PODER JUDICIAL TRIBUNAL DE CASACIÓN PENAL Decision: [Telf1] Case file: 07-202638-0485-PE (5) TRIBUNAL DE CASACIÓN PENAL. Segundo Circuito Judicial de San José. Goicoechea, at eleven fifteen on veintitrés de diciembre de dos mil diez.
APPEALS IN CASSATION (RECURSOS DE CASACIÓN) filed in the present criminal proceeding (causa) against [Nombre1], of legal age, married, Costa Rican, CED1, a merchant by occupation, born on [Nombre2], child of [Nombre2], resident of [Nombre2], and [Nombre3], of legal age, in a common-law union (unión de hecho), Costa Rican, CED1, a merchant by occupation, born on [Nombre2], child of [Nombre2], resident of [Nombre2]; for the offense of TREE FELLING (TALA DE ÁRBOLES), to the detriment of the FOREST RESOURCE (RECURSO FORESTAL). Judges [Nombre4] and Ingrid Estrada Venegas, and Judge [Nombre5], participated in deciding the appeals. The following appeared before this Court: attorney [Nombre6], representing the private complainant (querellante) and civil plaintiff (actora civil), Procuraduría General de la República; attorney [Nombre7], in his capacity as prosecutor for the Ministerio Público de Pococí y Guácimo; and attorney [Nombre8], in his capacity as public defender for co-defendant [Nombre3].
RESULTS:
I.By Judgment number 12-G-2010, issued at nine twelve on quince de enero de dos mil diez, the Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, Guápiles, ruled: “THEREFORE (POR TANTO): In accordance with the rules of sound rational judgment (sana crítica racional), Articles 39 and 41 of the Constitución Política, 1, 30 and 31 of the Código Penal, 1, 6, 9, 37 et seq., 111 to 118, 142, 267, 360 and 361, and 363 to 366 of the Código Procesal Penal, and Articles 1, 3, 19, 58 subsection a) and 61 subsections a) and c) of Ley Forestal 7575, it is hereby ruled: [Nombre1] and [Nombre3] are ACQUITTED of all punishment and liability for the offenses of VIOLATION OF LEY FORESTAL (INFRACCION A LA LEY FORESTAL), in the forms of illegal harvesting (aprovechamiento Ilegal) and land-use change (cambio de uso de suelo), with which they had been charged by the Ministerio Público and the Procuraduría General de la República.
The CIVIL ACTION FOR DAMAGES (ACCION CIVIL RESARCITORIA) brought against them by the Procuraduría General de la República is hereby DENIED in all respects; nevertheless, because it litigated in good faith, it is exempted from paying the costs of this action. In the criminal matter, no special award of costs is entered. Once this judgment becomes final, the Leyland tractor, [Placa1], shall be returned to whoever establishes ownership thereof or, failing that, to the person from whom it was seized; likewise, the seized timber shall be returned to whoever establishes lawful ownership thereof. Let notice be given by reading.” (sic. fl. 256).
II.Attorney [Nombre6], representative of the Procuraduría General de la República, and attorney [Nombre7], prosecutor for the Ministerio Público de Pococí y Guácimo, filed appeals in cassation against the foregoing ruling.
III.Following the corresponding deliberation in accordance with Article 465 of the Código de Procesal Penal, the Court considered the issues raised in the appeals in cassation.
Drafted by Cassation Judge [Nombre9]; and,
CONSIDERING:
I.The Procuraduría General de la República attorney, [Nombre6], and the prosecutor, attorney [Nombre7], filed appeals in cassation against Judgment Nº 9-G-2010, issued at 16:35 on 7 de enero de 2010 by the Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica. An oral hearing (audiencia oral) was held in this proceeding on 21 de abril de 2010, and given that no evidence was received, the grounds were not expanded, and no issues other than those raised in the appellate briefs were introduced, and having verified that due process (debido proceso) is not affected because the Sala Constitucional has so held through repeated binding decisions—including decisions Nº 6681-96, Nº 11508-2000 and 17553-07—the appeals shall be decided by a panel composed differently from the one that participated in that hearing, since Judge Ingrid Estrada Venegas sits in place of Judge Guillermo Sojo Picado (who was present at that time, CED2).
II.Content of the challenges.- Appeal on points of law (recurso de casación) filed by Attorney [Nombre6]. First ground.- She alleges a lack of reasoning (falta de fundamentación), in violation of Articles 142, 361 subsection a), and 363 subsection b), in relation to Article 369 subsection d), of the Code of Criminal Procedure. She states that the judgment deemed the facts comprising the indictment and the private criminal complaint (querella) not proven. She asserts that the trial judge based the acquittal on the fact that the land where the felling (tala) occurred did not measure two hectares, the minimum area required by Article 3 of the Ley Forestal for it to be classified as forest (bosque); the appellant challenges this assessment, asserting that the trial judge distorted the testimony of a MINAE witness, who, although he mentioned that the area was approximately two hectares, was referring to what he observed on October 31, 2007 (when he visited the site), but that it had previously been larger because the forest ecosystem had been reduced.
Furthermore, even though the forest manager (regente forestal), [Nombre10], stated at trial that the area in question did not measure two hectares, he did not do so based on the size of the land before the cutting (corta) took place; in any event, he stated that he had not marked any trees in the forest. Although, when this person went with the prosecutor to measure the area, it yielded one and one-quarter hectares, “it cannot be concluded from this that, at the time of teh (sic) events, it did not measure two hectares either.” (See folio 265). She alleges that all of the court’s reasoning for concluding that the area did not measure two hectares is contradictory and insufficient, and that even the civil action for damages (acción civil resarcitoria) was dismissed. She requests that the trial and judgment be declared null and void and that new proceedings be ordered. Second ground.- She alleges a lack of reasoning and criticizes the judgment for acquitting the defendants because, in the court’s view, it had not been proven that 46 additional trees had been felled, adding: “It is important to clarify that the CED3 is the prescribed procedure for obtaining authorization to cut trees, trees that the engineer marks under the authority of his public certification, which he cannot misuse to deceive.
The certificate states that he marked trees, and after they are cut, the owner or the person who purchased the timber asks MINAE for transport permits based on the number of logs produced; in this case, 35 trees were marked and permits were requested for 80 logs. When the forest manager issued his final report, he said that 24 additional trees had been cut, and given that [Nombre10] was found to be a credible witness as to everything else, why not as to this? The judgment then says that they did not find the stumps on the day of the inspection with the Prosecutor. This would be a sound basis for doubt. But [Nombre3] testified that he cleared the property of stumps and planted it; now there is cassava, he said... The judgment says that the forest manager stated in his report that no trees were cut in the ‘protected zones’ (zonas protectoras), but at trial he was not asked which protected zones the Property had, because if he had already said that he did not mark trees in the forest, to which protected zones was he referring—to that forest, or were there others—and if there was only that forest, why did he include that information?
And the judgment goes on to ask, if MINAE ‘conducted the inspection on October 31, the question then arises: where, how, and when did the forest manager determine that those 24 trees had been cut unlawfully? And doubt arises as to the credibility of that report and the forest management services.’” (See folios 265 and 266; the spelling and drafting errors appear in the original). The appellant believes that the judgment cannot be based on serious doubts when its reasoning is, in fact, contradictory. She requests that the judgment be vacated and the case remanded. Third ground.- She alleges a violation of the rules of sound judicial assessment (reglas de la sana crítica) when the trial court questions [Nombre3]’s participation in the timber cutting, even though, as the defendants testified, the matter “... is clear: [Nombre3] sells the timber to [Nombre1], [Nombre1] hires [Nombre10], and [Nombre10] asks E, who was the owner for IDA purposes, to sign.” (See folio 268).
The trial judge omitted this analysis in violation of the rules of rational sound judicial assessment (sana crítica racional), even failing to evaluate the defendants’ testimony, which shows that the timber transaction was conducted by the current owner of the property ([Nombre3]) and not by the registered owner (E). She requests that the judgment be vacated and the case remanded. Fourth ground.- She invokes a violation of substantive law, because the facts found proven reveal an error in the application of Articles 58 and 61 of the Ley Forestal, and explains that the judgment did not find it proven that [Nombre3] or [Nombre1] carried out a land-use change (cambio en el uso del suelo) by cutting trees in a forest, because it was not shown that the existing stand of trees legally constituted a forest; regarding this issue, the appellant objects: “It was not proven that it is a forest today, because what should have been investigated was whether it was a forest at the time of the event; the court is therefore applying substantive law at the wrong point in time.” (See folio 269).
For the foregoing reasons, she requests that this ground be granted and that the civil action for damages caused be allowed. Appeal on points of law filed by Attorney [Nombre7].- First ground.- He alleges the improper application of substantive law, in violation of Articles 365, 369 subsection c), 422, 423, 424, 443, 444, and 445 of the Code of Criminal Procedure. He challenges the trial judge’s assertion in the judgment that three core aspects of the alleged facts were not proven, when the evidence presented established the felling of unauthorized trees (24 not included in CED4 CED5); and that the defendant [Nombre3] is the owner of the property where the felling took place, had negotiated the timber with co-defendant [Nombre1], and was the person who benefited from the value of the timber. Second ground.- He alleges a violation of the rules of sound judicial assessment and argues that the testimony of the accused, [Nombre3], stated that he was the owner of the property where the felling occurred, that he had a kiln for turning the timber into charcoal, that he made use of forest resources, and that he had cleared and cleaned the land for planting cassava; it was therefore impossible, contrary to the trial judge’s assessment, to find stumps from the felled trees (whether or not they were among those authorized under CED3), because the “clearing” for cassava cultivation eliminated all traces, evidence, signs, or stumps demonstrating that the felling had occurred.
The trial judge did not consider this circumstance in the judgment, even though the record contained photographs and a MINAE report on the matter, neither of which was evaluated by the court. Third ground.- He objects on the basis of a violation of the principle of consistency between the indictment and the judgment (principio de correlación entre acusación y sentencia); in this regard, he challenges the trial judge’s statement, in the section of the judgment addressing proven facts, that there were no facts relevant to resolving the matter, an assertion that contradicts other statements by the court, such as its finding that the illegal cutting of timber had not been proven. He alleges that the ruling contains contradictory reasoning, because, on the one hand, it excludes any participation by defendant [Nombre3] in the alleged events, while, on the other hand, it finds it proven that [Nombre3] sold the timber to [Nombre1] and therefore benefited from the forest product, precisely because he was the possessor of the property.
