1. The petitioner instituted these possessory information proceedings, valued at twenty million colones, seeking an order to register with the Public Property Registry the real property described as follows: “Mountain and pasture land located in Quebrada Gallardo, [Dirección1], Canton [Dirección2] Golfito, Province of Puntarenas. It measures fifty-eight hectares, three thousand four hundred sixteen square meters and ninety square decimeters and is bounded to the North by Río Tigre, to the South by [Nombre2], to the East by [Dirección3], with frontage of one thousand four hundred thirty-six meters, and to the West by [Nombre3].”, (folios 8 to 11).- 2. The Procuraduría General de la República and the Instituto de Desarrollo Agrario were deemed to have entered appearances in the proceedings, under the terms set forth at folios 34 to 35 and 36, respectively.-

  1. 3Attorney Marisel Zamora Arias, the trial judge, ruled by judgment issued at two-oh-five p.m. on May 7, 2009: “THEREFORE (POR TANTO): The possessory information proceedings are approved, without prejudice to third parties having superior rights, and the Registrar of the Property Registry is ordered to register, for the first time, in the name of [Nombre1], of legal age, married once, farmer, resident of [Dirección4], Puerto Jiménez, Puntarenas, identity card CED6 - , the property described in the plan registered with the Catastro Nacional under number P-117156-1993, which is described as follows: Mountain and pasture land located in Quebrada Gallardo, [Dirección5]: Seventh Canton: Golfito, Province of Puntarenas, which, according to the attached cadastral plan No P-117156-1993, has a total area of fifty-eight hectares, three thousand four hundred sixteen (sic) square meters and ninety square decimeters, whose current and true boundaries are: North: Río Tigre; South: [Nombre4]; East: [Dirección6], with linear frontage thereon of one thousand four hundred thirty-six linear meters; West: [Nombre3].The real property that is the subject of these proceedings is valued at twenty million colones. RESERVATIONS AND RESTRICTIONS: In addition to those described in Articles 16, 17, and 19 of the Ley de Informaciones Posesorias and the provisions of Ley de Aguas Nº 276 of August 27, 1942. The property whose registration arises (sic) from these proceedings is subject to preserving the area adjacent to [Dirección7], as provided in Article 33(b); it is also subject to preserving the existing mountain area in accordance with Ley Forestal Nº 7575, taking into account that such areas constitute protected areas (áreas de protección) and that the cutting or removal of trees is prohibited,” (folios 104 to 108).-
  2. 4Attorney Susana Fallas Cubero, in her capacity as Deputy Attorney General, filed an appeal expressly stating the reasons for challenging the trial court’s position, (folios 117 to 124).-

5. The statutory requirements were observed in the conduct of the proceedings, and the judgment contains no errors or omissions capable of rendering it null and void.

Drafted by Judge Ulate Chacón; and,

CONSIDERING:

I. The Court adopts the statement of proven facts because it is well supported by the record

II.The court below approved these proceedings upon finding that the requirements imposed by the Ley de Informaciones Posesorias for obtaining title had been satisfied.

III.The Deputy Attorney General appealed. She argues that, according to the land-use study (estudio de uso del suelo), 71% of the real property is eroded, 60% consists of steep terrain, and 11% is sharply undulating, which entails one of the most significant causes of degradation: the loss of vegetation cover, as occurs through deforestation and intensive agriculture. She contends that deforestation in parts of the watersheds has caused erosion, as evidenced by the provisions of the Convenio Regional para el Manejo y Conservación de Econosistemas Forestales y Desarrollo de Plantaciones Forestales (approved by Ley 7572 of February 1, 1996). She therefore considers that protection of the natural resource, a requirement under Article 7 of the Ley de Informaciones Posesorias, cannot be deemed proven.

