JUDGMENT Nº 0 573 -F-1 1 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, at eleven thirty-five a.m. on trece de junio de dos mil once.- POSSESSORY-TITLE PROCEEDINGS (INFORMACIÓN POSESORIA), brought by [Nombre1], of legal age, married once, Agricultural Engineer, resident of Río Grande de Paquera, identity card number CED1 - - . The PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by Lydiana Rodríguez Paniagua in her capacity as Deputy Attorney General, and the INSTITUTO DE DESARROLLO AGRARIO, legal entity identification number CED2 - - - , represented by Carmelina Vargas Hidalgo, of legal age, divorced, attorney, resident of Guachipelín, Escazú, identity card CED3 - - , in her capacity as general judicial attorney-in-fact (apoderada general judicial), are participating in the proceedings. CONSIDERING
II.Deputy Attorney General Lydiana Rodríguez Paniagua filed an appeal against the decision issued by the Juzgado Agrario de Santa Cruz approving the possessory-title proceedings, asserting the following grounds of error (agravios): 1) She states that the property to be titled is mountain land, as indicated in the petitioner’s application and the plan underlying these proceedings, and that such land is therefore subject to the public domain (demanio público) and may not be titled. She argues that forested areas cannot be titled (citing artículos 11, 13 y 14 de la Ley Forestal and voto 4587-97 de la Sala Constitucional concerning the public-domain status of property). 2) She states that the witnesses’ testimony does not establish the ten-year possession required for acquisition by adverse possession (usucapión) (see folio 113 a 123).
III.The appellant’s arguments are without merit because, upon reviewing the evidence in the record, it can be determined that the land consists of scrubland (charral) and natural regeneration (regeneración natural), as shown by the certificate of conforming land use (certificado de uso conforme de suelos), which states that the land consists of scrubland and natural regeneration of cachimbo, ron ron, cocobolo, guanacaste, and guaitil trees, among others, with tall trees throughout the creek’s protection area, (see folios 19). A judicial inspection (reconocimiento judicial) established that the land is devoted mostly to scrubland, with a large portion undergoing natural regeneration (see minutes at folio 93). The witnesses [Nombre4], [Nombre5], and [Nombre6] state that the land consists of scrubland and is therefore undergoing natural regeneration (see folios 66 y 67). They also stated that they had known the property for 20, 30 y 40 años, respectively; accordingly, the ten-year possession required for acquisition by adverse possession has been conclusively established, contrary to the appellant’s assertions in her grounds of error.
This Court considers it important to analyze what is understood by forest (bosque) under Ley Forestal and to clarify what constitutes secondary scrub growth (tacotal) or a secondary forest (bosque secundario). For land to qualify as forest, a series of requirements must be met concurrently. Section 3 of Ley Forestal Nº 7575 defines forest as follows: “A native or indigenous ecosystem, whether disturbed or undisturbed, regenerated through natural succession or other forestry techniques, occupying an area of two or more hectares and characterized by the presence of mature trees of different ages, species, and sizes, with one or more canopies covering more than seventy percent (70%) of that area, and containing more than sixty trees per hectare with diameters of fifteen or more centimeters measured at breast height (DBH).” In this case, the certificate of conforming land use indicates that the land consists of scrubland undergoing natural regeneration.
Under the Regulations to the former Ley Forestal, secondary scrub growth is a “plant formation consisting of taller and older herbaceous, woody, and tree species, originating from the abandonment of agricultural areas or pastures. It generally consists of fast-growing pioneer species, and its economic potential depends on the species present. It has the same origins as scrubland and may contain scattered harvestable trees of various sizes and species, which generally do not exceed fifteen meters in height.” The Diccionario Ilustrado Océano de la Lengua Española defines secondary scrub growth as “Dense Thicket.” Scrubland is an area of abandoned pasture where all vegetation has arisen through natural regeneration and thorny and shrubby plants are abundant, while trees are scarce. From the foregoing, it is evident that this is a second stage of regenerative succession (segunda sucesión regeneracional), which means that the title claimant has taken care to restore the land by allowing it to regenerate after having, at some point, been stripped of all vegetation, thereby demonstrating her intention to conserve natural resources.
This Court considers that denying her title would punish her for attempting to regenerate those resources and could instead create an incentive not to allow land lacking vegetation cover (cobertura vegetal) to regenerate, because doing so would prevent title from being granted. That could be misconstrued and, in this Court’s view, would be contradictory if the purpose is to protect resources.
