PROCEDURAL ACTIONS. The following occurred in the course of the proceedings:

By complaint filed on 10 de marzo del 2024, the plaintiffs asserted the following claims, seeking a judgment declaring as follows: “43.1 Grant this complaint in all respects, under the terms set forth throughout this pleading (facts, legal grounds, evidence, and claims). 43.2 Declare the defendant’s obligation to compensate the plaintiffs for the portions of properties 1-542449-000 rights 001, 002 and 003; 1-542450-000 rights 001, 002 and 003; and 1-542451-000 rights 001, 002 and 003 that are affected by the protection area (área de protección) of the unnamed permanent spring (naciente), with reference number ID 4224-2022, located at Lambert north coordinates: initial latitude 203.619 initial longitude 501.995 final latitude: 203.619 final longitude: 501.995, CRTM05: initial latitude: 1.089.016 initial longitude: 465.652 final latitude: 1.089.016 final longitude: 465.652. It is likewise referenced under the georeferencing (georreferenciación) CRTM05 East 465652 North 1089016.

In addition, property 1-542449-000 is affected twice, insofar as it also lies within the protection area of an unnamed intermittent spring, located at coordinates CRTM05: East:465592 North: 1088960. 43.3. Grant the defendant a maximum period of 2 months to bring its actions into compliance with the law and commence the expropriation proceeding (proceso de expropiación) for the portions of properties 1-542449-000 rights 001, 002 and 003; 1-542450-000 rights 001, 002 and 003; and 1-542451-000 rights 001, 002 and 003 that are affected by the protection area of the unnamed spring, with reference number ID 4224-2022, located at Lambert north coordinates: initial latitude: 203.619 initial longitude: 501.995 final latitude: 203.619 final longitude: 501.995, CRTM05: initial latitude: 1.089.016 initial longitude: 465.652 final latitude: 1.089.016 final longitude: 465.652. It is likewise referenced under the georeferencing CRTM05 East 465652 North 1089016, and, in the case of property 1-542449-000, which is also affected by the protection area of the unnamed intermittent spring, located at coordinates CRTM05: East: 465592 North: 1088960. 43.4 Order the State to pay both procedural costs and attorney’s fees (costas procesales y personales).” The plaintiffs expressly stated: “Pursuant to Articles 69 and 98 of the Código Procesal Contencioso Administrativo, because this is a purely legal matter in which there is no evidence to be presented, I request that, once the complaint has been answered, the proceeding be decided by direct judgment, without the need to receive additional evidence and dispensing with conciliation and the holding of hearings.” (See images 2 to 22 of the electronic court file).

After the Tribunal Contencioso Administrativo y Civil de Hacienda served the complaint on the State by order issued at 13:32 hours on 22 de marzo de 2024, and following the corresponding appearance, the State answered the complaint on 20 de mayo de 2024, denying it and asserting at that time the defenses of lack of standing to be sued (falta de legitimación pasiva) and failure to state a legal entitlement (falta de derecho). Accordingly, it requested that the complaint be dismissed in all respects and that the plaintiffs be ordered to pay both procedural costs and attorney’s fees. It additionally stated that it was unwilling to conciliate and, because there was no testimonial or expert evidence to be presented, requested pursuant to provision 69 of the Código Procesal Contencioso Administrativo that the corresponding hearings be dispensed with. (See images 71 to 74, and 80 to 88 of the electronic court file).

By order issued at 08:44 hours on 21 de mayo de 2024, the Tribunal Contencioso Administrativo y Civil de Hacienda deemed the complaint timely answered and granted the plaintiffs a period of three (3) business days to address the defenses of lack of standing to be sued and failure to state a legal entitlement asserted by the State. That order was served on the parties on 21 de mayo de 2024. Additionally, through that order, it verified compliance with the requirements contained in provision 69 of the Código Procesal Contencioso Administrativo and granted the request to process this proceeding by Direct Judgment. (See images 118 to 122 of the electronic court file).

By pleading dated 27 de mayo de 2024, the plaintiffs responded to the defenses asserted by the State in its answer, without submitting any documentary, expert, or testimonial evidence in addition to that already submitted with the complaint. (See images 124 to 146 of the electronic court file).

On 29 mayo de 2024, this matter was assigned for adjudication on the merits to Equipo de Trabajo I de Fondo, in accordance with the parameters established by Consejo Superior resolutions N° 84-2021 dated 28 de setiembre de 2021, Article XXVIII; N° 95-2021 dated 04 de noviembre de 2021, Article XXXIX; and N° 57-2023 dated 11 de junio de 2023, Article XXXVII, and the provisions issued by the Comisión de lo Contencioso Administrativo, based on the principle of equitable distribution of workloads and the assignment schedule for priority proceedings, in light of provision 69 of the Código Procesal Contencioso Administrativo. The statutory requirements and deadlines have been observed in these proceedings, and no flaws, defects, or omissions are apparent that could result in the nullity of the proceedings or deny the parties an adequate defense. This decision is issued unanimously and following deliberation by the members of this Tribunal, in accordance with the prioritization criteria for handling proceedings under the redesign of the Tribunal Contencioso Administrativo y Civil de Hacienda, and within the period established by provision 69 of the Código Procesal Contencioso Administrativo.

  • 9)On 15 de diciembre de 2003, Mr. José Carlos Padilla Pérez, holder of identity card N° 1-0522-0750, acquired title to right 003 of property registered under real property folio N° 542451, in the San José Registry District, described as follows: Lot Three, Land for construction; located in District 1: Santiago, Canton 4: Puriscal, Province of San José; bounded on the North by: Remainder designated for a public street, with frontage of 45 meters 25 centimeters; on the South by: Francisco Gutiérrez Hidalgo; on the East by: Public street, with frontage of 20 meters 68 centimeters; and on the West by: Sara Marín Porras; measuring nine hundred seventy-one square meters and twenty-two square decimeters, and recorded under cadastral survey plan N° SJ-00854978-2003. The basis of title is not specified. (Uncontested fact; see Literal Certification N° RNPDIGITAL-344557-2024 issued by the Registro Nacional at 13:55 hours on 05 de marzo de 2024, appearing at image 44 of the electronic court record).
  • 10)On 21 de abril de 2017, the Dirección de Agua del Ministerio de Ambiente y Energía, in the Province of San José, Canton of Puriscal, District of Santiago, Santiago Site, identified an unnamed water source classified as a spring (naciente), corresponding to an intermittent publicly owned watercourse (cauce de dominio público) whose tributary is an unnamed stream, Río Grande 3345-IV map sheet, (84-24)-Tárcoles watershed, corresponding to cadastral survey plan N° SJ-1184864-2007 and located at the following coordinates: LAMBERT NORTE: Initial Latitude: 203.563, Initial Longitude: 501.940. The stated justification was: “THIS IS AN INTERMITTENT SPRING; THIS LOCATION COINCIDES WITH OPINION AT-5175-2013, PREPARED DURING THE 2013 RAINY SEASON BY ENGINEER IGNACIO CAMPOS. THERE IS ANOTHER OPINION, AT-1166-2014, FROM THE 2014 DRY SEASON, PREPARED BY ENGINEER JESÚS MONGE, WHICH LOCATES THE SPRING POINT APPROXIMATELY 26 METERS DOWNSTREAM. HOWEVER, WHAT IS PRESENT IN THAT CASE IS THE BASE FLOW OF THE STREAM THAT GIVES RISE TO THIS SPRING, SINCE, AS INDICATED, THE SPRING IS UPSTREAM.” (Capitalization is from the original; see Official Letter N° DA-UHTPCOSJ-1074-2017 dated 21 de abril de 2017, appearing at images 105 through 107 of the electronic court record).
  • 11)On 12 de enero de 2023, the Departamento de Control y Desarrollo Urbano of the Municipalidad de Puriscal denied the application submitted by Mr. José Carlos Padilla Pérez for a land-use permit (permiso de uso de suelo) to construct a dwelling on property registered under real property folio N° 542449-000 in the San José Registry District. Specifically, the Environmental Restrictions (Limitaciones Ambientales) section stated as follows: “The property in question DOES have a restriction under current land-use planning (ordenamiento territorial) legislation regarding establishment of the requested construction activity, because the property in question lies within the protection radius (radio de protección) of an Intermittent Spring pursuant to determination DA-UHTPCOSJ-1074-2027 dated 21 de abril del 2017, located at coordinates (CRTM05) East: 465592 and North: 1088960; therefore, a protection radius of 50 meters applies pursuant to the Water Law (ley de Aguas).

It is also located within the protection radius of a Spring for which no determination has been issued by the Dirección de Aguas, located at coordinates (CRTM05) East: 465645 North: 1089012. (…)” Accordingly, that Municipal Department determined that “the RESIDENTIAL use requested for the property of interest at coordinates (CRTM05) East: 465587 North: 1088939 IS NOT PERMITTED.” (Emphasis and capitalization are from the original; see Land-Use Certificate N° MP-AM-CU-US 0012-2023 dated 12 de enero de 2023, appearing at images 59 and 60 of the electronic court record).

  • 12)On 15 de mayo de 2023, the Dirección de Agua del Ministerio de Ambiente y Energía, in the Province of San José, Canton of Puriscal, District of Santiago, Junquillo Abajo Site, identified an unnamed water source classified as a permanent spring, whose tributary is an unnamed stream, Río Grande map sheet, (88-26)-Parrita watershed, located at the following coordinates: LAMBERT NORTE: Initial Latitude: 202.600, Final Latitude: 202,600; Initial Longitude: 502.282 and Final Longitude: 502.282. CRTM02: Initial Latitude: 1.087.997, Final Latitude: 1.087.997; Initial Longitude: 465.933 and Final Longitude: 465.933. It was determined to be a permanently flowing publicly owned body of water (cuerpo de agua de dominio público), and its prior record is Opinion N° DA-UHTPCOSJ-0325-2022 issued by that same Dirección. (See Official Letter N° DA-UHTPCOSJ-0841-2023 dated 15 de mayo de 2023, appearing at images 46 through 49 of the electronic court record).
  • 13)On 15 de mayo de 2023, the Dirección de Agua del Ministerio de Ambiente y Energía, in the Province of San José, Canton of Puriscal, District of Santiago, Junquillo Abajo Site, identified an unnamed water source classified as a permanent spring, whose tributary is an unnamed stream, Río Grande map sheet, (88-26)-Parrita watershed, located at the following coordinates: LAMBERT NORTE: Initial Latitude: 203.619, Final Latitude: 203,619; Initial Longitude: 501.995 and Final Longitude: 501.995. CRTM05: Initial Latitude: 1.089.016, Final Latitude: 1.089.016; Initial Longitude: 465.652 and Final Longitude: 465.652. It was determined to be a permanently flowing publicly owned body of water. (See Official Letter N° DA-UHTPCOSJ-0841-2023 dated 15 de mayo de 2023, appearing at images 49 through 51 of the electronic court record).
  • 14)On 16 de junio de 2023, the Departamento de Control y Desarrollo Urbano of the Municipalidad de Puriscal denied the application submitted by Mr. José Carlos Padilla Pérez for a land-use permit to construct a dwelling on property registered under real property folio N° 542451-000 in the San José Registry District. Specifically, the Environmental Restrictions section stated as follows: “The property in question DOES have a restriction under current land-use planning legislation regarding establishment of the requested construction activity, because the property in question lies within the protection radius of a PERMANENT Spring pursuant to determination DA-UHTPCOSJ-0841-2023 15-MAYO-2023, located at coordinates (CRTM05) East: 465652 and North: 1089016; therefore, a protection radius of 100 meters applies pursuant to Article 33 of the Ley Forestal.” Accordingly, that Municipal Department determined that “the RESIDENTIAL use requested for the property of interest at coordinates (CRTM05) East: 465670 North: 1088972 IS NOT PERMITTED.” (Emphasis and capitalization are from the original; see Land-Use Certificate N° MP-AM-CU-US 0530-2023 dated 16 de junio de 2023, appearing at images 53 and 54 of the electronic court record).
  • 15)On 16 de junio de 2023, the Department of Urban Development and Control of the Municipalidad de Puriscal denied the application for a land-use permit (permiso de uso de suelo) for the construction of a dwelling on property registered under real-property folio N° 542450-000 of the San José Registry District, submitted by Mr. José Carlos Padilla Pérez. In doing so, it stated the following in the Environmental Restrictions section: “The property in question DOES have a restriction under current legislation relating to land-use planning (ordenamiento territorial) for undertaking the requested construction activity, since the property in question is located within the protection radius of a PERMANENT spring (Naciente PERMANENTE), pursuant to opinion DA-UHTPCOSJ-0841-2023 15-MAYO-2023, located at coordinates (CRTM05) Easting: 465652 and Northing: 1089016; accordingly, a protection radius of 100 meters applies, pursuant to Article 33 of Ley Forestal.” Consequently, that Municipal Department resolved that “the RESIDENTIAL use requested for the property in question at coordinates (CRTM05) Easting: 465670 Northing: 1088972; IS NOT PERMITTED.” (The highlighting, underlining, and capitalization appear in the original, Land-Use Certificate N° MP-AM-CU-US 0529-2023 dated 16 de junio de 2023, visible in images 56 and 57 of the electronic judicial case file).
  • 16)By resolution N° RES-MP-AM-HM-AT-VL-023-2023 issued at 11:30 on 13 de julio de 2023, the Valuation Office of the Municipalidad de Puriscal, in response to the written application submitted by the claimants regarding the reassessment of properties registered under real-property folios N° 542449, interests 001, 002 and 003; N° 542450, interests 001, 002 and 003; and N° 542451, all of the San José Registry District, because they are located within the protection zone (zona de protección) of a permanent spring, ordered the following in the operative portion of the resolution: “The taxable value recorded in the database for property 1-542449-000 must be amended to ¢112.817.656,00, with the new amount payable being ¢0, so that non-taxability (no sujeción) may be applied because the property has been located in a protection zone since 21 de abril del 2017. Likewise, the taxable value recorded in the database for property 1-542450-000 must be amended to ¢75.890.542,00, with the new amount payable being ¢0, so that non-taxability may be applied because the property has been located in a protection zone since 21 de abril del 2017.

Lastly, the taxable value recorded in the database for property 1-542451-000 must be amended to ¢46.230.072,00, with the new amount payable being ¢0, so that non-taxability may be applied because the property has been located in a protection zone since 15 de mayo del 2023. The taxpayer is obligated to notify this office if the status of the protection zone undergoes any change.” (See images 63 through 70 of the electronic judicial case file).

II. UNPROVEN FACTS

The following are deemed unproven facts relevant to rendering judgment, either because the parties failed to meet their burdens of proof or because this Court found no suitable evidence that, under the principle of sound judicial assessment (sana crítica), would establish them:

  • 1)That, at the time of the events, there was a legal provision in force requiring the State to compensate for or expropriate properties registered under real-property folios N° 542449, interests 001, 002 and 003; N° 542450, interests 001, 002 and 003; and N° 542451, all of the San José Registry District. (No evidence establishing this was submitted).
  • 2)That the statutory environmental restrictions (limitaciones legales de carácter ambiental) affecting the claimants’ properties entail a severance or extinguishment of the ownership rights (derecho de propiedad) therein and, consequently, give rise to a duty on the part of the State to pay compensation. (No evidence establishing this was submitted).
  • 3)That the claimants, Manuel Padilla Pérez, Elena Rocío Padilla Pérez, and José Carlos Padilla Pérez, acquired the real properties registered under real-property folios N° 542449, interests 001, 002 and 003; N° 542450, interests 001, 002 and 003; and N° 542451, all of the San José Registry District, before the legal provisions establishing the environmental restrictions—an environmental protection zone due to the existence of a “spring”—affecting those properties entered into force. (There is no evidence in the record demonstrating this).
  • 4)The exact date on which the permanent water sources (fuentes de agua permanentes), or springs, and the intermittent publicly owned watercourse (cauce de dominio público intermitente) affecting properties registered under real-property folios N° 542449, interests 001, 002 and 003; N° 542450, interests 001, 002 and 003; and N° 542451, all of the San José Registry District, naturally formed or visibly emerged. (No evidence establishing this was submitted).
  • 5)Proof of special and abnormal harm (daño especial y anormal) to the claimants’ ownership rights at issue in this litigation, as well as proof that only a small proportion of persons were affected or that the harm arising from the environmental restrictions affecting properties registered under real-property folios N° 542449, interests 001, 002 and 003; N° 542450, interests 001, 002 and 003; and N° 542451, all of the San José Registry District, was exceptionally severe. (No evidence establishing this was submitted). -

III. REGARDING THE PLAINTIFFS’ ARGUMENTS

As indicated above, in their complaint and reply to the answer to the complaint, the plaintiffs, Manuel Padilla Pérez, Elena Rocío Padilla Pérez, and José Carlos Padilla Pérez, state that they are co-owners in equal shares (one-third ownership each) of the properties located in Santiago de Puriscal, Province of San José, recorded under real-property folio registration N° 542449, rights 001, 002 and 003; N° 542450, rights 001, 002 and 003; and N° 542451. They further state that the cited properties lie entirely within the protection area (área de protección) of the permanent spring (naciente permanente), “unnamed, with reference number ID 4224-2022, Source Number 2, located at Lambert North coordinates: initial latitude: 203.619 initial longitude: 501.995 final latitude: 203.619 final longitude: 501.995, CRTM05: initial latitude: 1.089.016 initial longitude: 465.652 final latitude: 1.089.016 final longitude: 465.652, hereinafter ‘Spring 1.’ It is likewise referenced under the CRTM05 georeferencing East 465652 North 1089016.

For its part, property 1-542449-000 is affected both by spring ID 4224-2022 and by the intermittent spring (naciente intermitente) delimited by the coordinates (CRTM05) East: 465592 North: 1088960, hereinafter ‘Spring 2.’” In their complaint, they specify that the spring identified as number 1 was determined by the Dirección de Agua del Ministerio de Ambiente y Energía (hereinafter, which may be abbreviated as MINAE) through official letter N° DA-UHTPCOSJ-0841-2023 dated 15 de mayo de 2023, and is regulated by the legislature in Article 33(a) of the Ley Forestal, Ley N° 7575 dated 13 de febrero de 1996, which establishes a one-hundred-meter radius, measured horizontally, as a protection zone (zona de protección). Article 34 of that law establishes a prohibition on logging (talar) in the protected areas or zones described in Article 33 of the law under discussion. Regarding the spring identified as number 2, they indicate that its protection zone is regulated by the Ley de Aguas, Ley N° 276 dated 27 de agosto de 1942, Article 149 of which establishes a fifty-meter protection radius in cases involving flat land, within which owners are prohibited from destroying public or private forests.

They claim that Spring 2 was identified by the Dirección de Agua del MINAE through official letter N° DA-UTTPCOSJ-1074-2017. By virtue of these environmental restrictions (limitaciones ambientales), the plaintiffs maintain that they are unable to make any commercial or residential use of their properties, “entirely hollowing out their property right and preventing any commercial and/or residential use or development of the affected Properties.” Faced with this situation, and because they consider these restrictions on their properties neither reasonable nor proportionate, they contend that the State incurs strict liability (responsabilidad objetiva) to redress the damage to their assets by paying compensation, which they have not received from the State to date for the adverse effects caused by the properties’ location within the protection zones of Springs N° 1 and 2. In support of this request for compensation, they discuss the arguments set forth by the Sala Primera de la Corte Suprema de Justicia in Decision N° 00199-2010 at 15:30 on 04 de febrero de 2010, to the effect that the restrictions governed by Article 34 of the Ley Forestal implicitly restrict the exercise of those incidents of ownership (facultades de dominio) that could directly or indirectly affect a permanent spring, as evidenced by the fact that the Municipalidad de Puriscal issued findings of noncompliance for the land-use certificates (certificados de usos de suelo) sought for residential construction on their properties.

They subsequently argue, as part of their theory of the case, that the Tribunal Constitucional, in Decision N° 4205-1996 at 14:33 on 20 de agosto de 1996, established that: “private [property restrictions] reach their natural boundary at the degree to which the property is affected; that is, when the restriction on the property right becomes a true expropriation, with the consequent obligation to provide compensation, because the property right is made to disappear entirely, or when it does not affect the community as a whole. The Corte Plena stated as much regarding restrictions imposed on property when they exceed the indicated limit, at its extraordinary session of dieciséis de junio de mil novecientos ochenta y tres: ‘[...] that is, “restrictions,” as Article 45 calls them, but not dispossession of private property or deprivation of a primary incident of ownership, because preventing the enjoyment of property is equivalent, at least in this case, to a form of expropriation without the requirement of prior compensation mandated by the Political Constitution’”; they maintain that the restrictions affecting their properties extend across 100% of their area because the properties are located within the protection zone of Spring 1 and, in the case of the property recorded under real-property folio registration N° 542459-000 of the Province of San José, also within that of Spring 2, “which prevents any use or development by my Clients, who are its owners.

This restriction on the property right is excessive in this specific context.” Throughout their presentation, they reiterate that the circumstances entail a significant impairment of their property right, which, in their view, even “compromises its fundamental essence”; they assert that “Although they are not formally classified as expropriations, these restrictions on the powers inherent in the property right are so severe that they transform possession into mere legal title. This substantial alteration of the right justifies adequate compensation similar to that which would be awarded in cases of expropriation.” Accordingly, they allege a violation of the property right protected by Article 45 of the Constitución Política and Article 21 of the Convención Americana de Derechos Humanos and maintain that the appropriate and necessary proceedings must therefore be initiated to expropriate their real property pursuant to the Ley de Expropiaciones: “This is because the property right has been completely hollowed out and nullified for a validated public-interest reason, namely the conservation of aquifer resources.

Accordingly, for as long as the State fails to provide adequate compensation, it would be committing an unlawful omission that the Owners are not required to tolerate.” A second argument advanced by the plaintiffs is the liability of the State as legislator (responsabilidad del Estado Legislador) based on the special and abnormal sacrifice (sacrificio especial y anormal) suffered by the plaintiffs. To that end, they begin by asserting that Articles 9 and 41 of the Constitución Política give rise to the State’s strict liability whenever the performance of its functions causes damage or loss, without any need to examine intent or negligence. That liability is provided for by law in Articles 190 and 191 of the Ley General de la Administración Pública, provisions that they quote; they also cite, in support of their position, Decision N° 213-2008 at 8:20 on 25 de marzo de 2008 of the Sala Primera de la Corte Suprema de Justicia, deriving therefrom liability for lawful or unlawful, normal or abnormal operation (funcionamiento legítimo o ilegítimo, normal o anormal).

