The fundamental criterion is the agrarian production activity (actividad agraria de producción), whether animal husbandry or crop cultivation, as business or subsistence activities, or related activities, as well as sustainable agro-environmental activities (actividades agroambientales sostenibles). The nature or suitability of the productive property, its size, and the parties participating in the agrarian proceeding as plaintiffs or defendants have been established as supplementary criteria. The nature or suitability of the property is closely linked to agrarian holdings (fundos agrarios), incorrectly termed rural properties (predios rústicos) in the legislation, which are devoted or capable of being devoted to productive agrarian activities or to forest conservation and the sustainable management of agro-environmental activities. Likewise, the parties acquire the designation of “agrarian parties” (sujetos agrarios) through their engagement in productive agrarian activities.

The fundamental criterion is always the functional one, namely, the activity, to which both the objective and subjective criteria are referred. * * * * * * * * * * * * * III- The present case is an ordinary proceeding for damages (daños y perjuicios) against Tico Verde S.A., Mindoro del Caribe S.A., Frutas de Exportación Frutex S.A., the State, Ministerio de Agricultura y Ganadería, Ministerio de Salud, and Ministerio de Ambiente, Energía y Telecomunicaciones (folio 163, Volume I, and folio 258, Volume II). The claim is based on Articles 51 and 52 of the Ley de Uso Manejo Y Conservación de Suelos N. 7779. In the allegations of the complaint, they assert that the soil, water, and forest resources, as well as human health, have suffered serious deterioration due to the expansion of pineapple cultivation in the northern region of the country. As part of their efforts, they requested reports from the authorities of the Ministerio de Ambiente, Energía y Telecomunicaciones and the Ministerio de Agricultura, which recorded confirmation of damage caused by erosion and sedimentation in natural watercourses, roads, and lower-lying areas of the property, as well as loss of the soil’s physical, chemical, and biological fertility.

The complaint further states that Mindoro del Caribe S.A. proceeded to deforest an area of 14 hectares along the banks of the Río Perla in order to prepare the land for pineapple planting and effect a land-use change (cambio en el uso del suelo). Frutex S.A. acquired a farm for the purpose of cultivating pineapples near springs (nacientes de agua), thereby intending to change the land use from pasture and forest, and polluting the Parismina and Guacimito rivers and the streams identified therein, in addition to engaging in tree felling, thereby contributing to global warming. They report that complaints have already been filed with the local Municipalidad and the Ministerio de Ambiente, Energía y Telecomunicaciones. As the factual basis for their action, they state that environmental damage is being caused to both the soil and water resources, since the sedimentation caused by such activities would directly harm the Canales de Tortuguero.

They also assert that damage is being caused to the aquifers needed for the public water supply because their recharge occurs through concentrated discharge into the principal springs in the mountainous area of Pococí and Guácimo. The fifth allegation states that Article 11 of the Ley de Uso, Manejo y Conservación de Suelos grants the Ministerio de Agricultura y Ganadería authority to prepare the Plan Nacional de Manejo y Conservación de Suelos, which would be binding on projects and programs affecting use of the resource and whose purpose is the rational improvement and sustainable development of soil-use systems. That Plan should define critical areas according to watershed and sub-watershed criteria. This has not been fulfilled to date, although it is necessary because that Plan is a technical instrument for resolving the issues raised in this litigation. They add that the lack of financial resources is no excuse for the Public Administration’s failure to implement the cited law in compliance with Article 50 of the Constitución Política.

The plaintiffs act as affected third parties and residents of the communities of Quebrada Honda, Iroquois, Las Mercedes de Pocora, Parismina, and Guácimo, which are inhabited by more than 7 persons. They state that the defendants’ actions degrade the environment and generate toxic and hazardous waste that violates the sustainable development of the region. In its seventh allegation, the complaint states that the areas located on the southern side of [Dirección1] are near springs and are critical areas. Accordingly, cultivation in those areas is restricted, and agroecological principles must be considered with a view to improving production systems and ensuring rational soil use. They state that, on farms, irrespective of whether they are public or private, measures and practices leading to soil improvement, restoration, and preservation must be respected and followed in accordance with Ley Numero 7.779, and that activities changing the land use on the southern side of the route, which has always consisted of pasture and forest, must be restricted.

