Case File Res: [Telf1] Case File: 99-000038-0559-PE CRIMINAL COURT OF APPEALS (TRIBUNAL DE CASACION PENAL). SECOND JUDICIAL CIRCUIT OF SAN JOSE, GOICOECHEA. At twelve hours and fifty minutes on the eleventh of October, two thousand and two.

CASSATION APPEAL filed in the present case brought against [Nombre1], of legal age, in a common-law union, with national identity card (cédula de identidad) number CED1, native of Cóbano de Puntarenas, born on the twenty-seventh of July, nineteen seventy-five, for the offense of ILLEGAL TIMBER PROCESSING, to the detriment of NATURAL RESOURCES. The judges Fernando Cruz Castro, [Nombre2], and Ronald Salazar Murillo participate in the decision on the appeal. Licenciada [Nombre3], in her capacity as public defender (defensora pública), appeared before the Court of Appeals.

RECITALS:

1) That by judgment number 97-2001, issued at seventeen hours thirty minutes on the twelfth of June, two thousand and one, the Criminal Trial Court of San Carlos ruled: "POR TANTO. In accordance with the foregoing, the evidence received, and articles 39 of the Constitución Política; 1, 8, 226, 265 TO 269, 361, 362, 363, 364, 365, of the Code of Criminal Procedure (Código Procesal Penal), 1, 28, 29, 30, 31, 42, 43, 45, 51, 59, 60, 61, 62, 63, 71 TO 74, of the Penal Code (Código Penal), and article 61, subsection b, of the Ley Forestal number 7575, the accused [Nombre1] is found to be the responsible perpetrator of the offense of VIOLATION OF THE Ley Forestal IN THE FORM OF ILLEGAL TIMBER PROCESSING to the detriment of NATURAL RESOURCES, and as such he is sentenced to ONE MONTH OF IMPRISONMENT, to be served in the corresponding correctional facility, with credit for any pretrial detention (preventiva) served. In view of the fact that the convicted [Nombre4] meets the legal requirements, the benefit of a suspended sentence (ejecución condicional) is granted for a probationary period of three years, with the understanding that if during that period he commits a new willful offense punishable by imprisonment exceeding six months, said benefit shall be revoked. He is likewise condemned to pay both costs of these proceedings. The forfeiture (comiso) of the seized property is ordered. Once this judgment becomes final, it shall be recorded in the Judicial Criminal Registry (Registro Judicial de Delincuentes) and the corresponding certified copies of the judgment (testimonios de sentencia) shall be sent. LICDA. [Nombre5], JUDGE" (sic).
  • 2)That against the foregoing ruling, Licenciada [Nombre3] filed a Cassation Appeal.
  • 3)That after the corresponding deliberation, in accordance with the provisions of article 450 of the Code of Criminal Procedure, the Court considered the issues raised in the Appeal.
  • 4)That the relevant legal requirements have been observed throughout the proceedings.

The opinion is drafted by Cassation Judge [Nombre6], and;

CONSIDERING:

The judge of the Criminal Trial Court of the Second Judicial Circuit of Alajuela, Ciudad Quesada, Licda. Deyanira Martínez Bolivar, found the accused [Nombre7] to be the responsible perpetrator of the offense of Violation of the Ley Forestal to the detriment of natural resources, sentencing him to one month of imprisonment. Against this decision, Licenciada [Nombre3], public defender of the accused, filed a Cassation Appeal. The Court analyzed the arguments of the appellant (impugnante), resolving the claims raised in accordance with the grounds set forth below:

Cassation Appeal on Procedural Grounds (Recurso de Casación por la Forma):

I.The appellant alleges violation of articles 1, 6, 9, 142, 178 subsection a), 184, 363 subsections b) and c), 369 subsections b) and d), all of the Code of Criminal Procedure, articles 33, 37, and 39 of the Constitución Política, and 8.2 of the American Convention on Human Rights. It is argued that not every act of timber harvesting (aprovechamiento), cutting, processing, etc., constitutes a forestry offense. The law is clear: the forest product must be located within a forest (bosque), and this fact has not been proven in the present case. What was established is that it involved a property (finca), but it is not known whether the trees were personally planted by the owner, or whether they were in a forest plantation (plantación forestal), a pasture (potrero), or an agroforestry (agroforestal) property. The accused was processing a fallen tree; it was not established that he had cut it down.

Rather, it was determined that he was not going to derive any profit, benefit, advantage, utility, or gain from it, as indicated in subsection a) of article 3, nor that he was processing the tree without meeting the legal requirements, since processing does not require a permit — only in the case of forest plantations, article 31 of the Ley Forestal. Nor was it an industrial activity regulated under article 3, subsection j). The appellant points to the statement made by the court of first instance (a quo) that "this judge has no doubt whatsoever that the accused [Nombre8] did not have any permit authorizing him to proceed to saw the timber that was seized at the scene of the events, and that he was aware of this fact. It is notable that at no point was it established that he asked [Nombre9] for the corresponding permit — who, according to his own account, did not have one — nor did the accused ask for it, since he claimed not to know that a permit was required.

It is also important to note that the defense witness clearly stated that the accused engaged in this activity, which leads this judge to have no doubt that the accused did know of the need for a permit to carry out this work, regardless of whether he was doing a favor for [Nombre9], since what the criminal provision punishes is the processing of forest products without meeting the required conditions, an activity in which the accused was caught red-handed." From the foregoing, according to the appellant, it follows that at no point was the benefit of the doubt granted to the accused. The burden of proof lies with the Office of the Public Prosecutor (Ministerio Público); the prosecution was required to prove that the accused knew or agreed with Mr. [Nombre10] that they were acting unlawfully — a circumstance that was not established. The accused's statement indicates that "The day I went there to saw the timber was because Mr.

Perfecto [Nombre9] told me to saw the logs and that he had the permit….. I was sawing, I was just starting — it was pure laurel, all laurel, it was for the owner, for use in his house…… I was doing him a favor because he had no money. The saw was not mine…. I work at a sawmill (aserradero). The property belonged to Don Perfecto; from my house to his is about four or five kilometers, maybe less. Don Perfecto's house was about 100 meters from the timber; the tree was already fallen." No other testimony indicates that the accused knew that Don Perfecto [Nombre10] did not have a permit; on the contrary, the latter consistently stated that the timber was not his and that he did not know where the permit was. His conduct was without malice, and moreover, the person responsible for obtaining the permit was Mr. [Nombre10], the owner of the timber and the property. The accused must be acquitted of all punishment and liability in accordance with the principle of in dubio pro reo.

For the reasons and in the manner set forth below, the error alleged must be upheld. The grounds of the judgment contain essential errors that render it illegitimate. One of the elements in which an essential error of reasoning (motivación) is alleged is that the trial judge fails to specify what legal requirements the accused was obliged to meet. Determining this point is very important and has a decisive bearing on the legal grounds of the judgment. It is not clearly established whether the act described in the statement of proven facts (relación de hechos probados) actually constitutes the processing of forest products, as defined under the Ley Forestal.

Nor does the trial judge explain why the failure to meet the legal requirements for processing the timber is a culpable omission attributable to the accused, without taking into account the explanation provided by the accused — who states that the owner of the property asked him to saw the timber logs (trozas de madera) and even told him that he had the corresponding permit. The trial judge does not examine why the accused's conduct is culpable, given that he received the assignment from the owner of the property, who assured him that he had the corresponding permit. The judgment establishes as an indisputable fact that the authorizations — without specifying which ones — did not exist; however, the trial judge does not analyze why the explanation given by the accused appears to be irrelevant. The fact that the accused engaged in activities related to the processing of forest products is not a sufficient argument to conclude that he should have obtained the permit, because the objective and subjective context he describes in his defendant's statement (indagatoria) provides a specific justification that the a quo should have examined.

The parameters provided by rules of experience are applicable in this situation, answering the following question: Is a person who receives an assignment from the owner of a landholding (fundo) to process some timber logs, having been told that the owner has the corresponding permit, to be held culpable for the omission of not having the corresponding permits? This question is not resolved in the judgment under appeal. It is not sufficient to assume that a person has extensive experience in a given activity; it is also necessary to establish whether the specific circumstances described in the defendant's statement justify, notwithstanding that experience, his passivity. The accused's responsibility cannot be inferred solely from the non-existence of the permit; rather, the objective and subjective circumstances in which the act was carried out must be evaluated, as described by the accused in his defendant's statement. This is a point at which this Chamber identifies an essential error in the reasoning of the challenged decision.

Another important element that the trial judge should have examined, and which bears on the legal grounds, is the concept of "forest product" (producto forestal). It should have been determined whether the processed timber was a forest product, by analyzing whether it came from a forest (art. 3, subsection d of the Ley Forestal), a forest plantation, or timber originating from a property under the terms and conditions established in article 27 of the Ley Forestal — which, as established in vote 682-F-97 of this Chamber, cannot serve as a basis for the criminal offenses (tipos penales) contained in the Ley Forestal. (art. 57 et seq.).

All of the foregoing errors of reasoning are essential, and for this reason the first ground of Cassation is upheld, annulling the judgment under appeal, as well as the trial proceedings (debate) that preceded it, and remanding the case to the court of origin (Despacho de origen) for new proceedings (nueva sustanciación).

In light of what has been resolved, it is unnecessary to rule on the second claim raised by the defense attorney.

POR TANTO:

The Cassation Appeal filed by the defense representative, [Nombre3], is declared well-founded, and the judgment under appeal, as well as the trial proceedings that preceded it, are annulled. The case is remanded to the court of origin for new proceedings.

TRIBUNAL DE CASACION PENAL. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSE, GOICOECHEA. A las doce horas cincuenta minutos del once de octubre de dos mil dos.- RECURSO DE CASACION interpuesto en la presente causa seguida contra [Nombre1], mayor, en unión libre, con cédula de identidad número CED1, nativo de Cóbano de Puntarenas, el veintisiete de julio de mil novecientos setenta y cinco, por el delito de PROCESAMIENTO ILEGAL DE MADERA, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los jueces Fernando Cruz Castro, [Nombre2] y Ronald Salazar Murillo. Se apersonó en Casación la Licenciada [Nombre3] en su calidad de defensora pública.

RESULTANDO:

  • 1)Que mediante sentencia número 97-2001, dictada a las diecisiete horas treinta minutos del doce de junio de dos mil uno, el Tribunal de Juicio de San Carlos resolvió: "POR TANTO. De conformidad con lo expuesto, pruebas recibidas y artículos 39 de la Constitución Política; 1, 8, 226, 265 A 269, 361, 362, 363, 364, 365, del Código Procesal Penal, 1, 28, 29, 30, 31, 42, 43, 45, 51, 59, 60, 61, 62, 63, 71 A 74, del Código Penal y el artículo 61 inciso b de la Ley Forestal número 7575, se declara al imputado [Nombre1] autor responsable de haber cometido el delito de INFRACCION A LA LEY FORESTAL EN SU MODALIDAD DE PROCESAMIENTO ILEGAL DE MADERA en perjuicio de LOS RECURSOS NATURALES y en tal carácter se le impone una pena de un UN MES DE PRISION, que deberá descontar en el establecimiento carcelario respectivo, previo abono de la preventiva que hubiere sufrido. En virtud de que el sentenciado [Nombre4] reúne los requisitos de ley, se le concede el beneficio de ejecución condicional por un período de prueba de tres años, en el entendido de que si durante dicho lapso cometiere un nuevo delito doloso sancionado con pena de prisión superior a los seis meses, dicho beneficio le será revocado.

Se le condena igualmente al pago de ambas costas de este proceso. Se ordena el comiso de los bienes decomisados. Una vez firme este fallo, se inscribirá en el Registro Judicial de Delincuentes y se remitirán los testimonios de sentencia correspondientes. LICDA. [Nombre5], JUEZA" (sic).- 2) Que contra el anterior pronunciamiento la Licenciada [Nombre3] interpuso Recurso de Casación.

  • 3)Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 450 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el Recurso.
  • 4)Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el Juez de Casación [Nombre6], y;

CONSIDERANDO:

La Jueza de Tribunal de Juicio del Segundo Circuito Judicial de Alajuela, Ciudad Quesada, Licda. Deyanira Martínez Bolivar, declaró al imputado [Nombre7] como autor responsable del delito de Infracción a la Ley Forestal en perjuicio de los recursos naturales, imponiéndole una pena de un mes de prisión. Contra esta decisión, la Licenciada [Nombre3], defensora pública del encartado, interpuso recurso de Casación. El Tribunal analizó los argumentos del impugnante, resolviendo sus pretensiones, conforme a los motivos que se expondrán:

Recurso de Casación por la Forma:

I.Acusa la impugnante la violación de los artículos 1, 6 9, 142, 178 inciso a), 184, 363 incisos b) y c), 369 incisos b) y d) , todos del Código Procesal Penal, artículos 33, 37 y 39 de la Constitución Política y 8.2 de la Convención Americana de Derechos Humanos. Se alega que no todo aprovechamiento, corta, procesamiento, etc, es delito forestal. La Ley es clara, es necesario que el producto forestal esté ubicado en un bosque y este hecho no está probado en la presente causa. Sí quedó claro que se trataba de una finca, no se sabe si los árboles fueron sembrados personalmente por el dueño, o si estaban en presencia de una plantación forestal, un potrero o de una finca de uso agroforestal. El imputado se encontraba procesando un árbol caído, no se comprobó que lo hubiera cortado, más bien se estableció que no iba a tener ningún provecho, beneficio, ventaja, utilidad o ganancia, según lo indica el inciso a) del artículo 3, ni que estuviera procesando el árbol sin cumplir los requisitos de ley, ya que para procesar no se requiere permiso, solamente en el caso de las plantaciones forestales, artículo 31 de la Ley Forestal.

Tampoco se trataba de una actividad industrial regulada en el artículo 3. Inciso j). La recurrente señala lo expresado por el a quo en el sentido de que “no lo cabe ninguna duda a esta juzgadora que el encartado [Nombre8], no lo amparaba permiso alguno para proceder aserrar la madera que fuera decomisada en el lugar de los hechos, lo cual era de su conocimiento, nótese que en ningún momento quedó demostrado que él le pidió el permiso respectivo a [Nombre9], quien según su propia versión el no tenía, tampoco el encartado se lo pidió pues ignoraba que se requería permiso, asimismo es importante hacer notar que el testigo de la defensa fue claro en señalar que el encartado se dedicaba a esa actividad, por lo que a esta juzgadora no le cabe la duda que el encartado si conocía de la necesidad de un permiso para llevar a cabo esta labor, siendo independiente de que le estuviera haciendo un favor a [Nombre9], pues el tipo penal lo que reprocha es procesar productos forestales sin reunir los requisitos exigidos, actividad en la que fue sorprendido en flagrancia el encartado”.

De lo anterior, según la impugnante, se deduce que en ningún momento la duda benefició al imputado. El Ministerio Público tiene la carga de la prueba, esa representación debía probar que el imputado sabía o estaba de acuerdo con el señor [Nombre10] que estaban actuando ilícitamente, situación que no quedó demostrada. La declaración del encartado refiere que “El día que me fui ahí, a aserrar la madera, fue porque el señor Perfecto [Nombre9] me dijo que le aserrara los palos y que él tenía el permiso…..Yo estaba aserrando, estaba empezando, era laurel puro laurel era para el Señor, para uso de su casa……yo le estaba haciendo un favor porque él no tenía plata. La sierra no era mía….trabajo en aserradero. La finca era de don Perfecto, mi casa a la de él está como a cuatro o cinco kilómetros, tal vez menos, la casa de don perfecto estaba como a 100 metros de la madera, el árbol ya estaba caído”.

Ningún otro testimonio indica que el imputado sabía que don Perfecto [Nombre10] no tenía permiso, todo lo contrario, éste siempre indicó que la madera no era de él y no sabía donde estaba el permiso. Su actuación fue sin malicia, además de que el responsable de sacar el permiso lo era el señor [Nombre10], dueño de la madera y de la propiedad. El imputado debe ser absuelto de toda pena y responsabilidad en apego al principio del in dubio pro reo. Por las razones y en la forma que se dirán, el yerro planteado debe acogerse. La fundamentación de la sentencia contiene yerros esenciales que la tornan ilegítima. Uno de los elementos en los que se acusa un yerro esencial de motivación es que la juzgadora no determina cuáles son los requisitos de ley que debió cumplir el encausado. La determinación de este extremo, es muy importante y tiene una incidencia determinante en la fundamentación jurídica.

No se determina claramente, si la acción descrita en la relación de hechos probados constituye realmente el procesamiento de productos forestales, conforme a las definiciones que contiene la Ley Forestal.

Tampoco expresa la juzgadora por qué razón el incumplimiento de los requisitos legales para procesar la madera, es una omisión reprochable atribuible al imputado, sin tomar en cuenta la explicación brindada por el encausado; éste afirma que el dueño del inmueble le solicitó que aserrara las trozas de madera y que incluso le mencionó que tenía el permiso correspondiente. La juzgadora no examina por qué razón es reprochable la conducta del acusado, si éste recibió el encargo del dueño del inmueble y le aseveró que tenía el permiso correspondiente. En el fallo se establece como hecho indubitable que las autorizaciones, sin determinar cuáles, no existían, sin embargo, la juzgadora no analiza por qué razón le parece intrascendente la explicación que brinda el acusado. El hecho que el encausado se dedique a actividades relacionadas con al procesamiento de productos forestales, no es un argumento suficiente para concluir que debió contar con el permiso, porque el contexto objetivo y subjetivo que narra en su indagatoria, brindan una justificación específica que debió examinar el a-quo.

Los parámetros que brindan las reglas de experiencia son aplicables en esta situación, contestando el siguiente interrogante: Una persona que recibe el encargo del propietario del fundo, para que procese algunas trozas de madera, informándosele que tiene el permiso correspondiente, ¿ le será reprochable la omisión de no contar con los permisos correspondientes ? Este interrogante no se resuelve en el fallo recurrido. No basta asumir que una persona tiene mucha experiencia en una determinada actividad, es necesario establecer, además, si las circunstancias específicas que describe en su indagatoria, justifican, no obstante su veteranía, su pasividad. La responsabilidad del encausado no se infiere, exclusivamente, de la inexistencia del permiso, sino que deben evaluarse las circunstancias, objetivas y subjetivas, en las que se ejecuta el hecho, conforme lo describe en su indagatoria el encausado. Este es un punto en que esta Cámara nota un yerro esencial en la motivación de la decisión que se impugna.

Otro elemento importante que debió examinar la juzgadora y que incide en la fundamentación jurídica, es el concepto: producto forestal. Debió determinarse si la madera procesada era un producto forestal, analizando si se trataba de un bosque (art.3, inciso d- de la Ley Forestal), de una plantación forestal o de una madera que proviene de un fundo en los términos y condiciones que establece el artículo 27 de la Ley Forestal, que conforme se estableció en el voto 682-F-97 de esta Cámara, tal disposición no puede darle sustento a los tipos penales que contiene la Ley Forestal. (art. 57 y siguientes).

Todos los yerros de fundamentación referidos, son esenciales y por este motivo se acoge el primer motivo de Casación, anulando el fallo recurrido, así como el debate que le antecedió, remitiendo la causa al Despacho de origen para una nueva sustanciación.

En virtud de lo resuelto, resulta innecesario pronunciarse sobre el segundo reclamo planteado por la abogada defensora.

POR TANTO:

Se declara con lugar el recurso de Casación planteado por la representante de la Defensa, [Nombre3], anulándose el fallo recurrido, así como el debate que le antecedió. Se remite la causa al Despacho de origen para una nueva sustanciación.
