BACKGROUND

WHEREAS:
I.Allegations of the plaintiff: The plaintiff alleged that he owns a property with the following characteristics: Province: Limón Property: [Valor 008] Duplicate: Horizontal: Right: 001 Segregations: none, Nature: Lot 269-139 for agriculture, located in District 2 Batan, Canton 5 Matina, Province of Limón, Boundaries: North: Road, South: Porfirio Espinoza, East: Emanuel Araya, West: Porfirio Espinoza, area: fifteen thousand six hundred thirty-five square meters and forty-seven square decimeters, SURVEY PLAN: [Valor 006]. He states that the property is located precisely at [...]. He alleges that the property contains a large number of timber and fruit-tree species. He states that there is no current permit for tree cutting (tala de árboles) on that property issued by the Ministry of Environment and Energy. He indicates that the property borders Route 32 and, therefore, an area of 1982 square meters will be expropriated and used for its widening.
He referred to expediente 20-0013-1028-CA. He clarifies, however, that as of the filing of this action, the grant of possession (puesta en posesión) of the property had not been authorized, nor had the payment of any amount as compensation for expropriation been authorized. He maintains that the plaintiff did not authorize CONAVI or CHEC to perform work of any kind on the property. He explains that during the first months of 2019, the plaintiff had not been notified in any manner of the existence of any expropriation proceeding involving his property. Nevertheless, while reiterating that he was never notified by CONAVI, he learned informally that an engineer from CHEC, the company responsible for widening that route, was seeking the owners of the properties so that they could provide formal permission to enter and clear them without having to await the expropriation proceeding. That was how the engineer contacted him and told him that he had to approach them and begin the process of determining the exact area that would be expropriated from him.
Once he was provided with the foregoing information, the plaintiff went to his property to conduct a field inspection and discovered that the property had already been entered and disturbed by CHEC without his permission, to the point that CHEC had created an enormous embankment (talud) that physically prevents him from entering it, as may be seen in the photographs and videos contained in the record, which is also documented by the attached topographic report and the testimony of the witnesses offered. To enter, the plaintiff must request authorization from the adjoining neighbor, since access from Route 32 was no longer possible. It was also confirmed that a large number of timber and fruit trees had been cut down and piled on his property and that the site’s original topography had been altered with heavy construction machinery, leaving evidence of extensive earthworks (movimientos de tierra) and causing impacts not only within the area that might eventually be expropriated, but also within an additional area of nearly seven hundred square meters.
See the attached photographs and videos submitted to the record, as well as the topographic survey report prepared on 5 de marzo del presente año. He maintains that since CHEC’s intervention, the plaintiff has been unable to enter the property and, as its owner, has been unable to exercise and enjoy his property right, including the performance of ordinary activities such as entering by vehicle, carrying out clearing work, and planting plants of any species. He explains that upon learning of the foregoing, the plaintiff sought out the persons responsible for both companies, as well as CONAVI, in order to report what had occurred and demand that they accept responsibility for the evident unlawful occupation and damage to his property. When he subsequently met with representatives of those companies and CONAVI, they told him that his property had indeed been entered illegally using CHEC machinery due to a lack of knowledge of Costa Rica’s legal system, since CHEC’s representatives are citizens of Chinese origin who were unaware that they had to await authorization from the property owner.
They also told him that, before entering the property, they did not even have a forest inventory (inventario forestal) of the affected area and that, despite the tree cutting that had occurred, they failed to prepare such an inventory. As a result of the complaints, on 19 de abril del año anterior, at CHEC’s request and with CONAVI’s knowledge, Environmental Manager (Regente Ambiental) Luis Meneses Valverde, CDG. CIA 2233, prepared a report—which is already in the record—on the environmental damage caused by CHEC on the property, following a field investigation, expressly acknowledging therein the environmental damage caused by that company as follows: “Introduction: This study is the economic valuation of the environmental damage caused by the company CHEC on part of the property (approximately 0,30 hectares), registered under real-property folio of the Province of Limón N° [Valor 008], with cadastral survey plan N° [Valor 006], owned by Mr. [Nombre 001], identity card N° [Valor 007], by cutting 30 trees of 12 different species outside the right-of-way in the widening of National Route N°32.” He states that the same study specifies that at least 30 species were cut down by CHEC, taking into account that the study was based on an examination of the trunks and roots from which the number of trees formerly present there could be reconstructed, though not precisely.
He maintains that on 12 de junio del año anterior, the plaintiff participated in a meeting with CHEC and CONAVI officials, at which he expressed his concern about the environmental and personal harm caused by their physical actions (actuaciones materiales). At that meeting, they agreed that no further work would be performed on the property until the grant of possession was formally authorized in the pending expropriation proceeding. However, the plaintiff immediately went to his property and confirmed that earthworks had again been performed there, expanding the environmental damage through the execution of major works without regard for the vegetation, wildlife, and trees existing on the property, as shown in the attached videos and photographs. He adds that, concerned about the situation described, the plaintiff filed an application for a precautionary measure (medida cautelar) before this jurisdiction.
Although the application was denied, the court found that CHEC had entered his property and caused the resulting damage to his land, a situation that led the judge to issue a warning to the defendants herein. Accordingly, Voto Nº 551-2019-T, issued at dieciséis horas del día veintitrés de octubre de dos mil diecinueve, stated: “With respect to the alleged property damage, it must be stated that it is not a disputed fact in this precautionary proceeding that machinery belonging to the co-defendant company entered the property at issue (removal of vegetation cover (cobertura vegetal), tree cutting, and earthworks), although no specific date has been established, but that this occurred between January, February, and March of this year and subsequently between June and July, when an incident of a smaller scale, but apparently of the same nature, occurred, as follows from the complaint, the answers thereto, the numerous submissions filed in October of this year, and the documentary evidence visible in images 54 to 67, 308, 311 to 313, 318 to 320, 324 to 326, and 336 to 338 of the court record, as well as the 36 photographs and six videos on three compact discs attached to the digital record…
In any event, in view of the foregoing and without prejudice to the manner in which this matter is decided, the co-defendants are strongly admonished and urged not to engage in conduct such as that reported, and to respect the applicable body of law and private property.” The following are presented: “Considerations regarding the damages (daños y perjuicios) caused by the defendants: CAUSE OF THE DAMAGES: This action seeks compensation for the damages caused to my principal by CONAVI’s and CHEC’s physical actions or omissions, which caused and continue to cause serious damage to his property, impairing his legitimate enjoyment of the right to property and, consequently, his estate. The event giving rise to liability consisted, in CHEC’s case, of entering private property on at least two occasions—see the cited judgment, which finds it proven that this occurred during the first months of the preceding year, as well as in June and July of that same year—and exercising complete control over it, causing serious damage without the prior authorization of its lawful owner, and violating the legal system by disregarding the provisions of the Expropriation Law (Ley de Expropiaciones), which establishes that entry onto such property may occur only when expressly authorized by the owner or when the grant of possession is ordered by the competent judicial authority, regardless of a project’s urgency and necessity.
In CONAVI’s case, there was an evident breach of its duty of oversight, since it was the administrative authority entrusted with supervising the Contract for the Widening of Route 32. Its omission enabled CHEC to act in the highly arbitrary manner that it did, to my principal’s detriment, and it failed to discharge its obligation to ensure that CHEC’s actions concerning entry onto private property were carried out as required by the Ley de Expropiaciones. Instead, CONAVI merely watched passively as CHEC proceeded to enter the private property, with no evidence of timely intervention on its part to prevent the contractor from continuing its unlawful conduct; as explained, the contractor did not intervene on only one occasion, but repeated its conduct months later on my principal’s property, as the judge who heard the application for a precautionary measure found proven. This gives rise to joint and several liability (responsabilidad solidaria) on the part of CONAVI together with CHEC, because CONAVI has a duty to ensure that the contract is performed in compliance with the legal system in force.
As may be seen from the evidence submitted by CONAVI itself, its officials participated in meetings at which the damage that had occurred was discussed with my principal and CHEC, yet there is no indication of any action to sanction CHEC’s conduct or to prevent it from again intervening on the property, as occurred during the months of June of the preceding year, as described in the cited judgment. Both CONAVI and the contractor CHEC have demonstrated their disregard for the legal system by failing to respect the right to property and the adverse effects upon the right to a healthy and ecologically balanced environment, entering again and again to perform work without a prior forest inventory, without notice of the expropriation proceeding, without a judgment in that proceeding, and without my principal’s authorization, at least as already indicated. As Your Honor may observe from the evidence already submitted, MINAE states that there is no permit whatsoever to cut trees on my principal’s property and that, despite this, flagrant environmental damage was caused by proceeding to cut down all the existing trees.
NATURE OF THE DAMAGES: CHEC’s actions, as well as CONAVI’s omissions, have caused serious injury to my principal’s legal position, consisting of the damage caused by the unauthorized entries onto his property, which have substantially impaired its value through the destruction carried out and have caused my principal pecuniary and non-pecuniary damage (daños patrimoniales y morales).
CHEC arbitrarily enters the property and takes full control of it as though it were the owner, bringing in heavy machinery to destroy at will everything that existed there. CHEC decides to indiscriminately deforest all existing trees without even having a forest inventory (inventario forestal). CHEC destroyed the existing access to the property, making it impossible ever again to enter it either by vehicle or on foot because of the embankment (talud) it constructed in front of the property. CHEC, not content with violating the rule of law and the sacred constitutional right to private property, encroaches upon an area larger than the one that may eventually be expropriated, approximately 700 square meters, causing damage such as deforestation and alteration of vegetation and, in short, destroying everything located on that property. CHEC decides to fell the trees and subsequently dispose at will of most of the felled species for a use unknown to my principal, depriving him of that right as the lawful owner.
PECUNIARY DAMAGE CAUSED: By arbitrarily entering the property and taking full control of it as though it were the owner, bringing in heavy machinery to destroy at will everything that existed there, CHEC completely devalued my property, leaving it in a state of total deterioration. This is because its first action consisted of creating an embankment approximately 12 meters high that, since CHEC’s first intervention, has prevented access to the property, a condition that persists to this day. Likewise, an area larger—almost 700 meters—than the area to be expropriated was disturbed, and it was completely destroyed. This is demonstrated by the attached expert report (informe pericial), prepared by Engineer Jimmy Madrigal Mora IT-28958, dated 5 de marzo del presente año, which states: “A comparison of the boundary line fronting the public road shown on the survey plan with the area used by the company to carry out the earthworks (movimiento de tierra) shows that the work performed directly affects the property of Mr. [Nombre 001], because work was carried out not only within the right-of-way (derecho de vía) shown on the plan, but also within the land intended to be expropriated.
Of the stakes placed by the entity seeking to expropriate the land, according to the property owner, five were located that make it possible to determine that the area to be expropriated is approximately 2660 square meters, taking into account the road width shown on the plan. The applicant is advised that, in addition to the direct impact, because the area worked on belongs to him, it is also important for the competent entity to assess the indirect impact on the remainder of the land. This is due to the formation of the embankment fronting the public road, which prevents direct access to the property and limited our work until permission to enter through the adjoining property on the east side was requested from and granted by its owner. However, according to the registered survey plan (plano catastrado) and the deed, the property has access only from its frontage on the public road and not through any neighboring property, a circumstance that could result in considerable depreciation of the asset.
It should be noted that, following the work performed, the embankment on the property rises more than 12.50 meters above the public road, without taking into account any additional increase resulting from full use of the portion intended to be expropriated. It is observed that, unless work is performed to remedy the existing access deficiencies affecting the property, the use of this land for any income-generating activity could be rendered impossible. In conclusion, the area where the material-moving work was performed constitutes a direct impact on the interested party’s property, because work was performed not only in the area designated on the plans as the right-of-way of the national highway, but also in the area intended to be expropriated. Furthermore, the remainder of the property was indirectly affected by restricting access to it and jeopardizing its value in the event of a potential sale.
It is therefore important to request that the entity responsible for appraisals, in the event of a potential expropriation, assess not only the land being considered for expropriation but also the impact on the remainder of Mr. [Nombre 001]’s property, which shows evident depreciation due to the residual damage caused by the work performed at the site.” In summary, the damage caused to the property and assets of my principal is as follows: CHEC destroyed the existing access to the property, making it impossible ever again to enter it either by vehicle or on foot because of the embankment it constructed in front of the property. CHEC decides to indiscriminately deforest all existing trees without even having a forest inventory. CHEC, not content with violating the rule of law and the sacred constitutional right to private property, encroaches upon an area larger than the one that may eventually be expropriated, approximately 700 square meters, causing damage such as deforestation and alteration of vegetation and, in short, destroying everything located on that property.
CHEC decides to fell the trees and subsequently dispose at will of most of the felled species for a use unknown to my principal, depriving him of that right as the lawful owner. CHEC destroys the property and deprives it of all use and market value, making it impossible to exploit, sell, or mortgage because the embankment prevents access to it; moreover, it destroyed practically the entire frontage of the property, turning the remainder—more than 80 %—into a landlocked parcel (fundo enclavado) devoid of any value. As for CONAVI, as stated above, it merely stood by passively while CHEC encroached upon the private property, with no evidence of timely intervention on its part to prevent the contractor’s unlawful conduct (sic) from continuing. As explained, the contractor did not intervene on only one occasion but returned to the property of my principal months later, as found proven by the judge who heard the application for interim relief (medida cautelar).
This renders CONAVI jointly and severally liable (responsabilidad solidaria) with CHEC because it has a duty to ensure that the contract is performed in compliance with the legal system in force. It is clear that, had CONAVI acted promptly in accordance with its obligations, the damage to my principal’s property would not have occurred. NON-PECUNIARY DAMAGE (DAÑO MORAL): The current situation has caused my principal severe subjective non-pecuniary harm (daño moral subjetivo) due to the destruction of the property, which he received as a gift from his grandmother and which is a family asset of great value to his family. This has caused my principal emotional distress resulting from the pain and emotional suffering caused by the unlawful administrative conduct at issue in the present proceeding, which he has endured since the first such administrative act occurred with the initial intervention during the first months of the previous year.
Since that time, he has suffered an entirely unjust disruption of his emotional well-being, associated with discouragement, distress, despair, and injury to his honor and dignity. That is, since learning of the damage sustained by the property as a result of CHEC’s actions, I have experienced constant, unrelenting, stressful distress because this placed my assets and those of my family at risk, given that the donated asset was an asset of great value whose value would obviously increase with the expansion of Route 32. The capital appreciation (plusvalía) would have been evident; now, however, everything has changed because of the defendants’ actions, and the family is left with an asset that is destroyed, unusable, and currently without market value due to the condition in which CHEC left the property after its disastrous and unlawful intervention. Another equally important consideration is that this property constituted half of my principal’s assets, as he owns only one other property in Cantón de Pococí.
The case law of our courts consistently recognizes this type of harm, as shown by the following judicial decisions, the first of which was issued by this Court: Resolution 120 at una hora cuarenta minutos on 16 de mayo de 2011 of the Tribunal Contencioso Administrativo Sección VI [...] For its part, the Sala Primera has defined this type of harm, among other decisions, in Resolution 000206-F-S1-2009 at dieciséis horas veinte minutos on veintiséis de febrero de dos mil nueve. [...]. Under the cited case law, it follows that all the elements required for this type of harm to be recognized as such are present in my principal’s case: it is therefore certain, actual, assessable, and individualized. The certain harm already sustained—entry onto the property without my principal’s authorization; construction of an embankment preventing all forms of access; use of heavy machinery that completely destroyed the area, extending almost 700 meters beyond the portion to be expropriated; felling of trees; removal of the trees, making the timber unavailable for use; and leaving the remainder of the property as a landlocked parcel—makes it real, that is, actual and financially assessable, based on expert studies determining the value of the property before CHEC reduced it to its destroyed condition and its current value, since it can be assessed economically.
It is also “individualized,” because the parties responsible have been clearly identified as CHEC and CONAVI, from whom I am entitled to demand reparation for the harm caused and who shall be jointly and severally liable for that damage. Seventy percent of the damages must be paid by CHEC and thirty percent by CONAVI. LOSSES (PERJUICIOS): The defendants’ actions have caused a loss in the property’s future value and in the value of its use since CHEC’s first intervention, leaving the property entirely unusable. Since the first months of the previous year, it has been impossible to enter the property; consequently, it cannot be used for any kind of agriculture or construction, nor can it be mortgaged or sold. AMOUNT IN CONTROVERSY Because of its special nature, this action is not susceptible to monetary valuation. Without prejudice to the foregoing, based on the expert studies that will be submitted in due course, I prudently estimate this action for damages and losses (daños y perjuicios) at [Valor 001] million colones, itemized as follows: 1.- Damage inflicted upon the property by the construction of an embankment preventing access to and full use of the property since the first months of the year 2019: [Valor 003], million colones
II.CONAVI’s Arguments: CONAVI denied the allegations in the complaint and raised the following defenses: “1. DEFENSE OF LACK OF LEGAL RIGHT: a) Act of a third party; lack of causal nexus (nexo causal). The plaintiff seeks compensation for damages (daños y perjuicios) allegedly caused by CONAVI’s and CHEC’s physical acts or omissions, which allegedly caused, and continue to cause, severe damage to his property, impairing his legitimate enjoyment of the right to property and, consequently, his assets, a situation that is not attributable to this Council for the following reasons: By Law No. 9293 dated 10 de marzo de 2015, financing was approved for the rehabilitation and extension project for National Route Nº 32, Route 4 Intersection–Limón section. On 18 de febrero de 2013, Eng. Pedro Castro, in his dual capacity as Minister of Public Works and Transportation and President of the Board of Directors, signed a memorandum with CHINA HARBOUR ENGINEERING COMPANY DE COSTA RICA SOCIEDAD ANONIMA (VOLUME I Folios 81 to 82 and annex at folio 83 to 144 of the administrative record, Project: “Design, Rehabilitation, and Widening of National Route Nº32, Braulio Carrillo Highway, Section: Intersection with National Route Nº 4 (Sarapiquí–Limón Junction),” which provided that the contractor must obtain the following Insurance and Liability policies.
“[...] Civil liability insurance: THE COMPANY shall be required to obtain a policy from the Instituto Nacional de Seguros (INS) or from any duly authorized civil liability insurer covering liability attributable to the insured (THE COMPANY) for injury or death to third parties or damage to third-party property; ...” [...]. Subsequently, the Consejo Nacional de Vialidad entered into a contract with CHINA HARBOUR ENGINEERING COMPANY DE COSTA RICA SOCIEDAD ANONIMA, which was endorsed by the Contraloría General de la República through official letter No. 5662-2016, and which established the contractor’s general obligations in General Conditions point 4.1, subsection 3. [...]. 4.1. General obligations of the contractor. In addition to the obligations set forth in the memorandum of agreement for the Design, Rehabilitation, and Widening of National Route 32, Braulio Carrillo Highway, section at the intersection with National Route 4 (Sarapiquí–Limón Junction), and its annexes, the contractor shall have, among others, the following obligations: 1 (...) 3.
The contractor shall be liable for all losses, expenses, and claims for loss or damages sustained by tangible property, and for injuries and death occurring as a result of its own acts or omissions in the performance of the contract being executed ...” [...]. Additionally, point 39 of the supplementary obligations specified that the contractor must comply with all laws in force in the Republic of Costa Rica, stating as follows: 39. The Contractor shall comply with all laws in force in the Republic of Costa Rica; those laws shall include all local, state, national, or other laws affecting performance of the Contract and binding upon the Contractor. The Contractor shall indemnify the Employer against all liability for damages, claims, fines, penalties, and expenses of any kind arising from or resulting from the violation of those laws by the Contractor or its personnel, including Subcontractors and their personnel. [...] Points 4.12 and 4.16 of the contract then established the contractor’s liability as follows: 4.12.
Non-interference. The contractor shall not interfere unnecessarily or improperly with: a) the convenience of the public; b) access to, use of, and occupancy of all roads and paths, regardless of whether they are public or in the possession of the Employer or others. The Contractor shall indemnify and hold the Employer harmless from all damages and expenses (including attorneys’ fees and expenses) arising from any such unnecessary or improper interference. 4.16. Environmental Protection (Compliance with environmental approval (Viabilidad Ambiental) and its obligations. The contractor shall faithfully comply with the provisions of the Environmental Legislation of the Republic of Costa Rica; accordingly, it shall take all necessary measures to protect the environment (both within and outside the Work Site) and to prevent environmental damage and disturbances that its operations may cause to persons and property. [...] In addition to the foregoing, by official letter UE-DRA-RN32-002-2017-119 (2199) dated 14 de junio de 2017, CONAVI diligently informed CHEC’s legal representative of the procedure that had to be completed for tree cutting (corta de árboles) before the construction stage began. [...] Likewise, through official letter UE-DRA-RN32-001-2017-321 (855) dated 25 de octubre de 2017, Project Manager Mr.