IV.Furthermore, with respect to the ground of appeal raised by the Procuraduría, it is important to clarify that, in this case, the legislature established a series of heightened requirements for obtaining title through possessory information proceedings, precisely to prevent harm to the Patrimonio Forestal del Estado and protected areas, as well as to their biodiversity. Accordingly, Article 7 of the Ley de Informaciones Posesorias requires proof not only of ten years’ possession prior to the creation of the respective protected area, but also that the forest has been conserved. The ten years preceding its creation are required precisely to protect private parties who had perfected their possessory rights (derecho de posesión) ten years before the area was created—that is, before the property became subject to the public domain (dominio público) (See, among others, Tribunal Agrario, No.124 at 11:30 a.m. on March 14, 2003). Article 11 of the Ley de Informaciones Posesorias is mandatory in stating that the judge: “Shall dismiss the proceeding upon determining that it improperly seeks title to unappropriated national lands (baldíos nacionales) or lands belonging to any State institution, as well as forest reserves, national parks, or biological reserves.”

V.Possessory Information Proceedings are non-contentious judicial proceedings (actividad judicial no contenciosa) for formalizing a registrable title to a property right acquired through adverse possession (usucapión), subject to compliance with the applicable statutory requirements. The petitioner seeking title must prove possession as owner, exercised quietly, publicly, peacefully, and continuously (Articles 1 of the Ley de Informaciones Posesorias and 856 of the Código Civil). In addition to lacking a title registered or eligible for registration with the Public Registry, the petitioner must expressly declare that the property has not previously been registered with the Public Registry. For reasons of public interest, and to prevent duplicate registration of the same property or to protect third parties having rights superior to those of the petitioner, the Law requires notice to certain parties.

It also established an objection procedure (trámite de oposición) within the Possessory Information Proceedings if any interested party believes that the titling would be prejudicial (Article 8). The Ley de Informaciones Posesorias directs the Judge to recognize the adjoining landowners (colindantes) as parties and therefore to serve them personally from the outset of the proceedings, because the titling could encompass part of the lands belonging to them. Notice must also be given to co-owners or condominium owners (condueños o condóminos). Likewise, to safeguard the interests of the State, the Procuraduría General de la República and the Instituto de Desarrollo Agrario must be recognized as parties to protect property subject to the public domain and State Agrarian Property (Propiedad Agraria estatal) (Article 5). Finally, the Law requires that all persons who may have a legitimate interest in the proceedings be summoned through publication of an Edict (Edicto) in the Boletín Judicial. (See Section 5 of the Ley de Informaciones Posesorias).-

VI.Article 7 of the Ley de Informaciones Posesorias, as well as the Ley Forestal, have long sought to protect forest resources from human activity by subjecting them to various forms of forest management (manejo forestal). Although titling of such areas has been permitted, once declared conservation areas they become part of the Patrimonio Forestal del Estado, and compliance with additional, more stringent requirements is demanded. This leads directly to the concept of ecological possession (posesión ecológica) and the principle of the ecological function of forest property (función ecológica de la propiedad forestal). It is precisely in these cases that the Ley Forestal establishes a comprehensive legal framework for protecting forest resources, sometimes mandatorily subjecting the owner to the forest regime (régimen forestal) and, in other cases, doing so voluntarily. Thus, in forest possession (posesión forestal), de facto control is exercised over property suited for forestry or intended mainly to protect forest resources, without any intention of exploiting them, or else it is devoted solely to the extraction of timber species through management plans (planes de manejo) intended to achieve natural forest regeneration.

In neither case would there be development of a plant or animal biological cycle, nor would any risk be assumed by humans. For that reason, the law does not protect—and instead penalizes—possession through which the forest resources of protected areas are destroyed. It also precludes the acquisition of possessory rights over lands within national reserves when harmful action against forest resources has occurred.

VII.Special legislation protecting forest property and possession has developed in three stages in our country. The first stage of forest property began with Ley No. 4465 of November 35, 1969. The second stage began with a better-conceived statutory framework under Ley No. 7032 of April 7, 1986, which was subsequently declared unconstitutional. The final stage began with the enactment of Ley Forestal No. 7174 of June 28, 1990, recently amended by Ley No. 7575 of February 13, 1996 (published in Supplement 21 of La Gaceta No. 72 on Tuesday, April 16, 1996). These laws contain various forest property regimes and limit private parties’ use and exploitation of resources. Ownership of lands with forest cover (cobertura boscosa) cannot be acquired unless protection of the forest resource is proven. Its constitutional basis is found in the second paragraph of Article 45 of the Constitution. The legal institution of forest property and possession is protected through restrictions in the social interest. It is not the same as civil or agrarian property; it is property intended for conservation, and therefore any acts of possession (actos posesorios) performed upon it must serve that purpose.-

