This decision of the Tribunal is issued without any defects or omissions being observed that could result in nullity or a denial of due process to the parties.
In summary, the plaintiff sets forth the following facts in support of its action, and therefore, verbatim and insofar as relevant, states: “FACTS.
He added: Finally, the photograph used to prepare the report submitted as evidence with the complaint serves the purpose of demonstrating that, as of the date on which the property was registered, it already encompassed areas of the coastal public domain, and that this was not a circumstance that arose subsequently; that is, the defect has existed since its inception, and it should never have been registered because private registration of this type of property is null and void (Constitución Política, artículos 28 párrafo 2 -a contrario sensu- y 129 párrafo 4; Ley 6043, artículos 1, 7, 11 y 45; Código Civil, artículos 19, 261, 262, 627 inciso 2, 629, 631). The public-domain portion to be excluded from the property at issue in the litigation (litis) will be identified, should our second claim be granted, through the preparation of the new survey plan (plano). That survey (levantamiento) must receive the approval of the Instituto Geográfico Nacional, because it has exclusive responsibility for demarcating the Public Zone (Zona Pública) of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) (Decretos Ejecutivos Nos. 7841 y 34331).
Opinion DIG-TOT-INF-115-2021, submitted as evidence, demonstrates that, at the time of its registration, 95,2% of the property’s surface area comprised the public domain of the maritime zone, corresponding to the estuary (ría) of the río Tusubres, which borders the property on 3 of its sides (Evidence number 1 of the complaint) B) THE DEFENDANT’S ARGUMENTS IN OPPOSITION TO THE COMPLAINT: In summary, the defendant presents the following arguments in opposition to the action; accordingly, the relevant portions are quoted verbatim: “FACTS: FIRST: true. SECOND: true. THIRD: I reject it as inaccurate. The allegation does not provide a detailed description of the land to which it refers, which it states is located in the Maritime-Terrestrial Zone adjacent to the estuary of the Río Tusubres, indicating in parentheses: Report DIG-TOT-INF-115-2021 of 29 de setiembre de 2021. This inaccuracy makes it impossible to answer because it could leave my clients without an adequate defense.
Furthermore, the report mentioned states that it is based on an aerial photograph from the year 1974 and that the image has not undergone orthorectification (orto rectificación), which is the process by which geometric distortions in an aerial or satellite photograph are eliminated to create a planimetric scale image that is consistent in all its parts. In other words, because it has not undergone that orthorectification, the image contains geometric distortion and is not consistent in all its parts. Nor is that report clear and consistent as to which area is affected by the public domain, where it is located, and which area of the parcel (finca) is private. This is because the entire parcel is not shown as public-domain property (bien demanial). What is clear is that the entire parcel is not subject to public-domain status (demanialidad), and therefore the plaintiff cannot seek to have it annulled in its entirety.
LAW: Although it is true that part of the parcel is affected by the maritime zone, it is also true that another part of the parcel is private property and that my clients acquired it in reliance on the public record of the Registro Inmobiliario, at the time deed number ochenta y uno was executed before the Cónsul de Costa Rica in Atlanta, Estado de Georgia, EEUU, on 31 de mayo de 2006, as good-fa third parties (terceros de buena fe). The documentary evidence submitted by the plaintiff itself, on which it seeks to base its claim, contradicts that claim because Report DIG-TOT-INF-115-2021 of 29 de setiembre de 2021 is absolutely clear that a percentage of the parcel at issue IS NOT public-domain property, which plainly contradicts the State’s request that the entire parcel be declared property subject to that status, thereby annulling the parcel and, with it, its entries in the property and cadastral registries.
Accordingly, the claim must be dismissed in its entirety because it renders ineffective my clients’ right to private property with respect to the percentage of the parcel that is not public-domain property. The right to private property is enshrined in artículo 45 of our Constitution, which states: ‘ARTÍCULO 45.- Private property is inviolable; no one may be deprived of their property except for a legally established public interest and upon prior compensation in accordance with the law. In the event of war or internal disturbance, prior compensation is not indispensable.’ Thus, if a percentage of the parcel is not public-domain property and there is no legally established public interest concerning it, accompanied by prior payment of compensation, that percentage remains the property of my clients and must be so declared, since the plaintiff’s claim exceeds what our legal system permits.
Moreover, the documentary evidence submitted by the plaintiff itself, namely Report DIG-TOT-INF-115-2021 of 29 de setiembre de 2021, likewise fails to clearly and conclusively identify, whether on a registered survey plan (plano catastrado) or at least on an aerial photograph, which areas of the parcel are public-domain areas and which are not. Consequently, the action must be dismissed because the facts must be set forth clearly, in full detail and with specificity, requirements that have not been satisfied here. If the State’s claim were granted in the judgment, my clients’ right to private property would be infringed by declaring an area of land to be public-domain property when it is not. Regarding the legal concept of a good-fa third party, the Procuraduría General de la República addressed it in Opinion No. C-125-2013, dated 4 de julio de 2023, signed by the then Procurador General, Mr.
Julio Jurado del Barco, and his assistant, which states, in relevant part: (excerpt from opinion quoted). The protection afforded by this principle of reliance on the public registry (fe pública registral) operates such that, in the event of the invalidity of the ownership right of the non-owner (non domino), the ownership right of the acquiring third party does not inherit the invalidity of the previously registered right. The protection that our legal system affords a good-fa third-party purchaser is therefore clear: that party retains their right despite the possible nullity or annulment of the prior legal transaction or contract. Accordingly, good-fa purchasers could not be affected by defects in the right of the person who transferred it—and which come to light as a result of a police investigation—if that person appeared as the owner in the public registry and those defects were not recorded in the registry.
It must also be borne in mind that every complaint and the relief sought therein must be entirely precise and detailed as to the facts and the requested relief, because failure to do so leaves the defendant without an adequate defense. In this case, no section of the complaint (facts, relief sought, and/or documentary evidence) states with complete clarity and specificity which part of the parcel lies within the Maritime-Terrestrial Zone or where it is located. Such information is essential to the proper exercise of my clients’ defense and for the Court to issue a duly reasoned ruling on the merits based on certain and verifiable facts and data. Because my clients have acted as good-fa third-party purchasers, they should not be ordered to pay both categories of litigation costs (costas) in this action, since they are good-fa third-party purchasers.”
The following facts relevant to the resolution of this matter are deemed proven: 1.- Property registration 139159 of the Puntarenas district, with survey plan P-861478-2003, is currently registered in the names of Michael Albert Francis and Rodrigo Luis Chamberlain. It is divided into two interests, 001 and 002, each corresponding to one-half of the parcel, and has a total registered cadastral area of 154.191.86 m2 (see the literal certification of the parcel and source document at volume 549, entry 6046, images 11-17, 435-437 of the court record).
The evidence admitted into the record failed to establish: 1) The physical and geolocation accuracy of the remaining private area excluded from the public domain zone, corresponding to 7,383.86 m²—4.8%—of the property’s total area, due to the absence of an exact demarcation using bearings, azimuths, and coordinates that would provide certainty and specific land-registry security regarding the private occupation of property registered in the Real Property Folio under number 6-139159, interests 001 and 002.
The subject matter of this proceeding is the annulment of the registration of the property in the Province of Puntarenas, registered in the Real Property Folio under number 6-139159, interests 001 and 002, and, consequently, the cancellation of its associated survey plan P-861478-2003, because it encompasses primarily areas of the maritime-terrestrial zone and is therefore in the public domain. Accordingly, the Public Registry is to be ordered to cancel the registration entry for said property, as well as the registration entry for its survey plan.
As recognized by domestic legislation and case law, the maritime-terrestrial and mangrove zone is a public domain asset and shares the characteristics of this type of property: it is not subject to acquisitive prescription, attachment, or alienation. Its recognition as such is based on Article 261 of the Civil Code, which distinguishes between public domain property and property within the Administration’s private domain: “Public things are those that, by law, are permanently allocated to any service of general utility and those that everyone may use because they have been made available for public use. All other things are private and subject to private ownership, even when they belong to the State or municipalities, which, for this purpose, as civil persons, are no different from any other person.” In our legal system, the public nature of that marine strip adjacent to the national territory, over which the State exercises its sovereignty, has been recognized ...
Article 45 of the Constitution cannot be deemed violated, because no restrictions are imposed on private property; rather, in regulating the public domain, the law establishes the conditions under which private parties may use and enjoy the maritime-terrestrial zone. Thus, anyone seeking to make private use of that zone through unauthorized means is barred from doing so, since it has also been accepted from time immemorial that these assets cannot be acquired by private parties through prescription and are outside commerce.” The legal nature of public domain property is fundamentally different, as this Chamber previously stated in Resolution No. 2306-91, issued at 2:45 p.m. on November 6, in which it held: “The public domain consists of assets that, by the legislature’s express intent, have the special purpose of serving the community and the public interest. They are known as dominical property, public domain property, public assets, or public things, which do not belong individually to private parties and are allocated to public use and subject to a special regime, outside private commerce.
In other words, they are so dedicated by their nature and purpose. Consequently, such assets belong to the State in the broadest sense of the term, are dedicated to the service they provide—which is invariably essential by virtue of an express provision—and are characterized as inalienable, not subject to acquisitive prescription or attachment, incapable of being mortgaged or encumbered under civil law, with administrative action taking the place of possessory remedies for recovering dominion. Because they are outside commerce, these assets cannot be possessed, although a right of use—but not ownership—may be acquired. A use permit is a unilateral legal act issued by the Administration in the exercise of its functions; what is placed in the hands of the private party is the beneficial dominion over the property, while the State always retains direct dominion over it (...).” At present, the law governing matters related to the planning of the maritime-terrestrial zone (zona marítimo terrestre) is Ley 6043, Ley Sobre la Zona Marítimo Terrestre of March two, nineteen seventy-seven, which addresses basic matters such as the distinction between the public zone (zona pública) and the restricted zone (zona restringida), the granting of concessions (concesiones), and other matters of interest (Articles 6 and 7).
It is understood that no rights of any kind may be exercised over the public zone, whereas permits or concessions may be granted in the restricted zone by the respective municipalities. Likewise, Article 7 of the law establishes that no right may be obtained in the aforementioned zone through possessory information proceedings (informaciones posesorias). Nevertheless, when the events at issue in this action occurred, specifically regarding the chain of title (antecedentes de dominio) and successive registrations of what is now the property registered under Real Property Folio (Folio Real) 6-139159, rights 001 and 002, Ley 4558, Ley de Urbanización Turística de la Zona Marítimo Terrestre, enacted on April 22, 1970, was in force and governed the use of the zone in the following terms: “Article 6.- The fifty meters of the maritime-terrestrial zone measured from the ordinary high-tide line shall be inalienable and may under no circumstances be leased or sold.
Accordingly, no person may claim any right over that strip, which shall be devoted to public use for leisure, recreation, or free passage. Buildings or facilities currently located in that zone may not be remodeled, and if they are destroyed, any new construction shall respect this inalienable zone. Article 7.- The remaining one hundred fifty meters inland may be leased in accordance with the following rules: a) Lots intended for the construction of residences or recreational country homes for use by the lessee or the lessee’s associates, and which do not constitute a profit-making activity, may be leased only in areas not exceeding one hectare, provided that the beachfront does not exceed twenty-five meters. No person, together with that person’s spouse or unmarried children, may hold more than one lease of this kind. b) Parcels intended for the establishment of recreational centers, hotels, motels, restaurants, and similar facilities may be leased in larger areas, in accordance with the planning for the zone.
In every lease of this type, the respective municipality must first obtain the opinion of the Instituto Costarricense de Turismo. c) Under no circumstances may parcels be leased for the establishment of industries in the zones referred to by this law, except for industries related to tourism development. In all cases, however, such industries must be located outside the urban area. d) The leases governed by the preceding subsections shall be granted for a term of one year but may, at the request of the interested parties, be extended up to a maximum of ten years. The application for an extension must be filed within the month preceding expiration of the agreement, failing which the lease shall be permanently canceled. In every case in which a lease terminates, the improvements shall accrue to the respective municipality.” However, in its original version, through Transitory Provision III (Transitorio III), which remained in force until October four, nineteen seventy-one, it permitted land within the zone to be titled under the following parameters: “Transitory Provision III.- Persons who demonstrate that they have possessed lots or properties in the maritime-terrestrial zone quietly, publicly, peacefully, and as owners for more than thirty years may apply for title to them, subject to the reservation referred to in Article 6 of this law, even when they possessed such properties during part of that period as lessees under agreements entered into with the State or its Institutions.
The procedure shall be that established by the current Ley de Informaciones Posesorias. In this case, there shall be no limitation on the area of the lot or property to be registered in the interested party’s name.” Notwithstanding the foregoing, possessory information was governed by Ley 4545, Ley de Informaciones Posesorias, which permitted an administrative proceeding before the Instituto de Tierras y Colonización (ITCO); recourse to judicial proceedings occurred only in the event of a dispute or silence by that Institute, as established by Article 12 of that law. For clarity, it should be noted that the recently cited Transitory Provision III was repealed by Ley 4847 of October four, nineteen seventy-one; that the effects of Ley 4558 were suspended by Ley 5602 of November four, nineteen seventy-four; and that it was repealed in its entirety upon the entry into force of Ley 6043, Ley sobre la Zona Marítimo Terrestre, which is the law currently in force.
B.- LEGAL PROTECTION OF MANGROVES AS PART OF THE STATE’S NATURAL HERITAGE (PATRIMONIO NATURAL DEL ESTADO): It has been established, and this Court so finds, that mangroves form part of the natural heritage, by reason of their importance within the ecosystem because, as part of wetlands, they contribute to the water supply, both for direct use and for aquifer recharge; the regulation of flows for flood control; the prevention of and protection against the intrusion of salt water affecting groundwater and surface freshwater; protection against natural forces such as storms, hurricanes, etc.; and the retention of sediment and nutrients. Accordingly, mangroves in particular, together with estuaries, seagrass meadows, and other marine-coastal zones, constitute areas of great importance for the reproduction of marine species and therefore possess substantial environmental, economic, social, cultural, scientific, and recreational value.
For this reason, their protection as a legally protected interest (bien jurídico) is of fundamental importance to society, since their destruction, impairment, or loss causes serious harm by negatively affecting a sustainable environment, while their irrational exploitation directly affects marine-coastal habitat. The Costa Rican State has therefore protected them through various laws, and because of their natural importance, mangroves were incorporated into the “Patrimonio Natural del Estado.” Thus, for example, pursuant to Articles 1 and 3 of Ley de Aguas No. 276 of August 27, 1942, mangroves are designated as public-domain property (bien de dominio público). In this regard, Article 1 provides: “The following are public-domain waters: I.- The waters of the territorial seas, to the extent and under the terms established by international law; II.- The waters of coastal lagoons and estuaries that communicate permanently or intermittently with the sea; III.- The waters of naturally formed inland lakes that are directly connected to permanent watercourses; IV.- The waters of rivers and their direct or indirect tributaries, streams, or springs, from the point where the first permanent waters emerge to their outlet into the sea or into lakes, lagoons, or estuaries; V.- The waters of permanent or intermittent watercourses whose channel, throughout all or part of its length, serves as a boundary of the national territory, ownership of such watercourses being subject to the provisions of international treaties concluded with neighboring countries and, in their absence or regarding matters not provided for therein, to the provisions of this law; VI.- The waters of any watercourse flowing directly or indirectly into those listed in subsection V; VII.- Waters extracted from mines, subject to the limitation set forth in Article 10; VIII.- Waters from springs that emerge on beaches, in maritime zones, channels, basins, or banks owned by the Nation and, in general, all waters originating on public-domain lands; IX.- Groundwater that is not brought to the surface by means of wells; and X.- Rainwater flowing through ravines or dry streambeds whose channels are in the public domain.” Article three, in turn, states: “The following are likewise national property: I.- Beaches and maritime zones; II.- The basins of lakes, lagoons, and estuaries owned by the Nation; III.- The channels of public-domain watercourses; IV.- Land reclaimed from the sea through natural causes or artificial works; V.- Land reclaimed from watercourses, lakes, lagoons, or estuaries through works carried out with State authorization; and VI.- Islands formed in territorial seas, in the basins of lakes, lagoons, or estuaries, or in the channels of watercourses owned by the Nation, provided that they do not result from a bifurcation of a river across privately owned land.” This legal status of mangroves as public-domain property was confirmed by the former Chamber of Cassation (Sala de Casación) itself in decision No. 121 at 16:00 hours on November 14, 1979, which held that the waters covering mangroves do not originate within the properties but come from the sea and that, consequently, those waters and the interconnected basins containing them are in the public domain and cannot be converted into private property.
Consistent with this same protective approach, Articles 13 and 14 of the Ley Forestal establish that forested areas, lands suitable for forestry, mangroves, and wetlands are immediately incorporated into this Heritage, without any action by the Administration being required, a situation upheld by the Constitutional Chamber (Sala Constitucional) in judgments 1992-03789 and 1997-04587. With regard to the public-domain status (demanialidad) of mangroves, Ley 6043; Ley Orgánica del Ambiente; Ley 7224; Ley Forestal; Ley de Biodiversidad; and Ley de Conservación de la Vida Silvestre afford them the same protection provided since the aforementioned “Ley de Aguas” and its amendments. As inalienable assets, they are outside private commerce and cannot be converted into private property; because they are assets allocated to the Public Domain (Dominio Público), they are therefore not subject to acquisitive prescription, inalienable, and not subject to attachment.
The State is responsible for their direct protection, without needing to resort to the courts, although it may of course do so. The Sala Constitucional, for its part, has stated in its case law: “...Protected Wildlife Areas declared by the Executive Branch are assets subject to the regime of the Patrimonio Natural del Estado because they are of high value to ecosystems or threatened species or from a scientific standpoint. They are demarcated by the Executive Branch; upon their declaration, these geographical zones are intended to be given the conservationist and protective purpose necessary for them to fulfill their function. As this Chamber has interpreted it, this Heritage encompasses both public and private lands, which are subject to a special legal regime regardless of whether they belong to a person governed by public law or private law. In accordance with the legislation contained in the Ley Orgánica del Ambiente and the Ley Forestal, these assets of the Patrimonio Natural del Estado are subject to interests and restrictions that transcend the boundaries of individual cantons, giving rise to a national and even international interest in their protection...” (Judgment No. 2010-021258 at fourteen hours on December twenty-two, two thousand ten).
Regarding the legal protection of the State Natural Heritage (Patrimonio Natural del Estado), that Chamber has stated: “...Given that the challenged provisions specifically refer to the State Natural Heritage, it is necessary to recall how the Chamber has defined this concept: ‘The State Natural Heritage is public-domain property (bien de dominio público), the conservation and administration of which are entrusted by law to the Ministerio del Ambiente y Energía, through the Sistema Nacional de Áreas de Conservación (Ley Forestal, arts. 6 inc. a and 13 pfo.2°, and 14; Ley Orgánica del Ambiente, artículo 32, pfo. 2°). It consists of two important components: a) Protected Wildlife Areas (Áreas Silvestres Protegidas), regardless of their management category, declared by Law or Executive Decree: forest reserves, protected zones, national parks, biological reserves, national wildlife refuges, wetlands, and natural monuments (Ley Forestal 7575, arts. 1°, pfo. 2°, 3° inciso i; Ley Orgánica del Ambiente 7554, artículo 32; Ley de Biodiversidad N° 7788, arts. 22 y sigts. and 58; Ley del Servicio de Parques Nacionales N° 6084, artículo 3° incs. d and f, in relation to Ley Orgánica del MINAE N° 7152 and its Reglamento; Ley de Conservación de la Vida Silvestre N° 7317, artículo 82, inciso a). b) The other forests and forest lands or lands suitable for forestry (terrenos forestales o de aptitud forestal) belonging to the State and public institutions (artículo 13 of Ley Forestal), which are immediately subject to statutory protection (afectación legal inmediata).
With respect to the maritime-terrestrial zone (zona marítimo terrestre), Ley 6043 itself (artículo 73) excludes Protected Wildlife Areas from its scope and subjects them to their own legislation. The remaining coastal forested areas and lands suitable for forestry are also administered by the Ministerio del Ambiente and governed by their specific regulations (Ley Forestal, artículo 13 and related provisions)’ (see judgment No. 2008-016975 of fourteen hours and fifty-three minutes on the twelfth of November, two thousand eight).” In view of the foregoing, upon examining the case, the first point that must be made is that the defendant’s representative acknowledges that part, but not all, of the property at issue is located within a public-domain zone (zona demanial pública), which is true and has been deemed proven by this Court. Therefore, on that basis, it is clear, pursuant to the aforementioned regulatory provisions, that because mangroves belong to a higher category of wetlands (humedales), wherever they are located on State-owned properties (belonging to any State entity, body, or agency), they form part of that estate, since they are classified as forest lands (terrenos forestales) (see Decreto Ejecutivo 36786 del 12 de agosto de 2011); moreover, mangroves or salt forests and estuaries, as part of the public zone (zona pública) within the maritime-terrestrial zone (zona marítimo terrestre), an inalienable area pursuant to article 1 of the Ley sobre la zona marítimo terrestre, “the public-domain status of the maritime-terrestrial zone (or seashore, as it was formerly called) has been recognized since time immemorial, and Roman law itself acknowledges that status as ‘res communes’ and ‘extra comercium’ (see voto No. 447-91 de 15:30 horas del 21 de febrero de 1991),” constitute a forest reserve (reserva forestal) and are subject to Ley Forestal 7575 del 13 de febrero de 1996 pursuant to article 13 of that law.
In any event, the Sala Constitucional has further clarified this matter, holding: “It is important to emphasize how the State’s forest estate (patrimonio forestal del Estado) is constituted, insofar as it has a dual nature: first, the State’s natural heritage (patrimonio natural del Estado), comprising forest reserves, biological reserves, protected zones, wildlife refuges, wetlands, and natural monuments (article 32 of the Ley Orgánica del Ambiente, número 7554, de dieciocho de setiembre de mil novecientos noventa y cinco), which is granted the status of public-domain property (bien de dominio público), pursuant to article 14 of Ley Forestal, número 7575...” (See sentencia de la Sala Constitucional No. 2011-16938). In accordance with the foregoing, mangrove zones, as part of wetlands, may not be appropriated or exploited by private parties, even through lawful practice and conduct, because they are classified as public-domain property and are therefore subject to the principles of non-acquisitive prescription (imprescriptibilidad), inalienability (enajenabilidad), and immunity from attachment (inembargabilidad); private parties claiming ownership thereof or holding registered title must prove, first, that the property is not located within an affected public-domain zone and, second, that it was acquired under the exceptions established by law.
The evidence shows only that the property registered under matrícula 139159 of the Partido de Puntarenas, with survey plan (plano) P-861478-2003 and currently registered in the names of MICHAEL ALBERT FRANCIS and RODRIGO LUIS CHAMBERLAIN, lies partially, but not entirely, within areas included in the demarcation of the maritime-terrestrial zone due to mangrove occupation, adjacent to the Río Tusubres estuary and ZMT. The portion included in the ZMT of the río Tusubres and occupied in el año 1974 is estimated at alrededor de 109.348m2 (70.9%) of the property, and that of the río Tusubres at 37.460m2 (24.3%), yielding an approximate total of 146.808m2 (95.2%) of the property within a public-domain zone included in the State’s natural heritage (see informe DIG-TOT-INF-115-2021 de 29 de setiembre de 2021, see plan in images 18, 20-28 of the judicial case file). This does not preclude granting the action, but only in part, as detailed below.
Because the property is located and demarcated, in the indicated percentages, within public-domain zones, those portions are outside private commerce (fuera del comercio de los hombres), such that they cannot be acquired by prescription, attached, or alienated, and they enjoy a heightened special legal regime (articles 261 and 262 of the Código Civil and 121 inciso 14 of the Constitución Política). According to the Sala Constitucional (sentencia N°2007-2408 16:13 horas del 21 de febrero de 2007), “these are assets to which the State holds title in its capacity as administrator, and they must therefore be understood as assets belonging to the Nation (...) which means that ownership rights over them cannot be acquired through the passage of time, not even mere possession—in other words, they cannot be acquired through adverse possession (usucapión) (...) and they are inalienable, meaning that they are outside private commerce; consequently, they cannot be transferred, sold, or acquired, whether gratuitously or for consideration, either by private parties or by the State, and are therefore excluded from private commerce and subject to a heightened special legal regime.” In addition, notwithstanding the existence of the principle of public notice through registration (principio de la publicidad registral), that principle yields to another principle of greater public interest and greater legal protection: the principle of first registration (principio de inmatriculación), because the public-domain regime is effective per se, and its existence and public notice operate independently of the Registry, without a registered titleholder being entitled to plead lack of knowledge as a means of disproving or defeating the property’s designation.
The principles of inalienability and non-acquisitive prescription that characterize the public domain prevent reliance upon the doctrine of the registered third party (tercero registral) against it in order to consolidate private ownership unlawfully removed from that regime. The public domain (demanio) is subject to notice by operation of law. The foregoing is coupled with the principle of first registration of properties comprising the public domain, which enjoy substantive public notice and do not necessarily require formal notice or registration. As against the public domain, private possession has no preclusive effect, regardless of how long it continues and even if it appears to be supported by entries in the Property Registry. The status of an asset as public-domain property intended for public use is enforceable against third parties even if that status does not appear in the Property Registry.
By their nature, such assets do not require registration. (See, among others, Sentencia N° 868-2001, de las 10:15 horas del 16 de octubre de 2001 Sala Constitucional and Sentencia N°189-F-S1-2011, de las 9:15 horas del 3 de marzo de 2011 de Sala Primera)
Accordingly, under the applicable provisions cited ut supra and in conjunction with the factual circumstances, which demonstrate that the property at issue intrudes to a significant extent because it lies mostly within the public-domain maritime-terrestrial zone and lacks valid title predating its designation for public use, and consistent with the State’s claim seeking a declaration of nullity and cancellation of the registration entries in the Real Property Registry of the Registro Nacional concerning the property of the Partido de Puntarenas under matrícula 139159—divided into two interests, 001 and 002—with survey plan P-861478-2003, together with the matters extensively detailed in the proven-facts section of this decision, which sets forth the history/background of the cited property and the information contained in informe DIG-TOT-INF-115-2021 de 29 de setiembre de 2021, this Court finds that report credible, particularly in the absence of evidence to the contrary.
It therefore deems it established that approximately 95.2% of that property lies within the State Estate (Patrimonio del Estado) corresponding to the Zona Marítimo Terrestre and mangrove area. Based on these elements, and although the property was lawfully acquired after the transferor’s ownership right had already vested, under the protection of the principles of public notice through registration, the defendants’ good faith in those legal transactions does not diminish in any respect the public-domain status of the affected portion of the land. By virtue of the principle of first registration of public-domain assets, the principle of public notice through registration cannot be asserted against that regime as a defense for retaining private title unless the private party proves that its title predated the establishment of the public domain over the disputed lands, as previously stated.
Because the final registration of the property at issue in this proceeding derives from the registration transactions described in proven facts 2 through 5 of this judgment, it has been established in this case that the State is partially correct in its claim for modification of the registered documents and is therefore fully entitled to recover full ownership (dominio pleno) of the public-domain estate included within the registered property (article 264 of the Código Civil), with the qualification that this applies solely to the portion included within that exclusionary area—95.2%. It is understood that, pursuant to section 320 of the Código Civil, the “original” owner may bring the action against possessors (whether in good or bad faith), as well as against third parties who subsequently succeeded in registering title to the same property (the phenomenon of double registration (doble matriculación)) as a result of possessory-title proceedings (información posesoria) or land-titling procedures (procedimientos de titulación de tierras), as occurred here.
Because it has been established in both the administrative and judicial proceedings that a large portion, but not all, of the defendants’ property overlaps land possessing all the characteristics of the public domain, it is evident that the registrations under review should not have been allowed. Given the nature of the property, as already explained, they cannot be validated by any means, not even through the passage of time. This is particularly so considering that the evidence gathered, consisting primarily of informe DIG-TOT-INF-115-2021 de 29 de setiembre de 2021, partially identifies areas included within the demarcation of the maritime-terrestrial zone due to mangrove occupation, adjacent to the Río Tusubres estuary and ZMT. The portion included in the ZMT of the río Tusubres and occupied in el año 1974 is estimated at alrededor de 109.348m2 (70.9%) of the property, and that of the río Tusubres at 37.460m2 (24.3%), yielding approximately 146.808m2 (95.2%) of the entire property within a public-domain zone.
The report is deficient, however, insofar as it does not precisely demarcate, by bearings, azimuths, and coordinates, the specific remaining area under exclusive private occupation (ocupación privativa), against which this action cannot be enforced as to the defendants without amounting to a de facto expropriation (expropiación de hecho) and an infringement of private property.
Conclusion. In this regard, and under the considerations set forth above, it must be stated that the actions identified by the Instituto Geográfico Nacional del Registro Público in the cited report make it impossible to create rights for either the original purchaser or successive acquirers, because registration does not cure any defects in origin or title history that it may contain and, therefore, is incapable of creating rights for the original titleholder or subsequent good-faith purchasers, as the current defendants appear to be, over the entire area of the property in question. It is reiterated that the land-registry entries examined neither produce nor confer any real right (derecho real) eligible for private protection over the public-domain property (patrimonio demanial) contained within the registered property, nor may encumbrances of any kind validly be imposed upon it, whether as security for credit or otherwise, in legal conflict with the public-domain regime (régimen demanial), since the portion of the property at issue occupying the public domain (demanio público) and mangrove area is removed from private commerce.
Thus, based on the factual and legal considerations set forth above, and subject to the determination of the effects of this judgment, the complaint filed by the State must be partially granted because the property lies predominantly within the publicly owned maritime-terrestrial zone (zona marítimo terrestre) and mangrove area (95.2%) and lacks valid title predating its designation, in an exclusive area in which the competent active Administration shall exercise its powers of public-domain self-protection (autotutela demanial); restitution of the stated percentage of the land is therefore ordered because it belongs to the State, with the required reduction in the area of the registered property, while the remaining private portion shall remain vested in the defendants. Accordingly, the Registro Público shall mandatorily make the modification required by the illegitimate excess area reflected in the registration of the given property record, using the information to be gathered during enforcement of the judgment (ejecución de sentencia), and cadastral plan P-861478-2003 shall be rendered without effect because it does not correspond to the remainder belonging to the defendants.
To that end, once the remaining private-area percentage corresponding to 7.383.86m2 -4.8%- of the property’s total area has been duly surveyed, located, and monumented so as to separate the public-domain area in favor of the State, the State, through the appropriate institution, shall ensure that property 6-139159-001-002 is adjusted to include only the private area under a plan conforming to its actual circumstances. The boundaries of the land to be recovered in favor of the State shall be determined during the judgment-enforcement phase with expert assistance or through the Instituto Geográfico Nacional del Registro Público, as required to implement this judgment and ensure its due effectiveness until the corresponding new cadastral plan is obtained. The State’s representatives are therefore admonished, as set forth above, to pursue the appropriate actions, which entails determining the location of the private area corresponding to 7.383.86m2 -4.8%; the defendants are likewise admonished to work at their own expense and in coordination with the State to fulfill the purpose of this judgment.
This disposition contradicts, as unfounded, the defendants’ assertion that “In this case, nowhere in the complaint (facts, relief sought, and/or documentary evidence) is it stated with complete clarity and specificity which portion of the property lies within the maritime-terrestrial zone and where it is located, information that is indispensable for the proper exercise of my clients’ defense and for the Court to issue a duly reasoned decision on the merits based on certain and verifiable facts and information.” Restitution to the State is ordered of the indicated public-domain area corresponding to 146.808m2 (95.2%) of the total area of the property at issue, pursuant to section 122 of the CPCA, subsections a), b) c), d), f), k) l), which authorizes the State to challenge any irregular extension to its detriment of the public-domain land recovered herein, or any deficiency in area within the zones ordered recovered, should grounds exist.
The Court understands that it would have been desirable and appropriate to have a comprehensive map or plan of the entire disputed area prepared using a global positioning system (GPS), which does make it possible to obtain the actual, high-precision geographic coordinates of a particular location, or a survey based on georeferenced points from orthophotographs (corrected aerial photographs), rather than relying solely on old aerial photographs, since these may contain inherent errors in the interpretation of surface details due to physical variables at the site, thereby exacerbating the lack of precision of those public documents. The private-property right to the aforementioned remainder, which shall remain as a privately owned remnant, must therefore also be protected, and the effectiveness of this judgment shall accordingly remain conditional until the orders herein have been duly and fully carried out under the stated terms.
VIII: DEFENSES OF LACK OF LEGAL ENTITLEMENT AND LACK OF CAUSE OF ACTION (EXCEPCIONES DE FALTA DE DERECHO Y FALTA DE CAUSA): For the reasons stated in the preceding recitals (considerandos), the defenses raised must be granted insofar as they concern the exclusion from the cancellation of property record 6-139159-001-002 of the 4.8% private-area portion corresponding to 7.383.86m2 of the property’s total area, which must be duly surveyed, located, and monumented as indicated above before the ordered cancellation.
Given the recovery-of-title nature of these proceedings, which arose from prior lawful conduct that led the defendants to acquire registered title to the cited property, the litigating parties shall be exempted from an award of the costs of the proceedings, pursuant to subsection b) of article 193 of the Código Procesal Contencioso Administrativo.
POR TANTO
The defenses of lack of legal entitlement and lack of cause of action are granted with respect to the cancellation of the registration entry for property record 6-139159-001-002 and its corresponding cadastral plan P-861478-2003, insofar as they concern the exclusion from the cancellation of property record 6-139159-001-002 of the 4.8% private-area portion corresponding to 7.383.86m2 of the property’s total area. Consequently, the complaint filed by the State is partially granted, and restitution of the stated percentage of the land is ordered because it belongs to the State, with the required reduction in the area of the registered property, while the remaining private portion shall remain vested in the defendants. Accordingly, the Registro Público shall make the modification required by the illegitimate excess area reflected in the registration of the given property record, through the ensuing enforcement of the judgment, once the remaining private-area percentage corresponding to 7.383.86m2 -4.8%- of the property’s total area has been duly surveyed, located, and monumented, with the public-domain area reserved for the State, so that property 6-139159-001-002 is adjusted to include only the private area; this judgment shall therefore remain conditional until this has been carried out in the prescribed manner.
The boundaries of the land to be recovered in favor of the State shall be determined during the judgment-enforcement phase with expert assistance or through the Instituto Geográfico Nacional del Registro Público, as required to implement this judgment and ensure its due effectiveness, with the preparation of the corresponding cadastral plan. CONSIDERANDO
Como parte del íter procesal se tiene lo siguiente:
Se dicta la presente resolución del Tribunal, sin que se observen vicios u omisiones susceptibles de generar nulidad o indefensión a las partes.
En resumen, la parte actora refiere los siguientes hechos para justificar su acción, por lo que en lo literal y en lo conducente se indica: "HECHOS.
Agregó: Finalmente, la fotografía utilizada para realizar el informe aportado como prueba de la demanda cumple el propósito de demostrar que, para la fecha en que el inmueble fue inscrito, ya abarcaba áreas del dominio público costero, y que no fue una circunstancia que sobrevino posteriormente; es decir, el vicio lo acarrea desde su nacimiento, nunca debió ser inscrito porque la inscripción privada sobre este tipo de bienes es nula (Constitución Política, artículos 28 párrafo 2 -a contrario sensu- y 129 párrafo 4; Ley 6043, artículos 1, 7, 11 y 45; Código Civil, artículos 19, 261, 262, 627 inciso 2, 629, 631). La porción demanial a excluir del inmueble objeto de la litis se materializará de acogerse nuestra pretensión segunda, con la confección del nuevo plano. Ese levantamiento deberá contar con el visto bueno del Instituto Geográfico Nacional por corresponderle la función exclusiva de la demarcación de la Zona Pública de la Zona Marítimo Terrestre (Decretos Ejecutivos Nos. 7841 y 34331).
En el dictamen DIG-TOT-INF-115-2021 aportado como prueba se demuestra que, al momento de su inscripción, el inmueble comprendía, en un 95,2% de su superficie, el dominio público de la zona marítima, correspondiente a la ría del río Tusubres, con el cual colinda por 3 de sus costados (Prueba número 1 de la demanda) B) ALEGACIONES DE OPOSICIÓN LA PARTE DEMANDADA SOBRE LA DEMANDA: En resumen, la parte demandada refiere los siguientes alegatos para oponerse a la acción, por lo que en lo literal y en lo conducente se indica: "HECHOS: PRIMERO: es cierto. SEGUNDO: es cierto. TERCERO: lo rechazo por inexacto. El hecho no hace descripción detallada de los terrenos a que hace referencia, que indica se encuentra en la zona marítimo terrestre contigua a la ría del Río Tusubres, indicando entre paréntesis: Informe DIG-TOT-INF-115-2021 de 29 de setiembre de 2021. Esta inexactitud hace que sea de imposible respuesta, ya que podría causar indefensión a mis representados.
Por otra parte, el informe que se menciona indica que tiene como base una fotografía aérea del año 1974 y que esa imagen no tiene orto rectificación, que es el proceso mediante el cual se eliminan distorsiones geométricas en una fotografía aérea o satelital, para crear una imagen planimétrica de estaca coherente en todas sus partes. Es decir que, al no contar con esa orto rectificación, la imagen tiene distorsión geométrica y no es coherente en todas sus partes. Ese informe tampoco es claro y coherente en relación a cuál es el área afectada por el dominio público y adónde se ubica y cuál es el área privada de la finca. Esto por cuanto no toda la finca aparece como bien demanial. Lo que sí es claro es que no toda la finca está afecta a la demanialidad, por lo que no puede pretender la parte actora, que se anule en su totalidad. DERECHO: Si bien es cierto que existe una parte de la finca afectada por la zona marítima, también es cierto que otra parte de la finca es un bien privado y que mis representados adquirieron al amparo de la publicidad del Registro Inmobiliario que, en el momento del otorgamiento de la escritura número ochenta y uno, ante el Cónsul de Costa Rica en Atlanta, Estado de Georgia, EEUU, el día 31 de mayo de 2006, como terceros de buena fe.
La misma prueba documental que aporta la parte actora y con la que pretende fundamentar su pretensión, es contradictoria con ésta, pues el Informe DIG-TOT-INF-115-2021 de 29 de setiembre de 2021, es absolutamente claro con el hecho de que existe un porcentaje de la finca que nos ocupa, que NO ES bien demanial, lo que obviamente contradice la pretensión del Estado en el sentido de pedir que se declare la totalidad de la finca como bien afectado a esa condición, anulando la finca y con ello, los asientos de su inscripción registral y catastral. Siendo así, la pretensión debe rechazarse en todos sus extremos, pues está haciendo nugatorio el derecho a la propiedad privada que les asiste a mis representados sobre el porcentaje de la finca que no es bien demanial. El derecho a la propiedad privada está consagrado en el artículo 45 de nuestra Carta Magna, que dice: “ARTÍCULO 45.- La propiedad privada es inviolable; a nadie puede privarse de la suya si no es por interés público legalmente comprobado, previa indemnización conforme a la ley.
En caso de guerra o conmoción interior, no es indispensable que la indemnización sea previa.” Es decir que si hay un porcentaje de la finca que no es bien demanial y tampoco existe sobre él un interés público legalmente comprobado, previo pago de una indemnización, ese porcentaje sigue siendo propiedad de mis representados y así debe declararse, siendo que la pretensión de la parte actora va más allá de lo que nuestro ordenamiento jurídico le permite. Además, la misma prueba documental aportada por la parte actora, que es Informe DIG-TOT-INF-115-2021 de 29 de setiembre de 2021, tampoco es claro y contundente con señalar aunque sea en un plano catastrado o, al menos en una fotografía aérea, cuales son las áreas demaniales de la finca y cuáles no lo son, lo que conlleva a que la acción se deba declarar sin lugar, porque los hechos deben estar claramente expuestos, con todo detalle y especificidad, lo que aquí no se cumple.
Si se llegara a acoger en sentencia la pretensión del Estado, se estaría transgrediendo el derecho a la propiedad privada de mis representados, al declarar demanial un área de terreno que no lo es. Sobre la figura del tercero de buena fe, la Procuraduría General de la República se refirió en Criterio No. C-125-2013, de fecha 4 de julio de 2023, suscrito por el entonces Procurador General, señor Julio Jurado del Barco y su asistente, que en lo conducente, dice: (cita extracto de criterio). La protección que brinda este principio de fe pública registral se manifiesta en el sentido de que, ante la eventual invalidez del derecho de propiedad del non domino, el derecho de propiedad del tercero que adquiere no arrastra la invalidez del derecho previamente inscrito. De ahí que es clara la protección que nuestro ordenamiento otorga al tercero adquirente de buena fe, quien mantiene su derecho a pesar de la posible nulidad o anulación del negocio o contrato jurídico anterior.
En razón de lo dicho, los adquirentes de buena fe no podrían verse afectados por vicios que aquejen el derecho de quién transmitió -y que salgan a la luz como resultado de una investigación policial- si este aparecía como propietario en el registro público, y tales vicios no constaran en el registro. Debe tomarse también en consideración que cualquier demanda y su pretensión deben ser absolutamente exactas y detalladas en sus hechos y en lo que se pide, porque el no hacerlo causa indefensión a la parte demandada. En este caso en ningún aparte de la demanda (hechos, pretensión y/o prueba documental) se indica con toda claridad y especificidad, cuál es la parte de la finca que está dentro de la zona marítimo terrestre y adónde está ubicada, datos indispensables para el ejercicio correcto de la defensa de mis representados y para que el Despacho Judicial pueda emitir una resolución de fondo debidamente fundamentada y con hechos y datos ciertos y comprobables. En vista de que mis representados han actuado como terceros adquirentes de buena fe, no debe condenárseles al pago de ambas costas de esta acción, puesto que son terceros adquirentes de buena fe.
De importancia para la resolución del presente asunto, se tienen como probados los siguientes hechos: 1.- A nombre de Michael Albert Francis y Rodrigo Luis Chamberlain está inscrita actualmente la matrícula 139159 del partido de Puntarenas con el plano P-861478-2003, misma que se encuentra dividida en dos derechos, 001 y 002, correspondientes a un medio de la finca cada uno y con área total catastrada de 154.191.86 m2 (ver certificación literal de la finca y documento de origen al tomo 549, asiento 6046, imagen 11-17, 435-437 de expediente judicial).
De los elementos probatorios admitidos en autos no se logró acreditar: 1) Exactitud, física y de geolocación del área de resto privado excluido de la zona demanial correspondiente a 7.383.86m2 -4.8%- del área total del inmueble, por falta de demarcación con exactitud bajo rumbos, azimut y coordenadas que brinden certeza y seguridad registral específica de ocupación privativa del inmueble matrícula de Folio Real 6-139159 derecho 001 y 002.
El objeto de este proceso es la anulación de la inscripción de la finca del Partido de Puntarenas, matrícula de Folio Real 6-139159 derecho 001 y 002 y consecuentemente la cancelación de su plano asociado P-861478-2003, esto en razón de comprender mayormente áreas de la zona marítimo terrestre, ergo, de dominio público. En razón de lo anterior, se ordene al Registro Público la cancelación del asiento de inscripción, de dicha finca así como la cancelación del asiento de inscripción de su plano.
Tal y como lo ha reconocido la legislación y la jurisprudencia patria, la zona marítimo terrestre es un bien demanial y de manglar, el cual comparte las características de este tipos de bien, que son la imprescriptibilidad, inembargabilidad e inalienabilidad. Su reconocimiento como tal se hace con base en el artículo 261 del Código Civil, que hace la distinción entre bienes de dominio y bienes de dominio fiscal de la administración: "Son cosas públicas las que, por ley, están destinadas de un modo permanente a cualquier servicio de utilidad general, y aquellas de que todos pueden aprovecharse por estar entregadas al uso público. Todas las demás cosas son privadas y objeto de propiedad particular, aunque pertenezcan al Estado o a los Municipios, quienes para el caso, como personas civiles, no se diferencian de cualquier otra persona." En nuestro medio, se ha reconocido el carácter público de esa franja marina adyacente al territorio nacional, en la que ejerce su soberanía ... no es posible tener por violado el artículo 45 Constitucional, ya que no se imponen limitaciones a la propiedad privada, sino que al regularse el dominio público, la ley lo que hace es establecer condiciones mediante las que es posible el uso y disfrute de la zona marítimo terrestre, por parte de los particulares.
Así quien pretenda por medios no autorizados ejercer un uso privativo de esa zona tendrá vedada la posibilidad de consumarlo, pues es aceptable también, desde tiempo inmemorial, que se trata de bienes imprescriptibles en favor de particulares y que están fuera de comercio." La naturaleza jurídica de la propiedad demanial es virtualmente diferente, como ya lo indicó esta Sala por resolución número 2306-91 de las 14:45 horas del 6 de noviembre, en la cual indicó: "El dominio público se encuentra integrado por bienes que manifiestan, por voluntad expresa del legislador, un destino especial de servir a la comunidad, al interés público. Son llamados bienes dominicales, bienes demaniales, bienes o cosas públicos, que no pertenecen individualmente a los particulares y que están destinados a un uso público y sometidos a un régimen especial, fuera del comercio de los hombres. Es decir, afectados por su naturaleza y vocación.
En consecuencia, esos bienes pertenecen al Estado en el sentido más amplio del concepto, están afectados al servicio que prestan y que invariablemente es esencial en virtud de norma expresa. Notas características de estos bienes, es que son inalienables, imprescriptibles, inembargables, no pueden hipotecarse ni ser susceptibles de gravamen en los términos de Derecho Civil y la acción administrativa sustituye a los interdictos para recuperar el dominio. Como están fuera del comercio, estos bienes no pueden ser objeto de posesión, aunque se puede adquirir un derecho al aprovechamiento, aunque no un derecho a la propiedad. El permiso de uso es un acto jurídico unilateral que lo dicta la Administración, en el uso de sus funciones y lo que se pone en manos del particular, es el dominio útil del bien, reservándose siempre el Estado, el dominio directo sobre la cosa (...)." En la actualidad, la ley que rige lo relativo al ordenamiento de la zona marítimo terrestre, es la Ley 6043, Ley Sobre la Zona Marítimo Terrestre del dos de marzo de mil novecientos setenta y siete, que recoge aspectos básicos, como la distinción de la zona pública y la zona restringida, el otorgamiento de concesiones y otros aspectos de interés (artículos 6 y 7).
Se entiende que sobre la zona pública no puede ejercerse ningún tipo de derecho, mientras que en la zona restringida pueden otorgarse permisos o concesiones, los cuales será otorgados por las respectivas municipalidades. De igual forma, el artículo 7 de la ley, establece que por medio del procedimiento de informaciones posesorias, no puede obtenerse ningún derecho en la mencionada zona. No obstante, al momento de suceder los hechos objeto de esta demanda, concretamente en cuanto a los antecedentes de dominio y registraciones sucesivas de lo que hoy es el inmueble inscrito bajo matrícula de Folio Real 6-139159 derecho 001 y 002, se encontraba vigente la Ley 4558, Ley de Urbanización Turística de la Zona Marítimo Terrestre, promulgada el 22 de abril de 1970, que reguló el aprovechamiento de la zona, en los siguientes términos: "Artículo 6º.- Los cincuenta metros de la zona marítimo-terrestre a partir de la pleamar ordinaria, serán inalienables y en ningún caso pueden se objeto de arrendamiento o venta.
Por lo tanto, nadie puede alegar derecho alguno sobre dicha franja, que estará dedicada a uso público para fines de esparcimiento, recreo o libre circulación. Las construcciones o instalaciones actualmente ubicadas en esa zona, no pondrán ser remodeladas y en caso de destrucción de las mismas, las nuevas construcciones deberán respetar esta zona inalienable. Artículo 7º.- Los ciento cincuenta metros restantes, tierra adentro, pueden ser objeto de arrendamiento, dentro de las siguientes normas: a) Los lotes destinados a construir residencias o quintas de recreo para uso del arrendatario o sus allegados y que no constituyan actividad lucrativa, sólo podrán arrendarse por extensiones no mayores de una hectárea y siempre que el frente a la playa no exceda de veinticinco metros. Ninguna persona junto con su cónyuge o hijos solteros, podrá tener más de un contrato de arrendamiento de esta clase. b) Las parcelas destinadas al establecimiento de centros de recreo, hoteles, moteles o restaurantes y similares, podrán arrendarse por extensiones mayores, de acuerdo con la planificación de la zona.
En todo caso de arrendamiento de este tipo, la municipalidad respectiva debe oir previamente el parecer del Instituto Costarricense de Turismo. c) En ningún caso podrán darse en arrendamiento parcelas para el establecimiento de industrias en las zonas a que esta ley se refiere, salvo las relacionadas con la explotación turística. Pero en todo caso, tales industrias deberán ser localizadas fuera del área urbana. d) Los arrendamientos regulados en los incisos anteriores se otorgarán por el plazo de un año, pero podrán ser prorrogados hasta un máximo de diez, a solicitud de los interesados. La solicitud de prórroga deberá hacerse necesariamente dentro del mes anterior al vencimiento del contrato, bajo pena de cancelación definitiva del arrendamiento. En todos los casos de terminación del arrendamiento, las mejoras quedarán a favor de la municipalidad respectiva." Sin embargo, en su versión original, a través del Transitorio III, que estuvo vigente hasta el cuatro de octubre de mil novecientos setenta y uno, permitió titulación de terrenos dentro de la misma, bajo los siguientes parámetros: "Transitorio III.- Aquellas personas que demuestren haber poseído en forma quieta, pública, pacífica y a título de dueños, lotes o fincas en la zona marítimo-terrestre, por más de treinta años, pueden solicitar título de propiedad sobre ellos, salvo la reserva a que se refiere el artículo 6º de esta ley, aún cuando hubieren poseído tales inmuebles durante parte de ese tiempo como arrendatarios, mediante contratos suscritos con el Estado o sus Instituciones.
El procedimiento será el que marca la actual ley de Informaciones Posesorias. En este caso no habrá limitación en cuanto a la extensión del lote o finca a inscribir en cabeza del interesado." No obstante lo indicado, y en relación a la información posesoria, era la regulada por la Ley 4545, Ley de Informaciones Posesorias, que permitía un trámite administrativo ante el Instituto de Tierras y Colonización (ITCO) y que únicamente en caso de contención o de silencio por parte de ese Instituto, se acudía a la vía judicial, según lo establecía el artículo 12 de dicha ley. Para efectos de claridad, debe de indicarse que el Transitorio III, recién citado, fue derogado mediante la Ley 4847 del cuatro de octubre de mil novecientos setenta y uno, que la Ley 4558 fue suspendida en sus efectos mediante la Ley 5602 del cuatro de noviembre de mil novecientos setenta y cuatro y que fue derogada en su totalidad con la entrada en vigencia de la Ley 6043, Ley sobre la Zona Marítimo Terrestre, que es la que se encuentra actualmente vigente.
B.- DE LA TUTELA JURÍDICA DE LOS MANGLARES COMO PARTE DEL PATRIMONIO NATURAL DEL ESTADO: Está definido y este Tribunal así lo considera, los manglares forman parte del patrimonio natural y su razón reside en su importancia en el ecosistema, pues, como parte de los humedales, colaboran con el suministro de agua, para la explotación directa como para la recarga de acuíferos; regulación de flujos para el control de inundaciones; prevención y protección contra el ingreso de aguas saladas que afecten aguas subterráneas y aguas dulces superficiales; protección contra las fuerzas de la naturaleza como tormentas, huracanes, etc.; retención de sedimentos, nutrientes. Por ello, los manglares específicamente junto con los estuarios, los pastos marinos y las demás zonas marino costeras, constituyen zonas de gran importancia para la reproducción de especies marinas y por tanto, poseen un gran valor ambiental, económico, social, cultural, científico y recreativo, razón por la cual su protección como bien jurídico es un hecho fundamental para la sociedad, ya que su destrucción, menoscabo o pérdida, ocasiona grandes perjuicios, pues impacta de manera negativa un medio ambiente sustentable, y cuando su explotación es irracional afecta de manera directa el hábitat marino costero.
Es por ello que el Estado costarricense a través de diversas leyes lo ha protegido y por su importancia natural, los manglares fueron afectos al "Patrimonio Natural del Estado". Así por ejemplo, a partir de los artículos 1 y 3 de la Ley de Aguas No. 276 del 27 de agosto de 1942, el manglar está afectado como bien de dominio público. Al respecto el artículo 1 señala: "Son aguas del dominio público: I.- Las de los mares territoriales en la extensión y términos que fija el derecho internacional; II.- Las de las lagunas y esteros de las playas que se comuniquen permanente o intermitentemente con el mar; III.- Las de los lagos interiores de formación natural que estén ligados directamente a corrientes constantes; IV.- Las de los ríos y sus afluentes directos o indirectos, arroyos o manantiales desde el punto en que broten las primeras aguas permanentes hasta su desembocadura en el mar o lagos, lagunas o esteros; V.- Las de las corrientes constantes o intermitentes cuyo cauce, en toda su extensión o parte de ella, sirva de límite al territorio nacional, debiendo sujetarse el dominio de esas corrientes a lo que se haya establecido en tratados internacionales celebrados con los países limítrofes y, a falta de ellos, o en cuanto a lo no previsto, a lo dispuesto por esta ley; VI.- Las de toda corriente que directa o indirectamente afluyan a las enumeradas en la fracción V; VII.- Las que se extraigan de las minas, con la limitación señalada en el artículo 10; VIII.- Las de los manantiales que broten en las playas, zonas marítimas, cauces, vasos o riberas de propiedad nacional y, en general, todas las que nazcan en terrenos de dominio público; IX.- Las subterráneas cuyo alumbramiento no se haga por medio de pozos; y X.- Las aguas pluviales que discurran por barrancos o ramblas cuyos cauces sean de dominio público".
Por su parte el artículo tercero indica: "Son igualmente de propiedad nacional: I.- Las playas y zonas marítimas; II.- Los vasos de los lagos, lagunas y esteros de propiedad nacional; III.- Los cauces de las corrientes de dominio público; IV.- Los terrenos ganados al mar por causas naturales o por obras artificiales; V.- Los terrenos ganados a las corrientes, lagos, lagunas o esteros, por obras ejecutadas con autorización del Estado; y VI.- Las islas que se forman en los mares territoriales, en los vasos de los lagos, lagunas o esteros o en cauces de las corrientes de propiedad nacional, siempre que éstas no procedan de una bifurcación del río en terrenos de propiedad particular". Esta naturaleza jurídica de los manglares como un bien de dominio público, fue confirmada por la misma antigua Sala de Casación al indicar en el voto No. 121 de las 16 horas del 14 de noviembre de 1979; que las aguas cubiertas por el manglar no brotan en el interior de las fincas, sino que provienen del mar, y que por tanto esas aguas y los vasos comunicantes que las contienen son de dominio público y no pueden ser reducidas a propiedad privada.
En este mismo sentido de protección, los artículos 13 y 14 de la Ley Forestal, establecen que las zonas boscosas, los terrenos con aptitud forestal, los manglares y los humedales, quedan afectadas de forma inmediata a este Patrimonio, aún sin concurrencia de la Administración, situación que fue avalada por la Sala Constitucional en sentencias 1992-03789 y 1997-04587. En cuanto a la demanialidad de los manglares la ley 6043; la Ley Orgánica del Ambiente; la Ley 7224; la Ley Forestal; la Ley de Biodiversidad y la Ley de Conservación de la Vida Silvestre le da igual tutela que desde la citada "Ley de Aguas" y sus reformas y que como bienes inalienables los mismos se encuentran fuera del comercio de los hombres y no pueden ser reducidos a propiedad privada, y por tratarse de bienes afectos al Dominio Público, y por ende imprescriptibles, inalienables e inembargables. En cuanto a su tutela, le corresponde al Estado su protección en forma directa, sin necesidad de acudir al ámbito jurisdiccional, aunque desde luego puede hacerlo.
Por su parte, la Sala Constitucional en su jurisprudencia ha dicho que: “...Las Áreas Silvestres Protegidas declaradas por el Poder Ejecutivo, son bienes sujetos al régimen del Patrimonio Natural del Estado, por tener un alto valor para los ecosistemas, especies amenazadas o desde el punto de vista científico. Son delimitadas por el Poder Ejecutivo; a partir de su declaratoria se pretende dotar a estas zonas geográficas de una vocación conservacionista y proteccionista necesarias para cumplir su función. Como lo ha interpretado esta Sala, este Patrimonio alcanza tanto los terrenos públicos como los privados, sometidos a un régimen jurídico especial aunque pertenezca a un sujeto derecho público o de derecho privado. De conformidad con la legislación contenida en la Ley Orgánica del Ambiente y la Ley Forestal, estos bienes del Patrimonio Natural del Estado, soportan intereses y restricciones que superan los límites propios de los cantones, para dar lugar a un interés nacional e incluso internacional de protección...”(Sentencia No. 2010-021258 de las catorce horas del veintidós de diciembre de dos mil diez).
En cuanto a la tutela jurídica del patrimonio natural del Estado, esa Sala ha manifestado: “...En virtud de que las normas impugnadas se refieren en forma específica al Patrimonio Natural del Estado, es necesario recordar cómo ha definido la Sala este concepto: “El Patrimonio Natural del Estado es un bien de dominio público cuya su conservación y administración están encomendadas, por la ley, al Ministerio del Ambiente y Energía, mediante el Sistema Nacional de Áreas de Conservación (Ley Forestal, arts. 6 inc. a y 13 pfo.2°, y 14; Ley Orgánica del Ambiente, artículo 32, pfo. 2°). Lo integran dos importantes componentes: a) Las Áreas Silvestres Protegidas, cualquiera sea su categoría de manejo, declaradas por Ley o Decreto Ejecutivo: reservas forestales, zonas protectoras, parques nacionales, reservas biológicas, refugios nacionales de vida silvestre, humedales y monumentos naturales (Ley Forestal 7575, arts. 1°, pfo. 2°, 3° inciso i; Ley Orgánica del Ambiente 7554, artículo 32; Ley de Biodiversidad N° 7788, arts. 22 y sigts. y 58; Ley del Servicio de Parques Nacionales N° 6084, artículo 3° incs. d y f, en relación con la Ley Orgánica del MINAE N° 7152 y su Reglamento; Ley de Conservación de la Vida Silvestre N° 7317, artículo 82, inciso a). b) Los demás bosques y terrenos forestales o de aptitud forestal del Estado e instituciones públicas (artículo 13 de la Ley Forestal), que tienen una afectación legal inmediata.
Para la zona marítimo terrestre, la misma Ley 6043 (artículo 73) excluye de su ámbito las Áreas Silvestres Protegidas y las sujeta a su propia legislación. El resto de áreas boscosas y terrenos de aptitud forestal de los litorales, están también bajo la administración del Ministerio del Ambiente y se rigen por su normativa específica (Ley Forestal, artículo 13 y concordantes)” (ver sentencia No. 2008-016975 de las catorce horas y cincuenta y tres minutos del doce de noviembre del dos mil ocho).
Visto lo anterior, del examen del caso, lo primero que debe decirse es que la representación de la demandada acepta que el inmueble discutido, en parte de su área se encuentra incluido en zona demanial pública y no su totalidad, lo cual es cierto y así lo ha tenido por acreditado este Tribunal. Ergo, a partir de ello, está claro, de acuerdo con los elementos normativos de marras, al pertenecer el mangle a una categoría superior de humedales, éste se encuentren en propiedades del Estado (que pertenezcan a cualquier ente, órgano u organismo estatal), por lo que forman parte de ese patrimonio, dado que se les clasifica como terrenos forestales (ver Decreto Ejecutivo 36786 del 12 de agosto de 2011); además, los manglares o bosques salados y los esteros, al formar parte de la zona pública en la zona marítimo terrestre, área inalienable según el artículo 1 de la Ley sobre la zona marítimo terrestre “el carácter demanial de la zona marítimo terrestre (o ribera marina como se le denominó antiguamente) se reconoce desde tiempo inmemorial, y el Derecho Romano mismo recoge ese status, como "res communes" y "extra comercium" (ver voto No. 447-91 de 15:30 horas del 21 de febrero de 1991), constituyen reserva forestal y están afectados a la Ley Forestal 7575 del 13 de febrero de 1996 de acuerdo con el artículo 13 de esa ley.
En todo caso, la Sala Constitucional ha venido precisando este tema, considerando: “Interesa resaltar la forma en que está conformado el patrimonio forestal del Estado, en tanto en él se da una doble naturaleza, en primer lugar, por el patrimonio natural del Estado, conformado por reservas forestales, reservas biológicas, zonas protectoras, refugios de vida silvestre, humedales y monumentos naturales (artículo 32 de la Ley Orgánica del Ambiente, número 7554, de dieciocho de setiembre de mil novecientos noventa y cinco), al cual se le dota de la condición de bien de dominio público, al tenor de lo dispuesto en el artículo 14 de la Ley Forestal, número 7575...” (Ver sentencia de la Sala Constitucional No. 2011-16938). Conforme a lo expuesto, las zonas de manglar como parte de los humedales, y su apropiación aún por práctica y conducta lícita, aprovechada por parte de particulares está vedada, por calificarse como un bien de dominio público, y por ende, se le aplica los principios de imprescriptibilidad, enajenabilidad e inembargabilidad, y los particulares que reclamen su titularidad o bien la ostenten bajo la titularidad registral, deben acreditar, primero, que el inmueble no está en zona demanial afectada y segundo, que se adquirió bajo las excepciones dadas por la ley, resultando, que de las probanzas lo único demostrado es que el inmueble con matrícula 139159 del partido de Puntarenas con el plano P-861478-2003 y actualmente inscrito registralmente a nombre de MICHAEL ALBERT FRANCIS y RODRIGO LUIS CHAMBERLAIN, se comprende parcialmente y no su totalidad, en áreas incluidas dentro de la demarcación de la zona marítimo terrestre por ocupación de manglar, contigua a la ría del Río Tusubres y ZMT, estimándose inclusión en ZMT del río Tusubres ocupada en el año 1974 alrededor de 109.348m2 (70.9%) de la propiedad y del río Tusubres 37.460m2 (24.3%) generando un aproximado de 146.808m2 (95.2%) del total del inmueble en zona pública demanial incluida en patrimonio natural del Estado (ver informe DIG-TOT-INF-115-2021 de 29 de setiembre de 2021, ver plano en imagen 18, 20-28 de expediente judicial), lo que no impide que se falle este asunto con lugar pero de forma parcial en lo que más adelante se detallará.
Por la ubicación y demarcación del inmueble en los porcentajes indicados en zonas de dominio público, el mismo está fuera del comercio de los hombres, de manera que resultan imprescriptibles, inembargables e inalienables, y gozan de un régimen jurídico especial reforzado (artículos 261 y 262 del Código Civil y 121 inciso 14 de la Constitución Política). De acuerdo con la Sala Constitucional (sentencia N°2007-2408 16:13 horas del 21 de febrero de 2007) "se trata de bienes cuya titularidad ostenta el Estado en su condición de administrador, por lo que debe entenderse que se trata de bienes que pertenecen a la Nación (...) lo cual implica que por el transcurso del tiempo, no puede adquirirse el derecho de propiedad sobre ellos, ni siquiera de mera posesión, es decir, no pueden adquirirse mediante la usucapión (...) y son inalienables, lo que se traduce en la condición de que están fuera del comercio de los hombres; de donde no pueden ser enajenados, vendidos o adquiridos, ni a título gratuito ni oneroso, ni por particulares, ni por el Estado, de modo que están excepcionados del comercio de los hombres y sujetos a un régimen jurídico especial y reforzado." Suma a ello, que a pesar de la existencia del principio de la publicidad registral, este cede a otro de mayor interés interés y de mayor protección jurídica, cual es el principio de inmatriculación, puesto que la eficacia del régimen demanial es per se y su existencia y publicidad se da con autonomía del Registro, sin que sea dable al titular registral alegar desconocimiento como medio para desvirtuarlo y contrarrestar la afectación.
Los principios de inalienabilidad e imprescriptibilidad que caracterizan el dominio público impiden que en su contra pueda esgrimirse la figura del tercero registral para consolidar la propiedad privada ilícitamente sustraída de ese régimen. El demanio tiene publicidad legal. Lo anterior va aparejado al principio de inmatriculación de los inmuebles componentes del dominio público, el cual cuenta con una publicidad material y no necesariamente formal o registral. Frente al dominio público, las detentaciones privadas adolecen de valor obstativo, por prolongadas que sean en el tiempo y aunque aparezcan amparadas por asientos del Registro de la Propiedad. La condición de bien de dominio público y uso público afecta a tercero, aunque tal cualidad no resulte del Registro de la Propiedad. Se trata de bienes que, por su naturaleza, no necesitan de la inscripción registral. (ver entre otros Sentencia N° 868-2001, de las 10:15 horas del 16 de octubre de 2001 Sala Constitucional y Sentencia N°189-F-S1-2011, de las 9:15 horas del 3 de marzo de 2011 de Sala Primera)
En consecuencia, de la normativa aplicable indicada ut supra y en asocio al cuadro fáctico, que evidencia la intromisión en gran medida de la heredad en cuestión, por estar mayormente inmersa dentro de la zona marítimo terrestre de dominio público y, sin justo título anterior a la afectación pública, y en correspondencia con la pretensión del Estado, en cuanto solicitó que se sancione la nulidad y cancelación de los asientos de inscripción en el Registro de Bienes Inmuebles del Registro Nacional de la propiedad del Partido de Puntarenas con matrícula 139159 -dividida en dos derechos, 001 y 002- con el plano P-861478-2003, aunado a lo quedó ampliamente detallado en el apartado de hechos probados de esta resolución, en donde se consignó el historial/antecedente del inmueble en cita y de la información contenida del informe DIG-TOT-INF-115-2021 de 29 de setiembre de 2021, arriba este Tribunal a otorgar credibilidad a dicho informe, por demás, también ante la falta de demostración en contrario, por lo que se tiene como cierto que dicho inmueble se encuentran con inclusión aproximada del 95.2% dentro del Patrimonio del Estado correspondiente a la Zona Marítimo Terrestre y de Manglar.
Es con base en estos elementos y bajo la estimación que si bien el inmueble fue adquirido de forma lícita cuando ya se había consolidado el derecho de propiedad del transmitente, amparados a los principios de publicidad registral, que la buena fe de los demandados en tales negocios jurídicos no demerita en absoluto el carácter demanial del área del terreno afectado, puesto que en virtud del principio de inmatriculación de los bienes de dominio público, a dicho régimen no le es oponible el principio de publicidad registral como defensa para mantener un título de propiedad privada, salvo que el particular demostrara que su título era preexistente a la constitución del demanio en los terrenos disputados, como ya se había indicado. Dado que la inscripción final de la finca discutida en este asunto proviene de los movimientos registrales apuntados en los hechos 2 a 5 de esta sentencia, resulta acreditado en este caso que el Estado tiene parcialmente razón en su pretensión de modificación de los documentos registrados y siendo así, está en todo su derecho de recuperar el área de dominio pleno sobre el patrimonio demanial incluido en el inmueble inscrito (artículo 264 del Código Civil), con la salvedad que es únicamente, en la porción incluida sobre esa área de exclusión -95.2%, entendiéndose que de conformidad con el numeral 320 del Código Civil, la acción la puede ejercer el dueño "primigenio" tanto frente a poseedores (sean éstos de buena o de mala fe), como también frente a terceros que lograron inscribir posteriormente un título registral sobre la misma finca (fenómeno de doble matriculación), producto de un trámite de información posesoria o por la vía de procedimientos de titulación de tierras, como se ha dado en la especie.
Al haber quedado acreditado tanto en sede administrativa como judicial que el inmueble de los demandados se sobrepone en gran parte y no en todo, a un terreno que goza de todas las características propias del demanio público; resulta evidente que las inscripciones examinadas no debieron prosperar dado que, por su naturaleza ya explicada, no puede convalidarse por ninguna vía, ni siquiera por el transcurso del tiempo, sobre todo teniendo en consideración que la prueba recabada, que consistió fundamentalmente en el informe rendido DIG-TOT-INF-115-2021 de 29 de setiembre de 2021, establece parcialmente áreas incluidas dentro de la demarcación de la zona marítimo terrestre por ocupación de manglar, contigua a la ría del Río Tusubres y ZMT, estimándose inclusión en ZMT del río Tusubres ocupada en el año 1974 alrededor de 109.348m2 (70.9%) de la propiedad y del río Tusubres 37.460m2 (24.3%) generando un aproximado de 146.808m2 (95.2%) del total del inmueble en zona pública demanial, pero que resulta omiso, en el tanto, no demarca con exactitud bajo rumbos, azimut y coordenadas, el área restante específica de ocupación privativa, y sobre la cual, la presente acción no puede oponerse a los demandados, bajo pena de entenderse como una expropiación de hecho y la transgresión a la propiedad privada.
Colofón. En este sentido, y bajo las consideraciones expuestas, ha de indicándose que las actuaciones encontradas por el Instituto Geográfico Nacional del Registro Público en su informe de cita, hacen que sea imposible generar derechos tanto para el comprador original como los sucesivos adquirentes debido a que la inscripción no subsana los vicios de origen o antecedente que contenga y, por lo tanto, es incapaz de generar derechos para el titular original o los posteriores de buena fe, como resultan ser los demandados actuales sobre la totalidad del área de la finca en cuestión. Se reitera que las inscripciones registrales examinadas no surten ni conceden derecho real alguno susceptible de protección privada sobre el patrimonio demanial inmerso en la finca inscrita, ni tampoco sobre ellos pueden imponerse válidamente gravámenes de cualquier tipo, sea por título de garantía de crédito u otro en confrontación legal del régimen demanial, toda vez que sustrae del comercio de los hombres el inmueble de marras, en la parte ocupada sobre el demanio público y el mangle.
Así, con base en las consideraciones de hecho y de derecho expuestas, procede bajo el dimensionamiento de los efectos de esta sentencia, declarar parcialmente con lugar la demanda interpuesta por el Estado, por estar en su gran mayoría el inmueble dentro de la zona marítimo terrestre de dominio público y de mangle (95.2%) y sin justo título anterior a la afectación, en área exclusiva y excluyente donde regirán las potestades de autotutela demanial a cargo de la Administración activa competente, ordenándose la restitución del área porcentual del terreno por ser este perteneciente al Estado, con la obligada disminución de cabida del área inscrita del inmueble, debiendo quedar el resto privado en cabeza de los demandados. Por consiguiente, el Registro Público hará preceptivamente la modificación por el exceso de cabida ilegítima que instrumentaliza la inscripción de la matrícula dada, esto con la información que se recabará en la ejecución de sentencia, dejándose sin efecto el plano catastral P-861478-2003, por no ser coincidente con lo el remanente que le corresponde a los demamdados y en ese orden, deberá el Estado, por medio de la institución respectiva, una vez que el restante porcentaje de área privada correspondiente a 7.383.86m2 -4.8%- del área total del inmueble sea debidamente deslindada, ubicada y amojonada, par separar el área demanial a favor del Estado, a fin de que el inmueble 6-139159-001-002 sea ajustado al área privada solamente con un plano ajustado a su realidad.
La determinación de los linderos de los terrenos a reivindicar a favor del Estado, se hará en fase de ejecución de sentencia con auxilio pericial o por medio del Instituto Geográfico Nacional del Registro Público, según amerita la instrumentación de esta sentencia para su debida eficacia hasta lograrse el nueno plano catastral respectivo, por lo que se le llama la atención de la representación del Estado, en el sentido expuesto, para efectos de que se ejerzan las acciones correspondientes, lo que implica, determinar la ubicación del área privada correspondiente a 7.383.86m2 -4.8%-, como igualmente la atención a los demandados para que por su cuenta y coordinación con el Estado logren el cometido de esta sentencia. Este resultado resolutivo contradice por infundada, la afirmación de los demandados en cuanto a que "En este caso en ninguna parte de la demanda (hechos, pretensión y/o prueba documental) se indica con toda claridad y especificidad, cuál es la parte de la finca que está dentro de la zona marítimo terrestre y adónde está ubicada, datos indispensables para el ejercicio correcto de la defensa de mis representados y para que el Despacho Judicial pueda emitir una resolución de fondo debidamente fundamentada y con hechos y datos ciertos y comprobables".
Se ordena la restitución a favor del Estado del área indicada del demanio público correspondiente a 146.808m2 (95.2%) del total del inmueble de marras, esto en aplicación del numeral 122 del CPCA, incisos a), b) c), d), f), k) l), que faculta al Estado para impugnar cualquier extensión anómala en su perjuicio de la tierra de dominio público aquí reivindicada o faltantes de cabida en las zonas que se ha ordenado reivindicar, si hubiere mérito. Entiende el Tribunal, que lo deseable y pertinente era contar con un mapa o plano integral de la toda la zona en conflicto que haya sido levantado a partir del uso de un sistema de posicionamiento global (GPS), el cual sí permite obtener las coordenadas geográficas reales y de alta precisión de un determinado lugar, o bien un levantamiento a partir de un posicionamiento por puntos georeferenciados de ortofotos (fotografías aéreas corregidas) y no sólo con vista en fotografías aéreas de vieja data, ya que éstas pueden presentar errores naturales en la interpretación de los detalles de la superficie, debido a variables físicos de situ, lo que agrava la falta de precisión de dichos documentos públicos, por lo que debe también tutelarse el derecho de propiedad privada del restante citado y le quede como remante privativo, quedando así condicionada la eficacia de esta sentencia, hasta que lo ordenado sea debida y cabalmente diligenciado en los términos señalados.
VIII: DE LAS EXCEPCIONES DE FALTA DE FALTA DE DERECHO Y FALTA DE CAUSA: Por las razones indicadas en considerandos previos deben acogerse las excepciones opuestas en el tanto y en relación a la exclusión de la matrícula 6-139159-001-002 con el porcentaje de área privada 4.8% correspondiente a 7.383.86m2 del área total del inmueble, la cual deberá quedar debidamente deslindada, ubicada y amojonada de acuerdo a lo indicado atrás de previa a la anulación ordenada.
Por la naturaleza reinvindicatoria del presente proceso, originado por conductas lícitas precedentes que llevaron a los demandados a la adquisición de la propiedad registral del inmueble de cita, procede declarar la eximente de condena de las costas del proceso a las partes litigantes de acuerdo con el inciso b) del artículo 193 del Código Procesal Contencioso Administrativo.
POR TANTO
Se acogen las excepciones de falta de derecho y falta de causa en relación a la anulación del asiento registral de inscripción de la matrícula 6-139159-001-002 y de su plano catastro correlativo P-861478-2003 en el tanto y en relación a la exclusión de la matrícula 6-139159-001-002 con el porcentaje de área privada 4.8% correspondiente a 7.383.86m2 del área total del inmueble. En consecuencia, procede declarar parcialmente con lugar la demanda interpuesta por el Estado, ordenándose la restitución del área porcentual del terreno por ser este perteneciente al Estado, con la obligada disminución de cabida del área inscrita del inmueble, debiendo quedar el resto privado en cabeza de los demandados. Por consiguiente, el Registro Público hará la modificación por el exceso de cabida ilegítima que instrumentaliza la inscripción de la matrícula dada, esto con la ejecución de sentencia que se extienda, una vez que el restante porcentaje de área privada correspondiente a 7.383.86m2 -4.8%- del área total del inmueble sea debidamente deslindada, ubicada y amojonada, reservándose el área demanial a favor del Estado, a fin de que el inmueble 6-139159-001-002 sea ajustado al área privada únicamente, quedando así condicionada esta sentencia hasta tanto ello no sea ejecutado de la manera dispuesta.
La determinación de los linderos de los terrenos a reivindicar a favor del Estado, se hará en fase de ejecución de sentencia con auxilio pericial o por medio del Instituto Geográfico Nacional del Registro Público, según amerita la instrumentación de esta sentencia para su debida eficacia, con la extensión del plano catastral correspondiente.