Fourth ground.- He alleges insufficient reasoning due to the absence of any analysis of the photographs and the MINAE report describing the condition of the affected property after it was cleared for cassava cultivation. Fifth ground.- He alleges a lack of reasoning and asserts that the court treated the statements made by engineer [Nombre10] as expert evidence (pericia), even though he testified as a witness, since the expert evidence consisted of the report he had submitted in the proceeding. He adds: “Given that the witness contradicts his own official report, this reveals an intent to benefit the person who hired him, establishing bias in his account, which departs from the forest management report.” (See folio 272). Sixth ground.- He alleges a violation of Articles 1 and 30 of the Criminal Code, Article 1 and Article 369 subsection i) of the Code of Criminal Procedure, and Article 61 subsections a) and c) of the Ley Forestal.
He explains that criminal liability in this case arises because the accused, [Nombre3], owned the affected property and its timber, ordered the illegal felling and the clearing of the debris without regard for the environmental damage caused by such action, and even obtained an economic benefit from the sale of the timber. He does not specify the relief sought under any of the grounds.
III.The appeals are granted, but for the following reasons.- In view of the connection between the content of the challenges, they are decided jointly in this section. It is necessary to revisit the content of the judgment to determine whether the petitioners’ objections are well-founded, based on the charges brought by both the Public Prosecutor’s Office and the Office of the Attorney General of the Republic, and on the factual and intellectual evidentiary reasoning set forth in the ruling. The defendants [Nombre1]. and [Nombre3]. were accused of having unlawfully felled forest products in a small forest through persons hired for that purpose; for although a “CED3” had been issued (authorizing the felling of 35 trees), the cutting encompassed another 46 trees not authorized under that certificate, located in a forest area of approximately two hectares. It is also specified that the aforementioned contract concerns a property registered in the name of [Nombre11]. but in the possession or enjoyment of the accused [Nombre3]; where MINAE authorized the extraction of timber through a forest-supervision contract (contrato de regencia) under the “Certificate of Origin” (Certificado de Origen) modality authorized by the forest supervisor (regente forestal), [Nombre10].
The judge then states that three core issues must be determined (although four are actually mentioned): (1) The felling of the additional 46 trees. (2) Whether the land where the alleged illegal felling occurred constituted a forest. (3) The participation and criminal liability of the accused. (4) Whether the additional felling involved unauthorized species. He decides to begin with the issue of whether the site where the alleged felling occurred constituted a forest and states: “REGARDING WHETHER THE SITE WHERE THE TREES WERE ALLEGEDLY FELLED CONSTITUTED A FOREST: This judge reaches the conclusion that this matter was definitively never established by the criminal and civil claimants. Article 3 of the Ley Forestal defines a forest as an area that, among other characteristics, measures NO LESS THAN TWO HECTARES; upon examining the evidence received in this regard, the MINAE Report appearing at folios 1 to 8 states that the land measured ‘approximately 2 hectares,’ meaning that it does not affirm that it measured the two hectares required by the provision in order to be considered a forest; at trial, engineer [Nombre12]., who signed that report, stated that this portion of land was an area ‘of about two hectares,’ meaning that once again he did not affirm that it met the statutory minimum area; he did add that this part of the property had been disturbed, with the forest having been removed from part of it, but ultimately, in his trial testimony, he neither affirmed nor demonstrated that it measured the area prescribed by the provision; the plans appearing at folios 38 to 440 and prepared by MINAE were admitted into evidence, showing an area that would correspond to the site where the trees that MINAE had authorized for cutting were felled, as well as those reported as having been cut in the forest zone, and from the coloration of those maps or plans we find that almost the entire area in which all of the cutting occurred, with a few exceptions, would constitute forest, both where the authorized trees were cut and where those said to be unauthorized were cut; nevertheless, for the purposes relevant here, it is not possible to infer or derive from those plans or maps the size of the affected area; according to engineer [Nombre10]., the supervisor who authorized the cutting (being empowered by law to do so) and a prosecution witness, the area did not measure two hectares and therefore could not be classified as forest for the purposes at issue, and measured at most 1.4 hectares; the accused [Nombre1]. denies that it measured two hectares and states that, when an inspection was conducted with the investigating prosecutor, they measured and verified that it did not measure two hectares; finally, the visual inspection or site examination conducted by Lic. [Nombre13], which appears at folios 78 to 81, shows that on that occasion both engineer [Nombre10]. and the accused stated that they had measured the area and that it did not meet the statutory area requirement; one fact, however, is particularly relevant: notwithstanding the statements of the supervisor and the accused, neither Lic. [Nombre14] nor the MINAE representative who also attended took any precaution in this regard, and they did not measure the swampy land comprising the grove in order to verify that it constituted a forest under the definition in Article 3 of the Ley Forestal with respect to its area.
Given this insufficiency of evidence—indeed, its absence—it cannot be deemed established that the accused cut trees in a forest without having the proper authorization to do so, conduct prohibited by forestry regulations (Articles 58 and 61). In this case, it was not enough merely to assert that it was a forest, as stated in the charges brought by the Public Prosecutor’s Office and the Office of the Attorney General for Criminal Matters, nor can this be presumed on the basis of experience or logic, because the information yielded by the evidence indicates that this was a fairly small portion of land; even in the MINAE report, engineer [Nombre12] states that it measured approximately two hectares, while supervisor [Nombre10]. and the accused said that they had measured it and that it measured approximately one and one-quarter hectares; it was therefore necessary to measure the area in order to determine its actual size, because this constituted an element of statutory offense classification (tipicidad normativa), and it had to be established that the area measured at least two hectares, a fact that ultimately was not established.” (Cfr. folio 246 a 248).
As can be seen, the judge decides to begin his intellectual analysis by determining whether the area where the illegal felling was alleged to have occurred constituted a “forest.” Although the decision does not specify the source of the judge’s concern with establishing the existence of a forest (in the terms prescribed by the Ley Forestal), it may have arisen from a judicial interpretation by this same Criminal Cassation Court, which for years adopted the position set forth in voto Nº682-F-97, de las 15:45 horas del 25 de agosto de 1997, analyzing the concept of harvesting forest products (aprovechamiento de productos forestales) contained, for example, in the text of Articles 58 and 61 of the Ley Forestal; this is because the Public Prosecutor’s Office charged the defendants with the offenses of felling, transporting, and harvesting timber, established and punishable under Article 61(a) and (c) of the Ley Forestal (Cfr. 89 a 91); and because the Office of the Attorney General of the Republic charged them with illegal felling, sawing, and illegal harvesting of timber in a forest area, pursuant to Articles 57, 58(a), and 61(a) of the Ley Forestal (Cfr. folio 198 a 200).
In voto Nº682-F-97, Articles 61 and 3(a) are transcribed, followed by the following statement: “From the relationship between the two articles, the case law has concluded that the mere act of cutting down a timber tree, irrespective of whether it forms part of a forest or forest plantation (plantación forestal), constitutes the offense contemplated in Art. 61 inciso a), mentioned above (see voto 524-F-97 of this Court (there is a dissenting opinion)). However, we, the judges of the Superior Criminal Cassation Court designated to hear this matter, consider that the aforementioned case law should be changed. Of great importance is the text defining the criminal offense set forth in Art. 61 inciso a), which refers to the harvesting ‘... of one or more forest products....’ Regarding the interpretation of statutes, the existence of various methods has been noted, all of which are, of course, limited by the principle of legality (principio de legalidad) established in Art. 1 of the Criminal Code and Article 39 of the Political Constitution, one of the fundamental principles of a State governed by the rule of law (Estado de Derecho), regarding which there is consensus (see, for example: Constitutional Chamber, voto 461-91).
It is significant that the case law has tended to conceptualize ‘forestry’ as ‘relating to trees,’ which is incorrect. Indeed, if the term forestry is looked up in the dictionary, it will be seen to mean ‘relating to forests and their uses’ (Vox Diccionario General Ilustrado de la Lengua Española. Barcelona, 1995, p. 517. See also: Larousse. Diccionario Usual, México, 1985, p. 266). Note also that the Spanish term forestal comes from the Latin word foresta, meaning forest. It is true that, in defining forestal, the Dictionary of the Royal Spanish Academy indicates that the term means ‘relating to forests and the harvesting of firewood, pastures, etc.’ Diccionario de la Lengua Española. Real Academia Española, Madrid, vigésimo primera edición, 1992, p. 984). Nevertheless, the term ‘forest’ must be regarded as fundamental, and the reference to ‘the harvesting of firewood, pastures, etc.’ concerns the use of the forest, as indicated in other dictionaries.
It should be noted that the objective definition of a criminal offense (tipo penal objetivo) consists of descriptive elements and, by way of exception, normative elements. It has been held that one consequence of the principle of legality is that the latter elements must be avoided because of the legal uncertainty they introduce as a result of the scope for value judgments they afford the judge. Accordingly, when interpreting an element of a criminal offense, it must be presumed to be descriptive unless sufficient reasons exist to conclude that it is not descriptive but rather normative. In this specific case, there are no elements indicating that the term forestal should be understood in a sense other than that indicated above, namely, as a descriptive element. This is without prejudice to the fact that the term indirectly acquires normative characteristics insofar as the Ley Forestal defines concepts such as ‘forest’ and ‘forest plantation’ (Art. 3 of the law).
Relevant in support of the foregoing interpretation of the term forestal is the fact that the ultimate purpose of the Ley Forestal is the protection and administration of forests and the use of forest resources. This is made clear in Article 1 of the Ley Forestal, which specifies the objectives of that law, a matter of paramount importance in interpreting its various provisions. It thus provides: ‘Objectives. This law establishes as an essential and priority function of the State the conservation, protection, and administration of natural forests, and the production, use, industrialization, and promotion of the country’s forest resources intended for that purpose, in accordance with the principle of the proper and sustainable use of renewable natural resources....’ Article 3 of the law, for its part, provides a series of definitions, including those of timber harvesting (aprovechamiento maderable), land suitable for forestry (terrenos de aptitud forestal), forest ecosystem (ecosistema boscoso), forest, forest management plan (plan de manejo forestal), forest plantation, forestry regime (régimen forestal), agroforestry system (sistema agroforestal), protected wilderness area (área silvestre protegida), primary processing facility (centro de industrialización primaria), and environmental services (servicios ambientales).
Significantly, all of these ultimately refer to the ‘forestry regime,’ with particular emphasis on the terms ‘forest’ and ‘forest plantation.’ Reference must be made to the reliance sometimes placed on Art. 3 inciso a) of the Ley Forestal to justify the proposition that Art. 63 inciso a) penalizes the cutting of trees on non-forest land. This concerns that article’s reference to the cutting of trees not included in Art. 1. It has therefore been stated that such cutting is unrelated to the objectives of the law established in Art. 1, mentioned above. This interpretation must be rejected, first, because Art.