VIII.Forest possession (posesión forestal) has been governed by the legal regime established in the aforementioned Leyes Forestales. It applies to a specific asset: land covered by forests or suited for forestry. The owner or possessor of such property has an obligation to conserve forest resources and may exploit them economically only subject to the restrictions or limitations imposed by law. That special legal regime and the principles of Forestry Law must be applied to the legal resolution of disputes arising from the exercise of forest possession. The Ley Forestal establishes, as an essential function and priority of the State, the duty to safeguard the protection, conservation, utilization, industrialization, administration, and promotion of the country’s forest resources, in accordance with the principle of rational use of renewable natural resources. (Article 1). All land suited for forestry and all forests in the country, whether State-owned or held in private ownership, are subject to the purposes of the law.

The forestry regime (régimen forestal) is the body of provisions—including legal, economic, and technical provisions—established by the law, its regulations, and other rules governing the conservation, renewal, utilization, and development of the country’s forests and land suited for forestry. Therefore, acquiring forest property through acquisitive prescription (usucapión) requires the exercise of forest possession. Article 7 of the Ley de Informaciones posesorias, as amended by the Ley Forestal, provided, before its amendment: “Article 7.- When the property to which the possessory information proceeding (información posesoria) refers lies within an area declared a national park, biological reserve, forest reserve, or protected zone, the applicant for title must demonstrate that the ten-year possession (posesión decenal) was exercised at least ten years before the effective date of the respective law or decree by which the relevant wilderness area was created.

Properties located outside those areas that contain forests may be titled only if the petitioner demonstrates possession of them for ten years or more and protection of that natural resource, it being understood that the property must be duly demarcated with fences or cleared boundary lines.” (italics ours). In other words, actual control under forest possession applies to the natural resource consisting of “forests” or “land suited for forestry,” and the possessory acts (actos posesorios) must be directed toward its protection and conservation. Only if this is demonstrated may the land be acquired or registered in favor of those possessors. Otherwise, it would become part of the natural patrimony of the State (patrimonio natural del Estado) (Article 13 of the new Ley Forestal), would be exempt from attachment and inalienable, and its possession would create no rights in favor of private parties (Article 14 of the new Ley Forestal).-

IX.Ley Forestal No. 7575 also maintained the restrictions in the Ley de Informaciones Posesorias governing the titling of land located within protected areas. In this regard, the current article provides: “Article 7.- When the property to which the possessory information proceeding refers lies within a protected wilderness area, regardless of its management category, the applicant for title must demonstrate that he or she holds the legal rights to ten-year possession, exercised at least ten years before the effective date of the law or decree by which that wilderness area was created. Properties located outside those areas that contain forests may be titled only if the petitioner demonstrates that he or she holds the legal rights to ten-year possession, exercised for at least ten years, and has protected that natural resource, it being understood that the property must be duly demarcated and enclosed by fences or clean boundary lines” (boldface ours).

X.Based on the foregoing, the Court finds that the State’s representative is not correct in her grounds for appeal. It must be recalled, as stated in the preceding recitals (considerandos), that evidence in this area is freely assessed, without strict adherence to the rules of ordinary law (Article 54 of the Ley de Jurisdicción Agraria), and that, in possessory information proceedings, every agrarian judge has a duty to safeguard the natural patrimony of the State and therefore must verify with certainty that the statutory requirements for acquisition by prescription are satisfied. Article 11 provides: “Whenever the judge deems it appropriate, the judge may order any measures considered necessary to verify the truth of the facts to which the proceeding refers. The judge shall reject it upon determining that the applicant is improperly seeking title to national public lands (baldíos nacionales), land belonging to any State institution, forest reserves, national parks, or biological reserves.” Accordingly, in this particular case, the conduct of the court below (a quo) was justified, both in verifying the applicant’s ten-year possession predating 1978, the date on which Reserva Forestal Golfo Dulce was created, as exercised by the applicant and his prior transferors, and in verifying the exercise of ecological possession (posesión ecológica) aimed at conserving and restoring forest resources.

