Criminal case 13-200145-0634-PE in which [...], a Limited Liability Company (Sociedad de Responsabilidad Limitada), corporate ID number (cédula jurídica) [Valor 003], represented by [Nombre 004], national ID (cédula) [Valor 002], located at [...], appears as an interested third party; for the offense of INVASION OF A CONSERVATION OR PROTECTED AREA to the detriment of NATURAL RESOURCES. The Court is composed of Judges Susana Wittmann Stengel, Maureen Sancho González, and Xiomara Gutiérrez Cruz. M.S.c. FINDINGS:

I.That pursuant to judgment number 10-2025 of fourteen hours two minutes on the thirteenth of January of the year two thousand twenty-five, the TRIBUNAL DE JUICIO DEL PRIMER CIRCUITO JUDICIAL DE LA ZONA SUR, SEDE PÉREZ ZELEDÓN ruled: "Por tanto: In accordance with section 103 of the Penal Code (Código Penal), Articles 98, 99, 100, and 101 of the Environmental Framework Law (Ley Orgánica del Ambiente) 7554, Article 5 of the Ley Forestal 7575, Articles 11, 45, and 50 of the Political Constitution (Constitución Política), Articles 52 and 55 of the Law on Soil Use, Management, and Conservation (Ley de Uso, Manejo y Conservación de los Suelos) N.º 7779, Article 8 of the Biodiversity Law (Ley de Biodiversidad), Articles 6, 184, 142, 175 through 179, and 341 through 365, it is resolved: RESTORATION OF THINGS TO THEIR ORIGINAL STATE (RESTITUCIÓN DE LAS COSAS A SU ESTADO ORIGINAL) IS HEREBY ORDERED on property number [Valor 005], located in the locality of [...], owned by [...], Sociedad de Responsabilidad Limitada, cédula jurídica [Valor 003], represented by [Nombre 004], cédula [Valor 002].

Restoration to the prior state is ordered under the following terms: Removal of culverts (alcantarillas) and the water intake system (sistema de captación de agua) located in the stream (quebrada); with respect to the two bodies of water (the stream and the spring (naciente)), the protection zones (áreas de protección) must be delimited with fences as established by law, and any structures and trails or paths (trochas o caminos) encroaching upon the protection zone must be removed from those areas; likewise, livestock must be removed from the protection zones; the brachiaria grass (zacate brizanta) must be eliminated through plowing (arado), to be carried out mechanically, and the area from which the improved grass has been removed must be left to regenerate naturally. In connection with Resolution R-2800-2024-AGUAS-MINAE, which ordered the installation of a valve at the spring to ensure flow diversion, verification of its installation is hereby ordered.

The company [...], SRL, is granted a period of three months after notification of this judgment to comply with what has been ordered by this Court herein, which shall be carried out under the supervision of the Ministerio de Ambiente y Energía, SINAC, Área de Conservación La Amistad Pacífico Subregión de Buenos Aires, which entities are hereby ordered to be notified of this resolution. Likewise, the Ministerio de Ambiente y Energía, SINAC, is ordered to conduct an inspection and submit a report to verify compliance with what has been ordered in this judgment. Notice shall be given by reading. NOTICE SHALL BE GIVEN BY READING. SONIA HUEZO HERRERA. Trial Judge." (sic)

II.That against the aforementioned ruling (fallo), M.S.c. José Lino Chaves López and the legal representative of the company [...], [Nombre 004], filed appeals (recursos de apelación).

III.By resolution issued at 19:09 hours on February 17, 2025, the Court of the I Circuito Judicial de la Zona Sur (criminal division) gave notice to the parties regarding the appeals filed.

IV.Having conducted the statutory deliberation (deliberación de ley) as provided in section 465 of the Code of Criminal Procedure (Código Procesal Penal), this chamber considered the issues raised in the appeal.

V. The formalities and requirements of law have been observed throughout the proceedings

Opinion authored by Appeals Judge Wittmann Stengel;

CONSIDERING:

I.Admissibility. With respect to the appeals filed, by admissibility ruling number 2025-269 of ten hours thirty minutes on the thirtieth of May, two thousand twenty-five, issued by this same panel, only the appeals filed by the legal representative of the company [...], Sociedad de Responsabilidad Limitada, [Nombre 004], and by M.S.c. José Lino Chaves López were admitted for substantive review.

II.Regarding the oral hearing (vista) scheduled in this case. The scheduled hearing was held before this court with the participation of José Lino Chaves, attorney, representing interested third party [Nombre 004], who also took part in said judicial proceeding, as well as Viviana Brenes Delgado, state attorney of the Procuraduría General de la República, and Julián Martínez Madriz, attorney, representing the Fiscalía Adjunta de Impugnaciones del Ministerio Público. The appellants set forth the same arguments described in their appeals and requested annulment of the challenged judgment, a request whose dismissal was sought by the representative of the Ministerio Público and by the state attorney of the Procuraduría General de la República.

III.Regarding the appeals (recursos de apelación) filed. Against judgment (sentencia) number 10-2025, issued at 14:02 hours on January 13, 2025, by the Tribunal de Juicio del Primer Circuito Judicial de la Zona Sur, Sede Pérez Zeledón, which orders the restoration of things to their original state on property (finca) number [Valor 005], owned by [...], Sociedad de Responsabilidad Limitada, two appeals were filed through identical pleadings (libelos idénticos) by MSc. José Lino Chaves López and by [Nombre 004] as representative of the company [...], Sociedad de Responsabilidad Limitada. Among their arguments, they challenged the following aspects: the improper citation and participation of [...], Sociedad de Responsabilidad Limitada in this matter; the erroneous application of the figure of interested third party (tercero interesado); the absence of compulsory joinder of defendants (litisconsorcio pasivo necesario); violation of due process (debido proceso) with respect to the handling of this case file (expediente); violation of the right to a defense (derecho de defensa) for having been unable to timely present exculpatory evidence (prueba de descargo); violation of the right to a hearing (derecho de audiencia) for the failure to accept the medical opinion (dictamen médico) of the interested third party in order to suspend a scheduled hearing in this matter; the lack of grounds for subjective or objective criminal liability (responsabilidad subjetiva u objetiva penal); improper reasoning in the judgment; failure to weigh the evidence; inequality between the parties; the inapplicability of Article 140 of the Criminal Code (Código Penal); and, furthermore, that the judgment is ultra petita — for all of which reasons the annulment of the challenged judgment is requested and, in the interest of procedural economy (economía procesal), that the petition of the Procuraduría General de la República be dismissed and this case be archived.

By majority vote (Judges Wittmann Stengel and Gutiérrez Cruz), the claim based on lack of adequate reasoning (falta de fundamentación) in the challenged judgment is granted. For the purpose of resolving the pertinent issues, it has been deemed necessary to structure this ruling as follows:

  • i)Background: a) In this case, judgment number 62-2021 was issued at sixteen hours and ten minutes on February fifth, two thousand twenty-one. That judgment resolved as follows: "In accordance with the foregoing, the cited provisions, Articles 39 and 41 of the Political Constitution; 1, 11, 30, 45, 367 of the Criminal Code, and numerals 1, 2, 6, 8, 9, 111 through 124, 142, 265 through 270, 341 through 366 of the Code of Criminal Procedure (Código Procesal Penal); Art. 58 paragraph A of the Ley Forestal; 73.2 of the Code of Civil Procedure (Código Procesal Civil), this Court resolves to ACQUIT [Nombre 001] of all penalty and liability with respect to the offense of Invasion of a Protection Zone (Invasión a Área de Protección), which had been attributed to him by the Ministerio Público and the Procuraduría General de la República in the capacity of Complainant, to the detriment of Natural Resources.

The lifting of every precautionary measure (medida cautelar) issued against the defendant in this case is hereby ordered. The civil damages action (Acción Civil Resarcitoria) filed by the Procuraduría General de la República against the civil defendant ([Nombre 004]) is declared WITHOUT MERIT. The civil damages action is resolved without a special award of costs (costas). The costs of the proceedings are charged to the State. In accordance with Article 140 of the Code of Criminal Procedure, restoration of things to their original state is ordered with respect to the access trail (trocha) and the culverts (alcantarillas), and the structures and constructions within the protection zone (área de protección) of property number [Valor 005], located in the locality of [...], owned by [...], Sociedad de Responsabilidad Limitada. A three-month period is granted following notification of this judgment to the Legal Representative of the Limited Liability Company [...], SRL, to proceed with the demolition of the six culverts, as well as the structures and constructions within the protection zone.

Likewise, the Ministry of Environment and Energy, SINAC, is ordered to conduct an inspection and submit a report to verify compliance with the terms ordered in this judgment. Notification by reading." In that ruling, pursuant to the provisions of numeral 363, paragraph a), of the Code of Criminal Procedure, it was stated that the facts subject to that trial (as charged) were as follows: «I.- The Ministerio Público of this city filed charges based on the following facts: "1.- On December twenty-sixth, two thousand twelve, in the afternoon hours, in the locality of [...], on a property belonging to [Nombre 004], the defendant [Nombre 001], acting as the property manager and brother of the owner, together with another unidentified individual, proceeded by common agreement and through the use of heavy machinery to invade the protection zone of a permanent spring (naciente permanente), a body of water that subsequently gives rise to a stream.

To that end, the defendant ([Nombre 004]) gave verbal instructions regarding the area to be worked to the unidentified co-defendant, who operated a yellow crawler tractor, CASE brand, and made cuts with the tractor blade and removed soil within the protection zone of the aforementioned body of water, at a distance of approximately thirty-five meters from the channel of the permanent spring, with the intent of constructing an access trail on the site and enabling the grazing and watering of cattle." Likewise, the Procuraduría filed a complaint (querella) for a public criminal offense based on the following facts: "FIRST: On December twenty-sixth, two thousand twelve, in the afternoon hours, in the locality of [...], on property number [Valor 005] owned by [...], Sociedad de Responsabilidad Limitada, legally represented by [Nombre 004], the defendant [Nombre 001], acting as the property manager and brother of the owner, together with another unidentified individual, proceeded by common agreement and through the use of heavy machinery to invade the protection zone of a permanent spring, a body of water that subsequently gives rise to a stream.

To that end, the defendant [Nombre 001] gave verbal instructions regarding the area to be worked to the unidentified co-defendant, who operated a yellow crawler tractor, CASE brand, and made cuts with the tractor blade and removed soil within the protection zone of the aforementioned body of water, at a distance of approximately thirty-five meters from the channel of the permanent spring, with the intent of constructing an access trail on the site and enabling the grazing and watering of cattle. SECOND: The defendant [Nombre 001] did not hold permits from the State forestry administration (administración forestal del Estado) to carry out construction works and cattle-grazing activities in protection zones in [...]. THIRD: It is clear that the unlawful conduct perpetrated by the defendant [Nombre 001] caused serious environmental harm, as it affected the protection zone of a permanent spring, thereby degrading that resource and its capacity for recovery — including such items as the opportunity cost of vegetation growth, loss of biodiversity, and replacement costs, among others.

This conduct undermined the natural resources existing in the area, which impacts the prevailing biological activity in the locality where the events occurred, causing not only harm to the environment but also an unsustainable deterioration of quality of life." In the same vein, a civil damages action was filed based on the following facts of interest: "FIRST: On December twenty-sixth, two thousand twelve, in the afternoon hours, in the locality of [...], on property number [Valor 005] owned by [...], Sociedad de Responsabilidad Limitada, legally represented by [Nombre 004], the defendant [Nombre 001], acting as the property manager and brother of the owner, together with another unidentified individual, proceeded by common agreement and through the use of heavy machinery to invade the protection zone of a permanent spring, a body of water that subsequently gives rise to a stream. To that end, the defendant [Nombre 001] gave verbal instructions regarding the area to be worked to the unidentified co-defendant, who operated a yellow crawler tractor, CASE brand, and made cuts with the tractor blade and removed soil within the protection zone of the aforementioned body of water, at a distance of approximately thirty-five meters from the channel of the permanent spring, with the intent of constructing an access trail on the site and enabling the grazing and watering of cattle.

SECOND: The defendant [Nombre 001] did not hold permits from the State forestry administration to carry out construction works and cattle-grazing activities in protection zones in [...]. THIRD: It is clear that the unlawful conduct perpetrated by the defendant [Nombre 001] caused serious environmental harm, as it affected the protection zone of a permanent spring, thereby degrading that resource and its capacity for recovery — including such items as the opportunity cost of vegetation growth, loss of biodiversity, and replacement costs, among others. This conduct undermined the natural resources existing in the area, which impacts the prevailing biological activity in the locality where the events occurred, causing not only harm to the environment but also an unsustainable deterioration of quality of life."» Also, in that judgment, the trial court established that no facts of relevance had been proven.

  • b)The Tribunal de Apelación de Sentencia Penal, in a different composition (Fernández Mora, Carranza Cambronero, and Fallas Redondo), upon an appeal being filed against the aforementioned judgment, partially granted it and ordered a remand (reenvío) solely for the purpose of discussing the matter concerning the restoration of things to their natural state, as determined from the operative section (parte dispositiva): "The appeal filed by the representative of the Ministerio Público is declared without merit, as are the first and second grounds of the appeal filed by the Procuraduría General de la República. Acting ex officio, the extinction of criminal proceedings by statute of limitations (prescripción) is declared and the acquittal (absolutoria) of the defendant for the facts attributed to him in this proceeding is confirmed. Judge Fernández Mora appends a note. The appeal filed by the defense of the civil defendant is declared with merit, as is the third ground of challenge filed by the representative of the Procuraduría General de la República; the partial invalidity of the judgment is ordered and a remand trial is ordered, solely for the purpose of discussing the matter concerning the restoration of things to their natural state as ordered in the judgment. Judge Fallas Redondo partially dissents." (bold text is the Court's own).
  • c)As a result of the ordered remand, a new trial was held and judgment number 10-2025 of the Tribunal de Juicio del Primer Circuito Judicial de la Zona Sur, Sede Pérez Zeledón, issued at fourteen hours and two minutes on January thirteenth, two thousand twenty-five, was rendered — the judgment now being challenged before this panel. Of relevance, the following aspects of that judgment must be highlighted: i) the first resultando stated the following: "I. That by ruling issued at fourteen hours and two minutes on April twenty-ninth, two thousand twenty-one, by the Tribunal de Apelación de Sentencia Penal de Cartago, a remand trial was ordered in this case solely for the purpose of discussing the matter concerning the restoration of things to their natural state." ii) Furthermore, in the third recital, the following were established as proven facts: "That property number 6-[Valor 005]-000 is owned by [...] Responsabilidad Limitada, legal identification number (cédula jurídica) [Valor 003], represented by [Nombre 004], national identification number (cédula) [Valor 002], said property being located in the locality of [...], where on December 26, 2012, works were carried out that caused environmental damage at the site; specifically, a crawler tractor (tractor de uruga) was used to remove earth for the purpose of constructing a forest track (trocha); culverts (alcantarillas) were placed in the stream (quebrada); and brachiaria grass (pasto brizanto) of the brizanto species, which is not native to the area, was planted — actions that resulted in the invasion of the protection areas of two bodies of water, namely a spring (naciente) and a stream" (bold text is not in the original).
  • iii)In the operative section (parte dispositiva), the following was ordered: "In accordance with section 103 of the Código Penal, Articles 98, 99, 100 and 101 of the Ley Orgánica del Ambiente 7554, Article 5 of the Ley Forestal 7575, Articles 11, 45 and 50 of the Constitución Política, Articles 52 and 55 of the Ley de Uso, Manejo y Conservación de los Suelos N.º 7779, Article 8 of the Ley de Biodiversidad, Articles 6, 184, 142, 175 through 179, and 341 through 365, it is hereby resolved: THE RESTITUTION OF THINGS TO THEIR ORIGINAL STATE IS HEREBY ORDERED on property number [Valor 005], located in the locality of [...], owned by [...], Sociedad de Responsabilidad Limitada (Limited Liability Company), legal identification number [Valor 003], represented by [Nombre 004], national identification number [Valor 002]. The restitution of things to their prior state is ordered in the following terms: Removal of the culverts and the water-collection system located in the stream; with respect to both bodies of water (the stream and the spring), the protection boundaries shall be demarcated with fences as required by law, and any structures, forest tracks, or roads invading the protection zone shall be eliminated from those areas; livestock must be removed from the protection areas; the brachiaria grass must be eliminated by plowing, which shall be carried out mechanically; the area where the improved grass is removed shall be left to naturally regenerate the soil.

In connection with Resolution R-2800-2024-AGUAS-MINAE, which ordered the installation of a valve at the spring to ensure flow diversion, verification of its installation is hereby ordered. The company [...], SRL, is granted a period of three months following notification of this judgment to comply with the orders issued by this Tribunal in the present judgment; compliance shall be carried out under the supervision of the Ministerio de Ambiente y Energía, Sistema Nacional de Áreas de Conservación, Área de Conservación La Amistad Pacífico Subregión de Buenos Aires, who are hereby ordered to be notified of this resolution. Likewise, the Ministerio de Ambiente y Energía, SINAC, is ordered to conduct the inspection and submit a report in order to verify compliance with the orders set forth in this judgment. Notification shall be made by reading. NOTIFICATION SHALL BE MADE BY READING." d) On the merits: Although the appellants (recurrentes) raised various grounds objecting to the restitution ordered in the challenged judgment number 10-2025 of the Tribunal de Juicio del Primer Circuito Judicial de la Zona Sur, Sede Pérez Zeledón, issued at fourteen hours and two minutes on January 13, 2025, this Tribunal will not address all of them, as the judges issuing the majority opinion (voto de mayoría) have found — as the appellants themselves argued — that the judgment lacks an adequate intellectual evidentiary analysis (motivación probatoria intelectiva) of the evidence introduced at trial and offered by the appellants (the interested third party (tercero interesado) and their attorney).

In this regard, it is necessary to clarify, as a preliminary matter, that the figure of the interested third party is not specifically established in the Código Procesal Penal; however, national case law from both the Sala Constitucional and the Sala Tercera has recognized it as a special form of participation in criminal proceedings, which means that persons holding a right over an asset — whether real or personal property — that is the subject of criminal proceedings in which that right may be affected, have the ability to exercise the rights that procedural law grants to other participants, ranging from the right to be heard during the proceedings and to have legal representation (patrocinio letrado) for the defense of their interests, to the right to offer evidence and submit arguments that must be considered by the adjudicators. These powers entail that the interested third party in criminal proceedings has the right to a well-reasoned judgment and to a fair trial, even though their role differs from that of the accused or the victim.

The duty to provide reasoning is inescapable in light of due process and the fundamental principles of criminal law, which require that judicial decisions be based on law and solid evidence; otherwise the judgment may be annulled if the interests of that third party are affected without proper reasoning, allowing the filing of the remedies provided by law to defend their position. In this regard, the Sala Constitucional, in various decisions, has reiterated that the lack of reasoning constitutes a violation of due process (see, for example, Voto 3917-97, which cites numerous decisions on the subject). Likewise, Article 142 of the Código Procesal Penal stipulates that: "Judgments and orders shall contain a clear and precise statement of reasons (fundamentación). Such statement shall set forth the factual and legal reasoning underlying the decisions, as well as the weight assigned to the means of evidence (medios de prueba).

A mere recitation of the evidence or mention of the parties' requests shall in no case substitute for the required reasoning. The reasoning shall be insufficient when forms, dogmatic assertions, routine phrases, mere descriptions of the facts, or bare mentions of evidentiary elements are used. There is no sufficient reasoning when the rules of sound judgment (sana crítica) have not been observed with respect to decisive evidentiary means or elements. Orders and judgments lacking a statement of reasons shall be void." Likewise, Article 361 of that same legal body provides that: "The court shall assess the evidence produced at trial in a comprehensive manner and with strict application of the rules of sound judgment. The judges shall deliberate and vote on the issues and shall, to the extent possible, follow this order: … d) Restitution and costs…" Now, upon reviewing the statement of reasons in the challenged judgment, it is apparent that the evidence presented by the interested third party and introduced into the trial proceedings (plenario) was assessed in a cursory manner, as will be seen below, since it is not sufficient merely to cite the evidence and make general assertions; rather, a detailed explanation must be provided as to why the arguments raised by the interested third party do not allow their obligation to repair the alleged environmental damage to be ruled out, or the scope of such restitution must be defined.

It must be noted that environmental restitution must not prevail over due process. While protecting the environment is essential — it being a fundamental right and a priority state objective aimed at its restoration — it cannot be overlooked that the civil third party has a subjective interest in the manner in which the matter will be resolved, and it therefore follows that their fundamental rights must be respected, such as the right to a fair trial, which is an intrinsic component of due process. The Constitución Política and international treaties guarantee both rights, and a balance must prevail between environmental protection and the rights of individuals, as well as the procedural guarantees applicable in this case to the interested third party. In the challenged judgment, the fourth recital, entitled "On the Merits of the Matter," sets out the evidence that served as the basis for that decision.

In that regard, in order to identify the defect mentioned above (insufficient reasoning), it has been deemed necessary to provide an account of the evidence upon which the a quo relied in upholding the restitution request filed by the prosecuting bodies, followed by a detailed account of the objections raised against the evidence submitted by the interested third party, and subsequently an exposition of the deficiencies in the resolution; accordingly, the following sections have been deemed necessary:

  • i)Regarding the analysis of the prosecution evidence. The sentencing court concludes that on property number [Valor 005], owned by the company known as [...] Responsabilidad Limitada, on December 26, 2012, a series of works were carried out to the detriment of the environment through the use of a crawler tractor, with which earth was removed to construct a forest track, resulting in the invasion of the protection area of a permanent spring and a stream, in which several culverts were placed — elements that, as noted, remained in the area at the time of the trial and continue to affect the environment — as well as brachiaria grass that was planted; and it is these circumstances that compel the ordering of restitution of things to their prior state, clarifying that it is unnecessary to prove the participation of any person or company, given that in the prior criminal trial an acquittal was entered on the criminal charges and the civil action (acción civil) was declared without merit, based on the legal obligation to protect the environment (relevant legislation and case law are cited in this regard).

Among the evidentiary elements taken into account, the testimony of SINAC officials is cited, specifically that of [Nombre 021] and [Nombre 022], who are described as having stated that the environmental damage to the property in question persists to this day. In the relevant portion, the adjudicator offered the following explanation: "to this day, thirteen years after the environmental damage at that site was first documented, the environmental impact remains palpable and stems from the same factors identified at that time; in this regard, both witnesses were consistent in clearly and precisely identifying the factors that caused this damage, which resulted from human conduct, since both confirmed that on December 26, while conducting a patrol in the locality of [...], at the property [...], they spotted a truck parked on a public road and observed that a forest track was being cleared, which prompted both of them to enter the site in order to verify the conditions of the place; at that moment they located a crawler tractor opening said forest track; they state that it had crossed over a body of water and was located within the protection area; that on that occasion a permanent spring was also found on the property, located only thirty-five meters from the aforementioned forest track.

They state that they had visited this property before December 26, 2012, and knew that the forest track had not previously existed — rather, there was a trail (trillo) used by horses and people — and they finally confirmed the presence of brachiaria grass [brizanta], which is not native to the area and is planted in the protection areas.

It was therefore possible on that occasion to clearly establish the factors determining the environmental damage (daño ambiental) at the site; as regards the encroachment upon the protection zones (áreas de protección) of the water bodies (cuerpos de agua), the stream (quebrada) was encroached upon on both sides by reason of the unpaved track (trocha) that crosses it, where the placement of culverts (alcantarillas) in the streambed (cauce) and the presence of cattle were also verified, all of which was recorded in report N.ACLA-P-SRBA-191, which appears at folios 164 to 167 of the virtual case file (escritorio virtual); likewise, it is on record that on that occasion a crawler tractor was also seized pursuant to official record (acta) N.3670, which appears at folio 168 of the virtual case file (expediente virtual), these being items of evidence that fully corroborate the testimony of both witnesses.

It is likewise specified that two years after December 26, 2012, new unpermitted works were found to have been carried out, according to official communication (oficio) SINAC-ACLA-P-SRBA-365-2015, such as: "the construction of a well over the spring (naciente), the placement of six culverts over a water body, and the construction of a barbed-wire fence, as set forth in reports SINAC-ACLA-P-SRBA-294-14, SINAC-ACLA-P-SRBA-406-2015, and SINAC-ACLA-P-388-14, which appear at folios 173 to 180, 220 to 222, and 273 to 274 of the virtual case file." Based on the information contained in these documents, the lower court (a quo) concludes that since 2012 a series of works have been carried out to the detriment of the environment, and that it is not true that the unpaved track existed beforehand, as asserted by the witness ([Nombre 001]) and his attorney-in-fact (apoderado judicial), given that the court takes into account that the witnesses stated they had known the area for some time.

The judgment (sentencia) also notes that the attorney-in-fact referred to an alleged confusion regarding the water bodies found at the scene, and such confusion was dismissed on the grounds that there have been inspections since 2012 that have been documented in the case file; and again, officials [Nombre 021] and [Nombre 022] are mentioned, whose accounts are transcribed, and it is detailed that their statements establish that environmental damage has occurred, as documented with photographs in report SINAC-AC-LAP-SRBA-0910-2024, and it is explained that such environmental impact arises because natural regeneration is not permitted, all resulting from an unpaved track used by vehicles; in addition, structures harmful to the environment have been placed in the water bodies, specifically culverts built in the streambed of one of them; pasture grass (zacate) not native to the area has been planted; dividing fences have been installed; the site is dedicated to cattle ranching; and the stream has a concrete structure that prevents the water from flowing naturally.

  • ii)Regarding the assessment of the evidence offered by the interested third party (tercero interesado).

On the other hand, after the trial court cited the foregoing evidence — which served as the basis for ordering "the restoration of things to their original state" — it is also noted that the interested third party submitted evidence to assist the court in reaching a decision (prueba para mejor proveer) in the proceedings, and it is indicated that such evidence does not disprove the finding of environmental damage, which has been evident, and that the activities conducted on the property in question must be restricted and its ecological function restored. However, upon reviewing the documentary evidence submitted by the interested third party, as will be seen, it is apparent that such evidence was not assessed in a linked and thorough manner alongside the remaining evidence received at the trial (plenario), so as to rule out or confirm each of the arguments raised by the interested third party.

The trial court does accept as valid evidence the annual registration renewal certificate from SENASA submitted by the attorney-in-fact, which authorizes the conduct of cattle-ranching activities on the property of [Nombre 004], and from which it is indeed clear, as stated in the judgment, that encroachment upon the protection zones is not permitted and that cattle must not enter those zones, so as not to harm the environment. The judgment also notes that the interested third party, [...], holds a concession for the use of surface water R-2800-2024-AGUAS-MINAE, and explains that this is "a concession whose primary source is a spring; under that concession, the installation of a valve was ordered for the purpose of ensuring the diversion of the water flow (caudal); however, the court finds that the installation of this instrument does not authorize encroachment upon the protection zone corresponding to that spring — that is, the factors that caused the impact on the spring, namely the opening of the unpaved track, the brizanta grass (pasto brizanto), and the concrete structures located at that site, bear no relationship to the water use permit granted, since for the use of that water only the installation of the aforementioned valve is required; accordingly, this evidence does not disprove the environmental damage that has been deemed proven." The contested judgment also cites the report identified as "Determination of Environmental Damage on Farm (finca) [Valor 004] in the name of [...] S.R.L.," and the information contained in that document is dismissed on the grounds that it offers subjective assessments, as is apparent from the text transcribed below: "no environmental damage has been detected; it is affirmed that the current state of environmental elements such as water quality, the presence or absence of water bodies affected by civil works or the presence of contaminants, the qualitative quality of the air, as well as the state of biodiversity on the farm, indicates that no environmental damage whatsoever has occurred.

However, it is clear that the Ley Forestal defines the protection zones for water bodies, so such conclusions conflict with what the evidence has established within the proceedings, namely, the environmental damage attributable to the factors already extensively analyzed. The report further asserts that no significant or degrading changes, alterations to environmental benefits, adverse collateral effects, or externalities that would modify the environmental balance on the farm have been detected; however, a series of factors have been deemed proven that have considerably affected the environmental balance, among which the presence of brizanta grass — which is not native to the area and affects the soil — was identified; it was also determined that the protection zones not being properly demarcated has caused cattle to enter the margins of the water bodies, generating water contamination from animal waste, with the soil also being affected by cattle traffic in that area.

The report also asserts that the demolition of infrastructure within the farm would entail an impact on the environment and a detriment to the economic and social benefits; however, the court finds that the environmental impact — which is the overriding concern in the case before us — is such that at least the assessments made in that report are entirely subjective and depart from what forest regulations prescribe; the report asserts that removing the culverts would leave the runoff (escorrentía) without infrastructure to properly channel it, in addition to what their removal itself entails; it is also asserted that eliminating the unpaved track would entail a detriment to the economic and social benefits of the farm, a conclusion that is inconsistent with environmental interests. In this regard, the interested third party [Nombre 004] also testified at the trial hearing (debate), describing during his account the purpose of the farm as well as all the actions taken over the years for the benefit of the environment; he also referred to the previously analyzed report, which concludes that no environmental damage exists, pointing out how harmful SINAC's proposals to remove the unpaved track and the concrete structures placed in the water bodies, as well as to eliminate the brizanta grass, could prove to be; in this regard, despite the extensive and detailed nature of his testimony, it is not supported by any item of evidence consistent with the evidence that does establish the existence of environmental damage on that farm; his arguments are entirely subjective and find no support in any scientific evidence submitted to the case file, so his account must be disregarded" (as in the original document).

From the foregoing, it is apparent that the trial court centered its reasoning on the statements made by MINAE officials and on their reports.

  • iii)Regarding the deficiencies in the assessments conducted.

Upon review, the foregoing explanations are found to be very general; the original document, recorded at folios 1557 et seq. of the electronic case file (expediente electrónico), is not consulted for an in-depth review, nor is this evidence confronted with the evidence supporting the charges. The report mentioned in the preceding section was issued by biologist and environmental consultant Isaac Alonso Baldizón Fernández, and regardless of whether one agrees with what is stated therein, it is not enough to assert that its arguments are subjective — it must be explained why that is the case. This document begins by defining what environmental damage is, and then proceeds to conduct an analysis and evaluation of the ecological impacts on the property in question, of which it provides a general overview (f. 1564), and notes that this is "a rural landscape highly degraded by livestock activities carried out over decades that have displaced the original forest cover (cobertura forestal) with large pasturelands (potreros) for extensive grazing, in order to supply beef to the domestic market." All of this information about the timeline of the damage was relevant to the case, since it is important to determine not only whether environmental damage has occurred on the property in question, but, if proven, from what point in time it has been occurring, in order to assess factors such as the severity of the consequences, and also to understand whether the deterioration is reversible or permanent, so as to design adequate prevention and mitigation strategies, and to determine whether the interested third party could be required to carry out whatever restoration measures might be necessary.

The cited study also includes a photograph showing the location of the water bodies within the farm, which are documented with information obtained from the Atlas del Instituto Tecnológico de Costa Rica as of 2014, upon which the Sistema Nacional de Información Territorial SNIT of the IGN is based, from which it is drawn that in the area there are "two water bodies near the farm in question, and the farm itself does not contain lotic (flowing) or lentic (standing) water bodies," and photographs are provided of the natural drainage system or outlets where the accumulated water present on the farm is released, and the type of runoff or surface water drainage occurring therein, and it is indicated that these cannot be considered streams.

In this regard, the text explains the following: "If those channels were in fact permanent streams, as indicated in the aforementioned case file, then forest cover and vegetation in general would be along their margins and not within the channels themselves. Figure 7 demonstrates that what the MINAE official's report designates as a streambed is in reality a channel. Figure 8 details the level of the water flow (caudal) entering the farm in question through the channels that drain the water from the farms upstream.

If this runoff water (aguas de escorrentías) is not properly channeled, the sparse vegetation downstream would not be capable of retaining it adequately, and significant hydro-erosive processes (procesos hidroerosivos) would occur, stripping away the layers of organic topsoil (suelo orgánico) from the pastures (potreros), impoverishing the soils with serious consequences for livestock production on those lands, further reducing the already low profitability from cattle sales, and on the other hand resulting in a discharge of sediments into the bodies of water downstream, such as the río Coto Brus, altering its benthic dynamics (dinámica bentónica) — the benthic ecosystems of the riverbeds. Piping this stormwater to direct it toward the drainage channels (canales de desfogue) downstream is one of the principal environmental management practices properly implemented for soil protection downstream. Because these are drainage channels and not bodies of water proper, no fish were observed as indicators of aquatic ecosystems" (bold text not in the original).

The foregoing information, which calls into question the data provided by MINAE officials regarding the type of bodies of water present on the property in question, imposed on the trial court the obligation to conduct a comprehensive cross-examination against the prosecution's evidence, in order to determine the true environmental consequences that may or may not have occurred at the site, given that each type of water body has different recovery capacities, and this further determines what type of liabilities may be incurred by the owner of a property on which legally protected bodies of water are located, and what the best means of protecting them are. The contested report also mentions that water quality was analyzed using a Hanna model HI 98194 multiparameter device (Figure 9), which showed that no water contamination exists as a result of the day-to-day activities currently carried out on the property — a finding that was likewise a relevant piece of data for establishing whether or not environmental damage had occurred.

The study likewise mentions that in order to determine environmental damage, a biodiversity inventory of the area must be conducted along with an understanding of the trophic role (rol trófico) played by each species in the ecosystem and landscape; an explanation is provided of the area and of what has happened to the property in question over the past several decades — information that was important and should have been taken into account in the appealed judgment in order to establish whether or not ecological deterioration existed at the site, in accordance with those characteristics.

Furthermore, it is important to note that the report in question provided a breakdown of the questioned actions, divided as follows in order to determine whether any activity had affected the environment: "1. Excavation of a well at the location of the spring (naciente). 2. Construction of a structure at the edge of the concrete well. 3. Maintenance of the trail (trocha). 4. Placement of 6 culverts (alcantarillas) to bridge the watercourse (cauce). 5. Construction of a barbed wire fence." However, despite each of these elements having been elaborated upon, the sentencing court did not take care to verify the data contained in each of those sections. This does not imply that the appellant should be found to be in the right, but rather that the ruling must be shown to have been the product of a comprehensive analysis of all the evidence.

It is worth noting that, with respect to the first item concerning the well, the report states: "The structure of the well shows that it was built years ago, and what the MINAE official observed was the placement of a culvert to prevent the collapse (descampanamiento) of the well crown; his report therefore states '…construction of a structure at the edge of the concrete well.'" The study further details that no spring was located at the well site and that the improvements do not technically put the environment at risk — an aspect that was not taken into account in the appealed judgment. Regarding the trail, it is noted that it is not a new road, that it is compatible with the activity certified by SENASA through CVO2583-04, that the earthworks (movimiento de tierras) did not degrade the immediate surroundings, that the tractor used generated nothing more than noise, and an explanation is provided as to why this was not considered harmful to the environment; furthermore, still with respect to the trail, it is noted that it is not related to activities that cause environmental damage, and it is described that an environmental improvement has in fact been made along it, given that [Nombre 004], who holds a master's degree in agricultural engineering, has introduced vegetative strips (fajas vegetativas) on both sides, planted with grasses that take root and allow for adequate compaction of the trail, as well as preventing sediment runoff downstream; in addition, these plants contribute organic matter that can enrich the surrounding soil, serve as a seed source for birds and insects, fix atmospheric carbon, and serve as food for livestock and wild herbivores — none of which aspects were taken into account in determining whether ordering the removal of the trails or roads on the property would result in better environmental protection or not.

Regarding the age of the road or trail — a matter that the court dismisses based on the testimony of MINAE witnesses — the court does not explain why the reference in the report in question to the presence of slow-growing trees, among which the Cristóbal is cited and for which photographic documentation is provided, appearing as Figure 16, does not refute the position established by the MINAE officials. Reference is also made to the six culverts identified in the report prepared by the MINAE officials. The following is detailed in this regard: "Another activity noted in the MINAE official's report was the placement of a culvert in the trail to bridge the watercourse; in this regard, several aspects need to be clarified, namely, that the placement of culverts to prevent damage to roads or trails constitutes activities inherent to the land use of the farm, given that it is a cattle-raising operation.

It is important to clarify once again that the property in question is not crossed by any body of water (Figure 6) that could be considered an aquatic ecosystem, as follows from the aforementioned report; it is necessary to emphasize that what flows through the property are drainage channels that direct stormwater originating from properties upstream. The pipes that were placed therefore serve the function of channeling the runoff water beneath the road so that it may continue through the drainage channels downstream, thereby protecting the soil, the pastures, and the bodies of water further downstream. It is therefore incorrect to state that the bed of a body of water or an aquatic ecosystem was affected. Figure 17 shows the alleged watercourse that has been piped beneath the road, demonstrating that what is observed is heavy runoff that is generated during rainy periods but disappears when it does not rain, so that water does not remain long enough to classify this drainage channel as a watercourse or aquatic ecosystem; indeed, no aquatic fauna whatsoever is observed therein." This observation, supported by two photographs in which it is explained that the culverts are replacements for earlier ones and provide continuity to the drainage channel, further clarifies that any civil work aimed at adequate stormwater management constitutes a form of climate-proofing (blindaje climático) and that the culverts do not pipe any watercourse, body of water, or aquatic ecosystem; yet even less reference was made in the ruling to these aspects, despite the fact that they pertain precisely to what is being ordered to be removed from the interested third party. No mention is made either of the pastures on the property that aim to reduce chemical fertilizer costs and lower the farm's carbon footprint, as stated by the appellant.

Finally, the report in question sets out a series of conclusions, among which the following stands out; although it is lengthy, it is considered important to transcribe it in full, as it reflects the fact that despite several relevant arguments being raised, the presiding judge did not take care to examine them in detail or explain why they lacked any basis — if that was indeed the court's position: "Among the report's conclusions, it is noted that no environmental damages were estimated, as no significant degrading changes were established; the environmental elements analyzed, such as water, show no contaminants; the actions attributed in the case file do not demonstrate manifest environmental damage and instead enhance the ecosystem services (servicios ecosistémicos) of the farm; and an extensive conclusion is transcribed, given that it reflects how the presiding judge did not, in reaching a decision, take care to analyze these arguments specifically: 'The request for demolition of any infrastructure within the property in question may be entirely counterproductive for the environment, since such action would indeed create a before-and-after scenario to the detriment of the economic, social, and environmental benefits that these works currently provide; for example, removing a properly constructed rural road surface would affect the economic benefits of the farm by hindering the transport of cattle for fattening and/or sale.

Such removal would degrade the vegetative strips already established along the road margins, generating negative externalities downstream through sediment discharge. The demolition of the culverts would cause further environmental damage, not only from the removal itself but also because the runoff would no longer have infrastructure to direct it adequately toward the drainage channels, thereby producing another permanent environmental harm, given the resulting soil loss and sediment discharge. The removal of the living fences (cercas vivas) would strip the farm of the economic, social, and environmental benefits they generate, including the ability to restrict free cattle movement, the impossibility of establishing fallow plots (barbechos) within enclosures, and all the ecosystem services produced synergistically by a group of trees growing together, as explained above. The potential demolition of all the works cited in the MINAE official's report would ultimately alter the value of the rural land, the income generated by that rural land, and the average rate of return; likewise, the average remuneration for human resources employed in all activities on the farm, the cost of materials and inputs, and other aspects would all be affected.

The removal of the road would in turn affect the use value of the route; travel time without the road for moving cattle and inputs in and out would be affected, as would average man-hour values for carrying out those same activities without the road; the change in the quantity and type of vehicles required would also have to be considered in assessing environmental damages arising from the road's demolition, as would the change in cargo volume per vehicle in the absence of the road.'" The removal of the fences, for its part, will affect the fallow land (zona en barbecho), generating environmental damage (daño ambiental) to the flora therein, since the free movement of livestock will no longer be restricted; the environmental damage will occur because it will inevitably generate changes in the environmental use value of the flora — this value will be diminished since the flora in these fallow areas will alter the value of the economic and socioeconomic benefits of the flora maintained under these conditions, meaning that income from the environmental use and environmental non-use of the flora will be reduced (environmental non-use of the flora being understood as all those direct exploitation activities such as obtaining living fence posts, fodder, among others); without the fallow areas, it is likely that the useful life of the flora resource on the farm will be impaired, especially due to the loss of benefits derived from the resource through its environmental use, such as oxygen production, soil protection, the rising of soil water to the surface, and the maintenance of current moisture levels in soil that is recovering from or resting between grazing cycles — all of which will ultimately result in soil that is progressively less suited for grazing.

Likewise, by eliminating plant cover on the farm, the value of the fauna will be affected by environmental damage, especially through the loss of the ecosystem services (servicios ecosistémicos) it generates on the farm — particularly those provided by birds, bats, and small arboreal and terrestrial mammals — as well as the vital pollination service carried out by insects, which guarantees the presence of native and local plant species on the farm. All of the foregoing leads to the conclusion that the demolition of the works on the farm in question can indeed produce environmental damage, both permanent, temporary, and potential" (as in the original document).

From the foregoing, it must be noted that in the appealed judgment, there was no apparent concern for conducting a review of all the core aspects raised above, which was crucial in order to either refute or confirm the incriminating evidence (prueba de cargo), and which was necessary to demonstrate thoroughness in the analysis of the evidentiary record — given that the evidence offered by the interested third party provided another technical interpretation of the subject matter of the trial, even though the expert opinion (dictamen) is not binding on the adjudicator (persona juzgadora) — particularly since what this opinion put forward is that no environmental damage occurred in the area, that carrying out demolition works such as those sought by the court could cause greater environmental damage than that which it seeks to protect against, and that it further notes that the culverts (alcantarillas) have been on the property for more than 45 years, which should even have been assessed in terms of whether they existed prior to the Ley Forestal or not.

In this regard, in resolution number 2025-370 of this same Tribunal, with a different composition, issued at seven hours and fifty minutes on the twenty-fourth of July of two thousand twenty-five, the following considerations were developed, which this majority considers applicable to the present case: "What this means is that, without any intention of minimizing the environmental damage that may be linked to the facts that are the subject of this criminal — and civil — proceeding, the truth is that restitution to the original state is not always a decision that must be adopted, since the changes generated at a site, for whatever reason, may determine that in the end a forcibly ordered restitution could cause far greater damage to the ecosystem of a place — especially in cases such as this one where little more than two decades have passed since the environmental offense supposedly took place — making it reasonable to estimate that nature has been adapting to the new configuration of the existing structures, and that the most appropriate course of action may be not to order restitution.

In the same constitutional precedent from this same year, partially quoted above, when elaborating on the pro natura principle, the Sala stated that: 'Actions will not be undertaken when their potential adverse effects are disproportionate or excessive in relation to the benefits derived from them...' (idem), for which reason it must be considered that even in very serious cases of environmental damage, the passage of time naturally leads to an ecological equilibrium being reached, which was not analyzed in either direction in the judgment. What this chamber seeks to express, in simpler terms, is that not all cases are alike, and therefore, before adopting the decision to order that things be returned to the state prior to a criminal act — in matters concerning the environment and nature — the judicial body must weigh all information directly related to the particular site, with a view to considering the natural and man-made changes that may have occurred, in order to determine whether restitution is truly what is best for the protection of everyone's right to a healthy and ecologically balanced environment." Accordingly, since the judgment fails to comply with the provisions of Article 142 of the Code of Criminal Procedure, the appealed judgment and the trial proceedings that preceded it are hereby annulled.

The case file (sumaria) is ordered to be remanded to the a quo for new proceedings in accordance with law. In light of the foregoing resolution, this Chamber refrains from ruling on the remaining grounds alleged in the appeals filed in this case.

IV. Dissenting vote (voto salvado) of Judge Sancho González

With due respect, I depart from the opinion of my fellow panel members, as I believe the judgment does not suffer from the deficiency in reasoning claimed by the appellant. From my perspective, the ruling adequately analyzes all evidence — both inculpatory and exculpatory — to reach the conclusion that, on property number [Valor 005] owned by [...] R.L., a series of works were carried out beginning in 2012 that caused environmental damage (daño ambiental) which persists to this day and which, on the basis of the constitutional guarantee of the right to a healthy and ecologically balanced environment, must be remedied in the terms set forth by the lower-court ruling. First and foremost, the analysis conducted by the trial judge (jueza de mérito) incorporated all evidentiary elements that had been admitted during the trial phase (fase plenaria) and weighed the fact that SINAC, beginning in 2012, had detected that certain works had been carried out on the referenced property that were compromising a spring (naciente) and a stream, in addition to the planting of non-native pasture grass for livestock-raising purposes.

The challenged ruling explains that these findings were verified on December 26 of that year by officials [Nombre 021] and [Nombre 022], witnesses who, by virtue of their institutional roles, were familiar with the property prior to that inspection and knew that the opening of an access track (trocha) a mere 35 meters from a permanent spring was a recent development as of that date, in connection with which report N.ACLA-P-SRBA-191 was prepared. The trial judge grounded her decision not only on the evidence from that period, but reinforced her analysis by noting that, following that first report, new inspections were conducted by the competent SINAC authorities — the first of them two years later — at which point it was confirmed that works continued to affect the stability of the bodies of water (cuerpos de agua) located on the property. Furthermore, taking into account the considerable amount of time that has elapsed since the environmental damage was first detected, the tribunal ordered a new on-site inspection for November 2024 in order to verify current conditions, confirming that at this point in time the environmental impact caused by the actions carried out on the property persists.

In addition to a written report, the officials who conducted the inspection provided testimony, as the trial judge duly notes when referring to the account given by witness [Nombre 021], who explained that the impact on two bodies of water continues; this was likewise confirmed by engineer [Nombre 022], who explained that the water resource (recurso hídrico) is contaminated and noted that a concrete structure was built in the stream that prevents the water from flowing freely, resulting in a flow greatly reduced compared to what it was in 2012. Indeed, it is precisely from this detailed account of the on-site findings — drawn from information provided by qualified witnesses, officials with extensive experience within SINAC whose knowledge and integrity have not been called into question, as well as from the content of reports produced over thirteen years — that the tribunal was able to verify that the environmental damage persists and that, therefore, the ecological balance (equilibrio ecológico) must be restored, since protection zones (áreas de protección) are limitations of public interest on private property designed to protect water resources from actions that could affect the natural condition of water sources.

Under the Ley de Aguas n° 276 del 27 de agosto de 1942 and Article 50 of the Ley Orgánica del Ambiente número 7594, water and the watercourses (cauces) through which it flows are in the public domain (dominio público), regardless of where they are located — on State-owned land or private property — given that there is a superior public interest in protecting water resources as an integral component of the right to an ecologically healthy environment and, specifically, the right to water as a human necessity that the State must guarantee, recognized as a third-generation human right pursuant to the Declaration on the Right to Development adopted by the United Nations General Assembly on December 4, 1986. Thus, Article 1 of the Ley de Aguas provides: "The following are waters of the public domain: IV.- Those of rivers and their direct or indirect tributaries, streams or springs from the point at which the first permanent waters emerge to where they flow into the sea, lakes, lagoons, or estuaries"; Article 2 further provides: "[t]he waters enumerated in the preceding article are national property," while the Ley Orgánica del Ambiente states in Article 50: "Water is in the public domain; its conservation and sustainable use are matters of social interest." There is no doubt, therefore, that every water source is in the public domain, even when located on privately owned land.

In this regard, the Sala Constitucional has stated: "It is thus clear that the recognition of water as an essential resource and fundamental right necessarily entails protecting its sources and catchment areas (áreas de captación), encompassing underground and surface aquifers (mantos acuíferos), springs, wells, and other areas from which the water resource is located and obtained" (see resolución n.° 9221 de las 11:41 horas del 22 de mayo de 2019). The appellant argued that an expert report submitted by [...] R.L. — which questioned the findings of the inspections carried out by SINAC — was not considered in the challenged decision; however, this report was analyzed by the trial judge, whose principal conclusion in the ruling is that, notwithstanding what that document sets forth, the scope of legal protection for bodies of water is clearly defined by law, and even if the company holds permits for the use of surface water or for livestock activity (which is not disputed), such activities must be carried out within the parameters and limits established by law itself.

The fact that the company in question holds water exploitation permits merely confirms that bodies of water exist on the property, as the inspections conducted by SINAC verified; therefore, the existence of an access track, the planting of non-native pasture grass, and the construction of a drainage system (alcantarillado) that fails to respect the applicable setback limits all constitute environmental damage for which [...] R.L. is objectively obligated to provide remediation. Thus, there is no evidence to rebut the findings of the inspections conducted over thirteen years by SINAC officials who confirmed the environmental damage, as the appealed judgment aptly notes; accordingly, the decision to order the restoration of conditions to their original state and to seek the re-establishment of environmental balance is properly grounded in the evidence produced at trial. I therefore find the ground of appeal based on lack of reasoning in the ruling to be without merit, and I dissent from the majority opinion that annuls the challenged ruling.

POR TANTO:

By majority vote, the challenged judgment, number 10-2025, handed down at fourteen hours and two minutes on the thirteenth of January 2025 by the Tribunal de Juicio del I Circuito Judicial de la Zona Sur, sede Pérez Zeledón, along with the trial proceedings preceding it, is hereby annulled. Furthermore, it is ordered that these proceedings (sumaria) be remanded to the court below (a quo) for new proceedings (nueva sustanciación) in accordance with the law. In light of the foregoing, this Chamber refrains from ruling on the grounds raised in the appeals filed in this case. Judge Sancho González dissents. Notify.— ???????????????

Causa penal 13-200145-0634-PE en la que figura como tercero interesado la empresa [...], Sociedad de Responsabilidad Limitada, cédula jurídica [Valor 003], representada por [Nombre 004], cédula [Valor 002], ubicada en [...]; por el delito de INVASIÓN A UN ÁREA DE CONSERVACIÓN O PROTECCIÓN en perjuicio de LOS RECURSOS NATURALES. Integran el Tribunal las juezas Susana Wittmann Stengel, Maureen Sancho González y Xiomara Gutiérrez Cruz. Se apersonó en sede de apelación el M.S.c. José Lino Chaves López y el representante legal de la empresa [...], [Nombre 004], así como la licenciada Viviana Brenes Delgado, procuradora de la Procuraduría General de la República y el licenciado Julián Martínez Madriz en representación de la Fiscalía Adjunta de Impugnaciones del Ministerio Público

RESULTANDO:

I.Que mediante la sentencia número 10-2025 de las catorce horas dos minutos del trece de enero del año dos mil veinticinco; el TRIBUNAL DE JUICIO DEL PRIMER CIRCUITO JUDICIAL DE LA ZONA SUR, SEDE PÉREZ ZELEDÓN: "POR TANTO: De conformidad con el numeral 103 del Código Penal, artículos 98, 99, 100 y 101 de la Ley Orgánica del Ambiente 7554, artículo 5 de la Ley Forestal 7575, artículo 11, 45 y 50 de la Constitución Política, artículo 52 y 55 de la Ley de Uso, Manejo y Conservación de los Suelos N.º 7779, artículo 8 de la Ley de Biodiversidad, artículo 6, 184, 142, 175 a 179, 341 a 365, se resuelve; SE ORDENA LA RESTITUCIÓN DE LAS COSAS A SU ESTADO ORIGINAL en la finca número [Valor 005], ubicada en la localidad de [...], propiedad de [...], Sociedad de Responsabilidad Limitada, cédula jurídica [Valor 003], representada por [Nombre 004], cédula [Valor 002]. La restitución de las cosas al estado anterior se ordena en los siguientes términos: Eliminación de alcantarillas y sistema de captación de agua ubicadas en la quebrada, en cuanto a los dos cuerpos de agua (la quebrada y la naciente) delimitar las áreas de protección con cercas conforme lo establece la ley y eliminar de dichas áreas estructuras y trochas o caminos que estén invadiendo la zona de protección, así como el ganado deberá salir de las áreas de protección, se debe eliminar el zacate brizanta, esto mediante arado, lo cual se realizará de manera mecánica, se deberá dejar en esa zona donde se elimine el zacate mejorado, regenerar el suelo naturalmente.

Con ocasión de la resolución R-2800-2024-AGUAS-MINAE, en la cual se ordenó la colocación de una válvula en la naciente para asegurar la derivación del caudal, se ordena verificar su instalación. Se le otorga a la empresa [...], SRL, el plazo de tres meses después de notificada la presente sentencia para que proceda con lo ordenado por este Tribunal en la presente sentencia, lo cual se deberá realizar bajo supervisión del Ministerio de Ambiente y Energía, Sistema Nacional de Áreas de Conservación, Área de Conservación La Amistad Pacífico Subregión de Buenos Aires, a quienes se ordena comunicar esta resolución. Asimismo, se ordena al Ministerio de Ambiente y Energía, SINAC, realizar la inspección y rendir el informe a fin de constatar el cumplimento de lo ordenado en la presente sentencia. Notifíquese mediante lectura. NOTIFÍQUESE MEDIANTE LECTURA. SONIA HUEZO HERRERA. Jueza de Juicio." (sic)

II.Que contra el fallo indicado, el M.S.c. José Lino Chaves López y el representante legal de la empresa [...], [Nombre 004], interpusieron recursos de apelación.

III.Mediante resolución de las 19:09 horas del 17 de febrero de 2025, el Tribunal del I Circuito Judicial de la Zona Sur (penal), emplazó a las partes acerca de los recursos de apelación interpuestos.

IV.Realizada la deliberación de ley según lo dispuesto en el numeral 465 del Código Procesal Penal, esta cámara se planteó las cuestiones formuladas en el recurso.

V. En los procedimientos se han observado las formalidades y prescripciones de ley

Redacta la Jueza de Apelación de Sentencia Wittmann Stengel;

CONSIDERANDO:

I.Admisibilidad. En relación con los recursos de apelación interpuestos, mediante la resolución de admisibilidad número 2025-269 de las diez horas treinta minutos del treinta de mayo de dos mil veinticinco, dictada por esta misma integración, se admitieron para su estudio de fondo, únicamente, los recursos de apelación interpuestos por el representante legal de la sociedad [...], Sociedad de Responsabilidad Limitada, [Nombre 004] y del M.S.c. José Lino Chaves López.

II.Acerca de la vista señalada en esta causa. En esta sede se realizó la vista programada con la intervención del licenciado José Lino Chaves, en representación del tercero interesado [Nombre 004], quien también participó en dicha diligencia judicial, así como la licenciada Viviana Brenes Delgado, procuradora de la Procuraduría General de la República y el licenciado Julián Martínez Madriz en representación de la Fiscalía Adjunta de Impugnaciones del Ministerio Público. Los recurrentes mencionaron los mismos alegatos descritos en sus recursos de apelación y solicitaron la anulación de la sentencia impugnada, petición de la cual se pidió su rechazo por parte del representante del Ministerio Público y de la procuradora de la Procuraduría General de la República.

III.Acerca de los recursos de apelación incoados. En contra de la sentencia número 10-2025 de las 14:02 horas del 13 de enero de 2025 del Tribunal de Juicio del Primer Circuito Judicial de la Zona Sur, Sede Pérez Zeledón, en la que se ordena la restitución de las cosas a su estado original en la finca número [Valor 005], propiedad de [...], Sociedad de Responsabilidad Limitada, en libelos idénticos, se interpusieron dos recursos de apelación por parte del MSc. José Lino Chaves López y del señor [Nombre 004] como representante de la sociedad [...], Sociedad de Responsabilidad Limitada. Entre sus alegatos, cuestionaron los siguientes aspectos: la incorrecta citación y participación de la Sociedad [...], Sociedad de Responsabilidad Limitada en este asunto, la errónea aplicación de la figura de tercero interesado, la falta de litisconsorcio pasivo necesario, violación al debido proceso acerca del manejo que se ha dado en este expediente, la violación al derecho de defensa por no haber podido presentar oportunamente la prueba de descargo oportuna, la violación al derecho de audiencia por no haberse acogido el dictamen médico del tercero interesado para suspender una audiencia programada en este asunto, la falta de fundamentación de la responsabilidad subjetiva u objetiva penal, la indebida fundamentación de la sentencia, la no apreciación de la prueba, la desigualdad entre las partes, la inaplicabilidad del artículo 140 del Código Penal, además, que la sentencia es ultra petita, razones por las cuales se pide la anulación de la sentencia impugnada y por economía procesal se desestime la petición de la Procuraduría General de la República y se archive esta causa.

Por voto de mayoría (juezas Wittmann Stengel y Gutiérrez Cruz), se declara con lugar el reclamo establecido por falta de fundamentación de la sentencia impugnada. Para efectos de resolver lo pertinente, se ha considerado necesario estructurar esta resolución de la siguiente manera: i) Antecedentes: a) En esta causa se dictó la sentencia número 62-2021, de las dieciséis horas diez minutos del cinco de febrero de dos mil veintiuno. En la misma se resolvió lo siguiente: “De conformidad con lo expuesto, normas citadas, artículos 39 y 41 de la Constitución Política; 1, 11, 30, 45, 367 del Código Penal, y numerales 1, 2, 6, 8, 9, 111 a 124, 142, 265 a 270, 341 a 366 del Código Procesal Penal; artículo 58 inciso A de la Ley Forestal; 73.2 del Código Procesal Civil, este Tribunal resuelve ABSOLVER de toda pena y responsabilidad al imputado [Nombre 001], en cuanto a un delito de Invasión a Área de Protección, que le venía atribuyendo el Ministerio Público y la Procuraduría General en la República en calidad de Querellante, en perjuicio de Los Recursos Naturales.

Se ordena el levantamiento de toda medida cautelar que se haya dictado en contra de la aquí imputada en la presente causa. Se declara SIN LUGAR la Acción Civil Resarcitoria interpuesta por la Procuraduría General de la República, en contra de la demandada civil ([Nombre 004]). Se resuelve sin especial condena en costas en cuanto a la Acción Civil Resarcitoria. Son los gastos del proceso a cargo del Estado. De conformidad con el artículo 140 del Código Procesal Penal, se ordena la restitución de las cosas a su estado original en cuanto a la trocha y las alcantarillas, y la estructuras y construcciones dentro del área de protección, de la finca número [Valor 005], ubicada en la localidad de [...], propiedad de [...], Sociedad de Responsabilidad Limitada. Se le otorga el plazo de tres meses después de notificada la presente sentencia al Representante Judicial de la Sociedad de Responsabilidad Limitada, [...], SRL, para que proceda con el derribo de las seis alcantarillas, así como la estructuras y construcciones dentro del área de protección.

Asimismo, se ordena al Ministerio de Ambiente y Energía, SINAC, realizar la inspección y rendir el informe a fin de constatar el cumplimento de lo ordenado en la presente sentencia. Notifíquese mediante lectura.” En dicha resolución, de conformidad con lo establecido en el ordinal 363 inciso a) del Código Procesal Penal, se indicó que los hechos objeto de ese juicio (acusados) fueron los siguientes: « I.- El Ministerio Público de ésta ciudad, formuló acusación por los siguientes hechos: “1.- El día veintiséis de diciembre del año dos mil doce, en horas de la tarde, en la localidad de [...], en una finca propiedad del señor [Nombre 004], el acusado [Nombre 001] en calidad del encargado de la finca y hermano del propietario; en asocio de otro sujeto no identificado procedieron actuando de común acuerdo y mediante la utilización de maquinaria pesada, a invadir el área de protección de una naciente permanente, cuerpo de agua que luego origina una quebrada.

El tal efecto, el imputado ([Nombre 004]) giraba instrucciones verbales sobre el área a trabajar al encartado no identificado, quien operaba un tractor de oruga color amarillo, marca CASE y realizaba cortes con la pala del tractor y removía la tierra en el área de protección del cuerpo de agua supra indicado, estando a una distancia de treinta y cinco aproximadamente del cauce de la naciente permanente, esto con el afán de construir una trocha en el sitio y lograr el pastoreo y abrevadero de ganado vacuno”. Asimismo, la Procuraduría instó querella por delito de acción pública por los siguientes hechos: "PRIMERO: El día veintiséis de diciembre del año dos mil doce, en horas de la tarde, en la localidad de [...], en la finca número [Valor 005] propiedad de [...], Sociedad de Responsabilidad Limitada, representada judicialmente por el señor [Nombre 004], el acusado [Nombre 001], en calidad de encargado de la finca y hermano del propietario; en asocio de otro sujeto no identificado procedieron actuando de común acuerdo y mediante la utilización de maquinaria pesada, a invadir el área de protección de una naciente permanente, cuerpo de agua que luego origina una quebrada.

El tal efecto el imputado [Nombre 001] giraba instrucciones verbales sobre el área a trabajar al encartado no identificado, quien operaba un tracto oruga color amarillo, marca CASE y realizaba cortes con la pala del tractor y removía la tierra en el área de protección del cuerpo de agua supra indicado, estando a una distancia de treinta y cinco metros aproximadamente del cauce de la naciente permanente, esto con el afán de construir una trocha en el sitio y lograr el pastoreo y abrevadero de ganado vacuno. SEGUNDO: El acusado [Nombre 001] no contaba con los permisos de la administración forestal del Estado para realizar trabajos de construcción de obras y actividades de pastoreo de ganado vacuno, en áreas de protección en [...]. TERCERO: Es claro que el actuar ilícito perpetrado por el acusado [Nombre 001] produjo un grave daño ambiental, ya que causó la afectación del área de protección de una naciente permanente deteriorando con ello ese recurso y su recuperación, tales como el costo de oportunidad de crecimiento de la vegetación, perdida de la biodiversidad y costo de reposición, entre otros.

Menoscabando con ello, los recursos naturales existentes en el área, lo que incide en la actividad biológica imperante en la localidad de los hechos causando no sólo perjuicio al medio ambiente, sino también, un insostenible deterioro de la calidad de vida". De igual forma, se interpuso acción civil resarcitoria con fundamento en los siguientes hechos de interés: "PRIMERO: El día veintiséis de diciembre del año dos mil doce, en horas de la tarde, en la localidad de [...], en la finca número [Valor 005] propiedad de [...], Sociedad de Responsabilidad Limitada, representada judicialmente por el señor [Nombre 004], el acusado [Nombre 001], en calidad de encargado de la finca y hermano del propietario; en asocio de otro sujeto no identificado procedieron actuando de común acuerdo y mediante la utilización de maquinaria pesada, a invadir el área de protección de una naciente permanente, cuerpo de agua que luego origina una quebrada.

El tal efecto el imputado [Nombre 001] giraba instrucciones verbales sobre el área a trabajar al encartado no identificado, quien operaba un tracto oruga color amarillo, marca CASE y realizaba cortes con la pala del tractor y removía la tierra en el área de protección del cuerpo de agua supra indicado, estando a una distancia de treinta y cinco metros aproximadamente del cauce de la naciente permanente, esto con el afán de construir una trocha en el sitio y lograr el pastoreo y abrevadero de ganado vacuno. SEGUNDO: El acusado [Nombre 001] no contaba con los permisos de la administración forestal del Estado para realizar trabajos de construcción de obras y actividades de pastoreo de ganado vacuno, en áreas de protección en [...]. TERCERO: Es claro que el actuar ilícito perpetrado por el acusado [Nombre 001] produjo un grave daño ambiental, ya que causó la afectación del área de protección de una naciente permanente deteriorando con ello ese recurso y su recuperación, tales como el costo de oportunidad de crecimiento de la vegetación, perdida de la biodiversidad y costo de reposición, entre otros.

Menoscabando con ello, los recursos naturales existentes en el área, lo que incide en la actividad biológica imperante en la localidad de los hechos causando no sólo perjuicio al medio ambiente, sino también, un insostenible deterioro de la calidad de vida ». También, en este fallo, el tribunal de juicio estableció que ningún hecho de relevancia quedó demostrado. b) El Tribunal de Apelación de Sentencia Penal, con diferente integración (Fernández Mora, Carranza Cambronero y Fallas Redondo), al haberse interpuesto recurso de apelación contra la sentencia antes indicada, lo acogió parcialmente y determinó el reenvío únicamente para que se discutiera el tema referente a la restitución de las cosas a su estado natural, como se determina de la parte dispositiva: “Se declara sin lugar el recurso de apelación incoado por la representante del Ministerio Público, así como los motivos primero y segundo del recurso planteado por la Procuraduría General de la República.

De manera oficiosa se declara la extinción de la acción penal por prescripción y se confirma la absolutoria del imputado por los hechos que se le han atribuido en este proceso. El juez Fernández Mora pone nota. Se declara con lugar el recurso de apelación incoado por la defensa del demandado civil, así como el tercer motivo de impugnación incoado por el representante de la Procuraduría General de la República, se dispone la ineficacia parcial del fallo y se ordena la realización de un juicio de reenvío, únicamente para que se discuta lo concerniente a la restitución de las cosas a su estado natural que se dispuso en sentencia. El juez Fallas Redondo salva parcialmente su voto” (la letra en negrita es propia). c) Debido al reenvío ordenado, se realizó un nuevo debate y se dictó la sentencia número 10-2025 del Tribunal de Juicio del Primer Circuito Judicial de la Zona Sur, Sede Pérez Zeledón, de las catorce horas dos minutos del trece de enero de dos mil veinticinco, objeto de impugnación ante esta integración.

De interés, de dicho fallo debe destacarse los siguientes aspectos: i) en el resultando primero se indicó lo siguiente: “I. Que mediante resolución de las catorce horas dos minutos del veintinueve de abril del dos mil veintiuno del Tribunal de Apelación de Sentencia Penal de Cartago se ordenó juicio de reenvío en la presente causa únicamente para que se discuta lo concerniente a la restitución de las cosas a su estado natural”. ii) Además, en el considerando tercero, se establecieron como hechos probados los siguientes: “Que la finca número 6-[Valor 005]-000 es propiedad de [...] Responsabilidad Limitada, cédula jurídica [Valor 003], representada por [Nombre 004], cédula [Valor 002], misma que se ubica en la localidad de [...], lugar en donde el veintiséis de diciembre del 2012 realizaron trabajos que ocasionaron un daño ambiental en el lugar, siendo que utilizaron un tractor de uruga, el cual removía tierra con el objetivo de construir una trocha, específicamente se colocaron alcantarillas en la quebrada y se sembró pasto de especie brizanto que no es originario de la zona, acciones que ocasionaron que se invadieran las áreas de protección de dos cuerpos de agua, a saber una naciente y una quebrada” (la letra en negrita no es del texto original). iii) En la parte dispositiva se dispuso que: “De conformidad con el numeral 103 del Código Penal, artículos 98, 99, 100 y 101 de la Ley Orgánica del Ambiente 7554, artículo 5 de la Ley Forestal 7575, artículom11, 45 y 50 de la Constitución Política, artículo 52 y 55 de la Ley de Uso, Manejo y Conservación de los Suelos N.º 7779, artículo 8 de la Ley de Biodiversidad, artículo 6, 184, 142, 175 a 179, 341 a 365, se resuelve; SE ORDENA LA RESTITUCIÓN DE LAS COSAS A SU ESTADO ORIGINAL en la finca número [Valor 005], ubicada en la localidad de [...], propiedad de [...], Sociedad de Responsabilidad Limitada, cédula jurídica [Valor 003], representada por [Nombre 004], cédula [Valor 002].

La restitución de las cosas al estado anterior se ordena en los siguientes términos: Eliminación de alcantarillas y sistema de captación de agua ubicadas en la quebrada, en cuanto a los dos cuerpos de agua (la quebrada y la naciente) delimitar las marcas de protección con cercas conforme lo establece la ley y eliminar de dichas áreas estructuras y trochas o caminos que estén invadiendo la zona de protección, así como el ganado deberá salir de las áreas de protección, se debe eliminar el zacate brizanto, esto mediante arado, lo cual se realizará de manera mecánica, se deberá dejar en esa zona donde se elimine el zacate mejorado, regenerar el suelo naturalmente. Con ocasión de la resolución R-2800-2024-AGUAS-MINAE, en la cual se ordenó la colocación de una válvula en la naciente para asegurar la derivación del caudal, se ordena verificar su instalación. Se le otorga a la empresa [...], SRL, el plazo de tres meses después de notificada la presente sentencia para que proceda con lo ordenado por este Tribunal en la presente sentencia, lo cual se deberá realizar bajo supervisión del Ministerio de Ambiente y Energía, Sistema Nacional de Áreas de Conservación, Área de Conservación La Amistad Pacífico Subregión de Buenos Aires, a quienes se ordena comunicar esta resolución.

Asimismo, se ordena al Ministerio de Ambiente y Energía, SINAC, realizar la inspección y rendir el informe a fin de constatar el cumplimento de lo ordenado en la presente sentencia. Notifíquese mediante lectura. NOTIFÍQUESE MEDIANTE LECTURA.” d) Por el fondo: Aunque los recurrentes interpusieron diferentes motivos en los cuales objetan la restitución ordenada en la sentencia impugnada número 10-2025 del Tribunal de Juicio del Primer Circuito Judicial de la Zona Sur, Sede Pérez Zeledón, de las catorce horas dos minutos del trece de enero de dos mil veinticinco, este Tribunal no va a conocer la totalidad de estos, ya que, se ha constatado por las juezas que dictan el voto de mayoría, tal y como ha sido planteado por los apelantes, que el fallo carece de una adecuada motivación probatoria intelectiva de las probanzas incorporadas en el plenario y ofrecidas por los recurrentes (el tercero interesado y su abogado).

Al respecto, resulta necesario aclarar, de previo, que la figura del tercero interesado no se encuentra establecida, de manera específica en el Código Procesal Penal, sin embargo, la jurisprudencia nacional, tanto de la Sala Constitucional como de la Sala Tercera, la han reconocido como una forma especial de intervención en el proceso penal, lo que implica que las personas que ostenten un derecho sobre un bien, ya sea inmueble o mueble, que sea objeto de un proceso penal, en el cual se pueda dar una afectación al derecho real que tienen sobre este, tienen la posibilidad de ejercer los derechos que la normativa procesal fija para otros intervinientes, que van desde poder ser escuchados durante el proceso, contar con un patrocinio letrado para la defensa de sus intereses, ofrecer pruebas hasta presentar alegatos que deber ser considerados por quienes juzgan. Ahora bien, estas facultades traen aparejadas a que el tercero interesado en un proceso penal tiene el derecho a que la sentencia esté bien fundamentada y a un proceso justo, aunque su papel sea diferente al de la persona acusada o de la víctima.

El deber de fundamentar es insoslayable al debido proceso y a principios fundamentales del derecho penal, que fijan que las decisiones judiciales deben estar basadas en la ley y en pruebas sólidas, pues caso contrario el fallo puede ser anulado si los intereses de ese tercero se ven afectados sin el debido razonamiento, lo que permite interponer los recursos previstos en la ley para defender su postura. Al respecto, la Sala Constitucional, en diversas resoluciones, ha reiterado que la falta de fundamentación constituye una violación al debido proceso (vid., a modo de ejemplo, el voto 3917-97, que cita numerosos votos sobre el tema). Del mismo modo, en el artículo 142 del Código Procesal Penal se estipula que: "Las sentencias y los autos contendrán una fundamentación clara y precisa. En ella se expresarán los razonamientos de hecho y de derecho en que se basan las decisiones, así como el valor otorgado a los medios de prueba.

La simple relación de las pruebas o la mención de los requerimientos de las partes no reemplazará, en ningún caso, la fundamentación. Será insuficiente cuando se utilicen formularios, afirmaciones dogmáticas, frases rutinarias, la simple descripción de los hechos o la sola mención de los elementos de prueba. No existe fundamentación cuando se hayan inobservado las reglas de la sana crítica, con respecto a medios o elementos probatorios de valor decisivo. Los autos y las sentencias sin fundamentación serán ineficaces”. Asimismo, el ordinal 361 del cuerpo legal citado preceptúa que: "El tribunal apreciará las pruebas producidas durante el juicio, de un modo integral y con estricta aplicación de las reglas de la sana crítica. Los jueces deliberarán y votarán respecto de las cuestiones y seguirán en lo posible el siguiente orden: … d) La restitución y las costas…” Ahora bien, al revisar la fundamentación del fallo impugnado se denota que, en este, la prueba que fue presentada por el tercero interesado y que se incorporó al plenario fue valorada de manera lacónica, como se verá más adelante, pues no basta con citarla y realizar afirmaciones generales, sino que debe explicarse, de manera minuciosa, por qué los argumentos alegados por el tercero interesado no permiten descartar su obligación de reparar el daño ambiental acusado o también debe definirse hasta dónde debe darse esa restitución.

Debe apuntarse que la restitución ambiental no debe prevaler sobre el debido proceso. Si bien resulta fundamental proteger el medio ambiente, que es un derecho fundamental y un objetivo prioritario del Estado que va dirigido a buscar su restauración, no puede dejarse de lado que el tercero civil tiene un interés subjetivo por la forma en la cual se resolverá el asunto y de ahí deviene que deben respetarse sus derechos fundamentales, como la posibilidad de contar con un juicio justo, que es parte intrínseca del debido proceso. La Constitución Política y los tratados internacionales garantizan ambos derechos y debe prevalecer un equilibrio entre la protección ambiental y los derechos de las personas y las garantías procesales en este caso del tercero interesado. En el fallo recurrido, en el considerando cuarto denominado “Sobre el fondo del asunto,” se indica cuál fue la prueba que sirvió de base para dicha decisión.

En ese sentido, para poder determinar el vicio del cual se ha hecho mención (motivación insuficiente), se ha considerado necesario realizar un recuento de esas probanzas que tuvo como base el a quo para acoger la solicitud de restitución gestionada por los órganos acusadores, luego se detallará los cuestionamientos que realizó de la prueba aportada por el tercero interesado y posteriormente se hará la exposición acerca de cuáles son las deficiencias de lo resuelto, por lo que se ha considerado necesario establecer los siguientes acápites: i) Acerca del análisis de la prueba de cargo. El tribunal sentenciador llega a la conclusión de que en la finca número [Valor 005], propiedad de la sociedad denominada [...] Responsabilidad Limitada, el 26 de diciembre del año 2012 se hicieron una serie de trabajos en detrimento del ambiente, al darse el uso de un tractor de oruga, con el cual se removió tierra para construir una trocha y se dio la invasión de un área de protección de una naciente permanente y de una quebrada, en la cual se hizo la colocación de varias alcantarillas, elementos que se indica que para la época del debate aún se mantenían en la zona y que afectan el ambiente, al igual que un pasto brizanto que se sembró, por lo que estas situaciones son las que obligan a ordenar la restitución de las cosas al estado anterior, aclarando que resulta innecesario el que se demuestre la participación de alguna persona o sociedad, dado que en el juicio pasado se absolvió en lo penal y se declaró sin lugar la acción civil, por la obligación legal de proteger al medio ambiente (se cita normativa y jurisprudencia relevante al respecto).

Entre los elementos probatorios que fueron tomados en cuenta, se citan los testimonios de funcionarios del SINAC, específicamente los de [Nombre 021] y [Nombre 022], de quienes se expone que ellos narraron que la afectación ambiental en la finca de interés aún se mantiene. En lo que interesa la persona juzgadora desarrolló la siguiente explicación: “al día de hoy, trece años después de que se constató por primera vez el daño ambiental en dicho sitio, la afectación ambiental sigue siendo palpable y por lo mismos factores que en aquella ocasión se identificaron, al respecto ambos testigos fueron congruentes en señalar de manera clara y precisa los factores que han ocasionado este daño, los cuales fueron producidos por conductas humanas, pues a ambos que les consta que el día 26 de diciembre mientras realizaban un recorrido en la localidad de [...], en la finca [...], había un camión parqueado en calle pública y constataron la apertura de una trocha, lo cual motivó que ambos ingresaran al sitio con la finalidad de corroborar las condiciones del lugar, ubicando en ese momento un tractor de uruga haciendo la apertura de dicha trocha, afirman que éste había pasado por un cuerpo de agua y que se ubicaba dentro del área de protección, que en esa ocasión además se ubicó en la propiedad una naciente permanente, que se encontraba a tan solo treinta y cinco metros de la trocha en mención.

Afirman que esta propiedad ya la habían visitado antes de este veintiséis de diciembre de 2012 y conocían que esa trocha no existía, sino que lo había era un trillo por donde se desplazaban caballos y personas, y finalmente constataron la presencia de pasto brizanta el cual no es originario de la zona, el cual se encuentra sembrado en las áreas de protección. De modo que fue posible en aquella ocasión establecer con claridad los factores que determinaban el daño ambiental en el sitio; en cuanto a la invasión de las áreas de protección de los cuerpos de agua, en el caso de la quebrada se invadió en ambos lados, esto con ocasión de la trocha que la atraviesa, donde además se constató la colocación de alcantarillas en el cauce y la presencia de ganado, todo lo cual se consignó en el informe N.ACLA-P-SRBA-191 que se encuentra visible a folios 164 a 167 del escritorio virtual, asimismo consta que en aquella ocasión también se decomisó un tractor de oruga, esto mediante acta N.3670, la cual es visible a folio 168 del expediente virtual, elementos de prueba que respaldan en un todo el dicho de ambos testigos”.

Asimismo, se especifica que dos años después del 26 de diciembre de 2012, se determinó la realización de nuevas obras sin permiso, de acuerdo con el oficio SINAC-ACLA-P-SRBA-365-2015, tales como: “la construcción de un pozo sobre la naciente, la colocación de seis alcantarillas sobre un cuerpo de agua y la construcción de cerca de alambre de púas, lo cual se desprende de los informes SINAC-ACLA-P-SRBA-294-14, SINAC-ACLA-P-SRBA-406-2015 y SINAC-ACLA-P-388-14, mismos que se encuentran visible a folios 173 a 180, 220 A 222 y 273 A 274 del expediente virtual.” Con la información que consta en estos documentos, concluye el a quo que desde el año 2012 se ha dado la realización de una serie de obras en detrimento del ambiente y que la trocha no resulta cierto que haya existido desde antes, como lo externó el declarante ([Nombre 001]) y su apoderado judicial, dado que toma en cuenta que los testigos hicieron referencia que conocían la zona desde antes.

También se menciona en la sentencia que el apoderado judicial hizo referencia a una confusión que se da de los cuerpos de agua que hay en el lugar de los hechos y se descarta tal confusión, debido a que hay inspecciones desde 2012 que han sido documentadas en el expediente y, nuevamente, se menciona a los funcionarios [Nombre 021] y [Nombre 022], de quienes transcribe sus relatos y se detalla que de sus dichos se desprende que se ha dado un daño ambiental, que fue documentado en el informe del SINAC-AC-LAP-SRBA-0910-2024, con imágenes, y se explica que se da esa afectación ambiental al no permitirse la regeneración natural, todo producto de una trocha por la que transitan vehículos, aparte que en los cuerpos de aguas se ha dado la colocación de estructuras que dañan el medio ambiente, como lo son alcantarillas construidas en el cauce de uno de estos, que se ha dado la siembra de zacate no propio de la zona, así como la inclusión de cercas divisorias, que es un lugar dedicado a la ganadería y que la quebrada tiene una estructura de concreto y eso impide que el agua fluya naturalmente. ii) Acerca de la valoración de la prueba ofrecida por el tercero interesado.

Por otro lado, luego de mencionar el tribunal de instancia la anterior prueba, que le sirvió de base para ordenar “la restitución de las cosas a su estado original”, también se menciona que el tercero interesado ofreció prueba para mejor proveer en el juicio y se indica que esta no desvirtúa la acreditación de un daño ambiental que ha sido palpable y que las actividades que se desarrollan en la propiedad de interés se deben limitar y recuperar su función ecológica. Sin embargo, al revisar la prueba documental que fue ofrecida por el tercero interesado, como se verá, se denota que la misma no fue valorada de manera concatenada y minuciosa con el resto de las pruebas recibidas en el plenario, para así descartar o confirmar cada uno de los argumentos dados por el tercero interesado. Sí acepta el tribunal de instancia como prueba válida que el apoderado judicial aportó un certificado de renovación del registro anual de SENASA, que da permiso al desarrollo de la actividad ganadera en la propiedad del señor ([Nombre 004]), del cual efectivamente se desprende que no se permite la invasión de las áreas de protección como se indica en la sentencia y que el ganado no debe ingresar a dichas zonas, para no afectar el medio ambiente.

También se menciona en el fallo que el tercero interesado, [...], tiene una concesión para el aprovechamiento de agua superficiales R-2800-2024-AGUAS-MINAE y se explica que esto es “donde la fuente principal es una naciente, en dicha concesión se ordenó la instalación de una válvula que tiene como finalidad asegurar la derivación del caudal, sin embargo, estima el tribunal que la instalación de este instrumento no autoriza la invasión del área de protección que le asiste a dicha naciente, es decir, que los factores que determinaron la afectación de la naciente, en este caso la apertura de la trocha, el pasto brizanto y las estructuras de cemento ubicadas en dicho sitio no guardan relación con el permiso concedido de agua, pues únicamente se requiere para uso de esta la instalación de la válvula antes referida, de modo que con esta prueba no se desvirtúa el daño ambiental que se ha tenido por acreditado”.

También se cita en la sentencia impugnada el informe identificado como “Determinación de daños ambientales en la finca [Valor 004] a nombre de [...] S.R.L.” y la información consignada en este documento se descarta, por considerar que aporta apreciaciones subjetivas, como se desprende del texto que se transcribe seguidamente: “no se han detectado daños ambientales, se afirma que el estado actual de los elementos ambientales como la calidad del agua, la presencia o ausencia de cuerpos de aguas afectados por obras civiles o presencia de contaminantes, la calidad cualitativa del aire, así como el estado de biodiversidad en la finca, indica que no se ha producido daño ambiental alguno. Sin embargo, es claro que la Ley forestal define las áreas de protección de los cuerpos de agua, de modo que tales conclusiones rozan con lo que la prueba ha permitido establecer dentro del proceso, a saber, el daño ambiental con ocasión de los factores ya ampliamente analizados.

Se afirma además en este informe que no se han detectado cambios significativos, degradantes, alteraciones de los beneficios ambientales, efectos negativos colaterales o externalidades que modifique el equilibrio ambiental en la finca, sin embargo, se tuvo por acreditado una serie de factores que han incidido considerablemente en el equilibrio ambiental, dentro de los cuales se identificó la presencia de pasto brizanto que no es originario de la zona y que afecta el suelo, además se determinó que al no estar las áreas de protección debidamente delimitadas, esto ha ocasionado que el ganado ingrese a los márgenes de los cuerpos de agua y esto genera contaminación del agua por las heces de los animales y el suelo se ve afectados por tránsito del ganado en dicha zona. Afirma también el informe que la demolición de infraestructuras dentro de la finca implicaría una afectación para el ambiente y un menoscabo de los beneficios económicos y sociales, sin embargo, estima este tribunal que la afectación ambiental, que es la que debe imperar en el caso que nos ocupa, por lo menos las apreciaciones que se hacen en dicho informe son completamente subjetivas que se apartan de lo que dispone la normativa forestal; afirma este informe que al eliminar las alcantarillas la escorrentía ya no contaría con infraestructura que la encause de forma adecuada, además de lo que implica la remoción de la misma, también se afirma que eliminar la trocha implicaría un menoscabo en los beneficios económicos y sociales de la finca, conclusión que no guardar congruencia con los intereses ambientales.

Al respecto, también el tercero interesado [Nombre 004], durante el debate declaró, durante su relato señaló el objetivo de la finca así como todas las acciones que en beneficio del ambiente a lo largo de estos años han realizado, además se refirió al informe antes analizado, que concluye que no existe daño ambiental, señalando lo perjudicial que puede resultar las propuestas del SINAC al eliminar la trocha y las estructuras de concretos que se ubicaron en los cuerpos de agua, así como la eliminación del pasto brizanto, en este sentido a pesar de lo amplia y detallada declaración la misma no se sustenta en ningún elemento de prueba que resulte congruente con la prueba que sí establece la existencia del daño ambiental en dicha finca, sus argumentos son completamente subjetivos que no encuentran respaldo en ninguna prueba científica aportada al expediente, de modo que se relato debe ser descartado” (así en el documento original).

De lo expuesto, se denota que el tribunal de juicio centró sus razonamientos en lo declarado por los funcionarios del MINAE y en sus informes. iii) Sobre las deficiencias en las valoraciones efectuadas. De la revisión, de las anteriores explicaciones se denota que estas son muy generales y no se acude al documento original, plasmado a folios 1557 y siguientes del expediente electrónico para revisarlo a profundidad, ni se confronta esta prueba con la de cargo. El informe, que se menciona en el apartado anterior, es emitido por el biólogo y consultor ambiental Isaac Alonso Baldizón Fernández, e independientemente se comparta lo que se consigna en este, no basta con afirmar que sus argumentos son subjetivos sino que debe explicarse por qué ello es así. Este documento inicia con la referencia de qué es daño ambiental, para de seguido realizar un análisis y evaluación de afectaciones ecológicas de la propiedad de interés, de la que muestra una vista general (f. 1564), y acota que se trata de “un paisaje rural altamente degradado por las actividades pecuarias realizadas por décadas y que han desplazado la cobertura forestal original por potreros de grandes dimensiones para el pastoreo extensivo, para el suministro de carne vacuno en el mercado nacional”.

Toda esta información de la temporalidad del daño era relevante para el caso, debido a que es importante determinar no solo si se ha dado un daño ambiental en la propiedad de interés sino en caso de acreditarse, desde cuándo se da dicha situación para determinar aspectos tales como la severidad de las consecuencias y, además, para comprender si el deterioro es reversible o permanente para diseñar estrategias adecuadas de prevención y mitigación adecuadas y de estas si se podía imponer al tercero interesado su obligación de realizar las medidas de restitución que fuesen necesarias. También, dentro del estudio citado se aporta una fotografía de la ubicación de los cuerpos de agua dentro de la finca, los cuales se documenta con información obtenida del Atlas del Instituto Tecnológico de Costa Rica al 2014, en el cual se basa el Sistema Nacional de Información Territorial SNIT del Instituto Geográfico Nacional en Costa Rica (IGN), del que se extrae que en la zona hay “dos cuerpos de aguas cercanas a la finca de interés y la finca misma no posee cuerpos de aguas lóticos (con movimiento) o lénticos (estancados)” y se aporta fotografías del sistema de desfogue natural o salidas donde se libera el agua acumulada que se presenta en la finca y el tipo de escorrentía o escurrimiento del agua que se dan en este y se indica que no pueden ser considerados como quebradas.

Al respecto, se explica en el texto lo siguiente: “Si tales canales fuesen en realidad quebradas permanentes como se indica en expediente judicial supracitado, entonces la cobertura forestal y vegetal en general estaría en las márgenes y no justamente dentro de los canales. En la figura 7 queda demostrado que lo que se indica en el informe del funcionario del MINAE como cauce es en realidad un canal. La figura 8 detalla el nivel del caudal que ingresa a finca de interés a través de los canales que desfogan las aguas fincas arriba. De no canalizarse adecuadamente estas aguas de escorrentías, la pobre vegetación finca abajo no sería capaz de retenerla adecuadamente y se produciría importantes procesos hidroerosivos eliminando las capas de suelo orgánico de los potreros, emprobreciendo los suelos con graves consecuencias sobre la producción pecuario en los mismos, reduciendo aún más la baja rentabilidad en la venta de ganado vacuno y por otro lado ser efectuaría un exportación de sedimentos hacia los cuerpos de aguas fincas abajo como lo es el río Coto Brus, cambiando su dinámica bentónica (bentos ecosistemas de los fondos de los ríos).

El entubar estas aguas pluviales para su direccionamiento hacia los canales de desfogue finca abajo resulta una de las principales prácticas de gestión ambiental adecuadamente ejecutas para la protección del suelo fincas abajo. Por ser estos canales de desfogue y no cuerpos de aguas propiamente dicho, no se observó la presencia de peces como indicadores de ecosistemas acuáticos” (la letra en negrita no es del texto original). La anterior información, en la que se cuestiona los datos brindados por los funcionarios del MINAE acerca del tipo de cuerpos de agua que había en la finca de interés, era obligación del tribunal de instancia realizar una confrontación integral con la prueba de cargo, para así determinar las verdaderas consecuencias ambientales que podían haberse dado o no en el lugar, dado que cada tipo tiene diferentes capacidades para recuperarse y esto determina, además, qué tipo de responsabilidades puede acarrearle al dueño de una propiedad en la que se encuentran cuerpos de aguas protegidos por la ley y cuáles son las mejores formas de protegerlos.

También se hace mención en el informe cuestionado que la calidad del agua fue analizada con un multiparámetro marca Hanna modelo HI 98194 (figura 9) que arrojó que no existe contaminación del agua por las actividades cotidianas que se realizan hoy en día en dicha propiedad, el cual también era un dato relevante para la acreditación o no de un daño ambiental. Asimismo, se menciona en el estudio que para determinar el daño ambiental debe realizarse un inventario de la biodiversidad de la zona y el conocimiento del rol trófico que desempeña cada especie en el ecosistema y paisaje, y se da una explicación de la zona y de lo que ha pasado con la finca de interés desde décadas atrás, información que resultaba importante y que debía haber sido tomada en cuenta en la sentencia impugnada para establecer la existencia o no del deterioro ecológico en el lugar, de acuerdo con dichas características.

Por otro lado, es importante acotar que en el informe de interés se hizo un desglose de las acciones cuestionadas, que se dividieron de la siguiente manera, esto para determinar si había alguna actividad sobre el ambiente: “1. Excavación de pozo, sobre el punto de naciente. 2. Construcción de estructura en el borde del pozo de concreto. 3. Mantenimiento a la trocha. 4. Colocación de 6 alcantarillas para hacer puente sobre el cauce. 5. Construcción de cerca de alambre de púas”. Sin embargo, pese a cada uno de estos elementos fue desarrollado, el tribunal sentenciador no se preocupó por verificar los datos consignados en cada uno de estos apartados. Lo anterior no implica que se le deba dar la razón a la parte recurrente, sino que se debe evidenciar que lo resuelto fue producto de un análisis integral de todas las probanzas. Véase que, con respecto al punto primero del pozo, en este se indica: “La estructura del pozo muestra que fue construido años atrás y lo que observó el funcionario del MINAE fue la colocación de una alcantarilla para evitar el descampanamiento de la corona del pozo, por ello en su informe se indica “…construcción de estructura en el borde del pozo de concreto.” Se detalla en el estudio que no se logra ubicar una naciente en el sitio del pozo y que las mejoras técnicamente no ponen en riesgo el medio ambiente, aspecto que no fue tomado en cuenta en la sentencia recurrida.

Sobre la trocha se hace ver que no es un camino nuevo, que es compatible con la actividad certificada por SENASA a través del CVO2583-04; que el movimiento de tierras no degradó el entorno inmediato, que el tractor utilizado lo que generó fue ruido y se explica por qué no se consideró un acto dañoso al ambiente, además, siempre con respecto a la trocha, se menciona que no está relacionada con actividades que ocasionen daños ambientales y se describe que incluso se ha realizado una mejora ambiental a lo largo de esta, dado que el señor [Nombre 004], quien tiene una maestría en ingeniería agrícola ha incluido fajas vegetativas a ambos lados, sembradas con gramíneas que enraízan y permiten el adecuado nivel de compactación de la trocha, así como que no se dé una exportación de sedimentos finca abajo, aparte que estas plantas aportan materia orgánica que puede enriquecer el suelo aledaño, que es fuente de semillas para las aves e insectos, que fijan carbono atmosférico, que sirve de alimento para el ganado y herbívoros silvestres, aspectos todos estos que tampoco fueron considerados para determinar si el ordenar la eliminación de las trochas o caminos que había en el lugar incidían en una mejor protección o no del ambiente.

Sobre la antigüedad del camino o de la trocha, que es un tema que el tribunal descarta con base en lo narrado por los testigos del MINAE, no explica por qué la mención que se hace en el informe de interés de que se da la presencia de árboles de lento crecimiento, entre los que se cita el Cristóbal y del que se aporta un respaldo fotográfico, que consta en lo que se denomina figura 16, no descarta la posición establecida por los funcionarios del MINAE. También se hace mención a las seis alcantarillas que se indican en el informe realizado por los funcionarios del MINAE. Al respecto se detalla lo siguiente: “Otra actividad que se observa en el informe del funcionario del MINAE fue la colocación de alcantarilla en la trocha para hacer puente sobre el cauce, al respecto es necesario aclara varios aspectos, a saber, la colocación de alcantarillas para evitar daños en los caminos o trochas son actividades propias del uso del suelo de la finca, por ser finca ganadera.

Es importante de nuevo aclarar que la finca en cuestión no es atravesada por ningún cuerpo de agua (figura 6) que pueda ser considerado un ecosistema acuático como se desprende del informe supracitado, se necesario hacer énfasis en que lo que discurre a través de la finca son canales de desfogue que encausan el agua pluvial proveniente de fincas arriba. Por lo que las tuberías colocadas tienen la función de encausar el agua de escorrentía por debajo del camino para que esta pueda continuar por los canales de desfogue finca abajo, y de esta forma proteger el suelo, los potreros, y los cuerpos de aguas fincas abajo. Por lo que resulta incorrecto indicar que se afectó un cauce de un cuerpo de agua o ecosistema acuático. La figura 17 muestra el supuesto cauce que ha sido entubado por debajo del camino, quedando demostrado que lo que se observa es una fuerte escorrentía que se genera en tiempos de lluvias pero que desaparece cuando no llueve, así que no se mantiene el agua lo suficiente para catalogar este canal de desfogue como un cauce o ecosistema acuático, incluso en él no se observa fauna acuática alguna”.

Este comentario que se respalda con dos fotos, en las que se explica que las alcantarillas son reemplazo de otras anteriores y que dan continuidad al canal de desfogue e incluso se hace la aclaración que cualquier obra civil que procure una adecuada gestión del agua de lluvia es una forma de blindaje climático y que el alcantarillado no entuba ningún cauce, cuerpo de agua o ecosistema acuático, menos aún se hizo referencia en el fallo a estos aspectos, pese a que versan acerca de lo que precisamente se está ordenando eliminar al tercero interesado. Ni se hace la mención de pastos en el lugar que busca la reducción de costos en fertilizantes químicos y reducir la huella de carbono de la finca, según lo indicado por el recurrente. Finalmente, el informe de interés da una serie de conclusiones, entre las que destaca la siguiente, que aunque es extensa, se considera importante transcribirla, para reflejar que pese a que se dan varios planteamientos relevantes la persona juzgadora no se preocupó de examinarlos en detalle y aclarar por qué no tenían sustento alguno, si esa era la posición del tribunal: “Entre las conclusiones del informe se cita que no se estimaron daños ambientales al no acreditarse cambios significativos degradantes, los elementos ambientales analizados como el agua carecen de contaminantes, las acciones que se imputan en el expediente no evidencian daño ambiental manifiesto y más incrementan los servicios ecosistémicos de la finca y se da una conclusión extensa que se transcribe, dado que refleja que la persona juzgadora no se preocupó al resolver el analizar de manera específica estos planteamientos: “La solicitud de demolición de cualquier infraestructura dentro de la finca en cuestión puede ser totalmente contraproducente para el ambiente, puesto que dicha acción si producirá un antes y un después con menoscabo de los beneficios económicos, sociales y ambientales que en la actualidad brindan como por ejemplo eliminar un suelo de uso vial rural adecuadamente conformado afectará los beneficios económicos de la finca al dificultar el transporte de ganados para la engorde y/o la venta.

Dicha remoción degradaría las fajas vegetativas ya establecidas en los márgenes del camino generado externalidades fincas abajo por la exportación de sedimentos. La demolición de las alcantarillas produciría otro daño ambiental, no solo por la remoción misma sino que la escorrentía ya con contará con una infraestructura que la encause hacia los canales de desfogue de forma adecuada, produciendo otro daño ambiental permanente, dado la pérdida de suelo y la exportación de sedimentos. La eliminación de las cercas vivas despojará la finca de los beneficios económicos, sociales y ambientales que generan, como producto de la posibilidad de limitar el tránsito libre del ganado, la imposibilidad de establecer apartados en barbechos, y todos aquellos servicios ecosistémicos que producen en sinergia un grupo de árboles creciendo en conjunto, como se explicó texto arriba. La posibilidad de demoler todas las obras citadas en el informe del funcionario del MINAE en definitiva cambiar el valor del suelo rural, la renta de dicho suelo rural, así como la tasa media de rendimiento, de igual forma se verán afectados la renta media del recurso humano para el desarrollo de todas las actividades en la finca, la renta de materiales e insumos cambiarán, entre otros aspectos.

La eliminación del camino por su parte afectará el valor de uso de la vía, ya se verán afectados el tiempo de viaje sin la vía para meter y sacar ganado e insumos, los valores promedio hora hombre para ejecutar las mismas actividades, pero sin el camino, el cambio en la cantidad y tipo de vehículos también tendrán que considerarse para la valoración de daños ambientales por demolición del camino, así como el cambio en el volumen de carga por vehículo sin el camino. El retiro de las cercas por su lado afectará las zona en barbecho generando un daño ambiental a la flora en ellos, ya se no se limitará el tránsito libre del ganado, el daño ambiental se producirá por que generará inevitablemente cambios en el valor en uso ambiental de la flora, este valor se menoscabará puesto que la flora en estos berbechos cambiará el valor del beneficio económico y socioconómicos de la flora mantenida bajo estas condiciones, o sea los ingreso por uso ambiental y desuso ambiental de la flora se reducirá (entiéndase desuso ambiental de la flora como todas aquellas actividades de aprovechamiento directo como la obtención de postes vivos, forrajes, entre otros), sin los berbechos es probable que la vida útil del recurso flora en finca se vea menoscabada especial por la pérdida de beneficios del recurso por su uso ambiental como la producción de oxígeno, la protección de suelo, la superfialización del agua del suelo, el mantenimiento de los actuales niveles de humedad en suelo en recuperación o descanso del pastoreo que al final de la ecuación redundará en suelo cada vez menos aptos para el pastoreo.

De igual forma al eliminar cobertura vegetal en la finca se verá afecto por daño ambiental el valor de la fauna, especialmente por la pérdida de los servicios ecosistémicos que ella genera en la finca especialmente las aves, murciélagos y los mamíferos pequeños arbóreos y terrestres, además del vital servicio de polinización llevada a cabo por los insectos que garantiza la presencia de especies vegetales nativas y locales en la finca. Todo lo anterior permite concluir que la demolición de las obras en la finca en cuestión si puede producir daños ambientales, permanentes, temporales y potenciales” (así en el documento original). De lo expuesto, debe acotarse que en la sentencia impugnada, no se denotó una preocupación por realizar un revisión de todos los aspectos medulares anteriormente planteados, lo que resultaba crucial para desvirtuar o confirmar la prueba de cargo, lo cual era necesario para evidenciar una exhaustividad en el análisis de las probanzas debido a que la prueba ofrecida por el tercero interesado proporcionaba otra interpretación técnica del tema objeto del plenario, aunque el dictamen no sea vinculante para la persona juzgadora, máxime que este lo que planteó es que en la zona no se dio un daño ambiental, que realizar obras de derribo como las que pretende el tribunal podrían ocasionar un daño ambiental mayor, que al que se pretende proteger, además, que menciona que incluso las alcantarillas han estado en la propiedad por más de 45 años, lo que incluso debió haber sido valorado si existían desde antes de la Ley Forestal o no. Al respecto, en la resolución número 2025-370 de este mismo Tribunal, con diversa integración, a las siete horas con cincuenta minutos del veinticuatro de julio del dos mil veinticinco, se desarrollaron las siguientes consideraciones, que esta mayoría considera aplicables al presente caso: “Esto lo que significa es que sin el afán de invisibilizar el daño ambiental que pudiera vincularse con los hechos objeto de esta causa penal - y civil -, lo cierto es que no siempre la restitución a su estado original es una decisión que deba adoptarse, pues los cambios generados en un sitio, por la razón que sea, pueden determinar que al final del día una restitución forzosamente dispuesta, pudiera generar mucho más daño al ecosistema de un lugar, máxime que en casos como este donde han pasado poco más de dos décadas desde que supuestamente tuvo lugar el delito ambiental, es razonable estimar que la naturaleza se ha ido adaptando a la nueva configuración de las estructuras existentes, pudiendo ser lo más conveniente no ordenar la restitución.

En el mismo precedente constitucional de este mismo año parcialmente transcrito, al profundizar en torno al principio pro natura la Sala expuso que: "No se emprenderán acciones cuando sus potenciales efectos adversos sean desproporcionados o excesivos en relación con los beneficios derivados de los mismos..." (ídem), en razón de lo cual debe considerarse que aún en casos muy graves de daño ambiental, el paso del tiempo conduce a que naturalmente se produzca un equilibrio ecológico, lo cual no fue analizado en uno u otro sentido en la sentencia. Lo que se quiere decir por parte de esta cámara, en palabras más sencillas, es que no todos los casos son iguales y por ende, antes de adoptar la decisión de disponer que las cosas vuelvan al estado anterior a un hecho delictivo, en tratándose del ambiente y la naturaleza, el órgano jurisdiccional debe ponderar toda la información directamente relacionada con el sitio en particular, de cara a considerar los cambios naturales y artificiales que hayan podido ocurrir, con el fin de precisar si la restitución realmente es lo mejor para la tutela del derecho de todos a un ambiente sano y ecológicamente equilibrado”.

De esta manera, al no cumplir el fallo, con lo establecido en el artículo 142 del Código Procesal Penal, se anula la sentencia impugnada y el debate que la precedió. Se ordena reenviar la sumaria a conocimiento del a quo, para su nueva sustanciación conforme a derecho. En vista de lo resuelto, omite esta Cámara pronunciarse sobre el resto de los motivos alegados en los recursos de apelación interpuestos en esta causa.

IV. Voto salvado de la jueza Sancho González

De manera respetuosa, me aparto del criterio de mis compañeras de integración pues estimo que el fallo no aqueja el vicio de fundamentación que reclama la parte recurrente. Desde mi perspectiva, la sentencia analiza de manera adecuada todas las pruebas —tanto de cargo como de descargo— para arribar a la conclusión de que en la finca número [Valor 005] propiedad de [...] R.L., se realizaron una serie de trabajos desde el año 2012 que ocasionaron daños al ambiente que aún se mantienen y que, con base en la garantía constitucional del derecho a un ambiente sano y ecológicamente equilibrado, deben repararse en los términos que lo dispuso la resolución de instancia. Primero que todo, el análisis que hizo la jueza de mérito incorporó todos los elementos probatorios que habían sido admitidos con amplitud durante la fase plenaria y se ponderó que el Sistema Nacional de Áreas de Conservación (en adelante SINAC) desde el año 2012 había detectado que en la finca de referencia se habían hecho algunos trabajos que comprometían una naciente de agua y una quebrada, a lo que se suma la utilización de un pasto no autóctono con fines de ganadería.

En la resolución impugnada se explica que esos hallazgos fueron constatados el 26 de diciembre del año de cita por los funcionarios [Nombre 021] y [Nombre 022], testigos que por sus funciones en la institución de referencia, conocían el inmueble de previo a esa incursión y sabían que la apertura de una trocha a escasos 35 metros de una naciente permanente, se trataba de una acción reciente para la data aludida, respecto de lo cual se elaboró el informe N.ACLA-P-SRBA-191. La jueza de mérito fundamentó su decisión no solo en aquellas probanzas propias de la época, sino que reforzó el análisis aludiendo a que, posterior a ese primer informe, se realizaron nuevas inspecciones por las autoridades competentes del SINAC, la primera de ellas dos años después, en la que se constató que se mantenían trabajos que seguían afectando la estabilidad de los cuerpos de agua que en esa propiedad se encontraban.

Por otro lado, el tribunal, teniendo en cuenta la gran cantidad de tiempo que ha transcurrido desde que se detectó el daño ambiental a la fecha, ordenó una nueva inspección en el lugar para el mes de noviembre de 2024 y así poder verificar el estado actual, constatando que para este momento, persiste la afectación al medio ambiente a partir de las acciones que en la propiedad se han ejecutado, de las cuales, además de un informe, brindaron referencias los funcionarios actuantes, como bien lo analiza la juzgadora, que alude a lo que informó el testigo [Nombre 021], quien explicó que se mantiene la afectación a dos cuerpos de agua y así también lo constató el ingeniero [Nombre 022], quien explicó que hay contaminación del recurso hídrico y aludió a que en la quebrada se hizo una estructura de concreto que impide que el agua fluya libremente y por ello su flujo es muy limitado en comparación con lo que había en el año 2012.

Y es que, es precisamente a partir de este detalle de los hallazgos in situ, que se desprende tanto de la información que brindaron testigos calificados, funcionarios con amplia experiencia dentro del SINAC y, respecto de los cuales no se ha cuestionado ni su conocimiento ni su probidad así como del contenido de informes vertidos a través de trece años, que el tribunal pudo verificar que el daño ambiental subsiste y por ende, debe restablecerse el equilibrio ecológico, pues las áreas de protección son limitaciones de interés público a la propiedad para proteger el recurso hídrico de acciones que puedan afectar el estado natural de las fuentes de agua. Según la Ley de Aguas n° 276 del 27 de agosto de 1942 y el artículo 50 de la Ley Orgánica del Ambiente número 7594, el agua y los cauces por los que esta discurre son de dominio público, independientemente de dónde se encuentren (terrenos del Estado o propiedades privadas) dado que existe un interés superior en proteger el recurso hídrico como parte integrante del derecho a un ambiente ecológicamente sano y al derecho al agua específicamente, como una necesidad humana que el Estado debe garantizar siendo considerada un derecho humano de tercera generación, esto a partir de la Declaración sobre el Derecho al Desarrollo adoptada por la Asamblea General de las Naciones Unidas el 04 de diciembre de 1986.

Así, dispone el artículo 1º de la Ley de Aguas: “Son aguas del dominio público: IV.- Las de los ríos y sus afluentes directos o indirectos, arroyos o manantiales desde el punto en que broten las primeras aguas permanentes hasta su desembocadura en el mar o lagos, lagunas o esteros”; por su parte, el artículo 2 establece: “[l]as aguas enumeradas en el artículo anterior son de propiedad nacional” mientras que la Ley Orgánica del Ambiente dispone en su artículo 50: “El agua es de dominio público, su conservación y uso sostenible son de interés social”. No hay duda, entonces, de que toda fuente de agua es de dominio público, así se encuentren en terrenos propiedad de particulares. Al respecto, ha indicado la Sala Constitucional: “De tal manera, es claro que la consideración del agua como recurso esencial y derecho fundamental, conlleva la necesaria protección de sus fuentes y de las áreas de captación, donde se consideran desde los mantos acuíferos subterráneos y superficiales, así como las nacientes, pozos y demás áreas desde las que se ubica y dispone del recurso hídrico” (ver resolución n.° 9221 de las 11:41 horas del 22 de mayo de 2019).

Se reclamó por quien apela que existe un informe emitido por un perito aportado por [...] R.L. que cuestionó los hallazgos de las inspecciones realizadas por el SINAC que no fue considerado en la decisión que se cuestiona, sin embargo, este fue analizado por la jueza de instancia y la principal conclusión a la que llega en la sentencia es a que, pese a lo estipulado en dicho documento, en efecto, legalmente se encuentra definido el ámbito de protección de los cuerpos de agua y, así la empresa interesada cuente con permisos otorgados para el aprovechamiento de aguas superficiales o para el desarrollo de actividad ganadera (lo que no se cuestiona), ello debe ser ejecutado bajo parámetros de observancia de los límites establecidos por la ley misma. El que la sociedad promovente cuente con permisos para la explotación de agua, revela sin más, que en la propiedad hay cuerpos de agua tal como lo constataron las inspecciones realizadas por el SINAC y por ello, la existencia de una trocha, la siembra de pasto no autóctono y la construcción de alcantarillado que no respeta los límites que corresponden, constituyen daño ambiental que, objetivamente, está obligado a reparar [...] R.L.

Así, no existen pruebas que desvirtúen los hallazgos de las inspecciones que realizaron a lo largo de trece años funcionarios del SINAC que constataron el daño ambiental, como bien lo apunta la sentencia venida en alzada, de modo que, la decisión de ordenar la restitución de las cosas a su estado original y procurar el restablecimiento del equilibrio ambiental, se encuentre debidamente sustentada en las probanzas evacuadas. De esta manera, declaro sin lugar el motivo de apelación que fuera planteado por falta de fundamentación del fallo y me separo del voto de mayoría que anula la resolución impugnada.

POR TANTO:

Por mayoría, se anula la sentencia impugnada número 10-2025 de las catorce horas dos minutos del trece de enero de 2025, dictada por el Tribunal de Juicio del I Circuito Judicial de la Zona Sur, sede Pérez Zeledón y el debate que la precedió. Asimismo, se ordena reenviar esta sumaria a conocimiento del a quo, para su nueva sustanciación conforme a derecho. En vista de lo resuelto, omite esta Cámara pronunciarse sobre los motivos alegados en los recursos de apelación interpuestos en esta causa. La jueza Sancho González, salva el voto. Notifíquese.- ???????????????