The complaint concerns contamination and degradation of the soil resource caused by pineapple cultivation, which in turn affects various other resources. The relief sought in the complaint is a declaration that the defendants are destroying the environment and its resources through pineapple-growing activities and generating waste that disrupts sustainable development; an order prohibiting the companies from planting or maintaining pineapple crops in these areas because they are critical; and a declaration that the land use on the southern side of [Dirección2], which they designate as a critical area for natural-resource conservation, must be devoted solely to forest and woodland conservation. They add that the area should be used only under systems such as pasture, family farms, ecotourism projects, and agro-environmental projects that do not harm the resource. They seek an order requiring remediation of the damage caused to the soil resource by tree felling and directing the Ministerio de Ambiente, Energía y Telecomunicaciones to specify the quantity felled and report on soil erosion.

They further request an order that pineapple cultivation not be halted, nor its expansion permitted, until the Ministerio de Agricultura y Ganadería submits the Plan Nacional de Manejo y Conservación de Suelos for the purpose of complying with Article 11 of the governing Law and, failing that, that it be declared to have breached its duty. They request that the latter Ministry, in coordination with other legally designated bodies, be ordered to establish the river Sub-watershed Committees (Comités de Subcuencas) pursuant to Article 34 of Law number 7779, in order to draw up the Micro-watershed or Sub-watershed Management Plans (planes de Manejo de las Microcuencas o Subcuencas). They seek an order requiring the defendant companies to pay for environmental damage, which they describe as erosion, damage to forest resources, and non-pecuniary harm (daño moral), as well as costs. Frutas de Exportación Frutex S.A. answered the complaint on January 16, 2008 (folio 693), within the statutory period, and raised a plea of lack of subject-matter jurisdiction, on the grounds that the Procuraduría General de la República had been joined as representative of the State and that claims 8 and 9 require this proceeding to be heard by the administrative litigation courts (jurisdicción contencioso administrativa).

Agroindustrial Tico Verde S.A. answered the complaint and raised what it termed an objection based on “lack of jurisdiction” (falta de jurisdicción), which must be understood as a lack of subject-matter jurisdiction, asserting that, because the State was sued, the present proceeding must be heard by the Jurisdicción Contenciosa Administrativa.* * * * * * * * * * * * * IV—The soil resource as an object of protection under Environmental Law and Agrarian Law. Environmental protection legislation arose from the need to safeguard the vital elements of the ecosystem from human actions that degrade the capacity of systems and their resources to perpetuate themselves. Within this complex body of regulations, the Ley de Manejo, Uso y Conservación de Suelos N. 7779 was enacted for the purpose of protecting, conserving, and improving soils through integrated and sustainable management with other natural resources, by means of promotion and planning.

That statute establishes obligations for State bodies and private parties that require the adoption of effective and preventive measures to protect the soil resource. To that end, the State, through its Ministries and agencies, must apply the environmental principle of coordination of administrative powers (coordinación de competencias administrativas) in order to achieve the environmental protection established by this law. This is because the soil resource is an element subject to use and enjoyment by private parties in their various activities. Soil, or the fertile layer (capa fértil), as a complex component of the environment, may be technically defined by the following characterization: “The solid surface upon which we walk and build cities and roads is called soil. Although it may not appear so at first glance, soil constitutes a natural, complex, and dynamic system in which multiple processes occur and numerous factors, both biotic and abiotic, are involved.

Soil, a thin layer only a few centimeters deep, is formed through the continuous action of the factors mentioned above upon the parent rock. Thus, soil is composed of materials resulting from the physical and chemical disintegration of surface rocks and of organic materials derived from the activity of millions of microorganisms, as well as plants and animals. The processes through which soil is formed are extremely slow: hundreds or thousands of years must pass for 30 cm. of soil to mature. For this reason, we must understand that soil is a natural resource that is difficult to renew and that its conservation is indispensable” (taken from http://www.oni.escuelas.edu.ar//2002/santiago_delestero/madre-fertil/explota.htm on 9 de mayo at 10:45 horas del 2011). Like other elements such as the atmosphere, soil is not regarded as public-domain property (bien demanial), but rather as an element that must be used rationally and sustainably.

This means that activities carried out on it must respect its structure and prevent its degradation. Among the resources degraded by the various activities of humankind, the fertile layer, or soil, is one of the most severely affected. Humanity as we know it today arose upon this element, and throughout its existence it has exerted adverse pressure upon it. This natural resource formed the basis of human civilization and has been regarded as the fundamental means of production in the economic systems of the most advanced societies throughout history. Through agriculture, humanity succeeded in exploiting the fertile-layer resource, thereby obtaining benefits that shaped the structure of the modern world. The human species’ constant dependence on the land, manifested in the need to provide food and other basic necessities for all humankind, has led it to disregard the resource’s regenerative capacity, without appreciating the fragility of its structure or the slowness of its formation and regeneration processes.

