EL ESTADO No. 2025002115 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, at eleven thirty-one on cinco de Marzo del dos mil venticinco.- The Court considers the application for interim relief filed by GEOVANNI ESPINOZA CUBILLO, holder of identity card number 602330436, and JENNY CORDERO VARELA, holder of identity card number 204810207, against MUNICIPALIDAD DE HEREDIA. ESTADO (MINAE) and Sistema Nacional de Áreas de Conservación (SINAC) participate as necessary co-litigants (litis consortes necesarios).
CONSIDERING
a-) By a written submission filed on 28 de agosto de 2024, an application for interim relief (medida cautelar) was brought before this jurisdiction, in which the claimant requests the following: “RELIEF SOUGHT THROUGH THE INTERIM MEASURES: 1. That the Municipalidad de Heredia refrain from carrying out the eviction, demolition, and dispossession of the residence of Mr. Giovanni Espinoza Cubillo and Ms. Jenny Cordero Varela” (see image 8 of the digital case file for the interim-relief proceeding, hereinafter interchangeably referred to as the “digital case file” or the interim-relief file). The claimant states, in summary, that the eviction and demolition would render the property uninhabitable and that the claimants lack the financial means to rent a home or renovate the house. The claimant also indicates that the eviction is scheduled to be carried out on 20 de setiembre de 2024, such that there is an imminent risk of serious damage to the residence, which would be rendered uninhabitable.
The relief sought is a STAY (medida cautelar de carácter SUSPENSIVO) to prevent enforcement of the administrative eviction and demolition proceeding for encroachment upon public-domain property (bienes demaniales), as ordered by resolution AMH-0803-2024 issued by the Alcaldía Municipal de la Municipalidad de Heredia at seven hours and seven minutes on 19 de agosto de 2024. Regarding the likelihood of success on the merits (apariencia de buen derecho), the claimant states that it is evident in this particular case. This is because, in summary, the claimant states in the complaint (see the complaint appearing at images 2 to 13 of the main case file, as well as the application for interim relief at images 5 to 9 of the interim-relief file) that the Municipalidad de Heredia initiated an administrative eviction and demolition proceeding against the claimants for encroachment upon and unlawful occupation of public-domain property, under registration number 270947, which became public property of the Municipalidad de Heredia through a DONATION made by the BANCO HIPOTECARIO DE LA VIVIENDA (BANHVI), which the claimant characterizes as null and unlawful.
The claimant further maintains that both claimants hold title to the 50.42 square meters from which eviction is sought because BANHVI had granted them a public deed 28 years ago and the parcel is registered in the Registro Nacional; therefore, the Municipalidad de Heredia has no right over that property. The claimant also states that they do not occupy a protected area (zona de protección), as asserted by the respondent municipality, because no regulation designates the area as a forest protection area and the existing vegetation was planted by local residents. Accordingly, the claimant requests a declaration that the administrative conduct is null and void, compensation for the resulting damages and losses, and a declaration and recognition of their rights over the aforementioned 50.42 square meters, together with interest and costs on both bases. Finally, regarding the balancing of the interests at stake (ponderación de intereses en juego), the claimant states, in summary, that the seriousness of the harm caused to the claimants and their family unit must be given greater weight than the interests defended by the respondent. As evidence, the claimant offers a copy of the eviction order (see images 10 to 25 of the interim-relief file), and the following documentary evidence is offered in the main proceeding:
It also states that the deed submitted in the case file records the transfer of the area to the respondent municipality and that the claimant contradicts itself in its assertions, as well as that the designation of the district in the deed, the survey map of the parent property, and the site plan is immaterial to the purpose of these proceedings, since it is clear that this is the parent property from which the La Gran Samaria residential development originated; it therefore requests that a ruling be issued as soon as possible, given the large number of pleadings filed by the claimant in this case. It offers the case record as evidence. g-) Finally, through further submissions dated 11 de octubre de 2024, the claimant, in summary, reiterates the position set forth in previous pleadings, stating that sewage is being diverted near the residence into the quebrada Aries and that this is a nature reserve, and therefore the cadastral survey map (plano catastrado) identified by the municipality is unlawful because it required authorization from SINAC, as it is a protection zone (zona de protección); in its prayer for relief, it requests that officials from SINAC and MINAE visit the area and verify the alleged environmental damage (see images 141 to 143). h-) By order issued at fourteen hundred hours and zero minutes on once de noviembre de dos mil veinticuatro, in order to continue processing the matter and due to the claimant’s statement in its pleading dated 11 de octubre de 2024, appearing at image 143 of the digital case file, concerning the possible joinder of the ESTADO and SINAC, the parties were granted a period of TRES DÍAS HÁBILES to submit their views.
Both parties made submissions after the hearing granted, and the corresponding issue was resolved by judgment N° 2024008381, issued at sixteen hours and seven minutes on quince de Noviembre del dos mil veinticuatro, ordering the joinder of the ESTADO (MINAE) and SINAC in these precautionary proceedings (medida cautelar) so that they could address the relief sought (see images 148 to 218 of the digital case file). i-) By order issued at ten hours and twenty-six minutes on dos de diciembre de dos mil veinticuatro, the representatives of SINAC and the ESTADO were granted a hearing on the requested precautionary measure (see images 224 to 225 of the digital case file). j) By pleading dated 13 de enero de 2025, the representative of SINAC responds to the hearing granted and requests, in summary, that the relief sought be denied as legally unfounded. Said representative states, in summary, that no administrative acts (actos administrativos) of that institution are being challenged in this proceeding and indicates that the claimant’s request is improper, stating as follows: “(...) The claimants’ argument is that there is a treatment plant, which is not the subject matter of the proceeding but is located nearby, that is harming the environment.
Although the possibility of this occurrence is relevant to the Public Administration, and the appropriate procedure is to file a complaint directly with administrative or judicial authorities or through the SITADAS system, it is not pertinent to this administrative litigation proceeding.” (see image 233 of the digital case file, emphasis added). SINAC likewise considers that the requirements for precautionary relief (tutela cautelar) have not been met, noting that no relationship can be identified between the treatment plant and the need for an inspection in connection with the subject matter of the proceeding, nor is there any logical or causal link between the challenged acts of the municipal entity and the claimant’s request. It also states that the relief sought cannot be deemed to satisfy the likelihood of success on the merits (apariencia de buen derecho) and the balancing of interests (ponderación de intereses), because, in summary, the claimant cannot seek suspension of the municipality’s actions merely by alleging that other persons are engaging in environmentally harmful activities on another property.
Accordingly, the representative of SINAC disagrees with the claimant’s position and states, in sum, that the risk arising from delay (peligro en la demora), contrary to the claimant’s assertion, lies in allowing a structure encroaching on publicly owned land within a water-resource protection zone to remain in place, in violation of the legal and constitutional framework protecting a healthy and ecologically balanced environment, since there is mention of an intention to maintain works and structures within the protection area, as well as pollution of bodies of water; therefore, the requirements for precautionary relief have not been met, and it requests that the application for a precautionary measure be denied. It offers as evidence the material contained in the judicial case file (see images 231 to 236 of the precautionary-measure file). k) By order issued at thirteen hours and sixteen minutes on diez de febrero de dos mil veinticinco, prior to ruling, a hearing was granted concerning the claimant’s submissions dated 15 and 20 de noviembre de 2024; the opposing parties responded by reiterating their request that the claimant’s requested relief be denied.
In summary, the representative of the respondent municipality states as follows: “(...) With regard to the pleading dated 15 de noviembre del 2024, this representative objects to the evidence submitted by the claimant, consisting of the minutes of an Ordinary Session considered by the Concejo Municipal in 2009, when the Auditoria Municipal conducted a study regarding the Condominio San Agustín and the treatment of wastewater from that condominium’s treatment plant. The second item of evidence cited is a judgment in an amparo proceeding (recurso de amparo) in which the respondent municipality was not held liable because its diligent conduct in the specific case of Condominio Agustín was demonstrated. Therefore, the objection is based on the fact that the evidence is irrelevant, is not useful, is unrelated to and has no bearing on the origin of this specific case, namely the encroachment on a public area established in the record and forming the subject matter of this proceeding...” (see image 244 of the precautionary-measure file).
With respect to the pleadings dated 20 de noviembre del 2024, it further states: “(...) we reiterate to Your Honor the arguments of this representative set forth in the submission dated 15 de noviembre del 2024 regarding the confusion that the claimant’s counsel continues to maintain, because the area of the Quebrada Aries originating in the Desarrollo Urbanístico la Gran Samaria is not within the protected areas of the Sistema Nacional de Áreas Silvestres Protegidas” (see image 245 of the precautionary-measure file). Accordingly, the respondent municipality’s position is that this evidence is inadmissible (see images 239 to 246 of the precautionary-measure file).
In the present matter, by means of a brief dated August 28, 2024, the claimant filed an application for interim relief in the following terms: “RELIEF SOUGHT THROUGH THE INTERIM MEASURES: 1. That the Municipalidad de Heredia refrain from carrying out the eviction, demolition, and encroachment against the residence of Mr. Giovanni Espinoza Cubillo and Ms. Jenny Cordero Varela” (see image 8 of the interim-relief file). In summary, the claimant states that the eviction and demolition would render the property uninhabitable and that the claimants lack the financial means to rent housing or renovate the house. The claimant further states that the eviction is scheduled to be carried out shortly, on September 20, 2024, and that there is therefore an imminent risk of serious damage to the residence, which would be rendered uninhabitable. The relief sought is a STAY (SUSPENSIVO) to prevent the enforcement of the administrative eviction and demolition proceeding (procedimiento de desalojo administrativo y demolición) for encroachment upon public-domain property (bienes demaniales), as ordered by resolution AMH-0803-2024, issued by the Alcaldía Municipal of the Municipalidad de Heredia at seven hours and seven minutes on August 19, 2024.
Subsequently, in submissions dated October 11, 2024, the claimant essentially reiterated the position outlined above and additionally requested that officials from the Sistema Nacional de Áreas de Conservación (SINAC) and MINAE (the State) visit the area and verify the environmental damage alleged in the application (see images 141 through 143 of the interim-relief file). In summary, that request seeks interim relief consisting of an affirmative order (orden de HACER), directed at SINAC and the STATE (MINAE), requiring them to visit the area in question in connection with the alleged environmental damage. Accordingly, both were joined as respondents and given an opportunity to be heard concerning the relief sought. Thus, the application seeks interim measures to preserve the status quo and measures having innovative effects (affirmative orders), as requested by the claimant and permitted under Article 20 of the Código Procesal Contencioso Administrativo (CPCA).
In summary, the claimant argues that the likelihood of success on the merits (apariencia de buen derecho) is evident in this particular case. This is because, in summary, the claimant states in the application (see the complaint appearing at images 2 through 13 of the main case file, as well as the application for interim relief appearing at images 5 through 9 of the interim-relief file) that the Municipalidad de Heredia commenced an administrative eviction and demolition proceeding against the claimants for invasion and encroachment upon public-domain property, under registration number 270947, which became part of the public domain of the Municipalidad de Heredia through a DONATION made by the BANCO HIPOTECARIO DE LA VIVIENDA (BANHVI), which the claimant characterizes as null and unlawful. The claimant further maintains that both claimants hold title (derecho de propiedad) to the 50.42 square meters from which eviction is sought because BANHVI granted them a public deed (escritura pública) 28 years ago and the property is a lot recorded in the Registro Nacional; therefore, the Municipalidad de Heredia has no rights over that property.
The claimant also states that they are not occupying a protected area (zona de protección), as alleged by the respondent municipality, because no regulation designates it as a forest protection area and the existing vegetation was planted by local residents. The claimant therefore requests that the administrative action (conducta administrativa) be declared null and void, that compensation be awarded for the harm and losses caused, and that the claimants’ rights over the aforementioned 50.42 square meters be declared and recognized, together with interest and costs and attorneys’ fees. Finally, regarding the balancing of the interests at stake (ponderación de intereses en juego), the claimant argues, in summary, that the severity of the harm caused to the claimants and their family unit must outweigh the interests defended by the respondent. As evidence, the claimant offers a copy of the eviction order (see images 10 through 25 of the interim-relief file), while the following documentary evidence (prueba documental) is offered in the main proceeding:
In summary, the respondent party addresses the interim relief (medida cautelar), stating its opposition and requesting that it be denied because the essential requirements for granting a measure of this nature are not met in this case. By submission dated 17 de setiembre de 2024, appearing at images 50 to 58 of the interim-relief file, counsel for the respondent Municipalidad de Heredia answers the application for interim protection (tutela cautelar), requesting that it be denied on the ground that the requirements for granting a measure of this nature are not met. After recounting the background and the so-called “facts” of the case, the respondent municipality states, in summary, regarding the so-called prima facie case (apariencia de buen derecho), that this application lacks that prerequisite because it concerns the unlawful occupation and disposition of a 50.42-square-meter area of public-domain property (dominio público) designated as a protection zone (zona de protección) (referring to official letter DIP-DT-0328-2023), which forms part of properties 4-150475-001 and 4-150475-002, registered survey plan H-084457-1989, located in the La Gran Samaria residential development in San Francisco de Heredia.
Consequently, eviction (desalojo) and demolition (demolición) were ordered due to the encroachment upon public-use property (bienes demaniales), with the due process (debido proceso) provided for in the applicable legislation having been afforded. It states that this constitutes a duty because the property is in the public domain and the municipality is authorized to recover control of such real property through administrative action (acción administrativa). In this regard, it states that the complaint is devoid of supporting grounds and lacks seriousness; it indicates that ownership of the property is not being disputed, but rather the encroachment being committed against public-domain property 4-27094-000, and that the plaintiffs submit no evidence establishing a right to encroach upon the public area. Regarding the risk arising from delay (peligro en la demora), the municipality states that, although conclusive evidence is not required to establish it and both present and potential harm may be considered, the claimant’s mere assertion is insufficient; evidence of the serious magnitude of the harm is required, and the municipality states that the plaintiffs’ allegation is completely devoid of such evidence.
It states that the eviction or demolition concerns the 50.42-square-meter area located on public-domain property pursuant to resolution AMH-0803-2024, and therefore this prerequisite has not been substantiated with suitable evidence. Finally, regarding the balancing of the interests at stake (ponderación de intereses en juego), the municipality states that, in its view, the public interest protected by the municipality in restoring the public area to its intended use must be weighed against the private interests of the claimant parties in perpetuating their encroachment upon public-use property (protection zone). Because there is no harm that could serve as a basis for such balancing, it is not even possible to assess this prerequisite, as the application lacks any reasoning balancing the interests at stake. Accordingly, the respondent municipality requests that the interim relief be denied and that the extremely urgent provisional measure (medida cautelar provisionalísima) ordered be revoked.
It offers as evidence file DIP-DT-0328-2023 of the Sección de Control Fiscal y Urbano (see images 60 to 103 of the interim-relief file). After being given an opportunity to respond to the supplemental statements, the respondent municipality replied in a submission dated 10 de octubre de 2024, appearing at images 133 to 137 of the interim-relief file, in which it again states that there is no evidence that IMAS was at any time the registered owner of “Gran Samaria,” and that it is unclear whether this refers to the parent property (finca madre) or the public areas. It states that this distinction is immaterial for purposes of evicting the encroachment from the public property in this case, which is registered in the municipality’s name. It also states that these proceedings are not the proper avenue for challenging the property’s registry history and that evidence has been entered into the record showing that the trust made the conveyance.
It further states that the deed submitted to the case file reflects the conveyance of the area to the respondent municipality and that the plaintiffs contradict themselves in their assertions. It also states that the designation of the district in the deed, the parent property’s survey plan, and the site plan are irrelevant to the subject matter of these proceedings because it is clear that this is the parent property from which the La Gran Samaria residential development originated. It therefore requests a ruling as promptly as possible, given the large number of submissions filed by the claimant party in this case. It offers the case record as evidence. Now, after the respondents were given an opportunity to address the requested on-site inspection (inspección en sitio), in a submission dated 13 de enero de 2025, counsel for SINAC addresses the opportunity granted and requests, in summary, that the requested relief be denied as improper.
That counsel states, in summary, that no administrative acts (actos administrativos) of that institution that are in dispute have been identified in this case, and indicates that the plaintiff’s request is improper, stating as follows: “(...) The plaintiffs’ argument is that there is a treatment plant, which is not the subject matter of the proceedings but is located nearby, that is harming the environment. Although the possibility that this is occurring is relevant to the Public Administration, and the appropriate procedure is to file a complaint directly with administrative or judicial entities or through the SITADAS system, it is not pertinent to these administrative judicial-review proceedings (proceso contencioso administrativo).” (see image 233 of the digital case file, emphasis added). SINAC likewise considers that the prerequisites for interim protection have not been met, stating that the relationship between the treatment plant and the need for an inspection relevant to the subject matter of the proceedings cannot be identified, nor is there any logical or causal connection between the challenged acts of the municipal entity and the relief requested by the claimant party.
It also states that the requested relief cannot be deemed to satisfy the requirements of a prima facie case and balancing of interests because, in summary, the municipal action cannot be suspended based on the claimant’s assertion that other persons are engaging in activities harmful to the environment on another property. Accordingly, counsel for SINAC disagrees with the claimant party’s position and states, in sum, that, contrary to the claimant’s assertion, the risk arising from delay results from allowing a structure encroaching upon public-domain land within the water-resource protection zone to remain in place, in contravention of the legal and constitutional framework protecting a healthy and ecologically balanced environment. This is because an intention is expressed to maintain works and structures within the protected area (área de protección), along with pollution of bodies of water; consequently, the requirements for interim protection are not met, and it requests that the application for interim relief be denied. It offers as evidence the materials contained in the judicial case file (see images 231 to 236 of the interim-relief file).
As established by the Constitutional Chamber, as well as in prior rulings of this Court (see, among others, ruling N°38-2022 of diez horas diez minutos del doce de enero de dos mi veintidós), interim relief (justicia cautelar) responds to the need to safeguard the constitutional principle of prompt and effective justice by preserving the factual conditions essential for the issuance and enforcement of the judgment (Resolution 7190-1994, de las 15:24 horas del 6 de diciembre). Along the same lines, Article 19 of the Code of Administrative Procedure (Código Procesal Contencioso Administrativo) provides that the purpose of imposing an interim measure (medida cautelar) is to provisionally protect and preserve the subject matter of the proceedings and the effectiveness of the judgment. Legal scholarship has stated that interim relief is not intended to declare a fact or liability, establish a legal relationship, enforce an order and satisfy an undisputed right, or resolve a dispute, but rather to prevent harm that may be caused by the litigation or may arise from an abnormal situation (Gallegos Fedriani, Pablo.
Interim Measures Against the Public Administration. 2nd ed. Buenos Aires, Argentina: Ábaco, 2006). In ruling #4074-2010, the Administrative Court (Tribunal Contencioso Administrativo) states that: “the requirements for interim protection (tutela cautelar) are threefold: risk arising from delay (peligro en la demora), prima facie merit (apariencia de buen derecho), and the balancing of interests (ponderación de los intereses), particularly the public interest,” and “[o]nly where all three elements are present—that is, prima facie merit, risk arising from delay, and a determination, based on the balancing of interests, that the harm suffered by the individual must be protected above the other interests at stake—may the court grant the requested interim measure” (Tribunal Contencioso Administrativo, resolution n.° 4074-2010 de las 13:21 hrs. del 29 de octubre de 2010). The Administrative Appeals Court (Tribunal de Apelaciones de lo Contencioso Administrativo) has similarly stated: “In the case of interim measures, this means that, in addition to addressing the structural characteristics of instrumentality (instrumentalidad) and provisionality (provisionalidad), the decision must clearly and sufficiently explain how the requirements of prima facie merit, risk arising from delay, and the balancing of the interests at stake are or are not satisfied; none of them may be disregarded, since the law requires all of them to be present for the measure adopted to be warranted […] if this Court were hypothetically to uphold the arguments concerning this issue and conclude that the balancing-of-interests element is indeed present, this would require this Court, at first and sole instance, to analyze and develop the issue of balancing interests in a manner omitted by the lower-court judge; consequently, as the party properly noted at the time, this Court would be substituting itself for the lower-court judge in the analysis of that element at first or sole instance, thereby depriving the party of the right to appeal what has been determined in that regard” (see resolution of the Tribunal Procesal Contencioso Administrativo, n.° 132-2017-I de las dieciséis horas dieciocho minutos del veintinueve de marzo del dos mil diecisiete.

This position is complemented by the opinion expressed by the First Chamber of the Supreme Court of Justice (Sala Primera de la Corte Suprema de Justicia), acting as the Administrative Cassation Court (Tribunal de Casación de lo Contencioso Administrativo), in Voto N° 5-F-TC-2008 de las diez horas con cuarenta y cinco minutos del seis de febrero del año dos mil ocho, concerning the need to satisfy the burden of proof (carga probatoria) at this interim stage, stating that “(…) three requirements apply, namely fumus bonis iuris, or prima facie merit… risk arising from delay and the balancing of the interests at stake… under the new legislation, prima facie merit does not impose an onerous burden of demonstrating the seriousness of the claim, but instead entails even the judge’s own internal assessment that the prospective judgment is not frivolous and that the claim is not lacking in seriousness; this is, incidentally, an inverted view of what is known as fumus bonis iuris.
This periculum also falls within the burden borne, as a burden of proof, by the party requesting the interim measure, and this is so. An interim measure therefore entails a provisional assessment of that risk arising from delay; it is not… an assessment of the merits of the proceedings… as pertains to the specific case (…) and this Chamber, after thorough and extensive deliberation, as it does (…) has found that the serious or irreparable damages warranting adoption of the interim measure at issue have not been duly proven (…) Ultimately, the Court finds that the principle of rational proof for interim relief, which corresponds to balanced evidence, has not been satisfied. Although it is true that conclusive evidence is not required, because such evidence cannot be required in interim proceedings, neither may the matter be left to the discretion of the unsupported assertions of the appellant; potential public interests are also involved.” Based on the foregoing statutory and case-law framework for analysis and the elements required for granting an interim measure, the Court shall examine the specific case in light of the presentation of the so-called theory of the case (teoría del caso) and the evidence proffered. Having established the analytical framework and the three elements required for granting an interim measure, the Court now examines the specific case.-
For approval, precautionary measures (medidas cautelares) require the concurrence of the three elements indicated above (likelihood of success on the merits (apariencia de buen derecho), viewed inversely and nearly equivalent to a “fumus non mali iuris”; risk arising from delay (peligro en la mora); and the balancing of interests (equilibrio de intereses)). In addition, this precautionary measure must be instrumental, ancillary, and provisional, insofar as it seeks to ensure the effectiveness of the judgment in the principal case file. It is the applicant’s responsibility to explain, analyze, and substantiate each of these requirements, and the defendant parties’ responsibility to contest the arguments presented, so that, based on the parties’ theories and the evidence cited, a determination may be made as to what is legally appropriate regarding the merits of the requested measure. VI. A) POSITIONS OF THE PARTIES: 1) POSITION OF THE CLAIMANT: In summary, the claimant’s request for interim relief (tutela cautelar) is based on alleged grounds of nullity affecting the administrative acts ordering the demolition of part of the claimant’s residence.
In summary, the claimant states that the eviction and demolition would render the property uninhabitable and that the claimants lack the financial means to rent a residence or remodel the house. The claimant further indicates that the eviction is about to be carried out and was initially scheduled for September 20, 2024 (suspended pursuant to the extremely urgent provisional measure (medida provisionalísima)), such that there is an imminent risk of serious damage to the residence, which would become uninhabitable unless suspension of that administrative conduct is ordered as a precautionary measure in this case. This is a SUSPENSIVE precautionary measure intended to prevent enforcement of the administrative eviction and demolition proceeding (procedimiento de desalojo administrativo y demolición) for encroachment upon public-domain property (bienes demaniales), as determined by resolution AMH-0803-2024 issued by the Office of the Mayor of the Municipalidad de Heredia at seven hours and seven minutes on August 19, 2024.
The claimant also states in the application (see the complaint appearing at images 2 through 13 of the principal case file, as well as the request for a precautionary measure appearing at images 5 through 9 of the precautionary-measure file) that the Municipalidad de Heredia initiated an administrative eviction and demolition proceeding against the claimants for the encroachment and unlawful occupation of public-domain property registered under folio 270947, which became part of the public domain of the Municipalidad de Heredia through a DONATION made by the BANCO HIPOTECARIO DE LA VIVIENDA (BANHVI), which the claimant characterizes as null and unlawful. The claimant also maintains that both claimants hold title to the 50.42 square meters from which eviction is sought because BANHVI granted them a public deed 28 years ago and the lot is registered with the Registro Nacional; accordingly, the Municipalidad de Heredia has no right to that property. 2) POSITION OF THE DEFENDANTS: As detailed above, the defendant municipality rejects, in summary, the claimant’s assertions, stating that the proceeding concerns the claimants’ encroachment upon public-domain property and that there is no competent evidence that demolition of the 50.42 square meters would render the residence uninhabitable.
It further states that it has no knowledge of the fill allegedly placed more than 20 years ago, as claimed by the claimants, and that the claimant’s health conditions do not justify the occupation of public-domain property. Regarding the requested visit to the area in question, the representative of SINAC objects and, concerning the requested suspension, states that suspending the administrative act would entail declining to apply forestry regulations, which conflicts with the legal framework for environmental protection because the claimant seeks to retain the works and structures within the protection zone (zona de protección). VI. B).- THE SO-CALLED “STRUCTURAL ELEMENTS”: To begin, regarding the so-called “structural elements” of interim relief, irrespective of what may ultimately be decided in the adjudicatory proceeding (proceso de conocimiento) on the merits and of the challenges raised concerning the administrative conduct, the following should be noted in relation to the most basic characteristics of instrumentality, ancillary nature, and provisionality applicable to a request such as the one before us.
Regarding these so-called “structural” characteristics of a precautionary measure, judgment 2023006573, issued at twenty-one hours and twenty-seven minutes on December nineteenth, two thousand twenty-three, stated, among other things, as follows: “IV.- STRUCTURAL CHARACTERISTICS OF PRECAUTIONARY MEASURES. // In determining whether the measure is appropriate, it is also important to consider—as stated supra and in addition to the requirements already indicated—that the measure to be adopted structurally possesses the following characteristics: 1.- Instrumentality and prior independence in relation to the final judgment to be issued in a principal proceeding, a matter that simultaneously determines the measure’s subordination or ancillary nature with respect to the principal proceeding within which, or for the purposes of which, it is ordered. 2.- Provisionality, insofar as its effectiveness is, in principle, exhausted when the judgment on the merits is issued in the principal matter or when circumstances so require.
In other words, its effects are contingent upon the pendency of that proceeding and, on the other hand, upon the continued existence over time of the circumstances taken into account when it was adopted; these characteristics derive from its inherent capacity for modification or revocation (rebus sic stantibus effect (eficacia rebus sic stantibus)). 3.- Every judicial proceeding entails due process (debido proceso), which gives rise to a series of stages that must successively become final before a ruling may definitively resolve the dispute that has been brought before the courts. It is precisely the length of judicial proceedings that gives rise to risk arising from delay, coupled with the danger or urgency that, while the action proceeds through its ordinary course, a party’s right or either party’s legally relevant interests may be lost or altered; this is provided for by the legal system in Article 78 of the Código Procesal Civil, which applies by analogy to this subject matter.
The urgency of avoiding risk arising from delay is the feature that justifies precautionary measures adopted ante causam, prima facie, or inaudita altera parte. 4.- Summary cognizance (sumaria cognitio), that is, these types of measures are adopted by virtue of an extremely summary review conducted by the court, without prejudging the merits of the matter, and such review in no way replaces the full sequence of steps entailed by the adjudicatory proceeding.” Now, in relation to the so-called “structural” characteristics of precautionary measures, the statements made by the representative of the defendant party have made it very clear that its primary interest regarding this request for interim relief is to have the effects of the administrative act ordering the partial demolition of the residence “suspended.” The defendant party contends that the residence encroaches upon public-domain land, whereas the claimant denies this and states that, on the contrary, it is real property registered in the claimant’s name.
The claimant requests that the demolition not be carried out while the merits of the proceeding are being litigated before this court because the residence would be rendered uninhabitable and the claimant lacks the means to meet the claimant’s housing needs in that event. Accordingly, insofar as this is a request to suspend the effects of an administrative act characterized as absolutely null, this Court finds that the relief sought in this respect does satisfy the requirements of instrumentality and provisionality in relation to the matter before us. The same is not true, however, of the claimant’s other request that, as interim relief, the Court issue an affirmative order to ACT, constituting an innovative measure (medida de carácter innovativo), directed at officials of SINAC and the STATE (MINAE). As reflected in the record through statements dated October 11, 2024, the claimant, in summary, reiterates the position outlined in earlier pleadings, stating that sewage is being diverted near the residence into the quebrada Aries and that the area is a nature reserve, for which reason the cadastral plan (plano catastrado) cited by the municipality is unlawful.
The claimant also states that authorization from SINAC was required because it is a protection zone and expressly requests that officials of the Sistema Nacional de Áreas de Conservación (SINAC) and MINAE (State) visit the area and verify the environmental damage alleged in the application (see images 141 through 143 of the precautionary-measure file). Now, insofar as the claimant expressly seeks, as a claim for interim relief, an affirmative order to ACT directed both to the Sistema Nacional de Áreas de Conservación (SINAC) and to the State (Ministerio de Ambiente y Energía or MINAE), requiring them to visit the area in question in connection with the alleged environmental damage, before issuing any ruling on the request, both defendants (SINAC and the STATE) were joined as parties to the litigation (integración de la litis) so that they could respond to the claimant’s request and submit any statements they deemed pertinent in that regard.
In this respect, after being informed of the allegations, SINAC stated the following to the Court: “(...) The claimants’ argument is that a treatment plant exists that is not the subject of the proceeding but is located nearby and is harming the environment. Although the possibility that this is occurring is relevant to the Public Administration, and the appropriate procedure is to file a complaint directly with administrative or judicial authorities or through the SITADAS system, it is not germane to this administrative litigation proceeding (proceso contencioso administrativo).” (emphasis added; see image 233 of the precautionary-measure file). In this respect, this Court agrees with the representative of defendant SINAC that the matter raised by the claimant is one that should be processed as an administrative complaint through the appropriate channels available to the claimant; however, the claimant has not demonstrated that the claimant was denied the opportunity to file such a complaint or to access those appropriate channels in connection with the allegation concerning the existence of a treatment plant that is not the subject of this proceeding.
Therefore, in accordance with the foregoing, because this other request lacks even the slightest instrumentality in relation to the administrative conduct specifically at issue in this case, this additional request for interim relief must be denied for lack of instrumentality, a basic and fundamental requirement of that request for affirmative action. This is because no direct relationship or causal link can be identified between the treatment plant and the need for an inspection, on the one hand, and the specific subject matter of this proceeding—the order to demolish part of the residence—on the other; nor is there any logical or causal connection between the challenged acts of the municipal entity and the relief sought by the claimant in this regard.
In any event, this judge considers, as indicated, that sufficient evidence is already available concerning those matters that do bear an instrumental relationship to the administrative conduct (conducta administrativa) heard in these proceedings, enabling a ruling on the requested stay without the need to conduct an on-site inspection; accordingly, the requested interim relief (tutela cautelar) in the form of a stay shall be decided on the basis of the evidence already in the record. The petitioner should bear in mind that whether or not enforcement of the municipal administrative act (acto administrativo) at issue in these proceedings is stayed bears no direct relationship to the petitioner’s allegation that other persons or entities are supposedly carrying out activities harmful to the environment on another property. For that matter, where appropriate and if deemed warranted, the petitioner may file the corresponding complaint through the channels identified by the SINAC representative in its response to that request, there having been no showing that access to this option was denied.
Therefore, that request for affirmative relief (petición de HACER) is denied, and the Court shall now consider the interim measure (medida cautelar) seeking a stay of the effects of the administrative conduct that is the specific subject matter of these proceedings. VI. C).- REGARDING THE SO-CALLED “LIKELIHOOD OF SUCCESS ON THE MERITS” IN ITS INVERTED FORM: The so-called “fumus boni iuris,” as regulated in section 21 CPCA, provides that an interim measure shall be appropriate when the enforcement or continuation of the conduct submitted for review produces serious actual or potential harm or loss to the asserted legal position, which is commonly referred to as “periculum in mora,” and, as a second requirement, “provided that the claim is not frivolous or manifestly lacking in seriousness.” Thus, the so-called “fumus boni iuris” appears in its inverted form, more properly as a “fumus non mali iuris,” because proof of the likelihood that the relief sought will succeed is not required; rather, the requirement is that it not be frivolous or manifestly lacking in seriousness.
The parties must bear in mind, however, that the analysis conducted in interim-relief proceedings is the product of summary review (cognición sumaria) and does not constitute an assessment of the merits of the matter, nor may it do so under any circumstances. As the Tribunal de Casación de lo Contencioso Administrativo stated at the time, the requirement of “non-frivolousness” “[...] is not an assessment of the merits of the proceedings, nor can it be, nor should it be; the judge may not confuse the requirements applicable to interim relief with a final proceeding concerning the validity or unlawfulness of administrative conduct, as this would lead to final justice through interim relief, which is not the purpose of the proceeding. (Tribunal de Casación de lo Contencioso Administrativo, voto 05-F-TC-08 de las diez horas cuarenta y cinco minutos del seis de febrero de dos mil ocho). As previously noted, the analysis of the prerequisite for interim relief set forth in Article 21 of the Código Procesal Contencioso Administrativo (CPCA)—that the claim not be frivolous or manifestly lacking in seriousness—does not amount to establishing a plausible “likelihood of success on the merits” of the action; precisely because the analysis conducted in interim-relief proceedings does not constitute an assessment of the merits of the matter, nor may it do so, as the Tribunal de Casación de lo Contencioso Administrativo stated at the time (Tribunal de Casación de lo Contencioso Administrativo, voto 05-F-TC-08 de las diez horas cuarenta y cinco minutos del seis de febrero de dos mil ocho).
In this regard, the so-called “theory of the case” (teoría del caso) (position) advanced by the plaintiff and its arguments are not considered frivolous or manifestly lacking in seriousness, without undertaking an analysis of the merits of those arguments, because the plaintiff provides a series of explanations and lines of reasoning whose validity and applicability must ultimately be determined by the court responsible for deciding the merits of the matter. That court must also ultimately determine whether the administrative conduct contains the defects rendering it absolutely void (vicios de nulidad absoluta) identified by the petitioner in its application, whether the petitioner’s fundamental rights have been violated, and whether the real property in question is in fact land duly registered in the petitioner’s name rather than property in the public domain (bien de dominio público) of the Municipalidad de Heredia, as the respondent entity contends.
That determination is precisely the focal issue on the merits and cannot be addressed in summary interim-relief proceedings. As for the respondent’s representative’s allegations that the claim is frivolous because, following due process (debido proceso) and the exercise of the right of defense (derecho de defensa), the facts established in the administrative proceedings empowered and authorized the administration to act as it ordered and directed, it must be borne in mind that the analysis conducted in interim-relief proceedings is inherently a summary review performed by the judge, without prejudging the merits of the matter, and in no way replaces the analysis proper to the proceedings on the merits (proceso de conocimiento). The matters identified by the respondent’s representative would constitute defenses appropriate to the proceedings on the merits, to be considered at the proper procedural stage, and not in these interim-relief proceedings.
When faced with a dispute similar to the present one, this Tribunal stated as follows in fallo N° 1172-2017 de las quince horas y veinticinco minutos del veintiséis de mayo del año dos mil diecisiete: “(...) the plaintiff’s fundamental right to litigate her right to private property in plenary proceedings (vía plenaria) is recognized, in view of the legal-administrative relationship existing between the petitioner and the Municipalidad de Heredia, given that the petitioner is subject to an administrative decision ordering the eviction and partial demolition of her property, in which the municipal entity grounds its conduct on the assertion that the petitioner encroached upon the public area by constructing structures on her property, whereas the petitioner states that her construction is located within the remainder of a parent parcel (finca madre) and does not encroach upon the public area in any way.
The petitioner further states that the structures slated for demolition comply with the setback from the public road, as well as with the public sidewalk, on the same terms as the other property owners. She also asserts that the structures the respondent seeks to demolish have the corresponding municipal permits and that the action the respondent municipality intends to take is arbitrary and disproportionate. In turn, she challenges the technical basis used by the municipal entity in its decision ordering the eviction and partial demolition of structures on her property (see statements in the application for interim relief). In that regard, she has the opportunity to seek review, through plenary proceedings on the merits, of the legality of that administrative conduct pursuant to Article 49 of the Constitution...” (emphasis added, expediente 17-001040-1027-CA). This judge considers that the present case involves a dispute similar to that addressed in the foregoing decision and that, accordingly, the individual subject to the administrative action has the opportunity to obtain effective judicial protection (tutela judicial efectiva) through plenary proceedings on the merits, so that the legality of that administrative conduct may be reviewed pursuant to Article 49 of the Constitution.
In this case, as in the cited case, the municipal entity grounds its conduct on the assertion that the petitioner encroached upon the public area by constructing structures on her property, whereas the petitioner states that her construction is located within private property registered in her name and does not encroach upon the public area in any way. Accordingly, as in the foregoing case, the plaintiff’s fundamental right to litigate her right to private property in plenary proceedings is recognized, in view of the legal-administrative relationship existing between the petitioner and the Municipalidad de Heredia. Thus, contrary to the respondent’s representative’s assertion, the frivolousness of the claim is not clear and manifest. Having completed the analysis of non-frivolousness, the plaintiff, in her arguments, addresses in general terms the substance of the three prerequisites for interim relief.
Given that this analysis is presented in general terms, the appropriate examination shall be conducted on the basis of the statements in the application, which were previously described in detail. In this regard, this judge finds that the requested interim relief satisfies the remaining prerequisites for approval and must therefore be GRANTED IN PART with respect to the REQUESTED STAY, as explained below. VI. D) REGARDING THE DANGER IN DELAY (PELIGRO EN LA DEMORA): With respect to the danger in delay, this Tribunal previously stated, among many other decisions, in fallo 009-2021-T de las doce horas y tres minutos del día siete de enero de dos mil veintiuno that: “...for interim relief to be granted, the law requires that enforcement or continuation of the administrative conduct submitted for review produce serious actual or potential harm or loss to the petitioner’s legal position. In that regard, it must be emphasized that merely alleging the existence of serious harm (or loss), whether actual or potential, is insufficient; it must be proven, which entails a procedural burden (carga procesal) that the interested party must bear pursuant to Articles 220 of the Código Procesal Contencioso Administrativo and 41 of the Código Procesal Civil.” Regarding this prerequisite for interim relief, it was also stated at the time that “[...] the current legislation introduces greater flexibility into the former procedural system, which referred to ‘impossible or difficult reparation’—that is, it was rigid.
We have moved from an extremely rigid standard requiring proof of harm and loss that was ‘impossible or difficult to repair’ to a more flexible system, consistent with the philosophy of broadening access to interim relief [...] under which the harm must reach a level of ‘seriousness.’ Therefore, the statement that serious harm that is difficult or impossible to repair must be proven is language that no longer exists [...] But the threshold—and this is what matters—established by Article 21 is precisely ‘serious’; at or above that level of seriousness, interim relief is appropriate, while anything below that level that cannot be deemed and classified as serious does not satisfy the prerequisite for interim relief. In other words, if the harm does not reach that level of ‘seriousness,’ the measure is not appropriate [...]. (TRIBUNAL PROCESAL CONTENCIOSO ADMINISTRATIVO, Resolución 286-08 de las doce horas treinta minutos del nueve de mayo de 2008.
Cfr. 12:34:22 – 12:35:27 de la grabación digital correspondiente, exp. 08-35-1027-CA). In this regard, the petitioner asserts that failure to stay enforcement of the act at issue in the proceedings, which she characterizes as void, would cause serious harm both to the plaintiff and to her family because they would be unable to meet their housing needs. This would seriously affect both the plaintiff and her family unit and would violate their rights, and the petitioner therefore considers that this would constitute serious injury to her legal position. In summary, the petitioner states that the eviction and demolition would render the property uninhabitable and that the plaintiffs lack the financial means to rent housing or renovate the house.
Likewise, the claimant states that the eviction (desalojo) is about to be carried out and was initially scheduled for 20 de setiembre de 2024 (suspended by virtue of the extremely provisional measure (medida provisionalísima)), such that there is an imminent risk of serious damage to the dwelling, which would become uninhabitable unless suspension of such administrative conduct is adopted as a precautionary measure (medida cautelar) in this case. On the other hand, regarding the risk arising from delay (peligro en la demora), the respondent argues, in summary, that the claimant’s allegations lack sufficient evidentiary support and fail to establish any actual harm should the proceedings follow their normal course without the measures being granted; it states that the claimant has failed to prove the facts asserted. In summary, the respondent rejects the claimant’s assertions, indicating that the proceedings concern the claimants’ encroachment upon public-domain property (bien de dominio público), and that there is no suitable evidence that demolishing the 50.42 square meters would render the dwelling uninhabitable.
It also states that it has no knowledge of the fill placed more than 20 years ago to which the claimants refer, and that the claimant’s health conditions do not justify occupying property designated for public use and protection (bienes de carácter demanial y de protección). That said, regarding this issue, this judge considers that case law has held that proof of harm may even be inferred from a presumption based on ordinary human experience (presunción humana), without the need for documentary evidence. This approach has been followed, for example, in dismissal cases, in which the existence of serious harm is inferred from the severance of the service relationship that linked the claimant to the Administration and, consequently, the loss of the compensation available to that person to meet basic needs. In this regard, the First Section of the Administrative Litigation Court of Appeals stated the following in judgment N° 292-2017-I, issued at diez horas cuarenta y dos minutos del diez de julio de dos mil diecisiete: “… this Court, this Section of the Court, throughout its existence since 2010, has established that, in cases involving the termination of a public-employment relationship, whether at the municipal level or otherwise, termination of the relationship in itself entails the existence of serious harm; under the rules of administrative law, there is no greater sanction in public employment than termination, elimination, or severance of the service relationship that linked the Administration to an employee.
Not only does the relationship disappear, but with it the income—the salary—which, in practically every case heard by this Court, constitutes the person’s sole or most important source of income for meeting basic needs. We have indicated here that proof of harm may even be inferred from a mere presumption based on ordinary human experience, without the need for documentary evidence…” (Cf. 01:47:17 – 01:48:16 of the digital recording of the corresponding judgment. Expediente 17-1865-1027-CA.). Likewise, the cited judgment also states that serious harm should not be measured solely and exclusively by the financial loss sustained, but also by non-pecuniary considerations (aspectos de orden extrapatrimonial), which vary from case to case and are linked to matters such as human dignity. Under the foregoing premise, as this Court has stated (see, among others, resolution N° 2024000992, issued at quince horas con treinta y siete minutos del 19 de febrero de 2024, expediente 23-003382-1027-CA), it is entirely understandable to this judge that an important human and financial component is at stake in the matter under discussion.
It is not easy for homeowners to relinquish part of their dwelling (in this specific case, the 50.42 square meters that they have been ordered to vacate), since this entails serious harm to the claimant’s comfort, quality of life, and property, among other interests enjoyed over time. It is also valid to state, based even on a mere presumption grounded in ordinary human experience and without the need for documentary evidence, that financial and material resources and effort were invested in the housing project and that, regardless of the amount involved, the investment is significant to its owners. Together with the documents previously submitted by the claimant and referred to in the case record, this provides sufficient circumstantial evidence (indicios) of the existence of potential serious harm arising from the partial demolition of the claimant’s dwelling in question. In the judgment cited above, N° 1172-2027, faced with a dispute similar to the one before us, this Court also reasoned in the manner indicated, stating the following concerning the existence of serious harm in a similar situation: “(...) The requirement refers to harm that is alleged or liable to occur—actually or potentially.
Such harm must be established as serious and must also be regarded as arising from the alleged situation, on the understanding that the claimed injuries must at least be demonstrated under the rational-evidence principle (principio racional de prueba) and with a minimum degree of evidentiary rigor, the burden resting on the interested party. This simply means that it is not enough to allege harm in the terms stated; in addition to its present or potential existence, it must be considered ‘serious’ harm. At this point, it is necessary to note that the party requesting interim relief (tutela cautelar) must undertake an evidentiary effort commensurate with the circumstances of each particular case. An exception exists where the seriousness of the harm can be determined without—albeit to a different degree—the evidentiary rigor mentioned above, if that circumstance can be clearly inferred from the elements available when the corresponding judgment is rendered.
However, this situation is the exception and not the rule, on the understanding that the judge is not called upon to speculate where a party is required to prove. In the specific case, the claimant requests suspension of the order to vacate and partially demolish her dwelling and alleges, as serious harm should the present measure not be granted, that demolition of the structure would in itself cause her serious harm, particularly because there is no certainty that the structures to be demolished actually encroach upon the public zone (zona pública), together with the possibility that the property’s foundations could be undermined, since the municipality has not properly delineated where the demolition would take place. In the specific case, it is the opinion of this judge that it can logically be inferred that demolishing structures forming part of a dwelling in itself has consequences for the owner of the property to be vacated and demolished and that, by circumstantial inference (artículo 417 del Código Procesal Civil), harm may be inferred as a direct, precise, and logical consequence of a proven fact—namely, that an eviction and demolition order exists—such that this person could see her dwelling partially demolished.
Together with the evidence submitted by the claimant, including photographs and surveyors’ reports, the harm is established in the terms required by artículo 21 del Código Procesal Contencioso Administrativo. It should be noted that even the respondent municipality, when addressing the harm requirement, states that the demolition conditions for the claimant’s structures would be the ‘least onerous.’ Accordingly, it is the opinion of this judge that, in this specific case, the harm has been duly established. Under numeral 21 del Código Procesal Contencioso Administrativo, a precautionary measure is appropriate when execution of the conduct at issue in the proceedings would cause serious harm, provided that the claim is not frivolous (temeraria). In this regard, it is the opinion of this judge that the demolition of a residential structure, even partially, causes harm within the legal sphere of the person who suffers it and, as stated supra, the claim is not frivolous.
Accordingly, serious harm to the applicant’s legal position (situación jurídica) has been established...” (see judgment N° 1172-2017, issued at quince horas y veinticinco minutos del veintiséis de mayo del año dos mil diecisiete, expediente 17-001040-1027-CA). As evidence, the claimant offers a copy of the eviction order (see images 10 to 25 of the precautionary-measure file (legajo de medida cautelar)), while the following documentary evidence is offered in the principal proceedings:
The Administrative Litigation Appeals Tribunal has analyzed that requirement for provisional relief (presupuesto cautelar) in the following terms: “Regarding the issue of balancing or weighing the interests at stake, it is necessary to recall that, in this type of provisional measure (medida cautelar), the effects that the prospective measure may generate for the applicant’s private interest must necessarily be weighed against those embodied in the public interest. At the doctrinal level, this requirement has also been addressed through what has been termed the bilateral nature of periculum in mora. Before adopting a provisional measure, the judge must assess the implications that this decision may have for the public interest and the legal position of third parties. In striking that balance, it is also necessary to weigh the impact that the provisional measure may have on the ordinary activities of the public administration, since it may affect or hinder the substantive operations of a particular administrative organization.
Along these lines, the proper weighing of the public interest entails denying the application for provisional relief when the harm to the public interest outweighs the private interest, taking into account even the financial or budgetary provisions that the public administration must make in order to implement the provisional measure. Finally, it bears emphasizing that any provisional measure adopted must always be appropriate to the specific case, insofar as it must be suitable for achieving the intended purposes reasonably and proportionately, bearing in mind the interests at stake...” (see ruling of the Administrative Litigation Appeals Tribunal, N°336-2017-I, issued at trece horas con treinta y cinco minutos del nueve de agosto de 2017, among many others). Accordingly, in light of the specific case, it is precisely the balancing of the interests at stake that must guide the decision to be adopted and, in the context of the case file before us, leads to GRANTING the relief sought by the claimant.
There is a certain doctrinal consensus that balancing is a method of argumentation carried out through three successive stages: a) identification of the conflicting interests; b) assignment of weight to each of them; and finally, c) a decision establishing equilibrium or conditional precedence under the criterion that “the greater the impairment of one, the greater the importance of satisfying the other,” or simply, “the more... then,” according to the formulation of the German Federal Constitutional Court. In this case, with respect to identifying the conflicting interests, the claimant’s interest lies in staying the demolition order in order to preserve part of her property (the dwelling) without alteration, while the competing public interest would be associated with compliance with mandatory urban-planning regulations, for the purpose of satisfying the general interests of orderly development and environmental protection.
Consequently, staying enforcement will indeed affect those interests by permitting the structure erected at the site to remain while the merits of the matter are resolved. In the case before us, it is therefore evident that different balancing assessments exist, both that of the respondent in the decision giving rise to the dispute and that of the claimant in the arguments referenced above and the evidence submitted by the claimant in her defense. Accordingly, this judge finds that, given such differences concerning the resolution of the conflict among the principles involved, it will be for the Trial Court, at the appropriate procedural stage, to determine which must prevail through the application of the constitutional principles of reasonableness and proportionality, taking into account the particular circumstances of the specific case. At this time, however, there is neither justification nor evidence of harm to the public interests of such magnitude that it should prevail over the serious harm caused by the immediate partial demolition of the dwelling.
In addressing a similar dispute, this Tribunal stated the following in the aforementioned ruling N°1172-2017: “(...) This Judge considers that, on the basis of the evidence in the record, it cannot be established that staying the eviction and demolition order would actually cause harm to the public interests. Although it is true that the respondent municipal entity alleges that the public interest in protecting the public area purportedly being encroached upon by the claimant must prevail, and states that those assets are public-domain property (bienes demaniales) and are therefore characterized as not subject to prescription, inalienable, and exempt from attachment, the photographs and documents submitted by the municipal entity itself as evidence show that the construction undertaken by the claimant—regardless of whether or not it is located in a public area—does not obstruct pedestrian passage along the sidewalk and therefore does not pose a danger, in the sense that pedestrians may move freely along the sidewalk and need not walk in the street.
Thus, the interests of third parties are not currently being affected. In turn, the claimant states that the structure covered by the demolition order is occupied by third parties to whom she rents her dwelling. The interests of those tenants must therefore also be protected, since, for purposes of these proceedings, they would appear as third parties whose interests must be considered when weighing the interests at stake (as provided in article 22 of the CPCA). Accordingly, the private interests of the claimant and of the third-party tenants of the structures at issue prevail and, because the three statutory requirements have been established, the requested anticipatory provisional measure (medida cautelar anticipada) sought by Ms. (...) is granted insofar as it provisionally stays the effects of Official Letter (...) issued by the Municipalidad de Heredia and, consequently, stays the eviction, demolition, and removal of the structures at issue that are owned by the claimant.
The interlocutory ruling issued at catorce horas y siete minutos del dos de febrero del año dos mil diecisiete is therefore affirmed. Pursuant to artículo 26 párrafo segundo del Código Procesal Contencioso Administrativo, the complaint shall be filed within 15 días, counted from the day following notice of the order granting the measure. The party is directed to state in her ordinary complaint the same case number assigned to this provisional-measure proceeding. This matter is decided without a special award of costs (see ruling N° 1172-2017, issued at quince horas y veinticinco minutos del veintiséis de mayo del año dos mil diecisiete, expediente 17-001040-1027-CA, emphasis added). As in the case cited above, in the case before us it cannot be established that staying the eviction and demolition order would actually cause harm to the public interests of greater weight than the serious harm entailed by immediately demolishing the dwelling to the extent specified in the administrative act while the merits of this matter are being resolved.
Although it is true that the respondents argue that the public interest in protecting the public area purportedly being encroached upon by the claimant must prevail, and that the assets in question are identified as public-domain property and are therefore characterized as not subject to prescription, inalienable, exempt from attachment, and intended for protection, the documents submitted show that the construction has stood at the site for several years and that the property has been registered since the década de los noventa (see images 66 a 79 of the provisional-measure file), with survey plan H-0845457-1989; whereas the survey plan for property real-property folio 4-270947-000 was registered on 14 de diciembre de 2020 for purposes of locating the property identified by the municipality (see image 63 of the provisional-measure file, as well as findings of fact primero al cuatro of official letter AMH-0803-20224).
In other words, the position of the respondent in this case is that public-domain properties exist within the canton and that, for various reasons, it was not until recently that a field inspection and measurement revealed the existence of an area being encroached upon, whereupon the administrative eviction and demolition proceeding for encroachment upon public-domain property at the site was initiated. In other words, the alleged impairment is not recent, but was recently discovered and, according to the respondents’ own allegations, has existed at that location for a long time and was discovered as a result of a topographic survey (levantamiento topográfico) conducted in 2023. Under these circumstances, the provisional and temporary stay and preservation of the state of affairs already existing at the site would provisionally maintain a situation that has existed there for years, without any showing that its continuation would significantly impair the public interest.
According to the respondent, it was only recently discovered due to the various circumstances described above. Thus, provisionally staying enforcement of the demolition and maintaining that stay would not entail harm to the public interest of such magnitude as to outweigh the serious potential harm that would result in this specific case from immediately carrying out the demolition without first subjecting it to judicial review of legality. It should be noted that the stay merely preserves, while the lawfulness of the actions taken is disputed, a state of affairs that has existed at the site for years without having caused any significant impairment of the public interest (there is no evidence to that effect in the record). This authority does not find that the provisional stay sought would harm the public interests to such a degree as to outweigh the serious potential harm that partial demolition of her dwelling would cause the claimant.
It must be taken into consideration that the claimant has owned the real property for many years (more than dos décadas), whereas the municipality’s survey-plan registration and the topographic survey are relatively recent. Additionally, it is taken into consideration in this matter—and must be emphasized—that, in these provisional-relief proceedings (gestión cautelar), the ruling issued at catorce horas treinta y cinco minutos del veintiocho de agosto de dos mil veinticuatro granted provisional relief on an exceptionally urgent interim basis (carácter de provisionalísima) and ordered the immediate stay of the effects of the administrative act. Accordingly, since that date, the situation at the site has remained in abeyance and, during that time, it appears that no greater disruption to the public interest has occurred, nor has the situation changed significantly to the detriment of the condition or protection of the local water resource.
At least, that may be presumed in the absence of any evidence establishing otherwise (artículo 29.1 del Código Procesal Contencioso Administrativo and 41.1 del Código Procesal Civil, applicable to this subject matter by virtue of the referral in 220 del Código que regula esta Materia). In view of the foregoing, and until it is established in judicial proceedings whether the administrative conduct at issue in these proceedings is lawful, the balance, on this occasion, weighs in favor of finding that this requirement for provisional relief has been satisfied, since this authority does not find that, in this specific case, the requested provisional stay would cause any significant or overriding impairment of the public interest involved or pose such a risk to the public interests concerned.
The result of this balancing test therefore leads us to conclude that the efficient balance of the interests at stake favors GRANTING the requested relief and stay. The harm to the public interest caused by temporarily staying enforcement of the demolition in this specific case is not sufficiently serious to constitute a significant and overriding impairment of the public interest. Accordingly, since all the requirements for interim relief have been established pursuant to Articles 1, 2, 20, and 21 of the Code of Administrative Litigation Procedure, the requested interim measure must be granted. Therefore, as an interim measure, the effects of the challenged administrative conduct are provisionally stayed.
POR TANTO
Based on the foregoing and pursuant to Articles 20 and 21 of the Código Procesal Contencioso Administrativo, the application for a precautionary measure (medida cautelar) filed by GEOVANNI ESPINOZA CUBILLO, holder of identity card number 602330436, and JENNY CORDERO VARELA, holder of identity card number 204810207, against the MUNICIPALIDAD DE HEREDIA is hereby declared PARTIALLY WELL-FOUNDED and is PARTIALLY GRANTED. The ESTADO (MINAE) and the Sistema Nacional de Áreas de Conservación (SINAC) participate as necessary co-parties (litis consortes necesarios), under the following terms: as a precautionary measure, the effects of the administrative act (acto administrativo) consisting of resolution AMH-0803-2024, issued by the Office of the Mayor of the Municipalidad de Heredia at seven hours and seven minutes on 19 de agosto de 2024, are suspended; consequently, the eviction, demolition, and removal of the structures at issue on the claimant’s property resulting from that administrative conduct (conducta administrativa) are also suspended as a precautionary measure.
As a precautionary measure, the respondent Municipalidad de Heredia is ORDERED to refrain from engaging in any conduct that may directly or indirectly have the effect of enforcing that administrative act, in order to safeguard the interim judicial protection (tutela judicial cautelar) granted in this decision. EL ESTADO N° 2025002115 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las once horas con treinta y uno minutos del cinco de Marzo del dos mil venticinco.- Se conoce solicitud de MEDIDA CAUTELAR presentada por GEOVANNI ESPINOZA CUBILLO, portador de la cédula de identidad número 602330436, y JENNY CORDERO VARELA, portadora de la cédula de identidad número 204810207, en contra de la MUNICIPALIDAD DE HEREDIA. Intervienen como litis consortes necesarios el ESTADO (MINAE) y al Sistema Nacional de Áreas de Conservación (SINAC).
CONSIDERANDO
a-) Mediante escrito presentado el 28 de agosto de 2024, se interpone solicitud de medida cautelar ante esta jurisdicción en que la parte accionante solicita lo siguiente: "PRETENSIÓN DE LAS MEDIDAS CAUTELARES: 1. Que la Municipalidad de Heredia no efectúe el desalojo, demolición y usurpación en contra de la casa de habitación del Sr. Giovanni Espinoza Cubillo y la Sra. Jenny Cordero Varela" (ver imagen 8 del expediente digital del legajo de medida cautelar, en adelante el "expediente digital" o el legajo de medida cautelar indistintamente). Señala la parte accionante, en síntesis, que con el desalojo y demolición el inmueble quedaría inhabitable y los actores no cuentan con medios económicos para alquilar una vivienda o hacer remodelaciones en la casa. Asimismo, indica que el desalojo está pronto a ser ejecutado el día 20 de setiembre de 2024 de manera que hay un riesgo inminente de graves daños a la vivienda la cual quedaría inhabitable.
Se trata de una medida cautelar de carácter SUSPENSIVO para que no se ejecute el procedimiento de desalojo administrativo y demolición por invasión de bienes demaniales, determinado por resolución AMH-0803-2024 emitida por la Alcaldía Municipal de la Municipalidad de Heredia a las siete horas siete minutos del 19 de agosto de 2024. En cuanto a la apariencia de buen derecho señala la parte accionante que resulta evidente en el caso concreto. Lo anterior por cuanto, en síntesis, indica la parte accionante en su demanda (ver escrito de demanda visible a imágenes 2 a 13 del expediente principal, así como escrito de solicitud de medida cautelar de imágenes 5 a 9 del legajo de medida cautelar) que la Municipalidad de Heredia inicia contra de los actores un procedimiento de desalojo administrativo y demolición por invasión y usurpación de bienes demaniales, bajo la matrícula 270947, que se constituyó como dominio público de la Municipalidad de Heredia por una DONACIÓN que realiza el BANCO HIPOTECARIO DE LA VIVIENDA (BANHVI) que el accionante califica de nula e ilícita, asimismo, sostiene la parte accionante que ambos actores ostentan el derecho de propiedad sobre los 50.42 metros cuadrados que se pide desalojar puesto que el BANHVI les había otorgada escritura pública desde hace 28 años y se trata de un lote inscrito en el Registro Nacional, por lo que la Municipalidad de Heredia no tiene derecho sobre dicha propiedad.
Señala también la parte accionante que no están habitando una zona de protección como se afirma por la municipalidad accionada por cuanto no existe normativa alguna que señala tal zona como de protección forestal y la vegetación existente ha sido plantada por los vecinos de la localidad, por lo que solicita que se declare la nulidad de la conducta administrativa así como la indemnización de los daños y perjuicios causados, así como también se declare y reconozca su derecho sobre los citados 50.42 metros cuadrados, intereses y ambas costas. Finalmente, sobre la ponderación de intereses en juego, indica, en síntesis, que debe ponderarse la gravedad del perjuicio que se causa a los accionantes y su nucleo familiar por encima de los intereses defendidos por el accionado. Ofrece como prueba la copia del desalojo (ver imágenes 10 a 25 del legajo de medida cautelar), y en el principal se ofrece la siguiente prueba documental:
En el presente asunto la parte accionante mediante memorial de fecha 28 de agosto de 2024 presenta solicitud de medida cautelar en los siguientes términos: "PRETENSIÓN DE LAS MEDIDAS CAUTELARES: 1. Que la Municipalidad de Heredia no efectúe el desalojo, demolición y usurpación en contra de la casa de habitación del Sr. Giovanni Espinoza Cubillo y la Sra. Jenny Cordero Varela" (ver imagen 8 del legajo de medida cautelar). Señala la parte accionante, en síntesis, que con el desalojo y demolición el inmueble quedaría inhabitable y los actores no cuentan con medios económicos para alquilar una vivienda o hacer remodelaciones en la casa. Asimismo, indica que el desalojo está pronto a ser ejecutado el día 20 de setiembre de 2024 de manera que hay un riesgo inminente de graves daños a la vivienda la cual quedaría inhabitable. Se trata de una medida cautelar de carácter SUSPENSIVO para que no se ejecute el procedimiento de desalojo administrativo y demolición por invasión de bienes demaniales, determinado por resolución AMH-0803-2024 emitida por la Alcaldía Municipal de la Municipalidad de Heredia a las siete horas siete minutos del 19 de agosto de 2024.
Ahora bien, con posterioridad, mediante manifestaciones fechadas 11 de octubre de 2024, en síntesis, la parte accionante insiste en su posición esbozada anteriormente, solicitando además que personeros del del Sistema Nacional de Áreas de Conservación (SINAC) y del MINAE (Estado) visiten la zona y verifiquen el daño ambiental que aducen en su gestión (ver imágenes 141 a 143 del legajo de medida cautelar). Dicha solicitud, se trata, en síntesis, de una pretensión cautelar consistente en una orden de HACER pero dirigida al SINAC y al ESTADO (MINAE), para que se visite la zona en cuestión en relación con el alegado daño ambiental que indica, por lo cual fueron integrados ambos como accionados y se les otorgó audiencia al respecto de lo solicitado. Así las cosas, se trata de una gestión cautelar solicitando medidas de carácter conservativo del estado de las cosas y de efectos innovativos (órdenes de hacer) que formula la parte actora, contenidas dentro de las posibilidades de petición que regula el numeral 20 del Código Procesal Contencioso Administrativo (CPCA).
En síntesis, la parte accionante indica en cuanto a la apariencia de buen derecho que resulta evidente en el caso concreto. Lo anterior por cuanto, en síntesis, indica en su gestión (ver escrito de demanda visible a imágenes 2 a 13 del expediente principal, así como escrito de solicitud de medida cautelar de imágenes 5 a 9 del legajo de medida cautelar) que la Municipalidad de Heredia inicia contra de los actores un procedimiento de desalojo administrativo y demolición por invasión y usurpación de bienes demaniales, bajo la matrícula 270947, que se constituyó como dominio público de la Municipalidad de Heredia por una DONACIÓN que realiza el BANCO HIPOTECARIO DE LA VIVIENDA (BANHVI) que el accionante califica de nula e ilícita, asimismo, sostiene la parte accionante que ambos actores ostentan el derecho de propiedad sobre los 50.42 metros cuadrados que se pide desalojar puesto que el BANHVI les había otorgada escritura pública desde hace 28 años y se trata de un lote inscrito en el Registro Nacional, por lo que la Municipalidad de Heredia no tiene derecho sobre dicha propiedad.

En síntesis, la parte accionada se refiere a la medida cautelar indicando su oposición y solicitando su rechazo por no concurrir en la especie los requisitos esenciales para el acogimiento de una medida de tal naturaleza. Mediante memorial de fecha 17 de setiembre de 2024, visible a imágenes 50 a 58 del legajo de medida cautelar, la representación de la Municipalidad de Heredia accionada contesta la gestión de tutela cautelar solicitando su rechazo indicando que no concurren los requisitos para el acogimiento de una medida de tal naturaleza indicando. Luego de realizar un recuento de los antecedentes y denominados "hechos" del caso, la municipalidad accionada señala, en síntesis, sobre la denominada apariencia de buen derecho que en este caso se trata de una gestión carente de este presupuesto, pues se trata de la ocupación y disposición ilegítima de un área de 50.42 metros cuadrados de dominio público destinada a zona de protección (refiere al oficio DIP-DT-0328-2023) parte de la finca 4-150475-001 y 4-150475-002, plano catastrado H-084457-1989, ubicado en la urbanización la Gran Samaria en San Francisco de Heredia, por lo que se ordenó el desalojo y demolición por invasión de bienes demaniales, otorgando el debido proceso contemplado en la legislación al efecto, lo cual indica se trata de un deber por tratarse de bienes de dominio público y la municipalidad está facultada para recuperar el dominio de dichos inmuebles a través de la acción administrativa.
Señala en este sentido que la demanda se encuentra ayuna de fundamentación y carece de seriedad, indica que no se cuestiona la titularidad sobre el inmueble sino la invasión que se perpetra contra el bien de dominio público 4-27094-000, así como que los actores no aportan prueba para acreditar un derecho para invadir la zona pública. Sobre el peligro en la demora indica la municipalidad que si bien no se requiere plena prueba par su demostración y se contemplan daños no solo actuales sino también potenciales, no basta con el dicho del accionante sino que requiere la evidencia de la magnitud grave del año, de lo cual indica está completamente desprovisto el alegato de la parte actora. Señala que el desalojo o demolición es del área de 50.42 metros cuadrados que se encuentran sobre el bien de dominio público según loa resolución AMH-0803-2024, por lo que no se justifica con prueba idónea este presupuesto.
Finalmente, sobre la ponderación de intereses en juego señala la municipalidad que en su criterio debe ponderar el interés público tutelado por la municipalidad de recuperar el uso al que fue destinado la zona pública sobre los intereses privados de las partes accionantes de perpetuarse en la invasión de bienes demaniales (zona de protección), por cuanto al no existir un daño que sirva de base para ponderar no es siquiera posible valorar este presupuesto al carecer incluso la gestión de un razonamiento de ponderación de los intereses en juego. Por lo anterior, la municipalidad accionada solicita que rechace la medida cautelar y se revoque la medida cautelar provisionalísima decretada. Ofrece como prueba el expediente DIP-DT-0328-2023 de la Sección de Control Fiscal y Urbano (ver imágenes 60 a 103 del legajo de medida cautelar). Luego de otorgada audiencia de las manifestaciones complementarias la municipalidad accionada responde en memorial de fecha 10 de octubre de 2024, visible a imágenes 133 a 137 del legajo de medida cautelar, en que señala nuevamente que no existe prueba en cuanto a que el IMAS fuera el propietario registral de la "Gran Samaria" en algún momento, desconociendo si esto se refiere a la finca madre o las áreas públicas, lo cual señala es indistinto a efectos del desalojo del bien público invadido en este caso que se encuentra a nombre de la municipalidad.
Asimismo, señala que no es procedente en esta vía cuestionar los antecedentes registrales del bien inmueble y se han aportado a los autos elementos de prueba que dan cuenta de la existencia del traspaso por parte del fideicomiso. También señala que en la escritura aportada al expediente consta el traspaso generado de la zona a favor de la municipalidad accionada y la parte actora se contradice en sus afirmaciones, así como que la asignación del distrito en la escritura, plano de la finca madre y diseño de sitio resulta intrascendente para el objeto de estas diligencias, puesto que es claro que se trata de la finca madre que dio origen a la urbanización La Gran Samaria, por lo que solicita resolver a la mayor brevedad dada la gran cantidad de escritos presentados por la parte accionante en este caso. Ofrece como prueba los autos. Ahora bien, otorgada la audiencia a los accionados respecto de la inspección en sitio solicitada, por memorial de fecha 13 de enero de 2025, la representación del SINAC se refiere a la audiencia conferida y peticiona, en síntesis, que se rechace lo pretendido por improcedente.
Señala dicha representación, en síntesis, que en esta causa no se verifican actos administrativos de dicha institución que se encuentren en pugna, e indica que lo solicitado por el actor es improcedente indicando lo siguiente: "(...) El argumento de los actores es que existe una planta de tratamiento, que no es objeto del proceso, pero ubicada en cercanías, que se encuentra vulnerando el medio ambiente. Si bien la posibilidad de este hecho resulta relevante para la Administración Pública, y su procedimiento corresponde en una denuncia directa ante entidades administrativas, judiciales o utilizando el sistema de SITADAS; el mismo no resulta atinente al presente proceso contencioso administrativo." (ver imagen 233 del expediente digital, destacado propio). Asimismo, considera el SINAC que no se presentan los presupuestos de la tutela cautelar, señalando que no se logra identificar la relación que tiene la planta de tratamiento y la necesidad de inspección al objeto del proceso ni existe vínculo lógico o causal sobre los actos del ente municipal cuestionado y lo solicitado por la parte actora.
También señala que no se puede indicar que lo pretendida cumpla con la apariencia de buen derecho y ponderación de intereses, por cuanto, en síntesis, no se puede pretender suspender la actuación municipal por el señalamiento de la actora de que otras personas en otro inmueble desarrollan actividades contra el medio ambiente. Así las cosas, la representación del SINAC se encuentra disconforme con la posición de la parte actora e indica, en suma, que el peligro en la demora, al contrario de lo indicado por la actora, se da al mantenerse una construcción en invasión de terrenos de dominio público dentro de zona de protección del recurso hídrico, contraviniendo el orden legal y constitucional de protección al medio ambiente sano y ecológicamente equilibrado, por cuanto se menciona la intención de mantener obras y construcciones dentro del área de protección como también contaminación a cuerpos de agua, de manera que no se cumplen los requisitos de la tutela cautelar y solicita que la medida cautelar sea declarada sin lugar. Ofrece como prueba la que consta en el expediente judicial (ver imágenes 231 a 236 del legajo de medida cautelar)
Tal y como ha sido desarrollado por la Sala Constitucional, así como en fallos anteriores de este Tribunal (ver, entre otros, el fallo N°38-2022 de las diez horas diez minutos del doce de enero de dos mi veintidós) la justicia cautelar responde a la necesidad de garantizar el principio constitucional de una justicia pronta y cumplida, al conservar las condiciones reales indispensables para la emisión y ejecución de la sentencia (Resolución 7190-1994, de las 15:24 horas del 6 de diciembre). En este mismo sentido, el artículo 19 del Código Procesal Contencioso Administrativo, establece que el fin de la fijación de una medida cautelar es proteger y garantizar, provisionalmente el objeto del proceso y la efectividad de la sentencia. La doctrina ha indicado que la justicia cautelar no tiene como fin declarar un hecho o una responsabilidad, ni la de constituir una relación jurídica, ni ejecutar un mandato y satisfacer el derecho que se tiene sin ser discutido, ni dirimir un litigio, sino prevenir los daños que el litigio pueda acarrear o que puedan derivarse de una situación anormal (Gallegos Fedriani, Pablo.
Las medidas cautelares contra la Administración Pública. 2 ed. Buenos Aires, Argentina: Ábaco, 2006). En el voto #4074-2010 el Tribunal Contencioso Administrativo señala que: “los presupuestos de la tutela cautelar son tres, el peligro en la demora, la apariencia de buen derecho y la ponderación de los intereses, particularmente el interés público” y “[s]ólo en la concurrencia de los tres elementos, es decir, de la apariencia de buen derecho, del peligro en la demora y que del análisis de ponderación de intereses se considere que daño sufrido por el particular debe tutelarse por encima de los demás intereses en juego, puede proceder el despacho a conceder la medida cautelar solicitada” (Tribunal Contencioso Administrativo, resolución n.° 4074-2010 de las 13:21 hrs. del 29 de octubre de 2010). También el Tribunal de Apelaciones de lo Contencioso Administrativo ha señalado en el mismo sentido: “En el caso de las medidas cautelares, esto implica que, en adición a lo relativo a las características estructurales de instrumentalidad y provisionalidad, la resolución debe explicar de forma clara y suficiente de qué modo concurren o no los presupuestos de apariencia de buen derecho, peligro en la demora y ponderación de los intereses en juego, ninguno de ellos puede ser dejado de lado, pues para la procedencia de la medida que se adopte la ley exige la concurrencia de todos ellos […] si este Tribunal hipotéticamente acogiese los alegatos relativos a este extremo, y entendiera que el elemento de ponderación de intereses sí está presente eso obligaría a este Tribunal en primera y única instancia a entrar a analizar y a desarrollar el tema de ponderación de intereses en una forma que omitió el juez de instancia, por lo cual, como bien lo señaló en su momento la parte, estaría haciendo que este Tribunal sustituya al juzgador de instancia en el análisis en primera o en única instancia de ese elemento, privando a la parte por lo tanto del derecho de recurrir al respecto de lo que se ha indicado" (ver resolución del Tribunal Procesal Contencioso Administrativo, n.° 132-2017-I de las dieciséis horas dieciocho minutos del veintinueve de marzo del dos mil diecisiete.
Cfr. 00:16:24 – 00:21:35 de la grabación digital del fallo correspondiente). Esta posición se complementa con el criterio externado por la Sala Primera de la Corte Suprema de Justicia, en funciones de Tribunal de Casación de lo Contencioso Administrativo, en Voto N° 5-F-TC-2008 de las diez horas con cuarenta y cinco minutos del seis de febrero del año dos mil ocho, respecto de la necesidad de cumplimiento de la carga probatoria en esta fase cautelar, al indicar que "(…) tres requisitos que se aplican como es el fumus bonis iuris o apariencia de buen derecho… el peligro de la demora y la ponderación de los intereses en juego… la apariencia de buen derecho conforme a la nueva legislación no constituye una carga gravosa de demostración de la seriedad de la demanda, sino la valoración incluso interna del juez de que aquella sentencia no es temeraria de que no es carente de seriedad, que es una visión invertida, por cierto, del denominado fumus bonis iuris, este periculum además corresponde a la carga, como carga probatoria para quien pide la cautelar, y esto es así, luego la cautelar es un juicio provisional de ese peligro en la mora no es… una valoración del fondo del proceso… en lo que corresponde al caso concreto (…) y esta Sala luego de deliberar concienzuda y ampliamente como lo hace (…) ha estimado que no están debidamente demostrados los daños y perjuicios graves o de imposible reparación que ameriten la adopción de la medida cautelar en cuestión (…) En definitiva, el Tribunal estima que no se cumple con el principio de la prueba racional de la cautelar que se corresponde con una prueba de equilibrio, si bien es cierto no se requiere de una prueba contundente, porque no puede serlo en la medida cautelar, tampoco lo podemos dejar al arbitrio del solo dicho de quien recurre, hay de por medio también eventuales intereses públicos” .
Partiendo del anterior marco normativo y jurisprudencial de análisis y los elementos requeridos para la estimación de una medida cautelar, se procede a realizar el estudio del caso concreto, atendiendo a la exposición de la denominada teoría del caso y el ofrecimiento de la prueba. Fijado el escenario de análisis y los tres elementos requeridos para la estimación de una medida cautelar, se analiza de seguido el caso concreto.-
Las medidas cautelares para su aprobación requieren la concurrencia de los tres elementos antes indicados (apariencia de buen derecho en su visión invertida casi asimilable a un "fumus non mali iuris", peligro en la mora y el equilibrio de intereses). Además, esta medida cautelar debe ser instrumental, accesoria y provisional, en el tanto procura asegurar la eficacia de la sentencia del expediente principal. Es responsabilidad del promovente explicar, analizar y fundamentar cada uno de estos presupuestos y de las partes demandadas debatir los argumentos presentados y así, con base en las teorías de las partes y las pruebas mencionadas determinar lo que derecho corresponde sobre el fondo de la medida solicitada. VI. A) POSICIONES DE LAS PARTES: 1) POSICIÓN DE LA PARTE ACCIONANTE: La pretensión de tutela cautelar de la parte actora se fundamenta, en síntesis, en supuestos vicios de nulidad en los actos administrativos en donde se acordó la demolición de parte de la vivienda de la parte accionante.
Señala la parte accionante, en síntesis, que con el desalojo y demolición el inmueble quedaría inhabitable y los actores no cuentan con medios económicos para alquilar una vivienda o hacer remodelaciones en la casa. Asimismo, indica que el desalojo está pronto a ser ejecutado y fue señalado inicialmente para el día 20 de setiembre de 2024 (suspendido en virtud de la medida provisionalísima) de manera que hay un riesgo inminente de graves daños a la vivienda la cual quedaría inhabitable si no se adopta como medida cautelar para este caso la suspensión de dicha conducta administrativa. Se trata de una medida cautelar de carácter SUSPENSIVO para que no se ejecute el procedimiento de desalojo administrativo y demolición por invasión de bienes demaniales, determinado por resolución AMH-0803-2024 emitida por la Alcaldía Municipal de la Municipalidad de Heredia a las siete horas siete minutos del 19 de agosto de 2024.
También señala la parte accionante en su gestión (ver escrito de demanda visible a imágenes 2 a 13 del expediente principal, así como escrito de solicitud de medida cautelar de imágenes 5 a 9 del legajo de medida cautelar) que la Municipalidad de Heredia inicia contra de los actores un procedimiento de desalojo administrativo y demolición por invasión y usurpación de bienes demaniales, bajo la matrícula 270947, que se constituyó como dominio público de la Municipalidad de Heredia por una DONACIÓN que realiza el BANCO HIPOTECARIO DE LA VIVIENDA (BANHVI) que el accionante califica de nula e ilícita, asimismo, sostiene la parte accionante que ambos actores ostentan el derecho de propiedad sobre los 50.42 metros cuadrados que se pide desalojar puesto que el BANHVI les había otorgada escritura pública desde hace 28 años y se trata de un lote inscrito en el Registro Nacional, por lo que la Municipalidad de Heredia no tiene derecho sobre dicha propiedad. 2) POSICIÓN DE LOS ACCIONADOS: La municipalidad accionada, según ha quedado detallado, en síntesis, rechaza las afirmaciones realizadas por la parte actora, indicando, en síntesis, que el proceso versa sobre la invasión de los actores sobre un bien de dominio público, y no hay prueba idónea de que la demolición sobre los 50.42 metros cuadrados implicaría que la casa de habitación quedaría inhabitable.
Asimismo, indica que no le consta el relleno realizado hace más de 20 años que refieren los actores, así como que los padecimientos de salud de la parte actora no justifican la ocupación de bienes de carácter demanial. Con respecto a la visita a la zona en cuestión, la representación del SINAC se opone y respecto de la suspensión pedida indica que la suspensión del acto administrativo implica desaplicar la normativa forestal, lo que roza con el ordenamiento jurídico de protección al medio ambiente, al pretenderse por el accionado mantener las obras y construcciones en la zona de protección. VI. B).- SOBRE LOS DENOMINADOS "ELEMENTOS ESTRUCTURALES": Para empezar, sobre los denominados "elementos estructurales" de la tutela cautelar, independientemente de lo que pueda llegar a definirse en el proceso de conocimiento sobre el fondo del asunto y de los cuestionamientos que se plantean respecto de la conducta administrativa, cabe indicar lo siguiente en relación con las características más elementales de instrumentalidad, accesoriedad y provisionalidad para una solicitud como la que nos ocupa.
Sobre tales denominadas características "estructurales" de la medida cautelar, entre otros, se ha indicado en el fallo 2023006573 de las veintiuno horas con veintisiete minutos del diecinueve de Diciembre del dos mil veintitrés, lo siguiente: "IV.- CARACTERÍSTICAS ESTRUCTURALES DE LAS MEDIDAS CAUTELARES. // Para la determinación de la procedencia de la medida es también importante tomar en cuenta, - tal y como fuera señalado supra y además de los presupuestos ya indicados-, que la medida que vaya adoptarse estructuralmente cuente con las siguientes características: 1.- La instrumentalidad e independencia previa con relación a la sentencia definitiva que se produzca en un proceso principal, cuestión que determina al propio tiempo, la subordinación o accesoriedad de la medida con respecto del proceso principal dentro, o a efecto del cual se dicta. 2.- La provisionalidad, en cuanto su eficacia en principio se agota al momento de dictarse la sentencia de mérito en el asunto principal o cuando las circunstancias así lo impongan.
Es decir, tiene efectos supeditados a la pendencia de aquel proceso, tanto como y, - por otro lado-, a la permanencia en el tiempo de las circunstancias que fuesen tomadas en cuenta para su adopción, características que traen causa de su intrínseca posibilidad de modificación o revocación (eficacia rebus sic stantibus). 3.-Todo proceso judicial conlleva un debido proceso que da pie a una serie de etapas que deben irse precluyendo para poder llegar a una resolución que el conflicto ya judicializado de manera definitiva. Es justamente la dilatación de los procesos judiciales lo que origina que opere el peligro en la demora, aunado al peligro o urgencia de que mientras se da el curso normal de la acción se pierda o altere el derecho de la parte o de intereses jurídicamente relevantes de alguna de las partes y es así como lo prevee el ordenamiento jurídico en su numeral 78 del Código Procesal Civil, el cual se aplica de manera analógica a esta materia.
La urgencia para evitar el peligro en la mora, nota que justifica las medidas cautelares adoptadas ante causam, prima facie o inaudita altera parte. 4.- La sumaria cognitio, esto es, que este tipo de medidas son adoptadas en virtud de una cognición sumarísimo efectuada por el órgano jurisdiccional, sin entrar a prejuzgar sobre el mérito del asunto, que de forma alguna sustituye la plenaria sucesión de pasos que implica el proceso de conocimiento". Ahora bien, en relación con las denominadas características "estructurales" de las medidas cautelares, ha quedado muy claro de las manifestaciones de la representación de la parte accionada que su interés principal con la presente solicitud de tutela cautelar consiste en que se "suspendan" los efectos del acto administrativo que dispuso la demolición parcial de la vivienda que la parte accionada sostiene invade terrenos de dominio público, lo cual es negado por la parte actora indicando que en realidad no es así y se trata por el contrario de un bien inmueble inscrito a su nombre.
La parte accionante solicita que no se ejecute la demolición mientras mientras se discute el fondo del proceso en esta sede judicial por cuanto la vivienda quedaría inhabitable y no cuenta con medios para poder satisfacer sus necesidades de vivienda en esa eventualidad. Así las cosas, en el tanto se trata de una petición de carácter suspensivo respecto de los efectos de un acto administrativo que se califica como absolutamente nulo, es el criterio de este juzgador que sí cumple en lo peticionado en este extremo con los requisitos de instrumentalidad y provisionalidad con respecto a la causa que nos ocupa. Sin embargo, no sucede así con la otra petición que realiza la parte actora de que se ordene como tutela cautelar de "HACER" una medida de carácter innovativo respecto de personeros del SINAC y del ESTADO (MINAE). Tal como consta en autos mediante manifestaciones fechadas 11 de octubre de 2024, en síntesis, la parte accionante insiste en su posición esbozada en memoriales anteriores señalando que cerca de la vivienda se están desviando aguas negras hacia la quebrada Aries y se trata de una reserva natural por lo que el plano catastrado que se indica por la municipalidad es ilícito, también indica que necesitaba el permiso del SINAC por ser zona de protección, y como petitoria pide expresamente que personeros del Sistema Nacional de Áreas de Conservación (SINAC) y del MINAE (Estado) visiten la zona y verifiquen el daño ambiental que aducen en su gestión (ver imágenes 141 a 143 del legajo de medida cautelar).
Ahora bien, en el tanto la parte actora está pretendiendo en forma expresa como una pretensión en sede cautelar una orden de HACER dirigida tanto al Sistema Nacional de Áreas de Conservación (SINAC) como al Estado (Ministerio de Ambiente y Energía o MINAE) para que se visite la zona en cuestión en relación con el alegado daño ambiental que indica, de previo a emitir cualquier pronunciamiento acerca de lo solicitado se procedió a la integración de la litis con ambas accionadas (SINAC y el ESTADO) para que se pronunciaran sobre lo solicitado por la parte actora y realizaran las manifestaciones que consideraban pertinentes al respecto. En este sentido, el SINAC indicó al despacho una vez enterado de las manifestaciones lo siguiente: "(...) El argumento de los actores es que existe una planta de tratamiento, que no es objeto del proceso, pero ubicada en cercanías, que se encuentra vulnerando el medio ambiente.
Si bien la posibilidad de este hecho resulta relevante para la Administración Pública, y su procedimiento corresponde en una denuncia directa ante entidades administrativas, judiciales o utilizando el sistema de SITADAS; el mismo no resulta atinente al presente proceso contencioso administrativo." (destacado propio, ver imagen 233 del legajo de medida cautelar). En este sentido, el criterio de este juzgador coincide con la representación del accionado SINAC en el sentido de que lo manifestado por la parte actora se trata de un extremo cuya tramitación correspondería a una denuncia en la sede administrativa utilizando las vías pertinentes que están al acceso de la parte actora, pero la parte no ha demostrado que se le haya negado la posibilidad de formular su denuncia o de acceder a dichas vías pertinentes en relación con su alegato de la existencia de una planta de tratamiento que no es objeto del presente proceso.
Por lo tanto, de conformidad con lo indicado, al carecer dicha otra petición de la más mínima instrumentalidad relacionada con la conducta administrativa que se conoce específicamente en la presente causa debe ser rechazada esta otra petición cautelar por ausencia de instrumentalidad, como requisito básico y fundamental de dicha petición de hacer. Lo anterior, en el tanto no se logra identificar la relación directa ni vínculo causal entre la planta de tratamiento y la necesidad de inspección con respecto al objeto específico de este proceso que es la orden de demolición de parte de la vivienda, ni existe vínculo lógico o causal entre los actos del ente municipal cuestionado y lo solicitado por la parte actora en este sentido. En todo caso, este juzgador considera, como se indicó, que para los extremos que sí presentan una relación instrumental con la conducta administrativa conocida en esta sede se cuenta ya con elementos de prueba suficientes para poder resolver acerca de la suspensión solicitada sin necesidad de realizar una inspección en el sitio; por lo cual se procederá a resolver entonces la tutela cautelar de suspensión pedida con los elementos de prueba que ya constan en autos.
Tome en consideración la parte accionante que la suspensión o no de la ejecución del acto administrativo municipal que se pide dentro del presente proceso, no tiene relación directa con lo alegado por la parte accionante de que otras personas o entidades, en otro inmueble desarrollan supuestamente actividades en contra del medio ambiente para lo cual podrá acudir, en su caso y de considerarlo procedente a interponer la denuncia correspondiente por los medios indicados por la representación del SINAC en su respuesta a dicha petición, sin que se haya demostrado una denegatoria de acceso a esta posibilidad. Por lo tanto, en este sentido se rechaza dicha petición de HACER y se conocerá de seguido sobre la medida cautelar suspensión de los efectos de la conducta administrativa que es objeto específico de este proceso. VI. C).- SOBRE LA DENOMINADA "APARIENCIA BUEN DERECHO" EN SU VERSIÓN INVERTIDA: El denominado "fumus boni iuris" tal como aparece regulado en el numeral 21 CPCA indica que la medida cautelar será procedente cuando la ejecución o permanencia de la conducta sometida al proceso, produzca graves daños o perjuicios, actuales o potenciales, de la situación jurídica aducida que es lo que comúnmente se denomina como "periculum in mora" y, como segundo requisito "y siempre que la pretensión no sea temeraria o, en forma palmaria, carente de seriedad" de manera que el denominado "fumus boni iuris" aparece en su versión invertida, más propiamente un "fumus non mali iuris", por cuanto no se exige la acreditación de las probabilidades de éxito de lo pretendido sino que, por el contrario, el requisito es su no temeridad o que no se evidencie en forma palmaria la carencia de seriedad de lo pretendido.
Ahora bien, deben tomar en cuenta las partes que el análisis que se realiza en sede cautelar es producto de una cognición sumaria que no se corresponde con una valoración del fondo del asunto, ni puede ser así en ningún caso, tal y como ha indicado en su momento el Tribunal de Casación de lo Contencioso Administrativo el presupuesto de "no temeridad" "[…] no es una valoración del fondo del proceso, ni puede serlo, ni debe serlo, no puede confundir el juzgador los requisitos propios de una cautelar con un procedimiento definitivo sobre la validez o antijuricidad de una conducta administrativa, esto nos llevaría a una justicia definitiva por la vía cautelar y esto no es la finalidad del objeto. (Tribunal de Casación de lo Contencioso Administrativo, voto 05-F-TC-08 de las diez horas cuarenta y cinco minutos del seis de febrero de dos mil ocho). Tal como se ha señalado previamente el análisis del presupuesto de la tutela cautelar contemplado en el artículo 21 del Código Procesal Contencioso Administrativo (CPCA) de que la pretensión no es temeraria o, en forma palmaria, carente de seriedad, no se corresponde con la acreditación de una verosimilitud de "buen derecho" de la demanda; precisamente porque el análisis que se realiza en sede cautelar no se corresponde con una valoración del fondo del asunto, ni puede ser así, tal y como ha indicado en su momento el Tribunal de Casación de lo Contencioso Administrativo (Tribunal de Casación de lo Contencioso Administrativo, voto 05-F-TC-08 de las diez horas cuarenta y cinco minutos del seis de febrero de dos mil ocho).
Al respecto, se considera que la denominada "teoría del caso" (posición) planteada por la parte actora y sus argumentos no resultan temerarios o en forma palmaria, carentes de seriedad, sin entrar a analizar el fondo de los argumentos que plantea, pues realiza una serie de justificaciones e ilaciones argumentativas que será el tribunal encargado de conocer del fondo del asunto, el que determine finalmente si proceden o no, si son válidas o no, y, finalmente, si la conducta administrativa presenta los vicios de nulidad absoluta señalados por la parte accionante en su gestión, si se violentan sus derechos fundamentales y si, en realidad, el bien inmueble en cuestión se trata de un terreno debidamente inscrito a su nombre y no de un bien de dominio público de la Municipalidad de Heredia como sostiene el ente accionado. En tal determinación consiste precisamente el punto focal del fondo del asunto y no puede ser abordado en la sede sumaria de una tutela cautelar.
Ahora bien, sobre las alegaciones que realiza la representación del accionado que indica la existencia de temeridad al indicarse que previo debido proceso y ejercicio del derecho de defensa, los hechos determinados en sede administrativa facultaron y autorizaron a la administración a proceder como lo ha ordenado y dispuesto se debe tomar en consideración que el análisis realizado en sede cautelar es propio de una cognición sumaria efectuada por el juzgador, sin entrar a prejuzgar sobre el mérito del asunto por el fondo y que en modo alguno viene a sustituir el análisis propio del proceso de conocimiento, tales elementos señalados por la representación del accionado serían propios de las defensas correspondiente al proceso de conocimiento a conocer en el momento procesal oportuno y no propiamente en esta sede cautelar. Ante un conflicto similar al que nos ocupa, este Tribunal mediante el fallo N° 1172-2017 de las quince horas y veinticinco minutos del veintiséis de mayo del año dos mil diecisiete indicó lo siguiente: "(...) se reconoce el derecho fundamental de la actora de discutir en la vía plenaria su derecho a la propiedad privada, vista la relación jurídico administrativa que existe entre quien acciona y la Municipalidad de Heredia, siendo que la promovente es objeto de una decisión Administrativa que decretó el desalojo y demolición parcial de su propiedad, donde el ente municipal fundamenta su conducta en que la gestionante realizó una invasión de la zona pública por medio de la construcción de estructuras en su propiedad, mientras que la promovente expresa que su construcción se encuentra dentro del resto de una finca madre y que en nada invade la zona pública, asimismo, señala la promovente que las obras que se pretenden derribar respetan el alineamiento frente a calle pública, así como la acera pública en igualdad de condiciones que los otros propietarios, asimismo, manifiesta que las obras que la accionada pretende demoler cuentan con los permisos municipales correspondientes y que la actuación que pretende realizar la municipalidad demandada es arbitraria y desproporcional, a su vez, cuestiona el fundamento técnico utilizado por parte del ente municipal en la decisión de desalojo y demolición parcial de estructuras de su propiedad (ver manifestaciones en solicitud de medida cautelar), en ese sentido tiene abierta la posibilidad de accesar por medio de un proceso de conocimiento plenario para que se revise la legalidad de esa conducta administrativa al amparo del artículo 49 constitucional..." (destacado propio, expediente 17-001040-1027-CA).
