Res: [Telf1] CRIMINAL COURT OF CASSATION. Second Judicial Circuit of San José. Goicoechea, at nine hours and twenty-three minutes on the twenty-second of April of two thousand and four.

APPEAL ON POINTS OF LAW (recurso de casación) filed in the present case against [Nombre1], adult, married, 57 years of age, resident of San Pedro de Turrubares, for the offense of VIOLATION OF THE LEY FORESTAL to the detriment of the STATE FOREST HERITAGE (PATRIMONIO FORESTAL). Participating in the decision on the appeal are Judges [Nombre2], Jorge Luis Arce Víquez, and [Nombre3]. Defense counsel Lic. [Nombre4] appeared before the Court on cassation.

BACKGROUND:

1. That by means of a ruling issued at sixteen hours on the sixth of March of two thousand and three, the Tribunal de Juicios of the First Judicial Circuit of San José resolved: Por tanto: In accordance with the foregoing, articles 39 and 41 of the Political Constitution, articles 1, 30, 31, 45, 50, 51, 59, 60, 62, 71 and 110 of the Penal Code, articles 1, 6, 58, 141, 142, 144, 184, 360, 361, 363, 364, 365, 367 and 459 of the Code of Criminal Procedure, Art. 33 and Art. 58 subsection B of the Ley Forestal N. 7575, [Nombre1] is declared the liable author of the offense of VIOLATION OF THE LEY FORESTAL committed to the detriment of the STATE FOREST HERITAGE; in that capacity, he is sentenced to THREE MONTHS OF IMPRISONMENT, a sentence to be served in the place and manner indicated by the applicable prison regulations, with credit for any pre-trial detention already served. Finding it appropriate, the convicted person is granted the BENEFIT OF SUSPENDED EXECUTION OF SENTENCE (BENEFICIO DE EJECUCION CONDICIONAL DE LA PENA) for a probationary period of FIVE YEARS, with the understanding that during said period he must not be convicted of a new intentional offense carrying a prison sentence of more than six months, since in that event the benefit hereby granted shall be revoked and he shall be required to serve the imposed sentence in prison.

The costs of the criminal proceedings shall be borne by the State. Furthermore, THE CONFISCATION (COMISO) OF THE SEIZED TIMBER IS ORDERED; IT SHALL BE PLACED AT THE DISPOSAL OF THE ADMINISTRACIÓN FORESTAL DEL ESTADO TO DISPOSE OF AS IT SEES FIT. Once the judgment is final, it shall be registered in the Registro Judicial and the customary certified copies shall be forwarded to the Juzgado de Ejecución de la Pena and the Instituto Nacional de Criminología. Notification by reading. LIC. [Nombre5], TRIAL JUDGE.

2. That against the foregoing ruling, Lic. [Nombre1] filed an Appeal on Points of Law.

3. That upon completion of the corresponding deliberation in accordance with the provisions of article 450 of the Code of Criminal Procedure, the Court addressed the issues raised in the Appeal.

4. That the relevant legal requirements have been observed in the proceedings.

OPINION DRAFTED BY JUDGE [Nombre6]; AND,

WHEREAS:

I.The appeal on points of law meets the admissibility requirements of articles 422, 423, 424, 443, 444, 445, and 447 of the Code of Criminal Procedure, and the ground submitted is accordingly considered on its merits.

II.In the first ground of the appeal, a violation of substantive law is alleged, on the basis that Art. 58 subsection B) of the Ley Forestal penalizes anyone who exploits forest resources (recursos forestales) on lands comprising the natural heritage of the State, as well as in protection areas, for purposes other than those established by law. The appellant argues that the provision cannot be interpreted in isolation but must be understood within the law as a whole. He claims that the challenged judgment interprets the "concept of forest resource exploitation as the exploitation of a dead tree, already felled by the action of a third party, in which case, (…) [the court] interprets the law by analogy and extends that concept to situations neither foreseen nor intended by the criminal legislator. By extensively interpreting the concept of forest resource, the challenged judgment violates, through improper application, Art. 58 subsection b) of the Ley Forestal." In the second ground, a violation of article 39 of the Political Constitution is alleged, along with a failure to apply articles 3 and 58 of the Ley Forestal.

It is argued that the judgment violates the principle of social adequacy of conduct, since exploiting the resources of a "dry" tree does not represent any attack on the legally protected interest and in fact constitutes an activity that is socially accepted among our rural farmers (campesinos). In the third and final ground of cassation on the merits, it is alleged that the judge violated articles 39 and 45 of the Political Constitution, articles 1 and 2 of the Penal Code, and articles 3 and 58 subsection b) of the Ley Forestal. It is argued that in issuing the conviction "for the exploitation of timber for use on the farm, which is the property of the farm owner, without considering that such exploitation must be unlawful — contrary to law —, the challenged judgment violates, through failure to apply, article 45 of the Political Constitution, which establishes that property is inviolable and that no one may be deprived of it, except through expropriation by the State with prior compensation; violates, through failure to apply, article 39 of the Political Constitution, which establishes the principle of criminal legality; also violates, through failure to apply, articles 1 and 2 of the Penal Code, which establish the principle of legality and the prohibition of analogy; and violates, through improper application, articles 3 and 58 subsection b) of the Ley Forestal." THE APPEAL IS UPHELD.

