Ordinary contentious-administrative proceeding (proceso ordinario contencioso-administrativo) brought by Nombre61168 and others against the State N° 19-2009-S.X Tribunal Contencioso Administrativo y Civil de Hacienda, Sección Décima. Segundo Circuito Judicial de San José. Goicoechea, Annex A, at eleven hours and fifty-nine minutes on the thirteenth of February two thousand and nine.

An appeal (recurso de apelación) filed by the plaintiffs is heard in the ordinary contentious-administrative proceeding brought by Nombre61168, Nombre159154, and Nombre159155, who are adults, married once, farmers, and residents of Drake de Osa, bearing the following national identity document numbers, respectively: CED125425 and CED125427, against the State, currently represented by Deputy Attorney General Gloria Solano Martínez, an adult, married, attorney, bearing national identity document number CED1449- -, resident of Heredia. Also appearing, in the capacity of special judicial attorney (apoderado especial judicial) for the plaintiffs, is Licenciado Ricardo Granados Calderón, an adult, married once, attorney, bearing national identity document number CED125426- -, resident of Sabana Norte.

Background:

  • I)With the value of this matter fixed as indeterminate (inestimable) (see ruling at folio 193), the complaint seeks a judgment declaring the following: "In accordance with my arguments and the legal sources cited, I respectfully request that the present complaint be granted and that the ruling issued by the Tribunal Ambiental Administrativo, number 409-03, at fifteen hours and forty-three minutes on the sixth of May two thousand and three, and ruling 606-03 TAA at twelve hours and forty-four minutes on the fifth of June two thousand and three, as well as all other administrative or judicial acts resulting from the application of said ruling, be annulled. That upon annulment of the judgment, the State be ordered to pay the damages and losses (daños y perjuicios) incurred, as detailed in this complaint. Likewise, we request payment of court costs (costas)" (see complaint filing, f. 92).
  • II)The State answered the complaint in the negative and raised the exception of lack of legal right (excepción de falta de derecho). It further requested that the plaintiffs be ordered to pay both court costs of the action. It also raised the exception of lack of legal right (see answer brief, fs. 179-188).
  • III)The trial judge, Licda. Gricelda Trejos Vega, through her judgment N° 294-2008 issued at nine hours forty minutes on the twenty-eighth of March two thousand and eight, dismissed the complaint in its entirety, stating the following in the operative section (parte dispositiva) thereof: "The exception of lack of legal right raised by the State is upheld and, consequently, the complaint is dismissed in its entirety. Both court costs of this action shall be borne by the plaintiff party" (see judgment at fs. 296-312).
  • IV)The plaintiffs appealed the aforementioned judgment and said appeal was admitted by the trial court; accordingly, this Tribunal is now hearing the matter.
  • V)This matter has been processed in the manner appropriate to it, and no defects are noted that would invalidate the proceedings or that require correction; therefore, judgment is rendered within the timeframe permitted by the workload of the Court, following the required deliberation.

Considering:

  • I)The list of proven and unproven facts set forth in the challenged judgment is hereby adopted.
  • II)It should be noted that the grounds of appeal (agravios) raised by the special attorney for the plaintiffs against the first-instance judgment are fundamentally those set out in the appeal brief (fs. 314-325). In order to facilitate the exposition and avoid unnecessary repetition, each ground of appeal and the analysis performed by this Chamber will be addressed in the sections that follow.
  • III)First ground of appeal: It is argued that there was an incorrect assessment of the facts, which affects the judgment. Specifically, it is contended that the lower court judge (a quo) erroneously found that no evidence had been presented of any complaint filed in connection with the theft the plaintiffs claim to have suffered, thereby failing to report the environmental damage (daño ambiental) sustained in the protected area and failing to fulfill the duty of protection incumbent upon them as owners of the affected property (finca). This assertion overlooks the fact that the property is 134 hectares in size and consists of primary forest (bosque primario), with access to two public roads, and that the extraction was carried out precisely on the most remote portion of the property; moreover, Nombre61168 does not live on the property but in another locality. Likewise, the challenged judgment fails to take into account that the criminal complaint filed concerning these same events was archived by the courts of the criminal jurisdiction, as the commission by the affected parties of the offenses set forth in Articles 57 and 61 of the Ley Forestal could not be established.

It is further stated that no evidence was found against the reported individual Nombre28601, who is not the owner of the property and has no connection whatsoever with the plaintiffs. The judgment also fails to analyze the fact that the land was acquired by the undersigned [plaintiffs] in the year 1997 and has since been cared for and protected, despite the denial of any possibility of extracting timber, which even led to the filing of a lawsuit that was ultimately won on grounds of an excessive restriction of the right of ownership (see fs. 314-316).

The ground of appeal raised by the plaintiffs' representative cannot succeed. In the first place, this proceeding does not address the criminal liability of the plaintiffs for the offenses attributed to them in the criminal jurisdiction, but rather the fact that at the time of the events in which environmental damage was caused—a fact not disputed by the parties—they were the owners of the property and failed to exercise the necessary surveillance over it, thereby permitting significant environmental damage to occur in breach of environmental regulations. It must be recalled that a single event may give rise to different types of liability (civil, criminal, administrative), which may be examined under the rules specific to each branch of law, through separate proceedings and before different jurisdictional bodies, without implying in any way that an exoneration of liability in one forum necessarily entails exemption from liability in another.

