MUNICIPALIDAD DE CURRIDABAT N° 2024007535 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, at nine hours and two minutes on veintiocho de Octubre del dos mil veinticuatro.- This Tribunal, acting as the non-hierarchical reviewer of legality (contralor no jerárquico de legalidad), hears the appeal (recurso de apelación) filed by Condominio Horizontal Residencial de Fincas Filiales Primarias Individualizadas Vía Cipreses, represented by Ms. Rebeca Chaves Flores in her capacity as president of Inversiones Florem F.M.R. Sociedad Anónima, which is the administrator of the aforementioned condominium—as evidenced by the Registry certifications appearing at folios 15 to 17 of the record—against resolution MC-ALC-RS-0046-05-2022, issued at fourteen hours and fifty-four minutes on diecinueve de mayo del año dos mil veintidós by the Alcaldía Municipal de Curridabat.- Judge Solís Valverde drafts the decision; and

CONSIDERING

I. EVIDENCE FOR BETTER ADJUDICATION OFFERED BY THE APPELLANT

In accordance with the documentation in the record, this panel finds that no additional evidence is required to decide the appeal filed; accordingly, the evidence for better adjudication (prueba para mejor resolver) offered by the appellant on 06 de julio del año 2023 is denied.-

II. PROVEN FACTS (HECHOS PROBADOS)

Of relevance to the resolution of this case—with folio numbering in ascending order according to the case file generated on the virtual desktop—the following facts are deemed established: 1) By a filing submitted on 04 de marzo del año 2022, the appellant filed an administrative claim (reclamo administrativo), through which it requested:

(Folio 04 to 13);

  • 2)By resolution MC-ALC-RS-0046-05-2022, issued at fourteen hours and fifty-four minutes on diecinueve de mayo del año dos mil veintidós by the Alcaldía Municipal de Desamparados, it was decided: “... POR TANTO Based on the foregoing considerations and legal authorities, the ‘ADMINISTRATIVE CLAIM’ filed by Ms. REBECA CHAVES FLORES on behalf of INVERSIONES FLOREM F.M.R.S.A, which in turn is the Administrator of CONDOMINIO HORIZONTAL RESIDENCIAL DE FINCAS FILIALES PRIMARIAS INDIVIDUALIZADAS VIA (sic) CIPRESES, is denied...”. (Folio 111 to 115);
  • 3)By a filing submitted on 30 de mayo del año 2022, the appellant filed a motion for reconsideration with an appeal in the alternative (recurso de revocatoria con apelación en subsidio) against resolution MC-ALC-RS-0046-05-2022. (Folio 117 to 120);
  • 4)By resolution MC-ALC-RS-0058-06-2022 of diecisiete de junio del año 2022, the Alcaldía Municipal denies the motion for reconsideration filed against resolution MC-ALC-RS-0046-05-2022 and refers the appeal to this Court. (Folio 149 to 156);

III. ON THE SPECIFIC CASE

For purposes of analyzing the application under consideration, it is appropriate to recall that, pursuant to the provisions of Article 173 of the Political Constitution, as developed in sections 162, 165, 166, 170 and 171 of the Municipal Code and 189 et seq. of the Administrative Litigation Procedural Code, the jurisdiction of the Administrative Litigation Court to act as a non-hierarchical overseer of legality (contralor no jerárquico de legalidad) within the municipal system is established. Pursuant to section 181 of the General Public Administration Act, this jurisdiction is limited to exercising an essentially legal review of the formal functions of municipal corporations, insofar as it is confined to reviewing the administrative decisions of the Municipalities issued by their authorities, namely, the Council and the Mayor, within the scope of the claims and factual issues raised by the appellant.

In the case before us, the challenge concerns the act of the Municipal Mayor’s Office, resolution MC-ALC-RS-0046-05-2022, issued at catorce horas cincuenta y cuatro minutos del diecinueve de mayo del año dos mil veintidós by the Municipal Mayor’s Office of Curridabat. To address the challenge filed, this Court will consider the grievances raised by the appellant regarding the content of the administrative act (acto administrativo). Appellant’s grievances: The appellant begins her appeal by referring to a series of facts, emphasizing that the record contains no evidence of any application made to the Ministry of Health, even though official letters MC-GIR-0026-03-2022 and MC-DGV-0204-92-2022, both issued by the Comprehensive Risk Management Department, confirm that it assisted in bringing the reported situation before the Ministry of Health. She states that, through official letter MC-PMA-0147-03-2022, the Environmental Protection Department confirms that it has attempted to find a solution to the problem but has been unable to do so because the governing authority (Área rectora) is the Ministry of Health.

She therefore points out that, for a long time, they were told that this Department was seeking a solution to the problem, and they were never informed that the Municipality lacked jurisdiction to resolve the situation. Regarding the facts deemed unproven, she asserts that it is unreasonable to deem submissions made to the Municipality unproven when their receipt, bearing the corresponding received stamp, appears in the administrative record (expediente administrativo). She argues that it is incomprehensible to deem unproven a fact concerning a meeting held at the Condominio with a German university, at which Mr. José Retana was present. As to the merits, she notes that the decision states that a registry report is attached demonstrating that Calla La Única is not under municipal administration because it is registered as a private easement (servidumbre), but that report was not submitted and is not part of the administrative record.

She states that, by emphasizing that the Condominio is located on private property and that the events are occurring there, the decision assigns responsibility for covering the channel exclusively to its owners, who could make any decision, including closing it, because it is a private channel over which the Municipality states that it has no authority whatsoever. She requests that, in view of the inconsistencies in the challenged act, it be annulled and replaced with an objective ruling accompanied by all supporting documents and evidence from the Municipality. For its part, in the challenged act, the respondent Municipality includes, insofar as relevant, a section setting forth the factual background (resultando), in which it identifies the location of the Condominio, states that its original design included a stormwater channel (canal de aguas pluviales), and refers to the filing of the administrative claim (reclamo administrativo) being decided.

It describes the actions taken by the Road Management Directorate to assist the residents with their applications before Acueductos y Alcantarillados and the Ministry of Health, and states that the Ministry is the governing authority in this public-health matter. It further states that they are awaiting the studies to be conducted on private properties upstream from the Condominio that apparently discharge untreated sewage into the stormwater channel, noting that the Ministry of Health must issue sanitary orders (ordenes sanitarias) requiring each property either to treat its wastewater internally or to connect to the Acueductos y Alcantarillados sanitary sewer system. In the fifth factual finding, it states that the issue of sewage involving illegal connections to the stormwater channel has been referred by Environmental Protection and Road Management to the Ministry of Health for appropriate action.

It reports that the Urban Development and Control Department has not participated in the Condominio proceedings. It also states that, although the Environmental Protection Department has shown an interest in finding a solution to the wastewater-contamination issue, that office cannot resolve the situation because jurisdiction rests with the governing office of the Ministry of Health in Curridabat. It states that the stormwater easement (servidumbre pluvial) challenged by the appellant was designed in its current condition—that is, as an open channel—from the outset of the Condominio’s construction. It then describes a series of facts deemed proven and unproven in connection with the claim filed. As to the merits, the challenged act states that it is untrue that the contaminated water flows into administratively controlled areas, because all land adjoining the Condominio is privately owned, and that La Única street itself is registered as a private access easement, as stated in the attached registry report.

It argues that the assertion that a pipeline was donated to the Municipality lacks factual support. It states that the proceeding initiated is inadmissible for two reasons: first, because the appellant Condominio is located on private property and any events occurring on the property must be resolved directly by the registered owner, not by the Municipality; and second, because pursuant to Article 2 of the Organic Law of the Ministry of Health and sections 1 and 2 of the Constitutive Law of Acueductos y Alcantarillados, the requested course or action plan falls to the Ministry of Health as a public-health matter, while the Municipality’s role is limited to providing assistance. It states that Acueductos y Alcantarillados has already issued a report whose conclusions do not identify any duty on the part of the Municipality to act, and that the Ministry of Health must issue a report establishing actions, conclusions, and recommendations addressed to the registered owner; it therefore rejects the administrative claim filed.

OPINION OF THIS OFFICE: Having reviewed the record, the content of the challenged act, and the grievances presented, this office concludes that this appeal (recurso de apelación) must be granted for the following reasons. First, this office agrees with the appellant’s assertion that the challenged act contains a series of substantive inconsistencies. As the appellant correctly argues, the record contains no evidence of the specific actions that the respondent Municipality claimed to have taken before the Ministry of Health. Indeed, official letter MC-GIR-0026-03-2022 dated 10 de marzo del año 2022, issued by the Municipal Comprehensive Risk Management Department, stated that the application had been forwarded to the Ministry of Health. In this regard, the official letter states: “... In response to your request, you are advised that, based on the matters described, this concerns sewage involving illegal connections to the stormwater channel, which has been duly handled by Environmental Protection / Road Management and forwarded to the Ministry of Health for appropriate action...” (underlining not in the original) (image 102 of the record).

Likewise, the FIFTH factual finding of the challenged act reiterates the statement made in the cited official letter (image 112 of the record). Image 105 of the record also contains official letter MC-PMA-0147-03-2022 of 16 de marzo del 2022, issued by the Municipal Environmental Protection Department, which states: “... The attached documents do not show the responses of the Governing (sic) Office of the Ministry of Health in Curridabat; having considered the respective functions and powers, we suggest and offer to follow up on this application with that Governing Office...” (emphasis not in the original). Notwithstanding the statements made in the administrative acts quoted above, the record does not show what referral or follow-up the Municipality claims to have undertaken regarding the reported case with the corresponding Governing Office of the Ministry of Health. Indeed, the Municipality itself subsequently clarified that no such referral had been made, stating in resolution MC-ALC-RS-0058-06-2022: “...

On another matter, the Municipal Road Management Department of Curridabat indicated that it has provided assistance with the actions undertaken by the residents (sic), but has not forwarded the (sic) matter to the Ministry of Health. With respect to official letter MC-GIR-0026-03-2022 dated 10 de marzo del 2022, it is clarified that it erroneously stated that the matter had been forwarded to the Ministry of Health. The Municipality of Curridabat had no need to forward it because, when this municipal entity was informed of the situation, the matter had already been sent to the Ministry of Health, and the report from that institution determining how to proceed in resolving the problem is currently pending. The importance of that report has been repeatedly emphasized because the matter falls within the exclusive jurisdiction of the Ministry of Health...” (emphasis not in the original) (images 149 to 156, specifically images 152 and 153, all from the record).

This appellate body (alzada) therefore finds that the inconsistency identified by the appellant is indeed present in the challenged act, and this grievance must consequently be sustained. It should also be emphasized that, when the Municipality subsequently considered the motion for reconsideration (recurso de revocatoria) filed against the challenged act, it stated that the entire matter resulted from an error in official letter MC-GIR-0026-03-2022 issued by one of its own departments; accordingly, the municipal entity has neither referred the matter to nor provided assistance before the Governing Office of the Ministry of Health. In this respect, the municipal entity has failed to comply with the requirement established by the Constitutional Chamber as part of the principle of coordination (principio de coordinación) among different municipal offices and entities: “... Therefore, to prevent the simultaneous coexistence of spheres of power having different origins and natures, the duplication of national and local efforts, and confusion concerning the rights and obligations of the various parties involved, it is necessary to establish a series of coordinating relationships among the various offices of the Executive Branch and decentralized institutions, and between those entities and the municipalities, so that they may perform the functions entrusted to them.” See resolution 2010006922 de las catorce horas y treinta y cinco minutos del dieciséis de abril del dos mil diez, issued by the Constitutional Chamber.

Second, in accordance with the foregoing, this appellate body concludes that the respondent Municipality has failed to comply with the obligation imposed upon it by Article 169 of the Political Constitution of Costa Rica concerning the urban planning and oversight of the canton under its administration. In this regard, the Constitutional Chamber held in resolution 2016005107 de las doce horas y cero minutos de quince de abril de dos mil dieciséis, insofar as relevant: “V.

Regarding the problem of wastewater (aguas residuales) leaking through the sewer system (alcantarillado). This Sala Constitucional, in ruling 2015-9940 at nine twenty in the morning on tres de julio de dos mil quince, heard a case very similar to that raised by the appellant:... III.- On the merits. The municipalities are responsible for administering local interests and services in each canton, pursuant to the aforementioned Article 169 of the Constitución Política. From this derives the municipalities’ authority to plan and oversee the urban development of their locality, which includes the duty to establish a comprehensive urban-planning policy (planeamiento urbano) that ensures urban development consistent with the efficient operation of a system for the supply of drinking water and the collection, treatment, and final disposal of wastewater, as well as the obligation to adopt the measures required to provide the canton with an adequate sanitary and storm sewer system (alcantarillado sanitario y pluvial), in order to guarantee its inhabitants the right to health and to an environment free from pollution (see, to that effect, judgments No. 2009-000908 at 13:34 hrs. on 23 de enero del 2009 and No. 2009-003368 at 12:40 hrs. on 27 de febrero del 2009, among others).

Accordingly, this Sala concludes that, despite its legal obligation, the respondent Municipality has not fulfilled its duty to supervise the construction of Urbanización Santa Rosa de Lima; hence, there are problems not only with stormwater (aguas pluviales), but also with sewage or wastewater (aguas negras o servidas). With respect to the Ministerio de Salud, it has been established that, although the Área Rectora de Salud de Santo Domingo de Heredia has received, processed, and resolved the complaints filed by the affected residents since 2008, it has not taken decisive action to secure a solution to a situation that, it acknowledges, still persists and has not been resolved, nor has it required the municipal government to assume its share of responsibility for circumstances of which it has had full knowledge for several years. Specifically, this Tribunal has recognized that one of the governing principles of administrative organization is the coordination that must exist among all public entities and bodies when exercising their powers and providing the services assigned to them by the legal system.

Coordination, insofar as it ensures administrative efficiency and effectiveness, is a virtual or implicit constitutional principle that permeates the entire administrative legal system and binds all public entities. Coordination may be inter-organizational—among the various bodies comprising a public entity that are not subject to a hierarchical relationship—or intersubjective—that is, among public entities, each with legal personality, its own budget, autonomy, and specific powers. The purpose of administrative coordination is to prevent duplication and omissions in the performance of the administrative functions of each public entity; that is, to ensure that they are performed rationally and in an orderly manner (see, to that effect, judgment No. 2007-015218 at 12:00 hrs. on 19 de octubre del 2007, among others). Accordingly, this Tribunal concludes that stormwater and wastewater problems do exist in Residencial Santa Rosa de Lima, for which reason both the respondent Municipality and the Ministerio de Salud must coordinate with one another and take the actions necessary to provide an effective solution to that problem.

In any event, the owners of properties in the aforementioned Residencial, including the appellant, must comply with the sanitary orders (órdenes sanitarias) issued by the Ministerio de Salud...” (the underlining and bold type are not in the original). Continuing with the obligations and powers concerning matters such as the one analyzed, the same Sala Constitucional, in decision 2020020109 at nine twenty-five in the morning on veinte de octubre de dos mil veinte, stated, insofar as relevant: “III.- ON THE POWERS AND OBLIGATIONS OF MUNICIPALITIES. Regarding the claims brought by the appellant, it should first be noted that this Tribunal has recognized in its case law the obligation of Municipalities to take effective and prompt action in response to the needs of the territorial jurisdiction assigned to each municipal corporation, which is closely linked to the population element. Those obligations derive from Articles 169 and 170 of the Constitución Política and encompass a broad range of activities.

Thus, in judgments N° 2011-12886 at 12:44 hours on 23 de setiembre de 2011 and N° 2015010541 at 09:20 hours on 17 de julio de 2015, among others, this Sala stated: ‘(…) as established by Article 169 of the Constitución Política and the Código Municipal, municipalities are responsible for administering local services and interests in order to promote the comprehensive development of the cantons in harmony with national development. Consequently, the Municipality must establish a comprehensive urban-planning policy in accordance with the relevant law, aimed at the efficient and harmonious development of urban centers and guaranteeing—at a minimum—efficient electricity and communications services; sound drinking-water supply and wastewater-disposal systems; adequate water-supply and sewer systems (acueductos y alcantarillado); city lighting and beautification systems; construction, repair, and cleaning services for streets and other public roads; and, in general, concrete and practical plans to make life comfortable and safe for the population.’ Moreover, regarding the provision of services, this Sala has held—see, e.g., judgment N° 2016-000427 at 09:30 hours on 15 de enero de 2016—that the proper operation of such services constitutes a fundamental right.

This follows from the content of Articles 139, 140, and 191 of the Constitución Política. This translates into an obligation for the various Public Administrations to provide services continuously, regularly, promptly, effectively, and efficiently. Likewise, the organizational provisions of the Carta Fundamental establish a series of principles governing the organization and functioning of the Administration, which have been developed through subconstitutional rules, such as the Ley General de la Administración Pública, which, in Articles 4, 225, paragraph 1, and 269, paragraph 1, imposes upon State bodies the duty to guide and support administrative organization and functioning. Thus, the principle of effectiveness presupposes that administrative organization is designed to achieve the objectives and purposes assigned by the legal system itself, which requires planning and accountability.

The principle of efficiency, in turn, entails achieving the best results through the rational use of the resources available to the various agencies. The Administration is also subject to the principle of simplicity, which must be understood as the obligation to ensure that administrative structures and their powers are readily understandable, without complex procedures that delay the satisfaction of public interests. The principle of promptness imposes upon Public Administrations the obligation to fulfill their objectives and purposes in the most expeditious, swift, and appropriate manner possible, so as to avoid undue and unjustified delays. Thus, these principles impose a series of permanent requirements, responsibilities, and duties upon all public entities...” (the emphasis is not in the original). The respondent Municipality must therefore take effective and efficient action to address the needs of its canton, notably including sound drinking-water supply and wastewater-disposal systems; adequate water-supply and sewer systems; city lighting and beautification systems; construction, repair, and cleaning services for streets and other public roads; and, in general, concrete and practical plans to make life comfortable and safe for the population—actions that are conspicuously absent in this particular case.

Third, and closely connected with the Local Government’s oversight of infrastructure to be constructed or already constructed on privately owned land (predios privados), it should be emphasized that the following articles of the Ley de Construcciones (Ley número 833 del 02 de noviembre de 1949) impose clear duties upon the Municipalidad de Curridabat in the context of the specific case assessed in this decision. The relevant provisions are transcribed below: “Article 14.- When a privately owned parcel that provides access to adjoining parcels has been abandoned or causes unhealthy conditions, insecurity, or mere nuisance, the Municipality shall order the owners of that parcel and the adjoining parcels to eliminate those conditions. If they fail to comply within the prescribed period, the Municipality shall undertake the conversion of the parcel serving as a passageway into a public road having the width, services, and other requirements mandated by the laws and regulations in force.

The cost of this work shall be paid jointly by the owner of the parcel serving as a passageway and by the owners of the adjoining parcels.” This provision supports the conclusion that, when the Municipality identifies such circumstances in advance, it has sufficient public authority to require the owners of privately owned land to correct conditions causing nuisance, insecurity, or unhealthy conditions to other public or private parcels and to the environment generally. It is important to note that the Municipality may itself make improvements to the parcel and charge the owner for the expenses. Article 17, in turn, provides: “Article 17.- Types of Buildings. The Municipality is empowered to require materials of a specified quality in buildings, as well as a particular class or type of building, in subdivisions (fraccionamientos) or replanning zones (zonas de replanificaciones) that, because of their category or the importance of nearby areas, must present a harmonious ensemble and be of durable quality.” Closely connected with the preceding provision, if it can be established that a particular building causes environmental harm or harm of any other kind to neighboring residents, the Municipality may require the owner to use specified construction materials or to employ a particular type of construction.

Under this understanding, where a deficient civil-engineering structure channels blackwater or greywater (aguas negras o grises) improperly, or in a manner different from that contemplated in the corresponding building permit (licencia constructiva), it falls within the Municipality’s authority to order the owner to make the necessary changes. Failing that, through the combined application of the aforementioned Articles 14 and 17 of the Ley de Construcciones, the Municipality has both the duty and the authority to restore urban-planning harmony to a polluting parcel and charge the owner for the expenses.

It is not true that the restoration of sanitary conditions resulting from construction work (obras constructivas) on a parcel of land is the exclusive responsibility of the Ministry of Health. The Municipalidad de Curridabat, as in the case under review, must intervene. It must be understood that application of and compliance with the Political Constitution is a duty of both private persons and persons governed by Public Law, particularly when such compliance arises from the Municipalidad de Curridabat’s urban-planning oversight and supervisory powers, in harmony with the decisions issued by the Sala Constitucional itself and transcribed in the second point of this Whereas clause (considerando), by virtue of which it must safeguard the Right to Health, the Right to Life, and the Right to a Healthy and Ecologically Balanced Environment, especially when those Fundamental Rights may be affected by structures on public or private property, over which the Local Government has clear authority to authorize construction, inspect, and oversee operation following notice of completion of the work.

For this purpose, it even has legal enforcement mechanisms in the event of noncompliance, as shown in the following articles of the referenced law: “Article 33—Penalties. The Municipality shall impose fines of five percent (5%) to ten percent (10%) of a base salary, calculated in accordance with Article 2 of Law No. 7337 of 5 May 1993, for violations of the rules in this chapter, and shall order the dismantling and removal, at the owner’s expense, of signs and related structures that it considers unsuitable or dangerous.” It follows from the foregoing that the Municipalidad de Curridabat has the authority to order the dismantling and removal, at the owner’s expense, of civil structures that it considers unsuitable or dangerous, as is plainly the case with an uncontrolled discharge of contaminated wastewater that is incompatible with urban-planning and environmental requirements. “CHAPTER XX INSPECTION Article 87.—The Municipality shall exercise oversight over works performed within its jurisdiction and over their use.

It shall also be responsible for monitoring compliance with the provisions of this Law….” Based on this provision, it is clear that a Municipality is responsible not only for potentially granting an urban-planning construction permit (licencia urbanística constructiva), but also for ensuring consistency between the authorized work and the work actually constructed. Moreover, in addition to the foregoing, the Municipality has a public responsibility to oversee the use made of the works whose construction it authorized, particularly if the civil-engineering or architectural infrastructure is unsuitable or has operational problems or deficiencies in its planning that result in harm to neighboring properties due to the improper channeling and treatment of wastewater. Specifically, the Municipality must intervene and order the owner to carry out the work or, failing that, perform it itself and charge the owner for the expenses incurred in seeking to restore the Principle of Harmony in Urban-Planning Law (Principio de Armonía del Derecho Urbanístico), under which municipal interventions must be undertaken in accordance with science and technology, pursuant to Articles 16 and 160 of the Ley General de la Administración Pública, so that environmental impact and harm to persons and neighboring properties are minimized.

Continuing with the penalties, Article 88 provides: “Article 88.—Powers. The Municipality may impose penalties for violations of the rules of this Code. The penalties shall be those specified in the body of this Law and its Regulations (fines, closures, vacation of premises, destruction of the work, etc.) and those set forth in this Chapter.” In support of the foregoing, it should be noted that, when infrastructure is shown to be harmful to the environment and to the rights to health and life, the Municipality may impose penalties such as fines, orders to vacate, and even the destruction of civil works for channeling contaminated wastewater that harm persons and the environment in general. The Local Government does not depend on the Ministry of Health or any other body to safeguard the environment and the technical suitability of construction performed within its territorial jurisdiction.

It should be recalled that the Municipality has autonomy within the essential sphere of its powers and territory, guaranteed by the Political Constitution, the Código Municipal, and the extensive case law of the Sala Constitucional. Along the same lines, the Ley de Construcciones provides: “Article 89.—Violations. In addition to those indicated in the Chapters of this Code, the following shall be deemed violations: a) Performing, without a prior permit, works for which this Law and its Regulations require a permit. b) Performing works under a permit whose term has expired. c) Performing work by partially or radically modifying the respective approved project. d) Performing, without adequate protection, works that endanger life or property. e) Failing to timely submit to the Municipality the data reports required under various Chapters of the Regulations. f) Failing to notify the Municipality of the suspension or completion of works. g) Failing to obey Municipality orders concerning the modification, suspension, or destruction of works. h) Improperly using public roads. i) Improperly using public utilities. j) Occupying or using a building before giving notice of completion of the work. k) Preventing or obstructing Inspectors from performing their duties” (underlining not in the original).

It should be noted, for example, that under the foregoing rationale, the Municipality must intervene on its own initiative or at a party’s request when civil structures on public or private property are unsuitable or malfunction and thereby affect neighbors or the environment. If any irregularity is identified, the Municipality may require the owner to make repairs and improvements, just as it requires residents to repair sidewalks or pay municipal taxes; failing that, it may perform the work directly and charge the expenses to the owner. Indeed, under subsection g) of Article 89 cited above, the Municipality may deem it a violation when the owner of private property fails to obey Municipality orders to modify, suspend, or destroy works. There are numerous circumstances, including structural instability of civil works; pollution; failure to comply with zoning rules; environmental damage; failure to comply with the maximum percentage of the land that may be covered by construction; construction without a permit; construction without the supervision of a duly licensed civil engineer responsible for the work; construction on public roads and within the public domain (demanio público); and illegal construction within the Zona Marítimo Terrestre, among others.

In other words, the Municipality must intervene when civil construction works on real property affect third parties, the environment, the right of movement, or the public domain. With respect to the foregoing, the referenced body of law states: “Article 95.—If the owner submits the corresponding project and it is accepted, the Municipality shall verify whether the work was performed in accordance with it and whether both satisfy the requirements of this Law and its Regulations, subjecting it to the necessary tests.” This provision supports the conclusion that the Local Government may and must, at all times and either on its own initiative or at a party’s request, verify whether civil works constructed on real property were performed in accordance with the urban-planning construction permit. For this purpose, it may conduct whatever tests and inspections are necessary concerning the operation of the electrical installation, the suitability of the plumbing system, the width of columns, beams, reinforcing bars, and the quality of cement and materials in general, as well as the proper sanitary conveyance of wastewater.

It should be noted that the Municipality may not decline to provide this service: it must inspect proposed construction when processing the permit and during construction, and, pursuant to the authority cited above, it must also ensure, for as long as the property exists and without being subject to any mandatory or restrictive time limit, that every structure on the property functions properly, because its powers of inspection, oversight, enforcement, remediation, and demolition due to misuse, deterioration, or poor construction planning are not subject to prescription, may not be waived, and may not be delegated, pursuant to Article 66 of the Ley General de la Administración Pública, insofar as the structures and their impact on persons and the environment are potentially harmful and incompatible with urban-planning requirements. In light of these considerations, this Office finds that the respondent Municipality has been neither consistent nor clear in the various administrative acts communicated to the appellant concerning the proper handling of the reported matter.

As indicated, several administrative acts state that the reported situation had been brought to the attention of the appropriate Área Rectora del Ministerio de Salud and that those actions would be followed up; subsequently, however, the Municipality contradicted itself and stated that those assertions in the acts were errors and that no matter had been referred. It is therefore determined that the inconsistencies have denied the appellant proper consideration of the request and, consequently, that the claim submitted has not been duly resolved. Indeed, as the appellant correctly notes, the challenged act states that, because the reported events occurred on private property, the appellant must resolve them directly (image 114 of the record), apparently disregarding the constitutional and statutory obligations imposed on the Municipalidad de Curridabat with respect to urban planning, including verification of compliance with urban-planning requirements concerning the necessary infrastructure works and, where appropriate, establishment of the relevant procedures to review and supervise, within the scope of its powers, whether the reported problem is attributable to construction deficiencies or other causes, which must comply with the applicable statutory and regulatory construction standards.

The Municipalidad de Curridabat must recall that it has a duty to plan and oversee the urban development of its community, including a duty to establish a comprehensive urban-planning policy that ensures urban development consistent with the efficient operation of systems for supplying drinking water and collecting, treating, and finally disposing of wastewater, as well as an obligation to adopt the measures required to provide the canton with an adequate sanitary- and storm-sewer system in order to guarantee its inhabitants the right to health and to an environment free from pollution. Although this Office agrees with the municipal entity that certain powers are legally assigned to other entities, such as the Instituto Costarricense de Acueductos y Alcantarillados and the Ministry of Health, this does not exempt the Municipal entity from complying with its obligations within the scope of its own powers.

Accordingly, the appeal filed is granted and, consequently, Resolution MC-ALC-RS-0046-05-2022, issued by the Alcaldía Municipal de Curridabat at fourteen hours and fifty-four minutes on the nineteenth of May of the year two thousand twenty-two, is declared null and void.

Return the case file to the Municipality of origin so that, within the scope of its authority, it may decide the administrative claim filed by the appellant on 04 de marzo del año 2022, with the resolution ultimately issued duly stating the grounds and corresponding evidence on which it is based.-

IV. RETURN OF THE CASE FILE

Because the proceedings before this forum were conducted electronically, the parties may obtain a complete copy containing both the administrative case file (expediente administrativo) forwarded by the Municipal Corporation and all documents comprising these appellate proceedings (alzada), for which purpose they must provide an electronic storage device (USB flash drive or compact disc). Furthermore, if physical or electronic documentation (plans, photographs, reports, etc.) was submitted and remains in the Court’s custody, the party that submitted it may retrieve it within 30 business days, in accordance with Article 12 of the Regulations on Electronic Case Files before the Poder Judicial, approved by the Corte Plena at session n.° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial n.° 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session n.° 43-12 held on 3 de mayo del 2012, Article LXXXI.-

POR TANTO

The evidence offered by the appellant for further adjudication (prueba para mejor resolver) is rejected. The appeal (recurso de apelación) filed is granted; consequently, the challenged decision is declared null and void. The case file shall be returned to the Municipality of origin so that, within the scope of its authority, it may adjudicate the administrative claim (reclamo administrativo) filed by the appellant on 04 de marzo del año 2022, with due reasoning and the corresponding evidence upon which the decision ultimately issued is based. That is all. Notice shall be given. MUNICIPALIDAD DE CURRIDABAT N° 2024007535 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las nueve horas con dos minutos del veintiocho de Octubre del dos mil veinticuatro.- Conoce este Tribunal como contralor no jerárquico de legalidad, del recurso de apelación interpuesto por Condominio Horizontal Residencial de Fincas Filiales Primarias Individualizadas Vía Cipreses, representado por la señora Rebeca Chaves Flores en su condición de presidenta de Inversiones Florem F.M.R. Sociedad Anónima, quien es la administradora del condominio referido -según certificaciones registrales visibles a folios 15 a 17 de los autos-; contra la resolución MC-ALC-RS-0046-05-2022 de las catorce horas cincuenta y cuatro minutos del diecinueve de mayo del año dos mil veintidós emitida por la Alcaldía Municipal de Curridabat.- Redacta la Jueza Solís Valverde y;

CONSIDERANDO

I. DE LA PRUEBA PARA MEJOR RESOLVER OFRECIDA POR LA PARTE RECURRENTE

De conformidad con la documentación que consta en autos, es criterio de este Colegio que no se requiere prueba adicional para resolver el recurso de apelación planteado, así las cosas, se rechaza la prueba para mejor resolver ofrecida por la parte recurrente en fecha 06 de julio del año 2023.-

II. HECHOS PROBADOS

De interés para la resolución del presente caso -con foliatura según el expediente generado en el escritorio virtual de forma ascendente- se tienen por acreditados los siguientes hechos: 1) Mediante escrito presentado en fecha 04 de marzo del año 2022 la parte recurrente interpone reclamo administrativo, por medio del cual solicitó:

(Folio 04 a 13);

  • 2)Por resolución MC-ALC-RS-0046-05-2022 de las catorce horas cincuenta y cuatro minutos del diecinueve de mayo del año dos mil veintidós emitida por la Alcaldía Municipal de Desamparados, se resolvió: "... POR TANTO Con base en las consideraciones expuestas y citas legales, se rechaza el "RECLAMO ADMINISTRATIVO" interpuesto por la señora REBECA CHAVES FLORES en representación de INVERSIONES FLOREM F.M.R.S.A quién a su vez es el Administrador del CONDOMINIO HORIZONTAL RESIDENCIAL DE FINCAS FILIALES PRIMARIAS INDIVIDUALIZADAS VIA (sic) CIPRESES...". (Folio 111 a 115);
  • 3)Por escrito presentado el 30 de mayo del año 2022 la parte recurrente interpone recurso de revocatoria con apelación en subsidio en contra de la resolución MC-ALC-RS-0046-05-2022. (Folio 117 a 120);
  • 4)Por resolución MC-ALC-RS-0058-06-2022 del diecisiete de junio del año 2022, la Alcaldía Municipal declara sin lugar el recurso de revocatoria interpuesto contra la resolución MC-ALC-RS-0046-05-2022 y traslada la apelación ante este despacho. (Folio 149 a 156);
  • 5)La parte recurrente interpone gestión de adición y aclaración en contra de la resolución MC-ALC-RS-0058-06-2022. (Folio 160 a 161);
  • 6)Mediante resolución MC-ALC-RS-0060-06-2022 del 28 de junio del 2022 emitida por la Alcaldía Municipal, se rechaza de plano la gestión de adición y aclaración presentada. (Folio 162 a 163);
  • 7)La parte recurrente en fecha 06 de julio del año 2023, presenta prueba para mejor resolver ante el despacho. (Folio 169 a 172);
  • 8)En resolución de las diez horas cuarenta y tres minutos del veintidós de diciembre de dos mil veintitrés, el despacho confiere a la Municipalidad recurrida audiencia del escrito y prueba presentado por la parte recurrente. (Folio 175 a 176);
  • 9)Mediante escrito presentado el 10 de enero del año en curso, la Municipalidad recurrida se refiere a la audiencia concedida por el despacho. (Folio 179 a 181).-

III. SOBRE EL CASO CONCRETO

A efectos de analizar la gestión que se conoce, es conveniente recordar, que conforme al enunciado del artículo 173 de la Constitución Política, desarrollado en los numerales 162, 165, 166, 170 y 171 del Código Municipal y 189 y siguientes del Código Procesal Contencioso Administrativo, se define la competencia del Tribunal Contencioso Administrativo para actuar como contralor no jerárquico de legalidad del régimen municipal, lo cual, conforme al numeral 181 de la Ley General de la Administración Pública, se circunscribe a ejercer un control eminentemente de legalidad de la función formal de las corporaciones municipales, en tanto se limita a verificar un control de las decisiones administrativas de las Municipalidades, emanadas de sus autoridades, sea, del Concejo y del Alcalde, dentro del límite de las pretensiones y cuestiones de hecho planteadas por la parte recurrente. En el caso que nos ocupa, se conoce impugnación que recae sobre el acto de la Alcaldía Municipal resolución MC-ALC-RS-0046-05-2022 de las catorce horas cincuenta y cuatro minutos del diecinueve de mayo del año dos mil veintidós emitida por la Alcaldía Municipal de Curridabat, a efectos de atender la impugnación formulada, se procederá a conocer por parte de este Tribunal los agravios planteados por la parte recurrente con respecto al contenido del acto administrativo.

Agravios de la recurrente: En este sentido, inicia su recurso haciendo referencia a una serie de hechos donde destaca que no consta en autos gestión alguna realizada ante el Ministerio de Salud, a pesar de que constan los oficios MC-GIR-0026-03-2022 y MC-DGV-0204-92-2022 ambos emitidos por el Departamento de Gestión Integral de Riesgo, donde confirman su acompañamiento ante el Ministerio de Salud de la situación denunciada. Refiere que el Departamento de Protección del Medio Ambiente por oficio MC-PMA-0147-03-2022 confirma que ha tratado de buscar una solución al problema y que no ha sido posible debido a que el Área rectora es el Ministerio de Salud, por lo anterior, señala que por largo tiempo se les indicó que ese Departamento estaba buscando una solución al problema y que nunca se les manifestó que la Municipalidad no tenía competencia para resolver la situación. Manifiesta sobre los hechos no probados que no es razonable tener por no probadas notas presentadas ante la Municipalidad, al constar sus recibidos en el expediente administrativo con su sello de recibido.

Aduce que es incomprensible tener por no probado un hecho que refiere a una reunión realizada en el Condominio con una Universidad Alemana donde estuvo presente el señor José Retana. En cuanto al fondo señala, que se afirma se adjunta un informe registral donde se demuestra que la Calla La Única no es de administración municipal, porque se encuentra inscrita como una servidumbre privada y que el informe no fue aportado y no forma parte del expediente administrativo. Refiere que al resaltar que el Condominio esta en propiedad privada y que los acontecimientos se presentan en el mismo, le compete únicamente a sus propietarios tapar el canal, pudiendo tomar cualquier decisión incluso clausurarlo al ser un canal privado en el que la Municipalidad manifiesta no tiene ningún tipo de injerencia. Solicita que en virtud de las inconsistencias del acto recurrido el mismo sea anulado y que en su lugar se resuelva de forma objetiva acompañando la resolución de todos los documentos y prueba de respaldo por parte de la Municipalidad.

Por su parte la Municipalidad recurrida en el acto que se impugna refiere en lo de interés un apartado de resultando donde señala la ubicación del condominio, que en el mismo desde su diseño cuenta con un canal de aguas pluviales y refiere la interposición del reclamo administrativo que se resuelve. Aduce las acciones que ha realizado la Dirección de Gestión Vial para acompañar a los vecinos en las gestiones realizadas ante Acueductos y Alcantarillados y el Ministerio de Salud, y señala que es el Ministerio quien tiene la rectoría en esta materia de salud pública y que se encuentran a la espera de los estudios que realicen en propiedades privadas aguas arriba del condominio que en apariencia están disponiendo sus aguas servidas sin ningún tratamiento al canal pluvial, indicando que el Ministerio de Salud debe emitir ordenes sanitarias para que cada propiedad trate a lo interno sus aguas o se conecte a la red sanitaria de Acueductos y Alcantarillados.

En el resultando quinto refiere que el tema de aguas negras con conexiones ilegales hacia el canal pluvial, se ha gestionado por Protección del Medio Ambiente y Gestión Vial hacia el Ministerio de Salud para lo que corresponda. Informa que el Departamento de Desarrollo y Control Urbano no ha participado en proceso del condominio. Y señala que si bien el Departamento Protección de Medio Ambiente ha mostrado interés para encontrar una solución al tema de contaminación por aguas residuales, no es posible para esa dependencia resolver la situación al ser el área rectora del Ministerio de Salud de Curridabat a quien les compete. Manifiesta que la servidumbre pluvial reclamada por la recurrente desde el inicio de construcción del Condominio se contempló en las condiciones actuales, sea como canal abierto. Posteriormente, refiere una serie de hechos probados y no probados del reclamo planteado.

En lo que corresponde al fondo, indica en el acto impugnado que no es cierto que el agua contaminada desemboca en áreas administrativas ya que todos los terrenos aledaños al condominio son privados, que la misma calle La Única esta inscrita como servidumbre privada de ingreso, tal y como se indica en el informe registral que se adjunta. Aduce, que la afirmación de donación de una tubería a la Municipalidad carece de sustento verídico. Manifiesta que el trámite planteado es improcedente por dos razones: porque el condominio recurrente se encuentra en propiedad privada y los acontecimientos que se presenten en el inmueble le corresponden al propietario registral solucionarlos directamente y no a la Municipalidad y en segundo lugar, de conformidad con el artículo 2 de la Ley Orgánica del Ministerio de Salud y numerales 1 y 2 de la Ley Constitutiva de Acueductos y Alcantarillados, se establece que la solicitud del interesado el margen o plan de acción recae en el Ministerio de Salud por un tema de salud pública y que la Municipalidad se limita a realizar un acompañamiento.

Refiere que ya Acueductos y Alcantarillados emitió un informe y que en sus conclusiones no señala un deber de actuar de la Municipalidad y que es necesario que el Ministerio de Salud emita un informe fijando acciones, conclusiones y recomendaciones dirigidas al propietario registral y rechaza el reclamo administrativo planteado. CRITERIO DEL DESPACHO: Analizados los autos, el contenido del acto que se impugna, así como los agravios expuestos, es criterio de este despacho que el presente recurso de apelación debe ser declarado con lugar, por los siguientes motivos. En primer lugar, se coincide con lo indicado por el recurrente referente a que el acto impugnado presenta una serie de inconsistencias en cuanto al fondo. Nótese que efectivamente como se agravia, no consta en autos las acciones concretas que la Municipalidad recurrida indicó había realizado ante el Ministerio de Salud y es que, tal y como se desprende del oficio MC-GIR-0026-03-2022 de fecha 10 de marzo del año 2022 emitido por el Departamento de Gestión Integral del Riesgo Municipal, se había señalado que la gestión se había remitido al Ministerio de Salud, véase al respecto que indica el oficio: "...

En atención a su solicitud, se informa que acorde a lo expuesto corresponde a un tema de aguas negras con conexiones ilegales hacia el canal pluvial, lo cual ha sido debidamente gestionado por parte de Protección de Medio Ambiente / Gestión Vial; así remitido hacia el Ministerio de Salud para lo que corresponda..." (el subrayo no es del original) (imagen 102 de los autos), igualmente en el resultando QUINTO del acto que se impugna se reitera lo señalado en el oficio de cita (imagen 112 de los autos). Asimismo, consta a imagen 105 de los autos el oficio MC-PMA-0147-03-2022 del 16 de marzo del 2022 emitido por el Departamento de Protección del Medio Ambiente Municipal, donde se indica: "... En los documentos que se anexan no es posible observar las respuestas del área (sic) Rectora del Ministerio de Salud de Curridabat; y al considerar las funciones y competencias, lo que sugerimos y ofrecemos es dar seguimiento a esta gestión con dicha Área Rectora..." (el resaltado no es del original).

No obstante las afirmaciones realizadas en los actos administrativos transcritos, no se desprende de los autos, cual es la remisión o seguimiento que indica la Municipalidad ha realizado del caso denunciado con el Área Rectora del Ministerio de Salud correspondiente. Incluso, véase que la misma Municipalidad después aclara que esa remisión no se ha realizado, al respecto indicó en la resolución MC-ALC-RS-0058-06-2022: "... En otro orden de ideas, lo señalado por el Departamento de Gestión Vial de la Municipalidad de Curridabat, es que ha existido un acompañamiento en las acciones que los vecinos (sic) y no así en la remisión de (sic) asunto al Ministerio de Salud. El lo que respecta al oficio MC-GIR-0026-03-2022 de fecha 10 de marzo del 2022, se aclara que por error se indicó que se remitió el asunto al Ministerio de Salud, ya que por parte de la Municipalidad de Curridabat no hubo necesidad de remitirlo en razón de que cuando se puso en conocimiento a este ente municipal de la situación, ya había sido enviado el asunto al Ministerio de Salud y actualmente se está a la espera precisamente del informe de esa institución que determine cómo se procederá para solventar la problemática, importancia que ha sido reiterada, en virtud de que es de la competencia exclusiva del Ministerio de Salud..." (el resaltado no es del original) (imagen 149 a 156, en especifico imagen 152 y 153, todas de los autos), es así como se determina por parte de esta alzada que la incongruencia apuntada por la parte recurrente efectivamente se encuentra presenta en el acto recurrido, por lo que este agravio debe ser acogido.

Incluso se resalta que la misma Municipalidad, posteriormente al conocer el recurso de revocatoria interpuesto contra el acto impugnado, señala que todo se debió a un error en el oficio MC-GIR-0026-03-2022 emitido por uno de sus propios departamentos, por lo que la remisión o acompañamiento ante el Área Rectora del Ministerio de Salud, no se ha dado por parte del ente municipal. En este sentido incumple el ente municipal con lo señalado por la Sala Constitucional como parte del principio de coordinación entre diferentes dependencias y entes municipales: "... Por ello, a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas.", ver al respecto la resolución de 2010006922 de las catorce horas y treinta y cinco minutos del dieciséis de abril del dos mil diez emitida por la Sala Constitucional.

En segundo lugar; de conformidad con lo referido líneas arriba, esta alzada concluye que la Municipalidad recurrida ha incumplido con la obligación que le impone el artículo 169 de la Constitución Política de Costa Rica, en cuanto a la planificación y vigilancia urbana del cantón que administra. En esta línea la Sala Constitucional estableció en la resolución 2016005107 de las doce horas y cero minutos de quince de abril de dos mil dieciséis, en lo de interés: "V. Sobre el problema de fuga de aguas residuales que corren por el alcantarillado. Esta Sala Constitucional, en el voto 2015-9940 de las nueve horas veinte minutos del tres de julio de dos mil quince conoció un caso muy similar al planteado por la recurrente:... III.- Sobre el fondo. Corresponde a las municipalidades la administración de los intereses y servicios locales en cada cantón, de conformidad a lo dispuesto por el citado artículo 169 de la Constitución Política.

De lo que deriva la competencia de las municipalidades para planificar y vigilar el desarrollo urbano de su localidad, lo que incluye el deber de establecer una política integral de planeamiento urbano, que garantice un desarrollo urbano en congruencia con el funcionamiento eficiente de un sistema de provisión de agua potable y de recolección, tratamiento y disposición final de las aguas residuales, así como la obligación de adoptar las medidas requeridas para proveer al cantón de un adecuado sistema de alcantarillado sanitario y pluvial, a fin de garantizar a sus habitantes el derecho a la salud y a un ambiente libre de contaminación (véanse, al efecto, sentencias No. 2009-000908 de las 13:34 hrs. del 23 de enero del 2009 y No. 2009-003368 de las 12:40 hrs. del 27 de febrero del 2009, entre otras). De este modo, concluye esta Sala que a pesar de la obligación legal, la Municipalidad accionada no ha cumplido con su deber de fiscalización de la construcción de la Urbanización Santa Rosa de Lima, de ahí que haya problemática no solo en cuanto a las aguas pluviales, sino también respecto de las negras o servidas.

Sobre el caso del Ministerio de Salud, se comprueba que si bien el Área Rectora de Salud de Santo Domingo de Heredia ha atendido, tramitado y resuelto las denuncias que desde el año 2008 han sido presentadas por los vecinos afectados, no ha sido determinante en procurar la solución a una situación que se acepta aún persiste y que no ha sido solucionada, ni tampoco en exigirle al ayuntamiento su cuota de responsabilidad en los hechos que son de su pleno conocimiento desde hace varios años. Precisamente, este Tribunal ha reconocido que uno de los principios rectores de la organización administrativa lo constituye la coordinación que debe mediar entre todos los entes y órganos públicos al ejercer sus competencias y prestar los servicios que el ordenamiento jurídico les ha asignado. La coordinación, en cuanto asegura la eficiencia y eficacia administrativas, es un principio constitucional virtual o implícito que permea el entero ordenamiento jurídico administrativo y obliga a todos los entes públicos.

La coordinación puede ser interorgánica -entre los diversos órganos que conforman un ente público no sujetos a una relación de jerarquía- o intersubjetiva -esto es, entre los entes públicos, cada uno con personalidad jurídica, presupuesto propio, autonomía y competencias específicas-. La coordinación administrativa tiene por propósito evitar las duplicidades y omisiones en el ejercicio de las funciones administrativas de cada ente público, esto es, que sean desempeñadas de forma racional y ordenada (véase, al efecto, la sentencia No. 2007-015218 de las 12:00 hrs. del 19 de octubre del 2007, entre otras). De esta manera, este Tribunal concluye que sí existen problemas de aguas pluviales y servidas en el Residencial Santa Rosa de Lima, razón por la que tanto la Municipalidad accionada como el Ministerio de Salud, deberán coordinar entre sí y ejercer las acciones necesarias para darle una solución efectiva a dicha problemática.

En todo caso, los dueños de las propiedades en el Residencial citado, incluyendo la recurrente, deben cumplir las órdenes sanitarias giradas por el Ministerio de Salud..." (el subrayo y la negrita no son del original) y es que continuando con las obligaciones y competencias en temas como el analizado, la misma Sala Constitucional en la resolución 2020020109 de las nueve horas veinticinco minutos del veinte de octubre de dos mil veinte, acotó en lo de interés: "III.- SOBRE LAS COMPETENCIAS Y OBLIGACIONES DE LAS MUNICIPALIDADES. Respecto a los reclamos incoados por el recurrente, en primer término, corresponde indicar que este Tribunal, en su jurisprudencia, ha reconocido la obligación de las Municipalidades de ejecutar acciones eficaces y céleres en función de las necesidades de la circunscripción territorial asignada a cada corporación municipal, y que se encuentra íntimamente ligado al elemento de población.

Tales obligaciones, derivan de lo contemplado en los artículos 169 y 170, de la Constitución Política, siendo que abarca un amplio número de actividades. Así, en sentencias N° 2011-12886 de las 12:44 horas de 23 de setiembre de 2011 y N° 2015010541 de las 09:20 horas de 17 de julio de 2015, entre otras, esta Sala indicó: “(…) conforme lo establece el artículo 169 de la Constitución Política y el Código Municipal, corresponde a las municipalidades la administración de los servicios e intereses locales, con el fin de promover el desarrollo integral de los cantones en armonía con el desarrollo nacional. En consecuencia, la Municipalidad debe establecer una política integral de planeamiento urbano de acuerdo con la ley respectiva, que persiga el desarrollo eficiente y armónico de los centros urbanos y que garantice -al menos- eficientes servicios de electrificación y de comunicación; buenos sistemas de provisión de agua potable y evacuación de aguas servidas, adecuados sistemas de acueductos y alcantarillado, sistemas de iluminación y ornato de las ciudades; servicios de construcción, reparación y limpieza de calles y otras vías públicas; en general planes concretos y prácticos para hacer confortable y segura la vida de la población”.

Además, en materia de prestación de servicios, esta Sala ha señalado –v. gr. sentencia N° 2016-000427 de las 09:30 horas de 15 de enero de 2016- que el buen funcionamiento de estos corresponde a un derecho fundamental. Esto, a partir del contenido de los artículos 139, 140 y 191 de la Constitución Política. Esto se traduce en la obligación de las distintas Administraciones Públicas de prestar servicios de forma continua, regular, célere, eficaz y eficiente. Asimismo, de la parte orgánica de la Carta Fundamental, se erigen una serie de principios de la organización y función de la Administración, los cuales han sido desarrollados por normas infra constitucionales, tales como la Ley General de la Administración Pública, que en sus artículos 4, 225, párrafo 1 y 269, párrafo 1, impone el deber de los órganos del Estado, de orientar y nutrir la organización y la función administrativa. Así, el principio de eficacia supone que la organización administrativa está diseñada para la obtención de objetivos y fines asignados por el propio ordenamiento jurídico, lo que obliga la existencia de planificación y rendición de cuentas.

Por su parte, la eficiencia implica la obtención de los mejores resultados con el uso racional de los recursos con los que cuentan las diferentes dependencias. Asimismo, se impone a la Administración el principio de simplicidad, el cual se debe entender como la obligación de que las estructuras administrativas y sus competencias sean de fácil comprensión, sin procedimientos complejos que retarden la satisfacción de los intereses públicos. El principio de celeridad, impone la obligación a las Administraciones Públicas a cumplir con sus objetivos y fines, de la forma más expedita, rápida y acertada posible, para evitar retardos indebidos e injustificados. Así, estos principios imponen una serie de exigencias, responsabilidades y deberes permanentes a todos los entes públicos..." (el resaltado no es del original). Es así como la Municipalidad recurrida, debe ejecutar acciones eficaces y eficientes para atender las necesidades de su cantón, entre las que destacan; buenos sistemas de provisión de agua potable y evacuación de aguas servidas, adecuados sistemas de acueductos y alcantarillado, sistemas de iluminación y ornato de las ciudades; servicios de construcción, reparación y limpieza de calles y otras vías públicas; en general planes concretos y prácticos para hacer confortable y segura la vida de la población, acciones que en el caso concreto se echan de menos.

En tercer lugar y en estrecha vinculación con las labores de vigilancia del Gobierno Local sobre las infraestructuras por construir y construidas en predios privados, es dable destacar que contenido de los siguientes artículos de la Ley de Construcciones (Ley número 833 del 02 de noviembre de 1949), imponen claros deberes a la Municipalidad de Curridabat en el contexto del caso concreto valorado en esta resolución, al respecto se transcriben los numerales de interés: "Artículo 14.- Cuando un predio de propiedad particular que dé acceso a predios colindantes esté abandonado o sea motivo de insalubridad, inseguridad o simplemente molestia, la Municipalidad ordenará a los propietarios de ese predio y de los colindantes que hagan desaparecer esos motivos. De no dar cumplimiento en el plazo que se les fije, el Municipio se hará cargo de la transformación del predio que sirva de paso en la vía pública que tenga la anchura, servicios y demás requisitos exigidos por las leyes y reglamentos en vigor.

El importe de estas obras será pagado conjuntamente por el propietario del predio que sirve de paso y por los colindantes.". Norma que permite concluir, que la Municipalidad tiene la potestad pública suficiente cuando así lo detecte de previo, para exigir a los dueños de un predio privado que corrijan situaciones de molestia, inseguridad o insalubridad que genere a otros predios públicos, privados y al ambiente en general. Es importante destacar que la Municipalidad puede hacer de propia mano las mejoras al predio y cobrar los gastos al propietario. Por su parte el numeral 17 señala: "Artículo 17.- Tipos de Edificación. La Municipalidad está facultada para exigir determinada calidad de materiales en las edificaciones, así como la clase o tipo de ellas, en los fraccionamientos o zonas de replanificaciónes que por su categoría o por la importancia de zonas inmediatas, deban presentar un concurso armónico y deban ser de calidad durable".

En estrecha vinculación con la norma anterior, si se logra acreditar que una determinada edificación genera algún tipo de afectación a los vecinos de orden ambiental o de cualquier naturaleza, bien puede exigir al propietario determinados materiales en la construcción o bien, exigir un determinado tipo de construcción. En dicho entendido, una deficiente estructura de ingeniería civil que canalice aguas negras o grises en forma no idónea, o bien en forma diferente a como fue proyectado en la respectiva licencia constructiva, es competencia Municipal ordenar los cambios al propietario, en su defecto, en aplicación conjunta del artículo 14 y 17 citados de la Ley de Construcciones, la Municipalidad tiene el deber y la potestad de restablecer la armonía urbanística de un predio contaminante y cobrar los gastos al propietario. No es cierto que el restablecimiento de condiciones de salubridad derivadas de obrar constructivas en un predio, son competencia exclusiva del Ministerio de Salud, la Municipalidad de Curridabat, tal como sucede en el caso bajo estudio, debe intervenir, entender que la aplicación y observancia de la Constitución Política es un deber tanto de sujetos privados como de sujetos de Derecho Público, máxime si tal observancia se desprende de las potestades de control y vigilancia urbanística de la Municipalidad de Curridabat, en armonía con las propias resoluciones emitidas por la Sala Constitucional y que se transcriben en el punto segundo de este considerando, por virtud de las cuales, debe velar por el Derecho a la Salud, el Derecho a la Vida, al Ambiente Sano y Equilibrado, máxime cuando dichos Derechos Fundamentales pueden ser afectados por las unidades constructivas en predio público o privado; sobre las cuales, el Gobierno Local tiene competencias claras de autorización de construcción, inspección y funcionamiento con posterioridad al aviso de finalización de obra.

Para lo cual incluso tiene herramientas jurídicas sancionatorias en caso de incumplimiento, conforme se muestra en los siguientes artículos de la norma de referencia: "Artículo 33- Sanciones La Municipalidad impondrá multas de cinco (5%) a diez por ciento (10%) de un salario base, calculado conforme a lo dispuesto en el artículo 2 de la Ley N.º 7337, de 5 de mayo de 1993, por las infracciones a las reglas de este capítulo y ordenará el desmantelamiento y retiro, a costa del propietario, de anuncios y estructuras relativas que considere inconvenientes o peligrosas". De lo anterior se concluye que la Municipalidad de Curridabat tiene potestad para ordenar el desmantelamiento y retiro, a costa del propietario de estructuras constructivas civiles que considere inconvenientes o peligrosas, como bien lo es un vertido sin control, sin armonía urbanística ni ambiental de aguas residuales contaminadas.

"CAPITULO XX INSPECCIÓN Artículo 87.-La municipalidad ejercerá vigilancia sobre las obras que se ejecuten en su jurisdicción, así como sobre el uso que se les dé. Además, tendrá la misión de vigilar la observancia de los preceptos de esta Ley...". Con fundamento en dicha norma, es claro que a una Municipalidad no solo le corresponde eventualmente conceder una licencia urbanística constructiva, sino también velar porque haya coherencia entre la obra autorizada y la obra realmente construida. Pero ahora bien, adicional a lo indicado, la Municipalidad tiene responsabilidad pública de velar por el uso que se dé a la obras sobre las cuales autorizó su construcción, máxime si la infraestructura de ingeniería civil o de arquitectura no es idónea o presenta problemas de funcionamiento o deficiente planificación, que dé como resultado la afectación de predios vecinos por la inadecuada canalización y procesamiento de aguas residuales.

En concreto la Municipalidad debe intervenir, ordenar al propietario realizar las obras, o en su defecto realizarlas y cobrar al propietario los gastos generados en procura del restablecimiento del Principio de Armonía del Derecho Urbanístico, el cual orienta a que las intervenciones municipales deben darse en el contexto de la ciencia y la técnica, conforme a los artículos 16 y 160 de la Ley General de la Administración Pública, de forma tal que exista el menor impacto ambiental y afectaciones a personas y predios vecinos. Por su parte y continuando con las sanciones, el artículo 88 señala: "Artículo 88.- Facultades. La Municipalidad puede imponer sanciones por las infracciones a las reglas de este Ordenamiento. Las sanciones serán las que se han especificado en el cuerpo de esta Ley y su Reglamento (multas, clausuras, desocupación, destrucción de la obra, etc.) y los que señala este Capítulo".

Véase como respaldo de lo indicado, que ante infraestructuras que se acrediten son dañinas con el ambiente y con el derecho a la salud y la vida de las personas, la Municipalidad puede imponer sanciones, tales como multas, desocupaciones, incluso la destrucción de una obra civil de canalización de aguas residuales contaminadas que afecten a las personas y al ambiente en general. No depende el Gobierno Local del Ministerio de Salud ni de ningún otro órgano para velar por el ambiente y por la idoneidad técnica de las construcciones realizadas en su jurisdicción territorial. Recuérdese que la Municipalidad tiene autonomía en el ámbito esencial de sus competencias y territorio, garantizada por la Constitución Política, el Código Municipal y la copiosa jurisprudencia de la Sala Constitucional. En esta misma línea, establece la Ley de Construcciones:"Artículo 89.- Infracciones. Se considerarán infracciones además de las señaladas en los Capítulos de este Ordenamiento, las siguientes: a) Ejecutar sin licencia previa, obras para las cuales esta ley y su reglamento exigen la licencia. b) Ejecutar obras amparadas por una licencia de plazo vencido. c)Ejecutar una obra modificando en parte o radicalmente el proyecto respectivo aprobado. d) Ejecutar, sin la debida protección, obras que pongan en peligro la vida o las propiedades. e) No enviar oportunamente a la Municipalidad los informes de datos que se previenen en diferentes Capítulos del Reglamento. f) No dar aviso a la Municipalidad de suspensión o terminación de obras. g) No obedecer órdenes sobre modificaciones, suspensión o destrucción de obras de la Municipalidad. h) Usar indebidamente la vía pública. i) Usar indebidamente los servicios públicos. j) Ocupar o usar una construcción antes de haber dado aviso de la terminación de la obra. k) Impedir o estorbar a los Inspectores cumplir su cometido" (el subrayo no es del original).

Véase por ejemplo, que en el orden de ideas expuesto, la Municipalidad de oficio o bien a gestión de parte debe intervenir cuando se dan situaciones de falta de idoneidad o bien mal funcionamiento de construcciones civiles en predios públicos o privados, cuando estos afecten a vecinos o al ambiente, para lo cual si se determina algún tipo de irregularidad, puede exigir al propietario que haga las reparaciones y mejoras (al igual que exige a los munícipes arreglar las aceras, o bien cancelar los tributos municipales); y en su defecto, realizar las obras en forma directa y cobrar los gastos al propietario. Incluso, conforme al inciso g) del artículo 89 arriba citado la Municipalidad puede considerar como infracción que un propietario de un predio privado cuando no obedezca órdenes de modificación, suspensión o destrucción de obras que le ha dado la Municipalidad. Los supuestos son muchos, dentro de los cuales se destaca: la falta de estabilidad estructural de una obra civil; contaminación; inobservancia de las reglas de zonificación; daños al ambiente; inobservancia del porcentaje de cobertura constructiva del terreno; construcciones sin permiso; construcciones sin la supervisión de n ingeniero civil debidamente colegiado y responsable de la obra; construcciones sobre la vía y el demanio público; construcciones ilegales sobre la Zona Marítimo Terrestre, entre otros.

Es decir, la Municipalidad debe intervenir, cuando las obras de construcción civil sobre bienes inmuebles afectan a terceros, al ambiente, al derecho de circulación y al demanio público. En relación con lo recientemente indicado; destaca el cuerpo normativo de referencia: "Artículo 95.- Si el propietario presenta el proyecto respectivo y una vez que sea aceptado, la Municipalidad comprobará si la obra ha sido ejecutada de acuerdo con él y si ambos satisfacen los requisitos exigidos por esta Ley y su Reglamento sometiéndolo a las pruebas necesarias". Norma que permite concluir que el gobierno local, en todo momento puede y debe vigilar en forma oficiosa o a solicitud de parte si la obra civil construida sobre un inmueble fue ejecutada en los términos de la licencia constructiva urbanística, para lo cual podrá realizar las pruebas e inspecciones que fueran necesarias, respecto del funcionamiento de la instalación eléctrica, la idoneidad de la instalación hidráulica, ancho de columnas, vigas, varilla y calidad del cemento y materiales en general, así como el correcto cause sanitario de las aguas residuales.

Nótese, que la Municipalidad no puede declinar su servicio, tanto debe inspeccionar una obra por construir, cuando tramita la licencia y durante su ejecución, sino que también, conforme al fundamento dado, debe velar mientras el inmueble, exista sin sujeción a ningún plazo ordenatorio o restrictivo, que toda construcción en un inmueble funcione bien, toda vez que la potestad de inspección, control, sanción, corrección demolición, por el mal uso, desgaste, mala planificación de una construcción es imprescriptible, irrenunciable e indelegable, conforme al artículo 66 de la Ley General de la Administración Pública, en el tanto sean las construcciones y su impacto en las personas y el ambiente, potencialmente dañinas y carentes de armonía urbanística. En ese orden de consideraciones observa este despacho, que la Municipalidad recurrida no ha sido conteste ni clara en los diferentes actos administrativos comunicados a la parte recurrente, sobre el debido abordaje del tema denunciado, como se indicó en varios actos administrativo se le señala que la situación denunciada ha sido puesta en conocimiento del Área Rectora del Ministerio de Salud correspondiente y que se le dará seguimiento a dichas gestiones, sin embargo, posteriormente, se contradice y refiere que lo señalado en dichos actos son errores y que no se ha remitido ninguna gestión, por lo que se determina que las incongruencias presentadas, no le proporcionan a la parte recurrente una atención debida de su gestión y por ende, no se ha resuelto debidamente el reclamo planteado.

Incluso como bien lo señala la parte recurrente, indica el acto impugnado que los acontecimientos denunciados al ser realizados en propiedad privada deben solucionarlo directamente el recurrente (imagen 114 de los autos), pareciendo obviar, la Municipalidad de Curridabat las obligaciones que se le establecen de manera constitucional y legal, en cuanto a la ordenación urbanística y que además tiene que ver con la verificación del cumplimiento de la materia urbanística en cuanto a las obras de infraestructura necesarias y de ser el caso, establecer los procedimientos pertinentes para revisar y supervisar en el ámbito de sus competencias, si el problema denunciado se debe a deficiencias de construcciones u otras, mismas que deben ser acordes con la normativa constructiva legal y reglamentaria establecida. Debe recordar la Municipalidad de Curridabat, que es su deber planificar y vigilar el desarrollo urbano de su localidad, lo que incluye el deber de establecer una política integral de planeamiento urbano, que garantice un desarrollo urbanístico en congruencia con el funcionamiento eficiente de un sistema de provisión de agua potable y de recolección, tratamiento y disposición final de las aguas residuales, así como la obligación de adoptar las medidas requeridas para proveer al cantón de un adecuado sistema de alcantarillado sanitario y pluvial, a fin de garantizar a sus habitantes el derecho a la salud y a un ambiente libre de contaminación.

Si bien se coincide con el ente municipal, en el entendido que existen competencias que legalmente son otorgadas a otros entes como el Instituto Costarricense de Acueductos y Alcantarillados y el Ministerio de Salud, ello no exime al ente Municipal del cumplimiento de las obligaciones señaladas dentro del ámbito de sus competencias. Así las cosas, se declara con lugar el recurso de apelación interpuesto, en consecuencia se declara la nulidad de la resolución MC-ALC-RS-0046-05-2022 de las catorce horas cincuenta y cuatro minutos del diecinueve de mayo del año dos mil veintidós emitida por la Alcaldía Municipal de Curridabat. Devuélvase el expediente a la Municipalidad de origen, para que proceda a resolver dentro del ámbito de sus competencias, el reclamo administrativo planteado por la parte recurrente el día 04 de marzo del año 2022, con la debida fundamentación y pruebas correspondientes en que se base la resolución que se emita finalmente.-

IV. DE LA DEVOLUCIÓN DEL EXPEDIENTE

Al haberse sustanciado esta sede en forma electrónica, queda a disposición de las partes obtener una copia integral que contiene tanto el expediente administrativo remitido por la Corporación Municipal así como la totalidad de las piezas que conforman la presente alzada, para lo cual deberá aportar el dispositivo electrónico de almacenamiento (llave maya o disco compacto). Asimismo, en caso que hubiere ingresado documentación física o electrónica (planos, fotografías, informes, etc.) que permanezca aún en custodia el Despacho, podrá retirarla quien la aportó en un plazo de 30 días hábiles, de conformidad con lo dispuesto en el artículo 12 del Reglamento sobre Expediente Electrónico ante el Poder Judicial, aprobado por la Corte Plena en sesión n.° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial n.° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión n.° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.-

POR TANTO

Se rechaza la prueba para mejor resolver ofrecida por la parte recurrente. Se declara Con Lugar el recurso de apelación interpuesto, en consecuencia se declara la nulidad de la resolución impugnada. Devuélvase el expediente a la Municipalidad de origen, para que proceda a resolver dentro del ámbito de sus competencias, el reclamo administrativo planteado por la parte recurrente el día 04 de marzo del año 2022, con la debida fundamentación y pruebas correspondientes en que se base la resolución que se emita finalmente.
