Decision: [Telf1] CRIMINAL CASSATION COURT. Second Judicial Circuit of San José. Goicoechea, at ten fifty-six a.m. on the twenty-fourth of July, two thousand three.- APPEALS ON POINTS OF LAW (RECURSOS DE CASACIÓN) filed in the present proceedings brought against [Nombre1], of legal age, a native of San Carlos de Alajuela, child of [Nombre2] and [Nombre3], identity card number CED1, and [Nombre4] [Nombre5], of legal age, married, a native of San Ramón de Alajuela, child of [Nombre6] and [Nombre7], identity card number CED2, for the offense of VIOLATION OF THE LEY FORESTAL, to the detriment of NATURAL RESOURCES. Judges Jorge Alberto Chacón Laurito, Rafael Ángel Sanabria Rojas, and Jorge Luis Arce Víquez participated in deciding the appeal. Attorneys [Nombre8], public defender for [Nombre9], and [Nombre10], public defender for [Nombre11], entered appearances in the cassation proceedings, as did Attorney José Alberto Rojas Chacón on behalf of the Public Prosecution Service (Ministerio Público).-

FINDINGS:

I.By means of a judgment of conviction issued at ten fifteen a.m. on the nineteenth of December, two thousand two, the Trial Court of the First Judicial Circuit of Alajuela, San Ramón Seat, ruled: “POR TANTO: In accordance with the foregoing; Articles 39 and 41 of the Political Constitution; 1, 30, 45, 59 to 62, and 71 to 74 of the Criminal Code; 265, 360, 361, 363, 364, 365, 367, 370, and 371 of the Code of Criminal Procedure; and 58(a) and 61(a) of Ley Forestal number 7575, [Nombre12] is sentenced to THREE MONTHS’ IMPRISONMENT as the perpetrator responsible for the offense of ENCROACHMENT UPON A FOREST AREA, as well as ONE MONTH’S IMPRISONMENT for the offense of EXPLOITATION OF FOREST RESOURCES, both committed to the detriment of NATURAL RESOURCES, for a total of FOUR MONTHS’ IMPRISONMENT; he is also ordered to pay the costs of the proceedings. Likewise, ELIVER [Nombre9] is sentenced to THREE MONTHS’ IMPRISONMENT as the perpetrator responsible for the offense of ENCROACHMENT UPON A SPRING AND STREAM PROTECTION ZONE, committed to the detriment of NATURAL RESOURCES; he is also ordered to pay the costs of the proceedings.

After credit for time served in pretrial detention, the Defendants shall serve the sentences imposed upon them at the place and in the manner prescribed by prison regulations. The Defendants are granted the Benefit of a Conditionally Suspended Sentence (Beneficio de Condena de Ejecución Condicional) for a probationary period of three years beginning when the judgment becomes final; consequently, they shall not be required to serve the prison sentences imposed if, during that period, they do not commit an intentional offense punishable by imprisonment for more than six months. As to the Civil Action for Damages (Acción Civil Resarcitoria) filed by the civil plaintiff, the State, represented by the Procuraduría General de la República, against civil defendants [Nombre12] and [Nombre13] [Nombre9], that action is deemed withdrawn because the State’s representative did not submit closing arguments. LET IT BE KNOWN. ATTORNEY [Nombre14]. Trial Judge”.-

II. Attorneys [Nombre8] and [Nombre10] filed Appeals on Points of Law against the foregoing decision

III.After the corresponding deliberation was conducted in accordance with Article 450 of the Code of Criminal Procedure, the Court considered the issues raised in the Appeals.-

IV. The applicable legal requirements have been observed in the proceedings

Cassation Judge [Nombre15] drafts the opinion; and,

CONSIDERING:

APPEAL BY COUNSEL FOR DEFENDANT [Nombre9]:

I- As his first claim of procedural error, counsel for defendant [Nombre9] argues that the judgment lacks a statement of reasons because the trial judge made no analysis whatsoever of the subjective elements required by the criminal offense charged against his client, nor did he address the element of culpability (culpabilidad), which is important in determining whether criminal blameworthiness may properly be attributed, since the judgment itself shows that the defendant was performing brush clearing (chapea) as a laborer for [Nombre16], rather than encroaching upon a protected area. The judgment also lacks descriptive and analytical reasoning because the trial judge referred to an act of deforestation rather than encroachment, a circumstance that causes irreparable harm to his client, since the grounds for issuing the judgment of conviction are unknown. He therefore requests that the judgment be declared null and void.

The claim is denied. After reviewing the reasoning of the judgment, this Chamber finds that the trial judge clearly and comprehensively stated that the conduct proven to have been committed by defendant [Nombre17] consisted of cutting vegetation in a protected area, specifically at a spring (naciente) or stream located on the property known as Coopezamora. The trial judge clearly stated that the defendant was caught in flagrante delicto by police officers [Nombre18] and [Nombre19] while they were investigating a complaint filed by the injured party and property owner, [Nombre20]. In analyzing the defendant’s statement at folio 230, the court below stated: “...that defendant states: ‘A stream runs nearby.’ ‘The stream is about ten or eight meters from where I was working.’ This means that precisely where defendant [Nombre9] was carrying out the deforestation, there is a spring and a stream runs through it, an act entirely detrimental to the conservation of the species native to that protection zone...” Thus, the trial judge did analyze both the location where the defendant was clearing brush within the protected zone and its distance from the stream.

The judgment also analyzed why the accused was at that location, referring to the person who hired him and stating at folio 231: “...Juan [Nombre21], defendant [Nombre9]’s employer, stated that he had indeed hired [Nombre13] to clear brush at the scene, but that the contract was not for deforestation, much less for clearing brush near a spring located there...” Thus, the trial judge did analyze, both descriptively and analytically, the evidence presented in the adversarial proceedings that provided the basis for convicting the defendant for his intentional conduct, without finding any ground of justification or exculpation applicable to the particular case. The defendant’s control over the act (dominio del hecho) was established because police officers caught him in flagrante delicto while he was clearing brush within the protected zone of the stream located at the site, thereby committing the conduct defined as an offense under the provision.

II- As a claim of substantive error, the appellant argues that the judgment erroneously applies Article 58(a) of the Ley Forestal because his client was convicted of cutting vegetation without authorization in the protected area of a spring and stream, with the prohibited conduct being construed as encroachment. He argues that the conduct is not criminally proscribed when the defendant’s actual action is considered, because he had been hired to clear brush along one edge of the property and did not occupy the land. According to the prohibited act of encroachment, the perpetrator must have performed certain acts of possession over the conservation area, such as building a house, etc., a circumstance that was not proven. He therefore requests that his client be acquitted of the charged offense. The claim cannot be entertained. After analyzing the proven facts with respect to the prohibited conduct described in Article 58(a), in conjunction with the protected areas described in Articles 33(a) and 34 of the Ley Forestal, this Chamber finds that deforestation in a protected area is accomplished, according to the synonyms of the verb “to encroach” listed in the third edition of the 1997 Diccionario Consultor Larousse de Sinónimos, p. 437, through the act of breaking into, entering, occupying, attacking, etc. Thus, the act of encroachment to which the appellant refers does not apply only to encroachment for the purpose of exercising possession; in our judgment, it may also be committed, as the legislature indicates, by breaking into, entering, or occupying.

The trial judge described this as the act committed by the defendant, who was caught while carrying it out after entering the area bordering a spring and stream and engaging in deforestation, thereby plainly causing significant environmental damage in the protected zone. The court below described the foregoing conduct at folio 231 when it stated: “the defendant herein, [Nombre13] [Nombre9], who, without any permit whatsoever, proceeded to deforest a protected or managed forest, causing harm to the local flora and fauna because, as stated, that defendant deforested part of a primary forest located in that area...” Thus, as the trial judge explained, the judgment established that the defendant fulfilled the objective elements of the offense (tipicidad objetiva) described in the criminal provision by deforesting the protected zone of a spring and stream, as well as the subjective elements of the offense (tipicidad subjetiva) by carrying out the act with complete control over the criminal conduct he was committing. For the foregoing reasons, the appeal filed by counsel for defendant [Nombre9] is denied.

APPEAL ON POINTS OF LAW FILED BY COUNSEL FOR DEFENDANT [Nombre11].

III- As one of the procedural grounds, counsel for the accused [Nombre11] argues that the judgment lacks sufficient reasoning because the trial court has a duty to examine and assess all evidentiary material relevant to the subject matter of the proceedings and to indicate the weight assigned to each item of evidence; the judgment does not explain why the proven facts constitute the offenses of invasion and exploitation of forest products, nor does it address the subjective elements of the criminal offense in order to determine his client’s guilt; neither does it analyze the testimony obtained so as to reach a genuine assessment of the evidence concerning his client’s guilt, particularly since the witnesses consistently stated that the person responsible for the deforestation was [Nombre22], the previous possessor, who abandoned the parcel after a traffic accident, whereupon Mr. [Nombre23] entered and has been working it.

The claim is well-founded. After reviewing the recitals of the judgment, this Chamber determines that it was deemed proven that on July 10, 2000, the accused [Nombre24] deforested an approximately two-manzana tract of forested land. However, when the judgment proceeds to analyze the testimony from which such criminal conduct was inferred, it begins by stating that the police officers arrived to inspect the land on July 10, 2000, but that the deforestation occurred before that date, without specifying when—whether the preceding month, the preceding year, etc.—which entails deeming proven an assertion that is not made specific, particularly since it must also be stated whether the accused currently works that land, since when it has no longer been forest, and the basis for reasonably concluding that it was the accused who caused the damage to the forest, or whether it was another person who allegedly possessed it previously, as the defense asserts in its claim.

It is on folio 237 that the trial court concludes that the accused was the person who deforested it, stating: “... although no one observed that gentleman carry out such deforestation, it is nevertheless true that all the evidence analyzed leads us to conclude with the requisite certainty that [Nombre23] was the person who deforested the parcel that apparently belonged to Mr. [Nombre25], since he allegedly dispossessed him of that parcel more than two years ago and immediately began working it, thereby causing the deforestation ...” Notwithstanding the foregoing, the a quo court does not provide adequate reasoning based on the application of the rules of logic, experience, and psychology to infer from the evidence that the accused [Nombre26] possessed the parcel before it was deforested; instead, the trial court itself states that the parcel apparently belonged to [Nombre22] and that it was the accused who dispossessed him of it more than two years ago, assertions made without providing adequate grounds based on the evidence obtained, since it is not enough to state that the defense witnesses are contradictory; rather, there must be evidence supporting the proven facts, which is lacking in the judgment.

For the foregoing reasons, because the judgment lacks adequate reasoning with respect to establishing the guilt of the aforementioned accused, the asserted ground is granted, and the judgment is vacated solely with respect to the conviction of the accused [Nombre11], remaining undisturbed in all other respects. The case is remanded for new proceedings; in view of this ruling, the remaining grounds of the appeal are not addressed.

POR TANTO:

The appeal in cassation filed by the defense of [Nombre27] is denied. The appeal in cassation filed by the defense of [Nombre11] is granted, and the judgment is vacated solely with respect to the conviction of the accused [Nombre4] [Nombre11], remaining undisturbed in all other respects. The case is remanded for new proceedings; in view of this ruling, the remaining grounds of the appeal are not addressed. Let notice be given.

Intervienen en la decisión del recurso, los Jueces Jorge Alberto Chacón Laurito, Rafael Ángel Sanabria Rojas y Jorge Luis Arce Víquez. Se apersonaron en casación los Licenciados [Nombre8], defensor público de [Nombre9], [Nombre10], defensor público de [Nombre11] y en representación del Ministerio Público el Licenciado José Alberto Rojas Chacón.-

RESULTANDO:

I.Que mediante sentencia condenatoria dictada a las diez horas y quince minutos del diecinueve de diciembre del año dos mil dos, por el Tribunal de Juicio del Primero Circuito Judicial de Alajuela, Sede San Ramón, resolvió: “POR TANTO: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política; 1, 30, 45, 59 a 62, 71 a 74 del Código Penal, 265, 360, 361, 363, 364, 365, 367, 370 y 371 del Código Procesal Penal, 58, inciso a) y 61 inciso a) de la Ley Forestal número 7575, se le impone a [Nombre12] el tanto de TRES MESES DE PRISION, como autor responsable del delito de INVASION A AREA DE BOSQUE, así como el tanto de UN MES DE PRISION, por el delito de APROVECHAMIENTO DE RECURSOS FORESTALES, que en perjuicio de LOS RECURSOS NATURALES se le ha venido atribuyendo, para un total de CUATRO MESES DE PRISION, condenándosele además al pago de las costas del proceso. Así mismo, se le impone ELIVER [Nombre9], el tanto de TRES MESES DE PRISION, como autor responsable del delito de INVASION A UNA ZONA DE NACIENTE Y QUEBRADA, que en perjuicio de LOS RECURSOS NATURALES se le ha venido atribuyendo, condenándosele además al pago de las costas del proceso.

Las penas impuestas a los Justiciables, las deberán descontar, previo abonos de las preventivas sufridas, en el lugar y forma que indiquen los reglamentos carcelarios. Por un período de prueba de tres años, que corre a partir de la firmeza del fallo, se le conceden a los Justiciables el Beneficio de Condena de Ejecución Condicional, en consecuencia, no están obligados a cumplir las penas de prisión impuestas si en el período dicho no incurren en delito doloso sancionado con prisión mayor a seis meses. En cuanto a la Acción Civil Resarcitoria interpuesta por el actor civil El Estado, representado por la Procuraduría General de la República, contra los demandados civiles [Nombre12] y [Nombre13] [Nombre9], se declara desistida dicha acción, por cuanto el representante estatal no presentó conclusiones. HÁGASE SABER. LIC. [Nombre14]. Juez de Juicio”.-

II. Que contra el anterior pronunciamiento interpusieron Recursos de Casación los Licenciados [Nombre8] y [Nombre10]

III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 450 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en los Recursos.-

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta el Juez de Casación [Nombre15]; y,

CONSIDERANDO:

RECURSO DE LA DEFENSA DEL IMPUTADO [Nombre9]:

I- Como primer motivo por la forma plantea el señor defensor del imputado [Nombre9], que la sentencia carece de fundamentación por cuanto, el juzgador no hace el menor análisis sobre los elementos subjetivos requeridos por el tipo penal atribuido a su defendido, ni tampoco hace referencia al elemento culpabilidad, lo que es de importancia para determinar si procede o no el reproche, porque del propio fallo se desprende que el imputado lo que hacía era una chapea como peón de [Nombre16] y no una invasión de un área protegida. También existe en el fallo falta de fundamentación descriptiva e intelectiva, puesto que lo que se hace por parte del juzgador, es hacer referencia a una acción de deforestación y no de invadir, situación que causa un gravamen irreparable a su defendido, ya que no se sabe cuáles fueron los motivos para el dictado del fallo condenatorio, por lo que solicita la nulidad de la sentencia.

El reclamo se rechaza. Esta cámara luego del estudio de los considerandos del fallo determina, que el juzgador es amplio y diáfano en indicar, que la conducta que se demostró realizó el imputado [Nombre17], fue la de cortar la flora en un área protegida concretamente en una naciente o quebrada ubicada en la finca denominda Coopezamora. El juzgador es claro en indicar, que el imputado fue sorprendido en flagrancia por los oficiales de policía [Nombre18] y [Nombre19], cuando investigaban una denuncia planteada por el ofendido propietario de la finca [Nombre20], indicando el a quo al analizar el dicho del imputado al folio 230: "...dicho justiciable afirma que: ' Por el lugar pasa una quebrada cerca'. 'La quebrada está como a diez u ocho metros de donde estaba yo trabajando'. Quiere decir que precisamente por donde el acusado [Nombre9] estaba realizando la deforestación, existe una naciente y pasa una quebrada, acción que viene en total detrimento para la conservación de las especies propias de esa zona de protección ..." de tal forma, que el juzgador sí analiza el lugar donde se encontraba chapeando el imputado en la zona protegida y la distancia de la quebrada, analizándose también en el fallo, la situación del por qué se encontraba el acusado en ese lugar, al referirse al que lo contrató cuando indica al folio 231: "...Juan [Nombre21], empleador del acusado [Nombre9], indicó que precisamente contrató a [Nombre13] para hacer una chapea en el lugar de los hechos, pero que ese contrato no era para deforestar ni mucho menos que chapeara cerca de una naciente que hay en el lugar..." de tal forma, que el juzgador sí analizó tanto descriptivamente como intelectivamente la prueba recabada en el contradictorio y que sirvió de fundamento para condenar al imputado, por la acción dolosa desplegada por éste, sin que se determinara existiera alguna causa de justificación o exculpación, que debiera aplicarse al caso concreto, puesto que se determinó el dominio del hecho que tuvo el acusado, al ser sorprendido en flagrancia por los agentes de policía, cuando efectuaba la chapea en la zona protegida de la quebrada ubicada en el lugar, con lo cual estaba ejecutando la acción típica descrita en la norma.

II- Como motivo por el fondo plantea el recurrente, que la sentencia aplica erróneamente el artículo 58 inciso a) de la Ley Forestal por cuanto, se condena a su defendido por cortar sin autorización vegetación en un área protegida de una naciente y quebrada, considerándose la acción típica como la de invadir, acción que es atípica si se analiza la acción desplegada por el imputado que fue la de chapear una orilla de la finca para lo cual fue contratado, pero no hubo ocupación del terreno, requiriéndose según la acción típica de invadir, que el autor haya realizado ciertos actos de posesión sobre el área de conservación, como contruir una casa etc., situación que no se tuvo por demostrada, por lo que solicita se absuelva a su defendido del delito acusado. El reclamo es inatendible. Esta cámara luego del análisis de los hechos demostrados, en cuanto a la acción típica descrita en la norma del artículo 58 inciso a), en relación con las que describen las áreas protegidas 33 inciso a) y 34 de la Ley Forestal determina, que la acción de deforestar en un área protegida se ejecuta, según los sinónimos del verbo invadir que consta en el Diccionario Consultor Larousse de Sinónimos, tercera edición de 1997 pag. 437, con la acción de irrumpir, penetrar, ocupar, acometer etc., de tal forma que la acción de invadir a que alude el recurrente, no se refiere a la de invadir con fines de ejercer posesión, sino también puede efectuarse como lo indica el legislador a nuestro juicio con la acción de irrumpir, penetrar, ocupar, acción que describe el juzgador como la ejecutada por el imputado, el cual fue sorprendido cuando ejecutaba la acción, de haber penetrado en el área que bordea una naciente y quebrada y ejecutar una deforestación, con lo cual evidentemente causó un daño ambiental importante en la zona protegida.

La anterior acción la describe el a quo al folio 231 cuando indica: " el aquí acusado [Nombre13] [Nombre9], quien sin contar con permiso alguno procedió a deforestar un bosque protegido o intervenido, causando un perjuicio a la flora y fauna del lugar, pues, como se dijo, dicho encartado realizó la deforestación de parte de un bosque primario ubicado en esa zona..." de tal forma, que se demostró en el fallo tal y como lo fundamentó el juzgador, que el imputado ejecutó la tipicidad objetiva descrita en la norma penal, al deforestar la zona protegida de una naciente y quebrada y la tipicidad subjetiva al ejecutar la acción con total dominio del hecho delictivo que ejecutaba. Por lo expuesto, se declara sin lugar el recurso de casación interpuesto por la defensa del imputado [Nombre9].

RECURSO DE CASACIÓN INTERPUESTO POR LA DEFENSA DEL IMPUTADO [Nombre11].

III- Como uno de los motivos de forma plantea el señor defensor del imputado [Nombre11], que la sentencia carece de fundamentación por cuanto, el tribunal de juicio tiene el deber de examinar y valorar todo el material probatorio de interés con el objeto procesal, e indicar el valor que le otorga a cada probanza, no se indica en la sentencia por qué, los hechos probados constituyen los delitos de invasión y aprovechamiento de productos forestales, ni tampoco de los elementos subjetivos del tipo penal para determinar, la culpabilidad de su defendido, tampoco entra a analizar los testimonios recabados, para concluir con una verdadera valoración de la prueba sobre la culpabilidad de su defendido, máxime que en los testigos existe congruencia en indicar, que el responsable de la deforestación fue [Nombre22] anterior posedor, el cual luego de un accidente de tránsito abandonó la parcela y fue cuando ingresó don [Nombre23] y la ha estado trabajando.

El reclamo es procedente. Esta cámara luego del estudio de los considerandos del fallo determina, que se tuvo por demostrado que el 10 de julio del 2000, el imputado [Nombre24] deforestó un terreno formado de bosque de aproximadamente dos manzanas, sin embargo cuando entra a analizar los testimonios que permiten derivar tal acción delictiva, empieza por expresar que el día que llegaron los oficiales de policía al terreno para inspeccionar, fue el 10 de julio del 2000, pero que la deforestación fue antes de esa fecha sin precisar cuándo, si fue el mes anterior, el año anterior etc., lo que implica tener por demostrada una afirmación que no se concreta, máxime que debe expresarse también, si el imputado en la actualidad trabaja tal terreno, a partir de cuándo ya no es bosque y de donde deriva razonablemente que fue el imputado el que produjo el daño a la foresta o si fue otra persona, el cual supuestamente lo poseía antes como lo afirma la defensa en su reclamo.

Es en el folio 237 donde el juzgador concluye, que el imputado fue el que deforestó afirmando: "... si bien nadie observó a dicho señor realizar tales deforestaciones, es lo cierto que todas las pruebas analizadas nos enrumban a considerar con la debida certeza que [Nombre23] fue la persona que deforestó la parcela que aparentamente perteneció al señor [Nombre25], pues a él supuestamente lo despojó de dicha parcela hace más de dos años y procedió de inmediato a trabajarla, produciendo la deforestación ..." no obstante lo anterior, no realiza el a quo una adecuada motivación basada en la aplicación de las reglas de lógica, experiencia y sicología, para derivar de la prueba que el imputado [Nombre26] poseyera la parcela antes de ser deforestada, sino que más bien el mismo juzgador afirma que aparentemente dicha parcela perteneció a [Nombre22] y que fue el imputado, quien lo despojó hace más de dos años, afirmaciones que se realizan sin efectuar una adecuada fundamentación de la prueba recabada, puesto que no basta con expresar que los testigos de descargo son contradictorios, sino que debe contarse con prueba que respalde los hechos probados, lo que se echa de menos en el fallo.

Por lo expuesto, al carecer la sentencia de una adecuada motivación, en lo relativo a la demostración de culpabilidad del imputado citado, se declara con lugar el motivo interpuesto, anulándose la sentencia únicamente en cuanto a la condena del acusado [Nombre11], manteniéndose incólume en lo demás. Se ordena el reenvío para nueva sustanciación, en vista de lo resuelto no se entra a resolver los restantes motivos del recurso.

POR TANTO:

Se declara sin lugar el recurso de casación interpuesto por la defensa de [Nombre27]. Se declara con lugar el recurso de casación interpuesto por la defensa de [Nombre11], anulándose la sentencia únicamente en cuanto a la condena del acusado [Nombre4] [Nombre11], manteniéndose incólume en lo demás. Se ordena el reenvío para nueva sustanciación, en vista de lo resuelto no se entra a resolver los restantes motivos del recurso. Notifíquese.
