SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At sixteen hours and nineteen minutes on November twelfth, two thousand twenty-four.- PRELIMINARY INJUNCTION (MEDIDA CAUTELAR ANTICIPADA) filed by NEREYDA AVILÉS TAYLOR, of legal age, married, retired, identity card number seven - zero forty-eight - eight hundred thirty, resident of Alajuela; against SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN, legal entity identification number three - zero zero seven - three hundred seventeen thousand nine hundred twelve, represented by its interim executive director David Chavarría Morales, of legal age, married, holder of a degree in business administration, identity card number one - one thousand sixty-nine - two hundred ninety-five, resident of Limón. Participating as special litigation counsel (apoderados especiales judiciales) are: for the plaintiff, attorney Carlos González Campos, bar number five thousand nine hundred twenty-three; and for the defendant, attorney Andrés Alvarado Ramírez, bar number twenty-four thousand two hundred eleven.

Proceeding heard before the Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica. This Tribunal hears the appeal against interlocutory judgment (auto sentencia) Nº 2024000300, issued at thirteen hours and fifty-two minutes on July fifteenth, two thousand twenty-four.- Drafted by Judge Castro García; and,

WHEREAS:

I.The applicant for the preliminary injunction appeals the trial court’s resolution N° 2024000300, issued at thirteen hours and fifty-two minutes on July fifteenth, 2024, which denied her claim. In her appeal, she alleges that the decision is unlawful and contradictory. She states that it denies access to rights and justice enshrined in the national and international legal system because the decision authorizes the Administration to impose the order and dispossess her of possession (posesión) dating back to 1948, when the transferee of that possession took possession of the property. Protection was requested on the basis of her right and legal standing (legitimación) due to improper state action. Possession has been continuously maintained quietly, publicly, peacefully, uninterruptedly, under color of title, as owner, and in good faith, through the conduct of the agricultural production cycle (ciclo agropecuario).

She considers the decision defective and based on an insufficient assessment of the evidence because the evidence was not analyzed as a whole. She invokes the failure to observe articles 277, 278, and related provisions of the Código Civil; provisions 11, 27, 33, 39, 41, and 45 of the Constitución Política; and articles 1, 7, 8, and 21 of the Convención Americana Sobre Derechos Humanos. She objects that the appealed decision acknowledges that administrative order number 918 was issued, ordering the appellant to remove a vehicle from Parque Nacional Tortuguero, to cease removing coconuts from the Park, to cease the encroachment and occupation, and to remove her cattle. She alleges that this order treats the appellant as an unlawful occupant (usurpadora) of the property. She was therefore left unprotected by the denial of the requested preliminary injunction, which was substantiated in the initial application.

She argues that the Administration is being authorized to terminate agricultural possession dating back to 1948, in clear violation of articles 277 and 278 of the Código Civil concerning possession of real property. She maintains that she is not an unlawful occupant but a long-standing possessor whose possession predates the creation of Parque Nacional Tortuguero. She challenges the violation of constitutional article 11, the right to receive a response, due process (debido proceso), the guarantee of prompt and effective justice, the right to property under article 45, and the inviolability of property. These rights are supported by article 21 of the Convención Americana sobre Derechos Humanos regarding the right to property. Although reference is made to a previous injunction arising from the intention to dispossess Doña Nereyda of the stated possession, the fact is that the specified administrative order constitutes a new disturbance of that possession, such that my client is fully entitled to apply again for an atypical injunction (medida cautelar atípica) to safeguard her right.

Once it is granted, the appropriate appeal or claims required as a result of the Administration’s current and imminent disturbance will be filed, because the Administration seeks to terminate this decades-long possession through an administrative act (acto administrativo); indeed, issuing that resolution denying relief also violates provision 6 of the Ley de Creación del Parque Nacional Tortuguero. In view of all the foregoing, I request that the appealed resolution be reversed and that the preliminary injunction be granted so that my principal may proceed as provided by law. As a separate ground for appeal, she invokes the absence of analysis in the reasoning supporting the resolution. The reasoning is insufficient and lacks a comprehensive assessment of the testimonial evidence, including Mr. Abella’s testimony, which demonstrates that Doña Nereyda’s possession is indeed long-standing and that an agricultural production cycle has been conducted on the property.

Yet, overnight, she was adversely affected by an abusive act that contravenes higher-ranking civil, constitutional, and international rules. The statement of the Director as a party was not assessed, even though it demonstrated that the act carried out by officials of that institution is abusive and contrary to law. It follows that, to terminate this possession, the procedure specified in article 6 of the Ley Constitutiva del Parque Tortuguero must be followed, or else an ordinary proceeding (proceso ordinario) must be brought to terminate the long-standing possession. The fact that a previous injunction existed cannot render that decision res judicata (cosa juzgada) or justify denying a new application for an injunction based specifically on a different administrative act, as was decided in this matter. She requests that, due to the lack of supporting reasons, the resolution be reversed and the injunctions granted for the following purpose: to prevent damage or harm and achieve the objective of this measure, which was sought because of the administrative act and the conduct of the Administration; otherwise, she considers that there would be a denial of prompt and effective justice under articles 41 and 21 of the Constitución Política.

II- II- An analysis of the record shows that, in the initial filing in this preliminary-injunction proceeding brought by plaintiff Inés Avilés Taylor against SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), she seeks the following relief: “1- I request that the injunction sought be declared partially well-founded and that the administrative eviction order (orden de desalojo administrativa) n. 918 be provisionally stayed, should Your Honor conclude that they intend to order the suspension of agricultural activities that have been conducted on the property for seventy-five years, and that they intend to do so solely through an administrative order, without respecting due process and the right of defense, as well as the right of possession. 2. I request that this injunction be granted. 2. SINAC officials shall be prohibited from disposing of the cattle grazing on the property, since that activity has been conducted there for approximately 75 years. 3.

SINAC officials shall be prohibited from preventing the removal of coconuts, since these are obtained from the plantations established by my predecessors and by the undersigned. All the foregoing is subject to the warning that, in the event of noncompliance, they may be prosecuted for the offense of disobedience of authority and held liable for damages. I inform the judge that this is the second administrative order within a short period and that, in this regard, there previously exists” (images 1 to 8, PDF format). In her brief, she states that she possesses a tract of land located within Parque Nacional Tortuguero. It is situated in Limón, Second Canton of Pococí, Fourth District of Roxana. Its nature is mountain land, fruit trees, pasture, and coconut groves, with a large main house, large dining hall, two small houses, an electric generator, a well, grazing paddocks, and coconut crops.

It is bounded to the north, west, and south by Parque Nacional Tortuguero and to the east by an inalienable zone (zona Inalienable). Its area is thirty-seven hectares and three thousand four hundred forty square meters. Survey plan (plano) L-942313 - 1991. She states that she exercises current and immediate possession derived from her parents’ possession dating back to 1948. She engages in agricultural livestock, agroforestry, and conservation activities. The improvements and fixtures (mejoras y accesiones) were made by her parents before the aforementioned national park was declared. As the disturbing act (acto perturbatorio), she describes how, on June 27, 2023, officials from Área de Conservación Tortuguero - SINAC appeared at her property and served administrative order number 0918, instructing them to remove the vehicle and cattle from Parque Nacional Tortuguero, to cease removing coconuts, and to cease the encroachment.

This caused intimidation and disturbance of her possession, as well as an abuse of authority violating due process. She recounts the history of possession of her property, stating that her parents entered it in 1948, before the creation of Parque Nacional Tortuguero by law number 5680 of November 3, 1975, and its expansion under article 2 of executive decree N° 11148 of February 05, 1980, which included Laguna Jalova, the area where her property is located. She states that, as of the date of the expansion, her family had already exercised possession for 32 years and, as of the Park’s creation, for 73 years. She states that there is no administrative eviction act, nor any agrarian, criminal, or administrative-litigation proceeding in which she can defend herself against SINAC’s actions and exercise due process. She therefore resorts to this proceeding to prevent a forced and unlawful eviction through intimidation by means of an administrative order.

The JUZGADO AGRARIO DEL II CIRCUITO JUDICIAL DE LA ZONA ATLÁNTICA issued an order deeming the proceeding commenced and scheduling a judicial inspection (reconocimiento judicial) for October 24, 2023, summoning Sistema Nacional de Áreas de conservación and ordering that testimony be taken from a proposed witness. (images 21 and 22 of the digital case file, PDF format). It entered an appearance in the case file through a filing shown in images 30 to 31, PDF format. The judicial inspection was conducted on the specified date (minutes at image 33, PDF format). The record contains evidence and subsequent submissions by SINAC with observations and arguments (images 35 to 76, PDF format). Documentary evidence was also submitted consisting of a copy of prior case file number 21-000197-507-AG concerning a preliminary injunction before the same agrarian court. The appealed interlocutory injunction judgment N° 2024000300, issued at thirteen hours and fifty-two minutes on July fifteenth, two thousand twenty-four, ruled: “THEREFORE: The injunction filed by Nereyda Avilés Taylor against Sistema Nacional de Áreas de Conservación is denied.

Once this resolution becomes final, the case file shall be sent to the permanent archive. Ms. Avilés Taylor is ordered to pay the costs arising from this matter.” (images 156 to 162 of the digital case file, PDF format).

III.In light of the foregoing, pursuant to articles 1 and 2 of the Ley de Jurisdicción Agraria, this Court determines that the specialized agrarian court must declare that it lacks subject-matter jurisdiction (incompetencia por razón de la materia) to hear the appeal against the challenged interlocutory judgment (auto sentencia), which denied the anticipatory interim relief (medida cautelar anticipada). This is because the subject matter of the interim-relief proceeding is an administrative act (acto administrativo) issued by SINAC in the exercise of its own environmental functions, the suspension of which is requested on the grounds that the reasoning, legality, and purpose of the decision ordering the Regulated Party to suspend activities on her property are being challenged. It should be noted that, through the request for anticipatory interim relief, the applicant seeks to have the SINAC administrative order requiring the cessation and suspension of productive activities within the property located inside Parque Nacional Tortuguero rendered without effect.

That order was issued in the exercise of the statutory administrative powers of SINAC as a deconcentrated entity of the Ministerio de Ambiente y Energía and administrator of protected wilderness areas (áreas silvestres protegidas). Although the property is described as being devoted to agricultural activities, the claims seek to challenge administrative acts through anticipatory interim relief; this falls outside the jurisdiction of this Court, given the allegations of abuse of rights by the Administration—meaning MINAE-SINAC—the illegality of its conduct, and the infringement of the Regulated Party’s rights. The foregoing is pursuant to articles 1 and 2 of the Ley de Jurisdicción Agraria. The matters referenced concern administrative relationships or acts connected with the powers inherent in the State’s administrative function. It follows from the subject matter of the proceeding that this case falls outside the jurisdiction of the Agrarian Courts.

Article 10 of the Código Procesal Contencioso Administrativo provides that the purpose of contentious-administrative jurisdiction (jurisdicción contencioso-administrativa) is to protect the legal interests of every person, ensure or restore the legality of any conduct by the Public Administration subject to Administrative Law, and hear and adjudicate the various aspects of the legal-administrative relationship (relación jurídico-administrativa). Accordingly, jurisdiction to hear the appeal against the appealed interlocutory judgment, in view of the determination that jurisdiction is lacking, lies with the contentious-administrative jurisdiction, because the dispute concerns the exercise of the acts and administrative conduct challenged herein. Under current legislation, the agrarian courts are not intended to adjudicate challenges to acts of the Administration (article 1 of the Código Procesal Contencioso Administrativo; see also decision of the Sala Primera de la Corte Suprema de Justicia n° 530-F-S1-2008 of 14 hours 25 minutes on 1 de agosto del 2008).

IV- For those reasons, and pursuant to articles 1 and 2 of the Ley de Jurisdicción Agraria, article 110 of the Ley Orgánica del Poder Judicial, and articles 1 and 2 of the Código Procesal Contencioso Administrativo, this Court declares that it lacks subject-matter jurisdiction to hear this matter, as jurisdiction is deemed to lie with the contentious-administrative courts. Given that the decision under appeal ruled on the request for anticipatory interim relief at first instance, this case file shall be forwarded to the Tribunal de lo Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José for processing, should it deem appropriate.

POR TANTO

It is hereby declared that, by reason of subject matter, this case does not fall within the jurisdiction of the specialized agrarian courts. Jurisdiction over this proceeding is declared to lie with the Juzgado Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José. This case file shall be forwarded to that court for adjudication of the appeal filed against interlocutory judgment N° 2024000300, issued at thirteen hours fifty-two minutes on quince de julio del 2024 by the Juzgado Agrario del Segundo Circuito Judicial de La Zona Atlántica, should it deem appropriate.

CONSIDERANDO:

I.Se apela por la solicitante de la medida cautelar anticipada, la resolución que denegó su pretensión N° 2024000300 de las trece horas cincuenta y dos minutos del quince de julio del 2024 del Juzgado de instancia. Alegando en su recurso la ilegalidad de la decisión y resultar contradictoria. Menciona, se niega el acceso al derecho y la justicia consagrado en el ordenamiento jurídico nacional e internacional, pues la decisión autoriza a la Administración la imposición de la orden y el despojo de una posesión que deriva desde el año 1948. Fecha en que se entró en posesión de la finca por el cesionario de dicha posesión. Se solicitó la tutela por el derecho y la legitimación debido a una actuación estatal irregular. La posesión se ha mantenido en el tiempo de forma, quieta, pública, pacífica, ininterrumpida, a título y de dueño y de buena fe, en el desarrollo del ciclo agropecuario. Considera, la decisión se encuentra viciada y con valoración insuficiente de prueba al no realizarse su análisis integral.

Invoca la inobservancia de los artículos 277, 278 y relacionados del Código Civil, numerales 11, 27, 33, 39, 41 y 45 de la Constitución Política, 1, 7, 8, 21 de la Convención Americana Sobre Derechos Humanos. Refuta, se reconoce en la decisión apelada se giró la orden administrativa número 918, que le ordena a al recurrente sacar un vehículo del Parque Nacional Tortuguero, no continuar extrayendo cocos del Parque, ni continuar con la usurpación y ocupación, así como sacar su ganado. En dicha orden, acusa, se le considera a la apelante como usurpadora de la finca. Quedando desprotegida a partir del rechazo de la tutela cautelar anticipada solicitada, que se fundamentó en el escrito de solicitud inicial. Aduce, se le está autorizando a la Administración dar por fenecida una posesión agropecuaria derivada desde el año 1948, en claro atropello a los numerales artículos 277, 278 del Código Civil respecto a la posesión de un inmueble.

Reclama, no ser usurpadora, sino poseedora de vieja data y de previo a la creación del Parque Nacional Tortuguero. Cuestiona, la violación de los artículos constitucionales 11, del derecho a la respuesta, el debido proceso y a garantía de justicia pronta y cumplida, el derecho a la propiedad artículo 45 y la inviolabilidad de la propiedad. Que encuentra sustento en la Convención Americana sobre Derechos Humanos en su artículo 21, respecto del derecho a la propiedad. Si bien se hace referencia a una medida cautelar anterior por la intención de despojar la posesión indicada e doña Nereyda, lo cierto del caso es que existe una nueva perturbación a esa mediante la orden administrativa señalada, de tal forma que mi representada está en todo su derecho de aplicar nuevamente con una medida cautelar atípica en resguardo de su derecho. Que una vez con esta se procederá a interponer el recurso recursos o demandadas que se requieran en virtud de la perturbación actual e inminente por parte de la administración, quien desea terminar que esa posesión de tantos años mediante un acto administrativo, incluso al dictar ese resolución con el rechazo se violenta el numeral 6 de la Ley de Creación del Parque Nacional Tortuguero.

Por todo lo expuesto solicito se revoque la resolución recurrida y en su lugar se otorgue la medida cautelar anticipada para proceder de parte de mi poderdante como en derecho corresponde. Como agravio separado invoca la ausencia de análisis en la fundamentación intelectiva de la resolución. Media un análisis intelectivo insuficiente, carente de valoración integral de la prueba testimonial, la declaración del señor Abella donde se demuestra, que efectivamente la posesión de doña Nereyda es de larga data y el ciclo agropecuario desarrollado en la finca. Ocurriendo que de la noche a la mañana, mediante un acto abusivo en contra de normas civiles, constitucionales e internacionales de alto rango se le afecta. No se valoró la declaración de parte del Director, donde se demostró que el acto realizado por funcionarios de esa institución es abusivo y contrario a derecho. Deduciéndose, que para terminar con esa posesión se debe proseguir lo indicado en el artículo 6 de la Ley Constitutiva del Parque Tortuguero, o bien mediante un proceso ordinario para dar por fenecida la posesión de vieja data.

Sin que sea posible considerar que por haber existido una medida cautelar anterior, se tenga como cosa juzgada dicha decisión y al solicitar nuevamente otra medida cautelar, precisamente por otro acto administrativo se vaya a rechazar la solicitud, como se decide en este asunto. Solicita que, por falta de fundamentación, se revoque la resolución y se ordenen el otorgamiento de las medidas cautelares por lo siguiente: para evitar la causación del daño o perjuicio y lograr el objetivo de esta medida que se ha planteado debido al acto administrativo y actuar de la Administración, caso contrario estimo, estaríamos en presencia de una denegación de justicia pronta y cumplida, acorde con el artículo 41 y 21 de la Constitución Política

II- II- Analizados los autos se observa que en el escrito inicial del presente proceso de medida cautelar anticipada la actora Inés Avilés Taylor contra el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), como pretensiones pide: "1- Solicito declarar parcialmente con lugar la medida cautelar solicitada, y ordenar la suspensión provisional de la orden de desalojo administrativa n. 918, concluya su autoridad que pretenden ordenar la suspensión de actividades agropecuarias que han existido en la finca desde hace setenta y cinco años, y lo pretenden hacer solamente con una orden administrativa, sin respetar el debido proceso y el derecho de defensa así como el derecho de posesión. 2.Solicito se declare con lugar la presente medida cautelar. 2. Se le prohíba a los funcionarios del SINAC, disponer del ganado que pasta en la finca, ya que dicha actividad tiene cerca de 75 años de ejercerla en esa. 3.Se le prohíba a los funcionarios del SINAC impedir la extracción de cocos, ya que estos se obtienen de los sembradíos realizados por mis antecesores y por la infrascrita.

Todo lo anterior, bajo apercibimiento de que en caso de incumplimiento se les puede seguir causa por el delito de desobediencia a la autoridad y al pago de daños y perjuicios. Le informo al señor juez que esta es la segunda orden administrativa en un corto tiempo y que al respecto existe previamente” (imagen 1 a 8 modo pdf). Señala en su memorial, es poseedora de un terreno ubicado dentro del Parque Nacional Tortuguero. Sito en Limón, cantón Segundo Pococí, distrito Cuatro Roxana. Naturaleza de montaña frutales pastos y cocales, con construcción de casona grande, comedor grande, dos casas pequeñas, una planta eléctrica, pozo, repastos, cultivos de coco. Linda al norte, oeste y sur con Parque Nacional Tortuguero y al este con zona Inalienable. Cabida treinta y siete hectáreas tres mil cuatrocientos cuarenta y dos metros cuadrados. Plano L-942313 - 1991. Afirma, ejerce la posesión actual y momentánea, que deriva desde el año 1948 de sus padres.

Se dedica a actividad agraria ganadera, agroforestal y de conservación. Las mejoras y accesiones se realizaron por sus progenitores, desde antes que se declarara el parque nacional citado. Como acto perturbatorio describe que el 27 de junio del 2023 se apersonaron a su finca funcionarios del Área de Conservación Tortuguero - SINAC y notificaron la orden administrativa número 0918, en la que se les indica sacar el vehículo y ganado del Parque Nacional Tortuguero. No seguir extrayendo cocos, ni con la usurpación. Con lo cual se genera intimidación y perturbación de su posesión, así como abuso de autoridad violatoria del debido proceso. Relata los antecedentes de la posesión de su fundo, donde sus progenitores desde 1948 ingresaron de previo a la creación del Parque Nacional Tortuguero por ley número 5680 del 3 de noviembre de 1975 y su ampliación por el artículo 2 del decreto ejecutivo N° 11148 del 05 de febrero de 1980, donde se incluyó la Laguna Jalova que es la zona donde se ubica su fundo.

A la fecha de la ampliación, cita, la posesión ejercida por su familia era ya de 32 años y al crearse el Parque de 73 años. Señala, no existe ningún acto administrativo de desalojo, ni en sede agrario o penal o contenciosa administrativa, donde pueda defenderse de las actuaciones del SINAC y ejercer el debido proceso Por lo que acude a esta vía para evitar el desalojo forzoso e ilegal en uso de la intimidación de una orden administrativa. Se emite por el JUZGADO AGRARIO DEL II CIRCUITO JUDICIAL DE LA ZONA ATLÁNTICA. Auto que tiene por establecido el proceso y se señala un reconocimiento judicial el 24 de octubre del 2023 citando al Sistema Nacional de Áreas de conservación y ordenando recibir la declaración testimonial de un testigo propuesto. (imagen 21 y 22 expediente digital modo PDF). Que se apersona al expediente mediante escrito del imagen 30 a 31 modo pdf. Se realiza reconocimiento judicial en fecha señalada (minuta a imagen 33 modo pdf).

Consta prueba y manifestaciones posteriores del SINAC con observaciones y alegatos (imagen 35 a 76 modo pdf). Y se aportó prueba documental de copia de expediente número 21-000197-507-AG previo de medida cautelar anticipada del mismo juzgado agrario. Se emite el auto sentencia cautelar apelada N° 2024000300 de las trece horas con cincuenta y dos minutos del quince de julio del año dos mil veinticuatro que resuelve: “POR TANTO: Se rechaza la medida cautelar interpuesta por Nereyda Avilés Taylor en contra del Sistema Nacional de Áreas de Conservación. Una vez firme esta resolución, envíese el expediente a su archivo definitivo. Se condena a la señora Avilés Taylor al pago de las costas producto de este asunto.” (imagen 156 a 162 expediente digital modo pdf).

III.Dado lo citado, con fundamento en el artículo 1 y 2 de la Ley de Jurisdicción Agraria, se determina por esta Sede ha de declararse la incompetencia por razón de la materia de la sede especializada agraria para conocer la apelación contra el auto sentencia recurrida que denegó la medida cautelar anticipada. Lo anterior, en virtud de que el objeto del proceso cautelar lo constituye un acto administrativo del SINAC ejercido en funciones propias en materia ambiental, contra el que se solicita su suspensión al cuestionarse la motivación, legalidad y fin de la decisión de orden de suspensión de actividades a la Administrada en su fundo. Se hace notar, se solicita en la vía de medida cautelar anticipada se deje sin efecto la orden administrativa del SINAC de eliminación y suspensión de actividades productivas dentro de la finca ubicada dentro del Parque Nacional Tortuguero. Orden emitida en ejercicio de las facultades administrativas legales del SINAC como ente desconcentrado del Ministerio de Ambiente y Energía y administrador de las áreas silvestres protegidas.

Si bien, se describe que la finca se dedica a actividades agrarias, las pretensiones se dirigen al combate de actos administrativos en la vía de medida cautelar anticipada; lo cual resulta ajeno al conocimiento de esta Jurisdicción dada la argumentación de abuso de derecho de la Administración entiéndase MINAE-SINAC, ilegalidad de la actuación y lesión a los derechos de la administrada. Lo anterior, al tenor del artículo 1 y 2 de la Ley de Jurisdicción Agraria. Lo referido versa sobre relaciones o actos de naturaleza administrativa, en relación con facultades de la función administrativa estatal. Se concluye del objeto del proceso, que el conocimiento de este asunto está fuera del ámbito de las competencias de los Tribunales Agrarios. El artículo 10 del Código Procesal Contencioso Administrativo dispone, la jurisdicción contencioso-administrativa tiene por objeto tutelar las situaciones jurídicas de toda persona, garantizar o restablecer la legalidad de cualquier conducta de la Administración Pública sujeta al derecho Administrativo, así como conocer y resolver los diversos aspectos de la relación jurídico-administrativa.

Por lo que el conocimiento de la apelación contra el auto sentencia apelada, dada la incompetencia decretada, corresponde a la jurisdicción contencioso-administrativa; al tratarse sobre la discusión del ejercicio de los actos y la conducta administrativa aquí cuestionada. La sede agraria no está ideada con la legislación vigente para atacar actos de la Administración (artículo 1 del Código Procesal Contencioso Administrativo y ver voto de Sala Primera de la Corte Suprema de Justicia n° 530-F-S1-2008 de las 14 horas 25 minutos del 1 de agosto del 2008).

IV- Por esas razones, y de conformidad con el artículo 1, 2 de la Ley de Jurisdicción Agraria y 110 de la Ley Orgánica del Poder Judicial, 1 y 2 del Código Procesal Contencioso Administrativo, se decreta la incompetencia por la materia para el conocimiento de este asunto por estimarse corresponde a la jurisdicción contencioso-administrativa. Visto que lo apelado es una resolución que resolvió la solicitud de medida cautelar anticipada de primera instancia, remítase el presente expediente al Tribunal de lo Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José para su tramitación, si a bien lo tiene.

POR TANTO

Se decreta que, por razón de la materia, este asunto no compete ser conocido por la jurisdicción especializada agraria. Se declara que el conocimiento del presente proceso corresponde al Juzgado Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José. Remítase el presente expediente a ese despacho para la resolución de la apelación interpuesta con el auto sentencia N° 2024000300 de las trece horas cincuenta y dos minutos del quince de julio del 2024 del Juzgado Agrario del Segundo Circuito Judicial de La Zona Atlántica, si a bien lo considera.