Nor is it relevant—or does it exempt from the liability established by the Tribunal Ambiental Administrativo—that in a separate judicial proceeding it was declared that excessive restrictions had been imposed on the enjoyment of the real property (bien inmueble) and that said restriction must be compensated, since that does not affect the environmental protection obligations that owners hold with respect to their properties. Indeed, upon review of the judgment of the Sala Primera de la Corte Suprema de Justicia, the plaintiffs' ownership (dominio) over the parcel (predio) is reaffirmed, and it must be recalled that holding ownership or possession (posesión) over real property that primarily fulfills an ecological function (función ecológica) not only entails rights—such as those recognized by the courts in due course in favor of the plaintiffs—but also obligations, chief among them the conservation of the property.

  • IV)Second ground of appeal: The plaintiffs' attorney argues that the lower court incorrectly applied and interpreted the applicable legal rules. The assertion that strict liability (responsabilidad objetiva) arose in this case is challenged on the basis that the very challenged judgment found that the Tribunal Ambiental Administrativo erred in sanctioning Nombre28601, who is not the owner of the property where the damage occurred. On this basis, the plaintiffs' representative contends that the sole person responsible for the illegal extraction and disposal was this individual. The following is stated verbatim: "This being so, not only is there a contradiction in the challenged ruling, but this necessarily entails an annulment of the Tribunal Ambiental's decision, because if the latter errs in its operative section with respect to an element as important as who carried out the acts constituting the offense, and the trial court confirms and corrects this, it is not possible for this situation to have no bearing on the legality of ruling 409-03." The attorney contends that Articles 98 and 101 of the Ley Orgánica del Ambiente are applicable only to those directly responsible for the timber felling (corta) and not to the owners, who in this case were actually the ones harmed by the actions of a third party—not by the State, which is moreover imposing charges for the actions of a third party.

If a third party exists who is directly responsible for the extraction, the doctrine of strict liability does not apply. The argument concludes as follows: "Now, since the burden of proof (carga de la prueba) is reversed, how [sic] is our 'objective' innocence demonstrated? By proving the guilt of the person who committed the acts; however, the Juzgado Contencioso Administrativo does not note that this was already established by the Tribunal Ambiental Administrativo, and that this person was Mr. Nombre28601, which is why we should not be required to demonstrate that we were not responsible" (fs. 316-317).

Upon analyzing the challenged judgment, several important situations are found:

  • 1)That the plaintiffs herein failed in their duty to adequately monitor the real property (bien inmueble) they own, which enabled a third party (Nombre28601) to carry out the logging (tala) and to construct the logging trails (trochas) — activities that are prohibited because the land in question constitutes primary forest (bosque primario) forming part of the State forest heritage (patrimonio forestal del Estado) (see proven facts 1, 2, and 11);
  • 2)That as indicated at the outset of the fifth considerando of the judgment, that failure to monitor the property — which allowed a third party to cause the environmental damage — gives rise to liability by omission on the part of the plaintiffs herein, in accordance with Articles 98 and 101 of the Ley Orgánica del Ambiente, which provide: "Article 98. Imputation for environmental damage // Environmental damage or contamination may arise from acts of commission or omission and is imputable to all natural or legal persons who carry it out." "Article 101. Liability of infringers // Without prejudice to liabilities of any other nature that may arise from their participation in any capacity, those who cause infringements of the present law or of laws regulating the protection of the environment and biological diversity, whether natural or legal persons, shall be civilly and jointly and severally liable for the damages and losses caused. Joint and several liability shall also attach to the owners of the enterprises or activities in which the damage is caused, whether by act or by omission (…)" (the underscoring appears in the original);
  • 3)That in accordance with what was indicated at the outset of the fifth considerando, already discussed, there existed on the part of the plaintiffs herein a violation of Articles 98 and 101 of the Ley Orgánica del Ambiente, committed by omission; a form of liability that, in the strict sense, cannot be confused with the figure of strict liability (responsabilidad objetiva), which is precisely the liability that exists independently of any fault on the part of the responsible party;
  • 4)That notwithstanding the foregoing, and the fact that at the outset of the fifth considerando of the judgment a form of environmental liability by omission is discussed, the reasoning subsequently — within the same fifth considerando, beginning with the paragraph that opens with the phrase: "La normativa indicada es clara" — makes a "logical leap" and begins to address strict liability, which according to legal doctrine is "(…) that which is established by law without any personal act constituting a deliberate current infringement of the legal order or an intentional breach of another's property or rights" (see the entry for that concept in the Diccionario Jurídico Elemental by Guillermo Cabanellas de Torres, updated by Nombre159156 — Editorial Heliasta, Buenos Aires, 16th ed., 2003, p. 352);
  • 5)The fact that the challenged judgment made the "logical leap" mentioned above does not invalidate it, because, as shown, liability on the part of the plaintiffs did exist; accordingly, the administrative acts (actos administrativos) challenged in these proceedings are consistent with the law.
  • V)Third ground of appeal (agravio): The attorney-in-fact (apoderado) of the plaintiffs contends that the challenged judgment misapplies and misinterprets Articles 98 and 101 of the Ley Orgánica del Ambiente, attributing to those provisions a scope they do not possess. The text of Art. 101 is transcribed, and it is argued that in the specific case at hand it is not possible for the plaintiffs to be condemned "to civil payment and to joint and several liability" when they were not the cause of the infringements. The representative notes further that the plaintiffs were even acquitted of the offenses set forth in Articles 57 and 61 of Ley 7575. It is argued that Art. 101 of the aforementioned law is imprecise, and that in this case the plaintiffs have no established business entity, let alone any commercial or profit-making activity on the property. The argument concludes: "If that is so, then where does one find the rule establishing that, simply by being the owners of a piece of land, we bear strict liability for the actions carried out by third parties?

The court, and even less the Tribunal Ambiental Administrativo, can regard this article as granting authorization to punish the owner of a piece of land for acts or omissions by third parties that have nothing to do with us. To interpret it otherwise is to extend the rule to situations not contemplated by the legislature, thereby violating the principle of legality" (fs. 317-318).

This argument likewise cannot succeed. It must be borne in mind that liability by omission attaches to the owners of real property who have failed to prevent the commission of environmental damage, by direct application of the language of Art. 101 of the Ley Orgánica del Ambiente, whose text has already been cited, and no imprecision of the kind alleged is apparent. Moreover, in the case of owners of real property that fulfills an ecological function — as is the case with the property on which the environmental damage occurred — it cannot be said that the administrative resolutions applied provisions to situations not contemplated by the legislature; rather, those resolutions gave effect to the purposes of the law, which are to establish a broad liability regime in the face of environmental damage. Nor does the existence of a form of liability by commission (committed by Nombre28601) exclude the liability by omission of the plaintiffs herein.

  • VI)Fourth ground of appeal: The representative of the plaintiffs challenges the interpretation of Art. 109 of the Ley Orgánica del Ambiente, on the grounds that the challenged judgment held that the parties subject to administrative proceedings must demonstrate that they did not cause the damage, thereby reversing the burden of proof (carga de la prueba). It is stated that the plaintiffs proposed a site inspection (reconocimiento) to the Tribunal Ambiental Administrativo, which rejected the request, and that as a result of that decision it was not possible to demonstrate various facts, including that the property is properly fenced, its location, the access roads, and the distance and topography between the cut timber and the home of Nombre61168. The trial judge's decision — holding that the Tribunal Ambiental Administrativo's decision not to carry out the site inspection was misguided, because it made it impossible to show that the events would have occurred regardless, even with the utmost diligence of a good administrator — is considered incorrect.

The representative argues that the a quo was wrong to conclude that no defenselessness existed. It is also asserted that, through the submission of a certificate showing the archiving of the criminal complaint, "…it was possible to determine that the plaintiffs had no direct or indirect responsibility (sic) for the acts of tree felling, but moreover the challenged judgment also, as we said, clarifies and corrects the assertion in the Por tanto of the judgment of the Tribunal Ambiental Administrativo to the effect that Nombre61168, Nombre159155, and Nombre159154 were not responsible for the environmental damage, yet curiously this important fact does not result in the annulment of the act, as would be proper" (uppercase letters appear in the original) (fs. 318-320).

The argument cannot succeed. We have already rejected the contention that the absence of criminal liability attributed to the plaintiffs herein necessarily bears on what is decided in these proceedings, conducted before the contentious-administrative jurisdiction (jurisdicción contenciosa-administrativa). As regards the alleged violation of the right of defense and effective access to due process, arising from the fact that the site inspection requested in connection with the real property was not carried out during the administrative proceedings, the Court likewise finds the argument unconvincing, because a review of the administrative record (expediente administrativo) reveals that there was compelling evidence regarding the characteristics and severity of the environmental damage, and the particular conditions of the property — specifically the alleged multiple points of access to it — could not at any point have exempted the parties from liability for that damage.

It must also be noted that in these judicial proceedings the plaintiffs did not effectively pursue the site inspection of the property, nor did they produce other evidence — witness testimony, photographs, or videos — that would have made it possible to determine that, at the time of the events, any other party could have caused the environmental damage. In the circumstances, no prejudice or defenselessness was caused to the plaintiffs, since despite having had the opportunity to develop procedural activity to prove the facts they considered relevant, they did not do so in the manner required. As for the reversal of the burden of proof established in Art. 109 of the Ley Orgánica del Ambiente, this is a fundamental procedural rule in environmental matters that, for the reasons stated, was not improperly applied in the present case.

  • VII)Fifth ground of appeal: It is contended that Resolution N° 409-2003 or N° 309-2003 (both numbers are cited interchangeably) of 15:43 hours on May 6, 2003, issued by the Tribunal Ambiental Administrativo, is contrary to law, because while on the one hand it states that Nombre61168, Nombre159155, Nombre159154, and Nombre28601 constructed two logging trails and a timber-collection yard (patio de acopio) and indiscriminately logged the forest without authorization from the Administración Forestal del Estado, on the other hand, official communication ACOSA-SPF-CP-017-D states that the unlawful activity was carried out directly by Nombre28601. The representative further states that at the hearing (comparecencia) held on January 30, 2003, the plaintiffs appeared to clarify the facts and to find out who had stolen the timber; that even the reporting official did not appear at the hearing, and the other witnesses (Nombre159157, Nombre159158, and Nombre159159) did not testify against them, leaving the proceedings devoid of evidence (fs. 320-322).