Zhou Jingxiong was informed of the coordination efforts with the Sistema Nacional de Áreas de Conservación (SINAC) to develope (sic) the protocol for the procedures associated with the tree cutting (sic) required by the project, and the draft protocol was forwarded to him. Service Order No. 3 dated 16 de noviembre de 2017 authorized the construction stage to begin as of 20 de noviembre de 2017. [...] Through official letter UE-DRA-RN32-001-2017-333 (855) dated 01 de noviembre de 2017, Project Manager Mr. Zhou Jingxiong was advised regarding environmental monitoring and that he had to update the documentation based on (sic) the resolition (sic) 2207-2016 SETENA granting environmental approval before work commenced. [...]. Subsequently, through official letter UE-DRA-RN32-002-2018-104 (855) dated 02 de marzo de 2018, Project Manager Mr. Zhou Jingxiong was advised regarding environmental monitoring; the relevant portion reads as follows: “In connection with the commencement of the Tree Cutting to be performed by the company you represent [...] It should be recalled that this work may not begin until all required permits have been obtaned (sic)... [...].
Then, through official letter UE-DRA-RN32-002-2018-104 (855) dated 02 de marzo de 2018, Project Manager Mr. Zhou Jingxiong was notified regarding tree cutting, and and (sic) the provisions of point 4.16. of the contractor’s supplementary obligations were reiterated to him; he was further advised that “The forest inventory (inventario forestal) is an indispensable technical input for the ‘Tree-Cutting Permit,’ a permit which, pursuant to point 10 (c) of the Contract scope document ...” [...]. It follows from the foregoing that, should any damage exist, the liable party is not the Consejo Nacional de Vialidad but CHEC, as provided in the memorandum, the contract, and their addenda. CONAVI was not only diligent in advising the contractor of the various procedures and legal requirements, but did so sufficiently in advance. It Is (sic) necessary to state that CHEC attempted to reach an agreement with Mr. [Name 001] to compensate him in accordance with the inventory prepared by Eng.
Luis Femando Meneses Valverde, and even proposed restoring the land to its original condition using the company’s machinery; however, the owner stated that “...he is not interested because he does not want to depend on CHEC’s schedule and prefers to do it whenever he wishes.” In addition to the foregoing, CHEC proposed paying rent for the affected land from the time the machinery entered the land until julio de 2019 and immediately carrying out the improvement work on the land,” but Mr. [Name 001] did not accept the proposal, stating that he preferred the money. Note that CHEC attempted to provide a solution to the problem; however, the property owner was interested only in money, which clearly demonstrates that the owner’s interest is purely economic and that CHEC understands and accepts that it is solely responsible for the alleged damages claimed. Furthermore, the existence of environmental damage (daño ambiental) is denied because the project has environmental approval granted by the Ministry of Environment and Energy, the National Environmental Technical Secretariat, through Resolution Nº 2207-2016-SETENA at 15 hours 30 minutes on 02 de diciembre del 2016; therefore, this would constitute an environmental impact (impacto ambiental), which arises when environmental approval exists because the possible occurrence of a particular event, such as the felling of trees, has already been anticipated.
The plaintiff seeks compensation for alleged moral and material damages arising from CHEC’s alleged cutting of certain trees on his property, which must be proven in these proceedings. With respect to the causal relationship (relación de causalidad), there must be a connection, and the harm caused is an indispensable condition for imposing the duty to compensate for that harm; compensation is warranted only when the evidence establishes the causal nexus with certainty. In the present case, the plaintiff fails to submit the evidence necessary to establish the causal nexus with the alleged harm and the nexus with the Administration, particularly since the plaintiff himself states that the alleged encroachment onto the land was carried out by CHINA HARBOUR ENGINEERING COMPANY DE COSTA RICA SOCIEDAD ANONIMA (CHEC). 2. DEFENSE OF LACK OF STANDING (FALTA DE LEGITIMACIÓN): This defense is raised because, as the plaintiff himself states, the alleged encroachment upon the property was committed by CHINA HARBOUR ENGINEERING COMPANY DE COSTA RICA SOCIEDAD ANONIMA (CHEC), and pursuant to the contract, addenda, and supplementary documentation, should any damage or loss occur, the company shall be liable for it.
Moreover, the property for which damages are claimed was duly expropriated and possession thereof had already been delivered to the Ministerio de Obras Públicas y Transportes by notice issued at fifteen hours and twenty-eight minutes on treinta de abril de 2020, corresponding to Case File 20-000013-1028-CA-0” (Boldface and underlining are ours). It requests that the plaintiff be ordered to pay the costs of these proceedings, as well as the corresponding interest.
III.Arguments of the State: It opposed the complaint and, with respect to the facts, clarified that: “The State has decided to expropriate an area of land measuring one thousand nine hundred eighty-two square meters (1,982.00 metros cuadrados), according to cadastral plan Nº [Valor 009], which forms part of the property registered in the Limón Registry District, Real Property Folio Registration [Valor 010]. Said expropriation is being processed before the Juzgado Contencioso Administrativo under expediente N° 20-13-1208-CA, in which entry into possession of the strip to be expropriated has already been authorized and disbursement of the amount of the administrative appraisal (avalúo administrativo) has been ordered. [...] First, we have no knowledge of the alleged encroachment upon the plaintiff’s property, nor that the alleged damages were caused. In this regard, the co-defendants have stated and submitted evidence establishing that work was being performed within the right-of-way (derecho de vía).
Second, according to the evidence in the record, we have no knowledge that the work performed by China Harbour Engineering Company de Costa Rica Sociedad Anónima (hereinafter CHEC) prevents access to the plaintiff’s property, since access was provided through a small side entrance to the property. In this regard, according to administrative appraisal N° SABI-2019-117 del 12 de agosto del 2019, appearing at folios 44 al 59 of the expropriation proceeding, it can be seen that the plaintiff’s land is situated 4-5 metros above the level of the public road and that there was no access from the front of the lot, as shown in the photographs appearing at folio 51 of that proceeding. [...] Third, it is denied that work was carried out over an area larger than the area subject to expropriation, as is the cutting of trees in the manner and dimensions described by the plaintiff. Finally, without prejudice to the foregoing, it is clear that the alleged acts and encroachment reported by the claimant were carried out directly by CHEC, as contractor for the work currently being performed, and that there were no acts or omissions by the Consejo Nacional de Vialidad (hereinafter CONAVI) or by the State in this case. [...]” (emphasis added).
The relief sought by the plaintiff was opposed, and the following defenses (excepciones) were asserted: “I. Lack of a right of action and lack of standing (falta de derecho y falta de legitimación): Title Seven of the Ley General de la Administración Pública governs matters related to government liability (responsabilidad de la Administración). Section 190 of that title provides that the Administration shall be liable and answer for all harm caused by its lawful, unlawful, normal, or abnormal operation. Three essential elements must be present for such liability to arise:
Accordingly, in view of the complete absence of evidence supporting and substantiating the damages sought, that claim for relief is inadmissible and must be denied by this Court” (underlining and boldface added). It requests that the action be dismissed in its entirety, with the plaintiff ordered to pay both costs and attorney’s fees, as well as any interest accrued thereon until paid in full.
IV.Arguments of the co-defendant company CHEC: It states that the property at issue in the proceedings is held through rights and that the plaintiff holds only bare ownership (nuda propiedad). It clarifies that the expropriation proceedings (proceso expropiatorio) concerning the plaintiff’s property are being conducted before the Contentious-Administrative Court (Juzgado Contencioso) under case file Nº20-0013-1028-CA, in which disbursement of the amount of the administrative appraisal (avalúo administrativo) was authorized and, by an order issued at 15:28 hours on 30 de abril de 2020, taking possession of the property was authorized 2 months after service of notice, with the area to be expropriated measuring 1.982,00 square meters. It states that the construction work performed by CHEC was carried out within the State-owned right-of-way (derecho de vía), which is 50 meters wide in front of Mr. [Nombre 001]’s property, and that, to date, no construction work has been performed on the plaintiff’s property.
It alleges that the plaintiff has confused the right-of-way with his property. It reiterated that the construction work was performed entirely within the right-of-way and that no slope (talud) has been created on Mr. [Nombre 001]’s property. Nor is it true that there was an access point to Mr. [Nombre 001]’s property that was affected. Although Mr. [Nombre 001]’s property fronts Route 32, it had no constructed access road. On the contrary, the portion of the right-of-way that was worked on was not level with the highway. It was necessary to remove a large amount of earth to clear the right-of-way and form the temporary slope. Once possession of the expropriated land is taken, it will be necessary to continue the earthworks (movimiento de tierra) and form the permanent slope. It states that all the work and activities performed are contemplated in the Environmental Impact Study (Estudio de Impacto Ambiental) as part of the Environmental Impact Assessment (Evaluación de Impacto Ambiental) process that resulted in Secretaría Técnica Nacional Ambiental granting environmental feasibility approval (viabilidad ambiental).
The project area assessed consists of what is called the Project Area (Área de Proyecto, AP), comprising the fifty-meter-wide right-of-way and the areas to be expropriated; the Project’s Direct Area of Influence (Área de Influencia Directa del Proyecto), comprising the next fifty meters adjacent to the right-of-way; and the Project’s Indirect Area of Influence (Área de Influencia Indirecta del Proyecto), comprising the 250 meters adjacent to the Direct Area of Influence. Accordingly, the felling of trees and any earthworks that may be required on the expropriated land are authorized from an environmental standpoint under the environmental feasibility approval. It clarified that it is not true that Mr. Luis Meneses is the project’s environmental manager (regente ambiental), or that fruit trees or commercially important tree species were affected. It denied that the plaintiff’s property had been usurped.
It maintains that it is not true that CHEC performed any construction work on Mr. [Nombre 001]’s property. It clarifies that one of the activities performed before undertaking any construction work on a highway is the felling of trees. It was expressly acknowledged that CHEC did fell trees within the right-of-way in abril del 2019. In addition, because of an error by workers who were unable to distinguish the boundary marking of the right-of-way from that of the area to be expropriated, CHEC felled trees within the expropriated area. It is also true that Mr. [Nombre 001] met with CHEC representatives, specifically Engineer Luis León, and that CHEC undertook to instruct its workers and operators not to perform any further activity on his land. In junio del 2019, CHEC completed the earth-removal and slope-forming work, but all of it was within the right-of-way. No activity was performed on the expropriated land or on the property of which Mr. [Nombre 001] is the bare owner.
It was stated that it is not true that forestry engineer Luis Meneses is the project’s environmental manager. It was admitted as true that CHEC asked forestry engineer Luis Meneses to conduct a rapid review of the area and, using a methodology that assumed the existence of environmental damage (daño ambiental), determine the amount required for full remediation (reparación integral), even though such remediation was not warranted, in order to establish an objective benchmark for compensating Mr. [Nombre 001]. This was done despite the fact that the area was to be expropriated and that, under the Environmental Impact Study, CHEC is authorized to perform construction activities within the expropriated area. On that basis, Mr. [Nombre 001] was offered compensation even higher than the amount indicated in the report prepared by Engineer Luis Meneses, which Mr. [Nombre 001] rejected. It states that the report prepared by forestry engineer Luis Meneses is not evidence of the damage caused because it is based on a series of assumptions and therefore reaches conclusions that are not accurate, since those assumptions were proposed by CHEC in good faith to facilitate negotiations aimed at avoiding litigation and expediting the taking of possession, which was not achieved.
It was admitted that, on 12 de junio, it held a meeting with Mr. [Nombre 001] and representatives of Consejo Nacional de Vialidad. At that meeting, CHEC again undertook to perform activities solely within the right-of-way. In fact, since the incident involving the trees in abril del 2019, no further activity had been performed on Mr. [Nombre 001]’s property. After the meeting, Mr. [Nombre 001] had a telephone conversation with the general supervisor of CHEC’s Branch 1, Mr. Luis Yogseng León Villagra, whom he told that work was again being performed on his property. Mr. Luis León explained that no work was being performed on his property, but rather that work was being done to form the temporary slope within the right-of-way, which is 50 meters wide in total. It is absolutely false that earthworks were performed on Mr. [Nombre 001]’s property, that environmental damage was caused, or that the vegetation, wildlife, and trees existing on Mr. [Nombre 001]’s property were affected.
There was and is no forest, forest plantation, or fruit-tree plantation on the strip of land at issue. It adds that it is true that Mr. [Nombre 001] sought interim relief (vía cautelar) and that his application was denied, but it is not true that damage to his property was proven. The damage must be proven in the ordinary proceedings (procedimiento ordinario). It raised the following defenses on the merits (excepciones de fondo): “Lack of standing to be compensated for environmental damage (Falta de legitimación activa para ser indemnizado por daño ambiental): The right to a healthy environment has been recognized as a fundamental right, the impairment of which may affect not only one person but, by its very nature, the community. For that reason, standing in this area tends to be extended and broadened based on the doctrine of diffuse interests (intereses difusos), under which the original standing of a person with a legitimate interest, or even a mere interest, extends to all members of a particular category of persons who are thus equally affected by the unlawful acts that violate those interests.
Accordingly, virtually any person may pursue administrative and judicial remedies in response to an act or omission by any natural or legal person, whether private or public, that threatens to cause environmental damage. This was incorporated into the Ley de Biodiversidad in Article 105, by granting every person standing to bring proceedings before administrative or judicial authorities in defense of biodiversity. However, because protection of the right to the environment is a matter of public interest and, in many cases, the affected environmental element is in the public domain, standing to claim compensation for environmental damage is restricted; otherwise, it would mean accepting the possibility that a private party could represent the public interest in matters of compensation. Mr. [Nombre 001] confuses ‘procedural standing (legitimación procesal) (which permits a claim to be filed) with the substantive right (derecho de fondo) (the relief sought), which must specifically exist in order to obtain a favorable decision, and the damage caused to the community does not entail the automatic existence of personal damage or standing to claim compensation for it’ (Voto 834-2015 de la Sala Primera de la Corte Suprema de Justicia).
Therefore, although national legislation grants broad standing to bring proceedings, it does not grant equally broad standing to receive the amount of compensation: ‘Thus, despite the breadth of standing to claim environmental damage, compensation for collective damage may not be awarded to the specific private or public persons who filed the claim. The party entitled to receive it is the State (represented by the PGR) or those expressly designated by law. Compensation for indirect impairment of private property or interests (individually sustained damage) may be claimed only by the person who sustained it and who, under the ordinary rules of liability, is entitled to compensation’ (Tribunal Contencioso Administrativo. Sentencia Nº 00045 -2016 del 06 de Mayo del 2016). Although the complaint does not clearly state what the environmental damage consists of, its factual allegations refer to the report prepared by forestry engineer Luis Meneses, and another document containing estimates of environmental damage for which compensation is sought was also submitted.
Both reports combine economic estimates of the damage that may have been individually sustained by Mr. [Nombre 001] with other estimates that, although unwarranted, as will be demonstrated in these proceedings, would properly pertain to compensation for collective damage. Nevertheless, the only body with standing to claim compensation for collective damage is Procuraduría General de la República, in its capacity as representative of the State, as provided by Articles 1, 3.a) and 3.i) of Ley Orgánica de la Procuraduría General de la República, and Ley Forestal states in Article 58 [...]. It is clear from the foregoing that the plaintiff lacks standing to request compensation for the alleged environmental damage insofar as its collective elements are concerned, such as environmental services (servicios ambientales), because by law such representation belongs exclusively to Procuraduría General de la República.
Defense of failure to state a substantive right (Excepción de Falta de derecho): (...) 1. The claims for compensation. As a preliminary matter, it must be reiterated that we deny the existence of any causative event that could be considered to have caused any damage. The plaintiff’s subjective view that CHEC ‘destroyed’ his property is entirely unfounded, because the actions of my client were carried out entirely within the right-of-way; it is therefore incorrect to consider that it exceeded the geographical scope of the work it is performing. Nor does the complaint explain—or even identify—the basis for attributing subjective civil liability (responsabilidad civil subjetiva) under which CHEC would allegedly be liable. It must be recalled that CHEC is a private-law entity, and therefore the plaintiff must prove the basis of attribution or subjective attribution factor that would justify CHEC’s alleged civil liability; that basis must be substantiated by the party seeking compensation such as that sought by the plaintiff.
The connotation of the term ‘destroy’ may mislead the Court because it gives the statement a negative meaning, suggesting that this involves serious damage or hardship that should not have to be endured.
When, in reality, actions have been carried out that, from an objective standpoint, cannot be regarded as arbitrary interference, but rather as the legitimate exercise of an activity in the public interest—namely, the execution of public works of vital importance to the State—on land legally owned or possessed by the State. a. Absence of the alleged property damage (daño patrimonial): The plaintiff recklessly asserts that our client caused property damage that rendered the property registered in the Province of Limón [Valor 008], in which the plaintiff holds right 001 over the entirety of the bare ownership (nuda propiedad), practically unusable. [...] Although in the present case the contentious-administrative court has ancillary jurisdiction (fuero de atracción) because a public entity is a party to the proceedings, for CHEC to incur the liability attributed to it by the plaintiff, the plaintiff would have to conclusively prove that an act infringing upon his rights and interests was committed, that there is an actual causal relationship (relación de causalidad) between our client’s actions and the occurrence of that damage, and that those actions were performed intentionally or negligently (dolosa o culposa).
The plaintiff would also have to prove the amount of that injury, and there must not be an appropriate, specialized procedural avenue for litigating such matters. [...] (ii) The damage alleged by the plaintiff has not occurred [...] The plaintiff merely recounts a series of events interspersed with personal opinions. He does not demonstrate how the work performed by CHEC within the right-of-way (derecho de vía) could have affected the property in which he holds bare title (nudatario). He fails to establish the existence of a causal relationship, and it is clear that there is only one reason for this deficiency. No such damage exists, nor is there any possible causal nexus (nexo causal) between that damage, had it occurred, and the work performed by CHEC. (iii) CHEC has not acted intentionally or negligently. Although this is a contentious-administrative proceeding (proceso contencioso administrativo), CHEC is a party in its capacity as a third party maintaining a contractual relationship with the State.
It is participating in this proceeding because of the ancillary jurisdiction provided for in the Contentious-Administrative Procedure Code (Código Procesal Contencioso Administrativo). Nevertheless, it has not lost its status as a private-law entity (sujeto de Derecho Privado), and the substantive rules applicable to such natural and legal persons therefore apply to it. Articles 190 et seq. of the General Public Administration Act (Ley General de la Administración Pública) set forth the requirements for determining the liability of the Public Administration and its officials. Those provisions establish strict liability (responsabilidad objetiva) for the Administration, which is liable to third parties for all damage caused by its lawful or unlawful, normal or abnormal operation. Conversely, unlike that sphere of strict liability, a public official’s liability is fault-based (responsabilidad subjetiva), because it is founded on the existence of intentional or negligent conduct causing damage to a third party or to the Administration. [...] In the present case, CHEC has operated within the right-of-way and carried out the engineering work necessary to restore and use it for the widening of Route 32.
Our client is acting as a State contractor, complying with the obligations assumed under the contract in accordance with the designs prepared and the schedule agreed upon with the State. The plaintiff has submitted no evidence showing that any of CHEC’s construction work was performed with the intention of affecting the property in which the plaintiff holds bare title, or that CHEC used improper methods, incorrect plans, or unsuitable machinery to carry out (sic) the work. He has not demonstrated that the personnel responsible for the work were negligently selected or supervised. The plaintiff relies on mere presumptions, which cannot support the imposition of liability on CHEC. On the contrary, my client has acted in full compliance with construction best practices, attending to every detail to prevent the development of an important public work from causing those subject to the Administration any greater inconvenience than they must inevitably tolerate during the construction of infrastructure such as this. [...]” It continues, stating essentially as follows: b. Absence of environmental damage (daño ambiental): It asserts that “CHEC has in good faith acknowledged its responsibility for the cutting of trees in the area to be expropriated, which is very different from there having been an impact on the local fauna and flora and extensive environmental damage.
Both during negotiations with Mr. [Nombre 001] and in the precautionary-measures proceeding (medida cautelar), CHEC acknowledged that it mistakenly cut the 30 trees identified in the document prepared by forestry engineer Luis Meneses. However, that action is entirely separate and distinct from the earthworks (movimientos de tierra) performed within the right-of-way. As is well known, when a road is being built, once all engineering work has been completed—topographic surveys, forest inventories, designs, and field staking—one of the first activities undertaken is vegetation clearing and tree cutting. Those activities do not require earthmoving machinery; rather, the trees are cut and gathered at a location from which a truck subsequently collects and transports them to sites authorized by SETENA for disposal of that material. Tree cutting is likewise performed in sections. In other words, the road is 107 kilometers long, so it is divided into several sections, each several kilometers in length, for purposes of performing the work.
In the case of the tree cutting carried out for the right-of-way passing in front of [Nombre 001]’s property, work was being performed on all properties located between the Madre Dios River and the Barbilla River, that is, within an area extending slightly more than 5 kilometers. [...] With respect to Mr. [Nombre 001]’s property, CHEC has acknowledged that it did cut 30 trees located in the area to be expropriated and has therefore agreed to pay the stumpage value (valor en pie) of the timber. Nevertheless, at no time did it perform earthworks or cause any greater impact on Mr. [Nombre 001]’s property. Nor has there been environmental damage as such. It should be noted that the document prepared for CHEC by engineer Luis Meneses clearly states: ‘I must clarify that this tree cutting is covered by the Environmental Feasibility (Viabilidad Ambiental) approved by SETENA for the widening of National Route Nº 32.’ Likewise, the document omits any reference to the type of ecosystem present at the site or to the intended use of that already-expropriated land, which [Nombre 001] himself has acknowledged will become part of the road. [...]” c. Absence of non-pecuniary damage (daño moral): It alleges that “it appears that what is sought is compensation for property damage disguised as non-pecuniary damage, since the complaint merely states that this property is of great value to his family, without explaining the basis for that assertion. [...] Finally, it must be emphasized that, because there is no detailed and coherent line of argument identifying the event that allegedly gave rise to this damage or these forms of damage, and because no causal link has been demonstrated, this part of the claim must be dismissed.” d. Regarding the apportionment of damages: “We cannot fail to address the arbitrary and unsupported apportionment asserted by the plaintiff, under which he assigns a 70/30 ratio to the allocation of civil liability.
The joint-and-several liability regime (responsabilidad solidaria), which governs non-contractual civil liability (responsabilidad civil extracontractual) pursuant to Article 1046 of the Civil Code (Código Civil) and Article 201 of the General Public Administration Act, provides that the obligation to compensate is joint and several among the participants. Accordingly, because no legal basis can be found to support the plaintiff’s request, the claim must be rejected and the existing statutory regime applied.” It is maintained that some of the claims asserted properly belong in the expropriation proceeding (procedimiento de expropiación), to which the plaintiff is a party as the holder of bare title to the property at issue. Matters such as the extent of the area to be expropriated, the effect that this may have on the property’s value, and the impact on the remainder not expropriated are factors that will determine the fair compensation (justiprecio) that the State must pay the owner to compensate for the property loss resulting from the expropriation.
This is clearly established in Articles 29, 30, 39 et seq. of the Comprehensive Reform of Act Nº 7495, Expropriations Act Nº 9286 (Reforma integral de la ley Nº 7495, Ley de Expropiaciones Nº 9286), as well as Article 110.4 of the Organic Law of the Judiciary (Ley Orgánica del Poder Judicial). e. Absence of consequential damages (perjuicios): In this regard, it was alleged: “Likewise, we emphatically reject the plaintiff’s scant and confusing arguments concerning the alleged consequential damages. Principally, he alleges a future loss of increased property value (plusvalía), which he does not even attempt to prove, given the impossibility of doing so. There is no evidence of any certain future damage that all this activity will cause him, since there is not even any basis for finding actual and present damage; and because future damage can only be a consequence of present damage, this claim for compensation cannot be granted.” Lastly, an “Objection to the valuation (estimación)” is raised: “We object to the valuation of the complaint because it is a confusing calculation, as indicated in the opening lines of this answer.
In addition, there is in any event a lack of proportionality, as well as a lack of specificity and technical substantiation for the monetary amount in dispute, which are sufficient grounds for objecting to the valuation submitted by the plaintiff.” It requests that the complaint be dismissed and that the plaintiff be ordered to pay both categories of costs (ambas costas).
V.Regarding the evidence offered to assist the court in reaching a decision: During the preliminary hearing, the co-defendant company CHEC offered documentary evidence to assist the court in reaching a decision, appearing in images 398 through 422 of the judicial case file and consisting of documentation submitted in expropriation proceeding Nº20-00013-1028-CA before the Juzgado Contencioso Administrativo y Civil de Hacienda. Accordingly, the Case Management Judge granted all parties an opportunity to respond in writing and reserved the issue of admissibility for the Trial Court pursuant to numeral 50 subsection 2) of the Código Procesal Contencioso Administrativo. The State’s counsel addressed the evidence offered in a brief dated 14 de julio de 2023, appearing in image 431 of the main case file. Additionally, during the oral and public trial, the plaintiff offered evidence to assist the court in reaching a decision, consisting of photographs taken in junio 2024 to show the current condition of the property following completion of the infrastructure works in the expropriated area.
He states that this evidence is useful in providing a realistic and definitive view of the slope (talud) facing the road, which physically prevents pedestrian and vehicular access to the property, rendering it unusable land (fundo inutilizable). The Court granted the defendants an oral opportunity to respond and reserved the issue of admissibility pursuant to numeral 50 CPCA. With respect to the discretionary admission of evidence to assist the court in reaching a decision, it is the settled position of the case law of the Sala Primera de la Corte Suprema de Justicia that rejection of such evidence does not leave the parties without a defense (see decisions Nº547-F-S1-2002 and Nº29-F-S1-1995, both of the Sala Primera de la Corte Suprema de Justicia). As to the evidence offered by CHEC to assist the court in reaching a decision, it is admitted because it constitutes an update of documents from expropriation case file Nº20-00013-1028-CA before the Juzgado Contencioso Administrativo y Civil de Hacienda, since this evidence was admitted during the preliminary hearing.
The photographs offered by the plaintiff as evidence to assist the court in reaching a decision are rejected because they lack usefulness and relevance to the subject matter of the proceedings for purposes of deciding the merits of this matter, as they are not connected to the facts underlying the claim or to the historical time when those facts occurred.
VI.Proven facts. The following facts have been established as relevant to these proceedings:
VII.Regarding unproven facts: The following facts relevant to resolving this matter were not established: 1- That the co-defendant company CHEC constructed a slope on the plaintiff’s property before possession of the expropriated strip was granted. 2- That the co-defendant company CHEC destroyed the access to the plaintiff’s property. 3- That the co-defendant CHEC destroyed the property and rendered it devoid of use and market value, such that it could not be sold or mortgaged because it was landlocked property. 4- That the plaintiff conducted activities involving the productive use of the property and the timber located on it. 5- That the updated commercial value of the timber felled within the plaintiff’s property was determined. 6- That CONAVI committed breaches and omissions of its duty to supervise and monitor the contractor CHEC.
VIII.On the strict liability (responsabilidad objetiva) of the Public Administration: To impose liability on the Public Administration, it is necessary to establish, together with actual, effective, and individually ascertainable damage, the causal nexus (nexo causal) with the administrative conduct alleged to have caused the damage, pursuant to Article 190 of the Ley General de la Administración Pública. The term administrative conduct (conducta administrativa) encompasses all forms in which the will of the Public Administration is manifested, whether material actions (actuaciones materiales), which are those not supported by an administrative act or mere ordinary activity; omission-based conduct (conducta omisiva), meaning the failure to do something required by the body of law (bloque de legalidad); or formal conduct (conducta formal), meaning the administrative act itself. Accordingly, four elements must be present, namely: a) An injury (lesión), consisting of unlawful economic losses because the person suffering them has no duty to bear them; b) administrative conduct connected with the occurrence of the alleged damage; b) a causal nexus, consisting of a direct cause-and-effect relationship between the alleged event (administrative conduct) and the damage caused; and c) The absence of grounds of justification (causas de justificación), since their existence may legally sever the connection between the loss caused and the conduct of the Public Administration, such that the harmful effect is not attributable to it, breaking the chain of causation upon the occurrence of an exonerating circumstance (situación eximente), such as force majeure (fuerza mayor), fault of the victim (culpa de la víctima), or the act of a third party (hecho de un tercero).
The regime governing the State’s and its institutions’ financial liability (responsabilidad patrimonial), established in Articles 9 and 41 of the Constitución Política and Articles 190 et seq. of the Ley General de la Administración Pública, is therefore essentially strict in nature, such that liability arises upon the existence of compensable damage (daño indemnizable), administrative conduct, and a causal nexus between them. There is a clear need to demonstrate the existence of a relationship between the damage claimed and the conduct undertaken by the Public Administration—that is, the causal nexus. Legal scholarship has identified various criteria of objective attribution (imputación objetiva), but adequate causation (causalidad adecuada) must be emphasized. Regarding this criterion of causation, the Sala Primera de la Corte Suprema de Justicia, in its decision 251-F-06 at 10 hours 30 minutes on 25 de mayo del 2006, together with the efficient-cause theory (teoría de la causa eficiente), explained:
“XIV.- The causal nexus as a prerequisite for liability. The various categories of causes. (…) it remains to be determined whether the administrative inaction of the Ministerio de Salud, in failing to verify before issuing the health and operating permit whether the bullring complied with the standards established by the Ley General de Salud, was the direct or indirect cause of the damage, given that granting the complaint depends upon demonstrating the existence of a causal nexus, in its traditional cause-and-effect sense. In this regard, it should be recalled that multiple factors frequently contribute to causing damage, among which it is necessary to identify those that are directly or indirectly the efficient and adequate cause of the harm caused (…) Within this convergence of factual or legal elements surrounding the harmful situation, the adjudicator must determine, based on the evidence in the proceedings, whether the specific action consisting of administrative functioning, or the failure to deploy the functional framework imposed by the Legal System, is a cause capable of producing the damage (…)..
In other words, to infer the efficiency of the cause deemed adequate, it is essential to determine whether it produced the injury, such that if it were eliminated, it may rationally be inferred that the damage would not have occurred. This entails an evaluative exercise to exclude from consideration those causes that had no influence whatsoever on the outcome (extraneous causes), and to distinguish them from those whose absence would have prevented the harm. This is a type of objective prognosis through which it may be affirmed that the specific damage would logically or probably result from such action or omission. Under this understanding, the causal nexus constitutes the inescapable relational link between the damage and the administrative conduct, such that without the latter, the former probably would not have occurred. Clearly, determining this factor depends to a considerable degree on examining the evidence submitted in the proceedings by the litigating parties.
From that evidence, the adjudicator may determine whether, within the particular factual circumstances, the State’s actions entail liability because its functioning was associated with causing the injuries.” The Sala Primera endorses the theory of damage causation together with the efficient-cause theory in order to identify the cause having the greatest capacity to produce the damage most effectively, selecting from among all the conditions the one representing the greatest possible contribution to the harmful outcome (the greatest intrinsic power to cause the damage). This seeks to identify the acts or omissions that effectively influenced the harm invoked by the injured party, or that at least support a degree of objective probability regarding their influence on it (an assessment of the probability of the outcome based on facts deemed proven, conducted in accordance with the rules of experience).
In any event, it must be stated that the party invoking it bears the burden of proving the existence of that causal link between the event deemed to have caused the damage and the damage itself. Liability must be determined on the basis of these considerations. In liability for administrative omission (omisión administrativa) or omission-based conduct, the issue analyzed is whether the Public Administration had a legal duty to undertake certain conduct and whether it breached that duty. In such cases of omission, the liability exemptions of force majeure, fault of the victim, and the act of a third party likewise apply; therefore, if any of them is present, the public entity to which the administrative omission is attributed is deemed not legally accountable and, consequently, no liability exists. From the foregoing, it is clear that merely alleging damage is insufficient; its existence and the causal nexus connecting it to the conduct or omission of the responsible entity must be conclusively demonstrated.
IX.On the specific case: The complaint filed constitutes civil proceedings against the State (proceso civil de hacienda), the subject matter of which is limited to the plaintiff’s claim for compensation (pretensión indemnizatoria) arising from the alleged intrusion onto private property before official possession of the expropriated strip was delivered, and from the damage resulting from those material actions. This was established in the decisions resolving the objection for lack of jurisdiction (excepción de incompetencia), specifically Resolution Nº76-2021 at 11:55 hours on 20 de enero de 2021 issued by this Tribunal and Resolution Nº2441-C-S1-2022 at 14:40 hours on 3 de noviembre de 2022 issued by the Sala Primera de la Corte Suprema de Justicia, which stated in relevant part:
“[...] In the case under review, compensation is sought from the defendants on the grounds that they apparently entered the plaintiff’s property unlawfully without yet having the corresponding permits, constructed a slope (talud) on the property, and caused environmental and physical damage that prevented the claimant from entering his property. In accordance with the relief sought, because financial and non-pecuniary liability (responsabilidad patrimonial y moral) is claimed against the State (Article 190 et seq. of the Ley General de la Administración Pública), these proceedings fall within the jurisdiction of the Tribunal de lo Contencioso Administrativo y Civil de Hacienda.” (images 288 to 292 of the court record (expediente judicial). Emphasis added).
It is emphasized that the subject matter of these proceedings does not include any claim for annulment (pretensión anulatoria), any claim related to the expropriation proceedings (proceso expropiatorio), or any items pertaining to just compensation (justiprecio). In light of this clarification, this Tribunal shall rule in strict accordance with the relief sought by the plaintiff and shall refrain from addressing any argument unsupported by a clearly pleaded claim in the complaint. For the foregoing reasons, this Tribunal finds the claims in the complaint partially meritorious, based on the analysis set forth below.
“[...] IV.- ON THE CONSTITUTIONALITY OF SUBSECTION B) OF ARTICLE 2 OF THE LEY DE CONTRATACIÓN ADMINISTRATIVA. Although this action does not directly challenge the exception contained in subsection b) of Article 2 of the Ley de Contratación Administrativa, the fact remains that, before ruling on the constitutionality alleged in this action, it is necessary to analyze that subsection, since it was on the basis of that provision that the direct contracting (contratación directa) referred to in Ley 9293, challenged herein, was authorized. Article 2, subsection b), of the Ley de Contratación Administrativa provides:
“Article 2°.-Exceptions The following activities are excluded from the competitive procedures (procedimientos de concursos) established in this law:
[…]” As stated in the preceding recital (considerando), there are highly exceptional cases in which, for reasons of urgency, necessity, or their nature, the use of competitive or public-bidding procedures (procedimientos licitatorios) obstructs or frustrates the ability to serve the public interest. Exceptions based on urgency or necessity include, for example, cases in which natural events such as earthquakes and floods create a need to contract for the restoration of road infrastructure or the purchase of supplies, among other things, which, because of their urgent nature, cannot await the completion of public-bidding formalities. As for exceptions based on the nature of the act, these encompass international negotiations with other States, which is precisely the exception established by subsection b) of Article 2 of the Ley de Contratación Administrativa. In the opinion of this Chamber, the exception contained in that subsection is constitutionally valid because it concerns contracting within the sphere of Public International Law, which, by virtue of its nature and characteristics, is an autonomous legal order governed by rules and principles different from those of the domestic legal system, including the principles of good faith, reciprocity, sovereignty, freedom of contract, and cooperation, but which is based primarily on the full consent of the States.
Thus, in accordance with those principles, States, through their representatives, may enter into negotiations and conclude cooperation agreements or agreements for the procurement of public works in order to obtain the support, resources, advantages, and conditions offered by international cooperative relations, thereby serving a public interest in an expeditious, efficient, and timely manner. It is clear that, in order to implement and enforce the agreement within the domestic legal system, it must be incorporated through a statutory mandate, which indeed falls within the authority of the Legislative Assembly. Accordingly, because these are negotiations between two entities governed by Public International Law, one State cannot impose its domestic procurement system or the use of public-bidding procedures upon another; rather, this is a matter of consensus between the two States at the time of contracting.
The legislature therefore chose to exclude this type of contracting from the public-bidding procedures established in the Ley de Contratación Administrativa, not only because of the special nature of these acts, but also to avoid hindering and obstructing international cooperative relations with other countries and, consequently, impairing the public interest sought to be served. In any event, it should be recalled that the authorization of direct contracting does not exempt the State from its responsibility to oversee, supervise, and adopt the necessary and timely measures to ensure that the works are performed in accordance with law and the agreement, and in an efficient manner. Under these circumstances, this Chamber finds that the exception contained in subsection b) of Article 2 of the Ley de Contratación Administrativa is consistent with Constitutional Law.
Having analyzed the constitutional conformity of subsection b) of Article 2 of the Ley de Contratación Administrativa, it is appropriate to analyze the provision challenged in this action, namely Ley 9293, in order to determine whether the direct contracting that it governs falls within the exceptional circumstances referred to in the aforementioned subsection b), given that the petitioner’s argument is precisely that the provision directly violates Article 182 of the Political Constitution, which requires a public-bidding procedure for contracting, because, in the petitioner’s view, it authorizes direct contracting with a public enterprise even though that enterprise is neither a State nor an entity governed by international law of the type mentioned in subsection b) of Article 2 of the Ley de Contratación Administrativa, without any public-bidding procedure. Nevertheless, this Chamber observes that Ley 9293 establishes, beginning with its first article, that:
“The Framework Agreement between the Government of the Republic of Costa Rica and the Government of the People’s Republic of China on the Granting of a Preferential Line of Credit by the Chinese Party to the Costa Rican Party is hereby approved.” (Emphasis not in the original) Likewise, pursuant to Article 2 of the same Law, it is established that:
“ARTICLE 2.- Approval of financing. The Supplementary Contract to Increase Coverage, the Concessional Loan Agreement for six hundred twenty-eight million yuan (¥628 million), and the Commercial Loan Agreement and their respective addenda in the amount of two hundred ninety-six million United States dollars (US$296 million), executed between the Government of Costa Rica and the Export-Import Bank of China on 3 de junio de 2013, which finance the Project for the Rehabilitation and Expansion of Route 32, Route 4 Intersection–Limón Section, are hereby approved.
[…]
“Supplementary Contract to Increase Coverage for the PROJECT FOR THE DESIGN, REHABILITATION, AND EXPANSION OF NATIONAL ROUTE NO. 32 Between the Government of the Republic of Costa Rica Represented by the Ministerio de Hacienda as Borrower and the Export-Import Bank of China as Lender This Supplementary Contract to Increase Coverage, hereinafter referred to as ‘this Contract,’ is entered into between the Government of the Republic of Costa Rica, represented by the Ministerio de Hacienda, and the Export-Import Bank of China.
Whereas: ------------------------------------------------------- 1) On 3 de junio del 2013, Consejo Nacional de Vialidad (CONAVI) and China Harbour Engineering Company Ltd. (CHEC) entered into the Commercial Contract (CC) for the implementation of the Project for the Design, Rehabilitation, and Expansion of National Route No. 32 (hereinafter, the ‘Project’), for a total amount of 465,593,387.06 U.S. dollars (US$ Four hundred sixty-five billion five hundred ninety-three thousand three hundred eighty-seven and six cents). The Government of the Republic of Costa Rica (GRCR), represented by the Ministerio de Hacienda (the Borrower), requests a Loan from the Government of the People’s Republic of China (GPRC) to partially finance the Project.[…]” (Emphasis not in the original) In this regard, a plain reading of the challenged law shows, first, that the purpose of the law is, on the one hand, to approve the financing agreed upon between the Government of the People’s Republic of China and the Government of Costa Rica to finance the project for the rehabilitation and expansion of National Route N° 32, Route 4 Intersection–Limón Section, as well as the terms and conditions under which such financing will be carried out.
In this regard, this Chamber observes that, contrary to the claimant’s assertion, the negotiation approved by the challenged law did take place between two States—Costa Rica and China—and not between Costa Rica and an international public enterprise; this situation clearly falls within the exception provided for in subsection b of Article 2 of the Ley de Contratación Administrativa. It is likewise established that the approved financing is for the rehabilitation and expansion of Route 32, a project of clear public interest (interés público), since it is the national route connecting the Capital with the province of Limón and, in addition to being one of the country’s main routes, is of great economic and commercial importance because it constitutes a channel for the transportation and distribution of products and goods unloaded at the port of Moín in Limón. As for the parties involved in the project, as stated in the preceding recital (considerando), from the standpoint of international relations, States, in the exercise of their freedom of contract (autonomía de la voluntad), may agree upon the terms and conditions under which the financing will be carried out, including the designation of the bodies and parties that will physically implement the agreements.
This is all the more true where the financing of public works (obra pública) is involved—as is the case here—because the lending State, like any other creditor, may validly establish certain conditions or requirements to protect its funds and reduce credit risks; it may even select the company that will perform the work, not only in its capacity as creditor but also as part of the agreement reached by both States. In this particular case, it is noted that, as a result of the agreements reached by both Governments, all matters relating to the financing resources will be processed by the Ministerio de Hacienda on behalf of the Government of the Republic of Costa Rica and by the Export-Import Bank of China on behalf of the Government of the People’s Republic of China. As for the performance of the public works for which the financing was requested, both States agreed to designate the Consejo Nacional de Vialidad (CONAVI) on behalf of the Government of Costa Rica and China Harbour Engineering Company Ltd.
(CHEC) on behalf of the Government of China; all of the foregoing was a direct consequence of the negotiations and agreements reached by both States. This is not, therefore, the separate procurement (contratación) of a public enterprise to perform a particular project, but rather one of the points agreed upon between two States in the context of international negotiations. Accordingly, the procurement and involvement of CHEC, mentioned by the claimant and forming the focus of his challenge, is nothing more than the result of the negotiations conducted by the Government of China and the Government of Costa Rica, which, in agreeing upon the terms of the financing, designated the bodies and parties responsible for disbursing and overseeing the funds and those responsible for carrying out the work: in the first case, the Ministerio de Hacienda and the Bank of China, and in the second, CONAVI and China Harbour Engineering Company Ltd.
Consequently, this Chamber finds that the challenged law is not contrary to Article 182 of the Constitución Política, because it concerns one of the prior exceptions expressly and exhaustively authorized by the legislature in Article 2, subsection b), of the Ley de Contratación Administrativa; what the legislature authorized in Ley 9293 is financing agreed upon between States as part of the international cooperation relations between both countries, the purpose of which is to satisfy a public interest. Therefore, the exception from competitive-bidding procedures (procedimientos de licitación) in this case is constitutionally valid. [...]” (Underlining added).
It follows from the foregoing that the contract executed between CONAVI and CHEC falls within a special type of negotiation, governed by specific regulations and terms agreed upon by the contracting parties and subject to mandatory application. Along the same lines, the Contraloría General de la República, through official letter Nº05262 dated 26 de abril de 2016, DCA-1062, granted its endorsement (refrendo) of the contract and Addenda 1, 2, 3 y 4 for the “Project for the Design, Rehabilitation, and Expansion of National Route N° 32, Braulio Carrillo Highway, National Route N° 4 Intersection (Cruce a Sarapiquí)–Limón Section,” executed between the Consejo Nacional de Vialidad and China Harbour Engineering Company Limited and China Harbour Engineering Company de Costa Rica, S.A, for an amount of $[Valor 012], under the lump-sum arrangement (modalidad de suma alzada), emphasizing the distinctive features of this procurement:
“[...] Specifically, regarding the selection of the contractor, China Harbour Engineering Company Limited, it should be noted that its designation as the company responsible for implementing this project was made by the legislature itself through Ley No. 9293, which ‘Approves financing for the project for the rehabilitation and expansion of National Route N° 32, Route 4 Intersection–Limón Section.’ In this regard, as part of the conditions established by the Export-Import Bank of China for granting the financing, it was stipulated that the company responsible for implementing the project had to be a Chinese company. This is documented in DCI-406-13 dated 04 de setiembre del 2013, which shows that, during the negotiations, the Government of the People’s Republic of China itself initially proposed China Harbour Engineering Company Limited to implement the project. As part of the negotiations, our country accepted that designation, which was formalized in a Commercial Agreement and subsequently validated by the legislature through the enactment of Ley No.9293. [...]” (Underlining added).
Regarding Conavi’s liability, the aforementioned endorsement by the Contraloría made specific reference to the issue of expropriations (expropiaciones) of private properties and stated the following:
“[...] Accordingly, the Consejo shall timely structure a strategy for addressing the risk associated with expropriations, within the functions assigned to each party. The foregoing is required because this issue is extremely sensitive to the success of the project and could affect not only construction timelines but also the financing obligations. The Consejo is therefore reminded that it bears sole responsibility for ensuring that the various activities pertaining to this matter are carried out in a timely and efficient manner, by designating those responsible for managing the identified risk and maximizing the possibility of meeting the established dates.
To that end, given the importance of this issue to the project in question, CONAVI shall establish general guidelines for managing the risks inherent in processing the expropriations, with a view to preventing delays in the implementation of the work schedule, particularly its critical path (ruta crítica), and ensuring compliance with the implementation period established by the parties, namely a total of 42 months (an 8-month design stage counted from the design commencement date and a 34-month construction stage counted from the construction commencement date, provided that environmental approval (viabilidad ambiental) granted by Setena is available), as well as ensuring that the parcels (predios) required for carrying out the works are addressed in a timely manner and preventing potential claims by the contractor based on the possibility that such matters could be deemed compensable events (eventos compensables). [...]” (Underlining added).
With regard to the liability of the contractor, CHEC, the contract executed and endorsed by the Contraloría General de la República specifically established a clause under which the contractor assumes exclusive liability for all damage caused to third-party property. That clause remains in force and is fully applicable to the case under review. Specifically, clause 17.1 provides:
“17. Risks and Liabilities. 17.1 Indemnification: The Contractor, as the party responsible for the execution of the Works, shall be liable for every claim, damage, loss, and expense (including attorneys’ fees and expenses) relating to damage to (sic) or loss of any property, whether real or personal, to the extent that such damage or loss occurs as a result of or in the course of the Contractor’s design, execution and completion of the Works, and the repair of any defects. / The Contractor shall be liable to third parties for acts or events arising in connection with its operations, due to the fault, negligence, or lack of skill of its officers or third parties occurring during performance of the subject matter of this contract. The Contractor shall be solely responsible for the occupational risks affecting all its personnel, as well as for any injury, death, or harm to third parties and, additionally, for damage to third-party property, regardless of whether the losses and damages caused by such events exceed the amounts specified in the insurance policies held by the Contractor or its subcontractors” (emphasis added).
In this particular case, the damage caused by the physical act of the company CHEC—entering the plaintiff’s property without his permission and cutting down the trees—was established, and resulted from an inexcusable error caused by the negligence of its officers, who acted without first verifying the location coordinates of the properties for which permission had in fact been obtained from their owners. The foregoing constitutes gross negligence (culpa grave) on the part of the contractor CHEC because of its disregard for private property and the pecuniary damage (daños patrimoniales) caused by cutting down trees without the owner’s permission, for which it must bear full responsibility. The Diccionario Usual del Poder Judicial defines gross negligence as follows: “An extremely high degree of negligence in the performance of obligations. Some legal scholarship, because of the substantial lack of diligence involved, equates gross negligence with willful misconduct. || Total carelessness or absolute disregard for precautions intended to prevent harm. || Inexcusable incompetence.” It is considered that the company CHEC and its officers failed to exercise the minimum necessary diligence when entering private properties to ascertain that they had the owner’s permission or a judicial order placing them in possession (puesta en posesión judicial), as was required and was their duty.
For purposes of determining the updated value of the timber, the matter is referred to the judgment-enforcement phase (Ejecución de Sentencia) so that, with expert assistance, the amount owed for the trees cut down on private property may be quantified in accordance with the inventory prepared by engineer Luis Gerardo Meneses Valverde dated 19 de abril de 2020, shown in images 32 to 36 of the main case file. Payment for reforestation or forestry services for forest maintenance shall not be awarded because it was not established that the plaintiff performed such activities. As to the liability claimed against CONAVI, the alleged breach of the duty to oversee and supervise the contractor CHEC was not established in the case file. Nor did the plaintiff rebut any of the communications issued by the Council to the company Chec for the purpose of informing, communicating, and organizing the execution of the work jointly with the project’s Supervisory Consortium.
In addition, the plaintiff did not argue clearly and sufficiently the alleged breaches by Conavi of its duty to oversee and supervise, nor did he submit the requisite evidence, requiring rejection of this claim. Lastly, the requested percentage-based allocation of liability—70% to the company CHEC and 30% to Conavi—is rejected for lack of any legal basis, since the contractual provision in force and endorsed by the comptroller body assigns the contractor CHEC 100% liability for damage to third-party property, and no contractual provision has been challenged.
IX.Regarding the defenses raised: the defendants raised the defenses of lack of standing (falta de legitimación) and lack of legal entitlement (Falta de Derecho). The State’s lack of passive standing (falta de legitimación pasiva) is sustained because it was established that there was no state conduct involved in the facts alleged in the complaint and that the State’s participation resulted from joinder pursuant to numeral 12 subsection 2) of the CPCA. The lack of active standing (falta de legitimación activa) based on the plaintiff’s status as bare owner (nudatario) is rejected because, pursuant to Article 316 of the Código Civil, the owner of bare title (nuda propiedad) has the authority to claim in court the thing owned by him and the free enjoyment of each and every right encompassed therein. Accordingly, while the usufruct is in effect, the bare owner (nudo propietario) may sell, mortgage, assign, or otherwise transfer his bare title and may perform the acts necessary to preserve the thing.
The bare owner is required to refrain from exercising the right of transformation and from destroying the property or imposing easements (servidumbres) upon it. In addition, Article 363 of the Código Civil provides: “When the property subject to usufruct is expropriated on grounds of public utility, the price of the property shall be invested at interest, and the usufructuary shall enjoy the income for the term for which his right was established,” a circumstance that is not present in the case under review and is therefore inapplicable. The lack of active standing based on environmental damage is rejected because no ruling was issued on that matter, as there was no related claim. Given that the plaintiff is the registered owner of the property at issue, which borders national route 32, and that an agreement for the expansion of that route was entered into between the company CHEC and Conavi, the procedural legal relationship between the parties and the claims asserted in the complaint are established; the defense of lack of standing in both its active and passive forms is therefore rejected.
The Representation of Conavi raised the defense of lack of legal entitlement, which must be sustained because the claims brought against it by the plaintiff were not established. Lastly, the defense of lack of legal entitlement raised by Chec is partially sustained in accordance with the considerations set forth in this Judgment, because the plaintiffs’ claims were granted in part, and the complaint against co-defendant CHEC is declared partially meritorious.
X.Regarding costs. Article 193 of the Code of Administrative Procedure (Código Procesal Contencioso Administrativo) establishes that procedural costs and attorney’s fees (costas procesales y personales) shall be imposed on the losing party solely by virtue of having lost. Relief from such an award is permissible only when, in the Court’s judgment, there was sufficient cause to litigate or when the judgment is rendered on the basis of evidence of which the opposing party was unaware. In this case, no grounds are apparent that would warrant an exception to the rule that costs are awarded against the losing party. Accordingly, both categories of costs in these proceedings are imposed on the co-defendant company CHEC in favor of the plaintiff. No special award of costs is made with respect to the State, because it was legally required to be joined in the proceedings (litis), or with respect to Conavi, because the Court finds that there was sufficient cause to litigate, and each party shall bear its own costs. The amount of the costs shall be determined by the competent judge during the judgment-enforcement phase (fase de ejecución de sentencia), upon application by the defendant.
POR TANTO
The additional evidence for adjudication (prueba para mejor resolver) offered by the co-defendant company CHEC is admitted, and that offered by the plaintiff is rejected. Insofar as the action was brought against the State, the defense of lack of standing to be sued (falta de legitimación pasiva) is upheld, and the complaint is dismissed in its entirety. No ruling is made on the defense of failure to state a legal right (falta de derecho). No special award of costs is made. With respect to the action brought against Consejo Nacional de Vialidad (Conavi), the defense of lack of standing (falta de legitimación), in both of its forms, is rejected, and the defense of failure to state a legal right is upheld. The complaint is dismissed in its entirety. No special award of costs is made. With respect to the action brought against the contractor China Harbour Engineering de C.R. (CHEC), the defense of lack of standing to sue (falta de legitimación activa) is rejected, and the defense of failure to state a legal right is partially upheld.
Consequently, the action filed by Mr. [Name 001] against CHEC is partially granted, with any relief not expressly granted deemed denied: i) CHEC is ordered to pay a total of three million colones to the plaintiff as compensation for subjective emotional harm (daño moral subjetivo). ii) CHEC is ordered to pay the updated value of the trees felled on the plaintiff’s property without his permission and before possession was delivered, according to the inventory prepared by forestry expert Luis Gerardo Meneses Valverde on April 19, 2019, as compensation for economic loss (daño económico); the amount shall be determined during the judgment-enforcement phase with expert assistance. iii) The costs of these proceedings shall be borne by the co-defendant company CHEC in favor of the plaintiff and shall be determined during the Judgment-Enforcement Stage (Etapa de Ejecución de Sentencia).- NOTICE SHALL BE GIVEN.

N° 2024004639 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SECCIÓN CUARTA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las catorce horas con cincuenta y uno minutos del dieciocho de Julio del dos mil venticuatro.- Proceso de conocimiento establecido por el señor [Nombre 001], [...], contra las siguientes partes demandadas: CONSEJO NACIONAL DE VIALIDAD (en adelante CONAVI), representada por su apoderada especial judicial la licenciada Dixa Córdoba Gómez, carné profesional seis mil cuatrocientos setenta y tres, EL ESTADO, representada por su procurador el licenciado Omar Rojas Valverde Cordero, carné profesional veintiún mil doscientos ochenta y nueve y la empresa CHINA HARBOUR ENGINEERING DE C.R. (en adelante CHEC), representada por sus apoderados especiales judiciales los licenciados Raúl Guevara Villalobos, carné profesional diez mil seiscientos y John A. Brenes Rodríguez, carné profesional veintisiete mil sesenta y dos. Figura como apoderado especial judicial de la parte actora el licenciado Donald Picado Angulo, carné profesional nueve mil seiscientos tres.
RESULTANDO
Redacta la Jueza Reyes Castillo;
CONSIDERANDO:
I.Alegatos de la parte actora: La parte actora alegó que es propietario de una finca con las siguientes características: Provincia: Limón Finca: [Valor 008] Duplicado: Horizontal: Derecho: 001 Segregaciones: no hay, Naturaleza: Lote 269-139 para la agricultura, situada en el Distrito 2 Batan, Cantón 5 Matina de la Provincia de Limón, Linderos: Norte: Calle, Sur: Porfirio Espinoza, Este: Emanuel Araya, Oeste: Porfirio Espinoza, mide: quince mil seiscientos treinta y cinco metros con cuarenta y siete decímetros cuadrados, PLANO: [Valor 006]. Señala que dicha propiedad, se ubica, con exactitud de [...]. Alega que la finca contiene una gran cantidad de especies de árboles maderables y frutales. Manifiesta que sobre esa propiedad, no existe permiso vigente para la tala de árboles, otorgado por el Ministerio de Ambiente y Energía. Indica que dicha propiedad colinda con la ruta 32, por lo que un área de 1982 metros cuadrados, va a ser expropiada y utilizada en la ampliación de la misma.
Hizo referencia al expediente 20-0013-1028-CA. Aclara, sin embargo, que, hasta el momento de la interposición de la presente demanda, no se ha autorizado la puesta en posesión de la propiedad y que tampoco se ha autorizado la entrega de monto alguno por concepto de expropiación. Sostiene que el actor no ha dado ninguna autorización para que se realicen trabajos de ninguna naturaleza en la propiedad, ni al Conavi, ni a Chec. Expone que durante los primeros meses del 2019, el actor no había sido notificado en modo alguno, de la existencia de algún proceso expropiatorio sobre su propiedad. No obstante, reiterando que nunca fue notificado por parte del CONAVI, de modo informal, se enteró que un ingeniero de CHEC, como empresa responsable de la ampliación de dicha ruta, andaba en busca de los dueños de las propiedades para que le suministraran un permiso formal para el ingreso y limpieza en las propiedades, sin tener que esperar el proceso de expropiación.
Fue así, como dicho Ingeniero le contacta, y le indica que debía acercarme a ellos, e iniciar el trámite para conocer el área exacta que le iban a expropiar. Que una vez que se le brindó la información indicada anteriormente, el actor se dirige a su propiedad para hacer una inspección de campo, quien descubre que la propiedad ya había sido invadida e intervenida por parte de Chec, sin permiso alguno del mismo, al punto que Chec realizó un enorme talud que le impide materialmente el ingreso a la misma, como puede observarse en las fotografías y videos que obran en el expediente, de lo cual, da cuenta además, el informe topográfico adjunto y el testimonio de los testigos ofrecidos. Para poder ingresar, el actor debe pedir autorización al vecino colindante, siendo que ya no era posible el acceso por la ruta 32. Además, se constata que, una gran cantidad de árboles maderables y frutales, habían sido talados y apilados en su propiedad, amén de haberse afectado la topografía original del lugar con maquinaria pesada de construcción, dejando evidencias de grandes movimientos de tierra, provocando afectaciones no solamente en el área eventualmente a expropiar, sino en un área de casi setecientos metros cuadrados adicionales.
Ver fotografías y videos adjuntos aportados al expediente, así como informe de topografía, realizado en fecha 5 de marzo del presente año. Sostiene que desde el momento de la intervención de CHEC, se le imposibilita el ingreso a la propiedad al actor, sin que pueda como propietario, hacer uso y disfrute de su derecho de propiedad, quedando imposibilitado de realizar tareas habituales como ingresar en vehículo, realizar tareas de limpieza, sembrar plantas de cualquier especie. Explica que al darse cuenta de lo anterior, el actor se dirigió a buscar a los responsables de ambas empresas, así como de CONAVI, con la finalidad de denunciar lo realizado y que se responsabilizaran por la evidente usurpación y afectación de su propiedad. Al reunirse luego con representantes de tales empresas y el CONAVI, le indicaron que, efectivamente, el ingreso a su propiedad fue realizado ilegalmente con maquinaria de CHEC, por desconocimiento del ordenamiento jurídico en Costa Rica, dado que los representantes de CHEC son ciudadanos de origen Chino, que no tenían conocimiento de tener que esperar la autorización del propietario del inmueble.
Asimismo, le indican que antes de hacer la invasión, no contaban al menos con un inventario forestal del área intervenida y que, pese a la tala realizada, omitieron realizar dicho inventario. Que como consecuencia de los reclamos, el 19 de abril del año anterior, a pedido de CHEC y con el conocimiento de CONAVI, el Regente Ambiental, Luis Meneses Valverde, CDG. CIA 2233, realizó un informe –que ya obra en el expediente - sobre el daño ambiental realizado por CHEC en la propiedad, previa investigación de campo, reconociendo expresamente allí los daños ambientales ocasionados por esta empresa, cuando indica: “Presentación: El presente estudio es la valorización económica de los daños ambientales, que ocasionó la empresa CHEC, en parte del fundo (aproximadamente 0,30 hectáreas), inscrita al folio real de la provincia de Limón N° [Valor 008], con plano catastrado N° [Valor 006], propiedad del señor [Nombre 001], cédula de identidad N° [Valor 007], al cortar 30 árboles de 12 diferentes especies fuera del derecho en la ampliación de la ruta nacional N°32”.
Señala que en ese mismo estudio, se detalla que son, al menos, 30 especies, las que fueron taladas por parte de la empresa CHEC, considerando que este estudio se realiza sobre la constatación de aquellos troncos y raíces que permiten reconstruir, sin ser exacto, la cantidad de árboles que allí existía. Sostiene que el 12 de junio del año anterior, el actor participó en una reunión con personeros de CHEC y CONAVI, en la cual manifiesta su preocupación por los daños ambientales y personales causados por sus actuaciones materiales. Allí, estos se comprometieron a no realizar más obras en la propiedad, hasta que no se autorice formalmente la puesta en posesión en el proceso de expropiación que se sigue. Sin embargo, el actor se dirige inmediatamente a su propiedad y constata que nuevamente, se hicieron movimientos de tierras en la misma, expandiendo el daño ambiental, al realizarse obras mayores sin reparar en el respeto a la vegetación, fauna y a los árboles existentes en dicha propiedad, conforme se aprecia de los videos y fotografías adjuntos.
Agrega que preocupado por la situación expuesta, el actor acudió mediante solicitud de medida cautelar ante esta jurisdicción, misma que aunque fue rechazada, tuvo por demostrado la invasión por parte de la empresa CHEC a su propiedad, así como los consecuentes daños causados a su terreno, situación que llevó a la juzgadora a emitir una advertencia contra los aquí demandados. Al efecto, se estableció en el Voto Nº 551-2019-T de las dieciséis horas del día veintitrés de octubre de dos mil diecinueve: “En cuanto al daño material argumentado, debe decirse que, no es un hecho controvertido dentro de este proceso cautelar, que la propiedad en discusión, sufrió el ingreso de maquinaria de la empresa codemandada (remoción de cobertura vegetal, corta de árboles y movimientos de tierra), sin precisarse una fecha concreta, pero entre los meses de enero, febrero y marzo del presente año y posteriormente, entre los meses de junio y julio, donde se dio un incidente de menor escala, pero en apariencia, de igual naturaleza, tal y como se desprende de la demanda, sus contestaciones, los numerosos escritos de octubre del presente año y la prueba documental visible a imágenes 54 a 67, 308, 311 a 313, 318 a 320, 324 a 326, 336 a 338 del expediente judicial, así como las 36 fotografías y seis videos en tres discos compactos adjuntos al expediente digital…
En todo caso, en mérito de lo expuesto anteriormente y sin perjuicio de la forma en que se resuelve, se llama fuertemente la atención a los codemandados, instándolos a no incurrir en conductas como las denunciadas, atendiendo al respecto al bloque normativo y a la propiedad privada”. Se plantean las siguientes: “Consideraciones sobre los daños y perjuicios ocasionados por las demandadas: MOTIVO QUE LOS ORIGINA: La actual demanda, pretende el resarcimiento de daños y perjuicios causados por las actuaciones materiales u omisiones de CONAVI y CHEC, a mi poderdante, que le generaron y le siguen generando, severos daños a su propiedad, perjudicándole en el legítimo goce del derecho a la propiedad y, consecuentemente su patrimonio. El hecho generador de la responsabilidad, consistió, en el caso de CHEC, ingresar en al menos dos ocasiones – ver sentencia citada, donde se tiene por demostrado que en los primeros meses del año anterior, así como en junio y julio de ese mismo año - a una propiedad privada y disponer a su totalidad de la misma, causando severos daños, sin previa autorización de su legítimo propietario y, violentar el ordenamiento jurídico, al desobedecer lo dispuesto en la Ley de Expropiaciones que establece que solamente en el momento en que el propietario lo autorice expresamente, o bien, sea girada la puesta en posesión por la autoridad judicial competente, puede procederse a ingresar a tal propiedad, indistintamente de la urgencia y necesidad que revista un proyecto.
Para el caso de CONAVI, existe una evidente falta a su deber de vigilancia, en tanto Administración encomendada para la fiscalización del Contrato de Ampliación de la ruta 32. Su omisión, propició que CHEC actuara en la forma tan arbitraria en que lo hizo detrimento de mi poderdante y no ejerció su obligación de vigilar porque las actuaciones de CHEC, en relación con el ingreso a la propiedad privada, se realizar conforme lo demanda la Ley de Expropiaciones. Por el contrario, CONAVI se limitó a observar pasivamente como CHEC estaba procediendo a irrumpir en la propiedad privada, sin que conste intervención oportuna de su parte, para impedir que se continuara con el proceder ilegítimo del contratista que, tal como se expuso, no solamente intervino una ocasión, sino que reincidió meses después en la propiedad de mi poderdante, conforme lo tuvo por demostrado la juzgadora que conoció la medida cautelar.
Esto le genera una responsabilidad de orden solidaria a CONAVI con CHEC, por cuanto, es su deber, constatar que el contrato se ejecute en resguardo del ordenamiento jurídico vigente. Como puede observarse en la prueba aportada por el propio CONAVI, sus personeros participaron en reuniones donde se discutió junto con mi poderdante y CHEC sobre los daños acaecidos, sin que se vislumbre acción alguna para reprimir lo actuado por CHEC, ni para impedir, que se volviera a dar otra intervención de ésta en la propiedad, como la que se suscitó en los meses de junio del año anterior, tal cual, se expuso en la sentencia citada. Tanto CONAVI como la contratista CHEC, han evidenciado el irrespeto del ordenamiento jurídico, al desconocer el derecho de propiedad y las afectaciones al derecho a un ambiente sano y ecológicamente equilibrado, al ingresar una y otra vez a realizar trabajos, sin inventario forestal previo, sin notificación del proceso expropiatorio, sin sentencia de dicho proceso y sin autorización de mi poderdante, al menos, como ya se indicó.
Conforme Su Autoridad podrá apreciar en la prueba ya aportada, el MINAE indica que no hay permiso alguno para talar árboles en la propiedad de mi poderdante, y que pese a esto, se realizaron flagrantes daños al ambiente, al proceder con la tala total de los árboles existentes. EN QUÉ CONSISTEN: Lo actuado por CHEC, así como lo omiso de la conducta de CONAVI, genera una lesión grave a la situación jurídica de mi poderdante, las cuales consisten en el daño provocado por las invasiones no autorizadas por mi poderdante a su propiedad, en las que se ha afectado fuertemente el valor de la misma por las destrucciones realizadas, las cuales le generan daños patrimoniales y morales, a mi poderdante. CHEC, ingresa arbitrariamente a la propiedad y toma el control total, cual propietario, introduciendo maquinaria pesada, para proceder a destruir a su antojo todo lo que allí existía. CHEC decide deforestar indiscriminadamente la totalidad de árboles existentes, sin contar con al menos un inventario forestal.
CHEC, destruyó el ingreso existente a la propiedad, haciendo que nunca más se pueda ya ingresar ni en vehículo ni caminando a la misma, merced al talud que construyó al frente de la propiedad. CHEC, no conforme con abusar del Estado de Derecho, violentado el sagrado derecho constitucional de propiedad privada, irrumpe en un área superior a la que eventualmente se va a expropiar, de aproximadamente 700 metros cuadrados, generando daños tales como deforestación, cambio de vegetación, en definitiva, destruyendo todo lo que se encontraba en esa propiedad. CHEC decide talar los árboles y posteriormente, disponer antojadizamente de la mayoría de especies cortadas, para un aprovechamiento que desconoce mi poderdante, cercenándole ese derecho como legítimo propietario. DAÑO PATRIMONIAL CAUSADO: CHEC, al ingresar arbitrariamente a la propiedad y tomar el control total, cual propietario, introduciendo maquinaria pesada, para proceder a destruir a su antojo todo lo que allí existía, desvalorizó absolutamente mi propiedad, al punto que la dejó en un estado de deterioro total.
Esto por cuanto, su primera acción, consistió en crear un talud de aproximadamente 12 metros que impide, a partir de la primera intervención de CHEC, el ingreso a la propiedad, defecto que persiste hasta este momento. Asimismo, se intervino un área superior – casi 700 metros - a la que se va a expropiar, a la cual se le causó una destrucción total. Así lo evidencia el informe pericial, adjunto, realizado por el Ing. Jimmy Madrigal Mora IT-28958, de fecha 5 de marzo del presente año, que indica: “La comparación de la línea de colindancia frente a la calle pública del plano con respecto al área utilizada por la empresa para realizar el movimiento de tierra, muestra que el trabajo realizado afecta directamente la propiedad del señor [Nombre 001], puesto que no solamente se realizaron trabajos en el derecho de vía que indica el plano, sino también dentro del terreno que se pretende expropiar.
De las estacas colocas por el ente interesado en la expropiación del terreno según el propietario del inmueble, se lograron ubicar cinco que sirven para determinar que el área a expropiar es de aproximadamente 2660 metros cuadrados esto considerando el ancho de vía indicado en el plano. Se hace indicación al solicitante que además de existir afectación directa ya que la parte trabajada es de su propiedad, también es importante que se haga una valoración por parte de ente encargado de la afectación indirecta sobre el resto del terreno, esto debido a la conformación del talud frente a calle pública, que impide el acceso directo a la propiedad, mismo que nos limitó el trabajo hasta tanto no se solicitara y se concediera el permiso de entrada por parte del propietario de la finca colindante al costado este, sin embargo según el plano catastrado y la escritura, la propiedad solo tiene entrada por el frente a calle pública y no por alguna propiedad vecina, razón que hace posible una considerable depreciación de bien.
Es de considerar que el talud presente en la propiedad después de los trabajos realizados supera los 12.50 metros de altura con respecto a la calle publica, esto sin tomar en cuenta lo que pueda aumentar al hacer uso completo de la parte que se pretende expropiar. Se hace la observación, que de no realizarse un trabajo que logre subsanar los defectos de acceso presentes en la propiedad, el uso de este terreno para cualquier actividad generadora de ingresos se podría ver imposibilitado. En conclusión, el área donde se realizaron los trabajos de movimiento de material representa una afectación directa a la finca del interesado, puesto que no solo se trabajó en el área comprendida dentro de lo establecido según los planos como derecho de vía de la carretera nacional, si no también se realizaron trabajos sobre el área prevista para ser expropiada. Por otra parte, se afectó de forma indirecta el resto de la propiedad limitando el acceso a la misma y comprometiendo el valor en caso de una posible venta, por tanto es importante solicitar al ente responsable de los avalúos, que en caso de una posible expropiación, no solo se valore el terreno que se está considerando para ser expropiado, si no también, la afectación al resto del inmueble del señor [Nombre 001], el cual muestra una evidente depreciación por el daño remanente causado por los trabajos realizados en el lugar”.
En resumen, los daños causados a la propiedad y al patrimonio de mi poderdante, concuerdan con: CHEC, destruyó el ingreso existente a la propiedad, haciendo que nunca más se pueda ya ingresar ni en vehículo ni caminando a la misma, merced al talud que construyó al frente de la propiedad. CHEC decide deforestar indiscriminadamente la totalidad de árboles existentes, sin contar con al menos un inventario forestal. CHEC, no conforme con abusar del Estado de Derecho, violentado el sagrado derecho constitucional de propiedad privada, irrumpe en un área superior a la que eventualmente se va a expropiar, de aproximadamente 700 metros cuadrados, generando daños tales como deforestación, cambio de vegetación, en definitiva, destruyendo todo lo que se encontraba en esa propiedad. CHEC decide talar los árboles y posteriormente, disponer antojadizamente de la mayoría de especies cortadas, para un aprovechamiento que desconoce mi poderdante, cercenándole ese derecho como legítimo propietario.
CHEC destruye y deja sin valor de utilización y comercialización la propiedad, haciendo que esta no pueda aprovecharse más, ni pueda ser objeto de venta o hipoteca, en tanto el talud impide su ingreso, y; además, destruyó prácticamente todo el frente de la propiedad, haciendo que el resto – más del 80 % - se constituya en un fundo enclavado, carente de cualquier valor. Para el caso de CONAVI, como se expuso, se limitó a observar pasivamente como CHEC estaba procediendo a irrumpir en la propiedad privada, sin que conste intervención oportuna de su parte, para impedir que se continuara con el proceder ilegímito (sic) del contratista que, tal como se expuso, no solamente intervino una ocasión, sino que reincidió meses después en la propiedad de mi poderdante, conforme lo tuvo por demostrado la juzgadora que conoció la medida cautelar. Esto le genera una responsabilidad de orden solidaria a CONAVI con CHEC, por cuanto, es su deber, constatar que el contrato se ejecute en resguardo del ordenamiento jurídico vigente.
Es claro que si CONAVI hubiese actuado oportunamente apegado a sus obligaciones, el daño en la propiedad del poderdante no se hubiera consumado. DAÑO MORAL: La actual situación, le acarrea a mi poderdante severos daños de orden moral subjetivo, por la destrucción de la que es objeto la propiedad, misma que recibe por donación de su abuela, siendo un activo familiar de mucho valor para su familia. Esto, le origina a mi poderdante, afectación anímica, producto del dolor y sufrimiento emocional, originada en las conductas administrativas ilícitas, objeto del actual proceso, las cuales padeció desde el momento en que la primera de aquellas conductas administrativas se suscita, con la primera intervención en los primeros meses del año anterior. Es desde ese momento en que recae en él, una perturbación injusta absolutamente de sus condiciones anímicas, asociadas con desánimo, disgusto, desesperación, agravio contra su honor y dignidad.
Esto es, desde el momento en que se entera de los daños sufridos en la propiedad, producto de la acción de CHEC, me acompaña una perturbación constante, incesante, estresante, toda vez que esto ponía en riesgo mi patrimonio y el de mi familia, en tanto el activo donado, constituía un activo de mucho valor, el cual se incrementaría obviamente con la ampliación de la ruta 32. La plusvalía iba a ser evidente, sin embargo, ahora todo cambia por la actuación de las demandadas, teniendo ahora un activo familiar destruido, inutilizado y sin valor comercial en este momento, por las condiciones en que CHEC deja la propiedad posterior a su desastrosa e ilegal intervención. Otro aspecto no menos importante, es que esta propiedad conformaba la mitad del patrimonio de mi poderdante, siendo que solamente posee a su nombre otra propiedad en el Cantón de Pococí. La jurisprudencia de nuestros tribunales, en conteste en reconocer este tipo de daño, así se desprende de las siguientes citas jurisprudenciales, la primera de ellas, emanada en este Despacho: Resolución 120 de la una hora cuarenta minutos del 16 de mayo de 2011 del Tribunal Contencioso Administrativo Sección VI [...] Por su parte, la Sala Primera, ha definido este tipo de daño, entre otras, mediante resolución 000206-F-S1-2009 de las dieciséis horas veinte minutos del veintiséis de febrero de dos mil nueve. [...].
Al tenor de las citas jurisprudenciales expuestas, se extrae que en el caso de mi poderdante, acontecen la totalidad de los elementos que este tipo de daño debe tener, para ser considerado como tal, ergo cierto, efectivo, evaluable e individualizable. El daño cierto, ya producido, - intervención de la propiedad sin autorización de mi poderdante, construcción de un talud que impide cualquier tipo de acceso, utilización de maquinaria pesada, que destruyó totalmente el área, aumentada en casi 700 metros sobre lo que se va a expropiar, corta de árboles, retiro de los árboles que hacen que no pueda utilizarse la madera, dejar la propiedad restante como un fundo enclavado - lo convierte en real, es decir, efectivo y patrimonialmente evaluable, a partir de lo que determinen estudios periciales que incluyan el valor de la propiedad antes de su condición de destrozo a la que la sometió CHEC, y el valor actual, considerando que este puede ser apreciable económicamente, e “individualizable” toda vez que sus agentes actores están ampliamente localizados en CHEC y CONAVI, es decir, a quien tengo el derecho a exigir la reparación de la lesión causada, quienes responderán solidariamente por los daños causados.
Los daños deben ser cubiertos en un setenta por ciento por CHEC y en un treinta por cierto por CONAVI. PERJUICIOS: Las actuaciones de las demandadas, han ocasionado una pérdida en el valor futuro de la propiedad y el valor de aprovechamiento de dicha propiedad desde que se realiza la primera intervención de CHEC, dejando inutilizable totalmente la propiedad. Desde los primeros meses del año anterior, no se puede ingresar, por lo que no se puede aprovechar para agricultura de ninguna especie, ni tampoco es objeto de construcción, ni hipotecarse o bien de poder comercializarse. ESTIMACION Por su especial naturaleza, la presente demanda es de carácter inestimable. Sin perjuicio de esto, producto de los estudios periciales que oportunamente se aportarán, prudencialmente, estimo la presente demanda, por concepto de daños y perjuicios en la suma de [Valor 001] millones de colones, desglosados en el siguiente orden: 1.- Daños a la propiedad infringidos por construcción de talud que impide acceso y aprovechamiento total de la propiedad desde los primeros meses del año 2019: [Valor 003], millones de colones
II.Alegatos de Conavi: El CONAVI rechazó los hechos de la demanda y presentó las siguientes excepciones: “1. EXCEPCIÓN DE FALTA DE DERECHO: a) Hecho de un tercero, falta de nexo causal. El actor pretende el resarcimiento de daños y perjuicios supuestamente causados por las actuaciones materiales u omisiones de CONAVI y CHEC, que supuestamente le generaron y le siguen generando, severos daños a su propiedad, perjudicándole en el legítimo goce del derecho a la propiedad y, consecuentemente su patrimonio, situación que no es imputable a este Consejo por los siguientes motivos: Mediante ley No. 9293 de fecha 10 de marzo de 2015, Aprueba financiamiento al proyecto rehabilitación y extensión de la ruta nacional Nº 32 sección cruce ruta 4-Limón. El 18 de febrero de 2013, el Ing. Pedro Castro en su doble condición de ministro de Obras Públicas y Transportes y presidente del Consejo de Administración suscribió un memorándum con la empresa CHINA HARBOUR ENGINEERING COMPANY DE COSTA RICA SOCIEDAD ANONIMA (TOMO I Folios 81 al 82 y anexo de folio 83 al 144 del expediente administrativo Proyecto: "Diseño, Rehabilitación y Ampliación de la Ruta Nacional Nº32 carretera Braulio Carrillo, Sección: Intersección Ruta Nacional Nº 4 (Cruce a Sarapiquí-Limón)'' en el cual se dispuso que el contratista debe suscribir las siguientes pólizas de Seguros y Responsabilidad. ''[...] Seguros por responsabilidad civil: será obligación de LA EMPRESA tomar una póliza del Instituto Nacional de Seguros (INS) o de cualquier ente asegurador de responsabilidad civil debidamente imputable al asegurado (LA EMPRESA) por lesiones o muerte a terceros o por daños a la propiedad de terceros; ...
" [...]. Posteriormente, el Consejo Nacional de Vialidad suscribió un contrato con la empresa CHINA HARBOUR ENGINEERING COMPANY DE COSTA RICA SOCIEDAD ANONIMA, mismo que fue refrendo por la Contraloría General de la República con oficio No. 5662-2016, en el cual se estableció en las condiciones generales punto 4.1 inciso 3 las obligaciones Generales del contratista. [...]. 4.1. Obligaciones generales del contratista. Aparte de las obligaciones dispuestas en el memorándum de acuerdo para el proyecto de Diseño, rehabilitación y ampliación de la ruta nacional 32 Carretera Braulio carrillo, sección intersección ruta nacional 4 (Cruce Sarapiquí Limón y sus anexos. El contratista tendrá entre otras, las siguientes obligaciones: 1 (...) 3. El contratista será el responsable por toda pérdida, gasto y reclamo por pérdida o daños y perjuicios sufridos por los bienes materiales, lesiones y muerte que se produzcan como consecuencia de sus propios actos u omisiones en la ejecución del contrato que se suscribe ...” [...].
Adicionalmente, en las obligaciones complementarias en el punto 39 se especificó que el contratista debe cumplir con todas las leyes vigentes en la república de Costa Rica indicándose lo siguiente: 39. El Contratista cumplirá todas las leyes vigentes en la República de Costa Rica, esas leyes incluirán todas las leyes locales, estatales, nacional o de otra índoles que afecten el cumplimiento del Contrato y sean obligatorias para el Contratista. El Contratista eximirá al Contratante de toda responsabilidad por daños y perjuicios, demanda, multas, sanciones y gastos de cualquier índole que surjan o sean consecuencia de la violación de esas leyes por el Contratista o su personal, incluidos los Subcontratistas y su personal. [...] Luego en el punto 4.12 y 4.16 del contrato se estableció como responsabilidad del contratista lo siguiente: 4.12. No interferencia El contratista no interferirá en forma innecesaria ni inadecuada con: a) la comodidad del público, b) el acceso, uso y ocupación de todos los caminos y senderos, independientemente que sean públicos o estén en posesión del Contratante o de otros.
El Contratista deberá indemnizar y amparar al Contratante de todos los daños y perjuicios y gastos (incluidos honorarios y gastos de abogados) que se generen a raíz de una interferencia innecesaria o inadecuada de ésa índole. 4.16. Protección del Medio Ambiente (Cumplimiento con la Viabilidad Ambiental y sus obligaciones. El contratista deberá cumplir fielmente con lo dispuesto en la Legislación Ambiental de la República de Costa Rica; así tomará todas las medidas necesarias para proteger el medio ambiente (tanto dentro como fuera del Lugar de las Obras) y para evitar los daños y las alteraciones ambientales que se puedan crear a las personas y las propiedades como consecuencia de sus operaciones. [...] Como complemento a lo anterior, mediante oficio UE-DRA-RN32-002-2017-119 (2199) de fecha 14 de junio de 2017, el CONAVI de forma diligente le informó al representante legal de la empresa CHEC, el procedimiento previo al inicio de la etapa de construcción que hay que realizar para la corta de árboles. [...] Asimismo, con oficio UE-DRA-RN32-001-2017-321 (855) de fecha 25 de octubre de 2017, se le informa al Gerente del Proyecto señor Zhou Jingxiong, sobre las acciones de coordinación con el Sistema Nacional de Áreas de Conservación (SINAC) para desarrollara (sic) el protocolo para los trámites asociados a la corta de árboles (sic) que conlleva el proyecto y se le remite el borrador del protocolo.
Con orden de servicio No. 3 de fecha 16 de noviembre de 2017, se da orden de inicio a partir del 20 de noviembre de 2017, la etapa de construcción. [...] Mediante oficio UE-DRA-RN32-001-2017-333 (855) de fecha 01 de noviembre de 2017, se le comunica al Gerente del Proyecto señor Zhou Jingxiong sobre el seguimiento ambiental y que debe actualizar la documentación con base al (sic) la resolición (sic) 2207-2016 SETENA del otorgamiento ambiental previamente a dar inicio de las obras. [...]. Posteriormente, mediante oficio UE-DRA-RN32-002-2018-104 (855) de fecha 02 de marzo de 2018, se le comunica al Gerente del Proyecto señor Zhou Jingxiong sobre el seguimiento ambiental, se trascribe en lo conducente lo siguiente: ''En relación con el inicio de la Corta de Árboles que se realizará por parte de su representada [...] Cabe recordar que, dicha labor no podrá dar inicio hasta que no se cuentr (sic) con todos los permisos requeridos... [...].
Luego mediante oficio UE-DRA-RN32-002-2018-104 (855) de fecha 02 de marzo de 2018, se le comunica al Gerente del Proyecto señor Zhou Jingxiong sobre la corta de árboles se se (sic) le reitera lo establecido en el punto 4.16. de las obligaciones complementarias del contratista, además se le indica que "El inventario forestal es un insumo técnico inexorable para el "Permiso de corta de árboles" permiso que de acuerdo a lo estipulado en el punto 10 (c) del documento de alcance del Contrato ... " [...]. De lo hasta aquí indicado se tiene que de existir un eventual daño el responsable no es el Consejo Nacional de Vialidad, sino la empresa CHEC, tal y como dispone el memorando y el contrato, y sus adendas. El CONAVI no solo ha sido diligente en advertir al contratista de diversos trámites y cumplimiento de leyes, sino que lo hizo con la antelación debida. En (sic) necesario indicar que la empresa CHEC intentó llegar a un acuerdo con el señor [Nombre 001], de indemnizarlo de conformidad con lo indicado en el inventario realizado por el Ing. Luis Femando Meneses Valverde inclusive propuso que con la maquinaria de la empresa restablece el terreno a las condiciones originales, sin embargo el propietario indicó que "...no le interesa ya que no quiere depender de los tiempos del CHEC y prefiere hacerlo en el momento que el desea''.
Aunado a lo anterior, la empresa CHEC propuso pagar un alquiler del terreno afectado desde el momento en que ingresó la maquinaria al terreno hasta el mes de julio de 2019 y de una vez realizar los trabajos de mejora en el terreno", pero el señor [Nombre 001] no aceptó la propuesta, indicando que él prefiere el dinero. Nótese que la empresa CHEC intentó dar una solución al problema, sin embargo, el dueño de la propiedad solo estaba interesado en el dinero, por lo que claramente se evidencia que el interés del propietario es meramente económico y que la empresa CHEC entiende y acepta que es la única responsable de los supuestos daños y perjuicios reclamados. Por otra parte, se rechaza la existencia de un daño ambiental por cuanto el proyecto cuenta con la viabilidad ambiental otorgada mediante Resolución el ministerio de ambiente y energía, la secretaría técnica nacional ambiental Nº 2207-2016-SETENA las 15 horas 30 minutos del 02 de diciembre del 2016, por lo que se estaría ante un impacto ambiental que se configura cuando existe una viabilidad ambiental por cuanto se tiene ya previsto que puede ocasionarse determinado evento como lo es la tala de árboles.
La parte actora pretende se le indemnice los supuestos daños moral y material por supuestos daños al cortar ciertos árboles en su propiedad por parte de la empresa CHEC, lo que deberá acreditarse en este proceso. Respecto a la relación de causalidad debe existir conexidad y el daño producido es una condición indispensable para que pueda atribuirse a aquella el deber de resarcir dicho daño, este solo procede cuando existe certeza en la prueba del nexo causal. En el presente caso la parte actora omite presentar la prueba correspondiente que logre acreditar el nexo de causalidad con el daño alegado y el nexo con la administración, máxime que la propia actora indica que la supuesta invasión al terreno fue ejecutada por la empresa CHINA HARBOUR ENGINEERING COMPANY DE COSTA RICA SOCIEDAD ANONIMA (CHEC). 2. EXCEPCIÓN DE FALTA DE LEGITIMACIÓN: Se interpone esta excepción, por cuanto como lo indica la propia parte actora, la supuesta invasión a la propiedad fue realizada por la empresa CHINA HARBOUR ENGINEERING COMPANY DE COSTA RICA SOCIEDAD ANONIMA (CHEC) y de acuerdo a lo establecido en el contrato adendas y documentación complementaria, de darse un daño o perjuicio la empresa responderá por ello.
Aunado a ello que en la propiedad en la que se reclama los daños y perjuicios fue debidamente expropiada y ya fue puesta en posesión del Ministerio de Obras Públicas y Transportes, mediante notificación de las quince horas y veintiocho minutos del treinta de abril de 2020, correspondiente al Expediente 20-000013-1028-CA-0” (La negrita y subrayado son nuestros). Solicita condenar al actor al pago de las costas de este proceso, así como los intereses respectivos.
III.Alegatos del Estado: Rechaza la demanda en cuanto a los hechos aclaró que: “El Estado ha decidido expropiar un área de terreno con una medida de mil novecientos ochenta y dos metros cuadrados (1,982.00 metros cuadrados), según plano catastro Nº [Valor 009], el cual forma parte del inmueble inscrito en el Partido de Limón, Folio Real Matrícula [Valor 010]. Dicha expropiación se tramita ante el Juzgado Contencioso Administrativo bajo el expediente N° 20-13-1208-CA, siendo que en el mismo ya se autorizó la entrada en posesión de la franja a expropiar y se dispuso el giro del monto del avalúo administrativo. [...] En primer término, no nos consta la supuesta invasión de la propiedad del actor, ni tampoco que se hayan ocasionado los daños que se alegan. En ese sentido, las partes codemandadas han manifestado y aportado pruebas que acreditan que se estuvo trabajando en el derecho de vía. En segundo término, según la prueba que consta en autos, no nos consta que los trabajos realizados por la empresa China Harbour Engineering Company de Costa Rica Sociedad Anónima (en adelante CHEC) no permitan el ingreso a la propiedad del actor, toda vez que el mismo se realizaba por un pequeño acceso lateral a la finca.
En ese sentido, conforme al avalúo administrativo N° SABI-2019-117 del 12 de agosto del 2019, visible a folios 44 al 59 del expediente relativo a la expropiación, se puede apreciar que el terreno del actor se encuentra a 4-5 metros sobre el nivel respecto de la vía pública, sin que existiera un acceso por el frente del lote, según se observa en las fotografías visibles a folio 51 de dicho expediente. [...] En tercer lugar, se rechaza que se hayan realizado obras en un área mayor a la que es objeto de expropiación, así como la corta de árboles en los términos y dimensiones que expone el actor. Finalmente, sin perjuicio de lo anterior, es claro que las supuestas actuaciones e invasión denunciadas por el accionante fueron realizadas directamente por CHEC, como contratista de la obra que se encuentra en ejecución, sin que existan actuaciones u omisiones por parte del Consejo Nacional de Vialidad (en adelante CONAVI) o del Estado en este caso. [...]” (la negrita es nuestra).
Se rechazaron las pretensiones formuladas por el actora y se interpusieron las siguientes excepciones: “I. Falta de derecho y falta de legitimación: La Ley General de la Administración Pública en su título sétimo regula lo relacionado con la responsabilidad de la Administración. Tal título en su numeral 190 ordena que la Administración será responsable y responderá por todo daño que produzca su funcionamiento legítimo, ilegítimo, normal o anormal. Para que quepa esta responsabilidad deben concurrir tres elementos esenciales:
IV.Alegatos de la empresa co-demandada CHEC: Se indica que la finca objeto del proceso se encuentra en derechos y le corresponde al actor solamente la nuda propiedad. Aclara que el proceso expropiatorio de la finca del actor se tramita ante el Juzgado Contencioso con el expediente Nº20-0013-1028-CA donde autorizó el giro del monto del avalúo administrativo y mediante auto de las 15:28 horas del 30 de abril de 2020 se autorizó la puesta en posesión del inmueble pasado 2 meses desde la notificación, siendo el área a expropiar de 1.982,00 metros cuadrados. Señala que las obras constructivas realizadas por CHEC se efectuaron en el derecho de vía propiedad del Estado que es de 50 metros frente a la propiedad del señor [Nombre 001] sin que a la fecha se haya efectuado obra constructiva en la propiedad del actor. Alega que el actor confunde el derecho de vía con su propiedad. Reiteró que las obras constructivas se efectuaron cien por ciento en el derecho de vía y que no se ha realizado ningún talud en propiedad del Señor [Nombre 001].
Tampoco es cierto que existiera un acceso a la finca del Señor [Nombre 001] que se haya afectado. La finca del Señor [Nombre 001] si bien da frente a la ruta 32, no tenía construido ningún camino de acceso. Por el contrario, la parte que se intervino del derecho de vía no estaba a la altura de la carretera. Fue necesario remover gran cantidad de tierra para poder liberar el derecho de vía y conformar el talud provisional. Una vez que se entre en posesión del terreno expropiado, será necesario continuar con el movimiento de tierra y conformar el talud definitivo. Indica que todas las obras y actividades realizadas se encuentran contempladas en el Estudio de Impacto Ambiental como parte del proceso de Evaluación de Impacto Ambiental que resultó en el otorgamiento de la viabilidad ambiental por parte de la Secretaría Técnica Nacional Ambiental. El área de proyecto evaluada está formada por lo que se denomina Área de Proyecto (AP) que es el derecho de vía de cincuenta metros de ancho y las áreas a expropiar, el Área de Influencia Directa del Proyecto conformada por los siguientes cincuenta metros adyacentes al derecho de vía y el Área de Influencia Indirecta del Proyecto que la constituyen los 250 metros adyacentes al Área de Influencia Directa.
Es por ello que la corta de árboles y cualquier eventual actividad de movimiento de tierras que se deba realizar en el terreno expropiado, se encuentra autorizada desde el punto de vista ambiental en la viabilidad ambiental. Aclaró que no es cierto que el señor Luis Meneses sea el regente ambiental del proyecto, ni que haya habido afectación a árboles frutales o a especies arbóreas de importancia comercial. Rechazó que haya habido una usurpación a la propiedad del actor. Sostiene que no es cierto que CHEC haya realizado obra constructiva alguna en la propiedad del Señor [Nombre 001]. Aclara que una de las actividades que se realizan previo a efectuar cualquier actividad constructiva en una carretera, es la corta de árboles. Se reconoció expresamente que sí es cierto que, en abril del 2019, CHEC realizó corta de árboles en el derecho de vía. Adicionalmente y por error de los peones que no supieron diferenciar la demarcación del derecho de vía con la demarcación del área a expropiar, realizó corta de árboles en el área expropiada.
Es cierto también que el Señor [Nombre 001] se reunió con representantes de CHEC, específicamente con el Ingeniero Luis León, y CHEC se comprometió a instruir a sus peones y operarios para que no se volviera a realizar actividad alguna en su terreno. En junio del 2019 CHEC finalizó con las obras de remoción de tierra en el derecho de vía y de conformación de talud, pero todo en el derecho de vía. Ninguna actividad se realizó en el terreno expropiado ni en la finca donde el Señor [Nombre 001] es nudo propietario. Se indicó que no es cierto que el ingeniero forestal Luis Meneses sea el regente ambiental del proyecto. Se aceptó como cierto que CHEC solicitó al ingeniero forestal Luis Meneses que realizara una revisión rápida del área y determinara bajo una metodología que partiera de la existencia de un daño ambiental para que se calculara a cuánto ascendería la reparación integral, aún y cuando ésta no es procedente, con el fin de tener un parámetro objetivo para indemnizar al señor [Nombre 001], todo eso a pesar de que el área iba a ser expropiada y que, conforme al Estudio de Impacto Ambiental, CHEC está autorizada para realizar actividades constructivas en el área expropiada.
Con base en lo anterior, se le ofreció al Señor [Nombre 001] una indemnización incluso más alta de lo que arrojó el informe elaborado por el ingeniero Luis Meneses, lo cual el Señor [Nombre 001] rechazó. Manifiesta que el informe elaborado por el ingeniero forestal Luis Meneses no es prueba del daño ocasionado porque parte de una serie de supuestos y, por lo tanto, llega a conclusiones que no son exactas, ya que fueron planteadas por CHEC de buena fe para facilitar la negociación que permitiera evitar procesos litigiosos y buscar acelerar la puesta en posesión, lo que no se logró. Se aceptó que el día 12 de junio sostuvo una reunión con el Señor [Nombre 001] y con representantes del Consejo Nacional de Vialidad. En esa reunión CHEC asumió nuevamente el compromiso de realizar actividades únicamente en el derecho de vía. En realidad, desde el incidente de los árboles en abril del 2019, no se había realizado ninguna nueva actividad en la propiedad del Señor [Nombre 001].
Posteriormente a la reunión, el Señor [Nombre 001] sostuvo una comunicación telefónica con el supervisor general de la rama 1 de CHEC, señor Luis Yogseng León Villagra, a quien le indicó que se estaba trabajando nuevamente en su propiedad. El Señor Luis León le explicó que no se estaba haciendo ningún trabajo en su propiedad sino que se estaba trabajando en la conformación del talud provisional dentro del derecho de vía que en total es de 50 metros. Es absolutamente falso que se hicieran movimientos de tierra en la propiedad del Sr. [Nombre 001], que se causara daño ambiental, que se afectara la vegetación, la fauna y los árboles existentes en la propiedad del Sr. [Nombre 001]. En la franja de terreno en discusión no había ni hay bosque, ni plantaciones forestales o de árboles frutales. Adiciona, que es cierto que el Señor [Nombre 001] acudió a la vía cautelar y su solicitud fue rechazada, pero no es cierto que se haya demostrado daños a su propiedad.
Los daños deben ser demostrados en el procedimiento ordinario. Interpuso las siguientes excepciones de fondo: “Falta de legitimación activa para ser indemnizado por daño ambiental: El derecho a un ambiente sano ha sido considerado como un derecho fundamental, cuya afectación no solo puede incidir en una persona, sino que por su naturaleza afecta a la colectividad. Es por eso que la legitimación en esta materia tiende a extenderse y ampliarse justificada en la doctrina de los intereses difusos, según la cual la legitimación original del interesado legítimo o aún del simple interesado, se difunde entre todos los miembros de una determinada categoría de personas que resultan así igualmente afectadas por los actos ilegales que los vulneran, por lo que prácticamente cualquier persona puede entablar los remedios administrativos y jurisdiccionales ante una acción u omisión de alguna persona física o jurídica, privada o pública, que amenace con causar un daño ambiental.
Lo anterior fue recogido por la Ley de Biodiversidad en su artículo 105, al legitimar a toda persona a accionar en sede administrativa o jurisdiccional en defensa de la biodiversidad. Sin embargo, por ser la tutela del derecho al ambiente de interés público y en muchos de los casos el elemento del ambiente afectado es de dominio público, la legitimación para reclamar indemnizaciones por daño ambiental se restringe, lo contrario sería aceptar la posibilidad de que un particular represente el interés público en materia de resarcimiento. El Señor [Nombre 001] confunde "la legitimación procesal (que permite plantear una demanda), con el derecho de fondo (lo pretendido), que se debe tener en concreto para obtener una decisión favorable y que el daño causado a la colectividad no implica la existencia automática de un daño personal ni legitimación para reclamarlo" (Voto 834-2015 de la Sala Primera de la Corte Suprema de Justicia).
Por lo tanto, aunque la normativa nacional concede amplia legitimación para accionar, no así lo es para que una persona pueda recibir el monto de la indemnización: ‘Así, pese a la amplitud en la legitimación para reclamar el daño ambiental, las indemnizaciones por daño colectivo no pueden ser otorgadas a favor de las personas privadas o públicas específicas que hayan planteado el reclamo. El titular para recibirlas es el Estado (representado por la PGR) o quienes la ley determine expresamente. La indemnización por afectación indirecta a bienes o intereses privados (daño individualmente soportado), puede reclamarla sólo quien lo ha sufrido y es tal, por las reglas comunes de responsabilidad, quien tiene derecho a la indemnización" (Tribunal Contencioso Administrativo. Sentencia Nº 00045 -2016 del 06 de Mayo del 2016). Aunque la demanda no indica de manera clara en qué consiste el daño ambiental, en los hechos de la demanda hace referencia al informe realizado por el ingeniero forestal Luis Meneses, además de presentarse otro documento con estimaciones del daño ambiental el cual reclama que se le indemnice.
En ambos informes se mezclan estimaciones de económicas del daño que pudo individualmente ser soportado por el Señor [Nombre 001], así como de otras, aunque improcedentes según se demostrará en este proceso, serían propias de la indemnización por daño colectivo. No obstante, el único órgano legitimado para reclamar indemnizaciones de tipo colectivo es la Procuraduría General de la República, en su calidad de representante del Estado según así lo dispone los artículos 1, 3.a) y 3.i) de la Ley Orgánica de la Procuraduría General de la República y la Ley Forestal indica en su artículo 58 [...]. De lo anteriormente expuesto, queda claro que la demandante no se encuentra legitimada para solicitar que se le indemnice el supuesto daño ambiental en cuanto a los elementos colectivos de éste como puede ser los servicios ambientales, debido a que por ley esa representación corresponde únicamente a la Procuraduría General de la República.
Excepción de Falta de derecho: (...) 1. De las pretensiones indemnizatorias. Preliminarmente, es menester reiterar que rechazamos la existencia de cualquier hecho generador que pueda considerarse causante de daño alguno. La apreciación subjetiva del actor en torno a que CHEC haya 'destruido' su propiedad es absolutamente infundada pues la actuación de mi representada se ha efectuado cien por ciento en el derecho de vía por lo que es incorrecto considerar que se ha extralimitado en cuanto al alcance geográfico de las obras que ejecuta. Tampoco se ahonda en describir -o siquiera indicar- el criterio de imputación de responsabilidad civil subjetiva bajo el cuál CHEC sería -supuestamente- responsable. Debe recordarse que CHEC es un sujeto de derecho privado por lo que el actor debe acreditar el criterio de imputación o el factor subjetivo de atribución que justifica la supuesta responsabilidad civil de CHEC debe ser justificado por quien solicite una indemnización como la que pretende el actor.
La connotación del término 'destruir' puede inducir a error al tribunal, por cuanto, se atribuye un sentido negativo al enunciado dando a entender que se trata de un grave daño o aflicción, que no se debería estar soportando. Cuando, la realidad de las cosas es que se han llevado a cabo acciones que, desde un punto de vista objetivo, no pueden considerarse una afectación arbitraria sino el ejercicio legítimo de una actividad de interés público, a saber, la ejecución de obra pública de vital importancia para el Estado, en terrenos que legalmente pertenecen o se encuentran en posesión de este. a Inexistencia del alegado daño patrimonial: Afirma la parte actora, en forma temeraria, que nuestra representada causó daños patrimoniales que, prácticamente, dejaron inutilizable la finca del Partido de Limón [Valor 008], de la cual es titular del derecho 001, a la totalidad de la nuda propiedad. [...] Pese a que en el presente caso opera un fuero de atracción de la competencia contencioso administrativo por existir una parte procesal pública, lo cierto es que para que fuera aplicable a CHEC la responsabilidad que el actor le indilga, debería demostrar fehacientemente que se ha realizado un acto que lesiona sus derechos e intereses, que existe un efectiva relación de causalidad entre acciones de nuestra representada y la causación de ese daño, y que tales actuaciones fueron desarrolladas en forma dolosa o culposa.
Debería también el actor comprobar el importe de dicha lesión y no debería existir una vía procesal idónea y especial para la discusión de tales extremos. [...] (ii) No se ha generado el daño acusado por la parte actora [...] El actor no hace sino relatar una serie de hechos mezclados con apreciaciones personales. No demuestra cómo los trabajos desarrollados por CHEC dentro del derecho de vía podrían haber afectado la propiedad de la cual es nudatario. No fundamenta la existencia de una relación de causalidad, y es claro que la razón de esta deficiencia en solo una. No existen tales daños ni existe un nexo causal posible entre aquellos (si se hubieran dado) y los trabajos desarrollados por CHEC. (iii) CHEC no ha actuado de forma dolosa o culposa. Si bien este es un proceso contencioso administrativo, CHEC es parte en su condición de tercero que mantiene una relación contractual con el Estado.
En este caso participa de este proceso debido al fuero de atracción previsto en el Código Procesal Contencioso Administrativo. No obstante, no ha perdido su condición de sujeto de Derecho Privado, por lo que le son aplicables las reglas de fondo previstas para tales personas físicas y jurídicas. Los artículos 190 y siguientes de la Ley General de la Administración Pública contienen los presupuestos bajo los cuales debe determinarse la responsabilidad de la Administración Pública y de sus funcionarios. A partir de dicha normativa se establece una responsabilidad objetiva para la Administración, que responde frente a terceros por todos los daños que cause su funcionamiento legítimo o ilegítimo, normal o anormal. Y por otro lado a diferencia de dicho campo de imputación objetiva, la responsabilidad del funcionario público es de naturaleza subjetiva, toda vez que se fundamenta en la existencia de una conducta dolosa o culposa que cause daño a un tercero o a la Administración. [...] En el presente caso, CHEC ha actuado dentro del derecho de vía, realizado las acciones ingenieriles necesarias para su recuperación y uso en la ampliación de la ruta 32.
Nuestra representada actúa como contratista del Estado, acatando las obligaciones asumidas en el contrato, de acuerdo con los diseños efectuados y la programación acordada con el Estado. No existe, por parte del actor, ningún elemento de prueba que demuestre que alguna de las intervenciones constructivas de CHEC haya sido realizada con la intención de afectar la propiedad de la que el demandante es nudatario, ni tampoco que haya empleado métodos inadecuados, planos incorrectos o maquinaria inidónea para llevara (sic) a cabo las obras. No ha demostrado que el personal a cargo de los trabajos haya sido negligentemente seleccionado y supervisado. El actor se basa en simples presunciones, que no pueden dar lugar a la asignación de responsabilidad a CHEC. Por el contrario, mi representada ha actuado en absoluto apego a las mejores prácticas constructivas, poniendo atención en cada detalle para evitar que el desarrollo de una importante obra pública, ocasiones a los administrados más molestias de las que inevitablemente debe tolerar, ante la construcción de una infraestructura como esta. [...]”.
Continúa manifestado en lo esencial: b. Inexistencia de daño ambiental: afirma que “CHEC de buena fe ha reconocido su responsabilidad por la corta de árboles en el área a ser expropiada, lo cual es muy diferente a que haya habido impacto en la fauna y flora del lugar y gran daño ambiental. CHEC ha reconocido tanto en el proceso de negociación con el Señor [Nombre 001] como en la medida cautelar que por error, cortó los 30 que se indican en el documento elaborado por el ingeniero forestal Luis Meneses. Sin embargo, esa acción es totalmente independiente y diferente de las obras de movimiento de tierras realizadas en el derecho de vía. Como bien se sabe, cuando se está construyendo una carretera, una vez que se han realizado todas las labores de ingeniería (levantamientos topográficos, inventarios forestales, diseños, trazos en campo), una de las primeras actividades que se realiza es la limpieza de vegetación y corta de árboles.
Para esas actividades, no se requiere maquinaria que remueva la tierra, sino que se cortan los árboles y se aglomeran en un sitio donde después pasa un camión a recoger y llevar a los sitios autorizados por la SETENA para disponer de ese material. La corta de árboles igualmente se realiza por secciones. Es decir, la carretera tiene una extensión de 107 kilómetros, así que se divide en varias secciones de varios kilómetros para hacer los trabajos. En el caso de la corta de árboles realizada para el derecho de vía que pasa por frente de la propiedad de [Nombre 001], se venía trabajando en todas las fincas que están entre el río Madre Dios y río Barbilla, es decir, en un perímetro de poco más de 5 kilómetros. [...] En el caso de la propiedad del señor [Nombre 001], CHEC ha aceptado que sí cortó 30 árboles que están en el área a expropiar, por lo que sí ha aceptado pagar por el valor en pie de la madera.
No obstante, en ningún momento realizó movimientos de tierras o afectación mayor en propiedad del señor [Nombre 001]. Tampoco ha habido un daño ambiental como tal. Obsérvese que el documento elaborado por el ingeniero Luis Meneses para CHEC, claramente indica que "He de aclarar que esta corta de árboles se encuentra cubierta por la Viabilidad Ambiental aprobada por SETENA para la ampliación de la ruta nacional Nº 32". Igualmente, el documento omite hacer referencia al tipo de ecosistema presente en el lugar, así como al destino que tiene ese terreno ya expropiado, el cual ha sido reconocido por el mismo [Nombre 001] que formará parte de la carretera. [...]”. c. Inexistencia del daño moral: Alega que “da la impresión de que lo que se pretende es una indemnización del daño patrimonial bajo un disfraz de daño moral pues, en el escrito de demanda, se limita a decir que ese inmueble representa un alto valor para su familia, sin fundamentar en que se basa para decir tal cosa [...] Finalmente, debe remarcarse que al no haber una línea argumentativa circunstanciada y coherente en cuanto a cuál es el hecho que funge como generador de este o estos daños, y al no demostrarse vínculo de causalidad alguno, lo procedente es declarar sin lugar este extremo de la demanda.” d. Sobre la distribución de daños: “No podemos dejar de referirnos a la antojadiza e infundada distribución que el actor sostiene, en cuanto establece la proporción 70/30 en cuanto a la distribución de la responsabilidad civil.
El régimen de responsabilidad solidaria, que sería el regente en materia de responsabilidad civil extracontractual de conformidad con el artículo 1046 del Código Civil y 201 de la Ley General de la Administración Pública indica que la obligación resarcitoria es de carácter solidaria entre los partícipes. Por ello, ante la imposibilidad de encontrar el sustento normativo que justifique la solicitud del actor, lo procedente es desechar la pretensión y regirse por el régimen legal existente”. Se sostiene que parte de las pretensiones planteadas son propios del procedimiento de expropiación en el cual es parte como nudatario de la propiedad en cuestión. Aspectos tales como la amplitud del área a expropiar, la afectación que esta pueda generar en el valor de la propiedad así como a la afectación del resto no expropiado, son aspectos que determinarán el justiprecio que el Estado deba cancelar al propietario para compensar la pérdida patrimonial sufrida producto de la expropiación.
Esto es claramente definido en los artículos 29, 30, 39 y siguientes de la Reforma integral de la ley Nº 7495, Ley de Expropiaciones Nº 9286, así como en el artículo 110.4 de la Ley Orgánica del Poder Judicial. e. Inexistencia de los perjuicios: En este extremo se alegó: “De igual manera, rechazamos vehementemente la escasa y confusa argumentación del actor en lo referente a los perjuicios alegados. Como punto principal, alega la pérdida futura de plusvalía, lo cual no intenta siquiera probar, ante la imposibilidad de la tarea. No queda en evidencia ningún daño futuro cierto que toda esta actividad le genere, dado que ni siquiera hay base alguna para sostener un daño real y actual, y, como el futuro solo puede ser consecuencia del daño presente, no es posible concederle este extremo indemnizatorio”. Por último se plantea la “Oposición a la estimación: Nos oponemos a la estimación de la demanda por tratarse de una operación confusa tal y como se indicó en las líneas iniciales de esta contestación.
Además de esto, de cualquier forma, existe una desproporción, así como una falta de concreción y fundamentación técnica del contenido económico del proceso, razones suficientes para oponernos a la estimación hecha por el actor”. Se solicita declarar sin lugar la demanda y se condene a la actora al pago de ambas costas.
V.Sobre la prueba para mejor resolver ofrecida: Durante la audiencia preliminar la empresa co-demandada CHEC ofreció prueba documental en carácter de prueba para mejor resolver visibles a imágenes 398 a 422 del expediente judicial consistente en documentación aportada en el expediente de expropiación Nº20-00013-1028-CA del Juzgado Contencioso Administrativo y Civil de Hacienda, motivo por el cual la Jueza de Trámite concedió audiencia por escrito a todas las partes y reservó la admisibilidad para el Tribunal de Juicio conforme al numeral 50 inciso 2) del Código Procesal Contencioso Administrativo. La representación Estatal se refirió a la prueba ofrecida en memorial del 14 de julio de 2023 visible a imagen 431 del principal. Adicionalmente, la parte actora durante la celebración del juicio oral y público ofreció prueba para mejor resolver consistente en fotografías tomadas en junio 2024 para observar el estado actual de la propiedad una vez concluidas las obras de infraestructura en el área expropiada, señala que es útil para dar una perspectiva real y definitiva del talud frente a calle, que imposibilita materialmente el acceso peatonal y vehiculara la propiedad convirtiéndolo en un fundo inutilizable.
El Tribunal confirió audiencia oral a las partes demandadas y se reservó la admisibilidad conforme el numeral 50 CPCA. Respecto a la admisión facultativa de la prueba para mejor resolver, es criterio reiterado de la jurisprudencia de la Sala Primera de la Corte Suprema de Justicia, que su rechazo no produce la indefensión de las partes (véase los votos Nº547-F-S1-2002 y Nº29-F-S1-1995, ambas de la Sala Primera de la Corte Suprema de Justicia). En cuanto a la prueba para mejor resolver ofrecida por la empresa CHEC, se admite por tratarse de la actualización de piezas del expediente expropiatorio Nº20-00013-1028-CA del Juzgado Contencioso Administrativo y Civil de Hacienda, toda vez que se trata de prueba admitida durante la audiencia preliminar. Con respecto a las fotografías ofrecidas por la parte actora como prueba para mejor resolver se rechazan por carecer de utilidad y relevancia con el objeto procesa para la resolución de fondo del presente asunto debido a que no están vinculadas con los hechos objeto de la demanda ni con el momento histórico en que sucedieron.
VI.Hechos probados. De relevancia para efectos del presente proceso se tienen los siguientes hechos demostrados:
VII.Sobre hechos no probados: De relevancia para la resolución del presente asunto se tienen como indemostrados los siguientes: 1- Que la empresa co-demandada CHEC construyera un talud en la propiedad del actor antes de la puesta en posesión de la franja expropiada. 2- Que la empresa co-demandada CHEC hubiera destruido el acceso de ingreso a la propiedad del actor. 3- Que la co-demandada CHEC hubiera destruido y dejado sin valor de utilización y comercialización la propiedad sin que pueda ser objeto de venta o hipoteca por tratarse de un fundo enclavado. 4- Que el actor hubiera realizado labores de aprovechamiento de la finca y de madera ubicada en la propiedad. 5- Que se haya determinado el monto actualizado del valor comercial de la madera talada dentro de la propiedad del actor. 6- Que el CONAVI incurriera en faltas y omisiones al deber de supervisión y vigilancia de la contratista CHEC.
VIII.Sobre la responsabilidad objetiva de la Administración Pública: Para imponer la responsabilidad a la Administración Pública se requiere acreditar junto con el daño real, efectivo e individualizable, el nexo causal con la conducta administrativa acusada de haber ocasionado el daño, al tenor del artículo 190 de la Ley General de la Administración Pública. En cuanto al término ce conducta administrativa, comprende todas las formas de manifestación de la voluntad de la Administración Pública, sea las actuaciones materiales que son aquellas no amparadas a un acto administrativo o mera actividad normal, la conducta omisiva, no hacer algo que está obligado por el bloque de legalidad y la conducta formal, sería el acto administrativo propiamente. De este modo, se requiere de la concurrencia de cuatro elementos, a saber: a) Una lesión, que consiste en los perjuicios patrimoniales antijurídicos, porque el que los padece no tiene el deber de soportarlos; b) Una conducta administrativa en relación con la cual se encuentre vinculada la producción del daño reprochado; b) Un nexo causal, conformado por la existencia de una relación directa de causa a efecto entre el hecho (conducta administrativa) que se imputa y el daño producido; y c) Que no existan las causas de justificación, siendo que la existencia de las mismas puede desvincular jurídicamente el perjuicio producido con la conducta de la Administración Pública, de modo tal que el efecto dañoso no le sea imputable, rompiendo el nexo de causalidad al acontecer una situación eximente como la fuerza mayor, la culpa de la víctima y el hecho de un tercero.
El régimen de responsabilidad patrimonial del Estado y sus instituciones previsto en los artículos 9, y 41 de la Constitución Política, y 190 y siguientes de la Ley General de la Administración Pública, es entonces de naturaleza esencialmente objetiva, por lo que para nacer basta con que exista un daño indemnizable, una conducta administrativa y un nexo causal entre ambas. Existe una clara necesidad de demostrar la existencia de una relación entre el daño reclamado y la conducta desplegada por la Administración Pública, sea el nexo causal. En doctrina se han indicado diferentes criterios de imputación objetiva, pero debe destacarse, la causalidad adecuada. Con respecto a este criterio de causalidad, la Sala Primera de la Corte Suprema de Justicia en su voto 251-F-06 de las 10 horas 30 minutos del 25 de mayo del 2006, en conjunto con la teoría de la causa eficiente, explicó que: "XIV.- El nexo causal como presupuesto de responsabilidad.
La diversa tipología de las causas. (…) resta por establecer si la inacción administrativa del Ministerio de Salud por no verificar, de previo a emitir el permiso de salud y de funcionamiento, si el redondel cumplía con los estándares que dispone la Ley General de Salud, fue la causante directa o indirecta del daño, dado que la estimación de la demanda depende de la demostración de la existencia de un nexo causal, en su tradicional noción de causa-efecto. Al respecto cabe recordar que en la producción del daño suelen concurrir con frecuencia múltiples factores, dentro de los cuales es preciso determinar aquellos que directa o indirectamente son causa eficiente y adecuada del mal causado (…) En esa confluencia de elementos fácticos o jurídicos que rodean la situación dañosa, el Juzgador debe establecer, con base en las pruebas del proceso, si la acción concreta que consiste en un funcionamiento administrativo, o bien la abstención de desplegar el marco funcional que le impone el Ordenamiento Jurídico, es causa apta para la generación del daño (…)..
Es decir, para inferir la eficiencia de la causa que se tiene por adecuada, es indispensable deducir si es la productora de la lesión, de manera que de eliminarse, es racional deducir que el daño no se hubiera producido. Lo anterior supone un ejercicio valorativo para desplazar del marco de consideración, las causas que no han tenido ninguna influencia en el resultado (causas extrañas), de las que, de no haber tenido lugar, hubiesen evitado el menoscabo. Se trata de una especie de prognosis objetiva, a través de la cual se pueda afirmar que con tal acción u omisión es lógico o probable que se produzca el daño específico. En esta inteligencia, el nexo causal se impone como el inexorable vínculo relacional entre el daño y la conducta administrativa, de modo que sin esta, aquel probablemente no se hubiese producido. Claro está que la determinación de este factor depende en alto grado del examen de las pruebas traídas al proceso por las partes litigantes.
A partir de ellas, el Juzgador puede deducir si dentro del cuadro fáctico particular, las acciones del Estado conllevan a su responsabilidad, por haberse asociado su funcionamiento a la generación de las lesiones”. La Sala Primera se decanta por la teoría de la causalidad del daño en conjunto con la teoría de la eficiencia de la causa, para establecer aquella que presenta mayor aptitud para generar con mayor eficacia el daño y selecciona de todas las condiciones aquella que supone una posibilidad máxima en la contribución al resultado dañoso (mayor poder intrínseco de causación del daño). De esta manera se busca individualizar los hechos u omisiones que tengan efectiva influencia en la afectación que invoca la parte lesionada o que al menos sustente un grado de probabilidad objetiva en su influencia en el mismo (juicio de probabilidad del resultado basado en los hechos tenidos por demostrados que se realiza conforme las reglas de la experiencia).
En todo caso, es menester indicar que será carga de la parte que la invoca, la respectiva demostración de la existencia de dicho vínculo causal entre el hecho que se estima generador del daño y éste. Es con base en estas consideraciones que procede determinar la responsabilidad. En la responsabilidad por omisión administrativa (conducta omisiva), lo que se analiza es si la Administración Pública se encuentra en el deber legal de realizar una conducta y si incumplió ese deber. En esos casos de omisión, igualmente aplican los eximentes de responsabilidad de la fuerza mayor, la culpa de la víctima y el hecho de un tercero, por lo que en caso de concurrir cualquiera de ellas se entiende que el sujeto público a quien se le atribuye la omisión administrativa no es imputable y, por ende, no existe responsabilidad. De lo expuesto, resulta claro que no es suficiente invocar un daño, sino que se debe demostrar fehacientemente su existencia y el nexo de causalidad que le une con la conducta u omisión del ente responsable.
IX.Sobre el caso concreto: La demanda interpuesta consiste en un proceso civil de hacienda cuyo objeto está circunscrito a la pretensión indemnizatoria de la parte actora que reclama la supuesta invasión sufrida en la propiedad privada de previo a la puesta en posesión oficial de la franja expropiada y los daños derivados de tales actuaciones materiales. Lo anterior, según fue establecido en las resoluciones que resolvieron la excepción de incompetencia interpuesta, en concreto la resolución Nº76-2021 de las 11:55 horas del 20 de enero de 2021 de este Tribunal y la resolución Nº2441-C-S1-2022 de las 14:40 horas del 3 de noviembre de 2022 de la Sala Primera de la Corte Suprema de Justicia que en lo medular señaló: “[...] En el caso de estudio, se solicita indemnización en contra de los demandados, por motivo que, en apariencia, estos ingresaron ilegalmente a la propiedad del actor sin contar aún con los respectivos permisos, y realizaron un talud en la propiedad, y provocaron daños ambientales como materiales que le impidieron al accionante ingresar a su propiedad.
De conformidad con lo solicitado, al pretenderse una responsabilidad patrimonial y moral en contra del Estado (artículo 190 y siguientes de la Ley General de la Administración Pública), el presente proceso se enmarca dentro de los asuntos de conocimiento del Tribunal de lo Contencioso Administrativo y Civil de Hacienda.” (imágenes 288 a 292 del expediente judicial. El subrayado es nuestro). Se destaca que no forma parte del objeto de este proceso, ninguna pretensión anulatoria ni relacionada con el proceso expropiatorio ni con los rubros propios del justiprecio. A partir de lo aclarado, este Tribunal hará pronunciamiento en estricto apego a lo solicitado por la parte actora y se omitirá respecto de cualquier argumento que carezca de una pretensión claramente deducida en la demanda. En razón de lo anterior, este Tribunal estima que las pretensiones de la demanda resultan parcialmente procedentes, con fundamento en el análisis que de seguido se expone.
“[...] IV.- SOBRE LA CONSTITUCIONALIDAD DEL INCISO B) DEL ARTÍCULO 2 DE LA LEY DE CONTRATACIÓN ADMINISTRATIVA. Si bien, en esta acción no se impugna directamente la excepción contenida en el inciso b) del Artículo 2 de la Ley de Contratación Administrativa, lo cierto es que previo a resolver la constitucionalidad alegada es esta acción, es preciso efectuar un análisis de este inciso, dado que fue con base en esta norma, que se autorizó la contratación directa a la que se refiere la ley 9293 aquí cuestionada. El artículo 2 inciso b) de la Ley de Contratación Administrativa, dispone que:
“Artículo 2°.-Excepciones Se excluyen de los procedimientos de concursos establecidos en esta ley las siguientes actividades:
[…]” Tal como se indicó en el considerando anterior, existen casos muy calificados en los que por razones de urgencia, necesidad o por su naturaleza, la utilización de concursos o procedimientos licitatorios obstaculizan o enervan la posibilidad de satisfacer el interés público. Dentro de las excepciones por razones de urgencia o necesidad, se pueden citar, por ejemplo, los casos en que por eventos de la naturaleza como terremotos e inundaciones, surge la necesidad de contratar para la restauración de estructuras viales o la compra de insumos, entre otros, que por su carácter urgente, no puede esperar a la realización de trámites de licitación. Ahora bien, en cuando a las excepciones en atención a la naturaleza del acto, se enmarcan las negociaciones internacionales con otros Estados, que es precisamente, la que establece el inciso b) del artículo 2 de la Ley de Contratación Administrativa.
A juicio de esta Sala, la excepción contenida en dicho inciso resulta constitucionalmente válida, toda vez, que se refiere a los casos de contratación en el ámbito del Derecho Público Internacional, el cual por su naturaleza y características, es un orden jurídico autónomo, que se rige por reglas y principios diferentes a las del ordenamiento interno, entre ellos el principio de buena fe, de reciprocidad, soberanía, autonomía de la voluntad y cooperación, pero principalmente, está basado en el pleno consentimiento de los Estados. Es así, como de acuerdo con esos principios, los Estados a través de sus representantes, pueden entablar negociaciones y realizar convenios o acuerdos de cooperación y contratación de obras públicas, para obtener de esta forma el apoyo, los recursos, las ventajas y las condiciones que ofrecen las relaciones de cooperación internacional, con el fin de satisfacer un interés público de manera ágil, eficiente y oportuna.
Claro está, que para ejecutar y hacer valer el acuerdo en el ordenamiento interno, éste debe ser incorporado a través de un mandato legal, lo cual efectivamente, corresponde a la Asamblea Legislativa. En razón de lo anterior, al tratarse de negociaciones entre dos entes de Derecho Público Internacional, un Estado no puede imponer a otro, el sistema interno de contratación, ni la utilización de procedimientos licitatorios, se trata más bien de una cuestión de consensos entre ambos Estados al momento de pactar, por lo que el legislador optó por excluir este tipo de contrataciones de los procedimientos licitatorios establecidos en la Ley de Contratación Administrativa, no solo por la especial naturaleza de estos actos, sino también, para evitar el entorpecimiento y obstaculización de las relaciones internacionales de cooperación con otros países, y consecuentemente, la afectación del interés público que se pretende satisfacer.
En todo caso, cabe recordar, que el hecho de que la contratación se autorice en forma directa, no exime al Estado de la responsabilidad de controlar, fiscalizar y adoptar las medidas necesarias y oportunas, para que las obras se ejecuten conforme a Derecho, a lo pactado y de forma eficiente. Bajo tales circunstancias, estima esta Sala que la excepción contenida en el inciso b) del Artículo 2 de la Ley de Contratación Administrativa resulta acorde con el Derecho de la Constitución.
Una vez analizada la conformidad constitucional del inciso b) del Artículo 2 de la Ley de Contratación Administrativa, procede analizar la norma cuestionada en esta acción, sea la Ley 9293, a efecto de determinar, si la contratación directa que regula, se enmarca dentro del presupuesto de excepción al que hace referencia el citado inciso b), toda vez, que el alegato del accionante es, precisamente, que la norma quebranta en forma directa el artículo 182 de la Constitución Política, que exige un procedimiento de licitación para contratar, pues a su juicio, autoriza la contratación directa con una empresa pública pese a que no es un Estado, ni un sujeto de derecho internacional de los que menciona el inciso b) del Artículo 2 de la Ley de Contratación Administrativa, lo anterior, sin que exista un procedimiento de licitación. No obstante, observa esta Sala que la Ley 9293, desde su artículo primero, establece que:
“Se aprueba el Convenio Marco entre el Gobierno de la República de Costa Rica y el Gobierno de la República Popular China sobre el Otorgamiento de una Línea de Crédito Preferencial a la Parte Costarricense por la Parte China.”. (El resaltado no es original) Asimismo, de conformidad con el artículo 2 de la misma Ley, se establece que:
“ARTÍCULO 2.- Aprobación del financiamiento. Se aprueban el Contrato Suplementario para Aumentar la Cobertura, el Contrato de Préstamo Concesional por seiscientos veintiocho millones de yuanes (¥628 millones) y el Contrato de Préstamo Comercial y sus respectivas adendas por un monto de doscientos noventa y seis millones de dólares de los Estados Unidos de América (US$296 millones), suscritos entre el Gobierno de Costa Rica y el Banco de Importación y Exportación de China, el 3 de junio de 2013, y que financian el Proyecto de Rehabilitación y Ampliación de la Ruta 32, Sección Cruce Ruta 4-Limón.
[…]
"Contrato Suplementario para Aumentar la Cobertura sobre PROYECTO DE DISEÑO, REHABILITACIÓN Y EXTENSIÓN DE LA RUTA NACIONAL NO. 32 Entre El Gobierno de la República de Costa Rica Representado por el Ministerio de Hacienda como Prestatario y El Banco de Exportación e Importación de China como Prestamista El presente Contrato Suplementario para Aumentar la Cobertura al que de aquí en adelante nos referimos como "el presente Contrato") se celebra entre el Gobierno de la República de Costa Rica representado por el Ministerio de Hacienda y el Banco de Exportación e Importación de China.
Por cuanto: ------------------------------------------------------- 1) El 3 de junio del 2013, Consejo Nacional de Vialidad (CONAVI) y China Harbour Engineering Company Ltd. (CHEC) formalizaron el Contrato Comercial ( CC ) sobre la implementación del Proyecto para el Diseño, Rehabilitación y Extensión de la Ruta Nacional No. 32 (en adelante el "Proyecto"), con un monto total de 465,593,387.06 dólares de EE.UU. (US$ Cuatrocientos sesenta y cinco mil millones quinientos noventa y tres mil trescientos ochenta y siete con seis centavos). El Gobierno de la República de Costa Rica (GRCR) representado por el Ministerio de Hacienda (el Prestatario) solicita un Préstamo del Gobierno de la República Popular de China (GPRC) para financiar en parte el Proyecto.[…]” (El resaltado no es original) En ese sentido, de la simple lectura de la ley impugnada, se desprende, en primer término, que el objeto de la ley, es por un lado, aprobar el financiamiento acordado entre el Gobierno de la República Popular de China y el Gobierno de Costa Rica, para financiar el proyecto de proyecto rehabilitación y extensión de la ruta nacional N° 32 sección cruce ruta 4-Limón, así como los términos y condiciones en que se llevará a cabo dicho financiamiento.
En ese sentido, observa esta Sala que contrario a lo que afirma el accionante, la negociación que se aprueba en la ley impugnada sí se produce entre dos Estados –Costa Rica y China- y no entre Costa Rica y una empresa pública internacional; situación que claramente se enmarca dentro del caso de excepción contenido en el inciso b del Artículo 2 de la Ley de Contratación Administrativa. Asimismo, se constata que el financiamiento aprobado es para la rehabilitación y extensión de la ruta 32, obra que reviste un claro interés público, toda vez, que se trata de la ruta nacional que conecta la Capital con la provincia de Limón, la cual además de ser una de las rutas principales del país, tiene una gran importancia económica y comercial pues constituye un canal de transporte y distribución de los productos y bienes que se desembarcan en el puerto de Moín en Limón. Ahora bien, en cuanto a los sujetos que intervienen en el proyecto, tal como se indicó en el considerando anterior, desde el punto de vista de las relaciones internacionales, los Estados en ejercicio de su autonomía de la voluntad, pueden pactar los términos y condiciones en que se llevará a cabo el financiamiento, lo que incluye la designación de los órganos y sujetos que se encargarán físicamente, de ejecutar los acuerdos.
Con mayor razón, cuando se trata de un financiamiento de obra pública –tal como ocurre en este caso- el Estado prestamista, como cualquier otro acreedor puede, válidamente, establecer ciertas condiciones o requisitos con la finalidad de proteger sus fondos y disminuir los riesgos del crédito, por lo que incluso puede escoger la empresa que llevará a cabo la obra, no solo por su condición de acreedor, sino también como parte de la negociación a la que llegaron ambos Estados. En el caso particular, se observa, que producto de los acuerdos a los que llegaron ambos Gobiernos, todo lo relacionado con los recursos del financiamiento, será tramitado por el Ministerio de Hacienda en representación del Gobierno de la República de Costa Rica, y el Banco de Exportación e Importación de China por parte del Gobierno de la República Popular de China. Ahora bien, en cuanto a la ejecución de las obras públicas para la cual se solicitó el financiamiento, ambos Estados acordaron designar al Consejo Nacional de Vialidad (CONAVI) por parte del Gobierno de Costa Rica y a la empresa China Harbour Engineering Company Ltd.
(CHEC), por parte del Gobierno de China; todo lo anterior, como consecuencia directa de la negociación y los acuerdos a los que llegaron ambos Estados. No se trata entonces, de la contratación aislada de una empresa pública, para la realización de determinada obra, sino de uno de los puntos acordados entre dos Estados en el ámbito de negociaron internacional. De esta forma, se observa que la contratación e intervención de la empresa CHEC mencionada por el actor y sobre la cual se centra su impugnación, no es más que el producto de la negociación que llevaron a cabo el Gobierno de China y el Gobierno de Costa Rica, quienes al pactar los términos del financiamiento designaron los órganos y sujetos que se encargarían de girar y controlar los fondos, y los que debían ejecutar la obra, que en el caso de los primeros es el Ministerio de Hacienda y el Banco de China, y en el segundo, el CONAVI y la empresa China Harbour Engineering Company Ltd.
En consecuencia, estima esta Sala que la ley impugnada no es contraria a lo dispuesto en el artículo 182 de la Constitución Política, pues se trata de uno de los casos de excepción previa, expresa y taxativamente autorizados por el legislador en el artículo 2 inciso b) de la Ley de Contratación Administrativa; dado que lo autorizado por el legislador en la ley 9293 es un financiamiento acordado entre Estados, como parte de las relaciones de cooperación internacional entre ambos países, cuyo fin es satisfacer un interés público; por lo que la excepción a los procedimientos de licitación en este caso, resulta constitucionalmente válida. [...]”. (El subrayado es nuestro).
De lo expuesto, se extrae que el contrato suscrito entre el CONAVI y la empresa CHEC se enmarca como un tipo especial de negociación, con regulaciones y términos particulares pactados por las partes contratantes de aplicación obligatoria. En la misma línea, la Contraloría General de la República mediante oficio Nº05262 del 26 de abril de 2016 DCA-1062 otorgó el refrendo al contrato y a los Adendas 1, 2, 3 y 4 del "Proyecto de Diseño, Rehabilitación y Ampliación de la Ruta Nacional N° 32 Carretera Braulio Carrillo, Sección Intersección Ruta Nacional N° 4 (Cruce a Sarapiquí) - Limón", suscritos entre el Consejo Nacional de Vialidad y las empresas China Harbour Engineering Company Limited y China Harbour Engineering Company de Costa Rica, S.A, por un monto de $[Valor 012], bajo la modalidad de suma alzada, enfatizando en las diferencias de dicha contratación:
“[...] Particularmente, en relación con la selección del contratista, China Harbour Engineering Company Limited, es preciso apuntar que su designación como empresa encargada de la ejecución del presente proyecto, viene dada por el propio legislador, mediante la Ley No. 9293 con la que se “Aprueba financiamiento al proyecto rehabilitación y extensión de la ruta nacional N° 32 sección cruce ruta 4-Limón”. Al respecto, se tiene que como parte de las condiciones establecidas por el Banco de Exportación e Importación de China para otorgar el financiamiento, se dispuso que la empresa encargada de la ejecución del proyecto debía ser una empresa china, lo anterior queda constando en el documento DCI-406-13 del 04 de setiembre del 2013, en la que se muestra que dentro de la negociación fue el propio Gobierno de la República Popular de China quien propone inicialmente a la empresa China Harbour Engineering Company Limited para la ejecución del proyecto. Como parte de la negociación, nuestro país aceptó tal designación, lo que se materializó en un Acuerdo Comercial y luego se validó por parte del legislador, mediante la promulgación de la Ley No.9293. [...]”. (El subrayado es nuestro).
En materia de la responsabilidad del Conavi, el indicado refrendo de la Contraloría hizo especial referencia al tema de las expropiaciones de las propiedades privadas y puntualizó lo siguiente:
“[...] Por consiguiente, el Consejo estructurará oportunamente una estrategia para el abordaje del riesgo asociado a las expropiaciones, en las funciones que le correspondan a cada parte. Lo anterior por ser un tema extremadamente sensible para el éxito del proyecto, de forma que impactaría no solo tiempos de la construcción sino también podría afectar las obligaciones del financiamiento. Es por ello que se le reitera al Consejo que es de su exclusiva responsabilidad que las diferentes actividades atinentes a este tema sean desarrolladas de forma oportuna y eficiente, definiendo para ello los encargados de administrar el riesgo señalado y potenciar la posibilidad de cumplir con las fechas fijadas.
Para ello, en función de la relevancia que representa este tema en el proyecto en cuestión, el CONAVI deberá definir los lineamientos generales para el manejo de los riesgos inherentes a la tramitación de las expropiaciones, todo en aras de que no se presenten atrasos en la ejecución del programa de trabajo, particularmente de su ruta crítica, y se cumpla el plazo de ejecución definido por las partes, a saber un total de 42 meses (etapa de diseño 8 meses contados a partir de la fecha de inicio del diseño y etapa de construcción 34 meses contados a partir de la fecha de inicio de construcción y que se disponga de viabilidad ambiental otorgada por Setena), y que se atiendan oportunamente los predios que resultan necesarios para la ejecución de las obras, así como que se eviten posibles reclamos que podrían ocasionarse por parte de la contratista al considerarse que podrían tratarse de eventos compensables. [...]”. (El subrayado es nuestro).
En lo que se refiere a la responsabilidad del contratista CHEC el contrato suscrito y refrendado por la Contraloría General de la República, estableció de manera particular una claúsula de asunción exclusiva de la responsabilidad por el contratista de todos los daños ocasionados a la propiedad de terceros, que se encuentra vigente y de plena aplicación al caso bajo estudio. En concreto en la cláusula 17.1 se establece:
“17. Riesgos y Responsabilidades. 17.1 Indemnizaciones: El Contratista por ser el responsable de la ejecución de las Obras se hará responsable de toda reclamación, daño, pérdida y gasto (incluidos honorarios y gastos de abogados) relacionado con daños a (sic) o pérdida de cualesquiera propiedades, ya sean bienes raíces o personales, en la medida en que dicho daño o pérdida se produzca como resultado o en el curso del diseño del Contratista, la ejecución y terminación de las Obras y la reparación de cualesquiera defectos. / El Contratista se compromete frente a terceros, por actos o hechos con ocasión de su funcionamiento, por culpa, negligencia o impericia de sus funcionarios o terceros que se presenten durante el cumplimiento del objeto de este contrato. El Contratista será el único responsable de los riesgos del trabajo de todo su personal, así como, cualquier lesión, muerte o perjuicio a terceros, además por daños a la propiedad de terceros independientemente que los daños y perjuicios provocados por esos eventos, superen o no los montos definidos en las pólizas de seguros de las que disponga el Contratista o sus subcontratistas” (el subrayado es nuestro).
En el caso particular, se acreditó el daño causado por la actuación material de la empresa CHEC de ingresar sin el permiso del actor a su propiedad y talar los árboles por un error inexcusable producto de la negligencia de sus funcionarios, quienes actuaron sin verificar previamente las coordenadas de ubicación de los predios que sí contaban con permisos de sus propietarios. Lo anterior califica como culpa grave del contratista CHEC debido al irrespeto a la propiedad privada y a los daños patrimoniales provocados por la tala de árboles sin permiso del dueño, que deberá asumir en su totalidad. El Diccionario Usual del Poder Judicial define la culpa grave así: “Grado altísimo de negligencia en el cumplimiento de las obligaciones. Hay doctrina que, en virtud de la gran falta de diligencia, equipara la culpa grave al dolo. || Descuido total o desprecio absoluto de precaución para evitar un daño. || Ineptitud inexcusable”.
Se estima que la empresa CHEC y sus funcionarios no guardaron la diligencia mínima necesaria al momento de ingresar a las propiedades privadas para cerciorarse de que contaban con el permiso del dueño o con la puesta en posesión judicial, como le correspondía y era su deber. A efecto de determinar el monto actualizado de la madera, se remite el asunto a la fase de Ejecución de Sentencia para que con auxilio pericial se cuantifique el monto que deberá por los árboles talados en propiedad privada según el inventario realizado por el ingeniero Luis Gerardo Meneses Valverde del 19 de abril de 2020 visible a imágenes 32 a 36 del expediente principal. No procede reconocer el pago de reforestación ni de servicios forestales por mantenimiento de bosque, por cuando no se acreditó que el actor realizara tales acciones. En cuanto a la responsabilidad reclamada al CONAVI, no se acreditó en el expediente la supuesta falta al deber de vigilancia y supervisión del contratista CHEC.
Tampoco fueron desvirtuadas por el actor ninguna de las comunicaciones realizadas por el Consejo a la empresa Chec, tendientes a informar, comunicar y organizar la ejecución de la obra en conjunto con el Consorcio Supervisor del proyecto. Adicionalmente, la parte actora no argumentó con claridad y suficiencia las supuestas faltas al deber de vigilancia y supervisión del Conavi ni aportó la prueba de rigor, lo que impone el rechazo del extremo. Por último, se rechaza la pretendida distribución de responsabilidad porcentual repartida en el 70% a la empresa CHEC y 30% al Conavi por carecer de soporte normativo alguno, siendo que la norma contractual vigente y refrendada por el órgano contralor dispone la responsabilidad del 100% al contratista CHEC por daños a la propiedad de terceros, sin que se haya cuestionado ninguna contractual.
IX.En cuanto a las excepciones planteadas: las partes demandadas opusieron las excepciones de falta de legitimación y Falta de Derecho. Se acoge la falta de legitimación pasiva del Estado al acreditarse que no existe conducta estatal en los hechos de la demanda y que la participación obedece a integración conforme al numeral 12 inciso 2) del CPCA. Se rechaza la falta de legitimación activa sustentada en la condición de nudatario del actor, de conformidad con el artículo 316 del Código Civil el dueño de la nuda propiedad tiene la facultad de reclamar en juicio la cosa objeto de su propiedad, y el libre goce de todos y cada uno de los derechos que ésta comprende. En consecuencia, durante el goce del usufructo el nudo propietario puede vender su nuda propiedad, hipotecarla, cederla o de cualquier otro modo traspasarla, ejecutando los actos necesarios para conservar la cosa. El nudatario está obligado a abstenerse del derecho de transformación; de destruir e imponer servidumbres sobre el bien.
Adicionalmente, el artículo 363 del Código Civil dispone: “Cuando hubiere expropiación de la cosa usufructuada por causa de utilidad pública, el precio de la finca se colocará a interés, y el usufructuario gozará de la renta, durante el tiempo por que se constituyó su derecho”, supuesto que no se presenta en el caso bajo estudio y no resulta de aplicación. Se rechaza la falta de legitimación activa con base en un daño ambiental, toda vez que se sobre ese extremo se omitió pronunciamiento al no existir una pretensión vinculada. Siendo que el actor ostenta la condición de propietario registral de la finca objeto de litis que colinda con la ruta nacional 32, siendo que entre la empresa CHEC y el Conavi se suscribió para la ampliación de la indicada ruta, se acredita la relación jurídica procesal entre las partes y las pretensiones deducidas en la demanda, motivo por el cual se rechaza la falta de legitimación en su doble modalidad, activa y pasiva.
La Representación Conavi opuso la excepción de falta de Derecho que debe ser acogida al no acreditarse los reclamos planteados por el actor en su contra. Por último, se acoge parcialmente la falta de derecho interpuesta por Chec conforme a las consideraciones dadas en esta Sentencia, al haberse concedido de forma parcial las pretensiones de los actores y se declara parcialmente con lugar la demanda en contra de la empresa co-demandada CHEC.
X.Sobre las costas. El artículo 193 del Código Procesal Contencioso Administrativo establece que las costas procesales y personales se imponen al vencido por el solo hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o cuando la sentencia se dicte en virtud de pruebas que desconociera la parte contraria. En este caso, no se observan motivos que permitan excepcionar la máxima de condena al vencido. Por ello, se imponen ambas costas del proceso a cargo de la empresa co-demandada Chec en favor del actor. Se dicta sin especial condenatoria en costas con relación al Estado por existir obligación legal de ser integrado a la litis y al Conavi por estimar que había motivo suficiente para litigar, debiendo asumir cada parte las suyas. La determinación de lo correspondiente a las costas en cuanto a su importe, habrá de ser fijado por el juez competente en la fase de ejecución de sentencia a ruego de la parte demandada.
POR TANTO
Se admite la prueba para mejor resolver ofrecida por la empresa co-demandada CHEC y se rechaza la ofrecida por el actor. En lo que la demanda se dirigió contra el Estado, se acoge la falta de legitimación pasiva y se declara sin lugar la demanda en todos sus extremos. Se omite pronunciamiento sobre la falta de derecho. Se dicta sin especial condenatoria en costas. Respecto de la demanda seguida contra Consejo Nacional de Vialidad (Conavi), se rechaza la falta de legitimación en su doble modalidad y se acoge la excepción de Falta de Derecho. Se declara sin lugar la demanda en todos sus extremos. Se dicta sin especial condenatoria en costas. Sobre la demanda interpuesta en contra de la empresa contratista China Harbour Engineering de C.R. (CHEC) se rechaza la excepción de falta de legitimación activa y se acoge parcialmente la falta de derecho. En consecuencia, se declara parcialmente con lugar la demanda incoada por el señor [Nombre 001] contra CHEC, entendiéndose denegada en lo no expresamente concedido: i) Se condena a la empresa CHEC al pago de tres millones de colones en total, por concepto de daño moral subjetivo en favor del actor. ii) Se condena a la empresa CHEC al pago del valor actualizado de los árboles talados en la propiedad del actor sin su permiso y de previo a la puesta posesión, según el inventario levantado por el perito forestal Luis Gerardo Meneses Valverde en fecha 19 de abril de 2019, por concepto de daño económico, monto que deberá ser determinado en la fase de ejecución de sentencia con auxilio pericial. iii) Son las costas de este proceso a cargo de la empresa CHEC co-demandada en favor del actor, que se determinarán en la Etapa de Ejecución de Sentencia.- NOTIFÍQUESE.
