JUDICIAL BRANCH CRIMINAL COURT OF CASSATION Res. [Telf1] CRIMINAL COURT OF CASSATION. Second Judicial Circuit of San José. Goicoechea, at nine hours and forty minutes on the twenty-seventh of October two thousand six.
APPEAL FOR CASSATION (recurso de casación) filed in the present case brought against [Nombre1], [Nombre2], and [Nombre3], whose personal details and address are on record, for the offense of VIOLATION OF THE Ley Forestal, to the detriment of NATURAL RESOURCES. The judges [Nombre4], Ulises Zúñiga Morales, and [Nombre5] participate in the decision on the appeal. Attorney [Nombre6], Criminal Prosecutor, appeared before the Court of Cassation.
BACKGROUND:
1. That by means of a ruling issued at sixteen hundred hours on the seventeenth of August two thousand six, the Trial Court of the Southern Zone, Pérez Zeledón seat, resolved: "Por tanto: In the present case brought against [Nombre7], national identity card number CED1, against [Nombre8], identity card CED2, and against [Nombre9], identity card CED3, for the offense of Violation of the Ley Forestal, committed to the detriment of Natural Resources, for the acts described in the charging document (pieza acusatoria) at folio 35 and in the private criminal complaint (querella) filed by the Office of the Attorney General of the Republic, a JUDGMENT OF DEFINITIVE DISMISSAL (sobreseimiento definitivo) DUE TO THE STATUTE OF LIMITATIONS (prescripción de la acción penal) IS ENTERED in favor of the accused. The civil damages action (acción civil resarcitoria) filed by the State is ordered archived. All costs of the criminal proceedings shall be borne by the State. No special award of costs is made with respect to the civil action. Once this ruling becomes final, the case file shall be archived. Francisco Sánchez Fallas. JUDGE." 2. That against the foregoing ruling, Attorney [Nombre6] filed an Appeal for Cassation.
3. That upon completion of the relevant deliberation in accordance with the provisions of article 450 of the Code of Criminal Procedure, the Court considered the issues raised in the Appeal.
4. That the relevant legal requirements have been observed in the proceedings.
DRAFTED by Cassation Judge [Nombre10]; and,
Considerando:
I.The appeal for cassation meets the admissibility requirements of articles 422, 423, 424, 443, 444, and 447 of the Code of Criminal Procedure, and the Court therefore proceeds to consider the grounds presented.
II.In the first ground of the appeal for cassation on procedural form, the representative of the Office of the Attorney General of the Republic alleges the defect of failure to state reasons (falta de fundamentación) in the judgment and the violation of articles 142 of the Code of Criminal Procedure and 58 of the Ley Forestal. He states that in the present matter, the accused were charged with the alleged commission of the offense of Illegal Logging (Tala Ilegal), as well as the offense defined and penalized under section 58 of the Ley Forestal. However, in the challenged judgment, the Trial Court of the Southern Zone, Pérez Zeledón seat, the trial judge proceeded to enter a judgment of dismissal on grounds of the statute of limitations without taking into consideration that the offense of Invasion of a Protected Zone (Invasión a Zona Protegida) is an instantaneous offense with permanent effects (delito instantáneo de efectos permanentes), in which case the statute of limitations does not begin to run until the moment the invasion ceases.
Nevertheless, in order to avoid that issue, the court considered that, in order to determine whether or not the offense of Invasion of a Protected Zone existed, it was necessary to establish whether the spring (naciente) being referred to was permanent or not, for which reason it referred the parties to establish that matter in another proceeding. The appellant argues that the ruling lacks adequate reasoning, and accordingly requests that the appeal be granted, the judgment be annulled, and "a new trial hearing" be ordered. The argument is meritorious. In the private criminal complaint filed by the Office of the Attorney General of the Republic (folios 1 and 2), as well as in the charge filed by the Public Prosecutor's Office (folios 34 to 37), [Nombre11], [Nombre12], and [Nombre13], all [Nombre14], are charged with acting jointly to illegally fell (talar) approximately "one-fifth of a hectare" of a tropical rainforest (bosque tropical húmedo) located in Santa Elena de General Viejo de Pérez Zeledón, with the purpose of effecting a land-use change (cambio de uso del suelo) and dedicating the land to coffee cultivation.
