Voto N° 032-2013 ADMINISTRATIVE LITIGATION COURT, FOURTH SECTION, San José, at fourteen hours and thirty minutes on veintitrés de abril de dos mil trece.- Ordinary proceeding (proceso de conocimiento) brought by Nombre110740, identity card number CED87490 - -, Nombre110728, identity card number CED87491 - -, Nombre110729, identity card number CED87492 - -, Nombre110730, residence card number uno - cinco cinco ocho - cero cero cuatro siete ocho siete cero cuatro, and Nombre110731, identity card number CED87493 - -, against the Instituto de Desarrollo Rural (INDER), formerly the Instituto de Desarrollo Agrario (IDA), represented by Lic. Jonathan Jiménez Ruiz, married, attorney, identity card number CED14409 - -, and resident of San José. The plaintiffs are represented by Lic. Nombre1037, married, attorney, resident of Cartago, identity card number CED87494 - -. RESULT:

D) That the Instituto de Desarrollo Agrario (IDA) pay all costs of this Action.” At the preliminary hearing, the claims were adjusted to set compensation at cincuenta millones de colones for each plaintiff for losses to plantings, crops, animals, and other investments made during their occupation of the parcels; pecuniary damage (daño patrimonial) consisting of the expectation of being able to live on the properties at issue; and emotional harm arising from the prospect of eviction and the uncertainty they have had to face. Judge Madrigal Jiménez drafts the judgment; and,

CONSIDERING:

I. BASIS OF THE PROCEEDING

The plaintiffs state that they have possessed Finca el Higuerón, in la Virgen de los Chiles, for more than diez años, quietly, publicly, peacefully, continuously, and without interruption, under a claim of ownership. They state that those properties belong to Agrícola Don H.I.S. A., Agrícola H y H, and Agrícola Industrial Rah S. A., all represented by Nombre110741. They further state that IDA, now Instituto de Desarrollo Rural, purchased those properties in order to award them to the plaintiffs, and that the real property is currently identified under Real Property Folio record number Placa19442. They add that the public entity now seeks to evict their representatives in order to award the land to other persons, which they consider morally unjustified because they have invested their entire lives, time, and assets in their crops and in constructing their homes. The claims asserted arise from these circumstances. The defendant does not acknowledge their possession but does admit that it owns the property. It states that, under the regulations governing it, a person must satisfy the statutory criteria to qualify as an allottee (adjudicatario), and that some of the claimants were declared ineligible while others never filed any application. It therefore considers its actions lawful.

II. PROVEN FACTS

The following relevant facts are material to the issuance of this judgment:

  • 1)The Instituto de Desarrollo Rural (at the time, Instituto de Desarrollo Agrario) owns the property in the Alajuela registration district, under Real Property Folio record number Placa19448 -, located in los Chiles in the province of Alajuela, with an area of cuatrocientos ochenta y cinco mil ochocientos dieciocho metros cuadrados con cuarenta y ocho decímetros cuadrados; that property was acquired at the request of the persons in possession of it (see folios 9 and 10 of the judicial case file).
  • 2)The plaintiffs entered the IDA property in la Virgen de los Chiles de San Carlos de Alajuela around the year dos mil cinco (see the testimony of Nombre110742 given at the oral and public trial).
  • 3)The plaintiffs have carried out agricultural work on the properties they have possessed (see the testimony of Nombre110742 given at the oral and public trial).
  • 4)Nombre110740 and Nombre110731 have not undergone the land-selection assessments (estudios de selección de tierras) conducted by the Instituto de Desarrollo Agrario (a fact admitted by each of them at the oral and public trial).
  • 5)On veintinueve de marzo de dos mil once, Nombre110731 requested that the Executive Presidency of the Instituto de Desarrollo Agrario conduct the corresponding selection assessments (see the evidence ordered for clarification of the case, appearing at folios 98 and 99 of the judicial case file).
  • 6)At the beginning of dos mil doce, Nombre110740 requested that the Instituto de Desarrollo Agrario conduct the corresponding assessments (see the evidence ordered for clarification of the case, appearing at folios 100 to 103 of the judicial case file).
  • 7)Nombre110729, Nombre110728, and Nombre110730 underwent the land-selection assessments promoted by IDA at the time (a fact admitted by each of them at the oral and public trial and also documented in the corresponding administrative case file).
  • 8)Nombre110729, Nombre110728, and Nombre110730 received unfavorable determinations in the selection assessments conducted by IDA (a fact admitted by each of them at the oral and public trial).
  • 9)In the case of Nombre110729, the benefit was denied because, according to IDA, he had included in his household persons who did not live with him (see folio 19 of the administrative case file concerning the allotment application).
  • 10)Nombre110730 received an unfavorable determination because she was found not to have demonstrated the technical capacity to engage in agricultural activity (see folio 10 of the application case file).
  • 11)In the case of Nombre110728, the benefit was denied because, according to IDA, he had included in his household persons who did not live with him and had not demonstrated the technical capacity to perform agricultural work (see folio 18 of the administrative case file concerning the allotment application).
  • 12)In the case of Nombre110743, the rejection was based on the failure to demonstrate technical capacity as an independent producer and the failure to establish the marketing of the product (see folio 17 of the judicial case file).
  • 13)At the time this proceeding was filed, and thereafter, none of the plaintiffs had authorization to occupy any IDA land (a fact admitted by each of them at the oral and public trial).
  • 14)At the beginning of dos mil once, INDER formally ordered (intimó) Nombre110731, Nombre110730, Nombre110728, Nombre110729, and Nombre110740 to vacate the property it owned and which they were occupying (see folios 3 to 6 of the administrative case files of the aforementioned persons; folios 12 to 16 in the case of Nombre110730; and folios 6 to 11 in the case of Nombre110728).
  • 15)By resolution 365-12 D.M. issued at nueve horas on siete de febrero de dos mil doce, the Minister of Public Security ordered the administrative eviction (desalojo administrativo) of Nombre110731 (see folio 34 of that individual’s administrative case file).
  • 16)Although the exact date cannot be determined, around the end of dos mil doce IDA evicted the plaintiffs, except for Nombre110740, and delivered the parcels to other persons (testimony of Nombre110742 and Arguedas Vega given at the oral and public trial, as well as the testimony under examination of Nombre110740 and the photographs at folios 54 to 67 of the judicial case file).
  • 17)When possession was delivered, the immovable property located on the parcels was destroyed, as were the crops and animals belonging to the affected plaintiffs at that location (testimony of Nombre110742 and Arguedas Vega given at the oral and public trial, discs containing publications from the newspaper La Extra, and photographs at folios 54 to 67 of the judicial case file).
  • 18)The plaintiffs, except for Nombre110740, suffered as a result of the eviction to which they were subjected (see the testimony given by those persons at the oral and public trial, which the Court finds credible).

III. UNPROVEN FACTS

The following are deemed unproven:

  • 1)That the plaintiffs had acquired any legitimate title to the properties they possessed before the Instituto de Desarrollo Rural, formerly IDA, acquired the property (the record).
  • 2)That the decision issued by the defendant at the relevant time denying allottee status lacked adequate technical grounds (there is no evidence to that effect).
  • 3)That all applications submitted by the plaintiffs to the different INDER offices were resolved in a timely manner and validly served (the record).
  • 4)That the plaintiffs’ possession was not in good faith (buena fe) (there is no evidence to that effect).
  • 5)The value of the property destroyed that belonged to the evicted plaintiffs (the record).
  • 6)That the denial of allotment to the plaintiffs was based on a political interest unrelated to the interests recognized by the legal system (there is no evidence to that effect).
  • 7)The value of the property destroyed that belonged to the evicted plaintiffs (the record).
  • 8)The existence of an administrative act (acto administrativo) ordering administrative eviction in the case of the plaintiffs other than Nombre110731 (the record).
  • 9)That Nombre110740 suffered any compensable harm as a result of the events giving rise to this action (there is no evidence to that effect).
  • 10)That the defendant public entity paid any of the plaintiffs for improvements (mejoras) (the record).

I V. ON THE APPLICABLE LEGAL REGIME: Ley de Tierras y Colonización, number 2825 of October fourteenth, nineteen sixty-one, provides that the Instituto de Desarrollo Agrario has the purpose of integrating citizens into a sound system of land tenure, ensuring that the allocation of this resource promotes a gradual increase in productivity, advocating a fair distribution of its output and an improvement in their socioeconomic condition, thereby enabling them to participate consciously in the nation’s development, achieving a fair distribution of wealth and preventing indirect forms of land exploitation (section one ibid.). Indeed, the provision is nothing more than the direct implementation of Article fifty of the Constitution, under which the State intervenes in the means of production in order to generate a sound distribution of wealth in favor of groups with the greatest social needs. By virtue of those purposes, every person is encouraged to exercise the right to report or provide notice of the existence of land whose exploitation does not fulfill the social function of property (función social de la propiedad).

Although this latter concept was rejected by the Constituent Assembly of nineteen forty-nine, it was embraced by the ordinary legislature, legal scholarship, and case law to establish that land is of public interest because it is the means through which, directly or indirectly, the goods and services necessary for the existence of the human species are produced, such that its exploitation within an ecologically balanced environment is a societal priority. This is all the more so when it enables the creation of rural parcels for low-income persons. It is a special regime that constitutes an exception to the right of property enshrined in the first paragraph of the constitutional provision and affords heightened protection to the weaker party in the relationship, namely, the farmer, who often has the interest and contributes the labor but lacks the land. In furtherance of those objectives, the State originally declared itself the owner of all ownerless land in order to distribute it and, subsequently, upon the closing of the agricultural frontier, the former ITCO became the IDA, whose Board of Directors has the authority to promote subdivision plans (planes de parcelación), arrange for the acquisition of privately owned property in order to fulfill its economic and social purposes, make owners of the farmers to whom it allocates a parcel, and approve the allocation of estates for the issuance of the corresponding titles.

As may be observed, in order to implement land-subdivision policies (section 49 et seq. ibid.), the entity offers purchasers highly favorable terms, with manageable payment arrangements and low installments and interest rates, for the purpose of promoting the social function of property (sections 58 through 61 ibid.). Initially, it was considered that all rural land within the national territory could be directed toward that purpose, but this assertion was progressively qualified in light of compliance with environmental rules and the public-domain regime (demanio público) governing such matters. This led the institution to become more technically sophisticated and to determine which lands were suitable for agricultural use and which areas of the rural national territory had a different legally and technically appropriate use. It has always been maintained that the beneficiaries of these distribution plans must be persons who use the property for their own support and that of their families, who possess technical capacity and experience in agricultural work, and who undertake to work the parcel personally and with their descendants up to the second degree of consanguinity (section 62 ibid.).

Likewise, no beneficiary shall be allocated more than one parcel, and its size shall be proportional to the number of family members (Article 64 ibid.). All of this unquestionably establishes a special property regime subject to heightened oversight and protection, for the purpose of devoting the property to the use prescribed by law, thus preventing the land from being used for purposes contrary to its social purpose, which would distort its essential nature. The legal nature of this type of property was long the subject of intense debate because, although such property was ordinarily classified as public-domain property (bienes demaniales), if it possessed that status, transfer to private parties would be impossible; conversely, if it were regarded as State-owned private property (bienes fiscales), it could be acquired through the ordinary means of private law, thereby frustrating its public purpose.

Case law and legal scholarship resolved the conflict by placing it within the category of temporary or transitional public-domain property, such that the property retains its public-domain status while it is held by the Administration, which prevents it from leaving the public domain through ordinary means while it forms part of the State’s general assets; once the statutory requirements have been satisfied, however, its public nature ceases, the property is withdrawn from public use (se desafecta), and it becomes State-owned private property and is consequently transferable in accordance with the special statutory provision governing the matter (in this regard, see judgment 2008-18434 of the Sala Constitucional). Accordingly, once the allocation of parcels by sale has been approved, the Instituto shall issue the occupant a provisional possession title (título de posesión provisional) setting forth the occupant’s rights and obligations, so that if the occupant has cultivated the prescribed minimum and satisfactorily fulfilled the remaining obligations, the occupant shall be entitled to receive title to the property (Article 65 ibid.).

In view of all the foregoing, it follows readily that the beneficiary may not transfer title to the property, encumber it, lease it, or subdivide it (subdividirlo) without authorization from the Instituto, unless fifteen years have elapsed since acquisition of the parcel and all obligations owed to that agency have been discharged; consequently, private contracts entered into by the allottee (adjudicatario) with third parties do not bind the entity. It was provided in this regard that, even after that period has elapsed, if disposal of the parcel results in excessive concentration or subdivision (subdivisión) of property, the Instituto may acquire it on a priority basis (section 67 ibid.). In addition, with respect to this differentiated property regime and based on Article 67 ibid., it should be noted that the fifteen-year period begins to run upon acquisition—that is, upon issuance of the property title (sale and purchase)—and not upon occupation or administrative allocation (adjudicación administrativa).

In this connection, a proper interpretation of the above-cited provision indicates that the parcel is acquired upon registration in the beneficiary’s name by virtue of the conveyance made by the entity in the beneficiary’s favor. This is so because the imposed restrictions are entered in the registry and begin to run as of that date, it being provided that the sale under the foregoing terms is subject to the conditions and restrictions of Ley 2825 of October fourteenth, nineteen sixty-eight, since, under the terms of the cited section sixty-five, prior to acquisition the beneficiary possesses only a provisional possession title that is not subject to the restrictions, because those restrictions are imposed once the estate has been transferred into the parcel holder’s name; before then, they would serve no purpose because one cannot restrict that over which one has no power of disposition.

One exception remains, which we shall consider below. Pursuant to Ley de Tierras y Colonización, N° 2825, the Instituto de Desarrollo Agrario (IDA) is charged with subdividing its lands in order to achieve, among other purposes, a better distribution of land for settlement purposes, giving preference to areas and lands where there are groups of precarious possessors (poseedores en precario) and which are deemed suitable for its objectives. Persons interested in becoming beneficiaries must submit the corresponding application so that it may be determined whether they qualify as such (Article 55). Once the allocation of the parcels by sale has been approved, the Instituto issues the occupant a “provisional possession title” setting forth the occupant’s rights and obligations. Thereafter, if the occupant has cultivated the minimum prescribed by the Instituto and satisfactorily fulfilled all other obligations, the occupant shall be entitled to receive title to the property (Article 65).

The sanction for any failure to fulfill the duties imposed on beneficiaries is set forth in the immediately preceding section: “Article 66.- Failure to fulfill the obligations imposed on the occupant of a parcel shall, in the judgment of the Instituto, result in the loss of the right thereto.// If a decision to that effect is issued, which shall require four concurring votes of the Board of Directors, the parcel shall revert to the ownership of the Instituto together with all its appurtenances, and the Instituto shall compensate the parcel holder for the value of any necessary or useful improvements (mejoras necesarias o útiles) made at the parcel holder’s own expense.” The rationale underlying the provision rests on the aforementioned social function of land; nevertheless, as may be seen, the legislature exercised due prudence by safeguarding the right to compensation for work performed in good faith by an allottee whose allocation is subsequently revoked, under the principle prohibiting unjust enrichment (enriquecimiento sin justa causa).

Thus, if the public entity recovers the property so that it may be reallocated, the governing rationale is that lawful expenditures made from the affected private party’s own resources must be reimbursed. These naturally include plantings, fences, and developed infrastructure. To do otherwise would cause unjustifiable harm. Referring to this latter provision, the Sala Constitucional stated at the time:

“[The] land-allocation contract may be revoked by the Instituto de Desarrollo Agrario—pursuant to Article 66 of the same law cited above—before the expiration [of the period under Article 67] if the beneficiary fails to comply with the conditions stipulated in Ley de Tierras y Colonización and in the allocation contract, because the estate is conveyed for a specific purpose, namely, to promote agricultural production, in view of the agricultural suitability recognized in these estate (sic).” (N° 2006-01806 at 14:55 hours on February 15, 2006; the square brackets do not appear in the original.)

Anticipating somewhat the issue before us, the aforementioned principle may well apply even before the public deed (escritura pública) is executed or even before the adjudication (adjudicación). It should be recalled that, as indicated, those same rules allow for the possibility of occupying uncultivated land even when it has an owner, particularly since the entity may acquire land suitable for agriculture in order to adjudicate it. This entails recognition of the rights of persons who have worked the land honestly, regardless of whether they ultimately succeed in becoming adjudicatees (adjudicatarios), a rule that is also grounded in other provisions scattered throughout civil law. It is worth citing section three hundred twenty-eight of the Civil Code, which provides: “ARTICLE 328.- In addition, a good-faith possessor (poseedor de buena fe) shall be entitled to have the claimant in an action for recovery (reivindicador) pay the price that the possessor paid for the property, the value of necessary improvements (mejoras necesarias) and useful improvements (mejoras útiles), and to remove the materials used for purely ornamental improvements, provided that they can be removed without detriment to the property being recovered and that the owner refuses to pay the value that such materials would have after removal.

Until payment of the amount owed is made, the possessor may retain the property in his possession.” This provision is supplemented by article three hundred thirty of the same body of law, which establishes: “ARTICLE 330.- A bad-faith possessor (poseedor de mala fe) is entitled to reimbursement of the value of necessary improvements; with respect to useful improvements, the possessor has the same rights as a good-faith possessor, except for the right of retention; purely ornamental improvements may neither be removed nor give rise to any claim for compensation.” Without prejudice to the fact that section three hundred thirty-two ibid. states what is understood by each type of improvement: “ARTICLE 332.- Necessary improvements shall include all expenses indispensable for the preservation of the property, and useful improvements shall include those that have increased the property’s market value….” Accordingly, it may be categorically stated, without fear of error, that every parcel holder (parcelero) has a right to recognition of improvements, under the terms and conditions guaranteed by law.

On the other hand, as previously noted, there is an exception concerning the commencement of the limitation period (plazo de limitaciones), which pertains to what is known as administrative delay (morosidad administrativa), but certain preliminary clarifications are necessary. The Public Administration has a duty to enforce favorable administrative acts or acts declaring rights (actos administrativos favorables o declarativos de derechos) that have become final, once they have satisfied all requirements for effectiveness prescribed by the legal system. That duty arises from article two hundred twenty-eight of the General Law of Public Administration (Ley General de la Administración Pública; hereinafter LGAP), which, insofar as relevant, provides that “... The Administration shall comply with final administrative acts, for which purpose the provisions of the chapter on enforcement of judgments of the Code of Contentious-Administrative Procedure shall apply....” Failure to fulfill that duty—that is, failure to materially implement such favorable formal administrative conduct—constitutes a form of material inactivity (inactividad material) that causes harm to the holder of the right contained in the act that, due to administrative inertia, is not enforced.

Therefore, if the Administration refuses, or even merely fails through inertia or non-enforcement of an act (administrative default (mora administrativa)), to enforce that favorable act, the interested party may apply for its enforcement before the contentious-administrative jurisdiction (jurisdicción contencioso administrativa), as reiterated by section one hundred seventy-six of the Code of Contentious-Administrative Procedure (Código Procesal Contencioso Administrativo; hereinafter CPCA), which provides that “...When the Public Administration fails to comply with its final acts that are favorable to the administered party (administrado), the latter may have them enforced in accordance with this chapter....” Accordingly, this type of act declaring rights in favor of administered parties must be enforced promptly and fully in order to satisfy the principle of effective administrative protection (tutela administrativa efectiva).

Naturally, the Administration is afforded a reasonable time to act, depending on the specific action required and varying with the circumstances, but there is both a reasonable and an unreasonable period for compliance. Once the latter situation arises, the conduct becomes unlawful and consequently contrary to the legal system, without prejudice to any resulting liability and irrespective of enforcement through judicial proceedings, as already noted. The Administration could refuse to enforce such acts only if their absolute nullity (nulidad absoluta) had already been declared through the formal and substantive procedures and safeguards established by the body of legality (bloque de legalidad), namely, proceedings for a declaration of injury to the public interest (proceso de lesividad), in cases of absolute nullity, or the procedure governed by article one hundred seventy-three of the General Law of Public Administration, in cases of evident and manifest absolute nullity (nulidad absoluta evidente y manifiesta).

Returning to the issue of restrictions (limitaciones), as previously noted, the general rule in this area indicates that the period of restrictions begins when the corresponding deed of conveyance (escritura de traspaso) is executed. The remaining question is what occurs when the Administration adopts an act favorable to the administered party’s interests but does not execute the deed of conveyance. If the interested party were to hinder the administrative action, the general rule already stated should apply; however, if the public entity is responsible, the situation requires further analysis. Clearly, the affected person could resort to judicial proceedings not only to enforce the act favorable to his or her interests, but also to have the period of administrative inertia that has elapsed applied for his or her benefit. In this regard, the first of these claims requires little discussion, since it does indeed concern an act declaring rights and favorable to the administered party, which as such does not extinguish the party’s right to have it enforced. Regarding the unlawfulness of the conduct, the Constitutional Chamber of the Supreme Court of Justice has stated:

“In view of the foregoing, the Chamber finds that, in the specific case, it has been duly established that the administrative appeals filed by the appellant remained pending decision as of the date on which the amparo proceeding (amparo) was filed –16 January 2004-, even though the statutory period established for that purpose had long since elapsed, and therefore the alleged administrative default occurred. As this Court has stated in its precedents, the Administration’s obligation does not end when it decides the filings or applications submitted to it, but rather when the applicant is informed of the decision adopted, that is, upon its service. In the Chamber’s view, the respondent’s ‘justifications’ are unacceptable. The fact that various authorities—whether administrative or ministerial—participate in the processing of the appeal filed by the protected party, or the workload borne by the respondent offices, does not exempt the Public Administration from deciding the matter within a reasonable period; something that did not occur in this particular case.- CONCLUSION.

Based on the statements made by the respondent authorities in their reports and the evidence entered into the record, this Chamber finds that the Administration incurred administrative default, since the period prescribed by law (art. 261.1 of the General Law of Public Administration and 27 and 41 of the Political Constitution) for a final decision on the matter raised by the protected party had long since elapsed, thereby violating the right to prompt and full administrative justice. Consequently, this amparo proceeding is granted.” (decision 2004-13658 of the Constitutional Chamber, 18:19 hours, 30 November 2004) As indicated, the statutory provision proceeds from the premise that the period during which the transferred property may not be disposed of (inamovilidad del bien entregado) begins upon conveyance of the property, which, under the rules applicable to rights in rem (bienes de naturaleza real), occurs when it is transferred through the corresponding public deed.

On the other hand, the governing rationale in this area is that enforcement is to be carried out with the appropriate promptness. To hold, in such cases, that the period of statutory restrictions begins to run upon execution of the public deed would mean that administrative inertia penalizes the private party, who would be required to bear a period during which the property could not be disposed of that exceeds the period prescribed by the legal system. This would impose upon that party an adverse consequence for which he or she is not responsible and for which there is no basis whatsoever. On several occasions, we have already noted the duty of the public service to act effectively and efficiently in performing its functions; thus, merely providing the public service is insufficient, since it must meet minimum quality standards in order to guarantee citizens effective delivery in return for its funding from the public treasury.

Within this framework, this Court and the First Chamber of the Supreme Court of Justice have taken the view that administrative delay cannot prejudice the beneficiary of the act, but must instead be charged to the party truly at fault, namely, the Administration that issued it. A purposive interpretation (interpretación teleológica) of the statutory provision leads to the conclusion that its purpose is for such property to be placed in private hands in order to distribute wealth, and that the restriction on its disposition is intended to prevent the concentration of wealth. What the legislature did not consider is that farmers turn to credit to finance their crops and that these restrictions prevent them from obtaining favorable credit terms because they lack collateral. The prohibition of any type of commercial transaction involving such property constitutes a burden that would be increased by administrative action without any basis whatsoever.

All of this necessarily leads us to depart from any strictly textual interpretation (postura exegética) of the provision and endeavor to fulfill its purpose. This is consistent with article ten of the General Law of Public Administration. It must also be mentioned that the IDA recently became the Instituto de Desarrollo Rural, with the aim of adopting a more comprehensive view of the national agricultural paradigm.

V. THE SPECIFIC CASE

In accordance with the substantiated claim (pretensión acreditada), the plaintiffs request that they be declared the owners of the properties (fundos) they have been possessing, essentially because they have held them publicly, peacefully, lawfully, and as owners. As established in the statement of proven facts (hechos probados), the property over which acts of possession (actos de posesión) were exercised was in fact privately owned at one time and was subsequently acquired by the Instituto de Desarrollo Agrario for the purpose of being subdivided and transferred to the plaintiffs, one portion to each of them. At the time of that acquisition, insufficient time had elapsed for a right of ownership to be acquired through acquisitive prescription (prescripción positiva) with respect to third-party private individuals. Clearly, Nombre110740, Nombre110728, Nombre110729, Nombre110730 and Nombre110731 had a legitimate expectation (confianza legítima) regarding their possession, since everything suggested that they would become beneficiaries of the property.

However, in the case of Nombre110729, Nombre110728 and Nombre110730, their confessional testimony (confesional) shows that they were aware that their applications had been expressly denied, and the grounds for the denial appear in the case file; although in some cases it cannot be determined with certainty whether that decision was served on the interested parties, the fact remains that they knew their applications had not been accepted. In the other two cases, they are aware that their cases have not been evaluated. As already indicated, the allocation of parcels (adjudicación de lotes) by the Instituto de Desarrollo Rural (formerly IDA) is carried out pursuant to legal provisions governing its conduct. This is an exceptional regime departing from private property rules, imbued with the public interest (interés público), and subject to special rules on acquisition and conveyance (traspaso), as discussed in the preceding recital.

Possession of property is a factor that carries weight in a potential allocation, but it is not the only one. Articles fifty-five, sixty-two and sixty-three of the Ley de Tierras y Colonización unequivocally establish other additional requirements, supplemented by Article seven of the Reglamento para la Selección y Asignación de Solicitantes de Tierras del Instituto de Desarrollo Agrario, which precludes allocation or conveyance to persons who have not previously undergone a selection process and been declared eligible. Indeed, subsection fourteen of Article two of that regulation defines an eligible person as one who, based on a series of parameters established by the public entity, obtains a minimum score of sixty-five points. Mere possession therefore does not per se entail a right to receive an allocation or eventually become the owner of the real property (inmueble) in cases such as the one under review, where the property belongs to a public entity and was acquired for purposes defined by law.

The person must necessarily qualify under the institution’s parameters, requirements and procedures; therefore, if that subjective legal status (situación jurídica subjetiva) is not demonstrated, the existing occupation cannot be deemed lawful. The entity’s mere tolerance of a person’s presence and occupation of the property is likewise insufficient when the entity holding title invokes and possesses specific regulations governing how title to the property may be obtained. In the case under review, it should be noted that the plaintiffs have not reliably demonstrated that the findings contained in the defendant entity’s technical studies are untrue or attributable to other reasons, and those studies are therefore presumed lawful. For that reason, the defendant entity cannot be compelled to convey title to the respective properties to the plaintiffs. Although it is alleged in this case that the land is being allocated to third parties to fulfill political commitments unrelated to the regulatory framework, that argument amounts to nothing more than unfounded speculation, unsupported by any evidence beyond the plaintiffs’ own assertions.

Likewise, the list of unproven facts (hechos no probados) shows that there is not a single item of evidence from which the existence of a defect in the administrative denial (acto administrativo denegatorio) could be established in the cases of the persons who received adverse determinations. Even under the plaintiffs’ own reasoning—which, we reiterate at the outset, is inapplicable because of the special property regime at issue—it is indisputable that prescription (prescripción) requires at least two elements: the passage of time and inaction by the titleholder; pursuant to Articles three hundred twenty and eight hundred fifty-three of the Código Civil, this situation must continue for ten years, in good faith (buena fe) and under color of title (justo título). The absence of an instrument transferring ownership (título traslativo de dominio) vitiates good faith. This anomalous situation cannot be validated merely by the passage of time, given the non-prescriptible nature (carácter imprescriptible) of real-property ownership and the impossibility under Costa Rican law of unilateral appropriation outside the law.

We recognize that legislators in other jurisdictions have chosen a different approach, but those positions cannot be applied in our case when the applicable provisions are unequivocally clear. The concept of the social function of property (función social de la propiedad) has a clear protective content intended to safeguard the weaker party in a relationship in which the inviolability of property yields to the more transcendent ideal of protecting the person actually possessing agricultural land. Originally, case law made it possible to dispense with the requirements of color of title and good faith in proven cases of agricultural possession (posesión agraria), giving rise to significant development of agricultural law during the 1970s and 1980s; for more than two decades, however, national case law has clearly evolved toward an approach that protects the person actually possessing the land without eliminating the need for color of title, which is absent here because the plaintiffs expressly state in their own complaint that the property does not belong to them.

Thus, the ten-year prescriptive period (prescripción decenal) has not elapsed, nor can any color of title be established. Accordingly, even under the plaintiffs’ own reasoning, the claim cannot be granted because no legal provision supports it. It must therefore be denied for lack of any legal right supporting it. What this Chamber does find irregular is that Article sixty-six of the Ley de Tierras y Colonización provides that, before withdrawing a previously granted ownership right, the public entity must reimburse the necessary and useful improvements (mejoras necesarias y útiles) made by the interested party at their own expense, which is consistent with Articles three hundred twenty-eight, three hundred thirty and three hundred thirty-two of the Código Civil; such reimbursement is available even to a bad-faith possessor (poseedor de mala fe). Articles one hundred ninety et seq. of the Ley General de la Administración Pública may be interpreted in the same manner, since there is no basis for requiring a person dispossessed of the property to bear the loss without claiming compensation (indemnización).

Here, nothing indicates that possession was in bad faith, and the contrary is therefore presumed, particularly because, as already stated, there was a legitimate expectation that led these persons to maintain possession while awaiting a potentially favorable decision. The fact that this legal principle is established in the Ley de Tierras y Colonización with respect to ownership rights does not prevent its application to lesser rights, such as the right of possession (derecho de posesión). Since the existence of various agricultural possession activities has been established, there is no basis for denying the interested parties recognition of the improvements made, including plantings, crops, constructed infrastructure and animals raised on the property. With respect to those items, for which compensation was requested at the preliminary hearing (audiencia preliminar), this adjudicative body finds that payment is warranted because they constitute useful and necessary improvements.

As shown during the oral and public trial, some of them were intentionally destroyed by public officials during the administrative eviction (desalojo administrativo). That eviction was lawful as such because the property, then temporarily within the public domain (demanio público transitorio), was being unlawfully occupied; nevertheless, this did not authorize the failure to make the corresponding payment. Given the unlawfulness of the occupation by most of the plaintiffs, with the exception of Nombre110731 and Nombre110740, the Administration was legally entitled to evict the occupants from its property because it had been technically determined that they did not satisfy the regulatory requirements either to maintain their legal status regarding the property or to obtain title to it. Accordingly, there is no evidence that their occupation of the properties was lawful at the time of the respective eviction.

Prima facie, this situation gives rise to a right to the corresponding monetary award, because damages have been established based not on the eviction itself, but rather on the monetary recognition of improvements and crops. However, because the specific amount has not been determined, the plaintiffs—with the exception of Nombre110740—must pursue liquidation of their rights during the judgment-enforcement stage (etapa de ejecución de sentencia), with those rights being recognized only in the abstract. With respect to subjective non-pecuniary damages (daño moral subjetivo), certain special considerations are necessary. Lastly, the claim seeking to require the defendant to refrain from forcibly relocating the families is manifestly without merit, provided that it proceeds through lawful channels and recognizes the improvements, as required by the legal system itself.

VI. REGARDING THE SPECIFIC SITUATION OF MR. Nombre110740

Returning once again to the established facts, it is clear that the aforementioned gentleman has not undergone the selection assessment required by the legal system, which would indeed prevent him from being an awardee; however, it has also been established that he filed a petition requesting that his case be evaluated, which has not been resolved to date. The right to petition and receive a response, constitutionally enshrined in Article Twenty-Seven of the Constitution, guarantees the right to have this petition considered and resolved in a timely manner, which has not occurred in this case. That lack of a response constitutes abnormal conduct by the Administration which, although it does not authorize the granting of property rights under the terms requested, must be remedied as soon as possible by conducting the corresponding review and determining, based on the legal parameters, whether or not the gentleman is eligible, as a measure preceding consideration of any administrative eviction (desalojo administrativo).

Accordingly, the claim must be rejected insofar as it seeks issuance of the property title underlying the dispute, but the administrative conduct must be directed toward resolving the petition as appropriate. Regarding compensation for useful and necessary improvements (mejoras útiles y necesarias), this is an issue that must be weighed if the application is denied, as already reasoned; however, as the interested party acknowledged, he remains in possession to date, which would preclude any compensation in that regard at this time, when the injury is not actual but merely contingent. Thus, in that case there is not only a lack of legal entitlement to the property title, but that same defense also applies to the asserted claim for damages, as is hereby declared. The same situation applies to the requested order prohibiting eviction, which could be issued in due course, provided that the previously established petition has first been effectively resolved in accordance with the legal system and compensation has been made for any improvements for which compensation is appropriate. In any event, this issue is premature at this time, since the gentleman may well receive a favorable response.

VII. REGARDING THE PARTICULAR CASE OF MR. Nombre110731

Returning to the established facts, it is unquestionable that the aforementioned gentleman likewise has not undergone the selection assessment required by the legal system, which would indeed prevent him from being an awardee; however, it has been established that he filed a petition requesting that his case be evaluated, which has not been resolved to date. Once again, we are faced with a violation of the constitutional right to administrative protection (tutela administrativa), the right to petition and receive a response, and the right to administrative action generally. We are faced with a material omission by the Administration, namely its failure to provide the corresponding response to a specific request from an individual, which cannot be condoned. This does not create a right to have property rights vested on the grounds stated, but the administrative conduct must at least be directed toward providing the corresponding response under the applicable legal parameters and as soon as possible.

Regarding the liability claimed for compensation for useful and necessary improvements, as with the other claimants (except Mr. Nombre110740 ), compensation must be awarded under the same terms as for the other claimants, to be determined in the judgment-enforcement proceedings (ejecución de sentencia). In addition, the situation becomes highly particular with respect to subjective emotional distress (daño moral subjetivo). The aforementioned gentleman filed a petition with the head of the institution requesting an assessment of his specific situation; that petition was processed internally but has received no final response to date, thereby strengthening his legitimate expectation that he should not be evicted until such a response was issued. Despite this situation and without any justification, the gentleman was evicted; the resulting state of helplessness and powerlessness must have been extremely severe in this case, particularly because the legal system recognized his right to payment for the improvements, which has not been made to date.

Naturally, and without the need for further analysis, this adjudicative body finds that there is manifest subjective emotional distress for which compensation must be awarded. As a deductive inference in re ipsa, the failure to comply with the legal system caused harm to Mr. Nombre110731 for which compensation has been requested and must be awarded. The submitted calculation quantifies that harm at fifty million colones, an amount that, without further consideration, we deem excessive. As is well known, compensation for subjective emotional distress is intended to compensate for suffering endured—which in this case arose from abnormal conduct—not to confer unjust enrichment upon an individual. Considering the specific degree of harm caused by the failure to receive a response to a petition and by the execution of the corresponding eviction despite the pending resolution of that petition, together with the fact that he had to endure dispossession and the destruction of many of the useful and necessary improvements, as established in the record, we set the amount at three million colones for the aforementioned subjective emotional distress. That sum provides the indicated redress.

VIII. REGARDING THE CLAIMS OF THE OTHER CLAIMANTS

As has been noted, in the case of the remaining claimants (except Messrs. Nombre110740 and Nombre110731 ), in addition to rejecting the issuance of property titles for lack of legal entitlement, while awarding compensation for the useful and necessary improvements, it is necessary to rule on the requested compensation for subjective emotional distress. It is clear that once these persons learned that their applications had been denied, their continued presence on the property became unlawful, and they acknowledged that situation in their corresponding testimony under examination (confesional). The illegitimate nature of their possession precludes an award of compensation for any subjective emotional distress arising from the eviction itself. Nevertheless, their right to compensation for the improvements under the terms stated, and the public entity’s failure to make the corresponding payment, must have generated a sense of helplessness under the circumstances set forth in the complaint, from which liability for the subjective emotional distress that was also claimed and clarified during the oral and public trial may be derived.

In this case, the degree of harm is lower than that suffered by the claimant analyzed above in the preceding recital, because they were not awaiting any response to a pending petition, since they knew of the public entity’s adverse position regarding their applications for selection as awardees. In the opinion of this Panel, the amount of one million colones for each of those claimants is sufficient to compensate for that suffering, and that amount is hereby awarded. We reiterate that this award is not based on the failure to grant the property title previously requested, on the demand that the interested parties vacate the property, or on the execution of the eviction; rather, it is based on the failure to pay for the improvements within the time and under the conditions required by the legal system. It also bears noting that the amount sought by the claimants is excessive, while the amount awarded is more commensurate with the harm suffered.

IX. REGARDING THE DEFENSES

The defendant asserted the defense of lack of legal entitlement (excepción de falta de derecho). That defense must be sustained with respect to all claimants insofar as they seek issuance of property titles in their favor, as well as insofar as they seek not to be compelled to vacate the real property, because such a demand is lawful with respect to all persons who cannot qualify as awardees. Regarding the request for compensation for the harm suffered, however, compensation is appropriate only for the improvements and with respect to all claimants except Mr. Nombre110740 , as the case file contains no evidence of any compensable harm suffered by him; the asserted defense must therefore be sustained as to him.

X. REGARDING INDEXATION AND COSTS

Indexation (indexación) must be ordered sua sponte pursuant to Article One Hundred Twenty-Three of the Code of Administrative Litigation Procedure. It constitutes recognition of the loss of the purchasing power of money. If it were not awarded, the claimants would receive less money in terms of its purchasing power with respect to the specifically established amounts representing the harm suffered. Accordingly, with respect to the material damages suffered—the uncompensated improvements—indexation shall apply from the time those damages are specifically and finally determined in the judgment-enforcement proceedings until final payment. Because the public entity has been unsuccessful in all instances, because there was sufficient cause to litigate in the case of Mr. Nombre110740 , and because there are no grounds for exempting it, pursuant to Article One Hundred Ninety-Three of the Code of Administrative Litigation Procedure, the defendant is ordered to pay both categories of litigation costs (ambas costas del proceso).

POR TANTO:

The defense of lack of legal entitlement established by the defendant is partially sustained and is deemed rejected in all respects not expressly granted. The complaint is declared partially well-founded, and the Instituto de Desarrollo Rural is ordered to pay Messrs. Nombre110728 , Nombre110729 , Nombre110730 , and Nombre110731 for the improvements that the claimants demonstrate they had on the properties from which they were evicted, including plantings, crops, animals, and other investments made during their occupation of the parcels, in an amount to be determined in the judgment-enforcement proceedings. Indexation is awarded on those amounts from the time they are finally and specifically determined until final payment, pursuant to Article One Hundred Twenty-Three of the Code of Administrative Litigation Procedure. The public entity is likewise ordered to pay Mr. Nombre110731 the sum of three million colones as compensation for subjective emotional distress and to pay one million colones to each of Messrs.

Nombre110728 , Nombre110729 , and Nombre110730 . The remainder of the complaint is denied. Pursuant to Article One Hundred Twenty-Two of the Code of Administrative Litigation Procedure, the administrative conduct is directed toward resolving the selection applications of Messrs. Nombre110740 and Nombre110731 in strict accordance with the applicable legal system. Costs shall be borne by the unsuccessful party.

Voto N° 032-2013 TRIBUNAL CONTENCIOSO ADMINISTRATIVO, SECCIÓN CUARTA, San José, a las catorce horas con treinta minutos del veintitrés de abril de dos mil trece.- Proceso de conocimiento de los señores Nombre110740 , cédula de identidad número CED87490 - - , Nombre110728 , cédula de identidad número CED87491 - - , Nombre110729 , cédula de identidad número CED87492 - - , Nombre110730 , cédula de residencia número uno - cinco cinco ocho - cero cero cuatro siete ocho siete cero cuatro y Nombre110731 , cédula de identidad número CED87493 - - , en contra del Instituto de Desarrollo Rural (INDER) antes Instituto de Desarrollo Agrario (IDA), representado por el Lic. Jonathan Jiménez Ruiz, casado, abogado, cédula de identidad número CED14409 - - y vecino de San José. Los actores están siendo representados por el Lic. Nombre1037 , casado, abogado, vecino de Cartago, cédula de identidad número CED87494 - - . Las personas físicas son mayores, vecinas de los Chiles de Alajuela y agricultores, con las excepciones dichas.

RESULTANDO:

  1. 1Los actores pretenden "A) Que el Instituto de Desarrollo Agrario (IDA) queda obligado a adjudicar a los señores Nombre110740 .... Nombre110728 .... Estiven Abarca Rojas (Nombre5999) .... Nombre110730 ... Nombre110731 .... como dueños poseedores de la Finca El Higuerón partido de Alajuela Matrícula Placa19442, sus respectivas parcelas, haciendo las segregaciones correspondientes a cada uno. B) Que el Instituto de Desarrollo Agrario (IDA) debe pagarles el gran daño moral, que les ha causado con la angustia por amenaza de lanzarlos a su suerte después de haber invertido toda su vida en el desarrollo de su parcela. C) Que ese Instituto (IDA) debe abstenerse de llegar con familias a ubicarlas a la fuerza a la finca, dizque por compromisos políticos. D) Que el Instituto de Desarrollo Agrario (IDA) debe pagar ambas costas de esta Acción." En la audiencia preliminar se ajustaron las pretensiones para fijar la indemnización en la suma de cincuenta millones de colones por cada actor por las p é rdidas en las siembras, cultivos, animales y demás inversiones realizadas en el tiempo de ocupación de las parcelas, daño patrimonial consistente en la expectativa de poder vivir en las fincas objeto de la litis y daño moral en la situación de ser desalojados y la incertidumbre que han tenido que afrontar . Sin hacer desglose a lo interno del rubro por cada una de estas partidas (ver folio 72 del expediente judicial).
  2. 2El demandado se opuso a la pretensión y agregó la excepción de demanda defectuosa (ya resuelta interlocutoriamente) y falta de derecho.
  3. 3Que el juicio oral fue realizado el día ocho de abril pasado, disponiéndose la aplicación de los artículos ciento once del Código Procesal Contencioso Administrativo y cuarenta y siete del Reglamento, a efectos -exclusivamente- del dictado de la sentencia que nos ocupa de manera escrita.
  4. 4En los procedimientos se han observado las prescripciones de rigor y no se notan causales de nulidad capaces de invalidar lo actuado. Esta sentencia se dicta previo las deliberaciones de rigor y por unanimidad.

Redacta el Juez Madrigal Jiménez; y,

CONSIDERANDO:

I. DE LA BASE DEL PROCESO

Indican los actores que han sido poseedores de la Finca el Higuerón, en la Virgen de los Chiles por más de diez años, de forma quieta, pública, pacífica, continua e ininterrumpida a título de dueños. Siendo que dichas fincas pertenecen a Agrícola Don H.I.S. A., Agrícola H y H y Agrícola Industrial Rah S. A., todas representadas por el señor Nombre110741 . Siendo que el IDA hoy Instituto de Desarrollo Rural compró esas propiedades para adjudicarlas a los señores actores, inmueble actualmente identificado bajo la matrícula de Folio Real número Placa19442. Agrega que el ente público quiere ahora desalojar a sus representados para adjudicar a otras personas, lo que consideran moralmente injustificado, pues han invertido toda su vida, tiempo y patrimonio en sus siembras y construcción de sus viviendas. De lo cual deriva las pretensiones deducidas. La demandada no reconoce la posesión, pero sí acepta ser la propietaria del inmueble. Indica que conforme con la normativa que los rige para ser adjudicatario es necesario cumplir con los parámetros legales, siendo que algunos de los demandados fueron declarados inelegibles y otros nunca presentaron gestión alguna. De esa manera considera que su actuación es conforme a derecho.

II. HECHOS PROBADOS

De importancia para el dictado de esta sentencia, se tienen los siguientes hechos de relevancia:

  • 1)Que el Instituto de Desarrollo Rural (en su momento Instituto de Desarrollo Agrario) es propietario de la finca del partido de Alajuela, con matrícula de Folio Real Placa19448 - , que se ubica en los Chiles de la provincia de Alajuela y que presenta una cabida de cuatrocientos ochenta y cinco mil ochocientos dieciocho metros cuadrados con cuarenta y ocho decímetros cuadrados, siendo que dicha finca fue adquirida a gestión de los poseedores del inmueble (ver folios 9 y 10 del expediente judicial).
  • 2)Los señores actores ingresaron a la finca del IDA en la Virgen de los Chiles de San Carlos de Alajuela para los alrededores del año dos mil cinco (ver declaración del señor Nombre110742 rendida en el juicio oral y público).
  • 3)Que los actores han estado realizado labores agrarias en las fincas que han estado poseyendo (ver declaración del señor Nombre110742 rendida en el juicio oral y público).
  • 4)Los señores Nombre110740 y Nombre110731 no se han sometido a estudios de selección de tierras frente al Instituto de Desarrollo Agrario (hecho confesado por cada uno de los señores en el juicio oral y público).
  • 5)Que el señor Nombre110731 solicitó el veintinueve de marzo de dos mil once ante la Presidencia Ejecutiva del Instituto de Desarrollo Agrario se le realizaran los correspondientes estudios de selección (ver prueba ordenada para mejor resolver que figura a folios 98 y 99 del expediente judicial).
  • 6)Que el señor Nombre110740 solicito a principios del año dos mil doce ante el Instituto de Desarrollo Agrario se le realizaran los correspondientes estudios (ver prueba ordenada para mejor resolver que figura a folios 100 al 103 del expediente judicial).
  • 7)Que los señores Nombre110729 , Nombre110728 e Nombre110730 se sometieron a los estudios de selección de tierras que en su momento promovió el IDA (hecho confesado por cada uno de los señores en el juicio oral y público, así como que consta en el expediente administrativo correspondiente).
  • 8)Que los señores Nombre110729 , Nombre110728 e Nombre110730 fueron dictaminados negativamente a los estudios de selección que realizó el IDA (hecho confesado por cada uno de los señores en el juicio oral y público).
  • 9)En el caso del señor Nombre110729 , la negativa del beneficio se debió a que según el IDA estaba incluyendo personas en el núcleo familiar que no convivían con él (ver folio 19 del expediente administrativo de la solicitud de adjudicación).
  • 10)Que la señora Nombre110730 fue dictaminada negativamente al considerar que no demostró su capacidad técnica para afrontar la actividad agrícola (ver folio 10 del expediente de la gestión).
  • 11)En el caso del señor Nombre110728 , la negativa del beneficio se debió a que según el IDA estaba incluyendo personas en el núcleo familiar que no convivían con él y no demostraba capacidad técnica para la labor agrícola (ver folio 18 del expediente administrativo de la solicitud de adjudicación).
  • 12)En el caso del señor Nombre110743 el rechazo se fundamentó en la ausencia de demostración de la capacidad técnica como productor independiente y no se demostró la comercialización del producto (ver folio 17 del expediente judicial).
  • 13)Que ninguno de los actores presentaba al momento de la interposición del proceso, ni después de eso, alguna autorización para ocupar algún terreno del IDA (hecho confesado por cada uno de los señores en el juicio oral y público).
  • 14)El INDER intimó a principios de dos mil once a los señores Nombre110731 , Nombre110730 , Nombre110728 , Nombre110729 y Nombre110740 para que abandonaran el inmueble de su propiedad que estaba ocupando (ver folio del 3 al 6 del expediente administrativo de los referidos señores y 12 al 16 en el caso de la señora Nombre110730 , 6 al 11 en el caso del señor Nombre110728 ).
  • 15)Por resolución 365-12 D.M. de las nueve horas del siete de febrero de dos mil doce, el Señor Ministro de Seguridad Pública ordenó el desalojo administrativo del señor Nombre110731 (ver folio 34 del expediente administrativo del referido señor).
  • 16)Sin poderse precisar fecha exacta pero alrededor de finales del dos mil doce el IDA desalojo a los actores, a excepción del señor Nombre110740 , entregando las parcelas a otras personas (declaración de los señores Nombre110742 y Arguedas Vega, rendidas en el juicio oral y público, así como confesional del señor Nombre110740 y fotografías de folios 54 al 67 del expediente judicial).
  • 17)Con ocasión de la puesta en posesión se destruyeron los bienes inmuebles que se asentaban sobre la fincas, al igual que los cultivos y animales que poseían los actores afectados en dicho lugar (declaración de los señores Nombre110742 y Arguedas Vega, rendidas en el juicio oral y público, discos de publicaciones del diario La Extra y fotografías de folios 54 al 67 del expediente judicial).
  • 18)Que los actores, a excepción del señor Nombre110740 , sufrieron con ocasión del desalojo a que se vieron sometidos (ver declaración de los mismos señores rendida en el juicio oral y público que al Tribunal le merece fe).

III. SOBRE HECHOS NO PROBADOS

Se tienen como tales, los siguientes:

  • 1)Que los señores actores hayan constituido algún título legítimo sobre las fincas que poseían con anterioridad a la adquisición del bien por parte del Instituto de Desarrollo Rural, antes IDA (los autos).
  • 2)Que el acto denegatorio de la condición de adjudicatario dictado en su oportunidad por el demandado no acredite la debida fundamentación técnica (no hay prueba en ese sentido).
  • 3)Que todas las gestiones realizadas por los actores ante las diferentes instancias del INDER hayan sido resueltas oportunamente, así como que hubieran sido notificadas válidamente (los autos).
  • 4)Que la posesión de los actores no haya sido de buena fe (no hay prueba en ese sentido).
  • 5)El valor de los bienes que le fueron destruidos a los actores desalojados (los autos).
  • 6)Que la denegatoria de adjudicación frente a los actores tenga como fundamento un interés político, alejado de los que el ordenamiento reconoce (no hay prueba en ese sentido).
  • 7)El valor de los bienes que le fueron destruidos a los actores desalojados (los autos).
  • 8)La existencia del acto administrativo que ordena el desalojo administrativo en el caso de los actores a excepción del Nombre110731 ( los autos)
  • 9)Que el señor Nombre110740 haya sufrido algún daño que sea susceptible de indemnización con ocasión de los hechos que motivan esta demanda (no hay prueba en ese sentido).
  • 10)Que el ente público demandado haya realizado pago de mejoras a alguno de los señores actores (los autos).

I V. SOBRE EL RÉGIMEN JURÍDICO APLICABLE: Dispone la Ley de Tierras y Colonización, número 2825 del catorce de octubre de mil novecientos sesenta y uno, que el Instituto de Desarrollo Agrario tiene por objeto vincular al ciudadano a un régimen sano de posesión de la tierra, velando por que la asignación de este recurso promueva el aumento gradual de la productividad, propugnando por una justa distribución de su producto y la elevación de su condición socioeconómica, para de esa forma hacerlo partícipe consciente del desarrollo de la nación, logrando así una justa distribución de la riqueza y evitando las formas indirectas de explotación de la tierra (ordinal primero ibid.). En efecto la norma no es más que el desarrollo directo del artículo cincuenta constitucional, donde El Estado interviene en los medios de producción a fin de generar una sana distribución de la riqueza en favor de los grupos de mayor necesidad social.

En virtud de tales fines, es que se incentiva el derecho de toda persona de denunciar o informar la existencia de tierra en cuya explotación no se cumple con la función social de la propiedad. Este último concepto si bien fue descartado de la Asamblea Constituyente de mil novecientos cuarenta y nueve, fue recogido por el legislador ordinario, la doctrina y la jurisprudencia para fijar que la tierra presenta un interés público de ser el medio a partir del cual de manera directa o indirecta se producen los bienes y servicios necesarios para la existencia de la especie humana, de suerte que su explotación dentro de un ambiente ecológicamente equilibrado es una prioridad en la sociedad. Más aún cuando permite generar las parcelas rurales para personas de bajos recursos . Es un sistema especial y excepcional al derecho de propiedad consagrado en el párrafo primero de la norma constitucional, en protección de la parte débil de la relación a saber el agricultor, quien muchas veces tiene el interés y pone su esfuerzo pero carece de la tierra.

En mérito de tales cometidos, originalmente el Estado se declaró propietario de toda la tierra carente de dueño para distribuirla, y de manera ulterior, con el cierre de la barrera agraria el antiguo ITCO paso a ser el IDA, donde la Junta Directiva de dicha entidad tiene la facultad de promover planes de parcelación, disponer la adquisición de propiedad particular a fin de cumplir con sus fines económico-sociales, de constituir en propietarios a los campesinos a quienes les adjudica una parcela y de aprobar la adjudicación de fundos para el otorgamiento de los títulos respectivos. Como puede observarse en aras de hacer efectiva las políticas de parcelación de tierras (numeral 49 y siguientes ibíd.) la entidad ofrece condiciones muy favorables a los adquirentes, con cómodos sistemas de pago y bajas cuotas e intereses, con el objeto de promover la función social de la propiedad (numerales 58 a 61 ibíd.).

Inicialmente se consideró que todo el territorio nacional rural podía presentar esa orientación, siendo progresivamente matizada esa aseveración a partir del respeto a normas ambientales y del demanio público que impera en esas materias. Eso llevo a la institución a tecnificarse más y establecer cuales terrenos presentaban una vocación agraria, de forma tal que fuera verdaderamente aprovechable y que espacios del territorio nacional rural presentaban desde el plano jurídico y técnico otra vocación. Siempre propugnándose que los beneficiarios de estos planes de distribución recaigan sobre personas que destinen el inmueble para la propia manutención y de su familia, que tengan capacidad técnica y experiencia en trabajos agrarios, debiendo comprometerse a trabajar la parcela personalmente y con sus descendientes hasta el segundo grado de consanguinidad (ordinal 62 ibíd.). De igual forma, no se adjudicará más de una parcela a cada beneficiario y su extensión irá en proporción a los miembros de la familia (artículo 64 ibíd.).

Todo ello sin duda establece un régimen especial de propiedad, tutelado y protegido en forma agravada, con el objeto de destinarla al fin encomendado por ley, evitando así que la tierra sea dedicada a fines contrarios a su fin social, lo cual implicaría su desnaturalización. La naturaleza jurídica de este tipo de bienes fue durante mucho tiempo un tema de ardua discusión, pues si bien normalmente se les calificaba como bienes demaniales, si presentaban esta naturaleza resultaría imposible la transmisión hacia los particulares; mientras que por el contrario si se tomaban como bienes fiscales, podrían ser adquiridos por los medios propios del derecho común, desviándose el fin público que presentaban. La jurisprudencia y la doctrina resolvieron el conflicto bajo la categoría de bienes demaniales temporales o transitorios, de suerte que el bien presenta la condición dominical durante el tiempo que está en manos de la administración, lo que impide salir del dominio público por los medios comunes, dentro del patrimonio general del Estado, pero cumplidos los requisitos legales, la naturaleza pública desaparece, se desafecta el bien, para pasar a ser bien fiscal y consecuentemente transmisible conforme la norma legal especial para la materia (al respecto es posible ver el voto 2008-18434 de la Sala Constitucional).

Así las cosas, una vez acordada la adjudicación de las parcelas por venta, el Instituto expedirá a favor del ocupante un título de posesión provisional en que consten sus derechos y obligaciones, de modo que si el ocupante ha cultivado el mínimo señalado y cumplido a satisfacción las demás obligaciones, tendrá derecho a que se le otorgue el título de propiedad (artículo 65 ibíd.). En mérito de todo lo expuesto, se colige sin dificultad que el beneficiario no podrá traspasar el dominio de su predio, ni gravarlo, arrendarlo, subdividirlo sin autorización del Instituto, excepto que hayan transcurrido quince años desde la adquisición de la parcela y de que todas las obligaciones con dicho organismo estuvieren canceladas, en mérito de lo cual los contratos privados celebrados por el adjudicatario con terceros, no vincula a la entidad. En ese sentido se dispuso que incluso transcurrido tal plazo, si la enajenación de la parcela produce la concentración o subdivisión excesiva de la propiedad, el Instituto podrá adquirirlas en forma prioritaria (numeral 67 ibíd.).

Aunado a lo anterior, es dable indicar en torno a este régimen diferenciado de propiedad, y con base en lo estipulado en el artículo 67 ibíd., que el plazo de los quince años comienza a correr a partir de la adquisición, es decir del otorgamiento del título de propiedad (compraventa) y no de la ocupación o de la adjudicación administrativa. En torno a ello, para una correcta interpretación de la norma supra citada, se colige que se adquiere la parcela desde la inscripción registral a su nombre en virtud de la enajenación que realizara la entidad en su favor. Ello es así, porque es a partir de dicha data que registralmente se establecen y comienzan a correr las limitaciones impuestas, disponiéndose que la venta en los términos expuestos queda sujeta a las condiciones y limitaciones de la Ley 2825 de catorce de octubre de mil novecientos sesenta y ocho, toda vez que en los términos del ordinal sesenta y cinco citado, antes de la adquisición lo que se tiene es un título de posesión provisional no sujeto a las limitaciones, porque éstas se imponen una vez traspasado a nombre del parcelero el fundo, antes de ello no tendrían razón de ser, debido a que no se puede limitar aquello de lo cual no se dispone.

Quedando a salvo una excepción, que consideraremos más adelante. De acuerdo con la Ley de Tierras y Colonización, N° 2825, el Instituto de Desarrollo Agrario (IDA) está llamado a efectuar la parcelación de sus tierras para lograr, entre otros fines, una mejor distribución de la tierra, con propósitos de colonización, dando preferencia a aquellas zonas y tierras en donde existan núcleos de poseedores en precario y que se consideren aptas para sus objetivos. Las personas interesadas en convertirse en beneficiarias deben presentar la solicitud correspondiente, a fin de que se analice si califican como tales (artículo 55). Una vez acordada la adjudicación de las parcelas por venta, el Instituto expide a favor del ocupante un “título de posesión provisional” en que consten sus derechos y obligaciones. Luego, si el ocupante ha cultivado el mínimo señalado por el Instituto y cumplido a satisfacción todas las demás obligaciones, tendrá derecho a que se le otorgue título de propiedad (artículo 65).

La sanción para los eventuales incumplimientos de los deberes señalados a los beneficiarios está prevista en el ordinal inmediato anterior: “Artículo 66.- El incumplimiento de las obligaciones impuestas al ocupante de una parcela, causará, a juicio del Instituto, la pérdida del derecho sobre la misma.// En el caso de dictarse una resolución en tal sentido, que requerirá cuatro votos conformes de la Junta Directiva, la parcela volverá al dominio del Instituto con toda su dotación, reconociéndole éste al parcelero el valor de las mejoras necesarias o útiles que hubiere hecho de su peculio.” El fundamento lógico de la norma se sustenta en la ya señalada función social de la tierra; aún cuando como se puede ver el legislador presentó la debida prudencia de garantizar el derecho de las obras de buena fe realizadas por el adjudicatario ulteriormente revocado, bajo el principio de la prohibición del enriquecimiento sin justa causa.

De manera que si el ente público recupera el bien, para ser re adjudicado la lógica imperante es que los esfuerzos lícitos realizados con el peculio particular del particular perjudicado deben ser reintegrados. Dentro de estas se ubican naturalmente las siembras, cercas, e infraestructura desarrollada. Hacer lo contrario llevaría un perjuicio no justificable. Refiriéndose a esta última norma, señaló en su momento la Sala Constitucional:

“[El] contrato de adjudicación de tierras puede ser revocado por el Instituto de Desarrollo Agrario –al tenor de lo dispuesto en el artículo 66 de la misma ley de referencia–, antes del vencimiento [del plazo del artículo 67], si el beneficiado no cumple las condiciones estipuladas en la Ley de Tierras y Colonización y en el contrato de adjudicación, por cuanto el fundo se entrega con una finalidad determinada, esta es, la de promover la producción agraria, en atención a la vocación agrícola que se reconoce en estos fundo (sic).” (N° 2006-01806 de las 14:55 horas del 15 de febrero del 2006; los paréntesis cuadrados no son del original.)

Adelantándonos un poco al tema que nos ocupa, el principio antes señalado bien puede aplicarse incluso antes del momento de la confección de la escritura pública o incluso antes de la adjudicación. Es de recordar que como se ha indicado, las mismas normas abren puerta a la posibilidad de la invasión de terrenos incultos aún cuando presenten dueño, máxime cuanto el ente puede adquirir terrenos con vocación agrícola para ser adjudicados. Lo que lleva aparejado un reconocimiento de los derechos de las personas que han trabajado honradamente la tierra, al margen de si después no logran resultar adjudicatarios, norma que incluso tiene asidero en otras dispersas en el ordenamiento civil. Cabe señalar el canon trescientos veintiocho del Código Civil, que señala: “ARTÍCULO 328.- Además tendrá derecho el poseedor de buena fe a que el reivindicador le pague el precio que él haya dado por la cosa, el valor de las mejoras necesarias y el de las útiles, y a retirar los materiales de las de puro adorno, con tal que la separación pueda hacerse sin detrimento de la cosa reinvindicada y de que el propietario rehusé pagarle el valor que tendrían dichos materiales después de separados.

Mientras no se le haga el pago de lo que se le debe, puede retener la cosa en su poder.” Norma complementada con el artículo trescientos treinta del mismo cuerpo normativo al fijar: “ARTÍCULO 330.- El poseedor de mala fe tiene derecho a que se le abone el valor de las mejoras necesarias; respecto de las útiles tiene los mismos derechos, menos el de retención, que el poseedor de buena fe; las de puro adorno no puede retirarlas ni reclamar nada por ellas.” Sin perjuicio que la norma trescientos treinta y dos ibídem señala que se entiende por cada mejora: “ARTÍCULO 332.- Se tendrán como mejoras necesarias todos los gastos indispensables para la conservación de la cosa, y como útiles las que hayan aumentado el valor venal de la cosa….” De manera que sin temor a equivocarnos es posible asegurar de forma categoria la existencia de un derecho al reconocimiento de las mejoras de todo parcelero, en los términos y condiciones que la ley garantiza.

Por otro lado y c omo ya se adelantó, existe una excepción para el inicio del cómputo del plazo de limitaciones, que corresponde a la denominada morosidad administrativa, pero es necesario hacer algunas aclaraciones previas. La Administración Pública tiene el deber de ejecutar los actos administrativos favorables o declarativos de derechos que se encuentren firmes, cuando éstos han cumplido con todos los requisitos de eficacia previstos en el ordenamiento jurídico. Tal deber se desprende del artículo doscientos veintiocho de la Ley General de la Administración Pública (en adelante LGAP) que en lo que interesa señala que "... La Administración deberá dar cumplimiento a los actos administrativos firmes, a cuyo efecto serán aplicables las disposiciones del capítulo de ejecución de sentencias del Código Procesal Contencioso Administrativo...". El incumplimiento de ese deber, sea, la inejecución material de estas conductas formales administrativas favorables, se constituye en un manifestación de inactividad material que acarrea una lesión al titular del derecho contenido en el acto que, por inercia administrativa, no se ejecuta.

Es por ello que, si la Administración se niega o incluso incurre en mera inercia o inejecución de un acto (mora administrativa) a ejecutar ese acto favorable, el interesado puede acudir a solicitar su ejecución ante la jurisdicción contencioso administrativa, tal y como lo reitera el numeral ciento setenta y seis del Código Procesal Contencioso Administrativo (en adelante CPCA) cuando señala que "...Cuando la Administración Pública no cumpla sus actos firmes y favorables para el administrado, éste podrá hacerlos ejecutar de conformidad con el presente capítulo....". Así las cosas, este tipo de actos que declaran derechos en favor de los administrados deben ejecutarse de forma pronta y cumplida, para satisfacer el principio de tutela administrativa efectiva. Naturalmente, existe un tiempo razonable para el actuar administrativo, que depende de la actuación en concreto y que varía de circunstancia, más existe un margen razonable para el cumplimiento y uno irrazonable.

En el momento que se configura el segundo supuesto, la acción se torna ilícita y consecuentemente contraria al ordenamiento jurídico, sin perjuicio de derivar responsabilidad, al margen de la ejecución en vía jurisdiccional según lo ya señalado. La Administración solo podría negarse a ejecutarlos si ya se hubiera declarado la nulidad absoluta de aquél por los procedimientos y recaudos formales y sustanciales establecidos por el propio bloque de legalidad, esto es, el proceso de lesividad, tratándose de nulidades absolutas o el procedimiento regulado en el artículo ciento setenta y tres de la Ley General de la Administración Pública, si se está frente a una nulidad absoluta evidente y manifiesta. Retornando al tema de las limitaciones, c omo se adelantó, la regla general en la materia nos orienta a señalar que el plazo de las limitaciones opera a partir del momento en el cual se genera la correspondiente escritura de traspaso.

La inquietud remanente nos hace cuestionar que ocurre cuando la Administración adopta el acto favorable a los intereses del administrado, más no ejecuta la escritura de trasp a so. Véase que si fuera que el interesado dificulta el actuar administrativo la regla general ya señalada debería aplicarse, más si es el ente público la situación requiere mayor análisis. Evidentemente, sería posible que la persona afectada concurriera a la vía jurisdiccional no solo para la ejecución del acto favorable a sus intereses, sino también para que el tiempo que ha transcurrido de inercia administrativa le resulte aplicable a su beneficio. Al respecto, la primera de las pretensiones no merece la mayor discusión en tanto se trata efectivamente de un acto declarativo de derechos y favorable al administrado, que como tal no precluye su derecho de que sea ejecutado. Sobre la ilicitud de la conducta ha dicho la Sala Constitucional de la Corte Suprema de Justicia:

"En razón de lo antes expuesto, estima la Sala que, en el caso concreto, ha quedado debidamente acreditado que, los recursos administrativos planteados por el recurrente pendían de resolución, a la fecha de interposición del amparo –16 de enero de 2004-, a pesar de que el plazo legal establecido al efecto, había transcurrido sobradamente, por lo que se produjo la mora administrativa acusada. Tal y como lo ha indicado este Tribunal en sus precedentes, la obligación de la Administración no se acaba al resolver las gestiones o solicitudes ante ella planteadas, sino, al momento en que se ponga en conocimiento del gestionante la resolución adoptada, o sea, con su notificación. Para la Sala, las “justificaciones” de la recurrida no son de recibo. El hecho de que en el trámite de la gestión recursiva planteada por el amparado intervengan distintas instancias –sean estas administrativas o ministeriales-, o la cantidad de trabajo que tienen las dependencias recurridas, no exime a la Administración Pública de resolver la gestión dentro de un plazo razonable; lo que en el caso concreto no ha ocurrido.- CONCLUSIÓN.

A partir de lo indicado por las autoridades recurridas en sus informes, y de las pruebas agregadas a los autos, esta Sala estima que la Administración ha incurrido en mora administrativa, al haber transcurrido sobradamente el plazo de ley (art. 261.1 de la Ley General de la Administración Pública y 27 y 41 de la Constitución Política) para la resolución definitiva de lo gestionado por el amparado, por lo que se ha producido un quebranto al derecho a una justicia administrativa pronta y cumplida. En consecuencia, se declara con lugar el presente recurso de amparo." (voto 2004-13658 de la Sala Constitucional, 18:19 horas, 30 de noviembre de 2004) Como se indicó la norma legal parte de la premisa que el computo de la inamovilidad del bien entregado inicia a partir de la transmisión del bien, que por regla propia de los bienes de naturaleza real ocurre en el momento del transpuso de este por la correspondiente escritura pública.

Más por otro lado, la lógica que impera en la materia es que la ejecución se realiza con la correspondiente celeridad. El indicar, en esos supuestos, que es a partir de la escritura pública que inicia a correr el plazo de las limitaciones legales llevaría aparejado que la inercia administrativa genere un castigo hacia el particular quien asumiría un lapso de inmovilización del bien por un espacio temporal superior a lo que el ordenamiento señala. Implica cargarlo de un efecto negativo que no le es achacable y sin sustento alg un o para hacerlo. Ya en varias ocasiones hemos indicado el deber de la función pública de actuar con eficacia y eficiencia en su función, de suerte que no es suficiente con prestar el servicio público, sino que este debe contar con niveles mínimos de calidad para garantizar a los ciudadanos una efectividad en la prestación consecuencia de su manutención a cargo del erario.

En dicho marco, este Tribunal y la Sala Primera de la Corte Suprema de Justicia se orientado por considerar que la morosidad administrativa no podría perjudicar al beneficiario del acto, sino que debe cargarse al verdadero culpable, a saber la propia administración autora. Una interpretación teleológica de la norma legal nos lleva a la consecuencia de que el interés es que dichos bienes se entregan a manos de particulares para distribuir la riqueza y que la inmovilización es para evitar la concentración de la riqueza. Lo que no consideró el legislador es que el agricultor recurre al crédito para sus cosechas, y estas limitaciones le impiden acceder a condiciones de crédito en condiciones blandas ante la ausencia de una garantía. La imposición de la negativa a cualquier tipo de acto de comercio con esos bienes representa una carga que se vería incrementada por la actuación administrativa y sin fundamento alguno.

Todo lo cual nos lleva a la necesaria consecuencia que a debemos alejarnos de cualquier postura exegética de la norma y procurar cumplir el fin. Lo que es coherente con el artículo diez de la Ley General de la Administración Pública. No puede dejar de mencionarse que de manera reciente, el IDA paso a ser el Instituto de Desarrollo Rural, pretendiendo realizar una visión más integral del paradigma agrícola nacional.

V. SOBRE EL CASO EN CONCRETO

Conforme con la pretensión acreditada se solicita que se declare a los señores actores dueños de los fundos que han venido poseyendo, básicamente por haber estado en dicha condición de una forma pública, pacífica, ajustada a derecho a título de dueño. Según se constata en la relación de hechos probados, la finca sobre la cual se realizaron actos de posesión, efectivamente en algún momento fue propiedad privada y fue adquirida de manera ulterior por parte del Instituto de Desarrollo Agrario con el fin de ser segregada y entregada a los actores en razón de una parte para cada uno de ellos . Al momento de dicha adquisición no había transcurrido un plazo suficiente para generar la adquisición de un derecho de propiedad por prescripción positiva con respecto a los terceros personas civiles . Evidentemente, existe una confianza legítima de los señores Nombre110740 , Nombre110728 , Nombre110729 , Nombre110730 y Nombre110731 en cuanto a la posesión realizada en tanto todo hacía pensar que iban a ser los beneficiarios del bien.

Mas en el caso de los señores Nombre110729 , Nombre110728 e Nombre110730 , conforme con la confesional rendida son conocedores de que su solicitud fue rechazada de manera expresa , constando en el expediente los motivos, aún cuando en algunos casos no es posible tener seguridad de si ese acto les fue notificado o no a los interesados lo cierto es que ellos conocían de la no aceptación de su gestión; y en los otros dos casos, tienen claridad que no se ha realizado el estudio en el caso de ellos. Como ya se indicó la adjudicación de lotes por parte del Instituto de Desarrollo Rural (antes IDA) se realiza al amparo de normas legales que reglamentan su forma de actuar. Se trata de un régimen de excepción al de propiedad privada, revestido del interés público, con normas especiales de adquisición y traspaso en los términos desarrollados en el considerando anterior. L a posesión de un bien es un elemento que pesa dentro de una eventual adjudicación, más no es el único.

Los artículos cincuenta y cinco, sesenta y dos y sesenta y tres de la Ley de Tierras y Colonización son c ontundentes en establecer otros requerimientos adicionales, lo que resulta complementado por el artículo siete del Reglamento para la Selección y Asignación de Solicitantes de Tierras del Instituto de Desarrollo Agrario donde se niega la posibilidad de asignación o traspaso a las personas que previamente no se han sometido a un proceso de selección, y que hubieran sido declarados elegibles. Incluso el inciso catorce de artículo dos del mencionado reglamento define elegible a aquella persona que conforme con una serie de parámetros establecidos por el ente público logra conseguir una calificación mínima de sesenta y cinco puntos. Es por ello que la mera posesión no implica per se un derecho a ser adjudicatario o eventualmente propietario sobre el inmueble en casos como el de examen, en que el bien es propiedad de un ente público y es adquirido con fines definidos por ley.

Necesariamente se requiere que la persona califique de conformidad con los parámetros, requisitos y procedimientos institucionales, por lo que si tal situación jurídica subjetiva no se demuestra, no es posible dar legitimidad a la ocupación existente. La mera tolerancia del ente en cuanto a la estadía y la ocupación sobre el inmueble tampoco es condición suficiente, cuando el ente titular invoca y posee regulación específica sobre cómo acceder a la titulación sobre el inmueble. En el caso en examen debe notarse que las partes actoras no demuestran fehacientemente que lo asentado en los estudios técnicos del ente demandado no sea cierto o responda a otros motivos, por lo que se presume la legitimidad de los mismos. Es por dicha razón que no es posible obligar al ente demandado a titular los inmuebles respectivos a favor de los actores. En este caso, si bien se indica que los terrenos se están asignando a terceras personas para cumplir con compromisos políticos ajenos al marco normativo lo cierto es que dicha argumentación no llega a ser más que una mera especulación sin fundamento alguno o prueba de sustento en ese sentido más que el mero dicho de los señores accionantes.

De igual manera, del elenco de hechos no probados se evidencia que no existe un solo elemento de convicción que permita establecer la existencia de un vicio dentro del acto administrativo denegatorio en el caso de las personas que fueron dictaminadas de manera negativa. Tomando como base el mismo razonamiento de los actores, el cual desde ya reiteramos que no es procedente por el régimen especial de propiedad en la que estamos, es incuestionable q ue para que se configure la prescripción es requisito cuando menos la existencia de dos requisitos el transcurso del tiempo y la inercia del titular, y conforme con los artículos trescientos veinte y ochocientos cincuenta y tres del Código Civil , dicha condición debe ser por el plazo de diez años de buena fe y con justo título. En ausencia de un título traslativo de dominio, vicia la buena fe. Esta situación anómala no puede ser convalidada por el simple transcurso del tiempo dado el carácter imprescriptible de la propiedad inmueble y la imposibilidad de apropiación unilateral al margen de la ley en el caso de la legislación costarricense .

Reconocemos que efectivamente en otras latitudes el legislador ha tomado partido en otra orientación, pero esas posturas no puede aplicarse en nuestro caso cuando las normas presentan una claridad incuestionable. El concepto de función social de la propiedad tiene un claro contenido protector cuya finalidad es tutelar al sujeto débil de una relación en la cual cede la inviolabilidad de la propiedad ante el ideal más trascendente de tutelar al poseedor efectivo de un fundo agrario. Originalmente, la jurisprudencia hace posible que los requisitos de justo título y buena fe no sean exigibles en los supuestos demostrados de posesión agraria , generando un gran desarrollo del derecho agrario en la décadas de los setenta y ochenta; pero la jurisprudencia nacional desde hace más de dos décadas ha evolucionado claramente hacia una concepción protectora del poseedor efectivo de la tierra, pero sin llega a suprimir la necesidad del justo título que en este caso no existe, en tanto los actores son claros en señalar en su misma demanda que el bien no es de su propiedad.

Así no ha transcurrido la prescripción decenal y tampoco es posible ubicar un justo título. De manera que aún aplicando el mismo razonamiento que utilizan los actores la pretensión no puede ser acogida, en tanto carece de norma alguna que le de abrigo. De suerte que se impone el rechazo de la misma por carencia de derecho que la sustente. Lo que sí encuentra irregular esta Cámara es que conforme con el artículo sesenta y seis de la Ley de Tierras y Colonización, establece que el retiro del derecho de propiedad previamente obliga al ente público a cancelar las mejoras necesarias y útiles que el interesado hubiera realizado de su peculio, lo que es coherente con los artículos trescientos veintiocho, trescientos treinta y trescientos treinta y dos del Código Civil, las que incluso proceden en el poseedor de mala fe. En el mismo sentido es posible interpretar los artículos ciento noventa y siguientes de la Ley General de la Administración Pública en tanto no es posible ubicar un sustento para que la persona desapoderada del bien deba soportar el sacrificio sin reclamar indemnización.

En este caso, nada indica que la posesión haya sido de mala fe, por lo que se presume lo contrario; máxime cuando como ya se indicó había una confianza legítima que determinó que estas personas poseyeran a la espera de un acto eventualmente positivo a su favor. Dicho principio legal, que en la Ley de Tierras y Colonización está establecido con respecto al derecho de propiedad en nada impide su aplicación hacia las figuras menores como el derecho de posesión. De suerte que habiendo sido acreditadas la existencia de una serie de actividades de posesión agraria, no existe sustento para negar a los interesados el reconocimiento de las mejoras realizadas entre las cuales se ubican las siembras, cultivos, infraestructura generada y animales desarrollados en el inmueble. Sobre dichos rubros requeridos su indemnización en la audiencia preliminar, es criterio de este órgano jurisdiccional que sí procede el pago en tanto corresponden a mejoras útiles y necesarias.

En este caso, conforme se evidenció en juicio oral y público algunas de ellas fueron destruidas de manera intencional por funcionarios públicos al momento del desalojo administrativo, acto que como tal es legítimo, al estarse realizando una invasión de un bien del demanio público transitorio, sin que ello facultara a que no se diera el correspondiente pago. Es un hecho que frente a la antijuridicidad de la ocupación de la mayoría de los actores, con excepción de los señores Nombre110731 y Nombre110740 ; la A dministración se encontraba en una situación lícita de desalojar a los ocupantes del inmueble de su propiedad, en tanto que técnicamente se estableció que ellos no reunían las condiciones reglamentarias para que mantuvieran su situación jurídica sobre él, o inclusive titular a su favor. En este orden de ideas, no se advierte prueba alguna de que al momento del desalojo respectivo, la ocupación de los inmuebles sea legítima.

