, objective, procedural, and temporal conditions are imposed. Regarding the subjective aspect, standing to bring the action (legitimación activa) is granted to the Administration that issued the challenged act, while the party with standing to be sued (legitimado pasivo) is the recipient of the effects of that conduct, namely, the person who obtains its benefits. As to the objective aspect, adverse-to-public-interest proceedings constitute a mechanism for the legal elimination of administrative acts that are substantially inconsistent with the legal system, namely, acts affected by some degree of invalidity (invalidez), whether absolute or relative, in any of its forms (Articles 128, 158, 165 and related provisions of the LGAP).
Accordingly, the Administration must declare that conduct adverse to the public interest, which must be established through internal administrative actions that are indispensable for bringing the action. Indeed, procedurally, the highest-ranking authority of the respective Public Administration must declare the act adverse to the public interest, whether because it harms economic, fiscal, or other interests arising from the public interest; for this purpose, that authority must have an underlying legal and technical opinion supporting the determination. Unlike other mechanisms for setting aside public administrative conduct, this process does not require a hearing for the third party, but only internal actions within the Administration, since it is in the judicial proceedings that the third party may present its defenses. Regarding the temporal dimension, the new procedural legislation establishes a period of one year from the issuance of the act—not from its notification—to declare the act adverse to the public interest.
Following that declaration—and not from the expiration of that first year—a period of one year is granted to file the administrative-law action (acción contenciosa administrativa), as a mandatory limitation period (plazo fatal de caducidad), except in cases involving acts that are absolutely null and void (nulidad absoluta), in which case the declaration of adverse effect may be made for as long as their effects persist (Articles 34 and 39 of the CPCA). The exception applies to the protection of the public domain (dominio público), in which case the adverse-to-public-interest action is not subject to a time limit because of the general rule that such property is not subject to prescription (imprescriptibilidad), as follows from Article 261 of the Civil Code. In this case, an examination of the record leads to the conclusion that, in principle, the internal declaration of adverse effect satisfies the requirements identified above.
As established, the act whose annulment is sought is the resolution adopted under Article XIV of session 037-98 of 6 de mayo de 1998, insofar as it concerns the award and transfer of the Ganadera Guaycará property to Sermucoop R.L. That administrative conduct was declared adverse to the public interest by the Board of Directors of the IDA, acting as that public entity’s highest authority, through resolution number 72 of ordinary session 025-2010, of 16 de agosto de 2010. Likewise, the claim was brought by the aforementioned institute, as the issuer of the challenged act, against the person in whose favor the beneficial effects of the act arose. Therefore, the aforementioned requirements concerning both active and passive standing are satisfied. Nor is there any deficiency in the procedural element, because an internal declaration of adverse effect was issued by the administrative authority, as explained above.
The fact that proceedings were instead initiated to determine whether there was an absolute, evident, and manifest nullity (nulidad absoluta, evidente y manifiesta), and that the ultimate conclusion of those proceedings was that the circumstances of the case did not support such a finding, although they did support a declaration of adverse effect, does not constitute any defect. Rather, the party was afforded more means of defense before the Administration itself than either the legal system or the case law on this issue requires. With regard to the temporal aspect, however, it should be noted that the resolution whose annulment is sought was issued in 1998 and declared adverse to the public interest in 2010, that is, after the CPCA entered into force. Accordingly, the time limits set forth in Articles 34 and 39 CPCA apply, including the express rule in the second paragraph of Article 34 thereof, which states: “An adverse-to-public-interest action concerning the protection of public-domain property shall not be subject to a time limit.” The claimant contends that the action was brought in a timely manner because it concerns the recovery of public-domain property, a matter in which limitation periods do not run; the defendant, by contrast, asserts that the property at issue does not belong to the public domain (demanio público) and that the action brought is “time-barred by prescription (prescrita).” In this regard, the Court considers it essential to determine whether the property is public-domain property and then to examine the temporal aspects of the adverse-to-public-interest proceedings and rule on the incorrectly designated defense of prescription (excepción de prescripción), which, as will be seen below, is actually one of expiration (caducidad), and, depending on the outcome of that issue, to grant or deny the requested declaration of nullity.
As previously stated in the aforementioned judgment of this Section (number 014-2012-VI, at 16:20 hours on 30 de enero), this Court’s analysis must begin with the premise that not all State-owned property is in the public domain; rather, public entities also hold proprietary property or private-domain property (bienes patrimoniales o de dominio privado). This distinction is grounded in the Civil Code (Código Civil; hereinafter, CC), Article 261 of which provides that: “Public things are those that, by law, are permanently allocated to any service of general utility, and those that everyone may use because they have been made available for public use. All other things are private and subject to private ownership, even if they belong to the State or to Municipalities, which, for this purpose and as civil persons, are no different from any other person.” Indeed, the relationships arising between the State and private individuals with respect to property falling within the public domain and the private domain differ substantially: while the former must be governed by the public-law regime (régimen de Derecho Público) and therefore entail the application of rules of subordination, the latter are characterized by the application of private law (Derecho Privado) and operate within the elements of coordination inherent in that regime.
It is therefore essential to determine the nature of the property at issue in each case, since the applicable legal regime will depend on it. For the present, the Court is concerned with public-domain property. As stated, by its nature this type of property is subject to a special public-law regime. It forms part of the public estate (demanio público), understood as “(…) the body of property subject to a special legal regime that differs from the regime governing the private domain and that, in addition to belonging to or being administered by public legal entities, is allocated or designated for purposes of public utility, as manifested in the direct or indirect use that any person may make of it. (…)” (Judgment No. 3145, issued by the Constitutional Chamber at 9 hours 27 minutes on 28 de junio de 1996). Indeed, the public domain comprises property that, by the legislature’s express intent, has the special purpose of serving the community and the public interest.
These are things that do not belong individually to private persons, that are intended for public use, and that are subject to a special regime outside private commerce. Thus, they are property belonging to the State in the broadest sense of the term, allocated to the service they provide, which is invariably essential by virtue of an express legal provision. Public-estate property (bienes demaniales), however, must possess certain essential elements in order to qualify as such. The first is the subjective element, concerning the person or titleholder of the property. In this respect, title to the property must be held by a public entity and not by a private individual. Alongside this consideration is a second important aspect: the principle that, by its nature, public-domain property cannot and must not belong to private individuals at any time. The reason why public-estate property cannot be owned by a private person lies in the fact that its purpose is to satisfy the general interest and that it serves the community; this necessarily falls within a public function that, given its scope, can hardly be conceived as the function of a person governed by private law.
A second element is the objective element, which concerns all property capable of being included within the public domain. In this regard, it may be stated that the range of property capable of forming part of the public estate is very broad. It includes immovable and movable property, corporeal and incorporeal things, fungible and non-fungible things, consumable and non-consumable things, divisible and indivisible things, simple and composite things, principal and accessory things, and universality of rights, among others. The third element is the normative element, under which the public-estate status of property depends on the existence of a legal provision declaring it as such. A statutory allocation (afectación normativa) is therefore required, by virtue of which the property becomes part of the public estate. In our legal system, Articles 261 and 262 CC establish the need for such allocation when they state with complete clarity that those things designated as such by law shall be public things dedicated to public use.
Consequently, it may be stated that the legislature decides which property forms part of the public domain and which forms part of the private domain. The public domain is therefore a legal concept, meaning that its existence depends on the express treatment accorded to it by the legislature; without a law serving as its basis, no property or thing will possess that status. Lastly, there is the teleological or purposive element, under which public-estate property must also be dedicated to public use in order to qualify as such. That is, its purpose must be the general interest, namely, that of the community. Our Civil Code also expressly enshrines this element. Thus, Article 261 provides that public things are those that, by law, are permanently allocated to any service of general utility, and those that everyone may use because they have been made available for public use. That same provision also distinguishes property that, despite belonging to a public entity, lacks this vocation for public use or utility, classifying it as private.
In conclusion, for property to be considered part of the public domain, all four of the aforementioned elements must be present simultaneously. The presence of only some of them is insufficient, because unless all are present, the property is excluded from classification as public-estate property. In this regard, legal scholar Miguel Marienhoff has stated, insofar as relevant, that “(…) In determining the legal status of property, it is not sufficient, for example, to consider only its teleological element or purpose; the nature of its titleholder—the subjective element—must also be considered, because a public domain can exist only when the four elements characterizing it are present. (…)” If there is any doubt regarding its classification, each of these elements must be examined. If all four converge, the property’s public-estate status (demanialidad) is clear; but if any one of them is absent, it cannot be classified as such.
Moreover, the public estate affords special protection to the property comprising it. In this respect, its characteristics include being inalienable, not subject to acquisitive prescription, and exempt from attachment (inalienables, imprescriptibles, inembargables). Accordingly, an action to recover such property is not subject to limitation periods (plazos de caducidad), as expressly provided in Article 34 CPCA. It is also outside private commerce, in the sense that it is not susceptible to private appropriation. A public entity may nevertheless grant rights of use (derechos de aprovechamiento) to private persons through use concessions (concesiones de uso). Finally, administrative action, exercised through powers of administrative self-enforcement and police powers (potestades de autotutela y policía), replaces possessory proceedings (interdictos) for recovering control of the property.
In conclusion, public-domain property and private-domain property are governed by different legal regimes, a distinction that, it bears repeating, arises from Article 261 CC. The public domain is inalienable and not subject to acquisitive prescription, with all the resulting consequences. State-owned private-domain property, for its part, is subject to the ordinary rules of private ownership. As explained, the criterion distinguishing these two categories is the concurrence of the four elements already analyzed: the subjective, normative, objective, and purposive elements.
