JUDGMENT NO. 0 370 - F -10 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, at ten hours and two minutes on veintidós de abril de l dos mil diez.- POSSESSORY INFORMATION PROCEEDING (INFORMACIÓN POSESORIA), filed by [Nombre1], of legal age, married, farmer, resident of La Chanchera de Golfito, identity card number CED1- - . Participating in the proceeding are the PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by Lydiana Rodríguez Paniagua, whose personal particulars are not indicated in the record, in her capacity as Deputy Attorney General, and the INSTITUTO DE DESARROLLO AGRARIO, represented by Gerardo Vargas Rojas, of legal age, married, attorney, resident of Atenas de Alajuela, identity card number CED2- - , in his capacity as executive president with the powers of a general attorney-in-fact without limitation. Processed before the Juzgado Agrario de la Zona Sur. Attorney Yadira Reyes Wong, of legal age, married, attorney, resident of Ciudad Neily, identity card number CED3- - , acts as special judicial attorney-in-fact for the petitioner.- BACKGROUND:
1. The petitioner instituted these possessory information proceedings, valued at the sum of two million colones, seeking an order that the following described property be registered in the Registro Público de la Propiedad: “Pastureland located at [Dirección1] ) ) in the Province of Puntarenas, with the following boundaries as shown on the cadastral survey plan (Plano Catastrado): to the North, [Nombre2]; to the South, a right-of-way easement (servidumbre de paso) and stream; to the East, [Nombre3] and [Nombre4]; and to the West, [Nombre5] and [Nombre2]. The land measures thirty-five hectares, one thousand two hundred fifty-six square meters and thirty-five square decimeters, as shown on Plan novecientos setenta y siete mil cuatrocientos diecinueve- dos mil cinco.”-, (pages 7 to 10).- 2. The Procuraduría General de la República and the Instituto de Desarrollo Agrario were deemed to have entered appearances in the proceeding, under the terms set forth at pages 32 to 33 and 38, respectively.- 3.
Attorney Marisel Zamora Arias, the trial judge, ruled at eight hours and thirty minutes on dieciocho de enero del dos mil diez: “THEREFORE (POR TANTO): In accordance with the foregoing and Articles 1, 2, 3, 4, 7 and following of the Ley de Informaciones posesorias, these Possessory Information Proceedings filed by Mr. [Nombre1] are APPROVED, and the Registro Público de la propiedad is ordered to register in his name the land described as follows: Pastureland located at [Dirección2] ) in the Province of Puntarenas, with the following boundaries: to the north, [Nombre5] ); to the South, [Nombre6]; to the East, [Nombre3]; and to the West, [Nombre7] and [Nombre8], measuring thirty-five hectares, one thousand two hundred fifty-six square meters and thirty-five square decimeters. The foregoing is according to cadastral survey plan novecientos setenta y siete mil cuatrocientos diecinueve- dos mil cinco.-”, (pages 324 to 331).- 4.
The Procuraduría General de la República filed an appeal expressly stating the reasons for challenging the trial court’s position, under the terms set forth at pages 343 to 354.- 5. The statutory requirements were observed in the processing of the case, and there are no errors or omissions capable of rendering the judgment void.

CONSIDERING:
I.The photographs submitted to this Court at pages 271 to 277 are admitted as evidence to assist in deciding the case. The sworn statements at pages 278 and 279 are rejected because they are unnecessary for deciding this appeal, as sufficient evidence is available. Pursuant to Article 52 of the Ley de Jurisdicción Agraria.-
II- The list of proven facts is adopted because it is well supported by the record, except for fact number three, because it is a procedural requirement rather than a fact of that nature. Fact number six is deleted because it bears no relation to these proceedings, as it refers to a possessor and witness testimony unrelated to those examined in this case.
III- The appeal was filed by Attorney Lydiana Rodríguez Paniagua in her capacity as Deputy Attorney General (pages 343 to 366). She disagrees with the judgment issued at 08 hours 30 minutes on 18 de enero del 2010, which approved the possessory information proceedings (page 324). She states the following grounds for appeal: The judicial inspection and witness testimony establish that most of the land consists of forest, a classification confirmed by the Soil Study, which states that it is 100% forest. Because they are located within national reserves, such forests are subject to the public-domain regime and form part of the State’s natural heritage, under Ley Forestal 4465 of 1969, Article 33, as amended by Ley Forestal 7174 of 1990 (Articles 32 and 33), and retain their public-domain status under Ley 7575, (Articles 13 and 14). She argues that the law allows properties outside protected wildlife areas (áreas silvestres protegidas) to be titled if the petitioner proves lawful rights based on ten years of possession, demonstrates that the resource has been protected, and shows that the property has been properly demarcated.
She cites Constitutional Chamber decision 4587-97 and reiterates that forests may be titled only if acquisitive prescription (usucapión) was completed before they became part of the State’s natural heritage by operation of law, and that the period required for qualifying acquisitive prescription must have elapsed before the designation occurred; she further argues that forest lands are immediately designated by law as public-domain property. She objects that the witnesses’ statements do not establish ten years of possession sufficient for acquisitive prescription in the owner’s favor. She reproduces judicial and administrative precedents concerning the continued application of repealed law to legal situations arising under it. She cites Constitutional Chamber decisions 4587-97 and 15753-2005, [Telf1], 783-2003 in connection with this ground of appeal. She adds that public-domain property cannot be titled, that private parties are barred from exercising possession over such property, and that acquisitive prescription and titling are inadmissible, invoking the principles of inalienability and immunity from prescription (imprescriptibilidad).
She requests that these proceedings be denied. She likewise requests correction of the property boundaries [Dirección3], [Dirección4], and [Dirección5], because streams exist and were omitted in that respect. She asks that the restrictions under Article 33(b) of Ley Forestal 7575 be added and that the channels and waters of watercourses be declared public-domain property.
