LEAD OPINION JUDICIAL BRANCH CRIMINAL CASSATION TRIBUNAL Res. [Telf1] CRIMINAL CASSATION TRIBUNAL. Second Judicial Circuit of San José. Goicoechea, at eleven o'clock on the fourteenth of September, two thousand and five.

CASSATION APPEAL filed in the present case brought against [Nombre1], adult, in a common-law union, farmer, national identity document number CED1, resident of Sarapiquí, and [Nombre2], adult, in a common-law union, farmer, resident of Sarapiquí, Nicaraguan national, for the offense of VIOLATION OF THE Ley Forestal, to the detriment of NATURAL RESOURCES. Participating in the decision on the appeal are Judges [Nombre3], Guillermo Sojo Picado, and [Nombre4]. Appearing before the Cassation Tribunal are Licenciado [Nombre5], Public Defender (Defensor Público), as well as Licenciada [Nombre6], representative of the Office of the Public Prosecutor (Ministerio Público), and Licenciado [Nombre7], Criminal Prosecutor (Procurador Penal).

RECITALS:

1. By means of a ruling issued at thirteen hours and ten minutes on the nineteenth of May, two thousand and four, the Trial Tribunal of Heredia resolved: "Por tanto: In accordance with the foregoing, Articles 39 and 41 of the Political Constitution; Articles 1, 30, 45, 59 through 63, 71, 73, 74, and 110 of the Criminal Code; Articles 58 and 61, subsection a), of Ley Forestal number 7575; Articles 265 through 270 and 360 et seq. of the Code of Criminal Procedure, [Nombre1] is declared the RESPONSIBLE AUTHOR of ILLEGAL TIMBER HARVESTING (aprovechamiento ilegal de madera) committed to the detriment of NATURAL RESOURCES, and as such is sentenced to THREE MONTHS OF IMPRISONMENT to be served, after crediting the pretrial detention (preventiva) already served, in the place and manner specified by the applicable prison regulations. The benefit of a suspended sentence (ejecución condicional) is granted for a period of three years, during which the defendant (imputado) shall not commit a new willful offense punishable by imprisonment of more than six months, under penalty of revocation of the benefit.

For the same offense and to the detriment of the same injured party, [Nombre2] is ACQUITTED of penalty and liability. The FORFEITURE (comiso) of the seized timber in favor of the State Forest Administration is ordered. The costs of the proceedings shall be borne by the convicted party. Once final, this judgment shall be recorded in the Judicial Registry. Zayra Sevilla Mora, Judge." 2. Against the foregoing ruling, Licenciado [Nombre8] filed a Cassation Appeal.

3. Upon completion of the respective deliberations in accordance with the provisions of Article 450 of the Code of Criminal Procedure, the Tribunal considered the issues raised in the Appeal.

4. The relevant legal requirements have been observed throughout the proceedings.

Opinion drafted by Judge [Nombre9]; and,

CONSIDERING:

I.The Trial Tribunal of Heredia, pursuant to Judgment No. 242 of 13:10 hours on May 19, 2004, sentenced the defendant [Nombre1] to THREE MONTHS of imprisonment for the offense of ILLEGAL TIMBER HARVESTING, to the detriment of NATURAL RESOURCES. On his part, Lic. [Nombre5], in his capacity as public defender of the defendant, files a cassation appeal against the cited judgment, which meets the requirements set forth in Articles 444 and 445 of the Code of Criminal Procedure, and is therefore admitted for review.

II.The first ground of the cassation appeal on procedural form alleges lack of intellectual evidentiary reasoning (fundamentación probatoria intelectiva), pursuant to Articles 1, 142, 363.c), 369.d), 443, and 450 of the Code of Criminal Procedure. It is argued that every judgment must include a proper enumeration of the evidence received during the oral trial (debate) and, beyond that, the judge must set out the factual and legal reasons underlying the analysis of the evidence, in order to articulate the reasons for which a person is found guilty of the charged offense or, as the case may be, innocent. It is further argued that in the present case, the challenged judgment does not contain an analysis of the reasons for which the judge considers the defendant to be the sole author and responsible party for the illegal timber harvesting, since the judgment merely sets out the statements of the witnesses and of the other accused (who was acquitted), but at no point explains the reasons that led the trial judge to that determination, nor the evidentiary basis therefor.

The judgment's reasoning does not indicate whether the timber had already been sawn, where it was located, whether it was old-growth timber that had been felled long ago, whether it had been sawn a long time earlier, whether a permit was required in that area to harvest timber, what type of timber was harvested, what quantity, or whether the co-defendants were merely transporting the timber. The argument continues that by failing to provide this analysis of the evidence and limiting itself to transcribing the witnesses' statements without explaining why the accused is found to have illegally harvested timber, the judgment is defective. The ground is well-founded. It is important to reproduce the facts found to be proven, as set out in "Considerando" I, under "Statement of Proven Facts":

"a) On March 21, 2003, officials of MINAE, namely [Nombre10], [Nombre11], [Nombre12], and [Nombre13], were conducting a patrol at approximately ten o'clock in the morning through the squatter settlement (precario) of Dos Locos de la Virgen de Sarapiquí, and came upon the defendants herein while they were transporting, for the use of defendant [Nombre1], 114 pieces of timber of the cacho venado and gavilán species, without holding the corresponding permit for that purpose. B) As a result of the foregoing, the said officials seized the timber and filed the corresponding complaint." (folio 57).

It is clear that the facts found to be proven are insufficiently clear in essential elements constituting the criminal offense (tipo penal) of illegal timber harvesting, because the conduct is defined by the normative concept incorporated into the criminal offense under Art. 61.a) of Ley Forestal, but the judgment does not elaborate on the content of that concept or the specific act in which the harvesting consisted. In this regard, Art. 61.a) of the cited Ley Forestal provides:

"[…] [Anyone who] harvests one or more forest products on private property without the permit of the State Forest Administration, or who, even holding a permit, does not comply with what was authorized." From a reading of the foregoing criminal provision, several elements of the criminal conduct can be extracted, which must of course be investigated and proven by the Office of the Public Prosecutor against the defendant; furthermore, the trial judge, when rendering a conviction, must examine and analyze these elements in the reasoning of the judgment. Accordingly, it is necessary to define the "harvesting" of forest products on "private property," as well as the absence of the respective "permit" from the State Forest Administration, or, in the case of holding a permit, non-compliance with what was authorized. In the case sub judice, the description of the proven facts omits all matters relating to the specific content of the harvesting of forest products and the acts carried out by the defendant in connection therewith; likewise, the judgment fails to find proven another normative element of the criminal offense, namely the private-property status of the location from which the illegally harvested forest product was extracted.

One might think that these deficiencies in the description of the proven facts are remedied in the reasoning of the judgment; however, this is not the case, since on this point, which is addressed in "Considerando" II under "Evaluation of Evidence. Legal Analysis," the only statement made is:

"[…] Witnesses [Nombre14] and [Nombre15], MINAE officials, stated that they came upon the defendants at the 'Los Locos' farm removing already-sawn timber, which was scattered in various places, ready to be transported. They mention certain statements that the defendants allegedly made to them in that regard; however, as is well known, those statements cannot be taken into account because they were obtained without following the applicable legal requirements. Notwithstanding the foregoing, the defendant [Nombre16] stated that the co-defendant [Nombre1] hired him to remove some timber from the farm that he said was his, which he claims to have believed, and that he agreed because he was unemployed and saw it as a way to earn money honestly. He also stated that [Nombre17] intended to use the timber for the construction of a small house. The MINAE officials were emphatic that in the settlement from which the timber was obtained there is no permit for its harvesting and that it is a protected forest grazing zone, and that the defendants did not produce any felling or timber-harvesting permit.

Furthermore, the fact that the defendant [Nombre1] does not hold such a permit is demonstrated by the certification incorporated into the oral trial record, appearing at folio 49 of the case file. Under these circumstances, it has been established that the defendant [Nombre17] [Nombre18] was harvesting timber from a farm without holding the respective permit, which makes him liable for the sanction set forth in Article 61, subsection 1) (sic) of Ley Forestal N° 7575." (folio 62).

What has been reproduced above constitutes the only reasoning contained in the challenged judgment, the content of which is directed at the mere recitation of the statements of witnesses [Nombre19] and [Nombre20], without conducting a genuine evaluation and analysis of this evidence. Similarly, reference is made to the content of the statement of the co-defendant — who was acquitted — [Nombre21], which is likewise not subjected to the filter of the rules of sound judgment (sana crítica), so as to reveal the reasoning process followed by the trial judge in reaching her conclusions. In addition to the foregoing, with respect to the documentary evidence (MINAE report-complaint at folios 1 and 2, field-inspection report at folio 5, temporary-custodian record defining the felled tree species and their quantities at folio 6, certification that no felling and timber-harvesting permit was granted in favor of defendant [Nombre22] at folio 49) and the expert evidence (appraisal of the felled timber, description of species, quantities, physical characteristics, and value at folio 4), absolutely nothing is said about it; neither its content is set out nor is any evaluation conducted.

It is therefore evident that there is an absence of intellectual evidentiary reasoning; the first ground of the cassation appeal on procedural form is upheld, and accordingly the judgment in its entirety and the oral trial that preceded it are annulled. Consequently, remand (reenvío) for new proceedings in accordance with law is ordered.

III.In light of the manner in which this matter is resolved, the other grounds of the cassation appeal on procedural form and on the merits are not addressed.

Por tanto:

The first ground of the cassation appeal on procedural form is upheld, and accordingly the judgment in its entirety and the oral trial that preceded it are annulled. Consequently, remand for new proceedings in accordance with law is ordered. In light of the manner in which this matter is resolved, the other grounds of the cassation appeal on procedural form and on the merits are not addressed.

PONENCIA PODER JUDICIAL TRIBUNAL DE CASACIÓN PENAL Res. [Telf1] TRIBUNAL DE CASACIÓN PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las once horas del catorce de setiembre de dos mil cinco.

RECURSO DE CASACIÓN interpuesto en la presente causa seguida contra [Nombre1], mayor, unión libre, agricultor, cédula de identidad número CED1, vecino de Sarapiquí y [Nombre2], mayor, unión libre, agricultor, vecino de Sarapiquí, nicaragüense, por el delito de INFRACCION A LA LEY FORESTAL, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los jueces [Nombre3], Guillermo Sojo Picado y [Nombre4]. Se apersonaron en Casación los Licenciados [Nombre5], Defensor Público, así como la Licenciada [Nombre6], representante del Ministerio Público y el Licenciado [Nombre7], Procurador Penal.

RESULTANDO:

1. Que mediante resolución dictada a las trece horas con diez minutos del diecinueve de mayo de dos mil cuatro, el Tribunal de Juicio de Heredia, resolvió: “POR TANTO: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política; 1, 30, 45, 59 a 63, 71, 73, 74 y 110 del Código Penal; 58 y 61 inciso a) de la Ley Forestal número 7575: 265 a 270 y 360 y siguientes del Código Procesal Penal, se declara a [Nombre1] AUTOR RESPONSABLE de APROVECHAMIENTO ILEGAL DE MADERA cometido en perjuicio de los RECURSOS NATURALES, y en tal carácter se le impone la pena de TRES MESES DE PRISION que deberá descontar, previo abono de la preventiva sufrida, en el lugar y forma que indiquen los respectivos reglamentos carcelarios. Se le con concede el beneficio de ejecución condicional por un período de tres años, durante los cuales no deberá cometer nuevo delito doloso sancionado con prisión mayor de seis meses, so pena de revocársele el beneficio. Por el mismo delito y en perjuicio del mismo ofendido se ABSUELVE de pena y responsabilidad a [Nombre2]. Se dispone el COMISO a favor de la Administración Forestal del Estado de la madera decomisada. Son las costas del proceso a cargo del condenado. Una vez firme, inscríbase este fallo en el Registro Judicial Zayra Sevilla Mora, Jueza.”.

2. Que contra el anterior pronunciamiento el Licenciado [Nombre8] interpuso Recurso de Casación.

3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 450 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el Recurso.

4. Que en los procedimientos se han observado las prescripciones legales pertinentes.

REDACTA el Juez [Nombre9]; y,

CONSIDERANDO:

I.El Tribunal de Juicio de Heredia, según sentencia N° 242 de las 13:10 horas del 19 de mayo del 2004, condenó al imputado [Nombre1] a TRES MESES de prisión por el delito de APROVECHAMIENTO ILEGAL DE MADERA, en perjuicio de LOS RECURSOS NATURALES. Por su parte, el Lic. [Nombre5], en su condición de defensor público del imputado, formula recurso de casación contra la citada sentencia, el cual reúne los requisitos exigidos por los artículos 444 y 445 del Código Procesal Penal, por lo que se admite para su conocimiento.

II.Se alega en el primer motivo del recurso de casación por la forma, falta de fundamentación probatoria intelectiva, conforme los artículos 1, 142, 363.c), 369.d), 443 y 450 del Código Procesal Penal. Se indica que toda sentencia debe contar con la debida enunciación de la prueba recibida debidamente en el debate y, aparte de ello, el juzgador debe exponer las razones de hecho y de derecho en que se fundamenta su análisis de la prueba, para plasmar las razones por las cuales encuentra a una persona culpable del delito acusado o, en su caso, inocente. Agrega que en el presente caso, el fallo recurrido no cuenta con el análisis de las razones por las cuales la juzgadora considera que el imputado es autor único y responsable del aprovechamiento ilegal de la madera, pues la sentencia se limita a indicar las declaraciones de los testigos y del otro encartado (absuelto), pero en ningún momento explica las razones que llevaron a la a quo a esa determinación, así como la fundamentación en la misma prueba.

No se señala en la fundamentación de la sentencia que la madera se encontraba aserrada, dónde estaba, si estaba vieja de haber sido talada, si tenía mucho tiempo de haber sido aserrada, si se necesitaba permiso en esa área para aprovechar madera, qué clase de madera fue la que aprovechó, cuánta cantidad, o si los coimputados estaban únicamente movilizando esa madera. Refiere que al no darse todo este análisis de la prueba de parte de la juzgadora y limitarse a transcribir la declaración de los testigos, sin indicar el por qué se considera que el encartado aprovechó madera de forma ilegal, existe un vicio en la sentencia. El motivo resulta atendible. Es importante transcribir los hechos que se han tenido por demostrados, conforme el “Considerando” I referido a la “Relación de hechos probados”;

“a) El día 21 de marzo del año 2003, los funcionarios del Ministerio de Ambiente y Energía, señores [Nombre10], [Nombre11], [Nombre12] y [Nombre13], realizaban un recorrido, a eso de las diez de la mañana, por el precario Dos Locos de la Virgen de Sarapiquí, y sorprendieron a los aquí imputados cuando estaban movilizando, para ser aprovechadas por el imputado [Nombre1], 114 piezas de madera de la especie cacho venado y gavilán, sin contar con el correspondiente permiso para ello. B) Que en virtud de lo anterior, los citados funcionarios decomisaron dicha madera y formularon la correspondiente denuncia.” (folio 57).

Es claro que los hechos tenidos por demostrados son poco claros en aspectos esenciales de conformación del tipo penal del aprovechamiento ilegal de madera, porque define la acción por el concepto normativo que se incorpora en el tipo penal del artículo 61.a) de la Ley Forestal, pero no se detiene a exponer el contenido de dicho concepto y la acción específica en que consistió ese aprovechamiento. En este sentido, dice el artículo 61.a) de la citada Ley Forestal; “ […] Aproveche uno o varios productos forestales en propiedad privada, sin el permiso de la Administración Forestal del Estado, o quien, aunque cuente con el permiso, no se ajuste a lo autorizado.” De la lectura de la norma penal anterior se extraen varios elementos de la acción típica, los cuales, por supuesto, deben ser investigados y demostrados como ciertos por parte del Ministerio Público en contra del imputado, además, lógicamente, que el juzgador de instancia, al acordar una sentencia condenatoria, debe examinar y analizar en la fundamentación del fallo.

Por ello, se debe definir el “aprovechamiento” de los productos forestales en “propiedad privada”, así como la ausencia del respectivo “permiso” de la Administración Forestal del Estado o, en caso de contar con permiso, no se ajuste a lo autorizado. En el caso subjúdice se deja de lado en la descripción de los hechos probados, lo relativo al contenido propio del aprovechamiento de los productos forestales y las acciones que se realizaron por parte del imputado para el mismo; de igual forma, no se detiene el fallo a tener por demostrado otro elemento normativo del tipo penal, como lo es, la condición de propiedad privada de lugar de donde se extrae el producto forestal que se aprovecha ilegalmente. Podríamos pensar que estas deficiencias de la descripción de los hechos probados se solventan en la fundamentación de la sentencia, sin embargo, ello no es así, pues acerca de este extremo que se desarrolla en el “Considerando” II sobre “Valoración de la prueba.

Análisis de derecho”, únicamente se dice; “[…] Los testigos [Nombre14] y [Nombre15], funcionarios del MINAE, indicaron que sorprendieron a los imputados en la finca ‘Los Locos’ sacando madera ya aserrada, la cual tenían diseminada en varias partes, lista para ser transportada. Ellos mencionan algunas aseveraciones que supuestamente los imputados les hicieron al respecto, sin embargo, bien sabemos que las mismas no pueden ser tomadas en cuenta por tratarse de declaraciones obtenidas sin que se siguieran las prescripciones legales respectivas. Pese a ello, el imputado [Nombre16] señaló que el coimputado [Nombre1] lo contrató para sacar una madera de la finca que según le dijo era de él, lo que dice haber creído, y que aceptó porque estaba sin trabajo y vio con ella la forma de ganarse un dinero honradamente. Dijo además que [Nombre17] emplearía esa madera para la construcción de una casita.

Los funcionarios del MINAE fueron enfáticos en que el asentamiento de donde se obtuvo esa madera no existe permiso para aprovechamiento de la misma y que es zona de repasto, de bosque protegida, y que los imputados no mostraron ningún permiso de tala ni aprovechamiento de madera. Asimismo, el que el imputado [Nombre1] no cuenta con dicho permiso, se demuestra con la certificación incorporada al debate, visible a folios 49 del expediente. En tales circunstancias, ha quedado demostrado que el imputado [Nombre17] [Nombre18] estaba aprovechando madera de una finca, sin contar con el respectivo permiso, lo que lo hace acreedor a la sanción establecida en el artículo 61 inciso 1) (sic) de la Ley Forestal N° 7575.” (folio 62).

Lo que se ha transcrito corresponde a la única fundamentación que se realiza en la sentencia recurrida, dirigiendo su contenido a la simple exposición de las declaraciones de los testigos [Nombre19] y [Nombre20], sin que se realice una verdadera valoración y análisis de estas pruebas. De igual forma, se refiere el contenido de la declaración del coimputado -absuelto- [Nombre21], la cual tampoco es sometida al tamiz de las reglas de la sana crítica, para conocer el íter seguido por la juzgadora de instancia para llegar a sus conclusiones. Aunado a lo anterior, respecto a la prueba documental (Informe-denuncia del MINAE folios 1 y 2, informe de gira a folio 5, acta de depositario temporal donde se define las especies de los árboles talados y su cantidad a folio 6, certificación de no otorgamiento de permiso a favor del imputado de [Nombre22] para talar y aprovechar los árboles a folio 49) y pericial (avalúo de la madera talada, descripción de las especies, cantidades, características físicas y valor a folio 4), no se dice absolutamente nada sobre ella, ni se entra a exponer su contenido y realizar valoración alguna.

Por ello, resulta evidente la ausencia de fundamentación probatoria e intelectiva, se declara con lugar el primer motivo del recurso de casación por la forma y, a su vez, se anula la sentencia en su totalidad y el debate que le precedió. En consecuencia, se dispone el reenvío para su nueva sustanciación conforme a derecho.

III.Por la forma como se resuelve este asunto, no se entra a conocer los otros motivos de forma y fondo del recurso de casación.

POR TANTO:

Se declara con lugar el primer motivo del recurso de casación por la forma y, a su vez, se anula la sentencia en su totalidad y el debate que le precedió. En consecuencia, se dispone el reenvío para su nueva sustanciación conforme a derecho. Por la forma como se resuelve este asunto, no se entra a conocer los otros motivos de forma y fondo del recurso de casación.