Accordingly, legislation intended to protect it through the actions of public and private actors has arisen at both the international and national levels. For the purpose of protecting soil, our legal system contains Ley 7.779, as noted above, and its implementing regulations, corresponding to decree number 29.375. The latter provides in its definitions that soil degradation (degradación del suelo) is:* * “Deterioration of the soil’s chemical, physical, and biological characteristics, with a decline in its productivity over time as a consequence of processes such as water or wind erosion, salinization, waterlogging, depletion of plant nutrients, contamination by slowly decomposing agrochemical products or heavy elements, structural deterioration, compaction, sedimentation, and other forms of degradation,” and defines soil as: “a natural body located on the Earth’s surface, formed over time from a variable mixture of mineral and organic materials through the action of chemical, physical, and biological weathering factors, capable of supporting the growth of plants and other living organisms, and susceptible to modification by human beings and natural events.” It is within this conceptual framework that the protected subject matter of the regulations governing the soil resource must be understood.* * * * * * * * * * * * * * V—The jurisdiction of the Agrarian Courts over matters concerning the soil resource and matters arising from the application of Ley N. 7779.

Agrarian Law arose as a branch of law centered on productive activity, and although new cultivation methods that do not require the use of the soil resource or fertile layer are now emerging, the exploitation of that resource remains, for the most part, the basis and foundation of agrarian activities throughout the world, and our national territory* is no exception. Regarding the subject-matter jurisdiction (competencia funcional) of this judicial forum to hear disputes arising from the application of the Ley de Uso, Manejo y Conservación de Suelos and its implementing regulations, Article 56 of that law states verbatim, insofar as relevant: “The Agrarian Courts shall have jurisdiction to hear and finally decide matters arising from the application of this Law.” Accordingly, this Court finds that, although State actors and private parties whose actions are required converge in the enforcement of these regulations, the legislature reserved matters involving the application of the law for the specialized agrarian forum because the protected subject matter is fully connected to the subject regulated and studied by Agrarian Law.

This situation is explained by the fact that the very foundation of this field of law lies in agrarian production, whose traditional core is the use of land or the fertile layer; it therefore constitutes a subject matter specific to Agrarian Law, whose unifying object has been the cultivation of land. The body of rules governing this field was enacted in accordance with the Theory of Agrarianity (Teoría de la Agrariedad) set forth in agrarian legal scholarship. In this regard, Article 1 of the Ley de la Jurisdicción Agraria provides: “Article 1.—Pursuant to Article 153 of the Constitución Política, the agrarian jurisdiction is hereby created as a specialized function of the Poder Judicial, which shall have exclusive jurisdiction to hear and finally decide disputes arising from the application of agrarian legislation and of the legal provisions governing the production, processing, industrialization, and disposal of agricultural products, in accordance with the provisions of the* following article.” Thus, pursuant to Article 56 of the Ley de Uso, Manejo y Conservación de Suelos and Article 1 of the Ley de Jurisdicción Agraria, this case falls within the jurisdiction of the specialized agrarian forum.

Furthermore, in decision number 9928 of the Sala Constitucional de la Corte Suprema de Justicia, issued at fifteen hours on nueve de junio de dos mil diez,* when ruling on the public-employment regime, although it held that jurisdiction belonged to the administrative courts rather than the labor courts, it analyzed the demarcation of the subject-matter jurisdiction of the Jurisdicción Contenciosa Administrativa and other jurisdictions, such as the labor and agrarian jurisdictions. In that decision, it modified the position previously expressed by that high Court in several of its rulings and held: “on that occasion ‘... 3°) The derivative constituent authority, or amending power, constitutionally reserved the subject-matter jurisdiction of the administrative courts by providing that their purpose is to “guarantee the legality of administrative functions”; consequently, the ordinary legislature, in exercising its freedom to shape or configure the law, may not assign that jurisdiction to any judicial branch other than the administrative courts, since doing so would deprive the institutional guarantee and fundamental right enshrined in Article 49 of the Constitution of their substance.