IV- The State representative’s ground for appeal rests on the contention that, because the area has forest cover (cobertura boscosa), it is not susceptible to acquisitive prescription because it forms part of the State’s forest heritage. These proceedings were instituted to register in the Registro Público de la Propiedad the property located at [Dirección6] in the Province of Puntarenas, measuring 35 hectares, 1256 square meters, and 35 square decimeters, according to plan 6-977419-2005, page (page 1). According to the certification issued by Sistema Nacional de Áreas de Conservación and submitted as evidence (page 2), the property is not part of a protected wildlife area. The soil study in the record (page 61) states that the land has been used in accordance with its soil classification, because the entire area consists of secondary forest. The observations indicate that the banks of the two streams have protection zones.
It adds that sector C contains an area of approximately 1500 square meters of pastureland to serve as a resting area for horses when tourists visit the farm, and its recommendations state: “Maintain the current land use and, in the area designated as pastureland, the most advisable course is to leave it as a forest protection zone.” The Court conducted a judicial inspection of the property on 21 de febrero del 2007 (page 110), for which a record was prepared stating: “We continued along a public road for approximately two hundred fifty meters, as far as the vehicle could travel, and from there we continued along a trail until reaching the property’s southern boundary. The pasture areas are located in the upper part of the farm, since most of the farm consists of grazing land; there are approximately three hectares of forest, which is properly conserved. The farm is bounded to the north and south by a stream, whose banks are protected.
The farm is demarcated (sic) by three-meter-wide cleared boundary strips, and there are no structures ..” The party submitted photographs to this Court (pages 271 to 277), showing the pasture area surrounded by forests, the area mentioned in the soil study and judicial inspection. Testimony was also received from witnesses [Nombre9], (page 107), [Nombre10] (page 108), and [Nombre11] (page 147). The first stated that he had known the farm since childhood because he was born in the area; he stated that one part of the farm was purchased from [Nombre8] and another from [Nombre12], who possessed it for more than 15 years, while the current possessor had held it for one or two years. He correctly located the farm and stated that it measured approximately 35 hectares. One portion measured approximately 15 hectares and the other approximately 20 hectares. He identified the adjoining landowners, naming [Nombre2], [Nombre3], [Nombre5], and [Nombre4].
He stated that the farm had been used as pastureland and forest, that it was bounded in the southwest sector by the [Dirección7] stream, that he was unaware of any possession disputes involving the petitioner or the previous possessors, and that possession had been exercised continuously, peacefully, publicly, and under a claim of ownership. The acts of possession (actos posesorios) mentioned consisted of maintaining the farm, keeping it demarcated with three-meter-wide boundary strips, and clearing it once a year. The forest area was conserved, and he was unaware of any harvesting of forest resources. Witness [Nombre10] gave testimony consistent with that of the preceding witness, stating that he had known the petitioner for approximately ten years, the transferor [Nombre8] for approximately 22 years because [Nombre8] was his father-in-law, and [Nombre12] for approximately 10 years, and that he had worked on the farm.
He established the chain of transfer of possession from [Nombre8] and [Nombre12], who were adjoining landowners and sold the property to the petitioner. He stated that [Nombre8] possessed the farm for more than twenty years and that [Nombre12] was already there at that time. He located the farm consistently with the survey plan and the preceding witness. He correctly stated the farm’s approximate measurement, identifying the areas belonging to each person who transferred possession to the petitioner. He added that he knew of the existence of three-meter-wide boundary strips that were regularly cleared and was unaware of possession disputes with third parties, as possession had been exercised publicly, peacefully, under a claim of ownership, and uninterruptedly. The acts of possession known to him consisted of clearing and maintenance; the farm has a protected forest area, and he was unaware of any timber having been extracted.
Witness [Nombre11] stated that he had lived in Purruja de Golfito for 15 years and knew the petitioner’s land because it had belonged to his father, [Nombre12], stating that his father possessed the land for approximately 20 years and sold it to [Nombre1] approximately three or four years earlier. He described the boundaries and an area of 35 hectares and was unaware of any claims arising from possession disputes.
V- The appellant alleged that the witnesses’ statements do not establish ten-year possession (posesión decenal). The Court does not agree with the State representative’s assertion regarding this lack of proof. She did not state the reasons for her assertion in the appeal; nevertheless, in order to establish compliance with all statutory requirements, the Court will analyze the testimony given by the three witnesses in these proceedings. The testimony already assessed in the preceding recital (considerando) consistently establishes the chain of transfer through which [Nombre8] and [Nombre12] conveyed possession that each had exercised for more than ten years. The petitioner acquired the property through sales recorded in public deeds (escrituras públicas) numbers fifteen (folio 5) and fourteen (folio 6), executed before a notary on January 5, 2005. In [Nombre8]’s deed of sale, possession of forty-five years was transferred to him; according to the document, this concerned an approximately two-hundred-thousand-square-meter area of unregistered land without a survey plan, located in Purruja de Golfito, province of Puntarenas.
In the second sale cited, [Nombre12] transferred his possessory rights (derechos posesorios) over land in the same situation, with an approximate area of one hundred thirty-one thousand square meters, likewise stating that he had possessed it for more than forty-five years. The purchaser relied upon the possession exercised by his transferors and, for that purpose, submitted the public instrument transferring their right, in accordance with section one of the Ley de Informaciones Posesorias. The three witnesses consistently stated that the persons transferring possession were [Nombre8] and [Nombre12] and that they had exercised possession for more than ten years, which is consistent with the public instruments submitted and the petitioner’s statements. The appellant’s claim of error is rejected.
VI- The appellant states that forest covers almost the entire property, as shown by the soil study, and therefore invokes the prohibition against obtaining title to forest-covered property because it is public-domain property (dominio público). The appellant’s claim of error is unfounded. The cited soil study indicated that the land is covered by secondary forest (bosque secundario) and contains an approximately 1500-meter pasture used for resting the horses ridden by tourists. The study concluded that the land was being used in accordance with its proper use, as the trial judge was also able to verify during the judicial inspection (reconocimiento judicial), identifying the pasture area in the upper portions and an approximately three-hectare mountain forest area. The witnesses’ statements also indicate that they had no knowledge of any logging of forest resources. Those statements, the judicial inspection, and the soil certification demonstrate a conservationist approach by the petitioner and her prior transferors, thereby satisfying section seven of the Ley de Informaciones Posesorias.