This Court has found it proven that, by agreement number XIV adopted at session number 037-98, of May 6, 1998, the IDA Board of Directors unanimously agreed to subdivide, award, and transfer 150 hectares (which were subsequently determined by the survey plan to amount in fact to slightly more than 68 hectares) from Finca Ganadera Guaycará to Sermucoop R.L. The transfer was formalized by deed number 16, from the notarial record of notary Julio Sánchez Carvajal, on May 19, 1998, but that transfer has not been recorded in the Public Registry. It was not until 2010 that the IDA Board of Directors declared this agreement detrimental to the public interest (lesivo), when it concluded that, although no evident and manifest nullity (nulidad evidente y manifiesta) existed, there were grounds for declaring it detrimental to the public interest, by virtue of the studies conducted, which concluded that forest had existed since before the year in which the transfer occurred and that the formalities governing its award had not been fulfilled because the property had automatically been incorporated into the National Natural Heritage (Patrimonio Natural del Estado, PNE).
To determine whether or not that property forms part of the public domain (demanio público), the presence of the subjective, normative, objective, and purposive elements must be analyzed. Regarding the first, although the property in question remains registered in the name of IDA because, despite the existence of a transfer deed, it was never recorded, ownership was transferred in accordance with the general principle set forth in Article 480 of the Civil Code (Código Civil, CC). This fact, however, is not relevant because, even if the property had been materially, though not officially in the registry, transferred to a private-law entity (sujeto de derecho privado), this would not prevent satisfaction of the subjective element, since that transfer does not cure any potential nullity if, prior to that transaction, the property could already have been classified as public-domain property (bien de dominio público).
The objective element is also satisfied because the property consists of real estate capable of forming part of the public domain. It is now necessary to analyze whether the other two elements, namely the normative and purposive elements, are also present. On at least one prior occasion (judgment number 014-2012-VI, at 16:20 hours on January 30), this Section has held, with the support of the position adopted by the First Chamber (judgment number 182-F-S1-2009, at 16 hours 27 minutes on February 19, 2009), that not all property owned by IDA must be considered public-domain property merely because it belongs to IDA, since, clearly and by virtue of the purpose pursued by the institution, much of that property instead forms part of its private domain (dominio privado). That judgment concluded that not every property acquired by IDA to fulfill the objectives of its governing law may be deemed public property, since nothing prevents private-domain property from being used in pursuit of those objectives.
Nevertheless, this Section has also stated—and this is the argument presented by IDA in this case—that the normative and purposive elements may be present if it is proven that, at the time of its award, the property formed part of the PNE under the rules of Articles 13 and 14 of the Ley Forestal. If that is the situation at issue, there would indeed be a general statutory dedication (afectación genérica) under Article 14 of the aforementioned Law, which clearly establishes that property forming part of the PNE “shall be immune from attachment and inalienable; possession thereof by private parties shall create no rights in their favor,” based on a specific conservation purpose distinct from those established in IDA’s enabling statutes. Determining whether property forms part of the PNE begins with the assessment prescribed by Article 13 of the cited Law, which states that it “shall consist of the forests and forest lands of national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for properties securing credit transactions with the National Banking System that become part of their assets.” Additionally, Article 15 of the repeatedly cited Law provides that the forest cover (cobertura boscosa) of a property owned by an institution immediately causes it to become part of the PNE, subject to the limitations noted above.
In summary, as applied to this specific case, the portion of Finca Ganadera Guaycará awarded and transferred to Sermucoop R.L. is part of the PNE and therefore public-domain property if, when the IDA agreement was issued, the property was classified as forest and used as such. Based on the facts found proven, particularly the report sent to IDA through official letter ACOSA-SRC-303, of August 7, 2006 (folios 162 to 164 of the judicial case file), the statement of the association’s own manager (folios 62 to 64 of the judicial case file), and the sketch of the settlement’s original layout (folio 165 of the judicial case file), this Court concludes that, even before the land was awarded to Nombre142864 ., it already had forest cover and therefore formed part of the PNE. This conclusion is based on the following elements: 1.- From the time the settlement was established, an area was designated as a reserve zone (see the sketch at folio 165 of the judicial case file), corresponding in shape and description to the area materially transferred to Nombre142864 ., identified in cadastral survey plan P-0796176-2002 (folios 166 and 167 of the judicial case file); in other words, even though the property as a whole had been acquired for parceling (parcelar), that area was never intended to meet the land needs of disadvantaged farmers in the area. 2.- The reason for the transfer to Nombre142864 . was precisely that the property could not be parceled and that its condition and forest cover made it suitable for conservation and forestry activities; consequently, the transfer would have served no purpose if the property had lacked forestry suitability (vocación forestal) (in this regard, see the statement of the Cooperative’s manager at that time, which clearly sets out the reasons for its interest in the land). 3.- The technical report concludes that, according to field evidence, the property was forest in 2006; that, according to the classification by Nombre28548, it was already forest in 2000; and that it therefore necessarily had to have been forest in 1998, the year of the transfer.
This conclusion is readily reached because a forest cannot grow in two years (from 1998, when the property was segregated, to 2000, when Nombre28548 declared it as such). Consequently, although no land-assessment document from 1998 certifies that it already had forest cover at that time, the subsequent assessments and technical criteria make clear that, for biological reasons, the forest development of the land at issue predates the transfer of the property. For the foregoing reasons, the property awarded to Sermucoop R.L., which had formed part of Finca Ganadera Guaycará, constitutes PNE and therefore satisfies the normative and purposive elements required for it to qualify as public-domain property, because a rule exists that, albeit in general terms, dedicates this property to common use and to the public purpose of conservation.
In its answer to the complaint, the Cooperative stated that it opposed the claimant’s requested relief “because the action is barred by the statute of limitations (sic). Under Article 194 (sic) of the General Law of Public Administration (Ley General de la Administración Pública), the period for alleging nullity is four years, and in our case more than thirteen have elapsed.” This statute-of-limitations defense (excepción de prescripción) was reserved for disposition on the merits by the case-management judge because it was not evident and manifest. Regarding this defense, the Court considers it necessary to make several preliminary clarifications before issuing the appropriate ruling. First, the defendant confuses the articles of the LGAP, because the article establishing a limitations period is not Article 194 but Article 198, or, in any event, Article 175 before the amendment adopted through the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo, CPCA).
Second, the period specified in Article 198 of the LGAP is a statute-of-limitations period (prescripción) for claiming administrative liability, not a peremptory time limit (caducidad), while the period formerly established by Article 175 does not apply because the act was adopted after the CPCA entered into force. Third, and perhaps most importantly, the claimant confuses the limitation of the right with the expiration of the action. In this Court’s view, although the defense raised is one based on the statute of limitations, the party’s arguments clearly show that it seeks to assert that the mandatory period for reviewing and declaring detrimental to the public interest the act transferring the portion of Finca Ganadera Guaycará in its favor has already expired. Generally speaking, reviewing whether an action is time-barred requires the Court to determine the applicable period and the point at which that period begins to run.
However, under the rules contained in the second paragraph of Article 34, which reflect the provisions of Article 14 of Ley 7575, no peremptory time limit applies to actions brought by the State—in the broad sense—seeking to recover title or any of its attributes when public-domain assets (bienes dominiales) are involved. Because this Court, for the reasons stated in the preceding paragraph, considers the property at issue in these proceedings to be public-domain property, the statute-of-limitations defense raised by the Cooperative—which the Court has construed as a time-bar defense—must be rejected, since no limitations period may be asserted with respect to public-domain property, by virtue of the non-prescriptible nature (imprescriptibilidad) of property subject to this public-law regime (régimen de Derecho Público). Having rejected the defense raised and determined that the property before us is public-domain property, this Court must now review the nullity of the IDA agreement that transferred title to the property in question.
Consistent with what this Section had already ruled in judgment number 2166-2010, at 10:16 hours on June 7, it must be noted that the mere fact that the property at issue in these proceedings constitutes State Natural Heritage (Patrimonio Natural del Estado, PNE), as well as the public-domain status (carácter demanial) that consequently characterizes it, renders absolutely null and void all formal administrative conduct and actions through which the transfer of that property to Sermucoop R.L. was permitted. This is because, as public-domain property (bien de dominio público), it was outside private commerce, and there was a legal prohibition against conveying title to it or creating rights in rem (derechos reales) over it. By its very nature, it could not be privately appropriated, nor could the existence of possessory rights (derechos de posesión) over it be asserted. Resolution number XIV of session number 037-98, of May 6, 1998, in which the Board of Directors of the IDA unanimously agreed to segregate, award, and transfer 150 hectares (which the survey plan later determined were actually slightly more than 68 hectares) of Finca Nombre141768 to Sermucoop R.L., is absolutely null and void, under the terms of Article 166 LGAP, because the basic elements required for its formation are entirely absent.
On the one hand, the factual and legal components of the grounds for the act (motivo del acto) are entirely absent, since it disposes of public-domain property as though it were not such, which is expressly prohibited by Ley 7575. That same Law (Article 15) establishes the mandatory requirement to consult Minaet before disposing of any forest-covered property, so that it may duly classify the property. The absence of this prior assessment renders the grounds for the act absolutely null and void, because the property may be disposed of only upon a declaration by Minaet that it is not PNE. In this case, the IDA Administration approved the segregation based on a technical recommendation from the institute itself, without obtaining the opinion of the entity legally mandated to administer the PNE. It should be noted that when, upon commencement of the administrative proceeding to annul the act in question, the directing body consulted Minaet, the latter categorically stated that the property in question was forestland and had to be considered PNE under the terms already described by Ley 7575.