1, as stated, is fundamental to the interpretation of the entire law insofar as it sets forth its objectives. However, the fundamental reason is that the reference made in Art. 3 subsection a) to Art. 1 does not concern its first paragraph, the relevant portion of which was transcribed above, but rather paragraph 2) of that same article, which, like Art. 3 subsection a), refers to the cutting of trees (corta de árboles), stating: “By virtue of the public interest and except as provided in Article 18 of this law, the cutting or harvesting of forests (aprovechamiento de los bosques) in national parks, biological reserves, mangroves, protected zones, wildlife refuges, and State-owned forest reserves is prohibited.” Relevant to the use of the concept of “forestry-related” (forestal) as pertaining to forests, as discussed above, is the fact that the only article in the Ley Forestal that refers to the prohibition against cutting trees on private property other than forests or plantations is Article 27.
It provides: “Trees may be cut on land used for agricultural or livestock purposes and without forest cover (terrenos de uso agropecuario y sin bosque) only after obtaining authorization from the Regional Environmental Council or the respective municipality, and only up to a maximum of five trees per hectare per year. Cutting more than twenty trees per property shall require authorization from the State Forestry Administration.” This leads, under an a contrario sensu interpretation, to the conclusion that the law contains no prohibition against cutting trees on land without forest cover that is not used for agricultural or livestock purposes. An attempt was made to correct this through regulations. Thus, the Regulations to the Ley Forestal, published in La Gaceta on January 23, 1997, define land used for agricultural or livestock purposes without forest cover as “private properties containing trees not established under an agroforestry system, properties containing areas of forest cover measuring less than two hectares, or trees located in urban areas” (Art. 2).
However, it is clear that this definition in the Regulations does not apply to the specific case at hand. First, the act being adjudicated was committed in early November 1995, whereas the Regulations were not even published until January 23, 1997; applying them would therefore constitute a prohibited instance of retroactive application. Moreover, in defining what is meant by “land used for agricultural or livestock purposes,” the Regulations exceed their authority, disregarding their merely implementing role with respect to the law, because they seek to include within the term “agricultural or livestock” everything that is not forestry-related. This is inconsistent with the meaning of the term “agricultural or livestock” (that is, relating to agriculture and livestock raising), and even leads to the absurdity of classifying urban land as “agricultural or livestock.” In any event, even the applicable penalty for violating Art. 27 of the Ley Forestal—that is, for cutting trees on land used for agricultural or livestock purposes—is debatable, since the law establishes no penalty whatsoever, and it is highly questionable whether Art. 61 subsection a) of the Ley Forestal, insofar as it refers to the harvesting of forest products (aprovechamiento de productos forestales), could therefore be deemed applicable in such a case.
Such an interpretation would not, in fact, be consistent with the principle of legality (principio de legalidad), because nowhere does the law state that forest products also include tree products originating from land that is not forest, but rather land used for agricultural or livestock purposes. Any interpretation seeking to include within Art. 61 subsection a) of the Ley Forestal the cutting of trees on land used for agricultural or livestock purposes would have to be based on the title of Title Three of the Ley Forestal, namely “Private Forest Property” (Propiedad Forestal Privada), within which Art. 27 of the Ley Forestal is located. However, an interpretation that sought by this means to broaden the definition of the criminal offense (tipo penal) under Art. 61 subsection a) of that law would not be consistent with the principle of legality, which requires clarity in the description of the prohibited conduct, and such clarity would be lacking under the proposed interpretation.
It is important to interpret legal provisions in conformity with the Constitución Política, as constitutional-law scholarship requires. Accordingly, expansive systematic interpretations of the relevant criminal offense cannot be used to classify as criminal conduct that is not clearly described within the definition of the offense. Indeed, “forestry-related” is one concept, while “agricultural or livestock” is an entirely different one, and an interpretation stating that agricultural or livestock matters are forestry-related would not be clear. In any event, in the specific case at hand, it could not even be said that a tree was cut on “land used for agricultural or livestock purposes,” because the two trees were cut on land intended for construction (see folio 35, front, lines 27-29). At the risk of repetition, it must be emphasized that, if it were maintained that the cutting of trees contemplated in Art. 27 of the Ley Forestal is punishable under Art. 63 subsection a) of the Ley Forestal, the expansion of the term “agricultural or livestock” provided for in the Regulations to the Ley Forestal would not only contravene the Regulations’ implementing role in relation to the law, but would also violate the principle of legality itself (Art. 39 of the Constitución Política).
This principle requires that the factual circumstances classified as criminal (supuesto de hecho calificado como delictivo) be established in an ordinary statute and not in a mere regulation, all of which is grounded in the Enlightenment doctrine that gave rise to the so-called separation of powers (Art. 9 of the Constitución Política). By way of exception, the Sala Constitucional has upheld the constitutionality of blank criminal statutes (leyes penales en blanco), meaning statutes that refer to a lower-ranking provision to specify one of the elements of the offense. In this regard, it is important that the Sala Constitucional has stated that “a criminal provision may be completed by means of a regulation, provided that, in doing so, the Executive Branch remains within its own sphere of authority and that the referring statute establishes with sufficient clarity the prerequisites for criminal liability, as well as the type and extent of the penalty...” (Sala Constitucional, voto 1876-90).
However, it is clear that, through the definition of “land used for agricultural or livestock purposes without forest cover,” the Regulations to the Ley Forestal would expand the scope of the criminal conduct established in the Ley Forestal and, in doing so, exceed the authority of the Executive Branch. The same may be said of any attempt to use the word “tree” as a synonym for “forestry-related,” as the Regulations to the Ley Forestal apparently seek to do by using the term “forest tree” (árbol forestal) (Art. 2). In addition to the a contrario sensu interpretation of Art. 27 of the Ley Forestal set forth above, the interpretation of Art. 63 subsection a) in relation to Art. 56 of the Ley Forestal is highly relevant to this matter. The former article makes violation of the referenced Art. 56 a criminal offense. That article, in turn, provides that “Logs, squared timber, or sawn timber originating from a forest or plantation may not be transported without the corresponding documentation.” Significantly, as the case law of the Tribunal Superior de Casación Penal has already held, only the unauthorized transportation of timber “originating from a forest or plantation” is punishable, not the transportation of timber originating from land that is neither forest nor plantation.
This is a relevant argument for concluding that Art. 61 subsection a) punishes only the harvesting—and, as part thereof, the cutting—of trees originating from forests or plantations. It should be noted that the legislature sought to extend the “pincers” of criminal law (Derecho Penal) to various forms of conduct comprising what might be called the “deforestation cycle,” paraphrasing terminology used with respect to other types of offenses. Thus, the purpose is to punish not only conduct related to the unauthorized cutting of trees on forest land, but also the unauthorized transportation of timber from trees on such land. There would therefore be no reason to punish transportation only when the timber originates from forests or plantations, while, with respect to tree cutting, punishing it even on land that does not possess those characteristics...” Consequently, based on that decision, the following rule was established: “This leads, under an a contrario sensu interpretation, to the conclusion that the law contains no prohibition against cutting trees on land without forest cover that is not used for agricultural or livestock purposes.” (Boldface does not appear in the original).
IV.This Chamber does not share that analysis, which equates the expression forest product or forest resources with forest, or with originating from a forest, for the following reasons. First.- The Ley Forestal provides for offenses involving harvesting (aprovechamiento) on both state-owned and private land. The provisions of the Ley Forestal contain two rules defining offenses involving the harvesting of forest products (which, incidentally, include conduct other than felling, as will be explained infra). The first is Article 58, which covers harvesting activities on state-owned properties or in protection areas (áreas de protección) (public or private). The second is Article 61, which defines harvesting activities carried out on private property as offenses. A reading of the Ley Forestal reveals various scenarios concerning the felling or cutting of trees, with express prohibitions or permits, noncompliance with which may result in the commission of the offenses penalized therein, even when private land is involved.
As [Nombre15] states: “The concept of private property entails usufruct and, therefore, the owner’s right to make use of all appurtenant property, such as trees located on the owner’s property. However, because of the importance of forest resources and associated ecosystems (such as water resources) to the environment in general, certain limitations have been imposed on the enjoyment of forest products for reasons of public interest. Thus, the law requires the private owner and lawful owner of the timber to request authorization from the State Forestry Administration (Administración Forestal del Estado, AFE) to harvest and transport the timber. By defining as an offense, in subparagraph c) of Article 58 of the LF, noncompliance with declared forestry bans, forest resources are also protected, but specifically species threatened with extinction or having reduced populations, because the commercial value of these species increases every day, as does demand for them, such that the legislature sought to grant them special protection in order to prevent their disappearance.” (GONZÁLEZ [Nombre16], [Nombre17], Manual de Delitos Ambientales, 1a. edition, Litografía e Imprenta LIL, S.A., San José, 2007, p.253).
Although Article 1 announces a total prohibition on cutting in forests, it also establishes exceptions which, in any event, if carried out without the permits or outside the circumstances authorized by law, may constitute one of the violations provided for by law. For example: (1) Article 1 prohibits felling or cutting in forests, but permits it for research, training, and ecotourism activities, with the prior approval of the Ministerio del Ambiente y Energía (Article 1 in relation to Article 18). (2) Article 19 contains a second exception, providing that the State Forestry Administration may: “a) Construct dwellings, offices, stables, corrals, nurseries, roads, bridges, and facilities intended for recreation and ecotourism, as well as other similar improvements, on privately owned land and properties where forests are located. b) Carry out state or private infrastructure projects of national interest (conveniencia nacional). c) Cut trees for reasons of human safety or scientific interest. d) Prevent forest fires, natural disasters, or other similar causes or their consequences.
In these cases, forest cutting shall be limited, proportionate, and reasonable for the purposes set forth above. A preliminary screening questionnaire (cuestionario de preselección) must first be completed before the State Forestry Administration to determine whether an environmental impact assessment (evaluación del impacto ambiental) may be required, as established by the regulations to this law.” Further onCED6), Article 34 prohibits the cutting or removal of trees in the protection areas (public or private) described in Article 33, except in the case of projects declared by the Poder Ejecutivo to be of national interest. Those protection areas are: “a) Areas bordering permanent springs (nacientes), defined within a radius of cien metros measured horizontally. b) A strip of quince metros in rural areas and diez metros in urban areas, measured horizontally on both sides along the banks of rivers, gullies, or streams, if the terrain is flat, and cincuenta metros horizontally if the terrain is rugged. c) An area of cincuenta metros measured horizontally along the shores of natural lakes and reservoirs and of artificial lakes or reservoirs constructed by the State and its institutions.
