VOTO N° 0088-F-09 VOTO N° 0088-F-09 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, at fifteen hours and forty-five minutes on the twenty-fourth of February, two thousand and nine.
POSSESSORY INFORMATION PROCEEDINGS (diligencias de información posesoria), filed by PORTOCITO DOMINICAL, SOCIEDAD ANÓNIMA, corporate tax identification number CED1 - -, represented by its president with powers of attorney-in-fact with unlimited authority (apoderado generalísimo sin límite de suma), Luis Garino Granados, an adult, married, attorney, national identification number CED2 - -, resident of San José. The INSTITUTO DE DESARROLLO AGRARIO and THE STATE appear as parties, represented by Annie Alicia Saborío Mora, an adult, divorced, holder of a master's degree in business administration, resident of San José, national identification number CED3 - -, and by Lydiana Rodríguez Paniagua, in her capacity as deputy attorney general (procuradora adjunta), whose personal details are not recorded in the file, respectively. The judgment is drafted by Judge Ulate Chacón; and,
CONSIDERING:
III.The deputy attorney general, Lydiana Rodríguez Paniagua, appealed on the following grounds: 1. Forest lands and forests within national reserves (reservas nacionales) form part of the State's natural heritage (patrimonio natural del Estado), at least since the Ley Forestal 4465 of 1969; even though forestry legislation permits the titling of real property outside protected wildlife areas (áreas silvestres protegidas), that declaration of public domain (dominio público) must be taken into account, so that forests may only be titled if adverse possession (usucapión) had been consolidated prior to their incorporation into the State's natural heritage; she argues that in this case the witness testimony does not demonstrate ten-year possession (posesión decenal) sufficient for adverse possession on the part of the petitioner; 2. She argues there is a contradiction between the judicial site inspection (reconocimiento judicial) and the land-use certificate (certificado de uso de suelos), due to the extent of the forest and mountain hectares; furthermore, the land-use certificate was made subject to future conditions, with no certainty that possession has been exercised in compliance with the permitted land use for the activity being carried out, invoking the application of articles 58 and 160 of the regulations under the Ley de Uso, Manejo y Conservación de Suelos. 3) Regarding the content of the ruling, she indicates that there is a material error, because it records the area adjacent to the "[Dirección6]," when the correct wording should be "[Dirección7]"; and she further requests that the judgment be supplemented to indicate that the right-of-way (derecho de vía) of the public road is 14 meters in accordance with the Ley General de Caminos Públicos and Art. 19, subsection a) of the Ley de Informaciones Posesorias.
IV.With regard to the first two grounds of appeal, the appellant is mistaken. While it is true that the Ley de Tierras y Colonización of 1961 and the Ley Forestal of 1969 established that forest-covered lands without private occupation were part of the national reserves, that encumbrance upon the public domain has evolved in step with the development of human rights, and specifically with the incorporation of third-generation rights, which include the human right to a healthy and ecologically balanced environment. The Ley Forestal of 1996 amended article 7 of the Ley de Informaciones Posesorias to permit adverse possession of forest-covered land, provided that ecological possession (posesión ecológica) is demonstrated through conservation of the forest resource (recurso forestal) for more than ten years, and allowing credit for transferred possession (see judgment of the Sala Constitucional No. 4587-97). The Agrarian Tribunal had previously held that such possession must be of a personal character, but the Sala declared that position unconstitutional.
V.On the matter of interpreting Article 7 of the Ley de Informaciones Posesorias and the Natural Heritage of the State (Patrimonio Natural del Estado), this Court has repeatedly stated in its decisions: "The Ley de Informaciones Posesorias, in its Article 7, as well as the Leyes Forestales, have sought to protect forest resources (recursos forestales) from human activity, subjecting them to various forms of forest management (manejo forestal). Although the titling (titulación) of such areas has been permitted—areas that, once declared conservation areas, become part of the State Forest Patrimony (Patrimonio Forestal del Estado)—more stringent requirements must be met. This leads us directly to the concept of ecological possession (posesión ecológica) and the criterion of the ecological function of forest property (propiedad forestal). In repeated rulings, both from the Sala Primera de Casación and from the Tribunal Superior Agrario itself, the principles that must govern the resolution of these types of agro-environmental situations have been established.
Our country has been a pioneer in the development of the legal institutions (institutos) of agrarian possession (posesión agraria) and ecological possession. The same body of case law has recognized and developed these institutions, as well as the life cycle of agrarian possession and, more recently, of ecological possession (within the broader criterion of the ecological function of forest property). The same body of case law has sought to distinguish commercial ownership and possession—in which an activity directed at forest cultivation is carried out—from that in which merely extractive or purely conservational activity takes place. In the latter cases, one would be dealing with forest property or forest possession (posesión forestal) (without a commercial enterprise). It is precisely in these cases that the Ley Forestal establishes a comprehensive legal framework for the protection of forest resources, sometimes subjecting the owner to the forest regime (régimen forestal) on a mandatory basis and in other cases on a voluntary basis.
Thus, in forest possession, de facto control is exercised over property of forest vocation or property mostly dedicated to protecting forest resources, without the intent to exploit it, or by devoting it to the mere extraction of timber species through management plans (planes de manejo) to achieve the natural regeneration of the forest. In either case, there would be no development of a plant or animal biological cycle, nor would any person assume any risk. For this reason, the law does not protect—but rather suppresses—possession through which the forest resources of protected areas are destroyed. Furthermore, it denies the possibility of acquiring possessory rights over national reserve lands when harmful action has been taken against forest resources. Today, part of agrarian legal doctrine affirms the existence of Forest Law as a body of law with the characteristics of an organic and comprehensive system, in which the institutions of forest property and forest possession occupy an important place.
In Costa Rica, forest property, and likewise forest possession as a real right (derecho real) derived from it or independently conceived, began to take shape with the Código Fiscal de 1885, which devotes an entire chapter to forests, the regulations of which are aimed at their conservation. Subsequently, the Ley de Terrenos Baldíos No. 13 of January 6, 1939 incorporated those principles. Later, the Ley de Tierras y Colonización, in its Article 7, expanded the national reserves for the protection of such resources.- VII. Special legislation regarding the protection of forest property and forest possession has gone through three stages in our country. The first stage of forest property is marked by Ley No. 4465 of 35 November 1969. The second opens with better-conceived legislation through Ley No. 7032 of April 7, 1986, which was subsequently declared unconstitutional. The last stage operates with the enactment of Ley Forestal No. 7174 of June 28, 1990, recently amended by Ley No. 7575 of February 13, 1996 (published in supplement 21 of La Gaceta No. 72 of Tuesday, April 16, 1996).
These laws contain various forest property regimes and limit the use and exploitation of resources by private individuals. It is not possible to acquire title (titularidad) over lands with forest cover (cobertura boscosa) without demonstrating that the forest resource has been protected. Its constitutional basis is found in the second paragraph of Article 45 of the Constitution. Through social-interest limitations, the institution of forest property and forest possession is protected. Forest property is not the same as civil or agrarian property; it is property meant for conservation, and therefore the possessory acts carried out on it must serve that purpose.- VIII. Forest possession has had its legal framework in the Leyes Forestales mentioned above. It applies to a specific type of property: lands covered by forests or of forestry suitability (aptitud forestal). The owner or possessor of such property has the obligation to conserve forest resources and may not exploit them economically except under the restrictions or limitations imposed by law.
For the legal resolution of conflicts arising from the exercise of forest possession, that special legal framework and the principles of Forest Law must be applied. The Ley Forestal establishes as an essential function and priority of the State the oversight of the protection, conservation, use, industrialization, administration, and development of the country's forest resources, in accordance with the principle of rational use of renewable natural resources. (Article 1). All lands of forestry suitability and all forests in the country, whether state-owned or reduced to private ownership, are subject to the purposes of the law. The forest regime is the set of provisions—legal, economic, and technical, among others—established by the law, its regulations, and other rules, governing the conservation, renewal, use, and development of the country's forests and lands of forestry suitability. Therefore, to acquire forest property through adverse possession (usucapión), the exercise of forest possession is required.