They continue by stating that, “It is clear that the State as legislator enacted the Ley Forestal, which prohibits any type of construction, use, development, or interference within a radius of 100 meters around permanent springs insofar as those activities could cause some type of adverse effect or damage to those water sources, as well as the Ley de Aguas, which prohibits the use or development of the area located within a radius of 50 meters around intermittent springs. These provisions affect both springs already existing at the time of their enactment and those that may arise or be identified on private property in the future, as occurred in the case under review. (…) In the specific case before us, the identified springs affect the entirety of the Affected Properties, preventing the full exercise of the property right. This situation resembles a constructive expropriation (expropiación tácita), since the restriction has gone beyond being reasonable and has become a total deprivation of the right.” Based on the foregoing, and after citing Article 194 of the Ley General de la Administración Pública and Decision N° 00796-1991 at 15:10 on 26 de abril de 1991, they maintain that this constitutes normal operation through lawful conduct that causes compensable damage, thereby giving rise to the State’s strict liability for the following reasons: i) the designation of environmental protection areas is a clear manifestation of lawful conduct by the State, with direct effects on the plaintiffs’ assets; ii) the plaintiffs’ economic rights are clearly impaired, and the State has no grounds for requiring them to sacrifice the entire value of their properties in the public interest without the corresponding fair and prior compensation, under penalty of violating the principle of equality in bearing public burdens (principio de igualdad en el sostenimiento de las cargas públicas); iii) “Third, the State’s conduct causes special and abnormal damage to my Clients.

On the one hand, the damage is special insofar as it financially affects a small but identifiable group of persons: the plaintiffs in these proceedings. It is also abnormal because of its severity, intensity, and significance, since the public burden represented by the Protection Areas in the particular case of the Affected Properties, which lie 100% within the protection area of Spring 1, exceeds the limit of what my Clients are required to bear because their property right has been hollowed out in its entirety, which necessarily entails compensation by the State.” They therefore conclude that there is an objective causal link (nexo de causalidad objetivo) between the specific manifestation of the State function—consisting of the imposition of environmental restrictions (protection zones) through the Ley Forestal and the Ley de Aguas—and the injury caused to the governed parties (because their properties are 100% restricted by those measures), impairing their property right and placing them in a situation of de facto expropriation (expropiación de hecho), in violation of the principle of equality in bearing public burdens and Articles 18, 33 and 45 of the Constitución Política.

This strict liability of the State as legislator creates a right to compensation for the special and abnormal damage that they suffer: “Therefore, for as long as the State fails to provide adequate compensation through the expropriation process established by law, we are faced with a continuing unlawful act and omission that results in a serious restriction of the right to private property.” Finally, they base their complaint on Article 21 of the Convención Americana sobre Derechos Humanos; Articles 18, 33, 45 and 49 of the Constitución Política; Articles 190, 191, 194 and 196 of the Ley General de la Administración Pública; Articles 13 and 17 of the Ley de Expropiaciones; Articles 33 and 34 of the Ley Forestal; Article 149 of the Ley de Aguas; and Articles 10, 12, 36, 42, 43, 69, 98, 122, 220 and related provisions of the Código Procesal Contencioso-Administrativo, in addition to the cited opinions and case law, pursuant to Articles 7 and 8 of the Ley General de la Administración Pública.

In the hearing granted by the Contentious-Administrative Court through the ruling issued at 8:45 hours on 21 de mayo de 2024 concerning the State’s response, with respect to lack of standing to be sued (falta de legitimación pasiva), they assert that “the purpose of the Complaint is not to have the administrative acts issued by the Municipality or the Water Directorate declared null and void, given the existence of the springs (nacientes), and, accordingly, the protection area (área de protección) within the radius established by the Legislative Branch has likewise been duly confirmed. Therefore, the attempt by the State’s representative to shift liability to the Municipality is improper,” but rather to establish liability on the part of the Legislative Branch, since the restriction on their property arises from a statutory provision and, because it deprives the property right of its substance, the claimed compensation must be awarded, as it constitutes a de facto expropriation (expropiación de hecho). They reiterate the arguments set forth in the complaint and described above. -

IV. THE STATE’S THEORY OF DEFENSE

In its answer to the complaint, the State’s representation denied all the allegations therein. It states in its answer that, in this case, there is a lack of standing to be sued (falta de legitimación pasiva), because the administrative acts (actos administrativos) that denied land use approval (uso de suelo) for construction were issued by the Municipalidad de Puriscal and not by the State; it thus refers to official letters N° MP-AM-CU-US 530-2023 and N° MP-AM-CU-US 0529-2023, both dated 16 de junio de 2023, and official letter N° MP-AM-CU-US 0012-2023 dated 12 de enero de 2023, noting that the latter does not include an opinion from the Dirección de Agua del Ministerio de Ambiente y Energía. Its position is that, because there is “no action whatsoever by the State, whether by act or omission, that would entail its liability,” the State’s defense of lack of standing to be sued must be sustained.

In addition, it raises the defense of failure to state a legally cognizable right (falta de derecho), asserting that both the Ley de Aguas and the Ley Forestal establish “non-compensable restrictions on private property.” (Bold emphasis appears in the original), provisions that were enacted before the plaintiffs acquired the property. It thus states: “The restrictions established in Articles 33 and 34 of the current Ley Forestal have their statutory antecedent in Ley Forestal Nº 4465 de 25 de noviembre de 1969, Articles 84 et seq., and the restrictions established in Articles 148, 149 and 151 of the Ley de Aguas date from 1942. Ley Forestal Nº 7575 entered into force (sic) on 16 de abril de 1996, and Ley de Aguas Nº 276 did so on 27 de agosto de 1942, whereas the parties acquired the property in 2003; that is, when the property was acquired, it was already subject to the restrictions established in those statutes.” In addition, it maintains that the Sala Constitucional has broadly recognized the legitimacy of non-compensable restrictions on the right to property, setting out the position adopted by that Constitutional Court in Resolution N° 8234-97 at 6:15 hours on 03 de diciembre de 1997, and citing Resolution N°0062-2019 at 8:25 hours on 30 de setiembre de 2019 of the Tribunal Contencioso Administrativo, a judgment that, in turn, quotes Resolution N° 4205-96 at 14:33 hours on 20 de agosto de 1996 of the Sala Constitucional de la Corte Suprema de Justicia.

It argues that the record lacks evidence “that would make it possible to determine with certainty that the restriction contained in Article 33(a) of the Ley Forestal and in Sections 148, 149 and 151 of the Ley de Aguas is of such magnitude that it prevents any use whatsoever of the property. The plaintiffs have not demonstrated that they have been unable to use the property, that their rights of enjoyment and possession have been affected, or that the existence of protected areas (áreas de protección) on the property renders it entirely unusable for the purposes sought by the plaintiffs.” Indeed, the State maintains that it is false that every type of construction, exploitation, or use of the property is prohibited. Based on the foregoing, it asserts that no adequate causal link (nexo de causalidad adecuada) has been established between the damage (whose existence it disputes) and the legally established restrictions; therefore, in accordance with the doctrine developed by the Constitutional Court, it must be demonstrated that the plaintiffs’ right to property has been deprived of its substance, which is essential to obtain any type of compensation, and no such showing has been made.

It considers that the Ley Forestal and the Ley de Aguas contain a series of restrictions that do not prevent owners from exercising all the incidents of the right to property; in its view, “These are limits or boundaries on the scope of the right to property, which can never itself be limited: ‘the limitation of a right operates upon that normal content so as to restrict the possibilities for its exercise.’” As part of the grounds supporting its position, it cites Resolution N° 0075-2011 at 11:10 hours on 12 de agosto del 2011, issued by the Tribunal Contencioso Administrativo y Civil de Hacienda, which cites judgments N° 5833-2002 and 2004-1924 of the Sala Constitucional. By virtue of the foregoing, it requests that the complaint filed by Manuel Padilla Pérez, Elena Rocío Padilla Pérez, and José Carlos Padilla Pérez be dismissed in its entirety and that they be ordered to pay procedural and attorneys’ costs (costas procesales y personales), together with interest until payment in full. -

V. SUBJECT MATTER OF THE PROCEEDING

An analysis of the record, the complaint, and the relief sought shows that the subject matter of the proceeding centers on a claim for compensation equal to the full value of the properties recorded under real-property folio registration numbers (matrículas folios reales) N° 542449, rights 001, 002 and 003; N° 542450, rights 001, 002 and 003; and N° 542451, all registered in the Partido de San José and owned by the plaintiffs. The claim arises principally from the identification of two bodies of water—a permanent spring (naciente permanente) and a spring classified as an intermittent public-domain watercourse (naciente clasificada como un cauce de dominio público intermitente)—near those properties, requiring application of the 100-meter and 50-meter protected zones (zonas de protección), respectively, established in Articles 33 and 34 of Ley Forestal, Ley N° 7575, and Section 149 of Ley de Aguas, Ley N°276.

The plaintiffs thus assert two grounds for their claims for compensation. First, they contend that all of those properties must be expropriated because the environmental restrictions imposed by the cited legislation deprive their private-property rights of substance by affecting one hundred percent of the properties and preventing residential and commercial construction. In their view, these are excessive restrictions for which compensation is payable, absent which the principles of equality in bearing public burdens and legality would be violated by impairing—as they maintain—the essential substance of the fundamental right enshrined in constitutional provision 45. Second, they contend that the conditions established in Section 194 of the Ley General de la Administración Pública, and indeed the entire regime governing the financial liability (responsabilidad patrimonial) of the “Legislative State” (Estado Legislador), apply on the basis of lawful conduct (conducta lícita) and normal operation, because the environmental protected zones contained in the Ley Forestal and the Ley de Aguas with respect to the plaintiffs’ properties cause harm to the plaintiffs’ financial interests that they characterize as “special, abnormal, unequal, and capable of being economically quantified through expropriation proceedings.” They therefore focus on a claim for economic loss (daño patrimonial); however, it is also noted that they assert no additional claim for non-pecuniary damage (daño moral), whether subjective or objective.

Accordingly, they seek an order from this Court requiring the State to pay for the entirety of the properties recorded under real-property folio registration numbers N° 542449, rights 001, 002 and 003; N° 542450, rights 001, 002 and 003; and N° 542451, all registered in the Partido de San José. They further request that, for this purpose, the State be ordered to commence expropriation proceedings for the “ut supra” properties within a period of two months. It is relevant to note, however, that the relief sought in this litigation does not include an analysis of whether the administrative acts issued by the Municipalidad de Puriscal were lawful or unlawful insofar as they found that the requested use for the “construction of housing” on the plaintiffs’ properties was noncompliant, upon determining that the properties lay within the radius of the protected zone regulated by Articles 33 and 34 of the Ley Forestal and Section 149 of the Ley de Aguas.

Those acts are official letters N° MP-AM-CU-US 530-2023 and N° MP-AM-CU-US 0529-2023, both dated 16 de junio de 2023, and official letter N° MP-AM-CU-US 0012-2023 dated 12 de enero de 2023, issued by the Municipal Corporation (Corporación Municipal). Nor does the dispute in this case include judicial review of the legality of the formal conduct undertaken by the Dirección de Agua del Ministerio de Ambiente y Energía through official letters N° DA-UHTPCOSJ-1074-2017 dated 21 de abril de 2017 and N° DA-UHTPCOSJ-0841-2023 dated 15 de mayo de 2023, in which, following an on-site inspection (inspección in situ), it verified the existence of the bodies of water—a permanent spring and an intermittent spring—on the three properties at issue in this proceeding. To the contrary, the requested relief and the grounds stated in the complaint show that this administrative action constitutes the premise for the corresponding financial claim for compensation.

Consequently, this Court conducts its analysis within the factual and legal framework derived from the contents of the complaint and the answer thereto, as well as from a comprehensive analysis of the admitted evidence, excluding the matters identified in this section. From this perspective, in compliance with the principle of party disposition (principio dispositivo), this Collegiate Chamber (Cámara Colegiada) will analyze the relief sought in the litigation and resolve the arguments that, in the plaintiffs’ view, support their claims, within the limits of the framework set forth above. -

VI. ANALYSIS OF THE SPECIFIC CASE

As a preliminary matter, this Court identifies two specific claims asserted by the plaintiffs’ counsel in the complaint: 1) A claim for compensation for the entirety of the properties recorded under real-property folio registration numbers N° 542449, rights 001, 002 and 003; N° 542450, rights 001, 002 and 003; and N° 542451, all registered in the Partido de San José. 2) A claim for affirmative relief (pretensión de “hacer”), consisting of an order requiring the State to commence expropriation proceedings within two months. As noted above, both claims rest on the premise that the environmental restrictions affecting those properties are compensable, thereby satisfying the criteria giving rise to administrative liability (responsabilidad administrativa) based on lawful conduct by the Legislative State and establishing what the plaintiffs describe as a de facto expropriation (expropiación de hecho).

Accordingly, the Court considers it relevant to analyze this legal doctrine and its differences from the regime governing restrictions on private property as the basis for the reasoning of this judgment. Following that order, the Court will now consider and resolve the claims, taking into account in its analysis the arguments submitted by both parties and the evidence contained in the court record, and relating them to the claims set forth in the complaint. - THE CONSTITUTIONAL REGIME GOVERNING PRIVATE PROPERTY:

There is a general consensus that a Social and Democratic State governed by the rule of law (Estado Social y Democrático de Derecho), such as ours, is grounded in respect for freedom in its various dimensions, which entail the recognition of freedom of enterprise, or free trade and markets, consumers’ freedom of choice, freedom to choose one’s occupation or work, as well as the related freedom to “have,” alluding to the right to private property. These constitute pillars upon which the Costa Rican constitutional system rests; and because the courts are subject to the Constitution (numerals 153 of the Political Constitution and 1 of the Organic Law of the Judiciary), when resolving a dispute such as the one at issue in this litigation, this Chamber of Judges must take those constitutional and democratic principles into account so as not to contravene the body of constitutional and statutory law (bloque de constitucionalidad y legalidad).

Thus, regarding this position, the Constitutional Chamber of the Supreme Court of Justice established in Resolution N° 3495-92 at 14:30 hours on 19 de noviembre de 1992 that: “(…) V- Furthermore, the Constitution and International Human Rights Law also establish a general framework for the recognition and guarantees of freedom, the essential content of which the law must—and can do nothing other than—develop and expand or, where appropriate, regulate within the limitations established therein and in accordance with the meaning they themselves impart. Specifically, in its article 28, our Constitution enshrines both the principle of freedom, still merely formal insofar as it permits human beings to do anything not prohibited by law, (…) a principle and system of freedom that constitute the raison d’être and fundamental core in which converge, on the one hand, the catalogue of individual and social rights and their own guarantees and, on the other, all other constitutional rules and principles concerning the organization and activity of the State, (…) VI- Implicit in those values and principles of freedom, its economic dimension occupies a paramount place.

In this area, the Constitution is particularly precise in establishing a system comprising rules that safeguard the relationships existing between persons and the different classes of property; that is, their relationship with the world of ‘having,’ through provisions such as those contained or implicit in articles 45 and 46. Although these rights must yield to needs ordinarily more compelling for human existence itself—such as life or personal freedom and integrity—they do not thereby become second-class rights, but remain as fundamental as the former and of equal rank—not without reason have the United Nations General Assembly and all international bodies and courts dealing with human rights invariably characterized them as ‘indivisible’ and ‘interdependent.’ Thus, the Constitution establishes an economic order based on freedom that is essentially reflected in private-property rights (art. 45) (…)” (Emphasis not in the original).

Accordingly, the Constitutional Court has also held that the system of guarantees and, in particular, the fundamental right to private property are not unrestricted; nevertheless, to delimit or regulate them, the body of constitutional and conventionality law (bloque de constitucionalidad y convencionalidad) in force requires the State to comply with a series of procedures that serve as guarantees for the population. This follows from the very concept of property aligned with provision 45 of the Constitution, as “that right which allows its holder to possess, dispose of, and freely use the property without interference by any third party. It is precisely this condition that gives it the character of an ‘erga omnes’ right, meaning that it may be asserted against third parties, who are in turn required to respect and refrain from interfering with that right.” (See Resolution N° 2802-99 at 17:12 hours on 20 de abril de 1999, issued by the Constitutional Chamber).

Within this analytical framework, this Court understands that the claims of the plaintiffs are circumscribed by their status as holders of a one-third interest in three immovable properties (Proven Facts N° 1 to 9), a status as owners that entails the “right to enjoy and dispose of a thing subject to no limitations other than those established by law” (Muñoz Machado (Santiago). Pan-Hispanic Dictionary of Legal Spanish. Spain, Royal Spanish Academy, Volume I, 2017 p.1694). The scope of property rights is regulated in equivalent terms by numeral 266 of the Civil Code, which provides that: “Property and each of the specific rights it encompasses have no limits other than those accepted by the owner and those imposed by provisions of law.” Regarding restrictions, limitations, and encumbrances on property (límites, limitaciones y cargas a la propiedad), numerals 383 and 384 of the Civil Code state: “Article 383.

Private ownership of immovable property is subject to certain encumbrances or obligations imposed by law for the benefit of neighboring properties or for reasons of public utility. Article 384. Obligations arising from public utility are governed by special regulations. Those relating to water matters are also governed by special laws, even when established in the direct interest or for the direct benefit of a private party.” (Emphasis not in the original). The restrictions, limitations, or encumbrances that are constitutionally permissible include those arising from the environmental protection regime (régimen ambiental), as in the case at hand. In this regard, the Constitutional Court has held that there is a system of restrictions and/or limitations which, insofar as it does not deprive the right of property of its substance and is neither disproportionate nor unreasonable, does not require compensation, a position shared by this Chamber of Judges.

Upon examining the arguments asserted by the plaintiffs in support of their claim for compensation, which is disputed by the State’s representative, the issue concerns the proportionality and reasonableness of the environmental limitations affecting the immovable properties at issue in these proceedings. From the alleged unreasonableness or disproportionality, the plaintiffs derive a claim of legislative State liability (responsabilidad del Estado Legislador), on which they base their request that expropriation proceedings (diligencias de expropiación) be carried out because, in their view, their property right has been deprived of its substance. Accordingly, this Chamber of Judges notes that there is no dispute that, in this case, the plaintiffs’ properties are subject to an environmental limitation (See Proven Facts N° 10, 12 and 13); rather, the disagreement concerns the effects those limitations have on the substance of the fundamental right to private property.

In this regard, this Judicial Body considers that these environmental limitations must be analyzed in light of the social function of property (función social de la propiedad), and on that basis it must be determined whether the plaintiffs are correct as to the relief sought. Regarding the social function of property, the Constitutional Chamber of the Supreme Court of Justice has addressed this subject extensively, emphasizing, for purposes of deciding the case at hand, that the second paragraph of numeral 45 of the Fundamental Law gives the legislature, by qualified majority, the power to establish limitations on property in the social interest, as a means of counterbalancing liberal ideology, which advocated broad freedom of private initiative while limiting public action to promoting that sphere of freedom within which private property served a purpose viewed exclusively from the standpoint of, or for the benefit of, its owner.

This thesis gradually gave way to theories more focused on safeguarding collective interests, and the framers therefore considered that: “Property is a legal institution that was formed to meet an economic need and that evolves inexorably as economic needs themselves evolve. Now, in our modern societies, the economic need that property came to meet is undergoing profound transformation; consequently, property, as a legal institution, must also be transformed. The evolution of the concept of property is also determined by the increasingly close interdependence of the different social elements. Hence, property becomes socialized, so to speak. This does not mean that it becomes collective in the sense of collectivist doctrines, but it means two things: first, that individual property ceases to be an individual right and becomes a social function; and second, that the instances in which wealth is allocated to communities that must be legally protected are becoming more numerous every day ...’ (Comments by Deputy Volio Sancho.

Records of the 1949 National Constituent Assembly, Volume I. page 505).” (See Constitutional Chamber of the Supreme Court of Justice, Resolution N° 2007-006581 at 15:39 hours on 15 de mayo de 2007). In this manner, our Constitutional Court has held that, although this social function is not expressly set forth in constitutional numeral 45, it is inferred from that provision, determining that the framers recognized that this social function is universal in nature and is sustained as part of the very existence of the community, in which it is established that “(…) ‘Such limitations on the right of property arise from the very fact of belonging to a community—the same community that guarantees that right but subjects it to certain regulations in order to achieve the optimal and harmonious enjoyment of the rights of all individuals—and, as a matter of principle, are characterized by not being compensable’ (judgment number 04205-96, cited above).” (See Resolution N° 2005-004926 at 11:59 hours on 29 de abril de 2005 of the Constitutional Chamber).

Accordingly, for this Judicial Body, analyzing the reasonableness or proportionality of an environmental limitation entails balancing the principles of respect for private property against the public or collective interest, as derived from constitutional provisions 45, first and second paragraphs, 46 and 50. In the view of this Chamber of Judges, when an alleged conflict arises involving the dimensions or scope of the right to individual private property, that right must yield to the pursuit of the community’s interest, which translates into environmental preservation and protection, encompassing not merely the natural environment but also the urban environment. In other words, this Court considers that Costa Rica’s current constitutional framework has assigned greater weight to environmental protection than to private property, taking into account that the fundamental rights to life and health of persons—including future generations—derive from the fundamental right to a sustainable environment and that, as part thereof, the right of access to water and all systems protecting this water resource have been recognized.

(Regarding the right of access to water, see, among others, Resolutions N° 2004-12263 at 14:49 hours on 29 de octubre de 2004 and N° 2011-6949 at 12:55 hours on 27 de mayo de 2011, issued by the Constitutional Chamber).

In this case, the petitioners base their theory of the case on the contention that there is a disproportionate environmental restriction (collective interest) that renders their property right (individual interest) devoid of substance and therefore constitutes a de facto expropriation (expropiación de hecho), thereby giving rise to the financial liability of the State as legislator (responsabilidad patrimonial del Estado Legislador). As indicated at the outset, this Collective Chamber does not share that view, for the reasons set forth below.

ANALYSIS OF THE CLAIMS OF THE PETITIONERS.

Repeatedly, in their complaint and reply to the answer, the claimants state that they recognize the existence of an environmental protection zone (zona de protección ambiental) encumbering properties recorded under real-property registration numbers (matrículas folios reales) N° 542449, rights 001, 002 and 003; N° 542450, rights 001, 002 and 003; and N° 542451, all registered in the Province of San José and owned by the claimants. Nevertheless, it bears reiterating that their theory of the case is that, as a result of those protection zones established by the legislature (Ley Forestal and Ley de Aguas), the substance of the property right governed by article 45 of the Political Constitution is effectively nullified because those protection zones or environmental restrictions affect the entirety of the aforementioned properties. As supporting evidence, they submit municipal letters documenting the denial of their application for land-use certification (certificación de uso) to construct a dwelling (letters N° MP-AM-CU-US 530-2023 and N° MP-AM-CU-US 0529-2023, both dated 16 de junio de 2023, and letter N° MP-AM-CU-US 0012-2023 dated 12 de enero de 2023, issued by the Municipalidad de Puriscal).

These arguments, the defense raised by the State, and the corresponding analysis of the claims underlying these proceedings will be examined by this Adjudicatory Body. THE COURT’S POSITION: Returning to what has been maintained throughout this decision, there is no question as to the inviolability of private property, understood as “the right to possess something exclusively and to enjoy and dispose of it, subject only to the limitations established by law or by the owner’s will.” (See Resolution N° 2006-017514, issued at 9:41 on 01 de diciembre de 2006 by the Sala Constitucional de la Corte Suprema de Justicia). It is also acknowledged—and this Court agrees—that: “The treatment of the protection of rights in rem (derechos reales) in civil and agrarian matters is of great importance in every legal system that has established a constitutional foundation firmly rooted in the protection of fundamental human rights: alongside rights of economic freedom, which include private property and other derivative rights in rem, economic, social, and environmental rights and duties have also been enshrined.

Private property and economic freedom enjoy constitutional protection under articles 45 and 46 of our Constitution and, although it may seem obvious, their existence and protection arise from the enduring nature of a Social State under the Rule of Law, founded on constitutional principles and values that establish not only rights for individuals but also duties, with a view to achieving economic development with equity, solidarity, and social justice.” (See Sala Constitucional Resolution Nº 16629 -2012 at 16:31 on 28 de noviembre del 2012). In this regard, this Court agrees with the position of the Sala Constitucional transcribed above, because the right to property cannot be analyzed in isolation as an unrestricted right; it must also be considered in light of citizens’ duties to protect nature. This necessarily means that when persons exercise their rights as owners of an asset or property, they must do so harmoniously with the community and, in the case before us, in balance with the environmental burdens established by the legislature to fulfill the social purposes of the State as a whole—in the words of the Sala Constitucional, to seek to “achieve economic development with equity, solidarity, and social justice.” This is because it must not be overlooked that the legal system as a whole establishes a balance between the rights of governed persons, the safeguards intended to protect the system of freedoms—including, as stated above, the fundamental right to “have” (private property)—and the general and public interest and the social function of property itself (particularly when safeguarding water resources, the primary objective of the restrictions or protection zones at issue in this litigation).

It is also appropriate to reiterate the point already made: for these reasons, and due to the evolution of the concept of property itself, property may legally be subject to burdens, limits, or restrictions encumbering real property, some of which must be borne by the owner without any entitlement to compensation. These include the restrictions or protection zones applicable to springs (nacientes) under the Ley Forestal and Ley de Aguas. The Court therefore disagrees with the claimants’ position. Consistent with the foregoing, this Panel finds that the claimants interpret “nullifying the substance of the right to private property” as equivalent to the inability to erect a residential or commercial building, which is inaccurate for the reasons explained below.

First, the administrative record contains no evidence that the claimants applied to the Municipalidad de Puriscal for a business license (patente comercial), or applied to that or any other public entity for any other permit or license to use the real property, such as the Fondo de Financiamiento Forestal, which operates various payment for environmental services or forest-use programs (aprovechamiento forestal). The foregoing is not intended as an exhaustive list of the options available under the existing legal framework, without violating the restrictions contained in the repeatedly cited statutory provisions, to the claimants or to any other natural or legal person in the same legal position contemplated by the statutory requirements of the Ley Forestal and Ley de Aguas. This Court infers that counsel for the claimants extrapolates this alleged inability to conduct any type of activity from sections 33 and 34 of the Ley Forestal and section 149 of the Ley de Aguas, as well as from the case law issued by the Sala Constitucional regarding the prohibition against cutting trees or carrying out unauthorized activities on properties located within an environmental protection zone, as the claimants’ properties are.

From this, counsel concludes that they must be compensated because this constitutes a de facto expropriation (expropiación de hecho). However, as noted, it is erroneous to equate the inability to construct a dwelling with the use of real property as such. The use of real property is not limited to constructing a dwelling; owners may put their property to various other uses or derive other benefits from it. According to the Diccionario de la Real Academia Española, the word “aprovechar” is defined as “To put something to useful use, make it beneficial, or derive the maximum benefit from it. Make use of fabric, time, an opportunity.” (Real Academia Española. Diccionario de la Lengua Española, Edición 2023, consulted at: https://dle.rae.es/aprovechar). Accordingly, such use must be analyzed in relation to all the rights arising from ownership of an asset and, as noted, within the context of the different types of property that exist and the purposes served by assets made available for human use.

In this respect, the Constitutional Court has specifically addressed the different designated purposes of properties—that is, the purposes and different uses of real property within the concept of its social function, particularly its environmental function. This is a matter of national public interest because the rights to health and life can be derived from section 50 of the Constitution; thus, protecting the environment and water is vital to achieving the harmonious coexistence of humankind. Accordingly, in Resolution N° 2007-006581-2007 at 15:39 on 15 de mayo de 2007, the Sala Constitucional extensively reviewed the different types of social interest that are consistent with the body of constitutional law (bloque de constitucionalidad) and which the claimants disregard: “XV.- TYPES OF SOCIAL INTEREST RECOGNIZED BY CONSTITUTIONAL CASE LAW. Constitutional case law has recognized two types of social interest that legitimize—or justify—the imposition of restrictions on property: those relating to environmental protection and those of an urban-planning nature, the latter based on the analysis developed in judgment number 4205-96, cited above.

It has expressly been recognized that the ultimate basis for these restrictions is precisely the ‘transnationalization’ of the values affected, because they affect not only the locality or nation, but humanity as a whole, since, as previously stated, the issue of environmental protection transcends the local or regional sphere (judgment number 3705-93, issued at fifteen hundred hours on thirty de julio de mil novecientos noventa y tres). (…) Thus, private forest property (propiedad forestal privada), which, as its name indicates, is property titled to private individuals and held under the terms of article 45 of the Political Constitution, becomes subject to a special legal regime—in the first instance, the forest regime (régimen forestal)—through the corresponding executive decree of the Ministerio del Ambiente y Energía. This regime encumbers the property as a restriction in the social interest and must, in all cases, be recorded in the Registro Público de la Propiedad.

For this reason, these properties may be mortgaged, and the forest resource may even be pledged as collateral; they may be acquired through adverse possession (usucapión), as well as transferred or conveyed, provided that the forest-related encumbrance is transferred in every case. Whether private property may be exploited and used, subject to compliance with the applicable management plan (plan de manejo), will depend on how existing regulations categorize the forest resource, including forest reserves, protection zones, and wildlife refuges (article 37 of Ley Forestal number 7174). It is clear that forest-related restrictions prevent owners from using the forest resource, and owners are in no way entitled to cut down or economically exploit the forest on their property as they please or at their discretion; they may do so only and exclusively pursuant to a management plan duly approved by the Dirección Forestal.” (Emphasis in bold added by this Court).

The Sala Constitucional’s reasoning, with which this Panel agrees, establishes that subjecting property to a forest regime or forest-related restrictions does not nullify the substance of the actions that its owners may undertake; rather, it imposes limitations on use and enjoyment that must be exercised within the parameters established by law.

Second, the claimants disregard the fact that the rights arising from ownership or absolute title (dominio absoluto) over an asset are not limited to construction (transforming the asset), but are those set forth in section 264 of the Código Civil, which provides: “Ownership or absolute title over a thing comprises the rights: 1º.- To possession. 2º.- To usufruct. 3º.- To transformation and transfer. 4º.- To defense and exclusion; and 5º.- To restitution and compensation.” Accordingly, the right to property would be stripped of its substance only where the State’s conduct, whether by action or omission, eliminates the possibility of exercising each and every one of the powers or entitlements listed above, which the claimants likewise have not proven.

Although the properties are subject to an environmental limitation and certain types of activities cannot be carried out on them, the fact remains that the powers to derive benefit from them are still retained, for example through cultivation, agricultural or livestock activities, or commercial activities that do not entail the complete transformation of the properties or the construction of permanent works thereon. Accordingly, it cannot be inferred from the record that the limitations contained in sections 33 and 34 of the Ley Forestal and section 149 of the Ley de Aguas prevent the exercise of each and every right encompassed within full ownership of their property. Therefore, in the absence of such evidentiary elements, the argument or premise underlying the claim for compensation—that the right of ownership has been deprived of its substance—must be rejected, since the burden of proof rested with the plaintiffs under section 41.1 of the Código Procesal Civil (the provision applicable to this specific case pursuant to Article 220 of the CPCA), which states that the burden of proof lies with: “Anyone asserting a claim, with respect to the facts establishing that person’s right.” The burden of introducing evidence into the proceedings also follows from the principle of the “dynamic burden” of proof (carga dinámica de la prueba), insofar as the claimants are better positioned within the legal circumstances of the proceedings to demonstrate the degree to which each and every right is affected and the various uses or purposes for which the properties may be exploited.

Without seeking to reiterate what has already been stated, the case law of the Sala Constitucional and the Primera de la Corte Suprema de Justicia has determined that the statutory limitations arising from Ley N° 7575, Ley Forestal are not compensable insofar as they impose certain limits but do not completely deprive the right to use and enjoy the property of its substance. Indeed, our Tribunal Constitucional has explained that the environmental limitations arising from sections 33 and 34 of the Ley Forestal—which the claimants allege give rise to disproportionate or unreasonable restrictions by depriving their property right of its substance—are consistent with the Constitution and therefore do not entail a de facto expropriation (expropiación de hecho), as the plaintiffs contend, stating as follows: “II.- Regarding the alleged constitutional conflict identified by the petitioner between sections 33 and 34 of the cited Law and Article 45 of the Constitution, this Sala considers the following.

Limits that may be introduced by law on the exercise of a public freedom or fundamental right concern the right itself, as well as the abstract position of a person’s sphere of action; that is, a limit on the exercise of a public freedom is nothing more than a limit on the exercise of a right. This is because recognition of a right by a constitutional provision does not exclude the possibility that the legislature may regulate its exercise, since every right is limited from its inception because it arises within a system of social coexistence, and its exercise must be harmonized with the rights of others and with requirements recognized in subsequent legislation specifying its limits and the conditions governing its exercise. Restrictions, by contrast, concern a curtailment or reduction of the person’s legal sphere; they relate to the actual exercise of the public freedom and, by their nature, must be contained in the constitutional text or be authorized by it for imposition by the Asamblea Legislativa.

Thus, restrictions entail a reduction of fundamental rights insofar as they constrain their effective exercise under certain conditions and in particular circumstances. In the case at hand, we are faced with a limitation imposed by law on the effective exercise of the right to property set forth in Article 45. Because the limitation must be legitimized by the constitutional text itself or be based on express constitutional authorization granted to the Asamblea Legislativa for its establishment, it is appropriate to determine whether the limitation imposed by Ley 7575 is properly grounded in the constitutional text. The second paragraph of Article 45 of the Carta Política provides: ‘For reasons of public necessity, the Asamblea Legislativa may, by a vote of two-thirds of its entire membership, impose limitations upon property in the social interest.’ It is thus apparent from the transcribed constitutional text that the provision itself allows the Asamblea Legislativa to introduce limitations upon property in the social interest, thereby legitimizing the content of sections 33 and 34 of Ley 7575, which are now being challenged.

III.- Having addressed the legitimacy of imposing the limitation, it remains to consider its reasonableness. This Sala finds the imposed limitation reasonable because it does not make enjoyment of the property right impossible, but instead defines its scope. That is, the limitation does not extinguish the petitioner’s property right with respect to the portion of land on which construction is prohibited—because the petitioner may still enjoy it—but merely directs the petitioner not to build within the boundary established by the restriction. Moreover, establishing a ten-meter setback line is reasonable in relation to the public-domain asset sought to be protected—a stream—and in whose preservation the State has a public interest; the setback established in forestry legislation is therefore considered reasonable and sufficient. For the foregoing reasons, the petition is inadmissible and must be so declared.” (See, among others, Resolución N° 08234-1997 de las 18:15 horas de fecha 03 de diciembre de 1997 de la Sala Constitucional).

This Panel of Judges shares that position and, for the same reasons, it may be applied to the limitations established in the Ley General de Aguas, since those limitations are even less burdensome on property than those established in the aforementioned Ley Forestal. In subsequent years, the Sala Constitucional stated that these limitations upon property—which, as noted, are neither disproportionate nor unreasonable—are not compensable because they arise from the social function of property itself, a function said to require weighing the collective interest (the right to the environment and the protection of water) above an individual interest (the ability to build on the real property that the plaintiffs claim to lack). Thus, in Resolución N° 4465-99 de las 10:21 horas de fecha 11 de junio de 1999, the Sala Constitucional de la Corte Suprema de Justicia held: “Article 45 of the Constitución Política enshrines the right to property.

Its first paragraph describes that right as ‘inviolable’ and establishes the State’s obligation to compensate the owner in advance when it must extinguish that right for reasons of ‘legally established public interest.’ The second paragraph establishes the possibility of imposing limitations upon property in the social interest through a law adopted by a qualified vote—a vote of two-thirds of the entire membership of the Asamblea Legislativa. The State’s obligation to provide compensation is therefore constitutionally prescribed solely and exclusively in cases of expropriation and does not apply to limitations in the social interest established through a law adopted by a qualified vote. Such limitations, however, must affect the community as a whole and may neither exceed the parameters of reasonableness or proportionality nor deprive the property right of its essential content. A restriction on the property right that deprives the right of its essential content becomes a disguised expropriation (expropiación encubierta) and consequently gives rise to an obligation to provide compensation.

Limitations established for urban-planning purposes form part of the property right and therefore are not compensable unless they entail a reduction of the right’s essential content, as stated above.” (Emphasis not in the original). Therefore, when it is alleged that a restriction or limitation upon property deprives the right of its substance or is disproportionate and unreasonable, this must, as reiterated, be proven by the party making the allegation—in this case, the claimants. No persuasive evidence supports that position, because the fact that the Municipalidad de Puriscal issued certifications denying approval for the construction of a dwelling (See Proven Facts N° 11, 14 and 15) affects only the right to transform the property and, to some extent but less significantly, the right to exploit it; it does not affect the comprehensive exercise of the rights comprising full ownership of the property.

Nor does the fact that, due to the existence of the spring (naciente), the Municipalidad applied the institution of non-liability for taxes (no sujeción de los tributos) establish that the property right was deprived of substance in all its components; moreover, that treatment may also be modified if the conditions giving rise to such non-liability change. In addition, although the exact date on which the springs may have become visible to the plaintiffs or naturally formed has not been established as a proven fact—because the official communications issued by the Dirección de Agua del MINAE do not create those springs but merely declare their existence—whether or not the señores Padilla Pérez, as third-party purchasers in 2003 (See Proven Facts N° 1 al 9), knew that the springs located around their properties did not exist is not attributable to the State. Rather, it falls within the parties’ transactional sphere and concerns the information provided at that time by the seller-owners to the purchasers regarding the existing conditions and limitations.

No assessment is made here concerning the substance of those contractual relationships, latent defects (vicios redhibitorios), or the possible application of section 35 of the Ley de Planificación Urbana. Nor does this exclude the possibility that the owners of the land on which the spring is located, after coordinating with the corresponding authorities, may pursue exploitation or enclosure solutions under which a different type of limitation would be imposed upon the properties (See, in this regard, Article 12 of the Reglamento de Construcción de la Municipalidad de Puriscal); this would also modify the condition of non-liability for payment of taxes to the corresponding municipal corporation. These matters cannot be attributed to the State and therefore do not give rise to the claimed pecuniary liability.

What follows from the plaintiffs’ arguments and corresponding claim for compensation is, precisely, that, on the one hand, they disregard the existence of other rights encompassed by ownership (title) of property, which has already been addressed; and, on the other hand, they seek compensation through expropriation while also confusing the scope of expropriation with the circumstances under which a restriction, limit, or encumbrance upon property legally entails depriving the property right of its substance—circumstances in which compensation is indeed required. We therefore consider it appropriate to distinguish between the two legal concepts.

  • i)Distinction between the legal mechanisms of expropriation proceedings (procedimiento de expropiación) and limitations (limitaciones). Having already briefly analyzed the limitations on property that are constitutionally permissible and non-compensable, we now proceed to briefly describe expropriation (expropiación). The Ley de Expropiaciones, in its first article, provides a series of guidelines concerning expropriation and its legal regime, stating: “This law governs compulsory expropriation on grounds of a legally established public interest. Expropriation is ordered in the exercise of the sovereign authority of the Public Administration and encompasses any form of deprivation of private property or of legitimate property rights or interests, irrespective of their holders, through the prior payment of compensation representing the fair price of the property expropriated.” (Emphasis not in the original).

It is reiterated that the Sala Constitucional and the Costa Rican constitutional and statutory legal framework are very clear that a series of limitations on property may be established by law insofar as “property is not subject to divisions that cause the right itself to disappear, since the natural use of the asset and its economic market value are retained. It is also clarified that limitations or restrictions on property are general in nature and have the virtue of providing individuals with the instruments necessary to mitigate the effects of the harmful activities of others. It should be noted that their purpose or objective is the rational use of property, thereby benefiting neighbors or society as a whole; this obligation is grounded (by way of justification) in the consideration that such limitations are indispensable for coexistence in society and do not constitute an expropriatory action requiring prior compensation, under the terms required and provided for in the first paragraph of Article 45 of the Constitución Política.” (See Resolución N° 2007-0006581 de las 15:39 horas de fecha 15 de mayo de 2007, cited above).

From the foregoing, it may very briefly be inferred that expropriation “per se” entails a deprivation of private property or of the rights of ownership (derechos del dominio), such as the use or enjoyment of the property, which is precisely what we identified above as an inviolable boundary on the imposition of an encumbrance, limit, or limitation: the property right must not be stripped of its substance. This is because when the limitation is of such magnitude, whether because of its content or duration—such as the temporary impairment of property, which the Sala Constitucional has held to constitute a freezing that must be compensated; see resolución N° 2007-005598 de las 15:47 horas de fecha 25 de abril de 2007—it entails a greater burden and an imbalance between citizens’ rights and guarantees and the powers of the State, even when supported by a public interest; indeed, the existence of a public interest is taken as a prerequisite.

Consequently, this constitutes an expropriatory act that deprives a person of property, thereby giving rise to the duty to provide compensation. The claimants’ theory of the case confuses the first paragraph of Article 45 of the Constitution with its second paragraph; the two contain different provisions. The first paragraph governs the complete deprivation of property or of the rights held by the owner of an asset, whereby, following a determination that a public interest exists to justify it, a private individual is dispossessed of the asset so that it may be transformed into another asset intended to serve the general public interest. The second paragraph provides for the social function of property (función social de la propiedad) and the possibility of establishing limitations and burdens, whose validity or legitimacy arises “when necessary to enable ‘the continued effectiveness of democratic and constitutional values’; thus, in addition to being useful, it must be necessary, reasonable, and timely, and must entail the existence of a compelling social need supporting it and must therefore be exceptional; accordingly, such limitations must be intended to satisfy an imperative public interest.

The reasonableness of the limitation is reflected in its suitability for the purpose and interest (value) that justify it; and f.- Limitations are non-compensable insofar as they do not entail divisions that cause the right to disappear; compensation is provided solely to address the loss of property (expropriation).” (See Resolución N° 2007-006581 cited above). The deprivation of property alleged by the claimants has not been established in this case. It may therefore be stated at the outset that both the request that expropriation proceedings be conducted and the request for payment of the fair price must be denied. The error underlying the claimants’ theory of the case is the assertion that the prohibition against cutting trees and constructing a residence, or the reduction of the tax base for the payment of taxes to the Municipalidad, constitutes a limitation that prevents them from using and enjoying their property and thereby strips their property right of its substance.

The mere imposition by law of an environmental protection zone does not have that effect. As repeatedly stated in this discussion, it must be established that the limitation is of such magnitude that it prevents the free use and enjoyment of the property. The claimants, who bear the burden of proof (carga probatoria), have not established this (artículo 41.1 del Código Procesal Civil, a civil provision applicable to this specific case pursuant to numeral 220 del CPCA). As previously noted, a party asserting a claim must prove the constituent elements of its right by introducing evidence into the proceedings to demonstrate that its property right has been stripped of its substance; however, there is no evidence whatsoever in the expediente that substantiates the claimants’ allegations. In other words, no abnormal omission by the State in failing to conduct due expropriation proceedings has been identified, since, as indicated above, the environmental limitations imposed on the claimants’ property arise from a constitutionally established power—not merely from the statutory legal framework—and the claimants have not demonstrated that such limitations strip or sever the substance of the right arising from their status as titleholders, an issue that they were required to prove.

In addition to the foregoing, it must be reiterated that the absence of a certificate of nonconforming use (certificado de uso no conforme) for construction, or the revaluation of the properties for tax purposes so as not to be subject to taxes established by the legal system, does not per se cause damage that must be compensated pursuant to numeral 194 de la Ley General de la Administración Pública. This issue has been addressed by the Sala Constitucional in cases similar to that of the claimants, noting that the party alleging such damage must prove it in the appropriate ordinary proceeding, namely, the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa); the claimants did not establish such damage in this case. The Tribunal Constitucional accordingly stated: “VI. Concerning the precautionary principle (principio precautorio) in environmental law. This governing principle is founded on the need to take and implement all measures necessary to prevent or contain possible harm to the environment or human health.

It thus seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources. Accordingly, where there is a risk of serious or irreversible harm—or uncertainty in that regard—a precautionary measure must be adopted, and the activity in question may even be postponed. This is because, in environmental matters, ex post facto enforcement is ineffective, since once harm has occurred, the biologically and socially harmful consequences may be irreparable. (…) With respect to the municipal corporation, the appellant challenges the change in land use (cambio de uso de suelo) ordered by the respondent Municipalidad, because he considers that it eliminates a right that had already been recognized and alleges that it causes the protected party serious economic harm. Based on the reports submitted by the respondent officials and an analysis of the evidence in the record, this Sala finds that the challenged actions comply with the law.

Although land-use permits (permisos de uso de suelo) for a single-family residence were initially granted for the protected party’s properties, once the possible existence of a spring (naciente) in that area became known, Resolución de Ubicación de Zonas de Protección Nº 595, de las 12:10 horas del 13 de diciembre de 2016, was issued, establishing the spring’s protection radius. In other words, the Municipalidad, exercising its sovereign powers, applied the precautionary principle and prioritized environmental protection. Although this clearly affects the protected party’s properties, it is appropriate, as stated in considerando VI. Accordingly, because what matters in environmental affairs is that the State actually adopt a policy that protects and effectively guarantees the exercise of those rights, both at the strictly legal level and at the technical and operational level, the proper course is to dismiss the appeal with respect to this issue.

If the appellant remains dissatisfied with what was ordered, he must establish the alleged damage through administrative proceedings or before the ordinary courts, because verification of compliance with technical parameters is a matter of ordinary legality.” (Sala Constitucional, Resolución N° 06565-2017 de las 9:45 horas de fecha 23 de junio de 2017). In conclusion, the foregoing leads this panel of judges to deny, for lack of merit, claim 43.1 as well as claims 43.2 and 43.3 contained in the complaint, insofar as they concern the alleged stripping of the claimants’ fundamental property right of its substance. - ii) On the absence of administrative liability of the Legislative State (Estado Legislador). Another of the grounds outlined by the plaintiffs in the complaint is that the State bears financial liability, for which they quote Articles 9 and 41 of the Political Constitution and Articles 190, 191 and 194 of the General Law of Public Administration.

However, that reasoning is based on two premises: first, that the legally established environmental restrictions deprive them of the substance of their property right, which they failed to prove, as indicated in the preceding section; and second, that this constitutes a de facto expropriation (expropiación de facto). Indeed, it may be inferred that they ultimately seek to equate just compensation (justiprecio), that is, the amount paid by the Administration as a result of an expropriation, with the damages awarded under the General Law of Public Administration, which is incorrect. As a preliminary matter, the Court agrees with the plaintiffs’ argument that, pursuant to the case law issued by the First Chamber of Justice cited above, it has been established that, in Costa Rica, Article 41 of the Political Constitution, read in conjunction with Articles 9, 11 and 33 thereof, provides for a predominantly strict-liability regime (régimen de responsabilidad preeminentemente objetiva) of the State, under which the entire system is shifted in favor of the individual subject to the Administration (administrado), who is no longer required to prove subjective elements concerning the public official in order to obtain compensation for public conduct that caused harm; consequently, the burden of proof now rests with the Administration, which must rebut the allegations made against it.

Thus, “Whenever an injury has been sustained as a consequence of public conduct, whether an act or omission, which the individual has no duty to bear, a duty to provide compensation arises by virtue of the principle of full reparation for harm (principio de reparación integral del daño) derived from Article 41 of the Political Constitution.” (First Chamber of the Supreme Court of Justice, Decisions N° 138 of 15:05 hours on 23 de agosto; N° 192 of 14:15 hours 1 on 06 de noviembre, both from 1991; N° 48 of 14:10 hours on 29 de mayo de 1996 and N° 55 of 14:30 hours on 4 de julio de 1997). However, the application of the constitutional principle of full reparation for harm is neither unrestricted nor unlimited, nor does it apply automatically whenever an individual subject to the Administration sustains an injury. It is necessary to establish, on the one hand, the existence of financial loss (menoscabo patrimonial) or non-pecuniary injury (lesión extrapatrimonial), and, on the other, a causal link (nexo causal) between the alleged harm and the Administration’s conduct, whether an act or omission.

Regarding the causal link, it has been stated that: “Having established in this case the abnormality and unlawfulness of the omission, it remains to be determined whether that inaction was or was not the cause of the injury claimed, (…). This is because the occurrence of harm is not sufficient in itself to give rise to a duty to compensate; that consequence must also have been produced by an act or omission of the State. Put more simply, in order to attribute liability to the Administration, there must be harm, administrative action or inaction, and a causal link between the two. Once that relational connection has been established, the duty of full reparation arising from Article 41 of the Political Constitution immediately comes into being. In this regard, it should be noted that a series of events and factors that caused the harm to varying degrees generally converge in its occurrence.

Among them, it is essential to establish which directly or indirectly constituted the adequate and efficient cause of the resulting harm. Regarding proximate, adequate and efficient cause, reference may be made to judgment no. 252-F-01 of this Chamber, issued at 16 hours 15 minutes on 28 de marzo del 2001. Within that convergence of factual or legal elements surrounding the harmful situation, it will be necessary to identify the action or omission capable of producing the consequence, excluding those that had no influence on the outcome (external causes), as distinguished from those which, had they not occurred, would have prevented the loss.” (First Chamber of the Supreme Court of Justice, Decision N° 0074-F-2007 of 10:15 hours on 02 de febrero de 2007). However, as we have seen, first, in this case the restriction affecting the plaintiffs’ properties does not have expropriatory effects, and therefore no breach of any legal obligation can be inferred, thereby breaking the causal link between the omission complained of and the harm caused.

Second, even if it had been determined that the substance of their right had been eliminated—which, it bears repeating, has not occurred in practice—any administrative liability would not result in compensatory relief based on liability, because the effects of expropriation are different. In fact, “Expropriation activity is intended to deprive a particular person, in whole or in part, of a right or legitimate interest, through the corresponding compensation or payment of just compensation, in order to satisfy public needs. It follows that an individual or particular sacrifice is imposed upon the expropriated party, treatment that the remaining persons do not receive. (…) It is important to note that GIANNINI used the term ‘real ablative measures’ (‘medidas ablatorias reales’) for measures adopted by public authorities in pursuit of the general public interest. Those measures include expropriation, easements (servidumbres), compulsory sales and exchanges, and measures particular to land-use planning law, such as imposing on a person the obligation not to build on property they own because it has been incorporated into the cultural heritage.

Administrative liability, for its part, means that the public entity is required to compensate private parties, as compensatory redress—and no longer as just compensation—for harm caused by its normal, abnormal, lawful, or unlawful operation. Damages (indemnización) are a mechanism created by law to compensate the person for harm inflicted by a particular administrative act or omission. It must be borne in mind, however, that harm arising from non-contractual administrative liability (responsabilidad administrativa extracontractual) does not always result in a social benefit for the community, as occurs with an expropriation ordered for reasons of public interest.” (Rojas Morales (Iris Rocío). Costa Rican Land-Use Planning Law. San José, Costa Rica, Editorial Investigaciones Jurídicas S.A., 2010, pp. 461 and 462). Accordingly, the two concepts cannot be equated. Just compensation, as its name indicates, is the payment received; it is the economic value of restitution for the taking of property by the Administration so that it may be transformed or allocated to a public purpose.

In other words, it is payment for the acquisition made, and that amount must therefore be reasonable and proportionate; it must be equivalent, reasonable, and proportionate so as to enable the natural or legal person to obtain redress or compensation for the full value of the expropriated property. Consequently, the respective terms—liability and expropriation, damages and just compensation—are not equivalent or synonymous, as is erroneously inferred from the arguments in the complaint, and this argument must therefore also be rejected. It should also be noted that the plaintiffs did not assert a claim seeking a determination of the State’s predominantly strict liability; instead, they linked it to expropriation and their right to compensation. Because the preceding section established that the expropriation procedure does not apply in this case, it does not give rise to a right to any payment (payment of just compensation), and because this cannot be confused with strict liability, claims 43.2 and 43.3 are rejected in their entirety and, consequently, claim 43.1 is also rejected.

It must further be mentioned that, in setting out the conditions under which predominantly strict liability for lawful conduct applies, the plaintiffs confuse the requirements contained in Article 194 of the General Law of Public Administration for establishing liability for lawful conduct, which is the type of liability they allege. In particular, they fail to establish special harm (daño especial) or that those affected constitute a small proportion; indeed, it is incorrect to assert that the only small proportion of persons affected by the restrictions arising from the Ley Forestal and the Water Law consists of Padilla Pérez. Let us consider the aforementioned Article 194, which provides: “Article 194.- 1. The Administration shall be liable for its lawful acts and normal operation when they cause special harm to the rights of an individual subject to the Administration, due to the small proportion of persons affected or the exceptional severity of the injury. 2.

In this case, compensation shall cover the value of the harm at the time of payment, but not lost profits (lucro cesante). 3. The State shall be liable for harm directly caused by a law when such harm is special in accordance with this Article.” Thus, the two fundamental requirements for determining the existence of strict liability of the Legislative State are the existence of special harm, which occurs when there is “a small proportion of persons affected” or “exceptional severity of the injury.” The severity of the injury would be comparable to the restrictions having the effect of severing the rights arising from absolute ownership of real property, an issue already discussed extensively throughout this analysis and which does not arise in the case at hand; what remains to be analyzed is the “small proportion of persons affected.” To identify the scope of this requirement, reference is made to the congressional debate involving Eduardo Ortiz Ortiz, one of the jurists who drafted the bill that is now the General Law of Public Administration.

The aforementioned scholar stated: “The expression (…) referring only to proportion has the advantage of giving this concept of special harm its full meaning as discriminatory harm. That is the idea, because it is not general harm that all of society must bear, but harm borne by only a few.” (Legislative File N° A23E5452, Minutes N° 104, folios 393 to 404, taken from QUIRÓS CORONADO (Roberto). General Law of Public Administration, cross-referenced and annotated with the legislative debate and constitutional case law. San José, Costa Rica. Editorial, ASELEX S.A., 1996, page 297). Two concepts should be drawn from the quoted passage: first, that it concerns discriminatory harm, meaning that under equal conditions it does not have the same effects on all persons; and second, that it is not general harm but affects the sphere of only a few persons and is exceptional, since all regulations are presumed to affect persons’ legal situations, but this does not give rise to a right to compensation for all of them, because doing so would curtail the legislative powers derived from the very foundation of the Constitution.

Thus, Ortiz Ortiz stated: “All social regulations cause some form of harm to some group. For example, a traffic regulation might ultimately disadvantage a person who previously had parking in front of their business. Now that person must spend a great deal of time looking for parking. But that harm is obviously not compensable, and therefore compensable harm in these situations must be very specifically defined, because not all harm is compensable, but only harm displaying certain characteristics (…)”. (Legislative File N° A23E5452, Minutes N° 104, folios 393 to 404, taken from QUIRÓS CORONADO (Roberto). Op.

Cit, 297) From the foregoing transcription, it cannot be inferred that the limitations at issue are discriminatory, insofar as they apply to every person located within the radius of influence of a permanent or intermittent spring (naciente) (protection zone (zona de protección)); that is, the scope of application of the requirements contained in the environmental regulations is general and does not apply solely to the plaintiffs, as they argue in their complaint when they state: “Third, the State’s conduct causes special and abnormal harm to my Clients. On the one hand, the harm is special insofar as it financially affects a small but ascertainable group of persons: the plaintiffs in these proceedings.” This is because, as stated, those requirements affect the legal situations of each and every person who owns property within the radius of influence of a spring, and not only the plaintiffs.

It follows that they are not discriminatory either, since they apply to persons who own real property located within the protection zone of a spring (permanent or intermittent). In other words, the harm would be discriminatory if persons in the same situation (within the radius of influence of the water body’s protection zone) were excluded, which is not the case here. Although the photographs submitted by the plaintiffs, specifically those of the land-use certificate documents issued by the Municipalidad de Puriscal, show that other properties with constructed buildings are located around the block where the properties of the Padilla Pérez family are situated and within the radius of the protection zone delineated by the Corporación Municipal, this does not mean that discriminatory harm exists; rather, each specific case would have to be analyzed with respect to the conditions and circumstances under which the land-use certificate and building permit (licencia constructiva) were granted by the Gobierno Local, without prejudice to the exercise of the Municipalidades’ police powers in environmental matters to determine their lawfulness or unlawfulness.

In this case, however, the provisions under discussion (Ley Forestal and Ley de Aguas) have general effects for each and every person who meets the criteria defined therein and, consequently, the element of a “small proportion of affected persons” cannot be established in this case either. Indeed, it must be considered that the objective of these measures is consistent with the body of constitutional law (bloque de constitucionalidad) protecting the environment as a fundamental right that has been recognized by the Sala Constitucional in various rulings, for example, in Resolution N° 6949 at 12:55 hours dated 27 de mayo de 2011, which stated: “Based on the provisions of Articles 21, 50, and 89 of the Constitución Política, this Tribunal Constitucional has broadly recognized the State’s duty to protect the right to enjoy a healthy and ecologically balanced environment, whereby the State becomes the guarantor of the protection and safeguarding of the environment and natural resources.

Pursuant to those provisions, the State’s responsibility to exercise a protective and governing role in this area arises, a role developed through subconstitutional environmental legislation.” This is especially so with regard to the strategic resource of water, “derived from the fundamental rights to health, life, a healthy environment, food, and adequate housing, among others, as has also been recognized in international human-rights instruments applicable in Costa Rica: it is expressly included in the Convención sobre la Eliminación de todas las formas de discriminación contra la mujer (art. 14) and the Convención sobre los Derechos del Niño (art. 24); it is also set forth in the Conferencia Internacional sobre Población y el Desarrollo de El Cairo (principio 2), and declared in numerous other instruments of International Humanitarian Law. Within our Sistema Interamericano de Derechos Humanos, the country is particularly bound in this area by the provisions of Article 11.1 of the Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales ("Protocolo de San Salvador" de 1988).” (Sala Constitucional de la Corte Suprema de Justicia, Resolution Nº 2004-12263 at 14:49 hours dated 29 de octubre del 2004).

Therefore, as stated above, this Chamber concurs with the Tribunal Constitucional’s position that the balance must be struck in favor of the environment and of the precautionary principle (principio precautorio), in order to secure water for present and future generations. It follows that the environmental limitations imposed by the Legislature do not cause special harm under the terms provided in section 196 of the Ley General de la Administración, nor was such harm proven by the plaintiffs, who bore the burden of proving both the existence of the harm and the elements governed by the aforementioned section 196. Moreover, as stated, adequate causation (nexo de causalidad adecuada) was not proven either, insofar as the premise underlying its existence—namely, that the limitations deprived the plaintiffs’ property right of all content—was not established in this case. In this regard, the Sala Primera de la Corte Suprema de Justicia, in Resolution N° 112-1992 at 14:15 hours dated 15 de julio de 1992 (a position that has been consistently reiterated to date), explained: “Harm constitutes one of the elements of non-contractual civil liability (responsabilidad civil extracontractual), because the duty to provide compensation arises only when an unlawful harmful act has occurred that injures a legally relevant interest capable of protection under the legal system.

Harm, in the legal sense, consists of any impairment, loss, or detriment to a person’s patrimonial or non-patrimonial legal sphere (that of the injured party), causing the deprivation of a legal interest whose preservation could objectively have been expected had the harmful event not occurred. Under this approach, there is no civil liability without harm, just as there is no harm without an injured party. Furthermore, only harm that is proven (its reality or existence) is compensable, this being a question of fact reserved to the prudent discretion of the adjudicator. In short, harm is the detrimental gap suffered by the victim, resulting from comparing the situation before the unlawful act with the situation after it. (...)” (Emphasis added by this Court). It therefore follows that, absent liability attributable to the State, no right to compensation can arise. And, as may properly be inferred from the cited judicial decision and from the case law discussed throughout this analysis, if adequate causation is not established, no right to an award of damages can arise, which would consist of payment of the full value of “the areas of real properties 1-542449-000 interests 001, 002, and 003; 1-542450-000 interests 001, 002, and 003; and 1-542451-000 interests 001, 002, and 003, which are affected by the protection area of the unnamed permanent spring, reference number ID 4224-2022, located at Lambert north coordinates: initial latitude 203.619 initial longitude 501.995 final latitude: 203.619 final longitude: 501.995, CRTM05: initial latitude: 1.089.016 initial longitude: 465.652 final latitude: 1.089.016 final longitude: 465.652.

It is also identified by the georeference CRTM05 East 465652 North 1089016. In addition, property 1-542449-000 is affected twice, insofar as it is also located within the protection area of an unnamed intermittent spring, situated at coordinates CRTM05: East:465592 North: 1088960.” Accordingly, the claim for payment of any compensation for the limitations imposed pursuant to legislation intended to protect water resources (environmental precautionary principle (principio precautorio ambiental)) is likewise denied, as is the claim seeking to compel the State to commence administrative expropriation proceedings (diligencias administrativas expropiatorias) within two months for properties recorded under real-property folio numbers N° 542449, interests 001, 002, and 003; N° 542450, interests 001, 002, and 003; and N° 542451, all in the Partido de San José. Consequently, with respect to these two claims (43.2 and 43.3), and with respect to the first claim because it is generic—“To grant this complaint in all respects, under the terms set forth throughout this filing (facts, legal grounds, evidence, and claims)”—the defense of lack of a legal right of action (falta de derecho) asserted by the defendant State is sustained, and the complaint filed by Manuel, Elena Rocío, and José Carlos, all surnamed Padilla Pérez, is dismissed in all respects.

Notwithstanding the foregoing, the Court clarifies that the stated reasoning is based on the record and on the factual circumstances assessed in this judgment. Accordingly, this ruling neither predetermines nor limits in any manner the party’s ability to apply to the competent authorities, such as SENARA and the Dirección de Agua del MINAE, concerning the specific scope of the management, determination, and modification of the restrictions recognized in this judgment, through the exercise of the powers vested in those bodies within their respective spheres of authority, as well as any initiative the co-owners may devise in that regard.-

VII. REGARDING THE DEFENSES RAISED

In its response to the complaint, the State’s counsel raised the defenses of lack of standing to be sued (falta de legitimación pasiva) and lack of legal right (falta de derecho). Accordingly, given the manner in which this matter has been decided, inasmuch as this Collegiate Chamber, after analyzing the case record and the evidence offered by the parties and admitted at the appropriate procedural stage, rejects all claims, the complaint filed by MANUEL PADILLA PÉREZ, ELENA ROCÍO PADILLA PÉREZ, AND JOSÉ CARLOS PADILLA PÉREZ must consequently be dismissed, based on the factual and legal grounds set forth in this decision. Therefore, the defense of lack of standing to be sued is rejected, since the party against whom the claims for compensation and expropriation were asserted was properly joined to the proceedings, and the defense of lack of legal right is upheld because it was not established that the State caused the harm alleged by the claimants, arising from a predominantly strict liability (responsabilidad objetiva) attributable to lawful conduct (conducta lícita) based on the legal regulations contained in Articles 33 and 34 of the Ley Forestal and Article 194 of the Ley de Aguas, which impose environmental restrictions (limitaciones ambientales) on properties located near bodies of water (permanent and intermittent springs (nacientes)), based on the reasoning set forth in the decision at issue. -

VIII. REGARDING PROCEDURAL COSTS AND ATTORNEYS’ FEES

With respect to the costs of these proceedings, pursuant to Article 193 of the Código Procesal Contencioso Administrativo, procedural costs (costas procesales) and attorneys’ fees (costas personales) constitute a burden imposed upon the losing party by virtue of having lost. Waiver of such an award is permissible only when, in the Tribunal’s judgment, there was sufficient cause to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, this Chamber finds that, because the substantive defense (excepción de fondo) of lack of legal right raised by the defendant State has been upheld, and because the record contains no evidence that would permit the losing parties—here, the plaintiffs—to be excused from paying such costs, an award of costs (procedural costs and attorneys’ fees), under the terms established by the cited legislation currently in force, is warranted, together with statutory interest from the date this decision becomes final until payment in full, the amounts of which shall be determined during the judgment-enforcement phase (fase de ejecución de sentencia). -

POR TANTO

Based on the factual and legal grounds set forth above, the defense of lack of standing to be sued raised by the State’s counsel is rejected, and the defense of lack of legal right is upheld; consequently, the complaint filed by MANUEL PADILLA PÉREZ, ELENA ROCÍO PADILLA PÉREZ, and JOSÉ CARLOS PADILLA PÉREZ against the STATE IS HEREBY DISMISSED. The plaintiffs are ordered to pay both procedural costs and attorneys’ fees, together with the corresponding statutory interest from the date this decision becomes final until payment in full, the amounts of which shall be determined during the judgment-enforcement phase. Participa como apoderado judicial del proceso de la parte actora, el señor Jean Carlo Díaz Chacón, carné del Colegio de Abogados y Abogadas de Costa Rica Nº 22788.

ACTUACIONES PROCESALES. Como parte del íter procesal se tiene lo siguiente:

Mediante escrito de demanda presentado en fecha 10 de marzo del 2024, la parte actora formuló las siguientes pretensiones, a fin de que en sentencia se declare lo siguiente: “43.1 Declarar con lugar la presente demanda en todos sus extremos, en los términos expuestos en la totalidad de este escrito (hechos, fundamento, prueba y pretensiones). 43.2 Se declare la obligación de la parte demandada de indemnizar a los actores por las áreas de los inmuebles 1-542449-000 derechos 001, 002 y 003; 1-542450-000 derechos 001, 002 y 003 y 1-542451-000 derechos 001, 002 y 003, que se encuentran afectados por el área de protección de la naciente permanente sin nombre, con número de referencia ID 4224-2022, ubicada en las coordenadas Lambert norte: latitud inicial 203.619 longitud inicial 501.995 latitud final: 203.619 longitud final: 501.995, CRTM05: latitud inicial: 1.089.016 longitud inicial: 465.652 latitud final: 1.089.016 longitud final: 465.652.

La cual, es referida igualmente bajo la georreferenciación CRTM05 Este 465652 Norte 1089016. Además, que la finca 1-542449-000 se encuentra doblemente afectada, en el tanto también se encuentra dentro del área de protección de una naciente intermitente sin nombre, ubicada en las coordenadas CRTM05: Este:465592 Norte: 1088960. 43.3. Se le otorgue un plazo máximo de 2 meses a la parte demandada para adecuar sus actuaciones a derecho e iniciar con el proceso de expropiación de las áreas de los inmuebles 1-542449-000 derechos 001, 002 y 003; 1-542450-000 derechos 001, 002 y 003 y 1-542451-000 derechos 001, 002 y 003, que se encuentran afectados por el área de protección de la naciente sin nombre, con número de referencia ID 4224-2022, ubicada en las coordenadas Lambert norte: latitud inicial: 203.619 longitud inicial: 501.995 latitud final: 203.619 longitud final: 501.995, CRTM05: latitud inicial: 1.089.016 longitud inicial: 465.652 latitud final: 1.089.016 longitud final: 465.652.

La cual, es referida igualmente bajo la georreferenciación CRTM05 Este 465652 Norte 1089016, y en el caso de la finca 1-542449-000 que también se encuentra afectada por el área de protección de la naciente intermitente sin nombre, ubicada en las coordenadas CRTM05: Este: 465592 Norte: 1088960. 43.4 Se condene al Estado al pago de ambas costas procesales y personales”. Realizando la manifestación expresa de que: "De conformidad con los artículos 69 y 98 del Código Procesal Contencioso Administrativo, tratándose éste de un asunto de puro derecho en el que no existe prueba para evacuar, solicito que, una vez contestada la demanda, el proceso se falle de forma directa, sin necesidad de recibir prueba adicional, prescindiendo de la conciliación y celebración de audiencias". (Ver imágenes 2 a 22 del expediente judicial en formato electrónico).

Conferido, mediante la resolución de las 13:32 horas del 22 de marzo de 2024 por parte del Tribunal Contencioso Administrativo y Civil de Hacienda, el traslado de la demanda al Estado; previo apersonamiento respectivo; en fecha 20 de mayo de 2024, contestó de forma negativa la demanda, interponiendo en ese acto las defensas de falta de legitimación pasiva y falta de derecho. A partir de lo cual, solicitó que se declare sin lugar en todos sus extremos la demanda y, se condene a la parte actora al pago de ambas costas. Adicionalmente expresó su negativa a conciliar, y ante la inexistencia de prueba testimonial o pericial que evacuar, al tenor del numeral 69 del Código Procesal Contencioso Administrativo, solicitó que se prescinda de las audiencias correspondientes. (Ver imágenes 71 a 74, y 80 a 88 del expediente judicial en formato electrónico).

Mediante resolución de las 08:44 horas del 21 de mayo de 2024, el Tribunal Contencioso Administrativo y Civil de Hacienda tiene por contestada la demanda en tiempo, confiriendo a la parte actora audiencia por un plazo de tres (3) días hábiles para que se refiera a las excepciones de falta de legitimación pasiva y falta de derecho incoadas por el Estado. Dicha resolución es notificada a las partes en fecha 21 de mayo de 2024. Adicionalmente, mediante dicha resolución verificó el cumplimiento de los presupuestos contenidos en el numeral 69 del Código Procesal Contencioso Administrativo, resolviendo acoger la solicitud de tramitar el presente proceso como un Fallo Directo. (Ver imágenes 118 a 122 del expediente judicial en formato electrónico).

Mediante escrito de fecha 27 de mayo de 2024, la parte actora se pronuncia respecto a las excepciones incoadas por parte del Estado en su contestación, no presentando prueba documental adicional ni pericial o testimonial, a la ya aportada con el libelo de demanda. (Ver imágenes 124 a 146 del expediente judicial en formato electrónico).

En fecha 29 mayo de 2024, se turna el conocimiento del presente asunto a este Equipo de Trabajo I de Fondo, conforme a los parámetros dispuestos por los acuerdos del Consejo Superior N° 84-2021 de fecha 28 de setiembre de 2021, artículo XXVIII; N° 95-2021 de fecha 04 de noviembre de 2021, artículo XXXIX y N° 57-2023 de fecha 11 de junio de 2023, artículo XXXVII, y las disposiciones emitidas por la Comisión de lo Contencioso Administrativo, partiendo de un principio de equidad de las cargas de trabajo y rol de asignaciones de procesos prioritarios, a la luz del numeral 69 del Código Procesal Contencioso Administrativo. (Ver imagen 147 del expediente judicial en formato electrónico).

En los procedimientos se han observado las prescripciones y términos de ley, y no se perciben vicios, defectos u omisiones susceptibles de producir nulidad de lo actuado o indefensión a las partes. Se dicta la presente resolución por unanimidad y previa deliberación de los miembros del presente Tribunal, respetando los criterios de priorización para la atención de los procesos, conforme al rediseño del Tribunal Contencioso Administrativo y Civil de Hacienda, y dentro del plazo conferido por el precepto 69 del Código Procesal Contencioso Administrativo.

CONSIDERANDO

HECHOS PROBADOS: Conforme al elenco documental probatorio admitido en este proceso, se tienen como demostrados y de relevancia para el dictado de la presente sentencia, por tener el correspondiente sustento, los siguientes hechos:

  • 1)En fecha 15 de diciembre de 2003, el señor Manuel Padilla Pérez, con cédula de identidad N° 1-0325-0008, adquirió la titularidad del derecho 001 de la finca matrícula folio real N° 542449, del Partido de San José, cuya naturaleza es: Lote Uno, Terreno para construir; situada en el Distrito 1: Santiago, Cantón 4: Puriscal, de la Provincia de San José; con linderos al Norte: Sara Marín Porras, al Sur: Calle Pública con un frente de 25 metros 25 centímetros y parte Celia Ligia Méndez Ruiz y José Fallas Murillo; Este: Parte resto destinado a calle pública con frente de 41 metros 92 centímetros y parte Celia Ligia Méndez Ruiz y Oeste: Calle Pública con frente de 69 metros 14 centímetros, mide dos mil setecientos setenta y ocho metros con setenta y seis decímetros cuadrados, y registra el plano N° SJ-0824592-2002. No especificándose la causa de dominio.   • 2)En fecha 15 de diciembre de 2003, la señora Elena Rocío Padilla Pérez, con cédula de identidad N° 1-0389-0747, adquirió la titularidad del derecho 002 de la finca matrícula folio real N° 542449, del Partido de San José, cuya naturaleza es: Lote Uno, Terreno para construir; situada en el Distrito 1: Santiago, Cantón 4: Puriscal, de la Provincia de San José; con linderos al Norte: Sara Marín Porras, al Sur: Calle Pública con un frente de 25 metros 25 centímetros y parte Celia Ligia Méndez Ruiz y José Fallas Murillo; Este: Parte resto destinado a calle pública con frente de 41 metros 92 centímetros y parte Celia Ligia Méndez Ruiz y Oeste: Calle Pública con frente de 69 metros 14 centímetros, mide dos mil setecientos setenta y ocho metros con setenta y seis decímetros cuadrados, y registra el plano N° SJ-0824592-2002. No especificándose la causa de dominio.   • 3)En fecha 15 de diciembre de 2003, el señor José Carlos Padilla Pérez, con cédula de identidad N° 1-0522-0750, adquirió la titularidad del derecho 003 de la finca matrícula folio real N° 542449, del Partido de San José, cuya naturaleza es: Lote Uno, Terreno para construir; situada en el Distrito 1: Santiago, Cantón 4: Puriscal, de la Provincia de San José; con linderos al Norte: Sara Marín Porras, al Sur: Calle Pública con un frente de 25 metros 25 centímetros y parte Celia Ligia Méndez Ruiz y José Fallas Murillo; Este: Parte resto destinado a calle pública con frente de 41 metros 92 centímetros y parte Celia Ligia Méndez Ruiz y Oeste: Calle Pública con frente de 69 metros 14 centímetros, mide dos mil setecientos setenta y ocho metros con setenta y seis decímetros cuadrados, y registra el plano N° SJ-0824592-2002. No especificándose la causa de dominio.   • 4)En fecha 15 de diciembre de 2003, el señor Manuel Padilla Pérez, con cédula de identidad N° 1-0325-0008, adquirió la titularidad del derecho 001 de la finca matrícula folio real N° 542450, del Partido de San José, cuya naturaleza es: Lote Dos, Terreno para construir; situada en el Distrito 1: Santiago, Cantón 4: Puriscal, de la Provincia de San José; con linderos al Norte: Parte Sara Marín Porras y Parte Francisco Gutiérrez Hidalgo, al Sur: Parte Rafael Cubillo Valverde y Parte Lucía Rojas Bermúdez; Este: Calle pública con frente de 31 metros con 30 centímetros y Oeste: Resto destinado a calle pública con frente de 36 metros con 53 centímetros, mide mil setecientos cuarenta y ocho metros con setenta y tres decímetros cuadrados, y registra el plano N° SJ-0854982-2003. No especificándose la causa de dominio. (Hecho no controvertido, ver Certificación Literal N° RNPDIGITAL-344493-2024 de las 13:51 horas de fecha 05 de marzo de 2024, extendida por el Registro Nacional, visible a imagen 38 del expediente judicial en formato electrónico).
  • 5)En fecha 15 de diciembre de 2003, la señora Elena Rocío Padilla Pérez, con cédula de identidad N° 1-0389-0747, adquirió la titularidad del derecho 002 de la finca matrícula folio real N° 542450, del Partido de San José, cuya naturaleza es: Lote Dos, Terreno para construir; situada en el Distrito 1: Santiago, Cantón 4: Puriscal, de la Provincia de San José; con linderos al Norte: Parte Sara Marín Porras y Parte Francisco Gutiérrez Hidalgo, al Sur: Parte Rafael Cubillo Valverde y Parte Lucía Rojas Bermúdez; Este: Calle pública con frente de 31 metros con 30 centímetros y Oeste: Resto destinado a calle pública con frente de 36 metros con 53 centímetros, mide mil setecientos cuarenta y ocho metros con setenta y tres decímetros cuadrados, y registra el plano N° SJ-0854982-2003. No especificándose la causa de dominio. (Hecho no controvertido, ver Certificación Literal N° RNPDIGITAL-344500-2024 de las 13:52 horas de fecha 05 de marzo de 2024, extendida por el Registro Nacional, visible a imagen 39 del expediente judicial en formato electrónico).
  • 6)En fecha 15 de diciembre de 2003, el señor José Carlos Padilla Pérez, con cédula de identidad N° 1-0522-0750, adquirió la titularidad del derecho 003 de la finca matrícula folio real N° 542450, del Partido de San José, cuya naturaleza es: Lote Dos, Terreno para construir; situada en el Distrito 1: Santiago, Cantón 4: Puriscal de la Provincia de San José; con linderos al Norte: Parte Sara Marín Porras y Parte Francisco Gutiérrez Hidalgo, al Sur: Parte Rafael Cubillo Valverde y Parte Lucía Rojas Bermúdez; Este: Calle pública con frente de 31 metros con 30 centímetros y Oeste: Resto destinado a calle pública con frente de 36 metros con 53 centímetros, mide mil setecientos cuarenta y ocho metros con setenta y tres decímetros cuadrados, y registra el plano N° SJ-0854982-2003. No especificándose la causa de dominio.   • 7)En fecha 15 de diciembre de 2003, el señor Manuel Padilla Pérez, con cédula de identidad N° 1-0325-0008, adquirió la titularidad del derecho 001 de la finca matrícula folio real N° 542451, del Partido de San José, cuya naturaleza es: Lote Tres, Terreno para construir; situada en el Distrito 1: Santiago, Cantón 4: Puriscal, de la Provincia de San José; con linderos al Norte: Resto destinado a calle pública con frente de 45 metros 25 centímetros; al Sur: Francisco Gutiérrez Hidalgo; Este: Calle pública con frente de 20 metros 68 centímetros y Oeste: Sara Marín Porras, mide novecientos setenta y un metros con veintidós decímetros cuadrados, y registra el plano N° SJ-00854978-2003. No especificándose la causa de dominio. (Hecho no controvertido, ver Certificación Literal N° RNPDIGITAL-344577-2024 de las 13:54 horas de fecha 05 de marzo de 2024, extendida por el Registro Nacional, visible a imagen 42 del expediente judicial en formato electrónico).
  • 8)En fecha 15 de diciembre de 2003, la señora Elena Rocío Padilla Pérez, con cédula de identidad N° 1-0389-0747, adquirió la titularidad del derecho 002 de la finca matrícula folio real N° 542451, del Partido de San José, cuya naturaleza es: Lote Tres, Terreno para construir; situada en el Distrito 1: Santiago, Cantón 4: Puriscal, de la Provincia de San José; con linderos al Norte: Resto destinado a calle pública con frente de 45 metros 25 centímetros; al Sur: Francisco Gutiérrez Hidalgo; Este: Calle pública con frente de 20 metros 68 centímetros y Oeste: Sara Marín Porras, mide novecientos setenta y un metros con veintidós decímetros cuadrados, y registra el plano N° SJ-00854978-2003. No especificándose la causa de dominio. (Hecho no controvertido, ver Certificación Literal N° RNPDIGITAL-344549-2024 de las 13:55 horas de fecha 05 de marzo de 2024, extendida por el Registro Nacional, visible a imagen 43 del expediente judicial en formato electrónico).
  • 9)En fecha 15 de diciembre de 2003, el señor José Carlos Padilla Pérez, con cédula de identidad N° 1-0522-0750, adquirió la titularidad del derecho 003 de la finca matrícula folio real N° 542451, del Partido de San José, cuya naturaleza es: Lote Tres, Terreno para construir; situada en el Distrito 1: Santiago, Cantón 4: Puriscal, de la Provincia de San José; con linderos al Norte: Resto destinado a calle pública con frente de 45 metros 25 centímetros; al Sur: Francisco Gutiérrez Hidalgo; Este: Calle pública con frente de 20 metros 68 centímetros y Oeste: Sara Marín Porras, mide novecientos setenta y un metros con veintidós decímetros cuadrados, y registra el plano N° SJ-00854978-2003. No especificándose la causa de dominio. (Hecho no controvertido, ver Certificación Literal N° RNPDIGITAL-344557-2024 de las 13:55 horas de fecha 05 de marzo de 2024, extendida por el Registro Nacional, visible a imagen 44 del expediente judicial en formato electrónico).
  • 10)El 21 de abril de 2017, la Dirección de Agua del Ministerio de Ambiente y Energía en la Provincia de San José, Cantón Puriscal, Distrito Santiago, Sitio Santiago, identificó una fuente de agua, de tipo “naciente”, sin nombre, correspondiente a un cauce de dominio público intermitente que tiene como afluente una quebrada sin nombre, hoja cartográfica Río Grande 3345-IV, cuenca (84-24)-Tárcoles, correspondiente al plano N° SJ-1184864-2007 que se ubica en las siguientes coordenadas: LAMBERT NORTE: Latitud Inicial: 203.563, Longitud inicial: 501.940. Determinándose como justificación “SE TRATA DE UNA NACIENTE INTERMITENTE, ESTE SITIO DE UBICACIÓN COINCIDE CON EL DICTAMEN AT-5175-2013 REALIZADO EN LA ÉPOCA DE LLUVIAS DEL AÑO 2013 POR EL INGENIERO IGNACIO CAMPOS, EXISTE OTRO DICTAMEN EL AT-1166-2014 EN LA ÉPOCA SECA DEL 2014, DEL INGENIERO JESÚS MONGE, QUE UBICA EL PUNTO DE NACIENTE A UNOS 26 METROS AGUAS ABAJO, SIN EMBARGO LO QUE SE PRESENTA EN ESE CASO ES UN FLUJO BASE DE LA QUEBRADA QUE ORIGINA ESTA NACIENTE YA QUE COMO SE INDICO LA NACIENTE ESTA AGUAS ARRIBA”. (Mayúsculas provienen del original, ver Oficio N° DA-UHTPCOSJ-1074-2017 de fecha 21 de abril de 2017, visible a imágenes 105 a 107 del expediente judicial en formato electrónico).
  • 11)En fecha 12 de enero de 2023, el Departamento de Control y Desarrollo Urbano, de la Municipalidad de Puriscal, denegó la solicitud de permiso de uso de suelo para construcción de vivienda, en la finca matrícula folio real N° 542449-000 del Partido de San José presentada por el señor José Carlos Padilla Pérez. Lo anterior estableciendo en el apartado de Limitaciones Ambientales lo siguiente: “El inmueble en mención SI contempla una limitación según la legislación actual relacionada al ordenamiento territorial para la instauración de la actividad de construcción solicitada, siendo que el terreno en mención se encuentra dentro del radio de protección de una Naciente Intermitente según criterio DA-UHTPCOSJ-1074-2027 del 21 de abril del 2017, ubicada en las coordenadas (CRTM05) Este: 465592 y Norte: 1088960, por lo que se aplica un radio de protección de 50 metros, según la ley de Aguas, además se ubica del radio de protección de una Naciente sin criterio de la dirección de Aguas ubicada en las coordenadas (CRTM05) Este: 465645 Norte: 1089012.

(…)” Por lo anterior, dicho Departamento Municipal resolvió determinar que “el uso RESIDENCIAL solicitado en el inmueble de interés en las coordenadas (CRTM05) Este: 465587 Norte: 1088939; NO ES PERMITIDO”. (El resaltado y mayúsculas corresponden al original, ver certificado de Uso de Suelo N° MP-AM-CU-US 0012-2023 de fecha 12 de enero de 2023, visible a imágenes 59 y 60 del expediente judicial en formato electrónico).

  • 12)El 15 de mayo de 2023, la Dirección de Agua del Ministerio de Ambiente y Energía en la Provincia de San José, Cantón Puriscal, Distrito Santiago, Sitio Junquillo Abajo, identificó una fuente de agua, de tipo “naciente”, sin nombre, de carácter permanente que tiene como afluente una quebrada sin nombre, hoja cartográfica Río Grande, cuenca (88-26)-Parrita, que se ubica en las siguientes coordenadas: LAMBERT NORTE: Latitud Inicial: 202.600, Latitud final: 202,600; Longitud inicia: 502.282 y Longitud final: 502.282. CRTM02: Latitud inicial: 1.087.997, Latitud final: 1.087.997; Longitud Inicial: 465.933 y Longitud final: 465.933. Determinándose que es un cuerpo de agua de dominio público, de carácter permanente, y cuyo antecedente corresponde al Dictamen N° DA-UHTPCOSJ-0325-2022 emitido por esa misma Dirección. (Ver Oficio N° DA-UHTPCOSJ-0841-2023 de fecha 15 de mayo de 2023, visible a imágenes 46 a 49 del expediente judicial en formato electrónico).
  • 13)El 15 de mayo de 2023, la Dirección de Agua del Ministerio de Ambiente y Energía en la Provincia de San José, Cantón Puriscal, Distrito Santiago, Sitio Junquillo Abajo, identificó una fuente de agua, de tipo “naciente”, sin nombre, de carácter permanente que tiene como afluente una quebrada sin nombre, hoja cartográfica Río Grande, cuenca (88-26)-Parrita, que se ubica en las siguientes coordenadas: LAMBERT NORTE: Latitud Inicial: 203.619, Latitud final: 203,619; Longitud inicia: 501.995 y Longitud final: 501.995. CRTM05: Latitud inicial: 1.089.016, Latitud final: 1.089.016; Longitud Inicial: 465.652 y Longitud final: 465.652. Determinándose que es un cuerpo de agua de dominio público, de carácter permanente. (Ver Oficio N° DA-UHTPCOSJ-0841-2023 de fecha 15 de mayo de 2023, visible a imágenes 49 a 51 del expediente judicial en formato electrónico).
  • 14)En fecha 16 de junio de 2023, el Departamento de Control y Desarrollo Urbano, de la Municipalidad de Puriscal, denegó la solicitud de permiso de uso de suelo para construcción de vivienda, en la finca matrícula folio real N° 542451-000 del Partido de San José presentada por el señor José Carlos Padilla Pérez. Lo anterior, estableciendo en el apartado de Limitaciones Ambientales lo siguiente: “El inmueble en mención SI contempla una limitación según la legislación actual relacionada al ordenamiento territorial para la instauración de la actividad de construcción solicitada, siendo que el terreno en mención se encuentra dentro del radio de protección de una Naciente PERMANENTE según criterio DA-UHTPCOSJ-0841-2023 15-MAYO-2023, ubicada en las coordenadas (CRTM05) Este: 465652 y Norte: 1089016, por lo que se aplica un radio de protección de 100 metros, con fundamento en el artículo 33 de la ley de Forestal”. Por lo anterior, dicho Departamento Municipal resolvió determinar que “el uso RESIDENCIAL solicitado en el inmueble de interés en las coordenadas (CRTM05) Este: 465670 Norte: 1088972; NO ES PERMITIDO”. (El resaltado y mayúsculas corresponden al original, certificado de Uso de Suelo N° MP-AM-CU-US 0530-2023 de fecha 16 de junio de 2023, visible a imágenes 53 y 54 del expediente judicial en formato electrónico).
  • 15)En fecha 16 de junio de 2023, el Departamento de Control y Desarrollo Urbano, de la Municipalidad de Puriscal, denegó la solicitud de permiso de uso de suelo para construcción de vivienda finca matrícula folio real N° 542450-000 del Partido de San José, presentada por el señor José Carlos Padilla Pérez. Lo anterior estableciendo en el apartado de Limitaciones Ambientales lo siguiente: “El inmueble en mención SI contempla una limitación según la legislación actual relacionada al ordenamiento territorial para la instauración de la actividad de construcción solicitada, siendo que el terreno en mención se encuentra dentro del radio de protección de una Naciente PERMANENTE según criterio DA-UHTPCOSJ-0841-2023 15-MAYO-2023, ubicada en las coordenadas (CRTM05) Este: 465652 y Norte: 1089016, por lo que se aplica un radio de protección de 100 metros, con fundamento en el artículo 33 de la ley de Forestal”. Por lo anterior, dicho Departamento Municipal resolvió determinar que “el uso RESIDENCIAL solicitado en el inmueble de interés en las coordenadas (CRTM05) Este: 465670 Norte: 1088972; NO ES PERMITIDO”. (El resaltado, subrayado y mayúsculas corresponden al original, certificado de Uso de Suelo N° MP-AM-CU-US 0529-2023 de fecha 16 de junio de 2023, visible a imágenes 56 y 57 del expediente judicial en formato electrónico).
  • 16)Mediante resolución N° RES-MP-AM-HM-AT-VL-023-2023 de las 11:30 horas de fecha 13 de julio de 2023, la Oficina de Valoraciones de la Municipalidad de Puriscal, ante la solicitud por escrita presentada por los accionantes, respecto a la revaloración de las fincas matrículas folios reales N° 542449, derechos 001, 002 y 003; N° 542450, derechos 001, 002 y 003 y N° 542451 todas del Partido de San José por encontrarse dentro de una zona de protección de una naciente permanente, en su parte dispositiva dispuso lo siguiente: “Que se debe modificar en la base de datos el valor imponible la finca 1-542449-000 con un valor de ¢112.817.656,00, a su vez siendo su nuevo valor por cancelar ¢0, esto para que se le aplique la no sujeción por encontrarse en zona de protección desde el 21 de abril del 2017. Así mismo debe modificar en la base de datos el valor imponible la finca 1-542450-000 con un valor de ¢75.890.542,00, a su vez siendo su nuevo valor por cancelar ¢0, esto para que se le aplique la no sujeción por encontrarse en zona de protección desde el 21 de abril del 2017.

Por último, debe modificar en la base de datos el valor imponible la finca 1-542451-000 con valor de ¢46.230.072,00 y siendo su nuevo valor por cancelar ¢0, esto para que se le aplique la no sujeción por encontrarse en zona de protección desde el 15 de mayo del 2023. Que es obligación del contribuyente; en caso de sufrir alguna modificación la condición de la zona de protección, la comunicación a esta oficina”. (Ver imágenes 63 a 70 del expediente judicial en formato electrónico).

II. HECHOS NO PROBADOS

Se tiene como hechos nos probados de relevancia para el dictado de la sentencia, sea porque las partes incumplieron con sus cargas probatorias, o bien, porque este Tribunal no halló prueba idónea que, a la luz del principio de la sana crítica, permitiera acreditarlo, los siguientes:

  • 1)Que exista norma jurídica vigente para el momento de los hechos, que exija que el Estado, indemnizar o expropiar las fincas matrículas folios reales N° 542449, derechos 001, 002 y 003; N° 542450, derechos 001, 002 y 003 y N° 542451 todas del Partido de San José. (No fue aportada prueba que lo acredite).
  • 2)Que las limitaciones legales de carácter ambiental a las cuales están afectadas las fincas propiedades de los actores, impliquen un desmembramiento o vacío del derecho de propiedad sobre éstas y, por ende, surja el deber indemnizatorio por parte del Estado. (No fue aportada prueba que lo acredite).
  • 3)Que los actores, los señores Manuel Padilla Pérez, Elena Rocío Padilla Pérez, y José Carlos Padilla Pérez hayan adquirido los bienes inmuebles, fincas matrículas folios reales N° 542449, derechos 001, 002 y 003; N° 542450, derechos 001, 002 y 003 y N° 542451 todas del Partido de San José de forma previa a la vigencia de las normas legales donde se disponen las limitaciones ambientales (zona de protección ambiental por la existencia de una “naciente”) que afectan las referidas propiedades. (No existe prueba aportada a los autos que lo demuestre).
  • 4)La fecha exacta de la constitución natural o surgimiento visible de las fuentes (nacientes) de agua permanentes y cauce de dominio público intermitente que pesan sobre las fincas matrículas folios reales N° 542449, derechos 001, 002 y 003; N° 542450, derechos 001, 002 y 003 y N° 542451 todas del Partido de San José. (No fue aportada prueba que lo acredite).
  • 5)La acreditación de un daño especial y anormal a los derechos de propiedad de los accionantes, objeto de la presente litis, así como la pequeña proporción de afectados o intensidad excepcional de la lesión derivada de las limitaciones ambientales que pesan sobre las fincas matrículas folios reales N° 542449, derechos 001, 002 y 003; N° 542450, derechos 001, 002 y 003 y N° 542451 todas del Partido de San José. (No fue aportada prueba que lo acredite). -

III. SOBRE LOS ARGUMENTOS DE LA PARTE ACTORA

Como se indicó líneas arriba, en su escrito de demanda y en la réplica de contestación de la demanda, los actores, los señores Manuel Padilla Pérez, Elena Rocío Padilla Pérez, y José Carlos Padilla Pérez, refieren a que, son copropietarios por partes iguales (un tercio de la titularidad) de los inmuebles ubicados en Santiago de Puriscal de la Provincia de San José, inscritos bajo la matrícula folio real N° 542449, derechos 001, 002 y 003; N° 542450, derechos 001, 002 y 003 y N° 542451. Continúan señalando que, las propiedades citadas se encuentran en su totalidad dentro del área de protección de la naciente permanente, “sin nombre, con número de referencia ID 4224-2022, Número de Fuente 2, ubicada en las coordenadas Lambert norte: latitud inicial: 203.619 longitud inicial: 501.995 latitud final: 203.619 longitud final: 501.995, CRTM05: latitud inicial: 1.089.016 longitud inicial: 465.652 latitud final: 1.089.016 longitud final: 465.652, en adelante ‘Naciente 1’.

La cual, es referida igualmente bajo la georreferenciación CRTM05 Este 465652 Norte 1089016. Por su parte, la propiedad 1-542449-000 está afectada tanto por la naciente ID 4224-2022 como por la naciente intermitente delimitada en las coordenadas (CRTM05) Este: 465592 Norte: 1088960, en adelante ‘Naciente 2’”. En su demanda especifican que la naciente identificada con el número 1 fue determinada por parte de la Dirección de Agua del Ministerio de Ambiente y Energía (en adelante pudiendo abreviarse como MINAE) mediante el oficio N° DA-UHTPCOSJ-0841-2023 de fecha 15 de mayo de 2023, y se encuentra regulada por el legislador en el artículo 33 inciso a) de la Ley Forestal, Ley N° 7575 de fecha 13 de febrero de 1996, en donde se dispone un radio de cien metros medidos de modo horizontal como zona de protección. Estableciéndose en el numeral 34 de la Ley mencionada que existe una prohibición para talar en áreas o zonas protegidas descritas en el numeral 33 de la norma legal en comentario.

En cuanto a la naciente identificada con el número 2, indican que su zona de protección está regulada por la Ley de Aguas, Ley N° 276 de fecha 27 de agosto de 1942, estableciéndose en su numeral 149 como un radio de protección de cincuenta metros en los casos de terrenos planos en donde los titulares se encuentran vedados de destruir bosques nacionales o particulares. Dicha Naciente 2 aluden que fue identificada por parte de la Dirección de Agua del MINAE mediante oficio N° DA-UTTPCOSJ-1074-2017. En virtud de estas limitaciones ambientales los accionantes sostienen que se encuentran imposibilitados a obtener tipo de uso comercial o habitacional en sus propiedades “vaciando su derecho de propiedad en su totalidad, impidiendo cualquier uso o aprovechamiento comercial y/o habitacional de las Fincas afectadas”. Ante esta situación, y siendo que consideran que dichas limitaciones a sus propiedades no son razonables y proporcionales, en su criterio surge el nacimiento de la responsabilidad objetiva del Estado de restituir el daño sobre su patrimonio, mediante el pago de una indemnización, la cual a la fecha no la han recibido por parte del Estado, con ocasión de las afectaciones causadas por estar afectadas dentro de la zona de protección de las nacientes N° 1 y 2.

Para sustentar esta petición de indemnización realizan una exposición sobre los argumentos vertidos por la Sala Primera de la Corte Suprema de Justicia en la Resolución N° 00199-2010 de las 15:30 horas de fecha 04 de febrero de 2010, en cuanto a que las limitaciones reguladas en el numeral 34 de la Ley Forestal lleva implícito una restricción del ejercicio de aquellas facultades de dominio que puedan afectar, directa o indirectamente una naciente permanente, prueba de ello, la Municipalidad de Puriscal emitió las no conformidades de los certificados de usos de suelo para construcción de vivienda en las propiedades de éstos. Posteriormente esgrimen como parte de su teoría del caso que el Tribunal Constitucional, en la Resolución N° 4205-1996 de las 14:33 horas del 20 de agosto de 1996 estableció que: “privada encuentran su frontera natural en el grado de afectación a la propiedad; esto es, cuando la restricción al derecho de propiedad se convierte en una verdadera expropiación con la consecuente obligación de indemnizar, porque se hace desaparecer completamente el derecho de propiedad, o cuando no se afecte a la generalidad de la colectividad.

Así lo señaló la Corte Plena en relación con las limitaciones a imponer a la propiedad cuando traspasan el límite señalado, en sesión extraordinaria del dieciséis de junio de mil novecientos ochenta y tres: "[...] es decir "limitaciones" como las llama el artículo 45, pero no despojo de la propiedad privada ni privación de un atributo primario del dominio, porque impedir el goce de los bienes equivale, al menos en este caso, a una forma de expropiación sin el requisito de previa indemnización que ordena la carta política"; sosteniendo que, las limitaciones a las que se encuentran afectas sus propiedades se encuentran al 100% de la extensión, por encontrarse dentro de la zona de protección de la Naciente 1, y en el caso de la finca matrícula folio real N° 542459-000 de la Provincia de San José, adicionalmente está en la Naciente 2, “lo que impide cualquier aprovechamiento por parte de mis Representados, quien son sus propietarios.

Esta restricción al derecho de propiedad resulta excesiva en el contexto específico”, reiterando a lo largo de su exposición que se presenta en la especie una afectación significativa al derecho de su propiedad, de forma que incluso en su criterio “compromete su esencia fundamental”; afirmando que “Aunque no se clasifiquen formalmente como expropiaciones, estas restricciones a las facultades propias del derecho de propiedad son tan severas que transforman la posesión en una mera titularidad. Esta alteración sustancial del derecho justifica una compensación adecuada, similar a la que se otorgaría en casos de expropiación”. De ahí que, arguyen una violación al derecho de la propiedad tutelado por el numeral 45 de la Constitución Política y 21 de la Convención Americana de Derechos Humanos, por lo que, se debe proceder en la especie de iniciar las diligencias útiles y necesarias para expropiar los bienes inmuebles de su propiedad, al tenor de la Ley de Expropiaciones, “Esto se debe a que el derecho de propiedad ha sido completamente vaciado y anulado por una razón de interés púbica validada, que es la conservación de los recursos acuíferos.

En este sentido, mientras el Estado no efectúe la compensación adecuada, estaría cometiendo una omisión ilícita que los Propietarios no están obligados a tolerar”. Un segundo argumento que esgrimen los accionantes es la responsabilidad del Estado Legislador, por motivo del sacrificio especial y anormal sufrido por parte de los actores. Para tal efecto, inicia su exposición aludiendo a que de los numerales 9 y 41 de la Constitución Política se deriva la responsabilidad objetiva del Estado, cuando en ejercicio de sus funciones cause un daño o un perjuicio, sin necesidad de realizar un examen sobre la intencionalidad o negligencia. responsabilidad que está contemplada a nivel legal mediante los numerales 190 y 191 de la Ley General de la Administración Pública, normas que transcriben, así como cita como fundamento de su postura la Resolución N° 213-2008 de las 8:20 horas de fecha 25 de marzo de 2008 de la Sala Primera de la Corte Suprema de Justicia, extrayendo la responsabilidad por funcionamiento legítimo o ilegítimo, normal o anormal.

Continúan señalando que, “Es claro que el Estado Legislador promulgó la Ley Forestal, que prohíbe cualquier tipo de construcción, aprovechamiento o afectación dentro de un radio de 100 metros alrededor de las nacientes permanentes, en el tanto estas actividades podrían ocasionar algún tipo de afectación o daño a estas fuentes de agua, así como la Ley de Aguas, que prohíbe el aprovechamiento de la zona ubicada dentro de un radio de 50 metros alrededor de las nacientes intermitentes. Estas disposiciones afectan tanto a las nacientes ya existentes al momento de su promulgación, como a las que puedan surgir o ser identificadas en propiedades privadas en el futuro como ocurre en el caso bajo análisis. (…) En el caso específico que nos ocupa, las nacientes identificadas afectan en su totalidad a las Fincas Afectadas, impidiendo el ejercicio pleno del derecho de propiedad. Esta situación se asemeja a una expropiación tácita, ya que la restricción ha trascendido de ser una limitación razonable para convertirse en una privación total del derecho”.

A partir de lo anterior, y después de referenciar el numeral 194 de la Ley General de la Administración Pública y la Resolución N° 00796-1991 de las 15:10 horas de fecha 26 de abril de 1991, sostienen que se está ante un funcionamiento normal por conducta lícita que produce un daño indemnizable, dando cabida a la responsabilidad objetiva del Estado por los siguientes motivos: i) la determinación de las áreas de protección ambientales son una manifestación clara de una conducta lícita realizada por el Estado, con efectos directamente en la esfera patrimonial de los actores; ii) existe una clara afectación de los derechos patrimoniales de los accionantes, no teniendo razón alguna el Estado para que éstos sacrifiquen el valor de la totalidad de sus propiedades en aras del interés público sin la correspondiente indemnización justa y previa, so pena de una vulneración del principio de igualdad en el sostenimiento de las cargas públicas. iii) “En tercer lugar, tenemos que el actuar del Estado genera un daño especial y anormal a mis Representados.

Por un lado, el daño es especial en cuanto afecta patrimonialmente a un grupo pequeño pero determinable de personas: los actores de este proceso. Asimismo, este es anormal dada su gravedad, intensidad y trascendencia ya que la carga pública que representan las Áreas de Protección en el caso particular para las Fincas Afectadas, las cuales están en un 100% dentro del área de protección de la Naciente 1, va más allá del límite de lo que mis Representados deben soportar, por cuanto, se ha vaciado en su totalidad el derecho de propiedad, lo que conlleva necesariamente una indemnización por parte del Estado”. Concluyendo por ello que, existe un nexo de causalidad objetivo entre la manifestación específica de la función estatal, consistente en la imposición de limitaciones ambientales (zonas de protección) a través de la Ley Forestal y la Ley de Aguas, y la lesión provocada a los administrados (al estar sus propiedades limitadas al 100% por éstas), afectándose su derecho de propiedad, al estar en una expropiación de hecho, violatoria del principio de igualdad de sostenimiento de las cargas públicas, artículos 18, 33 y 45 de la Constitución Política.

Responsabilidad objetiva del Estado Legislador que genera el derecho a indemnizar por el daño especial y anormal que sufren, “Por lo tanto, mientras el Estado no realice la compensación adecuada mediante el proceso de expropiación estipulado en la legislación, estamos ante una acción ilegal continua y omisiva que se traduce en una grave restricción al derecho de la propiedad privada”. Por último, fundamenta su demanda en lo dispuesto en el ordinal 21 de la Convención Americana sobre Derechos Humanos, preceptos 18, 33, 45 y 49 de la Constitución Política, artículos 190, 191, 194 y 196 de la Ley General de la Administración Pública, numerales 13 y 17 de la Ley de Expropiaciones, ordinales 33 y 34 de la Ley Forestal, artículo 149 de la Ley de Aguas y preceptos 10, 12, 36, 42, 43, 69, 98, 122, 220 y concordantes del Código Procesal Contencioso-Administrativo, además de los dictámenes y jurisprudencia citados, según los numerales 7 y 8 de la Ley General de la Administración Pública.

En la audiencia conferida por parte del Tribunal Contencioso Administrativo mediante la resolución de las 8:45 horas de fecha 21 de mayo de 2024 sobre la contestación del Estado, respecto a la falta de legitimación pasiva, afirman que “la finalidad de la Demanda no es que se declare la nulidad de los actos administrativos emitidos por la Municipalidad o la Dirección de Aguas, dada la existencia de las nacientes, y con esto, igualmente, el área de protección en su radio dispuesta por el Estado Legislador ha sido efectivamente corroborada. De tal manera que, no es procedente la transmisión de responsabilidad pretendida por la representación del Estado a la Municipalidad”, sino una responsabilidad del Estado Legislador, al devenir la limitación de su propiedad de una norma de carácter legal, y que al vaciar el contenido del derecho de propiedad debe ser acogida la indemnización reclamada, al constituir una expropiación de hecho. Reiterando los argumentos contenidos en el escrito de demanda y que fueron antes descritos. -

IV. SOBRE LA TEORÍA DE DEFENSA DEL ESTADO

La representación del Estado en la contestación del libelo de la demanda rechazó todos los hechos de ésta. Señala en su memorial de la contestación que, en la especie existe una falta de legitimación pasiva, por cuanto los actos administrativos que denegaron el uso de suelo para la construcción fueron dictados por la Municipalidad de Puriscal y no por el Estado, así refiere a los oficios N° MP-AM-CU-US 530-2023 y N° MP-AM-CU-US 0529-2023 ambos de fecha 16 de junio de 2023 y el oficio N° MP-AM-CU-US 0012-2023 de fecha 12 de enero de 2023, advirtiendo que éste último no cuenta con criterio de la Dirección de Agua del Ministerio de Ambiente y Energía. Es su postura que, al no existir “ninguna actuación del Estado ni por acción ni por omisión, que implique su responsabilidad”, debe declararse con lugar la excepción de falta de legitimación pasiva del Estado. Aunado a lo anterior, interpone la excepción de falta de derecho, aludiendo que tanto la Ley de Aguas como la Ley Forestal disponen “limitaciones a la propiedad privada no indemnizables”.

(Resaltado en negrita corresponde al original), normas que fueron emitidas de forma anterior a la adquisición de la propiedad por parte de los actores. Así indica que: “Las limitaciones establecidas en los artículos 33 y 34 de la Ley Forestal actual, tienen su antecedente normativo en la Ley Forestal Nº 4465 de 25 de noviembre de 1969, artículos 84 y siguientes y las limitaciones establecidas en los artículos 148, 149 y 151 de la Ley de Aguas, provienen de 1942. La Ley Forestal Nº 7575 entro en vigencia (sic) el 16 de abril de 1996 y la Ley de Aguas Nº 276 lo hizo el 27 de agosto de 1942, mientras que las partes adquieren la propiedad en el año 2003, es decir, al momento de adquirir la propiedad, está ya contaba con las limitaciones establecidas en esas normativas”. Sumado a lo indicado, sostiene que la Sala Constitucional ha reconocido de forma amplia la legitimidad de las limitaciones no indemnizables al derecho de la propiedad, extrayendo la posición esgrimida por dicho Tribunal Constitucional, en la Resolución N° 8234-97 de las 6:15 horas de fecha 03 de diciembre de 1997, y citando la Resolución N°0062-2019 de las 8:25 horas de fecha 30 de setiembre de 2019 del Tribunal Contencioso Administrativo, sentencia que a la vez, transcribe la Resolución N° 4205-96 de las 14:33 horas de fecha 20 de agosto de 1996 de la Sala Constitucional de la Corte Suprema de Justicia.

Arguye que los autos son omisos respecto a elementos de convicción “que permita determinar con certeza que la limitación contenida en el artículo 33 inciso a) de la Ley Forestal y en los numerales 148, 149 y 151 de la Ley de Aguas, sea de tal grado que impida dar algún uso al inmueble. Los actores no han demostrado que no han podido hacer uso del inmueble, que su derecho de disfrute y posesión se ha visto afectado y que la existencia de áreas de protección en el inmueble, lo haga del todo inutilizable para los fines requeridos por los actores”. De hecho, sostiene el Estado que es falso que se prohíba cualquier tipo de construcción, aprovechamiento o uso del inmueble. A partir de lo anterior, manifiesta que no logra acreditarse un nexo de causalidad adecuada entre el daño (que lo refuta en cuanto a su existencia), y las limitaciones que son legalmente establecidas, de ahí que, conforme a lo desarrollado por el Tribunal Constitucional, debe demostrarse que se ha dejado sin contenido el derecho de propiedad de los accionantes, lo cual resulta indispensable para acceder algún tipo de indemnización, aspecto que echa de menos.

Considera que las Leyes Forestal y de Aguas contienen una serie de limitaciones que no impiden a los propietarios el ejercicio de todos los atributos del derecho de la propiedad, en su criterio “Se trata de límites o fronteras a la extensión del derecho de propiedad, que nunca puede ser limitado: ‘la limitación de un derecho opera sobre ese contenido normal, para restringir sus posibilidades de ejercicio’”. Citando como parte de su fundamentación la Resolución N° 0075-2011 de las 11:10 horas del 12 de agosto del 2011 dictada por el Tribunal Contencioso Administrativo y Civil de Hacienda, en donde se citan las sentencias N° 5833-2002 y 2004-1924 de la Sala Constitucional. En virtud de lo anterior, solicita que se declare sin lugar en todos sus extremos la demanda incoada por los señores Manuel Padilla Pérez, Elena Rocío Padilla Pérez, y José Carlos Padilla Pérez, requiriendo que se condene a éstos al pago de las costas procesales y personales, e intereses hasta su efectivo pago. -

V. SOBRE EL OBJETO DEL PROCESO

Del análisis de los autos, demanda y sus pretensiones, se deriva que el objeto del proceso gravita, en el reclamo de una indemnización por el valor de la totalidad de los inmuebles, matrículas folios reales N° 542449, derechos 001, 002 y 003; N° 542450, derechos 001, 002 y 003 y N° 542451 todas del Partido de San José propiedad de los accionantes, derivada principalmente de la identificación de dos cuerpos de aguas (naciente permanente y naciente clasificada como un cauce de dominio público intermitente) en las cercanías de dichas propiedades, que implican la aplicación de las zonas de protección de 100 metros y 50 metros respectivamente, contenidas en los artículos 33 y 34 de Ley Forestal, Ley N° 7575 y numeral 149 de la Ley de Aguas, Ley N°276. Así argumentan los accionantes dos motivos para sus pretensiones indemnizatorias. El primero de ellos, por cuanto consideran que debe expropiarse la totalidad de dichas fincas, por cuanto las afectaciones ambientales dispuestas en la normativa legal citada vacían el contenido de su derecho de propiedad privada, al afectar al cien por ciento de dichos inmuebles, impidiéndoles realizar actividades constructivas para vivienda familiar y comercial, lo que en su criterio constituyen limitaciones excesivas, que resultan ser indemnizables, so pena de violentar los principios de igualdad en el sometimiento de las cargas públicas y de legalidad, al comprometer (según su postura) la esencia fundamental del derecho fundamental consagrado en el precepto 45 constitucional.

El segundo de ellos, corresponde a que, según su opinión, aplican las condiciones establecidas en el numeral 194 de la Ley General de la Administración Pública, y en sí todo el régimen de responsabilidad patrimonial del “Estado Legislador”, por conducta lícita y funcionamiento normal derivado en que, las zonas de protección ambientales contendidas en la Ley Forestal y la Ley de Aguas respecto a las propiedades de los accionantes, generan un daño sobre la esfera patrimonial de los accionantes que califican como “especial, anormal, desigual y susceptible de ser cuantificado económicamente por medio del proceso de expropiación”. Enfocándose por ello, en un reclamo de daño patrimonial, sin embargo, también se advierte que, no establecen ninguna pretensión por daño moral (subjetivo u objetivo) adicional. Siendo ello así, pretenden que este Tribunal condene al Estado al pago de la totalidad de las fincas matrículas folios reales N° 542449, derechos 001, 002 y 003; N° 542450, derechos 001, 002 y 003 y N° 542451 todas del Partido de San José.

Y que, para tal efecto, se ordene al Estado para que, dentro de un plazo de dos meses inicie las diligencias de expropiación de los inmuebles “ut supra”. Ahora bien, es relevante señalar que no es parte de las pretensiones objeto de la presente litis, el análisis de la conformidad o disconformidad de los actos administrativos emitidos por parte de la Municipalidad de Puriscal, en cuanto a la no conformidad con el uso para la “construcción de vivienda” solicitada para los inmuebles propiedad de los accionantes, ante la acreditación de que se encontraban dentro del radio de la zona de protección regulada en los artículos 33 y 34 de la Ley Forestal y numeral 149 de la Ley de Aguas, correspondiente a los oficios N° MP-AM-CU-US 530-2023 y N° MP-AM-CU-US 0529-2023 ambos de fecha 16 de junio de 2023 y el oficio N° MP-AM-CU-US 0012-2023 de fecha 12 de enero de 2023 emitidos por parte de la Corporación Municipal.

Tampoco es parte de lo discutido en la presente causa, el control de la legalidad sobre la conducta formal desplegada por la Dirección de Agua del Ministerio de Ambiente y Energía mediante los oficios N° DA-UHTPCOSJ-1074-2017 de fecha 21 de abril de 2017 y N° DA-UHTPCOSJ-0841-2023 de fecha 15 de mayo de 2023, en donde, previa inspección in situ, acreditó la existencia de los cuerpos de aguas (naciente permanente y naciente intermitente) en las tres propiedades objeto del presente proceso, sino que, al contrario se desprende del elenco de pretensiones y de la fundamentación del libelo de la demanda, que dicha actuación administrativa constituye la premisa para la reclamación patrimonial (indemnización) respectiva. De ahí que, el análisis que realiza este Tribunal se efectúa sobre el marco fáctico y jurídico derivado del contenido de la demanda, y la contestación de ésta, así como el análisis integral de los elementos probatorios admitidos, excluyendo los aspectos que han sido referenciados en el presente apartado.

Desde esta perspectiva, en cumplimiento del principio dispositivo, esta Cámara Colegiada procederá a analizar las pretensiones objeto de la litis, y dilucidar los argumentos que en criterio de los accionantes les asisten dentro del límite marco anteriormente expuesto. -

VI. SOBRE EL ANÁLISIS DEL CASO EN CONCRETO

Este Tribunal de forma previa, logra identificar que, en el libelo de la demanda, la representación de la parte actora establece dos pretensiones específicas, que corresponden a: 1) Pretensión indemnizatoria de la totalidad de las propiedades fincas matrículas folios reales N° 542449, derechos 001, 002 y 003; N° 542450, derechos 001, 002 y 003 y N° 542451 todas del Partido de San José. 2) Pretensión de “hacer”, correspondiente a ordenar al Estado, para que, en el plazo de dos meses, proceda a iniciar con el procedimiento de expropiación. Ahora bien, como se adelantó en líneas anteriores, ambas pretensiones parten de la premisa de que las limitaciones de orden ambiental que afectan dichas propiedades resultan ser indemnizables, configurándose los criterios para el surgimiento de la responsabilidad administrativa derivada de conducta lícita del Estado Legislador, y de la existencia de lo que denominan los accionantes como una expropiación de hecho.

Por lo anterior, se considera relevante analizar esta figura jurídica y sus diferencias con el régimen de limitaciones a la propiedad privada, como base para la fundamentación del presente fallo. Siguiendo el referido orden, se procederán a conocer y resolver de seguido, considerando dentro del análisis respectivo, los alegatos presentados por ambas partes y la prueba que consta en el expediente judicial, vinculándolos con las pretensiones esbozadas en el libelo de la demanda. - SOBRE EL RÉGIMEN CONSTITUCIONAL DE LA PROPIEDAD PRIVADA:

Existe un consenso general respecto a que, un Estado Social y Democrático de Derecho, como lo es el nuestro, tiene como asidero, el respeto de la libertad en sus diferentes dimensiones, que conllevan a que se promulgue la libertad de emprendimiento, o de libre comercio y mercado, la libertad de elección de los consumidores, la libertad de escogencia del oficio o trabajo a desarrollarse, así como lleva aparejado la libertad de “tener”, aludiendo al derecho de la propiedad privada, los cuales, vendrán a constituirse pilares sobre los cuales descansa, el régimen constitucional costarricense, y dentro de los cuales, al estar sujetos los órganos jurisdiccionales a la Constitución (numerales 153 de la Constitución Política y 1 de la Ley Orgánica del Poder Judicial), al momento de dirimir una controversia como la que corresponde el objeto de la presente litis, dichos postulados constitucionales y democráticos deben ser tomados en cuenta por parte de esta Cámara de Juzgadores, a fin de no contrariar el bloque de constitucionalidad y legalidad.

Así, la Sala Constitucional de la Corte Suprema de Justicia, en la Resolución N° 3495-92 de las 14:30 horas de fecha 19 de noviembre de 1992, sobre esta posición estableció que: “(…) V- Por otra parte, también la Constitución y el Derecho Internacional de los Derechos Humanos conforman un marco general de reconocimiento y garantías de libertad, cuyos contenidos esenciales la ley debe y no puede sino desarrollar y ampliar, o, si acaso, regular dentro de las limitaciones que aquéllos establecen y del sentido que ellos mismos les imprimen. Concretamente, nuestra Constitución consagra, en su artículo 28, tanto el principio de libertad, todavía meramente formal, en cuanto permite al ser humano todo aquello que la ley no le prohíba, (…) principio y sistema de la libertad que son la razón de ser y el núcleo fundamental en el cual convergen, por una parte, el elenco de los derechos individuales y sociales y sus propias garantías, y por otra, todas las demás normas y principios constitucionales relativos a la organización y actividad del Estado, (…) VI- Implícita en esos valores y principios de la libertad, ocupa lugar primordial la dimensión de ésta en el campo económico.

En esta materia la Constitución es particularmente precisa, al establecer un régimen integrado por las normas que resguardan los vínculos existentes entre las personas y las distintas clases de bienes; es decir, la relación de aquellas con el mundo del ‘tener’, mediante previsiones como las contenidas o implicadas en los artículos 45 y 46, las cuales, aunque deban ceder ante necesidades normalmente más intensas para la existencia misma del hombre -como la vida o a la libertad e integridad personales-, no crean por ello derechos de segunda clase, sino tan fundamentales como aquéllos, y con su mismo rango -no en vano la Asamblea General de las Naciones Unidas y todos los órganos y tribunales internacionales que se ocupan de los derechos humanos han venido invariablemente caracterizándolos como ‘indivisibles’ e ‘interdependientes’-. Así, la Constitución establece un orden económico de libertad que se traduce básicamente en los derechos de propiedad privada (art. 45) (…)” (El resaltado no corresponde al original).

De suerte que, también el Tribunal Constitucional ha postulado que el régimen de garantías y, en particular el derecho fundamental a la propiedad privada, no resultan ser irrestrictos, aunque para poder delimitarlos o regularlos, ese bloque de constitucionalidad y convencionalidad vigente exige que el Estado deba cumplir con una serie de procedimientos como garantías a la población, lo cual se deriva del propio concepto de la propiedad alineado al precepto 45 de la Constitución, como “aquel derecho que le permite a su titular poseer, disponer y hacer uso libremente del bien, sin que intervenga ningún tercero en ello. Es esta la condición, precisamente que le da el carácter de un derecho ‘erga omnes’, es decir que puede ser oponible ante terceros, obligándoles a su vez, a respetar y abstenerse a perturbar ese derecho”. (Ver Resolución N° 2802-99 de las 17:12 horas del 20 de abril de 1999 emitida por la Sala Constitucional).

Ahora bien, en ese marco de análisis, comprende este Tribunal que se encuentran circunscritas las pretensiones de la parte accionante, en calidad de titulares de un tercio de tres bienes inmuebles (Hechos Probados N° 1 a 9), condición de propietarios que implica el “derecho de gozar y disponer una casa sin más limitaciones que las establecidas en las leyes” (Muñoz Machado (Santiago). Diccionario Panhispánico del Español Jurídico. España, Real Academia Española, Volumen I, 2017 p.1694). Alcances de la propiedad que se encuentran regulados en igualdad de términos en el numeral 266 del Código Civil, al apuntar que: “La propiedad y cada uno de los derechos especiales que comprende, no tienen más límites que los admitidos por el propietario y los impuestos por disposiciones de la ley”. En relación con los límites, limitaciones y cargas a la propiedad, los numerales 383 y 384 del Código Civil rezan: “Artículo 383.

La propiedad privada sobre inmuebles está sujeta a ciertas cargas u obligaciones que la ley le impone en favor de los predios vecinos, o por motivo de pública utilidad. Artículo 384. Las obligaciones a causa de utilidad pública se rigen por los reglamentos especiales. También se rigen por leyes especiales las que se refieren al ramo de aguas, aunque se establezcan en interés o beneficio directo de particular”. (El resaltado no corresponde del original). Dentro de las límites, limitaciones o cargas que constitucionalmente son procedentes, son aquellas derivadas del régimen ambiental, como el caso de mérito. En este sentido, el Tribunal Constitucional ha sostenido que existe un régimen de límites y/o limitaciones que, en el tanto no vacíe del contenido del derecho de propiedad, ni que sean desproporcionados o proporcionados no requiere de ser indemnizado, posición que es compartida por esta Cámara de Juzgadores.

Ahora bien, al realizar un examen de los argumentos que esgrimen las partes accionantes como fundamento de su reclamo indemnizatorio, y sobre la cual existe controversia entre éstas y la representación del Estado, es respecto a la proporcionalidad y razonabilidad de las limitaciones ambientales que pesan sobre los bienes inmuebles objeto de la presente causa. Derivando de esta no razonabilidad o desproporcionalidad la parte accionante una responsabilidad del Estado Legislador, que fundamenta su pretensión de que se realicen las diligencias de expropiación, por considerar que se vacía su derecho de propiedad. De forma tal que, esta Cámara de Juzgadores advierte que no existe controversia respecto a que, en la especie las propiedades de los accionantes se encuentran bajo una limitación de carácter ambiental (Ver Hechos Probados N° 10, 12 y 13), sino la divergencia radica en los efectos que éstas tienen sobre el contenido del derecho fundamental de la propiedad privada.

En este sentido para este Órgano Jurisdiccional estas limitaciones de orden ambiental deben analizarse desde la función social de la propiedad, y a partir de ahí determinar si lleva razón los actores sobre los extremos pretendidos. Sobre la función social de la propiedad, la Sala Constitucional de la Corte Suprema de Justicia ha desarrollado de forma extensa este tema, destacando para los fines de dilucidar el caso de mérito, que se deriva del párrafo segundo del numeral 45 de la Norma Fundamental, la posibilidad del legislador por mayoría calificada, de establecer limitaciones de interés social a la propiedad, como una manera de sopesar la ideología liberal, que proponía la amplia libertad de la iniciativa privada y limitando la acción pública a promover ese espectro de libertad dentro del cual, la propiedad privada tenía un fin exclusivamente visto desde o en favor a su propietario. Tesis que fue dando espacio a teorías más enfocadas en velar por los intereses colectivos, por lo que, los constituyentes valoraron que: “La propiedad es una institución jurídica que se ha formado para responder a una necesidad económica y que evoluciona inexorablemente como las necesidades económicas mismas.

Ahora bien, en nuestras sociedades modernas, la necesidad económica a la cual ha venido a responder la propiedad se transforma profundamente: por consiguiente, la propiedad, como institución jurídica, debe transformarse también. La evolución del concepto de la propiedad está determinada también por una interdependencia cada vez más estrecha de los diferentes elementos sociales. De ahí que la propiedad, por decirlo así, se socialice. Esto no significa que llegue a ser colectiva, en el sentido de las doctrinas colectivistas, pero significaba dos cosas: primeramente, que la propiedad individual deja de ser un derecho del individuo para convertirse en una función social; y, en segundo lugar, que los casos de afectación de riqueza a las colectividades que jurídicamente deben ser protegidas, son cada día más numerosas ...’ (Comentarios del diputado Volio Sancho. Actas de la Asamblea Nacional Constituyente de 1949, Tomo I. página 505)”.

(Ver Sala Constitucional de la Corte Suprema de Justicia, Resolución N° 2007-006581 de las 15:39 horas de fecha 15 de mayo de 2007). De esta manera, nuestro Tribunal Constitucional ha sostenido que esa función social aunque no expresamente estatuida en el numeral 45 constitucional se infiere dicho precepto, determinando que los constituyentes reconocieron que esta función social reviste un carácter universal que se sustenta como parte de la misma existencia de la colectividad, donde se erige “(…) ‘Tales limitaciones al derecho de propiedad son producto del hecho mismo de formar parte de una colectividad, la misma que garantiza ese derecho, pero que lo somete a ciertas regulaciones con la finalidad de alcanzar un disfrute óptimo y armónico de los derechos de todos los individuos y que se caracterizan, como tesis de principio, por no ser indemnizables’ (sentencia número 04205-96, supra citada)”.

(Ver Resolución N° 2005-004926 de las 11:59 horas del 29 de abril de 2005 de la Sala Constitucional). De suerte que, para este Órgano Jurisdiccional al momento de analizar la razonabilidad o proporcionalidad de una limitación de carácter ambiental, conlleva a realizar una ponderación entre los principios de respecto de la propiedad privada y el interés público o colectivo, que se derivan de los preceptos constitucionales 45 párrafos primero y segundo, 46 y 50. En donde a criterio de esta Cámara de Juzgadores, ante un presunto conflicto entre las dimensiones o alcances del derecho a la propiedad privada individual, debe ceder hacia la búsqueda del interés de la colectividad, lo que, se traduce en la procura y protección ambiental, no solo del entorno meramente natural, sino el urbano-ambiental. En otras palabras, este Tribunal es del criterio, que el marco constitucional vigente en Costa Rica se le ha brindado un mayor peso a la protección del ambiente respecto a la propiedad privada, tomando en consideración que, del derecho fundamental al ambiente sostenible se derivan los derechos fundamentales de la vida y la salud de las personas (incluso las generaciones futuras), y como parte de éste se ha reconocido el derecho al acceso al agua y todos los regímenes de protección de este recurso hídrico.

(Sobre el derecho al acceso al agua ver entre otras, las resoluciones N° 2004-12263 de las 14:49 horas de fecha 29 de octubre de 2004 y N° 2011-6949 de las 12:55 horas de fecha 27 de mayo de 2011 emitidas por la Sala Constitucional). En este caso, los accionantes parten de su teoría del caso en sostener que existe una limitación ambiental (interés colectivo) desproporcionada que vacía su derecho de propiedad (interés individual) y que por ende constituye una expropiación de hecho, de donde surge una responsabilidad patrimonial del Estado Legislador, lo cual se adelanta, no es compartido por esta Cámara Colectiva, conforme a lo que se desarrollará en las siguientes líneas.

ANÁLISIS DE LAS PRETENSIONES DE LOS ACCIONANTES.

De forma reiterada la parte actora en su demanda y su réplica de contestación manifiesta que, reconoce la existencia de una zona de protección ambiental que pesa sobre las fincas matrículas folios reales N° 542449, derechos 001, 002 y 003; N° 542450, derechos 001, 002 y 003 y N° 542451 todas del Partido de San José cuya titularidad es de los accionantes. Ahora bien, se reitera que, gira su teoría del caso en que, proveniente de esas zonas de protección dispuestas por el legislador (Ley Forestal y Ley de Aguas), se le vacía el contenido del derecho de propiedad regulado en el artículo 45 de la Constitución Política, en el tanto, esas zonas de protección o limitaciones ambientales inciden en la totalidad de los inmuebles anteriormente citados, presentando como prueba que lo acredita los oficios municipales donde se le hace constar la no conformidad con la solicitud de certificación de uso para la construcción de una vivienda (oficios N° MP-AM-CU-US 530-2023 y N° MP-AM-CU-US 0529-2023 ambos de fecha 16 de junio de 2023 y el oficio N° MP-AM-CU-US 0012-2023 de fecha 12 de enero de 2023 emitidos por la Municipalidad de Puriscal).

Sobre estos argumentos, así como la defensa planteada por el Estado, y su correlativo análisis de las pretensiones base del presente proceso serán analizadas por este Órgano Juzgador. CRITERIO DEL TRIBUNAL: Retomando lo que se ha sostenido a lo largo de la presente resolución, no se pone en duda sobre la inviolabilidad de la propiedad privada, como “aquel derecho de poseer exclusivamente una cosa, gozar y disponer de ella, sin más limitaciones que las establecidas por la ley o por la voluntad del propietario”. (Ver Resolución N° 2006-017514 de las 9:41 horas de fecha 01 de diciembre de 2006 emitida por la Sala Constitucional de la Corte Suprema de Justicia). También se reconoce, posición que se comparte, que: “El tratamiento de la protección de los derechos reales, en materia civil y agraria, tienen una gran importancia en todos los ordenamientos jurídicos que han consolidado una base constitucional arraigada en la protección de los derechos humanos fundamentales: junto a los derechos de libertad económica, entre los cuales se encuentra la propiedad privada y demás derechos reales derivados, también se han consagrado derechos-deberes económicos, sociales y ambientales.

La propiedad privada y la libertad económica encuentran protección constitucional en los artículos 45 y 46 de nuestra Carta Magna y, aunque parece obvio, su existencia y defensa obedecen a la permanencia de un Estado Social de Derecho, basado en principios y valores constitucionales, en los cuales se consagran no solo derechos a favor de los particulares, sino también deberes, con miras a alcanzar un desarrollo económico, con equidad, solidaridad y justicia social”. (Ver Sala Constitucional Resolución Nº 16629 -2012 a las 16:31 horas 28 de noviembre del 2012). En este sentido, se comparte la posición de la Sala Constitucional transcrita, en el tanto, no se puede analizar el derecho de la propiedad de forma aislada, como un derecho irrestricto, sino que también debe analizarse éste dentro de los deberes de los ciudadanos en la protección de la naturaleza, lo cual incide definitivamente en el hecho de que, al momento de ejercer sus derechos como titulares de un bien o un valor, debe realizarse de forma armónica con el colectivo, y para el caso que nos ocupa, en equilibrio con las cargas ambientales que han sido establecidas por el legislador para lograr cumplir los fines sociales del Estado como un todo, en palabras de la Sala Constitucional procurar “alcanzar un desarrollo económico, con equidad, solidaridad y justicia social”.

Lo anterior dado que no se puede perder de vista es que el ordenamiento jurídico como un todo, consagra un balance o un equilibrio entre los derechos de los administrados, las garantías dispuestas en procura de la protección al régimen de libertades, dentro de las que se encuentra, como dijimos anteriormente, el derecho fundamental a “tener” (propiedad privada), y el interés general, público y la propia función social de la propiedad (especialmente cuando se trate del resguardo del recurso hídrico, objetivo primordial de las limitaciones o zonas de protección que son objeto de la presente litis). También se trae a colación lo ya apuntado, en lo concerniente a que, por estos motivos, y la propia evolución del concepto de la propiedad, es que jurídicamente es factible que la propiedad tenga cargas, límites o limitaciones que pesan sobre el bien inmueble, y respecto de las cuales, unas deben ser soportadas por su titular sin pretender ser indemnizadas, como lo son las restricciones o zonas de protección a las nacientes que están reguladas en la Ley Forestal y Ley de Aguas, por lo que no se comparte el criterio de los accionantes.

En consonancia con lo dicho, es criterio de esta Cámara de Juzgadores que los accionantes brindan una interpretación de “vaciar el contenido del derecho a la propiedad privada” equivaliéndolo a la imposibilidad de realizar una edificación o construcción para vivienda o comercial, lo cual es inexacto, según se explica a continuación. En primer lugar, no obra prueba alguna dentro del expediente administrativo respecto a que los accionantes hayan solicitado una patente comercial o algún otro permiso o licencia de aprovechamiento del bien inmueble a la Municipalidad de Puriscal u otra entidad pública como lo podría ser el Fondo de Financiamiento Forestal, que cuenta con diferentes proyectos de pago de servicios ambientales o aprovechamiento forestal. Lo anterior sin pretender ser taxativo en las opciones que, dentro del marco jurídico vigente y, sin transgredir las limitaciones que están contenidas en los preceptos legales de reiterada cita, pueden ejecutar los accionantes, y cualquier otra persona física o jurídica que se encuentre dentro de la misma condición jurídica contenida en los presupuestos normativos de las Ley Forestal y Ley de Aguas.

Infiere este Tribunal que la representación de la parte actora extrapola esa imposibilidad de ejercer cualquier tipo de actividad de las normas 33 y 34 de la Ley Forestal y del numeral 149 de la Ley de Aguas, así como la jurisprudencia emitida por la Sala Constitucional respecto a la imposibilidad de cortar árboles o realizar actividades que no están permitidas dentro de los bienes que están dentro de una zona de protección ambiental, como lo es las propiedades de los accionantes, de donde surge su conclusión de que debe ser indemnizados por ser una expropiación de hecho. Sin embargo, como se apuntó existe un error de equiparar la imposibilidad de construcción de una vivienda del aprovechamiento como tal de un inmueble, el cual no se agota en la construcción de una vivienda, sino que existen diferentes destinos o provechos que se pueden ejercer como propietario. Según el Diccionario de la Real Academia Española, el vocablo “aprovechar” se define como “Emplear útilmente algo, hacerlo provechoso o sacarle el máximo rendimiento.

Aprovechar la tela, el tiempo, la ocasión”. (Real Academia Española. Diccionario de la Lengua Española, Edición 2023 consultada en: https://dle.rae.es/aprovechar). Por lo que, ese aprovechamiento debe analizarse respecto a todos los derechos que surgen del ser titular de un bien, y como se citó, dentro del ámbito de los diferentes tipos de propiedad que existen, y los destinos de los bienes que están al servicio del ser humano. Al respecto, precisamente el Tribunal Constitucional se ha desarrollado el tema de las diferentes vocaciones de las propiedades, es decir, los destinos y diferentes aprovechamientos de los inmuebles dentro del concepto de la función social, especialmente la ambiental, tema que reviste de interés nacional público, en el sentido de que, del numeral 50 Constitucional se logra derivar el derecho a la salud y a la vida, de forma tal que, la protección del ambiente y del agua, son vitales para lograr una coexistencia armónica de la humanidad.

