WHEREAS:
I- In interlocutory judgment (autosentencia) 133-2013 dated 19 de noviembre del 2013, the trial judge recused herself (se declaró inhibida) from hearing this matter to prevent future nullities, given the position expressed by the Sala Primera in decision 959-2013, although she considered that she had subject-matter jurisdiction (competencia material) to hear it. This was because the matter involves land alleged to form part of the State’s natural heritage (patrimonio natural del Estado), as it lies within Parque Nacional Tortuguero (see pages 1998 and 1999).
II.Agricultural jurisdiction (competencia agraria) by subject matter is defined generally in Articles 1 and 2, subsection h), of the Ley de Jurisdicción Agraria. Those provisions authorize judges in this field to adjudicate or resolve disputes relating to the conduct of agricultural or agro-environmental activities (actividades agrarias o agroambientales), or activities connected with them. Agricultural property (fundo agrario) is understood to mean property devoted to such activities or capable of being devoted to them. For the latter situation, it is important to consider the size and location of the land and the type of production that can be carried out on it. The foregoing criteria must also be adapted to the needs and requirements arising from modern technologies and scientific advances in agricultural development. For example, land that previously could not be devoted to agricultural activities—because of its size or the prevailing climate in the area—may now be so devoted if hydroponic agriculture or other technologies are used in which the “land or soil” substrate is not essential.
Furthermore, the fact that land forms part of the State’s natural heritage does not prevent any judge from reviewing and applying the rules that protect it, nor is there any rule specifying that only the administrative litigation jurisdiction (Jurisdicción contenciosa administrativa) may do so. This is because environmental protection and the safeguarding of the constitutional right to a healthy environment (derecho constitucional a un ambiente sano) fall within the jurisdiction of every court, regardless of subject matter, because this is a fundamental right (Articles 50 and 69 of the Constitución Política). Moreover, environmental law is specifically characterized by its cross-cutting and multidisciplinary nature, which means not only that various disciplines are related to or influence one another in achieving effective environmental protection, but also that environmental law affects several different branches of law.
For that reason, it would be unconstitutional to interpret the law as meaning that only the Jurisdicción Contenciosa Administrativa may apply rules safeguarding the environment and protecting collective interests (intereses colectivos), or to consider it the only jurisdiction authorized to protect the assets comprising the environment. Accordingly, to determine subject-matter jurisdiction in cases such as this one, consideration and analysis must encompass not only the nature of the assets involved, whether public or private—an issue that must also be resolved or determined when adjudicating the merits (fondo del asunto), given that the record shows the land remains registered in the name of a private person—but also the other claims, based on the causes of action asserted by the parties. This follows from Article 108 of the Ley de Biodiversidad.-
III.As detailed by the court below, the complaint seeks a declaration that a de facto partnership (sociedad de hecho) existed between the plaintiff and a private defendant for the purpose of developing a tourist complex called Garza Tigre on land located at [Dirección1], [Dirección2], Limón, registration number [Placa1]. The counterclaim requests that the counterclaim defendants be ordered to subdivide (segregar) and contribute to Corporación Turística Garza Tigre S.A. three hectares of land forming part of the aforementioned parent property (finca madre). These claims and causes of action, by virtue of the nature of the assets involved, may and must be resolved by the agricultural courts, which are also required to apply environmental regulations when warranted. Accordingly, because the ruling of the trial judge was improper, the jurisdictional declination (inhibitoria) ordered must be rejected. This matter is declared to fall within the jurisdiction of the Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, seated in Guápiles, to which the case file must be returned for proper processing once this decision becomes final.

VOTO N° 019-C-2014 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las quince horas y cuarenta minutos del diez de enero de dos mil catorce.- PROCESO ORDINARIO establecido por SUEÑO TROPICAL DEL CARIBE SOCIEDAD ANÓNIMA, cédula jurídica CED1 , representado por su presidente [Nombre1] , mayor, casado, contador, vecino de Limón, cédula de identidad CED2 , contra [Nombre2] , mayor, casado, técnico en electrónica, de nacionalidad española, vecino de Heredia, pasaporte número CED3 . CONSIDERANDO:
I- En autosentencia 133-2013 del 19 de noviembre del 2013, la persona juzgadora se declaró inhibida para conocer de este asunto para evitar futuras nulidades, dado el criterio expuesto por la Sala Primera, en voto 959-2013, aunque consideraba que tenía competencia material para tramitarlo. Lo anterior por estar de por medio un terreno que se afirma forma parte del patrimonio natural del Estado, al estar inmerso en el Parque Nacional Tortuguero (ver folios 1998 y 1999).
II.La competencia agraria por razón de la materia está definida genéricamente en los artículos 1 y 2 inciso h) de la Ley de Jurisdicción Agraria. Dichas normas facultan a los jueces y a las juezas de esta disciplina para dirimir o resolver los conflictos relacionados con el ejercicio de actividades agrarias o agroambientales, o conexas a éstas. Se considera fundo agrario aquél destinado a dichas actividades, o que pueda destinarse a ellas. Para éste último supuesto, es importante tomar en cuenta la medida, la ubicación del terreno y el tipo de producción que se puede desarrollar en él. Los anteriores criterios deben además ajustarse a las necesidades y requerimientos que las tecnologías modernas y avances científicos planteen en materia de desarrollo agropecuario. Por ejemplo, terrenos que antes no podían destinarse a actividades agrarias -por su tamaño o el clima imperante en la zona-, actualmente pueden serlo, si se desarrolla agricultura hidropónica o con otras tecnologías, en las cuales el sustrato "tierra o suelo" no es fundamental.
Por otro lado, el que un terreno forme parte del patrimonio natural del Estado, no imposibilita que toda persona juzgadora pueda y esté facultada para revisar y aplicar la normativa que lo tutela, sin que exista normativa que especifique que solo la Jurisdicción contenciosa administrativa lo pueda hacer. Lo anterior por cuanto la protección del ambiente y la tutela del derecho constitucional a un ambiente sano es competencia de toda tribunal jurisdiccional, independientemente de la materia, por tratarse de un derecho fundamental (artículos 50 y 69 de la Constitución Política). Además, la materia ambiental precisamente se caracteriza por su transversalidad y multidisciplinariedad, que implica no solo el que varias disciplinas se relacionan o influyen entre sí para lograr una tutela efectiva del ambiente, sino también el que aquella incide en varias y diversas ramas jurídicas. Por ese motivo, resultaría inconstitucional interpretar que únicamente la Jurisdicción Contenciosa Administrativa es la que podría aplicar normativa para la tutela del ambiente y la protección de intereses colectivos, así como el considerar que serían la única facultada para tutelar los bienes que componen el ambiente.
Por ende, para definir la competencia material en casos como el presente, debe analizarse y tomarse en cuenta no solo la naturaleza de los bienes involucrados (público o privado) -aspecto además que deberá ser resuelto o determinado al analizarse el fondo del asunto, dado que el terreno, según consta en autos, aún se encuentra inscrito a nombre de una persona privada-; también deben valorarse las otras pretensiones, en función de las acciones planteadas por las partes. Lo anterior, con base en lo dispuesto por el artículo 108 de la Ley de Biodiversidad.-
III.En la demanda se pide, como lo desglosa el a quo, se declare la existencia de una sociedad de hecho entre el actor y una persona demandada privada, cuyo objeto era el desarrollo de un complejo turístico denominado Garza Tigre, en un terreno ubicado en [Dirección1] , de [Dirección2] , Limón, matrícula [Placa1]. En la contrademanda se pide se obligue a los reconvenidos a segregar y aportar a la sociedad Corporación Turística Garza Tigre S.A., tres hectáreas de terreno que forman parte de la finca madre referida. Se trata de pretensiones y acciones que por la naturaleza de los bienes implicados pueden y deben ser resueltas por tribunales agrarios, quienes además están obligados a aplicar la normativa ambiental en los casos que lo ameriten. Por ende, al ser improcedente lo dispuesto por la persona juzgadora de primera instancia, debe improbarse la inhibitoria decretada. Se declara este asunto compete tramitarlo al Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, con sede en Guápiles, al cual debe devolverse el expediente para su debido trámite, una vez firme esta resolución.
