APPEAL filed in the present proceeding against [Nombre1]., […], for the offense of VIOLATION OF THE LEY FORESTAL AND ANOTHER OFFENSE, to the detriment of NATURAL RESOURCES AND [Nombre2]. Judges Yadira Godínez Segura, Alberto Alpízar Chaves, and David Fallas Redondo participated in deciding the appeal. The representatives of the Ministerio Público, attorneys [Nombre3] and [Nombre4], and attorney [Nombre5], acting as privately retained defense counsel for the accused [Nombre1], appeared in the appeal from the judgment.
PROCEDURAL BACKGROUND:
Judgment drafted by Appellate Judge [Nombre7]; and,
WHEREAS:
I.In a written submission filed on 28 de febrero de 2012, attorney [Nombre3], prosecutor for San Carlos, appealed oral judgment number 47-2012, issued at 15:30 hours on 7 de febrero de 2012 by the Tribunal del II Circuito Judicial de Alajuela, which acquitted the defendant [Nombre1]. of the offenses of Violation of the Ley Forestal and Aggravated Theft. The appellant asserts one procedural ground and one ground concerning the application of substantive law; therefore, to address those grounds more effectively, the analysis begins with the latter.
II.In the second ground for appeal, she alleges the erroneous application of substantive law due to failure to observe Article 61(a) of the Ley Forestal. The appellant transcribes the aforementioned article, which she claims was erroneously interpreted. According to the judgment, there is no doubt that the acts were carried out in pastureland, on private property, and that the conduct therefore does not constitute an offense, because for the offense to exist, the felling must occur in a forested area; the judgment further bases its position on decisions 359-04 of the Criminal Cassation Court and 663-98 of the Criminal Cassation Court of the Second Circuit (sic). The complainant considers that interpretation erroneous because the Ley Forestal provides for offenses involving exploitation (aprovechamiento) on both state-owned and private land, not necessarily in forests, as the Court asserts. In support of her position, she cites the Manual de Delitos Ambientales by [Nombre8]. and decision 1505-2010 of the Criminal Cassation Court of the Second Judicial Circuit of San José.
She requests that the claim be granted and that the case be remanded. The claim is granted. As may be seen in the audiovisual recording containing the oral judgment issued in this matter, the trial judge, in addition to concluding that there was reasonable doubt regarding the defendant’s participation in the acts attributed to him—which will be examined in another recital (considerando)—also held that the acts did not constitute an offense. Thus, beginning at timestamp 16:57:54 hours, the judge stated as follows: “Clearly, such timber harvesting (aprovechamiento maderable) has been understood to mean that the act of cutting and removing trees must occur in a forested area and not on pastureland, and to that extent the Court considers that it does not constitute an offense… this Court considers that the act would not constitute an offense because, as established by our case law, I rely on decision 359-2004 of the Criminal Cassation Court of the Second Judicial Circuit of San José... which refers to decision 663-1998.” Decision 359-2004—to which the a quo refers—is based entirely on decision 682-F-97; that decision, together with decision 663-98, all issued by the Cassation Court of the Second Judicial Circuit of San José, fully adopted the reasoning set out in the aforementioned decision 682-F-97, which determined, in summary, that the term “forestry” included in Article 61(a) of the Ley Forestal must be restricted—according to the definition of the term in the Diccionario Vox General Ilustrado de la Lengua Española—to the definition “relating to forests and their exploitation.” That decision further held that, although the Diccionario de la Lengua Española of the Real Academia Española also defines “forestry” as “relating to forests and the exploitation of firewood, pasture, etc.,” according to the authors of that judgment: “the term ‘forest’ must be regarded as the fundamental term, and the reference to ‘the exploitation of firewood, pasture, etc.’ means the exploitation of the forest.” As a consequence of that interpretation, there is no legal prohibition against cutting trees on land that is not forested and is not used for agricultural or livestock purposes.
This descriptive interpretation of the objective elements of the offense (elementos objetivos del tipo) contained in Article 161 of the Ley Forestal is not shared by this Court of Appeal for Criminal Judgments. The view that “forestry” is synonymous with “forest” finds no support in Costa Rican law. The differences in the definitions or conceptualizations of the term “forestry” found in various Spanish-language dictionaries demonstrate that there is no single meaning of that word and that it likewise cannot be narrowed to such an extent that it is associated solely with the idea of a forest. Rather, it points toward an interpretation of the term in connection with several related concepts, including “forest,” “firewood,” and “pasture,” without those definitions—through the word “etc.”—producing a strict definition of that concept; instead, the concept is broad, encompassing everything from pasture to forests.
The foregoing—it bears repeating—makes it impossible to associate the word “forestry” exclusively with the concept of a forest. Thus, the definition historically and culturally given to the term “forestry” involves a broad concept encompassing numerous possibilities, such as the exploitation of trees, timber, medicinal herbs, ornamental plants, and seeds, among others; likewise, for example, maintenance of the hydrological cycle and ecotourism are also forest products. Thus far, we can see the polysemy of the word “forestry” in ordinary language. Furthermore, it must be clear that what matters in this case is the legal meaning of “forest products” (productos forestales). In light of the foregoing concerning the ordinary meaning of the word “forestry,” the concept of “forest products” contained in the statutory offense definition (tipo penal) set forth in Article 61 of the Ley Forestal cannot be confined solely to the concept of a forest, not only because the Spanish dictionary’s own definition does not do so, but also because the contents of the Ley Forestal at issue provide numerous indications that this element of the offense is normative in nature.
Through its various articles, the law itself clearly establishes that the term “forestry”—which was also used in the law’s title—does not refer exclusively to forests; rather, as indicated, it addresses forestry in a broad sense, concerning natural resources related to timber, its products, and the other elements operating within that ecosystem, which are regulated by this Law. In this respect, this Court agrees with decision [Telf1] of 11:15 hours on 23 de diciembre de 2010, issued by the Criminal Cassation Court of the Second Judicial Circuit of San José, which specifically adopted a position contrary to the case law invoked by the trial judge in the present matter and which led her to conclude that the defendant’s conduct did not constitute an offense. At this point, it should be recalled that determining the scope of the statutory offense set forth in Article 61 of the Ley Forestal (Nº 7575) requires determining what is meant by forest products.
That determination must be made in light of the provisions of that law. It should therefore be noted that this can be accomplished by interpreting that legal framework in light of Article 10 of the Civil Code, which provides: “Rules shall be interpreted according to the ordinary meaning of their words, in relation to their context, historical and legislative background, and the social circumstances prevailing when they are to be applied, with primary regard for their spirit and purpose.” It should be noted that no analogical interpretation (interpretación analógica) is being advocated—which is described in Article 12 of the Civil Code and prohibited by Article 2 of the Criminal Code for the purpose of establishing conduct constituting a criminal offense—but rather a systematic interpretation (interpretación sistemática) of the Ley Forestal to establish what that legal framework—which, it bears recalling, is statutory in rank—means by forest products, a concept that is determinative of the conduct constituting the offense set forth in Article 61 of the aforementioned law.
To conduct that interpretive exercise—the systematic one—it is permissible to consult other provisions of the same legislation (Nº 7575) in order to understand the scope of the concept under discussion. Proceeding in this manner reveals that the legislature understands forest products to include objects that are not forests; that is, the former concept is not limited to the latter. In this regard, it should be noted that Article 1 of the Ley Forestal states that its objective is as follows: “This law establishes, as an essential and priority function of the State, the duty to ensure the conservation, protection, and administration of natural forests, and the production, exploitation, industrialization, and promotion of the country’s forest resources intended for that purpose, in accordance with the principle of the proper and sustainable use of renewable natural resources. It shall also ensure the creation of employment and the improvement of the standard of living of the rural population through its effective incorporation into silvicultural activities.
In view of the public interest, and except as provided in Article 18 of this law, the cutting or exploitation of forests in national parks, biological reserves, mangroves, protected zones, wildlife refuges, and state-owned forest reserves is prohibited” (emphasis added). That article, among others, supports the systematic and normative interpretation advanced here in relation to Article 61 of the Ley Forestal, because it draws a clear separation and distinction between the terms “forests” and “forest resources,” and even refers to the protection of forests in forest reserves. In addition, the following must be considered from the contents of the Ley Forestal: i) Article 3 of that Law provides a definition of the term “forest”—whose unconstitutionality due to relative omission has already been declared by the Constitutional Chamber in decision 3923-2007—a definition that restricted the scope of environmental protection.
Although the Ley Forestal itself contains no definition of the term “forest resource” (recurso forestal), the rules contained in that law—without any need to resort to regulations or other provisions of substatutory rank—make it possible to determine that the term not only extends beyond the concept of a “forest”—because the law itself distinguishes the two—but also that, when the law refers to a “forest resource,” that concept transcends the concept of a forest and includes, in addition to forests, other products not necessarily derived from a forest. ii) Article 3 itself begins with the definition of “timber harvesting,” specifically stating that such exploitation—the cutting or removal of standing trees or use of fallen trees—is to take place on “private land” not included in Article 1 of that Law, because Article 1 prohibits the cutting or exploitation of forests in national parks, biological reserves, mangroves, protected zones, wildlife refuges, and state-owned forest reserves (that is, on publicly owned land).
That statutory definition of the concept of “timber harvesting” would be meaningless unless it expressly regulated state control over the cutting or removal of trees on private land—which is not required to contain a forest—because, had the law intended otherwise, it would have used the same specific description of a “forest” on private land as was used in the aforementioned Article 1, which expressly prohibits the cutting or exploitation of “forests” on state-owned land. iii) Another definition provided by Article 3 is that of “land suitable for forestry” (terrenos de aptitud forestal), which includes land falling within the classes established by the official methodology for determining land-use capability. Had the legislature considered “forestry” to mean “forest,” such land would then have to be understood as land suitable for forests, without permitting any other classification. The same analysis could be applied to the definitions of “forest management” (manejo forestal), “forest plantation” (plantación forestal), “forest regime” (régimen forestal), and the other terms incorporating that word and contained therein, all of which provide numerous grounds for understanding that the law speaks generally of elements related to the concept of forestry and not exclusively of forests. iv) Even setting those definitions aside, the Ley Forestal itself clearly distinguishes between its use of the concept of forestry—in the legal sense already explained—and its specific references to the concept of a forest.
Thus, it may be observed that Article 6 grants the State Forestry Administration (Administración Forestal del Estado) various oversight and management powers related to forests and forest resources (recursos forestales), in both state-owned and private areas, demonstrating that the latter are broader than the former. v) Another distinction drawn by the law regarding forests and forestry matters appears in Article 13, which specifically provides that the natural heritage of the Costa Rican State (patrimonio natural del Estado costarricense) consists of “the forests and forest lands (terrenos forestales) of national reserves, areas declared inalienable, properties registered in its name, and those belonging to municipalities, autonomous institutions, and other Public Administration bodies...” From this, it may validly be inferred that, in addition to forests—expressly defined by Article 3 of the same law—there are other forest resources that logically form part of the natural heritage of the State and are regulated by the Ley Forestal.
The protection of those resources is addressed in Articles 33 to 35, which prohibit the felling or removal of trees in areas other than forests—such as permanent springs (nacientes permanentes), riverbanks, the banks of ravines or streams, the shores of state-owned natural or artificial lakes and reservoirs, recharge areas, and spring aquifers—and also declare actions to prevent and extinguish forest fires to be in the public interest, without identifying specific areas to be protected, such as forests. Through these provisions, the law ultimately seeks to regulate all forestry-related matters, not forests in particular. Likewise, the Ley Forestal regulates matters related to privately owned forests and forest products (productos forestales). In this regard, provisions concerning management plans (planes de manejo) for private forests and incentives for their conservation are set forth beginning with Articles 19 to 26 of the cited Law.
Article 27, for its part, establishes a limitation on the felling of trees on “land used for agriculture or livestock and without forest,” where those provisions clearly establish that the felling of more than 10 trees per property requires authorization from the State Forestry Administration. It is important to pause here to analyze whether the conduct under examination satisfies the statutory elements of the offense (tipicidad), since there is not even any need to interpret the legislature’s intent in establishing quantitative limits on the felling of trees on land “without forest,” which, a contrario sensu to Article 3, subsection d), consists of all land that does not meet the legal definition established therein—that is, a “Native or indigenous ecosystem, whether disturbed or not, regenerated through natural succession or other forestry techniques, occupying an area of two or more hectares, characterized by the presence of mature trees of different ages, species, and varying sizes, with one or more canopies covering more than seventy percent of that area and containing more than sixty trees per hectare with a diameter of fifteen or more centimeters measured at breast height.” Accordingly, it may be said that the land on which the tree felling at issue in this matter is being investigated, which is a pasture area, does not fall within that definition.
The restriction contained in Article 27 of the Ley Forestal has its corresponding penalty in Article 61 of the same Law, which provides: “A prison sentence of one month to three years shall be imposed on anyone who: a) Harvests one or more forest products on private property without a permit from the State Forestry Administration, or who, despite having a permit, fails to comply with its authorization. b) Acquires or processes forest products without meeting the requirements established in this law. c) Engages in activities involving a change in land use (cambio en el uso de la tierra), contrary to the provisions of Article 19 of this law. In the foregoing cases, the products shall be seized and placed at the disposal of the competent judicial authority. d) Removes forest products from private or State property or transports forest products obtained in that manner” (emphasis added). A reading of the provision shows that, with the exception of subsection c), which refers to Article 19—where matters concerning forests are expressly regulated—in all other subsections the legislature referred to “forest products,” a distinction that would be entirely meaningless if forest product had been legally regulated as synonymous with forest.
In fact, the entire body of law comprising the Ley Forestal is consistent with the analysis conducted thus far and unequivocally indicates that the concept of forestry embraced by the law, which forms part of the descriptive elements of the criminal offenses through which conduct contrary to the purposes of that law is punished, is a concept that must not be confused with that of forest. Thus, as has been analyzed based on the literal wording of the law, the term forestry as established therein also encompasses trees, whose existence does not necessarily depend upon the existence of a forest; consequently, it is impossible to disregard them, not only because the law does not do so, but also because—with the deficiencies already identified by the Sala Constitucional regarding the application of the precautionary principle (principio precautorio)—the Ley Forestal provides legal mechanisms for adjudicating and punishing actions contrary to it.
Nevertheless, it cannot be overlooked that, through the current Ley Forestal, the legislature indeed severely restricted the concept of forest, thereby impairing the protection that must be afforded to all natural resources that provide people with a healthy environment and that Article 50 of the Constitución Política recognizes as a human right. The Sala Constitucional explained this in the previously cited decision [Telf2], in which it stated the following: “Forests. Irrespective of the concept set forth in the current Ley Forestal, broader concepts of forest may be conceived as a matter of legal scholarship. For example, a forest is a place populated by trees and shrubs, generally in dense growth. Broadening the concept, it may also be stated that ‘a forest is any area of land on which plant communities are growing, predominantly trees of different sizes, whether harvested or not, that are capable of producing timber or other products; they influence the climate and the hydrological regime and also provide protection for wildlife.’ The Procuraduría General also provides us with several definitions in its report: ‘forests are dynamic ecosystems, with continuous processes of change (growth and deterioration), containing representative and dominant trees.’ They interact with other plants, animals, and microorganisms, as well as with their physical and geographical environment, producing a series of complex interactions among biotic and abiotic elements known as ecological functions, such as hydrological regulation, nutrient cycling, energy flow, and climate regulation.
Others distinguish between primary forest and secondary forest. The former, regarded as virgin or climax forests, are characterized by an abundance of mature trees that have not been altered by human activities; according to data provided by the Procuraduría, 78% of these forests worldwide have already been destroyed. Secondary forests, for their part, contain ecosystems that regenerate naturally over an average period of approximately 15 years following a substantial disturbance: flooding, agricultural burning, forest fires, land clearing, or extensive harvesting. They are characterized by a small number of mature trees, an abundance of fast-growing species, and dense undergrowth of seedlings and herbaceous plants. They are also characterized, on some occasions, by emerging from scrublands or secondary thickets (charrales o tacotales). Indeed, it is extremely important to emphasize that, prior to its amendment by ley No. 7575 of 5 de febrero de 1996, the Ley Forestal had a very broad concept of forest in Article 6: ‘Forests are all plant communities composed predominantly of trees and other woody vegetation.’ Neither that definition nor those cited made any distinction requiring a forest to consist solely of native rather than exotic trees—which may even have regenerated naturally—or requiring it to exceed 2 hectares in area.
Another important aspect to consider is the services provided by forests, which are extremely important for people and for the development of society itself. These include: timber services (use of wood, firewood, posts); non-timber services (medicinal herbs, dyes, ornamental plants, seeds, vines, palms and construction materials, and materials for handicrafts); maintenance of the hydrological cycle (water for human consumption and industrial, commercial, and domestic activities; protection of agriculture; hydroelectric power); microclimate regulation; control of flooding, erosion, sediment, winds, and noise; landscape services (photography, painting, videos, fishing, and tourism); recreation and ecotourism; maintenance of resilience; preservation of ecosystems and biodiversity (research material and scientific tourism); and climate-change mitigation (carbon-dioxide sequestration). Consequently, harm to forests causes serious problems for human beings, since deforestation results in flooding, landslides, water scarcity, sedimentation of rivers, streams, and dams, crop losses, etc. In view of the foregoing, it is clear to the Sala that the Procuraduría is correct in stating that the definition of forest contained in the current Ley Forestal is insufficient and provides inadequate protection for our country’s forests, with the aggravating circumstance that this definition serves as the basis for the remaining definitions of the types of land on which trees may be felled, in some cases subject to regulation and in others even without restriction.
The amendment to this law enacted through ley No. 7575 of 5 de febrero de 1996 was indeed intended to promote and encourage reforestation in our country, for which purpose it sought to exempt the felling of certain types of trees from unnecessary procedures. Notwithstanding the foregoing, this Tribunal considers that, by moving from a broad definition of forest affording greater protective coverage to one so restricted in terms of species and area, the law diminished the protection previously afforded to the environment without any reasonable justification extending beyond the need to reforest and remove administrative obstacles as an incentive for that activity, and without first ensuring that implementation of the activity would not endanger the environment. We must recall that our country has undertaken international commitments to protect the environment, and one of the principles it must safeguard is the aforementioned precautionary principle, under which prevention must anticipate adverse effects and ensure the protection, conservation, and proper management of resources.
Consequently, this guiding principle of prevention is grounded in the need to take and implement all precautionary measures necessary to prevent or contain possible harm to the environment or human health. Thus, where there is a risk of serious or irreversible harm—or uncertainty in that regard—a precautionary measure must be adopted, and the activity concerned may even be postponed.
Undoubtedly, this requires a preventive, active, and vigilant stance on the part of the Administration, since conduct that occurs only afterward and is solely punitive would render ineffective any action intended to protect the environment, because once damage has occurred, it can scarcely be repaired, and its harmful effects may be felt not only nationally but globally. Indeed, prevention is one of the guiding principles of environmental law. Nor does this mean preventing development or halting progress and the economy; rather, an effort must be made to achieve a balance that allows human beings to develop while also enabling them to live in and enjoy that development, to which not only present but also future generations are entitled. The Chamber has stated: “The origins of environmental problems are complex and arise from an interplay of natural and social processes within the socioeconomic development model adopted by the country.
For example, environmental problems arise when the methods used to exploit natural resources cause ecosystem degradation beyond their capacity for regeneration, resulting in harm to broad sectors of the population and generating high environmental and social costs that lead to a deterioration in the quality of life; for the primary objective of using and protecting the environment is precisely to achieve development and evolution favorable to human beings...but even more important is understanding that although human beings have the right to use the environment for their own development, they also have a duty to protect and preserve it for the use of present and future generations. This is not particularly novel, because it is merely the application in this field of the principle of ‘injury,’ already well established in ordinary law, under which the lawful exercise of a right has two essential limits: on the one hand, the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself.” (see judgments 1993-3705 of fifteen hours on 30 de julio de 1993 and 1783-94 of nine hours and fifty-seven minutes on 15 de abril de 1994).
This analysis is not intended to indiscriminately equate the treatment that forests and forest plantations must receive, since ecological and socioeconomic studies may determine, for example, that an area must be designated as a protective forest because of the need to restore the soil or water or to protect species of flora and fauna, just as in some cases the advisable course may be to restore the resource while allowing its forestry use or the renewal of the forest. Thus, what matters is not to establish a total and unreasonable prohibition that prevents the use of resources, but rather to ensure that such use is properly regulated and is preceded, at a minimum, by inspections guaranteeing that native or exotic trees, regardless of the area, are not felled when they perform an essential environmental function in the sector where they were planted or grew naturally.” We consider that restricting the concept of “forest” under the Ley Forestal—which in itself, as the referenced constitutional ruling notes, weakened the protection of natural resources—cannot lead us to interpret the concept of forestry resources as being restricted or reduced to that of forest, or to merge both into a single definition.
First, because, as already explained, the law itself distinguishes between the two concepts—the former through a statutory definition and the latter through a broad regulatory conception—and also because the conduct at issue is statutorily defined and punishable under the same law, through Articles 27 and 61(a). It is important to note that, in the cited decision, the Sala Constitucional also ruled on Article 27 of the Ley Forestal as follows: “Under the challenged Article 27, only a maximum of 3 trees per hectare per year may be cut on land used for agricultural and livestock purposes and without forest, after obtaining authorization from the Consejo Regional Ambiental. If the cutting exceeds 10 trees per property, authorization from the Administración Forestal del Estado shall be required. Thus, this provision authorizes the felling of trees on land used for agricultural and livestock purposes and without forest, which, according to Article 2 of the Reglamento a la Ley Forestal, consists of private properties containing trees not established under an agroforestry system, properties having areas with forest cover (cobertura boscosa) of less than two hectares, or trees located in urban areas.
This Court does not find from the foregoing that Article 50 of the Constitución Política is being violated, because that provision states that the corresponding cutting requires prior authorization from the competent bodies and concerns land used for agricultural and livestock purposes that has no forest, subject also to the limitations established by Articles 33 and 34 of the Ley Forestal... Note that under both articles, felling is not unrestricted but is subject to the conditions of the land and the corresponding permits.” That provision is one of the few statutory limitations on tree cutting in privately owned areas that do not constitute forests; consequently, its legal force requires a determination in each particular case as to whether criminal conduct exists that must be punished under that legal framework. Returning to the case under review, the accused was charged with an offense under Article 61(a) of the Ley Forestal, in the form of illegal logging, and with the offense of Aggravated Theft.
According to the audiovisual recording containing the judgment, beginning at timestamp 15:53:44 hours, First Result stated that the Ministerio Público charged the following facts: “1. On 27 de mayo de 2008, at approximately 12:32 hours, officers of the Fuerza Pública de Los Chiles caught the accused, [Nombre1]., in flagrante delicto, cutting and sawing timber in a pasture area within the property of Mr. [Nombre9]., located in Gallo Pinto de San Jorge de Los Chiles, without permits from the Administración Forestal del Estado; they therefore proceeded to seize the timber that had been felled and sawn on that property and subsequently placed it in the provisional custody of [Nombre2]., with the timber remaining on the aforementioned property. 2. Thus, on 20 de junio de 2008, at approximately 13:00 hours, the Minaet official, [Nombre10]., together with officers of the Fuerza Pública of Los Chiles, conducted an inspection of the property of Mr. [Nombre9]., confirming that the accused herein, [Nombre1]., had felled and sawn thirty-five timber trees of the laurel, cedar, and lagarto species, all in a pasture area, without a permit from the Dirección Forestal del Estado. 3.
According to a certification issued by the Minae office in Los Chiles, the accused herein, [Nombre1]., does not have a permit from the Dirección Forestal del Estado to harvest trees on the property owned by Mr. [Nombre9]. 4. On an unspecified date, but in late mayo de 2008, the accused, [Nombre1]., entered the property of Mr. [Nombre9]., located in Gallo Pinto de San Jorge de Los Chiles, with a truck and, with the assistance of Mr. [Nombre11]. and Mr. [Nombre12]., loaded the aforementioned timber onto that truck, unlawfully appropriating the timber that had been left in the custody of the complainant herein, [Nombre2]..” According to that description of the facts, we are initially dealing with the investigation of an offense involving the cutting, without a permit from the Dirección Forestal del Estado, of 35 laurel, cedar, and lagarto trees in a non-forested area, as well as an offense involving the removal of timber.
Therefore, in accordance with the foregoing discussion concerning whether the conduct under investigation satisfies the statutory elements of the offense (tipicidad)—which, for the reasons also stated, is considered not to violate the principle of legality—there is no legal impediment to trying the accused for the charged acts and determining definitively, through due process, whether or not he bears criminal responsibility for them. In view of the foregoing, the objection is well founded insofar as the judgment erroneously found that the acts did not constitute an offense; accordingly, the reasoning of the judgment is vacated in that respect because it is contrary to law. Having established that no conflict exists between the charged conduct and the principle of legality, we now immediately proceed to assess the next procedural objection.
III.As the first ground, she alleges insufficient legal reasoning (fundamentación jurídica) due to an inadequate, contradictory, and erroneous assessment of the evidence (valoración de la prueba). She states that the judgment fails to specify the reasons why the defendant (imputado) was acquitted and does not thoroughly assess all the evidence submitted by the Ministerio Público. She adds that the Trial Court contradicts itself by assessing the evidence only partially. In the complainant’s view, the felling and use of forest products (tala y aprovechamiento de productos forestales) were indeed established, while the defendant was acquitted because there was no certainty that he was responsible for the alleged acts. She identifies the evidence from which the judgment derived its doubt and states that other accounts, such as that of witness [Nombre13], and the documentary evidence were not assessed; in her view, that evidence establishes that the defendant was responsible for the acts.
She disagrees with the “contracción” [“contraction”] (sic, folios 297 and 298) that the Trial Court found between the testimony of [Nombre14] and [Nombre13], because, in her view, it erroneously interpreted the former’s statement, “when what he actually states is that the property owner’s son said that he would take responsibility for what was happening there and that there was indeed a permit” (verbatim copy, folio 298). She then analyzes the remainder of this witness’s account and explains how she believes the Trial Court should have assessed it together with the testimony of the other witnesses. She adds that the Trial Court does not explain in detail why it finds the evidence credible or not. Likewise, she argues that the Trial Court erred through inadequate reasoning and an erroneous interpretation of the evidence when it acquitted the defendant of removing the timber, on the ground that it had not been established that the timber the defendant loaded onto the truck was the timber placed in the provisional custody (depósito provisional) of [Nombre2], without analyzing the accounts of [Nombre15], [Nombre11], and [Nombre12].
She alleges that the judgment contains “unfounded and disproportionate” arguments (folio 300). As her grievance, she asserts that the judgment is unlawful and arbitrary. The claim is granted. This Chamber finds that the judgment does indeed lack the legal reasoning necessary to validate it, and the scant reasoning that was provided is confusing, contradictory, and insufficient. From minute 15:53:44 through minute 16:32:00, the judge provides an extensive description of the testimony given by all the witnesses and by defendant [Nombre1]. The judgment did not include a section setting forth proven or unproven facts; thus, it is only beginning at minute 16:32:00 that the judge starts presenting what appears to be an evidentiary analysis. However, she engages in a series of unnecessary repetitions in which she informs the defendant of the accusations against him, stating: “That is the first part of what you, Mr. [Nombre1], are accused of...
Subsequently, you also face this trial, and it is alleged that once the Fuerza Pública conducted this inspection together with MINAE officers, it was established that timber trees had in fact been felled on this pastureland property...”; still addressing the defendant, she tells him that he is also accused of removing timber from the custody of [Nombre2]. She adds: “It is on the basis of this accusation that, once the Fiscalía initiated the investigation, it was carried out” (16:34:00 hours). The judge then states that she will assess the evidence in accordance with sound judicial reasoning (sana crítica) and the presumption of innocence (principio de inocencia), and says: “After conducting the corresponding deliberation and analyzing all the witnesses—of whom, incidentally, there were quite a few brought into these adversarial proceedings to prove these acts against you—the Trial Court determines that this judge lacks the absolute certainty required to issue a conviction against you, and this situation is stated for the following reasons: Based on this accusation, it must be clear to you that you are being accused of....” She continues with a discussion of the location, circumstances, and rules invoked by the Fiscalía in support of the accusation, and concludes that there is no doubt that the trees were cut in a pastureland area “because that is what the charging document says.” The foregoing account of the judgment’s reasoning reveals the deficiencies in the evidentiary analysis found throughout the remainder of the judgment.
The witness testimony is repeatedly—and, it may be said, tediously—restated, without any analysis of that testimony. Regarding the defendant’s statement—an account that is repeatedly restated in this section of the judgment—the court a quo states: “Despite those considerations, and notwithstanding that the Trial Court may have heard witnesses here, none of whom, while it is true, was clear as to whether these events occurred specifically in May 2008—some refer to three years ago, less than two years ago, approximately four years ago, approximately five years ago—it must nevertheless be taken into account that this case concerns the cutting and sawing of timber in a pastureland area, as the Fiscalía corrected at the appropriate time... Continuing with the analysis of the testimony, and, uh, beginning with the testimony of witness [Nombre13].” The judge dwells on vague references to the witnesses’ statements and thus fails to analyze the defendant’s account, in which he admitted having instructed others to go and cut trees on the land under investigation and provided other explanations that the Trial Court simply ignored, assigning them no weight whatsoever, despite being required to do so.
The judgment then continues by once again summarizing what witness [Nombre14] said and stating that his account essentially coincides with the work performed by another witness—M.—and contradicts what [Nombre2] said. It adds: “Despite this, this Trial Court finds that these witnesses display no particular reason for coming here to harm you... continuing with the assessment of this evidence [it again repeats what the witnesses said], we find that, based on this evidence, the acts are identified as having occurred in a pastureland area [it insists on repeating the witnesses’ exact words]; the Trial Court finds... that the situation can be clarified insofar as Mr. [Nombre14] likewise stated consistently that the person who was bringing the permit did so, had mentioned that it was inside a vehicle, and that the vehicle was parked on a public road... [it again recounts at length what [Nombre2] said].
Subsequently, regarding the other situation, the witness states that, because of this situation and because the permit held by Mr. [Nombre1] did not match, the Fuerza Pública left the timber in his provisional custody....” The judge then again repeats what [Nombre2] said and adds: “Regarding the first alleged acts... one, two, and three... this witness is likewise very consistent that this timber and these trees were in pastureland and has emphatically stated that it was the accused who later removed the timber. Another witness who has been clear regarding this situation is Mr. [Nombre15].” As is apparent from the foregoing, this manner of delivering the judgment, in addition to being confusing and lacking any genuine comparison of the accounts, makes it impossible to discern clearly what information was provided by the witnesses and what assessment and conclusion were reached by the judge.
In this way, minutes continued to accumulate in a presentation that not only repeatedly recited the testimony received, but also contained no analysis of that testimony capable of supporting the doubt that, according to the judgment, arose from such evidence. Offering only a scant analysis of the evidence, the judgment states: “Based on the assessment of all the testimony, it is taken into account that this is a pastureland area and that the accused (encartado) was placed at the scene, even though he himself stated that he had not been there when the felling occurred. The Trial Court finds the accused’s statement inconsistent on this point and therefore does not find it credible. It does not find it credible, despite the decision being made, insofar as he was placed there by one of the Fuerza Pública officers... Furthermore, he is clear and emphatic in stating that the sound of a chainsaw could be heard and that work was being carried out at that location.” The foregoing would appear to indicate that, for the court a quo, the defendant’s presence at the place where the trees were being cut was established, but the court later states that doubt arose on that point.
Likewise, regarding the acts constituting the offense of theft (hurto), the judgment states that it does not believe the defendant’s account that he was at the site because he was transporting furniture, since the evidence does not indicate that. Nevertheless, it contradictorily concludes that the testimony is insufficient to convict, without explaining why. The judgment also discusses what should be considered “use” (aprovechamiento) of the timber and states: “What must be established in order to verify the use? There has been... doubt insofar as the accused initially states that it was Mr. [Nombre2] who sought him out to perform that cutting; however, the accused tells one of the officers... whose surname is [Nombre13]... that he is responsible for the timber. On the other hand, there is also the report by the officer who testified, and here Mr. [Nombre16] likewise stated in these adversarial proceedings that the person who had identified himself as responsible for this timber was a son of the property owner; indeed, at the end of his testimony he said that it was another brother... a brother of [Nombre2] who had informed him that he was using the timber under an arrangement with this man, referring to the defendant, who had purchased the timber from him... there has been doubt... because...
Mr. [Nombre2] emphatically stated that he merely sold the timber to the defendant and that the latter told him he would take care of the permits... despite these considerations, this Trial Court finds that, in addition to the fact that Mr. [Nombre10] stated that a permit is required to cut trees on pastureland and private property, this Trial Court finds that this conduct does not constitute a criminal offense (atípica) because....” From this point in the oral judgment onward, the judge undertakes to justify, based on the case law already analyzed in Considerando II of this judgment, her position that the acts do not constitute a criminal offense, and states that the purpose of the Ley Forestal is to protect forested areas, which, as stated above, is wholly erroneous. The same erroneous reasoning occurred in connection with the offense of timber theft, regarding which the judgment states that the prosecutor requested six months’ imprisonment as punishment for two forms of conduct and did not separate some of the actions, and therefore “the prosecutor’s request is even more doubtful,” an assertion unsupported by any reasoning; moreover, the scant reasoning provided contains inconsistencies and contradictions that deprive it of validity.
Thus, the judgment states: “There has been no doubt whatsoever that the seized timber... remained in the custody of Mr. [Nombre2].... It is clear to this Trial Court that the accused did load some timber onto his truck... [it also states that there is doubt regarding this point because witness [Nombre11] was not emphatic in substantiating this account]; however, it is important to know more characteristics of the species, for example, or the quantity of this timber that he allegedly loaded into his vehicle....”
Thus, even though the judge states that she has evidence that the defendant (imputado) loaded the timber, she then says that this is insufficient for a conviction (condena)—without explaining why—and, despite referring to considerable evidence to the contrary, she contradictorily concludes that a doubt arises, although that doubt is neither justified nor inferable from the judgment (fallo). Regarding this point, the judgment states: “It cannot be reliably concluded despite the fact that [Nombre11]. said that you loaded that timber that was on don [Nombre9].’s property, and another witness named [Nombre12]. also said that the timber he had helped the defendant transport was at that location. This witness mentions that he believed it was cedar ... although those witnesses do indeed refer to you as the person loading timber, the Court does not find it reliably established that this timber was the same timber that had been placed that day in the provisional custody (depósito provisional) of don [Nombre2].... don [Nombre2].’s brother also mentions you... and one witness states that the timber you took was the timber that had been seized (decomisada)... you were the driver of the vehicle... this Court sets aside the matter of whether or not to find this witness [Nombre15]. credible; however, his account cannot provide direct evidence (prueba directa), as an eyewitness (testigo presencial), or at least yield circumstantial evidence (indicio) leading to only one conclusion.
Why? Because he sees you enter that property to drop off some bales and then states that he sees you leave, with you even driving, and with the timber, and that he knows that this timber was the timber that had been seized. However, how can he tell us that he knows it was the timber that had been seized? This gentleman says that it was not until the following day that he went to see whether or not the timber was there, and that he told his father, his mother, and his little brother that it was not there. Note that the prosecution (fiscalía) charged you with this having occurred at the end of May 2008... that would have been about five days after the timber was placed in custody... even though the witness don [Nombre2]. said it was fifteen days later... it can indeed be logically concluded that you drove the truck through there and that you may have loaded a certain amount of timber onto your truck; however, as has been indicated, it is not clear that this timber was the timber that had been seized.” It would appear that, even though the trial judge (jueza a quo) mentions having heard considerable testimonial evidence (prueba testimonial) identifying the defendant as the person who loaded onto a vehicle the timber that had been placed in [Nombre2].’s custody and that he reported as stolen, she concludes that there is doubt without providing reasons for it.
The judgment also expresses doubts regarding the quantity of timber stolen and speculates—without any evidentiary basis whatsoever—that after the witness [Nombre15]. saw the defendant leave with timber during the nighttime hours, another person could have entered and stolen more timber, and that this was why the defendant was acquitted (absuelto) of all punishment and liability. Moreover, the documentary evidence (prueba documental) was merely mentioned, without any assessment whatsoever. Based on the foregoing, it may be concluded that the judgment fails to comply with Article 363(b) of the Code of Criminal Procedure (Código Procesal Penal), because it lacks a legal basis supporting the decision adopted by the judge and ultimately prevents—due to the scant and contradictory analysis—ascertainment of the evidence-based reasons that led to the defendant’s acquittal. As stated above, the judgment contains no legally grounded evidentiary, factual, and legal analysis (análisis probatorio, fáctico y jurídico) justifying the conclusion of acquittal; the claim is therefore granted, the judgment is vacated in its entirety, and the case is remanded for new proceedings (reenvío para una nueva sustanciación).
POR TANTO:
The appeal against the judgment filed by the prosecution is granted. The challenged judgment is vacated in its entirety, and the case is remanded for new proceedings in accordance with law. NOTICE SHALL BE GIVEN.

RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra [Nombre1]., […], por el delito de INFRACCIÓN A LA LEY FORESTAL Y OTRO en perjuicio de LO RECURSOS NATURALES Y [Nombre2]. Intervienen en la decisión del recurso, los jueces Yadira Godínez Segura, Alberto Alpízar Chaves y David Fallas Redondo. Se apersonan en apelación de sentencia, las representantes del Ministerio Público, las licenciadas [Nombre3] y [Nombre4] y el licenciado [Nombre5] , en condición de defensor particular del encartado [Nombre1].
RESULTANDO:
Redacta la Jueza de Apelación de Sentencia [Nombre7] ; y,
CONSIDERANDO:
I.Por escrito presentado el 28 de febrero de 2012, la licenciada [Nombre3] , fiscal de San Carlos, presentó recurso de apelación contra la sentencia oral número 47-2012 de las 15:30 horas del 7 de febrero de 2012, emitida por el Tribunal del II Circuito Judicial de Alajuela y mediante la cual se absolvió al imputado [Nombre1]. de los delitos de Infracción a la Ley Forestal y Hurto Agravado. La apelante invoca un motivo de forma y otro de aplicación de la ley sustantiva, por lo que para un mejor abordaje de dichos motivos se inicia por el análisis del segundo de ellos.
II.En el segundo motivo alega errónea aplicación de la ley sustantiva por inobservancia del artículo 61 inciso a) de la Ley Forestal. La recurrente transcribe el mencionado artículo sobre el cual se queja de errónea interpretación. Según el fallo, no hay duda de que los hechos fueron realizados en área de potrero, en propiedad privada y por eso la acción es atípica, porque para que exista el delito la tala debe darse en área de bosque y además la sentencia fundamenta su posición en votos 359-04 del Tribunal de Casación Penal y 663-98 del Tribunal de Casación Penal del II Circuito (sic). La quejosa considera errónea esa interpretación, porque la Ley Forestal prevé delitos tanto por aprovechamiento en terrenos estatales como privados, no necesariamente en bosques, como afirma el Tribunal. En apoyo a su posición cita el Manual de Delitos Ambientales de [Nombre8]. y la resolución 1505-2010 del Tribunal de Casación Penal del Segundo Circuito Judicial de San José.
Solicita se acoja el reclamo y se ordene el reenvío del caso. Con lugar el reclamo. Según se aprecia en el archivo audiovisual que contiene la sentencia oral emitida en el presente asunto, la juzgadora además de concluir en un juicio de duda sobre la participación del imputado en los hechos que se le atribuyeron, -lo que será objeto de examen en otro considerando- también sostuvo que los hechos resultan atípicos. Así, a partir del contador 16:57:54 horas, la jueza señaló lo siguiente: "Evidentemente que ese aprovechamiento maderable se ha entendido que la acción de corta y eliminación de árboles debe darse en zona boscosa y no en terrenos de potreros y en ese tanto considera el Tribunal que resulta atípico… considera este Tribunal que la acción resultaría atípica, porque tal y como ha establecido nuestra jurisprudencia, hago uso de los votos 359-2004 Tribunal Casación Penal II Circuito Judicial de San José... que hace referencia al Voto 663-1998".
El voto 359-2004 -al que alude la a quo- se apoya íntegramente en el voto 682-F-97, mismos que junto al voto 663-98, todos del Tribunal de Casación del II Circuito Judicial de San José, adoptaron en un todo el contenido que expone el mencionado voto 682-F-97 y en el que, en resumen, se determinó que el término “forestal” incluido en el artículo 61 inciso a) de la Ley Forestal, debe restringirse –según la definición del término en el Diccionario Vox General Ilustrado de la Lengua Española- a la definición de “relativo a los bosques y su aprovechamiento”. Se consideró además en dicho fallo que si bien el Diccionario de la Lengua Española de la Real Academia Española, también define “forestal” como “relativo a los bosques y a los aprovechamientos de leñas, pastos, etc.”, según expusieron los redactores de tal sentencia: “el término “bosque” debe estimarse como el fundamental y lo concerniente a los “aprovechamientos de leñas, pastos, etc.”, hace mención al aprovechamiento del bosque”.
Como consecuencia de tal interpretación, en los terrenos sin bosque y que no sean de uso agropecuario, no hay prohibición legal para cortar árboles. Dicha tesis de interpretación descriptiva de los elementos objetivos del tipo contenid os en el artículo 161 de la Ley Forestal, no es compartida por este Tribunal de Apelación de Sentencia. Considerar que forestal es sinónimo de bosque no encuentra sustento en la normativa costarricense. Las diferencias en la definición o conceptualización del término “forestal” contenidas en distintos diccionarios de la lengua española, evidencia que no hay una noción única de dicho vocablo y que tampoco puede reducirse el mismo a tal punto que se le asocie solamente con la idea de bosque, sino que más bien apunta hacia una interpretación del término en relación con varios conceptos relacionados, entre ellos “bosque”, “leñas”, “pastos” , sin que tales definiciones –a través de la palabra “etc.”- lleven a una definición estricta de dicho concepto, que más bien es amplia, pues abarca desde pastos hasta bosques.
Lo anterior -cabe reiterarlo- hace imposible asociar la palabra forestal únicamente al concepto de bosque. Así, l a definición que histórica y culturalmente se ha brindado al término forestal, involucra un concepto amplio que abarca múltiples posibilidades, como el aprovechamiento de árboles, maderas, hierbas medicinales, plantas ornamentales, semillas, entre otros, así como también, por ejemplo, otro producto forestal resulta ser el mantenimiento del ciclo hidrológico y el ecoturismo. Hasta aquí vemos la polisemia que presenta la palabra forestal en el lenguaje común. Pero además, debe tenerse claro que lo que interesa en este caso es la noción normativa de "productos forestales". Si se considera lo expuesto en relación con el lenguaje común de la palabra "forestal", entonces la idea de “productos forestales” contenida en el tipo penal del artículo 61 de la Ley Forestal, no podría encasillarse en relación únicamente con el concepto de bosque, no solo porque la propia definición del diccionario español no lo hace, sino porque del contenido de la Ley Forestal de referencia, se derivan múltiples elementos que apuntan a que dicho elemento típico es de carácter normativo, encargándose la misma ley, a través de los diferentes artículos, de exponer claramente que el término forestal –con el que además se denominó la ley- no está referido de maner a exclusiva al tema de los bosques, sino que, como se ha indicado, aborda lo forestal en un sentido amplio y concerniente a los recursos naturales que en materia maderable, sus productos y demás elementos que actúan en dicho ecosistema, son regulados a través de esta Ley.
En ese sentido se comparte el voto [Telf1] de las 11:15 horas del 23 de diciembre de 2010, del Tribunal de Casación Penal del Segundo Circuito Judicial de San José, el que precisamente asumió una posición contraria a la jurisprudencia que invoca la juzgadora en el presente asunto y que la llevara a considerar atípica la conducta del imputado. En este punto, conviene recordar que la determinación del contenido típico del artículo 61 de la Ley Forestal (Nº 7575) exige que se determine qué se entiende por productos forestales. Y tal determinación se debe realizar a la luz de lo que dispone esa ley. Cabe entonces advertir que ello se puede lograr interpretando dicha normativa legal a la luz de lo dispuesto en el artículo 10 del Código Civil, el cual dispone: "Las normas se interpretarán según el sentido propio de sus palabras, en relación con el contexto, los antecedentes históricos y legislativos y la realidad social del tiempo en que han de ser aplicadas, atendiendo fundamentalmente al espíritu y finalidad de ellas".
Obsérvese que no se aboga por realizar interpretación analógica alguna (que está descrita en el artículo 12 del Código Civil y que está vedada en el artículo 2 del Código Penal para establecer conductas penalmente típicas), sino por una interpretación sistemática de la Ley Forestal para establecer lo que en dicha normativa (de orden legal, es pertinente recordar) se entiende por productos forestales, concepto que es determinante de la conducta típica contenida en el artículo 61 de la ley tantas veces mencionada. Ahora bien, para realizar tal ejercicio interpretativo -el sistemático-, es válido acudir a otras disposiciones de la misma legislación (Nº 7575), para entender el alcance del concepto de comentario. Al proceder de esta manera, se aprecia que el legislador entiende por productos forestales objetos que no son bosque, es decir, aquel concepto no está limitado al segundo. Sobre el particular, cabe advertir que el artículo 1 de la Ley Forestal señala que esta tiene el siguiente objetivo: " La presente ley establece, como función esencial y prioritaria del Estado, velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables.
Además, velará por la generación de empleo y el incremento del nivel de vida de la población rural, mediante su efectiva incorporación a las actividades silviculturales. En virtud del interés público y salvo lo estipulado en el artículo 18 de esta ley, se prohíbe la corta o el aprovechamiento de los bosques en parques nacionales, reservas biológicas, manglares, zonas protectoras, refugios de vida silvestre y reservas forestales propiedad del Estado" (destacado suplido). Dicho artículo, entre otros, respalda la interpretación sistemática y normativa que aquí se sostiene en relación con el artículo 61 de la Ley Forestal, puesto que el mismo contiene una separación y distinción clara entre los términos “bosques” y “recursos forestales”, e incluso se refiere a la protección de bosques en reservas forestales. Además , del contenido de la Ley Forestal debe considerarse lo siguiente: i) el artículo 3 de la misma Ley se encarga de exponer una definición del término " bosque" –cuya inconstitucionalidad por omisión relativa ya ha sido declarada por la Sala Constitucional, mediante voto 3923-2007- definición con la cual se restringió el ámbito de protección del medio ambiente.
Si bien no existe dentro de la misma Ley Forestal una definición del término “recurso forestal”, es a través de las normas que la misma ley contiene –sin necesidad de acudir a reglamentos u otras normas de rango infralegal- que es posible determinar que dicho término no solo va más allá del concepto de “bosque” - porque así la ley lo distinguió-, sino que al referirse la misma a “recurso forestal”, éste trasciende el concepto de bosque e involucra, además de éste, otros productos no necesariamente derivados de un bosque. ii) El propio artículo 3 inicia con la definición de “aprovechamiento maderable”, en el que se hace alusión específica de que tal aprovechamiento –corta, eliminación de árboles en pie o utilización de árboles caídos- se realice en “terrenos privados” no incluidos en el artículo 1 de dicha Ley, ya que el artículo 1 prohíbe la corta o aprovechamiento de los bosques en parques nacionales, reservas biológicas, manglares, zonas protectoras, refugios de vida silvestre y reservas forestales propiedad del Estado (es decir, en terrenos de dominio público).
Tal definición legal del concepto de "aprovechamiento maderable" carecería de sentido si no se estuviera expresamente regulando el control estatal de corta o eliminación de árboles en terrenos privados -dentro de los cuales no es requisito que exista un bosque-, porque de haberlo dispuesto así la ley, habría recurrido a la misma descripción específica de "bosque" en terrenos privados, tal y como fuera redactado el artículo 1 supra citado, en el que expresamente se señala la prohibición de cortar o aprovechar "bosques" en terrenos estatales. iii) Otra definición que otorga el artículo 3 es la de “Terrenos de aptitud forestal”, que incluye los terrenos contemplados en las clases que establezca la metodología oficial para determinar la capacidad de uso de las tierras. De haberse considerado por el legislador que "forestal" es "bosque", debería entonces entenderse que son terrenos de aptitud para bosque, sin permitir otra clasificación.
El mismo ejercicio podría derivar de las definiciones de “manejo forestal” , “plantación forestal”, “régimen forestal” y demás que involucran dicho término y que están allí contenidas, de las cuales se brindan múltiples factores para conocer que se habla en términos generales de elementos relacionados con el concepto de forestal y no en exclusiva de los bosques. iv) Apartándonos incluso de dichas definiciones, tenemos que la propia Ley Forestal distingue claramente cuándo utiliza el concepto forestal –en el sentido normativo ya expuesto- y cuándo hace referencia específica al concepto de bosque. Así puede observarse que el artículo 6 otorga a la Administración Forestal del Estado varias competencias de control y manejo relacionadas con los bosques y recursos forestales, tanto en áreas estatales como privadas, lo cual evidencia que los segundos son algo más amplio que lo primero. v) Otra distinción que expone la ley en materia de bosque y forestal lo contiene el artículo 13, el que precisamente determina que el patrimonio natural del Estado costarricense lo constituyen "los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública..." con lo cual válidamente se colige que además de los bosques -definidos expresamente por el artículo 3 de la misma ley- existen otros recursos forestales que -lógicamente- forman parte del patrimonio natural del Estado y que regula la Ley Forestal.
La protección de dichos recursos está contenida en los artículos 33 a 35, que prohíben la corta o eliminación de árboles en áreas diferentes a los bosques -tales como nacientes permanentes, riberas de ríos, quebradas o arroyos, riberas de lagos, embalses naturales o artificiales estatales, áreas de recarga y acuíferos de manantiales- y además declaran de interés público las acciones para prevenir y extinguir incendios forestales -sin determinar áreas específicas para proteger, como serían los bosques-, normativa con la cual en definitiva, pretende la ley regular todo lo relativo a lo forestal, no particularmente los bosques. De igual forma la Ley Forestal regula lo relacionado con los bosques y productos forestales de patrimonio privado. Al respecto, lo relativo al plan de manejo de los bosques privados y los incentivos para la conservación de los mismos, se desarrollan a partir de los artículos 19 a 26 de la Ley de cita.
El artículo 27 por su parte establece una limitación de corta de árboles en "terrenos de uso agropecuario y sin bosque" en donde claramente establece dicha normativa, que para cortar más de 10 árboles por inmueble se requerirá la autorización de la Administración Forestal del Estado. Es importante detenerse aquí en el análisis de la tipicidad de la conducta bajo estudio, puesto que no existe siquiera necesidad de interpretar la voluntad del legislador al establecer límites cuantitativos en la corta de árboles en terrenos "sin bosque", que a contrario sensu del artículo 3 apartado d) están constituidos por todos aquellos terrenos que no cumplan la definición legal que allí se establece -o sea, un "Ecosistema nativo o autóctono, intervenido o no, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o más hectáreas, caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del setenta por ciento de esa superficie y donde existan más de sesenta árboles por hectárea de quince o más centímetros de diámetro medido a la altura del pecho".
De manera que puede decirse que el terreno en el cual se investiga la tala de árboles en el presente asunto y que es un área de potrero, no se encuentra contenido en dicha definición. La restricción que contiene dicho numeral 27 de la Ley Forestal, encuentra su respectiva sanción en el artículo 61 de la misma Ley, el cual establece: "Se impondrá prisión de un mes a tres años a quien: a) Aproveche uno o varios productos forestales en propiedad privada, sin el permiso de la Administración Forestal del Estado, o a quien, aunque cuente con el permiso, no se ajuste a lo autorizado. b) Adquiera o procese productos forestales sin cumplir con los requisitos establecidos en esta ley. c) Realice actividades que impliquen cambio en el uso de la tierra, en contra de lo estipulado en el artículo 19 de esta ley. En los casos anteriores, los productos serán decomisados y puestos a la orden de la autoridad judicial competente. d) Sustraiga productos forestales de una propiedad privada o del Estado o transporte productos forestales obtenidos en la misma forma" (el subrayado es suplido).
De la lectura de la norma se deriva que con excepción del inciso c) que remite al artículo 19 -en el que expresamente se regula lo concerniente a los bosques- en todos los demás incisos el legislador hizo alusión a "productos forestales" , distinción que carecería de todo sentido si producto forestal se hubiera regulado legalmente como sinónimo de bosque. En realidad todo el cuerpo legal que conforma la Ley Forestal resulta conteste con el análisis hasta ahora realizado y señala inequívocamente, que el concepto de forestal que abraza la ley y que forma parte de los elementos descriptivos de los tipos penales mediante los cuales se sancionan las conductas contrarias a los fines de dicha ley, es un concepto que no debe confundirse con el de bosque. Así, según se ha analizado a partir de la literalidad de la ley, el término forestal que ésta establece, involucra también a los árboles, cuya existencia no necesariamente depende de que también exista un bosque, por lo cual resulta imposible invisibilizarlos, no solo porque la ley no lo hace, sino porque -con las deficiencias ya señaladas por la Sala Constitucional en relación con la aplicación del principio precautorio- la Ley Forestal otorga herramientas legales para juzgar y sancionar aquellas acciones que le resulten contrarias.
Ahora bien, no puede obviarse que con la Ley Forestal actual, ciertamente el legislador restringió en forma grave el concepto de bosque, perjudicando la protección de la cual deben ser objeto todos los recursos naturales que proveen un ambiente sano para las personas y que cobija el artículo 50 de la Constitución Política como un derecho humano. Así lo expuso la Sala Constitucional en el voto [Telf2] ya citado, en el cual mencionó lo siguiente: "Los bosques . Independientemente del concepto señalado en la Ley Forestal actual, es posible concebir doctrinariamente conceptos más amplios de bosque. Por ejemplo, bosque es un sitio poblado de árboles y matas, generalmente en espesura. Ampliando el concepto, también puede señalarse que "bosque es toda aquella superficie de tierra en donde se hallan creciendo asociaciones vegetales, predominando árboles de diferentes tamaños que han sido explotados o no, capaces de producir madera u otros productos; influyen en el clima y en el régimen hidrológico y además brindan protección a la vida silvestre.".
La Procuraduría General nos ilustra en su informe también con algunas definiciones: "los bosques son ecosistemas dinámicos, con procesos continuos de cambio (crecimiento y deterioro) con árboles representativos y dominantes". Se relacionan con otras plantas, animales y microorganismos, así como con su medio físico, geográfico, produciendo una serie de interacciones complejas de elementos bióticos y abióticos denominadas funciones ecológicas, tales como: regulación hidrológica, ciclaje de nutrientes, flujo de energía y regulación climática. Otros distinguen entre bosque primario y bosque secundario. Los primeros, considerados bosques vírgenes o climáticos, se caracterizan por una abundancia de árboles maduros, que no han sido alterados por las actividades humanas, los cuales según datos aportados por la Procuraduría, un 78% de estos bosques a nivel mundial han sido ya destruidos. Los secundarios, por su parte, contienen ecosistemas que se regeneran naturalmente en un plazo medio de 15 años aproximadamente, a partir de una alteración sustancial: inundación, quemas agrícolas, incendios forestales, limpia de terreno o aprovechamiento extensivo.
Se caracterizan por la poca cantidad de árboles maduros, con una abundancia de especies de rápido crecimiento y un espeso sotobosque de plántulas y plantas herbáceas. Se caracterizan además por surgir, en algunas ocasiones, a partir de charrales o tacotales. De hecho, es de suma importancia recalcar, que la Ley Forestal previo a su reforma mediante ley No. 7575 de 5 de febrero de 1996, tenía una concepción de bosque amplísima en el artículo 6: "Son bosques todas las asociaciones vegetales compuestas, predominantemente de árboles y de otra vegetación leñosa". No se hacía distinción alguna en aquella definición ni en las citadas, el hecho de que para ser considerado bosque, deba estar formado únicamente por árboles nativos y no por exóticos, que incluso pudieron haberse regenerado naturalmente y que deba ser mayor a 2 hectáreas. Otro aspecto importante a considerar son los servicios que prestan los bosques, los cuales son de suma importancia para las personas y para el desarrollo de la misma sociedad, entre ellos podemos citar: servicios maderables (uso de la madera, leña, postes), no maderables (hierbas medicinales, tintes, plantas ornamentales, semillas, bejucos, palmas y materiales de construcción, material para artesanía), mantenimiento del ciclo hidrológico (agua para el consumo humano, labores industriales, comerciales y domésticas; protección de la agricultura, energía hidroeléctrica), regulación del microclima, control de inundaciones, de la erosión, de sedimentos, de vientos y ruidos; paisaje (fotografía, pintura, videos, pesca y turismo), recreación y ecoturismo, mantenimiento de la resistencia, preservación del ecosistema y la biodiversidad (material de investigación, turismo científico), y cambio climático (fijación de dióxido de carbono).
De ahí que la afectación de los mismos, acarree graves problemas para el mismo ser humano, toda vez que la deforestación provoca inundaciones, derrumbes, escasez del agua, sedimentación de ríos, riachuelos y represas, pérdidas de cosechas, etc. Visto lo anterior, resulta claro para la Sala, que lleva razón la Procuraduría al señalar, que la definición de bosque contenida en la actual Ley Forestal, es insuficiente y tutela en forma deficitaria los bosques de nuestro país, con el agravante, de que es a partir de ésta, que se producen las demás definiciones de los tipos de terrenos que son objeto de la corta de los mismos, en algunos casos reguladamente y en otras, hasta en forma irrestricta. Ciertamente la reforma a esta ley, que se produjo mediante ley No. 7575 de 5 de febrero de 1996, tuvo como fin el promover e incentivar la reforestación en nuestro país, para lo cual intentó librar de trámites innecesarios la corta de determinado tipo de árboles.
No obstante lo anterior, considera este Tribunal que al haber pasado la ley de una definición amplia de bosque, con mayor cobertura de protección, a una tan restringida en cuanto a especies y superficie, hace que la protección dada con anterioridad al ambiente, haya sido disminuida sin una justificación razonable, que vaya más allá de la necesidad de reforestar y eliminar las trabas administrativas, como un incentivo de esta actividad, pero sin asegurar previamente, que ésta en su ejecución, no pusiera en peligro el ambiente. Debemos recordar que nuestro país ha suscrito compromisos internacionales de protección al ambiente y uno de los principios que debe resguardar es el principio precautorio ya citado, según el cual, la prevención debe anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, este principio rector de prevención, se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar o contener la posible afectación del ambiente o la salud de las personas.
De esta forma, en caso de que exista un riesgo de daño grave o irreversible -o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Sin duda alguna, para ello se requiere de una posición preventiva, activa y alerta por parte de la administración, pues una conducta posterior y únicamente sancionatoria, haría nugatoria cualquier acción efectiva que se pretenda a favor del ambiente, donde una vez producido el daño, difícilmente puede ser restaurado y sus efectos nocivos pueden afectar no sólo a nivel nacional, sino mundial. Y es que este, es uno de los principios rectores en materia ambiental, la prevención. Con ello no se trata tampoco de evitar el desarrollo y detener el progreso y la economía, sin embargo se debe procurar un equilibrio que le permita al ser humano desarrollarse, pero también vivir y disfrutar ese desarrollo, al cual tienen derecho no sólo las generaciones actuales, sino también las venideras.
La Sala ha indicado: "Los orígenes de los problemas ambientales son complejos y corresponden a una articulación de procesos naturales y sociales en el marco del estilo de desarrollo socioeconómico que adopte el país. Por ejemplo, se producen problemas ambientales cuando las modalidades de explotación de los recursos naturales dan lugar a una degradación de los ecosistemas superior a su capacidad de regeneración, lo que conduce a que amplios sectores de la población resulten perjudicados y se genere un alto costo ambiental y social que redunda en un deterioro de la calidad de vida; pues precisamente el objetivo primordial del uso y protección del ambiente es obtener un desarrollo y evolución favorable al ser humano...pero más importante que ello es entender que si bien el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, también tiene el deber de protegerlo y preservarlo para el uso de las generaciones presentes y futuras, lo cual no es tan novedoso, porque no es más que la traducción a esta materia, del principio de la "lesión" ya consolidado en el derecho común, en virtud del cual el legítimo ejercicio de un derecho tiene dos límites esenciales : por un lado, los iguales derechos de los demás, y, por el otro, el ejercicio racional y el disfrute útil del derecho mismo".
(véanse sentencias 1993-3705 de las quince horas del 30 de julio de 1993 y 1783-94 de las nueve horas cincuenta y siete minutos del 15 de abril de 1994). Este desarrollo no pretende igualar el trato que deben recibir los bosques y las plantaciones forestales indiscriminadamente, toda vez que a partir de estudios ecológicos y socioeconómicos se puede determinar por ejemplo, que un área debe ser forestal protectora, por la necesidad de recuperar el suelo, el agua o proteger especies de flora y fauna, así como en algunos casos lo recomendable puede ser la recuperación del recurso, permitiendo su aprovechamiento forestal o la renovación del bosque. De modo que, lo relevante no es establecer una prohibición total e irrazonada que impida el aprovechamiento de los recursos, pero sí debidamente regulada y que cuente previamente, al menos, con inspecciones que garanticen que no sean talados árboles nativos o exóticos sin importar el área, que estén cumpliendo una función esencial ambiental en el sector donde fueron sembrados o generados naturalmente." Consideramos que la restricción del concepto de "bosque" dentro de la Ley Forestal, que ya de por sí, -como señala el fallo constitucional de referencia- produjo un debilitamiento en la protección de los recursos naturales, no podría conducirnos a interpretar que el concepto forestal se restringe o ajusta al de bosque y se funden en una misma definición.
Primero porque tal y como ya fue expuesto, la propia ley distingue entre ambos conceptos -el primero mediante una definición legal y el segundo mediante una concepción normativa amplia- y además porque nos encontramos frente a una conducta que está típicamente definida y sancionada en la misma ley, mediante los artículos 27 y 61 inciso a). Es importante señalar que en el voto citado, la Sala Constitucional también se pronunció sobre el numeral 27 de la Ley Forestal, de la siguiente forma: "Según el artículo 27 cuestionado, sólo podrán cortarse hasta un máximo de 3 árboles por hectárea anualmente en terrenos de uso agropecuario y sin bosque, después de obtener la autorización del Consejo Regional Ambiental. Si la corta sobrepasare los 10 árboles por inmueble, se requerirá la autorización de la Administración Forestal del Estado. De modo, que esta norma autoriza la tala de árboles en terrenos de uso agropecuario y sin bosque, los cuales según el artículo 2 del Reglamento a la Ley Forestal, son aquellas fincas privadas con la presencia de árboles no establecidos bajo un sistema agroforestal o fincas que tienen áreas con cobertura boscosa menores a dos hectáreas, ó aquellos árboles ubicados en áreas urbanas.
Este Tribunal no estima de lo anterior, que se esté lesionando el artículo 50 de la Constitución Política, por cuanto el mismo señala, que para la corta respectiva, se requiere de la autorización previa de los órganos competentes y se trata de terrenos de uso agropecuario que no tienen bosque, con las limitaciones que además establecen los artículos 33 y 34 de la Ley Forestal... Nótese que en ambos artículos, la tala no es irrestricta, sino que está sujeta a las condiciones del terreno y a los permisos correspondientes". Dicha norma resulta ser una de las escasas limitaciones legales a la corta de árboles en zonas de terrenos privados que no constituyen bosques, por lo que su vigencia legal obliga en cada caso en particular a determinar si existe una conducta delictiva que deba ser sancionada, conforme dicho ordenamiento legal. De regreso al caso bajo examen, tenemos que contra el imputado se acusó una Infracción al artículo 61 inciso a) de la Ley Forestal en la modalidad de tala ilegal y un delito de Hurto Agravado.
Conforme con el archivo audiovisual en el que consta la sentencia, a partir del contador 15:53:44 horas, como resultando I, se expuso que el Ministerio Público acusó los siguientes hechos: "1. El 27 de mayo de 2008, a eso de las 12:32 horas, los oficiales de la Fuerza Pública de Los Chiles, sorprenden in fraganti al encartado [Nombre1]., cortando y aserrando madera en área de potrero dentro de la finca del señor [Nombre9]., ubicada en Gallo Pinto de San Jorge de Los Chiles, sin contar con los permisos de la Administración Forestal del Estado, razón por la cual proceden en decomisar la madera que se encontraba talada y aserrada en dicha finca, de seguido la engregan en depósito provisial a [Nombre2]., quedando dicha madera dentro de la citada finca. 2. Es así que el 20 de junio de 2008, a eso de las 13:00 horas, el funcionario del Minaet, [Nombre10]., conjuntamente con oficiales de la Fuerza Pública e Los Chiles, realiza inspección en la propiedad del señor [Nombre9]., corroborando que el aquí encartado [Nombre1]. había talado y aserrado treinta y cinco árboles maderables de las especies laurel, cedro y lagarto, todos en área de potrero, sin contar con el permiso de la Dirección Forestal del Estado. 3.
Según certificación emitida por la oficina del Minae de Los Chiles, el aquí imputado [Nombre1]. no cuenta con permiso de la Dirección Forestal del Estado para aprovechar árboles en la finca propiedad del señor [Nombre9]. 4. Sin precisar fecha, pero a finales del mes de mayo de 2008, el imputado [Nombre1]. ingresó con un camión a la finca del señor [Nombre9]., sita en Gallo Pinto de San Jorge de Los Chiles, y con la ayuda de los señores [Nombre11]. y [Nombre12]., cargó la citada madera en dicho camión, apoderándose de manera ilegítima de la madera que había quedado en custodia del aquí denunciante [Nombre2].." Según dicha descripción de hechos, en principio estamos frente a la investigación de un delito por la corta sin permiso de la Dirección Forestal del Estado, de 35 árboles de las especies laurel, cedro y lagarto, en zona no boscosa, así como ante un delito por sustracción de madera. De manera que conforme con lo expuesto en relación con la tipicidad de la conducta investigada, la cual por las razones también expuestas se considera que no transgrede el principio de legalidad, no existe obstáculo legal para juzgar al imputado por los hechos acusados y mediante el debido proceso determinar en definitiva si tiene o no responsabilidad penal en los mismos.
Según lo dicho, lleva razón el reclamo en el tanto en sentencia se estimó erróneamente que los hechos resultan atípicos, por lo que se ordena la nulidad de la fundamentación del fallo en ese sentido, por ser contraria a Derecho. Establecida la inexistencia de conflicto entre la conducta acusada y el principio de legalidad, de inmediato se procede a valorar el siguiente reclamo por la forma.
III.Como primer motivo señala falta de fundamentación jurídica por insuficiente, contradictoria y errónea valoración de la prueba. Indica que en el fallo se omite indicar las razones por las que se absolvió al imputado, sin valorar a fondo la totalidad de la prueba aportada por el Ministerio Público. Agrega que el Tribunal se contradice al valorar parcialmente la prueba. Según criterio de la quejosa sí se comprobó la tala y aprovechamiento de productos forestales, mientras el imputado fue absuelto por falta de certeza de que fuera el responsable de los hechos acusados. Indica los elementos de juicio de los cuales el fallo derivó la duda y según dice, se dejaron de valorar otras versiones, como la del testigo [Nombre13]. y la prueba documental, la que a su juicio acredita que fue el imputado el responsable de los hechos. No está de acuerdo en la "contracción" (sic folios 297 y 298) que encontró el Tribunal de Juicio entre los testimonios de [Nombre14]. y [Nombre13]., porque a su juicio se hizo una errónea interpretación de lo dicho por el primero, "quien en realidad lo que indica es que el hijo del dueño de la propiedad manifestó que se iba a hacer responsable de lo que estaba pasado ahí y que si había permiso" (copia textual folio 298).
De seguido hace un análisis del resto de la versión de este testigo y de cómo considera que debió valorarla el Tribunal, junto con el resto de los testigos. Agrega que el Tribunal no explica en forma detallada por qué la prueba le merece o no credibilidad. De igual forma señala que el Tribunal yerra por falta de fundamentación y errónea interpretación de la prueba al absolver al imputado por la sustracción de la madera, por no determinarse que dicha madera que el acusado cargó en el camión, sea la que estaba en depósito provisional de [Nombre2]., para lo cual se dejó de analizar las versiones de [Nombre15]., [Nombre11]. y [Nombre12]. Acusa que el fallo adolece de argumentaciones "infundadas y desproporcionadas" (folio 300). Como agravio indica que la sentencia es ilegítima y arbitraria. Con lugar el reclamo. Considera esta Cámara que en realidad el fallo adolece de fundamentación legal que lo valide y el escaso que se agregó resulta confuso, contradictorio e insuficiente.
A partir del minuto 15:53:44 y hasta el minuto 16:32:00, la jueza realiza una amplia descripción de lo declarado por todos los testigos y el imputado [Nombre1]. No se incluyó en sentencia un apartado de hechos probados o no probados, por lo que es a partir del minuto 16:32:00 horas, en que la juzgadora empieza la exposición de lo que pareciera ser un análisis probatorio, sin embargo incurre en una serie de innecesarias reiteraciones en las que le informa al imputado sobre lo que se le acusó y así indica el fallo: "Esa es la primera parte que don [Nombre1]. a usted se le acusa... Posteriormente usted también enfrenta este juicio y se indica que una vez que ha realizado la Fuerza Pública esta inspección en conjunto con oficiales del MINAE donde se constata que se ha dado efectivamente una tala de árboles maderables en esta finca de potrero...", y dirigiéndose siempre al imputado le manifiesta que también lo acusan de que sustrajo madera de custodia de [Nombre2]..
Y agrega: "con base en esta acusación es que una vez iniciada la investigación por parte de la fiscalía se realiza la misma" (16:34:00 horas). De seguido la jueza informa que va a valorar la prueba conforme con la sana crítica y el principio de inocencia y señala: "El Tribunal una vez realizada la deliberación correspondiente, analizada todos los testigos, que dicho sea de paso fueron bastantes los que se trajeron a este contradictorio, a fin de demostrar estos hechos en su contra, se determina que no existe la certeza absoluta para esta juzgadora para emanar una sentencia condenatoria en su contra y se indica esta situación por las siguientes consideraciones: Con base en esta acusación se debe tener claro por su persona, que a usted se le está acusando...." continúa con una exposición del lugar, circunstancias y normativa que invoca la fiscalía para la acusación y concluye que no hay duda de que la corta de árboles se dio en zona de potrero "porque así lo dice la pieza acusatoria" .