THEREFORE:
The decision rendered is affirmed.

RESULTANDO:
5. En la substanciación del proceso se han observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad.

CONSIDERANDO
II.La Procuradora Adjunta, licenciada Lydiana Rodríguez Paniagua, interpuso recurso de apelación contra la resolución dictada por el Juzgado Agrario de Santa Cruz que aprueba las diligencias de información posesoria señalando los siguientes agravios 1) Indica que el inmueble a titular es de naturaleza de montaña y así consta en la solicitud del promovente y el plano base de estas diligencias, por lo que dichos terrenos están afectos al demanio público y no pueden ser objeto de titulación. Aduce no se podría titular las áreas boscosas (cita los artículos 11, 13 y 14 de la Ley Forestal y el voto 4587-97 de la Sala Constitucional sobre demanialidad de bienes). 2) Dice, las declaraciones de los testigos no demuestran la posesión decenal apta para usucapir (ver folio 113 a 123).
III.En cuanto a lo alegado por la apelante no lleva razón, pues analizada la prueba constante en autos, se logra determinar que la naturaleza del terreno es charral y regeneración natural según se desprende del certificado de uso conforme de suelos en el cual se indica se trata de terrenos de charral y regeneración natural de árboles de cachimbo, ron ron, cocobolo, guanacaste y guaitil entre otros, árboles porte alto en toda la zona de protección de la quebrada, (véase folios 19). En reconocimiento judicial se logró determinar se trata de terrenos dedicados a charral en su mayoría, con una gran parte de regeneración natural (ver actas a folio 93). Los testigos [Nombre4] , [Nombre5] , [Nombre6] indican que el terreno se dedica a charral por lo que se encuentra en regeneración natural (ver folios 66 y 67). Dijeron también conocer el fundo desde hace 20, 30 y 40 años respectivamente, por lo que se tiene por demostrada fehacientemente la posesión decenal apta para usucapir, contrario a lo dicho por la apelante en sus agravios.
Considera importante este Tribunal hacer un análisis de lo que se entiende por Bosque según la Ley Forestal y tener claro lo que es un tacotal o un bosque secundario. Para que se pueda tener como bosque deben darse una serie de requisitos conjuntamente. El ordinal 3 de la Ley Forestal Nº 7575, define Bosque de la siguiente manera: " Ecosistema nativo o autóctono, intervenido o no, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o mas hectáreas, caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del setenta por ciento (70%) de esa superficie y donde existan más de sesenta árboles por hectárea de quince o más centímetros de diámetro medido a la altura del pecho (DAP).". En este caso se indica se trata de terrenos de charral en regeneración natural según se desprende del certificado de uso conforme de suelos.
Un tacotal según el Reglamento a la Ley Forestal anterior es una "formación vegetal constituida por especies herbáceas, leñosas y arbóreas de mayor altura y edad, originadas por el abandono de áreas agrícolas o pastos. Generalmente está constituido por especies pioneras, de rápido crecimiento y su potencial económico depende de las especies presentes. Tienen los mismos orígenes que el charral y pueden contener árboles dispersos aprovechables de diversos tamaños y especies, que por lo general no sobrepasan los quince metros de altura". El Diccionario Ilustrado Océano de la Lengua Española define Tacotal como "Matorral Espeso". Un Charral es un área de potreros abandonados en donde toda la vegetación ha nacido por regeneración natural y abundan las plantas espinosas y arbustivas, mientras existe poca cantidad de árboles. De lo expuesto, resulta evidente que se trata de una segunda sucesión regeneracional, lo cual implica la persona titulante se ha preocupado por recuperar los terrenos permitiendo los mismos se regeneren después de que en algún momento fueron desprovistos de toda vegetación, lo cual evidencia su intención de conservación de los recursos naturales.
Considera este Tribunal que no permitirles la titulación sería un castigo por tratar de regenerar los recursos, lo cual podría más bien servir para incentivar que los terrenos no provistos de cobertura vegetal, no se les permita regenerarse, pues de hacerlo no se les permitiría la titulación, ello podría mal interpretarse, lo cual considera este despacho sería un contrasentido si lo que se persigue es proteger los recursos.
POR TANTO:
