Decision: 2025-0316 Case file: 20-001673-0061-PE (3) COURT OF APPEAL FOR JUDGMENTS SPECIALIZING IN ORGANIZED CRIME, FIRST SECTION. First Judicial Circuit of San José. (Sitting as the Criminal Judgment Court of Appeal for the Third Judicial Circuit of Alajuela, San Ramón). At nine fifty-five a.m. on April 8, 2025.- APPEAL filed in these proceedings against [Nombre 001], of legal age, Costa Rican, identity card number [Valor 001], born on April 20, 1989, son of [Nombre 002] and [Nombre 003], single, merchant by occupation, resident of Puntarenas, Esparza; and [Nombre 004], of legal age, Costa Rican, identity card number [Valor 002], born on July 16, 1965, son of [Nombre 005] and [Nombre 006], divorced, merchant by occupation, resident of Puntarenas, Esparza; for the offense of VIOLATION OF THE LEY FORESTAL, to the detriment of NATURAL RESOURCES. Judges Andrea Renauld Castro and Mónica Hernández Leiva and Judge Alfredo Araya Vega participated in deciding the appeal. Attorney Luis Salazar Álvarez appeared before this Court in his capacity as public defender for the defendants ([Nombre 002]) and ([Nombre 004]), as did Attorney Zaray Chavarría Prado as representative of the Procuraduría General de la República.
BACKGROUND (RESULTANDO):
I.By judgment no. 04-P-2025 issued at 14:05 on January 7, 2025, the Tribunal Penal de Puntarenas ruled: “THEREFORE (POR TANTO): In accordance with the foregoing, Articles 50, 39, and 41 of the Constitución Política; Articles 3, 33, 58 subsection b), and 61 subsection A) of Ley Forestal 7575; Articles 1, 30, 31, 45, 50, 51, 59, 60, 62, and 71 of the Código Penal; and Articles 1, 6, 9, 16, 70, 71, 75, 76, 77, 111, 112, 113, 114, 116, 119, 120, 141, 142, 144, 182, 184, 360, 361, 363, 364, 365, and 367 of the Código Procesal Penal, this Court hereby orders: 1- The accused [Nombre 001] AND [Nombre 004] are found criminally responsible as principals for the offense of UNLAWFUL HARVESTING OF FOREST PRODUCTS, committed to the detriment of NATURAL RESOURCES, and, in that capacity, EACH ACCUSED IS SENTENCED TO THREE MONTHS’ IMPRISONMENT. The term of imprisonment shall be served in accordance with the applicable prison regulations, with credit for any pretrial detention served. 2- Because they meet the statutory requirements, the convicted persons [Nombre 001] AND [Nombre 004] are granted the BENEFIT OF A SUSPENDED SENTENCE (BENEFICIO DE EJECUCIÓN CONDICIONAL DE LA PENA), with a THREE-YEAR probationary period, during which they may not commit a new intentional offense resulting in a sentence of more than six months’ imprisonment; otherwise, the benefit granted shall be revoked. 3- AS TO THE CIVIL CLAIM FOR DAMAGES (ACCIÓN CIVIL RESARCITORIA): The civil claim for damages filed by the civil plaintiffs, the State, represented by Attorney Zaray Chavarría Prado, Procuradora General de la República, against the civil defendants [Nombre 001] AND [Nombre 004], is granted; accordingly, they are ordered to pay the civil plaintiffs ¢5.408.218 colones as compensation for environmental damage.
Likewise, the civil defendants shall pay the interest arising from their criminal conduct from the date the judgment becomes final until payment in full, which shall be calculated during the judgment-enforcement proceedings before the civil court. In the criminal matter, this case is resolved without a specific award of criminal costs, and the State shall bear the criminal costs of the proceedings. As to the costs of the private prosecution (querella), payment of costs is ordered in the amount of ¢484.000 colones pursuant to Decree number 41457 PJ, Article 38. In the civil matter, as warranted, the civil defendants are ordered to pay both categories of costs, including ¢1,081.643 colones (one million eighty-one thousand six hundred forty-three colones) in attorney’s fees. Once the judgment becomes final, the customary certified copies shall be issued to the Juzgado de Ejecución de la Pena and the Instituto Nacional de Criminología. Let notice be given. Attorney Julianita Morales Mora, Judge of the Tribunal de Juicio de Puntarenas” (sic).
II.Attorney Luis Salazar Álvarez, in his capacity as public defender for the defendants ([Nombre 004]) and ([Nombre 002]), filed an appeal against the foregoing ruling. The appeal is decided by the present panel of the Tribunal de Apelación de Sentencia Especializado en Delincuencia Organizada, pursuant to the final paragraph of Article 101 bis of the Ley Orgánica del Poder Judicial.
III.Following the deliberation required by Article 465 of the Código Procesal Penal, this Criminal Judgment Court of Appeal considered the issues raised in the challenge.