Upon analyzing the plaintiffs' argument, the Court finds that it cannot succeed. In that regard, a review of the judgment of the court of first instance reveals that it noted and corrected certain inconsistencies in the challenged administrative resolutions, reaching the well-founded conclusion that, although those inconsistencies existed, the acts of the Administration remained consistent with the law. In that same vein, a review of the challenged administrative resolutions shows that the extensive evidence in the record was analyzed, which demonstrated the environmental damage caused and that such damage occurred on the plaintiffs' property, and that those conclusions are not undermined by the absence of the reporting official.

  • VIII)Sixth ground of appeal: The special judicial attorney-in-fact (apoderado especial judicial) of the plaintiffs states that the Tribunal Ambiental Administrativo failed to fulfil the primary function of the administrative proceedings, which is to determine the material truth (verdad real) of the facts, in that it held the hearing without the presence of the reporting official, without any interest in gathering new evidence for the record, and without ascertaining the outcome of the existing criminal complaint filed against the plaintiffs. The representative concludes the argument by stating: "In conclusion, there is no doubt that the Tribunal Ambiental Administrativo did not fulfil its legally established duty (sic) in this specific case and acted with a high degree of negligence, with arbitrariness, and with very, very (sic) little seriousness." This argument is a mere repetition of the previous one and must therefore be dismissed.

However, it should also be noted that, although inconsistencies did exist in the challenged administrative resolutions (resoluciones administrativas), the Environmental Administrative Tribunal (Tribunal Ambiental Administrativo) and the authorities of the Ministerio del Ambiente y Energía acted diligently in ascertaining the material truth (verdad real) and afforded the parties opportunities to effectively exercise their right of defense (derecho de defensa). Nor is there any finding of arbitrariness or lack of seriousness, given that even with the existing material limitations, the harm was established and the corresponding liability could be determined, without the absence of the reporting official weakening the probative force of the evidence already in the record.- IX) Seventh Ground of Appeal (agravio): It is argued that the Tribunal Ambiental Administrativo violated the rights of defense and due process (debido proceso) established in Article 39 of the Constitution.

The plaintiffs allege that the administrative body should have awaited the outcome of the criminal complaint filed by MINAE against the plaintiffs herein in order to determine the degree of liability. This was not done; rather, guilt was simply presumed and a finding of liability was entered. The plaintiffs' representative takes the position that the doctrine of strict liability (responsabilidad objetiva) and the shifting of the burden of proof (carga de la prueba) onto the accused is contrary to the Constitution. He states that "…strict liability requires laws that establish and create the risk, as in the case of parents with respect to their children, the reason being that only this activity creates the risk; in the present case, the mere fact of owning a farm with forest cover is not sufficient to presume strict liability, for the simple reason that no law has so provided, and were one to do so it would be unconstitutional" (fs. 323-324).

On the basis of the foregoing arguments, the plaintiffs request that the appeal (recurso de apelación) be granted, that the lawsuit be upheld, and that resolution of the Tribunal Ambiental Administrativo No. 409-03, issued at fifteen hours and forty-three minutes on the sixth of May of two thousand and three, as well as all other administrative or judicial acts derived from the application of that resolution, be annulled.- It is found that this point of the appeal is a recapitulation of the arguments advanced throughout. It bears repeating, therefore, that in this case no violation of the plaintiffs' rights of defense or due process was found during the administrative proceeding (procedimiento administrativo). Nor is there any finding of a lack of legal basis for the establishment of liability under Articles 98 and 101 of the Ley Orgánica del Ambiente. It is the view of this Court that if the plaintiffs consider the liability regimes or the legislature's decision to redistribute the burden of proof in environmental matters to be unconstitutional, they may bring the corresponding actions before the constitutional jurisdiction (jurisdicción constitucional).- X) On the basis of the foregoing arguments, the plaintiffs' grounds of appeal against the first-instance judgment (sentencia de primera instancia) must be dismissed and the appellate recourse (recurso de alzada) submitted must be denied.-

Por tanto:

Proceso ordinario contencioso-administrativo de Nombre61168 y otros contra el Estado N° 19-2009-S.X Tribunal Contencioso Administrativo y Civil de Hacienda, Sección Décima. Segundo Circuito Judicial de San José. Goicoechea, Anexo A, a las once horas y cincuenta y nueve minutos del trece de febrero del dos mil nueve.- Se conoce recurso de apelación de los actores dentro de proceso ordinario contencioso-administrativo de Nombre61168 , Nombre159154 y Nombre159155 , quienes son mayores, casados una vez, agricultores, vecinos de Drake de Osa, quienes portan respectivamente, las siguientes cédulas de identidad: CED125425, y CED125427, en contra del Estado, representado últimamente por Procuradora Adjunta Gloria Solano Martínez, mayor, casada, abogada, portadora de la cédula de identidad número CED1449- - , vecina de Heredia. Interviene además en su condición de apoderado especial judicial de los actores, el Licenciado Ricardo Granados Calderón, mayor, casado una vez, abogado, portador de la cédula de identidad número CED125426- - , vecino de Sabana Norte.-

Resultando:

  • I)Fijada la cuantía de este asunto como inestimable (véase resolución de folio 193), la demanda es para que en sentencia se declare: " De acuerdo a mis argumentos y las fuentes de derechos citadas, solicito respetuosamente se declare con lugar la presente demanda y se anule la resolución emitida por el Tribunal Ambiental Administrativo, número 409-03 de las quince horas con cuarenta y tres minutos del día seis de mayo del dos mil tres, y la resolución 606-03 TAA de las doce horas con cuarenta y cuatro minutos del cinco de junio del dos mil tres, así como los demás actos administrativos o judiciales derivados de la aplicación de dicha resolución. Que al anularse la sentencia se condene al Estado al pago de los daños y perjuicios que se ocasionaron, y que se detallan en esta demanda. De igual forma, solicitamos el pago de las costas" (véase escrito de deducción de la demanda, f. 92).- II) El Estado contestó negativamente la demanda y opuso la excepción de falta de derecho.

Pidió además, que se condene a los actores al pago de ambas costas por la acción. Asimismo, opuso la excepción de falta de derecho (véase escrito de contestación, fs. 179-188).- III) Que la jueza de instancia, Licda. Gricelda Trejos Vega, por medio de su sentencia N° 294-2008 de las nueve horas cuarenta minutos del veintiocho de marzo del dos mil ocho, desestimó la demanda en su todos sus extremos, señalando en la parte dispositiva de la misma, lo siguiente: "Se acoge la excepción de falta de derecho interpuesta por el Estado y consecuentemente se declara sin lugar en todos sus extremos la demanda intentada. Son ambas costas de esta acción a cargo de la parte actora” (véase sentencia a fs. 296-312).- IV) Que los actores apelaron la sentencia mencionada y dicha apelación fue admitida por el Juzgado y en razón de ello conoce de la misma este Tribunal.- V) Al asunto se le ha dado el trámite que le es propio y no se notan defectos que invaliden lo actuado o que deban ser corregidos, por lo que se procede a dictar sentencia dentro del término que lo permiten las labores del Despacho, previa la deliberación de rigor.- Redacta el Juez Canales Hernández;

Considerando:

  • I)Se prohija el elenco de hechos probados y no probados de la sentencia impugnada.- II) Cabe indicar que los agravios del apoderado especial de los actores, contra la sentencia de primera instancia, son fundamentalmente los indicados en su escrito de interposición del recurso de alzada (fs. 314-325). Con el fin de facilitar la exposición y no incurrir en repeticiones innecesarias, en los siguientes apartados, se hará referencia a cada agravio y al análisis realizado por parte de esta Cámara.- III) Primer agravio : Se indica que existió una incorrecta valoración de los hechos, que incide en la sentencia. Así, se afirma que de manera equivocada se consideró por parte del a quo que no se demostró la presentación de alguna denuncia con relación al robo que los actores afirman haber sufrido, omitiéndose de esa manera denunciar el daño ambiental sufrido en la zona protegida, incumpliéndose de esa forma con la obligación de protección que se tenía en su condición de titulares del inmueble afectado. Esa afirmación obvia que la finca mide 134 hectáreas y que está compuesta de bosque primario, con acceso a dos calles públicas y que es precisamente por la parte más lejana que se realizó la extracción, amén que Nombre61168 no vive en la finca, sino en otra localidad. Asimismo, en la sentencia impugnada no se toma en cuenta que la denuncia penal presentada por estos mismos hechos, fue archivada por los tribunales de la jurisdicción penal, sin que se pudiera demostrar la comisión por parte de los afectados, de los delitos establecidos en los numerales 57 y 61 de la Ley Forestal. Manifiesta también, que no se encontraron pruebas contra el denunciado Nombre28601 , mismo que no es propietario del inmueble, ni tiene relación alguna con los actores. También se omite analizar que el terreno fue adquirido por los suscritos (sic) en el año 1997 y que durante ese período se ha cuidado y protegido, a pesar que se ha negado la posibilidad de extraer madera, lo que incluso llevó a plantear un juicio a la postre ganado, por limitación excesiva del derecho de propiedad (véase fs. 314-316).- El agravio del representante de los actores, no puede prosperar: en primer término, en este proceso no se discute la responsabilidad penal de los actores por los delitos que en su oportunidad se les atribuyó ante la jurisdicción penal, sino el hecho que en momento de las situaciones en que se causó daño ambiental (que no se discute por las partes), eran los propietarios de la finca, omitiendo la vigilancia necesaria sobre el inmueble, lo que permitió que se causara un daño ambiental de importancia, con infracción de normas de carácter ambiental. Debe recordarse que un mismo hecho, puede acarrear distintos tipos de responsabilidad (civil, penal, administrativa), que pueden ser conocidas bajo las reglas propias de los distintos ramos del derecho, por procesos diferentes y ante distintos órganos jurisdiccionales, no implicando en ningún momento que la exoneración de responsabilidad en una vía, conlleve que necesariamente se exima de responsabilidad en otra. Tampoco es relevante, ni exime de la responsabilidad establecida por el Tribunal Ambiental Administrativo, que en otro proceso jurisdiccional se haya declarado que se establecieron limitaciones excesivas en el disfrute de la propiedad y que esa limitación deba ser indemnizada, por cuanto eso no afecta las obligaciones de protección ambiental que tienen los propietarios, sobre sus inmuebles. Más bien, revisada la sentencia de la Sala Primera de la Corte Suprema de Justicia, se reafirma el dominio de los actores sobre el predio, debiéndose recordar que el ostentar el dominio o la posesión sobre un bien inmueble que cumple fundamentalmente con la función ecológica, no sólo acarrea derechos (como las reconocidas por los tribunales en su oportunidad a favor de los actores), sino también obligaciones, entre ellas fundamentalmente, la conservación del bien.