In view of the foregoing, the fact that the land is devoted to forest does not make it part of the State’s natural heritage (patrimonio natural del Estado), because, pursuant to article 856 of the Código Civil, the property is eligible for acquisition by adverse possession (usucapión). Accordingly, pursuant to article 7 of the Ley de Informaciones Posesorias, the Court finds that the evidence submitted did indeed establish the exercise of the legally required possession over the property beginning ten years before the date on which these proceedings were instituted, and that the land at issue in these proceedings is eligible for acquisition by adverse possession because it lies outside any protected wilderness area (área silvestre protegida), regardless of its management category, and because possessory acts (actos posesorios) aimed at conserving natural resources were exercised.
VII.Regarding this issue, this Court has held: “In connection with the arguments presented by the State’s representative concerning the State’s forest estate (patrimonio forestal del Estado), a brief discussion of the matter is appropriate. For this purpose, it is appropriate to cite decision Nº51 issued at 15 hours 15 minutes on May 26, 1995, by the First Chamber of the Supreme Court of Justice, which states, insofar as relevant: ‘IX.- The State’s forest estate includes the entire national territory (articles 4, 32 to 42), which may in turn be divided into three areas: A) The area covered by the forestry regime (régimen forestal) (articles l, 2, 7, 47 to 54, 66 to 81); B) forestry harvesting (aprovechamientos forestales) on privately owned land (articles 43 to 46, 60 to 65, 82 to 91); and C) national reserves (reservas nacionales) (articles 32 et seq.). The forestry regime—comprising the body of legal, economic, and technical provisions intended to give effect to the conservation, protection, and rational use of forests and forest lands (article 7)—also has three subareas: A) protective zones, B) national parks, forest and biological reserves, and C) forests and forest lands.
X.- Since Ley de Tierras y Colonización Nº 2825 of October 14, l961, the term national reserves has identified all lands referred to as national vacant lands (baldíos nacionales) by the Código Fiscal of l865 and subsequently by Ley Nº l3 of January 19, l939 (Colección de Leyes y Decretos, l939, I semester, p. l0). These are properties not subject to private ownership and not registered in the Public Property Registry, within the meaning of articles 267 and 486 of the Código Civil (see the decision of the Full Court on [Nombre13]’s constitutional challenge against the Ley de Tierras y Colonización concerning the provisions on excess areas (demasías), adopted at the extraordinary session of November 25, l971). These lands differ from privately owned lands registered in the name of the State or its institutions and constitute the remainder of the two preceding categories. Originally, during the colonial period, they were not allocated to public service or use.
Following the principles of the Código Civil, Ley General de Baldíos Nacionales Nº l3 of January l0, l939 declared that all such lands located within the boundaries of the Republic belonged to the State if they had not been acquired as private property under lawful title (e.g., by adverse possession), were not registered in the Public Registry in the name of any person—private or public—and were not allocated to public service. Ley de Tierras y Colonización Nº 2825 of October l4, l961 maintained the same approach, except that it expanded the lands declared inalienable under the prior law (Article 7). In general, possession of these reserves has been subject to limitations, as has the surface area that may be registered through possessory information proceedings (informaciones posesorias). Their administration was initially entrusted to the Land and Colonies Section of the Rural Credit, Land and Colonies Department of Banco de Costa Rica; it was subsequently transferred to Instituto de Tierras y Colonización; and when Ley Forestal Nº 4465 entered into force, administration of the State’s forest estate was granted to Dirección General Forestal, created within Ministerio de Agricultura y Ganadería.
Today Dirección General Forestal forms part of Ministerio de Recursos Naturales, Energía y Minas (articles 9 to 16). All lands considered national reserves immediately become subject to the purposes of forestry legislation (article 32). On those lands, the State may create—by statute or executive decree—forest reserves, protective zones, national parks, wildlife refuges, and biological reserves, thereby forming the forest estate (article 35). Legislative authorization is required before they may be colonized or transferred (article 40), and even when possessed by third parties, those parties acquire no rights, while the State’s right to recover them is not subject to prescription (article 33). National reserves are regulated in detail in the Chapter entitled “Forestry-resource harvesting on land belonging to the State and other public administrative bodies.” Harvesting in national reserves may be conducted only under concessions granted by Dirección General Forestal (articles 55 and 56).
Tender proceedings shall be conducted in accordance with technical forest-management plans and subject to the tender specifications prepared by the Directorate (article 55(a)), with concessionaires providing sufficient security (article 56). No person may obtain concessions over the forest estate in quantities exceeding the raw-material needs that person demonstrates. Authorizations obtained directly or through intermediaries contrary to the foregoing are void (article 59). XI.- Diametrically opposed to national reserves is private property, referred to in the law under the heading “Forestry-resource harvesting on privately owned land.” For reasons of social interest, these lands form part of the State’s forest estate. This is so because private parties—operating under any system, whether an agricultural or livestock enterprise, subdivision (parcelación), or colonization, and whether nationals or foreigners—whose work plans include forestry exploitation or removal of forest in any form must obtain the express approval of Dirección General Forestal, pursuant to Ley Forestal and its regulations (article 60).
The State’s forest-estate regime therefore applies to all property in the country containing natural forest resources. To exploit their own timber resources, private parties must prepare technical forestry plans, and the Directorate shall grant them long-term concessions (article 6l). The foregoing entails voluntary submission to the forestry regime. This is a legal presumption because it is the private owner’s only option, since the owner is prohibited from cutting trees or harvesting or exploiting forest products on the owner’s own property without prior authorization from Dirección General Forestal (articles 63 and 65). For these purposes, the State provides a series of incentives for the management and regulation of privately owned forests and forest lands, particularly through Certificados de Abono Forestal (articles 82 to 86) and other tax incentives (article 87). Because Dirección General Forestal must have trained personnel and forest rangers and maintains relations with the authorities, it shall provide owners with all necessary assistance to keep their properties free of trespassers and occupants (article 67)....’ It follows from the foregoing that the State’s forest estate consists of properties not subject to private ownership and not registered in the Public Property Registry, within the meaning of articles 267 and 486 of the Código Civil, according to the reference to the Constitutional Chamber of the Supreme Court of Justice’s holding.
Private property also stands in contrast to this estate. Throughout the development of forestry legislation, possessors of properties who had already perfected their ownership rights through adverse possession were afforded the opportunity to obtain title to them. That possibility is available through compliance with the requirements of the Ley de Informaciones Posesorias; accordingly, persons seeking title to land located within protected wilderness areas, regardless of management category, are expressly authorized to obtain title eligible for registration in the Public Registry upon proving possession for more than 10 years before the effective date of the law or decree creating the protected wilderness area (articles 1 and 7 of the Ley de Informaciones Posesorias) (decision 100-F-09 of the Tribunal Agrario). Furthermore, in decision 1167-2010, the Constitutional Chamber denied the constitutional inquiry filed against that provision.-
VIII- For the reasons set forth above, the photographs submitted before this court at folios 271 to 277 shall be admitted as evidence for better adjudication (prueba para mejor resolver), and the affidavits (declaraciones juradas) at folios 278 and 279 shall be rejected as unnecessary for deciding this appeal; and the judgment shall be affirmed because compliance with all statutory requirements has been established. The appellant is correct that the boundaries of the property for which title is sought must be corrected, because the survey plan shows boundaries with watercourses to the north, east, and south, consisting of streams. It shall be added that the northern, western, and southern boundaries also adjoin properties with a stream between them, a watercourse in the public domain, and a protection zone (zona de protección) that must be respected pursuant to Article 33 of Ley Forestal 7575.
It shall likewise be ordered that the prohibition against logging, building, cultivating, or carrying out any activity harmful to the protection of water or forest resources be observed within the protection areas of the streams along the boundaries, because the property is subject to the restrictions of Ley de Aguas and Ley Forestal, Ley de Tierras y Colonización Article 7 subsection c), and those set forth in Article nineteen of Ley de Informaciones Posesorias. The channels of those streams are in the public domain pursuant to provisions 33 subsection b) and 34 of Ley Forestal N° 7575, 1 subsections IV and 3 subsection III of Ley de Aguas. The Registro Público shall take note of these restrictions, which must be stated in the certified judgment (ejecutoria) sent for such purposes.
POR TANTO:
The photographs submitted before this court at folios two hundred seventy-one to two hundred seventy-seven are admitted as evidence for better adjudication. The affidavits at folios two hundred seventy-eight to two hundred seventy-nine are rejected. The judgment is affirmed as to the matters appealed. The judgment is reversed with respect to the boundary information for the northern, western, and southern directions, and the Registro shall instead record that the property is bounded to the north by [Nombre5], with a stream between them; to the west by [Nombre7], [Nombre8], with a stream between them; and to the south by [Nombre14], with a stream between them. The Registro shall also record that, pursuant to Article 33 of Ley Forestal 7575, compliance is ordered with the prohibition against logging, building, cultivating, or carrying out any activity harmful to the protection of water or forest resources within the protection areas of the streams along the boundaries, because the property is subject to the restrictions of Ley de Aguas and Ley Forestal, Ley de Tierras y Colonización Article 7 subsection c), and those set forth in Article nineteen of Ley de Informaciones Posesorias.
The channels of those streams are declared to be in the public domain pursuant to provisions 33 subsection b) and 34 of Ley Forestal N° 7575, 1 subsections IV and 3 subsection III of Ley de Aguas; the Registro Público shall take note of these restrictions, which must be stated in the certified judgment sent for such purposes. In all other respects that were the subject of the appeal, the decision is affirmed.- MARÍA ROSA CASTRO GARCÍA DAMARIS VARGAS VÁSQUEZ VANESSA FISHER GONZÁLEZ CASE FILE: EXPN1 PROCEEDING: POSSESSORY INFORMATION (INFORMACIÓN POSESORIA) PETITIONER: [Nombre1] [Nombre15]
VOTO Nº 0 370 - F -10 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las diez horas dos minutos del veintidós de abril de l dos mil diez.- INFORMACIÓN POSESORIA, promovida por [Nombre1] , mayor, casado, agricultor, vecino de La Chanchera de Golfito, cédula de identidad número CED1- - . Intervienen en el proceso la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Lydiana Rodríguez Paniagua, de calidades desconocidas en autos, en su condición de procuradora adjunta, y el INSTITUTO DE DESARROLLO AGRARIO, representado por Gerardo Vargas Rojas, mayor, casado, abogado, vecino de Atenas de Alajuela, cédula de identidad número CED2- - , en su condición de presidente ejecutivo con facultades de apoderado generalísimo. Tramitado en el Juzgado Agrario de la Zona Sur. Actúa como apoderada especial judicial de la parte promovente la licenciada Yadira Reyes Wong, mayor, casada, abogada, vecina de Ciudad Neily, cédula de identidad número CED3- - .-
RESULTANDO:
1. La parte promovente planteó las presentes diligencias de información posesoria, estimadas en la suma de dos millones de colones, a fin de que se ordene inscribir en el Registro Público de la Propiedad, el inmueble que se describe así: "Terreno de potrero, situado en [Dirección1] ) ) de la Provincia de Puntarenas, con los siguientes linderos según consta en el Plano Catastrado: al Norte con [Nombre2] , al Sur con servidumbre de paso y quebrada, al Este con [Nombre3] y [Nombre4] y al Oeste con [Nombre5] y [Nombre2] , el terreno tiene una medida de treinta y cinco hectáreas con mil doscientos cincuenta y seis metros con treinta y cinco decímetros cuadrados según consta en el Plano novecientos setenta y siete mil cuatrocientos diecinueve- dos mil cinco."-, (folios 7 a 10).- 2. Se tuvieron como apersonados al proceso a la Procuraduría General de la República y el Instituto de Desarrollo Agrario, a los términos que corren a folios 32 a 33 y 38, respectivamente.- 3.
La licenciada Marisel Zamora Arias, jueza de primera instancia, en resolución de las ocho horas treinta minutos del dieciocho de enero del dos mil diez, resolvió: "POR TANTO: De conformidad con lo expuesto artículos 1, 2, 3, 4, 7 y siguientes de la Ley de Informaciones posesorias, se APRUEBAN las presentes diligencias de Información Posesoria promovidas por el señor [Nombre1] se ordena al Registro Público de la propiedad inscribir a su nombre el terreno que se describe de la siguiente forma: Terreno de potrero, situado en [Dirección2] ) de la provincia de Puntarenas con los siguientes linderos; al norte con [Nombre5] ), al Sur; con [Nombre6] , al Este con [Nombre3] y al Oeste con [Nombre7] y [Nombre8] , con una medida de treinta y cinco hectáreas mil doscientos cincuenta y seis metros cuadrados y treinta y cinco decímetros cuadrados. Lo anterior según el plano catastrado novecientos setenta y siete mil cuatrocientos diecinueve- dos mil cinco.-”, (folios 324 a 331).- 4.
La Procuraduría General de la República interpuso recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del juzgado de instancia, a los términos que corren a folios 343 a 354.- 5. En la substantación del proceso se han observado las prescripciones legales, y no se observa la existencia de errores u omisiones capaces de producir la nulidad del fallo.
Redacta la jueza Castro García; y,
CONSIDERANDO:
I.Se admiten como prueba para mejor resolver las fotografías presentadas ante esta sede a folio 271 a 277. Se rechazan las declaraciones juradas de folios 278 y 279, por resultar innecesarias para resolver esta apelación, al haber suficientes elementos de prueba. Con fundamento en el artículo 52 de la Ley de Jurisdicción Agraria.-
II- Se comparte el elenco de hechos probados por tener buen sustento en los autos, con excepción del hecho numerado tres, por ser un requisito del procedimiento y no un hecho de esta naturaleza. Y el hecho numerado seis se elimina, al no guardar ninguna relación con estas diligencias, al citarse poseedor y testimoniales ajenas a los que se analizaron en este proceso.
III- La apelación es interpuesta por la licenciada Lydiana Rodríguez Paniagua en su carácter de Procuradora Adjunta (folio 343 a 366). Se muestra disconforme con la sentencia de las 08 horas 30 minutos del 18 de enero del 2010 donde se aprobaron las diligencias de información posesoria (folio 324). Expone como agravios los siguientes: Consta en el reconocimiento judicial y prueba testimonial el terreno en su mayor parte, está formado de bosque, naturaleza confirmada por el Estudio de Suelos donde consta que es 100% bosques. Los mismos , por ubicarse en reservas nacionales están afectados a régimen de dominio público, patrimonio natural del Estado, desde la Ley Forestal 4465 de 1969, artículo 33, reformada por la Ley Forestal 7174 de 1990 (artículos 32 y 33) y de carácter demanial que mantiene la Ley 7575, (artículos 13 y 14). Argumenta, la Ley permite titular inmuebles fuera de las áreas silvestres protegidas si el promovente demuestra sus legítimos derechos de posesión decenal, haber protegido el recurso y tener el inmueble debidamente deslindado.
Cita voto de la Sala Constitucional voto 4587-97 y reafirma los bosques solo podrán titularse si la usucapión se consolidó antes de ingresar por Ley a patrimonio natural de Estado y el plazo de la usucapión apta debe haber transcurrido antes de haberse producido la afectación, además esgrime los terrenos de bosques tienen una afectación inmediata por Ley a dominio público. Agravia la declaración de los testigos no demuestran la posesión decenal apta para usucapir en cabeza de su dueño. Transcribe precedentes judiciales y administrativos relativos a la supervivencia del derecho derogado para regular las situaciones jurídicas nacidas a su amparo. Cita voto de la Sala Constitucional 4587-97 y 15753-2005, [Telf1], 783-2003 relacionados al agravio referido. Agrega la imposibilidad de titular bienes de dominio publico y el impedimento de los particulares de ejercer posesión sobre estos bienes, así como la improcedencia de la usucapión y titulación, el principio de inalienabilidad, imprescriptibilidad.
Solicita, se imprueben estas diligencias. Igualmente peticiona sean rectificados las colindancias [Dirección3], [Dirección4] y [Dirección5] del inmueble, por existir quebradas y existiendo omisión en ese aspecto. Pide se adicionen las limitaciones del articulo 33 inciso b) de la Ley Forestal 7575 y se establezca que el cauce y las aguas de las corrientes de agua son de dominio publico IV- El agravio de la representación estatal radica en estimar, al tratarse de una zona con cobertura boscosa no es apta para usucapir , por ser parte del patrimonio forestal del Estado. Estas diligencias se formulan con la finalidad de inscribir en el Registro Público de la Propiedad el inmueble ubicado en [Dirección6] de la provincia de Puntarenas, mide 35 hectáreas 1256 metros cuadrados con 35 decímetros cuadrados, según plano 6-977419-2005, folio ( folio 1). Dicho bien no es parte de área silvestre protegida, conforme se indica en la certificación emitida por Sistema Nacional de Áreas de Conservación aportada como prueba (folio 2).
En el estudio de suelos que consta en autos (folio 61) se indica, se ha ejercido el uso conforme al suelo; al ser toda el área bosque secundario. Indicando en las observaciones, los bordes de las dos quebradas poseen zonas de protección. Agrega que en el sector C hay un área de aproximadamente 1500 metros cuadrados de potrero para que sirva como área de descanso para los caballos cuando la finca es visitada por turistas y en las recomendaciones apuntó: “Mantener el uso actual del suelo y en la zona denominada potrero, lo más recomendable es dejarlo como una zona de protección forestal”. El Juzgado practicó un reconocimiento judicial del inmueble el 21 de febrero del 2007 (folio 110) del que se levantó un acta que consignó : " Continuamos por un camino público con una distancia de unos doscientos cincuenta metros hasta donde llega el vehiculo , de ahí continúamos por un trillo hasta llegar a la colindancia sur de la propiedad.
En la parte alta de la finca se encuentra ubicado las áreas de potrero ya que la mayor parte de la finca es de repastos, hay como unas tres hectáreas de montaña, la cual está debidamente conservada , la finca colinda por el norte y sur con una Quebrada (sic) de por medio, cuya margen se encuentra protegido. La finca se encuentra deslinda (sic) con carriles de tres metros de años debidamente limpios, no hay construcciones ..”. La parte aporta fotografías ante esta instancia (folio 271 a 277), donde se muestra la zona de potrero rodeada por bosques, área mencionada por el estudio de suelos y el reconocimiento judicial. También se recibió la declaración del testigo [Nombre9] , (folio 107), [Nombre10] ( folio 108) y [Nombre11] ( folio 147). El primero indicó conocer la finca desde que era niño por haber nacido en el lugar, menciona la finca fue comprada a [Nombre8] en una parte y otra a [Nombre12] , quienes la tuvieron en posesión por más de 15 años y el actual poseedor hace uno o dos años.
Ubica correctamente la finca e indica mide aproximadamente 35 hectáreas. Una parte era de 15 hectáreas y la otra de 20 hectáreas en forma aproximada. Menciona a los colindantes, citando a [Nombre2] , [Nombre3] , [Nombre5] y [Nombre4] . Mencionó, la finca se ha dedicado a potrero y montaña, colinda en el sector suroeste con quebrada [Dirección7] , no le constan problemas de posesión del promovente, ni su anteriores poseedores, y manifiesta se ha ejercido la posesión en forma pacifica, pública y a título de dueño ininterrumpidamente. Los actos posesorios mencionados consistieron en darle mantenimiento a la finca, mantenerla deslindada con carriles de tres metros, y limpiándola una vez al año. Con área de montaña conservada y no le constan se tale el recurso forestal. El testigo [Nombre10] , depuso en forma coincidente con el anterior, indicando que conoce al promovente hacia como diez años, a su vez al transmitente [Nombre8] por ser su suegro desde hace como 22 años y a [Nombre12] hacia 10 años , y manifiesta haber trabajado en al finca.
Acredita la cadena de transmisión de la posesión por parte de [Nombre8] y [Nombre12] , que eran colindantes y le vendieron al promovente. Indica, [Nombre8] tuvo en posesión la finca por más de veinte años y para ese entonces [Nombre12] ya estaba allí. Ubica la finca en forma coincidente con el plano y el testigo anterior. Cita correctamente la medida aproximada de la finca, identificando las áreas de cada uno de los transmitentes al promovente. Agrega, conoce de la existencia de carriles de tres metros de ancho, que se limpian habitualmente y no conocer de conflictos de posesión con terceros, al haberse ejercido una posesión p ú blica, pacifica, a título de dueño e interrumpida. Los actos posesorios que le constan consisten en limpieza, mantenimiento, la finca tiene una área de montaña protegida y no conoce se hubiera extraído madera. El testigo [Nombre11] , manifestó tener 15 años de vivir en Purruja de Golfito y conoce el terreno del promovente, al haber sido de su padre [Nombre12] , indicando que su padre tuvo el terreno por unos 20 años y se lo vendió a [Nombre1] hacia como tres o cuatro años. Menciona las colindancias y un área de 35 hectáreas, no le constan reclamos por conflictos posesorios.
V- La recurrente agravi ó que las declaraciones de los testigos no demuestran la posesión decenal. No se comparte lo señalado por la representante estatal, respecto a esa falta de acreditación. No indicó en el recurso los motivos de su afirmación, sin embargo en aras de acreditar el cumplimiento de todos los requisitos de ley, se procederá a hacer el análisis de lo declarado por los tres testigos en este proceso. Los testimonios ya valorados en el considerando anterior, son coincidentes en demostrar la cadena de trasmisión que hicieran [Nombre8] y [Nombre12] de su posesión de más de diez años cada uno. El promovente adquirió el inmueble mediante ventas en escrituras publicas números quince (folio 5) y catorce (folio 6) otorgadas ante notario el día 5 de enero del 2005. En la escritura de venta de [Nombre8] , se le transmite una posesión de cuarenta y cinco años, según lo indica el documento de una área de terreno sin inscribir sin plano, situado en Purruja de Golfito, provincia de Puntarenas de doscientos mil metros cuadrados aproximadamente y en el segunda venta citada [Nombre12] transmite sus derechos posesorios sobre un terreno ubicado en la misma situación, con un área aproximada de ciento treinta y un mil metros cuadrados, indicando ser poseedor por mas de cuarenta y cinco años también.
El adquirente aprovechó la posesión ejercida por sus transmitentes y para ello aportó documento publico del traspaso de su derecho acode con el numeral primero de la Ley de Informaciones Posesorias. Los tres testigos citaron en forma coincidente, los transmitentes de la posesión fueron [Nombre8] y [Nombre12] y que tenían más de diez años de posesión, lo cual esta acorde con los documentos públicos aportados y lo manifestado por el promovente. Se rechaza el agravio de la recurrente VI- La apelante expresa que existe bosque casi en la totalidad de inmueble, según se desprende del estudio de suelos y por tal motivo alega la prohibición de titular bienes cubiertos de bosques, por ostentar el carácter de dominio publico. No lleva razón la apelante en su agravio. El estudio de suelos citado indicó que el terre n o esta cubierto de bosque secundario y contiene un potrero de aproximadamente 1500 metros utilizado para el descaso de los caballos que usan los turistas.