On this particular point and upon more careful consideration, this Constitutional Court modifies or reverses the position set forth in Decisions Nos. 3095-94 of 15:57 hrs. on 3 de agosto de 1994, 7540-94 of 17:42 hrs. on 21 de diciembre, both of 1994, 5686-95 of 15:39 hrs. on 18 de octubre de 1995, and 14999-2007 of 15:06 hrs. on 17 de octubre de 2007. This means that when a litigant brings a claim challenging the invalidity of, or material nonconformity with the administrative legal order of, administrative conduct or any specific manifestation of an administrative function (formal or material omission, formal activity or material action, or an administrative legal relationship), the administrative courts must necessarily hear and decide it.’” The foregoing means that review of the legality of administrative acts falls within the jurisdiction of the Jurisdicción Contenciosa Administrativa, which is also subject to criteria relating to the substantive content of the claim; other jurisdictions may have jurisdiction over proceedings, provided that the matter does not concern solely conformity or material nonconformity with an administrative function or conduct.

In the case at bar, the substantive legal subject matter of these ordinary proceedings is defined by the relief sought in the complaint, which seeks to establish and quantify damages caused to the environment and, specifically, to the soil resource or fertile layer, allegedly resulting from the activity of the private defendants, consisting of pineapple cultivation; it further asks that they be ordered to halt such production until the competent Ministries issue a series of technical instruments required and established by law to ensure rational use of the resource they consider damaged or at risk of degradation. Retaining jurisdiction over these proceedings in the agrarian forum does not conflict with the functions assigned by law to the Jurisdicción Contencioso Administrativa, and the interests of the State will be safeguarded through the participation as parties of the Ministerio de Ambiente, Energía y Telecomuncaciones, Ministerio de Salud, Ministerio de Agricultura, and Procuraduría General de la República.

Furthermore, environmental matters are cross-cutting in nature, meaning that they affect all administrative and judicial spheres and the activities of private parties. All such spheres must manage their affairs with the environmental variable (variable ambiental) incorporated into them, and every person residing within the national territory is obligated to safeguard the environment and apply environmental legislation. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la zona Atlántica. Intervienen el licenciado Jaime Flores Cerdas [Nombre11], abogado, vecino de Guápiles con cédula de identidad número CED15 - - en su condición de apoderado especial judicial de los actores, el licenciado Francisco Iza de calidades ignoradas como abogado director del codemandado Hacienda Mindorro del Caribe S.A. la licenciada Aisha Acuña Navarro de calidades ignoradas como abogada directora de la demandada Agroindustrial Tico Verde S.A. el licenciado Roberto Soto Vega [Nombre11], casado, vecino de Limón en su condición de apoderado especial judicial de Frutas de Exportación Frutex S.A. y el licenciado Víctor Bulgarelli Céspedes, mayor, casado, vecino de Heredia, en su condición de apoderado de la Procuraduría General de la República.-* * * * * * * * * * * * * Redacta la jueza Castro García ; y,* CONSIDERANDO* * * * * * * * * * * * * I.-* El Juzgado Agrario del II Circuito Judicial de la Zona Atlántica, remite el expediente a este Tribunal, mediante resolución de las 09:03 horas del 30 de marzo del 2011 (folio 1523 Tomo VI) para resolver excepciones de incompetencia planteadas. * * * * * * * * * * * * * II- La competencia agraria, por razón de la materia, está determinada en forma genérica por los artículos 1 y 2 inciso h) de la Ley de Jurisdicción Agraria.

El criterio fundamental es el de la actividad agraria de producción, sea de cría de animales o cultivo de vegetales (actividades empresariales o de subsistencia), o cuando se trate de actividades conexas, así como actividades agroambientales sostenibles. Como criterios complementarios, se han establecido, la naturaleza o aptitud del bien productivo, así como su extensión, y los sujetos que participan dentro del proceso agrario como actores o demandados. La naturaleza o aptitud del bien está estrechamente vinculada a los fundos agrarios (denominados incorrectamente por la legislación como predios rústicos), dedicados o que sean susceptibles de destinarse al ejercicio de actividades agrarias productivas, o a la conservación de bosques y manejo sostenible de actividades agroambientales. Los sujetos, igualmente, adquieren su calificativo de “sujetos agrarios”, por su dedicación al ejercicio de actividades agrarias productivas.