Privately owned artificial lakes and reservoirs are excluded. d) Recharge areas and the aquifers of springs (manantiales), whose boundaries shall be determined by the competent bodies established in the regulations to this law.” (4) If cutting occurs on land used for agricultural or livestock purposes and without forest, up to a maximum of tres árboles per hectare may be cut annually, with prior authorization from the Consejo Regional Ambiental. If diez árboles per property are exceeded, authorization from the State Forestry Administration is required (Article 27). Finally, (5) if the cutting occurs in forest plantations (plantaciones forestales), agroforestry systems (sistemas agroforestales), or individually planted trees, no permit is required for cutting, transportation, processing, or export (Article 28). However, to “remove from the property to any part of the national territory logs, squared timber, or sawn timber originating from forest plantations, a CED3 issued by the forestry manager (regente forestal) or the Consejo Regional Ambiental for the area shall be required...” (Article 31).
Consequently, if cutting or felling is performed without the corresponding permit, or in excess of or at variance with what was authorized, one of the criminal offenses provided for in the Ley Forestal is committed, for example, the offense established in Article 61: “A term of imprisonment of one month to three years shall be imposed on anyone who: a) Harvests one or more forest products on private property without a permit from the State Forestry Administration or who, despite having a permit, fails to comply with what was authorized. b) Acquires or processes forest products without complying with the requirements established in this law. c) Carries out activities involving land-use change (cambio en el uso de la tierra), contrary to the provisions of Article 19 of this law. In the foregoing cases, the products shall be seized and placed at the disposal of the competent judicial authority. d) Removes forest products from private or state-owned property or transports forest products obtained in the same manner.” Therefore, and with all due respect, we do not consider the assertion made in judgment Nº682-F-1997 to be correct when it states that a violation of Article 27 of the Ley Forestal cannot be penalized by applying Article 61, subparagraph a), because, precisely in accordance with the principle of legality (principio de legalidad), it must be concluded that this is the offense established to punish such conduct; that is, cutting carried out on private land without authorization or in excess of the authorization granted.
Second.- Article 61 of the Ley Forestal does not include the element of “forest” or forest plantation as part of the objective elements of the offense (tipo objetivo). The criminal offense defined and penalized in Article 61 of the Ley Forestal, transcribed above, makes no mention whatsoever of forests or forest plantations as part of the description of its objective elements. Third.- As established by the Ley Forestal, forests are not the only areas containing forest resources or products. The Ley Forestal has the distinctive feature of including an article containing definitions, Article 3, which defines several expressions: timber harvesting (aprovechamiento maderable), land suitable for forestry (terrenos de aptitud forestal), forest, forest management plan (plan de manejo forestal), etc.; however, it certainly does not provide a specific authoritative interpretation (interpretación auténtica) of “forest resources,” which means resorting to literal, historical, and/or systematic interpretation, which, in our view, does not lead to the conclusions reached in judgment Nº682-F-97.
Nevertheless, Article 3 is useful because subparagraph a) defines the term “harvesting,” which forms part of the objective elements established in Article 61 ibidem. It defines it as the act of cutting or removing standing timber trees or using fallen trees. But what of the expression forest products or resources (also used by the legislature in the statutory description of Article 61 and also Article 58 of the Ley Forestal)? The interpretation maintained by this Chamber for years associates it with the existence of a forest or plantation, purportedly on the basis of Article 1 of the Ley Forestal, which provides: “This law establishes, as an essential and priority function of the State, the duty to ensure the conservation, protection, and administration of natural forests and the production, harvesting, processing, and promotion of the country’s forest resources intended for that purpose, in accordance with the principle of appropriate and sustainable use of renewable natural resources.” (Boldface does not appear in the original.) Note that: (a) the law treats the terms “forest” and “forest resources” differently and separately; that is, it does not make the existence or designation of “forest resources” dependent on a forest; moreover, (b) the production, harvesting, processing, or promotion of forest resources, even though they do not physically occupy the same space as forests, undoubtedly contributes to the conservation, protection, and administration of natural forests, precisely “in accordance with the principle of appropriate and sustainable use of renewable natural resources,” also established in the cited Article 1 of the Ley Forestal.
In addition, (c) it would make no sense to refer to “forest resources” if they were already implicit in the term “forest”; the reference would be superfluous, yet Article 1 includes both expressions. Finally, (d) if, based on the objective set forth in Article 1, only felling in forests were punishable, it would make no sense for the criminal offenses to refer expressly to private land, but they do. For all the foregoing reasons, this panel considers the following to be the correct interpretation of the offenses under discussion (Articles 58 and 61). (1) They must be read in conjunction with Article 3, subparagraph a), which defines “harvesting”: “The act of cutting or removing standing timber trees or using fallen trees, carried out on private land, not included in Article 1 of this law, that generates or may generate some profit, benefit, advantage, utility, or gain for the person carrying it out or for the person whom that individual represents.” The phrase “not included in Article 1...” is useful in highlighting the prohibition on harvesting in state-owned protected wilderness areas (áreas silvestres protegidas).
(2) As for the interpretation of the expressions forest resource or product, we consider that, within the law, the adjective “forestry” has a normative character, as evidenced by the numerous references to expressions such as “forestry manager,” “forest management plan,” “forestry regime (régimen forestal),” “forest plantation,” “State Forestry Administration,” “Forestry Fund (Fondo Forestal),” etc. From that perspective, it would be entirely feasible to associate it with “trees,” regardless of whether they form part of a forest or plantation. But even if a purely descriptive meaning is adopted, the fact remains that the Diccionario de la Real Academia de la Lengua Española defines “forestry” as: “Relating to forests and to the utilization of firewood, pastures, etc.” Thus, from a semantic standpoint, the meaning of “forestry” is not limited or confined to matters related to forests; it includes “...the felling of trees of that nature even when they do not form part of a forested area, as well as the use of fallen trees, all as a means of preserving natural ecosystems.” (Cf. judgment Nº 524-F-1997, at 9:00 on 27 de junio de 1997).
That argument is reinforced by the fact that the concept of “forest product” (producto forestal) (one of the objective elements contained in Article 61) is cited in Article 2 of the Regulations to the Ley Forestal, published in La Gaceta Nº 16, del 23 de enero de 1997, in the following terms: “Forest product: Any log, squared timber, veneer, particleboard, matches, pulp, pallets, toothpicks, wood chips, furniture, doors, window frames, and moldings.” As may be seen, rather than a concept, this is a workable list of goods, objects, or products obtainable from trees, which are not usually found in forests or plantations. Resorting to the regulations is commendable and entirely lawful, since the enumeration they provide does not affect the central core of the charge established in the provision, nor does it exceed the purpose or objective contemplated in the Ley Forestal, because the provision clearly establishes the conditions for criminal liability (presupuesto de punibilidad), as well as the type and extent of the penalty (as established by voto Nº1876-1990 of the Sala Constitucional).
In fact, the reference contained in the Regulations is an exercise in providing examples of situations that may be classified as “forest products,” which in no way broaden or contradict the interpretation adopted in this decision. Moreover, even if that reference did not exist in the regulations, it could still readily be concluded that squared timber, pulp, wood chips, etc., are forest products. In short, it must be concluded that both forest product and forest resource (recurso forestal) are expressions that unquestionably refer to trees, regardless of their maturity, harvesting, commercial value, or location within or outside a forest or forest plantation; and the criminal offenses (tipos penales) under discussion must be analyzed accordingly. In assessing the reasoning of the challenged judgment, the trial judge proceeds from an erroneous analysis, because the judge makes proof of the alleged act contingent upon verification that trees were cut within a forest (under the terms set forth in Article 3 of the Ley Forestal); however, in this specific case, that is not a central factor, nor may it condition proof of the alleged criminal act.
In this Chamber’s view, that circumstance renders the ruling defective in its entirety and makes new proceedings in accordance with law indispensable. It is an error to consider that the purpose of the Ley Forestal is limited to the safeguarding or protection of forests; that does not follow from Article 1 thereof and becomes even more evident when the full content of that legislation is analyzed. It should also be noted that, merely by granting the claim raised herein that resulted in the judgment being vacated, the Tribunal de Casación is not prejudging the merits of the case. In that regard, this Chamber’s ruling must not influence the judgment of the court that is to be constituted for the remand trial (juicio de reenvío); rather, its members must independently and afresh assess the conviction arising from the evidence, as well as the logical soundness and persuasiveness of the reasons invoked by the parties in the adversarial proceedings, in order to decide impartially as appropriate. In view of the foregoing, because there is no need to do so, no ruling is issued on the other grounds of challenge.
POR TANTO
The appeals in cassation (recursos de casación) filed by attorney [Nombre6] on behalf of the Procuraduría General de la República and by attorney [Nombre7] on behalf of the Ministerio Público are hereby granted. The judgment and the trial are vacated. The case is remanded for new proceedings in accordance with law. LET NOTICE BE GIVEN.

I.Que mediante sentencia número 12-G-2010, de las nueve horas doce minutos del quince de enero de dos mil diez, el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, Guápiles, resolvió: "POR TANTO: De conformidad con las reglas de la sana crítica racional, artículos 39 y 41 de la Constitución Política, 1, 30 y 31 del Código Penal, 1, 6, 9, 37 y siguientes, 111 a 118, 142, 267, 360 y 361, 363 a 366 del Código Procesal Penal, y artículos 1, 3, 19, 58 inciso a) y 61 incisos a) y c) de la Ley Forestal 7575, se resuelve: ABSOLVER de toda pena y responsabilidad a [Nombre1]. y [Nombre3]. por los delitos de INFRACCION A LA LEY FORESTAL en su modalidad de aprovechamiento Ilegal y cambio de uso de suelo, que les venía atribuyendo el Ministerio Público y la Procuraduría General de la República. Firme esta sentencia devuélvase a quien acredite ser su propietario en su defecto a quien se le decomisó el chapulín marca Leyland, [Placa1], igualmente la madera decomisada a quien acredite que legalmente le pertenezca. Por lectura notifíquese." (sic. fl. 256).
II.Que contra el anterior pronunciamiento interpusieron recurso de casación la licenciada [Nombre6], representante de la Procuraduría General de la República; y el licenciado [Nombre7], fiscal del Ministerio Público de Pococí y Guácimo.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de casación.
Redacta la Jueza de Casación [Nombre9]; y,
CONSIDERANDO:
I.Contra la sentencia Nº 9-G-2010, de las 16:35 horas del 7 de enero de 2010, dictada por el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, presentaron recurso de casación la procuradora, licenciada [Nombre6], así como el fiscal, licenciado [Nombre7]. En este proceso se realizó audiencia oral el día 21 de abril de 2010 y en vista de que no se recibió prueba, ni se ampliaron los motivos o se introdujeron puntos diversos a los esgrimidos en los escritos impugnativos y verificando que no se afecta el debido proceso ya que la Sala Constitucional, mediante reiterados pronunciamientos vinculantes, así lo ha indicado -entre otros los votos Nº 6681-96, Nº 11508-2000 y 17553-07 se procede a su resolución con una integración diversa a la que participó en dicha audiencia, pues en lugar del juez Guillermo Sojo Picado (presente en ese momento, CED2), integra la jueza Ingrid Estrada Venegas.