In any event, the act whose annulment is sought is wholly devoid of the reasons for which it was issued, omitting any consideration of the legality of this action, as well as any analysis of the legal framework authorizing the institution to issue the act disposing of the property; this also constitutes a complete defect in the statement of reasons for the act (motivación del acto) (Articles 134 and 136 LGAP). The total absence of grounds (Article 133 LGAP) and of a statement of reasons also makes the content of the act (section 132 ibid.) manifestly unlawful, since it is contrary to the statutory purposes established by Ley Forestal for the conservation of publicly owned land with forest cover (cobertura boscosa). For the reasons stated both in this recital and in the preceding one, resolution number XIV of the IDA Board of Directors, adopted at session number 037-98 on May 6, 1998, must be declared absolutely null and void, solely insofar as it concerns the titling of a portion of Finca Ganadera Guaycará to Nombre142864.
Because the defects declared herein render the titling carried out by the IDA in favor of the defendant Nombre142864 invalid, this Court finds that, by connection, the execution of public deed number 16, volume 38, before notary Julio Sánchez Carvajal, authorized at 11:45 hours on May 19, 1998, was also invalid insofar as it formalized and recorded the transfer of Finca Ganadera Guaycará to Nombre142864, solely because the property was public-domain property. The Archivo Nacional must be notified of the annulment of the aforementioned notarial instrument so that a marginal notation may be entered in the original instrument in the corresponding notarial record. Now, having declared invalid the formal conduct of the IDA that was found to be injurious to the public interest (lesiva), as required by section 200 LGAP, it is necessary to determine whether the declared illegality is manifest. This judicial body finds that it is.
This is so for several reasons. First, when this titling occurred, Ley Forestal was already in force and, as stated, provided for the immediate incorporation into the PNE of all forest-covered lands, their inalienability, and the impossibility of transferring them to third parties. As explained, before and during the titling proceeding at issue, sufficient technical means were available to allow the IDA to establish the forested nature of the land. Diligent and lawful conduct by the plaintiff institution in assessing that circumstance would have prevented the transfer of this public-domain property into private ownership and avoided the resulting harm to the PNE. Actions of this kind are contrary to the legal system and are reprehensible. Accordingly, pursuant to Articles 192, 199, 200, 210, 211, and 213 LGAP, the head of the IDA must immediately initiate the appropriate internal proceedings to determine the financial or disciplinary liability of the officials who participated in the acts or omissions that led to unlawful actions in connection with the aforementioned titling.
A report on the actions taken must be submitted to this Court within three months after this judgment becomes final. Finally, it should be noted that the nullities declared herein are without prejudice to any potential public liability, and those affected by them may pursue the appropriate judicial remedy to establish the financial liability of the State or the IDA in this case, where applicable.
X.ACTIONS TO TRANSFER THE PROPERTY AT ISSUE IN THESE PROCEEDINGS TO THE STATE AND REGISTRATION PROCEDURES BEFORE THE REGISTRO NACIONAL. Having declared the property at issue in these proceedings to be Patrimonio Natural del Estado, pursuant to Article 13 of Ley Forestal, the IDA must immediately adopt all necessary measures to ensure that the property is duly registered in the name of the State. Under the cited provision, the Procuraduría General de la República, acting through the Notaría del Estado, is responsible for preparing the deed of transfer, including the corresponding change in classification, and taking the necessary steps to register that deed with the Registro Público de la Propiedad Inmueble. Likewise, in view of the general duty imposed on the State by the legal system regarding environmental protection, this Court finds that the State, through Minaet and Sinac, has the obligation to identify the property at issue in these proceedings as PNE.
Consequently, notice of this decision shall be given to the Procuraduría General de la República so that, through the Notaría del Estado, it may prepare the deed of transfer, including the corresponding change in classification, as promptly as possible and take the necessary steps to register the property described in registered survey plan P-796176-2002, if that plan in fact reflects the actual property in question, in the name of the State in the Registro Público de la Propiedad Inmueble. In addition, the defendant cooperative must place Minaet in possession of that property.
In its answer to the complaint, the defendant raised the defenses of lack of jurisdiction (incompetencia), failure to join an indispensable defendant (litis consorcio pasivo necesario incompleto), and limitation (prescripción). The lack-of-jurisdiction defense was denied by the case-management judge in ruling number 2176-2011, at 10:15 hours on December 20, 2011. The defense of improper joinder of the parties (indebida integración de la litis) was denied by an order issued at 10:39 hours on January 17, 2012, while the limitation defense, recharacterized by this Court as a defense of lapse (caducidad), is denied under the terms set forth above because the property is public-domain property, for the recovery of which no time limit may be asserted.
Article 193 of the Código Procesal Contencioso Administrativo provides that procedural costs and attorneys’ fees (costas procesales y personales) shall be imposed on the losing party solely by reason of having lost, and that such a ruling must be made even sua sponte, pursuant to section 119.2 ibid. Waiver of such an award is permissible only when, in the Court’s judgment, there was sufficient reason to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, the Court finds that the ruling was not based on evidence unknown to the defendant when the proceedings were commenced, but that there was sufficient reason to litigate because the defendant based its defense on the existence of an administrative act that granted it rights under the principle of legitimate expectations (principio de confianza legítima). Accordingly, this judgment shall be issued without a special award of costs.
POR TANTO
The provisional measures (medidas cautelares) sought by the IDA in this matter are granted and shall remain in force until this judgment becomes final. Accordingly, the notice of the action (anotación de la demanda) against property registration Placa28104 in the province of Puntarenas is confirmed, and Sermucoop R.L. is ordered to refrain from engaging in any conduct, whether by act or omission, that could harm the ecosystem existing on the property in question. The statute-of-limitations defense (excepción de prescripción), recharacterized by the Court as a defense of expiration (excepción de caducidad), raised by the representative of Sermucoop S.A., is denied. The complaint filed by Nombre81703, on behalf of the INSTITUTO DE DESARROLO AGRARIO, against COOPERATIVA DE SERVICIOS MÚLTIPLES COOPERATIVOS COTO 63 R.L., is granted in its entirety. Accordingly:

Número 188-2012-VI TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA. SECCIÓN SEXTA. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ, GOICOECHEA. ANEXO A.- A las trece horas treinta minutos del catorce de setiembre de dos mil doce.- Proceso de conocimiento incoado por Nombre81703 , cédula de identidad número CED112216, en representación del INSTITUTO DE DESARROLLO AGRARIO (IDA, hoy Instituto de Desarrollo Rural, Inder, pero referido a lo largo de esta sentencia con IDA), contra la COOPERATIVA DE SERVICIOS MÚLTIPLES COOPERATIVOS COTO 63 R.L. (SERMUCOOP R.L.), cédula jurídica número CED112217, representada por su Gerente General, con facultades de representante legal judicial y extrajudicial, Nombre142863 , mayor, cédula de identidad número CED112218. Intervienen, como abogado director de la cooperativa demandada el licenciado Wilfred Solís M., de calidades desconocidas y como apoderado general judicial del IDA el licenciado Alex Benjamín Gen Palma, carné del Colegio de Abogados y Abogadas número 6484.
RESULTANDO:
Redacta el Juez Conejo Cantillo, con el voto afirmativo de las juezas Abarca Gómez y Álvarez Molina.
CONSIDERANDO
Antes a entrar al análisis de los elementos de fondo del presente asunto, considera este Tribunal esencial referirse a tres aspectos detallados en el trámite: el rechazo de plano de la contrademanda, el rechazo sin audiencia de la excepción de indebida integración de la litis, y la falta de resolución de la medida cautelar solicitada por la parte actora, que fue parcialmente otorgada de manera provisional. Respecto del rechazo de la contrademanda, más alla de lo resuelto por el Juez de Trámite en el auto de las 10:39 horas del 17 de enero de 2012, decisión con la que este Tribunal no está de acuerdo pues revela un error de interpretación de la regla contenida en el artículo 173 párrafo sétimo de la Ley General de la Administración Pública (en adelante LGAP), lo cierto del caso es que contra esa decisión, que fue debidamente notificada al medio señalado para recibir notificaciones (ver folio 211 del espediente judicial), la parte demandada no opuso gestión alguna para someterla a revisión, a través del recurso de casación(numeral 62 en relación con el 134 del Código Procesal Contencioso Administrativo, en adelante CPCA).
En este sentido, teniendo remedios procesales importantes a su alcance para corregir la decisión jurisdiccional y al no haberlos ejercido en tiempo ni en forma, no podría este Tribunal sustituir la voluntad de la parte de aceptar estas decisiones con su inercia procesal. En todo caso, considera esta Cámara que el rechazo ad portas no enerva la facultad de la parte, a la luz de lo que se resuelve en esta sentencia, para reclamar de nuevo en esta vía la indemnización que constituía el eje de la contrademanda, en los términos en los que considere conveniente, razón por la cual no se genera un estado de indefensión que haga necesaria la anulación de lo actuado en sede judicial. En lo relativo al rechazo de la excepción de indebida integración de la litis, realizado en la misma decisión antes indicada, corre la misma suerte que el rechazo ad portas de la contrademanda: aun y cuando este Tribunal considera que no se aviene a las reglas del artículo 71 CPCA, lo cierto del caso es que la parte no ejerció sus derechos recursivos contenidos en el mismo artículo indicado (recurso de apelación), por lo que, como ya se dijo, su inacción no puede ser corregida por el Tribunal.
En todo caso, considera esta Cámara que no se requiere la participación del notario que autorizó la escritura, siendo que no se reclama conducta alguna o resposabilidad en su contra, y la pretensión de anular la escritura mediante la que se trasladó la propiedad a la parte demandada no le afecta en forma directa. Por último, en cuanto a la medida cautelar solicitada por la parte actora, procede el despacho a conocer de dicha gestión, bajo el siguiente razonamiento. Solicita la parte actora en su escrito de demanda dos medidas cautelares: 1. La anotación de la demanda en la finca del partido de Puntarenas, matrícula número Placa28104, propiedad del IDA; y 2. Que se ordene a Sermucoop R.L. abtenerse de realizar cualquier conducta (por acción u omisión) que pueda ir en menoscabo del ecosistema existente en la finca en cuestión. Como ya se indicó, el primer aspecto fue acogido en forma provisional por el Juez Tramitador, mediante auto de las 13:30 horas del 28 de julio de 2011.
