Judge Castro García drafts the opinion; and,

WHEREAS:

I. CLAIMS

The plaintiff filed this ordinary action, requesting that the judgment declare: “That because both properties, partly owned by ALFA ALBA, S.A., are landlocked, an adequate and sufficient outlet to a public road, or a compulsory right-of-way easement (servidumbre forzosa de paso) for travel on foot, horseback, by vehicle, or by any means of transportation, must be declared in their favor; in this specific case, through the only possible access, which the properties have always had on the eastern side, with a width appropriate to the needs of the dominant estates (propiedades dominantes) and which, taking their use into account, shall be no less than seven meters wide throughout its entire length; That, consequently, said passage shall follow the route we have always used, as I explained in the seventh factual allegation of the complaint, crossing the property of COLIBRIS DE LA MONTAÑA, S.A.; once the passage has been legally established, fencing may be installed on both sides of the easement (servidumbre), and all necessary modernization and maintenance work may be performed; That the judgment order the Registro Público to record, in favor of the landlocked parcels and against the properties of the defendant company, the compulsory right-of-way easement for travel on foot, horseback, by vehicle, or by any means of transportation, and that the corresponding certified enforcement copy of the judgment (ejecutoria) be issued; That because the foregoing claims are reasonable and supported by law, if the defendant raises any opposition, I request that it be ordered to pay both categories of costs (ambas costas) of this action.

My principal satisfies the two requirements for granting this action: namely, that both properties owned by ALFA ALBA, S.A. are landlocked and adjoin the defendant company’s property, which in turn adjoins a public street, and that the properties lack access to a public street or road” (See electronic case file downloaded in PDF format, images 18).

II. DEFENSES RAISED

Carlos Saborío Víquez, acting as representative of the defendant company, filed a timely answer denying the claim and raised the defenses (excepciones) of lack of legal entitlement (falta de derecho) and lack of interest (falta de interés). (See electronic case file in PDF format, images 50 to 56).

III. JUDGMENT APPEALED

Judge Edgar Eduber Calvo Solano, of the Juzgado Agrario del Primer Circuito Judicial de Alajuela, in judgment 2023000263, issued at eight hours and seven minutes on the twenty-first of November of the year two thousand twenty-three, ruled: «THEREFORE: The defenses of lack of legal entitlement and lack of interest asserted by Colibrís de la Montaña Sociedad Anónima are rejected. Consequently, the complaint is granted as follows, and shall be deemed denied in all respects not expressly granted:

  • 1)the Registrar of the Registro Público de la Propiedad is ordered to record a right-of-way easement against the property in the Heredia registry district, Real Property Folio registration number 171468-000, described in survey plan H-267141- 1995, and in favor of the properties with Real Property Folio registration numbers 26734 and 22340, of which Alfa Alba Sociedad Anónima is a co-owner;
  • 2)The easement shall be seven meters wide, run from east to west until reaching the public street, and be located parallel to the southern boundary of property number 171468-000, extending from vertices one to seven of Cadastral Plan H-267141-1995, which corresponds to property number 171468-000. The easement has an approximate length of eighty-eight linear meters;
  • 3)In enforcement-of-judgment proceedings (ejecución de sentencia), the price that the plaintiff must pay for said easement shall be established;
  • 4)Considering that the defendant litigated in good faith and also had grounds to litigate, it is exempted from paying both categories of costs of this action». (See electronic case file, images 419 to 431).

IV.Carlos Gerardo Saborío Víquez, in his capacity as general attorney-in-fact without limitation as to amount (apoderado generalísimo sin límite de suma) of Colibrís de la Montaña S.A, filed an appeal (recurso de apelación) together with a concurrent motion for nullity (nulidad concomitante). In his filing, he sets forth the following grounds for disagreement: Failure to Locate the Undivided Interests (Derechos Indivisos). In the first proven fact, the judgment recognizes the plaintiff’s interests in a property, but there is no evidence in the record establishing the specific location of those interests within the property or any actual acts of possession (actos de posesión) over them. He counters that, in Costa Rica, the Ley de Localización de Derechos Indivisos requires that, in order to exercise rights in rem (derechos reales) over a portion of a property, those interests must be duly located and established in the proceedings, which did not occur in this case.

He contends that there is no evidence in the record establishing where the plaintiff company’s interests are located; they could not be located even during the judicial inspection hearing (audiencia de reconocimiento judicial), although the property has an area of almost seventy thousand square meters. Similarly, he argues, there is no evidence demonstrating acts of possession exercised by the plaintiff over its corresponding interests. No agricultural activities (livestock, crops, or structures) were observed, and he questions how a judgment can grant an easement (servidumbre) benefiting land whose location was likewise not verified in accordance with the Ley de Localización de Derechos Indivisos. He asserts that the plaintiff was required to prove that it had located those co-ownership interests (derechos de copropiedad) in order to establish acts of possession, but no evidence to that effect exists.

He states that the defendant company holds title to the property upon which the easement is erroneously imposed and that, in the same property, the appellant also co-owns interests 9, 10 and 11 by virtue of existing litigation against the plaintiff company for the collection of professional fees. Those proceedings remain pending in court as of today. Existing sufficient access to a public road and indeterminate boundaries. He argues that the judgment states: “both of the plaintiff’s properties form a single physical unit; this access serves both properties because there is an internal road within the plaintiff’s properties that connects them and crosses both of them until it connects with this access track depicted in the sketch from the expert report submitted.” He asserts that this proven fact in the challenged judgment demonstrates that the plaintiff does have sufficient access. The legal issue does not concern sufficient access but rather the work that the plaintiff must perform to accomplish its objective.

The plaintiff has sought to avoid doing so at all costs by attempting to impose an easement in its favor to which it is not entitled, as is demonstrated by the expert opinion (dictamen pericial), which clearly explains the matter in technical terms. He challenges the following statement in the judgment: “Physically, there is a marked road, not surfaced with gravel but covered with vegetation, which begins at the western boundary of the plaintiff’s property and winds along the eastern boundary of the defendant’s property until reaching a public road through the western boundary of the defendant’s property. This route is approximately 300 meters long ... •” (boldface and underlining not in the original). He argues that this reveals uncertainty because it states that this would be the eastern boundary of the defendant’s property without clearly establishing that fact, demonstrating an improper assessment of the evidence produced in the record contrary to the applicable rules.

He alleges that, as stated, it could very well be another boundary, and that if the plaintiff company’s interests in the property have not been located, a right in rem of this nature cannot be granted for the benefit of a parcel (fundo) whose identity is ultimately unknown and regarding which there is no evidence of acts of possession. Regarding the route used. He asserts that there is no evidence whatsoever in the record that the plaintiff, whose interests have not been located, used the access route at issue, which the judgment concludes has been used and over which it grants a right burdening the property of the appellant defendant company. It is further stated that the plaintiff may make whatever improvements it wishes, although he believes this will not occur because, despite having its own access, as established by the technical evidence contained in the expert report, it has been unwilling to perform the work required to maintain its access properly, much less would it do so on the disputed access.

Regarding the access lane cited in the judgment. The ruling states that there is an access lane (Calle derrumbes), which he considers erroneous because what the judicial inspection demonstrated was the plaintiff’s failure to perform the maintenance in which it is responsible for investing. Moreover, that road is used by other neighbors, a fact that could be verified but was not mentioned in the judgment. He states that he submits, as evidence for the court’s better determination (prueba para mejor proveer), photographs taken on the same day as the hearing and judicial inspection, from which the use made of that road can be inferred. The same road is used by the family of Silvia Lara, whose property borders Yurro, as well as by the Familia Alfaro and the property known as the Finca de Teletica. This is also addressed by the testimony of the witness he offered, which appears in the recording but was not cited.

Regarding the road’s lack of public status. He complains that the unproven facts state that it was not established that the track providing access to the plaintiff company’s properties is a public road under the administration of the Municipalidad de Santa Bárbara de Heredia. He argues that these proceedings are not intended to determine whether it is a public road. He notes that municipal engineer Ingeniero Trejos stated that these roads exist because they are designated as access roads to properties and are therefore maintained by the respective owners; however, this was not analyzed in the judgment. Landlocked status (enclave) or sufficiency of access. He contends that the expert evidence clearly established that the plaintiff’s property is not landlocked so as to justify granting an easement. He considers it within the expert’s competence to advise the adjudicator whether the parcels are landlocked.

He disagrees with the contrary statement in the judgment because the expert was indeed appointed to determine that issue. The challenged decision states that the expert must ordinarily consider through which property the route to a public road would be shortest, whether it is possible to construct an easement over very steep or very wet land, the value of the easement, and so forth—that is, the advantages and disadvantages of each potential location of the easement. Nevertheless, the expert report must also establish whether the parcel for which the easement is sought is landlocked. In this case, the expert himself stated that this circumstance does not exist, and therefore the easement cannot be declared. In addition, the judgment focuses on whether access is sufficient. It does not consider whether the interests were located, applying a legal concept not defined by law. What is regulated in cases such as this one is whether the parcel is landlocked.

The expert opinion determined that it is not landlocked and that sufficient access does exist. What is actually occurring, he argues, is that the plaintiff does not wish to invest in providing the maintenance required by its existing road, as other neighbors in that area have done. It is easier to burden a property such as the appellant’s, which throughout all these years has provided the maintenance required to keep the road passable. He counters that the issue in this case is the party’s refusal to maintain its existing road, not whether the parcel is landlocked or lacks sufficient access. Violation of substantive rules and breach of the rules governing the assessment of evidence through failure to consider evidence (preterición) and improper interpretation. He invokes the improper assessment of evidence (previously understood as an error of law, which he proceeds to define). He asserts that this occurred because each item of evidence was not assigned its legally prescribed weight or because the required method for assessing that evidence under current law was not observed.

This occurs when one item of proof is favored with respect to facts alleged in the complaint and answer that form part of the grounds for the claim or opposition. This violates the duty to analyze all evidentiary materials as a whole. (FAILURE TO CONSIDER EVIDENCE [PRETERICIÓN DE LA PRUEBA]). He argues that the dispute has centered on the plaintiff’s request for a declaration of an easement over interests it holds in the plaintiff’s property that have not been located and in which the appellant defendant also holds interests. The improper assessment of the evidence lies in the fact that the expert report did determine that the referenced property and its interests have sufficient access and that the property is not landlocked, which is why the complaint is unfounded. The plaintiff therefore lacks the right to have the referenced easement granted. He complains that the evidence he offered is conclusive and that the defect in the judgment is its failure to analyze the body of evidence in full, leaving the defendants without an adequate defense in violation of constitutional principles.

He asserts that the testimony he offered was not analyzed, although it contains highly significant evidence demonstrating what has historically occurred with the entrance to the property in which the plaintiff claims interests. This failure to analyze the evidence inevitably renders the judgment at issue null and void, and it must therefore be so declared. Concurrently with the appeal, he invokes the nullity of the judgment so that the proceedings may be redirected to their proper course and the matter decided as required by law. Evidence for the court’s better determination (prueba para mejor resolver). He submits photographs that he states depict the disputed road in question. He states that this was shown during the Judicial Inspection (Reconocimiento Judicial), but complains that its results were never disclosed to the parties. He argues that these photographs show the access lane, which the plaintiff is responsible for maintaining but has refused to maintain in order to avoid spending money on the corresponding work.

He also submits photographs showing the condition of the road known as Cuesta del Pato, which is in perfect condition and which neighbors use without any difficulty. (See electronic case file, images 434 to 465).

V- Evidence for the court’s better determination. Pursuant to article 52 of the Ley de Jurisdicción Agraria, the evidence for the court’s better determination offered by the defendant company, consisting of photographs of the route that it states must be regarded as the plaintiff company’s properties’ access to a public road, is rejected as unnecessary because sufficient evidence exists regarding the course of the road at issue and the other road whose existence is alleged and which appears in the photographs. The Court finds that a judicial inspection was conducted in the presence of both parties and that the corresponding photographs were taken during that inspection and subjected to adversarial examination (contradictorio).

VI- Nullity (nulidad). The party claims that the evidence was inadequately assessed, invoking evidentiary omission (preterición). It therefore seeks nullification of the judgment on the ground that relevant testimonial and documentary evidence was not analyzed, leaving it without a defense (indefensión). It alleges that erroneous weight was assigned to the evidence because the testimonial evidence offered by the undersigned was not analyzed, although that testimony provides evidence of utmost importance for demonstrating what has historically occurred with the entrance to the property whose rights are invoked by the plaintiff. That failure to analyze the evidence inevitably renders the judgment in question null and void, and it must therefore be so declared. In addition, the claim states that photographs and other evidence demonstrating the condition and use of the road were submitted as evidence for better adjudication (prueba para mejor resolver), but were not duly considered in the judgment under appeal.

The nullity invoked on grounds of evidentiary omission or an erroneous comprehensive assessment of the body of evidence (acervo probatorio) submitted to the case record is rejected. A reading of the judgment on appeal shows that it analyzed the facts alleged in the complaint, the answer, and the arguments of both parties. All of this was weighed against the documentary evidence, judicial inspection (reconocimiento judicial), and expert evidence (prueba pericial) presented and subjected to adversarial examination (contradictorio), in accordance with artículo 54 de la Ley de Jurisdicción Agraria applicable thereto (Transitorio I Ley 9609). In this particular case, testimony was received only from one witness offered by the plaintiff: Rosa María Eduarte González, known as Mayela Eduarte González. However, the appellant does not indicate in the appeal how that person’s testimony disproves the landlocked status (condición de enclave) of the plaintiff’s property established during the judicial inspection and addressed in the judgment under appeal.

This claim therefore fails to satisfy the duty to substantiate the grounds of error (agravios) in the appeal so as to vest the Court with appellate jurisdiction (competencia funcional). The appeal must precisely state the factual or legal grounds supporting the appellant’s disagreement, as required by ordinal 592 del Código de Trabajo, applied by express reference under artículo 60 de la Ley de Jurisdicción Agraria (precedents of this Court 06 del 14.01. 2011, 793 del 27.07.2011 y 205 del 20.04.2004). Those precedents emphasize that “an appeal requires appellants to state their grounds of error. An appeal lacking such substantiation and reasoning prevents this Court from reviewing the judgment, because its jurisdiction is limited to the issues raised for debate on appeal, excluding matters related to procedure, which may be reviewed sua sponte (de oficio). A sua sponte review of the substantive issues would disrupt procedural balance because, as explained, the Court considers the case on the basis of the issues of disagreement raised by the party” (voto 166 del 06.03.2009).

Nor is it specified which documentary evidence, in particular, was allegedly disregarded in the decision under appeal. This Court finds no ground for nullity and no merit in the claims concerning the assessment of the evidence. The request for nullity is rejected.

VII- Proven Facts. The proven facts (hechos probados) of the judgment under appeal are affirmed because they are supported by evidence in the record.

VIII- Unproven Facts. The unproven fact (hecho no probado) stated in the decision under appeal is affirmed because no evidence reflecting a different factual reality was submitted to the record. This Court adds the following: nor was it demonstrated that the access route to the property, described in the expert report as an access track (trocha de acceso), is public in nature and has suitable conditions for travel.

IX- Regarding the Status of Alfa Alba S.A. as Co-owner of the Properties It Describes as Landlocked (Standing (legitimación activa)) The appellant company’s disagreement on this issue regarding the granting of the complaint centers on its claims that, although Alfa Alba S.A. (defendant) is also a co-owner (copropietaria), as the owner of undivided interests (derechos indivisos) in the properties registered in Heredia under matrícula 22340-000, where it owns interests 01 and 02, and matrícula 26734, interests 01, 03, 04 and 07, the plaintiff commercial company does not have its interests physically demarcated or located pursuant to the Ley de Derechos Indivisos and therefore cannot, in its capacity as co-owner, seek the imposition of a compulsory right of way (servidumbre forzosa de paso) for the benefit of the aforementioned properties on grounds that they are landlocked or have insufficient access (salida insuficiente).

It argues that the absence of any demarcation or location of the interests makes the access route uncertain because boundaries are described confusingly and without specifying the exact location of the plaintiff’s interests. It claims that there is no evidence of possessory acts (actos posesorios) concerning the disputed access and no showing that the plaintiff has actually used it. It further claims that granting a real right of easement (derecho real de servidumbre) over the defendant’s property without clear knowledge of the plaintiff’s interests constitutes a serious evidentiary deficiency. This Court rejects those appellate claims relating to the standing to bring the real action (acción real) filed herein. Having reviewed the appellate claims, the record, and the judgment under appeal, the allegations are rejected. First, it should be noted that the co-ownership regime (régimen de la copropiedad) governing real property is subject to the provisions of artículo 270 a 274 y 864 del Código Civil.

The first provision cited states: “when a thing belongs simultaneously to two or more persons, the owners jointly exercise all the rights of a sole owner, in proportion to each person’s share in the commonly owned property. A co-owner may not, however, dispose of a specific part of the thing unless it has first been awarded to that co-owner in the corresponding partition.” As follows from the provision transcribed above, the plaintiff company does have standing, by virtue of its status as co-owner, to institute the present proceeding and seek recognition of access on the grounds that its properties are landlocked or have insufficient access. The plaintiff’s co-ownership of the properties under the conditions registered in its name has not been disproved, nor is it among the objections raised on appeal. In response to those challenges, this Court notes, as did the judgment under appeal, that Alfa Alba S.A. is co-owner of interests 01,03,04 and 07 in the property registered in Alajuela under matrícula 26734 and interests 01 and 02 in the property under matrícula 22349.

Of relevance, the sixth proven fact states: “The plaintiff’s property, matrícula número 22340, shares two boundaries with property número 26734 (the plaintiff’s other property), along its western and southern boundaries. In physical terms, these properties are not divided by fences, lanes, or boundary markers (mojones) of any kind. Nor is there any indication in the field that would make it possible to locate those boundaries.” This was also stated in the first and second facts of the decision under appeal. In that capacity, the plaintiff holds ownership rights (derecho de propiedad), together with the incidents of ownership (atributos de dominio) provided under ordinal 264 in relation to ordinal 295 del Código Civil. Likewise, where properties are landlocked because they lack access to a public road or have insufficient access, the owner may bring the real action for a right of passage (obligación de paso), also referred to in legal scholarship as a “compulsory right of way,” under artículo 395 del Código Civil.

To file a complaint of this nature, it is not necessary first to legally or physically locate the co-owned interests held pursuant to the Ley de Derechos Indivisos or to physically locate the areas within the estate, as claimed on appeal. Nor is it necessary to demonstrate physical possession of the “physical areas corresponding to its interests” or establish the need to use that particular route to access a public road on the basis of a specifically located interest. That claim must therefore be rejected. Under the co-ownership regime, ownership is exercised jointly over fractional shares (porciones alícuotas). In this regard, Sala Primera de la Corte Suprema de Justicia has ruled as follows concerning this regime and the powers of co-owners: “The legal system does not condition the exercise of the right to defend property upon the joint action of all co-owners. On the contrary, acts by any one of them, insofar as they seek to protect their undemarcated rights, are fully valid and effective.

See resolución 826-2014 Sala Primera. Pursuant to ordinal 270 del Código Civil, the plaintiff herein, as a former co-owner of the property at issue in this dispute, has sufficient standing to bring the action (legitimación ad causam activa), acting alone, to seek a declaration that a mortgage proceeding and the subsequent registrations in favor of third-party purchasers are null and void, as well as restitution in his favor and that of a woman; this follows from the principle that any co-owner has standing to bring actions to protect and recover real property (acciones de tutela y de reivindicación de un inmueble), insofar as such actions benefit rather than prejudice the other co-owners. That principle is also contained in cardinales 837 y 864 del Código Civil. Under that reasoning, it is not possible to identify, within the property as a whole, the interest owned by the plaintiff, because it is an ideal and undivided interest in the entirety of the property in dispute.

See fallo 44-1991 Sala Primera (voto 801-F-2021).” (Voto Nº 00801- 2021 22 de abril del 2021 a las 09:15). Accordingly, this Court finds no limitation preventing the plaintiff company from bringing the action for a compulsory right of passage (acción de obligación forzosa de paso) pursuant to ordinal 395 del Código Civil, considering that it does have standing as a substantive prerequisite (presupuesto de fondo) of the real action that was filed and granted. The aforementioned challenges are rejected.

X- Regarding the alleged inadmissibility of the requested easement (servidumbre) because sufficient access exists, access is available by a different route, and the evidence was improperly assessed. In this regard, it claims that the following is apparent from the conclusions of the expert and documentary opinions entered into the record and from the judicial inspection (reconocimiento judicial): sufficient access exists, as acknowledged in the judgment when it reasoned that the plaintiff’s properties form a single physical unit and have an internal road connecting both properties to an access track (trocha de acceso) depicted in the expert sketch. Furthermore, the expert report clearly states that the plaintiff’s property has sufficient access to the public road and is not landlocked, making the requested easement inadmissible. It also contends that the real dispute is not the lack of access, but rather the plaintiff’s refusal to perform the necessary maintenance work on its own access, choosing instead to encumber the defendant’s property.

The judgment assessed the conclusions of the expert report. It analyzed the following matters concluded in the technical report: a) the existence of sufficient access to a public road, as it was determined that the claimant’s parcels have an internal road connecting the two properties and leading to an access track to the public road depicted in the expert sketch; b) the absence of a landlocked condition because sufficient access to the public road is available, even though the road is not surfaced with gravel, is overgrown, and therefore requires maintenance; b) the nature and maintenance of the route. It explains that this route is not a public road administered by the municipal authority and that, according to the municipal engineer, the owners of the road are responsible for maintaining it and bear such responsibility because it is currently in their possession. It also states that this road is used by other neighbors, demonstrating its private and shared nature.

Regarding the route that the defendant claims should be considered because it provides access, the judgment deemed the following proven: “ 7./ In accordance with the expert opinion and plans h-5826-1964 and H-5827-1964, property registration number 26734 has an access track located along its southern boundary, at the eastern end of the property. However, during the judicial inspection conducted, and because both of the plaintiff’s properties form a single physical unit, this access serves both properties. This is because an internal road within the plaintiff’s properties connects the two properties, crosses both of them, and connects to this access track, which is depicted in the sketch accompanying the expert opinion submitted. (See sketch two of the expert opinion and judicial inspection in the oral hearings in the digital case file); 8./ The road over which the plaintiff requests establishment of the easement is located on the defendant’s property, registration number 171468-000.

Physically, there is a demarcated road, not surfaced with gravel but overgrown, extending from the western boundary of property 26734 (the plaintiff’s property, which would be the eastern boundary of the defendant’s property) to the public road at the western boundary of the defendant’s property. This route is approximately 300 meters long. Although the expert opinion does not indicate its length, it states that it has an area of 727 thousand 30 square meters. (See judicial inspection in the oral hearings and sketches one and two of the expert opinion in the digital case file); 9./ The access track to the properties of the plaintiff corporation, depicted in sketch 2 of the expert opinion and drawn in blue, which is purportedly known as “Calle Derrumbes,” is not coded or inventoried as a cantonal public road. (See Official Letter number MSBI-071-2018, dated 20 de setiembre de 2018, issued by the Municipalidad de Santa Bárbara de Heredia / digital case file)”.

This Court must reject the arguments that sufficient access to a public road exists by another road, different from the one claimed, that crosses other parcels. It must depart from the conclusions of the expert opinion, as explained in the appealed judgment, without this constituting an erroneous weighting of the evidence. Regarding that other road which, according to the defendant, eliminates the landlocked condition of the plaintiff’s properties, this Court notes that although the road exists, as described during the judicial inspection and included in the expert opinion as an access route, that route cannot serve as access. This Chamber infers this from its review of the technical evidence in the record and from what was observed during the judicial inspection, the contents of which were not challenged. The expert report described the methodology and underlying documentation and, significantly, stated: “In its complaint, the plaintiff requests expert evidence (prueba pericial) through the appointment of a surveying expert to answer the following questions: “1) Determine whether the easement exists in fact.

Answer: The inspection, examination, and survey conducted during the expert field examination confirmed the existence of an internal road crossing the defendant’s property Nº 4-171468-000 in a west-northeast direction. The starting point of that road corresponds to the location assigned to it in plan Nº H-267141-1995, where it is identified as an easement. However, the undersigned has no personal knowledge and cannot assert that this road is an easement, since it would have had to be legally established as an encumbrance (gravamen) and recorded in the registry entry for the servient estate (finca sirviente) and the dominant estates (fincas dominantes). It is possible, however, that in the past, when the plaintiff owned the property crossed by that road, it used the road to access property Nº 4-026734-000, which at that time would have made it an “easement in fact (servidumbre de hecho).” Nevertheless, when the plaintiff sold the property that would serve as the servient estate (4-171468-000) without legally establishing or recording the easement, this gave the new owner grounds not to recognize it….. 5) Determine the total area of the land that would constitute the easement.

Answer: According to the traverse (derrotero) shown in Expert Sketch Nº 1, the total area of the land corresponding to the internal road crossing property Nº 4-171468-000, which could eventually become an easement, is 727.30 m2. 6) Determine whether the road shown on the plans exists and is recognized by the municipality as public, and whether it actually adjoins the easement. Answer: According to official letters Nº MSBI-084-2018 and MSBI-092-2018 from the Municipalidad de Santa Bárbara, the road referred to by that municipality as Calle Las Moras, which provides access to the two properties belonging to the defendant, is registered and classified as public road code C4-04-131. Between vertices Nº 1 and 2 of plan Nº H-267141- 1995, which describes property Nº 4-171468-000 belonging to the defendant, that road does in fact adjoin the internal road crossing the property, which both the plaintiff and the plan identify as an easement”.

These conclusions establish the physical existence of the disputed route, the distance it covers, and its connection to Calle Las Moras. The same evidence states: “8) Determine whether the two properties of ALFA ALBA, S.A. are landlocked estates (fundos enclavados). Answer: The field inspection established that neither property Nº 4-026734 nor property Nº 4-022340, of which the plaintiff is a co-owner, may be considered a landlocked estate, since they do have access through what the municipality refers to as tracks, which are identified in their respective plans as camino a Carrizal and vereda a Sacramento. Therefore, although these accesses allow only travel on foot or by pack animal because of their poor maintenance, they physically exist and have been established in fact, making it possible to enter the plaintiff’s properties through them; consequently, the properties are accessible and are not landlocked estates. 9) Determine whether the only access to the two properties of ALFA ALBA, S.A. is through the properties of COLIBRIS DE LA MONTAÑA SOCIEDAD ANÓNIMA.

Answer: As stated in the response to the preceding question, the two properties co-owned by the plaintiff corporation ALFA ALBA S.A. are not landlocked estates. It is therefore determined that the internal road existing on the defendant’s property Nº 4-171468-000, which both the plaintiff and plan Nº H-267141-1995 identify as an easement, is not the only access to a public road available to those properties”. As this Chamber observes, the expert evidence maintains that the property is not landlocked because those de facto roads, referred to as tracks, exist, notwithstanding their poor passability and condition. As reasoned in the appealed decision, this Court deems it proven that the route at issue is the one that provides access to a public road by means of the route that may legally be granted, because even though another track exists, it is not municipal or state-owned, since it crosses and leads to private properties.

The same expert confirmed this in his clarification of his expert opinion when he stated: “- According to the expert opinion submitted, how many privately owned properties does “the track” that purportedly provides access to my clients’ properties cross, and what are their registry entries? Answer: According to the searches conducted in the Registro Inmobiliario and the information supplied by the cadastral map of the area where the plaintiff’s properties are located, it was determined that several registered properties are geographically situated before the plaintiff’s two properties. These properties are described by cadastral plans indicating that the tracks in question are actually roads or public streets, rather than rights-of-way (servidumbres de paso). (Registry reports and images of the cadastral plans for these properties are attached to this submission.) Therefore, because these tracks are identified as roads or public streets, the registry entries for these properties contain no recorded encumbrance by a right-of-way. The following table identifies these properties, their cadastral plans, and their registered owners: .

As this Court deduces, the expert concludes that the road he identifies between properties constitutes public roads because the plans for those properties so indicate. However, this is not what was certified by the Municipality of Santa Bárbara, as the entity competent to administer local roads, which, in the communication of 20 de setiembre de 2018, Oficio MSBI-071-2018, from Engineer Jorge Trejos Molina of the Municipality of Santa Bárbara, states: “Please accept my cordial greetings. I am also responding to your inquiry concerning a road that you consider public and on which the Municipality should commence work. I inform you that, following your request, a site visit was conducted in your presence on 4 de setiembre de 2018. The purpose of the visit was to establish a reference point in order to determine whether the road you mention appears in the municipal records and inventories, so that work could be performed on it if appropriate.

The point established is shown in image #1, which appears below… (image). When the established point is plotted against the municipal road records and inventory, we can see that the road you mention has no connection whatsoever to, and does not form part of, any registered cantonal road. Indeed, the beginning of this ‘road’ shown in the image is located at a completely isolated point; therefore, for purposes of this decision, that section may be classified as an ‘access track’ (trocha de acceso). Following the site visit, you attached photographs of the cadastral plans (planos catastros) for the properties. Those plans contain sections designated as ‘Access Roads to Properties,’ which are what we have termed an ‘access track,’ as may be seen in the following image (image) … In addition to superimposing it on the municipal road inventory, an inquiry was made to the MOPT Sectoral Planning Secretariat, which informed us that the road is indeed not coded or inventoried as a cantonal public street.

Therefore, that ‘access track’ cannot be worked on by the Municipality of Santa Bárbara. At present, it functions as private access to properties, and the owners and directly interested parties are the ones who must perform maintenance in this case” (image 179 to 187, PDF view, digital case file). As this Court observes, it has been established that the routes referred to by the expert as roads or access routes—which he defines as public—are not of that nature; they are private roads between the various registered and unregistered properties that the defendant never requested be brought into the proceedings. Accordingly, the plaintiff’s properties are in fact landlocked (enclavadas), because the route through other private properties is unsuitable, and the road at issue must be granted under the legal concept of a compulsory right of way (obligación forzosa de paso), pursuant to artículo 395 del Código Civil.

This burden must continue until the current landlocked conditions caused by the insufficient outlet change and a request is made by the defendant herein, in accordance with the meaning of numeral 399 Ibidem. This Court considers it proportionate and reasonable to affirm the lower-court judgment, because the road at issue, granted as a compulsory right of way, is the only existing road that makes the plaintiff’s properties functional and usable in practice. It prevents the claimant’s properties from remaining isolated due to their landlocked condition and makes them usable; consequently, the plaintiff must compensate the defendant as determined in the decision under appeal, there having been no challenge in that regard. The foregoing follows from the conditions of both routes: the route at issue in these proceedings and the route identified in the expert evidence. This relates to the argument on appeal that the real dispute arose because the plaintiff failed to bear the expense of maintaining the roads available to it.

That argument cannot be accepted because, according to the expert and the judicial inspection (reconocimiento judicial), the route is difficult to access because of its physical condition. Expert Sketch No. 2, included in the expert evidence presented, shows the routes that the expert states provide an outlet for the properties depicted in red and blue and that are designated as access tracks (image 142, PDF view). Sketch No. 1 depicts the road at issue in these proceedings. In a supplemental response to the expert report, the expert stated (image 201 to 202, PDF view) that the report indicated that the track providing an outlet from the plaintiff’s property is passable only on foot or by pack animal because of its poor condition. According to Expert Sketch Nº 1, the portion of the road at issue crossing the property of COLIBRIS DE LA MONTAÑA SOCIEDAD ANÓNIMA is 103.88 meters long and, according to the judicial inspection, is passable and in safe condition; it was identified as a de facto easement (servidumbre de hecho) that has not been legally established.

In expert evidence subsequently submitted, the following was stated regarding that track (image 213 to 214, PDF view, digital case file): “—What is the distance of ‘the track’ from the public street to my client’s properties? Answer: As stated in the response to the first inquiry, the so-called tracks are described in all the plans listed in the preceding table as public streets. In the case of the plaintiff’s property Nº 4-026734-000, it has direct access to one of those tracks (public streets according to the plans already identified) through its southwestern sector (See Expert Sketch Nº 2 in the expert report). In other words, there is no distance to specify for this sector. However, the other track, which runs northeast and is also treated as a public street in third-party plans, reaches a point at which it forks. That branch could be regarded as a private road entering property Nº 4-026734-000, with a length of approximately 67.11 according to the bearings and distances (derroteros) between vertices Nº 13, 14 and 15 of plan Nº H-853471-1989, which describes property Nº 4-125794-000, adjoining the plaintiff’s property Nº 4-026734-000 to the southeast.

That track, which is treated as a private road, then continues for approximately 80 meters through the interior of property Nº 4-026734-000 in order to provide an outlet for the plaintiff’s property Nº 4-022340. (See images of plans Nº H-5827-1964 and Nº H-5826-1964, which describe the plaintiff’s two properties).” This Court notes, however, that the distances shown in Expert Sketch No. 1 do not demonstrate that the distances considered in that final response encompassed the entire route involved in using that road between private properties. Applying the rules of sound judicial discretion (sana crítica), it is evident that the distance is not limited to that stated in the previously cited expert evidence. The red road is far longer than the light-blue road that reaches Calle las Moras, which is the road being claimed (image 142, PDF view). In considerando VII of the judgment under appeal, the following was stated regarding the analysis of the track that the defendant asks the Court to consider in finding that the land is not landlocked: “There is no doubt that the track leading to Calle Derrumbes was, in the past, the only access road to the plaintiff company’s property and to many other properties in the area, because no alternative roads existed and those concerned had to make do with what was available.

But circumstances change, cities grow, and new roads are opened in the country. In this case, the opening of the public street to Carrizal, which reaches the defendant company’s property 171468-00 and is the street to which access is sought, means that both of the plaintiff’s properties could have relatively easy access to a public street. If established where the party requests, it could be approximately ciento veinte metros long, as compared with cinco kilómetros along the indicated track…” That description in the judgment was not challenged in the appeal before this Court; instead, emphasis was placed on the contention that the plaintiff should invest in repairing and bringing that five-kilometer track route into suitable condition. That is not an acceptable solution to apply to the claimant’s actual circumstances. As stated by the municipal authority, it lacks jurisdiction to manage that route because it is not cantonal and consists of access tracks serving private properties.

Consequently, making it passable cannot be undertaken by only one of the owners of the properties that might benefit from it, as it would be neither logical nor reasonable to impose that burden on the plaintiff. The ground of appeal (agravio) concerning the road’s condition, the viability of the route, or the possibility of treating that track as the route connecting the claimant’s properties to a public street is rejected. The judicial inspection established that it was impassable and was conducted with both parties present, confirming that the route was unsuitable. The appeal does not explain in detail what was observed during the inspection that would demonstrate different conditions, and the photographs of portions of the route submitted as evidence to assist the Court in reaching a decision do not remedy the findings made by the a quo during the judicial inspection. It is logical that different sections along a route may be in different conditions.

For that reason, the photographs were rejected. The claims that the track between the properties is in suitable condition must likewise fail for the reasons stated, as must the claim concerning the plaintiff’s failure to bear the costs of maintaining it in a condition suitable for use as an outlet from its land to a public street. On this issue, the Sala Primera de la Corte Suprema de Justicia, in judgment Nº 00380 - 2000 19 de mayo del 2000 at 16:45, held: “Consistent with the foregoing, this Chamber considers that this route is the appropriate means of resolving the landlocked condition (enclavamiento) of the plaintiffs’ property. This is because, as stated previously, in addition to the representation made by Suministros e Inversiones del Pacífico S.A., the judicial inspections conducted established that the route through that company’s property contains sections that are impassable even for four-wheel-drive vehicles, steep slopes, and constant landslides caused by water seepage.

Furthermore, the road is unstable along the edge of the precipice. All of this endangers the lives of those who travel there. By contrast, the passage through property number 27.578 is less uneven and more stable. Regarding the presence of the Proyecto Ecoturístico on that property, it was not established by the lower courts; and although the appellant in cassation (casacionista) does not challenge that point in accordance with the required formalities, the record of the judicial inspection conducted by the Court mentions … Moreover, as explained above, the danger that the other route poses to those who travel it disqualifies it as a suitable means of providing an outlet for the plaintiffs’ land. VII.—Law is reality. Accordingly, the work of the courts must always be characterized by an effort to penetrate deeply into the practical meaning of the law, without losing sight of its fundamental purposes: justice and security.

Theoretical schemes governed by rigid logic must not lead to conceptual excesses detached from reality. Such a tendency is not suitable for resolving the everyday conflicts that arise in society. If society is not scrutinized by closely observing its general conduct and its various reactions as the living organism that it is, there is a risk of turning the law into a kind of inflexible corset incapable of resolving the concrete problems of daily life. Each individual case must be interpreted in accordance with the eminently practical and human meaning of the law.

To understand it in this way means to recreate or renew it in each judgment, preventing it from becoming fossilized under the shelter of legalistic positivism or a coldly conceptual position. VIII.- In accordance with the foregoing in the preceding recital (considerando), and in relation to the route established to resolve the landlocked status (enclavamiento) of the plaintiffs’ property (fundo), it must be recalled that this is a problem with profound social and economic implications. It is therefore a matter of significant public interest. This is because, if it lacked access, or adequate access, to a public road, the property in question would become unproductive and useless, to the detriment of the national interest. The Romans understood it this way.” In resolving the specific subject matter of the proceeding, considerations of proportionality and reasonableness must be applied so as to keep the property in a condition in which it may be the object of an effective property right, fulfill its agrarian function, and retain its existing agrarian vocation, thereby safeguarding the conditions necessary to make its productive use feasible, even though it currently has no productive activities.

It is not possible to maintain land in a condition in which a total or partial impossibility of access has been established in fact. The national legislation applied in resolving the appeal entails imposing that burden on the defendant’s land in order to provide suitable access to the landlocked property, or property with insufficient access (salida insuficiente), for as long as necessary. Those criteria of proportionality and reasonableness entail limiting the rights of the persons involved, who would receive compensation in return, as ordered in the judgment under appeal. The measure is therefore proportional and reasonable and is not an unlawful or harmful solution that would effectively deprive the respondent’s property right of its substance. This entails a process of balancing (ponderación) reasonableness and proportionality. In this regard, in decision 732-2001 of 12 hours 24 minutes on 26 de enero de 2001, the Sala Constitucional de la Corte Suprema de Justicia defined the principle of reasonableness as follows: “V.- THE PRINCIPLE OF REASONABLENESS AS A CONSTITUTIONAL STANDARD.

Constitutional case law has been clear and consistent in holding that the principle of reasonableness constitutes a standard of constitutionality … In conducting the reasonableness analysis, United States doctrine calls first for an examination of what is known as ‘technical reasonableness,’ within which the specific rule (statute, regulation, etc.) is examined. Once it has been established that the selected rule is appropriate for regulating a particular matter, it is necessary to examine whether the means selected are proportional to the intended objective. Once the ‘technical reasonableness’ criterion has been satisfied, ‘legal reasonableness’ must be analyzed. For this purpose, this doctrine proposes examining: a) balancing reasonableness, which is a type of legal assessment undertaken when, given the existence of a particular antecedent circumstance (e.g., income), a particular obligation is required (e.g., a tax), in which case it must be established whether that obligation is equivalent or proportional; b) equality-based reasonableness, which is the type of legal assessment based on the premise that equal antecedent circumstances must produce equal consequences, without arbitrary exceptions; c) purpose-based reasonableness, which assesses whether the objective to be achieved is inconsistent with the purposes contemplated by the legislature in approving the measure.

Within this same analysis, it is not sufficient to assert that a means is reasonably suited to an end; it is also necessary to verify the nature and extent of the limitation that a personal right must bear as a result of that means. Thus, if the same end can be achieved through another means that imposes a less burdensome limitation on personal rights, the chosen means is not reasonable...” (To the same effect, Judgments Nos. 843-02 of 30 de enero de 2002; 5374-03 of 20 de junio de 2003; 340-04 of 16 de enero de 2004; 846-05 of 28 de enero de 2005; 1800-05 of 23 de febrero de 2005; 2236-05 of 2 de marzo de 2005; 1806-06 of 15 de febrero de 2006; 1807-06 of 15 de febrero de 2006 and 1557-07 of 7 de febrero de 2007 and 1571-08 of 15 de enero de 2008)”. In this matter, the conclusion is that the imposition of a compulsory right-of-way obligation (obligación forzosa de paso) in favor of the plaintiff’s property, by means of the path visible on the defendant’s land, must be affirmed because it is necessary, while the other route alleged to provide access cannot be considered functional and suitable.

There are interests protected by law, particularly Agrarian Law (Derecho Agrario), that are intended to ensure a reasonable degree of safety for persons using access routes and to safeguard the property’s agrarian vocation for as long as the landlocked condition or insufficient access persists. Although it has been argued that the plaintiff does not engage in an agrarian activity, when constitutional standards are applied to impose right-of-way obligations due to a landlocked condition or insufficient access, the social, agrarian, and environmental function and vocation of the property must indeed be considered. This is consistent with the criteria of proportionality and reasonableness. Accordingly, in this case, the other route does not resolve the landlocked status of the plaintiff’s properties. The grounds of appeal are rejected.

IX- For the reasons stated, pursuant to Articles 1 and 2 of the Agrarian Jurisdiction Law (Ley de Jurisdicción Agraria) and numeral 395 of the Civil Code (Código Civil), the evidence offered by Colibrís de la Montaña S.A. for further consideration is rejected, and the motion for nullity (nulidad) is denied. As to the matters appealed, the judgment under review shall be affirmed.

THEREFORE

The photographic evidence offered by Colibrís de la Montaña S.A. for further consideration is rejected. The motion for nullity is denied. As to the matters appealed, judgment number 2023000263, issued at eight hours and seven minutes on the twenty-first of November of the year two thousand twenty-three, is affirmed.

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las veintiuno horas doce minutos del veintisiete de junio de dos mil veinticinco.- PROCESO ORDINARIO interpuesto por ALFA ALBA SOCIEDAD ANÓNIMA, cédula jurídica tres - ciento uno - ciento cincuenta y dos mil veintiuno, representada por su apoderado generalísimo sin límite de suma Hermanus Cornelis Wijnberg, conocido como Henry Wynberg, mayor, divorciado, holandés, vecino de Alajuela, cédula de residencia número siete cuatro dos - uno uno cero tres cinco nueve - cuatro dos seis; contra COLIBRÍS DE LA MONTAÑA SOCIEDAD ANÓNIMA, cédula jurídica tres - ciento uno - quinientos treinta y un mil veintidós, representada por su apoderado generalísimo sin límite de suma Carlos Gerardo Saborío Víquez, mayor, casado, profesor, vecino de Heredia, cédula de identidad dos - trescientos cuarenta y uno - doscientos siete.

Actúan como abogados directores de la parte actora los licenciados Arnoldo Javier Morales Sánchez, cédula de identidad uno - setecientos ocho - cuatrocientos dos, carné veintiún mil cuatrocientos veinticinco; y el licenciado Jorge Gerardo Cerdas Pérez, cédula de identidad uno - ochocientos - trescientos trece, carné seis mil quinientos sesenta; de la sociedad demandada el licenciado Ricardo Chacón Cuadra colegiado seis mil novecientos noventa. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de Alajuela.

Redacta la jueza Castro García; y,

CONSIDERANDO:

I. DE LAS PRETENSIONES

La parte actora interpuso la presente demanda ordinaria, solicitando que se declare en sentencia: " Que al ser ambos fundos propiedad en parte de la sociedad ALFA ALBA, S.A. enclavados, debe declararse a favor de ellos una salida idónea y suficiente a vía pública o servidumbre forzosa de paso a pie, caballo, vehículo y cualquier medio de transporte y en este caso específico a través del acceso único posible y que siempre han tenido las fincas por el rumbo este con ancho acorde con las necesidades de las propiedades dominantes y que tomando en cuenta su uso no sea menor a siete metros de ancho por todo su largo, Que en consecuencia dicho paso será por donde siempre hemos salido como le expliqué en el hecho séptimo de la demanda, atravesando la propiedad de COLIBRIS DE LA MONTAÑA, S.A., pudiendo una vez legalmente constituido el paso, cercarse a ambos lados de la servidumbre y efectuarle todos los arreglos necesarios de modernización y mantenimiento que requiera, Se ordene en sentencia al registro Público inscribir a favor de los predios enclavados y en contra de las propiedades de la sociedad demandada la servidumbre forzosa de paso a pie, caballo, vehículo o cualquier medio de transporte, expidiéndose la ejecutoria del correspondiente, Que siendo lógicas y amparadas a la Ley las pretensiones dichas, si existiere oposición alguna por la demandada, solicito se le condene al pago de ambas costas de esta acción.

Mi representada cumple con los dos requisitos para declararse con lugar la presente demanda: sean que ambos fundos propiedad de ALFA ALBA, S.A. son enclavados y colindantes con la sociedad demandada, quién a su vez colinda con calle pública, y que las fincas carecen de salida a calle o camino público"(Ver expediente electrónico descargado en formato pdf, imágenes del 18).

II. EXCEPCIONES DEDUCIDAS

Carlos Saborío Víquez, en calidad de representante de la sociedad demandada, contestó en tiempo y de forma negativa, e interpone las excepciones falta de derecho y de falta de interés. (Ver expediente electrónico en formato PDF, imágenes 50 a 56).

III. RESOLUCIÓN APELADA

El juez Edgar Eduber Calvo Solano, del Juzgado Agrario del Primer Circuito Judicial de Alajuela, en sentencia 2023000263, de las ocho horas con siete minutos del veintiuno de noviembre del año dos mil veintitrés, resolvió: «POR TANTO: Se rechazan las excepciones de falta de derecho y de falta de interés opuestas por Colibrís de la Montaña Sociedad Anónima. En consecuencia se declara con lugar la demanda de la siguiente manera, entendiéndose denegada en todo aquello que no se indiqué:

  • 1)se ordena al señor Registrador del Registro Público de la Propiedad inscribir una servidumbre de paso en contra de la finca del Partido de Heredia con Matrícula de Folio Real número 171468-000, y que se describe en el plano H-267141- 1995 y a favor de las fincas con Matrículas de Folio Real números 26734 y 22340 de las cuales es copropietaria la sociedad Alfa Alba Sociedad Anónima;
  • 2)La servidumbre tendrá un ancho de siete metros, con un rumbo de este a oeste hasta llegar a calle pública, y se ubicará de forma paralela al lindero sur de la finca número 171468-000, que va de los vértices uno al siete del Plano Catastrado H-267141-1995, que se corresponde con la finca número 171468-000. La servidumbre tiene una longitud aproximada de ochenta y ocho metros lineales;
  • 3)Mediante ejecución de sentencia se establecerá el precio que ha de pagar la parte actora por la servidumbre dicha;
  • 4)Considerando que la parte demandada litigó de buena fe, y que además tenía razones para litigar se le exonera del pago de ambas costas de esta acción». (Ver expediente electrónico imágenes 419 a 431).

IV.Carlos Gerardo Saborío Víquez, en su condición de apoderado generalísimo sin límite de suma de Colibrís de la Montaña S.A interpuso recurso de apelación y nulidad concomitante. Expone en su gestión los siguientes temas de disconformidad: Falta de Localización de los Derechos Indivisos. La sentencia reconoce en el hecho probado primero los derechos sobre una finca en favor de la parte actora, pero no existe prueba en el expediente que acredite la localización específica de esos derechos dentro del inmueble, ni actos de posesión efectivos sobre los mismos. En Costa Rica, refuta, la Ley de Localización de Derechos Indivisos exige que, para ejercer derechos reales sobre una porción de finca, estos derechos deben estar debidamente localizados y acreditados en el proceso, lo que no ocurrió en este caso. Agravia, no existe en los autos prueba que acredite dónde tiene ubicados esos derechos la sociedad actora, ni siquiera en la audiencia de reconocimiento judicial se logró ubicarlos, siendo una propiedad con cabida de casi setenta mil metros cuadrados.

En igual sentido, arguye, tampoco existe prueba que evidencie actos de posesión desplegados por la parte actora en los derechos que le corresponden. No se visualizaron actos agrarios (ganado, siembras, construcciones) y se cuestiona cómo puede en sentencia concederse una servidumbre a favor de un terreno, que tampoco verificó la localización acorde con la Ley de Localización de Derechos Indivisos. Acusa, resultaba necesario que la parte actora acreditara haber localizado dichos derechos de copropiedad a fin de lograr acreditar los actos de posesión, sin que medie prueba al respecto. Señala la sociedad demandada es titular del derecho de propiedad de la finca contra la cual se Impone la servidumbre de manera errónea e igualmente en la finca, la apelante también es dueña en copropiedad de los derechos 9, 10 y 11, en virtud de litigio existente por cobro de honorarios contra la sociedad actora.

Proceso judicializado a la fecha de hoy. Salida suficiente a calle pública existente e indeterminación de linderos. Arguye, en la sentencia se cita: "ambas fincas de la actora conforman una unidad material, este acceso sirve a ambas fincas, pues dentro de la fincas de la actora hay un camino interno que conecta a ambas fincas, y las cruza a ambas hasta conectarse con esta trocha de acceso que se grafica en el croquis de la pericial rendida". Esboza que ese hecho probado del fallo recurrido lo que evidencia es que la parte actora sí tiene suficiente salida. El fenómeno jurídico no tiene que ver con la salida suficiente, sino con la obra que le corresponde realizar a la parte actora para lograr su cometido. Acto que ha querido evitar a toda costa tratando de imponer una servidumbre a su favor que no le corresponde, lo que se evidencia del dictamen pericial que en forma clara lo expone técnicamente.

Combate, se afirma en la sentencia: "Materialmente hay un camino demarcado, no lastreado sino cubierto de monte, que parte de la colindancia oeste de la finca de la actora v que serpia et lindero este de la finca de la demandada hasta salir a calle pública por el lindero oeste de la finca de la demandada. Este trayecto tiene una longitud de unos 300 metros de longitud ... • (la negrilla y el subrayado no son del original). Lo que pone en evidencia la incertidumbre al citarse que sería el lindero este de la finca de la demandada, sin que lo tenga claro, mostrándose la mala apreciación de la prueba producida en autos contrario a las reglas correspondientes. Achaca, tal y como se expone bien podría ser otro el lindero y al no estar localizados los derechos de la sociedad actora en la finca cómo puede entonces otorgarse un derecho real de esta naturaleza a favor de un fundo que no se sabe cuál es en definitiva y sobre lo que no hay prueba sobre actos posesorios.

Sobre la ruta utilizada. En autos no existe prueba alguna, acusa, de que la parte actora cuyos derechos no están localizados utilizara la salida en litis que según se concluye en la sentencia se ha usado y sobre la que se otorga el derecho sobre la propiedad de la sociedad demandada recurrente. Y se afirma que la actora, podrá hacer los arreglos que quiera, considerando no ocurriría, pues teniendo su propia salida como lo afirmó la prueba técnica contenida en el informe pericial, no ha querido hacer las obras correspondientes para el debido mantenimiento de su salida, mucho menos lo va a hacer en la del conflicto. Sobre el callejón de acceso citado en el fallo. Se afirma en la resolución existe un callejón de acceso (Calle derrumbes), lo que estima erróneo pues lo que se evidenciaba en el reconocimiento judicial era la falta de mantenimiento por la parle de la actora de lo que le corresponde invertir.

Además ese camino es utilizado por otros vecinos, aspecto que se pudo constatar pero no se mencionó en la sentencia. Señala, aporta prueba para mejor proveer consistentes en fotografías tomadas el mismo día de la audiencia y reconocimiento judicial, de las que se deduce el uso que tiene ese camino. Mismo utilizado por la familia de la señora Silvia Lara, cuya propiedad limita con el Yurro, así como la Familia Alfaro y la Finca conocida como la Finca de Teletica. Sobre lo que declaró la testigo que propuso por su parte, constante en la grabación no citada. Sobre la falta de naturaleza pública de calle. Reclama, en el hecho no probado se menciona no fue sea acreditado que la trocha que da acceso a las fincas de la sociedad actora sea una calle pública bajo la administración de la Municipalidad de Santa Bárbara de Heredia. Aduce, este proceso no tiene como finalidad determinar si es camino público.

Hace ver, el ingeniero municipal Ingeniero Trejos indica que estos caminos existen porque son declarados caminos de acceso a fincas y por lo tanto el mantenimiento lo hacen los dueños respectivos; sin que eso se analizara en la sentencia. Enclave o suficiencia de salida. Agravia, quedó claro en la pericial no se encuentra la finca de la actora en condición de enclave que justifique el otorgamiento de una servidumbre. Considera si es competencia del perito indicarle a la persona juzgadora si los fundos se encuentran en esa condición de enclave o no. Sin que esté de acuerdo con lo citado en la sentencia en sentido contrario, debido a que el perito si fue nombrado para determinar ese aspecto. Se indica en la pieza recurrida, normalmente el perito debe tomar en cuenta por cuál inmueble la salida a calle pública es más corta o si es posible construir una servidumbre en un terreno con mucha inclinación, o muy húmedo, el valor de la servidumbre, etc. Sea los pros y los contras· que tiene cada uno de las posibles opciones de ubicación de la servidumbre.

Sin embargo, en la pericial también debe establecerse si con relación al fundo para el cual se pide el otorgamiento de la servidumbre está enclavado o no. Y que en el presente caso el propio perito manifestó que no existe en el caso ese supuesto, de ahí que la servidumbre no es posible declararla. Además, se centra la atención en el fallo si la salida es suficiente o no. Sin considerarse si los derechos estaban localizados o no, existiendo un concepto jurídico no determinado por la Ley. Lo que si se regula en casos como el presente, es si el fundo está enclavado o no. En la pericia se dictaminó que no está enclavado y si existe salida suficiente. Lo que ocurre, apela, es que la parte actora no quiere invertir en brindar ese mantenimiento que le corresponde al camino con que cuenta, como si lo han hecho otros vecinos de ese lugar. Siendo más sencillo afectar una finca como la de la apelante, que a lo largo de todos estos años ha dado el mantenimiento que se requiere para que el camino esta habilitado.

Refuta, lo que sucede en el caso es la negativa del parte de dar mantenimiento al camino con que cuenta y no si es fundo enclavado o si no cuenta con salida suficiente. Violación de normas sustantivas e infracción a las reglas de la valoración de la prueba por preterición e inadecuada interpretación. Invoca la indebida valoración de la prueba (anteriormente entendido como error de derecho que procede a definir). Acusa, lo ocurrido sucede por no asignarse el valor legal que cada probanza tiene, o bien, inobservare la forma en que debe valorar ese elemento, a tenor de la legislación vigente. Lo que sucede al preferirse algún elemento demostrativo, respecto de hechos aducidos en la demanda y contestación, y que forma parte de su causa de pedir o de oponerse. Que transgrede el deber de analizar todo el material probatorio en su conjunto. (PRETERICIÓN DE LA PRUEBA). Aduce, la discusión se ha centrado en que la parte actora pretende la declaratoria de una servidumbre de unos derechos que ella tiene en la finca de la actora no localizados y en donde la recurrente demandada también tiene derechos en esa misma finca.

La mala valoración de la prueba radica en el hecho de que el informe pericial rendido sí determinó que la referida finca y sus derechos si tienen salida suficiente y que no está enclavada, razón de la improcedencia de la demanda. Careciendo la parte actora de derecho para que se conceda la servidumbre referida. Reclama, la prueba propuesta por su parte es contundente, el vicio que existe en el fallo es que no hubo análisis completo del acervo probatorio dejándole en indefensión a los demandados en violación a los principios constitucionales. Acusa, no se analizó la prueba testimonial ofrecida por su parte de la que se extraen elementos de prueba de suma importancia para demostrar a lo largo de la historia que ha ocurrido con la entrada a la finca, cuyos derechos invoca la parte actora. Esa falta de análisis de prueba provoca inevitablemente la nulidad del fallo en cuestión y por ello deberá declararse de esa manera.

Invoca la nulidad de la sentencia de forma concomitante a la apelación para reorientar el curso normal del proceso y se resuelva conforme en derecho corresponda. Prueba para mejor resolver. Se aportan fotografías que cita son del camino en litis del camino en cuestión. Que se evidenció en el Reconocimiento Judicial realizado, que reclama su resultado nunca se puso en conocimiento. Razona esas fotografías del callejón de acceso, cuyo mantenimiento le corresponde a la parte actora hacerlo y no ha querido para no erogar en la obra respectiva. Y fotos que muestran el estado del camino denominado Cuesta del Pato que se encuentra en perfectas condiciones y por donde los vecinos ingresan sin problema alguno. (Ver expediente electrónico imágenes 434 a 465).

V- Prueba para mejor resolver. Con fundamento en el artículo 52 de la Ley de Jurisdicción Agraria, se rechaza la prueba para mejor resolver ofrecida por la sociedad demandada consistente en fotografías de ruta que cita ha de tenerse como el acceso de salida a calle pública de las fincas de la sociedad actora, por resultar innecesarias dado que existe suficiencia probatoria del recorrido del camino en litis y del otro camino que se cita existe y consta en las fotografías. Se considera se realizó reconocimiento judicial en presencia de ambas partes y en tal se tomaron las fotografías correspondientes que se sometieron al contradictorio.

VI- Nulidad. La parte reclama medió una valoración deficiente de la prueba invocando preterición. Por lo que invoca la nulidad de la sentencia por omitirse el análisis de prueba testimonial y documental relevante, que le deja en indefensión. Otorgar valor erróneo a prueba aduce no se analizó la prueba testimonial ofrecida por el suscrito de la cual se extraen elementos de prueba de suma importancia para demostrar a lo largo de la historia que ha ocurrido con la entrada a la finca cuyos derechos invoca la parte actora. Esa falta de análisis de prueba provoca Inevitablemente la nulidad del fallo en cuestión y por ello deberá declararse de esa manera. Además, se señala en su reclamo como prueba para mejor resolver se aportaron fotografías y otros elementos probatorios que demuestran el estado y uso del camino, los cuales no fueron debidamente considerados en la sentencia recurrida. Se rechaza la nulidad invocada por preterición probatoria o errónea valoración integral del acervo probatorio ofrecido al expediente.

De la lectura de la sentencia venida en alzada se denota que se vertió un análisis de los hechos de la demanda, la contestación, los alegatos de ambas partes. Todo lo que se contrastó con la prueba documental, reconocimiento judicial y pericial vertida sometida al contradictorio, en apego al artículo 54 de la Ley de Jurisdicción Agraria aplicable (Transitorio I Ley 9609). En el caso concreto solamente se recibió el testimonio de una testigo ofrecida por el actor: Rosa María Eduarte González conocida como Mayela Eduarte González. Sin embargo, no se indica en el recurso la apelante de que manera el testimonio de esa persona desvirtúa la condición de enclave de la propiedad de la actora encontrada en el reconocimiento judicial y motivado en la sentencia recurrida. Incumpliéndose en este reclamo el deber de fundamentar los agravios del recurso de apelación para dotar de competencia funcional al Tribunal.

El recurso de apelación debe expresar en forma precisa los motivos de hecho o de derecho que apoyen la inconformidad, tal y como lo ordena el ordinal 592 del Código de Trabajo, aplicado por remisión expresa del artículo 60 de la Ley de Jurisdicción Agraria (precedentes de este Tribunal 06 del 14.01. 2011, 793 del 27.07.2011 y 205 del 20.04.2004). Se resalta en ellos que “el recurso de apelación exige de los quejosos una expresión de agravios. El recurso que carezca de tal fundamentación y razonamiento inhibe a esta Sede a revisar la sentencia, pues su competencia se limita a los temas que introducen a debate en la apelación, excluyendo los aspectos vinculados con el procedimiento, que son revisables de oficio. Hacer una revisión oficiosa de los temas de fondo, implicaría un quebranto al equilibrio procesal, porque tal y como se explicó el Tribunal se avoca al conocimiento del caso, en razón de los temas de disconformidad formulados por la parte” (voto 166 del 06.03.2009).

Tampoco se indica cual prueba documental en detalle se dejó de considerar en la pieza recurrida. No encuentra este Tribunal causal de nulidad, ni la procedencia de los reclamos respecto a la valoración de la prueba. Se rechaza la nulidad.

VII- Hechos Probados. Se avalan los hechos probados de la sentencia apelada, por estas sustentados en elementos probatorios que constan en autos.

VIII- Hechos no probados. Se comparte el hecho no probado de la resolución recurrida por no haberse aportado prueba a los autos que reflejen otra realidad fáctica Al mismo se agrega por esta Instancia: tampoco se demostró que la ruta de acceso a la finca denominada en la pericia como trocha de acceso sean de naturaleza pública y con condiciones idóneas de tránsito.

IX- Sobre la condición de copropietaria de la sociedad Alfa Alba S.A. de las fincas que califica como enclavadas (legitimación activa) La inconformidad de la sociedad apelante en este tema respecto a la estimación de la demanda se centra en los reclamos de que a pesar de que la sociedad Alfa Alba S.A. (demandada) sea también copropietaria en condición de dueña de derechos indivisos de las fincas de Heredia matrícula 22340-000; donde es titular de los derechos 01 y 02 y matrícula 26734 derecho 01, 03, 04 y 07. Además, la mercantil actora no tiene sus derechos materializados físicamente, ni localizados al amparo de la Ley de Derechos Indivisos como para reclamar en su condición de copropietaria la imposición de una servidumbre forzosa de paso a favor de los terrenos mencionados por enclave o salida insuficiente. Arguye en relación la ausencia de determinación o localización de derechos, hace que se torne incierto el trayecto del acceso donde se citan linderos de manera confusa y sin precisar la ubicación exacta de los derechos de la actora.

Reclamando no existe prueba de actos posesorios sobre la salida en litigio, ni se evidencia de que la actora haya hecho uso efectivo de la misma. Reclamando que otorgar un derecho real de servidumbre sobre la finca de la demandada sin contar con el conocimiento claro de los derechos de la actora es una grave deficiencia probatoria. Este Tribunal procede a rechazar esos reclamos recursivos que se vinculan con la legitimación activa de la acción real interpuesta. Vistos los reclamos recursivos, los autos y la sentencia apelada se rechazan las alegaciones. En primer orden cabe acotar el régimen de la copropiedad en los inmuebles corresponde a las regulaciones del artículo 270 a 274 y 864 del Código Civil. La primera norma citada estipula: “cuando una cosa pertenezca simultáneamente a dos o más personas, los dueños ejercen conjuntamente todos los derechos del propietario singular, en proporción a la parte que cada uno tenga en la propiedad común.

El condueño no puede, sin embargo, disponer de una parte determinada de la cosa, sin que antes le haya sido adjudicada en la respectiva división ”. Como se deduce del ordinal transcrito, la sociedad actora sí ostenta legitimación activa por su condición de copropietaria para interponer el proceso que se ventila y solicitar el reconocimiento del acceso por enclave o salida insuficiente de sus fincas. La copropiedad de las fincas en las condiciones registradas a su nombre no ha sido desvirtuada, ni es parte de los reproches recursivos. Ante esos embates señala este Tribunal, al igual que la sentencia apelada, la sociedad Alfa Alba S.A. es copropietaria de los derechos 01,03,04 y 07 de la finca de Alajuela matrícula 26734 y derechos 01 y 02 del inmueble bajo matrícula 22349. De interés, el hecho probado sexto señala que: “ La finca de la actora matrícula número 22340, tiene dos colindancias con la finca número 26734,(la otra finca de la actora) por su lindero oeste y lindero sur.

En la materialidad estas fincas no se encuentran divididas por cercas, carriles o mojones de ningún tipo. Tampoco existe indicio alguno que permita, en el campo, ubicar tales colindancias”. Así se ha consignado en el hecho primero y segundo de la pieza recurrida. Y en esa condición es titular del derecho de propiedad con los atributos de dominio del ordinal 264 en relación con el ordinal 295 del Código Civil. Igualmente, en caso de fincas en condición de enclave por ausencia de acceso a calle pública o salida insuficiente se cuenta con la acción real de obligación de paso o la denominada en la doctrina “servidumbre forzosa de paso” del artículo 395 del Código Civil. Para la interposición de una demanda de esta naturaleza no resulta necesario, que de forma previa, deba localizar jurídica o materialmente los derechos en copropiedad que ostente al amparo de la Ley de Derechos Indivisos o localice materialmente las áreas dentro de la heredad; como se reclama en la apelación.

Sea necesario demostrar la posesión material sobre las “áreas materiales que correspondan a sus derechos” o acreditar la necesidad de utilizar esa ruta concreta de acceso a calle pública acorde con su derecho localizado en específico. Por ello ha de rechazarse ese reclamo. Bajo el régimen de copropiedad se ejerce el derecho de propiedad en forma conjunta de porciones alícuotas. Al respecto la Sala Primera de la Corte Suprema de Justicia ha resuelto sobre este régimen y las facultades de las personas copropietarias: “El ordenamiento jurídico no condiciona el ejercicio del derecho de defensa de la propiedad a la actuación conjunta de todos los copropietarios. Por el contrario, los actos de uno de ellos, en tanto procuren el resguardo de sus derechos no localizados, son completamente válidos y eficaces. Ver resolución 826-2014 Sala Primera. Conforme el ordinal 270 del Código Civil, el aquí actor, como anterior condueño del inmueble objeto de esta litis, tiene suficiente legitimación ad causam activa, por sí solo, para pretender que se declare la nulidad de un proceso hipotecario, sus ulteriores inscripciones a favor de terceros adquirentes y la restitución a su favor y de una señora; lo anterior en virtud del principio de que a cualquier copropietario le asiste legitimación para ejercer las acciones de tutela y de reivindicación de un inmueble, en tanto éstas lo que aparejan es beneficio y no perjuicio a los demás condueños.

Principio que, además, se encuentra contenido en los cardinales 837 y 864 del Código Civil. En esa lógica, no es posible determinar, dentro de todo el fundo, el derecho cuya titularidad correspondía al actor, toda vez que se trata de un derecho ideal e indiviso sobre la totalidad del bien en litigio. Ver fallo 44-1991 Sala Primera (voto 801-F-2021).” (Voto Nº 00801- 2021 22 de abril del 2021 a las 09:15). De tal forma, no encuentra este Tribunal limitación alguna de la sociedad actora para haber interpuesto la acción de obligación forzosa de paso al tenor del ordinal 395 del Código Civil considerando que sí ostenta legitimación activa como presupuesto de fondo de la acción real interpuesta que se acogió. Se rechazan los embates citados.

X- Sobre la alegada improcedencia de la servidumbre solicitada por existir salida suficiente, existencia de acceso por vía diversa y deficiente valoración de la prueba. Reclama al respecto, de las conclusiones del dictamen pericial y documental vertidos en autos y del reconocimiento judicial, se desprende lo siguiente: la existencia de salida suficiente, lo que se reconoció en sentencia cuando se razonó que las fincas de la actora conforman una unidad material y cuentan con un camino interno que conecta ambas hasta una trocha de acceso graficada en el croquis pericia. Además que del informe pericial es claro en que la finca de la actora tiene salida suficiente a la vía pública y no se encuentra enclavada, resultando improcedente la servidumbre peticionada. Y aduce, que el verdadero conflicto no es la falta de salida, sino la negativa de la actora a realizar las obras de mantenimiento necesarias en su propio acceso optando por afectarse la propiedad de la parte demandada.

En la sentencia se valoraron las conclusiones del informe pericial. Donde se analiza, que en el informe técnico se concluyeron los siguientes temas: a) existencia de salida suficiente a calle pública, al haberse determinado que los terrenos de la accionante tienen un camino interno que conecta las dos propiedades que conducen a una trocha de acceso a la vía pública representante en el croquis pericial. b) Falta de enclave al disponer de una salida suficiente a la calle pública, aunque el camino no se encuentre lastreado, se encuentre cubierto de monte y por ello requerir de mantenimiento. b) naturaleza y mantenimiento de la ruta. Se expone esa ruta no es calle pública bajo administración del ente municipal y la obligación de los propietarios del camino de brindar el mantenimiento según expuso el ingeniero municipal y responsabilidad de estos de encontrarse en la posesión actual. Y que ese camino es usado por otros vecinos, que acreditan su naturaleza privada y compartida.

En la sentencia respecto a la ruta que reclama la demandada debe considerarse por dar acceso, se tuvo por probado: “ 7./ De conformidad con la pericia y de acuerdo a los planos h-5826-1964 y H-5827-1964, la finca matrícula número 26734, tiene una trocha de acceso que se ubica en su lindero sur, por el extremo este de la finca. Pero en el reconocimiento judicial practicado y dado que ambas fincas de la actora conforman una unidad material, este acceso sirve a ambas fincas. Pues dentro de la fincas de la actora hay un camino interno que conecta a ambas fincas, y las cruza a ambas hasta conectarse con esta trocha de acceso, que se grafica en el croquis de la pericial rendida. (Ver croquis dos de la pericial y reconocimiento judicial en audiencias orales de expediente digital); 8./ El camino por donde la parte actora solicita se constituya la servidumbre se ubica en la finca de la demanda matrícula número 171468-000.

Materialmente hay un camino demarcado, no lastreado sino cubierto de monte, que parte de la colindancia oeste de la finca 26734 (finca de la actora y que sería el lindero este de la finca de la demandada) hasta salir a calle pública por el lindero oeste de la finca de la demandada. Este trayecto tiene una longitud de unos 300 metros de longitud. Aunque la pericia no indica lo longitud señala que tiene un área de 727 mil 30 metros cuadrados. (Ver reconocimiento judicial en audiencias orales y croquis uno y dos de pericia en Expediente digital); 9./ La trocha de acceso a las fincas de la sociedad actora, graficada en el croquis 2 de la pericia, y dibujada de azul, que supuestamente es conocida como “Calle Derrumbes”, no se encuentra codificado o inventariado como calle pública cantonal. (Ver Oficio número MSBI-071-2018, con fecha del 20 de setiembre de 2018, emitido por la Municipalidad de Santa Bárbara de Heredia / Expediente digital)”.

Para esta Instancia los alegatos de la existencia de salida suficiente a calle pública por otro camino diverso al reclamado que discurre sobre otros fundos, debe ser denegado. Y separarse de las conclusiones del peritaje tal y como se fundamentó en la sentencia recurrida, sin que sea lo anterior otorgar a la prueba un valor erróneo. Denota esta Instancia respecto a ese otro camino alegado por la demandada que elimina la condición de enclave de las fincas de la actora que si bien el camino existe, según se describió en el reconocimiento judicial y se incluyó en la pericial como vía de salida, esa ruta no puede fungir como salida. Esto lo deduce esta Cámara de la revisión de esa prueba técnica que consta en autos y lo observado en el reconocimiento judicial que no fuera impugnado en su contenido. En el informe pericial se describió la metodología, documentación base, de importancia se describió: “La parte actora del proceso en su escrito de demanda, solicita prueba pericial para que se nombre un perito topógrafo, con el fin de que responda las siguientes consultas: “1) Determine la existencia de hecho de la servidumbre.

Respuesta: De la inspección, reconocimiento y levantamiento hecho durante la diligencia pericial de campo, se pudo confirmar la existencia de un camino interno que atraviesa con rumbo oeste-noreste la finca Nº 4-171468-000 de la demandada. Dicho camino concuerda en su inicio con la ubicación que le da al mismo el plano Nº H-267141-1995, en el que se le denomina como servidumbre. Ahora bien, el suscrito no le consta ni puede afirmar que dicho camino sea una servidumbre, ya que para ello la misma debió ser constituida jurídicamente como un gravamen, y haber sido anotada en el asiento registral de la finca sirviente y de las fincas dominantes. Ahora bien, es posible que en el pasado cuando la actora era dueña de la finca por donde atraviesa dicho camino, lo haya utilizado para el acceso a la finca Nº 4-026734-000, lo que lo convertiría para ese momento como una “servidumbre de hecho”. Sin embargo al vender la actora la finca que fungiría como fundo sirviente (4-171468-000) sin haber constituido ni registrado legalmente la servidumbre, se le dio pie al nuevo dueño para no respetarla….. 5) Que determine el área total del terreno de lo que será la servidumbre.

Respuesta: De acuerdo con el derrotero indicado en el Croquis Pericial Nº 1, el área total del terreno correspondiente al camino interno que atraviesa la finca Nº 4-171468-000, y que eventualmente podría convertirse en servidumbre, es de 727.30 m2. 6) Que determine la existencia y reconocimiento municipal de la calle como pública que indican los planos y la efectiva colindancia con la servidumbre. Respuesta: De acuerdo a los oficios de la Municipalidad de Santa Bárbara Nº MSBI-084-2018 y MSBI-092-2018, la calle denominada por dicho municipio como calle Las Moras, la cual permite el acceso a las dos fincas pertenecientes a la parte demandada, se encuentra registrada y catalogada como calle pública código C4-04-131. Dicha calle entre los vértices Nº 1 y 2 del plano Nº H-267141- 1995 que describe la finca Nº 4-171468-000 perteneciente a la demandada, efectivamente colinda con el camino interno que atraviesa dicha finca, y que tanto la parte actora como el plano lo denominan como servidumbre”.

Del estas conclusiones se denota que en la materialidad la ruta en discusión existe, cuál es la distancia que recorre y la conexión de esta con calle Las Moras. Esa misma probanza cita: “8) Que determine que las dos propiedades de ALFA ALBA, S.A. son fundos enclavados. Respuesta: Del reconocimiento hecho en el campo se pudo constatar que tanto la finca Nº 4-026734 como la finca Nº 4-022340, de la cual la parte actora es copropietaria, no pueden ser consideradas como fundos enclavados, ya que las mismas si poseen salida a través de lo que la municipalidad denomina como caminos de trocha, y en sus respectivos planos se denominan como camino a Carrizal y vereda a Sacramento. Por lo tanto aunque dichos accesos solo permitan el tránsito a pie o con bestia por su mal mantenimiento, los mismos existen en la materialidad y se encuentran de hecho constituidos, logrando a través de ellos ingresar a las fincas de la actora, siendo por tanto estas accesibles y no fundos enclavados. 9) Que determine que la única salida de las dos propiedades de ALFA ALBA, S.A. son por las propiedades de COLIBRIS DE LA MONTAÑA SOCIEDAD ANÓNIMA.

Respuesta: Como se indicó en la respuesta dada a la consulta anterior, las dos fincas en copropiedad de la sociedad actora ALFA ALBA S.A., no son fundos enclavados. Por tanto se determina que el camino interno existente en la finca Nº 4-171468-000 de la demandada, y que tanto la actora como el plano Nº H-267141-1995 denominan como servidumbre, no es la única salida a calle pública con que cuentan dichas propiedades”. Como se observa por esta Cámara, sostiene la prueba pericial que la finca no se encuentra enclavada al existir esos caminos de hecho denominados trochas, su mal estado de transitabilidad y condiciones. Tal y como se razona en la pieza recurrida, esta Instancia tiene por probado que la ruta en litis es la que da salida a calle pública por la ruta que es legalmente viable otorgarle, pues aún y cuando existe otra trocha la misma no es de naturaleza municipal o estatal al transcurrir y arribar a fincas privadas.

Así lo confirmó el mismo perito en su aclaración a su pericia cuando expuso: “- De acuerdo al peritaje rendido; por cuantos inmuebles de propiedad privada atraviesa “la trocha” que supuestamente da ingreso a los inmuebles de mis representadas; y cuáles son sus inscripciones registrales; Respuesta: De acuerdo a los estudios realizados en el Registro Inmobiliario y a la información suministrada por el mapa catastral de la zona en donde se localizan las fincas de la actora, se pudo determinar que existen varias fincas inscritas que geográficamente se encuentran antes de las dos fincas de la actora, las cuales son descritas por planos catastrados que indican que las trochas señaladas en realidad son caminos o calles públicas, y no servidumbres de paso. (Se adjuntan al presente escrito informes registrales e imágenes de planos catastrados de dichas fincas). Por lo tanto al ser dichas trochas señaladas como caminos o calles públicas, en los asientos registrales de estas fincas no se encuentra anotada la afectación por servidumbre de paso. En la siguiente tabla se indican cuáles son estas fincas, sus planos de catastro y a nombre de quien están: .

Como se deduce por esta Sede, el perito concluye que ese camino que identifica entre fincas corresponde a caminos públicos porque así lo indican los planos de tales propiedades. Sin que eso sea lo certificado por la Municipalidad de Santa Bárbara como ente competente de administrar los caminos vecinales que en el oficio del 20 de setiembre de 2018, Oficio MSBI-071-2018 del Ingeniero Jorge Trejos Molina de la Municipalidad de Santa Bárbara indica : “Por medio de la presente reciba un cordial saludo y además se da respuesta a su consulta de un camino, que para su persona es considerado como público y que la Municipalidad debe iniciar su intervención. Le comento que posterior a su solicitud se realiza visita a sitio estando su persona presente, dicha visita se realiza el día 4 de setiembre de 2018, el objetivo de la visita se basa en levantar un punto de referencia para dictaminar si el camino al que usted hace mención se encuentra dentro de los registros municipales e inventarios para que en dado caso se pueda intervenir.

El punto levantado se muestra en la imagen #1, que veremos a continuación… (imagen). Al colocar el punto levantado dentro del registro e inventario vial municipal, podemos observar que el camino al que usted hace mención no tiene conectividad alguna o forme parte de algún camino cantonal registrado, el inicio de este “camino” que se muestra en la imagen de hecho se encuentra en un punto totalmente aislado, por lo que para efectos de esta resolución dicho sector lo podemos catalogar como un “trocha de acceso” Posterior a la vista de sitio, su persona adjunta fotografías de planos catastros de las fincas, en ellos hay tramos donde se establecen como “Caminos de salidas a fincas” lo que hemos denominado como “trocha de acceso”, y así se puede apreciar en la siguiente imagen (imagen) .. Además del montaje con el inventario vial municipal, se hace consulta a la Secretaria de Planificación Sectorial de MOPT, donde se nos indica que en efecto el camino no se encuentra codificado e inventariado como calle publica cantonal.

Por tanto, dicha “trocha de acceso” no puede ser intervenido por la Municipalidad de Santa Bárbara, hasta el momento funciona y es acceso privado a fincas y son los propietarios e interesados directos que deben realizar mantenimiento en este caso” (imagen 179 a 187 modo pdf expediente digital). Como se observa por esta Instancia se constata que las rutas a las que se refiere el perito como caminos o rutas de acceso que según define son públicos, no son de esa naturaleza, son caminos privados entre las diversas fincas inscritas y no inscritas que la parte demandada nunca solicitó traer al proceso. De tal forma que las fincas de la parte actora si se encuentran enclavadas en la realidad por existir una ruta no idónea por otras fincas privadas y ser el camino en litis el que ha de concederse bajo la figura de obligación forzosa de paso al amparo del artículo 395 del Código Civil. Que ha de soportar hasta tanto no cambien las condiciones actuales de enclave por salida insuficiente y sea solicitado por la aquí demandada según la inteligencia del numeral 399 Ibidem.

Estima esta Sede resulta proporcional y razonable confirmarse la sentencia de instancia al ser el camino en litis concedido como obligación de paso, el único existente que hace que las fincas de la actora sean funcionales y aprovechables en la realidad. Mismo que no condena las propiedades de la accionante a su aislamiento por enclave, las hacen aprovechables y por lo que deberá resarcir a la demandada como se ha decidido en la resolución apelada sin que medie cuestionamiento al respecto. Lo anterior dadas las condiciones de ambas rutas: la que es objeto de este proceso y la identificada en la prueba pericial. Lo anterior tiene relación con el argumento de apelación que el conflicto real es no haberse asumido por la actora la erogación correspondiente al mantenimiento de caminos que tiene a su disposición, no resulta de recibo debido a que esa ruta es según el perito y el reconocimiento judicial es de difícil acceso por su materialidad.

En el croquis pericial N. 2 de la prueba pericial vertida se observan esas rutas que indica el perito les da salida a las fincas graficadas en color rojo y azul denominadas trochas de acceso (imagen 142 modo pdf). En el croquis N1 se dibujó el que es objeto de este proceso. En adición a la pericia se contestó por el perito (imagen 201 a 202 modo pdf) que en el informe se indicó que la trocha por la que tiene su salida la finca de la actora, solo es transitable a pie o con bestia por su mal estado. El largo del camino en litis por la propiedad de COLIBRIS DE LA MONTAÑA SOCIEDAD ANÓNIMA según el Croquis Pericial Nº 1, el camino es de 103.88 metros de distancia y según el reconocimiento judicial es transitable y en condiciones seguras identificadas como servidumbre de hecho no constituida legalmente. En pericial aportada en forma posterior se indicó respecto a esa trocha (imagen 213 a 214 modo pdf expediente digital): “- Que distancia tiene “la trocha” desde calle pública hasta los inmuebles de mi representada; Respuesta: Como se indicó en la respuesta dada a la primer consulta, las denominadas trochas se describen en todos los planos señalados en la tabla anterior como calles públicas.

En el caso de la finca Nº 4-026734-000 de la actora, la misma tiene salida directa a una de dichas trochas (calles públicas según planos ya señalados) por el sector suroeste de la misma (Véase Croquis Pericial Nº 2 del informe pericial). Es decir que por este sector no existe distancia alguna que indicar. Ahora bien, la otra trocha que tiene un rumbo noreste y que en los planos de terceros también se considera como una calle pública, llega a un punto en el que presenta una bifurcación la cual podría considerarse como un camino privado que ingresa a la finca Nº 4-026734-000 cuya longitud es de aproximadamente 67.11 según los derroteros entre los vértices Nº 13, 14 y 15 del plano Nº H-853471-1989, que describe la finca Nº 4-125794-000 colindante al sureste con la finca Nº 4-026734-000 de la actora. Luego se tiene que dicha trocha que se considera como camino privado, continúa por el interior de la finca Nº 4-026734-000 aproximadamente unos 80 metros, con el fin de darle salida a la finca Nº 4-022340 de la actora.

(Véase imágenes de los planos Nº H-5827-1964 y Nº H-5826-1964, que describen a las dos fincas de la actora)”. Cita esta Instancia, no obstante las distancias apuntadas en el croquis N. 1 pericial no se visualiza que las distancias consideradas en esta última respuesta hayan abarcado todo el trayecto que representa utilizar ese camino entre fincas privadas. Resulta evidente aplicando la sana crítica no es solo la distancia referida en esa pericial previamente citada. El camino rojo es muy superior en distancia al camino celeste que arriba a Calle las Moras que es el reclamado (imagen 142 modo pdf). En el considerando VII de la sentencia apelada respecto al análisis de la trocha que el demandado pide se considere para no tener por enclavado el terreno se indicó: “No cabe duda que la trocha, que da a la Calle Derrumbes, fue en tiempos pasados el único camino de acceso de la finca de la sociedad actora, y de muchas otras fincas del lugar, pues no existían caminos alternos para llegar y había que conformarse con lo que había.

Pero la realidad es cambiante, las ciudades crecen y nuevos caminos se abren en el país, en este caso con la apertura de la calle pública a Carrizal que llega hasta la finca 171468-00 de la sociedad demandada, que es la calle a la que se pide salida, hace que la salida de ambas fincas de la actora tengan un acceso relativamente fácil a calle pública, si se constituyera donde lo solicita la parte podría tener unos ciento veinte metros de longitud en contra de los cinco kilómetros por la trocha indicada..” Esa descripción de la sentencia no fue objetada en la apelación que conoce esta Tribunal, haciéndose énfasis en que la actora ha de invertir en reparar y poner en condiciones esa ruta de trochas de cinco kilómetros; lo que no resulta aceptable como solución a aplicarse en la realidad de la accionante. Como se consignó por el ente municipal carece de competencia para gestionar esa ruta por no ser cantonal y ser trochas de accesos de fincas privadas.

Por lo que pone en condiciones de transitabilidad no puede ser asumida solo por uno de los propietarios de las fincas que podrían aprovecharla, al no ser lógico ni razonable imponer esa carga a la actora. Se rechaza el agravio respecto a la condición del camino, la viabilidad de la ruta o la posibilidad de tener esa trocha como la vía de conexión de las propiedades de la accionante con salida a calle pública. El resultado del reconocimiento judicial arroja las condiciones de intransitabilidad y fue celebrado con ambas partes en donde se corroboró esa situación de inidoneidad. En el recurso no se expone en forma detallada que fue lo observado en el reconocimiento que demuestra otras condiciones y las fotografías aportadas como prueba para mejor resolver de partes de la ruta no subsanan lo señalado por el a quo en el reconocimiento judicial. Resulta lógico pensar que en el recorrido de una ruta existan tramos de diversa condición.

Razón por la que se rechazaron las fotografías. Igualmente han de perecer los reclamos de las condiciones idóneas de la trocha entre fincas por las razones expuestas y la omisión de la actora de asumir los costos de mantener la misma en condiciones aceptables de ser utilizada como salida a calle pública de sus terrenos. Sobre este tema la Sala Primera de la Corte Suprema de Justicia en sentencia Nº 00380 - 2000 19 de mayo del 2000 a las 16:45 sobre este tema resolvió: “ En concordancia con lo expuesto, esta Sala considera que dicho rumbo, para solucionar el problema del enclavamiento del predio de los actores, es el adecuado. Ello por cuanto, se repite, además de lo afirmado por el representante de Suministros e Inversiones del Pacífico S.A., según los reconocimientos judiciales practicados, el trayecto por la finca de esa sociedad presenta partes intransitables, incluso para vehículos de doble tracción, pendientes pronunciadas y constantes derrumbes provocados por las filtraciones de agua.

Por otro lado, es poco consistente en la orilla del precipicio. Todo ello pone en peligro la vida de quienes transiten por ahí. Por el contrario, el paso por la finca número 27.578 es menos irregular y más consistente. Tocante a la presencia del Proyecto Ecoturístico en ese inmueble, no fue acreditado por los juzgadores de instancia; y a pesar de que el casacionista no ataca ese aspecto conforme a las formalidades de rigor, en el acta de reconocimiento judicial efectuado por el Tribunal se menciona … Además, conforme se expuso, la peligrosidad del otro trayecto para quienes lo transiten, lo descarta como adecuado para darle salida al fundo de los actores. VII.- El derecho es realidad. Por ende, la labor de los tribunales ha de estar siempre caracterizada por el empeño de penetrar profundamente en el sentido práctico del derecho. Ello sin perder de vista sus fines fundamentales como son la justicia y la seguridad.

Los esquemas teóricos de férrea lógica no deben llevar a los excesos conceptualistas que se apartan de la realidad. Dicha tendencia no es idónea para dar solución a los conflictos cotidianos que se presentan en la sociedad. Si a ésta no se le escudriña, observando con detalle su comportamiento en general, y sus diversas reacciones, como organismo viviente que es, se corre el riesgo de convertir el derecho en una especie de corsé inflexible sin aptitud para resolver los problemas concretos de la vida diaria. Cada caso en particular debe ser interpretado con el sentido eminentemente práctico y humano del derecho. Comprenderlo así, significa recrearlo o remozarlo en cada fallo, impidiendo su fosilización al amparo del positivismo legalista o de una posición fríamente conceptual. VIII.- De acuerdo con lo apuntado en el considerando anterior, y en relación con la ruta fijada para darle solución al enclavamiento del fundo de los actores, debe recordarse que se está ante un problema de profundo contenido social y económico.

Por ende, de marcado interés público. Ello por cuanto, de no contarse con salida, o salida bastante a la vía pública, se convertiría el fundo de comentario en un predio improductivo y sin utilidad, lo cual va en menoscabo de la conveniencia nacional. Así lo entendieron los romanos.” Ha de aplicarse en la solución del objeto del proceso en particular motivos de proporcionalidad y razonabilidad para mantener el fundo en condiciones de poder ser objeto de un efectivo derecho de propiedad para cumplir su función agraria manteniendo la vocación agraria que ostenta y así tutelar las condiciones para que sea factible su aprovechamiento, aun cuando no contenga en la actualidad actividades productivas. Pues no es posible mantener un terreno en condición comprobada en la realidad de imposibilidad total o parcial de acceso. La legislación nacional aplicada a la solución de la apelación conlleva a imponer esa carga en el terreno de la parte demandada para otorgar salida idónea al terreno enclavado o con salida insuficiente mientras sea necesario.

Esos criterios de proporcionalidad y razonabilidad conllevan a disminuir derechos de las personas involucradas, que en compensación recibirían un monto indemnizatorio como se ordenó en la sentencia recurrida. Resultando la medida proporcional y razonable y no ser una solución ilícita o dañina al punto de vaciar el contenido del derecho de propiedad de la parte accionada. Conllevando a un proceso de ponderación de la razonabilidad y proporcionalidad. Al respecto en decisión 732-2001 de las 12 horas 24 minutos del 26 de enero de 2001 de la Sala Constitucional de la Corte Suprema de Justicia delimitó el principio de razonabilidad de la siguiente manera: “V.- DEL PRINCIPIO DE RAZONABILIDAD COMO PARÁMETRO CONSTITUCIONAL. La jurisprudencia constitucional ha sido clara y conteste en considerar que el principio de razonabilidad constituye un parámetro de constitucionalidad … Para realizar el juicio de razonabilidad la doctrina estadounidense invita a examinar, en primer término, la llamada "razonabilidad técnica" dentro de la que se examina la norma en concreto (ley, reglamento, etc.).

Una vez establecido que la norma elegida es la adecuada para regular determinada materia, habrá que examinar si hay proporcionalidad entre el medio escogido y el fin buscado. Superado el criterio de "razonabilidad técnica" hay que analizar la "razonabilidad jurídica". Para lo cual esta doctrina propone examinar: a) razonabilidad ponderativa, que es un tipo de valoración jurídica a la que se concurre cuando ante la existencia de un determinado antecedente (ej. ingreso) se exige una determinada prestación (ej. tributo), debiendo en este supuesto establecerse si la misma es equivalente o proporcionada; b) la razonabilidad de igualdad, es el tipo de valoración jurídica que parte de que ante iguales antecedentes deben haber iguales consecuencias, sin excepciones arbitrarias; c) razonabilidad en el fin, en este punto se valora si el objetivo a alcanzar, no ofende los fines previstos por el legislador con su aprobación.

Dentro de este mismo análisis, no basta con afirmar que un medio sea razonablemente adecuado a un fin; es necesario, además, verificar la índole y el tamaño de la limitación que por ese medio debe soportar un derecho personal. De esta manera, si al mismo fin se puede llegar buscando otro medio que produzca una limitación menos gravosa a los derechos personales, el medio escogido no es razonable...” (En igual sentido Votos Nos. 843-02 del 30 de enero de 2002; 5374-03 del 20 de junio de 2003; 340-04 del 16 de enero de 2004; 846-05 del 28 de enero de 2005; 1800-05 del 23 de febrero de 2005; 2236-05 del 2 de marzo de 2005; 1806-06 del 15 de febrero de 2006; 1807-06 del 15 de febrero de 2006 y 1557-07 del 7 de febrero de 2007 y 1571-08 del 15 de enero de 2008)”. En este asunto se arriba a la conclusión, se debe confirmar la imposición de la obligación forzosa de paso a favor de la finca de la accionante mediante el sendero que se encuentra visible en el terreno de la demandada por cuanto resulta necesario, sin que pueda la otra ruta que se alega le da salida sea funcional e idónea.

Existen intereses protegidos por el derecho y en especial el Derecho Agrario dirigidos a asegurar una meridana seguridad a las personas en los accesos y una tutela de la vocación agraria de la propiedad en tanto existe el enclave o salida insuficiente. Si bien se ha reclamado que la actora no desarrolla una actividad agraria, ciertamente, al emplear parámetros constitucionales para la fijar la imposición de obligaciones de paso por enclave o salida insuficiente se debe de considerar la función social, agraria y ambiental de la propiedad y su vocación. Respecto a los criterios de proporcionalidad y razonabilidad. Por lo que en este caso se encuentra en la otra ruta no es solución de salida de enclave de las propiedades de la actora. Se rechazan los agravios.

IX- Por los motivos expuestos, con fundamento en los artículos 1 y 2 de la Ley de Jurisdicción Agraria, numerales 395 del Código Civil, se rechaza la prueba para mejor resolver ofrecida por la sociedad Colibrís de la Montaña S.A, se rechaza la nulidad. En lo apelado, deberá confirmarse la sentencia recurrida.

POR TANTO

Se rechaza la prueba para mejor resolver por Colibrís de la Montaña S.A de fotografías. Se rechaza la nulidad. En lo apelado, se confirma la sentencia número 2023000263 de las ocho horas con siete minutos del veintiuno de noviembre del año dos mil veintitrés.