Although the appellant frames his claim in three separate grounds, all of them in fact address the same issues. They are therefore resolved jointly. According to judgment No. 254-2003 of sixteen hours on the sixth of March of two thousand and three, the accused was convicted as the author of the offense of violation of the Ley Forestal (Law No. 7575), and sentenced to three months of imprisonment, with a five-year suspended sentence granted. According to the proven facts, on the thirteenth of May of two thousand and one, officials from the Ministerio de Ambiente y Energía went to the farm of [Nombre7], located in San Pedro de Turrubares, where they found several planks of timber (madera) originating from two Guanacaste trees that had previously been felled on an unknown date and by an unknown person. After a brief investigation, it was determined that subsequent to the felling of the trees, the accused hired [Nombre8] to saw the timber for the purpose of using it in work on the same farm (see folio 89).

In summary, the accused was convicted for exploiting the timber from two Guanacaste trees that had been felled under unknown circumstances and by an unknown person. On this subject, the court of cassation has ruled on several occasions. In this regard, in voto No. 682-F-97, at fifteen hours and forty-five minutes on the twenty-fifth of August of nineteen ninety-seven, with Judge [Nombre9] as reporting judge (ponente), it was stated:

"Art. 61 subsection a) of the Ley Forestal provides that imprisonment of two months to two years shall be imposed on anyone who 'Exploits one or more forest products on private property without a permit from the Administración Forestal del Estado, or who, even having such a permit, does not comply with what was authorized.' Said article, with respect to the concept of exploitation, has been interpreted in relation to Art. 3 subsection a) of the Law, which states that 'timber harvesting (aprovechamiento maderable)' means: 'The act of felling or eliminating standing timber trees or utilizing fallen trees, carried out on private land not included within Art. 1 of this law, which generates or may generate some profit, benefit, advantage, utility, or gain for the person performing it or for the person he or she represents.' From the relationship between both articles, the courts have concluded that the mere act of felling a timber tree, regardless of whether it forms part of a forest (bosque) or a forest plantation (plantación forestal), constitutes the offense set forth in Art. 61 subsection a) above (see voto 524-F-97 of this Court (there is a dissenting opinion (voto salvado))).

However, the judges of the Tribunal Superior de Casación Penal assigned to hear this matter consider that the aforementioned case law must be changed. Of great importance is the text of the criminal offense type (tipo penal) set forth in Art. 61 subsection a), which refers to the exploitation '... of one or more forest products...' With respect to the interpretation of laws, the existence of various methods has been noted, all of which are of course limited by the principle of legality (principio de legalidad), set forth in Art. 1 of the Penal Code and Art. 39 of the Political Constitution, which is one of the fundamental principles of a rule-of-law state, on which there is consensus (see, for example: Sala Constitucional, voto 461-91). Importantly, the courts have tended to conceptualize 'forestal' as 'relating to trees,' which is not correct. Indeed, if one looks up the term 'forestal' in the dictionary, it means 'relating to forests and their uses' (Vox Diccionario General Ilustrado de la Lengua Española.

Barcelona, 1995, p. 517. See also: Larousse. Diccionario Usual, México, 1985, p. 266). Note even that the term 'forestal' comes from the Latin word 'foresta,' meaning forest. It is true that the Diccionario de la Real Academia, in defining 'forestal,' states that the term is understood as 'relating to forests and the exploitation of firewood, pastures, etc.' (Diccionario de la Lengua Española. Real Academia Española, Madrid, twenty-first edition, 1992, p. 984). However, the term 'bosque' must be regarded as the fundamental one, and the reference to 'the exploitation of firewood, pastures, etc.' refers to the use of the forest, as is stated in other dictionaries. It should be noted that the objective criminal offense type of a crime is composed of descriptive elements and, by way of exception, normative elements. It has been held that one consequence of the principle of legality is that these latter elements should be avoided, due to the legal uncertainty they introduce as a consequence of the evaluative discretion they grant to the judge.

For this reason, when interpreting an element of the criminal offense type, one must proceed on the assumption that it is descriptive in character, unless there are sufficient reasons to conclude that it is instead normative. In the present case, there are no elements indicating that the term 'forestal' should be understood in any sense other than that indicated above — that is, as a descriptive element. This is without prejudice to the fact that, indirectly, the term acquires normative characteristics to the extent that the Ley Forestal specifies concepts such as 'bosque' and 'plantación forestal' (Art. 3 of the law).

Of relevance in supporting the foregoing with respect to the term 'forestal' is that the ultimate purpose of the Ley Forestal is the protection and administration of forests and the exploitation of forest resources. This is clear from Article 1 of the Ley Forestal, which specifies the objectives of said law — an aspect of paramount importance in interpreting its various provisions. It reads as follows:

'Objectives. This law establishes as an essential and priority function of the State to ensure the conservation, protection, and administration of natural forests and the production, exploitation, industrialization, and promotion of the country's forest resources designated for that purpose, in accordance with the principle of adequate and sustainable use of renewable natural resources...' Article 3 of the law, for its part, provides a series of definitions, including those of timber harvesting (aprovechamiento maderable), forest-capable lands (terrenos de aptitud forestal), forest ecosystem (ecosistema boscoso), forest (bosque), forest management plan (plan de manejo forestal), forest plantation (plantación forestal), forestry regime (régimen forestal), agroforestry system (sistema agroforestal), protected wildlife area (área silvestre protegida), primary processing center (centro de industrialización primaria), and environmental services (servicios ambientales).