II.Contenido de las impugnaciones.- Recurso de casación de la licenciada [Nombre6]. Primer motivo.- Se reclama la falta de fundamentación, en quebranto de los artículos 142, 361 inciso a) y 363 inciso b) en relación con el 369 inciso d) del Código Procesal Penal. Afirma que en la sentencia se tuvo como hechos no demostrados los que integran la acusación y la querella. Que el juzgador basa la absolutoria porque el terreno donde se da la tala no media las dos hectáreas, que como medida mínima exige el artículo 3 de la Ley Forestal para ser calificado como bosque; apreciación que objeta la impugnante, quien asevera que el juzgador tergiversa la declaración de un testigo del MINAE, quien si bien mencionó que el área era de aproximadamente dos hectáreas, esa medida corresponde a lo que observó el 31 de octubre de 2007 (cuando se presenta a hacer la visita al lugar), pero era más, pues hubo una disminución del ecosistema boscoso.
Por otra parte, aún cuando el regente forestal [Nombre10] , manifestara en juicio que el área en cuestión no medía dos hectáreas, no lo hace considerando la extensión del terreno antes de que tuviera lugar la corta; en todo caso, indicó no realizar ninguna marca de árboles en el bosque. Que aún cuando esta persona al presentarse con la fiscal a realizar la medida, daba por resultado hectárea y cuarto, "no se puede concluir que con ello se desprende que al momento de laos (sic) hechos tampoco media las dos hectáreas." (Cfr. folio 265). Acusa que toda la fundamentación del tribunal para concluir que el área no media dos hectáreas es contradictoria e insuficiente, declarándose incluso sin lugar la acción civil resarcitoria. Solicita se declare la nulidad del debate y la sentencia, se ordena una nueva sustanciación. Segundo motivo.- Alega falta de fundamentación y critica que el fallo absolviera a los encartados al no demostrarse a juicio del tribunal, que se habían talado 46 árboles más y agrega: "Es importante aclarar que el CED3 es un procedimiento propio para gestionar la corta de árboles, árboles que marca el ingeniero con fe pública, de la cual no puede valerse y engañar.
En el certificado indica que marcó árboles, y luego que los cortan, el dueño o el que compró la madera, pide al MINAE las guías según el número de trozas que resultan, en este caso se marcaron 35 árboles y se pidió guías por 80 trozas. Cuando el regente hace su informe final dice que fueron cortados 24 árboles de más, y siendo que se acreditó que [Nombre10]. era un buen testigo, para todo lo demás, porqué en esto no? Entonces dice que es que no encontraron los tocones el día de la inspección con la Fiscal. Esto sería una buena base para dudar. Pero resulta que [Nombre3]. declaró que el limpió la finca de tocones y sembró, ahora hay yuca, dijo... Dice que es que el regente en su informe dice que no se cortaron árboles en las 'zonas protectoras', pero en debate no se le preguntó cuales tenía la Finca, porque si el ya había dicho que no marcó árboles en el bosque, a qué zonas protectoras se refería, a ese bosque o había otras, y si sol había ese bosque, para qué puso esa información?
Y el fallo sigue preguntando, si el MINAE 'hizo la inspección el 31 de octubre, surge entonces la pregunta, de dónde o como y cuando determinó el regente la corte de esos 24 árboles de forma irregular? Y surge una duda en cuanto a la credibilidad de ese informe y regencia.' (Cfr. folios 265 y 266, los errores de ortografía y redacción corresponden al original). Estima la impugnante que no es posible fundamentar el fallo en dudas graves, si lo que hace en realidad es fundamentar contradictoriamente. Solicita anular la sentencia y ordenar el reenvío. Tercer motivo.- Reprocha infracción a las reglas de la sana crítica cuando el tribunal de instancia cuestiona cuál fue la participación de [Nombre3]. en la corta de madera, pero como lo declararon los imputados, el asunto "... es claro, [Nombre3]. vende la madera a [Nombre1] , [Nombre1]. contrata a [Nombre10]. y [Nombre10]. le pide la firma E , que era el dueño para el IDA." (Cfr. folio 268) Análisis que omite el juzgador en quebranto de las reglas de la sana crítica racional, omitiendo incluso valorar la declaración de los encartados, que pone en evidencia que el negocio de la madera lo hace el dueño actual de la propiedad ([Nombre3]. ) y no el propietario registral (E ).
Solicita se anule la sentencia y se ordene el reenvío. Cuarto motivo.- Invoca la violación a la ley sustantiva, pues a partir de los hechos tenidos por demostrados hay un vicio en la aplicación de los artículos 58 y 61 de la Ley Forestal y explica que la sentencia no tuvo por acreditado que [Nombre3]. o [Nombre1]. realizaron un cambio en el uso del suelo cortando árboles en un bosque, porque no se demostró que la arbolera existente constituyera legalmente un bosque; sobre ese aspecto reprocha la impugnante: "No se demostró que hoy es bosque, pues lo que debía investigar era, que al momento del hecho sí era bosque, por lo que está aplicando la ley sustantiva a destiempo." (Cfr. folio 269). En razón de lo anterior, solicita se declare con lugar el motivo, se admita la acción civil resarcitoria por los daños causados. Recurso de casación del licenciado [Nombre7].- Primer motivo.- Acusa la indebida aplicación de la ley sustantiva, en quebranto de los artículos 365, 369 inciso c), 422, 423, 424, 443, 444 y 445 del Código Procesal Penal.
Objeta que el juzgador afirme en la sentencia que no se demostraron tres aspectos medulares de la relación de hechos acusados, cuando con la prueba evacuada se acreditó la tala de árboles no autorizados (24 no incluidos en el CED4 CED5); y que el imputado [Nombre3]. es el propietario del inmueble donde tuvo lugar la tala, había negociado la madera con el co encartado [Nombre1]. y es quien se benefició con el valor de la madera. Segundo motivo.- Afirma el quebranto de las reglas de la sana crítica y argumenta que con el testimonio del justiciable [Nombre3] quien refirió ser el propietario de la finca objeto de tala, tener un horno para convertir la madera en carbón, aprovechar los recursos forestales, así como barrer y limpiar la siembra de yuca; por ello no era posible (como lo estima el juzgador) encontrar tocones de los árboles talados (estuvieran o no dentro de los autorizados en el CED3), pues con la "barrida" para la siembra de yuca desaparecen todos los vestigios, evidencias, señas o tocones que demuestren la existencia de la tala.
Situación que no fue estimada por el juzgador en la sentencia, pese a que existían en autos fotografías y un informe del MINAE sobre el particular, que tampoco fue valorado por el tribunal. Tercer motivo.- Protesta por quebranto al principio de correlación entre acusación y sentencia, en ese sentido, reclama que dentro del acápite de los hechos probados del fallo, el juzgador indique que no existe ninguno de interés para la resolución del asunto, afirmación contradictoria con otras aseveraciones del tribunal, por ejemplo, cuando tiene por no acreditada la corta ilegal de madera. Acusa una fundamentación contradictoria del pronunciamiento, pues por un lado excluye toda participación del encartado [Nombre3]. en los hechos acusados, aunque por otro, se tiene por demostrados que [Nombre3]. vendió la madera a [Nombre1]. y por ende, se aprovecha del producto forestal, precisamente por ser el poseedor del inmueble.
Cuarto motivo.- Por insuficiente fundamentación, dada la ausencia de análisis de las fotografías y el informe del MINAE que refieren el estado de inmueble afectado después del barrido para la siembra de yuca. Quinto motivo.- Acusa falta de fundamentación y afirma que el tribunal da el rango de pericia a las manifestaciones realizada por el ingeniero [Nombre10] , cuando declaraba en condición de testigo, pues la pericia era el informe que éste había aportado al proceso. Agrega: "En vista de que el testigo entra en contradicción con su mismo informe oficial, evidencia una intención de beneficiar a su contratista, determinándose parcialización en su relato, mismo que se aleja del informe de regencia." (Cfr. folio 272). Sexto motivo.- Reclama la infracción de los artículos 1 y 30 del Código Penal, 1, 369 inciso i) del Código Procesal Penal, 61 incisos a) y c) de la Ley Forestal. Explica que la responsabilidad penal en el caso surge por ser el justiciable [Nombre3]. dueño del inmueble afectado y de su madera, haber ordenado la tala ilegal y el barrido de los escombros sin importarle el daño ambiental generado con tal acción e incluso, percibiendo un beneficio económico con la venta de la madera. En ninguno de los motivos concreta sus pretensiones.
III.Se declaran con lugar los recursos, pero por las siguientes razones.- Vista la conexidad en el contenido de la impugnaciones, se resuelven de forma conjunta en este acápite. Es preciso retomar el contenido de la sentencia para decidir si llevan o no razón en sus protestas los gestionantes, a partir de las imputaciones formuladas tanto del Ministerio Público como por la Procuraduría General de la República y la fundamentación probatoria fáctica e intelectiva establecida en el fallo. Se acusó a los justiciables [Nombre1]. y [Nombre3]. por haber talado en forma ilegal productos forestales en un bosque pequeño, mediante personas que eran contratadas al efecto; pues aún cuando se había otorgado un "CED3" (que permitía la tala de 35 árboles), la corta abarcó otros 46 árboles no autorizados en el referido certificado, ubicados en un área de bosque de aproximadamente dos hectáreas. Se especifica también que el citado contrato se da sobre una propiedad inscrita registralmente a nombre de [Nombre11]. pero en poder o disfrute del acusado [Nombre3] ; donde el MINAE autorizó la extracción de madera mediante un contrato de regencia modalidad "Certificado de Origen" autorizado por el regente forestal [Nombre10] .