El criterio fundamental es siempre el funcional, es decir, la actividad, al cual son reconducidos los criterios tanto objetivos como subjetivos. * * * * * * * * * * * * * III- El presente corresponde a un proceso ordinario de daños y perjuicios, en contra de Tico Verde S.A., Mindoro del Caribe S.A. Frutas de Exportación Frutex S.A., el Estado, Ministerio de Agricultura y Ganadería, Ministerio de Salud y Ministerio de Ambiente, Energía y Telecomunicaciones (folio 163 Tomo I y folio 258 Tomo II ). Se fundamenta el reclamo en el artículo 51 y 52 de la ley de Uso Manejo Y Conservación de Suelos N. 7779. Aducen en los hechos de la demanda se ha ocasionado un grave deterioro del recurso suelo, hídrico, forestal y de salud humana, en virtud de la expansión del cultivo de piña en la zona norte del país. Que dentro de sus gestiones han requerido informes de las autoridades del Ministerio de Ambiente, Energía y Telecomunicaciones y Ministerio de Agricultura en donde se anotó la corroboración de daños por erosión y sedimentación en cauces naturales, caminos y sectores más bajos de la propiedad, así como pérdida de fertilidad física, química y biológica del suelo.

Agrega la demanda, la empresa Mindoro del Caribe S.A. procedió a deforestar una zona de 14 hectáreas a orillas del Río Perla con el objetivo de preparar el terreno para la siembra de piña y hacer un cambio en el uso del suelo. La empresa Frutex S.A. adquiere una finca con la finalidad de cultivar piña cerca de nacientes de agua, alterando con tal intención el uso de suelo que es de pasto y montaña, y contaminando los ríos Parismina y Guacimito, y quebradas que cita, ademas de talar, lo cual fomenta el calentamiento global. Informa ya existen denuncias incoadas ante la Municipalidad del lugar y el Ministerio de Ambiente, Energía y Telecomunicaciones. Como hechos de su acción, indican que se produce un daño al ambiente, tanto al recurso suelo, como al hídrico, pues la sedimentación ocasionada con tales actividades perjudicarían en forma directa a los Canales de Tortuguero. Aducen también, se ocasiona daños a los acuíferos necesarios para el abastecimiento público del recurso hídrico, en virtud de que la recarga del mismo ocurre por la descarga concentrada en los manantiales principales del sector montañoso de Pococí y Guácimo.

EL hecho quinto indica que el artículo 11 de la Ley de Uso, Manejo y Conservación de Suelos otorga la competencia al Ministerio de Agricultura y Ganadería, para la elaboración del Plan Nacional de Manejo y Conservación de Suelos, que sería de carácter vinculante en proyectos y programas que incidan en el uso del recurso y cuyo objetivo es el mejoramiento y desarrollo sostenible de los sistemas de uso de los suelos en forma racional. Plan que debería definir las áreas críticas por el criterio de cuencas y subcuencas. Lo cual no ha sido cumplido hasta la fecha, y es necesario por ser tal plan, un instrumento técnico para dar solución a los problemas que se plantean en este litigio. Agrega, no ser excusa de la Administración Pública la falta de recursos económicos para ejecutar la ley citada en resguardo del artículo 50 de la Constitución Política. Los actores actúan en calidad de terceros afectados y vecinos de las comunidades de Quebrada Honda, Iroquois, Las Mercedes de Pocora, Parismina y Guácimo en la que habitan mas de 7 personas.

Indican, con los actos de las demandadas se degrada el ambiente, se generan residuos tóxicos y peligrosos que violentan el desarrollo sostenible de la zona. La demanda en su hecho sétimo, indica que las áreas ubicadas al lado sur de la [Dirección1] , esta cerca de nacientes de agua, y son áreas críticas. Por lo anterior, esta limitado el cultivo en dichas zonas y deben ser considerados los principios agroecológicos en procura del mejoramiento de sistemas de producción y uso racional del suelo. Mencionan, en las fincas, independientemente de su naturaleza pública o privada, deben respetarse y acatarse las medidas y prácticas que conllevan al mejoramiento del suelo, su recuperación y preservación, acorde con la Ley Numero 7.779 y deben ser restringidas las actividades que modifiquen el uso de suelo al lado sur de la ruta, que siempre ha sido de pastos y montaña. La demanda versa sobre contaminación y degradación del recurso suelo ocasionado por el cultivo de piña, que a su vez afecta recursos diversos.

La petitoria de la demanda se encamina a que se declare que las accionadas destruyen el ambiente y sus recursos con la actividad piñera, generan residuos que alteran el desarrollo sostenible, la prohibición a las empresas de siembra o mantenimiento de cultivos de piña en estas áreas, por ser críticas y se declare que el uso de suelo al lado sur de la [Dirección2] que denominan área crítica para conservación del recurso natural y deberá ser destinando solamente a la conservación de bosque y montaña. Agregandose que en tal zona solo debe permitirse su explotación, bajo sistemas tales como pastos, granjas familiares, proyectos ecoturísticos y agroambientales, que no dañan el recurso. Se obligue a la reparación del daño ocasionando al recurso suelo por la tala de árboles y se ordene al Ministerio de Ambiente, Energía y Telecomunicaciones indicar, en que cantidad talaron y se informe sobre la erosión del suelo.