El estudio concluyó se estaba haciendo un uso conforme del suelo, lo mismo pudo ser verificado por la juzgadora de instancia en el reconocimiento judicial don d e ubica en las partes altas la zona de potreros y una zona de tres hectáreas, en forma aproximada de montaña. Las declaraciones de los testigos también indican no constarles exista tala del recurso forestal. De lo arrojado por esas declaraciones, el reconocimiento judicial y la certificación de suelos se denota que existe una actitud conservacionista por la promovente y sus anteriores transmitentes, cumpliéndose el numeral sétimo de la Ley de Informaciones Posesorias. De acuerdo a lo anterior, que el terreno al estar destinado a bosque forma parte del patrimonio natural del Estado, porque de conformidad con el artículo 856 del Código Civil, el fundo es apto para adquirir por usucapión. Por ende, conforme al artículo 7 de la Ley de Informaciones Posesorias, estima el Tribunal que efectivamente fue acreditado con la prueba aportada, el ejercicio de la posesión legal exigida sobre el fundo, con diez años de antelación a la fecha en la que se promovieron estas diligencias, y el terreno objeto de las presentes diligencias es apto para usucapir al encontrarse fuera de cualquier área silvestre protegida sea cual fuere su categoría de manejo y haber ejercido actos posesorios de conservación de los recursos naturales.
VII.Respecto al tema este Tribunal ha resuelto: " Relacionado con lo expuesto por la representación estatal, vinculada con el patrimonial forestal del estado, resulta oportuno hacer una breve referencia sobre el tema. Para ello, es oportuno citar el voto Nº51 de las 15 horas 15 minutos del 26 de mayo de 1995 de la Sala Primera de la Corte Suprema de Justicia, el cual en lo que interesa indica: " IX.- El patrimonio forestal del Estado incluye a todo el territorio nacional (artículos 4, 32 al 42), el cual a su vez se puede subdividir en tres áreas: A) La comprendida por el régimen forestal (artículos l, 2, 7, 47 a 54, 66 al 81) B) Los aprovechamientos forestales en terrenos de propiedad privada (artículos 43 al 46, 60 al 65, 82 al 91); y C) las reservas nacionales (artículos 32 y siguientes). Por su parte el régimen forestal -constituido por el conjunto de disposiciones de carácter jurídico, económico y técnico, encargado de darle un contenido a la conservación, protección y racional aprovechamiento de los bosques y terrenos forestales (artículo 7)- tiene también tres subáreas: A) zonas protectoras, B) parques nacionales, reservas forestales y biológicas y C) bosques y terrenos forestales.
X.- Con el nombre de reservas nacionales se identifica, a partir de la Ley de Tierras y Colonización Nº 2825 del 14 de octubre de l961, todas aquellas tierras denominadas por el Código Fiscal de l865, y luego por la misma Ley Nº l3 del 19 de enero de l939 (Colección de Leyes y Decretos, l939, I semestre, p. l0), como baldíos nacionales. Se trata de los inmuebles no sometidos a propiedad privada, no inscritos en el Registro Público de la Propiedad, en los términos de los artículos 267 y 486 del Código Civil (ver lo resuelto por la Corte Plena, en recurso de inconstitucionalidad de [Nombre13] contra la Ley de Tierras y Colonización, respecto de las normas de demasías, acordado en sesión extraordinaria del 25 de noviembre de l971). Estas tierras difieren de las tierras de dominio privado inscritas a nombre del Estado o de sus Instituciones, y se encuentran constituidas como remanente de las dos anteriores.
Originalmente, en la época de la Colonia, no fueron destinadas al servicio o uso público. Siguiendo los lineamientos del Código Civil la Ley General de Baldíos Nacionales Nº l3 del l0 de enero de l939 las declaró pertenecientes al Estado, dentro de los límites de la República, y que no hubieren sido adquiridos en propiedad mediante título legítimo por particulares (vgr. por usucapión), ni estuvieran inscritas en el Registro Público a nombre de ninguna persona -privada o pública-, ni destinadas al servicio público. La Ley de Tierras y Colonización Nº 2825 del l4 de octubre de l961 mantuvo la misma orientación, solo que amplió las declaradas, por la anterior ley, como inalienables (Artículo 7). En general esas reservas han tenido límites para poseerlas, así como límites -en cuanto a la superficie- para ser inscritas por medio de informaciones posesorias. En un principio su administración fue confiada a la Sección de Tierras y Colonias, del Departamento de Crédito Rural, Tierras y Colonias del Banco de Costa Rica, luego pasó al Instituto de Tierras y Colonización, y al entrar en vigencia la Ley Forestal Nº 4465 se concedió la administración del patrimonio forestal del Estado a la Dirección General Forestal creada en el Ministerio de Agricultura y Ganadería.
Hoy la Dirección General Forestal forma parte del Ministerio de Recursos Naturales, Energía y Minas (artículos 9 al 16). Todas las tierras consideradas como reservas nacionales quedan afectas en forma inmediata a los fines de la normativa forestal (artículos 32). Sobre ellas puede el Estado crear -por Ley o por Decreto Ejecutivo- reservas forestales, zonas protectoras, parques nacionales, refugios de vida silvestre y reservas biológicas, conformando así el patrimonio forestal (artículo 35). Para poder ser colonizadas o enajenadas se requiere autorización legislativa (artículo 40), y aún cuando fueren poseídas por terceros éstos no adquieren ningún derecho, siendo imprescriptible el derecho del Estado para reivindicar (artículo 33). Tienen las reservas nacionales una detallada regulación dentro del Capítulo "Del aprovechamiento del recurso forestal en terrenos del Estado y demás organismos de la administración pública".
Estos aprovechamientos en las reservas nacionales solo podrán practicarse por concesión otorgadas por la Dirección General Forestal (artículo 55 y 56). Las licitaciones se tramitarán de acuerdo a planes técnicos de manejo forestal, sujetos al cartel confeccionado por la Dirección (artículo 55 inciso a), otorgando garantía suficiente los concesionarios (artículo 56). Ninguna persona puede obtener concesiones del patrimonio forestal en cantidades superiores a las necesidades de materia prima que demuestre requerir. Son nulas las autorizaciones que se obtengan directamente o por medio de personas interpuestas, en contra de lo indicado (artículo 59). XI.- En una posición diametralmente opuesta a la de las reservas nacionales se encuentra la de la propiedad privada, denominada en la ley como "Del aprovechamiento del recurso forestal en terrenos de propiedad privada". Estas tierras, por intereses de orden social, forman parte del patrimonio forestal del Estado.
Esto es así porque los privados -funcionando bajo cualquier sistema (empresa agrícola o ganadera, para parcelación o colonización, tratándose de nacionales o extranjeros)- si dentro de sus planes de trabajo está la explotación forestal o la eliminación del bosque, en cualquier forma, deberán necesariamente obtener aprobación expresa de la Dirección General Forestal, en los términos de la Ley Forestal y del reglamento a la misma (artículo 60). Por ello el patrimonio forestal del Estado es aplicable a todos los bienes nacionales donde existan recursos naturales forestales. Para poder explotar sus propios recursos maderables los privados deben elaborar planes técnicos forestales, y la dirección les otorgará concesiones a largo plazo (artículo 6l). Lo anterior implica un sometimiento voluntario al régimen forestal. Esta es una presunción legal pues resulta ser la única alternativa del privado quien se encuentra impedido para talar árboles, aprovechar o explotar los productos forestales, dentro de su mismo bien, si previamente no hay autorización de la Dirección General Forestal (artículo 63 y 65).
Para estos efectos el Estado otorga una serie de incentivos para el manejo y reglamentación de los bosques y terrenos forestales de dominio particular, especialmente a través de los Certificados de Abono Forestal (artículos 82 al 86) y otros incentivos fiscales (artículo 87). Como la Dirección General Forestal debe contar con personal capacitado, guardabosques, y mantiene relaciones con las autoridades, ésta le brindará a los propietarios toda la colaboración necesaria para mantenerlos libres de invasiones y ocupantes (artículo 67)..." De lo anterior se desprende, el patrimonio forestal del Estado, se trata de los inmuebles no sometidos a propiedad privada, no inscritos en el Registro Público de la Propiedad, en los términos de los artículos 267 y 486 del Código Civil, según la referencia que se hace sobre lo indicado por la Sala Constitucional de la Corte Suprema de Justicia. Frente a este patrimonio, se encuentra también la propiedad privada.
La cual a lo largo de la evolución de la legislación forestal se concedió la oportunidad a poseedores de fundos, que ya habían consolidado su derecho de propiedad por usucapión a titularlos. Esa posibilidad se da a través del cumplimiento de los requisitos de la Ley de Informaciones Posesorias, y por ello se autoriza de manera expresa a titular terrenos ubicados en áreas silvestres protegidas cualquiera que sea su categoría de manejo a obtener título inscribible en el Registro Público, al comprobar el titulante de una posesión de más de 10 años antes de la fecha de vigencia de la ley o decreto en que se cree tal área silvestre (artículo 1 y 7 de la Ley de Informaciones Posesorias) (voto 100-F-09 del Tribunal Agrario). Aunado a ello, l a Sala Constitucional en el voto 1167-2010 denegó la consulta de constitucionalidad planteada contra esa norma.-
VIII- Por los motivos expuestos anteriormente, deberá admitirse la prueba para mejor resolver de fotografías presentadas ante esta sede de folio 271 a 277 y rechazarse las declaraciones juradas de folios 278 y 279 por resultar innecesarias para resolver esta apelación ; y confirmarse la sentencia por haberse acreditado el cumplimiento de todos los requisitos de ley. Y llevando razón la recurrente, en que sean corregidos los linderos de la finca a titular, por existir colindancias con cauces de agua que se observan en el plano, al norte, este y sur con quebradas. Deberá ser agregado que en el lindero norte, oeste y sur colinda también con quebrada en medio, cauce de agua que es de dominio público, y zona de protección que debe ser respetada conforme el artículo 33 de la Ley Forestal 7575. Igualmente debe ordenarse, sea respetada la prohibición de talar, construir, cultivar, o realizar cualquier actividad perjudicial para la protección del recurso hídrico o forestal, en las áreas de protección de las quebradas existentes en las colindancias, por estar afecta la finca a las limitaciones de la Ley de Aguas y Ley Forestal, Ley de Tierras y Colonización articulo 7 inciso c) y aquellas que consigna el artículo diecinueve de la Ley de Informaciones Posesorias.
Que el cauce de esas quebradas son de dominio público, conforme a los numerales 33 inciso b) y 34 de la Ley Forestal N° 7575, 1 incisos IV y 3 inciso III de la Ley de Aguas. Limitaciones de las cuales debe tomar nota el Registro Público y debe de ser indicado en la ejecutoria que se envía para esos efectos
POR TANTO:
Se admiten como prueba para mejor resolver las fotografías presentadas ante esta sede a folio doscientos setenta y uno a doscientos setenta y siete. Se rechazan las declaraciones juradas de folios doscientos setenta y ocho a doscientos setenta y nueve . Se confirma la sentencia en lo que ha sido objeto de apelación. Se revoca la sentencia en cuanto a los datos referidos a las colindancias por los rumbos norte, oeste y sur para que en su lugar el Registro haga constar que el inmueble colinda al norte con [Nombre5] , quebrada en medio, al oeste con [Nombre7] , [Nombre8] , quebrada en medio y al sur con [Nombre14] , quebrada en medio. Asimismo deberá consignar el Registro que de conformidad con el artículo 33 de la Ley Forestal 7575 s e ordena, sea respetada la prohibición de talar, construir, cultivar, o realizar cualquier actividad perjudicial para la protección del recurso hídrico o forestal, en las áreas de protección de las quebradas existentes en las colindancias, por estar afecta la finca a las limitaciones de la Ley de Aguas y Ley Forestal, Ley de Tierras y Colonización articulo 7 inciso c) y aquellas que consigna el artículo diecinueve de la Ley de Informaciones Posesorias.
Se declara el cauce de esas quebradas son de dominio público, conforme a los numerales 33 inciso b) y 34 de la Ley Forestal N° 7575, 1 incisos IV y 3 inciso III de la Ley de Aguas , l imitaciones de las cuales debe tomar nota el Registro Público y debe de ser indicado en la ejecutoria que se envía para esos efectos.
