VOTO N° 33-F-03 AGRARIAN COURT OF THE SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. GOICOECHEA, AT FIFTEEN HOURS AND FIFTEEN MINUTES ON THE THIRTIETH OF JANUARY TWO THOUSAND AND THREE.

Possessory Information proceeding (Información Posesoria) filed by [Nombre1], whose particulars are known in the record, processed before the Agrarian Court of the Southern Zone. The State and the Instituto de Desarrollo Agrario appeared as parties, represented respectively by Licenciado Víctor Bulgarelli Céspedes in his capacity as Agrarian and Environmental Prosecutor (Procurador Agrario y Ambiental) and by Engineer José Joaquín Acuña Mesén, with powers of Attorney-in-Fact without limit of amount (Apoderado Generalísimo sin límite de suma). This Court takes up the Appeal (Recurso de Apelación) filed by the State's representative against the judgment handed down at eight hours and fifteen minutes on the twelfth of March two thousand and two.

BACKGROUND.

  1. 1The titling applicant (titulante) initiates a Possessory Information proceeding, valued at one million colones, seeking registration in the Public Property Registry of the parcel described as follows: Unregistered land located at [Dirección1], in the Province of Puntarenas, with an area of fifty-four thousand four hundred and eighty-six square meters and twenty-three square decimeters, according to cadastral plan number P-twenty-four seventy-five thirty-nine-ninety-five, with the following boundaries: to the north with [Nombre2], [Dirección2], [Dirección3] with Wilberth Medina Gatica, to the west with [Nombre3] and [Nombre4].
  2. 2The Instituto de Desarrollo Agrario appeared in the proceeding in the terms set out at folio 27, without opposing it. For its part, the State, represented by the Office of the Attorney General of the Republic (Procuraduría General de la República), appeared in the proceeding in the terms set out at folios 60 to 61, opposing it.
  3. 3Licenciada Marisel Zamora Arias, first-instance judge, in the judgment handed down at eight hours and fifteen minutes on the twelfth of March two thousand and two, ruled: "Por tanto Having fulfilled the remaining requirements and having duly conducted the proceeding in accordance with the provisions of the Ley de Informaciones Posesorias number 139 of the fourteenth of July of nineteen forty-one and its amendments, it is appropriate to approve the title and order its registration. The Public Property Registry shall proceed to register, for the first time and in the name of the applicant, the unregistered parcel described as follows: Unregistered land located in Los Mogos, district of Sierpe, fifth canton, Osa, Province of Puntarenas, with an area of fifty-four thousand four hundred and eighty-six square meters and twenty-three square decimeters, according to cadastral plan number P-twenty-four seventy-five thirty-nine-ninety-five, with the following boundaries: to the north with [Nombre2], to the south with [Dirección4], to the east with [Nombre5], to the west with [Nombre3] and [Nombre4] in part.By virtue of the fact that a stream (quebrada) runs through and across the parcel in question, in accordance with article 33, subsection b) of the Ley Forestal in force, it constitutes a protected zone (zona protectora) and shall be subject to the legal restrictions set forth in article 34 of that Law; it is noted that the beds of said stream are not included within the parcel, as they are in the public domain (article 1, subsection IV and article 3, subsection III of the Ley de Aguas). A certified copy of this ruling shall serve as the document for registration of the aforementioned parcel before the Public Registry."
  4. 4The procedural formalities and deadlines prescribed by law have been observed. No defects or omissions capable of leaving any party without a defense are noted.

The ruling is authored by Judge Vargas Vásquez; and,

WHEREAS

I.The first and third facts found to be proven in the appealed judgment are adopted herein, as they are consistent with the evidence produced in the proceeding; the remaining facts are not adopted, as they are unnecessary given the manner in which this instance will resolve the matter.

II.It is found to be unproven that the titling applicant and her predecessors in title were in possession of the property she seeks to title for at least ten years prior to the entry into force of Decreto N° 8494-A of April 28, 1978, which created the Reserva Forestal Golfo Dulce. There is no evidence to that effect.

III.The State's representative, in a brief submitted by fax on the first of April two thousand and two (folio 69), the original of which was filed in court on the third of April of that year (folio 73), filed an Appeal against the judgment, expressing disagreement on the following grounds: He considers that, in accordance with the new case law (jurisprudencia) of the Agrarian Court, when possession of real property forming part of the State Natural Heritage (Patrimonio Natural del Estado) is to be demonstrated, the point of reference must be the Ley de Tierras y Colonización N° 2825 of October 14, 1961—that is, possession for at least ten years prior to its enactment. In support of this argument, the appellant transcribes part of Voto N° 332 of 16:20 hours on July 7, 2000. He notes that, in the present case, none of the three witnesses attests that the property was possessed prior to 1951: [Nombre6] states he has known the land for about thirty-five years, [Nombre5] for about thirty years, and [Nombre2] for about forty years.

Under these circumstances, in the appellant's view, the Court should have dismissed these proceedings for failure to satisfy the essential requirement of proving ten-year possession (posesión decenal) for at least ten years prior to the Ley de Tierras y Colonización; accordingly, since the property is located within a protected area, it should continue to belong to the State Natural Heritage. He also transcribes part of the ruling issued by the Agrarian Court of the First Judicial Circuit of the Atlantic Zone, Number 7 of 15:00 hours on March 5, 2001, within the Possessory Information proceeding file of [Nombre7], a case in which, he states, the property was located within the Zona Protectora del Río Banano. He further adds that one of the witnesses, Mr. [Nombre5], was also unable to attest to ten-year possession prior to the decree creating the Reserva Forestal Golfo Dulce.

