JUDGMENT No. 0 353 - F -1 1 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, at eleven hours and ten minutes on seis de abril de l dos mil once.- POSSESSORY TITLE PROCEEDING (INFORMACIÓN POSESORIA) filed by [Nombre1], of legal age, married once, farmer, holder of identity card number CED1 - -, resident of Guanacaste.- The PROCURADURÍA GENERAL DE LA REPÚBLICA participates, represented by Licentiate Lydiana Rodríguez Paniagua in her capacity as Deputy Attorney General, whose other particulars are unknown in the record; as does the INSTITUTO DE DESARROLLO AGRARIO, represented by Marco Vinicio Cordero Quesada in his capacity as general attorney-in-fact without limitation as to amount, of legal age, married, agricultural engineer, holder of identity card number CED2 - -. FINDINGS

CONSIDERING:
II.The court below approved these proceedings upon finding that the requirements imposed by the Ley de Informaciones Posesorias for obtaining title had been satisfied.
III.The Deputy Attorney General appealed. She argues that the challenged decision deems it established that the property for which title is sought is forested in nature (woodland), a circumstance confirmed by the judicial inspection (reconocimiento judicial), witness testimony, plans submitted into the record, and even the petitioner’s own statements. For that reason, she contends that the property has been subject to the public domain (dominio público), as part of the State’s natural heritage (patrimonio natural del Estado), since the Ley Forestal of 1969 and is public-domain property (demanial); therefore, the petitioner was required to demonstrate ten-year possession (posesión decenal), protection of the natural resource, and that the property was duly demarcated. She states that the witnesses’ testimony does not demonstrate ten-year possession sufficient for acquisitive prescription (usucapión) by the petitioner. She supports her arguments with certain judicial precedents and opinions issued by the Procuraduría. In her view, public property cannot legally be titled because it is not subject to prescription, is inalienable, and cannot be acquired by acquisitive prescription. She requests that the judgment be reversed and the proceeding denied. (folios 128 to 139).
IV.The appellant’s claims of error are unfounded. Article 7 of the Ley de Informaciones Posesorias provides that land located outside protected wilderness areas (áreas silvestres protegidas) and containing forests may be titled if the petitioner demonstrates ten-year possession and protection of the natural resource, and the property must be demarcated and enclosed by fences or cleared boundary paths (carriles limpios). Under the broad definition of forest contained in Article 3 of the Ley Forestal, it is a “native or indigenous ecosystem, whether disturbed or undisturbed, regenerated through natural succession or other forestry techniques, occupying an area of dos o más hectáreas, characterized by the presence of mature trees of different ages, species, and sizes, with one or more canopies covering more than setenta por ciento (70%) of that area, and containing more than sesenta árboles por hectárea having a diameter of quince o más centímetros measured at breast height (DBH) (diámetro a la altura del pecho, DAP).” Irrespective of the absence of a technical opinion that would make it possible to determine with certainty whether the requirements concerning canopy coverage and the number and diameter of the trees have been met so as to establish the existence of a forest, the fact remains that the cadastral plan, the petitioner’s statements, the witnesses, and the land-use conformity certificate (certificación de uso conforme del suelo) all refer to the existence of forest on the land.
Although the cited article of the Ley de Informaciones Posesorias does not distinguish among forest categories, the expert opinion of Engineer Jimmy Mora Cruz is relevant. In the clarification he provided at the Procuraduría’s request, he stated that “the forested areas surrounding [Dirección5] Tigra are disturbed secondary forest, while the remaining forest cover (cobertura boscosa) consists of natural regeneration” (folio 90). In this regard, Executive Decree number 27.998-MINAE, “Principio, criterios e indicadores para el manejo sostenible de bosques secundarios y la certificación forestal en Costa Rica,” defines secondary forest (bosque secundario) as “Land with woody vegetation of a secondary successional nature that develops after the original vegetation has been removed by human activities and/or natural phenomena, with a minimum area of 0.5 hectáreas and a density of no fewer than 500 árboles por hectárea of all species, with a minimum diameter at breast height of 5 cm.
This also includes secondary forest land immediately after harvesting under the regeneration-cutting system.” Natural regeneration (regeneración natural), on the other hand, is understood as the natural succession of trees on temporarily denuded land considered to be forest or other forested land, or regeneration assisted by human action through the removal of external obstacles such as grasses and biotic interference, and sometimes through the use of controlled disturbances to induce the germination of native species (Programa de Evaluación de los Recursos Forestales, of the Dirección de Recursos Forestales (FOR) of the FAO). Based on the foregoing, it is clear that the land for which title is sought is a forested area that developed or regenerated after the original vegetation was removed.- With respect to protection of the natural resource, there is sufficient evidence to establish with certainty that the petitioner satisfied that requirement; indeed, the regeneration mentioned in the preceding paragraph resulted from the petitioner’s own protective actions and his refraining from destructive acts.