Además peticionan, se ordene no se detenga el cultivo de piña, ni se permita su expansión, hasta tanto el Ministerio de Agricultura y Ganadería, presente el Plan Nacional de Manejo y Conservación de Suelos con la finalidad de cumplir el artículo 11 de la Ley que rige, y en su defecto, se le declare ha incumplido su deber. Se ordene a éste último Ministerio citado, que en coordinación con otras instancias de ley, desarrollen los Comités de Subcuencas de los ríos según el artículo 34 de la Ley número 7779, para conformar los planes de Manejo de las Microcuencas o Subcuencas. Se condene al pago a las sociedades demandadas, por daño ambiental, que describen como la erosión, daños al recurso forestal y daño moral, además de costas. La sociedad Frutas de Exportación Frutex S.A. contesta la demanda el 16 de enero del 2008 (folio 693) dentro del plazo legal, e interpone la excepción de incompetencia por razón de la materia, fundándola en que se integró a la Procuraduría General de la República en representación del Estado y la pretensión 8 y 9 conducen a que este proceso deba ser del conocimiento de las jurisdicción contencioso administrativa.

La sociedad Agroindustrial Tico Verde S.A., contesta la demanda e interpone la excepción que denomina de "falta de jurisdicción", que debe ser entendida como incompetencia por razón de la materias, aduciendo que al haberse demandado a Estado debe ser conocido el presente proceso por la Jurisdicción Contenciosa Administrativa.* * * * * * * * * * * * * IV- Sobre el recurso suelo como objeto de tutela del derecho Ambiental y del derecho Agrario. Las legislaciones tutelares del ambiente, surgen debido al necesidad de resguardar los vitales elementos del ecosistema de las acciones humanas, que degradan la capacidad de perpetuación de los sistemas y sus recursos. Dentro de complejo normativo, se emite la Ley de Manejo, Uso y Conservación de Suelos N. 7779, que tiene como finalidad la protección, conservación y mejoramiento de los suelos en una gestión integrada y sostenible con los demás recursos naturales, mediante el fomento y planificación.Dicha norma legal establece obligaciones a los órganos del Estado y a los particulares, que reconducen a la toma de acciones efectivas y preventivas para la pretección del recurso suelo.

Para ello, el Estado a través de sus Ministerios y dependencias deberá aplicar el principio ambiental de la coordinación de competencias administrativas, para el logro de la protección ambiental establecido en esta ley. Lo anterior obedece a que el recurso suelo es un elemento sujeto al uso y disfrute de particulares en sus diversas acciones. El suelo o capa fértil como compenente complejo de ambiente, puede definirse técnicamente desde la siguiente caracterización: " La superficie sólida sobre la que caminamos, construimos ciudades y caminos, se denomina suelo. Aunque a simple vista no lo parezca, el suelo constituye un sistema natural, complejo y dinámico, donde se desarrollan múltiples procesos e intervienen numerosos factores, tanto bióticos como abióticos. El suelo, capa delgada de unos cuantos centímetros de profundidad, está formada por la actividad permanente de los factores que mencionábamos anteriormente sobre la roca madre.

Es así que el suelo está compuesto por materiales que provienen de la desintegración física y química de las rocas superficiales y por materiales orgánicos derivados de la actividad de millones de microorganismos e incluso también de plantas y animales. Los procesos por los cuales se forma el suelo son extremadamente lentos: para poder obtener 30 cm. de suelo es necesario que transcurran cientos o miles de años para su maduración. Es por esto que debemos saber que el suelo es un recurso natural difícilmente renovable, y se hace indispensable su conservación" (tomado de http://www.oni.escuelas.edu.ar//2002/santiago_delestero/madre-fertil/explota.htm el 9 de mayo a las 10:45 horas del 2011). Al igual que otros elementos tales como la atmósfera, el suelo no es concebido como un bien demanial, sino como un elemento del cual se debe hacer un uso racional y sostenible. Lo anterior significa que las actividades que se realicen en él, deben respetar su estructura y evitar su degradación.