IV.The appellant's legal argument is without merit. First, pursuant to article 9 of the Civil Code, case law is understood to mean the doctrine established in a reiterated manner by the Courts of Cassation and the full Court (Corte Plena) when applying the law, custom, and general principles of law; thus, the rulings of this Court do not constitute binding case law, and even less so do rulings of first-instance courts. Moreover, even if they did, such case law would not be binding under the terms stated by the Constitutional Chamber in Voto Número 2049 of 14:48 hours on February 27, 2002, which held: "… Only (sic) the case law and precedents of the Constitutional Chamber are binding erga omnes. The final requirement that must be met for a judicial consultation to be admissible is, therefore, that the doubt must arise in relation to a norm that the judge is required to apply, and the coercive element contained in that word cannot be set aside.

In the case of case law, however, that element does not exist, because, as this Court has already stated, the judge is not obligated to apply it by virtue of the principle of judicial independence …"; the foregoing is cited because the First Chamber of the Court, in Votos Números 51 of 15:15 hours on May twenty-sixth, nineteen ninety-five, and 59-99 of 14:00 hours on February fifth, nineteen ninety-nine, maintains a position similar to that advanced by the appellant—which, while respected, is not shared by this Court. This is so because the provisions of the Fiscal Code and the Ley de Terrenos Baldíos have been repealed and are not currently applicable; and as regards the Ley de Tierras y Colonización, this Court agrees with what the appellant's representatives have argued, namely that its provisions cannot be interpreted to mean that all land bearing forest cover (cobertura boscosa) forms part of the State Natural Heritage and is therefore inalienable and imprescriptible—for if that were so, the inclusion of the specific cases listed in subsections "a" through "i" of article 7 would be meaningless.

That article provides that, until the State, of its own accord or at the direction of the Ministry of Agriculture or the Instituto de Desarrollo Agrario, determines—on grounds of national interest—which parcels must remain under State ownership, such parcels shall be deemed inalienable and not susceptible of acquisition by discovery or possession, unless they are under private ownership by legitimate title; the cases enumerated in the cited subsections do not include any situation within which the property that is sought to be titled could be considered to fall—which property, as evidenced by the repeated certifications filed in the record, lies outside any protected area administered by the Ministry of Environment and Energy. Accordingly, the provisions contained in the subsequent articles of that Chapter of the Ley de Tierras y Colonización entitled "Agricultural Property of the State" must be understood in light of that norm; and with respect to the prohibition contained in article 8, read in conjunction with article 11, relating to national reserves, the Law again sets out a series of exceptions to what is to be understood as national reserves, consistent with the Ley de Informaciones Posesorias Número 139 of July 14, 1941, which was in force at that time—legislation that was subsequently amended by the Forest Laws enacted thereafter, including the current one, which amended the content of article 7 of the Ley de Informaciones Posesorias, permitting the titling of forested land.

Insofar as is relevant for purposes of this proceeding, that provision states: "When the property to which the information refers falls within a protected wildlife area (área silvestre protegida), of whatever management category, the titling applicant must demonstrate that he or she is the holder of the legal rights arising from ten-year possession exercised for at least ten years prior to the date of entry into force of the law or decree by which that protected wildlife area was created …". From the foregoing it follows that, in the present case, if the titling applicant manages to demonstrate possession of the property for ten years prior to the entry into force of the decree creating the Reserva Forestal Golfo Dulce, N° 8494 of April twenty-eighth, nineteen seventy-eight, while also satisfying the remaining requirements of the Ley de Informaciones Posesorias, the property may be titled, without it being possible to require ten-year possession prior to the entry into force of the Ley de Tierras y Colonización, as the appellant contends. Such a requirement would run contrary to what was decided by the Constitutional Chamber in Voto Número 4587 of 15:45 hours on August 5, 1997.

V.Regarding the testimonial evidence (prueba testimonial), it is apparent from the case file (autos) that deponent [Nombre6] stated having known the property for thirty years, referring to the year 1969, as he gave his testimony on October 4, 2001 (folio 41); [Nombre2] stated having been an adjacent landowner (colindante) for about forty years, referring to the year 1959; and [Nombre5] affirmed having known the property for more than thirty years, that is, since before 1969. In this case, as indicated, the decree that created the Reserva Forestal Golfo Dulce was established by Decreto Ejecutivo N° 8494-A of April 28, 1978; accordingly, in order to register the property in her name, the titling applicant (titulante) was required to demonstrate possession prior to April 28, 1968 — a circumstance that, as the representative of the State correctly notes, does not exist in this case, since both deponent [Nombre6] and [Nombre5] stated having known the property only as of the year 1969, and although the latter stated it was from before that year, no specific timeframe was established — it could have been a matter of days or a considerably longer period — an uncertainty that cannot serve as a basis for approving a possessory information proceeding (Información Posesoria), given the failure to comply with the provisions of the first paragraph of Article 7 of the Ley de Informaciones Posesorias.-

VI. For the foregoing reasons, the challenged judgment must be reversed.-

POR TANTO

The appealed judgment is reversed.- [Nombre8] [Nombre9] [Nombre10] NOTE OF JUDGE [Nombre9] The public domain (dominio público) —for the case at hand— is the body of publicly owned State assets, lato sensu, dedicated to the direct or indirect public use of the inhabitants, and subject to a special regime of public law that is, by its nature, exorbitant of private law. The public domain is composed of four elements: subjective, objective, normative, and teleological. The subjective element refers to the holder of the right —the State—; the objective element refers to, or is constituted by, the asset or assets upon which the public domain falls —in this case, the real property at issue in the litigation—; the normative element determines when an asset meets the legal requirements to be considered a public-domain asset (bien dominial), that is, it is the body of rules governing it —the list of rules to be set out below—; and the teleological element refers to the purpose pursued by including a given asset within the public domain, namely, what public purpose is assigned to the asset —in this case, the protection of natural resources.