Criminal Judgment Appellate Judge Renauld Castro authors the decision; and, REASONS (CONSIDERANDO):
I.Admissibility of the challenge.- Attorney Luis Salazar Álvarez, appearing as public defender for [Nombre 001] and [Nombre 004], appeals the judgment delivered orally by the Tribunal Penal de Puntarenas, no. 04-P-25, at 14:05 on January 7, 2025 (audiovisual file 200016730061PE-07012025020531-2_Multi-0). Through that judgment, the defendants were sentenced to 3 months’ imprisonment after being found criminally responsible as co-principals for the offense established in subsection b) of Article 58 of the Ley Forestal, and they were granted the benefit of a suspended sentence for a period of 3 years. They were also ordered in the civil matter to pay compensation for the environmental damage caused, which was fixed at 5.408.218 colones. They were further ordered to pay the costs associated with the private prosecution and the civil claim for damages filed. The appeal lodged by defense counsel is admitted for consideration on the merits: The challenge was filed in a timely manner by a party to the proceedings with standing to do so, namely, the defendant’s public defender.
Although the oral and full judgment was delivered on January 7, 2025 (audiovisual file 200016730061PE-07012025020531-2_Multi-0), the period for filing the appeal following the clarification and supplementation of the judgment runs from the issuance of the decision of the Tribunal Penal de Puntarenas at 7:30 a.m. on January 8, 2025 (p. 179 of the physical case file), which ordered that the trial judgment be supplemented and clarified with respect to the costs of the private prosecution (on this point: harmonizing precedent of the Sala Tercera de la Corte Suprema de Justicia, no. 390-2017, issued at 9:34 a.m. on May 3, 2017, reiterated in judgment no. 398-2018 of the same chamber, issued at 18:15 on May 31, 2018). Consequently, the challenge was filed before the court below (a quo) within the statutory period of fifteen business days established for its filing, specifically on January 23, 2025 (cf. receipt stamp at p. 181).
The purpose of the appeal is to review the decision rendered at the trial stage regarding the defendant’s criminal and civil liability. It is further established that the formal requirements inherent in this means of challenge—under the principles of flexibility, accessibility, breadth, and informality—have been satisfied in order to guarantee access to comprehensive review of the judgment by a higher court, as provided in Article 8.2 h) of the Convención Americana sobre Derechos Humanos and Articles 458 et seq. of the Código Procesal Penal. In light of the foregoing, and in accordance with the legally established criteria governing the objective and subjective availability of appeals, the appeal against the judgment filed by the co-defendants’ public defender is found formally admissible.
II.First ground of the appeal asserted: Erroneous application of sections 58(b) and 61(a) and (b) of Ley Forestal: Defense counsel argues that the objective element of “exploitation” (aprovechamiento) for profit, which is necessary for application of the offense established in section 58(b) of Ley Forestal, is satisfied, according to the trial judge, insofar as the accused “[…] illegally exploited the tree located in the riverbed (…) in order to be able to enjoy the river and its pools […]” (f. 181 vto.). Counsel states in this regard that, although the Public Prosecutor’s Office alleged that the co-defendants had felled a tree in order to dispose of it later, this was not proven at trial. Counsel maintains that it was not shown that the accused were responsible for felling the yellow-bark tree located in the river and that, on the contrary, there is abundant testimonial evidence “..establishing that the defendants went to the location where the fallen tree lay in the river at the request of a group of people […] who frequent the place (river), which is regularly visited by local residents, who go there to enjoy nature, including the green areas, the riverbanks, its cool waters, and its pools, and who believed that, because it was the winter season, a rainy period with high water flow along the riverbank, this could pose an imminent danger to local residents, owners of nearby properties, and even persons from outside the area who frequented the place, because the river could drag away the tree that had been cut down and had fallen into it, carrying away persons who were beside the tree or farther downstream […] causing death and tragedy for one or more persons.
This was corroborated by the defense witnesses, who confirmed that the matter was discussed in a WhatsApp group maintained by the property owners and that they were aware of the imminent danger caused by the tree’s fall into the river, including [Nombre 007], the owner of a parcel at the site, and the owner of the project involving the parcels that were sold, Mr. [Nombre 008] (sic), who confirmed that he was the person who contacted Mr. ([Nombre 004]) to ask him for help moving the tree from the river in order to prevent a greater tragedy involving any of the people who frequented the place […]” (f. 182). Counsel states that the judge failed to analyze what benefit, advantage, or gain resulted from disposing of the forest resource (recurso forestal), which, according to those involved, was removed solely at the residents’ express request to prevent the imminent danger that it would be swept away.
Counsel explains that forestry engineer Luis Guillermo Vásquez Vásquez pointed out during the adversarial proceedings that the exploitation of forest products requires proof of a series of activities, namely: felling, cutting, skidding, transfer, transportation, and industrial processing for commercial purposes; therefore, moving a tree out of a river to prevent danger to persons does not satisfy those requirements, even if the necessary permits for such movement had not been obtained. In counsel’s view, this is further supported by the statement of Mr. Adrián Arce, a SINAC official, who indicated that “processing a tree” requires cutting it into logs and producing boards from it with specialized machinery, which did not occur in this case, where the only fact established was that it was moved from the river to a nearby property (cfr. f. 182 vto.). Counsel adds that the criminal offense (tipo penal) applied requires “exploitation” for its commission, which means, as the appellant argues, “that there must be a benefit or advantage” (f. 182 vto.), not necessarily financial, but yielding some form of gain.
Counsel argues that, to the contrary, the tree in this case was removed because of an imminent danger. Lastly, counsel maintains that the assessment of environmental damage (daños ambientales) was made “[…] from the moment the tree was felled and thrown into the river; this covered a considerable area of land that, according to the Attorney General of the Republic (sic), was regarded as having been caused by the defendants, and it was already demonstrated during the trial that the illegal felling could not be established in any manner by the parties to the proceedings and that there was minimal damage in connection with moving the tree to the riverbank, to the property where it was moved […]” (cfr. f. 183 fte.). Second ground of the appeal against the judgment asserted: Failure to apply a justifying state of necessity (estado de necesidad justificante): Mr. Salazar Álvarez states that the testimonial evidence was unequivocal in establishing the existence of a real and imminent danger arising from the tree’s fall into the river, taking into account the location where it lay, the rainy season, and the river’s substantial flow, as well as the fact that the river was visited for recreational purposes.
Accordingly, upon balancing the legally protected interests (bienes jurídicos), the requirements for a justifying state of necessity are satisfied. He adds that the requirement that the risk not have been caused by the perpetrator (sujeto activo) is also satisfied because “[…] it was demonstrated that the defendants were not the persons who felled the tree, but rather were called upon to safeguard human life at the request of a group of local residents […]” (f. 183 vto.). He further states that the requirement that the danger could not be avoided by other means is also satisfied, as established through expert witness Luis Guillermo Vásquez, who addressed the condition in which the tree was found and the reasons why immobilizing it was justified in order to safeguard human lives, given the surrounding conditions and the time required to process the corresponding permit, whether through administrative or judicial proceedings.
He explains that, at the subjective level, the defendant ([Nombre 004]) stated at trial that he has extensive experience in timber extraction and administrative procedures. He added that he intervened because the tree posed an imminent danger to persons who frequented the location. Counsel requests that the existence of a justification (causa de justificación) based on a justifying state of necessity be examined and that the accused be acquitted or, alternatively, that the matter be remanded for trial.
III.For greater clarity in the ruling, the objections concerning criminal liability are addressed jointly because of their close interrelationship. For the reasons set forth below, insofar as the criminal aspect of the conviction is concerned, the appeal is denied: The appellant argues that the conviction of the co-defendants for the offense established in subsection b) of section 58 of the Ley Forestal is erroneous. In support of his position, he states that:
Although the argument concerning the cutting of the tree trunk in a protected area (zona de protección) without a permit, and the possible uses of the cut timber for different purposes, is sufficient to establish the objective elements of the criminal offense (elementos objetivos del tipo penal) applied, at the subjective level the trial judge found that the co-defendants worked in the timber-harvesting business and had previously applied for permits; accordingly, they were aware of the obligation to obtain the corresponding authorizations before intervening with respect to a tree that had fallen in a protected area (cf. established factual framework, audiovisual file 200016730061PE-07012025020531-2_Multi-0, minutes 00:31:00 to 00:31:11 according to the recording counter). However, this Chamber considers it necessary to address an issue that, although not raised directly by defense counsel, is essential to the proper resolution of this matter.
In this regard, it must be emphasized that, according to the account of the facts found proven in the second recital (considerando) of the challenged judgment, the accused proceeded to cut the tree when it was “[…] 3 metros from the bank of the río Paires […]” (cf. established factual framework, audiovisual file 200016730061PE-07012025020531-2_Multi-0, minutes 00:10:25 to 00:13:30 according to the recording counter). Nevertheless, in her reasoning, the trial judge states that, based on the evidence presented—particularly the testimony of the defense witnesses—it cannot be ruled out that the tree had fallen into the river channel (cauce del río). This discrepancy, however, has no bearing on whether the conduct satisfies the statutory elements of the offense (tipicidad), because regardless of whether the tree was located wholly or partially within the río Paires before being cut into pieces, as stated by the defense witnesses [Nombre 007] and [Nombre 008], or whether it was located 3 metros from the riverbank, in either case it was within the protected area defined in section 33(b) of Ley n.° 7575, namely: “A strip measuring fifteen meters in rural areas and ten meters in urban areas, measured horizontally on both sides along the banks of rivers, ravines, or streams, if the land is flat, and fifty horizontal meters if the terrain is steep.” It is therefore undeniable that the tree upon which the defendants intervened without permits was located within the protected area contemplated in section 33 of the Ley Forestal.
For the foregoing reasons, in terms of the statutory elements of the offense, the proven conduct falls within the criminal offense established in section 58(b) of Ley n.° 7575 de 13 de febrero de 1996. B) Argument concerning conduct under a justificatory state of necessity (estado de necesidad justificante): In his appeal, attorney Salazar Álvarez reiterated the defense strategy presented during trial, which consisted of asserting that there was an imminent danger to the physical integrity of one of the bathers who regularly visited the river. Thus, the court-appointed defense attorney for the accused argues that, although they intervened to remove the tree from the river without the corresponding permits, their conduct was protected by a justificatory state of necessity because they acted at the request of several local residents, who contacted the co-defendant ([Nombre 002]) to help them remove the tree from the río Paires, given his experience in that trade and the danger that the presence of the trunk in the water posed to bathers, particularly because it was the rainy season.
He contends that physical integrity and human life have greater value than environmental integrity and that removing the tree without permits was therefore justified. Regarding the analysis of unlawfulness (antijuridicidad), the trial court stated that the proven conduct was formally and substantively unlawful and ruled out the existence of any justification (causa de justificación) (cf. audiovisual file 200016730061PE-07012025020531-2_Multi-0, minutes 00:48:22 to 00:49:16 according to the recording counter). As will be discussed below, the absence of a more extensive analysis of the defense’s claim that the defendants acted under a justificatory state of necessity has no material bearing on the proper resolution of the matter. Even assuming that the accused went to remove the tree from the river because it posed an imminent danger to those who regularly bathed in its waters, as maintained by the defendant and the defense witnesses [Nombre 007] and [Nombre 008], the unlawfulness of the conduct does not lie in extracting or moving the tree from the river to prevent it from endangering a bather.
Rather, the conduct found proven and deemed relevant because it satisfied the statutory elements, was unlawful, and was culpable consisted of the co-defendants cutting the tree into several pieces after removing it from the river, which constitutes harvesting (aprovechamiento) under section 3 of the Ley Forestal, as discussed in point A) of this same recital. Defense counsel’s argument is therefore irrelevant insofar as it places the existence of the justification within a segment of the historical event other than the one deemed to satisfy the statutory elements, be unlawful, and be culpable, because the defendants were not convicted for extracting the tree from the río Paires due to the potential danger it posed to visitors to that location, but rather for cutting the trunk of that tree into pieces or “tucas” on the riverbank, which could in no way be covered by the alleged state of necessity.
However, this Court must note the existence of a contradictory argument in the oral judgment which, as will be shown, does not affect the validity of the decision. Specifically, the following was stated: “[…] the owners of this place asked that it be removed from the river channel because people go to this location to bathe in that river and make use of that river, and it posed an imminent danger because the river’s current could potentially move this tree and cause a tragedy. The fact is that, in order to bathe at that location, where it posed precisely such a danger because the tree was there, it was necessary to request permission to remove it, precisely to prevent the imminent danger that someone might die because the river’s current could potentially move the tree and cause […] the death of one of those persons […]” (audiovisual file 200016730061PE-07012025020531-2_Multi-0, minutes 1:40:32 to 01:41:35, according to the recording counter).
The challenged judgment also states: “[…] you should have requested permission; it is not as you said, that you would first move it and then request permission. Rather, before taking these actions, you should have submitted the appropriate applications so that you could be granted or denied authorization to remove that tree from the river […]” (audiovisual file 200016730061PE-07012025020531-2_Multi-0, minutes 01:38:31 to 01:38:50, according to the recording counter). This reasoning is incorrect because the defining feature of a justificatory state of necessity is precisely that the imminence of the danger threatening a legal interest (bien jurídico) of greater value justifies the immediate rescue action required under the circumstances, even though that action entails conduct satisfying the statutory elements of an offense and the resulting impairment of a legal interest of lesser importance.
Notwithstanding the foregoing, as already indicated, even assuming that extracting the tree from the river met the requirements of a state of necessity, the harvesting action consisting of cutting its trunk into 6 parts while it was on dry land (a short distance from the riverbank, as found proven) exceeds any standard of necessity or urgency for rescue purposes and constitutes, as noted, unlawful harvesting. For the reasons stated, the rejection of a justificatory state of necessity was correct because, in the event of an imminent danger—a possibility that the trial judge did not rule out—the only action the accused could take was to remove the tree from the river, but not to process it with a chainsaw by cutting the trunk into pieces, as established through the evidentiary analysis. Accordingly, the rejection of the state of necessity and the legal characterization of the proven factual circumstances as the offense established in section 58(b) of the Ley Forestal were correct. For the foregoing reasons, insofar as the criminal conviction is concerned, the appeal against the judgment filed by attorney Salazar Álvarez is denied.
IV.The claim concerning the amount of the civil judgment (condena civil) imposed on the co-defendants (coimputados) for the environmental damage (daño ambiental) caused is granted, for the reasons set forth below: In the first ground of the appeal filed, defense counsel (defensa técnica) argues that the civil judgment for environmental damage was based on the determination that the accused were responsible for felling the tree at its original location, taking into account, when assessing the damage, the entire area affected after the tree was felled and thrown toward the river, whereas what exists—in the defense’s view—is “[…] minimal damage in connection with moving the tree to the riverbank, to the property to which it was moved […]” (ibid). Now, the a quo did in fact exclude the co-defendants’ liability for the act of felling the yellow-bark tree at the location (within the property of Mr. [Nombre 010]) where it had originally been growing—an issue that was not appealed.
However, the co-defendants were not convicted of moving or removing the tree from the river without permits, as defense counsel claims; rather, they were charged with harvesting (aprovechamiento) the tree after it had fallen either within, or a few meters from, the bank of the río Paires. Although the Prosecutor’s Office charged the defendants both with felling the tree while it was still planted or “standing” (under the terminology of the Ley Forestal) and with subsequently processing it by cutting it into sections so it could be moved to another property, only the second act was deemed proven; that is, the defendants were found to have cut down, sawed, or “sectioned” the fallen tree within the protected zone (zona de protección) of the río Paires. The Procuraduría General de la República, the body pursuing the compensatory civil action (acción civil resarcitoria), relies solely on the second act (cutting or sawing the tree into sections after it had fallen), as is clear from the facts alleged in the compensatory civil action (cf. fols. 6 and 7 of the compensatory civil action file), which are the same facts alleged in the private prosecution (querella) brought by the representative of the State’s interests.
In this regard, it assessed the environmental damage at 5.408.218 colones, “[…] because, by unlawfully harvesting and processing a tree of the Yellow-Bark speces (sic) that was located within the protected area of the río Paires, 3 meters from the bank, they degraded the natural resources and their recovery, which had a significant and harmful impact on the public-domain property by affecting the natural conditions of that area, since they eliminated the existing natural resources and impaired their recovery, including the opportunity cost associated with the growth of species that inhabited the harvested tree, causing a loss of biodiversity through destructive exploitation and thereby destroying its biological wealth—flora, fauna, and ecosystems—in addition to the loss of carbon and replacement costs, impacts on water resources, and loss of scenic beauty, among other effects […]”. The environmental-damage expert report (peritaje del daño ambiental) cited by the civil plaintiff, which served as the basis for the judgment, is official letter no. ACOPAC-PINV-177-2022 (cf. fols. 45-68 of the case file).
The author of that assessment is Adrián Arce Arias, who holds a master’s degree and is a professional in natural-resource management and protection; he testified orally at trial, and the record shows that, during his testimony, he referred to that expert report and explained the basis for the amount of 5.408.218 colones at which he assessed the environmental damage (cf. audiovisual file 200016730061PE-11122024014304-2_Multi-1, minutes 01:06:50 to 01:39:20). In his report, the expert distinguishes each of the following items:

The first ground of the appeal filed by defense counsel is partially granted with respect to the amount awarded for non-pecuniary damage (daño moral). Consequently, judgment no. 04-P-2025, issued by the Tribunal Penal de Puntarenas at 14:05 hours on 7 de enero de 2025, is partially vacated solely and exclusively with respect to the amount awarded for environmental damage and the amount awarded as costs relating to the pursuit of the compensatory civil action. Resolución: 2025-0316 TRIBUNAL DE APELACIÓN DE SENTENCIA ESPECIALIZADO EN DELINCUENCIA ORGANIZADA, SECCIÓN PRIMERA. Primer Circuito Judicial de San José. (En funciones como Tribunal de Apelación de Sentencia Penal del Tercer Circuito Judicial de Alajuela, San Ramón). Al ser las nueve horas cincuenta y cinco minutos, del ocho de abril del dos mil veinticinco.- RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra [Nombre 001], mayor, costarricense, cédula de identidad número [Valor 001], nació el 20 de abril de 1989, hijo de [Nombre 002] y [Nombre 003], soltero, de oficio comerciante, vecino de Puntarenas, Esparza y [Nombre 004], mayor, costarricense, cédula de identidad número [Valor 002], nació el 16 de julio de 1965, hijo de [Nombre 005] y [Nombre 006], divorciados, de oficio comerciante, vecino de Puntarenas, Esparza; por un delito de INFRACCIÓN A LA LEY FORESTAL, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, las juezas Andrea Renauld Castro, Mónica Hernández Leiva y el juez Alfredo Araya Vega. Se apersonó en esta sede, el licenciado Luis Salazar Álvarez, en su condición de defensor público de los justiciables ([Nombre 002]) y ([Nombre 004]), además, la licenciada Zaray Chavarría Prado, como representante de la Procuraduría General de la República.
RESULTANDO:
I.Mediante sentencia n.° 04-P-2025 de las 14:05 horas del 7 del enero del 2025 el Tribunal Penal de Puntarenas, resolvió: “POR TANTO: De conformidad con lo expuesto, artículos 50, 39 y 41 de la Constitución Política, artículos 3, 33, 58 inciso b), 61 inciso A) de la Ley Forestal 7575, 1, 30, 31, 45, 50, 51, 59, 60, 62, 71 del Código Penal, artículos 1, 6, 9, 16, 70, 71, 75, 76, 77, 111, 112, 113, 114, 116, 119, 120, 141, 142, 144, 182, 184, 360, 361, 363, 364, 365, 367 del Código Procesal Penal, este Tribunal dispone: 1- Declarar a los imputados [Nombre 001] Y [Nombre 004], autores responsable de un delito de APROVECHAMIENTO ILÍCITO DE PRODUCTOS FORESTAL cometido en perjuicio de LOS RECURSOS NATURALES y en tal carácter se le impone la pena de TRES MESES DE PRISIÓN A CADA UNO DE LOS IMPUTADOS. La pena de prisión la deberán descontar según los respectivos reglamentos penitenciarios, previo abono de la prisión preventiva que hubiere sufrido. 2- Por cumplir con los requisitos de ley, se les concede a los condenados [Nombre 001] Y [Nombre 004] el BENEFICIO DE EJECUCIÓN CONDICIONAL DE LA PENA, estableciéndose un periodo a prueba de TRES AÑOS, plazo durante el cual los condenados no podrán cometer nuevo delito doloso en los que resulten sentenciados con una pena superior a los seis meses de prisión, de lo contrario se revocaría el beneficio otorgado. 3- EN CUANTO A LA ACCION CIVIL RESARCITORIA: Se declara con lugar la acción civil resarcitoria interpuesta por los actores civiles el Estado, representados por Licda. Zaray Chavarría Prado Procuradora General de la República en contra de los demandados civiles [Nombre 001] Y [Nombre 004] y acorde con ello, se le condena a pagar a favor de los Actores civiles la suma de ¢5.408.218 colones por concepto de daño ambiental.
Del mismo modo, los demandados civiles deberán cancelar los intereses que ha originado su acción delictiva a partir de la firmeza del fallo y hasta su efectivo pago, los cuales deberán ser liquidados en la vía de ejecución de sentencia en la sede civil. En lo penal se resuelve este asunto sin especial condena en costas penales, corriendo por cuenta del Estado los gastos penales del proceso. En cuanto a las costas de la querella se condena al pago de las costas debiéndose pagar la suma de ¢484.000 colones de acuerdo al decreto número 41457 PJ artículo 38. En lo civil, por resultar procedente, se condena en ambas costas a la parte demandada civil debiendo pagar la suma de ¢1,081.643 colones (un millón ochenta y un mil seiscientos cuarenta y tres colones) por concepto de costas personales. Una vez firme la sentencia emítanse los testimonios de estilo para ante el Juzgado de Ejecución de la Pena y el Instituto Nacional de Criminología. Notifíquese. Licda Julianita Morales Mora Jueza del Tribunal de Juicio de Puntarenas” (sic).
II.Contra el anterior pronunciamiento, el licenciado Luis Salazar Álvarez, en su condición de defensor público de los justiciables ([Nombre 004]) y ([Nombre 002])., interpuso el recurso de apelación, el cual es resuelto por la presente integración del Tribunal de Apelación de Sentencia Especializado en Delincuencia Organizada, conforme al numeral 101 bis de la Ley Orgánica del Poder Judicial, párrafo final.
III.Verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el esta Cámara de Apelación de Sentencia Penal, se planteó las cuestiones formuladas en la impugnación.
Redacta la Jueza de Apelación de Sentencia Penal Renauld Castro; y,
CONSIDERANDO:
I.Admisibilidad de la impugnación formulada.- El licenciado Luis Salazar Álvarez, quien figura como defensor público de [Nombre 001] y [Nombre 004], formula recurso de apelación de sentencia contra el fallo dictado en forma oral por el Tribunal Penal de Puntarenas, n.° 04-P-25, de las 14:05 horas del 7 de enero de 2025 (archivo audiovisual 200016730061PE-07012025020531-2_Multi-0). Mediante esta, se condenó a los justiciables a 3 meses de prisión, al declarárseles coautores responsables del delito previsto en el inciso b) del numeral 58 de la Ley Forestal y se les concedió el beneficio de ejecución condicional de la pena por el plazo de 3 años. Asimismo, se les condenó civilmente al pago del daño ambiental causado, el cual se fijó en 5.408.218 colones. Se les condenó también al pago de costas de la querella y acción civil resarcitoria formuladas. El recurso incoado por la defensa técnica se admite para su conocimiento de fondo: La impugnación fue interpuesta en tiempo, por uno de los sujetos procesales legitimados para ello, a saber: el defensor público del justiciable.
Pese a que la fecha de dictado de la sentencia oral e integral fue el 7 de enero de 2025 (archivo audiovisual 200016730061PE-07012025020531-2_Multi-0), el plazo para interposición del recurso posterior aclaración y adición de la sentencia, se contabiliza a partir el dictado de la resolución del Tribunal Penal de Puntarenas, de las 7:30 horas del 8 de enero de 2025 (f. 179 del expediente físico), que dispuso adicionar y aclarar la sentencia de juicio en lo que toca a las costas de la querella (sobre este punto: criterio unificador de la Sala Tercera de la Corte Suprema de Justicia, n.° 390-2017 de las 9:34 horas del 3 de mayo del 2017, reiterado en el fallo de ese mismo despacho, n.° 398-2018 de las 18:15 horas del 31 de mayo del 2018) Por consiguiente, la impugnación fue presentada ante el a quo, dentro del plazo legal de quince días hábiles fijado para su interposición; puntualmente, el 23 de enero de 2025 (cfr. sello de recibido a f. 181).
El recurso tiene por objeto el examen de la resolución que se pronunció en fase de juicio, con respecto a la responsabilidad penal y civil de la justiciable. Se verifica, además, el cumplimiento de los requisitos de forma que, de acuerdo con los principios de flexibilidad, accesibilidad, amplitud e informalidad, son consustanciales a este medio de impugnación, en aras de garantizar el acceso al examen integral del fallo ante un juez superior, tal y como se prevé en el artículo 8.2 h) de la Convención Americana sobre Derechos Humanos, así como en los numerales 458 y siguientes del Código Procesal Penal. A la luz de lo anterior, de conformidad con los criterios de taxatividad objetiva y subjetiva establecidos legalmente, se constata que el recurso de apelación de sentencia presentado por el defensor público de los coencartados, resulta formalmente admisible.
II.Primer motivo del recurso formulado: Errónea aplicación de los numerales 58 inciso b) y 61 incisos a) y b) de la Ley Forestal: Arguye la defensa técnica que el elemento objetivo de “aprovechamiento” con fines de lucro, que resulta necesario para aplicar el delito previsto en el ordinal 58 inciso b) de la Ley Forestal, se cumple, según la jueza de juicio, en el tanto los sindicados “[…] aprovecharon de manera ilegal el árbol que se encontraba en el cauce del río (…) con la finalidad de poder disfrutar del río y sus posas (sic) […]” (f. 181 vto.). Indica, al efecto que, si bien el Ministerio Público acusó que los coimputados habían talado un árbol para disponer de él posteriormente, esto no fue probado en debate. Sostiene que no se demostró que los incriminados fuesen responsables de la tala del árbol corteza amarilla que se encontraba dentro del río y que por el contrario, existe abundante prueba testimonial “..que acreditó que los imputados se presentaron al lugar donde se encontraba el árbol caído en el río a solicitud de un grupo de personas […] que frecuentan el lugar (río) que es un lugar de concurrencia frecuente de los lugareños, donde llegan a disfrutar de la naturaleza, incluidos las zonas verdes, los linderos del río, así como sus aguas frescas y sus pozas, y que consideraron que por estar en una época de invierno, lluviosa de alta afluencia hídrica en el margen del río y eso podía constituir un peligro inminente para los vecinos lugareños, dueños de propiedades cercanas e incluso personas ajenas a la zona pero que frecuentaban el lugar y llegar a arrastrar el árbol que habían cortado y caído al río llevándose personas que se encontraran junto al árbol, o mas (sic) abajo […] causando la muerte y desgracias para una o mas (sic) personas.
Esto lo corroboraron los testigos de descargo quienes confirmaron que el tema se discutió en un grupo de WhatsApp que tenían los dueños de finca y conocían del peligro inminente que ocasionó la caída del árbol en el río, entre ellos [Nombre 007], propietario de una parcela en el sitio, y el propio dueño del proyecto de las parcelas que se vendieron, el señor [Nombre 008] (sic), quien confirmó que fue quien contactó al señor ([Nombre 004]) para solicitarle ayuda y mover el árbol del río para evitar una desgracia mayor con algún ser humano de los que frecuentaban el lugar […]” (f. 182). Refiere que la juzgadora omitió analizar cuál era el beneficio, ventaja o ganancia de la disposición de recurso forestal, que sólo fue sacado, según los implicados, por solicitud expresa de los vecinos para evitar el peligro inminente de su arrastre. Expone que el ingeniero Forestal Luis Guillermo Vásquez Vásquez hizo ver en el contradictorio, que el aprovechamiento de productos forestales requiere que se compruebe una serie de actividades como son: tala, corta, arrastre, traslado, transporte e industrialización con fines comerciales, por lo que mover un árbol de un río para evitar peligros a personas, no cumple con dichos requerimientos, aun cuando no se contara con permisos para dicha movilización.
A su juicio, abona a lo anterior lo indicado por el señor Adrián Arce, funcionario del SINAC, quien indicó que “procesar un árbol” requiere que este sea troceado y se le saquen tablas con maquinaria especial, lo que no ocurrió en este asunto, en el que sólo se acreditó la movilización del río hacia una finca cercana (cfr. f. 182 vto.). Agrega que el tipo penal aplicado requiere de “aprovechamiento” para su configuración, lo que significa, según lo plantea el recurrente, «que debe existir un beneficio o ventaja» (f. 182 vto.), no necesariamente de tipo pecuniario, pero que reporte algún tipo de provecho. Arguye que, contrario a ello, en la especie el árbol fue removido por la existencia de un peligro inminente. Sostiene, por último, que la valoración de los daños ambientales se hace «[…] desde el momento en que el árbol fue talado y lanzado al río, esto abarcó un tamaño considerable de terreno que fue considerado según la procuradora general de la república (sic) por los imputados, y ya quedó demostrado durante el debate que la tala ilegal no pudo ser acreditada de ninguna forma por las partes procesales y existiendo un daño mínimo con relación a la movilización del árbol a la orilla del río, a la propiedad donde fue movilizado […]» (cfr. f. 183 fte.).
Segundo motivo del recurso de apelación de sentencia incoado: Inaplicación de un estado de necesidad justificante: Expone el licenciado Salazar Álvarez, que la prueba testimonial fue enfática en acreditar la existencia de un peligro inminente y real de caída del árbol al río, tomando en cuenta el lugar dónde se encontraba, la época de lluvias y el volumen caudaloso del río, que era visitado por recreación. Debido a ello que, en un ejercicio de ponderación de bienes jurídicos, se cumplen los requisitos para la concurrencia de un estado de necesidad justificante. Añade que se cumple también el requerimiento consistente en que el riesgo no haya sido provocado por el sujeto activo de la acción, porque «[…] quedó demostrado que los imputados no fueron las personas que talaron el árbol, si no (sic) que fueron llamados a salvaguardar la vida humana a petición de un grupo de lugareños de la zona […]» (f. 183 vto.).
Continúa indicando que también se cumple el requisito de que el peligro no sea evitable de otra manera, lo que se comprobó a través del perito Luis Guillermo Vásquez, quien se refirió a las condiciones en las que se encontró el árbol y las razones por las que se justificaba la acción de inmovilización de este para salvaguardar vidas humanas, por las condiciones del entorno y el tiempo que tarda el trámite del permiso respectivo, sea en sede administrativa o judicial. Explica que a nivel subjetivo, el imputado ([Nombre 004]) refirió en debate, que tiene amplia experiencia en temas de extracción de madera y trámites administrativos. Añadió que intervino porque el árbol constituía un peligro inminente para las personas que frecuentaban el lugar. Solicita que se analice la existencia de una causa de justificación por estado de necesidad justificante y se absuelva a los incriminados, o en su defecto, se reenvíe el asunto a juicio.
III.Para mayor claridad en la resolución, los reproches atinentes a la responsabilidad penal se resuelven de forma conjunta, por su estrecha interrelación. Por las razones que se exponen a continuación, en lo que atañe al extremo penal de la condena, se declara sin lugar el recurso: El recurrente señala que la condena de los coimputados por el ilícito previsto en el inciso b) del numeral 58 de la Ley Forestal, resulta errada. En abono a su tesis, señala que:
IV.El reclamo relativo al monto de condena civil de los coimputados por concepto del daño ambiental causado, se declara con lugar, por las razones que se dirán: Aduce la defensa técnica en el primer motivo de la impugnación formulada, que la condena civil por daño ambiental se realiza a partir de la consideración de que los encausados son responsables de la tala del árbol de su sitio de origen, considerando en la valoración de los daños, el área total afectada a partir de que el árbol fue talado y lanzado hacia el río, cuando lo que existe —a juicio de la defensa— es «[…] un daño mínimo en relación a la movilización del árbol a la orilla del río, a la propiedad donde fue movilizado […]» (ibid). Ahora bien, en efecto, el a quo excluyó la responsabilidad de los coendilgados por la acción consistente en talar el árbol corteza amarilla del sitio (dentro de la finca del señor [Nombre 010]) donde este se encontraba plantado originalmente —aspecto que no fue impugnado—.
Sin embargo, a los coendilgados no se les condenó por movilizar o extraer el árbol del río sin contar con permisos, como lo afirma la defensa técnica, sino que se les atribuyó el aprovechamiento del árbol que había caído ya sea dentro, o a pocos metros de la ribera del río Paires. A pesar de que la Fiscalía atribuyó a los justiciables tanto la tala del árbol estando este plantado o “en pie” (según la nomenclatura de la Ley Forestal), como su posterior procesamiento al seccionarlo en partes para su movilización a otra finca, se tuvo por cierta únicamente la segunda acción, es decir, se atribuyó a los coencartados talar, aserrar o “trocear” el árbol caído dentro de la zona de protección de río Paires. La Procuraduría General de la República, órgano que ejerce la acción civil resarcitoria, parte únicamente del segundo hecho (tala o acción de aserrar en trozos del árbol, una vez caído), tal y como se desprende de los hechos de la acción civil resarcitoria (cfr. fs. 6 y 7 del legajo de acción civil resarcitoria), que son los mismos de la querella ejercida por la representante de los intereses del Estado.
En este sentido, estimó el daño ambiental en la suma de 5.408.218 colones, «[…] por cuanto al realizar el aprovechamiento y procesamiento ilícito de un árbol de la especte Corteza Amarilla (sic) que se encontraba dentro del área de protección del río Paires a 3 metros de la rivera (sic), deterioraron los recursos naturales y su recuperación, lo que incidió de manera significativa y perjudicial en el bien demanial al afectar las condiciones naturales de esa área ya que eliminaron los recursos naturales existentes y su recuperación, tales como el costo de oportunidad de crecimiento de especies que habitaban en ese árbol aprovechado provocando la pérdida de la biodiversidad al realizar una explotación destructiva, haciendo desaparecer su riqueza biológica; flora, fauna y ecosistemas, aunado a ello, pérdida del carbono y costo de reposición, afectaciones al recurso hídrico y pérdida de belleza escénica, entre otros […]».
El peritaje del daño ambiental mencionado por la parte actora civil, que sirvió de base para la condena, es el oficio n.° ACOPAC-PINV-177-2022 (cfr. fs. 45-68 del expediente). El autor de dicha valoración es el máster Adrián Arce Arias, profesional en manejo y protección de recursos naturales quien declaró a viva voz en debate, y se constata que, en el curso de su declaración, se refirió a dicho peritaje, explicando el fundamento del monto de 5.408.218 colones en el que estimó el daño ambiental (cfr. archivo audiovisual 200016730061PE-11122024014304-2_Multi-1, minutos 01:06:50 a 01:39:20). En su informe, el perito diferencia cada uno de los siguientes rubros:
POR TANTO:
Se declara parcialmente con lugar el primer motivo de la impugnación formulada por la defensa técnica, en lo que toca al monto de la condena por concepto de daño moral. En consecuencia, se anula en forma parcial la sentencia n.° 04-P-2025, dictada por el Tribunal Penal de Puntarenas, a las 14:05 horas del 7 de enero de 2025, única y exclusivamente en lo que respecta al monto otorgado por concepto de daño ambiental y el monto de condena en costas relativas al ejercicio de la acción civil resarcitoria. Se dispone la celebración de juicio de reenvío para que, con integración diversa, se sustancien nuevamente los extremos puntuales antes indicados. En lo restante, se mantiene incólume la condena penal y civil.