Thus, in his initial filing and under oath, he states that “my possession has consisted of maintaining fences, creating firebreaks (rondas), and generally caring for the existing forest, preventing fires and intrusions.” (folio 5). All the witnesses presented made statements to the same effect. The witness [Nombre4] testified that “The land has been devoted to woodland, which has been protected because he prohibits cutting trees and hunting animals; moreover, he has kept it demarcated with firebreaks and four-strand barbed-wire fences on posts of mixed materials.” (folio 39). Similarly, the witness [Nombre5] stated: “The land has been devoted to conservation; it is a forest, a little patch of woodland that the gentleman (the petitioner) has never cleared... The land is completely enclosed with wire fencing.” (folio 67). Likewise, the witness [Nombre6] stated: “The land has not been devoted to anything; there has always been a forest there that they have never cleared, and it has been protected because hunting animals and cutting trees are not permitted.
The land is enclosed with wire fencing...” (folio 68). From the foregoing, it is established that the person seeking title has taken care to protect the area of the Tigra stream and the property as a whole, demonstrating his intention to conserve the natural resources. This Court considers that denying him title would punish him for protecting the stream; that could be misinterpreted and would be contradictory if the goal is to protect resources.- With respect to ten-year possession, all three witnesses stated that the petitioner had exercised possession over the land for more than treinta años. Thus, the witness [Nombre4] stated that “I have known the petitioner for approximately treinta años and have known the land to be registered for the same length of time” (folio 39); the witness [Nombre5] stated that “I have known the land sought to be registered for more than treinta... ever since I have known the land, its owner has been [Nombre1]” (folio 67); while the witness [Nombre6] stated that “I have known the land sought to be registered since I was attending school, that is, for approximately uno cuarenta años...
Ever since I have known the land, its sole owner has been [Nombre1]” (folio 68). Accordingly, the petitioner’s ten-year possession has been demonstrated, and because he satisfied the other requirements imposed for obtaining title to the possessed land, approval of the proceeding was proper.
POR TANTO:
The appealed judgment is affirmed.

VOTO Nº 0 353 - F -1 1 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las once horas diez minutos del seis de abril de l dos mil once .- INFORMACIÓN POSESORIA promovida por [Nombre1] , quien es mayor, casado una vez, Agricultor, cédula de identidad número CED1 - - , vecino de Guanacaste.- . Intervienen la PROCURADURÍA GENERAL DE LA REPÚBLICA representado por licenciada Lydiana Rodríguez Paniagua en su condición de procuradora adjunta , y demás calidades desconocidas en autos ; así como el INSTITUTO DE DESARROLLO AGRARIO representada en su condición de apoderada generalísimo sin límite de suma por Marco Vinicio Cordero Quesada, mayor, casado, ingeniero agrónomo, cédula de identidad número CED2 - - . Tramitado ante el Juzgado Agrario de Santa Cruz. Figura como apoderado especial judicial del promovente el licenciado José Moreno Paniagua, mayor, casado, abogado, vecino de Guanacaste, cédula de identidad número CED3 - - .
RESULTANDO
Redacta el Juez Madrigal Pacheco; y,
CONSIDERANDO:
II.El a-quo aprobó las presentes diligencias al considerar se cumplen los requisitos exigidos por la Ley de Informaciones Posesorias para titular.
III.La Procuradora Adjunta apeló. Aduce que la resolución impugnada tiene por acreditado que la naturaleza del inmueble a titular es boscosa (montaña), situación que viene a ser constatada con el reconocimiento judicial, prueba testimonial, planos aportados a los autos y hasta con las mismas manifestaciones hechas por el promovente. Por tal razón, alega que está afecto al dominio público, patrimonio natural del Estado, desde la Ley Forestal de 1969 y tiene carácter demanial, debiendo el promovente demostrar posesión decenal, haber protegido el recurso y tenerlo debidamente deslindado. Dice las declaraciones de los testigos no demuestran la posesión decenal apta para usucapir en cabeza del promovente. Apoya sus alegaciones en algunos precedentes jurisprudenciales y pronunciamientos emitidos por la Procuraduría. Existe, a su juicio, imposibilidad jurídica de titular bienes públicos, por ser imprescriptibles, inalienables y no susceptibles de adquirirse por usucapión. Solicita se revoque la sentencia y se imprueben las diligencias. (folios 128 al 139).
IV.No lleva razón la recurrente en sus agravios. El artículo 7 de la Ley de Informaciones Posesorias establece que en aquellos terrenos ubicados fuera de las áreas silvestres protegidas y que tengan bosques, podrán ser tituladas si el promovente demuestra la posesión decenal y la protección del recurso natural, debiendo estar el inmueble deslindado y con cercas o carriles limpios. Según la definición amplia de bosque que contiene el artículo 3 de la Ley Forestal, es un "ecosistema nativo o autóctono, intervenido o no, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o más hectáreas, caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del setenta por ciento (70%) de esa superficie y donde existan más de sesenta árboles por hectárea de quince o más centímetros de diámetro medido a la altura del pecho (DAP)." Independientemente de la ausencia de criterio técnico que permita establecer con certeza si se cumplen los requisitos de cobertura por doseles, cantidad y diámetro de los árboles para asegurar la existencia de bosque, lo cierto es que tanto en el plano catastrado, las manifestaciones del promovente, los testigos y la certificación de uso conforme del suelo, se refieren a la existencia de bosque en el terreno.
A pesar que el artículo citado de la Ley de Informaciones Posesorias omite distinguir las categorías de bosque, es relevante el criterio experto del Ingeniero Jimmy Mora Cruz, quien en la aclaración que realizó a solicitud de la Procuraduría manifestó que "las áreas boscosas en los alrededores de la [Dirección5] Tigra son de tipo secundario intervenido, la restante cobertura boscosa es de regeneración natural" (folio 90). Al respecto, el Decreto Ejecutivo número 27.998-MINAE, "Principio, criterios e indicadores para el manejo sostenible de bosques secundarios y la certificación forestal en Costa Rica", define el bosque secundario como "Tierra con vegetación leñosa de carácter sucesional secundaria que se desarrolla una vez que la vegetación original ha sido eliminada por actividades humanas y/o fenómenos naturales, con una superficie mínima de 0.5 hectáreas, y con una densidad no menor a 500 árboles por hectárea de todas las especies, con diámetro mínimo a la altura del pecho de 5 cm.
Se incluyen también las tierras de bosque secundario inmediatamente después de aprovechadas bajo el sistema de cortas de regeneración." Por otra parte, la regeneración natural se entiende como la sucesión natural de árboles en tierras temporáneamente desprovistas, consideradas como bosques u otras tierras boscosas o de manera asistida por obra humana a través de la eliminación de obstáculos externos, tal como yerbas, interferencia biótica y a veces el uso de alteraciones controladas a fin de provocar la germinación de especies indígenas (Programa de Evaluación de los Recursos Forestales, de la Dirección de Recursos Forestales (FOR) de la FAO). Con base en lo anterior, es claro que la naturaleza del terreno que se pretende titular corresponde a un área boscosa que se ha desarrollado o regenerado, luego que la vegetación original fuese eliminada.- Respecto a la protección del recurso natural, existen pruebas suficientes para tener certeza que el promovente ha cumplido con dicho requisito, más aún, la regeneración que se menciona en el párrafo anterior ocurre por las mismas acciones protectoras y omisión de actos destructivos del promovente.
Así, en su escrito inicial y bajo declaración jurada, informa que "mi posesión ha consistido en mantenimiento de cercas, hechura de rondas, y cuidado en general del bosque existente, evitando invendios e invasiones." (folio 5). En igual sentido se han manifestado todos los testigos ofrecidos. el testigo [Nombre4] testificó que "El terreno ha sido dedicado a montaña, la cual ha sido protegida porque él prohíbe la corta de árboles y cazar animales, además la ha mantenido delimitada con rondas y cercas de alambre de púa a cuatro hilos, sobre postería mixta." (folio 39) En igual sentido, el testigo [Nombre5] , dijo "El terreno ha sido dedicado a conservación, es un bosque, una montañita que el señor (promovente) no la ha apiado nunca...El terreno se encuentra cercado con alambre, a vuelta redonda." (folio 67). Asimismo, el testigo [Nombre6] expresó "El terreno ha sido dedicado a nada, siempre lo que ha existido es un bosque que ninca han apiado, el cual ha estado protegido porque no se permite cazar animales ni cortar árboles.
El terreno se encuentra cercado con alambre..." (folio 68). De lo expuesto, resulta cierto que la persona titulante se ha preocupado por mantener protegida el área de la quebrada Tigra y de todo el inmueble en general, lo cual evidencia su intención de conservación de los recursos naturales. Considera este Tribunal que no permitirle la titulación sería un castigo por proteger la quebrada, ello podría mal interpretarse y sería un contrasentido si lo que se persigue es proteger los recursos. - En cuanto a la posesión decenal, los tres testigos manifestaron que el promovente tenía más de treinta años de ejercer la posesión sobre el terreno. Así, el testigo [Nombre4] dijo que "conozco al promovente desde hace como treinta años y el terreno de inscribir desde hace ese mismo tiempo" (folio 39); el testigo [Nombre5] , manifestó que "conozco el terreno que se pretende inscribri desde ha más de treinta...desde que conozco el terreno, el dueño ha sido a [Nombre1] " (folio 67); mientras que el testigo [Nombre6] expresó "conozco el terreno que se pretende inscribir desde que yo iba a la escuela, es decir hace como uno cuarenta años...Desde que conozco el terreno, el dueño ha sido solo de [Nombre1] " (folio 68).
De manera que está demostrada la posesión decenal del promovente y habiendo cumplido con los demás requisitos exigidos para obtener el título sobre el terreno poseído, procedía la aprobación de las diligencias.
POR TANTO:
Se confirma la sentencia recurrida.