Public-domain assets are subject to a special legal regime, subject to police power (poder de policía), and are characterized essentially by their inalienability and imprescriptibility (imprescriptibilidad). By their nature they are directed toward satisfying public needs; this fact prevents private individuals or private persons from holding tenure or possession (posesión) over them, and places them outside the sphere of private-law commerce. Our Political Constitution, in Article 121, subsection 14, refers to public-domain status (Demanialidad), indicating which assets are susceptible to that regime of public ownership; indeed, that article establishes different degrees of public dedication (afectación pública), ranging from an intense and absolute degree of publicatio to other lesser degrees, harmonizing the rights of administered persons with the powers of the Administration. Our Código Civil, which dates from April of 1886, regulates the most important foundations in the area of public-domain assets, specifically in Articles 261 through 263.

Article 262 of the aforementioned Código Civil refers to two important characteristics of public-domain assets: a) public things are outside commerce, and b) de-dedication (desafectación) is established by stating that such assets may not enter into private commerce unless legally so provided. As may be observed, dedication to the public-domain regime does not depend on the nature of the asset, but on the will of the legislator. By means of Voto número 447-91 of fifteen hours thirty minutes on February 21, 1991, the Sala Constitucional stated that the declaration of an asset as public domain is established by law; this declaration does not constitute a limitation on property within the meaning of Article 45 of the Carta Magna, since that article refers to private property, and public-domain assets are not subject to private ownership. The State Forest Heritage (Patrimonio Forestal del Estado) is a public-domain asset (bien demanial) regulated by a broad body of rules which, historically and to this day, prohibits private individuals from carrying out any kind of work on properties bearing that characteristic, consequently denying them the right of possession —with one exception in a specific situation to be described below.

Lands constituting National Reserves (Reservas Nacionales) that contain forests are considered State Heritage (Patrimonio Estatal) —in their capacity as Public Domain (Demanio Público), which implies the principles of imprescriptibility, inalienability, and non-attachability (inembargabilidad). The foregoing finds its normative development in the citations set out below: 1) The Código Fiscal of 1865, which contained a chapter on forests, later repealed by the Ley General de Terrenos Baldíos Number Thirteen of January 6, 1939, which incorporated practically the same provisions. For example, Article 1 stated: "That lands within the boundaries of the Republic that have not been acquired or registered as private property by means of a legitimate title by private individuals are presumed to be vacant lands (baldíos) and belong to the State." This law generally regulates the prohibition against possessing and registering, through possessory information proceedings (informaciones posesorias), National Reserves that constitute Forest Heritage; in other words, they are not susceptible of appropriation by private individuals.

The Ley de Tierras y Colonización Number 2825 of October 14, 1961 maintained the same approach and has been in force since that date. Thus, Article 8 of that Ley de Tierras y Colonización provides: "Except in cases provided for in this law, it is prohibited for private individuals to enclose with fences, lanes, or any other means lands declared as National Reserves, to fell forests, to establish buildings and crops thereon, or to extract from them firewood, timber, vine, palm, and other products for exploitation purposes. Any such act, if the required legal procedures have not been previously completed and the corresponding authorization obtained, shall be considered, depending on the circumstances, as usurpation of the public domain or trespass; the authorities shall order the destruction and removal of the fences and prohibit the use of such lands, with no entitlement to compensation or claims for the value of improvements, and without prejudice to any other liability that may be incurred by those committing such violations." It should be noted that this article imposes criminal penalties on anyone who enters a National Reserve to carry out any activity on such lands; accordingly, that act cannot be considered an act of possession, since it would be illegitimate.

Article 11 of that same Law establishes that the following belong to the State as National Reserves: "a) All lands within the boundaries of the Republic that are not registered as private property, municipal property, or property of Autonomous Institutions. b) Those not supported by ten-year possession (posesión decenal). c) Those that, under special laws, have not been allocated for the formation of agricultural colonies. d) In general, all lands that, not being privately owned, are not occupied in public services." For its part, Article 19 of the repealed Ley Forestal Number 4465 of November 23, 1969 provided: "All forests and forest lands (terrenos forestales) located in the following are dedicated to the purposes of this law: 'a) Lands considered National Reserves...'" And Article 25 of that same law stated: "Possession of lands situated in the National Reserves and State properties referred to in Article 19 of this Law shall not give rise to any rights of any kind, and the State's revindicatory action (acción reinvidicatoria) over such lands is imprescriptible; the Dirección General Forestal, by the legal means at its disposal, shall proceed to evict from such lands any persons occupying them in whole or in part, in cases involving protective zones (zonas protectoras), National Parks (Parques Nacionales), Forest Reserves (Reservas Forestales), and Biological Reserves (Reservas Biológicas)." These rules afford the forests mentioned therein a dual protection: first, by virtue of their status as National Reserves, within which any possessory act is prohibited; and second, by virtue of their constituting State Forest Heritage, within which no possessory act shall give rise to any right of any kind.

This is confirmed by Article 8 of the regulations to that law, which states: "National lands comprised within areas declared Forest Reserves are inalienable, that is, they may not leave the State's domain, and possession of them shall not give rise to any right of any kind, in accordance with the provisions of Articles 25, 49, and 57 of the Ley Forestal." Article 80 of the aforementioned repealed Ley Forestal provided: "Invasion and occupation of lands in National Parks, Forest Reserves, and Protective Zones is prohibited. This prohibition extends to National Reserves, until their classification and transfer have been determined..." Article 6 of that same law provided: "The following shall be punished by imprisonment of six months to two years or by a fine of fifteen to one hundred days: a) A person who operates a forest of the forest heritage without the corresponding legal authorization... b) A person who invades a National Park, Biological Reserve, Protective Zone, or Forest Reserve...If the invasion is in National Reserves, the person shall be subject to the provisions of Article 227 of the Código Penal." As may be observed, possessory acts carried out in a forest constituting State Heritage are illegitimate and therefore cannot confer any right of possession.

With the entry into force of Ley Forestal Number 7174 of June 28, 1990, this same philosophy continued. Article 32 of that law provides: "The State Forest Heritage is constituted by all forests and forest lands of the National Reserves..." Article 33 of that same law provides: "The forest lands and forests constituting the State Forest Heritage detailed in the preceding article shall be non-attachable and inalienable; possession of them by private individuals shall not give rise to any right in their favor, and the State's revindicatory action over such lands is imprescriptible. Consequently, they are not susceptible of registration in the Registro Público through possessory information proceedings; their invasion and occupation shall be sanctioned pursuant to the provisions of this Law." With the current Ley Forestal in force, Ley 7575 of February 5, 1996, Title II regulates a single chapter devoted exclusively to the State Natural Heritage (Patrimonio Natural del Estado), maintaining the same philosophy that had been in place since 1865 with the Código Fiscal; accordingly, this new legislation reiterates that the State Natural Heritage shall be constituted by the forests and forest lands of the national reserves, of the areas declared inalienable, and of properties registered in the name of the Public Administration.

Article 14 of the current Ley Forestal in force emphatically states that the forest lands and forests constituting the State Natural Heritage are imprescriptible, non-attachable, and inalienable, and that possession of them by private individuals shall not give rise to any right in their favor. The Ley de Conservación de la Vida Silvestre Number 7317 of October 21, 1972, in Articles 3 and 4, in addition to declaring wild fauna (fauna silvestre) and wild flora (flora silvestre) respectively to be of public domain and of public interest, provides that wild flora and fauna are part of the National Heritage (Patrimonio Nacional). In the same vein, the Ley de Biodiversidad Number 7788 of April 30, 1998, in Article 6, declares the elements of biodiversity to be of public domain, as does the Ley Orgánica del Ambiente in Article 46, which establishes the State's sovereignty over biological diversity.

For the foregoing reasons, it is a legal imperative to deny the right of possession to those persons who carry out any activity on lands not subject to private ownership that consist of forests within National Reserves. To that imperative prohibition, Ley Forestal Ley 7575 of 1996, which amends Article 7 of the Ley de Informaciones Posesorias, establishes an exception to the philosophy set out above: the titling of forests becomes possible when what is understood as ecological possession (posesión ecológica) has been developed within them. The land that is the subject of this possessory information proceeding is State Natural Heritage, since it is composed almost entirely of primary forest (bosque primario), with eighty percent of its area falling within the Humedal Nacional Térraba Sierpe and twenty percent located within the Reserva Forestal Golfo Dulce; it is therefore clear that this territory has been State Natural Heritage since before those Decrees were issued, as already set out in the normative history above.

When discussing possession over public-domain property (bien demanial), such a discussion is only admissible when the right was acquired before the property was declared to be in the public domain. Likewise, the right of ownership in such cases may only be obtained when the holder has demonstrated ten-year possession (posesión decenal), exercised for at least ten years prior to the effective date of the law declaring the object to be Natural Heritage of the State (Patrimonio Natural del Estado). As the legal chronology protecting the Natural Heritage of the State has already been set forth, the law that must be taken into account for calculating the ten-year possession period of private individuals is the Ley de Tierras y Colonización número 2825 del 14 de octubre de 1961, a statute currently in force. The Código Fiscal of 1865 and the Ley de Terrenos Baldíos of 1939 should not be considered, as they were provisions that addressed the subject only in general terms and are no longer in effect; it is not until the current Ley de Tierras y Colonización that the Natural Heritage of the State is clearly defined and regulated as such.

Subsequent laws such as Ley Forestal and others cited in this considerando are supplementary to the aforementioned Ley de Tierras y Colonización. In the present case, the testimonial evidence (prueba testimonial) gathered does not establish ten-year possession under the terms of the legal framework set forth herein; it is in this sense that this note is entered, to indicate that the petitioner (promovente) was required to demonstrate ten years of possession prior to the Ley de Tierras y Colonización, and not prior to the Decree that created the protected zone (zona protectora) or wildlife refuge (refugio silvestre), as explained above. The majority opinion (voto de mayoría) looks to subsequent legislation as the basis for lifting the prohibition on registering title to Natural Heritage of the State; this position is not shared herein, because during the years in which the party seeking title claims to have held possession, that possession occurred at a time when the legal prohibition was already in effect, and therefore does not constitute legitimate possession eligible for title registration.

A later law cannot modify such a condition of illegitimate possession. The reasons set forth in this Note are the grounds upon which it is considered appropriate to affirm the appealed judgment (sentencia recurrida).

VOTO N° 33-F-03 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSE. GOICOECHEA, A LAS QUINCE HORAS QUINCE MINUTOS DEL TREINTA DE ENERO DE DOS MIL TRES.- Información Posesoria planteada por [Nombre1] , de calidades conocidas en autos, tramitada en el Juzgado Agrario de la Zona Sur. En el proceso se tuvo como parte al Estado y al Instituto de Desarrollo Agrario, representados por el Licenciado Víctor Bulgarelli Céspedes en el carácter de Procurador Agrario y Ambiental y el Ingeniero José Joaquín Acuña Mesén, con facultades de Apoderado Generalísimo sin límite de suma. Conoce este Tribunal del Recurso de Apelación interpuesto por el representante del Estado contra la sentencia dictada a las ocho horas quince minutos del doce de marzo del dos mil dos.-

RESULTANDO.

  1. 1La titulante plantea proceso de Información Posesoria, estimado en la suma de un millón de colones, para que se inscriba en el Registro Público de la Propiedad el terreno que se describe de la siguiente forma: Terreno sin inscribir situado en [Dirección1] , , de la Provincia de Puntarenas, que tiene una medida de cincuenta y cuatro mil cuatrocientos ochenta y seis metros, veintitrés decímetros cuadrados, según plano catastrado número P-veinticuatro setenta y cinco treinta y nueve- noventa y cinco, que tiene los siguientes linderos norte con [Nombre2] , [Dirección2] , [Dirección3] con Wilberth Medina Gatica, al Oeste con [Nombre3] y [Nombre4]
  2. 2El Instituto de Desarrollo Agrario, se apersonó al proceso en los términos que corre a folio 27, sin oponerse al mismo. Por su parte el Estado, representado por la Procuraduría General de la República, se apersonó al proceso en los términos que corren de folio 60 a 61, oponiéndose al mismo.-
  3. 3La licenciada Marisel Zamora Arias jueza de primera instancia, en sentencia de las ocho horas quince minutos del doce de marzo del dos mil dos, resolvió: “POR TANTO Habiéndose cumplido con los demás requisitos y habiéndose instruido debidamente conforme a lo establecido en la ley de Informaciones Posesorias número 139 del catorce de Julio de mil novecientos cuarenta y uno y sus reformas, procede aprobar la titulación y ordenar su inscripción, deberá proceder el Registro Público de la propiedad a inscribir a nombre del gestionante por primera vez la finca sin inscribir que se describe de la siguiente forma: Terreno sin inscribir situado en Los Mogos distrito de Sierpe del cantón quinto, Osa de la Provincia de Puntarenas, que tiene una medida de cincuenta y cuatro mil cuatrocientos ochenta y seis metros, veintitrés decímetros cuadrados, según plano catastrado número P- veinticuatro setenta y cinco treinta y nueve- noventa y cinco, que tiene los siguientes linderos norte con [Nombre2] , Sur con [Dirección4] ,, Este con [Nombre5] , al Oeste con [Nombre3] y [Nombre4] en parte.En virtud de que discurse y atraviesa una quebrada la finca en cuestión, conforme al ordinal 33 inciso b) de la Ley Forestal vigente, constituye zona protectora quedará sujeta a las restricciones legales que señala el ordinal 34 de la citada Ley, haciéndose la observación de que los causes de dicha quebrada no se encuentran comprendidos dentro de dicha finca por ser de dominio publico (artículo 1 inciso IV y 3 inciso III de la Ley de Aguas. Sirva la certificación de esta resolución como documento para la inscripción ante el Registro Público del citado terreno.”
  4. 4En los procedimientos y plazos se han observado las formalidades de ley. No se notan defectos u omisiones capaces de causar indefensión alguna a las partes.

Redacta la jueza Vargas Vásquez; y,

CONSIDERANDO

I.Se prohijan los hechos tenidos por probados primero y tercero de la sentencia recurrida al estar acordes a las probanzas evacuadas en el proceso, no así los restantes al ser innecesarios dada la forma en que se resolverá en esta instancia.-

II.Se tiene por indemostrado, que la titulante y sus transmitentes hayan estado en posesión del inmueble que se presente titular por lo menos diez años de la vigencia del Decreto N° 8494-A del 28 de abril de 1978, que creó la Reserva Forestal Golfo Dulce. No hay prueba en tal sentido.-

III.El representante del Estado, en memorial remitido por medio de fax el primero de abril del dos mil dos (folio 69), cuyo original fue presentado a estrados el tres de abril del citado año (folio 73), interpuso Recurso de Apelación contra la sentencia, mostrándose inconforme por lo siguiente: Considera, de acuerdo con la nueva jurisprudencia del Tribunal Agrario, cuando se pretenda demostrar la posesión sobre un bien inmueble integrante del Patrimonio Natural del Estado debe tomarse como punto de referencia la Ley de Tierras y Colonización N° 2825 del 14 de octubre de 1961, es decir, por lo menos diez años antes de su promulgación. Como fundamento de lo anterior, el recurrente transcribe parte del Voto N° 332 de las 16:20 horas del 7 de julio del 2000. Señala, en el presente caso, ninguno de los tres testigos da fe de que el inmueble se haya poseído con anterioridad al año 1951, pues [Nombre6] afirma conocer el terreno desde hace unos treinta y cinco años, [Nombre5] desde hace treinta años y [Nombre2] desde hace unos cuarenta años; así las cosas, en criterio del recurrente, debió el Juzgado haber procedido al rechazo de estas diligencias por no haberse cumplido con el requisito indispensable de probar la posesión decenal por lo menos diez años antes de la Ley de Tierras y Colonización, por ello, al encontrarse el inmueble dentro de un área protegida continúe perteneciendo al Patrimonio Natural del Estado.

Transcribe también parte de la resolución dictada por el Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, Número 7 de las 15:00 horas del 5 de marzo del 2001, dentro del expediente de Información Posesoria de [Nombre7] , caso en el cual dice, el inmueble se localizaba dentro de la Zona Protectora del Río Banano. Además agrega, uno de los testigos, el señor [Nombre5] , tampoco pudo dar fe de la posesión decenal con anterioridad al Decreto creador de la Reserva Forestal Golfo Dulce.-

IV.No lleva razón el recurrente en cuanto al fundamento jurisprudencial que expone. En primer término, de acuerdo al artículo 9 del Código Civil, por jurisprudencia debe entenderse, la doctrina que de modo reiterado establezcan las Salas de Casación y Corte Plena al aplicar la ley, la costumbre y los principios generales del Derecho, de manera tal que, los pronunciamientos de este Tribunal no son constitutivos de jurisprudencia, menos aún las resoluciones de los Juzgados. E inclusive, si así fuera, la misma no sería vinculante al tenor de lo dispuesto por la Sala Constitucional en Voto Número 2049 de las 14:48 horas del 27 de febrero del 2002, al señalar: “… Solo (sic) la jurisprudencia y precendentes de la Sala Constitucional son vinculantes erga omnes. El último requisito que debe cumplirse para admitir una consulta judicial es entonces, que la duda surja en relación con una norma que el juez deba aplicar y no puede dejarse de lado el elemento coactivo que dicha palabra encierra.

Sin embargo, en el caso de la jurisprudencia ese elemento no existe, pues según ya ha señalado este Tribunal, el juez no está obligado a aplicarla en virtud del principio de independencia …”; lo anterior se cita puesto que la Sala Primera de la Corte en los Votos Números 51 de las 15:15 horas del veintiséis de mayo de 1995 y 59-99 de las 14:00 horas del cinco de febrero de 1999, mantienen una posesión similar a la expuesta por el recurrente, pero aunque es respetada, no es compartida por este Tribunal. Lo anterior, al considerar, la normativa del Código Fiscal y la Ley de Terrenos Baldíos se encuentra derogada, no siendo de aplicación en la actualidad; y en cuanto a la Ley de Tierras y Colonización, se comparte lo expuesto por los representantes de la recurrente, en el sentido de que no es posible interpretar de su normativa, todos los terrenos con bosque están afectos al Patrimonio Natural del Estado, por ende, son inalienables e imprescriptibles, pues si así fuera, carecería de relevancia la inclusión de los supuestos señalados en los incisos “a” a “i” del artículo 7, pues esta norma señala, mientras el Estado por voluntad propia o por indicación del Ministerio de Agricultura o del Instituto de Desarrollo Agrario, atendiendo razones de conveniencia nacional, no determine los terrenos que deben mantenerse bajo su dominio, se considerarán inalienables y no susceptibles de adquirirse por denuncio o posesión, salvo que estuvieren bajo el dominio privado, con título legítimo, los casos citados en los incisos mencionados, dentro de los cuales no se incluye algún supuesto dentro del cual pueda considerarse incluido el terreno que se pretende titular, el cual, como consta en autos, mediante reiteradas certificaciones aportadas al expediente, está fuera de cualquier área protegida administrada por el Ministerio de Ambiente y Energía.

De esta manera, la regulación contenida en los artículos siguientes de ese Capítulo de la Ley de Tierras y Colonización denominado “Propiedad Agrícola del Estado”, debe entenderse a la luz de dicha norma, y en cuanto a la prohibición contenida en el artículo 8 en relación con el 11, vinculado con las reservas nacionales, la Ley de nuevo hace una serie de excepciones a lo que debe entenderse por reservas nacionales, en concordancia con la Ley de Informaciones Posesorias Número 139 del 14 de julio de 1941, vigente para esa época, normativa ésta reformada con las Leyes Forestales aprobadas posteriormente, incluyendo la vigente, que reformaron el contenido del artículo 7 de la Ley de Informaciones Posesorias, permitiendo la titulación de terrenos con bosque. En lo que interesa para efectos de este proceso, dicha norma dispone: “Cuando el inmueble al que se refiera la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre …”.

De lo expuesto se desprende, en el presente caso, si el titulante logra demostrar haber estado en posesión del inmueble diez años antes de la vigencia del Decreto que creó la Reserva Forestal Golfo Dulce, N° 8494 del veintiocho de abril de mil novecientos setenta y ocho, cumpliendo además con los demás requisitos que establece la Ley de Informaciones Posesorias, podrá titular el bien, sin que pueda exigírsele una posesión diez años antes de la vigencia de la Ley de Tierras y Colonización, como pretende el recurrente. Esto último atentaría contra lo resuelto por la Sala Constitucional en Voto Número 4587 de las 15:45 horas del 5 de agosto de 1997.-

V.En relación con la prueba testimonial, se desprende de los autos, el deponente [Nombre6] dijo tener treinta años de conocer el terreno, refiriéndose al año 1969, pues rindió su declaración el cuatro de octubre del dos mil uno (folio 41); [Nombre2] dijo tener unos cuarenta años de ser colindante, refiriéndose al año 1959; y, [Nombre5] afirmó conocer el inmueble hace más de treinta años, es decir, desde antes de mil novecientos sesenta y nueve. En este caso, según se indicó, el Decreto que creó la Reserva Forestal Golfo Dulce se creó mediante el Decreto Ejecutivo N° 8494-A del veintiocho de abril de mil novecientos setenta y ocho, de ahí, la titulante para poder inscribir el inmueble a su nombre, debió demostrar una posesión anterior al veintiocho de abril de mil novecientos sesenta y ocho, situación que como bien lo apunta el representante del Estado, no se da en este caso, pues tanto el deponente [Nombre6] como [Nombre5] dijeron haber conocido el bien hasta el año mil novecientos sesenta y nueve, y aunque este último dijo que fue desde antes de este año, no se estableció cuánto tiempo antes, pudiendo tratarse de unos días o de mucho tiempo, situación incierta que no podría servir de base para aprobar una Información Posesoria, al incumplirse con lo dispuesto por el párrafo primero del artículo 7 de la Ley de Informaciones Posesorias.-

VI. Por lo expuesto, ha de revocarse la sentencia impugnada.-

POR TANTO

Se revoca la sentencia recurrida.- [Nombre8] [Nombre9] [Nombre10] NOTA DE LA JUEZA [Nombre9] El Dominio Público -para el caso que nos interesa- es el conjunto de bienes propiedad pública del Estado, lato sensu, afectados al uso público directo o indirecto, de los habitantes, y sometido a un régimen especial de derecho público y, por tanto, exorbitante del derecho privado. El dominio público se encuentra conformado por cuatro elementos: subjetivo, objetivo, normativo y teleológico. El elemento subjetivo se refiere al titular del derecho -El Estado-; el elemento objetivo se refiere o se constituye por el bien o los bienes sobre los cuales recae el dominio público -para este caso el inmueble objeto de litigio- ; el elemento normativo determina cuando un bien reúne los requisitos señalados por ley para considerarlo dominial, es el conjunto de normas que lo rigen -elenco de normas que en adelante se dirán-; y el elemento teleológico que se refiere a la finalidad que se persigue al incluir determinado bien dentro del dominio público, qué finalidad pública es asignada al bien -en este caso la protección de los recursos naturales-.

Los bienes de dominio público están sometidos a un régimen jurídico especial, se encuentran sujetos a un poder de policía, y se caracterizan esencialmente por su inalienabilidad e imprescriptibilidad. Por su naturaleza están dirigidos a satisfacer necesidades públicas, este hecho impide que sobre ellos exista tenencia o posesión por parte de particulares o personas privadas, están fuera del comercio del derecho privado. Nuestra Constitución Política en su artículo 121 inciso 14) hace referencia a la Demanialidad indicándo qué bienes son susceptibles de ese régimen de propiedad pública, incluso estableciéndose en ese artículo diferentes grados de afectación pública dándose un grado de publicatio intenso y absoluto hasta otros grados menos intenso y se armonizan los derechos de los administrados con las potestades de la Administración. Nuestro Código Civil vigente que data desde el mes de abril de mil ochocientos ochenta y seis, regula las bases más importantes en materia de bienes de dominio público, concretamente en sus artículos 261 al 263.

El artículo 262 del citado Código Civil, hace referencia a dos características importantes de los bienes de dominio público: a- las cosas públicas están fuera del comercio, y b- se establece la desafectación al decir que esos bienes no pueden entrar en el comercio privado, mientras legalmente no se disponga así. Como puede observarse la afectación al régimen de dominio público no depende de la naturaleza del bien, sino de la voluntad del legislador. Mediante voto número 447-91 de las quince horas treinta minutos del 21 de febrero de 1991 la Sala Constitucional manifiesta que la declaración de dominio público del bien se establece por ley, esta declaración no constituye una limitación a la propiedad, de acuerdo con el artículo 45 de la Carta Magna, pues éste artículo se refiere a propiedad privada, y los bienes de dominio público no están sujetos a propiedad privada. El Patrimonio Forestal del Estado, es un bien Demanial regulado en un amplio conjunto normativo en el que históricamente hasta la actualidad se prohíbe a los particulares realizar cualquier tipo de labor dentro de los inmuebles con esa característica y como consecuencia negándoles el derecho de posesión, haciéndose una salvedad en una situación específica que más adelante se dirá.

Se considera como Patrimonio Estatal, -en su condición de Demanio Público que implica los principios de imprescriptibilidad, inalienabilidad, e inembargabilidad-, los terrenos que constituyen Reservas Nacionales que tengan Bosques. Lo anterior encuentra su desarrollo normativo en las citas que a continuación se exponen: 1) El Código Fiscal de 1865 el cual contempla un capítulo referido a los bosques, el cual fue derogado por la Ley General de Terrenos Baldíos Número trece del 6 de enero de 1939 la cual incorporaba prácticamente las mismas disposiciones. Por ejemplo el artículo primero indicaba: "Que los terrenos comprendidos en los límites de la República, que no hayan sido adquiridos o inscritos en propiedad mediante título legítimo por particulares, se presumen baldíos y pertenecen al Estado."- Esta ley en general regula la prohibición para poseer e inscribir mediante el trámite de informaciones posesorias las Reservas Nacionales que sean Patrimonio Forestal, en otras palabras no son susceptibles de apropiación por parte de particulares.- La Ley de Tierras y Colonización Número 2825 del 14 de octubre de 1961 mantuvo la misma orientación y se encuentra vigente en la actualidad desde aquella fecha.

Así el artículo 8 de esa Ley de Tierras y Colonización establece: "Exceptuado los casos previstos en esta ley es prohibido a los particulares encerrar con cercas, carriles, o cualquier otra forma los terrenos declarados Reservas Nacionales, derribar montes, establecer construcciones y cultivos o extraer de ellos leña, madera, bejuco, palma, y otros productos con fines de explotación. Todo acto de ese genero, si de previo no se han llenado los trámites legales y obtenido la autorización correspondiente será considerado, según el caso como usurpación de dominio público o merodeo, debiendo las autoridades ordenar la destrucción y remoción de las cercas e impedir el uso de esas tierras, sin lugar a inmdenización ni a reclamos por el valor de las mejoras y sin perjuicio de otras responsabilidades que pudieran caber a quienes incurrieren en tales faltas".- Nótese que este artículo sanciona penalmente a aquel que se introdujere a una reserva Nacional para realizar cualquier actividad en esas tierras, por lo que no se le pueda considerar a ésta acto de posesión pues su actividad sería ilegítima.- El artículo 11 de esa misma Ley, establece que pertenecen al Estado en caracter de Reservas Nacionales: "a) Todos los terrenos comprendidos entre los límites de la República que no estén inscritos como propiedad particular, de las Municipalidades o de las Instituciones Autonómas. b-) Los que no esten amparados por la posesión decenal.- c-) Los que por leyes especiales, no hayan sido destinados a la formación de colonias agrícolas.- d-) En general todo los que, no siendo de propiedad particular, no estén ocupados en servicios públicos."- Por su parte el artículo 19 de la Ley Forestal derogada número 4465 del veintitrés de noviembre de mil novecientos sesenta y nueve dispuso: "Quedan afectados a los fines de la presente ley todos los bosques y terrenos forestales ubicados en: "a-) Las tierras consideradas Reservas Nacionales..." Y el artículo 25 de esta misma ley señalaba: "La posesión de los terrenos situados en las Reservas Nacionales y fincas del Estado a que se refiere el artículo 19 de esta Ley, no causará derechos de ninguna especie y la acción reinvidicatoria del Estado, por los mismos, es imprescriptible, y la Dirección General Forestal con los medios legales a su disposición, procederá a desalojar de tales terrenos a las personas que los ocupan total o parcialmente, en el caso de que se trate de zonas protectoras, Parques Nacionales, Reservas Forestales, y Reservas Biológicas".- Con estas normas se otorga a los bosques allí mencionados una doble tutela: Primero por su condición de Reserva Nacional, en las que es prohibido realizar cualquier acto posesorio y segundo por constituir Patrimonio Forestal del Estado en el que ningún acto de posesión causará derecho de ninguna especie.