Dentro de los recursos que han sido degradados por las diversas actividades de la especie humana, la capa fértil o suelo es de los más afectados. Es este elemento sobre el cual se ha erigido la humanidad, tal y como se le conoce actualmente y sobre el mismo se ha ejercido una presión negativa a lo largo de toda su existencia. Este recurso natural, constituyó la base de la civilización humana y ha sido concebido como el medio de producción básico del sistema económico de las sociedades más avanzadas a lo largo de la historia. Mediante la agricultura la humanidad logró explotar el recurso capa fértil, obteniendo con ello beneficios que moldearon la estructura del mundo moderno. La constante dependencia de la especie humana con la tierra, manifestada en la necesidad de proveer alimento y demás necesidades básicas a toda la humanidad, lo ha llevado a desconocer la capacidad de regeneración del recurso, sin valorar la fragilidad de su estructura y la lentitud de su proceso de formación y regeneración.

Por ello, ha nacido las normativa legal que procura su protección con el actuar de sujetos públicos y privados, tanto a nivel internacional como nacional. Nuestro ordenamiento jurídico, en aras de tutelar el suelo, contiene la Ley 7.779 como fue indicado, y su Reglamento, que corresponde al decreto número 29.375. Este último en sus definiciones, reza que la degradación del suelo es el:* * " Deterioro de las características químicas, físicas y biológicas del suelo, con disminución de su productividad en el tiempo, como consecuencia de procesos tales como erosión hídrica o eólica, salinización, anegamiento, agotamiento de los elementos nutritivos para las plantas, contaminación con productos agroquímicos de lenta descomposición o elementos pesados, el deterioro de la estructura, compactación, sedimentación y otras formas de degradación ", y como suelo entiende: "cuerpo natural localizado en la superficie de la tierra, formado a partir de una mezcla variable de materiales minerales y orgánicos, mediante la acción de factores de meteorización, químicos, físicos y biológicos en el tiempo, capaz de sustentar el crecimiento de las plantas y otros seres vivos, y susceptible de modificaciones por el ser humano y por eventos naturales." Es dentro de ese marco conceptual, que debe ser entendido el objeto tutelado de la normativa del recurso suelo.* * * * * * * * * * * * * * V-.

Sobre la competencia de la Jurisdicción Agraria en el conocimiento de materia del recurso suelos y de los asuntos originados en la aplicación de la Ley N. 7779. El nacimiento del Derecho Agrario como rama jurídica, gira en torno a la actividad producción, y si bien actualmente surgen nuevas modalidades de cultivos que no requieren el uso del recurso suelo o la capa fértil, mayoritarimente su explotación es la base y sostén de las actividades agrarias del mundo entero y nuestro territorio nacional, * no es la excepción. En cuanto a la competencia funcional de esta vía jurisdiccional para conocer conflictos originados en la aplicación de la Ley de Uso, Manejo y Conservación de Suelos y su reglamento, el artículo 56 de dicha ley reza textualmente en lo que interesa: " Corresponderá a los Tribunales Agrarios conocer y resolver, definitivamente, los asuntos originados en la aplicación de la presente Ley.

Por ello, estima esta sede, que aún y cuando en el cumplimiento de dicha normativa convergen actores estatales y sujetos privados que deben actuar, el legislador reservó el conocimiento de la aplicación de la ley a la sede especializada agraria debido al objeto que se tutela que esta vinculando plenamente con el objeto de regulación y estudio del Derecho Agrario. Dicha situación se explica en que el fundamento mismo de esta materia del Derecho, se encuentra a partir de la producción agraria cuyo núcleo tradicional es el uso de la tierra o capa fértil, constituyéndose un objeto propio del derecho agrario y cuyo objeto unificador ha sido el cultivo de la tierra. Siguiendo la Teoría de la Agrariedad expuesta por la doctrina agrarista, se emite el conjunto de normas que rigen esta materia. Al respecto, el numeral 1 de la Ley de la Jurisdicción Agraria dispone: “Artículo 1.- Con fundamento en lo dispuesto por el artículo 153 de la Constitución Política, créase la jurisdicción agraria, como función especial del Poder Judicial, a la que corresponderá, en forma exclusiva, conocer y resolver definitivamente sobre los conflictos que se susciten, con motivo de la aplicación de la legislación agraria y de las disposiciones jurídicas que regulan las actividades de producción, transformación, industrialización y enajenación de productos agrícolas de conformidad con lo dispuesto en el* artículo siguiente.