Luego el juzgador indica que son tres los aspectos medulares (aunque en realidad menciona cuatro) necesarios de determinar: (1) La tala de los 46 árboles de más. (2) La condición de bosque del terreno donde se dio la supuesta tala ilegal. (3) La participación y responsabilidad penal de los imputados. (4) Si la tala de más, fue de especies no autorizadas. Decide empezar con el tema sobre la condición de bosque del sitio donde se dio la tala acusada e indica: "SOBRE LA CONDICION DE BOSQUE DEL SITIO DONDE SE HABRIAN TALADO LOS ARBOLES: Este juzgador arriba a la conclusión de que este aspecto definitivamente nunca fue acreditado por los actores penales y civil. El artículo 3 de la Ley Forestal define bosque como aquella área, que entre otras carácterísticas mida NO MENOS DE DOS HECTAREAS, analizando la prueba que se recibió en este respecto, se tiene que en el Informe del Minae de folios 1 a 8 se indica que dicho terreno mediría "aproximadamente 2 hectáreas", o sea que no afirma que mida las dos hectáreas exigidas por la norma para considerarse bosque; en debate el ingeniero [Nombre12]. firmante del referido informe, refirió que ese porción de terreno es un área "como de dos hectáreas", o sea que nuevamente tampoco ha afirmado que midiera la medida mínima de ley; ciertamente agregó que esa zona de la finca ha sido intervenida, suprimiendo el bosque en parte de la misma, pero en definitiva de su relato en juicio no afirmo ni demostró que midiera lo prescrito por la norma; se recibieron como prueba los planos de folios 38 al 440 hechos por el Minae donde se observa un área que correspondería al sitio donde se talaron los árboles autorizados a cortar por el Minae y también los que se indican cortados en zona de bosque, y por la coloración de dichos mapas o planos encontramos que casi la totalidad de la zona donde se dió la totalidad de la corta, con algunas pocas excepciones constituiría bosque, tanto donde se cortaron los árboles autorizados, como donde se cortaron los que se dicen no autorizados, pero de toda suerte, en lo que aquí interesa, no es posible inferir o derivar de dichos planos o mapas la medida del área afectada; según el ingeniero [Nombre10].
Regente que autorizó la corta (facultado por ley para ello) y testigo de cargo, refirió en el debate que dicha área no mide dos hectáreas y que por lo tanto no puede ser catalogada como bosque conforme para los efectos que nos ocupan, que a lo sumo mide 1.4 hectáreas, el imputado [Nombre1]. niega que midiera las dos hectáreas y refiere como al momento de hacer una inspección con la fiscal instructora, midieron y verificaron que no medía dos hectáreas; finalmente de la inspección ocular o reconocimiento de sitio que hizo la Lic. [Nombre13], que corre agregada de folios 78 al 81 se extrae como en esa oportunidad tanto el ingeniero [Nombre10]. como los imputados refirieron haber medido el área y que no cumplía con la medida de ley; pero un dato surge especialmente relevante, que aún con lo dicho por el regente y los imputados, la Lic. [Nombre14], ni el representante del Minae que también concurrió, tomaron previsión alguna en este sentido, y no midieron el terreno "suamposo" que conforma la arboleda a fin de verificar que constituyera un bosque según la definición del artículo 3 de la ley Forestal en cuanto a su medida.
Ante esta insuficiencia probatoria, más bien ausencia, no es posible tener por cierto, que los imputados hayan cortado árboles en un bosque sin contar con la debida autorización para ello, conducta prohibida por la normativa forestal (artículos 58 y 61 ). En este caso, no era suficiente con aseverar que se trataba de un bosque, tal como lo dicen la acusación del Ministerio Público y de la Procuraduría Penal, y tampoco puede presumirse de acuerdo a la experiencia o la lógica, ya que los datos que arrojan los elementos probatorios nos informan de que se trata de una porción de terreno bastante pequeño, que incluso en el informe del Minae el ingeniero [Nombre12] , indica que mide aproximadamente dos hectáreas, y el regente [Nombre10]. y los imputados dijeron haberlo medido y que su medida es de aproximadamente una hectárea y cuarto; de allí que se hacía necesario medir el área para determinar efectivamente su medida, ya que se trata de un elemento integrante de tipicidad normativa, debía acreditarse que medía al menos dos hectáreas, dato que en definitiva no se acreditó." (Cfr. folio 246 a 248).
Como se observa el juzgador decide iniciar su análisis intelectivo con la determinación o no de "bosque" del área donde se acusa se dio la tala ilegal. Y aunque no se especifica en el pronunciamiento, de donde emerge esa preocupación del juzgador por establecer la existencia de un bosque (en los términos prescritos por la Ley Forestal), podría surgir a causa de una interpretación jurisprudencial de este mismo Tribunal de Casación Penal, que por años acogió la tesis expuesta en el voto Nº682-F-97, de las 15:45 horas del 25 de agosto de 1997, que analiza el concepto de aprovechamiento de productos forestales inserto, por ejemplo, en los textos de los artículos 58 y 61 de la Ley Forestal; lo anterior debido a que el Ministerio Público atribuye a los justiciables los delitos de tala, transporte y aprovechamiento de madera, previstos y sancionados en el artículo 61 inciso a) y c) de la Ley Forestal (Cfr. 89 a 91); y porque la Procuraduría General de la República imputaba la tala ilegal, aserrío y aprovechamiento ilegal de madera en área de bosque, conforme lo establece los artículos 57, 58 inciso a) y 61 inciso a) de la Ley Forestal (Cfr. folio 198 a 200).
En el voto Nº682-F-97, se transcriben los artículos 61 y 3 inciso a), luego se indica: "De la relación de ambos artículos se ha concluido por la jurisprudencia que la simple acción de cortar un árbol maderable, independientemente de si forma parte de un bosque o plantación forestal es constitutiva del delito contemplado en el Art. 61 inciso a), arriba mencionado (véase el voto 524-F-97 de este Tribunal (hay un voto salvado). Sin embargo, los jueces integrantes del Tribunal Superior de Casación Penal designados para el conocimiento de este asunto, consideramos que debe variarse la jurisprudencia indicada. Es de gran importancia el texto del tipo penal contemplado en el Art. 61 inciso a), en el que se hace mención al aprovechamiento "... de uno o varios productos forestales..." En lo relativo a la interpretación de las leyes se ha señalado la existencia de diversos métodos, todos lo cuales por supuesto encuentran como límite el principio de legalidad, previsto por el Art. 1 del Código Penal y el 39 de la Constitución Política, que es uno de los principios fundamentales de un Estado de Derecho, sobre lo que existe consenso (véase por ejemplo: Sala Constitucional, voto 461-91).
Importante es que se ha tendido por la jurisprudencia a conceptualizar "forestal" como "relativo a los árboles", lo que no es correcto. En efecto si se busca el término forestal en el diccionario se verá que quiere decir "relativo a los bosques y a sus aprovechamientos" (Vox Diccionario General Ilustrado de la Lengua Española. Barcelona, 1995, p. 517. Véase también: Larousse. Diccionario Usual, México, 1985, p. 266). Nótese incluso que el término forestal viene de la palabra del latín "foresta", sea bosque. Es cierto que el Diccionario de la Real Academia al definir "forestal" indica que por dicho término se entiende lo "relativo a los bosques y a los aprovechamientos de leñas, pastos, etc." Diccionario de la Lengua Española. Real Academia Española, Madrid, vigésimo primera edición, 1992, p. 984). Sin embargo, el término "bosque" debe estimarse como el fundamental y lo concerniente a los "aprovechamientos de leñas, pastos, etc.", hace mención al aprovechamiento del bosque, tal y como se hace referencia en otros diccionarios.
Debe anotarse que el tipo penal objetivo de un delito se compone de elementos descriptivos y por vía de excepción de elementos normativos. Se ha estimado que una consecuencia del principio de legalidad es que deben evitarse estos últimos elementos, debido a la inseguridad jurídica que introducen, como consecuencia del ámbito valorativo que le conceden al juzgador. Por ello mismo debe partirse al momento de interpretación de un elemento del tipo penal de que éste es de carácter descriptivo, salvo que hayan razones suficientes para estimar que no es de este carácter, sino que es normativo. En el caso concreto no hay elementos que indiquen que el término forestal, deba ser entendido en sentido diverso al indicado arriba, sea como un elemento descriptivo. Lo anterior sin perjuicio de que en forma indirecta el término adquiere caracteres normativos, en la medida en que la ley forestal precisa conceptos como el de "bosque" y de "plantación forestal" (Art. 3 de la ley).
De relevancia para sostener lo anterior en cuanto al término forestal es que el fin de la ley forestal es en definitiva la protección y administración de los bosques y el aprovechamiento de los recursos forestales. Esto queda claro en el artículo 1 de la ley forestal, el que precisa los objetivos de dicha ley, aspecto que tiene una importancia capital en la interpretación de las diversas normas de la misma. Así se dispone: "Objetivos. La presente ley establece como función esencial y prioritaria del Estado velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables...". Por su parte el artículo 3 de la ley da una serie de definiciones, por ejemplo la de aprovechamiento maderable, terrenos de aptitud forestal, ecosistema boscoso, bosque, plan de manejo forestal, plantación forestal, régimen forestal, sistema agroforestal, área silvestre protegida, centro de industrialización primaria y servicios ambientales.
Importante es que todas ellas se refieren en definitiva al "régimen forestal", destacándose en ellas los términos "bosque" y "plantación forestal". Debe hacerse referencia a la mención que se ha hecho en ocasiones del Art. 3 inciso a) de la Ley Forestal, para justificar que se sanciona en el Art. 63 inciso a) la corta de árboles en terrenos no forestales. Lo anterior en cuanto a la referencia que se hace en dicho artículo a la corta de árboles no incluida en el Art. 1. Así se ha expresado que por ello dicha corta está desvinculada de los objetivos de la ley fijados en el Art. 1, mencionados arriba. Esta interpretación debe ser rechazada, en primer lugar ya que el Art. 1, como se dijo, es fundamental para la interpretación de toda la ley en cuanto menciona los objetivos de la misma. Pero la razón fundamental es que la referencia que se hace en el Art. 3 inciso a) al Art. 1, no es en lo relativo al párrafo primero del mismo, que fue transcrito en lo que interesa arriba, sino propiamente en lo concerniente al párrafo 2) del mismo artículo, que hace mención, al igual que el Art. 3 inciso a) a la corta de árboles, ello al decir: "En virtud del interés público y salvo lo estipulado en el artículo 18 de esta ley, se prohíbe la corta o el aprovechamiento de los bosques en parques nacionales, reservas biológica, manglares, zonas protectoras, refugios de vida silvestre y reservas forestales propiedad del Estado".
De relevancia en lo relativo a la utilización del concepto de "forestal" como concerniente a los bosques, a la que se hizo referencia antes, es que en la ley forestal el único artículo que se refiere a la prohibición de cortar árboles en propiedad privada que no sea bosques o plantaciones es el 27. En este se dispone: "Sólo se podrá llevar a cabo la corta de árboles en terrenos de uso agropecuario y sin bosque, obteniendo previamente la autorización del Consejo Regional Ambiental o de la municipalidad respectiva y hasta por un máximo de cinco árboles por hectárea por año. Para una corta que sobrepase los veinte árboles por inmueble se requerirá la autorización de la Administración Forestal del Estado". Ello lleva a que conforme a una interpretación a contrario sensu, en terrenos sin bosque y que no sean de uso agropecuario no hay ninguna prohibición en la ley para la corta de árboles. Esto trató de ser corregido por la vía reglamentaria.