En esa misma resolución se concedió audiencia a la parte demandada para que se refiriera a las medidas cautelares. Sin embargo, la parte no respondió en el plazo concedido y al contestar la demanda no hizo referencia a este aspecto. No consta en el expediente que el juez de trámite se haya referido, en los términos del artículo 25 CPCA a esta solicitud, razón por la cual entre este Tribunal a resolver la medida cautelar solicitada y establecer si rechaza, mantiene o modifica lo ordenado en forma provisional. Tal y como ha sido desarrollado por la Sala Constitucional, la justicia cautelar responde a la necesidad de garantizar el principio constitucional de una justicia pronta y cumplida, al conservar las condiciones reales indispensables para la emisión y ejecución de la sentencia (Resolución 7190-1994, de las 15:24 horas del 6 de diciembre). En este mismo sentido, el artículo 19 del CPCA establece que el fin de la fijación de una medida cautelar es proteger y garantizar, provisionalmente el objeto del proceso y la efectividad de la sentencia.
En este sentido, la justicia cautelar no tiene como fin declarar un hecho o una responsabilidad, ni la de constituir una relación jurídica, ni ejecutar un mandato y satisfacer el derecho que se tiene sin ser discutido, ni dirimir un litigio, sino prevenir los daños que el litigio pueda acarrear o que puedan derivarse de una situación anormal. De conformidad con el artículo 21 CPCA, el juez o el Tribunal, a la hora de determinar la procedencia de una solicitud de medida cautelar, debe verificar que la pretensión del proceso de conocimiento no sea temeraria o, en forma palmaria, carente de seriedad, lo que constituye una valoración preliminar del fondo para determinar si existe en el caso en cuestión lo que la doctrina y la jurisprudencia han llamado apariencia de buen derecho o fumus boni iuris. Por otro lado, el mismo numeral 21 del Código establece la procedencia de la medida cautelar cuando la ejecución o permanencia de la conducta sometida a proceso produzca graves daños o perjuicios, actuales o potenciales, situación que ha sido definida en la doctrina como el periculum en mora o peligro en la demora, es decir, que en virtud de la demora patológica del proceso judicial, concurra un peligro actual, real y objetivo de que se genere a la parte promovente un daño grave.
Por último, el artículo 22 CPCA establece la obligación del juzgador de realizar, a la luz del principio de proporcionalidad, una ponderación de los intereses en juego, es decir, entre la circunstancia del particular, por un lado y el interés público y los intereses de terceros que puedan verse afectados con la adopción de la medida cautelar, por el otro. Sólo en la concurrencia de los tres elementos, es decir, de la apariencia de buen derecho, del peligro en la demora y que del análisis de la ponderación de intereses se considere que daño sufrido por el particular debe tutelarse por encima de los demás intereses en juego, puede proceder el despacho a conceder la medida cautelar solicitada. Estudiados los autos a la luz de los elementos probatorios y argumentos esbozados por ambas partes, es el criterio del Tribunal que sí concurren los elementos para otorgar las medidas cautelares solicitadas, por las razones que se procede a exponer.
En cuanto a la apariencia de buen derecho, considera el Tribunal que no se está frente a una medida que pudiera derivar en una demanda temeraria o en forma palmaria carente de seriedad, pues a tenor de lo expuesto por la parte, se trata de un objeto posible y propio de ser discutido en esta sede, como es precisamente la anulación de una acto administrativo declarado lesivo por la propia Administración Pública. Acreditado el primer elemento, y entrando a la revisión del peligro en la demora , considera este Tribunal que existen elementos que permiten acreditar que en este caso, de no mantenerse la medida acogida en forma provisional, y de no dictarse la otra cautela solicitada, podría producirse una afectación al objeto del proceso que haga fútil lo que se resolverá en definitiva en esta sentencia. Aún y cuando ha sido el criterio reiterado del Tribunal que es carga de la parte actora acreditar los elementos de prueba que permitan verificar la existencia del peligro en la demora, existen casos, como el presente, en el que el daño es tan evidente que no requiere de mayores elementos de prueba para que el Tribunal tenga la convicción que de no adoptarse medidas como la anotación de la demanda sobre el asiento de la finca y la prohibición al titular actual de realizar cualquier conducta (acción u omisión) que afecte la condición actual del inmueble, el objeto del proceso podría verse perjudicado en forma grave.
En cuando a la anotación de la demanda, téngase presente que esta medida lo que busca es informar a terceros de la existencia de la discusión sobre determinado bien en sede judicial. En términos generales, el actor no solicita la anotación de una finca de la que él mismo es dueño, pero siendo que en el presente asunto nunca se realizó la inscripción del traspaso de la finca 95299-000 a favor de la cooperativa demandada, es lógico que lo que se pretenda es la anotación de la finca del propio IDA, para hacer saber a terceros y al propio Registro que sobre dicha finca existe una discusión sobre su titularidad. De no hacerse saber esa circunstancia, podrían darse movimientos registrales que de alguna forma restrinjan o imposibiliten una decisión favorable a las pretensiones del IDA, lo que constituiría, a criterio del Tribunal un daño grave a los intereses representados por la institución. En cuanto a la segunda medida cautelar, el Tribunal considera que aun y cuando no exista un daño inminente de modificación del bien por parte de la Cooperativa, sí existe un riesgo eventual de que se den cambios en el bien, sea por acción o por omisión, por lo que resulta prudente, a efectos de no causar daños que podrían ser irreversibles en el bien objeto del proceso, tener por acreditado un peligro en la demora también en este punto.
Tómese en cuenta que se trata de un bien que según los informes rendidos en el expediente administrativo (folios 163 y 164 del expediente judicial) es una finca con cobertura forestal y que sirve de zona de captación de agua para abastecer a la comunidad vecina, por lo que no resulta exagerado acreditar el peligro en la demora por la existencia de un riesgo de modificación de las condiciones actuales. En cuanto a la ponderación de intereses en juego, considera este Tribunal que en este asunto han de privar los intereses públicos revelados por la institución actora, que busca la recuperación de un bien que alega pertenece al patrimonio natural del Estado (en adelante PNE), y de su protección en la condición actual, tanto material como registralmente, frente a los intereses de una cooperativa, que aunque alega no haber afectado el bien, sino más bien haberlo manejado en forma responsable para la protección del ambiente, no puede hacerse depositaria de los fines públicos establecidos en la Ley 7575.
Así las cosas, por acreditarse los tres presupuestos requeridos para el otorgamiento de las medidas cautelares, ha de acogerse la medida cautelar solicitada en sus dos extremos, confirmando entonces la anotación de la demanda sobre la finca del partido de Puntarenas matrícula Placa28104 y ordenando a Sermucoop R.L. abtenerse de realizar cualquier conducta (por acción u omisión) que pueda ir en menoscabo del ecosistema existente en la finca en cuestión. Estas medidas mantendrán su vigencia hasta la firmeza de este fallo.
De esta naturaleza, y de importancia para la resolución de este asunto, durante el proceso han quedado demostrados los siguientes: 1. Mediante acuerdo número XIV de la sesión número 037-98, del 6 de mayo de 1998, la Junta Directiva del IDA acordó por unanimidad: "De conformidad con el oficio DRB-573-98 del 30 de abril de 1998, suscrito por la Dirección Regional Brunca y con fundamento en lo establecido en el artículo 67 de la Ley No. 7097, (...) segregar, adjudicar y traspasar conforme el siguiente detalle: (...) 2. Dirección17326 (150 Has) a la Cooperativa de Servicios Múltiples de Coto 63 (Sermucoop R.L.) cédula jurídica número CED112217, representada por el Gerente (...). Adjudicar dicha área no parcelable la cual se ubica en el Dirección16305 " (folios 147 a 151, 161 y 165 del expediente judicial). 2. Mediante escritura número 16, del protocolo del notario Julio Sánchez Carvajal, firmada a las 11:45 horas del 19 de mayo de 1998, comparecieron los apoderados generalísimos del IDA y de Sermucoop R.L., a efectos de formalizar, entre otros actos, el traspaso de la finca que se describió así: "un lote de terreno situado en Dirección17327 , , del cantón sétimo, Golfito, de la provincia de Puntarenas, que es terreno de repastos y tacotales, con un área aproximada de ciento cincuenta hectáreas.
Este terreno es parte de la finca del partido de Puntarenas inscrita al folio real matrícula Placa28103 - del partido de Puntarenas (sic)". Las condiciones de la operación fueron las siguientes: "El precio de venta de cada uno de los lotes aquí mencionados es por la suma de un colón y se hace con fundamente (sic) en el artículo sesenta y siete de la Ley siete mil noventa y siete (...) Se advierte al segundo compareciente que para la inscripción de ese documento se requiere que aporte los correspondientes planos catastrados de las áreas que en realidad corresponden al traspaso que aquí se realiza lo cual acepta y se compromete a aportar en su momento, motivo por el cual libera de toda responsabilidad al infrascrito notario y al Instituto tanto por la no inscripción del documento así como del área correcta que se le traspasa, de lo cual se dará fe una vez que se aporte al notario y al Instituto el respectivo plano.