To that end, they proceeded to fell 51 trees of various species found at a distance of 75 meters from a spring, and proceeded to girdle (anillar) other timber trees. These acts were classified as constituting the offenses defined and penalized under sections 58 and 61 of the Ley Forestal. As the first of these provisions states, "a prison term of three months to three years shall be imposed on whoever: a) Invades a conservation or protection area (área de conservación o protección), regardless of its management category, or other forested areas or lands subject to the forestry regime (régimen forestal), regardless of the area occupied; regardless of whether they are privately owned, owned by the State or other bodies of the Public Administration, or are privately held lands. The perpetrators or participants in the act shall have no right to any compensation for any construction or work carried out on the invaded lands." This provision is complemented by article 33 of the same law, which declares as a protection area "Areas bordering permanent springs, defined as a radius of one hundred meters measured horizontally." If in the present case the charges indicate that the site where the logging and the land-use change occurred is located seventy-five meters from a spring, it is evident that the question of whether that spring is permanent or not is a matter of evidence (cuestión probatoria) that must necessarily be addressed in the proceedings.
Therefore, the trial judge's argument is not acceptable when, in recital 2, specifically at point 2.3., he holds that "as can be inferred from the MINAE official communication at folio 154, the offense of Invasion of the Protection Area may be occurring, in the event that the spring described in the charge is a permanent one, since coffee crops remain at the site to this day. However, that matter must be resolved in another proceeding if it is of interest to the prosecuting body, since in the present case the charging document does not describe..." (folio 178). Contrary to what the trial judge asserts, the charging documents are in fact clear in describing that the logging and land-use change occurred at a distance of 75 meters from a spring. These elements are, in this Court's view, sufficient for the accused to be aware of the acts for which they are being investigated and to guarantee their right of defense.
Determining whether that spring is permanent or not is strictly a matter of evidence that must be resolved in the course of the proceedings. Consistent with the foregoing, it is clear that both the description of the acts set forth in the charges and the legal classification given in the private criminal complaint contemplate the offense of Invasion of a Protected Zone. Furthermore, the case law of this Court of Cassation has been consistent in holding that this type of offense has permanent effects, such that the computation of the statute of limitations begins to run from the moment the invasion of the protected zone ceases (Cf. Criminal Court of Cassation, Votes [Telf2] of 9:30 hours of 11 July 2002, [Telf3] of 16:15 hours of 30 September 2002, [Telf4] of 10:52 hours of 20 May 2004). In the present matter, as the trial judge himself acknowledges in the challenged judgment, the invasion is apparently ongoing, meaning that the statute of limitations has not even begun to run.
Finally, although the charging documents refer to the commission of various offenses, the trial judge must duly analyze and provide reasoning as to whether the case involves a single act constituting a single offense, an act in which different legally protected interests are violated, or several independent acts. This is necessary in order to prevent the formation of res judicata (cosa juzgada), since for those purposes what matters are the facts and not the legal classifications. Accordingly, given that the alleged defect exists, the ground is granted, the challenged judgment of dismissal is annulled, and a remand (reenvío) is ordered so that the processing of the case may continue as appropriate at law. The second ground of the appeal is omitted as it is unnecessary to resolve it.

RECURSO DE CASACIÓN interpuesto en la presente causa seguida contra [Nombre1], [Nombre2] y [Nombre3], de calidades y vecindario conocidos en autos, por el delito de INFRACCION LEY FORESTAL, en perjuicio de RECURSOS NATURALES. Intervienen en la decisión del recurso los jueces [Nombre4], Ulises Zúñiga Morales y [Nombre5]. Se apersonó en Casación el Licenciado [Nombre6], Procurador Penal.