Así el Reglamento a la Ley Forestal, publicado en la Gaceta del 23 de enero de 1997, que define qué se entiende por terrenos de uso agropecuario sin bosque, indicando que estos son "aquellas fincas privadas con la presencia de árboles no establecidos bajo un sistema agroforestal o fincas que tienen áreas con cobertura boscosa menores a dos hectáreas, o aquellos árboles ubicados en áreas urbanas" (Art. 2). Sin embargo, la no aplicación al presente caso concreto del Reglamento en lo relativo a dicha definición es clara. Ello en primer lugar debido a que el hecho que se juzga fue cometido a principios de noviembre de 1995, resultando que incluso el Reglamento fue publicado el 23 de enero de 1997, de modo que si se tratara de aplicar el mismo se estaría ante un supuesto prohibido de aplicación retroactiva. A lo anterior se agrega que el Reglamento al definir que se entiende por "terrenos de uso agropecuario", se excede, olvidándose el carácter meramente ejecutivo de la ley que tiene, por cuanto se trata de ubicar en el término "agropecuario" todo lo que no es forestal, lo que no concuerda con el sentido de la palabra "agropecuario" (sea que tiene relación con la agricultura y ganadería), llegándose incluso al absurdo de calificar de "agropecuario" lo urbano.
De todas maneras incluso es discutible qué sanción tiene la infracción al Art. 27 de la Ley Forestal, sea en lo relativo a la tala de árboles en terrenos de uso agropecuario, puesto que no se establece en la ley sanción alguna y es sumamente cuestionable que en virtud de ello pueda interpretarse que en tal caso, sería de aplicación el Art. 61 inciso a) de la Ley Forestal, en cuanto se refiere al aprovechamiento de productos forestales. Una interpretación en tal sentido no sería en realidad concordante con el principio de legalidad, puesto que en ninguna parte de la ley se indica que por productos forestales, se entienda también los productos arbóreos provenientes de un terreno que no es bosque, sino de un terreno de uso agropecuario. Si se intentara una interpretación que comprendiera dentro del Art. 61 inciso a) de la Ley Forestal la corta de árboles en terrenos de uso agropecuario tendría que partirse de la denominación del Título Tercero de la Ley Forestal, sea "Propiedad Forestal Privada", dentro del cual está ubicado el Art. 27 de la Ley Forestal.
Pero una interpretación que por esa vía tratara de ampliar el tipo penal del Art. 61 inciso a) de dicha ley, no sería concordante con el principio de legalidad, el que exige la claridad en la descripción de la conducta prohibida, claridad que no existiría con la interpretación indicada. Importante es el requerimiento de tratar de interpretar las normas conforme a la Constitución Política, de la que habla la doctrina constitucionalista, lo que exige que no sea posible que a través de interpretaciones sistemáticas extensivas del tipo penal respectivo, se llegue a considerar como típica una conducta que no aparece claramente descrita dentro del tipo penal, y es que un concepto es el de "forestal" y otro totalmente diverso es el de "agropecuario", no siendo clara una interpretación que dijera que lo agropecuario es forestal. De todas maneras en el caso concreto ni siquiera podría hablarse de la existencia de una corta de un árbol en "terrenos de uso agropecuario", puesto que la corta de los dos árboles se dio en un terreno para construcción (véase folio 35 fte líneas 27-29).
A pesar de ser reiterativo debe recalcarse que si se sostuviera que la corta de árboles prevista en el Art. 27 de la Ley Forestal encuentra su sanción en el Art. 63 inciso a) de la Ley Forestal, la extensión del término agropecuario prevista en el Reglamento de la Ley Forestal además de contrariar el carácter ejecutivo del reglamento con respecto a la ley, violentaría el mismo principio de legalidad (Art. 39 de la Constitución Política). Este principio exige que el supuesto de hecho calificado como delictivo sea previsto en un ley ordinaria, no pudiéndose hacer ello en un simple reglamento, todo lo cual encuentra su fundamento en la doctrina de la Ilustración que dio origen a la llamada división de poderes (Art. 9 de la Constitución Política). Por vía de excepción la Sala Constitucional ha admitido la constitucionalidad de leyes penales en blanco, sea de leyes que en lo relativo a la precisión de uno de los elementos del tipo delictivo remite a una norma de menor rango.
Importante al respecto es que Sala Constitucional ha dicho que "resulta posible completar una norma penal por medio de un reglamento, siempre que al hacerlo el Poder Ejecutivo se mantenga dentro de su espera propia de competencia y que la ley que remite establezca con suficiente claridad los presupuestos de la punibilidad, así como la clase y extensión de la pena..." (Sala Constitucional, voto 1876-90). Sin embargo, es claro que con la definición de "terrenos de uso agropecuario sin bosque" el Reglamento de la Ley Forestal extendería el ámbito de la conducta típica prevista en la Ley Forestal y con ello de la competencia del Poder Ejecutivo. Lo mismo puede decirse de cualquier intento de utilizar la palabra "árbol" como sinónimo de "forestal", como al parecer pretende el Reglamento de la Ley Forestal al usar el término "árbol forestal" (Art. 2). Además de la interpretación a contrario sensu del Art. 27 de la Ley Forestal, hecha antes, tiene gran relevancia en este asunto la interpretación del Art. 63 inciso a) en relación con el Art. 56 de la Ley Forestal.
El primero de dichos artículos sanciona como delictivo la infracción del Art. 56 mencionado. Este artículo por su parte indica que "No se podrá movilizar madera en trozas, encuadrada ni aserrada proveniente de bosque ni de plantación, si no se cuenta con la documentación respectiva". De importancia es que, como ya lo ha dicho la jurisprudencia del Tribunal Superior de Casación Penal, se sanciona sólo el transporte no autorizado de madera "proveniente de bosque o plantación", pero no el transporte de madera proveniente de terrenos que no sean bosque o plantación, lo que es un argumento de relevancia para estimar que el Art. 61 inciso a) sólo sanciona el aprovechamiento (y dentro de éste la corta) de árboles provenientes de bosques o plantaciones. Nótese que el legislador trató de extender "las tenazas" del Derecho Penal a diversas conductas que forman parte de lo que podríamos llamar el "ciclo de la deforestación", parafraseando la terminología que se ha utilizado con respecto a otros tipos de delitos, de modo que se trata de sancionar no sólo las conductas relacionadas con la corta de árboles no autorizada en terrenos forestales, sino también el transporte no autorizado de la madera de árboles de dicho terreno.
Por ello no habría razón alguna para sancionar el transporte solamente cuando la madera proviene de bosques o plantaciones, pero en lo relativo a la corta de árboles sancionar la realizada aun en terrenos que no reúnan esas características..." En consecuencia, a partir de ese voto se establece: "Ello lleva a que conforme a una interpretación a contrario sensu, en terrenos sin bosque y que no sean de uso agropecuario no hay ninguna prohibición en la ley para la corta de árboles." (La negrita no corresponde al original).
IV.Esta Cámara no comparte ese análisis que asimila la expresión producto o recursos forestales con bosque, o proveniente de bosque, por las siguientes razones. Primero.- La Ley Forestal prevé delitos tanto por aprovechamientos en terrenos estatales como privados. Dentro del articulado de la Ley Forestal existen dos normas que tipifican delitos de aprovechamiento de productos forestales (que por cierto, incluye otras conductas además de la tala, como se explicará infra). El primero es el artículo 58 y comprende conductas de aprovechamiento en propiedades estatales o en áreas de protección (públicas o privadas). El segundo es el artículo 61que tipifica acciones de aprovechamiento realizadas en propiedad privada. Una lectura de la Ley Forestal permite advertir diversos escenarios en cuanto a la tala o corta de árboles, con prohibiciones expresas o permisos, cuyo irrespeto puede llevar a la comisión de los delitos ahí sancionados, aún cuando se trate de terrenos privados.
Como indica [Nombre15]: "El concepto propiedad privada implica el usufructo y, por tanto, el derecho del propietario de aprovechar todos los bienes accesorios, como los árboles que se encuentren en su propiedad. Sin embargo, por la importancia que tienen el recurso forestal y los ecosistemas asociados (como el recurso hídrico), para el ambiente en general, se han impuestos ciertas limitaciones al disfrute del producto forestal por razones de interés público. De esta manera, la ley obliga al propietario privado y legítimo dueño de la madera a solicitar permiso a la Administración Forestal del Estado (AFE) para el aprovechamiento y transporte de la madera. Con la tipicidad del inciso c) del artículo 58 de la LF, sobre el irrespeto a las vedas forestales declaradas, se protegen también los recursos forestales, pero específicamente a las especies en vías de extinción o con poblaciones reducidas, por el hecho de que el valor comercial de estas especies aumenta cada día, al igual que su demanda, de forma que el legislador quiso darles una protección especial, con el fin de evitar que desaparezcan." (GONZÁLEZ [Nombre16], [Nombre17], Manual de Delitos Ambientales, 1a. edición, Litografía e Imprenta LIL, S.A., San José, 2007, p.253).
Y es que aunque la corta en bosques se anuncia en el artículo 1 con una prohibición total, también se establecen salvedades, que en todo caso, de realizar al margen de los permisos o supuestos autorizados por ley, pueden constituir una infracción de las previstas por la ley. Por ejemplo: (1) En el artículo 1 se prohíbe la tala o corta en bosques, pero se permite para realizar labores de investigación, capacitación y ecoturismo, previa aprobación del Ministerio del Ambiente y Energía (artículo 1 en relación con el 18). (2) En el artículo 19 hay una segunda excepción, al disponer que la Administración Forestal del Estado podrá: "a) Construir casas de habitación, oficinas, establos, corrales, viveros, caminos, puentes e instalaciones destinadas a la recreación, el ecoturismo y otras mejoras análogas en terrenos y fincas de dominio privado donde se localicen los bosques. b) Llevar a cabo proyectos de infraestructura, estatales o privados, de conveniencia nacional. c) Cortar los árboles por razones de seguridad humana o de interés científico. d) Prevenir incendios forestales, desastres naturales u otras causas análogas o sus consecuencias.