Los lotes aquí traspasados quedan sometidos a las limitaciones, prohibiciones y restricciones de la Ley dos mil ochocientos veinticinco (...) El fin para el que se traspasan los lotes aquí indicados es para protección y conservación tal y como lo estableció la Junta Directiva en el acuerdo supra citado" (folios 57 y 58 del expediente judicial). 3. El 12 de junio de 2002 fue catastrado el plano P-796176-2002, que corresponde a un área de 68 hectáreas con tres mil doscientos setenta y cinco metros cuadrados con ochenta decímetros cuadrados, realizado por el topógrafo José Luis Jiménez Alfaro y que indica que la propiedad descrita pertenece al IDA para traspasar a Sermucoop R.L. (folios 166 y 167 del expediente judicial). 4. En acuerdo número 29 de la sesión 009-06, del 6 de marzo de 2006, modificado por el acuerdo número 12 de la sesión 003-07, de 22 de enero de 2007, la Junta Directiva del IDA acordó en su punto segundo autorizar al Lic. Nombre81703 , en coordinación con la Dirección de Asuntos Jurídicos, para que se conforme en órgano director del procedimiento administrativo, a efecto de iniciar el procedimiento de nulidad absoluta tendiente a revertir al patrimonio institucional, entre otras, la finca sin número otorgada a Sermucoop R.L., en Ganadera Guaycará, Golfito con una cabida de 150 hectáreas (folios 78 y 79 y 155 y 156 del expediente judicial) 5.
En oficio número AJRB-B-039-2006, de 20 de marzo de 2006 el órgano director solicita al jefe de la Subregión Coto del Minaet un informe técnico "que dictamine si la cobertura de los predios que se detallan en el cuadro siguiente se califica como Bosque, cuál es su característica y si estos pueden ser considerados Patrimonio Natural del Estado, asi mismo (sic) si con base a su estado en cuáles sectores es dable determinar si en el año 1998 mantenía con igual calificación". Dentro de las fincas que se solicita informar se encuentra la del asentamiento Guaycará adjudicada a Nombre142864 . (folios 169 y 170 del expediente judicial). 6. En respuesta al oficio anterior, el jefe Subregional de Coto del Minaet, mediante oficio ACOSA-SRC-303, del 7 de agosto de 2006 responde al IDA remitiendo informe de la inspección realizada el 11 de junio de 2006, referido a la finca adjudicada a Sermucoop R.L., en el que se concluyó: "1-) En el recorrido que se hizo se logró determinar que la finca está constituida por bosques en diferentes etapas sucesionales. 2-) La mayoría del terreno presenta fuertes pendientes, de 47% hasta 76%, exceptuando una franja muy estrecha de aprox (sic) 30 metros de ancho que es la cresta de la fila que recorre la finca en un sentido Suroeste/Noreste. 3-) Según informes de vecinos, de esta finca se capta una cañería que abastece de agua al asentamiento La Esperanza del IDA. 4-) Según la clasificación que brinda el Mapa de Uso de Suelo del año 2000, elaborado por Fonafifo, por los puntos de GPS tomados en el campo la finca clasifica como bosque, lo que quiere decir, que para el año 1998, dichos terrenos eran bosques. 6-) (sic) En el recorrido hecho no se encontraron áreas recientemente trabajadas ni taladas, por referencia de los mismos vecinos esta finca ha permanecido sin trabajarse por varios años (más de quince) lo que explica la composición y desarrollo de los bosques muestreados" (folios 162 a 164 del expediente judicial). 7.
Durante la audiencia oral y privada del procedimiento administrativo, celebrada el día 28 de mayo de 2007, se recibió el testimonio del señor Nombre17601 , quien era el Gerente de Sermucoop R.L. al momento de la adjudicación. Consigna el acta de su deposición que el señor Nombre17601 declaró, en cuanto a la naturaleza del inmueble recibido: "la Cooperativa gestionó la solicitud de ese terreno ante la Junta Directiva del IDA, por un ofrecimiento de la Institución, específicamente de directores de la Junta Directiva que nos informaron de esas áreas y que sería importante que la Cooperativa incursionara en el área forestal (...) y lo que ha hecho [la Cooperativa] es cuidarla porque el terreno no es apto para la agricultura, incluso la mayoría del área se encuentra de bosque (...) Para cuidar ese terreno la cooperativa lo que ha hecho es darle vuelta al terreno, limpieza de carriles y alguna visita ocasional al terreno, porque es área de bosque" (folios 63 y 64 del expediente judicial). 8.
En acuerdo número 72 de la sesión ordinaria 025-2010, del 16 de agosto de 2010, la Junta Directiva del IDA, tomando como base el informe rendido por el órgano director, decidió que no había elementos suficientes para declarar la nulidad evidente y manifiesta de la adjudicación de la finca en Guaycará a Sermucoop R.L., pero sí para declarar "la lesividad del acuerdo tomado por la Junta Directiva en Artículo XIV Sesión 037-98 del 6 de mayo de 1998, que aprobó la adjudicación, segregación y traspaso a la Cooperativa de Servicios Múltiples Cooperativos Coto 63 R.L. (SERMUCOOP R.L.) (...), de un terreno no parcelable que es parte de la Finca Ganadera Guaycará, con un área de ciento cincuenta hectáreas" (folios 16 a 26 y 28 a 56 del expediente judicial).
No existen hechos no probados de relevancia para la resolución de este proceso.
Pretende el IDA, de conformidad con su escrito de demanda y siendo que no hubo aclaraciones o ajustes de importancia a la pretensión en la audiencia preliminar, que se declare la nulidad, en primer lugar, del acuerdo tomado por la Junta Directiva del IDA, en el artículo XIV sesión 037-98 del 6 de mayo de 1998, en lo que se refiere a la adjudicación y traspaso de la finca Ganadera Guaycará, a Sermucoop R.L., y en segundo lugar, de la escritura pública otorgada ante el notario Julio Sánchez Carvajal, número 16, tomo 38, autorizada a las 11:45 horas del 19 de mayo de 1998, que formalizó y protocolizó el traspaso de la finca Ganadera Guaycará, así como que se ordene al Archivo Nacional anotar en el protocolo original del notario indicado, razón de nulidad de esta escritura en lo que al traspaso de la finca Ganadera Guaycará se refiere. Argumenta la parte actora que el acto de adjudicación de esta finca es absolutamente nulo en tanto el bien trasladado constituye PNE, por lo que no podía ser objeto de disposición por parte del IDA.
En sustento de la naturaleza demanial de este bien, el IDA indica que el informe solicitado al Minaet (folios 162 a 164 del expediente judicial) es concluyente al indicar que al momento del traspaso el bien era bosque, pues así había sido catalogado por Fonafifo. Esta demanialidad, y el hecho de que no se pidiera al Minaet su criterio para disponer del bien (artículo 15 de la Ley 7575) llevan al IDA a concluir que el traspaso es absolutamente nulo. Por último indica que la propia naturaleza demanial del bien conlleva la imprescriptibilidad de la acción del Estado para recuperar este tipo de bienes. Por su parte, la Cooperativa demandada alega que el traspaso tuvo como fin la protección del bien y su conservación, y que esos fines fueron cumplidos en su totalidad por la Cooperativa. Rechaza la demandada las conclusiones del informe técnico de Minaet en cuanto a que para 1998 el terreno pudiera ser considerado como bosque, y alega que de conformidad con el artículo 194 LGAP (sic), ya trascurrió el plazo de cuatro años para alegar la nulidad del traspaso del bien, por lo que opuso la excepción del prescripción que fue reservada para el fondo por no ser evidente y manifiesta.
De forma previa a entrar al análisis de fondo del presente asunto, resulta importante revisar en forma el cumplimiento de los diversos presupuestos que impone el ordenamiento jurídico para la formulación de un proceso de lesividad, siendo que la ausencia de uno de estos elementos vedaría y haría innecesario el examen de fondo. Sobre este tema, la sentencia número 014-2012-VI, de las 16:20 horas del 30 de enero, estableció los parámetros generales sobre este tema, que se resumen de la siguiente forma. El análisis de estos presupuestos deviene en una práctica oficiosa para el juzgador, por constituir elementos esenciales de la acción. De manera general, la lesividad se constituye en un mecanismo jurisdiccional en virtud del cual la Administración pretende la supresión de un acto suyo, propio, que en tesis de principio, genera un efecto favorable a un tercero destinatario. Desde ese plano, en este tipo de contiendas, la lesividad es de corte subjetivo, en tanto pretende la anulación de una conducta que concede un derecho o en general, una situación de beneficio a una persona.
Tal figura se encuentra positivizada actualmente en el canon 34 CPCA, norma que fija los elementos previos y regulaciones procesales de esta figura. También se encuentra referenciada en el numeral 173 inciso 6) en relación con el 183 LGAP. Desde la óptica de los presupuestos procesales, se imponen condiciones subjetivas, objetivas, procedimentales y temporales. En cuanto a la arista subjetiva, la legitimación activa se concede a la Administración emisora del acto cuestionado, en tanto que el legitimado pasivo es el receptor de los efectos de la conducta, sea, quien obtiene sus beneficios. En lo atinente a la arista objetiva, la lesividad se constituye como un mecanismo de eliminación jurídica de actos administrativos que sean disconformes sustancialmente con el ordenamiento jurídico, sea, los actos que padezcan de algún nivel de invalidez, sea absoluta o relativa, en cualquiera de sus tipologías (artículos 128, 158, 165 y concordantes LGAP).
En esa línea, la Administración debe declarar lesiva a los intereses públicos esa conducta, lo que debe ser establecido dentro de un marco de acciones internas de la administración que son impostergables para formular la acción. En efecto, en el orden procedimental, se impone que el jerarca máximo supremo de la Administración Pública respectiva declare la lesividad del acto, sea por lesión a intereses económicos, fiscales o de otra índole que se desprendan del interés público, para lo cual, ha de contar con un criterio jurídico-técnico de base que sustente esa determinación. A diferencia de otras figuras de supresión de conductas públicas, no requiere de audiencia al tercero, sino solo de acciones a lo interno de la Administración, siendo que es dentro del proceso judicial que el tercero podrá establecer sus alegatos de defensa. En cuanto a la dimensión temporal, la nueva normativa procesal establece un plazo de un año contado a partir de la emisión del acto (que no de su comunicación) para declarar lesivo el acto a los intereses públicos, y luego de esa declaratoria (y no a partir del vencimiento de ese primer año) se otorga un plazo de un año para plantear la acción contenciosa administrativa a modo de plazo fatal de caducidad, salvo en casos de actos con nulidad absoluta, en cuyo caso, la declaratoria de lesividad puede realizarse en tanto perduren sus efectos (artículos 34 y 39 del CPCA).