It is noteworthy that all of these definitions ultimately refer to the forestry regime, with the terms "forest" and "forest plantation" standing out among them. Reference must be made to the argument occasionally advanced that Art. 3 inciso a) of the Ley Forestal justifies imposing criminal liability under Art. 63 inciso a) for tree felling (corta de árboles) on non-forest lands. This argument relies on the reference in that article to tree felling not covered by Art. 1. It has accordingly been argued that such felling is therefore disconnected from the objectives of the law established in Art. 1, as mentioned above. This interpretation must be rejected, first because Art. 1, as noted, is fundamental to the interpretation of the law as a whole, given that it sets out the law's objectives. But the fundamental reason is that the reference made in Art. 3 inciso a) to Art. 1 does not concern the first paragraph of that article — which was quoted above in the relevant parts — but rather paragraph 2) of the same article, which, like Art. 3 inciso a), refers to tree felling, by providing: "By virtue of the public interest and except as stipulated in article 18 of this law, the felling or harvesting of forests in national parks, biological reserves, mangroves, protected zones, wildlife refuges, and state-owned forest reserves is prohibited." Also relevant to the use of the concept of "forestry" as pertaining to forests, as discussed above, is that within the Ley Forestal the only article addressing the prohibition on felling trees on private property that is neither forest nor forest plantation is Article 27.

That article provides: "Tree felling on agricultural and livestock lands (terrenos de uso agropecuario) without forest may only be carried out after first obtaining authorization from the Consejo Regional Ambiental or the relevant municipality, and only up to a maximum of five trees per hectare per year. For felling exceeding twenty trees per property, authorization from the Administración Forestal del Estado shall be required." This leads to the conclusion that, under an a contrario sensu interpretation, there is no statutory prohibition on tree felling on lands without forest that are not agricultural and livestock lands. An attempt was made to remedy this through regulatory means. The Reglamento a la Ley Forestal, published in La Gaceta on 23 January 1997, defines what is meant by agricultural and livestock lands without forest, stating that these are "those private properties containing trees not established under an agroforestry system, or properties with forest cover (cobertura boscosa) areas of less than two hectares, or those trees located in urban areas" (Art. 2).

However, it is clear that the Reglamento cannot be applied to the present case with respect to that definition. This is first because the conduct under adjudication occurred in early November 1995, whereas the Reglamento was not published until 23 January 1997, meaning that applying it would amount to a prohibited retroactive application. Added to this is the fact that, in defining what is meant by "agricultural and livestock lands," the Reglamento exceeds its bounds, disregarding its purely executive character vis-à-vis the law, insofar as it attempts to bring within the term "agropecuario" everything that is not forestry-related — which does not accord with the meaning of the word "agropecuario" (that is, pertaining to agriculture and livestock farming) — reaching even the absurdity of classifying urban land as "agropecuario." In any event, it is even debatable what sanction applies to a violation of Art. 27 of the Ley Forestal — that is, with respect to tree felling on agricultural and livestock lands — since the law establishes no sanction whatsoever for such conduct, and it is highly questionable whether, on that basis, Art. 61 inciso a) of the Ley Forestal could be interpreted as applicable, insofar as it refers to the harvesting of forest products.

An interpretation to that effect would not in fact be consistent with the principle of legality (principio de legalidad), since nowhere in the law is it indicated that "forest products" should also be understood to include tree products originating from land that is not a forest but rather agricultural and livestock land. If one were to attempt an interpretation that brought tree felling on agricultural and livestock lands within the scope of Art. 61 inciso a) of the Ley Forestal, one would have to rely on the heading of Title Three (Título Tercero) of the Ley Forestal, namely "Propiedad Forestal Privada," within which Art. 27 of the Ley Forestal is located. But an interpretation that sought, in this manner, to expand the criminal offense type (tipo penal) of Art. 61 inciso a) of that law would not be consistent with the principle of legality, which demands clarity in the description of prohibited conduct — a clarity that would be absent under such an interpretation.

Noteworthy is the requirement — recognized in constitutional legal doctrine — to interpret legal norms in conformity with the Constitución Política, which demands that it not be possible for conduct that does not appear clearly described within the criminal offense type to be deemed criminal through broad systematic interpretations of that offense type; the concept of "forestry" and the concept of "agricultural and livestock" are entirely distinct, and any interpretation equating the latter with the former would lack clarity.

In any event, in the present case one cannot even speak of tree felling on "agricultural and livestock lands," since the felling of the two trees took place on a construction plot (see folio 35 fte lines 27-29).

At the risk of being repetitive, it must be emphasized that if one were to maintain that tree felling as contemplated in Art. 27 of the Ley Forestal finds its sanction in Art. 63 inciso a) of the Ley Forestal, the expansion of the term "agropecuario" set forth in the Reglamento de la Ley Forestal would, in addition to contravening the executive character of the reglamento vis-à-vis the law, violate the very principle of legality (Art. 39 of the Constitución Política). This principle requires that the factual predicate qualifying conduct as criminal be established in an ordinary statute, and not in a mere regulation — a requirement rooted in the Enlightenment doctrine that gave rise to the so-called separation of powers (división de poderes) (Art. 9 of the Constitución Política). By way of exception, the Sala Constitucional has recognized the constitutionality of open-textured criminal laws (leyes penales en blanco) — that is, laws that, with respect to the specification of one element of the criminal offense type, refer to a lower-ranking legal norm.

Notably, the Sala Constitucional has stated that "it is possible to supplement a criminal norm by means of a regulation, provided that in so doing the Poder Ejecutivo remains within its proper sphere of competence and that the referring law establishes with sufficient clarity the conditions for punishability, as well as the type and extent of the penalty…" (Sala Constitucional, voto 1876-90). However, it is clear that, through its definition of "agricultural and livestock lands without forest," the Reglamento de la Ley Forestal would expand the scope of the criminal conduct established by the Ley Forestal, and thereby the competence of the Poder Ejecutivo. The same may be said of any attempt to use the word "tree" as a synonym of "forestry," as the Reglamento de la Ley Forestal appears to do by employing the term "árbol forestal" (Art. 2). In addition to the a contrario sensu interpretation of Art. 27 of the Ley Forestal made above, the interpretation of Art. 63 inciso a) in relation to Art. 56 of the Ley Forestal is of great relevance to this matter.