Article 7 of the Ley de Informaciones Posesorias, as amended by the Ley Forestal, provided, prior to its subsequent amendment: "Article 7.- When the property to which the proceeding refers falls within an area declared a national park (parque nacional), biological reserve (reserva biológica), forest reserve (reserva forestal), or protected zone (zona protectora), the titling party (titulante) must demonstrate having exercised ten-year possession (posesión decenal) at least ten years prior to the effective date of the respective law or decree by which the respective wildlife area (área silvestre) was created. Properties lying outside those areas that contain forests may only be titled if the applicant (promovente) demonstrates having possessed them for ten years or more and having protected said natural resource, with the understanding that the property must be properly demarcated (deslindado) with fences or boundary lanes (cercas o carriles)." In other words, de facto control in forest possession is exercised over the natural resource of 'forests' or 'lands of forestry suitability,' and possessory acts must be directed toward their protection and conservation.
Only if this is demonstrated may lands be acquired or registered in favor of such possessors. Otherwise, they would remain part of the Natural Heritage of the State (Article 13 of the new Ley Forestal), non-attachable (inembargable) and inalienable, and their possession shall give rise to no right whatsoever in favor of private individuals (Article 14 of the new Ley Forestal).- IX. The Tribunal Agrario had interpreted Article 7 of the Ley de Informaciones Posesorias, before its amendment by the new Ley Forestal, as requiring personal possession exercised at least ten years prior to the creation of the forest reserve or protected area (see in this regard Votos No. 169 of 9:40 a.m. on March 22, 1991, and No. 251 of 2:00 p.m. on April 17, 1991)...". However, that interpretation of Article 7 of the Ley Forestal was challenged as "unconstitutional" by the titling party in this case, and the Sala Constitucional, in Voto No. 4587-97 (published in Boletín Judicial No. 188 of October 1, 1997), ruled, in the relevant part, as follows: "The action is declared partially with merit and, consequently, the interpretation of Article 7 of the Ley de Informaciones Posesorias No. 139 of July 14, 1941—whose text corresponds to the amendment introduced by Ley Forestal No. 7174 of June 28, 1990—is declared unconstitutional insofar as it requires, in order to title lands within national parks, biological reserves, forest reserves, or protected zones, personal possession at least ten years prior to the effective date of the law or decree creating the protected wildlife area (área silvestre protegida), and does not allow possession transmitted by prior possessors to count in such cases.
This ruling is declaratory and has retroactive effects, without prejudice to rights acquired in good faith...". Thus, current possessors may benefit from transmitted possession...X. Ley Forestal No. 7575 also maintained the restrictions in the Ley de Informaciones Posesorias for the titling of lands within protected areas. In this regard, the current provision states: "Article 7.- When the property to which the proceeding refers falls within a protected wildlife area, whatever its management category (categoría de manejo), the titling party must demonstrate holding legal title to the rights arising from ten-year possession exercised at least ten years prior to the effective date of the law or decree by which that wildlife area was created." (Emphasis added). That is, the legislative intent is that those areas shall have remained protected and conserved throughout all this time, even before the creation of the Reserves and protected areas...". (Decision of 2:50 p.m. on February 20, 1998, corresponding to Voto No. 113).
V.In more recent cases, the Court has rejected the arguments now reiterated by the appellant regarding the alleged retroactive interpretation or application of Article 7 of the Ley Forestal. In a case similar to the one before us, it was held: V.- Regarding the argument raised by the appellant that the trial court erred in applying Article 7 of the Ley de Informaciones Posesorias—which the appellant considers to have been declared unconstitutional, such that the proceedings (diligencias) should be analyzed in light of Article 1 of said Law—this Court finds that the appellant is incorrect, since Article 7 was not declared unconstitutional; rather, it was the interpretation previously applied by the Court—whereby the possession exercised by prior transferors was not counted—that was found to be unconstitutional. Therefore, since Article 7 of the Ley de Informaciones Posesorias remains in force, the applicant must demonstrate ten-year possession prior to the declaration of the protected wildlife area, as indicated by the Sala Constitucional in Voto No. 4587-97 (published in Boletín Judicial No. 188 of October 1, 1997).
It is important to note that the law is not being applied retroactively, as the appellant claims, because the ten-year possession period for adverse possession is established in the Código Civil, and the provision in question merely highlights certain elements inherent to adverse possession that are also defined in the general body of law, namely: the object of possession and the conditions under which it must be exercised in order to qualify for adverse possession.
In that regard, it is important to note what the Sala Constitucional stated in the cited ruling: "…Article 7, first paragraph, of the Ley de Informaciones Posesorias that is challenged — whose text predates the most recent amendment by Ley Forestal No. 7575 of February 13, 1996 — governs the land titling (titulación) of real property (bienes inmuebles) located within an area declared a national park, biological reserve, forest reserve, or protected zone. That article provides that the land-title applicant (titulante) must demonstrate having exercised ten-year possession (posesión decenal) for at least ten years prior to the effective date of the law or decree that created the wildlife area (área silvestre). The challenged provision governs the titling of real property that has been dedicated to the public domain (dominio público) through a declaration as a protected wildlife area, regardless of its specific category.
It is now necessary to determine whether, under the hypothesis contemplated by the challenged provision, and in light of the doctrinal and jurisprudential criteria governing the institutions of adverse possession (usucapión) and the possession required for adverse possession, as set forth above, the challenged provision regulates a special type of possession required to acquire ownership of real property — one that imposes specific requirements that may infringe upon the right to property or the principle of non-retroactivity (irretroactividad) of the law to the detriment of acquired rights (derechos adquiridos) or consolidated legal situations (situaciones jurídicas consolidadas), as regulated in the Constitution. First, it must be noted that the challenged article does not modify — either increase or decrease — the ten-year possession period required for adverse possession, as established in Article 860 of the Civil Code (Código Civil) for the general category of cases in which ownership of real property is sought through acquisitive prescription (prescripción positiva).
The extension of the period that the petitioner alleges as an infringement of the right to property does not in fact occur, because, given the nature of the property sought to be titled — a public thing — the possession period capable of giving rise to adverse possession must elapse before the property is dedicated to the public domain. That is to say, the declaration as a protected wildlife area prevents any possession occurring after the dedication from being counted, and bars completion of the requirements for adverse possession if, at that moment, the right has not yet been acquired — meaning the ten years of possession capable of giving rise to adverse possession, under the conditions established by law, have not yet elapsed. This is merely the natural result of applying the concepts governing the object of possession and the conditions under which it must be exercised in the capacity of a title holder — conditions necessary for possession ad usucapionem.
It must be recalled that properties dedicated to the public domain, whatever their specific category, are not susceptible to acquisition through adverse possession if, prior to the dedication, the conditions necessary for the acquisition of the right had not been met. In that regard, the challenged provision, despite appearing to regulate a specific case of adverse possession, does not create a regime with requirements different from those established in the Civil Code for the general run of cases. Accordingly, the alleged retroactive effect of the provision does not arise either, because the ten-year possession period for adverse possession is established in the Civil Code, and the challenged provision simply highlights certain elements intrinsic to adverse possession that are also defined in the general legislation — namely: the object of the possession and the conditions under which it must be exercised in order to be capable of giving rise to adverse possession.
In other words, the provision does not establish any different principle — or more stringent requirement — with respect to the application of the general rules of adverse possession. It merely specifies how those rules are to be applied, which is consistent with a logical outcome given the public domain property (bien demanial) status of the object to be titled. Therefore, it is not considered that the amendment to Article 7 of the Ley de Informaciones Posesorias, the text of which is challenged, introduced a different regime with respect to the requirements for adverse possession that could have worsened the situation of persons who were exercising possession ad usucapionem over land that was declared to be of public interest." (Tribunal Agrario, No. 173 de las 16:29 horas del 31 de marzo del 2003).
VI.Accordingly, a possessor seeking to acquire through adverse possession (usucapión) a tract of forested land that formed part of the national reserves must demonstrate ten-year possession (posesión decenal) — whether original or transferred — and must have conserved the forest resources. In this case, the Procuradora states that "The witness statements do not establish the ten-year possession required to obtain title by adverse possession in the petitioner's name." However, this is not the case. Witness [Nombre7] stated: "I have known this property since 1975, when it belonged to Mr. [Nombre8] — I correct that, [Nombre9] — who held it for about fifteen years; in fact, when I arrived he was already on the land. Don [Nombre9] later sold it to [Nombre10], who possessed it until about a year ago, when he sold it to the petitioning company..." (folio 59). Regarding the ecological possession (posesión ecológica) required by the Ley Forestal, the witness states: "...it has a wooded area that is protected, an area of secondary growth (tacotal), and the rest is pasture (potrero)..." (folio 59 vuelto).