In the present case, both conditions are satisfied. The three witnesses, [Nombre5] (folio [Nombre6] (folio 61 verso), and [Nombre7] (folio 62), agree that the applicant took possession of the property more than 41 years ago, that is, approximately in 1967, when it consisted of national public lands, and that he exercised agricultural possession (posesión agraria) through various types of crops and through conservation of the forest, to which the property has most recently been devoted. Witness [Nombre7] expressly stated: “...I have known the property that Mr. [Nombre8] seeks to register for forty-one years; Mr. [Nombre8] entered and cleared boundary lines around that land because it was previously national public land... part of it contains secondary forest and other parts contain primary forest; Mr. [Nombre8] previously planted many crops... The property has forested mountain land, and Mr. [Nombre8] has cared for it...” (folio 62).

The judicial inspection (reconocimiento judicial) stated: “...it can be observed that this entire part of the property used to be pastureland and is now regenerating... The entire portion bordering the río Tigre is protected...” (folio 63). This evidence is also fully consistent with the INTA Soil Study Certificate, which concludes that the land use complies with the approved methodology, expressly stating: “In summary, most of this property is undergoing Natural Forest Regeneration, is not being used for either extensive or intensive livestock farming, and has no significant crops... It is recommended that this property not be used for livestock farming, particularly in sectors A, B, or C; moreover, the entire property is in an advanced state of Natural Forest Regeneration, which is the appropriate use for 71% of the property...” (see folios 73 and 74). It follows from the foregoing that, although the property exhibits high levels of erosion, largely because the terrain is very steep (with slopes of up to 60 to 75%), it has not been demonstrated that the applicant caused those levels of erosion.

In any event, the remaining evidence showed that, for several years, almost the entire property has been left to undergo natural forest regeneration, which is beneficial and complies with the technical recommendations of the Instituto Nacional de Transferencia y Tecnología Agropecuaria. The Court therefore does find that the requirements of Article 7 of the Ley de Informaciones Posesorias and the provisions of the Convenio Regional para el Manejo y Conservación de los Ecosistemas Naturales Forestales y el Desarrollo de Plantaciones Forestales have been demonstrated; that Convention undoubtedly contains many provisions aimed at harmonizing Central American regional regulations and developing a common forestry policy for the protection of Forest Ecosystems.

XI.In view of all the foregoing, because the appellant is not correct in her grounds for appeal, the challenged ruling must be affirmed insofar as it approved these possessory information proceedings. This is subject, however, to the understanding that the applicant must comply with and follow INTA’s technical recommendations concerning forest regeneration and the placement of the property under FONAFIFO’s environmental services payment regime (régimen de pago por servicios ambientales).

POR TANTO:

The challenged ruling is affirmed, subject to the understanding that the applicant must comply with and follow INTA’s technical recommendations concerning forest regeneration and the placement of the property under FONAFIFO’s environmental services payment regime.

Actúa como a poderado especial judicial del promovente , el licenciado Ramón Francisco Zumbado Retana , mayor, casado, abogado, vecino de San José, cédula de identidad número CED5- - .-

RESULTANDO:

1. La parte promovente planteó las presentes diligencias de información posesoria, estimadas en la suma de veinte millones colones, a fin de que se ordene inscribir en el Registro Público de la Propiedad, el inmueble que se describe así : “ Terreno de montaña y potrero, situado en Quebrada Gallardo, del [Dirección1] , del Cantón [Dirección2] Golfito, de la Provincia de Puntarenas. Mide cincuenta y ocho hectáreas, tres mil cuatrocientos dieciséis metros con noventa decímetros cuadrados y linda al Norte con Río Tigre, al Sur con [Nombre2] , al Este con [Dirección3] con un frente de mil cuatrocientos treinta y seis metros y al Oeste con [Nombre3] . ” , (folio s 8 a 11 ).- 2. Se tuvieron como apersonados al proceso la Procuraduría General de la República y el Instituto de Desarrollo Agrario y a los términos que corren a folios 34 a 35 y 36, respectivamente.-

  1. 3El licenciad a Marisel Zamora Arias , juez a de primera instancia , mediante sentencia de las catorce horas cinco minutos del siete de mayo de dos mil nueve, resolvió: “ POR TANTO: Se aprueba la información posesoria y sin perjuicio de terceros de mejor derecho, se ordena al Señor Registrador del Registro de la Propiedad inscribir, por primera vez, a nombre de [Nombre1] , quien es mayor, casado una vez , agricultor , vecino [Dirección4] , Puerto Jiménez, Puntarenas , cédula de identidad CED6 - , la finca descrita en el plano inscrito en el Catastro Nacional bajo el número P-117156-1993, que se describe así: Terreno de montaña y potrero, ubicado en Quebrada Gallardo, [Dirección5] : , Cantón sétimo: Golfito, Provincia de Puntarenas, que según el plano catastrado adjunto No P-117156-1993 posee una extensión total de cincuenta y ocho hectáreas tres mil cuatrocientos dieciseis(sic) metros con noventa decímetros cuadrados, cuyos linderos actuales y verdaderos son: Norte: Río Tigre, Sur: [Nombre4] , Este: [Dirección6] con un frente lineal a ella de mil cuatrocientos treinta y seis metros lineales, Oeste: [Nombre3] .El inmueble objeto de estas diligencias se estima en la suma de veinte millones de colones. RESERVAS Y RESTRICCIONES: Ademas de las descritas en los artículos 16, 17, y 19 de la Ley de Informaciones Posesorias y las disposiciones de la Ley de Aguas Nº 276 del 27 de agosto de 1942. La finca a cuya inscripción registral da orige(sic) a la presente información, esta sujeta a respetar, el área contigua al [Dirección7] tal y como lo dispone artículo 33, inciso b), además está sujeta a respetar, el área existente de montaña de conformidad con la Ley Forestal Nº 7575 tomándo en cuenta que las mismas constituyen área de protección y queda prohibida la corta o eliminación de arboles", (folios 104 a 108).-
  2. 4La licenciada Susana Fallas Cubero , en su condición de Procuradora Adjunta, formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia, (folios 1 17 a 124 ).-

5. En la substanciación del proceso se han observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad.

Redacta el juez Ulate Chacón; y,

CONSIDERANDO:

I. El Tribunal comparte la relación de hechos probados por tener buen sustento en los autos

II.La a-quo aprobó las presentes diligencias al considerar se cumplen los requisitos exigidos por la Ley de Informaciones Posesorias para titular.

III.La Procuradora Adjunta apeló. Sostiene que conforme al estudio de uso del suelo, el 71% del inmueble está erosionado, el 60% es terreno escarpado y el 11% fuertemente ondulado, lo cual supone una de las causas más importantes de degradación como es la pérdida de la capa vegetal, como la deforestación y la agricultura intensiva. Considera que la deforestación en partes de las cuencas hidrográficas ha provocado erosión, lo cual se evidencia en lo establecido en el Convenio Regional para el Manejo y Conservación de Econosistemas Forestales y Desarrollo de Plantaciones Forestales (aprobada por Ley 7572 del 1 de febrero de 1996). Por ello considera que no puede tenerse por probada la protección del recurso natural, requisito del artículo 7 de la Ley de Informaciones Posesorias.

IV.Por otra parte, y en relación con el agravio de la Procuraduría, es importante aclarar que en este caso, para poder titular mediante información posesoria el legislador estableció una serie de requisitos mayores, justamente para evitar que el Patrimonio Forestal del Estado y las áreas protegidas se vean afectadas, así como su biodiversidad. Por ello la Ley de informaciones posesorias en su artículo 7 exige demostrar, aparte de la posesión decenal anterior a la creación de la respectiva área protegida, que se ha conservado el bosque. Los diez años anteriores a la creación se exigen, justamente, para proteger a aquellos sujetos privados que habían consolidado su derecho de posesión diez años antes de la creación del área, es decir, antes de que ocurriera la afectación al dominio público (Ver, entre otros, Tribunal Agrario, No.124 de las 11:30 horas del 14 de marzo del 2003). El artículo 11 de la Ley de Informaciones Posesorias es imperativo al indicar que el juez: "Rechazará la misma si llegare a constatar que se pretende titular indebidamente baldíos nacionales o terrenos pertenecientes a cualquier institución del Estado, lo mismo que reservas forestales, parques nacionales o reservas biológicas."

V.La Información Posesoria es un trámite de actividad judicial no contenciosa para la formalización de un título registrable sobre un derecho de propiedad que se ha llegado a adquirir por la usucapión, cumpliendo para ello con los requisitos legales correspondientes. Se exige demostrar la posesión a título de dueño, en forma quieta, pública, pacífica e ininterrumpida (artículos 1 de la Ley de Informaciones Posesorias y 856 del Código Civil). El titulante, aparte de carecer de título inscrito o inscribible en el Registro Público, debe manifestar expresamente que la finca no ha sido inscrita en el Registro Público anteriormente. Por razones de interés público, y para evitar una doble inscripción registral sobre un mismo bien, o bien, para tutelar a terceros de mejor derecho que el titulante, la Ley exige notificar a ciertos sujetos. También estableció un trámite de oposición dentro de la Información Posesoria, en caso de que alguno de los interesados se sienta perjudicado por la titulación (artículo 8).

La Ley de Informaciones Posesorias ordena al Juez tener como partes y por tanto notificarles personalmente desde el inicio de las diligencias, a los colindantes, ello por cuanto la titulación podría abarcar parte de las tierras que les pertenecen. También se ordena notificar a los condueños o condóminos. Igualmente, en resguardo de los intereses del Estado, se ordena tener como parte a la Procuraduría General de la República y al Instituto de Desarrollo Agrario, para el resguardo de la propiedad sujeta al dominio público, y de la Propiedad Agraria estatal (artículo 5). Finalmente, la Ley manda a citar a todos los interesados, mediante la publicación de un Edicto en el Boletín Judicial, que puedan tener un interés legítimo en el proceso.(Ver numeral 5 de la Ley de Informaciones Posesorias).-

VI.La Ley de Informaciones Posesorias, en su artículo 7, así como la Ley Forestal, desde hace mucho tiempo han procurado proteger los recursos forestales de la acción humana, sometiéndolos a diversas formas de manejo forestal. Aunque se ha permitido la titulación de dichas áreas, que ya declaradas como áreas de conservación pasan a formar parte del Patrimonio Forestal del Estado, se exige el cumplimiento de otros requisitos más calificados. Eso nos conduce, directamente al concepto de posesión ecológica, y al criterio de la función ecológica de la propiedad forestal. Precisamente es en estos casos donde la Ley Forestal viene a establecer todo un régimen jurídico para la protección de los recursos forestales, sometiendo algunas veces al propietario en forma obligatoria al régimen forestal y en otros casos en forma voluntaria. De esa forma, en la posesión forestal el poder de hecho se ejerce sobre un bien de vocación forestal o en su mayor parte destinado a proteger los recursos forestales, sin miras a su explotación o bien, dedicándolo a la simple extracción de especies maderables, a través de planes de manejo para lograr la regeneración natural del bosque.

En uno y otro caso no existiría el desarrollo de un ciclo biológico vegetal o animal, ni asumiría el hombre ningún riesgo. Es por eso que la ley no tutela, al contrario reprime, la posesión a través de la cual se destruyan los recursos forestales de áreas protegidas. Además niega la posibilidad de adquirir derechos de posesión sobre tierras de las reservas nacionales cuando se ha ejercido una acción dañina en contra de los recursos forestales.

VII.La legislación especial en cuanto a la tutela de la propiedad y posesión forestales tiene tres etapas en nuestro país. La primera etapa de la propiedad forestal se enmarca con la Ley No. 4465 del 35 de noviembre de 1969. La segunda etapa se abre a través de una normativa mejor concebida a través de la Ley No. 7032 del 7 de abril de 1986, la cual fue posteriormente declarada inconstitucional. La última opera con la promulgación de la Ley Forestal No. 7174 del 28 de junio de 1990, reformada recientemente, por Ley No. 7575 del 13 de febrero de 1996 (publicada en el alcance 21 de La Gaceta No. 72 del martes 16 de abril de 1996). En ellas, se contienen diversos regímenes de propiedad forestal, y limita el uso y aprovechamiento de los recursos por los particulares. No es posible adquirir la titularidad sobre terrenos con cobertura boscosa si no se demuestra haber protegido el recurso forestal. Su fundamento constitucional se encuentra en el párrafo segundo del artículo 45 de la Constitución. A través de limitaciones de interés social se protege el instituto de la propiedad y la posesión forestal. Esta no es igual a la civil, ni a la agraria, se trata de una propiedad para conservar, y por tanto los actos posesorios que en ella se realice deben tener esa finalidad.-

VIII.La posesión forestal ha tenido su régimen jurídico en las Leyes Forestales mencionadas. Recae sobre un bien específico: los terrenos cubiertos de bosques o de aptitud forestal. El propietario o poseedor de tales bienes tiene la obligación de conservar los recursos forestales y no los puede aprovechar económicamente sino bajo las restricciones o limitaciones impuestas por la ley. Para la solución jurídica de conflictos que nazcan del ejercicio de la posesión forestal, se debe aplicar ese régimen jurídico especial y los principios del Derecho forestal. La Ley Forestal establece como función esencial y prioridad del Estado, velar por la protección, la conservación, el aprovechamiento, la industrialización, la administración y el fomento de los recursos forestales del país, de acuerdo con el principio de uso racional de los recursos naturales renovables.(Artículo 1). Todos los terrenos de aptitud forestal y los bosques del país, ya sea estatales o que estén reducidos a dominio particular, quedan sometidos a los fines de la ley.

El régimen forestal es el conjunto de disposiciones, entre otras, de carácter jurídico, económico y técnico, establecidas por la ley, su reglamento y demás normas, que regulen la conservación, la renovación, el aprovechamiento y el desarrollo de los bosques y terrenos de aptitud forestal del país. Por ello, para adquirir la propiedad forestal por usucapión, se requiere el ejercicio de la posesión forestal. El artículo 7 de la Ley de Informaciones posesorias, reformado por la Ley Forestal, establecía, antes de su reforma: "Artículo 7.- Cuando el inmueble a que se refiere la información esté comprendido dentro de una zona declarada parque nacional, reserva biológico, reserva forestal o zona protectora, el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la respectiva ley o decreto en que se creó la respectiva área silvestre.

Las fincas que estén fuera de esas áreas y que tengan bosques, solo podrán ser tituladas si el promovente demuestra haberlas poseído por diez años o más y haber protegido dicho recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado con cercas o carriles." (la cursiva es nuestra). En otros términos, el poder de hecho en la posesión forestal recae sobre el recurso natural "bosques" o "terrenos de aptitud forestal", y los actos posesorios deben ir encaminados a su protección y conservación. Solo si se demuestra eso podría adquirirse o inscribirse terrenos a favor de dichos poseedores. De lo contrario, quedarían formando parte del patrimonio natural del Estado (artículo 13 de la nueva Ley Forestal), con carácter inembargable e inalienable, y su posesión no causará ningún derecho a favor de los particulares (artículo 14 de la nueva Ley Forestal).-

IX.La Ley Forestal No. 7575, también mantuvo las restricciones en la Ley de Informaciones Posesorias, para poder titular terrenos comprendidos en áreas protegidas. Al respecto dispone el actual artículo: "Artículo 7.-Cuando el inmueble al que se refiera la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser titular de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre. Las fincas ubicadas fuera de esas áreas y que tengan bosques, sólo podrán ser tituladas si el promoviente demuestra ser el titular de los derechos legales de posesión decenal, ejercida por lo menos durante diez años y haber protegido ese recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado y con cercas o carriles limpios"(La negrita es nuestra).

X.Con fundamento en lo expuesto, considera el Tribunal no lleva razón la representante del Estado, en sus agravios. Debe recordarse, como se señaló en los considerandos anteriores, que en esta materia la prueba se valora libremente, sin sujeción estricta a las normas de derecho común (artículo 54 de la Ley de Jurisdicción Agraria), y tratándose de informaciones posesorias, es obligación de todo juez agrario velar por el respeto del patrimonio natural del Estado y por ello debe verificar con certeza que se cumplan los requisitos exigidos por la Ley para poder usucapir. El artículo 11 dispone: “El juez podrá cuando lo crea conveniente, ordenar todas aquellas diligencias que estime necesarias para combrobar la veracidad de los hechos a que se refiere la información. Rechazará la misma si llegare a constatar que se pretende titular indebidamente baldíos nacionales o terrenos pertenecientes a cualquier institución del Estado lo mismo que reservas forestales, parques nacionales o reservas biológicas”.

De ahí que en este caso particular, se justificaba la actuación del a-quo, tanto en la verificación de la posesión decenal anterior a 1978, fecha en que se creó la Reserva Forestal Golfo Dulce, por parte del titulante y sus anteriores trasmitentes, como del ejercicio de una posesión ecológica tendiente a conservar y recuperar los recursos forestales. En el presente caso, ambas condiciones se cumplen. Los tres testigos, [Nombre5] (folio [Nombre6] (folio 61 vuelto), y [Nombre7] (folio 62), coinciden en que el titulante entró a poseer el inmueble hace más de 41 años, es decir aproximadamente desde 1967, cuando eran baldíos nacionales, habiendo ejercido una posesión agraria mediante diversos tipos de cultivos, y de conservación del bosque, al cual está dedicado últimamente el fundo. Expresamente el testigo [Nombre7] afirmó: "...desde hace cuarenta y un años conozco la finca que pretende inscribir don [Nombre8], don [Nombre8] entró y acarriló esos terrenos porque antes esos eran baldíos nacionales..tiene parte de bosque secundario y otras de bosque primario, anteriormente don [Nombre8] sembró muchos cultivos..

La finca tiene montaña y don [Nombre8] la ha cuidado..." (folio 62). En el reconocimiento judicial se indicó: "...se observa que toda esta parte de la finca son fueron potreros y ahora están regenerándose...Toda la parte que colinda con el río Tigre se encuentra protegida..." (folio 63). Dichas probanzas, también coinciden perfectamente como el Certificado de Estudio de Suelos del INTA, que concluye que el uso es conforme a la metodolgía aprobado, indicando expresamente que: "En resumen, la mayor parte de esta finca se encuentra en Regeneración Forestal Natural, no está siendo explotada en la ganadería extensiva, ni intensiva y no posee cultivos importantes...Se recomienda no explotar esta finca en la actividad ganadera, principalmente en los sectores A, B o C; además el total del inmueble se encuentra en un estado avanzado de Regeneración Forestal Natural, siendo esta la vocación de la misma en un 71%..." (ver folios 73 y 74).

De lo anterior se desprende, que si bien el inmueble presenta altos niveles de erosión, lo cual en gran parte obedece a que el terreno es muy escarpado (con pendientes de hasta el 60 al 75%, no está demostrado que fuere el titulante el que ocasionara esos niveles de erosión. Y, en todo caso, se demostró del resto de las probanzas, que desde hace varios años, casi la totalidad del inmueble se ha dejando en regeneración forestal natural, lo cual es positivo, y cumple las recomendaciones técnicas del Instituto Nacional de Transferencia y Tecnología Agropecuaria. De ahí que el Tribunal sí tenga por demostrado los requisitos del artículo 7 de la Ley de Informaciones Posesorias y las disposiciones del Convenio Regional para el Manejo y Conservación de los Ecosistemas Naturales Forestales y el Desarrollo de Plantaciones Forestales, que sin duda alguna tiene muchas disposiciones orientadas a la armonización normativa regional centroamericana y a la construcción de una política forestal común para la protección de los Ecosistemas Forestales.

XI.En razón de todo lo expuesto, no llevando razón la recurrente en sus agravios, deberá confirmarse la resolución recurrida, en cuanto aprobó las presentes diligencias de información posesoria. Pero en el entendido de que el titulante deberá respetar y seguir las recomendaciones técnicas del INTA, en cuanto a la regeneración forestal y el sometimiento del inmueble al régimen de pago por servicios ambientales de FONAFIFO.

POR TANTO:

Se confirma la resolución recurrida en el entendido de que el titulante deberá respetar y seguir las recomendaciones técnicas del INTA, en cuanto a la regeneración forestal y el sometimiento del inmueble al régimen de pago por servicios ambientales de FONAFIFO.