The first of those articles makes infringement of Art. 56 a criminal offense. That article, for its part, provides that "Roundwood (madera en trozas), squared timber, or sawn timber originating from a forest or forest plantation may not be transported without the corresponding documentation." Importantly, as the case law of the Tribunal Superior de Casación Penal has already established, only the unauthorized transport of timber "originating from a forest or forest plantation" is subject to criminal sanction — not the transport of timber originating from lands that are neither forest nor forest plantation — which constitutes a significant argument for concluding that Art. 61 inciso a) only penalizes the harvesting (and tree felling as a component thereof) of trees originating from forests or forest plantations. Note that the legislature sought to extend the "grip" of criminal law (Derecho Penal) to a variety of conducts forming part of what we might call the "deforestation cycle," paraphrasing the terminology used in connection with other types of offenses — the aim being to sanction not only conduct related to unauthorized tree felling on forest lands, but also the unauthorized transport of timber from trees on such lands.

There would therefore be no reason to sanction transport only when the timber originates from forests or forest plantations, while at the same time penalizing tree felling even on lands that do not meet those characteristics.

It should be noted that there is great concern in Costa Rica for the protection of the environment, and within it, the forests. Indeed, the Constitución Política, as amended by ley 7412 of 3 June 1994, provides that "Every person has the right to a healthy and ecologically balanced environment. Every person is accordingly entitled to report acts that infringe that right and to claim reparation for the harm caused.

The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding responsibilities and penalties" (Art. 50 párrafo 2) y 3)). Environmental protection, including through criminal law, is one of the trends within comparative law (Derecho Comparado). However, this must not lead to an "inflation" of criminal offenses running counter to the principle of criminal law as ultima ratio and to the harm principle (lesividad). It is true that for the prosecution of deforestation offenses it would be more convenient to criminalize any tree felling, whether on forest lands or otherwise. However, this would lead to an excessive expansion of criminal law, as has in fact occurred in Costa Rican practice, where, as noted, simple tree felling has been penalized even on urban land. Ultimately, considerations of mere expediency in the prosecution of certain offenses should not lead to extending criminal liability to circumstances other than those related to the legally protected interest (bien jurídico protegido) (Environment: protection of forests).

What is important is that it is clearly necessary for the state to act to prevent deforestation, that is, the destruction of forests. However, if criminal prosecution (incriminación penal) is employed to prevent such destruction, it can be addressed through criminal penalties for the felling of trees (tala de árboles) within those forests — not through penalties for the felling of trees that do not form part of forests. For all of these reasons, it cannot be maintained that this ruling implies that forests are left unprotected against deforestation; rather, the ruling is consistent with the need to protect forests, bringing that protection to its proper measure, so that the argument of protecting forests does not lead to the criminal penalization of the cutting of trees (corta de árboles) in "non-forests." All of this is a consequence not only of the principle of legality (principio de legalidad), mentioned above, but also of the harm principle (principio de lesividad).

For all of the foregoing, since the specific conduct at issue constitutes conduct not constituting a criminal offense (conducta atípica), the correct course is to grant the appeal on the merits (recurso por fondo) and to acquit the defendant of the criminal offense (delito) of violation of the Ley Forestal that has been attributed to him" (In a similar vein, votos 845-F-97 of 10:00 hours of October 17, 1997, and voto 2001-929 of 9:45 hours of November 16, 2001). From the case law (jurisprudencia) cited, it follows that the felling and harvesting (aprovechamiento) of trees on private land is criminally protected, provided that it takes place in a forest of the dimensions already cited, which is not the case here. Indeed, although the judgment does not state so expressly, it is apparent from the evidence cited in the ruling that the land where the harvesting took place is a property (finca) of 705,392 meters dedicated to cattle ranching (ganadería) and with a residential dwelling (see certification at folio 72).

In light of the foregoing, the appeal on the merits is granted. The defendant [Nombre10] is acquitted of the criminal offense of violation of the Ley Forestal that had been attributed to him. As it is unnecessary, no ruling is issued on the cassation appeal on procedural grounds (recurso de casación por la forma).

Res: [Telf1] TRIBUNAL DE CASACION PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las nueve horas con veintitrés minutos del veintidós de abril de dos mil cuatro.

RECURSO DE CASACION interpuesto en la presente causa seguida contra [Nombre1], mayor, casado, 57 años de edad, vecino de San Pedro de Turrubares, por el delito de INFRACCION A LA LEY FORESTAL en perjuicio del PATRIMONIO FORESTAL. Intervienen en la decisión del recurso, los Jueces [Nombre2], Jorge Luis Arce Víquez y [Nombre3]. Se apersonó en casación, el defensor Lic. [Nombre4].