Sobre dicha situación prima facie existe un derecho al reconocimiento económico correspondiente, a partir de estar demostrada la existencia de daños fundados no en el acto desalojo, sino más bien en el reconocimiento económico de mejoras y cultivos, pero no encontrándose establecida la cuantificación concreta no queda más que remitir a los accionantes (a excepción del señor Nombre110740 ) a la etapa de ejecución de sentencia a fin de liquidar su derecho, reconociéndolo únicamente en abstracto. Con respecto al daño moral subjetivo se hace necesario hacer algunas consideraciones especiales. Por último, sobre la pretensión para que la demandada se abstenga de reubicar a las familias a la fuerza, la misma resulta manifiestamente improcedente en tanto lo realice por los canales legales, y reconozca las mejoras, que el mismo ordenamiento impone.

VI. SOBRE LA SITUACIÓN EN CONCRETO DEL SEÑOR Nombre110740

Nuevamente retomando el elenco de hechos probados es claro que al referido señor no se ha sometido a un análisis de selección que establece el ordenamiento jurídico, lo que en efecto impediría que fuera adjudicatario; mas también se encuentra demostrado que él presentó una gestión solicitando que se valorara su caso la que no ha sido resuelta a la fecha. El derecho de petición y respuesta consagrada constitucionalmente por el artículo veintisiete de la carta fundamental garantiza el derecho a que esta gestión sea conocida y resuelta oportunamente lo que no ha ocurrido en la especie. Esa ausencia de respuesta, es una conducta anormal de la Administración, que si bien no faculta para otorgar el derecho de propiedad en los términos solicitada si debe ser solventada a la menor brevedad posible. Realizando el correspondiente estudio y estableciendo si el señor presenta o no la condición de elegible, a partir de los parámetros legales, como medida anterior a considerar cualquier desalojo administrativo.

De manera que la pretensión debe ser rechazada en cuanto constituir el título de propiedad base de la disputa pero si debe orientarse la conducta administrativa a resolver la gestión según proceda. En cuanto al reconocimiento de las mejoras útiles y necesarias es un aspecto que deberá ponderarse en caso de rechazarse la solicitud según lo ya razonado, más como reconoció el interesado a la fecha sigue siendo poseedor lo que impediría algún reconocimiento por ese aspecto en este momento cuando la lesión no es efectiva sino eventual. De forma tal que en ese caso no solo existe una carencia de derecho para el título de propiedad, sino también opera esa misma defensa con respecto a la pretensión indemnizatoria acreditada, lo que en efecto se declara. Igual situación ocurre con la orden de no desalojo, la que podría ser dictada en su momento, en tanto de previo se haya resuelto efectivamente la gestión en su momento acreditada conforme con el ordenamiento jurídico y se haga el reconocimiento de las mejoras que resulten procedentes. En todo caso, este aspecto resulta prematuro en este momento, pues bien podría ser que el señor recibiera una respuesta satisfactoria.

VII. SOBRE EL CASO PARTICULAR DEL SEÑOR Nombre110731

Retomando el elenco de hechos probados es incuestionable que al referido señor tampoco se ha sometido a un análisis de selección que establece el ordenamiento jurídico, lo que en efecto impediría que fuera adjudicatario; pero se encuentra demostrado que él presentó una gestión solicitando que se valorara su caso, la que no ha sido resuelta a la fecha. Otra vez nos encontramos frente a un incumplimiento del derecho constitucional a la tutela administrativa, al derecho de petición y respuesta y en general a la gestión administrativa. Estamos frente a una omisión material de la Administrativa que no puede ser consentida de otorgar la respuesta correspondiente ante una solicitud en concreto de un particular. No se genera el derecho a que se consolide el derecho de propiedad sobre las bases expuestas, pero si al menos debe orientarse la conducta administrativa para que se otorgue la respuesta correspondiente bajo los parámetros legales vigentes y a la menor brevedad posible.

En cuanto a la responsabilidad reclamada para el reconocimiento de mejoras útiles y necesarias, al igual que los restantes actores (a excepción del señor Nombre110740 ), debe ser otorgada en los mismos términos que a los restantes accionantes, a liquidar en ejecución de sentencia. Suma a lo antes dicho que la situación se torna muy particular con respecto al daño moral subjetivo. Véase como el referido señor presentó una solicitud ante el jerarca institucional solicitando se valorara su situación en concreto, la que fue canalizada internamente, sin respuesta definitiva a la fecha, lo que incrementa su confianza legítima de que no debía ser desalojado hasta tanto se generara esta. Pese a esta situación y sin justificación alguna el señor fue desalojado, la condición de desamparo e impotencia debió ser de suma gravedad en ese caso, máxime cuanto el ordenamiento jurídico le reconocía el derecho al pago de las mejoras las que no se han dado a la fecha.

Naturalmente y sin mayores esfuerzos es criterio de este órgano jurisdiccional que existe un manifiesto daño moral subjetivo que debe ser reconocido. Como inferencia deductiva in re ipsa la carencia de cumplimiento del ordenamiento jurídico presenta una afectación para el señor Nombre110731 que ha sido solicitada y que debe ser reconocida. En la liquidación presentada se cuantifica la misma en la suma de cincuenta millones de colones, importe que si mayores consideraciones consideramos como excesivo. Como es sabido el daño moral subjetivo pretende reconocer una indemnización a partir de un sufrimiento afrontado, que para el caso sería ante una conducta anormal, no el enriquecimiento sin justa causa de una persona. Considerando el nivel de afectación en concreto de no obtener respuesta a una solicitud y la ejecución del desalojo respectivo a pesar de estar pendiente la resolución de su petición, sumado al hecho de tener que afrontar el desapoderamiento y la destrucción de muchas de las mejoras útiles y necesarias, según se demostró en autos, fijamos el importe en la suma de tres millones de colones, con ocasión del indicado daño moral subjetivo. Rubro que permite la reparación indicada.

VIII. EN CUANTO A LA PRETENSIÓN DE LOS DEMÁS ACTORES

Como se ha venido señalando en el caso de los restantes actores (a excepción de los señores Nombre110740 y Nombre110731 ) aparte de rechazarse la constitución del título de propiedad por carencia de derecho, aún cuando si otorgar la indemnización a partir de las mejoras útiles y necesarias, se hace imperativo el pronunciamiento a partir del daño moral subjetivo solicitado. Es claro que desde el momento que estas personas conocían del rechazo de su solicitud, su permanencia dentro del fundo se tornaba antijurídica y ellos reconocieron esa situación en la correspondiente confesional. La condición de ilegitima de la posesión que presentaba determina la imposibilidad de reconocer algún daño moral subjetivo por el desalojo en si mismo. Más el derecho que presentaban al reconocimiento de las mejoras en los términos dichos y la ausencia de afrontar el correspondiente pago a cargo del ente público debió generar una sensación de desamparo en los términos presentados en la demanda, de lo cual es posible derivar la responsabilidad por daño moral subjetivo que también fue peticionada y aclarada en el juicio oral y público .

En este caso el nivel de afectación es menor que con respecto al señor actor precedentemente analizado en el considerando anterior, en tanto no había espera alguna de respuesta a gestión pendiente, toda vez que conocían de la posición negativa emitida por parte del ente público a la solicitud de selección para adjudicación. A criterio de este Colegio el importe de un millón de colones para cada uno de esos señores actores resulta ser suficiente para cancelar ese sufrimiento, reconociéndose dicho importe. Reiteramos que dicho reconocimiento no es por no haber otorgado el título de propiedad en su momento solicitado, o por el requerimiento de desalojo de los interesados o la ejecución de este; sino por la ausencia de afrontar el pago de las mejoras en el término y condiciones que el ordenamiento impone. No es de sobra señalar que el monto pretendido por los actores es exagerado, siendo el rubro reconocido más acorde con el daño afrontado.

IX. SOBRE LAS EXCEPCIONES

Se alegó por el demandado la excepción de falta de derecho. Defensa que debe ser acogida con respecto a la totalidad de los actores en tanto pretenden que se genere el título de propiedad a su favor, al igual que con respecto a no ser compelidos a salir del bien inmueble, en tanto dicho requerimiento es lícito con respecto a todas aquellas personas que no resulte posible ser adjudicatario. Por su parte, en cuanto a la solicitud para el reconocimiento del daño afrontado, el mismo solo es procedente en cuanto a la mejoras y con respecto a todos los actores a excepción del señor Nombre110740 , quien no existe acreditado en el expediente que exista daño alguno que reconocer, sobre quien si procedería acoger la defensa interpuesta.

X. EN CUANTO A LA INDEXACIÓN Y LAS COSTAS

En cuanto a la indexación la misma viene impuesta de manera oficiosa conforme con el artículo ciento veintitrés del Código Procesal Contencioso Administrativo. Se trata de un reconocimiento a la pérdida del valor adquisitivo del dinero. De no otorgarse se estaría entregando a los actores menos dinero (con respecto a su capacidad adquisitiva), de manera que sobre los rubros establecidos en concreto que representan el daño sufrido. De manera que sobre los daños materiales sufridos (las mejoras no reconocidas) la indexación procede desde el momento en que sean en concreto y firme en vía de ejecución de sentencia y hasta su pago definitivo. Siendo vencido el ente público en todos los casos y existiendo suficiente motivo para litigar en el caso del señor Nombre110740 y no existiendo mérito para su exoneración, de conformidad con el numeral ciento noventa y tres del Código Procesal Contencioso Administrativo, se condena al demandado al pago de ambas costas del proceso.

POR TANTO:

Se acoge parcialmente la defensa de falta de derecho acreditada por la demandada, entendiéndose rechazada en todo aquello que no sea otorgado expresamente. Se declara parcialmente con lugar la demanda y se condena al Instituto de Desarrollo Rural a cancelarse a los señores Nombre110728 , Nombre110729 , Nombre110730 , y Nombre110731 , las mejoras que demuestren los actores que tenían en los fundos de los cuales fueron desalojados, las siembras, cultivos, animales y demás inversiones realizadas en el tiempo de ocupación de las parcelas, monto a establecer en ejecución de sentencia. Sobre dichos importes se reconoce indexación desde el momento que sea fijado en firme y concreto y hasta su pago definitivo de conformidad con el artículo ciento veintitrés del Código Procesal Contencioso Administrativo. Igualmente, se condena al ente público a cancelarle al señor Nombre110731 la suma de tres millones de colones por concepto de daño moral subjetivo y un millón de colones para cada uno de los señores Nombre110728 , Nombre110729 e Nombre110730 .

En lo demás se declara sin lugar la demanda. De conformidad con el artículo ciento veintidós del Código Procesal Contencioso Administrativo, se orienta la conducta administrativa a fin de que se resuelva la solicitud de selección de los señores Nombre110740 y Nombre110731 , en estricto apego al ordenamiento jurídico vigente. Son las costas a cargo de la vencida.
