Municipalidad de Dota JUDGMENT N° N° 2024001027 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At fifteen thirty-two hours on the twenty-fourth of October, two thousand twenty-four.- SUMMARY DEMOLITION PROCEEDING (PROCESO SUMARIO DE DERRIBO) brought by MUNICIPALIDAD DE DOTA, legal entity identification number three - zero fourteen - zero forty-two thousand forty-nine, represented by its municipal mayor, Adrián Cordero Cordero, of legal age, married once, identity card number three- three hundred sixty-four - eight hundred thirty-eight. Processed before the Juzgado Agrario de Cartago. This Tribunal hears the declination of jurisdiction (inhibitoria) issued at nine hours and twenty-five minutes on the twelfth of September of the year two thousand twenty-four.
Judge Castro García authors the decision; and,
WHEREAS:
I.By order N° 2024000190 issued at nine hours and twenty-five minutes on the twelfth of September of the year two thousand twenty-four, the Juzgado Agrario de Cartago declined jurisdiction, reasoning that the dangers that could be caused by the six trees whose removal is requested by the Municipalidad de Dota from a property belonging to it, where municipal training classrooms will be built, are neither stated nor described.
II.Regarding jurisdiction over demolition injunctions (interdictos de derribo), this Tribunal has ruled: "II. A demolition injunction is appropriate when the poor condition of a building, structure, or tree poses a threat to the rights of possessors or passersby, or could harm public property. It follows from the complaint that the alleged danger is associated with an almond tree that is 15 meters tall, which, it is asserted, poses a risk to passersby, a risk that increases during the rainy season. The specific harm is alleged by a person who states that they work in a commercial establishment located beside that tree. In this regard, the Tribunal finds that this is indeed a proceeding within the jurisdiction of the Agrarian Jurisdiction because trees constitute natural resources that form part of the nation’s biodiversity. Trees, as natural resources, are regulated, among other provisions, by the Ley de Biodiversidad, subsection 3 of Article 11 of which provides that the environmental public interest is one of the criteria for applying that legislation.
Specifically, the provision states: ‘The use of the components of biodiversity must safeguard future generations’ development options, food security, ecosystem conservation, the protection of human health, and improvement of citizens’ quality of life.’ Such matters must be considered in resolving this proceeding because a natural resource is at issue, and subject-matter jurisdiction to make that determination is reserved by law to this Jurisdiction. Essentially, section 108 of the Ley de Biodiversidad provides: ‘In biodiversity matters, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the contentious-administrative jurisdiction. As exceptions to the foregoing rule, offenses against biodiversity shall be adjudicated by the criminal jurisdiction; likewise, disputes arising between private parties, where neither an administrative act nor public-domain property is involved, shall fall within the jurisdiction of the agrarian jurisdiction.’ It follows from the foregoing that, because this is a proceeding in which a private person asserts a claim concerning a natural resource, it falls within the subject-matter jurisdiction of the agrarian courts pursuant to the cited legislation; accordingly, the declination of jurisdiction issued by the Court must be denied." III- In this case, the Municipalidad de Dota brings this proceeding without naming any person as a defendant, alleging that the portion of the property registered in its name will be allocated to a community project. It asserts that tree species are present at the site that could pose a risk, according to the initial filing and the attached engineer’s report. This Tribunal finds that, given the ownership of the property and the intended use of the land where the trees are located, whose removal is requested for a community project, under Article 108 of the Ley de Biodiversidad this jurisdiction does not have authority to hear the matter. This Chamber considers that subject-matter jurisdiction lies with the contentious-administrative jurisdiction pursuant to Articles 1 and 2 of the Código Procesal Contencioso Administrativo.
IV.In view of the foregoing, pursuant to sections 11 subsection 3 and 108 of the Ley de Biodiversidad, 1 and 2 of the Ley de Jurisdicción Agraria, and Articles 1 and 2 of the Código Procesal Contencioso Administrativo, the declination of jurisdiction by the Juzgado Agrario de Cartago is upheld. It is declared that this matter does not fall within the subject-matter jurisdiction of the specialized agrarian jurisdiction. The case file shall be forwarded to the Juzgado Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José so that it may continue processing the matter if it deems appropriate.
THEREFORE:
The declination of jurisdiction by the Juzgado Agrario de Cartago is upheld. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las quince horas treinta y dos minutos del veinticuatro de octubre de dos mil veinticuatro.- PROCESO SUMARIO DE DERRIBO promovido por MUNICIPALIDAD DE DOTA, cédula jurídica tres - cero catorce - cero cuarenta y dos mil cuarenta y nueve, representada por su alcalde municipal Adrián Cordero Cordero, mayor, casado una vez, cédula de identidad tres- trescientos sesenta y cuatro - ochocientos treinta y ocho. Tramitado ante el Juzgado Agrario de Cartago. Conoce este Tribunal de la inhibitoria de las nueve horas con veinticinco minutos del doce de setiembre del año dos mil veinticuatro.
Redacta la jueza Castro García; y,
CONSIDERANDO:
I.Por auto N° 2024000190 de las nueve horas con veinticinco minutos del doce de setiembre del año dos mil veinticuatro del Juzgado Agrario de Cartago se inhibe, razonando no se comprende ni describe los peligros que puede ocasionar los seis árboles que se solicita derribar por la Municipalidad de Dota de una propiedad que le pertenece y en donde se construirán aulas de capacitación municipal.
II.Sobre el tema de competencia en materia de interdictos de derribo, este Tribunal ha resuelto:" II. El interdicto de derribo procede cuando el mal estado de un edificio, construcción o árbol, constituyan una amenaza para los derechos de las personas poseedoras o transeúntes, o pueda perjudicar algún bien público. De la demanda se desprende, la peligrosidad alegada está vinculada con un árbol de almendro de una altura de 15 metros, el cual se indica, constituye un riesgo para las personas transeúntes, el cual se incrementa por la temporada lluviosa. La afectación concreta la plantea quien dice laborar en un local comercial que se localiza al lado de dicho árbol. Al respecto, estima el Tribunal sí se está en presencia de un proceso competencia de la Jurisdicción Agraria debido a que los árboles constituyen recursos naturales parte de la biodiversidad nacional. Los árboles como recursos naturales, se encuentran regulados, entre otras normas, por la Ley de Biodiversidad, la cual dispone en el inciso 3 del artículo 11 que uno de los criterios de aplicación de esa normativa lo constituye el interés público ambiental.
Concretamente, señala la norma: "El uso de los elementos de la biodiversidad deberá garantizar las opciones de desarrollo de las futuras generaciones, la seguridad alimentaria, la conservación de los ecosistemas, la protección de la salud humana y el mejoramiento de la calidad de vida de los ciudadanos". Tales aspectos deberán ser considerados para la resolución de este proceso, al estar de por medio un recurso natural; y la competencia material para tal determinación está reservada por ley a esta Jurisdicción. Básicamente, el numeral 108 de la Ley de Biodiversidad señala: "En materia de biodiversidad y mientras no exista una jurisdicción ambiental, toda controversia será competencia exclusiva de la jurisdicción contencioso administrativa. Como excepciones a la regla anterior, los delitos contra la biodiversidad serán juzgados por la jurisdicción penal; de igual modo, las controversias que se susciten entre particulares, donde no medie un acto administrativo ni del dominio público, serán competencia de la jurisdicción agraria".
De lo expuesto se concluye, al estarse en presencia de un proceso en el cual una persona particular plantea un reclamo en relación con un recurso natural, el mismo es parte de la competencia material de los tribunales agraria conforme a la normativa citada, de ahí que deba improbarse la inhibitoria declarada por el Juzgado"(Voto N. 1577 -C-12 de las 12:15 del 20 de diciembre de 2012. Al respecto ver también Voto N. -50-C-13 de las 08:51 horas del 08 de enero del 2013).
III- En este caso, la Municipalidad de Dota interpone este proceso sin demandar a persona alguna alegando se destinará el sector de la finca a su nombre a proyecto comunal. POR TANTO:
Se acoge la inhibitoria del Juzgado Agrario de Cartago. Se decreta que este asunto no es del conocimiento por razón de la materia de la jurisdicción especializada agraria. Se dispone la remisión del expediente al Juzgado Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José, para que continúe con la tramitación, si a bien lo tiene.