Este juzgador considera que en este caso se presenta un conflicto similar al del fallo antes citado y en ese sentido tiene abierta la posibilidad el administrado de tener acceso a la tutela judicial efectiva por medio de un proceso de conocimiento plenario para que se revise la legalidad de esa conducta administrativa al amparo del artículo 49 constitucional; en este caso, al igual que el citado el ente municipal fundamenta su conducta en que la gestionante realizó una invasión de la zona pública por medio de la construcción de estructuras en su propiedad, mientras que la promovente expresa que su construcción se encuentra dentro de propiedad privada inscrita a su nombre y que en nada invade la zona pública. Se reconoce entonces, al igual que en el caso antes citado, el derecho fundamental de la parte actora de discutir en la vía plenaria su derecho a la propiedad privada, vista la relación jurídico administrativa que existe entre quien acciona y la Municipalidad de Heredia.
Así las cosas, se considera que no es evidente y manifiesta la temeridad de la pretensión, al contrario de lo indicado por la representación del accionado. Ahora bien, superado el análisis de la no temeridad la parte actora dentro de sus argumentos se refiere en términos generales sobre el fondo de los tres presupuestos cautelares, al realizar este análisis en términos generales, con lo que se indica en el libelo de solicitud y referido previamente con detalle se procede a realizar el examen que corresponde. En este sentido es criterio de este juzgador que la tutela cautelar cumple con los restantes presupuestos para su aprobación por lo que la misma debe ser ACOGIDA EN FORMA PARCIAL en cuanto a la SUSPENSIÓN PEDIDA, tal y como se verá a continuación. VI. D) ACERCA DEL PELIGRO EN LA DEMORA: Ahora bien, respecto del peligro en la demora, se ha indicado antes por este Tribunal, entre muchos otros, en el fallo 009-2021-T de las doce horas y tres minutos del día siete de enero de dos mil veintiuno que: "...para la procedencia de la tutela cautelar se requiere según disposición legal que la ejecución o permanencia de la conducta administrativa sometida al proceso produzca daños o perjuicios graves, actuales o potenciales, a la situación jurídica de la parte promovente.
En ese sentido debe recalcarse que no basta con alegar la existencia del daño (o perjuicio) grave (actual o potencial) sino que debe probarse, situación que implica una carga procesal que debe asumir la parte interesada, al tenor de los artículos 220 del Código Procesal Contencioso Administrativo y el 41 del Código Procesal Civil". Sobre este presupuesto de tutela cautelar se ha indicado también, en su momento "[…] la actual legislación viene a establecer una flexibilización del antiguo sistema procesal que hablaba de “imposible o difícil reparación” – o sea, era rígido –, pasamos de una posición sumamente rígida de demostración de esos daños y perjuicios de “imposible y difícil reparación” a un sistema más flexible, precisamente en la filosofía de apertura de las cautelares […] a un rango de “gravedad” que tienen que llenar los perjuicios. Por lo tanto, hablar de que se tienen que demostrar graves daños de difícil o imposible reparación es una frase que ya no existe […] Pero el límite, y esto es lo que es importante, de justamente que establece el artículo 21 son “graves” la palabra “graves”, de esa gravedad “hacia arriba” procede la cautelar, de esa gravedad “hacia abajo” lo que no pueda entrar y clasificarse como grave no entra dentro del presupuesto de la cautelar.
En otras palabras, si los daños no alcanzan ese rango de “gravedad” la medida no procede […]. (TRIBUNAL PROCESAL CONTENCIOSO ADMINISTRATIVO, Resolución 286-08 de las doce horas treinta minutos del nueve de mayo de 2008. Cfr. 12:34:22 – 12:35:27 de la grabación digital correspondiente, exp. 08-35-1027-CA). Ahora bien, en este sentido, la parte accionante hace manifestaciones en el sentido de que al no suspenderse la ejecución del acto objeto del proceso, que califica como nulo, se ocasionaría un grave daño tanto a la parte actora y a su familia, al no poder hacer frente a sus necesidades de vivienda, por lo que se daría una afectación grave tanto a la parte actora como a su grupo familiar, y serían violentados sus derechos, de manera que considera se configura una lesión grave a su situación jurídica, Señala la parte accionante, en síntesis, que con el desalojo y demolición el inmueble quedaría inhabitable y los actores no cuentan con medios económicos para alquilar una vivienda o hacer remodelaciones en la casa.
Asimismo, indica que el desalojo está pronto a ser ejecutado y fue señalado inicialmente para el día 20 de setiembre de 2024 (suspendido en virtud de la medida provisionalísima) de manera que hay un riesgo inminente de graves daños a la vivienda la cual quedaría inhabitable si no se adopta como medida cautelar para este caso la suspensión de dicha conducta administrativa. Por otro lado, sobre el peligro en la demora, señala en síntesis la parte accionada que lo alegado por la parte actora carece de sustento probatorio suficiente y que no logra definir una real afectación en caso de que el proceso se tramite con normalidad y sin el otorgamiento de las medidas, señala que el accionante no logra la demostración de los hechos que afirma. En síntesis, la parte accionada rechaza las afirmaciones realizadas por la parte actora, indicando que el proceso versa sobre la invasión de los actores sobre un bien de dominio público, y no hay prueba idónea de que la demolición sobre los 50.42 metros cuadrados implicaría que la casa de habitación quedaría inhabitable.
Asimismo, indica que no le consta el relleno realizado hace más de 20 años que refieren los actores, así como que los padecimientos de salud de la parte actora no justifican la ocupación de bienes de carácter demanial y de protección. Ahora bien, sobre este extremo este juzgador considera que la jurisprudencia ha estimado que la prueba del daño puede derivarse de incluso una presunción humana sin necesidad de prueba documental. Se ha procedido así, por ejemplo, en el caso de despidos la existencia del daño grave se deriva del rompimiento del vínculo de servicio que ligaba al accionante con la administración y de ahí la remuneración que tiene la persona para satisfacer sus necesidades básicas. En este sentido, ha indicado la Sección Primera del Tribunal de Apelaciones de lo Contencioso Administrativo en el fallo N° 292-2017-I de las diez horas cuarenta y dos minutos del diez de julio de dos mil diecisiete lo siguiente: “… este Tribunal, esta Sección del Tribunal, a lo largo de toda su existencia desde el año 2010, ha establecido que, en los casos del cese de la relación de empleo público, en cualquier ámbito municipal o no, el cese de la relación en sí mismo implica la existencia de un daño grave, no hay mayor sanción en el empleo público bajo las reglas del derecho administrativo que la cesación, que la eliminación, que el rompimiento del vínculo de servicio que ligaba a la administración con un empleado.
No solo la relación desaparece, sino que además que, con ella, desaparece el ingreso, el salario que constituye en prácticamente todos los casos que conoce este Tribunal, en el único o el más importante ingreso que tiene la persona para satisfacer sus necesidades básicas. Acá hemos indicado que la prueba del daño incluso puede derivarse de simple presunción humana sin necesidad de prueba documental…” (Cfr. 01:47:17 – 01:48:16 de la grabación digital del fallo correspondiente. Expediente 17-1865-1027-CA.). Asimismo, en el citado fallo, también indica que el daño grave no debe medirse única y exclusivamente por el aspecto patrimonial que se pierde sino también por aspectos de orden extrapatrimonial que varían en cada caso y están vinculados con aspectos tales como la dignidad de la persona. Bajo el anterior predicado, tal como se ha indicado por parte de este Tribunal (ver, entre otras, la resolución N° 2024000992 de las quince horas con treinta y siete minutos del 19 de febrero de 2024, expediente 23-003382-1027-CA), en enteramente entendible para este juzgador que en el asunto bajo debate existe un componente humano y patrimonial importante en juego.
No resulta fácil para los propietarios de una vivienda desprenderse de parte de su casa de habitación (en este caso concreto 50.42 metros cuadrados que se pide desalojar) toda vez que esto conlleva una afectación de carácter grave a la comodidad, calidad de vida y patrimonio de la parte accionante, entre otros, que por tiempo se ha gozado, incluso es válido mencionar que incluso derivado de una simple presunción humana sin necesidad de prueba documental, que existen recursos económicos, materiales y esfuerzos que fueron invertidos en el proyecto de vivienda y que independientemente de la suma económica en cuestión, es de carácter significativo para sus propietarios, lo cual unido a los documentos aportados por la parte actora antes referidos a los autos generan indicios suficientes de la existencia de un daño potencial grave con la demolición parcial de la vivienda de la parte accionante en cuestión.
En el fallo antes citado, N° 1172-2027, ante un conflicto similar al que nos ocupa, este Tribunal también ha razonado de la manera indica señalando lo siguiente sobre la existencia de un grave daño con ocasión de un supuesto similar: "(...) El presupuesto alude a esos daños que se reprochan o que son susceptibles de producirse -actual o potencialmente-. Daños que deberán ser establecidos como graves, además de tenerse como derivados de la situación aducida, entendiendo que, las lesiones acusadas al menos deben ser comprobadas a través del principio racional de prueba y con un mínimo de rigor probatorio con carga sobre el interesado, lo que no quiere decir otra cosa que no basta con aducir el daño en los términos dichos, sino que, además de la existencia presente o potencial del mismo, debe ser considerado como un daño "grave". En este punto es -necesario- señalar que, debe mediar un esfuerzo probatorio a cargo de quien pide la tutela cautelar, conforme las circunstancias de cada asunto en particular.
Existe la salvedad de que tal gravedad del daño resulte posible ser determinada prescindiendo -con diferencia de grado-, del rigor probatorio mencionado, si ésta circunstancia es claramente deducible a partir de los elementos con que se cuente al momento del dictado del fallo correspondiente, pero esta situación es la excepción y no la regla, en el entendido de que el juzgador no se encuentra llamado a suponer donde la parte se encuentra obligada a probar. En el caso concreto la actora solicita la suspensión de la orden de desalojo y demolición parcial de su casa de habitación y alega como daños graves en caso de no acogerse la presente medida, que la demolición de la obra por si misma le genera un daño grave, máximo al no existir certeza respecto a que las obras a demoler invadan efectivamente la zona pública, unido a que se podrían falsear los cimientos de la propiedad, toda vez que la municipalidad no ha delimitado debidamente donde se aplicaría la demolición, en el caso concreto es criterio de quien juzga que puede derivarse de manera lógica, que la demolición de estructuras de una casa de habitación por si misma produce consecuencias en el propietario del inmueble a desalojar y demoler y de forma indiciaria (artículo 417 del Código Procesal Civil) podemos derivar un daño como consecuencia directa, precisa y lógica de un hecho comprobado, como lo es que existe una orden de desalojo y demolición, por lo que esa persona podría ver demolida de manera parcial su vivienda, unido a las pruebas tanto aportadas por la parte actora como fotos e informes de topógrafos, se acredita el daño, en los términos que lo exige el artículo 21 del Código Procesal Contencioso Administrativo, nótese que incluso la municipalidad demandada al referirse al presupuesto del daño señala que las condiciones de derribo para las estructuras de la actora serían las "menos gravosas", por lo anterior es criterio de quien juzga que en el caso concreto el daño se tiene debidamente acreditado.
Véase que de conformidad con el numeral 21 del Código Procesal Contencioso Administrativo la medida cautelar resulta procedente cuando la ejecución de la conducta objeto del proceso produzca un daño grave, siempre que la pretensión no sea temeraria, en este sentido es criterio de quien juzga que la demolición de una estructura habitacional aunque sea de manera parcial produce un daño en la esfera jurídica de quien lo sufre y tal y como se indicó supra que la pretensión no resulta temeraria. De forma que se acredita un daño grave a la situación jurídica de la promovente..." (ver fallo N° 1172-2017 de las quince horas y veinticinco minutos del veintiséis de mayo del año dos mil diecisiete, expediente 17-001040-1027-CA). La parte accionante ofrece como prueba la copia del desalojo (ver imágenes 10 a 25 del legajo de medida cautelar), y en el principal se ofrece la siguiente prueba documental:
POR TANTO
Con fundamento en lo expuesto y de conformidad con los artículos 20 y 21 del Código Procesal Contencioso Administrativo, se declara PARCIALMENTE CON LUGAR y se ACOGE PARCIALMENTE la solicitud de medida cautelar promovida por GEOVANNI ESPINOZA CUBILLO, portador de la cédula de identidad número 602330436, y JENNY CORDERO VARELA, portadora de la cédula de identidad número 204810207, en contra de la MUNICIPALIDAD DE HEREDIA. Intervienen como litis consortes necesarios el ESTADO (MINAE) y al Sistema Nacional de Áreas de Conservación (SINAC) en los siguientes términos: se dispone como medida cautelar la suspensión de los efectos del acto administrativo resolución AMH-0803-2024 emitida por la Alcaldía Municipal de la Municipalidad de Heredia a las siete horas siete minutos del 19 de agosto de 2024 y por ende se adopta como medida cautelar la suspensión del desalojo, demolición y eliminación de estructuras en discusión en la propiedad de la parte actora derivadas de dicha conducta administrativa.
Se ORDENA como medida cautelar a la Municipalidad de Heredia accionada el abstenerse de realizar cualquier conducta que, de forma directa o indirecta, pueda tener como efecto el ejecutar dicho acto administrativo, lo anterior con el fin de resguardar la tutela judicial cautelar adoptada en la presente resolución. En los demás extremos se rechaza lo pretendido.- Notifíquese. Dr. José Alvaro López Camacho, Juez Tramitador. JLOPEZCAM ???????????????
