ORDINARY PROCEEDING (proceso ordinario) filed by JUAN BAUTISTA GARCÍA RODRÍGUEZ, senior citizen (adulto mayor), farmer, resident of Osa, Puntarenas, national identity card number (cédula) six-one hundred two-four hundred fifty-two; against LESLIE SIMMONS CANNON, senior citizen, resident of San Francisco de Dos Ríos, national identity card number eight-zero zero ninety-four-seven hundred forty-nine. The latter has filed a counterclaim (reconvención) against the plaintiff. Acting as lead attorney (abogado director) for the plaintiff: Elian Jiménez Céspedes, bar registration number (colegiado) sixteen thousand nine hundred one; as public defender (defensor público) for the defendant: Andrés Zamora Solera. The opinion is authored by Judge Alpízar Rodríguez; and,
WHEREAS:
In the complaint, filed on January 6, 2021, the following is requested: "1- That the rulings issued in the Administrative Eviction proceeding by the Ministry of Public Security, in administrative case file number 1057-17, be annulled, and consequently, that the eviction order be rendered without effect. 2- That this Complaint be declared well-founded, and consequently, that I be declared the possessor with the superior possessory right (mejor derecho de posesión) over the disputed land. 3- That in the judgment, the Defendant be ordered to refrain from disturbing my possession, under warning that failure to comply will result in prosecution for the crime of disobedience to authority. 4- That the defendant be condemned to pay damages (daños y perjuicios) in the abstract, as well as procedural and attorney's fees (costas procesales y personales). SUBSIDIARY CLAIM: Should the principal claim not be declared in the judgment, I request as a subsidiary claim: That the Defendant be ordered to pay me the value of the useful and necessary improvements (mejoras útiles y necesarias) in the abstract; that I likewise be permitted to remove the purely ornamental materials I have placed on the land, both from December 1, 2009; with the right to retain the land in my possession until effective payment is made, and with a period of three months to remove all of the purely ornamental materials" (image 1 of the complete digital case file (expediente digital completo), downloaded from oldest to most recent, hereinafter EDC).
The complaint was answered in the negative, and the following affirmative defenses (excepciones) were raised: lack of legal right (falta de derecho), lack of standing as plaintiff and as defendant (falta de legitimación activa y pasiva) (image 48 EDC).
Leslie Simmons Cannon filed a counterclaim against Juan Bautista García Rodríguez. She requests that the following be declared: "The present action well-founded in all its claims, and the defenses raised by the defendant declared without merit. LESLIE SIMMONS CANNONS declared the sole possessor of the land at issue in this case. Restitution of possession of the area subject to the proceeding to LESLIE SIMMONS CANNNOS ordered. JUAN BAUTISTA GARCÍA RODRÍGUEZ ordered to vacate the property and to refrain from disturbing the possession of the land exercised by Leslie Simmons Cannons. The costs of the proceeding to be borne by Mr. Juan Bautista García Rodríguez." (image 53 EDC).
The plaintiff-counterdefendant (actor reconvenido) answered in the negative and raised the defenses of acquisitive prescription and extinctive prescription (prescripción positiva y negativa), and lack of legal right (image 284 EDC).
V.The amount in controversy was set at ¢15,000,000.00 (image 303 EDC). On October 26, 2021, the oral hearing (juicio verbal) was held and audio-recorded (see minutes: image 306 EDC).
VI.The Agrarian Tribunal of the Second Judicial Circuit of San José, Goicoechea, in Voto 132 of February 16, 2023, annulled the first-instance judgment 189 of March 28, 2022 (images 335 and 367 EDC).
Judge Maricel Zamora Arias, in judgment 285 of August thirty-first, 2023, ruled: "In accordance with the foregoing, the defenses of lack of legal right, lack of standing as plaintiff and as defendant raised by Ms. Leslie Simmons Cannon within this proceeding are upheld; consequently, THE ORDINARY AGRARIAN COMPLAINT FOR SUPERIOR POSSESSORY RIGHT filed by JUAN BAUTISTA GARCÍA RODRÍGUEZ against LESLIE SIMMONS CANNON IS DECLARED WITHOUT MERIT IN ALL ITS CLAIMS, both as to the principal claim and the subsidiary claim. As to costs, the plaintiff is condemned to pay both costs of this action. With respect to the counterclaim filed by LESLIE SIMMONS CANNON against JUAN BAUTISTA GARCÍA RODRÍGUEZ, the defenses of lack of legal right, acquisitive prescription, and extinctive prescription raised by defendant Juan Bautista García are rejected, and the counterclaim IS DECLARED WELL-FOUNDED as follows:
Regarding the matters under appeal, the list of proven facts from the judgment being challenged is adopted, with the modifications set forth below, as they are supported by the evidentiary record. However, the Court notes to the lower court that it is important, for a better understanding of what occurred and what was proved, that the facts be arranged preferably in chronological order, which was not done in this judgment. The following facts are modified as indicated, due to the need to specify relevant data in order to complete the statements:
To fact 2 the following is added: The remaining fifty percent of the possessory right belongs to the counterclaimant (reconventora) Leslie Simmons, as a co-possessor (coposeedora) of the land from the time she acquired it together with her ex-husband, in nineteen ninety-nine (add as evidentiary items: copies of deeds of sale (escrituras de compraventas) before notary Martin Mainieri Jiménez: images 180 and 186 EDC; testimony of Rafael García: audio-recorded).
To fact 4 the following is added: Rafael García Rodríguez was the person who watched over the disputed land, under assignment from Carlos Vargas and the defendant-counterclaimant, for several years before his brother Juan García was permitted to reside in the house existing thereon.
To fact 5 the following is added: The house was built before Juan García was permitted to enter the land to reside in it.
Fact seven is clarified as follows: Juan Bautista García Rodríguez entered the disputed land between the years two thousand thirteen and two thousand fourteen, to watch over the land and because he had no place to live, thanks to his brother Rafael García Rodríguez having allowed him to do so, since Rafael was the caretaker of the land possessed by Carlos Vargas and the defendant-counterclaimant, and had the latter's consent (see statement of Juan Bautista García, given on October 26, 2021, audio-recorded, and testimonial statement of Rafael García, audio-recorded). Assessment rationale (criterio de apreciación): Although the plaintiff states in his declaration that it was Carlos Vargas who allowed him entry — which he conveniently omitted from his complaint — it was proved that he actually entered because his brother Rafael, who was the caretaker of the farm, facilitated his access. Moreover, by making that statement, despite its inaccuracy, the plaintiff acknowledges that he knew the land belonged to another.
To fact 9 the following is added: Said land was described in cadastral plan P-one million one hundred eighty-one thousand six hundred twenty-eight-two thousand seven (P-1181628-2007).
The following facts of the same nature are added, given what is at issue in the proceeding and what is analyzed on appeal:
10. Carlos Vargas died in the year two thousand twelve (see second fact of the counterclaim: image 54 EDC; deed of adjudication (escritura de adjudicación) in notarial probate proceeding (proceso sucesorio notarial): image 107 EDC; statement of Sara Vargas Simmons: audio-recorded). Assessment rationale: uncontested fact; the deed of adjudication states that the notarial probate case file is from the year 2012, and the referenced witness, the deceased's daughter, confirmed he died that year. The appellant himself, in the appeal, confirms he died in August 2012.
11. In October two thousand twenty-one, the disputed land located in Los Mogos de Puerto Jiménez, which has a fairly extensive frontage on the road leading to that locality. The boundaries consist of old-looking fences or cleared lanes. There was a residential dwelling of old appearance, with cement-block walls and zinc roofing, and a cement floor. At the rear there is a shed with an earthen floor used as a kitchen; also a frame structure that the plaintiff stated was used in the past to keep pigs. There is a stream where a hydraulic ram (ariete) is installed that supplies water to the house, and a small area with crops of sweet potato, cassava, pineapple, and plantain. The rest of the farm is forested and the terrain is very rugged (see judicial inspection report (acta de reconocimiento judicial) and photographs: images 306 to 323). Assessment rationale: the report precisely describes what existed at that time on the land, and the photographs complement what was observed.
What is included in the judgment under appeal as unproven is adopted. The following facts of the same nature are added:
2. That Carlos Vargas or Leslie Simmons, prior to the year two thousand thirteen, ceased to watch over and maintain the disputed land. The plaintiff claims that it was "abandoned" and that he therefore entered in the year two thousand nine, of which no evidence exists. The witnesses offered by him have known the land only from approximately two thousand thirteen onward, and the documentary evidence submitted (receipts for surveillance payments made to Rafael García) confirms the contrary of what the plaintiff states.
The plaintiff-counterdefendant (actora-reconvenida) appeals. The arguments are summarized and organized as follows to facilitate their analysis, given their repetitive drafting. The appellant argues:
The appellant contends that none of those facts were mentioned either in the complaint or in the counterclaim. The trial court's jurisdiction is limited to the facts alleged by the parties, and as stated in the aforementioned Article 54, the court may not resolve matters beyond those in dispute. In addition to being contradictory, finding four states that Carlos Vargas Pizarro kept watch over the land through Rafael García Rodríguez, while finding seven states that the former brought the appellant to the property to care for the land. The appellant therefore asks: if the land was being watched by one of them, what role did Rafael García play? Another matter that the challenged judgment does not establish is the moment at which the appellant entered the property; if he did not do so as a possessor (poseedor), in what capacity did he enter? This is relevant because the defendant alleged that it had no contractual relationship with him.
Finally, finding eight of the judgment holds as proven that the defendant is the one who has possessed the land because she paid for surveillance and electricity service. But finding six states that she paid for surveillance in 2012, 2013, 2017, 2018, and 2020—not in 2014, 2015, or 2016. It must also be noted that Rafael García Rodríguez did not reside at the location of the property, since he lives in La Palma de Puerto Jiménez, more than 30 minutes away by vehicle, "no (sic) which means that he never exercised such surveillance over the property." The appellant, by contrast, did so, given that he lived in the house located on the land. Moreover, the possessory acts (actos posesorios) allegedly performed by the counterclaimant—as mentioned in the judgment—are civil possessory acts and not agrarian ones, such that it is the appellant who has in fact performed agrarian possessory acts. Yet those acts are not found proven, even though the testimonial evidence and the judicial inspection (reconocimiento judicial) "demonstrated as much" (sic).
For the foregoing reasons, the appellant considers that his right of defense was violated, given that he submitted evidence and legal arguments to prove the facts of his complaint and to oppose the counterclaim. But if the presiding judge finds other facts proven that were not contemplated in "both pleadings in the case file," this leaves him in a state of defenselessness (indefensión), since he had no opportunity to contest those facts or to offer rebuttal evidence.
But that individual never did so. The appellant was always the one present on the property. Witnesses Miguel Amador Vargas, Raúl Barquero Espinosa, and José Antonio Amador Vargas were consistent in stating as much. In any event, that constitutes a civil possessory act and not an agrarian one. Moreover, through the judicial inspection and the testimonial evidence, possession of the land was proven, because the appellant has ensured that no one cuts trees or engages in hunting, and he also maintains crops including sweet potato, cassava, plantain, pineapple, and others; he raises chickens and pigs; he clears trails (carriles); he built a shed that serves as a kitchen; and he lives in the house. He installed a hydraulic ram pump (ariete) that supplies water to the house and for the care of the animals (when he has them). All of this has occurred over 10 years, in a peaceful, continuous, uninterrupted manner, with the intent of ownership.
This is because when he entered, the land was abandoned, given that Carlos Vargas had not returned to the property and died on August 12, 2012. For that reason, the appellant considers that the trial court weighed the evidence erroneously by characterizing his possession as exercised in bad faith on the grounds that he entered the land with knowledge that it had been possessed by Carlos Vargas. However, the court did not analyze the fact that that individual had abandoned the land, that neither he nor his estate is a party to these proceedings, and that the appellant had no knowledge that Leslie had been awarded Carlos's possession right. In any event, by that time the right had already prescribed by extinctive prescription. Therefore, the defendant-counterclaimant fails to establish agrarian, ecological, or agro-environmental possessory acts, such as clearing and fencing (cercamiento), posting signs (rotulación), caring for the forest, or enrolling the land in the Pago de Servicios Ambientales program.
Nor does she establish that she possessed through mediate possession (posesión mediata) exercised by a caretaker. And if she paid Rafael García, that individual kept the money for himself, because he performed no possessory act on Leslie's behalf. As to the identity of the subject matter, that requirement is also not met. The challenged judgment identifies the land as that represented in cadastral plan (plano catastrado) P-1181628-2017, but the complaint alleges a superior right of possession over an unregistered property (finca sin inscribir) without a cadastral plan. It is in the counterclaim that that plan is used to identify the land. However, the counterclaimant also submitted document ORPN-OF-0101-2019 from the FONAFIFO Regional Office–Palmar Norte, dated April 3, 2019. That document literally states: "We hereby inform you that, upon reviewing your application for enrollment in the Pago de Servicios Ambientales Program Number PN01-0111-19, it was determined that the unregistered property depicted in plan P-1181628-2007 presents the following inconsistency: said plan overlaps by approximately 18.8 hectares with the unregistered property depicted in cadastral plan number P-287442-1995, located in Sierpe, Osa, Puntarenas, registered by Alfredo Rosales Rosales and currently titled in the name of Reforestadora Los Mogos de Osa S.A." This evidence was not weighed by the trial court, constituting a defect of insufficient evidentiary reasoning.
That evidence establishes that the property claimed by the defendant is not the same property possessed by the appellant, and that the current owner Reforestadora Los Mogos has not been a party to these proceedings. Accordingly, the requirement of identity of the subject matter—necessary to declare the publicidad (sic) well-founded—is not met. The prejudice consists of the erroneous weighing of testimonial and documentary evidence and the failure to weigh the referenced document; a defect that persists from the prior judgment. There is therefore an absolute nullity (nulidad absoluta).
This demonstrates that from August 2012 onward it was the appellant who possessed the land, since the person who had been exercising possession had died. By the time the defendant was awarded the right, it had already prescribed, more than 6 years having elapsed without its being exercised. Furthermore, the appellant's possession is in good faith, since he learned that the possessor of the land, Carlos Vargas, had died, and that the land had been abandoned since 2009. That is why he began his possession. In the final years, Carlos did not visit the property, and subsequently no person came forward claiming to be the owner. It was not until 2017 that an administrative eviction proceeding (proceso de desalojo administrativo) was initiated, but by that point the appellant's right of possession had already been established. The appellant considers that the challenged judgment improperly requires title and disregards the possessory acts he has exercised, in good faith and for more than one year, which constitute the title to his right in accordance with the statutory provisions alleged to have been violated.
XI.Ground on which invalidity of the judgment is claimed. In the second summarized point of the grievances, the express annulment of the challenged judgment is sought on the ground that there was disregard of evidence (preterición de prueba), in that official communication ORPN-OF-0101-2019 of the FONAFIFO-Palmar Norte Regional Office, dated April 3, 2019, was not weighed—a defect that the appellant claims persisted from the prior judgment. Article 592 of the Labor Code (Código de Trabajo), now repealed but applicable to this matter pursuant to Transitorio I of Ley 9343 of 25/01/2016 and by express reference of Article 60 of the Ley de Jurisdicción Agraria, requires that when an appeal is analyzed, the case file must first be reviewed to determine whether any procedural defect affecting the proceedings or the challenged ruling exists and must be corrected, if legally appropriate. Likewise, Article 26 of the Ley de Jurisdicción Agraria provides, in the relevant part: "When appropriate, the courts may, on their own motion, declare nullities and order the repetition of procedural steps in order to correct irregularities that could affect the validity of the proceedings." Accordingly, if it is found that a procedural step or requirement has been omitted in a manner capable of causing actual inability to mount a defense (indefensión), the first course of action must be to attempt to cure the defect, and only in cases that warrant it should the nullity of the acts and rulings be declared, to the extent necessary to restore the normal course of the trial.
Under these regulations, it has consistently been held that the declaration of procedural nullity (nulidad procesal) is appropriate only when it is absolutely indispensable in order to avoid inability to mount a defense or to restore the normal course of the proceedings, due to violation of essential procedural forms (Articles 31 through 33 of the Código Procesal Civil, applied supplementarily). The ground of nullity invoked by the appellant is not well taken. Disregard of evidence, as already explained in voto 132 of February 16, 2023 of this Tribunal, occurs when the adjudicator fails to weigh items of proof that appear in the record and were previously admitted, which could prove decisive for determining the outcome of the proceedings, such that, had they been analyzed and weighed, the legal reasoning of the ruling could have been different. This is a serious defect, given that admitted and produced evidence is left unanalyzed and unevaluated, which causes inability to mount a defense to the detriment of the party who offered that evidence, presenting it in order to prove the facts underlying the party's claim.
As a matter of due process, every adjudicator is required, when handing down a judgment, to analyze all admitted evidence in its entirety, setting forth the reasons why each item of proof is or is not useful for resolving the dispute (Article 39 of the Constitución Política; Article 54 of the Ley de Jurisdicción Agraria; Articles 2 and 31 through 33 of the Código Procesal Civil, applied supplementarily). In the appealed judgment, the referenced official communication—which was submitted by the counterclaimant (reconventora) and which provides information about inconsistencies in cadastral plan (plano) P-1181678-2007—is indeed not expressly analyzed. However, for the purposes of what was decided in the challenged judgment, it does not constitute an item of proof capable of changing the outcome. This is because, as is clarified therein, "...the cross-defendant (actor reconvenido) also submits as evidence ... a notarial certification that cadastral plan number P-1181678-2007 (sic); these two items of proof contribute nothing new to demonstrate that the possession alleged by the plaintiff is legitimate; the fact that a cadastral plan does not exist because it was cancelled does not prove anything in relation to the exercise of possession, and likewise the document described that Ms.
Leslie Simmons presents in order to request an administrative eviction is also not a suitable document to demonstrate that the cross-defendant's possession is legitimate possession" (image 393 EDC). Consequently, if for the plaintiff the cadastral plan referenced in the official communication he claims was not analyzed had been cancelled, that official communication was therefore of no relevance (image 102 EDC). Nor, as explained in the challenged judgment, is the appellant's position acceptable—namely, that the existence of that cadastral plan proved that the parcel sought by the defendant is not the same one he possesses. That judgment explains that the identity of the property in dispute (physical location of the parcel and its area) was duly established as proved, that there was no dispute between the parties on that matter, and that during the judicial site inspection (reconocimiento judicial) "...both parties were present and were able to complete the walkthrough, observing in general the identification of the parcel" (image 389 EDC).
The appellant does not challenge the outcome of that judicial site inspection with respect to the identity of the parcel (no objection in that regard appears in the record of proceedings or thereafter) (images 308 through 327 EDC); nor does he do so in the appeal, nor is any evidence submitted to discredit what was found proved on that basis. Finally, upon review of the formal aspects of the challenged judgment, it satisfies the legal requirements sufficiently to be considered valid. It is reasoned, as the court explains the grounds on which it finds the appellant's claim must be dismissed and the counterclaim upheld, particularly due to Mr. García's failure to prove that he possesses the disputed parcel in his own right. Nor is there any incongruence, given that all matters submitted for adjudication were resolved. The fact that the appellant disagrees with the decision and the manner in which it is reasoned is not grounds for nullity.
XII.Also, confusingly, in the first summarized allegation, it is argued that there is incongruence because there is no correspondence between the facts alleged in the complaint, the counterclaim, and what was found proved, since some facts that were held proved are ones the appellant asserts were not mentioned in either the complaint or the counterclaim. As explained in voto 132 of February 16, 2023 of this Tribunal, when the same allegation was resolved, that does not constitute incongruence (Article 54 of the Ley de Jurisdicción Agraria). Incongruence exists when "...a matter is decided in a manner different from or outside what was requested, but not because the facts found proved fail to correspond exactly to the factual framework (cuadro fáctico) set out in the complaint and the answer. The appellant is reminded that the factual framework of the judgment (facts proved and not proved), while it must be based on the facts presented by the parties, is drafted according to what is necessary to establish whether or not the substantive prerequisites of the procedural claim or claims to be resolved are met.
For this reason, the list of facts in the complaint or answer does not necessarily correspond to the factual framework of the judgment, since the parties sometimes include facts that are not relevant to the matter in dispute, and it is also common for them to refer to legal matters within the statement of facts" (image 372 EDC).
XIII.Before analyzing the substantive grievances as such, and given that virtually all of them challenge the manner in which evidence was weighed, it is important to bear in mind that Article 54 of the Ley de Jurisdicción Agraria establishes the system of free evaluation of evidence (libre valoración probatoria). This system requires the adjudicator to study and select the sources of proof obtained, in order to determine their effectiveness in resolving the dispute submitted for adjudication, through perception, representation or reconstruction, and deductive or inductive reasoning. It also entails an obligation to express the principles of equity or of law on which the adjudicator's assessment is based. "The system of free evaluation of evidence supersedes the classical system of fixed evidentiary standards (tarifa legal), as well as that of reasoned discretion (sana crítica), which govern civil proceedings.
The manner in which the agrarian process has been conceived allows the judge to broadly evaluate the facts alleged by the parties. This system is not arbitrary; on the contrary, in free evaluation of evidence, such evaluation must be reasoned, critical, and grounded in logic, experience, and psychology. In the reasoning of the ruling, the judge must set out the grounds of conviction that lead to a decision in the terms expressed. Unlike the system of fixed evidentiary standards, in which evidence is weighed subject to pre-established legal rules and even the admissibility of evidence must be previously specified by the Legal Order, under the system of free evaluation the judge is free to admit evidence at the judge's discretion" (voto 398 of 06.06.2001 of the Sala Primera and voto 3657 of 07.05.2003 of the Sala Constitucional, both of the Corte Suprema de Justicia. In the same vein: precedents 206 of 26.03.1999, 46 of 26.04.1995; 66 of 06.02.2009, and 364 of 28.05.2009 of this Tribunal).
Proved and unproved facts, in sound legal technique, are drafted on the basis of the prerequisites that must be met according to the procedural claims to be resolved. They may therefore be more or fewer than those contained in a complaint or counterclaim. What is required is that they be orderly, precise (one item of information per fact), complete, numbered, preferably sequenced in chronological order, and comprehensible. In this case, this Tribunal endorsed all of the facts held proved in the appealed judgment, with some modifications, because they are based on the evidence submitted and produced, the grounds for which were duly expressed by the court—grounds that this Tribunal shares and which will be analyzed below.
…Also fundamental is the testimony of Mr. Rafael García Rodríguez (brother of the plaintiff (actor)), who was the person who for years watched over the property in dispute (terreno en litis) from the neighboring farm (finca colindante). He states clearly in his statement (deposición) that it was following the Cinchona earthquake that he brought his brother Juan Bautista to the area, since the latter had nowhere to live, and that for this reason Juan Bautista moved into the small house on the property, which Mr. Carlos Vargas had built, with the understanding that he was not a hired farmhand (peón contratado) but was being permitted to live in that house. This occurred approximately in the year 2014 (see, in the same vein, the party statement under oath (confesional) of Mrs. Leslie Simmons)… The statements of witnesses Miguel Ángel Amador Vargas, José Amador Vargas, and Raúl Barquero Espinoza focus entirely on explaining the collaboration and assistance they have provided to Mr.
Juan Bautista García Rodríguez, and that they have only ever seen him working alone on the small plot of land, which does not establish the legitimacy of his possession (posesión)… As stated above, from the moment the plaintiff Juan Bautista García first entered the property, he has had full knowledge that the holders in possession (poseedores) of that property have been Mr. Carlos Vargas Pizarro together with his wife Mrs. Leslie Simmons; that they acquired this property in the nineteen-nineties and throughout all those years continued to visit the property at least once a year; that for the surveillance of the property they hired Mr. Rafael García Rodríguez; and that it is Mr. Rafael who put Mrs. Leslie Simmons in contact with the herein plaintiff Mr. Juan Bautista García… after Mr. Rafael García was no longer going to be working on the farm neighboring the property, he decided to allow his brother, the defendant Juan Bautista García, to enter the property so that the latter would have somewhere to live and so that there would also be someone on the property (see the witness testimony (testimoniales) of Leslie Simmons (sic), of Sara Vargas Vargas, and of Mr.
Rafael García Rodríguez, as well as the party statement of the plaintiff Mr. Juan Bautista García Rodríguez)." This Court agrees with the explanation provided by the Trial Court (Juzgado), given that the witness evidence (prueba testimonial) shows that the property in dispute was in the shared possession of Carlos Vargas and his wife Leslie Simmons from 1999, when they acquired it through two deeds of sale (compraventas). The second established fact (hecho probado) specifies that the cross-claimant (reconventora) acquired the remaining 50% of the area in dispute by adjudication (adjudicación) in the probate estate proceedings (sucesorio) of her former husband Carlos Vargas. For this reason, this Court added to that established fact that the other 50% of the possessory right (derecho posesorio) was already held by the cross-claimant Leslie Simmons. The Trial Court relies on the deed (escritura) in which that adjudication is evidenced, to which must be added the deeds of sale before notary Martin Mainieri Jiménez (images 13, 180 and 186 EDC) and the testimony of witness Rafael García (audio-recorded), without the validity of those instruments having been rebutted in these proceedings.
It was also established that Rafael García Rodríguez, brother of the cross-defendant plaintiff (actor reconvenido), lived on a neighboring farm, which is why Mr. Vargas and Leslie paid him to watch over their property, and there are also documents confirming those payments (images 58 to 99 EDC). Following the Cinchona earthquake (which occurred in 2009) and the death of Mr. Carlos Vargas (in 2012), Mr. Rafael García had to leave the area, and since his brother Juan García had nowhere to live, he asked the owners of the property in dispute to allow him to live in the house existing there. Leslie Simmons acknowledges that she authorized that arrangement, but due to the abuses being committed by the cross-defendant plaintiff, in 2017 she asked him to leave; as he did not do so voluntarily, she had to file an administrative eviction proceeding (desalojo administrativo), which was granted but not executed due to the amparo (constitutional rights remedy) filed by Juan García and the subsequent precautionary measure (medida cautelar) ordered in this ordinary civil proceeding (ordinario) (images 219 and 32.
EDC). With respect to the foregoing, witness Rafael García, as the Trial Court highlights, is key to clarifying what happened in this case. His testimony is credible and consistent with the documentary evidence (prueba documental). He essentially confirms the cross-claimant's position, which she expressed and maintained in her various written submissions and in her party statement (declaración de parte) (audio-recorded): that Juan García entered the property at his brother Rafael García's request because he had nowhere to live, and that she authorized him to stay in the house existing on the farm while she was not occupying it. As explained, Rafael García first watched over the property, and the cross-defendant plaintiff was then permitted to live in the house existing thereon, beginning around 2013/2014. Therefore, there is no contradiction in established fact four. Nor did the appellant (apelante) prove that Rafael García was a resident of another location before 2014 in a manner that would have prevented him from watching over the property.
On the contrary, it was established that he was paid to do so. In relation to the foregoing, Rafael testified, in summary, that he is Juan García's brother, that in 2021 he was living in La Palma de Puerto Jiménez, and that he is a farmer. He confirmed that he cared for a farm located next to the property in dispute from 1996. He also watched over the property in question at the request of Carlos Vargas, who had purchased it from some individuals he knew. He watched to make sure no people or animals entered, and because there was a house there that was standing empty. Around 2011 he brought his brother, who was in Cinchona following the earthquake, because his mother was worried about him. And in 2013/2014, since he had to return to La Palma, he arranged for his brother to stay as a caretaker (cuidador) on Leslie's farm. When he was told to leave, Juan refused and changed the padlock on the gate.
The house was built by Carlos. After Carlos died, Mrs. Leslie remained. He confirms that he received payments from her for watching the property and that she kept herself informed about the property. On the farm there was no work or clearing to do given what was there — there was very little to do — and he took care of it; when Juan was there he gave him money to do it. Juan kept some small pigs and planted a few small things; but he does not work the farm in exchange for payment, because he has his pension. From the money that Leslie gave him, he would pass a portion on to Juan, of his own initiative.
XV.Before analyzing the remaining grounds for appeal, and with regard to the prerequisites (presupuestos) of the actions at issue in this case, it is important to bear in mind that, based on the facts and claims set forth in the complaint, a declaratory action to establish certainty of possession (acción declarativa de certeza de posesión), an ancillary claim for damages and losses (daños y perjuicios), and a subsidiary claim for payment of improvements (mejoras) were all brought jointly. In the counterclaim (contrademanda), a Publician action (acción publiciana) — also known as an action for preferential right of possession (mejor derecho de posesión) — was brought, since restitution of an unregistered property (finca sin inscribir) is sought. These are similar actions that share certain prerequisites, both being related to the real right of possession (derecho real de posesión), given that the subject matter in dispute is an unregistered real property (inmueble sin inscribir).
However, they are legally distinct in terms of their purposes and the specific content of certain prerequisites. The first is restitutory and the second is merely declaratory. Accordingly, if the actions are admitted, the relief granted differs. Notwithstanding the mischaracterization made by the Juzgado in qualifying the action in the complaint as a Publician action, no prejudice or denial of due process (indefensión) resulted for the plaintiff, given that the claim was dismissed without that mischaracterization affecting the grounds of that decision in light of the explained differences between those two procedural actions. The main procedural actions referred to — contained in the complaint and in the counterclaim — concern the real right of possession, since the subject matter in litigation is an unregistered parcel of land: one is a declaratory action regarding the right of possession and the other is a Publician (restitutory) action.
It is therefore important to analyze their requirements and effects. Declaratory actions seek to confirm or establish a legal situation with respect to real rights — in this case, the right of possession. In other words, they seek a declaration that the claimant holds a real right, or a legal situation related to such rights, in order to silence the opposing party that disputes the property or seeks to arrogate that right or any of its attributes to itself. They do not involve dispossession, as they are preventive or defensive in nature. Such an action is grounded in the ability to exercise powers of exclusion and defense (articles 305, 306, 307 Código Civil, which are also applicable to the right of possession). The prerequisites that must be demonstrated for a declaratory action such as the one analyzed in this specific case to be granted are:
XVI.The second action brought — also a principal action — is restitutory in nature (article 322 Código Civil). In legal doctrine it is called a Publician action, and at the national level it is also known as an "action for preferential right of possession" (acción de mejor derecho de posesión). It serves to protect the legitimate possessor against the illegitimate one, with the aim of enabling that person to obtain restitution of the possession from which they have been unduly dispossessed, since their preferential right over a prior possessor is recognized (Sala Primera de la Corte Suprema de Justicia, Decision 168 of 06.06.1990). According to the Sala's criterion, that action lies when the matter involves restoring an unregistered real property from which the claimant has been unduly dispossessed and over which the claimant holds a right of possession (see Decisions 31 of 21.05.1993 and 13 of 25.03.1994; also from this Tribunal, precedent 708 of 15.11.1997).
It therefore shares similarities with the preceding action, as both concern the real right of possession, but their purposes differ, since the declaratory action does not seek restitution of the property — which is the hallmark of the Publician action. For this reason, some of the prerequisites are practically identical. In this regard, in addition to those already explained for the preceding action, the Publician action requires, for passive standing, that it be demonstrated that the defendant is an illegitimate possessor by having unduly dispossessed the plaintiff of possession or physical holding (tenencia) (articles 317, 318, 319 and 322, 277 and 286 Código Civil); and with respect to the prerequisite of current interest, at the time the complaint is filed and at the time the proceeding is resolved, the relief sought must not have been satisfied — that is, the plaintiff must not have recovered possession and physical holding over the claimed property.
If even one of the 5 requirements is not met, the complaint must be dismissed. It is further emphasized that this second action likewise protects the real right of possession, not the right of ownership (which is why it is incorrect to refer to ten years of possession). To hold the real right of possession over an unregistered real property, each and every one of the legal requirements previously cited must be met: public, continuous, peaceful, good-faith possession, held in the capacity of owner for more than one year, fulfilling the duties and rights that the social function entails according to the aptitude of the property, and a valid legal basis supporting how the right was acquired (articles 307 and 319 Código Civil, applied supplementarily). Unlike the real right of ownership, the real right of possession is subject to both positive and negative prescription, the period required in both cases being 1 year.
This is set forth in articles 277, 278, 279, 284, 860, 865 through 874 Código Civil. The following provisions are worth highlighting with regard to the time period: "277.- The right of possession consists of the power belonging to a person to hold a thing, the object of the right, under their control and will. 279.- Independently of the right of ownership, the right of possession is acquired: ... 2°.- By the right to maintain possession for more than one year. The year runs from the moment possession is taken publicly, or if it was taken clandestinely, from the moment this becomes known to the dispossessed party... 284.- For possession lasting more than one year to confer the right to possess, such possession must be in good faith. 860.- To acquire ownership of real property, or any real right thereover, by prescription, possession for ten years is required. The right to possess is prescribed by possession for one year" (underlining not in the original).
It is reiterated that the two actions analyzed are very similar, with analogous prerequisites, except that the first does not require a showing of dispossession (because the aim is merely to confirm who holds the legitimate right of possession and to defend that right against disturbing acts that do not amount to dispossession), whereas in the Publician action dispossession must exist, because restitution of the property is sought. However, for one school of legal doctrine, the action for preferential right of possession may be either declaratory or restitutory, given that its name creates confusion as to its effects.
XVII.The appellant (apelante) claims that Leslie Simmons cannot be considered a legitimate possessor (poseedora legítima) of the land—and therefore lacks standing to bring a claim (legitimación activa)—because she has not demonstrated any kind of agrarian possessory acts (actos posesorios agrarios), since what the judgment describes as acts she performed are civil possessory acts (actos posesorios civiles) and not agrarian ones; whereas he is the one who has exercised agrarian possessory acts. It was established that she deposited money to Rafael García to watch over the land, but the appellant says that Rafael never did so. Moreover, witnesses Miguel Amador Vargas, Raúl Barquero Espinosa, and José Antonio Amador Vargas consistently stated that he was the one present on the land. He also alleges that through the judicial site inspection (reconocimiento judicial) and testimonial evidence it was proven that he possesses the land, because he has ensured that no one cuts trees or hunts, and he also has crops such as sweet potato, cassava, plantain, pineapple, and others; he raises chickens and pigs; he clears paths (carriles), built a hut (rancho) that serves as a kitchen, and lives in the house; he installed a hydraulic ram pump (ariete) that supplies water to the house and for the care of the animals (when he has them).
All of this, he says, has been done for 10 years, peacefully, continuously, without interruption, as owner, because when he entered the land it was abandoned, since Carlos Vargas never returned to the place and died on 12 August 2012.
This ground of appeal is not well-founded. In addition to the documentary evidence (prueba documental) already cited—title deeds (escrituras) confirming how Carlos Vargas and Leslie Simmons came to own the disputed land and that, following the death of the former, it belongs entirely to the latter—the testimony of Rafael García and the daughter of the counter-claimant (reconventora), Sara Simmons, support the conclusion, as the trial court found, that Leslie Simmons is the rightful holder of the possessory right over the property (finca). The testimony of Rafael García has already been analyzed. Sara Vargas Simmons, the counter-claimant's daughter, a physician and resident of Miramar de Puntarenas, stated that she has known the land since she was 11 years old (born in 1985). She gave credible, reasonable testimony consistent with the rest of the evidence. She stated that her parents purchased the land even though they knew they did not hold title, but they knew the area and wanted to preserve it.
They visited on vacation, at least once a year, because it is a remote location. When she turned 22, around 2007, was the last time she stayed at the property; afterward they would visit the area but she would not stay on the land. At that time no one was settled there, though the house existed and no one was living in it. She knows that "Rafa" was the one who watched over it and maintained it, and they stayed once at the house where he looked after it. That was when she was about 25 years old, and on that occasion they walked the entire property. Her father visited it often on his own. Her parents separated. Her father died in 2012. After that, around 2014, they visited the property again. At first they had no problem with Juan, because he was supposed to be looking after it. But she did not visit the property because she felt unsafe and did not want her mother to visit it alone. After Juan arrived, he and Rafa—her brother—worked together assisting with the property, and her mother paid Rafa.
She confirms that Juan entered because Rafael had to leave the house he was caring for, and Rafael thought his brother could stay on the land to watch it and have a place to live. Both witnesses thus confirm what the counter-claimant said about how and what she has done to exercise possession over the land. Nor is it true that her possession was considered legitimate solely on the basis of proof that she paid Rafael for security services and the electricity service receipts. The appealed judgment explains at length that she is considered a legitimate possessor not only because she acquired the right in a valid manner, but because she exercised it—first with her ex-husband and later alone—openly, peacefully, continuously, unambiguously, and for more than fifteen years, before the problems with Juan García began. Both witnesses also confirmed that, given the nature of the property (which, according to the witnesses, borders MINAE land) and Leslie Simmons's commitment to environmental conservation, it was acquired for conservation purposes. For that reason, in Rafael García's words, it required "very little" maintenance; only watching to ensure that no people or animals entered.
XVIII.With respect to the testimony given by Miguel Amador Vargas, Raúl Barquero Espinosa, and José Antonio Amador, this Tribunal finds that the trial court was correct in determining in the appealed judgment that their testimony is not useful to resolve the case in favor of the plaintiff (actor). In that regard, it was stated: "The testimony of witnesses Miguel Ángel Amador Vargas, José Amador Vargas, and Raúl Barquero Espinoza focuses on explaining all the assistance and help they have provided to Mr. Juan Bautista García Rodríguez, and that they have only seen him working in the small plot of land, which does not establish the legitimacy of his possession" (image 387 EDC). Furthermore, according to their own statements, they came to know the plaintiff on the land starting around 2013, which confirms what witness Rafael Vargas stated—that it was in that year or 2014 that he allowed the plaintiff to remain on the land with the counter-claimant's consent.
Witness José Amador Vargas, it is noted, came to know the property starting in 2013 according to his testimony, and at that time the defendant in the counterclaim (actor reconvenido) was present there, from whom they bought produce; he kept chickens and they once bought a pig from him. What he knows about how Juan entered the land comes from what Juan himself told him: that he arrived after the Cinchona earthquake because he had nowhere to stay and that a Mr. Carlos gave him permission to be there. He knows that Juan cultivated cassava and plantain and built a small hut. He and his brother Miguel Amador helped him clear the paths and make improvements on the property.
Witness Miguel Ángel Amador Vargas, a vegetable vendor, states that he visits the land at least twice a week and that the only person he has seen there is Juan García, whom he has helped financially and in every way he can because Juan reminded him of his grandfather and because he saw him as being ill. He states he has accompanied him throughout the entire property in the work he does; he has seen him cultivating plantain, cassava, tiquisque, and sweet potato. He knows that the house on the property has water "from a hydraulic ram pump" and that he has helped pay the electricity bill for a few years. He does not know when the pump was installed; when he met Juan and the property, around 2012/2013, it was already there. He does not know how large the property is and has only seen Juan on it. He says he does not know Rafael García. He does not know why Juan entered the land; Juan only told him he did so after the Cinchona earthquake. He does not know with whom Juan had the conflict when the police came to evict him.
Witness Raúl Barquero Espinoza, a resident of San Vito, a farmer and Christian pastor, did not know the land; he only passed by once a week when selling vegetables, for about the past seven years (2014). He saw Juan on the land tending the existing crops, but does not know why he entered it.
As for the judicial site inspection, it is likewise not useful evidence for establishing the plaintiff's position, since it can only record what existed at that moment—in October 2021—as summarized in proven fact eleven, added in this judgment.
XIX.The appellant also claims that the trial court erroneously weighed the evidence by finding that he exercised possession in bad faith (mala fe), on the grounds that he entered the land knowing that it had been possessed by Carlos Vargas, without analyzing that Mr. Vargas had abandoned the land and that neither he nor his estate is a party to these proceedings, and furthermore that he had no knowledge that Leslie had been assigned Carlos's possessory right. This ground of appeal is not acceptable.
Possession in bad faith is that which is exercised with the knowledge that one is performing an act without the authorization of the appropriate party, whether or not that in some way prejudices the patrimonial interests of that other person. This occurs, for example, when one possesses property knowing it belongs to another; that possession is carried out without the required authorization; or that what has been authorized has been exceeded—either in time or in scope—(articles 285 and 286 of the Civil Code). This Tribunal notes that, according to the evidence analyzed, the plaintiff's account that he entered the land in 2009—as alleged in the first fact of the complaint (image 1 EDC)—is not credible. Conveniently, the cause of acquisition is not specified in that filing, and the trial court did not require clarification of this in a timely manner. It was not until the reply to the counterclaim (reconvención) (image 285 EDC) and in Juan García's own party statement (recorded in audio) that he claimed to have entered in 2009 because the land was "abandoned," and that he entered on that basis. In his party statement, he also claims that Carlos Vargas had authorized him to do so. None of this was proven.
On the contrary, the evidence establishes that he entered only in 2013/2014, after the death of Mr. Vargas, because he had nowhere to live, thanks to his brother asking the counter-claimant to allow him to stay in the existing house on the property in exchange for watching over it. Therefore, from the moment he entered, he knew the land belonged to another and the terms under which he was doing so (with the mere tolerance of its owner). Furthermore, his version of events is likewise not credible—that a piece of land as valuable as this one, given its forested nature and its location in Puerto Jiménez with frontage on the main public road leading to that locality, and which had a house on it, would have been abandoned in the manner he describes in his questionable party statement; he also failed to allege this in his complaint. In any case, having accepted that he knew the land belonged to Carlos Vargas from the moment he entered, that alone is sufficient reason to find that his bad faith is established, because he cannot afterward claim ignorance of that fact by justifying himself on the grounds that Mr. Vargas had abandoned the land.
XX.The appellant argues that by the time he learned that Leslie Simmons had been awarded Carlos Vargas's right of possession, negative prescription (prescripción negativa) had already run. The grievance is not well-taken. In the appealed judgment, this argument is rejected on the following grounds: "…In this case, two reasons lead to the rejection of this defense: the entirety of Mr. Juan Bautista's entry onto the property did not occur in the capacity of owner, and he entered by authorization of the property owners, the plaintiff-counterdefendant being fully aware of this situation, so that his (sic) possession has been neither in good faith nor in the capacity of owner; and furthermore, since 2017 Ms. Leslie Simmons has been attempting to recover possession of the property through the means the law places at her disposal, namely the administrative eviction (desalojo administrativo) procedure, so that the prescription period invoked by the plaintiff has not run, since his possession is tainted.
Finally, it may be affirmed that the three requirements for granting the action for better right of possession (mejor derecho de posesión) brought by Ms. Leslie are thus met" (imagen 396 EDC). Beyond what has been stated, contrary to what the appellant asserts, it was not proven that at any point the property—neither before 2009 nor thereafter—ceased to be in the possession, first, of Carlos Vargas and Leslie Simmons jointly, and, after 2012, of the latter alone. On the contrary, the evidence analyzed in prior considerandos demonstrated that they have exercised continuous, public, peaceful, and owner-title possession of said property ever since they acquired it in 1999. It was not until 2017 that the problem with the plaintiff-counterdefendant arose, owing to his refusal to vacate the property voluntarily. In response, the person who remained as its sole legitimate possessor—Leslie Simmons—resorted to the appropriate legal channels to obtain his removal: first by initiating an administrative eviction, and then by defending herself through a counterclaim (contrademanda) in these proceedings. There is therefore no possibility of applying, in this case and as explained in considerando XV of this judgment, negative prescription against Leslie Simmons (numerales 279 a 282 Código Civil).
XXI.The grievance regarding the alleged incorrect rejection of the defenses of positive prescription (prescripción positiva) and lack of standing of the "counterclaimant" (reconventora) is likewise inadmissible. The appellant bases this argument on the ground that the person appealing lacks title upon entering and possessing the property, which in his view means the trial court fails to recognize that title itself is possession, since this is a case of better right to possess rather than of ownership, and because from August 2012 onward he was the one possessing the property, given that the person previously exercising possession had died (numeral 279-2 Código Civil). It is unnecessary to repeat the reasons why, in this case, the argument put forward by Juan García—that he entered the disputed property in 2009 because it was abandoned—cannot be accepted. The opposite was demonstrated. As the trial court correctly notes, the plaintiff-counterdefendant's entry onto and continued presence in the property was never in his own name, that is, in his own favor, because he remained there by the tolerance of its owners, who allowed him to inhabit the house from 2013/2014 onward.
He therefore always had full knowledge that the property belonged to another. This prevents him from legitimately acquiring a real right of possession over that unregistered property through adverse possession (usucapión) and, consequently, he holds no right that can be asserted against the counterclaim.
XXII.Finally, the appellant claims that Article 509 of the Código Civil was disregarded, because the subsidiary claim for payment of improvements should not have been rejected. In his view, the judicial inspection established that the property contained plantings of sweet potato, pineapple, plantain, and yuca, as well as a shed serving as the kitchen of the house, which gives rise to unjust enrichment (enriquecimiento sin causa) in favor of the defendant. The grievance is not well-taken. In the challenged judgment, this argument is rejected on the following grounds: "The plaintiff also presents a subsidiary claim consisting of the following: That the defendant be ordered to pay me the value of useful and necessary improvements (mejoras útiles y necesarias) in the abstract, that I likewise be permitted to remove purely ornamental materials I have placed on the property, both from December 1, 2009 onward, with the right to retain the property in my possession until effective payment is made and with a three-month period to remove all purely ornamental materials.
This claim must also be rejected in its entirety, because the evidence offered and produced by both parties did not establish that Mr. Juan Bautista García had made useful and necessary improvements to the property; the small house on the property was established to have existed before Mr. Juan Bautista entered the property; no permanent crops were observed during the judicial inspection proceeding; the majority of the farm consists of forest, which is conserved and maintained; and neither the testimonial nor the documentary evidence offered by the plaintiff (sic) establishes that improvements were introduced from an agrarian standpoint, so this claim must also be rejected" (imagen 389 EDC). Apart from the fact that the plaintiff did not specify in his complaint what he was seeking to be compensated for as "improvements"—which he should have done to guarantee due process for the opposing party, without the trial court having timely required him to cure this deficiency—this Tribunal agrees with the conclusion reached in the challenged judgment that it is not possible in this case to order payment for "improvements," not even in the abstract.
In this regard, as established in proven fact eleven, added by this Tribunal, the disputed property is almost entirely forested in nature. The old house that exists on the property was not built by Juan García. As for the plantings he claims to have made, in addition to the fact that—as has been established—they cover a very small area and are not permanent or semi-permanent crops, they are evidently for his own consumption and subsistence. The witnesses Miguel Amador Vargas, Raúl Barquero Espinosa, and José Antonio Amador, offered by the plaintiff, were clear about Juan García's poor economic situation, to the point that they felt compelled to help him with food and seeds so that he could plant something. And what is referred to as the "shed for a kitchen," described in the judicial inspection as a storage area used for that purpose, would not give rise to a right of compensation as an improvement, being a simple structure incorporated by the plaintiff that was not proven to be made of permanent materials or to be permanent in nature.
Nor would compensation be available on a theory of accession, since he may remove the materials and take them with him when he vacates the property (numerales 330 a 332 y 508 Código Civil). There is therefore no erroneous decision on this matter that generates unjust enrichment in favor of the counterclaimant.
XXIII.In accordance with the foregoing, the appealed judgment shall be confirmed with respect to the matters that were the subject of the appeal.
NOTE BY JUDGE FISHER GONZÁLEZ: The undersigned Judge concurs with the resolution reached in the specific case. However, it is necessary to make certain clarifications regarding the prescription (prescripción) of the possessory right (derecho de posesión). It is true that Article 860 of the Código Civil provides that the possessory right is extinguished by another person's one-year possession, but that period does not operate as a forfeiture of the right when one is dealing with a ten-year possession capable of ripening into acquisitive prescription (usucapión). This is so because if a person has exercised possession of an unregistered parcel (fundo no inscrito) for ten years, in a quiet, public, peaceful, continuous, good-faith manner and in the capacity of owner, what exists is no longer merely a possessory right but a more fully qualified form of possession. On this point, the Sala Constitucional had long held, with regard to unregistered parcels, that once acquisitive prescription has consolidated, the right of ownership is acquired as an original mode of acquisition (modo originario), in such a way that it is distinguished from the possessory title proceeding (información posesoria) as an instrument for formalizing that right so that it may be registered, while proceeding from the premise that the right is already consolidated.
In that regard, the Sala Constitucional stated: "(…) IV.- GENERAL REGIME OF ACQUISITIVE PRESCRIPTION: At the outset, it should be noted that the possessory title proceedings (diligencias de información posesoria) regulated by the Ley de Informaciones Posesorias No.139 de 14 de julio de 1941 and its amendments constitute a non-contentious judicial procedure through which a title to real property (bienes inmuebles) registrable in the Registro Público is formalized. In general, this procedure is intended to enable possessors who lack a title registrable in the Registro Público to obtain one. Article 1 of that Law provides that, in order for a possessor of real estate (bienes raíces) to request the issuance of a title based on the possessory title proceeding, the possessor must demonstrate possession for more than ten years under the conditions set forth in Article 856 of the Código Civil, namely: in the capacity of owner, continuous, public, and peaceful.
The foregoing requirements of time and condition characterize the possession necessary to achieve acquisitive prescription. To obtain ownership of real property by acquisitive prescription, in addition to possession under the stated conditions, Article 853 of the Código Civil requires: a deed conveying ownership (título traslativo de dominio) and good faith. From the foregoing, and from the provisions of Article 8 of the Ley de Informaciones Posesorias, which characterizes the possessory title proceeding as a non-contentious judicial process—in which the emergence of a claim or opposition by any person or by the State causes the matter to be suspended and referred to the declaratory proceeding for discussion and resolution, or the file to be archived and the administrative avenue deemed exhausted, respectively—it follows that the titling (titulación) of real property requires the prior acquisition of ownership.
That is to say, a distinction is drawn between the moment of acquisition of ownership through acquisitive prescription and the moment at which that situation is asserted in the possessory title proceeding in order to obtain a registrable title in the Registro Público. Hence, acquisitive prescription is considered a mode of acquiring ownership and other possessable real rights, and titling is regarded as the procedure by which, once the requirements of acquisitive prescription have been verified, a registrable title to ownership is conferred. (…) The possessory right may be acquired independently of full ownership (dominio pleno) under certain circumstances regulated by the Código Civil in Article 279—by consent of the owner, by the fact of retaining possession for more than one year, and because the law authorizes the creditor to retain the debtor's property or orders that all or some of the debtor's assets be transferred to a depositary.
The possessory right in general is composed of two elements: the corpus and the animus. The first refers specifically to the material fact of having the thing subjected to the power—action—and will of a person, and the second relates to an internal aspect that guides the possessor. To these elements must be added other special circumstances that the law requires for possession to be effective for acquisitive prescription. In that sense, possession ad usucapionem is a more rigorous or qualified form of possession that differs from the generic form. The requirements that the law imposes for possession to be apt for acquisitive prescription are regulated in Article 856 of the Código Civil" (emphasis not in the original. Sentencia No. 04587-97 de las quince horas cuarenta y cinco minutos del cinco de agosto de mil novecientos noventa y siete). In light of these considerations, it cannot be stated as a general proposition that, in the case of an unregistered parcel, the possessory right is lost by the mere circumstance of another person exercising possession for one year (Articles 279 and 284 of the Código Civil), since if the prior possessor had consolidated acquisitive prescription, that possessor clearly holds a superior right and a more qualified form of possession.
That said, in the present case, the appellant did not demonstrate having had or exercised a ten-year possession ad usucapionem, or that possession was held in the capacity of owner; therefore, the vote on the merits is concurred in, but with the present note regarding prescription of the possessory right, given the general statement made in the decision regarding that legal institution.

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las veinte horas cincuenta y cinco minutos del trece de agosto de dos mil veinticinco.- PROCESO ORDINARIO interpuesto por JUAN BAUTISTA GARCÍA RODRÍGUEZ, adulto mayor, agricultor, vecino de Osa, Puntarenas, cédula seis-ciento dos-cuatrocientos cincuenta y dos; contra LESLIE SIMMONS CANNON, adulta mayor, vecina de San Francisco de Dos Ríos, cédula ocho-cero cero noventa y cuatro-setecientos cuarenta y nueve. La anterior presenta reconvención contra la parte actora. Actúa como abogado director del actor: Elian Jiménez Céspedes, colegiado dieciséis mil novecientos uno; como defensor público de la parte demandada: Andrés Zamora Solera. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores.
Redacta la jueza Alpízar Rodríguez; y,
CONSIDERANDO:
En la demanda, incorporada el 6 de enero 2021, ser pide: «1-Se anulen resoluciones dictadas en el proceso de Desalojo Administrativo por el Ministerio de Seguridad Pública, en el expediente administrativo número: 1057-17, en consecuencia, se deje sin efecto la orden de desalojo. 2- Que se declare con lugar esta Demanda y en consecuencia se declare que soy el Poseedor con mejor derecho del terreno en litis. 3- Que en sentencia se ordene a la Demandada abstenerse a (sic) perturbar mi posesión, bajo el apercibimiento de que en caso contrario será juzgada por el delito de desobediencia a la autoridad.4- Se condene a la demandada al pago de los daños y perjuicios en abstracto; así como al pago de las costas procesales y personales. SUBSIDIARIA: En caso de no declarar en sentencia la pretensión principal, solicito como Pretensión subsidiaria: Se ordene a la Demandada pagarme el valor de las mejoras útiles y necesarias en abstracto, así mismo se me permita retirar los materiales de puro adorno que he colocado en el terreno ambos desde el 01 de Diciembre del 2009; con derecho a retener el terreno en mi poder hasta su efectivo pago, y con plazo de tres meses para retirar la totalidad de los materiales de puro adorno» (imagen 1 del expediente digital completo, descargado del archivo más antiguo al más reciente, en adelante EDC).
Se contestó negativamente la demanda y se interpusieron las excepciones de falta de derecho, falta de legitimación activa y pasiva (imagen 48 EDC).
Leslie Simmons Cannon contrademandó a Juan Bautista García Rodríguez. Solicita se declare: «Con lugar la presente acción en todos sus extremos y sin lugar las excepciones que oponga la parte demandada. Se declare como única poseedora del terreno objeto en litis a LESLIE SIMMONS CANNONS. Se ordene la restitución de la posesión del área objeto del proceso a LESLIE SIMMONS CANNNOS. Se ordene a JUAN BAUTISTA GARCÍA RODRÍGUEZ desocupar el inmueble y abstenerse de perturbar la posesión del terreno ejercida por Leslie Simmons Cannons. Sean las costas del proceso a cargo del señor Juan Bautista García Rodríguez.» (imagen 53 EDC).
El actor reconvenido contestó de forma negativa e interpuso las excepciones de prescripción positiva y negativa, falta de derecho (imagen 284 EDC).
V.La cuantía del proceso se fijó en ¢15000000.00 (imagen 303 EDC). El 26 de octubre 2021 se realizó el juicio verbal y se grabó en audio (ver minuta: imagen 306 EDC).
VI.El Tribunal Agrario de Segundo Circuito Judicial de la San José, Goicoechea, en voto 132 del 16 de febrero 2023 anuló la sentencia de primera instancia 189 del 28 de marzo 2022 (imágenes 335 y 367 EDC).
La jueza Maricel Zamora Arias, en sentencia 285 del treinta y uno de agosto 2023 resolvió: «De conformidad con lo expuesto se acogen las defensas de falta de derecho, falta de legitimación activa y pasiva que interpone la señora Leslie Simmons Cannon dentro de este proceso, en consecuencia se DECLARA SIN LUGAR EN TODOS SUS EXTREMOS LA demanda Ordinaria agraria de Mejor derecho de posesión que interpone JUAN BAUTISTA GARCÍA RODRÍGUEZ en contra de LESLIE SIMMONS CANNON. Tanto en su pretensión principal como la subsidiaria. En cuanto a costas se condena al actor al pago de ambas costas de esta acción. En relación con la reconvención planteada por la señora LESLIE SIMMONS CANNON en contra de JUAN BAUTISTA GARCÍA RODRÍGUEZ, se rechazan las excepciones de falta de derecho, prescripción positiva y prescripción negativa que interpone el demandado Juan Bautista García, la misma se DECLARA CON LUGAR de la siguiente forma:
En relación con lo apelado, se comparte del elenco de hechos probados de la sentencia recurrida, con las modificaciones que se dirán, por tener sustento en los elementos probatorios. Pero se hace ver al Juzgado que es importante, para una mejor comprensión de lo sucedido y probado, que se ordenen preferiblemente de manera cronológica, lo cual no se cumple en esta sentencia. Se modifican como siguen los siguientes hechos, por faltar precisar datos relevantes para completar los enunciados:
Al 2 se agrega: El restante cincuenta por ciento del derecho posesorio pertenece a la reconventora Leslie Simmons, como coposeedora del terreno desde que lo adquirió con su exesposo, en mil novecientos noventa y nueve (agregar como elementos probatorios: copias de escrituras de compraventas ante notario Martin Mainieri Jiménez: imágenes 180 y 186 EDC; testimonial de Rafael García: grabada en audio).
Al 4 se añade: Rafael García Rodríguez era quien vigilaba el terreno en litigio, por encargo de Carlos Vargas y la demandada reconventora, desde varios años antes de que se le permitiese a su hermano Juan García habitar la casa existente en tal.
Al 5 se adiciona: La casa se construyó antes de que se permitiese a Juan García ingresar al terreno para habitar en ella.
El sétimo se aclara como sigue: Juan Bautista García Rodríguez ingresó al terreno en litigio, entre los años dos mil trece y dos mil catorce, para vigilar el terreno y porque no tenía donde vivir, gracias a que su hermano Rafael García Rodríguez se lo permitió, por ser el cuidador del terreno que poseían Carlos Vargas y la demandada reconventora y contar con la anuencia de la segunda (ver declaración de Juan Bautista García, rendida el 26 de octubre 2021 y grabada en audio y declaración testimonial de Rafael García, grabada en audio).. Criterio de apreciación: Si bien el actor afirma en su declaración que quien lo ingresó fue Carlos Vargas, lo cual convenientemente no dijo en su demanda, se probó que en realidad ingresó por habérselo facilitado su hermano Rafael, quien era el cuidador de la finca. Pero, además, el actor con esa manifestación, pese a su inexactitud, acepta que sabía que el terreno era ajeno.
Al 9 se agrega: Dicho terreno se describió en el plano catastrado P-un millón ciento ochenta y un mil seiscientos veintiocho-dos mil siete (P-1181628-2007).
Se adicionan de igual naturaleza, por lo que es objeto de debate en el proceso y también por lo que se analiza en la apelación:
Se comparte lo incluido en la sentencia apelada como no demostrado. Se agregan de igual naturaleza:
La parte actora-reconvenida apela. Se resumen y ordenan sus alegatos como sigue, para facilitar su análisis, dada su reiterada redacción. Alega: 1) Existe violación del artículo 54 Ley Jurisdicción Agraria, 39 y 41 constitucionales, por incongruencia entre los hechos de la demanda, reconvención y la sentencia e inconformidad con los hechos tenidos por demostrados. La sentencia impugnada no tiene congruencia entre los hechos demandados y reconvenidos y los tenidos por demostrados en el considerando segundo. Objeta el segundo, el tercero y el cuarto, en los cuales se indica que Leslie Simons adquirió en proceso sucesorio el 50% de los derechos de posesión sobre el terreno en litigio; que quien apela tenía conocimiento, previo a su ingreso en el terreno, que lo poseía Carlos Vargas Pizarro y que tal señor tenían como vigilante en el lugar a Rafael García. También rechaza el quinto y el séptimo, que dicen que la casa la construyó Carlos Vargas Pizarro y que el apelante ingresó al inmueble porque ese señor lo llevó para que lo cuidara.
Sostiene que ninguno de esos hechos fueron mencionados ni en la demanda ni en la reconvención. El Juzgado tiene limitada su competencia a los hechos alegados por las partes, y como dice el artículo 54 mencionado no pueden resolver más cuestiones que las debatidas. Además de ser contradictorios, en el hecho cuarto se indica que Carlos Vargas Pizarro vigilaba el terreno por medio de Rafael García Rodríguez, y en el siete se dice que el primero llevó al apelante para que cuidara el terreno. Cuestiona entonces ¿si el terreno lo vigilaba él o Rafael García? Otro aspecto que no establece la sentencia impugnada es el momento en que él ingresó al terreno; si no lo hizo como poseedor ¿en qué condición lo hizo? Esto por cuanto la parte demandada alegó que no tenía ningún vínculo contractual con él. Por último, en el hecho ocho de la sentencia se tiene por probado que la demandada es quien ha poseído el terreno porque pagó la vigilancia y el servicio de electricidad.
Pero en el hecho sexto se dijo que pagó la vigilancia en los años 2012, 2013, 2017, 2018 y 2020. No lo hizo entonces en 2014, 2015 y 2016. Debe tenerse además presente que Rafael García Rodríguez no vivía en el lugar donde está el terreno, porque habita en La Palma de Puerto Jiménez, a más de 30 minutos en vehículo, “no (sic) que significa que nunca ejerció tal vigilancia sobre el inmueble”. Mientras que él sí lo hizo, dado que vivía en la casa que está en el terreno. Pero, además, los actos posesorios que supuestamente hizo la demanda reconventora -mencionados en la sentencia-, son actos posesorios civiles y no agrarios, de manera que es él quien si ha ejercido actos posesorios agrarios. Pero no se tienen por demostrados, aún y cuando la prueba testimonial y el reconocimiento judicial “así lo demostraron” (sic). Por lo explicado, considera se le violentó su derecho de defensa, porque se aportó prueba y fundamentos legales para demostrar los hechos de la demanda y oponerse a la reconvención.
Pero si la persona juzgadora tiene por demostrados otros hechos no contemplados en “ambas piezas del expediente” le deja en indefensión, al no tener oportunidad para oponerse a esos hechos y ofrecer prueba de descargo.
En todo caso eso es un acto posesorio civil y no agrario. Además, mediante el reconocimiento judicial y la prueba testimonial se probó la posesión del terreno, porque ha vigilado que nadie corte árboles, realice cacería y además tiene cultivos como camote, yuca, plátano, piña y otros; cría gallinas y cerdos; limpia carriles, hizo un rancho que funcionan como cocina y habita en la casa. Instaló un ariete que proporciona agua a la casa y para el cuidado de los animales (cuando los tiene). Todo eso durante 10 años, en forma pacífica, continua, ininterrumpida, a título de dueño. Porque cuando ingreso estaba en abandono, dado que Carlos Vargas no volvió al lugar y murió el 12 de agosto 2012. Por eso considera que el Juzgado valoró erróneamente la prueba, al tener su posesión como ejercida de mala fe, por haber ingresado al terreno con conocimiento de que había sido poseído por Carlos Vargas. Pero no analizó que ese señor había abandonado el terreno y que ni él ni su sucesión son parte en este proceso.
Y que no tuvo conocimiento que Leslie se adjudicara el derecho de posesión de Carlos. En todo caso, para ese momento ya estaba prescrito negativamente. Por ello la demandada reconventora no logra acreditar los actos posesorios agrarios, ecológicos o agroambientales, como limpieza y cercamiento, rotulación, cuido del bosque o someter el terreno al pago de servicios ambientales. Tampoco de que poseyera a través de una posesión mediata ejercida por un encargado del cuido. Y si le pagó a Rafael García, ese señor se dejó el dinero, porque no realizó ningún acto posesorio en nombre de Leslie. En cuanto a la identidad de la cosa tampoco se cumple. Se identifica en la sentencia impugnada el terreno como representado en el plano catastrado P-1181628-2017, pero en la demanda se alega el mejor derecho de posesión sobre un terreno sin inscribir y sin plano catastrado. Es en la reconvención que se usa ese plano para identificar el terreno.
Pero también ofreció la reconventora el oficio ORPN-OF-0101-2019 de la Oficina Regional FONAFIFO-Palmar Norte, fechado 3 de abril 2019. En tal literalmente se indica: “Se le comunica que revisada su solicitud de ingreso al Programa del Pago de Servicios Ambientales Número PN01-0111-19, se determinó que la finca sin inscribir, graficada mediante plano P-1181628-2007, presenta la siguiente inconsistencia: dicho plano presentan traslape de 18.8 Ha aproximadamente con la finca sin inscribir, graficada mediante plano catastrado número P-287442-1995, ubicado en Sierpe, Osa, Puntarenas, inscrito por Alfredo Rosales Rosales y con actual dueño a nombre de Reforestadora Los Mogos de Osa S.A.”. Esta prueba no fue valorada por el Juzgado, lo que ocasiona el vicio de falta de fundamentación probatoria. Con esa prueba se acredita que el terreno que pretende la demandada no es el mismo poseído por quien apela.
Y que el actual dueño Reforestadora Los Mogos no ha sido parte en este proceso. Por ello no se cumple con el requisito de identidad de la cosa, necesario para declarar con lugar la publicidad (sic). El perjuicio consiste en la errónea valoración de la prueba testimonial y documental y en no valorarse el oficio referido; vicio que subsiste de la sentencia anterior. Por ello existe nulidad absoluta.
Para cuando la demandada se adjudica el derecho, ya estaba prescrito, por haber transcurrido más de 6 años sin que se ejercitara. Además, su posesión es de buena fe, porque tuvo noticia de que el poseedor del terreno Carlos Vargas falleció, pero desde el 2009 quedó abandonado. Por eso inició su posesión. En los últimos años Carlos no llegó al terreno y luego, no se presentó alguna persona alegando ser la dueña. Es hasta el 2017 que se inició el proceso de desalojo administrativo, pero para ese entonces ya su derecho de posesión estaba constituido. Considera que la sentencia impugnada requiere un título y desconoce los actos posesorios ejercidos por él, de buena fe y por más de un año, lo que constituye el título de su derecho, de conformidad con las normas indicadas como violadas.
XI.Motivo con base en el cual se reclama invalidez de la sentencia. En el segundo punto resumido de los agravios, se pide expresamente la nulidad de la sentencia impugnada, por considerar existe preterición de prueba, al no valorarse el oficio ORPN-OF-0101-2019 de la Oficina Regional FONAFIFO-Palmar Norte, fechado 3 de abril 2019, vicio que afirma subsiste de la sentencia anterior. El numeral 592 del Código de Trabajo derogado, aplicable a este asunto según Transitorio I de la Ley 9343 de 25/01/2016, por remisión expresa del artículo 60 de la Ley de Jurisdicción Agraria, impone que al analizarse una apelación debe primero revisarse el expediente, para determinar si existe algún vicio procesal que afecte el proceso o la resolución impugnada, que deba ser subsanado, si es pertinente legalmente. Asimismo, el artículo 26 Ley de Jurisdicción Agraria, en lo que interesa dispone: "Cuando sea del caso, los tribunales podrán, por iniciativa propia, declarar nulidades y disponer la reposición de trámites, a fin de corregir irregularidades que pudieran afectar la validez del proceso ".
Por ende, si se encontrase que se ha omitido algún trámite o requisito, capaz de causar efectiva indefensión, debe primero intentarse subsanar el defecto y solo en casos que lo ameriten, decretar la nulidad de las actuaciones y resoluciones, hasta donde sea necesario para orientar el curso normal del juicio. Al amparo de dichas regulaciones, se ha mantenido el criterio de que la declaratoria de nulidad procesal procede solo cuando sea absolutamente indispensable su pronunciamiento, para evitar indefensión o para orientar el curso normal del procedimiento, por violación a formas esenciales en el trámite (artículos 31 a 33 Código Procesal Civil, aplicados supletoriamente). El motivo de nulidad invocado por la parte recurrente no es de recibo. La preterición de prueba, como ya se explicó en el voto 132 de 16 de febrero 2023 de este Tribunal, acontece cuando la persona juzgadora omite valorar probanzas que constan y fueron admitidas previamente, que puedan resultar fundamentales para la determinación del resultado del proceso, de forma tal que, si se hubiesen analizado y valorado, la motivación jurídica del fallo podría ser distinta.
Se trata de un vicio grave, dado que se omite valorar y analizar toda la prueba admitida y evacuada, lo cual produce indefensión en perjuicio de la parte oferente de la prueba, que aporta el elemento omitido con el fin de probar los hechos en que funda su acción. Por debido proceso, es obligación de toda persona juzgadora al dictar la sentencia, analizar la prueba admitida en forma integral, expresando las razones por la cual los elementos probatorios resultan útiles o no para resolver el conflicto (artículos 39 Constitución Política, 54 Ley de Jurisdicción Agraria, 2, 31 a 33 Código Procesal Civil, aplicado supletoriamente). En la sentencia apelada ciertamente no se analiza expresamente el oficio referido, que fue aportado por la parte reconventora y, en el cual se da información sobre inconsistencias del plano P-1181678-2007. Pero para efectos de lo decidido en la sentencia impugnada, no constituye un elemento probatorio que pueda variar el resultado.
Esto por cuanto, tal se aclara que “…el actor reconvenido también aporta como prueba … una certificación notarial de que el plano número P-1181678-2007 (sic), estas dos pruebas no aportan nada nuevo que demuestre que la posesión que alega el actor sea legítima, el hecho de que un plano no exista porque fue cancelado no demuestra nada en relación con el ejercicio de la posesión, e igualmente el documento descrito que presenta la señora Leslie Simmons para solicitar un desalojo administrativo, tampoco es un documento idóneo para demostrar la posesión del actor reconvenido como una posesión legítima” (imagen 393 EDC). Por consiguiente, si para el actor el plano al que se alude en el oficio que reclama no se analizó, había sido cancelado, no resultaba entonces de interés dicho oficio (imagen 102 EDC). Tampoco, como se explicó en la sentencia impugnada, es aceptable la posesión del apelante de que la existencia de ese plano probase que el terreno que pretende la demandada no es el mismo que él posee.
En dicha sentencia se explica que se tuvo por demostrada debidamente la identidad del bien en litigio (ubicación material del terreno y su extensión), que no existió controversia entre las partes por ese tema y que durante el reconocimiento judicial “… ambas partes estuvieron presentes y pudieron hacer el recorrido, observando en general la identificación del terreno” (imagen 389 EDC). No objeta al respecto el apelante el resultado de esa prueba de reconocimiento judicial en cuanto a la identidad del terreno (no consta en el acta ni posteriormente reclamo alguno en ese sentido) (imágenes 308 a 327 EDC); tampoco lo hace en el recurso ni se aporta prueba que permita desacreditar lo tenido por probado con base en ello. Finalmente, revisada la forma de la sentencia impugnada, cumple los requisitos de ley de manera suficiente para ser considerada válida. Está fundamentada, al explicar el Juzgado los motivos por los cuáles considera debe rechazarse la demandada del apelante y acogerse la contrademanda, especialmente por no probar el señor García ser poseedor a título propio del terreno en litigio.
Tampoco existe incongruencia, dado que se resolvieron todos los temas sometidos a conocimiento. El que la parte recurrente no comparta lo decidido y la forma como se fundamenta no es motivo de nulidad.
XII.También confusamente en el primer alegato resumido, se alega que existe incongruencia, porque no existe identidad entre los hechos de la demanda, la reconvención y lo tenido por demostrado, dado que se tuvieron por hechos probados algunos que asegura no fueron mencionadas ni en la demanda ni en la reconvención. Como se explicó en el voto 132 del 16 de febrero 2023 de este Tribunal, al resolverse igual alegato, eso no es incongruencia (artículo 54 Ley Jurisdicción Agraria). Tal existe cuando “…se resuelve en forma distinta o fuera de lo pedido, pero no porque los hechos probados no corresponda con exactitud al cuadro fáctico contenido en la demanda y contestación. Se aclara a la parte recurrente, el cuadro fáctico de la sentencia (hechos probados y no probados), si bien debe basarse en los hechos presentados por las partes, se redacta en función de lo que es necesario para tener por demostrados o no los presupuestos de fondo de la acción o acciones procesales por resolver. Por ello, no necesariamente el elenco de hechos de la demanda o contestación corresponde al cuadro fáctico de la sentencia, dado que en ocasiones las partes incluyen hechos que no son relevantes para lo debatido y también es frecuente que se refieran a aspectos jurídicos dentro de los hechos” (imagen 372 EDC).
XIII.Antes de analizar los agravios de fondo propiamente y dado que en prácticamente todos se objeta la forma como se valoró la prueba, es importante tener presente que el numeral 54 Ley de la Jurisdicción Agraria establece el sistema de la libre valoración probatoria. Ello exige a la persona juzgadora estudiar y seleccionar las fuentes de prueba obtenidas, a fin de establecer su eficacia para resolver el conflicto sometido a su conocimiento, a través de la percepción, la representación o reconstrucción y el razonamiento deductivo o inductivo. También implica que debe expresar los principios de equidad o de derecho sobre los cuales basa su criterio. "El sistema de la libre valoración de la prueba supera el clásico sistema de la prueba legal, así como el de la sana crítica, que rigen en el proceso civil. La forma como ha sido concebido el proceso agrario le permite al juez valorar ampliamente los hechos alegados por las partes.
Dicho sistema no es arbitrario, por el contrario, en la libre valoración de la prueba la misma deber ser razonada, crítica, basarse en la lógica, la experiencia y la sicología. En la motivación del fallo el juez debe exponer los motivos de convicción que lo llevan a resolver en los términos que lo hace. A diferencia del sistema de tarifa legal, en el cual las pruebas se aprecian con sujeción a reglas legales previas, e incluso la admisibilidad de pruebas debe estar previamente señalado por el Ordenamiento Jurídico, en el sistema de libre apreciación el juez tiene libertad para admitir pruebas conforme a su criterio” (voto 398 de 06.06.2001 de la Sala Primera y 3657 del 07.05.2003 de la Sala Constitucional, ambas de la Corte Suprema de Justicia. En igual sentido precedentes 206 de 26.03.1999, 46 del 26.04.1995; 66 del 06.02.2009 y 364 de 28.05.2009 de este Tribunal).
Los hechos probados y no probados, en buena técnica jurídica, se redactan con base en los presupuestos que tienen que cumplirse según las acciones procesales a resolver. Por ello pueden ser más o menos que los contenidos en una demanda o reconvención. Lo que se exige es que sean ordenados, precisos (un dato por hecho), completos, numerados, preferiblemente secuenciados en orden cronológico y comprensibles. Es el caso, este Tribunal avaló todos los hechos tenidos por demostrados en la sentencia apelada, con algunas modificaciones, porque se basan en la prueba aportada y evacuada, cuyos fundamentos fueron debidamente expresados por el Juzgado, razones que este Tribunal comparte y que se analizarán luego.
“…También es fundamental la declaración del señor Rafael García Rodríguez (hermano del actor), quien era la persona quien por años vigilo desde la finca colindante el terreno en litis, es claro en señalar en su deposición que es a partir del terremoto de Cinchona que él se trae a su hermano Juan Bautista para la zona, ya que no tenía donde vivir, y por esta razón el ingresa a vivir en la casita que hay en el terreno, la cual la hizo el señor Carlos Vargas, en el entendido de que no era un peón contratado sino que se él estaba permitiendo vivir en esa casa, esto ocurre aproximadamente en el año 2014 (ver en este mismo sentido confesional de la señora Leslie Simmons)… Las declaraciones de los testigos Miguel Ángel Amador Vargas, José Amador Vargas y Raúl Barquero Espinoza, se centran en explicar en toda la colaboración y ayuda que le han prestado al señor Juan Bautista García Rodríguez, y que únicamente lo han visto trabajar a él en el terrenito, lo cual no demuestra le legitimidad de su posesión…
Como se dijo anteriormente el actor Juan Bautista García desde que ingreso por primera vez en el terreno ha tenido pleno conocimiento de que los poseedores de ese terreno lo han sido el señor Carlos Vargas Pizarro conjuntamente con su esposa la señora Leslie Simmons, que este terreno lo adquirieron ellos desde los años noventa y durante todos esos años se mantuvieron visitando el terreno al menos una vez al año, que para la vigilancia del terreno contrataron al señor Rafael GarcÍa Rodríguez, y es don Rafael quien pone en contacto a doña Leslie Simmons con el aquí actor señor Juan Bautista García… luego de que don Rafael García ya no iba estar trabajando en la finca cercana al terreno, decide permitir que el hermano de don Rafael García, el demandado Juan Bautista García ingrese en el terreno para que tuviera donde vivir y a su vez hubiera alguien en el terreno (ver testimoniales de Leslie Simmons (sic), de Sara Vargas Vargas y de don Rafael García Rodríguez, así como la confesional del actor señor Juan Bautista García Rodríguez)”.
Este Tribunal comparte lo explicado por el Juzgado, dado que de la prueba testimonial se desprende que el terreno en litigio estuvo en posesión compartida de Carlos Vargas y su esposa Leslie Simmons desde 1999, cuando lo adquirieron a través de dos compraventas. En el hecho segundo hecho probado se precisa que la reconventora adquirió el restante 50% del área en litigio por adjudicación en el sucesorio de su exesposo Carlos Vargas. Por ello este Tribunal agregó a ese hecho, que el otro 50% del derecho posesorio ya era de la reconventora Leslie Simmons. El Juzgado se basa en la escritura en que se comprueba esa adjudicación, a lo que se deben agregar las escrituras de compraventas ante el notario Martin Mainieri Jiménez (imágenes 13, 180 y 186 EDC) y lo declarado por el testigo Rafael García (grabado en audio), sin que se desvirtuase en este proceso la validez de dichos actos. También se probó que Rafael García Rodríguez, hermano del actor reconvenido, vivía en una finca vecina, motivo por el cual los señores Vargas y Leslie le pagaban para que vigilara su terreno, de lo cual existen también documentos que confirman los pagos (imágenes 58 a 99 EDC).
Luego del terremoto de Cinchona (ocurrido en el 2009) y del fallecimiento del señor Carlos Vargas (año 2012), el señor Rafael García debe irse del lugar y dado que su hermano Juan García no tiene donde vivir, solicita a los dueños del terreno en litigo que le permitan vivir en la casa existente ahí. Leslie Simmons acepta que ella autorizó dicha situación, pero debido a los abusos que estaba cometiendo el actor reconvenido, en el año 2017 le solicitó irse del lugar; como no lo hizo voluntariamente, tuvo que interponer un procedimiento de desalojo administrativo, el cual fue acogido, pero no se ejecutó por el amparo interpuesto por Juan García y luego la medida cautelar resuelta en este ordinario (imágenes 219 y 32. EDC). Sobre lo indicado, el testigo Rafael García, como lo resalta el Juzgado, es fundamental para dilucidar lo sucedido en este caso. Su declaración es creíble y concordante con la prueba documental.
Básicamente confirma la posición de la parte reconventora, que ella expresó y mantuvo en sus diversas gestiones escritas y en su declaración de parte (grabada en audio), sobre haber ingresado Juan García a solicitud de su hermano Rafael García, porque no tenía donde vivir y que autorizó se quedase en la casa existente en la finca, mientras ella no la ocupase. Conforme lo explicado, primero vigiló el terreno Rafael García y luego se le permitió al actor reconvenido vivir en la casa existente en tal, a partir de los años 2013/2014. Por consiguiente, no existe contradicción en los hechos probados cuatro. Tampoco se probó el apelante que Rafael García fuese vecino de otro lugar antes del 2014, lo que le impidiese vigilar el terreno. Por el contrario, se probó que se le pagó por ello. En relación con lo indicado, Rafael declaró, en resumen, ser hermano de Juan García, vivir en el 2021 en La Palma de Puerto Jiménez y ser agricultor.
Confirmó que cuidó una finca ubicada a la par del terreno en litigio desde el año 1996. También vigiló la finca en discusión por encargo de Carlos Vargas, quien la compró a unos señores que él conoció. Vigilaba que no se metiera gente o animales y porque existía una casa, que estaba sola. Como en el 2011 se trajo a su hermano, que estaba en Cinchona, luego del terremoto, porque su mamá estaba preocupada por él. Y en el 2013/2014, dado que se tenía que devolver para La Palma, él gestionó para que su hermano se quedara como cuidador en la finca de Leslie. Cuando se le dijo que saliera, Juan no quiso hacerlo y cambió el candado del portón. La casa la hizo Carlos. Luego de que murió Carlos, quedó doña Leslie. Confirma que recibió pagos de ella por la vigilancia y que ella se mantenía al tanto del terreno. En la finca no se trabajaba o limpiaba por lo que había, era poco lo que había que hacer y él se encargaba de hacerlo; cuando estuvo Juan le daba dinero para que lo hiciera.
Juan tuvo unos chancitos y sembró unas cosillas; pero no trabaja la finca para que le paguen, porque él tiene su pensión. Del dinero que Leslie le daba él le daba a Juan una parte, por iniciativa de él.
XV.Antes de analizar los restantes agravios, al referirse a presupuestos de las acciones debatidas en el caso, es importante tener presente que, de acuerdo con los hechos y pretensiones de la demanda, se plantearon conjuntamente una acción declarativa de certeza de posesión, una acción accesoria de daños y perjuicios y una acción subsidiaria de pago de “mejoras”. En la contrademanda se planteó una acción publiciana (conocida también como de mejor derecho posesión), dado que se pide la restitución de una finca sin inscribir. Se trata de acciones similares, que comparten algunos presupuestos por estar relacionadas ambas con el derecho real de posesión, al ser el objeto de lo debatido un inmueble sin inscribir. Pero jurídicamente son diferentes por sus fines y el contenido específico de algunos presupuestos. La primera es restitutiva y la segunda es solamente declarativa. Por ello, de admitirse las acciones, las condenas son diferentes.
Pese a el error de calificación que hizo el Juzgado al calificar la acción de la demanda como publiciana, no existe perjuicio ni indefensión para la parte actora, dado que fue declarada sin lugar, sin que incidiese en los fundamentos de esa decisión las diferencias explicadas respecto de esas dos acciones procesales. Las acciones procesales principales referidas, contenidas en la demanda y en la contrademanda, versan sobre el derecho real de posesión, al ser el objeto en litigio un terreno sin inscribir: una declarativa del derecho de posesión y una publiciana (restitutoria). Por ello es importante analizar sus requisitos y efectos. En las acciones declarativas se pretende comprobar o fijar una situación jurídica, en relación con derechos reales, en este caso el de posesión. Es decir, obtener la declaración de que se es titular de un derecho real o de una situación relacionada con tales, para acallar a la parte contraria que discute el bien o quiere arrogarse ese derecho o alguno de sus atributos.
No implica despojo, pues es preventiva o defensiva. Dicha acción se fundamenta en la posibilidad de ejercer las potestades de exclusión y defensa (artículos 305, 306, 307 Código Civil, aplicables también al derecho de posesión). Los presupuestos que deben demostrarse para que proceda declarar con lugar una acción declarativa como la analizada en este caso en concreto, son:
XVI.La segunda acción planteada y también principal es de carácter restitutorio (numeral 322 Código Civil). En doctrina se le denomina publiciana y en el ámbito nacional se le conoce también como “acción de mejor derecho de posesión”. Tiende a tutelar a la persona poseedora legítima frente a la ilegítima, con el objeto de que logre la restitución de la posesión de la que ha sido indebidamente despojada, dado que se reconoce su derecho preferente respecto de una poseedora anterior (Sala Primera de la Corte Suprema de Justicia, voto 168 de 06.06.1990). De acuerdo con el criterio de la Sala, esa acción procede cuando se trata de restituir un bien inmueble no inscrito, del cual se ha sido indebidamente despojado, y sobre el cual quien restituye ostenta un derecho de posesión (ver votos 31 de 21.05.1993 y 13 de 25.03.1994. También de este Tribunal, el precedente 708 de 15.11.1997). Guarda entonces similitud con la anterior, al versar ambas sobre el derecho real de posesión, pero sus fines son diferentes, al no pretenderse en la declarativa de certeza la restitución del bien, lo que es característico de la publiciana.
Por ello algunos de los presupuestos son prácticamente iguales. Al respecto, adicional a los antes explicados para la anterior acción, en la publiciana se requiere para la legitimación pasiva se demuestre que la parte demandada es poseedora ilegítima por haber despojado en forma indebida la posesión o tenencia de la actora (artículos 317, 318, 319 y 322, 277 y 286 Código Civil); en el presupuesto del interés actual, a la fecha de plantearse la demanda y resolverse el proceso, no debe haberse satisfecho la pretensión planteada; es decir, la parte actora no debe haber recuperado la posesión y el ejercicio de la tenencia sobre el bien reclamado. Con solo que uno de los 5 requisitos no se cumpla, la demanda resulta improcedente. Se resalta, además, que también en esta segunda acción se tutela el derecho real de posesión, no el de propiedad (dominio) (por ello es incorrecto referirse a diez años de posesión).
Para ostentar el derecho real de posesión sobre un bien inmueble sin inscribir se requiere entonces cumplir todos y cada uno de los requisitos legales antes citados: posesión pública, continua, pacífica, de buena fe, a título de persona dueña por más de un año, cumpliendo con los deberes y derechos que la función social conlleva según la aptitud del inmueble y causa jurídica válida que fundamente cómo se adquirió el derecho (artículos 307 y 319 Código Civil, aplicado supletoriamente). A diferencia del derecho real de dominio, el de posesión es prescriptible positiva y negativamente, siendo el plazo exigido en ambos supuestos de 1 año. Así lo disponen los artículos 277, 278, 279, 284, 860, 865 a 874 Código Civil. Vale destacar en cuanto al plazo los siguientes: “277.- El derecho de posesión consiste en la facultad que corresponde a una persona de tener bajo su poder y voluntad la cosa objeto del derecho. 279.- Independientemente del derecho de propiedad, se adquiere el de posesión: … 2º.- Por el derecho de conservar la posesión por más de un año.
El año corre desde que se tome públicamente la posesión, o si fuere tomada clandestinamente, desde que eso conste al despojado… 284.- Para que la posesión por más de un año confiera el derecho de poseer, es necesario que dicha posesión sea de buena fe. 860.- Para adquirir la propiedad de los inmuebles, o algún derecho real sobre ellos por prescripción, se necesita una posesión de diez años. El derecho de poseer se prescribe por la posesión de un año” (lo subrayado no es del original). Se reitera, son las dos acciones analizadas muy parecidas, con presupuestos similares, solo que la primera no exige que se demuestre un despojo (porque se pretende solo confirmar quien es la persona titular legítima del derecho de posesión y defenderle contra acciones perturbadoras, que no implican despojo) y en la publiciana si debe existir despojo, porque se pretende la restitución del bien. Sin embargo, para un sector de la doctrina, la acción de mejor derecho de posesión puede ser tanto declarativa como restitutiva, dado que esa denominación genera confusión sobre sus efectos.
XVII.Reclama el apelante que Leslie Simmons no puede ser considerada poseedora legítima del terreno (y por ende carece de legitimación activa) por no haber demostrado ningún tipo posesión agraria, porque lo mencionado en la sentencia que ella hizo son actos posesorios civiles y no agrarios; mientras que él es quien, si ha ejercido actos posesorios agrarios. Se estableció ella depositaba un dinero a Rafael García para que vigilara que el terreno, pero el apelante dice que Rafael nunca lo hizo. Aparte de que, los testigos Miguel Amador Vargas, Raúl Barquero Espinosa y José Antonio Amador Vargas fueron contentes con indicar que él era quien estaba en el terreno. Además, alega, mediante el reconocimiento judicial y la prueba testimonial se probó su posesión sobre el terreno, porque ha vigilado que nadie corte árboles, realice cacería y además tiene cultivos como camote, yuca, plátano, piña y otros; cría gallinas y cerdos; limpia carriles, hizo un rancho que funcionan como cocina y habita en la casa; instaló un ariete que proporciona agua a la casa y para el cuidado de los animales (cuando los tiene).
Todo eso, dice, durante 10 años, en forma pacífica, continua, ininterrumpida, a título de dueño, porque cuando ingreso estaba en abandono, dado que Carlos Vargas no volvió al lugar y murió el 12 de agosto 2012. El agravio no es de recibo. Además de la prueba documental ya citada (escrituras), que confirma cómo Carlos Vargas y Leslie Simmons llegaron a ser dueños del terreno en litigio y que luego de la muerte del primero le pertenece totalmente a la segunda, las declaraciones de Rafael García y la hija de la reconventora, Sara Simmons, permiten concluir, como lo hizo el Juzgado, que Leslie Sinmons es la titular legítima del derecho de posesión sobre tal. La testimonial de Rafael García ya fue analizada. Sara Vargas Simmons, hija de la reconventora, médico, vecina de Miramar de Puntarenas, dijo conocer el terreno desde que tenía 11 años (nació en 1985). Rindió una declaración creíble, razonable y concordante con la restante prueba.
Indicó que sus papás lo compraron, a pesar de que sabían que no tenían título, pero conocían la zona y querían preservarlo. Lo visitaban en vacaciones, por lo menos 1 vez al año, porque quedar en un lugar lejano. Cuando cumplió 22 años, como en el 2007, fue la última vez que se quedó en la finca, pero luego visitaban la zona, aunque no se quedaba en el terreno. En ese entonces no había nadie instalado; pero si existía la casa, aunque no vivía nadie. Sabe que “Rafa” era quien les cuidaba y daba mantenimiento y se quedaron una vez en la casa donde él cuidaba. Eso fue cuando ella tenía como 25 años y en esa ocasión recorrieron la finca. Su papá si la visitaba mucho solo. Sus papás se separaron. Su padre murió en el año 2012. Luego de eso, como en el 2014, visitaron de nuevo la finca. Al principio con Juan no tuvieron problema, porque se suponía que estaba para cuidar. Pero no visitaba la finca porque se sentía insegura ni quería que su madre la visitara sola.
Luego de que llegó Juan, él y Rafa -su hermano- trabajaron en conjunto asistiendo la finca y su mamá le pagaba a Rafa. Confirma que Juan ingresó porque Rafael se tenía que ir de la casa que cuidaba y él pensó que su hermano podía quedarse en el terreno a cuidarlo y para tener donde vivir. Ambas personas testigos ratifican entonces lo dicho por la reconventora sobre cómo y que ha hecho para ejercer la posesión sobre el terreno. Tampoco es cierto que únicamente se tuviese por legítima su posesión por haberse probado que ella pagaba a Rafael por vigilancia y los recibos del servicio eléctrico. En la sentencia apelada se explica ampliamente que se considera poseedora legítima porque no solo adquirió el derecho de manera válida, sino que lo ejercieron (primero con su exesposo y luego solo Leslie), de forma pública, pacífica, continua, sin equívocos y por más de quince años, antes de empezar a tener problema con Juan García.
Incluso, ambos testigos confirmaron que dada la naturaleza del terreno (que colinda con el Minae según los testigos) y la vocación ambiental de Leslie Simmons, se adquirió para conservarlo. Por ello, en palabras de Rafael García, había que hacerle “muy poco”; solo vigilar que no se metieran personas y animales.
XVIII.Con respecto a lo declarado por Miguel Amador Vargas, Raúl Barquero Espinosa y José Antonio Amador, considera este Tribunal lleva razón el Juzgado al valorar en la sentencia apelada que sus testimonios no son útiles para resolver a favor del actor. Se indicó al respecto: “Las declaraciones de los testigos Miguel Ángel Amador Vargas, José Amador Vargas y Raúl Barquero Espinoza, se centran en explicar en toda la colaboración y ayuda que le han prestado al señor Juan Bautista García Rodríguez, y que únicamente lo han visto trabajar a él en el terrenito, lo cual no demuestra le legitimidad de su posesión” (imagen 387 EDC). Además, conforme a lo que declaran, conocen en el terreno al actor a partir del año 2013 aproximadamente, lo que confirma lo dicho por el testigo Rafael Vargas que fue para ese año o el 2014 en que él facilitó al actor permanecer en el terreno con anuencia de la reconventora.
El testigo José Amador Vargas, se resalta, conoce la finca a partir del año 2013 según su declaración y que para ese año en ella estaba el actor reconvenido, a quien le compraban productos; tuvo gallinas y una vez le compraron un cerdo. Lo que sabe sobre Juan ingresó al terreno, es porque él le dijo que llegó luego del terremoto de Cinchona, porque no tenía donde estar y que un señor Carlos le dio permiso de estar ahí. Sabe que hizo cultivos de yuca, plátano y una ranchita. Él y su hermano Miguel Amador le ayudaron a limpiar los carriles y a realizar arreglos en la finca. El testigo Miguel Ángel Amador Vargas, vendedor de verduras, indica que al menos dos veces por semana visita el terreno y que a quien ha visto en tal es a Juan García, a quien le ha ayudado económicamente y en todo lo que puede porque le recordaba a su abuelo y porque lo veía enfermo. Indica lo ha acompañado por toda la finca en las labores que hace; lo ha visto cultivando plátano, yuca, tiquisque, camote.
Conoce que la casa de la finca tiene agua “de un ariete” y la luz tiene dice que él la ha ayudado a pagarla desde hace unos años. No sabe cuándo se puso el ariete; cuando conoció a Juan y a la finca, en el 2012/2013, ya estaba ahí. No sabe cuánto mide el terreno y solo a Juan ha visto en el terreno. Dice no conocer a Rafael García. No sabe por qué Juan ingresó al terreno; tal solo le contó que lo hizo luego del terreno de Cinchona. No sabe con quién fue el conflicto que tuvo Juan, cuando la policía llegó para desalojarlo. El testigo Raúl Barquero Espinoza, vecino de San Vito, agricultor y pastor cristiano. No conocía el terreno, solo pasaba una vez por semana cuando vendía verdura, desde hace unos siete años (2014). Veía en el terreno a Juan, haciendo los cultivos existentes, pero no sabe por qué ingresó en él. Y con respecto al reconocimiento judicial, tampoco es prueba útil para demostrar la posición del actor, pues en tal, realizado en octubre 2021, solo se puede constatar lo que existe en ese momento, conforme se resumió en el hecho probado once, agregado en esta sentencia.
XIX.También reclama el apelante que el Juzgado valoró erróneamente la prueba, al tener su posesión como ejercida de mala fe, por haber ingresado al terreno con conocimiento de que había sido poseído por Carlos Vargas, sin analizarse que ese señor había abandonado el terreno y que ni él ni su sucesión son parte en este proceso, además de que no tuvo conocimiento que Leslie se adjudicara el derecho de posesión de Carlos. Lo agraviado no es aceptable. La posesión de mala fe es aquella que se realiza conociendo que se está ejecutando un acto sin la autorización de quien corresponde, ya sea que eso perjudique o no de alguna manera la esfera patrimonial de esa otra persona. Ello sucede, por ejemplo, cuando se posee y se sabe que el bien es ajeno; que se realiza sin la autorización debida o que se ha excedido lo autorizado (temporal o espacialmente) (numerales 285 y 286 Código Civil). Este Tribunal resalta que, conforme a la prueba analizada, no es creíble la posición del actor de que ingresó al terreno en el 2009, según lo que se afirma en el hecho primero de la demanda (imagen 1 EDC).
Convenientemente se omite especificar en tal acto la causa de adquisición, sin que el Juzgado haya prevenido su aclaración oportunamente. Es hasta la contestación de la reconvención (imagen 285 EDC) y en su declaración de parte de Juan García (grabada en audio), que tal afirma que ingresó en el año 2009 por estar “abandonado” el terreno y que ingresó luego de eso. En su declaración de parte afirma, además, lo había autorizado para hacerlo Carlos Vargas. Nada de ello fue demostrado. Por el contrario, la prueba acredita que ingresó hasta el año 2013/2014, luego de fallecer el señor Vargas, por no tener donde vivir, gracias a que su hermano le pidió a la reconventora que lo dejara estar en la casa existente en la finca a cambio de que la vigilara. Por ende, desde que ingresó sabía que el terreno era ajeno y en qué condición lo hacía (con la mera tolerancia de su persona dueña). Además, no es creíble tampoco su versión de que un terreno tan valioso al ser de naturaleza boscosa y ubicarse en Puerto Jiménez, con frente a la calle pública principal que lleva a esa localidad, que tenía una casa, quedase abandonado en la forma como lo expresa en su cuestionable declaración de parte; además de haber omitido expresar eso en la demanda.
En todo caso, al haber aceptado que sabía que el terreno era de Carlos Vargas desde que ingreso, eso es motivo suficiente para tener por configurada su mala fe, porque no puede después pretender ignorar que sabe eso, justificándose en que ese señor dejó abandonado el terreno.
XX.Alega el apelante que para cuanto tuvo conocimiento de que Leslie Simmons se adjudicó el derecho de posesión de Carlos Vargas, para ese momento ya estaba prescrito negativamente. El agravio no es de recibo. En la sentencia apelada se rechaza el tema con base en lo siguiente. “…En este caso dos razones llevan al rechazo de esta defensa que todo el ingreso del señor Juan Bautista no se da en calidad de dueño, e ingresa por la autorización de los dueños del terreno, teniendo pleno conocimiento el señor actor reconvenido de esta situación por lo cual seu (sic) posesión no ha sido ni de buena fe, ni en calidad de dueño, y además que desde el año 2017 la señora Leslie Simmons está intentando recuperar la posesión del terreno, por las vias que la ley pone a su disposición con la figura del desalojo administrativo, por lo cual no ha operado el plazo de prescripción que alega el actor, pues su posesión esta viciada.
Finalmente puede afirmase que se configuran así los tres presupuestos para acoger la acción de mejor derecho de posesión que interpone la señora Leslie” (imagen 396 EDC). Aparte de lo indicado, contrario a lo que afirma el apelante, no se probó que en algún momento el terreno, ni antes del año 2009, ni luego de eso, haya dejado de estar en posesión primero de Carlos Vargas y Leslie Simmons de manera conjunta, y luego del año 2012, únicamente de la segunda. Por el contrario, en la prueba analizada en considerandos anteriores, se demostró que ellos han ejercido una posesión continua, pública, pacífica y a título de dueños sobre tal inmueble desde que lo adquirieron, en 1999. Es hasta el año 2017 que se presenta el problema con la parte actora reconvenida, por no querer retirarse del inmueble de manera voluntaria. Ante ello, la persona que quedó como su legítima poseedora total -Leslie Simmons- acudió a las vías pertinentes para lograr su retiro: primero al plantearse un desalojo administrativo y luego, al defenderse con una contrademanda en este proceso.
No existe entonces posibilidad de aplicar en este caso, conforme lo explicado en el considerando XV de esta sentencia, la prescripción negativa en contra de Leslie Simmons (numerales 279 a 282 Código Civil).
XXI.No es admisible tampoco el agravio referido a que se rechazaron incorrectamente las excepciones de prescripción positiva y de falta de derecho de la “reconventora”, con base en que quien apela carece de título al ingresar y poseer el terreno, por lo que con ello desconoce el Juzgado que el título es la posesión misma, pues se está en un caso de mejor derecho de poseer y no de propiedad y porque desde agosto 2012 en adelante él era quien poseía el terreno, porque quien lo venía ejerciendo falleció (numeral 279-2 Código Civil). Es innecesario reiterar las razones del porque en este caso no es aceptable lo argumentado por Juan García sobre que el ingresó al terreno en litigio en el año 2009 por estar abandonado. Se demostró todo lo contrario. Como bien lo señala el Juzgado, el ingreso y permanencia del actor reconvenido en el terreno nunca fue a nombre propio, es decir, a su favor, porque se mantuvo en tal por tolerancia de sus dueños, desde que le permitieron habitar la casa a partir del año 2013/2014. Tuvo entonces siempre pleno conocimiento de que el terreno era ajeno. Ello impide que pueda adquirir legítimamente derecho real de posesión sobre ese inmueble sin inscribir a través de la usucapión y, por ende, no ostenta derecho que pueda oponer a la reconvención.
XXII.Finalmente, reclama el apelante que se inobservó el artículo 509 Código Civil, porque no debió rechazarse la pretensión subsidiaria, referida al pago de mejoras. Para él, con el reconocimiento judicial se acreditó que existían en el terreno plantaciones de camote, piña, plátano y yuca y un rancho que sirve como cocina de la casa, lo cual genera enriquecimiento sin causa a favor de la demandada. El agravio no es de recibo. En la sentencia recurrida se rechaza el tema con base en lo siguiente. “El señor actor plantea también una pretensión subsidiaria que consiste en lo siguiente: Se ordene a la demandada pagarme el valor de las mejoras útiles y necesarias en abstracto, así mismo se me permita retirar los materiales de puro adorno que he colocado en el terreno ambos desde el 01 de Diciembre del 2009; con derecho a retener el terreno en mi poder hasta su efectivo pago, y con plazo de tres meses para retirar la totalidad de los materiales de puro adorno.
Esta pretensión también debe de rechazarse en su totalidad, pues de la prueba ofrecida y evacuada por ambas partes no se acreditó que el señor Juan Bautista García hubiera hecho mejoras útiles y necesarias en el terreno, sobre la casita que está en el terreno la misma se acredito que existía desde antes de ingresar don Juan Bautista en el terreno, no se observaron cultivos permanentes en la diligencia de reconocimiento judicial, la finca en su mayoría está constituida por bosque el cual esta conservado, cuidado, y tampoco la prueba testimonial ni la documental ofrecida por el señora (sic) actor acreditan que se hubieran introducido mejoras desde el punto de vista agrario, por lo que esta pretensión también debe de rechazarse” (imagen 389 EDC). Aparte de que el actor no precisó en su demanda qué era lo que pedía se le indemnizase como “mejoras”, lo cual debió hacer en garantía del debido proceso de la parte contraria, sin que el Juzgado previniese su corrección oportunamente, se comparte lo concluido en la sentencia recurrida sobre que en este caso no es posible condenar al pago de “mejoras”, ni siquiera en abstracto.
Al respecto, conforme se tuvo por demostrado en el hecho probado once, agregado por este Tribunal, el terreno en litigio es casi totalmente de naturaleza boscosa. La casa vieja que existe no la hizo el Juan García. Y en cuanto a las siembras que reclama ha hecho, aparte de que como se tiene por probados es en un área muy pequeña y que no son cultivos permanentes o semipermanentes, resultan evidentemente ser para su consumo y su subsistencia. Los testigos Miguel Amador Vargas, Raúl Barquero Espinosa y José Antonio Amador, ofrecidos por el accionante, fueron claros en que la pobre situación económica de Juan García, por lo que ellos se veían obligados a ayudarle con comida y con semillas para que sembrara algo. Y lo que se denomina “rancho para cocina”, que en el reconocimiento judicial se describe como bodega con ese fin, no tendría derecho a que se le indemnice como mejora, por ser una edificación sencilla incorporada por el actor, que no se probó fuese de materiales ni de naturaleza permanente.
Tampoco como accesión, pues puede retirar los materiales y llevárselos cuando desaloje el terreno (numerales 330 a 332 y 508 Código Civil). No existe, por ende, una decisión equivocada sobre el tema que genera un enriquecimiento indebido a favor de la persona reconventora.
NOTA DE LA JUEZA FISHER GONZÁLEZ: La suscrita Jueza comparte la solución aplicada al caso concreto. Sin embargo, se estima necesario hacer algunas precisiones en cuanto a la prescripción del derecho de posesión. Ciertamente el ordinal 860 del Código Civil dispone que el derecho de posesión prescribe por la posesión de un año, pero ese plazo no opera como pérdida del derecho cuando se está en presencia de una posesión decenal apta para usucapir. Lo anterior porque si se ha ejercido en un fundo no inscrito una posesión de diez años, en forma quieta, pública, pacífica, continua, de buena fe y a título de dueño, se trata ya no solamente de un derecho de posesión sino de una posesión más calificada. Sobre el particular, desde vieja data, la Sala Constitucional había referido, para fundos sin inscribir, que una vez consolidada la usucapión se adquiere el derecho de propiedad como modo originario, de forma tal que se distingue de la información posesoria como instrumento de formalización de ese derecho para que sea inscrito, pero partiendo de que ya está el derecho consolidado.
En este sentido, consideró: “(…) IV.- RÉGIMEN GENERAL DE LA USUCAPIÓN: En principio, debe indicarse que las diligencias de información posesoria reguladas en la Ley de Informaciones Posesorias No.139 de 14 de julio de 1941 y sus reformas, son un procedimiento judicial no contencioso por medio del cual se formaliza un título de propiedad de bienes inmuebles inscribible en el Registro Público. En general, con ese procedimiento se pretende que los poseedores que carecen de título inscribible en el Registro Público, lo obtengan. El artículo 1 de esa Ley dispone que para que el poseedor de bienes raíces solicite el otorgamiento del título con base en el procedimiento de información posesoria, deberá demostrar una posesión por más de diez años con las condiciones que señala el artículo 856 del Código Civil, a saber, en calidad de propietario, continua, pública y pacífica. Los anteriores requisitos de tiempo y condición, caracterizan la posesión necesaria para usucapir.
Para obtener la propiedad de los bienes inmuebles por prescripción positiva, además de la posesión en las condiciones indicadas, el artículo 853 del Código Civil señala como requisitos: el título traslativo de dominio y la buena fe. De lo anterior y de lo dispuesto en el artículo 8 de la Ley de Informaciones Posesorias, que caracteriza el procedimiento de información posesoria como un proceso judicial no contencioso -en el que al surgir un reclamo u oposición de alguna persona o del Estado, provoca que el asunto se suspenda y se remita a la vía declarativa para su discusión y solución, o que se archive el expediente y se tenga por agotada la vía administrativa, respectivamente-, se desprende que la titulación del bien inmueble tiene como requisito la adquisición de la propiedad. O sea, que se distingue el momento de adquisición de la propiedad por usucapión del momento en que esa situación se hace valer en el procedimiento de información posesoria para obtener un título inscribible en el Registro Público.
De ahí que se considere la usucapión como un modo de adquisición de la propiedad y de otros derechos reales poseíbles, y a la titulación como el procedimiento por medio del cual, comprobados los requisitos de la usucapión, se confiere el título de propiedad inscribible. (…) El derecho de posesión puede ser adquirido independientemente del dominio pleno bajo ciertas circunstancias que el Código Civil regula en el artículo 279 -por consentimiento del propietario, por el hecho de conservar la posesión por más de un año y porque la ley autorice al acreedor a retener la cosa de su deudor o mande que todos o algunos de sus bienes pasen a un depositario-. El derecho de posesión en general se integra con dos elementos: el corpus y el animus. El primero, referido específicamente al hecho material de tener sometida la cosa al poder -acción- y la voluntad de una persona, y el segundo, relacionado con un aspecto interno que guía al poseedor.
A esos elementos se deben sumar otras circunstancias especiales que la ley exige para que la posesión resulte útil para usucapir. En ese sentido, la posesión ad usucapionem es una forma más rigurosa o calificada de posesión que se diferencia de la genérica. Los requisitos que la ley exige para que la posesión sea apta para la prescripción positiva se regulan en el artículo 856 del Código Civil” (el énfasis no es del original. Sentencia No. 04587-97 de las quince horas cuarenta y cinco minutos del cinco de agosto de mil novecientos noventa y siete). En este orden de consideraciones, no es dable afirmar de manera generalizada, que tratándose de un fundo sin inscribir se pierde el derecho de posesión por la sola circunstancia que otro sujeto lo ejerza por el plazo de un año (artículos 279 y 284 del Código Civil), toda vez si la persona poseedora anterior tenía una usucapión consolidada evidentemente tiene un mejor derecho y es una posesión más calificada.
Ahora bien, en este caso, la parte apelante no demostró haber tenido o ejercido una posesión de diez años ad usucapionem o que se hubiese poseído en calidad de dueño, razón por la cual se comparte el voto por el fondo, pero con la presente nota relativa a la prescripción del derecho de posesión, dado lo afirmado de manera general en la resolución en cuanto a ese instituto.
POR TANTO
En lo apelado, se confirma la sentencia 285 del treinta y uno de agosto dos mil veintitrés. Existe nota de la jueza Fischer González.