RESULTANDO:

1. Que mediante resolución de las dieciséis horas del seis de marzo de dos mil tres, el Tribunal de Juicios del Primer Circuito Judicial de San José, resolvió: POR TANTO: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política, artículos 1, 30, 31, 45, 50, 51, 59, 60, 62, 71 y 110 del Código Penal, artículos 1, 6, 58, 141, 142, 144, 184, 360, 361, 363, 364, 365, 367 y 459 del Código Procesal Penal, artículo 33 y 58 inciso B de la Ley Forestal N. 7575 se declara a [Nombre1] autor repsondable del delito de INFJRACCION A LA LEY FORESTAL cometido en perjuicio del PATRIMONIO FORESTAL, en tal caracter se le impone el tanto de TRES MESES DE PRISION, pena que deberá descontar en el lugar y forma que lo indiquen los respectivos reglamentos penitenciarios, previo abono de la preventiva sufrida. Por considerarlo procedente se le otorga al condenado el BENEFICIO DE EJECUCION CONDICIONALD E LA PENA por un período de prueba de CINCO AÑOS, en el entendido de que durante dicho lapso no deberá resultar ocndenado por nuevo delito doloso en que se le imponga una pena de prisión superior a seis meses, pues en dicho evento, le será revocado el beneficio aquí concedido y deberá descontar en prisión la pena impuesta.

Son los gastos del proceso penal a cargo del estado. Asimismo SE ORDENA EL COMISO DE LA MADERA SECUESTRADA, PÓNGASE A LA ORDEN DE LA ADMINISTRACION FORESTAL DEL ESTADO PARA QUE DISPONGA DE ELLA. Una vez firme la sentencia inscríbase en el Registro Judicial y envíense los testimonios de estilo para ante el Juzgado de Ejecución de la Pena y el Instituto Nacional de Criminología. Mediante lectura notifíquese. LIC. [Nombre5], JUEZ DE JUICIO.

2. Que contra el anterior pronunciamiento el Lic. [Nombre1], interpuso Recurso de Casación .

3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 450 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el Recurso.

4. Que en los procedimientos se han observado las prescripciones legales pertinentes.

REDACTA EL JUEZ [Nombre6]; Y,

CONSIDERANDO:

I.El recurso de casación reúne los requisitos de admisibilidad de los artículos 422, 423, 424, 443, 444, 445 y 447 del Código Procesal Penal, por lo que se entra a conocer el motivo presentado.

II.En el primer motivo del recurso se alega violación de la ley sustantiva, puesto que el artículo 58 inciso B) de la Ley Forestal sanciona a quien aproveche los recursos forestales en terrenos de patrimonio natural del Estado, así como en las áreas de protección para fines diferentes a los establecidos en la ley. Considera que la norma no puede interpretarse aisladamente, sino que debe entenderse inmersa dentro de la misma ley. Reclama que la sentencia impugnada interpreta el "concepto de aprovechamiento del recurso forestal como el aprovechamiento de un árbol muerto, ya cortado, por la acción de un tercero, en la cual, (…) interpreta la ley analógicamente, y extiende ese concepto a situaciones no previstas ni queridas por el legislador penal. Al interpretar extensivamente el concepto de recurso forestal, la sentencia impugnada viola, por aplicación indebida, el artículo 58 inc. b) de La Ley Forestal.

En el segundo motivo se aduce violación al artículo 39 de la Constitución Política, y falta de aplicación de los artículos 3 y 58 de la Ley Forestal. Se aduce que la sentencia viola el principio de adecuación social de la conducta, puesto que aprovechar los recursos de un árbol "seco" no representa ningún ataque al bien jurídico tutelado y más bien constituye una actividad socialmente aceptada por nuestros campesinos. En el tercer y último motivo de casación por el fondo se alega que el juzgador violó los numerales 39 y 45 de la Constitución Política, 1 y 2 del Código Penale, 3 y 58 inciso b) de la Ley Forestal. Argumenta que al dictarse la sentencia condenatoria "por el aprovechamiento de una madera para los fines de la finca, que es propiedad del dueño de la finca, sin considerar que ese aprovechamiento debe ser antijurídico, -contrario a derecho-, la sentencia impugnada viola, por falta de aplicación el artículo 45 de la Constitución Política, que establece que la propiedad es inviolable y que a nadie puede privársele de ella, salvo expropiación por el Estado y con una previa indemnización, viola, por falta de aplicación, el artículo 39 de la Constitución Política, que establece el principio de legalidad criminal, viola también, por falta de aplicación, los artículos 1 y 2 del Código Penal, que establecen el principio de legalidad y la prohibición de la analogía y viola, por aplicación indebida, los artículos 3 y 58 inciso b) de la Ley Forestal." CON LUGAR EL RECURSO.

Aunque el impugnante formula su reclamo en tres motivos separados, lo cierto es que todos versan sobre los mismos aspectos. De allí que se resuelvan conjuntamente. De acuerdo con la sentencia No: 254-2003 de las dieciséis horas del seis de marzo de dos mil tres, el imputado fue condenado como autor del delito de infracción a la ley forestal (ley No 7575), imponiéndose el tanto de tres meses de prisión, concediéndole por cinco años el beneficio de ejecución condicional de la pena. Según los hechos probados, en fecha trece de mayo de dos mil uno, funcionarios del Ministerio de Ambiente y Energía se hicieron presentes en la finca de [Nombre7], sito en San Pedro de Turrubares, en donde encontraron varias tablas de madera provenientes de dos árboles de Guanacaste que habían sido previamente cortados en fecha y por persona ignorada. Tras una pequeña investigación se determinó que posterior a la corta de los árboles, el encartado contrató a [Nombre8] para que aserrara la madera con el fin de aprovecharla en trabajos de la misma finca(ver folio 89).