- IV) Segundo agravio: El apoderado de los actores, indica que existió de parte del a quo una incorrecta aplicación e interpretación de las normas jurídicas. Se combate la afirmación de que en este caso existió responsabilidad objetiva, cuando en la propia sentencia impugnada se consideró que el Tribunal Ambiental Administrativo se equivocó al sancionar a Nombre28601 , mismo que no es propietario de la finca donde se dio la afectación. Con base en lo anterior, el representante de los accionantes indica que el único responsable de la extracción y disposición ilegales fue esta última persona. Se manifiesta textualmente: "Así las cosas, no solo (sic) existe una contradicción en la resolución impugnada, sino que esta conlleva necesariamente una anulación del fallo del Tribunal Ambiental, pues si éste en su parte dispositiva se equivoca, en cuanto a un elemento de tanta importancia como es quienes realizaron los hechos objeto del ilícito y el juzgado lo corrobora y lo corrije (sic) no es posible que esta situación no impacte la legalidad de la resolución 409-03". Considera el apoderado, que los artículos 98 y 101 de la Ley Orgánica del Ambiente sólo son de aplicación a los responsables directos de la corta y no a los propietarios, que más bien este caso fueron los perjudicados por la acción del tercero y no el Estado, que además cobra por las acciones de un tercero. Si existió un tercero, que es responsable directo de la extracción, no es aplicable la figura de la responsabilidad objetiva. Concluye el argumento indicando que: "Ahora bien como la carga de la prueba resulta inversa, como (sic) se demuestra nuestra inocencia "objetiva" pues demostrando la culpabilidad del que comete los hechos, sin embargo no mira el Juzgado Contencioso Administrativo, que esto ya fue establecido por parte del Tribunal Ambiental Administrativo, y que esta persona fue el señor Nombre28601 , razón por lo cual no debemos demostrar nosotros que no fuimos responsables" (fs. 316-317).- Analizada la sentencia impugnada, se encuentran varias situaciones de importancia:
  • 1)Que los aquí actores, omitieron su deber de vigilar adecuadamente el bien inmueble de su propiedad, lo que posibilitó que un tercero (Nombre28601 ), realizara la tala y construyera las trochas, actividades prohibidas, por tratarse de un bosque primario parte del patrimonio forestal del Estado (véase hechos probados 1, 2 y 11);
  • 2)Que según lo indicado al inicio del considerando quinto de la sentencia, esa omisión en la vigilancia del inmueble que permitió la comisión del daño ambiental por un tercero, permite atribuirle responsabilidad por omisión, a los aquí actores, conforme con lo establecido en los artículos 98 y 101 de la Ley Orgánica del Ambiente, mismos que disponen: “Artículo 98. Imputación por daño al ambiente// El daño o contaminación al ambiente puede producirse por conductas de acción u omisión y le son imputables a todas las personas físicas o jurídicas que la realicen". Artículo 101. Responsabilidad de los infractores// Sin perjuicio de las responsabilidades de otra naturaleza que les puedan resultar como partícipes en cualquiera de sus formas, los causantes de las infracciones a la presente ley o a las que regulan la protección del ambiente y la diversidad biológica, sean personas físicas o jurídicas, serán civil y solidariamente responsables por los daños y perjuicios ocasionados. Solidariamente, también responderán los titulares de las empresas o las actividades donde se causen los daños, ya sea por acción o por omisión (...)" (los subrayados corresponden al original);
  • 3)Que conforme con lo indicado al inicio del considerando quinto, ya comentado, existió de parte de los aquí actores, la violación de los artículos 98 y 101 de la Ley Orgánica del Ambiente, se cometió por omisión; forma de responsabilidad que en sentido estricto, no puede confundirse con la figura de la responsabilidad objetiva, que es precisamente la que existe con independencia de toda culpa por parte del sujeto responsable;
  • 4)Que no obstante lo anterior y que al inicio del considerando quinto de la sentencia, se habla de una forma de responsabilidad ambiental, por omisión, más adelante (en el mismo considerado quinto, a partir del párrafo que inicia con la frase: “La normativa indicada es clara”) se da un “salto lógico” y se comienza a hablar de responsabilidad objetiva, que según la doctrina es “(…) la determinada legalmente sin hecho propio que constituya deliberada infracción actual del orden jurídico ni intencionado quebranto del patrimonio ni de los derechos ajenos” (así la entrada de dicho concepto, en el Diccionario Jurídico Elemental de Guillermo Cabanellas de Torres, actualizado por Nombre159156 –Editorial Heliasta, Buenos Aires, 16ª. Edición, 2003, p. 352);
  • 5)El hecho que en la sentencia cuestionada se haya dado el “salto lógico” mencionado, no la invalida, por cuanto, como vimos, la responsabilidad de parte de los actores, existió, razón por la cual los actos administrativos que se cuestionan en este proceso, son ajustados a derecho.