Deponent [Nombre11] stated that he has known the property for more than fifteen years, when it belonged to [Nombre9], who sold it to [Nombre10], who in turn sold it to the petitioning company about two years ago; the company has devoted it to cattle ranching and to conservation of the woodland, keeping it well demarcated with fences and clear boundary lanes (carriles) (see folio 60). And witness [Nombre12] states that he has known the farm (finca) for fourteen or fifteen years, that it belonged to [Nombre9], who then transferred it to [Nombre10], who sold it to the petitioning company; he indicates that the possessors have devoted themselves to maintaining livestock, clear boundary lanes, and fences, and expressly states that it has a wooded area that is kept tended and protected (folio 60). As may be observed, the possession therefore dates back more than thirty years, to approximately 1975, with productive agricultural activity in the form of cattle ranching having been carried out on the estate (fundo), while the forest resources were simultaneously conserved.
The Procuradora could not properly demand that a personal ten-year possession be shown solely on the part of the titling applicant, as that would in fact conflict with the constitutional jurisprudential standard that permits adverse possession by aggregating transferred possession.
VII.As to the second ground of appeal (agravio), this Tribunal likewise finds no violation of the provisions of the Ley de Uso, Manejo y Conservación de Suelos and its implementing regulations. It is well known that in a judicial site inspection (reconocimiento judicial), the measurements recorded are approximate, not exact, unless a GPS measurement was performed. The official record states the following: "Said stream is well protected along its banks with abundant vegetation and trees. We continued the inspection along the western boundary from [Dirección8], per the map, to [Dirección9], where the boundary lane was observed to be clear and in good condition. From [Dirección9] the same lane continues, additionally with a three-strand barbed-wire fence on live and dead posts, until reaching [Dirección10] where we began the inspection. The property is for the most part devoted to pastures but in its northern and western sections it has approximately ten hectares of woodland with primary forest (bosque primario), whose resources are clearly very well tended and duly protected without environmental harm....".
From the foregoing it follows that the area of land indicated by the judge during the inspection was in fact approximate, because if the reference points on the survey map are taken into account, one inevitably reaches the conclusion that most of the boundaries, particularly on the [Dirección11] side, are boundary lanes where woodland is present. The Tribunal therefore finds no contradiction with the findings of the soil study, which is in fact favorable to the titling applicant, as it clearly concluded that "In accordance with article 58 of the Regulations to the Ley de Uso, Manejo y Conservación de Suelos, No. 7779 of 30 April 1998, and on the basis of a field visit, this office verifies that on the farm POSSESSION HAS BEEN EXERCISED in compliance with the conforming land use (uso conforme del suelo) for the activity carried out, in accordance with the approved methodology" (folio 17).
The same study reveals that there are fourteen hectares of forest in Sector A, and that in Sector B there is forest and pastureland (repastos), which gives rise to the presumption that forest undergoing natural regeneration is also present; it is for this reason that technical recommendations are issued, as is standard practice in this type of analysis. In conclusion, the Procuradora is not correct with respect to the aforementioned grounds of appeal, as ecological adverse possession (usucapión ecológica) and conforming land use have been established.
VIII.Regarding the objections raised against the content of the challenged ruling, this Tribunal finds that there is indeed a clerical error (error material) in the operative section (parte dispositiva) of the judgment (folio 120), which refers to "Quebrada El 20" when it should read "Quebrada Kilómetro 20"; this error must be corrected in accordance with article 161 of the Code of Civil Procedure prior to issuing the certified copy of the writ of execution (ejecutoria). Regarding the matter of [Dirección12] road, the request is hereby granted, given that the ruling does not indicate that the property (inmueble) borders a public road to the east; accordingly, the following must be added to the eastern boundary: [Nombre1], [Nombre4], and [Dirección13], with a width of fourteen meters.
POR TANTO:
The appealed judgment is affirmed, it being understood that the correct name of the stream is "Quebrada Kilómetro veinte," and it is added that the eastern boundary with [Dirección12] road has a width of fourteen meters.
ENRIQUE ULATE CHACÓN DAMARIS VARGAS VÁSQUEZ ALEXANDRA ALVARADO PANIAGUA DISSENTING VOTE OF JUDGE ALEXANDRA ALVARADO PANIAGUA.
The majority vote approving the possessory title proceeding (información posesoria) regarding lands consisting of forests is not concurred in, inasmuch as those lands are part of the State's Natural Heritage and it was not demonstrated that ten-year possession (posesión decenal) had been exercised prior to the designation of that asset under the public domain (demanial) regime. The public domain (Dominio Público) — in the case before us — is the body of assets of public ownership belonging to the State, broadly construed, designated for the direct or indirect public use of the inhabitants, and subject to a special public-law regime that is therefore exorbitant of private law. The public domain is composed of four elements: subjective, objective, normative, and teleological. The subjective element refers to the holder of the right — the State —; the objective element refers to or consists of the asset or assets upon which the public domain falls — in this case, the property in dispute —; the normative element determines when an asset meets the requirements set by law to be considered a public domain asset (demanial), and it is the body of rules governing it — the list of rules to be set forth below —; and the teleological element refers to the purpose pursued by including a given asset within the public domain, that is, what public purpose is assigned to the asset — in this case, the protection of natural resources.
Public domain assets (bienes de dominio público) are subject to a special legal regime, are subject to police power, and are characterized essentially by their inalienability (inalienabilidad) and imprescriptibility (imprescriptibilidad). By their nature they are directed at satisfying public needs; this fact prevents private individuals or persons from holding tenure or possession over them, and they are outside the realm of private-law commerce. Our Political Constitution, in Article 121, paragraph 14), refers to public domain status (demanialidad), indicating which assets may be subject to that regime of public ownership, with that article even establishing different degrees of public designation (afectación) — ranging from an intense and absolute degree of publicatio to lesser degrees — while harmonizing the rights of individuals with the powers of the Administration. Our current Civil Code, dating from April of eighteen hundred and eighty-six, regulates the most important foundations in the area of public domain assets, specifically in Articles 261 through 263.
Article 262 of the aforementioned Civil Code refers to two important characteristics of public domain assets: a) public things are outside commerce; and b) removal from public domain (desafectación) is established by providing that those assets may not enter private commerce until legally determined otherwise. As can be observed, designation under the public domain regime does not depend on the nature of the asset, but rather on the will of the legislature. By Voto 447-91, issued at three-thirty in the afternoon on February 21, 1991, the Constitutional Chamber stated that the declaration of an asset's public domain status is established by law, and that this declaration does not constitute a limitation on property within the meaning of Article 45 of the Constitution, since that article refers to private property, and public domain assets are not subject to private ownership. The State Forest Heritage (Patrimonio Forestal del Estado) is a public domain asset regulated by a broad body of rules that has historically and up to the present day prohibited private individuals from performing any kind of work on lands bearing that characteristic, and as a consequence denied them the right of possession, with one specific exception to be described below.
The lands constituting National Reserves (Reservas Nacionales) that contain forests are considered State Heritage — in their capacity as public domain property entailing the principles of imprescriptibility, non-attachability (inembargabilidad), and inalienability. The foregoing finds its normative development in the citations set forth below:
Any act of that kind, if the applicable legal formalities have not been previously completed and the corresponding authorization obtained, shall be considered, as the case may be, usurpation of public domain or trespass, and the authorities shall order the destruction and removal of the fences and prevent the use of those lands, without entitlement to compensation or claims for the value of improvements, and without prejudice to other liabilities that may arise against those who commit such violations." — It should be noted that this article imposes criminal penalties on anyone who enters a National Reserve to carry out any activity on those lands, so that such conduct cannot be regarded as an act of possession, since the activity would be unlawful. — Article 11 of that same Law provides that the following belong to the State as National Reserves: "a) All lands within the boundaries of the Republic that are not registered as private property, as municipal property, or as property of Autonomous Institutions. b) Those not supported by ten-year possession. c) Those that, by special laws, have not been designated for the formation of agricultural colonies. d) In general, all lands that, not being private property, are not occupied in public services." — For its part, Art. 19 of the repealed Ley Forestal Number 4465 of November twenty-third, nineteen sixty-nine provided: "All forests and forest lands (terrenos forestales) located in the following are designated for the purposes of this law: 'a) Lands considered National Reserves...'" And Article 25 of that same law stated: "Possession of lands located in National Reserves and State properties referred to in Art. 19 of this Law shall confer no rights of any kind, and the State's reivindicatory action (acción reivindicatoria) over them is imprescriptible; the General Forestry Directorate, by means of the legal instruments at its disposal, shall proceed to evict from such lands those persons who occupy them in whole or in part, in the event that the areas involve protected zones, National Parks, Forest Reserves, and Biological Reserves." — These rules confer on the forests mentioned therein a double protection: first, by virtue of their status as National Reserves, in which any possessory act is prohibited; and second, by constituting State Forest Heritage, in which no act of possession shall confer any right of any kind.
This is confirmed by Article 8 of the Regulations to that law, which states: "National lands within areas declared Forest Reserves are inalienable, meaning they may not leave the State's domain, and their possession shall confer no right of any kind in accordance with the provisions of Articles 25, 49, and 57 of the Ley Forestal." — Article 80 of the aforementioned repealed Ley Forestal provided: "The invasion and occupation of lands in National Parks, Forest Reserves, and Protected Zones is prohibited. This prohibition extends to National Reserves until their classification and transfer have been determined..." Article 6 of that same law provided: "The following shall be punished with imprisonment of six months to two years or a fine of fifteen to one hundred days, the person who: a) Exploits a forest forming part of forest heritage without the corresponding legal authorization... b) Invades a National Park, Biological Reserve, Protected Zone, or Forest Reserve...
If the invasion is in National Reserves, the person shall be subject to the provisions of Article 227 of the Código Penal." — As can be observed, possessory acts carried out in a forest constituting State heritage are unlawful and therefore cannot confer any right of possession. — With the entry into force of Ley Forestal Number 7174 of June 28, 1990, this same approach continued. Article 32 of that law provides: "The State Forest Heritage consists of all forests and forest lands of the National Reserves..." Article 33 of that same law provides: "The forest lands and forests constituting the State Forest Heritage detailed in the preceding article shall be non-attachable and inalienable; their possession by private individuals shall confer no right whatsoever in their favor, and the State's reivindicatory action over those lands is imprescriptible. Consequently, they are not susceptible to registration in the Public Registry through a possessory title proceeding; their invasion and occupation shall be punished as provided in this Law." — With the current Ley Forestal in force, Ley 7575 of February 5, 1996, Title II regulates a single chapter devoted exclusively to the State's Natural Heritage (Patrimonio Natural del Estado), embodying the same approach that had begun in 1865 with the Código Fiscal, and this new legislation reiterates that the State's Natural Heritage shall consist of forests and forest lands of the national reserves, of areas declared inalienable, and of properties registered in the name of the Public Administration.
Article 14 of that same Ley Forestal in force is emphatic in stating that the forest lands and forests constituting the State's Natural Heritage are imprescriptible, non-attachable, and inalienable, and that their possession by private individuals shall confer no right whatsoever in their favor. The Ley de Conservación de la Vida Silvestre Number 7317 of October 21, 1972, in Articles 3 and 4, in addition to declaring wild fauna and wild flora, respectively, as public domain and of public interest, states that wild flora and fauna are part of the National Heritage. In the same vein, the Ley de Biodiversidad Number 7788 of April 30, 1998, in Article 6, declares the elements of biodiversity to be public domain assets, as does the Ley Orgánica del Ambiente in Article 46, which establishes the State's sovereignty over biological diversity. For the foregoing reasons, it is a legal imperative to deny the right of possession to those persons who have carried out any activity on lands not subject to private ownership that consist of forests in National Reserves. — To that imperative prohibition, the Ley Forestal Ley 7575 of 1996, which amends Article 7 of the Ley de Informaciones Posesorias, establishes an exception to the approach set forth thus far: it makes possible the titling of forests where what is understood as ecological possession (posesión ecológica) has been developed within them.
The land subject to this possessory title proceeding (información posesoria) constitutes State Natural Heritage (Patrimonio Natural del Estado), as it is composed of forest cover (cobertura boscosa), as is apparent from the soil study appearing at folios 16 and 17 and the judicial inspection at folios 61 and 62, in which it is indicated that the land consists of approximately thirty-eight hectares of mountainous terrain according to the technical soil study, and 4.56 hectares of pasture (repasto), which implies that the overall nature of the land is predominantly forest. It is clear that said land constitutes State Natural Heritage from a time prior to the creation of those Decrees, as was already set forth in the regulatory history above. When possession of a public domain property (bien demanial) is in dispute, such a dispute can only be entertained when the right was acquired before the property was declared to be in the public domain (dominio público).
Likewise, the right of ownership in such cases may only be obtained when the holder has demonstrated ten-year possession (posesión decenal), exercised at least ten years prior to the effective date of the law that declares the property to be State Natural Heritage. As the legal chronology protecting State Natural Heritage has already been set forth, the law that must be taken into account for calculating the ten-year possession of private individuals is the Ley de Tierras y Colonización número 2825 del 14 de octubre de 1961, which is currently in force. The Código Fiscal de 1865 and the Ley de Terrenos Baldíos de 1939 must not be considered, as they were provisions that addressed the subject matter in a general manner and, furthermore, they are not currently in force; it is not until the current Ley de Tierras y Colonización that State Property or State Natural Heritage is clearly defined and regulated.
Subsequent laws such as Ley Forestal and others cited in this considerando are complementary to the aforementioned Ley de Tierras y Colonización. In the present case, the testimonial evidence gathered does not demonstrate such ten-year possession within the terms of the regulations set forth herein; it is for this reason that this dissenting vote (voto salvado) is recorded, to state that the petitioner (promovente) was required to demonstrate ten years of possession prior to the Ley de Tierras y Colonización, and therefore the possessory title proceeding should have been dismissed, reversing the judgment on appeal.

VOTO N° 0088-F-09 VOTO N° 0088-F-09 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las quince horas cuarenta y cinco minutos del veinticuatro de febrero del dos mil nueve.
DILIGENCIAS DE INFORMACIÓN POSESORIA, promovido por PORTOCITO DOMINICAL, SOCIEDAD ANÓNIMA, cédula de persona jurídica número CED1 - - , quien es representada por su presidente con facultades de apoderado generalísimo sin límite de suma por Luis Garino Granados, quien es mayor, casado, abogado, cédula de identidad número CED2 - - , vecino de San José. Intervienen como partes el INSTITUTO DE DESARROLLO AGRARIO, y EL ESTADO, representados por Annie Alicia Saborío Mora, mayor, divorciada, máster en administración de negocios, vecina de San José, cédula de identidad número CED3 - - , y por Lydiana Rodríguez Paniagua, en su condición de procuradora adjunta, y de calidades desconocidas en autos, respectivamente. Actúan como apoderados especiales judiciales del promovente los licenciados Norman De Pass Ibarra, mayor, casado, abogado, vecino de Santa Ana, cédula de identidad número CED4 - - , y Luis Alberto Canales Cortes, mayor, casado, abogado, vecino de Puntarenas, cédula de identidad número CED5 - - quinientos setenta y cinco.
RESULTANDO:
Redacta el juez Ulate Chacón; y,
CONSIDERANDO:
III.La procuradora adjunta, Lydiana Rodríguez Paniagua apeló aduciendo lo siguiente: 1. Los terrenos forestales y bosques de las reservas nacionales son patrimonio natural del Estado, al menos desde la Ley Forestal 4465 de 1969, aún cuando la legislación forestal permite titular inmuebles fuera de áreas silvestres protegidas, debe tenerse en cuenta dicha declaratoria de dominio público, de modo que los bosque solo pueden titularse si la usucapión se había consolidado antes de su ingreso al patrimonio natural del Estado, aduciendo en este caso las declaraciones de testigos no demuestran posesión decenal apta para usucapir en cabeza del promovente; 2. Aduce hay contradicción entre el reconocimiento judicial y el certificado de uso de suelos, por la dimensión de las hectáreas de bosque y montaña, además, el certificado de uso de suelo quedó sujeto a condiciones futuras, sin tener certeza de que la posesión se ha ejercido cumpliendo con el uso conforme para la actividad que se realiza, invocando la aplicación de los artículos 58 y 160 del reglamento a la Ley de Uso, Manejo y Conservación de Suelos. 3) En cuanto al contenido de la resolución, indica que existe un error material, porque consigna el área contigua a la "[Dirección6] , siendo lo correcto "[Dirección7] "; y además pide se adicione el fallo para que se indique el derecho de vía de la calle pública es de 14 metros conforme a la Ley General de Caminos Públicos y 19 inciso a) de la Ley de Informaciones Posesorias.
IV.En relación a los dos primeros agravios, no lleva razón la recurrente. Si bien es cierto, la Ley de Tierras y Colonización de 1961 y la Ley Forestal de 1969, establecían que los terrenos cubiertos de bosque, sin ocupación privada eran parte de las reservas nacionales, dicha afectación al dominio público ha venido cambiando conforme la evolución de los Derechos Humanos, y específicamente con la incorporación de los de tercera generación, en los cuales se incluye el derecho humano a un ambiente sano y ecológicamente equilibrado. La Ley Forestal de 1996 reformó, el artículo 7 de la Ley de Informaciones Posesorias, para permitir la usucapión, en terrenos cubiertos de bosque, pero demostrando una posesión ecológica, a través de la conservación del recurso forestal, durante más de diez años, pudiéndose aprovechar la posesión trasmitida (ver sentencia de la Sala Constitucional No. 4587-97). El Tribunal agrario sostuvo el criterio de que dicha posesión debía ser de carácter personal, pero la Sala declaró que el mismo era inconstitucional.
V.Sobre al tema de la interpretación del artículo 7 de la Ley de Informaciones Posesorias, y el Patrimonio Natural del Estado el Tribunal en reiteradas resoluciones ha expresado: “La Ley de Informaciones Posesorias, en su artículo 7, así como las Leyes Forestales han procurado proteger los recursos forestales de la acción humana, sometiéndolos a diversas formas de manejo forestal. Aunque se ha permitido la titulación de dichas áreas, que ya declaradas como áreas de conservación pasan a formar parte del Patrimonio Forestal del Estado, se exige el cumplimiento de otros requisitos más calificados. Eso nos conduce, directamente al concepto de posesión ecológica, y al criterio de la función ecológica de la propiedad forestal. En reiteradas sentencias, tanto de la Sala Primera de Casación, como del mismo Tribunal Superior Agrario, se han establecido los principios que deben regir para resolver éste tipo de situaciones agro-ambientales.
Nuestro país ha sido pionero en la construcción de los institutos de la posesión agraria y la posesión ecológica. La misma jurisprudencia ha reconocido y desarrollado estos institutos, así como el ciclo de vida de la posesión agraria y, recientemente de la posesión ecológica (dentro del más amplio criterio de la función ecológica de la propiedad forestal). La misma Jurisprudencia ha querido distinguir la propiedad y posesión empresarial donde se ejercita una actividad dirigida al cultivo del bosque, de aquella donde simplemente se realiza una actividad extractiva o bien, meramente conservativa. En estos últimos casos se estaría en presencia de una propiedad o posesión forestal (sin empresa). Precisamente es en estos casos donde la Ley Forestal viene a establecer todo un régimen jurídico para la protección de los recursos forestales, sometiendo algunas veces al propietario en forma obligatoria al régimen forestal y en otros casos en forma voluntaria.
De esa forma, en la posesión forestal el poder de hecho se ejerce sobre un bien de vocación forestal o en su mayor parte destinado a proteger los recursos forestales, sin miras a su explotación o bien, dedicándolo a la simple extracción de especies maderables, a través de planes de manejo para lograr la regeneración natural del bosque. En uno y otro caso no existiría el desarrollo de un ciclo biológico vegetal o animal, ni asumiría el hombre ningún riesgo. Es por eso que la ley no tutela, al contrario reprime, la posesión a través de la cual se destruyan los recursos forestales de áreas protegidas. Además niega la posibilidad de adquirir derechos de posesión sobre tierras de las reservas nacionales cuando se ha ejercido una acción dañina en contra de los recursos forestales. Hoy, parte de la doctrina agrarista afirma la existencia de un Derecho forestal, con particularidades de sistema orgánico y completo, donde ocupan un lugar importante los institutos de la propiedad y posesión forestal.
En Costa Rica la propiedad forestal, y también la posesión forestal como derecho real derivado de aquella, o bien concebido en forma independiente, se comienza a perfilar desde el Código Fiscal de 1885, que establece todo un capítulo en cuanto a bosques cuyas regulaciones tienden a su conservación. Posteriormente la Ley de Terrenos Baldíos No. 13 del 6 de enero de 1939 incorpora dichos principios. Luego la Ley de Tierras y Colonización en su artículo 7 amplía las reservas nacionales para la protección de tales recursos.- VII. La legislación especial en cuanto a la tutela de la propiedad y posesión forestales tiene tres etapas en nuestro país. La primera etapa de la propiedad forestal se enmarca con la Ley No. 4465 del 35 de noviembre de 1969. La segunda se abre a través de una normativa mejor concebida a través de la Ley No. 7032 del 7 de abril de 1986, la cual fue posteriormente declarada inconstitucional.
La última opera con la promulgación de la Ley Forestal No. 7174 del 28 de junio de 1990, reformada recientemente, por Ley No. 7575 del 13 de febrero de 1996 (publicada en el alcance 21 de La Gaceta No. 72 del martes 16 de abril de 1996). En ellas, se contienen diversos regímenes de propiedad forestal, y limita el uso y aprovechamiento de los recursos por los particulares. No es posible adquirir la titularidad sobre terrenos con cobertura boscosa si no se demuestra haber protegido el recurso forestal. Su fundamento constitucional se encuentra en el párrafo segundo del artículo 45 de la Constitución. A través de limitaciones de interés social se protege el instituto de la propiedad y la posesión forestal. Esta no es igual a la civil, ni a la agraria, se trata de una propiedad para conservar, y por tanto los actos posesorios que en ella se realicen deben tener esa finalidad.- VIII. La posesión forestal ha tenido su régimen jurídico en las Leyes Forestales mencionadas.
Recae sobre un bien específico: los terrenos cubiertos de bosques o de aptitud forestal. El propietario o poseedor de tales bienes tiene la obligación de conservar los recursos forestales y no los puede aprovechar económicamente sino bajo las restricciones o limitaciones impuestas por la ley. Para la solución jurídica de conflictos que nazcan del ejercicio de la posesión forestal, se debe aplicar ese régimen jurídico especial y los principios del Derecho forestal. La Ley Forestal establece como función esencial y prioridad del Estado, velar por la protección, la conservación, el aprovechamiento, la industrialización, la administración y el fomento de los recursos forestales del país, de acuerdo con el principio de uso racional de los recursos naturales renovables.(Artículo 1). Todos los terrenos de aptitud forestal y los bosques del país, ya sea estatales o que estén reducidos a dominio particular, quedan sometidos a los fines de la ley.
El régimen forestal es el conjunto de disposiciones, entre otras, de carácter jurídico, económico y técnico, establecidas por la ley, su reglamento y demás normas, que regulen la conservación, la renovación, el aprovechamiento y el desarrollo de los bosques y terrenos de aptitud forestal del país. Por ello, para adquirir la propiedad forestal por usucapión, se requiere el ejercicio de la posesión forestal. El artículo 7 de la Ley de Informaciones posesorias, reformado por la Ley Forestal, establecía, antes de su reforma: "Artículo 7.- Cuando el inmueble a que se refiere la información esté comprendido dentro de una zona declarada parque nacional, reserva biológico, reserva forestal o zona protectora, el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la respectiva ley o decreto en que se creó la respectiva área silvestre.
Las fincas que estén fuera de esas áreas y que tengan bosques, solo podrán ser tituladas si el promovente demuestra haberlas poseído por diez años o más y haber protegido dicho recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado con cercas o carriles." En otros términos, el poder de hecho en la posesión forestal recae sobre el recurso natural "bosques" o "terrenos de aptitud forestal", y los actos posesorios deben ir encaminados a su protección y conservación. Sólo si se demuestra eso podría adquirirse o inscribirse terrenos a favor de dichos poseedores. De lo contrario, quedarían formando parte del patrimonio natural del estado (artículo 13 de la nueva Ley Forestal), con carácter inembargable e inalienable, y su posesión no causará ningún derecho a favor de los particulares (artículo 14 de la nueva Ley Forestal).- IX. El Tribunal Agrario, había interpretado el artículo 7 de la Ley de Informaciones Posesorias, antes de ser reformado por la nueva Ley Forestal, en el sentido de exigir una posesión personal, ejercida con diez años de antelación a la creación de la reserva forestal o área protegida (Véase en tal sentido los Votos No. 169 de las 9 horas 40 minutos del 22 de marzo de 1991 y No. 251 de las 14 horas del 17 de abril de 1991)...".
Sin embargo, esa interpretación del artículo 7 de la Ley Forestal, fue cuestionada de "inconstitucional", por la aquí titulante, y la Sala Constitucional, en Voto No. 4587-97 (publicado en el Boletín Judicial No. 188 de fecha 1 de octubre de 1997) declaró, en lo que interesa, lo siguiente: "Se declara parcialmente con lugar la acción y, en consecuencia, que es inconstitucional la interpretación del artículo 7 de la Ley de informaciones Posesorias No. 139 del 14 de julio de 1941, cuyo texto corresponde a la reforma producida por la Ley Forestal No. 7174 del 28 de junio de 1990, de acuerdo con la cual para titular terrenos comprendidos en parques nacionales, reservas biológicas, reservas forestales o zonas protectoras, se requiere posesión personal con diez años de antelación a la fecha de vigencia de la ley o decreto que crea el área silvestre protegida, y que no favorece en estos casos la posesión transmitida por anteriores poseedores.
Esta sentencia es declarativa y sus efectos retroactivos, sin perjuicio de derechos adquiridos de buena fe...". De manera tal que los poseedores actuales pueden aprovechar la posesión trasmitida...X. La Ley Forestal No. 7575, también mantuvo las restricciones en la Ley de Informaciones Posesorias, para poder titular terrenos comprendidos en áreas protegidas. Al respecto dispone el actual numeral: "Artículo 7.-Cuando el inmueble al que se refiera la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser titular de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre."(La negrita es nuestra). Es decir, la intención del legislador es que esas áreas se hayan mantenido protegidas, conservadas durante todo este tipo, incluso antes de la creación de las Reservas y áreas protegidas...".
(Resolución de las 14:50 horas del 20 de febrero de 1998 que responde al Voto No. 113). V.- En casos más recientes, el Tribunal ha rechazado los alegatos que ahora reitera el apelante, sobre la supuesta interpretación o aplicación retroactiva del artículo 7 de la Ley Forestal. En un caso similar al que nos ocupa se dijo: V.- En cuanto a lo alegado por el recurrente respecto a que el juzgador de instancia comete un error al aplicar el artículo 7 de la Ley de Informaciones Posesorias, el cual considera fue declarado inconstitucional por lo que debe analizarse las diligencias a la luz de lo dispuesto por el artículo 1 de dicha Ley, considera este Tribunal no lleva razón pues el artículo 7 citado no fue declarado inconstitucional, sino lo fue la interpretación que venía haciendo el Tribunal en cuanto no se contabilizaba la posesión ejercida por los anteriores transmitentes. De ahí, al estar vigente el ordinal 7 de la Ley de Informaciones Posesorias, debe el promovente demostrar una posesión decenal antes de la declaratoria del área silvestre protegida según lo indicó la Sala Constitucional en el voto No. 4587-97 (publicado en el Boletín Judicial No. 188 de fecha 1 de octubre de 1997).
Es importante mencionar que tampoco se estaría aplicando retroactivamente la ley como lo indica el recurrente, porque el plazo de diez años de posesión para usucapir se encuentra establecido en el Código Civil y la disposición cuestionada simplemente destaca ciertos elementos propios de la usucapión que también están definidos en la normativa general, como son: el objeto de la posesión y las condiciones en que ésta se debe ejercer para ser apta para la usucapión. En ese sentido es importante señalar lo dicho por la Sala Constitucional al respecto en el voto citado “…El artículo 7 párrafo primero de la Ley de Informaciones Posesorias impugnado, cuyo texto es anterior a la última reforma por Ley Forestal No.7575 de 13 de febrero de 1996, regula el caso de la titulación de bienes inmuebles comprendidos dentro de un área declarada parque nacional, reserva biológica, reserva forestal o zona protectora.
Señala ese artículo que el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la ley o el decreto que creó el área silvestre. La disposición cuestionada regula el caso de titulación de un bien inmueble que ha sido afectado al dominio público con la declaratoria de área silvestre protegida, cualquiera que sea su especificidad. Corresponde ahora determinar si de acuerdo con la hipótesis que contempla la norma impugnada, a la luz de los criterios doctrinarios y jurisprudenciales que informan los institutos de la usucapión y de la posesión necesaria para usucapir, expuestos anteriormente, la norma cuestionada regula un tipo especial de posesión necesaria para adquirir la propiedad sobre los bienes inmuebles, que impone requisitos específicos que pueden infringir el derecho de propiedad o el principio de irretroactividad de la ley en perjuicio de derechos adquiridos o situaciones jurídicas consolidadas, regulados en la Constitución.
En primer término, debe señalarse que el artículo cuestionado no modifica -aumenta o disminuye- el plazo de diez años de posesión necesario para usucapir, fijado en el artículo 860 del Código Civil para la generalidad de los casos en que se pretende adquirir la propiedad de los bienes inmuebles por prescripción positiva. La ampliación del plazo que alega el accionante como infractor del derecho a la propiedad no se produce, porque dada la naturaleza del bien que se pretende titular (cosa pública), el plazo de posesión apta para la usucapión debe transcurrir antes de que se produzca la afectación del bien al dominio público. Es decir, la declaratoria de área silvestre protegida evita que cuente la posesión posterior a la afectación, e impide concretar los requisitos de la usucapión si a ese momento no se ha adquirido el derecho, o sea, no han transcurrido los diez años de posesión apta para usucapir con las condiciones que establece la ley.
Lo anterior es únicamente el resultado natural de aplicar los conceptos sobre el objeto de la posesión y su condición de ejercicio en calidad de titular, necesarios para la posesión ad usucapionem. Recuérdese que los bienes afectados al dominio público, tengan las especificaciones que tengan, no son susceptibles de adquisición por usucapión, si antes de producirse la afectación no se dieron las condiciones necesarias para la adquisición del derecho. En ese sentido, la disposición cuestionada, a pesar de que en apariencia regula un caso específico de usucapión, no crea un régimen con requisitos diferentes a los establecidos en el Código Civil para la generalidad de los casos. En ese sentido, tampoco se produce el alegado efecto retroactivo de la norma, porque el plazo de diez años de posesión para usucapir se encuentra establecido en el Código Civil y la disposición cuestionada simplemente destaca ciertos elementos propios de la usucapión que también están definidos en la normativa general, como son: el objeto de la posesión y las condiciones en que ésta se debe ejercer para ser apta para la usucapión.
Es decir, la norma no viene a establecer ningún principio diferente -o requisito más riguroso- en relación con la aplicación de las reglas generales de la usucapión. Simplemente especifica la forma en que deben aplicarse esas reglas, lo que coincide con un resultado lógico dada la condición de bien demanial del objeto a titular. De ahí que no se considere que la reforma al artículo 7 de la Ley de Informaciones Posesorias, cuyo texto se impugna, haya introducido un régimen diferente en relación con los requisitos de la usucapión, que haya podido agravar la situación de personas que se encontraban ejerciendo posesión ad usucapionem en terrenos que fueron declarados de interés público. (Tribunal Agrario, No. 173 de las 16:29 horas del 31 de marzo del 2003).
VI.De manera que el poseedor que pretenda adquirir por usucapión un terreno cubierto de bosque, que formaba parte de las reservas nacionales, deberá demostrar la posesión decenal (originaria o trasmitida), y haber conservado el recurso forestal. En este caso la Procuradora indica que "Las declaraciones de los testigos no demuestran la posesión decenal apta para usucapir en cabeza del promovente". Sin embargo ello no es así. El testigo [Nombre7] afirmó: "Conozco esta propiedad desde el año 1975 cuando era propiedad del señor [Nombre8] corrijo ([Nombre9]) quien (sic) la tuvo unos quince años inclusive cuando yo llegué ya él estaba en el terreno. Don [Nombre9] luego se la vendió a [Nombre10] quien la poseyó hasta hace como un año en que le vendió a la sociedad promovente..."(folio 59), en cuanto a la posesión ecológica que vino a exigir la Ley Forestal, el testigo indica "...tiene una parte de montaña la cual se encuentra protegida, parte de tacotal y el resto es potrero..."(folio 59 vuelto).
El deponente [Nombre11] señaló que conoce la propiedad desde hace más de quince años, cuando era de [Nombre9], el cual se la vendió a [Nombre10] y hace como dos años la vendió a la sociedad promovente, la cual han dedicado a ganadería y a la conservación de la montaña, manteniéndola bien deslindada con cercas y carriles limpios (ver folio 60). Y el testigo [Nombre12] , manifiesta conocer desde hace catorce o quince años la finca, que era de [Nombre9], después la trasmitió a [Nombre10] , y este la vendió a la sociedad promovente, indicando que los poseedores se han dedicado a mantener ganado, carriles limpios y cercas, indicando expresamente que tiene una parte de montaña que se mantiene cuidada y protegida (folio 60). Como se puede observar, en consecuencia, la posesión data de mas de treinta años, aproximadamente desde 1975, habiéndose desarrollado en el fundo una actividad agraria productiva de ganadería, y a su vez conservado el recurso forestal.
No podía pretender la Procuradora exigir una posesión personal decenal, únicamente de la titulante, porque ello más bien iría en contra del criterio jurisprudencial constitucional, que permite la usucapión sumando la posesión trasmitida.
VII.En cuanto al segundo agravio, tampoco observa este Tribunal que se esté irrespetando lo dispuesto en la Ley de Uso, Manejo y Conservación de Suelos y su Reglamento. Para todos es sabido, que en el reconocimiento judicial lo que se consignan son dimensiones aproximadas, no precisas, a menos que se realizara una medición con un GPS. En el acta se indicó lo siguiente: "Dicha quebrada se encuentra bien protegida en sus márgenes con abundante vegetación y árboles. Continuamos el recorrido por el lindero oeste desde el [Dirección8] según el mapa hasta el [Dirección9] donde el carril se aprecia limpio y en buen estado. A partir del [Dirección9] continúa el mismo carril pero además con cerca de alambre de púas a tres hilos sobre poste vivo y muerto hasta llegar al [Dirección10] en donde iniciamos el recorrido. La propiedad se encuentra en su mayor parte dedicada a potreros pero en su parte norte y oeste tiene aproximadamente diez hectáreas de montaña con bosque primario el cual se aprecia muy bien cuidado el recurso y debidamente protegido sin daños al ambiente....".
De lo anterior se desprende que en realidad la extensión del terreno indicada por el juez en el reconocimiento fue aproximada, porque si se toma como referencia los puntos del plano, evidentemente se llega a la ineludible conclusión de que la mayor parte de colindancias, sobre todo por el [Dirección11] son carriles, donde hay montaña. De ahí que no observa el Tribunal la contradicción con lo indicado en el estudio de suelos, que es más bien beneficioso para la titulante, porque en él se concluyó claramente que "De conformidad con el artículo 58 del Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, No. 7779 del 30 de abril de 1998 y con base en una visita de campo, esta instancia verifica que en la finca SE HA EJERCIDO la posesión cumpliendo con el uso conforme del suelo para la actividad que realiza de acuerdo con la metodología aprobada" (folio 17). Del mismo estudio se desprende que hay catorce hectáreas de bosque en el Sector A, y en el sector B hay bosque y repastos, lo cual hace presumir que también se encuentra bosque en proceso de regeneración natural, y por ello es que se dan recomendaciones técnicas como es de rigor en este tipo de análisis. En conclusión, no lleva razón la Procuradora en los referidos agravios, pues está demostrada la usucapión ecológica y el uso conforme del suelo.
VIII.En cuanto a los reparos realizados al contenido de la resolución impugnada, observa este tribunal que, efectivamente, existe un error material, en la parte dispositiva del fallo (folio 120), al indicar "Quebrada El 20", cuando en realidad es "Quebrada Kilómetro 20", el cual deberá ser corregido de conformidad con el artículo 161 del Código Procesal Civil, previo a expedir la certificación de la ejecutoria. En relación al tema de la calle [Dirección12], procede acoger la solicitud, toda vez que no se indica el inmueble colinda por el este con calle pública, en consecuencia deberá adicionarse en la colindancia este: [Nombre1] , [Nombre4] y [Dirección13] con un ancho de catorce metros.
POR TANTO:
Se confirma la sentencia recurrida, en el entendido de que el nombre correcto de la Quebrada es "Quebrada Kilómetro veinte", y se agrega que la colindancia este con calle [Dirección12] es de un ancho de catorce metros.

No se comparte el Voto de mayoría al aprobar la información posesoria sobre terrenos constituídos por bosques, por cuanto los mismos son parte del patrimonio natural del Estado y no se demostró una posesión decenal ejercida con antelación a la afectación de ese bien como demanial.- El Dominio Público -para el caso que nos interesa- es el conjunto de bienes propiedad pública del Estado, lato sensu, afectados al uso público directo o indirecto, de los habitantes, y sometido a un régimen especial de derecho público y, por tanto, exorbitante del derecho privado. El dominio público se encuentra conformado por cuatro elementos: subjetivo, objetivo, normativo y teleológico. El elemento subjetivo se refiere al titular del derecho -El Estado-; el elemento objetivo se refiere o se constituye por el bien o los bienes sobre los cuales recae el dominio público -para este caso el inmueble objeto de litigio-; el elemento normativo determina cuando un bien reúne los requisitos señalados por ley para considerarlo demanial, es el conjunto de normas que lo rigen -elenco de normas que en adelante se dirán-; y el elemento teleológico que se refiere a la finalidad que se persigue al incluir determinado bien dentro del dominio público, qué finalidad pública es asignada al bien -en este caso la protección de los recursos naturales-.
Los bienes de dominio público están sometidos a un régimen jurídico especial, se encuentran sujetos a un poder de policía, y se caracterizan esencialmente por su inalienabilidad e imprescriptibilidad. Por su naturaleza están dirigidos a satisfacer necesidades públicas, este hecho impide que sobre ellos exista tenencia o posesión por parte de particulares o personas privadas, están fuera del comercio del derecho privado. Nuestra Constitución Política en su artículo 121 inciso 14) hace referencia a la Demanialidad indicándo qué bienes son susceptibles de ese régimen de propiedad pública, incluso estableciéndose en ese artículo diferentes grados de afectación pública dándose un grado de publicatio intenso y absoluto hasta otros grados menos intenso y se armonizan los derechos de los administrados con las potestades de la Administración. Nuestro Código Civil vigente que data desde el mes de abril de mil ochocientos ochenta y seis, regula las bases más importantes en materia de bienes de dominio público, concretamente en sus artículos 261 al 263.
El artículo 262 del citado Código Civil, hace referencia a dos características importantes de los bienes de dominio público: a- las cosas públicas están fuera del comercio, y b- se establece la desafectación al decir que esos bienes no pueden entrar en el comercio privado, mientras legalmente no se disponga así. Como puede observarse la afectación al régimen de dominio público no depende de la naturaleza del bien, sino de la voluntad del legislador. Mediante voto número 447- 91 de las quince horas treinta minutos del 21 de febrero de 1991 la Sala Constitucional manifiesta que la declaración de dominio público del bien se establece por ley, esta declaración no constituye una limitación a la propiedad, de acuerdo con el artículo 45 de la Carta Magna, pues éste artículo se refiere a propiedad privada, y los bienes de dominio público no están sujetos a propiedad privada. El Patrimonio Forestal del Estado, es un bien Demanial regulado en un amplio conjunto normativo en el que históricamente hasta la actualidad se prohíbe a los particulares realizar cualquier tipo de labor dentro de los inmuebles con esa característica y como consecuencia negándoles el derecho de posesión, haciéndose una salvedad en una situación específica que más adelante se dirá.
Se considera como Patrimonio Estatal, -en su condición de Demanio Público que implica los principios de imprescriptibilidad, inalienabilidad, e inembargabilidad-, los terrenos que constituyen Reservas Nacionales que tengan Bosques. Lo anterior encuentra su desarrollo normativo en las citas que a continuación se exponen: 1) El Código Fiscal de 1865 el cual contempla un capítulo referido a los bosques, el cual fue derogado por la Ley General de Terrenos Baldíos Número trece del 6 de enero de 1939 la cual incorporaba prácticamente las mismas disposiciones. Por ejemplo el artículo primero indicaba: "Que los terrenos comprendidos en los límites de la República, que no hayan sido adquiridos o inscritos en propiedad mediante título legítimo por particulares, se presumen baldíos y pertenecen al Estado."- Esta ley en general regula la prohibición para poseer e inscribir mediante el trámite de informaciones posesorias las Reservas Nacionales que sean Patrimonio Forestal, en otras palabras no son susceptibles de apropiación por parte de particulares.- La Ley de Tierras y Colonización Número 2825 del 14 de octubre de 1961 mantuvo la misma orientación y se encuentra vigente en la actualidad desde aquella fecha.
Así el artículo 8 de esa Ley de Tierras y Colonización establece: "Exceptuado los casos previstos en esta ley es prohibido a los particulares encerrar con cercas, carriles, o cualquier otra forma los terrenos declarados Reservas Nacionales, derribar montes, establecer construcciones y cultivos o extraer de ellos leña, madera, bejuco, palma, y otros productos con fines de explotación. Todo acto de ese genero, si de previo no se han llenado los trámites legales y obtenido la autorización correspondiente será considerado, según el caso como usurpación de dominio público o merodeo, debiendo las autoridades ordenar la destrucción y remoción de las cercas e impedir el uso de esas tierras, sin lugar a indemnización ni a reclamos por el valor de las mejoras y sin perjuicio de otras responsabilidades que pudieran caber a quienes incurrieren en tales faltas".- Nótese que este artículo sanciona penalmente a aquel que se introdujere a una reserva Nacional para realizar cualquier actividad en esas tierras, por lo que no se le pueda considerar a ésta acto de posesión pues su actividad sería ilegítima.- El artículo 11 de esa misma Ley, establece que pertenecen al Estado en carácter de Reservas Nacionales: "a) Todos los terrenos comprendidos entre los límites de la República que no esten inscritos como propiedad particular, de las Municipalidades o de las Instituciones Autónomas. b-) Los que no esten amparados por la posesión decenal.- c-) Los que por leyes especiales, no hayan sido destinados a la formación de colonias agrícolas.- d-) En general todo los que, no siendo de propiedad particular, no estén ocupados en servicios públicos."- Por su parte el artículo 19 de la Ley Forestal derogada número 4465 del veintitrés de noviembre de mil novecientos sesenta y nueve dispuso: "Quedan afectados a los fines de la presente ley todos los bosques y terrenos forestales ubicados en: "a-) Las tierras consideradas Reservas Nacionales..." Y el artículo 25 de esta misma ley señalaba: "La posesión de los terrenos situados en las Reservas Nacionales y fincas del Estado a que se refiere el artículo 19 de esta Ley, no causará derechos de ninguna especie y la acción reivindicatoria del Estado, por los mismos, es imprescriptible, y la Dirección General Forestal con los medios legales a su disposición, procederá a desalojar de tales terrenos a las personas que los ocupan total o parcialmente, en el caso de que se trate de zonas protectoras, Parques Nacionales, Reservas Forestales, y Reservas Biológicas".- Con estas normas se otorga a los bosques allí mencionados una doble tutela: Primero por su condición de Reserva Nacional, en las que es prohibido realizar cualquier acto posesorio y segundo por constituir Patrimonio Forestal del Estado en el que ningún acto de posesión causará derecho de ninguna especie.
Este aspecto se ve confirmado con el artículo 8 del reglamento a esa ley que dice: "Los terrenos Nacionales comprendidos dentro de las áreas declaradas Reservas Forestales son inalienables, es decir no podrán salir del dominio del Estado, y su posesión no causará derecho de ninguna especie de conformidad con lo dispuesto por los artículos 25, 49 y 57 de la Ley Forestal".- El artículo 80 de la citada Ley Forestal derogada indicaba: "Queda prohibido la invasión y ocupación de terrenos en los Parques Nacionales, Reservas Forestales y Zonas Protectoras. Esta prohibición se extiende hasta las Reservas Nacionales, hasta tanto no se haya determinado su clasificación y transferencia..." El artículo 6 de esta misma ley disponía: " Será sancionado con prisión de seis meses a dos años o con multa de quince a cien días, la persona que: a-) Explote un bosque de patrimonio forestal sin autorización legal correspondiente... b-) Invada un Parque Nacional, Reserva Biológica, Zona Protectora o Reserva Forestal...Si la invasión es en Reservas Nacionales, estará sujeta a lo estipulado en el artículo 227 del Código Penal.-" Como puede observarse los actos posesorios realizados en un bosque patrimonio Estatal resultan ser ilegítimos por lo que no pueden conferir ningún derecho de posesión.- Con la entrada en vigencia de la Ley Forestal Número 7174 del 28 de junio de 1990, se continúa con esta misma filosofía.
En el artículo 32 de la citada ley establece: "El patrimonio forestal del Estado esta constituído por todos los bosques y terrenos forestales de las Reservas Nacionales...". El artículo 33 de esa misma ley dispone: "Los terrenos forestales y bosques que constituyen el Patrimonio Forestal del Estado detallados en el artículo anterior, serán inembargables e inalienables, su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por esos terrenos es imprescriptible.- En consecuencia, no son susceptibles de inscripción en el Registro Público mediante Información Posesoria, su invasión y ocupación será sancionados conforme lo dispuesto en esta Ley".- Con la actual Ley Forestal vigente número 7575 del 5 de febrero de 1996, en su título II regula un capítulo único referido exclusivamente al Patrimonio Natural del Estado, siendo la misma filosofía que se había iniciado desde 1865 con el Código Fiscal, por lo que se reitera en esta nueva normativa que el Patrimonio Natural del Estado estará constituído por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, y las fincas inscritas a nombre de la Administración Pública.
El artículo 14 de la misma ley forestal vigente es enfática en indicar que los terrenos forestales y bosques que constituyen el patrimonio natural del Estado son imprescriptibles, inembargables e inalienables y su posesión por los particulares no causará derecho alguno a su favor. La Ley de Conservación de la Vida Silvestre Número 7317 del 21 de octubre de 1972, en sus artículos 3 y 4, además de la declaratoria como de dominio público e interés público, a la fauna y flora silvestre respectivamente, se indica que la flora y fauna silvestre es parte del Patrimonio Nacional. En este mismo sentido la Ley de Biodiversidad número 7788 del 30 de abril de 1998 en su artículo 6 declara los elementos de la biodiversidad como de dominio público, así como la Ley Orgánica del Ambiente en su artículo 46 que establece la soberanía del Estado sobre la diversidad biológica. Por lo expuesto resulta un imperativo legal negar el derecho de posesión a aquellas personas que realizaran cualquier actividad en terrenos no sometidos a propiedad privada y que estén constituidos por bosques en reservas Nacionales.- A esa prohibición imperativa mediante la Ley Forestal Número 7575 del año 1996, que reforma el artículo 7 de la Ley de Informaciones Posesorias, establece una salvedad a la filosofía que hasta ahora se ha expuesto, y es que se posibilita la titulación de bosques cuando dentro de los mismos se haya desarrollado lo que se entiende como posesión ecológica.
El terreno objeto de esta información posesoria, es Patrimonio Natural del Estado, pues está compuesto por cobertura boscosa, según se desprende del estudio de suelos visible a folios 16 y 17 y reconocimiento judicial de folio 61 y 62, en el que se indica el terreno está conformado por aproximadamente treinta y ocho hectáreas de montaña según estudio técnico de suelos, y 4.56 hectáreas de repasto, lo que implica la naturaleza total del terreno es predominantemente bosque.- Es es claro dicho terreno es Patrimonio Natural del Estado, desde antes de que se crearan esos Decretos como ya se expuso en el historial normativo supra. Cuando se discute la posesión sobre un bien demanial, sólo cabrá esa discusión cuando se haya adquirido el derecho antes de que se haya declarado el bien como de dominio público. Así mismo, el derecho de propiedad en tales casos sólo podrá obtenerse cuando el titular haya demostrado una posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley que declara el objeto como Patrimonio Natural del Estado.
Como ya se ha expuesto la cronología legal que tutela el Patrimonio Natural del Estado, la ley que debe tomarse en consideración para realizar el cómputo de la posesión decenal de los particulares, es la Ley de Tierras y Colonización número 2825 del 14 de octubre de 1961, normativa actualmente vigente. No debe considerarse el Código Fiscal de 1865 y la Ley de Terrenos Baldíos de 1939, pues fueron normas que hacían referencia al tópico en forma genérica, además que no son disposiciones vigentes en la actualidad, no es sino hasta con la actual Ley de Tierras y Colonización que se viene a definir y regular en forma clara la Propiedad o Patrimonio Natural del Estado. Las leyes posteriores como Ley Forestal y otras que se han citado en este considerando, son complementarias a la referida Ley de Tierras y Colonización. Para el caso concreto, de la prueba testimonial recabada no se demuestra esa posesión decenal en los términos de la normativa aquí expuesta, pues en este sentido es que se consigna este voto salvado, para indicar el promovente debió demostrar diez años de posesión antes de la Ley de Tierras y Colonización, por lo que debió declararse sin lugar la información posesoria revocando el fallo venido en apelación.- [Nombre13] PROCESO:INFORMACIÓN POSESORIA PROMOVENTE: PORTOCITO DOMINICAL SA [Nombre14] / [Nombre15] + [Nombre15]