En síntesis, se condena al encartado por aprovechar la madera de dos árboles de Guanacaste que habían sido cortados en circunstancias y por persona desconocida. Sobre este tema, el tribunal de casación se ha pronunciado en varias ocasiones. Al respecto, en voto No: 682-F-97, de las quince horas, cuarenta y cinco minutos del veinticinco de Agosto de mil novecientos noventa y siete, cuyo ponente es el juez [Nombre9], se indicó:

" El Art. 61 inciso a) de la Ley Forestal indica que se impondrá prisión de dos meses a dos años a quien "Aproveche uno o varios productos forestales en propiedad privada sin el permiso de la Administración Forestal del Estado o a quien aunque cuente con el permiso no se ajuste a lo autorizado". Dicho artículo en lo relativo al concepto de aprovechamiento ha sido interpretado en relación con el Art. 3 inciso a) de la Ley, que indica que "aprovechamiento maderable" es: "Acción de corta, eliminación de árboles maderables en pie o utilización de árboles caídos, realizada en terrenos privados, no incluída en el Art. 1 de esta ley, que genera o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa". De la relación de ambos artículos se ha concluido por la jurisprudencia que la simple acción de cortar un árbol maderable, independientemente de si forma parte de un bosque o plantación forestal es constitutiva del delito contemplado en el Art. 61 inciso a), arriba mencionado (véase el voto 524-F-97 de este Tribunal (hay un voto salvado).

Sin embargo, los jueces integrantes del Tribunal Superior de Casación Penal designados para el conocimiento de este asunto, consideramos que debe variarse la jurisprudencia indicada. Es de gran importancia el texto del tipo penal contemplado en el Art. 61 inciso a), en el que se hace mención al aprovechamiento "... de uno o varios productos forestales..."En lo relativo a la interpretación de las leyes se ha señalado la existencia de diversos métodos, todos lo cuales por supuesto encuentran como límite el principio de legalidad, previsto por el Art. 1 del Código Penal y el 39 de la Constitución Política, que es uno de los principios fundamentales de un Estado de Derecho, sobre lo que existe consenso (véase por ejemplo: Sala Constitucional, voto 461-91). Importante es que se ha tendido por la jurisprudencia a conceptualizar "forestal" como "relativo a los árboles", lo que no es correcto. En efecto si se busca el término forestal en el diccionario se verá que quiere decir "relativo a los bosques y a sus aprovechamientos" (Vox Diccionario General Ilustrado de la Lengua Española.

Barcelona, 1995, p. 517. Véase también: Larousse. Diccionario Usual, México, 1985, p. 266). Nótese incluso que el término forestal viene de la palabra del latín "foresta", sea bosque. Es cierto que el Diccionario de la Real Academia al definir "forestal" indica que por dicho término se entiende lo "relativo a los bosques y a los aprovechamientos de leñas, pastos, etc." (Diccionario de la Lengua Española. Real Academia Española, Madrid, vigésimo primera edición, 1992, p. 984). Sin embargo, el término "bosque" debe estimarse como el fundamental y lo concerniente a los "aprovechamientos de leñas, pastos, etc.", hace mención al aprovechamiento del bosque, tal y como se hace referencia en otros diccionarios. Debe anotarse que el tipo penal objetivo de un delito se compone de elementos descriptivos y por vía de excepción de elementos normativos. Se ha estimado que una consecuencia del principio de legalidad es que deben evitarse estos últimos elementos, debido a la inseguridad jurídica que introducen, como consecuencia del ámbito valorativo que le conceden al juzgador.

Por ello mismo debe partirse al momento de interpretación de un elemento del tipo penal de que éste es de carácter descriptivo, salvo que hayan razones suficientes para estimar que no es de este carácter, sino que es normativo. En el caso concreto no hay elementos que indiquen que el término forestal, deba ser entendido en sentido diverso al indicado arriba, sea como un elemento descriptivo. Lo anterior sin perjuicio de que en forma indirecta el término adquiere caracteres normativos, en la medida en que la ley forestal precisa conceptos como el de "bosque" y de "plantación forestal" (Art. 3 de la ley).

De relevancia para sostener lo anterior en cuanto al término forestal es que el fin de la ley forestal es en definitiva la protección y administración de los bosques y el aprovechamiento de los recursos forestales. Esto queda claro en el artículo 1 de la ley forestal, el que precisa los objetivos de dicha ley, aspecto que tiene una importancia capital en la interpretación de las diversas normas de la misma. Así se dispone:

"Objetivos. La presente ley establece como función esencial y prioritaria del Estado velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables...".

Por su parte el artículo 3 de la ley da una serie de definiciones, por ejemplo la de aprovechamiento maderable, terrenos de aptitud forestal, ecosistema boscoso, bosque, plan de manejo forestal, plantación forestal, régimen forestal, sistema agroforestal, área silvestre protegida, centro de industrialización primaria y servicios ambientales. Importante es que todas ellas se refieren en definitiva al "régimen forestal", destacándose en ellas los términos "bosque" y "plantación forestal". Debe hacerse referencia a la mención que se ha hecho en ocasiones del Art. 3 inciso a) de la Ley Forestal, para justificar que se sanciona en el Art. 63 inciso a) la corta de árboles en terrenos no forestales. Lo anterior en cuanto a la referencia que se hace en dicho artículo a la corta de árboles no incluida en el Art. 1. Así se ha expresado que por ello dicha corta está desvinculada de los objetivos de la ley fijados en el Art. 1, mencionados arriba.

Esta interpretación debe ser rechazada, en primer lugar ya que el Art. 1, como se dijo, es fundamental para la interpretación de toda la ley en cuanto menciona los objetivos de la misma. Pero la razón fundamental es que la referencia que se hace en el Art. 3 inciso a) al Art. 1, no es en lo relativo al párrafo primero del mismo, que fue transcrito en lo que interesa arriba, sino propiamente en lo concerniente al párrafo 2) del mismo artículo, que hace mención, al igual que el Art. 3 inciso a) a la corta de árboles, ello al decir: "En virtud del interés público y salvo lo estipulado en el artículo 18 de esta ley, se prohíbe la corta o el aprovechamiento de los bosques en parques nacionales, reservas biológica, manglares, zonas protectoras, refugios de vida silvestre y reservas forestales propiedad del Estado".

De relevancia en lo relativo a la utilización del concepto de "forestal" como concerniente a los bosques, a la que se hizo referencia antes, es que en la ley forestal el único artículo que se refiere a la prohibición de cortar árboles en propiedad privada que no sea bosques o plantaciones es el 27. En este se dispone: "Sólo se podrá llevar a cabo la corta de árboles en terrenos de uso agropecuario y sin bosque, obteniendo previamente la autorización del Consejo Regional Ambiental o de la municipalidad respectiva y hasta por un máximo de cinco árboles por hectárea por año. Para una corta que sobrepase los veinte árboles por inmueble se requerirá la autorización de la Administración Forestal del Estado". Ello lleva a que conforme a una interpretación a contrario sensu, en terrenos sin bosque y que no sean de uso agropecuario no hay ninguna prohibición en la ley para la corta de árboles. Esto trató de ser corregido por la vía reglamentaria.

Así el Reglamento a la Ley Forestal, publicado en la Gaceta del 23 de enero de 1997, que define qué se entiende por terrenos de uso agropecuario sin bosque, indicando que estos son "aquellas fincas privadas con la presencia de árboles no establecidos bajo un sistema agroforestal o fincas que tienen áreas con cobertura boscosa menores a dos hectáreas, o aquellos árboles ubicados en áreas urbanas" (Art. 2). Sin embargo, la no aplicación al presente caso concreto del Reglamento en lo relativo a dicha definición es clara. Ello en primer lugar debido a que el hecho que se juzga fue cometido a principios de noviembre de 1995, resultando que incluso el Reglamento fue publicado el 23 de enero de 1997, de modo que si se tratara de aplicar el mismo se estaría ante un supuesto prohibido de aplicación retroactiva. A lo anterior se agrega que el Reglamento al definir que se entiende por "terrenos de uso agropecuario", se excede, olvidándose el carácter meramente ejecutivo de la ley que tiene, por cuanto se trata de ubicar en el término "agropecuario" todo lo que no es forestal, lo que no concuerda con el sentido de la palabra "agropecuario" (sea que tiene relación con la agricultura y ganadería), llegándose incluso al absurdo de calificar de "agropecuario" lo urbano.

De todas maneras incluso es discutible qué sanción tiene la infracción al Art. 27 de la Ley Forestal, sea en lo relativo a la tala de árboles en terrenos de uso agropecuario, puesto que no se establece en la ley sanción alguna y es sumamente cuestionable que en virtud de ello pueda interpretarse que en tal caso, sería de aplicación el Art. 61 inciso a) de la Ley Forestal, en cuanto se refiere al aprovechamiento de productos forestales. Una interpretación en tal sentido no sería en realidad concordante con el principio de legalidad, puesto que en ninguna parte de la ley se indica que por productos forestales, se entienda también los productos arbóreos provenientes de un terreno que no es bosque, sino de un terreno de uso agropecuario. Si se intentara una interpretación que comprendiera dentro del Art. 61 inciso a) de la Ley Forestal la corta de árboles en terrenos de uso agropecuario tendría que partirse de la denominación del Título Tercero de la Ley Forestal, sea "Propiedad Forestal Privada", dentro del cual está ubicado el Art. 27 de la Ley Forestal.

Pero una interpretación que por esa vía tratara de ampliar el tipo penal del Art. 61 inciso a) de dicha ley, no sería concordante con el principio de legalidad, el que exige la claridad en la descripción de la conducta prohibida, claridad que no existiría con la interpretación indicada. Importante es el requerimiento de tratar de interpretar las normas conforme a la Constitución Política, de la que habla la doctrina constitucionalista, lo que exige que no sea posible que a través de interpretaciones sistemáticas extensivas del tipo penal respectivo, se llegue a considerar como típica una conducta que no aparece claramente descrita dentro del tipo penal, y es que un concepto es el de "forestal" y otro totalmente diverso es el de "agropecuario", no siendo clara una interpretación que dijera que lo agropecuario es forestal.

De todas maneras en el caso concreto ni siquiera podría hablarse de la existencia de una corta de un árbol en "terrenos de uso agropecuario", puesto que la corta de los dos árboles se dio en un terreno para construcción (véase folio 35 fte líneas 27-29).

A pesar de ser reiterativo debe recalcarse que si se sostuviera que la corta de árboles prevista en el Art. 27 de la Ley Forestal encuentra su sanción en el Art. 63 inciso a) de la Ley Forestal, la extensión del término agropecuario prevista en el Reglamento de la Ley Forestal además de contrariar el carácter ejecutivo del reglamento con respecto a la ley, violentaría el mismo principio de legalidad (Art. 39 de la Constitución Política). Este principio exige que el supuesto de hecho calificado como delictivo sea previsto en un ley ordinaria, no pudiéndose hacer ello en un simple reglamento, todo lo cual encuentra su fundamento en la doctrina de la Ilustración que dio origen a la llamada división de poderes (Art. 9 de la Constitución Política). Por vía de excepción la Sala Constitucional ha admitido la constitucionalidad de leyes penales en blanco, sea de leyes que en lo relativo a la precisión de uno de los elementos del tipo delictivo remite a una norma de menor rango.

Importante al respecto es que Sala Constitucional ha dicho que "resulta posible completar una norma penal por medio de un reglamento, siempre que al hacerlo el Poder Ejecutivo se mantenga dentro de su espera propia de competencia y que la ley que remite establezca con suficiente claridad los presupuestos de la punibilidad, así como la clase y extensión de la pena..." (Sala Constitucional, voto 1876-90). Sin embargo, es claro que con la definición de "terrenos de uso agropecuario sin bosque" el Reglamento de la Ley Forestal extendería el ámbito de la conducta típica prevista en la Ley Forestal y con ello de la competencia del Poder Ejecutivo. Lo mismo puede decirse de cualquier intento de utilizar la palabra "árbol" como sinónimo de "forestal", como al parecer pretende el Reglamento de la Ley Forestal al usar el término "árbol forestal" (Art. 2). Además de la interpretación a contrario sensu del Art. 27 de la Ley Forestal, hecha antes, tiene gran relevancia en este asunto la interpretación del Art. 63 inciso a) en relación con el Art. 56 de la Ley Forestal.

El primero de dichos artículos sanciona como delictivo la infracción del Art. 56 mencionado. Este artículo por su parte indica que "No se podrá movilizar madera en trozas, encuadrada ni aserrada proveniente de bosque ni de plantación, si no se cuenta con la documentación respectiva". De importancia es que, como ya lo ha dicho la jurisprudencia del Tribunal Superior de Casación Penal, se sanciona sólo el transporte no autorizado de madera "proveniente de bosque o plantación", pero no el transporte de madera proveniente de terrenos que no sean bosque o plantación, lo que es un argumento de relevancia para estimar que el Art. 61 inciso a) sólo sanciona el aprovechamiento (y dentro de éste la corta) de árboles provenientes de bosques o plantaciones. Nótese que el legislador trató de extender "las tenazas" del Derecho Penal a diversas conductas que forman parte de lo que podríamos llamar el "ciclo de la deforestación", parafraseando la terminología que se ha utilizado con respecto a otros tipos de delitos, de modo que se trata de sancionar no sólo las conductas relacionadas con la corta de árboles no autorizada en terrenos forestales, sino también el transporte no autorizado de la madera de árboles de dicho terreno.

Por ello no habría razón alguna para sancionar el transporte solamente cuando la madera proviene de bosques o plantaciones, pero en lo relativo a la corta de árboles sancionar la realizada aun en terrenos que no reúnan esas características.

Debe indicarse que existe una gran preocupación en Costa Rica por la protección del medio ambiente, y dentro de éste de los bosques. Inclusive en la Constitución Política, de acuerdo con la reforma producida por la ley 7412 del 3 de junio de 1994 se dispuso que "Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado.

El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes" (Art. 50 párrafo 2) y 3)). La protección del medio ambiente, incluso por la vía penal, es una de las tendencias dentro del Derecho Comparado. Sin embargo, ello no debe llevar a una "inflación" de conductas delictivas que vaya en contra del principio del Derecho Penal como "ultima ratio" y del de "lesividad". Es cierto que es más fácil para la represión de los delitos de deforestación que se sancione cualquier corta de árbol, sea ésta en terrenos forestales o no. Sin embargo, ello llevaría a una extensión desmedida del Derecho Penal, tal y como ha ocurrido en la práctica costarricense, en la que se ha llegado, como se dijo, a sancionar simples cortas de árboles incluso en terrenos urbanos. En definitiva razones de mera conveniencia en la represión de determinados delitos no deberían llevar a extender la represión a supuestos diversos a los relacionados con el bien jurídico protegido (Medio Ambiente: protección de los bosques).

Importante es que es claro que debe actuarse estatalmente para evitar la deforestación, sea la destrucción de los bosques. Pero la destrucción de éstos, si se recurre a la incriminación penal, se puede tratar de evitar a través de la sanción en caso de tala de árboles en dichos bosques y no de la sanción a la tala de árboles que no forman parte de bosques. Por todo ello no puede sostenerse que esta sentencia, suponga la desprotección de los bosques frente a la deforestación, sino más bien es coherente con la necesidad de proteger los bosques, llevando dicha protección a la justa medida, de manera que con el argumento de proteger los bosques no se llegue a sancionar penalmente la corta de árboles en los "no-bosques". Todo ello es consecuencia no sólo del principio de legalidad, arriba mencionado, sino del mismo principio de lesividad. Por todo lo anterior estándose en el caso concreto ante una conducta atípica, lo correcto es declarar con lugar el recurso por fondo y absolver al imputado del delito de infracción a la ley forestal que se le ha venido atribuyendo" (En similar sentido votos 845-F-97 de las 10:00 horas del 17 de octubre de 1997 y voto 2001-929 de las 9:45 horas del 16 de noviembre de dos mil uno).

De la jurisprudencia invocada se extrae que la tala y aprovechamiento de árboles en terrenos privados está protegida como delito, siempre y cuando se realice en un bosque, con las dimensiones ya citadas, lo que no ocurre en este caso. En efecto, aunque la sentencia no lo diga expresamente, de la prueba citada en el fallo se desprende que el terreno donde se dio el aprovechamiento es una finca de setecientos cinco mil trescientos noventa y dos metros dedicada a la ganadería y con una casa de habitación (ver certificación de folio 72). Así las cosas, Se declara con lugar el recurso por el fondo. Se absuelve al imputado [Nombre10] del delito de infracción a la ley forestal que se le había venido atribuyendo. Por innecesario se omite pronunciamiento en cuanto al recurso de casación por la forma.