RESULTANDO:
1. Que mediante resolución dictada a las dieciséis horas del dieicisiete de agosto de dos mil seis, el Tribunal de Juicio de la Zona Sur, sede Pérez Zeledón, resolvió: "POR TANTO: En la presente causa seguida contra [Nombre7] de cédula de identidad número CED1, contra [Nombre8] de cédula CED2 y contra [Nombre9] de cédula CED3, por el delito de Infracción a La Ley Forestal, cometido en perjuicio de Los Recursos Naturales, por los hechos descritos en la pieza acusatoria de folio 35 y en la querella formulada por la Procuraduría General de La República, se dicta a favor de los acusados una SENTENCIA DE SOBRESEIMIENTO DEFINITIVO POR PRESCRIPCIÓN DE LA ACCION PENAL. Se ordena el archivo de la acción civil ressarcitoria formulada por el Estado. Son ambas costas del proceso penal a cargo del Estado. Se resuelve sin especial condena en costas en cuanto a la acción civil. Una vez firme archívese el expediente. Francisco Sánchez Fallas. JUEZ.".
2. Que contra el anterior pronunciamiento el Licenciado [Nombre6] interpuso Recurso de Casación.
3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 450 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el Recurso.
4. Que en los procedimientos se han observado las prescripciones legales pertinentes.
REDACTA el Juez de Casación [Nombre10]; y,
CONSIDERANDO:
I.El recurso de casación reúne los requisitos de admisibilidad de los artículos 422, 423, 424, 443, 444 y 447 del Código Procesal Penal, por lo que se entran a conocer los motivos presentados.
II.En el primer motivo de casación por la forma, el representante de la Procuraduría General de la República aduce el vicio de falta de fundamentación de la sentencia y el quebranto de los artículos 142 del Código Procesal Penal y 58 de la Ley Forestal. Señala que en el presente asunto se acusó la presunta comisión del delito de Tala Ilegal, así como el delito previsto y sancionado en el numeral 58 de la Ley Forestal. Sin embargo, en la sentencia cuestionada, el tribunal de Juicio de la Zona Sur, sede de Pérez Zeledón, el juzgador procede a dictar una sentencia de sobreseimiento por prescripción sin tomar en consideración que el delito de Invasión a una Zona Protegida es un delito instantáneo de efectos permanentes, en cuyo caso la prescripción empieza a correr hasta el momento en que cese la invasión. Sin embargo, para obviar ese tema, el tribunal consideró que para determinar si existía o no el delito de Invasión a la zona protegida era necesario establecer si la naciente a que se hacía referencia era o no permanente, por lo cual remitió a las partes a que establecieran otro proceso.
Estima que la resolución dictada carece de fundamento, por lo cual solicita se declare con lugar el recurso, se anule la sentencia y se ordene "una nueva audiencia de debate". El alegato es atendible. En la querella planteada por la Procuraduría General de la República (folios 1 y 2), así como en la acusación formulada por el Ministerio Público (folios 34 a 37),se atribuye a los imputados [Nombre11], [Nombre12] y [Nombre13], todos [Nombre14], el actuar conjuntamente para talar de forma ilegal, aproximadamente una "quinta héctarea" de un bosque tropical húmedo situado en Santa Elena de General Viejo de Pérez Zeledón con el propósito de cambiar el uso del suelo y dedicarlo a la siembra de café. Para ello procedieron a talar 51 árboles de diversas especies que se encontraban a una distancia de 75 metros de una naciente y procedieron a anillar otros árboles maderables. Tales hechos fueron calificados como constitutivos de los delitos previstos y sancionados en los numerales 58 y 61 de la Ley Forestal.
Según dispone el primero de ellos, "se impondrá prisión de tres meses a tres años a quien: a) Invada un área de conservación o protección, cualquiera que sea su categoría de manejo, u otras áreas de bosques o terrenos sometidos al régimen forestal, cualquiera que sea el área ocupada; independientemente de que se trate de terrenos privados del Estado u otros organismos de la Administración Pública o de terrenos de dominio particular. Los autores o participes del acto no tendrán derecho a indemnización alguna por cualquier construcción u obra que hayan realizado en los terrenos invadidos". Norma que se complementa con el artículo 33 de la misma ley que declara como área de proteccion "Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal". Si en el presente caso las acusaciones señalan que el lugar donde ocurrió la tala y el cambio del suelo se ubica a setenta y cinco metros de una naciente, es evidente que el tema de si la misma es o no permanente, se trata de una cuestión probatoria que necesarimente debe ser discutida en el proceso.
De allí que no resulte atendible el argumento del juzgador cuando en el considerando 2, específicamente en el punto 2.3. sostiene que "según se desprende del oficio MINAE de folio 154, podría estarse dando un delito de Invasión al Area de protección, ello en caso de que la naciente que se describe en la acusación fuere permanente, ya que a la fecha se mantienen en el sitio los cultivos de café. Pero ese tema deberá ser resuelto en otro proceso si es de interés del órgano acusados, ya que en esta causa no se describe en la pieza acusatoria..." (folio 178). Contrario a lo afirmado por el juzgador, las piezas acusatorias sí son claras al describir que la tala y cambio de destino del suelo ocurrieron a una distancia de 75 metros de una naciente. Elementos que a criterio de este tribunal resultan suficientes para que los acusados conozcan los hechos por los cuales se les investiga, así como para garantizar el derecho de defensa.
El establecer si dicha naciente es o no permanente, es un tema estrictamente probatorio que debe ser dilucidado en el desarrollo del proceso. En concordancia con lo anterior, queda claro que tanto la descripción de los hechos establecidos en las acusaciones, como en la calificación legal dada en la querella, contemplan el delito de Invasión a Zona Protegida. Ahora bien, la jurisprudencia de este Tribunal de Casación ha sido abundante al sostener que este tipo de delitos son de efectos permanentes, por lo que el cómputo de los plazos de prescripción empieza a correr a partir del momento en que cesa la invasión a la zona protegida (Cfr.Tribunal de Casación Penal, Votos [Telf2] de las 9:30 horas del 11 de fulio de 2002, [Telf3] de las 16:15 horas del 30 de setiembre de 2002, [Telf4] de las 10: 52 horas del 20 de mayo de 2004). En el presente asunto, según lo reconoce el propio juzgador en la sentencia recurrida, aparentemente se mantiene la invasión, con lo cual ni siquiera ha iniciado el plazo de prescripción.
Finalmente, aunque las piezas acusatorias se refieren a la comisión de distintos delitos, debe el juzgador analizar y fundamentar debidamente, si se trata de una sóla acción constitutiva de un solo delito, de una acción donde se vulneren distintos bienes jurídicos o de varias acciones independientes. Ello con el fin de evitar que se produzca la cosa juzgada, puesto que para esos efectos lo que interesa son los hechos y no las calificaciones legales. En consecuencia, al existir el vicio reclamado, se declara con lugar el motivo, se anula la sentencia de sobreseimiento recurrida, ordenándose el reenvío, para que se continúe la tramitación de la causa, conforme corresponda en derecho. Por resultar innecesario se omite resolver el segundo motivo de la impugnación.
POR TANTO:
Se declara con lugar el recurso de casación interpuesto por la Procuraduría General de la República. Se anula la sentencia de sobreseimeinto recurrida, ordenándose el reenvío, para que se continúe la tramitación de la causa, conforme corresponda en derecho. Por resultar innecesario se omite resolver el segundo motivo de la impugnación. NOTIFÍQUESE.