En estos casos, la corta del bosque será limitada, proporcional y razonable para los fines antes expuestos. Previamente, deberá llenarse un cuestionario de preselección ante la Administración Forestal del Estado para determinar la posibilidad de exigir una evaluación del impacto ambiental, según lo establezca el reglamento de esta ley." Más adelanteCED6) en el artículo 34 se prohíbe la corta o eliminación de árboles en las áreas de protección (públicas o privadas) descritas en el artículo 33, excepto que se trate de proyectos declarados por el Poder Ejecutivo como de conveniencia nacional. Esas áreas de protección son: "a) Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal. b) Una franja de quince metros en zona rural y de diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, quebradas o arroyos, si el terreno es plano, y de cincuenta metros horizontales, si el terreno es quebrado. c) Una zona de cincuenta metros medida horizontalmente en las riberas de los lagos y embalses naturales y en los lagos o embalses artificiales construidos por el Estado y sus instituciones.
Se exceptúan los lagos y embalses artificiales privados. d) Las áreas de recarga y los acuíferos de los manantiales, cuyos límites serán determinadospor los órganos competentes establecidos en el reglamento de esta ley." (4) Si la corta es en terrenos de uso agropecuario y sin bosque, se pueden cortar hasta un máximo de tres árboles por hectárea anualmente, previa autorización del Consejo Regional Ambiental. Si se sobrepasan los diez árboles por inmueble, se requiere la autorización de la Administración Forestal del Estado (artículo 27). Finalmente, (5) si la corta es en plantaciones forestales, sistemas agroforestales o árboles plantados individualmente, no se requiere permiso de corta, transporte, industrialización o exportación (artículo 28). Sin embargo, para "sacar de la finca hacia cualquier parte del territorio nacional, madera en trozas escuadrada o aserrada, proveniente de plantaciones forestales, se requerirá un CED3 expedido por el regente forestal o el Consejo Regional Ambiental de la zona..." (artículo 31).
En consecuencia, si se corta o tala sin el permiso correspondiente o excediendo o variando lo autorizado, es que se configura alguno de los tipos penales previstos en la Ley Forestal, por ejemplo, en el artículo 61 que establece: "Se impondrá prisión de un mes a tres años a quien: a) Aproveche uno o varios productos forestales en propiedad privada, sin el permiso de la Administración Forestal del Estado, o a quien, aunque cuente con el permiso, no se ajuste a lo autorizado. b) Adquiera o procese productos forestales sin cumplir con los requisitos establecidos en esta ley. c) Realice actividades que impliquen cambio en el uso de la tierra, en contra de lo estipulado en el artículo 19 de esta ley. En los casos anteriores, los productos serán decomisados y puestos a la orden de la autoridad judicial competente. d) Sustraiga productos forestales de una propiedad privada o del Estado o transporte productos forestales obtenidos en la misma forma." Por ende y con todo respeto, no estimamos acertada la afirmación realizada en el voto Nº682-F-1997, cuando se asevera que la infracción al artículo 27 de la Ley Forestal no encuentre sanción acudiendo al artículo 61 inciso a), pues precisamente, conforme con el principio de legalidad hay que concluir que ese es el tipo previsto para su reproche; es decir para cortas realizadas dentro de terrenos privados sin autorización o excediendo la otorgada.
Segundo.- El artículo 61 de la Ley Forestal no incluye el elemento "bosque" o plantación forestal como parte del tipo objetivo. El tipo penal previsto y sancionado en el artículo 61 de la Ley Forestal antes trascrito, no hace mención alguna a bosques o plantaciones forestales, como parte de la descripción del tipo objetivo. Tercero.- Conforme lo establece la Ley Forestal, no solo los bosques contienen recursos o productos forestales. La Ley Forestal tiene la peculiaridad de incluir un artículo de conceptos, el número 3; dentro del cual se definen varias expresiones: aprovechamiento maderable, terrenos de aptitud forestal, bosque, plan de manejo forestal, etc., pero ciertamente no presenta una interpretación auténtica específica de "recursos forestales", lo que implica, recurrir a la interpretación literal, histórica y/o sistemática, que en nuestro criterio, no conduce a las conclusiones del fallo Nº682-F-97.
Pese a ello, el artículo 3 resulta de utilidad, pues en el inciso a) define la expresión "aprovechamiento" que forma parte del tipo objetivo previsto en el artículo 61 íbidem. Lo conceptúa como la acción de cortar, eliminación de árboles maderables en pie o la utilización de los caídos. ¿Pero que hay de la expresión productos o recursos forestales (también utilizada por el legislador dentro de la descripción típica del artículo 61, también del 58 de la Ley Forestal) ? La interpretación que ha mantenido esta Cámara por años, la asocia a la existencia de un bosque o plantación, supuestamente a partir de lo establecido en el artículo 1 de la Ley Forestal, que dispone: "La presente ley establece, como función esencial y prioritaria del Estado, velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables." (La negrita no corresponde al original) Nótese que: (a) la ley trata de forma distinta y separada los términos "bosque" y "recursos forestales"; es decir, no supedita la existencia o denominación "recursos forestales" a un bosque; pero además, (b) la producción, aprovechamiento, industrialización o fomento de los recursos forestales aunque físicamente no ocupen el mismo espacio de los bosques, sin duda contribuyen a la conservación, protección y administración de los bosques naturales, precisamente, "de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables" establecido también en el citado artículo 1 de la Ley Forestal.
Adicional a ello, (c) no tiene sentido hacer referencia a los "recursos forestales" si es una realidad implícita en la expresión "bosque", estaría de sobra, sin embargo, en el artículo 1 se incluyen ambas expresiones. Finalmente, (d) si a partir del objetivo dispuesto en el artículo 1, sólo fuera sancionable la tala en bosques, no tendría ningún sentido que los tipos penales hicieran referencia expresa a terrenos privados, pero sí la hacen. Es por todo lo anterior, que esta integración estima que la interpretación correcta de los tipos en discusión (artículo 58 y 61). (1) Debe relacionarse con el artículo 3 inciso a) que define "aprovechamiento": "Acción de corta, eliminación de árboles maderables en pie o utilización de árboles caídos, realizada en terrenos privados, no incluida en el artículo 1 de esta ley, que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa." La expresión "no incluida en el artículo 1..." es de utilidad para destacar la prohibición del aprovechamiento en áreas silvestres protegidas estatales.
(2) Y en cuanto a la interpretación de las expresiones recurso o producto forestal, consideramos que dentro de la ley, el adjetivo "forestal" tiene carácter normativo, así se desprende de las múltiples referencia a expresiones como "regente forestal", "plan de manejo forestal", "régimen forestal", "plantación forestal", "Administración Forestal del Estado", "Fondo Forestal", etc.. Desde esa perspectiva, sería perfectamente factible asociarlo a "árboles" independientemente de que formen parte de un bosque o plantación. Pero incluso, acudiendo a un carácter puramente descriptivo , lo cierto es que el Diccionario de la Real Academia de la Lengua Española indica que lo "forestal" es aquello: "Relativo a los bosques y a los aprovechamientos de leñas, pastos, etc." Es decir, desde el punto de vista semántico, el significado de lo "forestal" no se limita o circunscribe a lo relacionado con el bosque, incluye "...la tala de árboles de esa naturaleza aunque no formen parte de una superficie boscosa y además la utilización de árboles caídos, todo como medio para preservar los ecosistemas naturales.
" (Cfr. voto Nº 524-F-1997, de las 9:00 horas del 27 de junio de 1997). Refuerza ese argumento que el concepto "producto forestal" (uno de los elementos objetivos presente en el artículo 61) es citado en el artículo 2 del Reglamento a la Ley Forestal, publicado en La Gaceta Nº 16, del 23 de enero de 1997, en los siguientes términos: "Producto forestal: Es toda troza, madera en bloc, enchapados, aglomerados, fósforos, pulpa, paletas, pallillos, astillas, muebles, puertas, marcos de ventana y molduras." Como se aprecia, más que un concepto es un listado factible de bienes, objetos o productos obtenibles a partir de los árboles, que no suelen estar en bosques o plantaciones. Siendo loable y absolutamente lícito acudir al reglamento, pues la enumeración que presenta no afecta el núcleo central de imputación establecido en el precepto y no excede tampoco el fin u objetivo previsto en la Ley Forestal, pues en el precepto se ha establecido con claridad el presupuesto de punibilidad, así como la clase y extensión de sanción (conforme lo establece el voto Nº1876-1990 de la Sala Constitucional).
En realidad la cita que se hace en el Reglamento resulta un ejercicio de ejemplificación de supuestos calificables como "productos forestales" que de ninguna forma amplían o resultan contradictorios con la interpretación que se sigue en este voto. Es más, aún cuando no existiera esa referencia en el reglamento, igual se podría concluir sin dificultad que la madera en bloc, la pulpa, las astillas, etc., son productos forestales. En suma, se deberá concluir que tanto producto como recurso forestal son expresiones que indiscutiblemente aluden a árboles, con independencia de su madurez, aprovechamiento, valor comercial, o de su ubicación, dentro o fuera de un bosque o plantación forestal; y en ese sentido deberán analizarse los tipos penales en discusión. Ahora al valorar la fundamentación del fallo impugnado, el juzgador parte de un análisis errado, pues supedita la comprobación del hecho imputado, a la verificación de una corta de árboles dentro de un bosque (en los términos previstos en el artículo 3 de la Ley Forestal); sin embargo, en el caso específico ese no resulta un factor medular, ni puede condicionar tampoco la acreditación del hecho delictivo reprochado; circunstancia que a criterio de este Cámara vicia en su totalidad el pronunciamiento y hace imprescindible una nueva sustanciación conforme a derecho.
Es un error estimar que el objetivo de la Ley Forestal se limita a la tutela o protección de los bosques, eso no se deriva del artículo 1 Íbidem y se hace más evidente cuando se analiza el contenido integral de esa normativa. No sobra señalar que sólo por el hecho de haber acogido el reclamo aquí formulado que llevó a la nulidad de la sentencia, el Tribunal de Casación no esta prejuzgando sobre el fondo del asunto, en ese sentido, lo resuelto por esta Cámara no debe influir sobre el ánimo del tribunal que deberá integrarse para el juicio de reenvío, sino que ellos deberán apreciar en forma original e independiente la convicción que dimane de las pruebas, así como logicidad y contundencia de las razones invocadas por las partes en el contradictorio, para decidir con imparcialidad lo que corresponda. Conforme a lo expuesto, por carecer de interés, se omite pronunciamiento respecto a los otros puntos de impugnación.
POR TANTO
Se declaran con lugar los recursos de casación formulados por la licenciada [Nombre6] en representación de la Procuraduría General de la República, y por el licenciado [Nombre7], en representación del Ministerio Público. Se anula la sentencia, así como el debate. Se ordena el reenvío para una nueva sustanciación conforme a derecho. NOTIFÍQUESE.