Este aspecto se ve confirmado con el artículo 8 del reglamento a esa ley que dice: "Los terrenos Nacionales comprendidos dentro de las áreas declaradas Reservas Forestales son inalineables, es decir, no podrán salir del dominio del Estado, y su posesión no causará derecho de ninguna especie de conformidad con lo dispuesto por los artículos 25, 49 y 57 de la Ley Forestal".- El artículo 80 de la citada Ley Forestal derogada indicaba: "Queda prohibido la invasión y ocupación de terrenos en los Parques Nacionales, Reservas Forestales y Zonas Protectoras. Esta prohibición se extiende hasta las Reservas Nacionales, hasta tanto no se haya determinado su clasificación y transferencia..." El artículo 6 de esta misma ley disponía: " Será sancionado con prisión de seis meses a dos años o con multa de quince a cien días, la persona que: a-) Explote un bosque de patrimonio forestal sin autorización legal correspondiente... b-) Invada un Parque Nacional, Reserva Biológica, Zona Protectora o Reserva Forestal...Si la invasión es en Reservas Nacionales, estará sujeta a lo estipulado en el artículo 227 del Código Penal.-" Como puede observarse los actos posesorios realizados en un bosque patrimonio Estatal resultan ser ilegítimos por lo que no pueden conferir ningún derecho de posesión.- Con la entrada en vigencia de la Ley Forestal Número 7174 del 28 de junio de 1990, se continúa con esta misma filosofía.

En el artículo 32 de la citada ley establece: "El patrimonio forestal del Estado esta constituído por todos los bosques y terrenos forestales de las Reservas Nacionales...". El artículo 33 de esa misma ley dispone: "Los terrenos forestales y bosques que constituyen el Patrimonio Forestal del Estado detallados en el artículo anterior, serán inembargables e inalineables, su posesión por los particulares no causará derecho alguno a su favor y la acción reinvidicatoria del Estado por esos terrenos es imprescriptible.- En consecuencia, no son susceptibles de inscripción en el Registro Público mediante Información Posesoria, su invasión y ocupación será sancionados conforme lo dispuesto en esta Ley".- Con la actual Ley Forestal vigente número 7575 del 5 de febrero de 1996, en su título II regula un capítulo único referido exclusivamente al Patrimonio Natural del Estado, siendo la misma filosofía que se había iniciado desde 1865 con el Código Fiscal, por lo que se reitera en esta nueva normativa que el Patrimonio Natural del Estado estará constituído por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, y las fincas inscritas a nombre de la Administración Pública.

El artículo 14 de la misma ley forestal vigente es enfática en indicar que los terrenos forestales y bosques que constituyen el patrimonio natural del Estado son imprescriptibles, inembargables e inalienables y su posesión por los particulares no causará derecho alguno a su favor. La Ley de Conservación de la Vida Silvestre Número 7317 del 21 de octubre de 1972, en sus artículos 3 y 4, además de la declaratoria como de dominio público e interés público, a la fauna y flora silvestre respectivamente, se indica que la flora y fauna silvestre es parte del Patrimonio Nacional. En este mismo sentido la Ley de Biodiversidad número 7788 del 30 de abril de 1998 en su artículo 6 declara los elementos de la biodiversidad como de dominio público, así como la Ley Orgánica del Ambiente en su artículo 46 que establece la soberanía del Estado sobre la diversidad biológica. Por lo expuesto resulta un imperativo legal negar el derecho de posesión a aquellas personas que realizaran cualquier actividad en terrenos no sometidos a propiedad privada y que estén constituídos por bosques en reservas Nacionales.- A esa prohibición imperativa mediante la Ley Forestal Número 7575 del año 1996, que reforma el artículo 7 de la Ley de Informaciones Posesorias, establece una salvedad a la filosofía que hasta ahora se ha expuesto, y es que se posibilita la titulación de bosques cuando dentro de los mismos se haya desarrollado lo que se entiende como posesión ecológica.

El terreno objeto de esta información posesoria, es Patrimonio Natural del Estado, pues está compuesto por bosque primario casi en su totalidad, siendo un ochenta por ciento de su ubicación parte del Humedal Nacional Térraba Sierpe creado y un veinte por ciento ubicado dentro de la Reserva Forestal Golfo Dulce, lo que es claro dicho territorio es Patrimonio Natural del Estado, desde antes de que se crearan esos Decretos como ya se expuso en el historial normativo supra. Cuando se discute la posesión sobre un bien demanial, sólo cabrá esa discusión cuando se haya adquirido el derecho antes de que se haya declarado el bien como de dominio público. Así mismo, el derecho de propiedad en tales casos sólo podrá obtenerse cuando el titular haya demostrado una posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley que declara el objeto como Patrimonio Natural del Estado.

Como ya se ha expuesto la cronología legal que tutela el Patrimonio Natural del Estado, la ley que debe tomarse en consideración para realizar el cómputo de la posesión decenal de los particulares, es la Ley de Tierras y Colonización número 2825 del 14 de octubre de 1961, normativa actualmente vigente. No debe considerarse el Código Fiscal de 1865 y la Ley de Terrenos Baldíos de 1939, pues fueron normas que hacían referencia al tópico en forma genérica, además que no son disposiciones vigentes en la actualidad, no es sino hasta con la actual Ley de Tierras y Colonización que se viene a definir y regular en forma clara la Propiedad o Patrimonio Natural del Estado. Las leyes posteriores como Ley Forestal y otras que se han citado en este considerando, son complementarias a la referida Ley de Tierras y Colonización. Para el caso concreto, de la prueba testimonial recabada no se demuestra esa posesión decenal en los términos de la normativa aquí expuesta, pues en este sentido es que se consigna esta nota, para indicar el promovente debió demostrar diez años de posesión antes de la Ley de Tierras y Colonización, y no del Decreto que creó la zona protectora o refugio silvestre, según se explicó.

El voto de mayoría considera normativa posterior considerada para levantar la prohibición de titular patrimonio natural del Estado, ello no es compartido, pues para los años en que indican la parte titulante ha poseído, ha sido en época en que existe la prohibición legal, por lo que no es una posesión legítima para ser considerada apta para titular, por ley posterior no es posible modificar tal condición de posesión ilegítima. Las razones expuestas en esta Nota son los fundamentos por los cuales se considera confirmar la sentencia recurrida.