La excepción se configura en tutela del dominio público, caso en el que la acción de lesividad no está sujeta a plazo por la aplicación de la cláusula general de imprescriptibilidad de ese tipo de bienes según se deriva del canon 261 del Código Civil. En la especie, del análisis de los autos, se concluye que, en principio, la declaratoria de lesividad interna cumple con los presupuestos señalados. Según se ha establecido, el acto cuya anulación se pretende es el acuerdo tomado en el artículo XIV sesión 037-98 del 6 de mayo de 1998, en lo que se refiere a la adjudicación y traspaso de la finca Ganadera Guaycará, a Sermucoop R.L. Esa conducta administrativa fue declarada lesiva a los intereses públicos por la Junta Directiva del IDA, en condición de jerarca supremo de ese ente público, mediante acuerdo número 72 de la sesión ordinaria 025-2010, del 16 de agosto de 2010. De igual modo, la demanda la formula el referido instituto, como autor del acto cuestionado y se presenta contra la persona a favor de quien surgen los efectos beneficiosos del acto, por lo que en términos del ámbito legitimante tanto activo como pasivo, se cumplen con las exigencias referidas.
No se observa, tampoco deficiencia alguna en el elemento procedimental al existir declaratoria interna de lesividad por parte del jerarca administrativo, según se ha expuesto. La circunstancia de que más bien se haya iniciado el procedimiento para verificar si se estaba frente a una nulidad absoluta, evidente y manifiesta, y que la conclusión final del procedimiento fuera que los elementos del caso no permitían arribar a esta conclusión, aunque sí para su declaratoria de lesividad, no constituye vicio alguno, en tanto más bien se otorgaron más armas de defensa a la parte en propia sede administrativa de las que ha exigido tanto el ordenamiento jurídico como la jurisprudencia en este tema. Ahora bien, en relación con el aspecto temporal cabe señalar que el acuerdo cuya nulidad se pretende fue dictado en el año 1998 y declarado lesivo en el año 2010, esto es, con posterioridad a la entrada en vigencia del CPCA, por lo que resultan de aplicación los plazos contenidos en los artículos 34 y 39 CPCA, lo que incluye la regla expresa del párrafo segundo del artículo 34 ídem, que indica "La lesividad referente a la tutela de bienes de dominio público no estará sujeta a plazo".
El accionante sostiene que la acción se ha ejercido en tiempo porque se está ante la recuperación de bienes de dominio público, materia en la cual, no corren plazos de caducidad; mientras que la demandanda afirma que los bienes en cuestión no pertenecen al demanio público y que la acción que se formula se encuentra "prescrita". En ese sentido estima el Tribunal que resulta indispensable determinar si se está o no frente a bienes de dominio público para luego examinar lo relativo a los aspectos temporales del proceso de lesividad, y resolver la mal denominada excepción de prescripción, que, como ser verá mas adelante, es en realidad de caducidad, y dependiendo del resultado de este aspecto, proceder o no a la declatoria de nulidad solicitada.
Como ya se afirmó en la sentencia de esta sección antes mencionada, (número 014-2012-VI, de las 16:20 horas del 30 de enero) el análisis de este Tribunal debe partir de la afirmación de que no todos los bienes del Estado son de dominio público sino que, por el contrario, los entes públicos cuentan, también, con bienes patrimoniales o de dominio privado. Esta distinción encuentra sustento en el propio Código Civil (en adelante CC), cuerpo normativo que en su artículo 261 señala que “Son cosas públicas las que por ley, están destinadas de un modo permanente a cualquier servicio de utilidad general, y aquellas de que todos pueden aprovecharse por estar entregadas al uso público. Todas las demás cosas son privadas y objeto de propiedad particular, aunque pertenezcan al Estado o a los Municipios, quienes para el caso, como personas civiles, no se diferencian de cualquier otra persona”. En efecto, las relaciones que surgen entre el Estado y los particulares con respecto a los bienes que se ubiquen dentro del dominio público y dentro del privado, tienen la diferencia sustancial de que, mientras las primeras deben someterse al régimen de Derecho Público, e implican por lo tanto, la aplicación de normas de subordinación; las segundas se caracterizan por la aplicación del Derecho Privado y se mueven dentro de elementos de coordinación, propios de este régimen.
Por ello es indispensable precisar en cada caso la naturaleza del bien en cuestión, pues de ello dependerá el régimen normativo aplicable para cada caso. De momento, interesa al Tribunal, referirse a los bienes de dominio público. Según se dijo, por su naturaleza este tipo de bienes se encuentran sometidos a un régimen especial de Derecho Público. Forman parte del demanio público, entendido como “(…) el conjunto de bienes sujeto a un régimen jurídico especial y distinto al que rige el dominio privado, que además de pertenecer o estar bajo la administración de personas jurídicas públicas, están afectados o destinados a fines de utilidad pública y que se manifiesta en el uso diretco o indirecto que toda persona puede hacer de ellos. (…)” (Sentencia No. 3145, dictada por la Sala Constitucional a las 9 horas 27 minutos del 28 de junio de 1996). En efecto, el dominio público se encuentra integrado por bienes que manifiestan, por voluntad expresa del legislador, un destino especial de servir a la comunidad, al interés público.
Son cosas que no pertenecen individualmente a los particulares y que están destinados a un uso público y sometidos a un régimen especial, fuera el comercio privado de los hombres. Así, son bienes que pertenecen al Estado en el sentido más amplio del concepto, están afectos al servicio que prestan y que invariablemente es esencial en virtud de norma expresa. Ahora bien, los bienes demaniales, para ser tales, deben reunir algunos elementos que resultan indispensables. Uno primero, subjetivo, referido al sujeto o titular del bien. En este sentido, el sujeto que tiene a cargo su titularidad ha de ser un ente público y no un particular. Paralelo a esta consideración, encontramos un segundo aspecto de importancia, a saber, partir del principio que los bienes de dominio público, por su naturaleza, no pueden ni deben, en ningún momento, pertenecer a los particulares. La razón por la que los bienes demaniales no pueden tener por titular a un sujeto particular, radica en el hecho que son cosas que tienen como finalidad la satisfacción del interés general, y están al servicio de la colectividad; lo que necesariamente se circunscribe a una función de carácter público, que, por sus alcances, difícilmente puede ser concebida como función de un sujeto de derecho privado.
Un segundo elemento es el objetivo, que está dirigido a todos aquellos bienes que pueden ser incluidos dentro del dominio público. Al efecto, puede afirmarse que es muy amplia la gama de bienes que son susceptibles de formar parte del demanio público. Así, tenemos los bienes inmuebles, muebles, cosas corporales, incorporales, fungibles y no fungibles, consumibles y no consumibles, divisibles y no divisibles, simples y compuestas, cosas principales y accesorias, universalidad de derechos, entre otros. Como tercer elemento está el normativo, conforme al cual el carácter demanial de los bienes depende de que exista una norma que así lo declare. Se requiere, entonces, de una afectación normativa, en virtud de la cual el bien entre a formar parte del demanio público. En nuestro ordenamiento, los artículos 261 y 262 CC, dicen de la necesidad de esta afectación cuando establecen, con toda claridad que serán cosas públicas y dedicadas al uso público, las que así se designen por ley.
En consecuencia, puede afirmarse que será el legislador quien decida qué bienes forman parte del dominio público y cuáles integran el dominio privado. Así, el dominio público es un concepto jurídico, lo que significa que su existencia depende del tratamiento expreso que le dé el legislador; por lo que sin ley que le sirva de fundamento ningún bien o cosa tendrá ese carácter. Por último, tenemos al elemento teleológico o finalista, según el cual, los bienes demaniales, para ser considerados como tales deben, también, estar dedicados al uso público. Esto es, tener como fin el interés general, o sea, de la comunidad. Nuestro Código Civil también consagra expresamente este elemento. Es así como el numeral 261 señala que son cosas públicas las que por ley, están destinadas de un modo permanente a cualquier servicio de utilidad general, y aquellas de que todos pueden aprovecharse por estar entregadas al uso público.
Esa misma norma distingue, además, aquellos bienes que, pese a pertenecer a un ente público, carecen de esa vocación de uso o utilidad pública, catalogándolas como privadas. En conclusión, para que un bien sea considerado como dominio público, es necesaria la reunión, en forma simultánea, de los cuatro elementos citados. No es suficiente la presencia de alguno de ellos, ya que si no concurren todos, el bien quedaría excluido de la categorización demanial. En este sentido, el tratadista Miguel Marienhoff, en lo que interesa, ha señalado que “(…) Para determinar la condición jurídica de un bien, no basta considerar, por ejemplo, sólo el elemento teleológico o destino, sino también la naturaleza de su titular, elemento subjetivo, porque sólo puede haber dominio público cuando están reunidos los cuatro elementos que lo caracterizan.(…)”. En el supuesto de que exista duda respecto de la categorización, resulta indispensable el examen de cada uno de estos elementos.
Si convergen los cuatro, es clara la demanialidad del bien, pero si faltase uno de ellos, no podrá ser catalogado como tal. Por otra parte, el demanio público ofrece una protección especial a los bienes que lo conforman. En este sentido, dentro de sus características tenemos que son inalienables, imprescriptibles, inembargables. Por ello la acción para recuperarlos no está sujeta a plazos de caducidad, como expresamente lo señala el numeral 34 CPCA. Asimismo, están fuera del comercio privado de los hombres, en el sentido que no son susceptibles de apropiación privada. Sin embargo, el ente público sí puede otorgar derechos de aprovechamiento a sujetos privados a través de concesiones de uso. Finalmente, la acción administrativa, a través de potestades de autotutela y policía, sustituye a los interdictos para recuperar el dominio. En conclusión, los bienes de dominio público y los de privado presentan un régimen jurídico distinto, que se insiste se desprende del numeral 261 del CC.
El dominio público es inalienable e imprescriptible, con todas las consecuencias que de ello se derivan. Por su parte, los bienes de dominio privado del Estado están sujetos a las reglas ordinarias de la propiedad privada. El criterio para distinguir estas dos categorías atiende, como se explicó, a la concurrencia de los cuatro elementos ya analizados, esto es, el subjetivo, normativo, objetivo y el finalista.
Ha tenido por probado este Tribunal que mediante acuerdo número XIV de la sesión número 037-98, del 6 de mayo de 1998, la Junta Directiva del IDA acordó por unanimidad segregar, adjudicar y traspasar 150 hectáreas (que después mediante el plano se determinó que en realidad eran poco más de 68 hectáreas) de la Finca Ganadera Guaycará a Sermucoop R.L. El traspaso fue formalizado mediante escritura número 16, del protocolo del notario Julio Sánchez Carvajal, el 19 de mayo de 1998, pero dicho traspaso no ha sido inscrito en el Registro Público. No es sino hasta 2010 que la Junta Directiva del IDA declara lesivo este acuerdo, cuando estimó que aunque no existía nulidad evidente y manifiesta, si había elementos para declararla lesiva a los intereses públicos, en virtud de los estudios realizados, que concluyeron la existencia de bosque desde antes del año en que se dio el traspaso y el incumplimiento de las formalidades para su adjudicación por encontrarse incorporado en forma automática ese bien al PNE.
Para determinar si ese inmueble integra o no el demanio público, debe analizarse la concurrencia de los elementos subjetivo, normativo, objetivo y el finalista. En cuanto al primero, tenemos que el inmueble en cuestión, aunque registralmente sigue perteneciendo al IDA, pues aun existiendo escritura de traspaso esta nunca fue inscrita, de conformidad con el principio general del artículo 480 CC sí hubo traslación del dominio. Este hecho sin embargo no es relevante, pues aun y cuando el bien fuera materialmente, aunque no registralmente, trasladado a un sujeto de derecho privado, esto no afecta el cumplimiento del elemento subjetivo, toda vez que esa transmisión no convalida una eventual nulidad en caso de que, desde antes de ese negocio, ya pudiera catalogarse como bien de dominio público. Por otra parte, se cumple también el elemento objetivo en tanto se trata de bienes inmuebles que son susceptibles de integrar el demanio público.
Ahora corresponde analizar la concurrencia de los otros dos elementos, sea normativo y teleológico. En al menos una oportunidad anterior (sentencia número 014-2012-VI, de las 16:20 horas del 30 de enero), ha sido criterio de esta sección, con el respaldo del criterio de Sala Primera (sentencia número 182-F-S1-2009, de las 16 horas 27 minutos del 19 de febrero de 2009), que no todos los bienes propiedad del IDA, por el sólo hecho de serlos, han de considerarse bienes de dominio público, pues claramente, y en virtud del fin que persigue la institución, muchos de esos bienes más bien integran su dominio privado. Se concluyó en aquella sentencia que no es posible entender que cualquier inmueble que haya sido adquirido por el IDA para cumplir con los objetivos de su ley, deba entenderse como público; en tanto nada obsta para que en la consecución de esos fines pueden estar presentes bienes de dominio privado.
Sin embargo, también ha señalado esta sección, y es en este caso, el argumento que presenta el IDA, que el elemento normativo y teleológico podría presentarse en caso de que se acredite que el bien constituía, al momento de ser adjudicado, PNE a tenor de las reglas de los artículo 13 y 14 de la Ley Forestal. En caso de ser esta la situación de marras, efectivamente habría una afectación genérica expresada por ley en el artículo 14 de la Ley indicada, que claramente establece que aquellos bienes que integran el PNE "serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor", a partir de un fin particular de protección, distinto a los establecidos en las leyes constitutivas del IDA. La determinación de si un bien constituye o no PNE parte de la valoración que al respecto hace el artículo 13 de la Ley citada, cuando indica que "estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio".
Adicionalmente, el numeral 15 de la Ley pluricitada indica que la cobertura boscosa de un inmueble propiedad de una institución lo convierte en forma inmediata en PNE, con las limitaciones señaladas anteriormente. En resumen, y en aplicación al caso concreto, la porción de la finca Ganadera Guaycará adjudicada y traspasada a Sermucoop R.L. será PNE y por ende, bien de dominio público, si al momento de dictarse el acuerdo del IDA el bien estaba catalogado como bosque y era usado como tal. Para este Tribunal y a partir de los hechos que se han tenido como probados, en particular del informe remitido al IDA mediante el oficio ACOSA-SRC-303, del 7 de agosto de 2006 (folios 162 a 164 del expediente judicial), de la declaración del propio gerente de la asociación (folios 62 a 64 del expediente judicial), y del croquis de la distribución original del asentamiento (folio 165 del expediente judicial), es posible concluir que el terreno, desde antes de que fuera adjudicado a Nombre142864 . ya tenía cobertura forestal y en consecuencia integraba el PNE.
Se arriba a esta conclusión con base en los siguientes elementos: 1.- Desde el momento en que se constituyó el asentamiento se consideró una zona de reserva (ver croquis de folio 165 del expediente judicial) que corresponde en forma y descripción con la zona materialmente trasladada a Nombre142864 ., identificada en el plano catastrado P-0796176-2002 (folios 166 y 167 del expediente judicial), es decir, que su destino nunca fue, aun y cuando se trataba de un bien que en su totalidad fue adquirido para parcelar, la de satisfacer las necesidades de tierra de campesinos desaventajados de la zona. 2.- La razón para el traspaso a Nombre142864 . fue precisamente porque el bien no podía ser parcelado sino que su condición y cobertura boscosa lo hacían útil para actividades de conservación y forestales, con lo que el traspaso hubiera sido inútil si el bien no hubiese tenido vocación forestal (véase a este respecto la declaración del gerente en ese momento de la Cooperativa que claramente expresa las razones por las que se interesaron en el terreno). 3.- El informe técnico concluye que para el 2006 el bien, según las pruebas de campo, era bosque, que para el año 2000, según la catalogación de Nombre28548 ya era bosque y que por consiguiente en 1998, año del traspaso, tenía necesariamente que ser bosque.
A esta conclusión es fácil arribar en el tanto un bosque no puede crecer en dos años (de 1998 que se segregó el bien al 2000 que lo declaró Nombre28548), y como consiguiente, aunque no exista un documento de evaluación del terreno en 1998 que certificara que en ese momento ya tenía cobertura forestal, es claro por las evaluaciones posteriores y los criterios técnicos que el desarrollo boscoso del terreno de marras es, por razones biológicas, anterior al traspaso del bien. Por las razones expuestas, el inmueble adjudicado a Sermucoop R.L., que fuera parte de la Finca Ganadera Guaycará constituye PNE, y en consecuencia completa los elementos normativo y teleológico para tenerle como bien de dominio público, pues existe una norma que aunque de forma genérica, afecta este bien al uso común y a un fin público de conservación.
En el escrito de contestación de la demanda, la Cooperativa señaló que se oponía a las pretensiones de la parte actora "por estar prescrita la acción (sic). De acuerdo con el artículo 194 (sic) de la Ley General de la Administración Pública, el plazo para alegar la nulidad es de cuatro años, y en nuestro caso han transcurrido más de trece". Esta excepción de prescripción fue reservada por el juez de trámite para el fondo por no ser evidente y manifiesta. Sobre esta, considera el Tribunal que es necesario hacer varias aclaraciones previas a resolver lo que corresponde. En primer lugar confunde el demandado los artículos de la LGAP, pues el artículo que señala un plazo no es el 194 sino el 198, o en todo caso el 175 antes de la reforma acordada por el CPCA. En segundo lugar el plazo que se indica en el 198 LGAP es de prescripción, a los efectos de reclamar la responsabilidad administrativa y no de caducidad, y el del 175 antes de la reforma no es de aplicación, por tratarse de un acto que se tomó después de la entrada en vigencia del CPCA.
Tercero, y tal vez más importante, confunde el actor la prescripción del derecho, con la caducidad de la acción. A criterio de este Tribunal aún y cuando se opone la excepción de prescripción, de los argumentos de la parte claramente se desprende que su interés es indicar que el plazo fatal para proceder a revisar y declarar lesivo el acto de traspaso de la porción de la finca Ganadera Guaycará a su favor ya caducó. En términos generales, la revisión de la caducidad implica al Tribunal determinar cuál es el plazo aplicable, y en qué momento inicia el cómputo del plazo. Sin embargo, a partir de las propias reglas contenidas en el artículo 34 párrafo segundo, que reflejan lo expresado en el artículo 14 de la Ley 7575, no hay plazo de caducidad para las acciones del Estado -lato sensu- tendientes a recuperar la titularidad o alguno de sus atributos, cuanto se refiere a bienes dominiales. Siendo que este Tribunal, por las razones expuestas en el párrafo anterior, considera que el bien objeto de este proceso es efectivamente un bien de dominio público, ha de rechazarse la excepción de prescripción opuesta por la Cooperativa, que el Tribunal ha entendido como de caducidad, en el tanto frente a los bienes de dominio público no es oponible plazo alguno, en virtud de la naturaleza imprescriptible de los bienes sujetos a este régimen de Derecho Público.
Rechazada la excepción planteada y determinado que estamos frente a un bien de dominio público, procede este despacho a revisar la nulidad del acuerdo del IDA que transfirió la titularidad del bien en cuestión.
En el mismo sentido que ya había resuelto esta sección en la sentencia número 2166-2010, de las 10:16 horas del 7 de junio, debe señalarse que el solo hecho de que el inmueble objeto de este proceso constituya PNE, así como el carácter demanial que en consecuencia le caracteriza, vicia de nulidad absoluta todas las conductas administrativas formales y actuaciones mediante las cuales se permitió el traspaso de esa propiedad a Sermucoop R.L. Ello toda vez que al tratarse de un bien de dominio público, estaba fuera del comercio del ser humano y existía prohibición legal para enajenar su dominio o constituir derechos reales sobre él. Por su misma naturaleza, no podía ser objeto de apropiación privada ni alegar la existencia de derechos de posesión sobre él. El acuerdo número XIV de la sesión número 037-98, del 6 de mayo de 1998, en el que la Junta Directiva del IDA acordó por unanimidad segregar, adjudicar y traspasar 150 hectáreas (que después mediante el plano se determinó que en realidad eran poco más de 68 hectáreas) de la Finca Nombre141768 a Sermucoop R.L., es absolutamente nulo, en los términos del artículo 166 LGAP, en tanto hay ausencia total de elementos básicos para su constitución.
Por un lado, hay una ausencia total de los componentes de hecho y derecho del motivo del acto, en tanto se dispone de un bien demanial como si no lo fuera, lo cual está expresamente prohibido por la Ley 7575. Esta misma Ley (artículo 15) establece la obligatoriedad de consultar al Minaet, previo a cualquier disposición sobre bienes cubiertos de bosque, para que este haga su debida catalogación. La ausencia de esta valoración previa vicia de nulidad absoluta el motivo del acto, en tanto sólo contando con una declaración del Minaet de que el bien no es PNE, puede procederse a la disposición del bien. En este caso, la Administración del IDA aprobó la segregación con base en una recomendación técnica del propio instituto, sin recabar el criterio del administrador, por mandato legal, del PNE. Véase que cuando al iniciar el procedimiento administrativo para la anulación del acto en cuestión, el órgano director consultó al Minaet, este en forma categórica indicó que el bien en cuestión era de bosque y debía de ser considerado PNE en los términos ya descritos por la Ley 7575.
En todo caso, el acto cuya anulación se solicita es absolutamente ayuno de las razones por las que se dicta, omitiendo cualquier consideración sobre la legalidad de esta actuación, así como el análisis del marco jurídico que facultaba a la institución a dictar el acto de disposición del bien, lo que constituye, también un vicio total en la motivación del acto (artículos 134 y 136 LGAP). La ausencia total del motivo (artículo 133 LGAP), y de motivación, conlleva también a que el contenido del acto (numeral 132 ídem) sea abiertamente ilícito, pues resulta contrario a los fines legales dispuestos por la Ley Forestal para la conservación de los terrenos de titularidad pública con cobertura boscosa. Por las razones expuestas tanto en este considerando como en el anterior, debe declararse la nulidad absoluta del acuerdo de la Junta Directiva del IDA número XIV de la sesión número 037-98, del 6 de mayo de 1998, únicamente en lo que se refiere a la titulación de una porción de la Finca Ganadera Guaycará a Nombre142864 .
En virtud de que los vicios que se han declarado generan la invalidez absoluta de la titulación realizada por el IDA en favor de la demandada Nombre142864 ., estima este Tribunal que también, y por conexidad, resultaba inválido el otorgamiento de la escritura pública otorgada ante el notario Julio Sánchez Carvajal, número 16, tomo 38, autorizada a las 11:45 horas del 19 de mayo de 1998, en el apartado en que formalizó y protocolizó el traspaso de la finca Ganadera Guaycará a nombre de Nombre142864 ., por el solo hecho de estar en presencia de un bien de dominio público. Deberá comunicarse al Archivo Nacional la anulación del instrumento notarial referido, a efectos de la anotación marginal en la matriz del protocolo respectivo. Ahora bien, habiéndose declarado la invalidez de la conducta formal del IDA que se declaró lesiva, conforme lo exige el numeral 200 LGAP, procede determinar si la ilegalidad declarada es manifiesta o no. Estima este órgano jurisdiccional que sí lo es.
Lo anterior por varias razones. Debe partirse de que para el momento en que se llevó a cabo esta titulación, ya se encontraba vigente la Ley Forestal, la que, como se ha dicho establecía la incorporación inmediata al PNE de todos aquellos terrenos cubiertos de bosque, su inalienabilidad y la imposibilidad de que fueran traspasados a terceros. Conforme ha sido expuesto, de previo y durante el procedimiento de titulación que nos ocupa existía posibilidad técnica suficiente que permitía al IDA establecer la naturaleza boscosa del terreno. Una actuación diligente y ajustada a Derecho por parte de la institución actora al valorar esa circunstancia hubiera impedido el traslado de ese bien demanial al dominio privado, y evitado el consecuente menoscabo al PNE. Actuaciones de este tipo resultan contrarias al ordenamiento jurídico y son reprochables. Es por ello que, de conformidad con los artículos 192, 199, 200, 210, 211 y 213 LGAP, deberá el jerarca del IDA iniciar de manera inmediata los procedimientos internos de mérito a fin de establecer la responsabilidad pecuniaria o disciplinaria de los funcionarios que participaron en las acciones u omisiones que llevaron a actuaciones contrarias a legalidad en la titulación referida.
Sobre lo actuado, deberá rendir informe a este Tribunal en el plazo de tres meses contados a partir de la firmeza de esta sentencia. Finalmente, cabe señalar que las nulidades que aquí se declaran lo son sin perjuicio de la eventual responsabilidad pública, siendo que quienes se vean afectados por éstas, pueden acudir a la vía jurisdiccional que corresponda para demostrar la responsabilidad patrimonial del Estado o del IDA en este caso , cuando así corresponda.
X.LAS ACCIONES DE TRASPASO DEL INMUEBLE OBJETO DEL PROCESO A FAVOR DEL ESTADO Y LOS TRÁMITES DE INSCRIPCIÓN EN EL REGISTRO NACIONAL. Habiéndose declarado el inmueble objeto de este proceso como Patrimonio Natural del Estado, conforme al artículo 13 de la Ley Forestal debe el IDA adoptar de inmediato todas las medidas necesarias, tendientes a que el inmueble sea inscrito como corresponde, a nombre del Estado. Conforme a la norma citada, corresponde a la Procuraduría General de la República, por medio de la Notaría del Estado, confeccionar la escritura de traspaso, con su respectivo cambio de naturaleza, y hacer las gestiones pertinentes para inscribir esa escritura en el Registro Público de la Propiedad Inmueble. Asimismo, en atención al deber genérico que, en lo referente a la tutela del ambiente, impone el Ordenamiento Jurídico al Estado, estima este Tribunal que es el éste, por medio del Minaet y Sinac quien tiene la obligación de identificar el inmueble objeto de este proceso como PNE.
En consecuencia, se ordena comunicar esta resolución a la Procuraduría General de la República, para que por medio de la Notaría del Estado, confeccione a la mayor brevedad la escritura de traspaso, con su respectivo cambio de naturaleza y realizar las gestiones pertinentes para inscribir la propiedad descrita en el plano catastrado P-796176-2002, si este efectivamente corresponde a la realidad de la propiedad en cuestión, a nombre del Estado en el Registro Público de la Propiedad Inmueble. Además, deberá la cooperativa demandada poner en posesión de esa finca al Minaet.
El demandado opuso en su contestación de la demanda, las defensas de incompetencia, litis consorcio pasivo necesario incompleto y prescripción. La incompetencia fue rechazada por el juez de trámite en la resolución número 2176-2011, de las 10:15 horas del 20 de diciembre de 2011. La de indebida integración de la litis, en auto de las 10:39 horas del 17 de enero de 2012, y la de prescripción, reconducida por este Tribunal como excepción de caducidad, en los términos arriba expuestos, se rechaza por tratarse de un bien dominial, para cuya recuperación no es oponible plazo alguno.
El artículo 193 del Código Procesal Contencioso Administrativo establece que las costas procesales y personales se imponen al vencido por el solo hecho de serlo, pronunciamiento que debe hacerse incluso de oficio, al tenor del numeral 119.2 ibídem. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, es criterio del despacho no se ha fallado con base en pruebas desconocidas para la parte demandada al momento de iniciar el proceso, pero que sí existía motivo suficiente para litigar, en tanto la parte demandada sustenta su defensa en la existencia de un acto administrativo que le otorgó derechos, al amparo del principio de confianza legítima, por lo que lo correspondiente es dictar esta sentencia sin especial condena en costas.
POR TANTO
Se acogen las medidas cautelares incoadas por el IDA en el presente asunto, las cuales se mantendrán vigentes hasta la firmeza de esta sentencia. En consecuencia, se confirma la anotación de la demanda sobre la finca del partido de Puntarenas matrícula Placa28104 y se ordena a Sermucoop R.L. abstenerse de realizar cualquier conducta (por acción u omisión) que pueda ir en menoscabo del ecosistema existente en la finca en cuestión. Se rechaza la excepción de prescripción, reconducida por el Tribunal como excepción de caducidad, opuesta por la representación de la Sermucoop S.A. Se declara con lugar en todos sus extremos la demanda presentada por Nombre81703 , en representación del INSTITUTO DE DESARROLO AGRARIO, contra la COOPERATIVA DE SERVICIOS MÚLTIPLES COOPERATIVOS COTO 63 R.L. En consecuencia:
