MUNICIPALIDAD DE MORA N° 2025007450 ADMINISTRATIVE AND TAX CIVIL COURT, SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at fourteen hours and five minutes on the twenty-fourth of July, two thousand twenty-five.- This Court, acting as the NON-HIERARCHICAL REVIEWER OF LEGALITY, hears the appeal filed by GUADAMUZ Y CASTRO, S.A., holder of legal entity identification number 3-101-245099, represented by Ms. XINIA GUADAMUZ CASTRO, of legal age, holder of identity card number 1-0710-0117, against decision AMR-026-2024 issued by the Alcaldía Municipal de Mora.
CONSIDERING

The following facts of significance for deciding this matter are deemed established:
The plaintiff’s representative states, in summary, that she applied for a construction permit and submitted the requirements requested for her project, but the application was denied because it involved commercial use on a right-of-way easement. She states that processing of her application was stayed pending completion of the administrative proceeding to reopen the public road or a determination as to whether it was a right-of-way easement, although the plaintiff had not requested that proceeding, thereby impairing the process and resulting in the denial of her application. She explains that she holds a compliant land-use certificate for a plant nursery and that new criteria unrelated to the subject matter were subsequently imposed. She argues that the sole ground stated for the denial is access via an easement and the absence of a public road, even though the reopening proceeding was conducted, and that none of the points raised by her representative was addressed.
She states that an opinion was requested from INVU, but INVU does not issue binding opinions regarding access to commercial establishments. She contends that the interpretation used to deny authorization for her project is unlawful and that she holds environmental approval (viabilidad ambiental) on zoning grounds because SETENA approved her project. She emphasizes that her business license for a plant nursery was approved, thereby authorizing a commercial operation regardless of the existence of a right-of-way easement. She requests that the action be granted, that she be issued the business license, and that the construction permit and compensation in the amounts she calculates for property damage, non-pecuniary damage, losses, and costs be awarded. The appellant states that the challenged conduct is invalid because she applied for a building permit and submitted the requirements requested for her project, but the application was denied because it involved commercial use on a right-of-way easement (servidumbre de paso). She states that her application was suspended pending completion of the administrative proceeding to reopen a public road or determine whether it was a right-of-way easement, which had not been requested by the appellant, thereby undermining the process and resulting in the denial of her application. In this regard, it must be understood that municipal powers, viewed in their dual capacity as both a power and a duty, are authorities entrusted by the Costa Rican legal system to local governments, including planning, oversight, control, and management powers exercised through the autonomy granted under Articles 170 et seq. of the Political Constitution and throughout the Municipal Code.
Their functions are carried out through sovereign powers (potestades de imperio), which are nondelegable, nontransferable, and nonwaivable, as established in Article 66 of the General Law of Public Administration. These powers include, most notably, oversight of all urban-development processes and assurance of compliance with all urban-planning regulations, in order to ensure that human settlements provide suitable housing and environmental conditions. Having clarified the foregoing, it should be noted that a land-use certificate (certificado de uso de suelo) is an administrative act by which the local Administration certifies whether or not the use of the land conforms to the applicable zoning provisions (Article 28 of the Urban Planning Law). By its nature, it directly affects the legal sphere of the individual subject to the Administration and is therefore capable of producing effects independently, since its content may declare the existence of limitations on the exercise of the attributes of the right to property, pursuant to urban-planning regulations and the environmental regime in force, thereby permitting or preventing subsequent decisions by private parties, including investments involving construction or business-license impacts.
Nevertheless, an application for a building permit or building license entails an analysis of the technical factors applicable to the proposal before it may be approved. Although a nursery may have existed on the property in question, as the appellant states, each application requires a separate analysis, as indicated by the local government, given the differing nature and urban-development impact of each activity. In other words, the land-use certificate does not replace the building license because, as stated, the applicant must comply with the applicable guidelines. In this case, it was determined that access to property N.° 1-374981-000, owned by the appellant, is through a private easement because, through official letter AMR-025-2024 issued at nine o’clock on March 20, 2024, the respondent issued the final decision in the proceeding to reopen a public road in the following terms: “FIRST: The proceeding to reopen the public road described on property N.° 1-83798-000, without a cadastral plan, which serves real properties registered under N.° 1-374981, cadastral plan N.° SJ-902450-1990; N.° 1-83711, cadastral plan N.° SJ-969729-1991; and N.° 1-83790, cadastral plan n.° SJ-1117237-2006, is hereby denied, and consequently the existence of a public road has not been proven...” (visible at pages 234 to 250 of the digital case file).
In view of the grievances described by the appellant, this Court reviewed the challenged decision, which found that the building permit sought by the appellant could not be regularized because access to the proposed development is by means of a right-of-way easement, a circumstance that was analyzed and confirmed in a separate proceeding to open a public street—cited above—the final outcome of which was not challenged by the appellant (there is no evidence of this in the record). The appellant submitted an inquiry to the Instituto Nacional de Vivienda y Urbanismo, Article 4 of whose Organic Law provides that it is responsible for advising State agencies and other Public Institutions and coordinating public initiatives concerning housing and urban development when so requested. In summary, regarding the uses and structures permitted in the area in question for the proposed activity, the Instituto stated that it must be carried out fronting a public street, in order to safeguard the sustained use of existing road resources and infrastructure.
Accordingly, the Court finds no improper statement of reasons for the decision, considering the activity and the implications and responsibilities associated with the proposed development, and therefore concludes that the decision issued is in accordance with law. The Court must reiterate that the proposed activity, access to which is through a right-of-way easement, cannot support commercial use, given the logical increase in vehicular and pedestrian traffic, which entails the large-scale entry of persons who are not residents of the 4 parcels adjoining the property (which use the easement) and could adversely affect them, as asserted by the respondent. Since the record currently contains no mutual agreement among the owners of the parcels concerning the creation of the easement that would authorize the appellant to conduct her activity, together with the legal formalities that this entails, the administrative actions appear free of any defect. The appeal must therefore be denied, the challenged decision affirmed, and, because no further appeal is available, the administrative remedies must be deemed exhausted.
In the case before us, the appellant’s claims for compensation are manifestly not subject to resolution in this proceeding because they fall outside the jurisdiction of this reviewing authority, and this must be so declared. They exceed the jurisdiction of the nonhierarchical municipal legality-review body (contralor no jerárquico de legalidad), as they constitute a matter that must be brought, fully litigated, and decided before the court of competent jurisdiction, pursuant to Articles 49 and 173 of the Political Constitution; Articles 181, 190 et seq. of the General Law of Public Administration; Articles 162 et seq. of the Municipal Code; and Article 2(b) of the Administrative Litigation Procedure Code. In view of the foregoing, it is evident that the appellant seeks compensation for the various types of damages she claims. No administrative remedies need be exhausted before this Court, because doing so would entail the exercise of powers that, under the Political Constitution and the law, are reserved to the Courts of Justice and not to the nonhierarchical legality-review body through an administrative appeal, which requires rejection of the relief sought. Accordingly, if the appellant deems it appropriate and no other circumstance prevents her from doing so, she may proceed directly to the corresponding judicial forum to exercise her rights.-
Because these proceedings were conducted electronically, the parties may obtain a complete copy containing both the administrative case file submitted by the Municipal Corporation and all documents comprising this appeal, for which purpose they must provide an electronic storage device (USB flash drive or compact disc). MUNICIPALIDAD DE MORA N° 2025007450 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las catorce horas con cinco minutos del veinticuatro de Julio del dos mil veinticinco.- Conoce este Tribunal, como CONTRALOR NO JERÁRQUICO DE LEGALIDAD, del recurso de apelación interpuesto por GUADAMUZ Y CASTRO, S.A, portadora de la cédula jurídica 3-101-245099 representada por la señora XINIA GUADAMUZ CASTRO, mayor, portadora de la cédula de identidad 1-0710-0117, en contra de la resolución AMR-026-2024 emitida por la Alcaldía Municipal de Mora.
CONSIDERANDO
Redacta la Jueza Hernández Orias;
De importancia para la resolución del presente asunto se tiene como acreditado lo siguiente:
indica la representante de la parte actora, en síntesis, que gestionó permiso constructivo y presentó los requisitos solicitados para su proyecto, que fue denegado por ser uso comercial en servidumbre de paso. Indica que se suspendió su gestión hasta concluir el procedimiento administrativo de reapertura de vía pública o determinar si se trataba de una servidumbre de paso, que no fue solicitado por la parte actora, lo cual produjo un deterioro del proceso denegando su gestión. Expone que posee un uso de suelo conforme para vivero y que luego se establecieron criterios nuevos que no pertenecen a la materia. Alega que el único argumento que se establece para el rechazo es el acceso por servidumbre y que no existe calle pública, aún cuando se realizó el procedimiento de reapertura y que no se desarrolló ninguno de los elementos establecidos por su representación. Indica que se le requirió criterio al INVU pero que éste no emite criterios vinculantes en materia de acceso a establecimientos comerciales.
Plantea que la interpretación que le deniega el establecimiento de su proyecto es ilegal y que posee la viabilidad ambiental por razones de zonificación, ya que SETENA aprobó su proyecto. Recalca que se aprobó su patente comercial para vivero, estableciendo un comercio sin importar la existencia de una servidumbre de paso. Solicita se declare con lugar la acción, se le otorgue la licencia comercial y se establezca el permiso de construcción e indemnización de sumas que cuantifica por concepto de por daño material, daño moral, perjuicios y costas. (visible de folio 265 a 290 del expediente digital).
la parte actora indica que la conducta cuestionada se encuentra viciada de nulidad por cuanto gestionó permiso constructivo y presentó los requisitos solicitados para su proyecto, que fue denegado por ser uso comercial en servidumbre de paso. Indica que se suspendió su gestión hasta concluir el procedimiento administrativo de reapertura de vía pública o determinar si se trataba de una servidumbre de paso, que no fue solicitado por la parte actora, lo cual produjo un deterioro del proceso denegando su gestión. Sobre el particular debe entenderse que las potestades municipales, entendidas en su doble condición de poder-deber, son atribuciones que el ordenamiento costarricense encomienda a los gobiernos locales que incluyen facultades de planificación, vigilancia, control y dirección que se despliegan a través de la autonomía otorgada en los ordinales 170 y siguientes de la Constitución Política y a lo largo de todo el texto del Código Municipal.
Sus funciones son llevadas a cabo mediante las potestades de imperio, competencias que devienen en indelegables, intransferibles e irrenunciables, conforme lo establece el artículo 66 de la Ley General de la Administración Pública. Esas facultades incluyen, por excelencia, la vigilancia de todo proceso urbanístico y el aseguramiento del cumplimiento de toda la normativa urbanística a efecto de garantizar que los asentamientos humanos brindan condiciones habitacionales y ambientales idóneas. Aclarado lo anterior, debe indicarse que el certificado de uso de suelo es un acto administrativo mediante el cual la Administración local acredita la conformidad o no del uso del suelo con lo establecido en la zonificación respectiva (artículo 28 de la Ley de Planificación Urbana) por su naturaleza, incide directamente sobre la esfera jurídica del administrado, de modo que es capaz de surtir efectos de manera independiente, puesto que su contenido puede enunciar la existencia de limitaciones al ejercicio de los atributos del derecho propiedad, en aplicación de las regulaciones urbanísticas y el régimen ambiental vigente, que permite o impide la toma de decisiones posteriores por parte de los particulares, incluyendo inversiones de impacto de tipo constructivo o de patentes.
No obstante, la gestión del permiso o licencia constructiva implica implica el análisis de factores técnicos aplicables a la propuesta para su aprobación y si bien pudo haber existido un vivero para la finca en cuestión, como lo indica la actora, cada gestión requiere un análisis separado, tal y como lo indica el gobierno local, dada la naturaleza diversa y el impacto urbanístico de cada actividad. Es decir, el certificado de uso de suelo no reemplaza a la licencia constructiva, ya que -como se indicó- se requiere del cumplimiento de lineamientos a los cuales debe ajustarse la parte que gestiona. En la especie se logró determinar que el acceso a la finca N.° 1-374981-000, propiedad de la actora es a través de una servidumbre privada, ya que la accionada, mediante oficio AMR-025-2024 de las nueve horas del 20 de marzo del 2024 emite acto final de procedimiento de reapertura de vía pública en los siguientes términos: "PRIMERO: Se declara sin lugar el procedimiento de reapertura de vía pública descrito en la propiedad N.° 1-83798-000 sin plano catrastro, mismo que sirve a los bienes inmuebles matrículas N.° 1-374981, plano catastrado N.° SJ-902450-1990, N.° 1-83711, plano catastrado N.° SJ-969729-1991 y N.° 1-83790, plano catastrado n.° SJ-1117237-2006 y en consecuencia no se prueba la existencia de un camino público..." (visible de folio 234 a 250 del expediente digital).
Dados los agravios descritos por la parte actora este Tribunal ha procedido con la revisión de la resolución que se impugna en la cual se dispone la imposibilidad de regularizar el permiso de construcción gestionado por la actora, ello por cuanto el acceso al emprendimiento que se pretende desarrollar comprende una servidumbre de paso, situación que fue analizada y confirmada en procedimiento de apertura de calle pública independiente -anteriormente citado- cuyo resultado final no fue impugnado por la actora (no existe prueba de ello en autos). La parte accionante remite consulta ante el Instituto Nacional de Vivienda y Urbanismo, quien en el numeral 4 de su Ley Orgánica dispone que le corresponde asesorar a los organismos del Estado y demás Instituciones Públicas y coordinar las iniciativas públicas en asuntos de vivienda y urbanización, cuando así se solicite, en la cual en síntesis expone, con respecto al los usos y construcciones permitidos en la zona en cuestión para la actividad a desarrollar, que se lleve a cabo frente a calle pública, en resguardo del uso sostenido de los recursos e infraestructura vial existente.
Ante lo cual el Tribunal no aprecia la existencia de una incorrecta motivación de lo dispuesto en consideración de la actividad, las implicaciones y responsabilidades que trae aparejado el desarrollo citado, en virtud de lo cual se estima que la resolución dictada se encuentra conforme a derecho. El Tribunal debe reiterar que el desarrollo de la actividad pretendida, cuyo acceso es mediante servidumbre de paso, no da pie para un uso comercial dado el lógico incremento vehicular y peatonal, lo cual implica el ingreso masivo de personas que no son residentes de los 4 fundos colindantes a la finca (que utilizan la servidumbre) y les pueda generar una afectación, tal y como lo plantea la accionada. Siendo que al momento no consta en autos común acuerdo de los fundos en lo relativo a la constitución de la servidumbre que habilite a la actora para su actividad, con las formalidades legales que ello implica, las actuaciones administrativas se aprecian sin vicio alguno, de modo que debe declararse sin lugar el recurso interpuesto, la resolución impugnada debe ser confirmada y, al no haber ulterior recurso, se ha de dar por agotada la vía administrativa.
En el caso que nos ocupa las pretensiones indemnizatorias que realiza la actora son abiertamente improcedentes de resolución en esta vía, al no ser competencia de esta Jerarquía y así debe declararse, al exceder la competencia del contralor no jerárquico de legalidad en materia municipal, pues constituye un asunto que debe plantearse, discutirse en forma plenaria y resolverse en la sede jurisdiccional competente, conforme a lo dispuesto en los artículos 49 y 173 de la Constitución Política; 181, 190 y siguientes de la Ley General de la Administración Pública; 162 y siguientes del Código Municipal; artículo 2 inciso b) del Código Procesal Contencioso Administrativo. En razón de lo expuesto, siendo evidente que lo pretendido por la parte apelante es la indemnización por los daños de diversa índole que reclama, ninguna vía administrativa debe agotarse ante este Tribunal, pues ello implicaría el ejercicio de competencias que están reservadas conforme a la Constitución Política y a la Ley, a los Tribunales de Justicia y no al contralor no jerárquico de legalidad por la vía del recurso administrativo, lo que implica el rechazo de lo pretendido. Así las cosas, puede la parte si lo tiene a bien y si ninguna otra situación lo impide, acudir directamente a la vía jurisdiccional correspondiente en el ejercicio de sus derechos.-
Al haberse sustanciado esta sede en forma electrónica, queda a disposición de las partes obtener una copia integral que contiene tanto el expediente administrativo remitido por la Corporación Municipal así como la totalidad de las piezas que conforman la presente alzada, para lo cual deberá aportar el dispositivo electrónico de almacenamiento (llave maya o disco compacto). Asimismo, en caso que hubiere ingresado documentación física o electrónica (planos, fotografías, informes, etc) que permanezca aún en custodia el Despacho, podrá retirarla quien la aportó en un plazo de 30 días hábiles, de conformidad con lo dispuesto en el artículo 12 del Reglamento sobre Expediente Electrónico ante el Poder Judicial, aprobado por la Corte Plena en sesión n.° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial n.° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión n.° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO
