APPEAL ON POINTS OF LAW (RECURSO DE CASACIÓN) filed in these proceedings brought against Nombre467., of legal age, unmarried, […]; for the offense of VIOLATION OF THE LEY FORESTAL, to the detriment of NATURAL RESOURCES. Judges Alfredo Chirino Sánchez and Jorge Luis Arce Víquez, and Judge Tatiana López Monge, participated in deciding the appeal. Attorney Olman Antonio Rodríguez Brunett appeared before this Court in his capacity as Criminal State Attorney.

FINDINGS:

I.By oral judgment number 70-2011, issued at catorce horas treinta y nueve minutos on quince de junio de dos mil once, the Heredia Criminal Court, Sarapiquí seat, ruled: “POR TANTO: In accordance with the foregoing and pursuant to Articles 39 and 41 of the Political Constitution, 08 of the American Convention on Human Rights, 11 of the Universal Declaration of Human Rights, 01, 30, 31, 45, 103 and 110 of the Criminal Code, 03, 05, 20, 21, and 61 subsection a) of the Ley 7575 Forestal, 1045 of the Civil Code, 122 and 124 of the Current Rules on Civil Liability of the Criminal Code, 01, 02, 06, 09, 75, 111, 116, 142, 186, 265 to 267, 270 and 324 to 366 of the Code of Criminal Procedure, Nombre467. IS ACQUITTED of all punishment and liability for the offense of VIOLATION OF THE LEY FORESTAL (IN THE FORM OF ILLEGAL HARVESTING OF FOREST RESOURCES ON PRIVATE PROPERTY), which he has been charged with committing to the detriment of NATURAL RESOURCES.

The civil damages action (Acción Civil Resarcitoria) brought by THE STATE against civil defendant Nombre467. IS DISMISSED. This criminal matter is resolved without a special award of costs. The costs of the civil action shall be borne by the plaintiff. Once the judgment becomes final, THE RETURN to its owner IS ORDERED of the Stihl 090 chainsaw, orange and white, serial number 115400831, together with its corresponding Vedova y Obando brand timber-sawing frame bearing plate 3092, as well as the pieces of wood seized from the accused under MINAET seizure record (acta de secuestro) number 0079. As this judgment is delivered orally, the parties are hereby notified of its contents upon its issuance. Should they wish to obtain a copy of the recording, they must submit a suitable digital-file storage device to the clerk’s office of this Court. The ruling shall be preserved in this Court’s digital decisions archive. Delivery of the judgment concludes at quince horas y quince minutos today.” (sic. folio, front and reverse, 172).

II.Attorney Olman Antonio Rodríguez Brunett, in his capacity as Criminal State Attorney, filed an appeal on points of law against the foregoing decision.

III.After the corresponding deliberation was conducted in accordance with Article 465 of the Code of Criminal Procedure, the Court considered the issues raised in the appeal on points of law.

IV. The relevant legal requirements have been observed in the proceedings

Criminal Judgment Appeals Judge Chirino Sánchez drafts the decision; and,

CONSIDERING:

I.Attorney Olman Antonio Rodríguez Brunett, representative of the State, acting in place of attorney Amira Suñol Ocampo, the State Attorney assigned to the proceedings, files an appeal on points of law against the oral judgment issued by the Heredia Trial Court, Dirección7970, at 14:39 hrs. on 15 de junio de 2011, in the proceedings against Nombre467. for Violation of the Ley Forestal, in the form of Harvesting Forest Resources on Private Property, to the detriment of Natural Resources and the State, in his capacity as defense counsel for the accused, pursuant to Articles 443, 444, and 445 of the Code of Criminal Procedure (Ley No.7594), and files an APPEAL ON POINTS OF LAW BASED ON PROCEDURAL GROUNDS (RECURSO DE CASACIÓN POR LA FORMA) within the statutory period against Judgment Number 239 - 2011, issued at 20: 45 hrs on jueves 9 de Junio del 2011 by the Heredia Flagrante Delicto Court.

II.First procedural ground: Failure to state reasons for the judgment due to noncompliance with the formal requirement to include a list of proven facts (Hechos Probados), resulting in inconsistency between the facts alleged in the indictment and those deemed proven in the judgment, in violation of Articles 142, 363, subsection c), and 369, subsection b), all of the Code of Criminal Procedure. According to the appellant, the trial judge decided not to list any proven facts because none were relevant to resolving this matter. He states that this omission renders the judgment inconsistent because there is no basis for the reasoning and assessment of the testimonial and documentary evidence undertaken in the judgment. The central thrust of his complaint is that the judge faulted the Public Prosecutor’s Office and the Office of the Attorney General of the Republic for failing to produce suitable evidence that no permits or authorizations had been issued by the State Forestry Administration to the accused or his family authorizing him to harvest forest resources on his property.

He considers that this judicial error requires the judgment to be annulled pursuant to the sanction established in Article 369, subsection b), of the Code of Criminal Procedure. There was also a failure to comply with Article 142 of the Code of Criminal Procedure; he therefore requests that the judgment be annulled and the legally required remand (reenvío) be ordered.

III.Second substantive ground: Failure to state reasons due to violation of the principle that matters must be governed by statute (principio de reserva de ley), established in Article 27 of the Ley Forestal, regarding the subjection of private forest-resource harvesting activities to the State Forestry Administration’s authorization regime. The appellant argues that the Ley Forestal, No. 7575, provides that any activity involving the harvesting and commercialization of forest resources consisting of more than tres árboles por hectárea on agricultural land without forest must necessarily be authorized by the Regional Environmental Council. He contends that the interpretation of this Article involves judicial error because the accused has not established that a harvesting permit was issued by the competent administrative authority. He states that this provision is a sine qua non requirement for every person using forest resources, because trees are biotic components of ecosystems and possess high commercial and industrial value.

The absence of evidence as to whether such a permit was issued does not alter the fact that the authorization regime established by law is a matter of public policy and must be complied with by every citizen. Moreover, it was established that at least cuatro de los doce árboles harvested had been cut in a forest area exceeding dos hectáreas, as demonstrated by the testimony of Mr. M., of MINAET. Obtaining the resulting forest product in a forest area requires the submission of a Forest Management Plan (Plan de Manejo de Bosque) and authorization from the Forestry Administration. He insists that the accused bears the “burden of proof” (carga de la prueba) to demonstrate that he had permission to harvest those forest resources. By imposing that burden of proof on the State, the judge declined to apply Article 27 of the Ley Forestal. He therefore requests that the appeal be granted and that the case be remanded to the Heredia Criminal Court, Puerto Viejo de Sarapiquí Seat, for new proceedings, including the reconvening of an oral trial in this matter.

IV.In view of the relationship between the two grounds for cassation on procedural form (casación por la forma), insofar as they challenge the reasoning of the judgment under review, they shall be decided jointly. The appeal in cassation (recurso de casación) filed by the representative of the Procuraduría General de la República is denied. The challenged judgment was delivered orally, and only an audio recording thereof exists. Beginning at folio 199 of the case file, there is an exact transcript of the judgment, and this Chamber has verified that the transcript matches the text delivered orally by the trial judge. Indeed, the judge found that there were no proven facts to list in the judgment because no suitable evidence had been introduced to establish the facts alleged to have been committed by the accused. According to the indictment (acusación), “...en fecha 31 de junio de 2008, without it being possible to determine an exact date, MINAET officials, while conducting a patrol through the hamlet of […], specifically on the property of Ms.

Nombre9913., found the defendant herein, Nombre467., and the co-defendant Nombre102374. —who is absent— sawing timber from various species, including: Guácimo Blanco, Anonillo, Chumico, Manga Larga, and Lagartillo, for the purpose of obtaining some advantage, benefit, utility, or gain from an area of forest.” The second alleged fact was that “...The defendants carried out the activity described above using an orange-and-white Stihl chainsaw, model 090, serial number 1154400831, which was not registered. Furthermore, when the officials of that Ministry asked them for the permits authorizing the harvesting and cutting of the timber they were sawing, they stated that they had no document permitting that activity.” The facts alleged in the private criminal complaint (querella) filed by the Procuraduría General de la República coincide with those set forth in the indictment. Thus, the defendants are accused of cutting forest resources in an area where cutting and harvesting permits are required, without having such a permit.

The principal reason the judge found that this circumstance had not been established and could not be included among the proven facts in the judgment was the failure to introduce suitable evidence, such as a MINAET certification establishing with certainty that no such permit had been issued to the defendants or to the owner of the property, Ms. Nombre9913., the mother of one of the defendants. He criticized the attempt to prove this circumstance instead solely through the testimony of Mr. M. of MINAET, who, for these purposes, acted as a public authority by requiring the defendants to show the permit authorizing those activities. In that capacity, he acted in an official role, and statements made to him cannot be used as lawful evidence to support a conviction. The judge also stated that the “burden of proof” does not rest upon persons subject to trial; rather, it was incumbent upon the prosecution and the private complainant to prove conclusively that no such permit existed.

In this regard, this Chamber fully agrees with the trial judge that, under the principle of onus probandi, the accused is not required to discharge a burden of proving innocence; that burden rests upon the accuser. The theory of the “burden of proof,” which has relevance in civil procedural law, for example, has no application whatsoever in criminal proceedings. As Nombre11760 aptly explains: “...it is sufficient to say that the category of burden or charge arose in procedural law as an attempt to replace the category of obligation, which is more technical and specific to substantive legal relationships, indicating that a person who failed to discharge a procedural burden omitted to exercise a power that would have prevented that person from being placed at a disadvantage with respect to the decision, or failed to use an opportunity to attain an advantageous position with a view toward the final judgment.

In truth, this defines nothing other than what legal theory generally calls a faculty, power, or right. In civil proceedings, however, the burden-of-proof theory has been used as a general rule for determining which party must prove the alleged facts and, consequently, how the judge must rule on alleged facts that have not been conclusively established; the rule explains that each party must prove the facts it invokes (onus probandi): the plaintiff must prove those supporting the claim, and the defendant must prove the preclusive facts invoked in the defense. Accordingly, a party who fails to establish what it asserts places the judge in the position of rejecting that hypothesis in the judgment by reference to the rule; because the court in civil proceedings is more an arbiter than an inquisitor, the rule governs the reconstruction of obscure or uncertain facts in light of the impossibility of a non liquet” (Nombre11760, Julio B.J, Derecho Procesal Penal.

Tomo I. Fundamentos, Buenos Aires, Argentina, Editores del Puerto, Segunda Reimpresión, 202, p. 506). Criminal proceedings are governed by the principle of in dubio pro reo; therefore, if the elements of the punishable act have not been established with certainty, the accused must be acquitted because the constitutionally protected presumption of innocence has not been overcome. Nombre11760 states this eloquently: “...the accused has no need to construct his innocence, which has already been established in advance by the presumption protecting him; rather, anyone who would convict him must completely destroy that position by attaining certainty that a punishable act was committed” (Nombre11760, op. cit., p. 507). It follows from this, and from the predominantly adversarial structure characterizing our current criminal proceedings, that the prosecuting authority and the private complainant bear the responsibility of proving the guilt of the accused, which had to be established through suitable, relevant, and lawful evidence in accordance with the rules set forth in Articles 99, 175, and 181 of the Código Procesal Penal.

As the judgment correctly explains (folios 207 and 208 of the transcript of the judgment), it was necessary to prove conclusively that harvesting (aprovechamiento) had occurred, as defined in subsection a) of Article 3 of the Ley Forestal, consisting of the cutting or removal of standing trees or, as in this particular case, the removal of fallen trees. It was also necessary to prove that no permit existed for the activity and that the events took place on private property. The judge complained that there was insufficient suitable evidence of these circumstances beyond the testimony of the MINAET official who appeared at the hearing. Finally, it was necessary to prove that the activity could have generated an advantage, benefit, or utility for the accused, which, in a residual sense, could indeed have been established through the testimony received. Nevertheless, proving only some elements of the objective offense is insufficient; the objective conformity of the conduct to the statutory offense (tipicidad objetiva) must be proved, and that has not been possible in this case.

The judgment under review demonstrably engages in these same considerations, citing cassation precedents, as may be verified at folios 202 and 203 of the transcript of the oral judgment delivered in the case. It emphasizes that the testimonial evidence, consisting of M.’s testimony, had been compelling and of high quality insofar as it established the day and place on which the events occurred, that the defendant was sawing timber, that the timber was from various species, and that he was performing the work with a chainsaw; however, the evidence was insufficient to establish a central element of the offense: the absence of a permit. The judge emphasized that, unlike in other similar proceedings, this case contained no MINAET certification stating whether the respective permit had been issued, which would have been the suitable means of determining whether the activity undertaken had official authorization and whether it was, in fact, illegal timber sawing.

The criminal offense is clear in deeming both timber sawing without a permit and timber sawing beyond the scope of the authorization granted to be unlawful. It is also true that the statements made by the accused to the MINAET official, without the legally required warnings having been given, constituted an admission of incriminating elements that he might well not have made had he known that the statement could be used against him, since officials of the Forest Administration act with police authority, as established by Article 54 of the Ley Forestal (cf. fl. 204 of the transcript of the judgment). Nor was this a spontaneous statement by the party that the police could later introduce when testifying at trial. The defendants had already been identified as suspects in unlawful conduct, and the questioning to which they were subjected could incriminate them by providing the police with information that would be used against them, thereby seriously impairing their constitutional right to remain silent.

Even so, had suitable evidence been introduced proving the absence of permits for the activity undertaken, there would have been sufficient grounds for establishing the existence of the basic requirements of conformity to the statutory offense and unlawfulness (antijuridicidad), thereby making it possible to attribute the unlawful act to the defendants. The judge was correct not only in refusing to consider this statement by the MINAET official, but also in criticizing the investigative and prosecutorial activities undertaken by the Ministerio Público and the Procuraduría General de la República. Following this same line of reasoning, the arguments raised in the second ground of the appeal must likewise be rejected. According to the Procurador, the Ley Forestal, No. 7575, provides that any activity involving the exploitation and commercialization of forest resources consisting of more than three trees per hectare on agricultural land without forest must necessarily be authorized by the Consejo Regional Ambiental.

Accordingly, there would have been judicial error in the interpretation of this article because the accused did not prove that an exploitation permit had been issued by the active Administration. This argument is unavailing for the reasons already explained. Whether the permit exists is not something the accused must prove; proving it is the responsibility of the prosecuting authorities. Although this is a matter of public order and a legal requirement that should be known to everyone, especially those engaged in forestry activities, Article 27 of the Ley Forestal does no more than impose a mandate that must be obeyed; it does not provide a specific instruction to convict upon a finding that an activity may contravene that mandate. In democratic criminal proceedings, the commission of a punishable act must still be lawfully attributed to the accused, with full application of the principle of minimum evidentiary activity (mínima actividad probatoria) set forth in Articles 175 and 181 of the Código Procesal Penal.

It is true that the activity was suspected of violating this legal mandate and that at least four of the twelve harvested trees had been cut in a forest area exceeding two hectares, as established through the testimony of Mr. M. of MINAET; even so, lawful and relevant evidence was still required to prove that the activity was not covered by official permits.

This alternative formulation of the burden-of-proof principle (principio de carga de la prueba), as a means of indirectly declining to apply section 27 of the Ley Forestal, is an argument that collapses under its own weight, not only because it consists of a rule that cannot be supported under the constitutional and statutory framework of our criminal proceedings (proceso penal), but also by virtue of the presumption of innocence (principio de estado de inocencia) enshrined in Article 39 of the Constitution. Accordingly, both grounds of the appeal on points of law (recurso de casación) filed by the Office of the Attorney General of the Republic (Procuraduría General de la República) must be denied.

THEREFORE:

The appeal in cassation filed by attorney Olman Rodríguez Brunett, on behalf of the Procuraduría General de la República, is hereby denied. Notice shall be given.- Alfredo Chirino Sánchez Jorge Luis Arce Víquez Tatiana López Monge Judges of the Criminal Judgment Appeals Court Accused: Nombre467.

I.Que mediante sentencia oral número 70-2011, de las catorce horas treinta y nueve minutos del quince de junio de dos mil once, el Tribunal Penal de Heredia, sede Sarapiquí, resolvió: "POR TANTO: De conformidad con lo expuesto y con sustento en los artículos 39 y 41 de la Constitución Política, 08 de la Convención Americana sobre Derechos Humanos, 11 de la Declaración Universal de Derechos Humanos, 01, 30, 31, 45, 103 y 110 del Código Penal, 03, 05, 20, 21, y 61 inc. a) de la Ley 7575 Forestal, 1045 del Código Civil, 122 y 124 de las Reglas Vigentes Sobre Responsabilidad Civil del Código Penal, 01, 02, 06, 09, 75, 111, 116, 142, 186, 265 a 267, 270 y 324 a 366 del Código Procesal Penal, SE ABSUELVE de toda pena y responsabilidad a Nombre467. por el delito de INFRACCIÓN A LA LEY FORESTAL (EN SU MODALIDAD DE APROVECHAMIENTO ILEGAL DE RECURSOS FORESTALES EN PROPIEDAD PRIVADA) que en perjuicio de LOS RECURSOS NATURALES se le ha venido atribuyendo.

Se DECLARA SIN LUGAR la Acción Civil Resarcitoria incoada por EL ESTADO en contra del demandado civil Nombre467. Se resuelve la presente sin especial condenatoria en costas en lo penal. Son las costas de la acción civil a cargo de la parte actora. Firme el fallo, SE ORDENA LA DEVOLUCIÓN a favor de su propietario, de la Motosierra Marca Stihl 090 color naranja con blanco serie 115400831 con su respectivo marco para aserrar madera marca vedova y obando con placa 3092, así como de las piezas de madera decomisadas al endilgado mediante acta de secuestro número 0079 del MINAET. Siendo esta sentencia dictada en forma oral, quedan las partes notificadas de su contenido con su dictado. En caso de que deseen obtener una copia de su grabación deberán presentar un dispositivo apropiado para el almacenamiento de archivos digitales ante la secretaría de este despacho. Lo resuelto se respaldará en el archivo de resoluciones digitales de este Tribunal. Se termina con el dictado de la sentencia al ser las quince horas y quince minutos del día de hoy." (sic. fl. fte. y vto. 172).

II.Que contra el anterior pronunciamiento interpuso recurso de casación el licenciado Olman Antonio Rodríguez Brunett, en calidad de Procurador Penal.

III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de casación.

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta el Juez de Apelación de Sentencia Penal Chirino Sánchez; y,

CONSIDERANDO:

I.El licenciado Olman Antonio Rodríguez Brunett, representante del Estado, en sustitución de la licenciada Amira Suñol Ocampo, Procuradora Titular del proceso, formula recurso de casación contra la sentencia oral dictada por el Tribunal de Juicio de Heredia, Dirección7970, de las 14:39 hrs. del 15 de junio de 2011, en el proceso que se le sigue a Nombre467. por Infracción a la Ley Forestal, bajo la modalidad de Aprovechamiento de Recursos Forestales en Propiedad Privada, en perjuicio de los Recursos Naturales y el Estado, en su condición de Defensor del imputado, de conformidad con los artículos 443, 444, y 445 del Código Procesal Penal ( Ley No.7594 ) interpone RECURSO DE CASACIÓN POR LA FORMA dentro del término de ley contra la Sentencia Número 239 - 2011, dictada a las 20: 45 hrs del día jueves 9 de Junio del 2011, por el Tribunal de Flagrancias de Heredia.

II.Primer motivo por la Forma: Falta de fundamentación de la sentencia por inobservancia de la formalidad de incluir un elenco de Hechos Probados, lo que causa incongruencia entre los hechos de la acusación y los tenidos como probados en la sentencia, inobservando los artículos 142, 363, inciso c) y 369, inciso b), todos del Código Procesal Penal. Según el recurrente, el juzgador de mérito decide no listar ningún hecho probado en virtud de que no hay ninguno de interés para la resolución del presente asunto. Dice que esta ausencia torna el fallo en incongruente, pues no hay fundamento para el razonamiento y valoración que se hace de la prueba testimonial y documental que se realiza en el fallo. La línea central de su queja radica en que el juzgador reprochó a la representación fiscal y a la Procuraduría General de la República prueba idónea de la inexistencia de permisos o autorizaciones expedidos por la Administración Forestal del Estado para el imputado o su familia, que le dieran autorización a explotar recurso forestal en su finca. Considera que este yerro judicial acarrea la nulidad de la sentencia en aplicación de la sanción prevista en el artículo 369, inciso b) del Código Procesal Penal. También habría incumplimiento de lo mandado por el artículo 142 del Código Procesal Penal, por lo que solicita se anule la sentencia y se ordene el reenvío de ley.

III.Segundo motivo por el Fondo: Falta de fundamentación por violación al principio de reserva de ley establecida en el artículo 27 de la Ley Forestal en cuanto al sometimiento de la actividad privada de explotación del recurso forestal al régimen de autorizaciones de la Administración Forestal del Estado. Plantea el impugnante, la Ley Forestal, No. 7575, señala en cuanto a toda actividad de explotación y comercialización del recurso forestal, de más de tres árboles por hectárea en terrenos de uso agropecuario y sin bosque, debe necesariamente estar autorizado por el Consejo Regional Ambiental. Habría un yerro judicial en cuanto a la inteligencia de este artículo, pues no se ha acreditado por parte del acusado que haya habido un permiso de explotación expedido por la Administración activa. Dice que esta norma es un requisito sine qua non para toda persona que esté utilizando recursos forestales, por ser los árboles componentes bióticos de los ecosistemas y de elevado valor comercial e industrial.

El hecho de que no haya prueba de que tal permiso se haya o no emitido no afecta el hecho que el régimen de autorizaciones establecido por el ordenamiento jurídico es de orden público y de cumplimiento de todo ciudadano. Además hay demostración que la corta de al menos de los cuatro de los doce árboles aprovechados se había dado en una zona de bosque con una cabida superior a dos hectáreas, según se acreditó con el testimonio del señor M., del MINAET. La disponibilidad de producto forestal derivado en una zona de bosque requiere una solicitud de un Plan de Manejo de Bosque y autorización de la Administración Forestal. Insiste que es “carga de la prueba” del acusado demostrar que tenía permiso de aprovechar esos recursos forestales. Al exigir esa carga de la prueba por parte del Estado desaplica el juzgador el numeral 27 de la Ley Forestal. Solicita, por ello, se acoja el recurso, se ordene el reenvío al Tribunal Penal de Heredia, Sede Puerto Viejo de Sarapiquí, para una nueva substanciación convocando nuevamente a debate oral en el presente asunto.

IV.En virtud de la relación que mantienen los dos motivos de casación por la forma en cuanto a la queja sobre la fundamentación del fallo bajo examen, se procede a resolverlos de manera conjunta. Se declara sin lugar el recurso de casación planteado por la representación de la Procuraduría General de la República. El fallo cuestionado ha sido dictado en forma oral y del mismo hay constancia únicamente de audio. A partir del folio 199 de la causa, hay transcripción exacta del contenido de la sentencia y esta Cámara ha corroborado la coincidencia de esta transcripción con el contenido del texto que fue emitido oralmente por el juez de mérito. En efecto, se aprecia que el juez consideró que no había hechos probados que enlistar en el fallo, en virtud de no haberse traído prueba idónea que permitiera demostrar los hechos que fueron acusados como cometidos por el endilgado. Según la acusación, "...en fecha 31 de junio de 2008, sin poderse precisar una fecha exacta, funcionarios del MINAET, encontrándose en recorrido por el caserío […], propiamente en la propiedad de la señora Nombre9913., localizaron al aquí encartado, Nombre467. y al co-imputado Nombre102374. -quien se encuentra ausente- aserrando maderas de distintas especies, entre ellas: Guácimo Blanco, Anonillo, Chumico, Manga Larga y Lagartillo, con el propósito de obtener algún provecho, beneficio o ventaja, utilidad o ganancia, de un área de bosque".

Como segundo hecho acusado, se tiene que "...La actividad anteriormente descrita, la llevaban a cabo los encartados, con una motosierra color anaranjada con blanca, marca Stihl, 090, serie 1154400831, la cual no se encontraba inscrita. Asimismo, al solicitarle los funcionarios de dicho Ministerio, los permisos de aprovechamiento y corta de la madera que se encontraban aserrando, indicaron no contar con ningún documento que permitiera dicha actividad". Los hechos de la querella de la Procuraduría General de la República coinciden con los planteados en la acusación. Se tiene, pues, que se atribuye a los imputados haber estado cortando recurso forestal en una zona que requiere permiso de corta y aprovechamiento, para lo que no tenían permiso. La razón principal por la cual el juzgador consideró que esta circunstancia no se había comprobado y no podía ser un hecho probado del fallo, es que no se había incluido prueba idónea, tal como una certificación del MINAET que diera certeza que tal permiso no había sido emitido a favor de los encartados o de la dueña de la finca, madre de uno de los encartados, señora Nombre9913.

Deplora que se intentara probar esta circunstancia, al contrario, con la sola declaración testimonial del señor M., del MINAET, que para los efectos actuó como autoridad pública, requiriendo a los imputados que mostraran el permiso con el que contaban para tales actividades. En tal condición ostentaba un carácter oficial y lo manifestado a él no puede ser utilizado como prueba lícita para fundar un fallo condenatorio. Indica también, la "carga de la prueba" no descansa en los justiciables sino que, antes bien, son los órganos de la acusación y de la querella los que debieron demostrar fehacientemente que tal permiso no existía. Al respecto, esta Cámara coincide plenamente con el juzgador de mérito, en el sentido de que en virtud del principio de onus probandi, la demostración de la carga de la prueba de la inocencia no le corresponde demostrarla al imputado, sino al acusador. La teoría de la "carga de la prueba", que tiene sentido en el derecho procesal civil, por ejemplo, no tiene ninguna aplicación en el proceso penal.

Como bien lo expone Nombre11760: "...baste decir que la categoría carga o cargo se presentó en el Derecho procesal como un intento de reemplazar a la de obligación, más técnica y propia de las relaciones jurídicas materiales, indicándose que quien no cumplía con una carga procesal omitía desarrollar una facultad que lo preservaba de colocarse en situaciones desventajosas respecto de la decisión, o bien dejaba de utilizar una posibilidad de colocarse en una situación ventajosa, en miras a la sentencia final. Ello, en verdad, no define otra cosa que lo que la teoría jurídica nombra como facultad, potestad o derecho, de manera general. Pero, en el proceso civil, la teoría de la carga de la prueba se ha utilizado como regla de principio para determinar cuál de las partes debe demostrar los hechos afirmados, y, a la vez, como consecuencia, cómo debe decidir el juez sobre los hechos afirmados, que no han sido determinados fehacientemente; la regla explica que cada una de las partes debe demostrar los hechos que invoca (onus probandi): el actor los que fundan su demanda, y el demandado los impeditivos que invoca en su defensa, con lo cual quien no verifica aquello que afirma coloca al juez en situación de negar la hipótesis de la sentencia, por remisión a la regla; como el tribunal es, en el proceso civil, más un árbitro que un inquisidor, la regla define la reconstrucción de los hechos oscuros o inciertos, ante la imposibilidad del non liquet" ( Nombre11760, Julio B.J, Derecho Procesal Penal.

Tomo I. Fundamentos, Buenos Aires, Argentina, Editores del Puerto, Segunda Reimpresión, 202, p. 506). En el proceso penal rige la idea del in dubio pro reo, por lo que si no han sido verificados con certeza los elementos del hecho punible, lo que corresponde es absolver al justiciable, pues no ha sido derrumbada la presunción de inocencia que desde la perspectiva constitucional le acompaña. Nombre11760 lo sostiene elocuentemente cuando dice: "...el imputado no tiene necesidad de construir su inocencia, ya construida de antemano por la presunción que lo ampara, sino que, antes bien, quien lo condena debe destruir completamente esa posición, arribando a la certeza de la comisión de un hecho punible" (Nombre11760, op. cit., p. 507). Desde aquí, y por la estructura predominantemente acusatoria que caracteriza nuestro proceso penal vigente, es claro que es al órgano acusador y al querellante, a los que les corresponde demostrar la culpabilidad de los justiciables, lo que debió haberse demostrado con prueba idónea, pertinente y lícita, conforme a las reglas de los artículos 99, 175 y 181 del Código Procesal Penal.

Como bien se expone en el fallo (folios 207 y 208 de la transcripción del fallo) había que demostrar fehacientemente que hubo una acción de aprovechamiento, conforme al inciso a) del artículo 3 de la Ley Forestal, consistente en la corta o eliminación de árboles en pie o como era, en el caso concreto, una eliminación de árboles caídos. Además había que demostrar la inexistencia de permiso para la actividad, y que los hechos tuvieron lugar en una propiedad privada, de lo cual, se queja el juez, no hay suficiente prueba idónea, más allá de lo declarado por el oficial del MINAET que declaró en la audiencia. Finalmente, era necesario demostrar que la actividad podría haber generado ventaja, provecho o utilidad a los justiciables, lo que, de manera residual, sí hubiera podido ser demostrado con la declaración recibida. No obstante, no basta con la demostración de alguno de los elementos del tipo objetivo, sino que debe demostrarse la tipicidad objetiva del hecho, y esto es algo que no ha sido posible alcanzar en la especie.

En la sentencia bajo examen se comprueba entra en estas mismas consideraciones, con cita de precedentes de casación, tal y como es constatable a folios 202 y 203 de la transcripción de la sentencia oral que ha sido dictada en la causa. Subraya que la prueba testimonial, consistente en la deposición de M., había sido contundente y de mucha calidad, en el sentido de que había fijado le día y el lugar en que habían tenido los hechos, que el encartado estaba realizando un aserrío de madera, que eran diversas especies, y que realizaba la tarea con una motosierra, pero que la prueba no alcanzaba para demostrar un tema central del ilícito: la inexistencia del permiso. El juzgador subraya, a diferencia de otros procesos similares, en este no había una certificación del MINAET en el sentido de si se había emitido o no el respectivo permiso, medio idóneo para considerar si había autorización oficial de la actividad emprendida y observar si se trataba, en efecto, de un aserrío ilegal.

El tipo penal es claro en considerar antijurídicas tanto el aserrío sin permiso como también el que se realiza más allá de la autorización otorgada. También es cierto, las manifestaciones hechas por el justiciable al funcionario del MINAET, sin haberse hecho las prevenciones de ley, consisten en una aceptación de elementos incriminantes que bien podía no haber emitido de haber sabido que tal manifestación podría ser usada en su contra, pues los funcionarios de la Administración Forestal actúan con caracter de policía como lo establece el artículo 54 de la Ley Forestal (cfr. fl. 204 de la transcripción de la sentencia). No se trata, tampoco, de una manifestación espontánea de la parte, que luego puede ser introducida por la policía a la hora de declarar en el debate. Ya los encartados habían sido señalados como imputados de una actuación ilícita, y el interrogatorio al que son sometidos podría incriminarlos, llevando información a la policía que sería usada en su contra, afectando gravemente su derecho constitucional a guardar silencio.

Si aun así, se hubiera producido prueba idónea que demostrara la inexistencia de permisos para la actividad emprendida, habría habido elementos suficientes de convicción para establecer la existencia de los requisitos básicos de la tipicidad y antijuridicidad del hecho, y con ello haber podido atribuir el injusto a los encartados. Tiene razón el juzgador no sólo al no valorar esta manifestación del oficial del MINAET, sino también al hacer los reproches que hace a la actividad de investigación y acusación emprendida por el Ministerio Público y la Procuraduría General de la República. En esta misma línea argumentativa, es que también deben declararse sin lugar las razones planteadas en el segundo motivo de la impugnación. Según lo sostiene el señor Procurador, la Ley Forestal, No. 7575, señala en cuanto a toda actividad de explotación y comercialización del recurso forestal, de más de tres árboles por hectárea en terrenos de uso agropecuario y sin bosque, debe necesariamente estar autorizado por el Consejo Regional Ambiental.

En virtud de ello, habría un yerro judicial en cuanto a la inteligencia de este artículo, pues no se ha acreditado por parte del acusado que haya habido un permiso de explotación expedido por la Administración activa. Este argumento no es de recibo, por las razones ya expuestas. La existencia o no del permiso no es algo que deba demostrar el imputado, es tarea de la actividad acusadora de los órganos encargados. Por más que se trate de un tema de orden público y de un aspecto legal que debe ser conocido por todos, especialmente por aquellos dedicados a la actividad forestal, la postulación del artículo 27 de la Ley Forestal no va más allá de dar un mandato que ha de ser cumplido, pero no da una instrucción específica de condena ante la constatación de una actividad que pueda contrariar su mandato. En un proceso penal democrático, aun debe imputarse de manera lícita la realización de un hecho punible, en plena aplicación del principio de mínima actividad probatoria consignado en los artículos 175 y 181 del Código Procesal Penal.

Cierto es que la actividad es sospechosa de infringir este mandato legal, y que la corta de al menos cuatro de los doce árboles aprovechados se había dado en una zona de bosque con una cabida superior a dos hectáreas, según se acreditó con el testimonio del señor M., del MINAET, pero aún así hace falta prueba lícita y pertinente que la actividad no estaba amparada en permisos oficiales. Esta otra forma de postular el principio de carga de la prueba, como una forma de desaplicación indirecta del numeral 27 de la Ley Forestal, es un argumento que cae por su propio peso, no sólo por consistir en una regla que no es respaldable desde la configuración constitucional y legal de nuestro proceso penal, sino también en virtud del principio de estado de inocencia consignado en el artículo 39 constitucional. Corresponde, por ello, declarar sin lugar ambos motivos del recurso de casación intentado por la Representación de la Procuraduría General de la República.

POR TANTO:

Se declara sin lugar el recurso de casación planteado por el licenciado Olman Rodríguez Brunett, en representación de la Procuraduría General de la República. Notifíquese.- Alfredo Chirino Sánchez Jorge Luis Arce Víquez Tatiana López Monge Jueces y Jueza de Apelación de Sentencia Penal Imputado: Nombre467.
