SUMARIA N- 04- 000009- 008- PE Res: [Telf1] TRIBUNAL DE CASACIÓN PENAL. Segundo Circuito Judicial de San José. Goicoechea, at fifteen hours and forty minutes on the fifteenth of April, two thousand and five.

SENTENCE REVIEW PROCEEDING (procedimiento de revisión de sentencia) filed in the present case against [Nombre1], of legal age, married, a native of Pérez Zeledón, born on the sixteenth of November, nineteen fifty-seven, for the offense of VIOLATION OF THE LEY FORESTAL, to the detriment of NATURAL RESOURCES. The Judges Guillermo Sojo Picado, Rafael Ángel Sanabria Rojas, and Jorge Luis Morales García participate in the decision of the sentence review proceeding. Attorney [Nombre2], private defense attorney (defensora particular) for the accused, and Attorney [Nombre3], representing the Ministerio Público, appeared in the cassation proceeding.

WHEREAS:

I.By judgment rendered at seven o'clock on the fifteenth of November, nineteen ninety-five, the Juzgado Penal de Pérez Zeledón, San Isidro de El General, ruled: "THEREFORE: In accordance with the foregoing and Article 39 of the Political Constitution (Constitución Política), Articles 1, 11, 30, 34, 45, 50, 59, 60, 61, 62, 63, 71, 73 of the Criminal Code, Articles 1, 68, 69, and 122(a) of the Ley Forestal Nº 7174, and Articles 1, 392 to 399, 401, 421, 511, 543, and 544 of the Code of Criminal Procedure (Código de Procedimientos Penales), [Nombre1] is hereby declared (sic) the sole author and responsible party for the offense of VIOLATION OF THE LEY FORESTAL IN ITS MODALITY OF ILLEGAL FELLING (CORTA) AND HARVESTING (APROVECHAMIENTO) OF TIMBER AND FOREST PRODUCTS committed to the detriment of NATURAL RESOURCES, and by virtue thereof he is sentenced to SIX MONTHS of imprisonment to be served at the appropriate Correctional Center (Centro Penitenciario), with credit for any pre-trial detention already served.- Because he qualifies for it, he is granted the Benefit of the SUSPENDED SENTENCE (CONDENA DE EJECUCION CONDICIONAL DE LA PENA) for a probationary period of THREE YEARS, on the understanding that if he commits a new intentional offense punishable by a prison term of more than six months during the probationary period, this Court will revoke the Benefit hereby granted.- Once this judgment is final, a summary thereof shall be entered in the Judicial Registry of Offenders (Registro Judicial de Delincuentes).- The costs of the present proceedings are charged to the Accused.- As requested by the Representative of the Ministerio Público, the corresponding certified copy of proceedings (testimonio de piezas) is ordered against the Accused in order to initiate a criminal investigation against him, with the purpose of confirming or ruling out the possible existence of the offense of Usurpation of Water Rights (Usurpación de Aguas).- By reading in the Courtroom at the time and date indicated, the parties are duly notified.- Criminal Case Nº 271-95.- LIC. [Nombre4]. CRIMINAL JUDGE OF [Nombre5]".

II.Against the foregoing ruling, Attorney [Nombre2], private defense attorney for the accused, filed a sentence review proceeding.

III.Upon completion of the corresponding deliberation in accordance with Article 416 of the Code of Criminal Procedure (Código Procesal Penal), the Court addressed the issues raised in the sentence review proceeding.

IV. The relevant legal requirements have been observed in the proceedings

The judgment is drafted by Cassation Judge [Nombre6]; and,

CONSIDERING:

I- Attorney [Nombre2], in her capacity as private defense attorney for the convicted person (sentenciado) [Nombre7], files a review of the judgment rendered at seven o'clock on the fifteenth of November, nineteen ninety-five by the Tribunal de Juicio de Pérez Zeledón. She bases the review on Articles 1 and 408(f), 409(a), 410 and following of the Code of Criminal Procedure, as well as on Articles 42 of the Political Constitution, 12 of the Criminal Code, and the Ley Forestal 7575 of February 3, 1996. She claims retroactive application of the latter legislation on the grounds that, upon its entry into force, the conduct for which convicted person [Nombre8] was sentenced ceased to constitute a criminal offense (devino en atípica). It is stated that the said defendant (justiciable) was convicted by the aforementioned Trial Court to a sentence of six months of imprisonment as the responsible author of the offense of violation of the Ley Forestal in its modality of illegal felling and harvesting of timber and forest products.

That judgment was rendered on the basis of Articles 68, 69, and 122(a) of the Ley Forestal 7174, which remained in force from 1990 to 1996 and until the approval of the current Ley Forestal 7575 of February 13, 1996. Said law criminalizes illegal logging (tala ilegal) and illegal harvesting of timber in a manner far more lenient than the previous law. The petitioner argues that the conduct for which the defendant was convicted ceases to constitute a criminal offense under the invoked Ley Forestal 7575, and therefore represents a far more favorable provision than the one previously in force. Consequently — she continues — it must be given retroactive effect in favor of the convicted person. It is noted that Ley Forestal number 7575 of February 13, 1996 ceased to treat illegal logging on private property as a criminal offense, under the terms in which the accused committed it according to the proven facts of the judgment under review.

It is stated that the accused was convicted for the offense of "Violation of the Ley Forestal in its modality of illegal felling and harvesting of timber and forest products," as provided and sanctioned by Article 122(a) of the Ley Forestal N°- 7174. Regarding this latter law, it is stated that it criminalizes the felling of trees without the corresponding permit on private property, which was the conduct that was found to have been proven against the defendant. In contrast, the new Ley N° 7575 establishes as a criminal offense only the harvesting of forest products on private property — not mere felling — when carried out without authorization from the Dirección General Forestal. In support of the thesis set forth in the review, decisions (votos) of the Tribunal de Casación Penal N° 929-2001, 682-97, and 745-97 are cited. It is finally argued that, pursuant to the jurisprudence of the Tribunal de Casación Penal, the felling of trees on private land constitutes an offense only when it takes place in a forest (bosque), with the dimensions and characteristics specified in the law, so that if the felling occurred on a coffee plantation, the legally protected interest was not harmed — since the felling did not take place in a forest — rendering the conviction untenable.

The petitioner adds: "My client had a coffee plantation (finca de café) where trees were removed in areas that do not constitute forest, even though they are protection zones (zonas de protección) by virtue of being on the bank of a stream (quebrada)." While the Ley Forestal in its Article 34 establishes the prohibition against cutting or removing trees in the protection zones defined in Article 33, no sanction is established for that action. The claims are denied. For the purpose of resolving the claim and contextualizing the factual framework from which the resolution of this matter must proceed, it is worth noting that the Tribunal de Juicio de Pérez Zeledón, in the judgment under review, found the following to be true: "That the accused (encartado) [Nombre1] is the owner of a property (finca) located in Rosario de Pacuar de Pérez Zeledón, a piece of real estate on which he developed (sic) a coffee cultivation project, and that at the beginning of June nineteen ninety-five he ordered (sic) his workers to fell and destroy the protection zone of an intermittent stream running through his property, over an approximate length of fifty meters, eliminating tree species such as pavillo, lengua de vaca, manzano, nance, and achiotillo, while also blocking the flow of water by ordering the construction of a dam two meters high by five meters wide. 2.- That the accused did not hold any forestry permit to carry out such work." (cf.

Folios 28 verso and 29 recto of the main file). Based on the foregoing proven facts, the defendant was declared the responsible author of the offense of Violation of the Ley Forestal in its modality of illegal felling and harvesting of timber and forest products, all in accordance with Article 122(a) of the Ley Forestal 7174. That provision covered the conduct of any person who fells or harvests forest products on private property without holding authorization from the Dirección General Forestal. Such conduct — contrary to the appellant's argument — was not decriminalized (despenalizada) by subsequent legislation; that is, by the Ley Forestal 7575 of April 16, 1996, published in Supplement (Alcance) No. 21 of Tuesday, April 16, 1996. The latter law clearly establishes in Article 58(b) — punishable by a sentence of three months to three years of imprisonment — that the following constitutes an offense, whoever: "a)-…b)- Harvests forest resources on lands belonging to the State's natural heritage (patrimonio natural del Estado) and in protection zones for purposes other than those established in this law. c)-…".

On the other hand, Article 33(c), which defines protection zones, declares as such: "a)…b) A strip of fifteen meters in rural areas and ten meters in urban areas, measured horizontally on both sides, along the banks of rivers, streams, or brooks, if the terrain is flat, and of fifty horizontal meters if the terrain is rugged. c)…d)…". Likewise, Article 3(a) of the cited Ley 7575 defines harvesting (aprovechamiento) as the "...act of felling, eliminating timber trees, or using fallen trees, carried out on private lands not included in Article 1 of this Law, that generates or may generate some benefit, gain, advantage, utility, or profit for the person performing it or for the person he or she represents." Furthermore, Article 1, paragraph two, of the aforementioned Ley Forestal N- 7575 is entirely clear when it states that, given the existence of a public interest, "...the felling or harvesting of forests in national parks, biological reserves, mangroves, protective zones (zonas protectoras), wildlife refuges, and State-owned forest reserves is prohibited." From the combined reading of Articles 1 paragraph 2, 3(1), 33(b), and 54(b) of Ley Forestal Number 7575 of April 16, 1996, it must be concluded that the logging or felling of trees in protected zones — such as riverbanks under the circumstances regulated therein — even when on private property, remains a punishable act and therefore has not been decriminalized as argued.

It should be clarified that while it is true that some decisions of this Court have embraced the thesis of non-criminal conduct in areas that do not fall within the concept of forest — as defined by Article 3(d) of the cited Ley Forestal N° 7575 — and setting aside the fact that this thesis is not uniformly held by the Court in that regard — those decisions are not applicable to the factual circumstances adjudicated here, since, according to the proven facts, the defendant proceeded to develop a coffee cultivation project, ordering for that purpose the felling and destruction of a protection zone along a stream. In other words, the circumstances here are different from those resolved in Voto 929-2001 of 9:45 a.m. on November 16, 2001. Finally, it must be noted that it is not true that the current Ley Forestal contains no sanction for the felling of trees in protection zones, because — as already set forth above — Article 58(b) does regulate that scenario. Consequently, and for the reasons stated, the review proceeding is denied.

THEREFORE:

The review proceeding brought on behalf of the convicted person [Nombre1] is denied. Notify the parties.

Goicoechea, a las quince horas cuarenta minutos del quince de abril de dos mil cinco.- PROCEDIMIENTO DE REVISION DE SENTENCIA interpuesto en la presente causa seguida contra [Nombre1], mayor, casado, nativo de Pérez Zeledón, el dieciséis de noviembre de mil novecientos cincuenta y siete, por el delito de INFRACCION A LA LEY FORESTAL, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del procedimiento de revisión de sentencia, los Jueces Guillermo Sojo Picado, Rafael Ángel Sanabria Rojas y Jorge Luis Morales García. Se apersonaron en casación la Licenciada [Nombre2], defensora particular del imputado y en representación del Ministerio Público el Licenciado [Nombre3].-

RESULTANDO:

I.Que mediante sentencia dictada a las siete horas del quince de noviembre de mil novecientos noventa y cinco, Juzgado Penal de Pérez Zeledón, San Isidro de El General, resolvió: “POR TANTO: De conformidad con lo expuesto y artículo 39 de la Constitución Política, 1, 11, 30, 34, 45, 50, 59, 60, 61, 62, 63, 71, 73, del Código Penal, 1, 68, 69 y 122 inciso a) de la Ley Forestal Nº 7174, 1, 392 a 399, 401, 421, 511, 543 y 544 del Código de Procedimientos Penales se declarar (sic) a [Nombre1] como autor único y responsable de un Delito de INFRACCION A LA LEY FORESTAL EN SU MODALIDAD DE CORTA Y APROVECHAMIENTO ILEGAL DE MADERA Y PRODUCTOS FORESTALES cometido en daño de los RECURSOS NATURALES y en virtud de ello se le impone el tanto de SEIS MESES de prisión que descontará en el Centro Penitenciario que corresponda previo abono de la preventiva sufrida si la hubiere.- Por calificar para ello se le otorga el Beneficio de la CONDENA DE EJECUCION CONDICIONAL DE LA PENA por un período de prueba de TRES AÑOS en el entendido de que si comete nuevo delito doloso sancionado con pena de prisión mayor a los seis meses durante el período de prueba el Despacho le revocará el Beneficio que ahora le concende.- Firme esta sentencia inscríbase un resumen de la misma en el Registro Judicial de Delincuentes.- Son las costas del presente proceso a cargo del Encartado.- Tal y como lo solicita el Representante del Ministerio Público, se ordena el respectivo testimonio de piezas en contra del Encartado a fin de que se inicie investigación criminal en su contra, con el propósito de acreditar o descartar la posible existencia de un Delito de Usurpación de Aguas.- Mediante lectura en la Sala de Debates a la hora y fecha señaladas quedan debidamente notificadas las partes.- Causa Penal Nº 271-95.- LIC. [Nombre4]. JUEZ PENAL DE [Nombre5]”.-

II.Que contra el anterior pronunciamiento interpuso procedimiento de revisión de sentencia la Licenciada [Nombre2], defensora particular del imputado.-

III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 416 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el procedimiento de revisión de sentencia.-

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta el Juez de Casación [Nombre6]; y,

CONSIDERANDO:

I- La Licenciada [Nombre2], en su condición de defensora particular del sentenciado [Nombre7], interpone procedimiento de revisión de la sentencia de las siete horas del quince de noviembre de mil novecientos noventa y cinco dictada por el Tribunal Juicio de Pérez Zeledón. Fundamenta la revisión en los numerales 1, 408 inciso f)-; 409 inciso a)-, 410 y siguientes del Código Procesal Penal, así como en los numerales 42 de la Constitución Política, 12 del Código Penal y en la Ley Forestal 7575 del 3 de febrero de 1996. Reclama aplicación retroactiva de esta última normativa en cuanto considera que con su vigencia devino en atípica la conducta por la cual el sentenciado [Nombre8] fue condenado. Se dice que el indicado justiciable fue condenado por ese Tribunal de Juicio supracitado a una pena de seis meses de prisión como autor responsable del delito de infracción a la Ley Forestal en su modalidad de corta y aprovechamiento ilegal de madera y productos forestales.

Dicha sentencia fue dictada con fundamento en los numerales 68, 69, y 122 inciso a)- de la Ley Forestal 7174, la cual se mantuvo vigente de 1990 a 1996 y hasta la aprobación de la actual Ley Forestal 7575 del 13 de febrero de 1996. Dicha ley tipifica la tala ilegal y aprovechamiento ilegal de madera en forma mucho más benévola que la ley anterior. En tesis de la quejosa, la conducta por la cual se condenó al justiciable deviene en atípica conforme a la Ley Forestal 7575 invocada, y por ende, se trata de una norma mucho más favorable que la anteriormente vigente. Ergo – sigue diciendo – debe dársele efecto retroactivo a favor del sentenciado. Se señala que la Ley Forestal número 7575 del 13 de febrero de 1996 dejó de considerar como hecho típico la tala ilegal en propiedad privada y en los términos en que los cometió el acusado según los hechos probados del fallo cuya revisión se pide. Se dice que al imputado se le condenó por el delito de “Infracción a la Ley Forestal en su modalidad de corta y aprovechamiento ilegal de madera y productos forestales” previsto y sancionado por el artículo 122 inciso a)- de La Forestal N°- 7174.

Respecto de esta última Ley se dice que tipifica como delito la corta de árboles sin el respectivo permiso en propiedad privada, que fue la conducta que se tuvo por demostrada en contra del justiciable. En cambio la nueva Ley N° 7575 establece como delito únicamente el aprovechamiento de los productos forestales en propiedad privada y no una simple corta, cuando se realice sin el permiso de la Administración Forestal. Se cita en apoyo de la tesis expuesta en la revisión los votos del Tribunal de Casación Penal N° 929- 2001, 682- 97 y 745 – 97. Se dice finalmente que de conformidad con la jurisprudencia del Tribunal de Casación Penal, la tala de árboles en terrenos privados se establece como delito solo cuando se realice en un bosque, con las dimensiones y características señaladas en la Ley, de modo que si la corta se hizo en una finca de café, no se afectó el bien jurídico –esto al no ocurrir la tala en un bosque, por lo que la condena se vuelve insostenible.

Agrega la gestionante que “ Mi defendido tenía una finca de café donde se eliminaron árboles en zonas que no es bosque, aún cuando si es zonas de protección por ser el margen de una quebrada”. Si bien la Ley Forestal en su artículo 34 establece la prohibición de cortar o eliminar árboles en las zonas de protección definidas en el artículo 33, no se establece sanción alguna para esa acción. Los reclamos se declaran sin lugar. A los fines de resolver el reclamo y contextualizar el marco fáctico sobre el que debe partir la resolución de este asunto, conviene indicar que el Tribunal de Juicio de Pérez Zelcdón en la sentencia que se pide revisar, tuvo por cierto lo siguiente: “ Que el encartado [Nombre1] es propietario de una Finca ubicada en el Rosario de Pacuar de Pérez Zeledón, inmueble donde desarrollo (sic) un proyecto de cultivo de café, siendo que para principios del mes de junio de mil novecientos noventa y cinco, ordeno (sic) a sus peones la tala y destrucción de la zona de protección de una quebrada intermitente, que discurre en su Finca, en una longitud aproximada de cincuenta metros, eliminando especies de árboles como pavillo, lengua de vaca, manzano, nance y achiotillo, bloqueando a la vez el paso del agua, al ordenar construir un represa de dos metros de altura por cinco metros de ancho. 2- Que el encartado no contaba con permiso forestal alguno para realizar esos trabajos”.

(cf. Folios 28 vuelto y 29 frente del principal). Conforme a los anteriores hechos probados al justiciable se le declaró autor responsable del delito de Infracción a La Ley Forestal en su modalidad de corta y aprovechamiento ilegal de madera y productos forestales, todo de conformidad con el numeral 122 inciso a- de la Ley Forestal 7174. Dicha norma contemplaba la conducta del que corte o aproveche productos forestales en propiedad privada sin contar con la autorización de la Dirección General Forestal. Tal conducta – contrario a la tesis de la recurrente, no fue despenalizada por ley posterior; esto es, por la Ley Forestal 7575 del 16 de abril de 1996, publicada en el Alcance número 21 del martes 16 de abril de 1996. La última ley de cita, claramente establece en el numeral 58 inciso b- y sancionable con una pena de tres meses a tres años de prisión, quien: “ a)-…b)- Aproveche los recursos forestales en terrenos del patrimonio natural del Estado y en las áreas de protección para fines diferentes a los establecidos en esta ley”. c)-…”.

Por otro lado, el numeral 33 inciso c-, el cual define las áreas de protección, establece que por tales se declaran: “ a)…b) Una franja de quince metros en zona rural y diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, (sic) quebradas o arroyos, si el terreno es plano, y de cincuenta metros horizontales, si el terreno es quebrado. c)…d)…”. Igualmente el numeral 3) inciso a) de la citada Ley 7575 define aprovechamiento como la “…acción de corta, eliminación de árboles maderables o la utilización de arboles caídos, realizada en terrenos privados, no incluidos en el artículo 1 de esta Ley, que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa”. Inclusive, el numeral 1 de la suprareferida Ley Forestal N- 7575, es clarísima en el párrafo segundo, al indicar que por mediar un interés publico, “…se prohibe la corta o el aprovechamiento de los bosques en parques nacionales, reservas biológicas, manglares, zonas protectoras, refugios de vida silvestre, y reservas forestales propiedad del Estado”.

De esa relación de artículos 1 párrafo segundo, 3 inciso 1, 33 inciso b- y 54 inciso b- de la Ley Forestal Número 7575 del 16 de abril de 1996, es preciso concluir que la tala o corta de árboles en zona protegidas, como lo son las riberas de los ríos en los supuestos ahí regulados, aún cuando se trate de propiedad privada, es una acción que sigue siendo punible y por ende no ha sido despenalizada como se argumenta. Debe aclararse que si bien es cierto existen algunos votos de este Tribunal que recogen la tesis de la atipícidad de la conducta en zonas que no corresponden al concepto de bosque – definido por el numeral 3 inciso d)- de la Ley Forestal N° 7575 citada – aparte de que se trata de una tesis que no es uniforme en ese sentido – no son aplicables a la especie fáctica juzgada, pues conforme a los hechos tenidos por ciertos, según los cuales el justiciable procedió a desarrollar un proyecto de cultivo de café, ordenando con ese fin la tala y destrucción de una zona de protección de una quebrada.

Es decir, que se trata de supuestos diversos al resuelto en el Voto 929- 2001 de 9:45 horas del 16 de noviembre del 2001. Finalmente debe señalarse que no es cierto que la actual Ley Forestal no contemple sanción para la tala de árboles en zonas de protección, pues- como ya se expuso supra – el numeral 58 inciso b)- sí regula esa hipótesis. En consecuencia, y por las razones expuestas se declara sin lugar el procedimiento de revisión.

POR TANTO:

Se declara sin lugar el procedimiento de revisión promovido a favor del sentenciado [Nombre1]. Notifíquese.