La reseña antes referida sobre el contenido de la fundamentación del fallo, revelan las falencias que sobre el análisis probatorio se detectan en el resto de la exposición de la sentencia. En ésta, constantemente -y puede decirse en forma tediosa- se reitera la declaración dada por los testigos, sin agregar ningún análisis de tales declaraciones. Sobre lo dicho por el imputado, -versión que se reitera constantemente en este apartado de la sentencia- indica la a quo lo siguiente: "A pesar de esas consideraciones, no por eventualmente haber tenido el Tribunal acá testigos, que si bien es cierto ninguno ha sido claro en cuanto a que estos hechos fueron en mayo del año 2008, específicamente, algunos hacen referencia a que fue hace tres años, hace menos de dos años, hace aproximadamente cuatro años, hace cinco aproximadamente, sin embargo se debe de tomar en cuenta que aquí se está en presencia de una corta y un aserrío de madera, en un área de potrero tal y como lo corrigió la fiscalía en su momento...
Siguiendo con el análisis de la declaración, y eh, empezando con la declaración de los testigos [Nombre13].". La jueza se entretiene en referirse vagamente al dicho de testigos y omite así analizar la versión dada por el imputado, declaración en la cual admitió haber ordenado a otros ir a realizar la corta de árboles en el terreno investigado y brindó otras consideraciones que simplemente fueron ignoradas por el Tribunal, sin otorgarle ningún tipo de valor, como era exigible. La dinámica con la que continúa la exposición del fallo es resumir otra vez lo que dijo el testigo [Nombre14]. e indica que básicamente son coincidentes con las labores realizadas por otro testigo –M.-, y que se contradice con lo dicho por [Nombre2]. y agrega: "Pese a ello considera este Tribunal que a estos testigos no se les nota ninguna particularidad para venir a perjudicarlo a usted... siguiendo con la valoración de esta prueba (vuelve a decir lo que dijeron los testigos) tenemos que con base en esa prueba se identifica que los hechos se dan en zona de potrero (insiste en lo que dijeron textualmente los testigos) estima el Tribunal... que se puede aclarar la situación en el tanto también don [Nombre14]. fue coincidente en que la persona que estaba trayendo el permiso, lo hizo, había mencionado que estaba dentro de un vehículo y que estaba estacionado en vía pública...
(vuelve a referir ampliamente lo que dijo [Nombre2].) posteriormente en cuanto a la otra situación el señor testigo menciona que la Fuerza Púbica en virtud de esta situación y por no coincidir el permiso que el señor [Nombre1]. tenía que lo deja en depósito provisional de esta madera...". De seguido insiste en reiterar lo que dijo [Nombre2]. y agrega: "En cuanto a los primeros hechos... uno, dos y tres acusados... también este testigo es muy conteste de que esta madera y árboles estaban en potrero y ha sido enfático en que el señor encartado fue el que sustrajo la madera posteriormente. Otro de los testigos que han sido claros en cuanto a esta situación es don [Nombre15].". Conforme se desprende de lo anterior, esa dinámica de informar el fallo, además de confusa y carente de una verdadera confrontación de versiones, impide conocer en forma clara cuál es la información dada por los testigos y cuál es la valoración y conclusión otorgada por la jueza.
De esa forma se fueron sumando minutos a una exposición que, no solo resulta ser una multireiteración de los testimonios recabados, sino que sobre los mismos no existe un análisis que sirva de fundamento para la duda que, según señala el fallo, surgió con dicha prueba. Realizando un escaso análisis de la prueba, indica la sentencia lo siguiente: "De acuerdo a la valoración de todos los testimonios se tiene en cuenta de que es un área de potrero, se ubica al señor encartado , a pesar de que él mismo indicó que no había estado cuando se había dado esta tala. Para el Tribunal no es consistente la declaración del señor encartado en cuanto a este punto y por ello no se le da credibilidad. No se le da credibilidad a pesar de la decisión que se está tomando en el tanto fue ubicado por uno de los oficiales de la fuerza pública... además de eso es claro y enfático en señalar que se estaba dándose el sonido de una motosierra, que se estaba trabajando en ese lugar".
De lo anterior pareciera desprenderse que para la a quo se demostró la presencia del imputado en el lugar en donde se daba la corta de árboles pero posteriormente expone que sobre el punto surgió duda. Asimismo, sobre los hechos constitutivos del delito de hurto, señala el fallo que no le cree la versión del imputado de que estuviera en el sitio porque estaba transportando muebles, porque la prueba no señala tal cosa. No obstante concluye contradictoriamente que los testimonios no son suficientes para condenar, sin indicar por qué. También refiere el fallo consideraciones sobre lo que debe considerarse "aprovechamiento" de la madera, e indica: "¿Qué se debe determinar para verificar el aprovechamiento? Ha existido... una duda en el tanto el señor encartado refiere en primera instancia que fue el señor [Nombre2]. el que lo buscó para hacer esa corta, sin embargo a uno de los oficiales... de apellido [Nombre13].... le dice el señor encartado que él es el responsable de la madera y por otro lado, también existe esta denuncia del oficial que depuso y aquí también don [Nombre16]. lo manifestó en este contradictorio que el que se había identificado como responsable de esta madera era un hijo del señor de la propiedad, incluso al final de su deposición dijo que era otro hermano... un hermano de [Nombre2]., el que le había informado que estaba aprovechando la madera en convenio con este señor, refiriéndose al acusado que le había comprado la madera... ha existido duda... en virtud de que... el señor [Nombre2]. fue enfático en indicar que él solamente le vendió la madera al imputado y que éste le indicó que se encargaría de los permisos... a pesar de estas consideraciones estima este Tribunal que aunado a que la declaración del señor [Nombre10]. ha mencionado que se necesita permiso para realizar corta en potrero y en propiedad privada, estima este Tribunal que esta acción es atípica porque...".
A partir de este momento del fallo oral, la juzgadora se aboca a justificar en la jurisprudencia ya analizada en el Considerando II de esta sentencia, su posición de que los hechos son atípicos y afirma que la finalidad de la ley forestal es la protección de zonas boscosas , lo cual como se indicó líneas atrás, es algo totalmente errado. La misma situación de errónea fundamentación se dio en relación con el delito de hurto de madera, sobre el cual indica el fallo que la fiscal solicitó seis meses de prisión en reproche de dos conductas y no desligó algunas de las acciones, y por ende "es más dudoso en cuanto a la petición de la señora fiscal", aseveración que no contiene ningún fundamento y el escaso que fue dado contiene incongruencias y contradicciones que le restan validez. Así indica el fallo: "No ha existido ninguna duda de que la madera decomisada... quedó en manos del señor [Nombre2].... es claro para este Tribunal que el señor encartado sí montó en su camión cierta madera...
(también dice que hay duda sobre este aspecto porque el testigo [Nombre11]. no fue enfático en acreditar esta versión) sin embargo es importante conocer mayores características de la especie, por ejemplo o de la cantidad de esta madera que supuestamente montó en su vehículo...". De manera que aun cuando la jueza refiere tener prueba de que el imputado cargó la madera, por otro lado dice que no le es suficiente para la condena -sin indicar por qué- y pese a hacer alusión de múltiple prueba en contrario, concluye contradictoriamente que surge una duda, que no justifica ni se infiere del fallo. Sobre tal aspecto indica la sentencia: "No se puede arribar a eso fehacientemente a pesar de que [Nombre11]. dijo que usted cargó esa madera que estaba en la finca de don [Nombre9]. y otro testigo llamado [Nombre12]. también dijo que esa madera que lo había ayudado al imputado a trasladar estaba en ese lugar.
Este testigo menciona que creía que era cedro ...esos testigos si bien es cierto refieren a su persona que carga una madera, para el Tribunal no queda fehacientemente determinado que esa madera fuera la misma que ese día se le entregara en depósito provisional a don [Nombre2].... el hermano de don [Nombre2]. también lo menciona a usted... y un testigo refiere que la madera que usted se llevó era la decomisada... usted era el conductor del vehículo... dejando de lado esta situación por parte de este Tribunal, a efectos de darle credibilidad o no a este testigo [Nombre15]., sin embargo de lo que él refiere no se puede llegar a tener prueba directa, como testigo presencial o por lo menos a derivar de él un indicio que no lleve a más de una conclusión, por qué? porque él lo ve ingresar a usted a esa propiedad a dejar unas pacas que después de eso menciona ve salir a su persona, quien manejaba incluso, y que con la madera y que sabe que esa madera era la que estaba decomisada, sin embargo ¿cómo hace para indicarnos que sabe que era la que estaba decomisada? este señor dice que es hasta el otro día que él va a ver si estaba la madera o no y que le dijo a su tata y a su mama y hermanillo que no estaba, véase que aquí la fiscalía lo acusó a usted que esto fue a finales de mayo del 2008... sería como cinco días después del depósito... a pesar de que el testigo don [Nombre2]. dijo que era quince días después... efectivamente se puede llegar a concluir lógicamente de que usted pasó con el camión por ahí de que usted pudo subir en su camión cierta madera, sin embargo conforme se ha venido indicando no queda claro que esta madera fuera la decomisada".
Pareciera que aún cuando la jueza a quo menciona haber recibido múltiple prueba testimonial que señala al imputado como la persona que cargó en un vehículo la madera que le fuera entregada en depósito a [Nombre2]. y que éste denunció como sustraída, concluye en una duda sobre la que no aporta razones. También expone el fallo dudas sobre la cantidad de la madera sustraída y especula -sin fundamento probatorio alguno- que después de que el testigo [Nombre15]., e n horas de la noche vio salir al imputado con madera, pudo haber entrado otra persona a sustraer más madera y por eso se absolvió al imputado de toda pena y responsabilidad. Por otra parte la prueba documental solo fue mencionada, sin valoración alguna. Según lo dicho, puede concluirse que el fallo incumple con el artículo 363 inciso b) del Código Procesal Penal, al adolecer de un fundamento legal que apoye la decisión adoptada por la jueza, impidiendo en definitiva -debido al escaso y contradictorio análisis- conocer las razones derivadas de la prueba que llevaron a absolver al imputado.
Según lo expuesto, la sentencia no contiene un fundamento legal de análisis probatorio, fáctico y jurídico que justifique la conclusión absolutoria emitida, por lo que se acoge el reclamo y se anula la totalidad del fallo, ordenándose el reenvío para una nueva sustanciación.
POR TANTO:
Se declara con lugar el recurso de apelación de sentencia presentado por la representación fiscal. Se anula totalmente la sentencia impugnada y se ordena el reenvío para una nueva sustanciación conforme a Derecho. NOTIFÍQUESE.