De tal forma, según lo regula el artículo 56 de la Ley de Uso, Manejo y Conservación de Suelos, y el artículo 1 de la Ley de Jurisdicción Agraria, el conocimiento de esta causa le corresponde a la sede especializada agraria. Aunado a lo anterior, en el voto de la Sala Constitucional de la Corte Suprema de Justicia número 9928 de las quince horas de nueve de junio de dos mil diez,* al pronunciarse sobre el régimen de empleo público, a pesar haberse dispuesto correspondía a los tribunales contenciosos su conocimiento y no a los laborales, analizó sobre la delimitación de la competencia material de la Jurisdicción Contenciosa Administrativa y otras jurisdicciones como la laboral y la agraria. En tal resolución, se modificó el criterio que venía siendo externado por ese alto Tribunal, en varios de sus pronunciamientos y resolvió: " en esa oportunidad "... 3°) El constituyente derivado o poder reformador estableció una reserva constitucional de la competencia material de la jurisdicción contencioso-administrativa al estatuir que su objeto es “garantizar la legalidad de la función administrativa”, razón por la cual el legislador ordinario, en el ejercicio de su libertad de conformación o configuración, no puede atribuirle esa competencia a otro orden jurisdiccional que no sea el contencioso-administrativo, puesto que, de ser así, estaría vaciando de contenido la garantía institucional y el derecho fundamental que consagra el artículo 49 de la Constitución.

Sobre este punto en particular y, bajo una mejor ponderación, este Tribunal Constitucional varía o revierte la tesis expuesta en los Votos Nos. 3095-94 de las 15:57 hrs. de 3 de agosto de 1994, 7540-94 de las 17:42 hrs. de 21 de diciembre ambos de 1994, 5686-95 de las 15:39 hrs. de 18 de octubre de 1995 y 14999-2007 de las 15:06 hrs. de 17 de octubre de 2007. Lo anterior significa que cuando un justiciable deduce una pretensión para cuestionar la invalidez o disconformidad sustancial con el ordenamiento jurídico-administrativo de una conducta administrativa o cualquier manifestación singular de la función administrativa (omisión formal o material, actividad formal o actuación material o relación jurídico-administrativa), debe conocerla y resolverla, indefectiblemente, la jurisdicción contencioso-administrativa.” Lo anterior conlleva que será de competencia de la Jurisdicción Contenciosa Administrativa, la revisión de la legalidad de actos administrativos la cual también esta sujeta, a criterios relacionados con el contenido material de la pretensión, pudiendo otras jurisdicciones ostentar competencia sobre proceso, siempre que no medie solamente la conformidad o disconformidad sustancial con la función o conducta administrativa.

En el subjúdice, el objeto jurìdico material de este ordinario, se define por la pretensión de la demanda que se dirige a establecer y cuantificar daños y perjuicios ocasionados al ambiente y en forma específica al recurso suelo o capa fértil, que aducen han sido producidos por la actividad de los sujetos privados demandados, que consiste en el cultivo de la piña, y se pide se les ordene detener tal producción, hasta tanto los Ministerios competentes emitan una serie de instrumentos técnicos necesarios y establecidos por Ley, para lograr el uso racional del recurso que consideran lesionado o con peligro de degradación. Mantener el conocimiento de este proceso en sede agraria, no riñe con las funciones dadas por ley a la Jurisdicción Contencioso Administrativa y los intereses del Estado serán resguardados, al tener como parte al Ministerio de Ambiente, Energía y Telecomuncaciones, Ministerio de Salud, Ministerio de Agricultura y Procuraduría General de la República.

Por otra parte, la materia ambiental es de carácter transversal, lo cual conlleva a afectar a todos los ámbitos administrativos, judiciales y las actividades de los particulares. Todos esos espacios deben gestionar sus asuntos con la variable ambiental incorporada en ellos y es obligación de todas las personas que habitan el territorio nacional, procurar el resguardo del ambiente y aplicar la legislación ambiental. Por ello, no resulta de recibo el motivo de la excepción de incompetencia, cuando se indica que al mediar como parte el Estado, debe remitirse el proceso al la Jurisdicción Contenciosa Adminsitrativa, pues la materia ambiental le compete a todas las áreas del Derecho. * * * * * * * * * * * * * * * * * * * * * * * VI.- Por lo expuesto, deberán rechazarse las excepciones de incompetencia interpuestas y firme esta resolución, remitirse este expediente al despacho de origen para que continúe con el conocimiento del proceso. * POR TANTO:* * * * * * * * * * * * * Se rechazan las excepciones de incompetencia interpuestas.