- V) Tercer agravio: El apoderados de los actores indica que en la sentencia impugnada, se aplican e interpretan erróneamente los artículos 98 y 101 de la Ley Orgánica del Ambiente, dándosele a dichas disposiciones alcances que no tienen. Se transcribe el texto del art. 101 y se dice que en el caso en concreto, no se posible que se condene a los actores "al pago civil y a una solidaridad", cuando no se ha sido el causante de las infracciones. Señala que incluso a los actores se les absolvió de los delitos señalados en los artículos 57 y 61 de la Ley 7575. Se señala que el artículo 101 de la ley antes citada es impreciso, siendo que en este caso, los actores no tienen ninguna empresa constituida y mucho menos actividad comercial o lucrativa en la finca. Se concluye indicando: "Siendo así de donde (sic) sacan la norma que establece que nosotros por solo ser propietarios de una finca somos responsables objetivos por acciones que realicen terceras personas. no (sic) puede el juzgado y mucho menos el Tribunal Ambiental Administrativo considerar que este artículo conlleva una autorización para castigar al dueño de la finca por acciones o (sic) omisiones de terceros, que nada tienen que ver con nosotros. Interpretar en contrario sentido es extender la norma a supuestos no contemplados por el legislador, violando el principio de legalidad" (fs. 317-318).- Tampoco el argumento anterior, puede prosperar. Téngase presente que existe responsabilidad por omisión de los propietarios de inmuebles, que no hayan impedido que se haya cometido el daño ambiental, por aplicación directa de la frase del artículo 101 de la Ley Orgánica del Ambiente, cuyo texto ya citamos, no apreciándose la imprecisión alegada. Aún más, en el caso de los propietarios de una propiedad inmueble que cumple una función ecológica, como es en la que se produjo el daño ambiental, no se encuentra que no exista una aplicación a supuestos no aplicados por el legislador, sino más bien que las resoluciones administrativas cuestionadas, se cumplió con los propósitos de la ley, que son establecer un régimen de responsabilidad amplio, cuando se enfrente el daño ambiental. Tampoco, la existencia de una forma de responsabilidad por comisión (la cometida por Nombre28601 ), excluye la responsabilidad por omisión de los aquí actores.- VI) Cuarto agravio: Se cuestiona por parte del representante de los actores, la interpretación del art. 109 de la Ley Orgánica del Ambiente, por cuanto se consideró en la sentencia impugnada, que los administrados deben demostrar no haber ocasionado el daño, invirtiéndose la carga de la prueba. Se indica que los actores propusieron una inspección al Tribunal Ambiental Administrativo, mismo que rechazó la petición y que con esa decisión, no se pudo demostrar diversos hechos, entre ellos que la finca se encuentra debidamente cercada, su ubicación, los caminos de acceso, la distancia y la topografía entre la madera cortada y la casa de Nombre61168 . Se considera que la decisión de la Jueza de instancia, en la que se considera que la decisión del Tribunal Ambiental Administrativo, de no realizar dicha inspección, es desacertada, porque imposibilita demostrar que ni con la mejor diligencia de un buen administrador, de todas formas hubiesen ocurrido los hechos. Considera que no lleva razón el a quo, cuando estima que no existió indefensión. Afirma también, que por medio de la presentación de una certificación del archivo de la denuncia penal, "...pudo determinarse que los actores tuvimos responsabilidad directa ni indirecta (sic) de los hechos de corta de los árboles, pero además la sentencia recurrida según también dijimos aclara y corrige la afirmación del por tanto de la sentencia del Tribunal Ambiental Administrativo que los suscritos Nombre61168 , Nombre159155 Y Nombre159154 no fuimos responsables del daño ambiental, pero curiosamente este importante hecho, no influje (sic) en la anulación del acto como es lo procedente" (las mayúsculas corresponden al original) (fs. 318-320).- El argumento no puede prosperar. Ya con anterioridad habíamos descartado que el hecho de que no se atribuyera responsabilidad penal de los aquí actores, incidiera necesariamente en lo que se decida en este proceso, tramitado ante la jurisdicción contenciosa-administrativa. En cuanto a la supuesta vulneración del derecho de defensa y de acceso efectivo al debido proceso, por el hecho que no se practicara el reconocimiento solicitado en el inmueble, durante el procedimiento administrativo, se encuentra que tampoco lleva razón la actora, por cuanto revisado el expediente administrativo, existía prueba contundente sobre las características y gravedad del daño ambiental existente, siendo que las condiciones particulares del inmueble (específicamente los supuestos múltiples accesos a él), no podría en ningún momento haber eximido de la responsabilidad por el daño. Téngase presente también que tampoco en este proceso jurisdiccional, los actores instaron de forma efectiva el reconocimiento sobre el inmueble, ni aportaron otra prueba -testimonios, fotografías, vídeos- que permitieran determinar que en el momento de los hechos, el daño ambiental podía producirlo, cualquier otro sujeto. Así, en la especie, no se causó gravamen, ni indefensión alguna a los actores, por cuanto ellos a pesar de haber podido desarrollar actividad procesal, para demostrar los hechos que le interesaban, no la desplegaron como correspondía. En cuanto a la inversión de la carga probatoria, establecida en el art. 109 de la Ley Orgánica del Ambiente, esta es una regla procedimental fundamental en materia ambiental que por lo indicado, no se aplicó indebidamente en el presente caso.- VII) Quinto agravio: Se indica que la resolución N° 409-2003 o N° 309-2003 (se citan indistintamente ambos números) de las 15 horas 43 minutos del 6 de mayo del 2003 del Tribunal Ambiental Administrativo, es contraria a derecho, por cuanto si bien por un lado se afirma que Nombre61168 , Nombre159155 , Nombre159154 y Nombre28601 , construyeron dos trochas y un patio de acopio y talaron indiscriminadamente el bosque sin la autorización de la Administración Forestal del Estado, por otro lado, se tiene que en el oficio ACOSA-SPF-CP-017-D, se manifiesta que la actividad ilícita fue realizada directamente por Nombre28601 . Además, manifiesta que en la comparecencia celebrada el día 30 de enero del 2003, los actores acudieron a aclarar los hechos y a conocer datos sobre quiénes se habían robado la madera, siendo que incluso el funcionario denunciante no se presentó a la audiencia y los otros testigos (Nombre159157 , Nombre159158 y Nombre159159 ), no atestiguaron en su contra, encontrándose el proceso ayuno de prueba (fs. 320-322).- Analizado el argumento de los actores, se encuentra que no puede prosperar. En ese sentido, revisada la sentencia de primera instancia, en ella se anotan y corrigen ciertas inconsistencias existentes en las resoluciones administrativas cuestionadas, llegándose a la conclusión acertada que si bien esas inconsistencias existían, los actos de la Administración, seguían estando apegados a derecho. En ese sentido, revisadas las resoluciones administrativas cuestionadas, se encuentra que se analizó la profusa prueba existente en los autos, que demostraba el daño ambiental causado y que ese daño se dio en la propiedad de los actores, no perdiendo consistencia esas conclusiones por la ausencia del funcionario denunciante.- VIII) Sexto agravio: El apoderado especial judicial de los actores, indica que el Tribunal Ambiental Administrativo, incumplió con la función principal del procedimiento administrativo, como es determinar la verdad real de los hechos, siendo que realizó la comparecencia sin la presencia del funcionario denunciante y sin tener interés de allegar nuevas probanzas al expediente y sin averiguar el resultado de la denuncia penal existente en contra de los actores. Finaliza el argumento, diciendo: "En conclusión, no cabe duda, que el Tribunal Ambiental Administrativo no cumplió con su deber legalmente establecido (sic) en este caso concreto y actuó con un alto grado de negligencia, con arbitrariedad y muy muy (sic) poca seriedad".- Este argumento es una mera repetición del anterior y por esa razón debe descartarse. No obstante, también cabe indicar que si bien existieron inconsistencias en las resoluciones administrativas cuestionadas, también es cierto que el Tribunal Ambiental Administrativo y las autoridades del Ministerio del Ambiente y Energía, fueron diligentes en la averiguación de la verdad real y brindaron oportunidades a los actores para que pudieran ejercer eficazmente su derecho de defensa. Tampoco se encuentra que haya existido arbitrariedad y falta de seriedad, por cuanto aún con las limitaciones materiales existentes, se determinó el daño y se pudieron establecer las responsabilidad del caso, sin que la falta de comparecencia del funcionario denunciante debilitara la fuerza de convicción de la prueba existente en el proceso.- IX) Sétimo agravio: Se estima que el Tribunal Ambiental Administrativo, violó los derechos de defensa y debido proceso establecidos en el artículo 39 constitucional. Alega que el órgano administrativo debió esperar que la denuncia penal presentada por el MINAE en contra de los aquí actores, determinara el grado de responsabilidad. No obstante, así no se hizo, siendo que simplemente se presumió la culpabilidad y se condena. Se considera por el representante de los actores que la tesis de la responsabilidad objetiva y la carga de la prueba a costa del denunciado, resulta contraria a la Constitución. Indica que "...la responsabilidad objetiva requiere de leyes que la establezcan y creen el riesgo, como en el caso de los padres respecto de sus hijos, razón solo esta actividad establece el riesgo, que en el caso presente, el hecho de tener una finca con bosque no es suficiente para presumir una responsabilidad objetiva, por una sencilla razón, ninguna ley así lo ha señalado y de señalarlo es inconstitucional" (fs. 323-324). Con base en lo antes argumentado, pide se declare con lugar el recurso de apelación y se acoja la demanda presentada, anulándose la resolución del Tribunal Ambiental Administrativo, número 409-03 de las quince horas y cuarenta y tres minutos del seis de mayo del dos mil tres, así como los demás actos administrativos o judiciales derivados de la aplicación de esa resolución.- Se encuentra que este punto del recurso, es una recapitulación de los argumentos esgrimidos durante el mismo. Cabe repetir entonces que en este caso, no se encontró vulneración de los derechos de defensa y debido proceso de los actores, durante el procedimiento administrativo. Tampoco se encuentra que exista falta de fundamento legal, para el establecimiento de la responsabilidad establecida en los artículos 98 y 101 de la Ley Orgánica del Ambiente. Se considera que si los actores estiman inconstitucionales los regímenes de responsabilidad o la decisión del legislador de redistribuir la carga de la prueba en materia ambiental, podrían establecer las acciones correspondientes ante la jurisdicción constitucional.- X) Con base en lo antes argumentado, cabe descartar los agravios de los actores contra la sentencia de primera instancia y desestimar el recurso de alzada presentado.-