Así la Sala Constitucional en la Resolución N° 2007-006581-2007 de las 15:39 horas de fecha 15 de mayo de 2007 de forma abundante realizó un repaso sobre los diferentes tipos de interés social que son conformes al bloque de constitucional, y que están dejando de lado los accionantes: “XV.- TIPOS DE INTERÉS SOCIAL RECONOCIDOS POR LA JURISPRUDENCIA CONSTITUCIONAL. La jurisprudencia constitucional ha reconocido dos tipos interés social que legitiman -o justifican- la imposición de limitaciones a la propiedad: estos son los relativos a la protección del ambiente y los de orden urbanístico, este último, a partir del desarrollo que se hace en la sentencia número 4205-96, supra citada. Expresamente se ha reconocido que la razón última de estas limitaciones es precisamente la ‘transnacionalización’ de los valores de su afectación, toda vez que no afectan únicamente a la localidad o nación, sino a la Humanidad en su conjunto, ya que como se ha indicado con anterioridad, la problemática de la protección del ambiente trasciende el orden local o regional (sentencia número 3705-93, de las quince horas del treinta de julio de mil novecientos noventa y tres).

(…) Es así como la propiedad forestal privada, la cual, como su nombre lo indica, es la propiedad titulada por los particulares, y que se ostenta en los términos del artículo 45 de la Constitución Política, se afecta con un régimen jurídico especial, en el primer caso, al régimen forestal, mediante el correspondiente decreto ejecutivo del Ministerio del Ambiente y Energía, el cual pesa sobre la propiedad a modo de limitación de interés social, que en todo caso debe inscribirse en el Registro Público de la Propiedad. Por este motivo es que estos inmuebles pueden hipotecarse, e incluso, el recurso forestal puede constituir prenda; adquirirse por usucapión, así como también enajenarse o trasladarse su dominio, con la advertencia de que, en todos los casos, se traslada la afectación forestal. Y dependerá de la categorización que del recurso forestal haga la normativa vigente, como lo son las reservas forestales, las zonas protectoras y los refugios de vida silvestre (artículo 37 de la Ley Forestal número 7174), que la propiedad privada podrá explotarse y aprovecharse, a condición de sujetarse al respectivo plan de manejo.

Queda claro que las limitaciones en materia forestal implican un impedimento de aprovechamiento del recurso forestal por parte de su propietario, quien en modo alguno está legitimado para talar o aprovechar económicamente el bosque existente en su propiedad a su antojo o voluntad, si no es, y exclusivamente, mediante un plan de manejo, debidamente aprobado por la Dirección Forestal”. (Lo resaltado en negrita es autoría propia). De lo esgrimido por la Sala Constitucional, lo cual es compartido por esta Cámara de Juzgadores es que, el estar sometida una propiedad a un régimen forestal o restricciones de índole forestal no conlleva el vaciar de contenido los actos que pueden ser ejercidos por sus titulares, sino limitaciones al uso y disfrute que deben efectuarse dentro del rango de los parámetros que están establecidos en la Ley. En segundo lugar, los accionantes dejan de lado que, los derechos que se derivan de la titularidad o dominio absoluto de un bien no solo son construir (transformar el bien), sino que corresponden a los dispuestos en el numeral 264 del Código Civil, precepto que regula que: “El dominio o propiedad absoluta sobre una cosa, comprende los derechos: 1º.- De posesión. 2º.- De usufructo. 3º.- De transformación y enajenación. 4º.- De defensa y exclusión; y 5º.- De restitución e indemnización”.

De esta manera, únicamente se estaría en el supuesto de vaciar el derecho de propiedad, cuando por la conducta del Estado (activa u omisiva) anula la posibilidad del ejercicio de todos y cada uno de las atribuciones o facultades enunciadas, lo cual tampoco ha sido probado por parte de los actores. Si bien, tiene una limitación ambiental y existen cierto tipo de actividades que no pueden ejecutarse en dichos inmuebles, lo cierto del caso es que aún se mantienen las potestades para usufructuar por ejemplo a través de sembradíos, actividades agropecuarias, o comerciales que no conlleven la transformación completa o la edificación de obras permanentes sobre el inmueble, de suerte que, no se logra desprender de los autos que las limitaciones que están contenidas en los numerales 33 y 34 de la Ley Forestal y 149 de la Ley de Aguas imposibiliten el ejercicio de todos y cada uno de los derechos que están contenidos dentro del dominio absoluto del bien de su propiedad.

Por lo que, ante esa omisión de elementos probatorios debe ser rechazado el argumento o premisa del reclamo indemnizatorio de que se vacía el contenido del derecho de propiedad, siendo que, le correspondía a los actores la carga probatoria a la luz del numeral 41.1 del Código Procesal Civil (norma aplicable al caso en concreto por enunciación del artículo 220 del CPCA), el cual enuncia que, le incumbe la carga de la prueba “A quien formule una pretensión, respecto de los hechos constitutivos de su derecho”. Carga de traer elementos al proceso que también se deriva del postulado de “carga dinámica” de la prueba, en el tanto, los accionantes se encuentran en mejor condición dentro de la situación jurídica del proceso para poder demostrar cuál es el grado de afectación a todos y cada uno de los derechos y dentro de las distintas vocaciones o fines que pueden ser usufructuadas las propiedades.

Sin pretender reiterar lo ya indicado, a nivel de jurisprudencia de la Sala Constitucional y de la Primera de la Corte Suprema de Justicia se ha determinado que las limitaciones legales derivadas de la Ley N° 7575, Ley Forestal no son indemnizables en el tanto, imponen ciertos límites, pero no vacía del contenido de forma absoluta el derecho del uso y disfrute de la propiedad. De hecho nuestro Tribunal Constitucional ha esbozado que, las limitaciones ambientales derivadas de los numerales 33 y 34 de la Ley Forestal, -sobre los cuales los accionantes alegan que se derivan restricciones desproporcionadas o irrazonables, al vaciar el contenido de su derecho de propiedad-, son conformes a la norma fundamental y no conllevan por ende una expropiación de hecho, como lo afirman los actores, al señalar lo que se procede a enunciar de seguido: “II.- En relación con el supuesto roce de constitucionalidad que apunta el recurrente entre los numerales 33 y 34 de la citada Ley y el artículo 45 Constitucional, esta Sala considera lo siguiente.

Los límites que se puedan introducir por Ley al ejercicio de una libertad pública o de un derecho fundamental, van referidos al derecho en sí, lo mismo que a la posición en abstracto de la esfera de acción de un sujeto, o sea, los límites al ejercicio de una libertad pública no es más que un límite al ejercicio de un derecho, lo anterior por cuanto el reconocimiento de un derecho por parte de una norma constitucional no significa exclusión de la posibilidad de regulación de su ejercicio por parte del legislador, ya que todo derecho nace limitado por cuanto nace dentro de un sistema de convivencia social y su ejercicio debe armonizarse con los derechos de los demás y con las exigencias reconocidas en posteriores legislaciones que especificarán sus límites y las condiciones de su ejercicio. Por el contrario, las limitaciones se refieren a la restricción o disminución de la esfera jurídica del sujeto, ocurriendo que se encuentra relacionada con el ejercicio mismo de la libertad pública y deben, por naturaleza, estar contenidas dentro del texto constitucional o que éste autorice a la Asamblea Legislativa para imponerlas.

Así, las limitaciones conllevan una disminución de los derechos fundamentales en cuanto restringen su ejercicio efectivo bajo ciertas condiciones y en determinadas circunstancias. En el caso de marras, nos encontramos ante una limitación impuesta por ley al ejercicio efectivo del derecho a la propiedad contenido en el artículo 45. En razón de que la limitación debe encontrarse legitimada por el mismo texto constitucional o bien fundado en una autorización constitucional expresa a la Asamblea Legislativa para su establecimiento, lo procedente es determinar si la impuesta por la Ley 7575, se encuentra debidamente fundada en el texto constitucional. El artículo 45 de la Carta Política establece en su párrafo segundo que: ‘Por motivos de necesidad pública podrá la Asamblea Legislativa, mediante el voto de los dos tercios de la totalidad de sus miembros, imponer a la propiedad limitaciones de interés social.’ Así, se observa del texto constitucional transcrito que, la misma norma establece la posibilidad de que la Asamblea Legislativa introduzca limitaciones de interés social a la propiedad, viéndose legitimado el contenido del texto de los artículos 33 y 34 de la Ley 7575 que ahora se impugnan.

III.- Agotado el tema de la legitimidad de la imposición, resta discutir la razonabilidad de la limitación. Considera esta Sala que la limitación impuesta resulta razonable toda vez que no importa una imposibilidad del disfrute del derecho de propiedad, sino que delimita los alcances de éste. O sea, la limitación no cercena el derecho de propiedad que posee el recurrente en relación con la porción de tierra sobre la que no podrá construir -ya que de igual forma podrá disfrutar de ella- sino que simplemente le ordena no construir dentro del límite contenido por la restricción. Por otra parte, la fijación de la línea de retiro de diez metros resulta razonable en relación con el bien demanial que se busca proteger -una quebrada- y sobre el cual el Estado posee un interés público en su conservación, considerando razonable y suficiente el retiro establecido en la legislación forestal. Por lo anterior, el recurso deviene en improcedente y así debe declararse”.

(Ver entre otras, Resolución N° 08234-1997 de las 18:15 horas de fecha 03 de diciembre de 1997 de la Sala Constitucional). Postura que se comparte por esta Cámara de Juzgadores y que por igualdad de motivos puede ser aplicada para las limitaciones dispuestas en la Ley General de Aguas, dado que incluso son menor intensidad sobre la propiedad que las dispuestas en la Ley Foresta de comentario. Manifestando dicha Sala Constitucional en años posteriores que, estas limitaciones a la propiedad, las cuales como se reseñó no son desproporcionadas ni irrazonables, no resultan ser indemnizables, por cuanto están en virtud de la propia función social de la propiedad, una función que se indicó que implica ponderar el interés colectivo (derecho al ambiente y la protección del agua) por encima de un interés individual (la posibilidad de edificar sobre el bien inmueble que extrañan los actores). Así en la Resolución N° 4465-99 de las 10:21 horas de fecha 11 de junio de 1999 la Sala Constitucional de la Corte Suprema de Justicia estableció que: “El artículo 45 de la Constitución Política consagra el derecho de propiedad.

En el párrafo primero señala su carácter de ‘inviolable’ y establece la obligación por parte del Estado de indemnizar al propietario previamente, cuando deba suprimirla por razones de ‘interés público legalmente comprobado’. En el párrafo segundo establece la posibilidad de establecer limitaciones de interés social a la propiedad, mediante ley aprobada por votación calificada -votación de los dos tercios de la totalidad de los miembros de la Asamblea Legislativa-. De manera que la obligación de indemnizar por parte del Estado está constitucionalmente prevista única y exclusivamente cuando se trata de expropiar y no rige para las limitaciones de interés social que se establezcan mediante ley aprobada por votación calificada. Sin embargo, estas limitaciones deberán afectar a la colectividad en general y no podrán exceder los parámetros de razonabilidad o proporcionalidad, ni vaciar de su contenido esencial el derecho de propiedad.

La restricción al derecho de propiedad que vacíe de su contenido esencial el derecho se convierte en una expropiación encubierta y, en consecuencia, genera la obligación de indemnizar. Las limitaciones establecidas con fines urbanísticos integran el derecho de propiedad y, por lo tanto, no son susceptibles de indemnización, a menos que implique una reducción del contenido esencial del derecho, como se indicó supra”. (El resaltado no corresponde al original). Por lo que, en el caso en que se alegue que una restricción o limitación a la propiedad vacíe su contenido o que es desproporcionada e irrazonable, como se reitera, debe ser probado por quien lo alegue, en este caso los accionantes, no obrando elementos de convicción en esa línea, dado que, el hecho que la Municipalidad de Puriscal haya emitido certificaciones no conformes para la construcción de una vivienda (Ver Hechos Probados N° 11, 14 y 15) sólo afecta el derecho de transformación del inmueble y en alguna medida pero con menor intensidad el derecho a usufructuarlo, pero no así el ejercicio omnicomprensivo de los derechos que integran el dominio absoluto del bien.

Tampoco dando pie la prueba del vacío del derecho de la propiedad en todos sus componentes el hecho que la Municipalidad ante la existencia de la naciente le haya aplicado el instituto de la no sujeción de los tributos, aspecto que también puede ser modificado, en tanto se modifiquen las condiciones de dicha no sujeción. Se suma a lo ya dicho que, si bien no ha sido un hecho probado la fecha exacta en que las nacientes pudieron hacerse visible para los actores o que éstas se hayan naturalmente constituidas, lo anterior, dado que los oficios emitidos por parte de la Dirección de Agua del MINAE no tienen el efecto de constituir dichas nacientes, sino de declarar su existencia, y los señores Padilla Pérez como personas terceras adquirentes en el año 2003 (Ver Hechos Probados N° 1 al 9), si fueron de su conocimiento o no de la inexistencia de las nacientes que se encuentran de forma circunvecina a sus propiedades, no resulta ser imputable al Estado, sino que está dentro del ámbito negocial de las partes, y de la información que se le brindó ese momento por parte de los propietarios vendedores a los compradores, advirtiendo de las condiciones existentes y limitaciones, así como omitiendo valoración sobre el contenido de dichas relaciones contractuales, vicios redhibitorios, así como la eventual aplicación del numeral 35 de la Ley de Planificación Urbana.

Lo cual tampoco excluye la posibilidad que los propietarios donde reside la naciente previa coordinación con las autoridades correspondientes puedan optar por soluciones de explotación o de cerramiento donde se establezcan otro tipo de limitación a los inmuebles (Ver al respecto artículo 12 del Reglamento de Construcción de la Municipalidad de Puriscal), lo cual también modificaría la condición de no sujeción del pago de los tributos ante la corporación municipal respectiva. Aspectos que no pueden ser endilgados al Estado y, por ende, no surge la responsabilidad patrimonial reclamada. Ahora bien, lo que se deriva de la argumentación y correlativa pretensión indemnizatoria por parte de los actores, es precisamente, por un lado, que deja de lado la existencia de otros derechos que envuelven el dominio (titularidad) sobre un bien, del cual ya se ha abordado, por otro lado, intenta requerir una indemnización a través de la expropiación, confundiendo a su vez, los alcances de la expropiación, y cuándo es que jurídicamente una limitación, límite o carga a la propiedad implica vaciar el contenido al derecho de propiedad, situaciones en las cuales, sí debe indemnizarse. Por lo anterior, consideramos realizar una distinción entre ambos institutos.

  • i)Distinción entre los institutos del procedimiento de expropiación y las limitaciones. Siendo que ya, de forma sucinta se ha analizado las limitaciones a las propiedades que son constitucionalmente viables y no indemnizables, se procede a describir brevemente la figura de la expropiación. La Ley de Expropiaciones, en su numeral primero, brinda una serie de pautas sobre la expropiación y su régimen jurídico, indicando que: “La presente ley regula la expropiación forzosa por causa de interés público legalmente comprobado. La expropiación se acuerda en ejercicio del poder de imperio de la Administración Pública y comprende cualquier forma de privación de la propiedad privada o de derechos o intereses patrimoniales legítimos, cualesquiera sean sus titulares, mediante el pago previo de una indemnización que represente el precio justo de lo expropiado”. (El resaltado no corresponde del original).

Se reitera que, la Sala Constitucional y el marco jurídico constitucional y legal costarricense es muy claro respecto a que pueden fijarse por ley una serie de limitaciones a la propiedad en tanto, “la propiedad no sufra desmembraciones que hagan desaparecer del derecho, toda vez que se mantiene el uso natural del bien y su valor económico en el mercado. Asimismo, se aclara que las limitaciones o restricciones a la propiedad son de carácter general, y tienen la virtud de dotar al individuo de los instrumentos necesarios para paliar los efectos de la actividad perjudicial de sus congéneres. Cabe señalar que tiene como finalidad u objetivo el uso racional de la propiedad, con lo que se benefician los vecinos o, en general toda la sociedad, obligación que se encuentra su sustento (a modo de justificación) en la consideración de que resultan imprescindibles para la convivencia en sociedad, no tratándose de una actividad expropiatoria que requiera de indemnización previa, en los términos exigidos y previstos en el párrafo primero del artículo 45 de la Constitución Política”.

(Ver Resolución N° 2007-0006581 de las 15:39 horas de fecha 15 de mayo de 2007, ya citada). De lo transcrito, muy brevemente se puede inferir que la expropiación “per se”, conlleva a una privación de la propiedad privada, o de sus derechos del domi.nio como lo es, la utilización o disfrute de la cosa, que es precisamente lo que líneas arriba indicamos como un marco infranqueable de la imposición de una carga, límite o limitación, el no vaciar de contenido el derecho de la propiedad, por cuanto, cuando la limitación es de tal magnitud ya sea por su contenido o el tiempo (como la afectación temporal de la propiedad, que la Sala Constitucional ha señalado que es un congelamiento que debe ser indemnizado, ver resolución N° 2007-005598 de las 15:47 horas de fecha 25 de abril de 2007), implica una cargar mayor y un desbalance del equilibrio entre los derechos y garantías de los ciudadanos y las potestades del Estado (aunque sean amparadas en un interés público, de hecho se parte de la existencia de un de interés público como presupuesto), por lo que, se está en el supuesto de un acto expropiatorio, privativo de la propiedad, consecuentemente nace el deber de indemnización.

La teoría del caso de los actores confunden el párrafo primero del numeral 45 constitucional, con su párrafo segundo, los dos son distintas sus regulaciones. En el primer párrafo se regula la privación completa de la propiedad o de los derechos que se ostenta en calidad de propietario de un bien, en donde previa determinación de un interés público que lo posibilita se despoja del bien a un particular, para transformarlo en otro bien destinado al interés público general, y el párrafo segundo, donde se prevé la función social de la propiedad, y la posibilidad de establecerse limitaciones y cargas, cuya validez o legitimidad resulta “cuando es necesaria para hacer posible ‘la vigencia de los valores democráticos y constitucionales’; de manera que, además de útil, debe ser necesaria, razonable y oportunidad, y debe implicar la existencia de una necesidad social imperiosa que la sustente, y por ende, excepcional; por lo cual, deben estar llamadas a satisfacer un interés público imperativo.

La razonabilidad de la limitación se traduce en su adecuación al fin y al interés (valor) que la justifica; y f.- Las limitaciones no son indemnizables en tanto no implican desmembramientos que hagan desaparece el derecho; la cual está prevista únicamente para hacerle frente a la pérdida de la propiedad (expropiación)”. (Ver Resolución N° 2007-006581 anteriormente citada). Esa privación de la propiedad, como lo afirma la parte actora, no se logra demostrar en la especie, por lo que se adelanta, que deviene en rechazo tanto en que se deba realizar un procedimiento de expropiación, así como el pago de su justo precio. El yerro de que parte la teoría del caso de los accionantes es que, con el hecho de que se haya impuesto una imposibilidad de cortar árboles y de construir una vivienda o rebajado la base imponible para el pago de los tributos ante la Municipalidad., deviene en un limitación que le impide hacer uso y goce de su propiedad vaciando el contenido de su propiedad, lo cual por el hecho de la mera imposición de la zona de protección ambiental por la ley, no le genera ese efecto, como reiteradamente se ha indicado en esta exposición, debe acreditarse que es de tal magnitud que le impide su libre uso y disfrute, lo cual no ha sido demostrado por la parte actora, teniendo la carga probatoria (artículo 41.1 del Código Procesal Civil, norma civil aplicable al caso en concreto por el numeral 220 del CPCA).

Como se había señalado antes, quien alega una pretensión debe probar los elementos constitutivos de su derecho, trayendo elementos de convicción al proceso, para demostrar que se le ha vaciado de contenido su propiedad, lo cual no hay prueba alguna que obre en el expediente que permita acreditar el dicho de los accionantes. Es decir, no se logra identificar un funcionamiento anormal omisivo del Estado de cumplir el debido proceso de expropiación, puesto que como se indicó en líneas anteriores, las limitaciones ambientales que pesan sobre la propiedad de los actores devienen de una potestad constitucionalmente prevista (no solo del marco de legalidad), y no demuestra que le esté vaciando o desmembrando el contenido de su derecho derivado de su condición de titular, aspecto que debió ser probada por los accionantes. En complemento a lo expuesto, debe reiterarse que, el hecho que no exista un certificado de uso no conforme para la construcción o la revalorización de las propiedades para fines fiscales (a fin de no ser sujetos a los tributos establecidos por el ordenamiento jurídico), no genera per sé un daño que, al tenor del numeral 194 de la Ley General de la Administración Pública deba ser indemnizado, aspecto que ha sido desarrollado en casos similares a los accionantes por parte de la Sala Constitucional, apuntando sobre el particular que debe ser probado por la parte quien lo alega en la vía ordinaria correspondiente como lo es la jurisdicción contenciosa administrativa, acreditación del daño que en la especie no fue demostrado por los accionantes.

Así el Tribunal Constitucional indicó: “VI. Sobre el principio precautorio en materia de derecho ambiental. Dicho principio rector se fundamenta en la necesidad de tomar y asumir todas las medidas para evitar o contener la posible afectación del ambiente o la salud de las personas. Así, pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. De esta forma, en caso de que exista un riesgo de daño grave o irreversible -o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, puesto que, de haberse producido el daño, las consecuencias biológicas y socialmente nocivas pueden ser irreparables. (…) En lo que respecta a la corporación municipal, el recurrente cuestiona el cambio de uso de suelo decretado por la Municipalidad recurrida, pues considera que se está eliminando un derecho que ya se había declarado y aduce que le causa un grave perjuicio económico al amparado.

De los informes rendidos por los funcionarios recurridos, y del análisis de la prueba que obra en autos, esta Sala considera que las actuaciones cuestionadas se encuentran ajustadas a derecho. Si bien inicialmente se otorgaron permisos de uso de suelo para vivienda unifamiliar en las propiedades del amparado, una vez que se tuvo noticia de la posible existencia de una naciente en esa zona se dictó la Resolución de Ubicación de Zonas de Protección Nº 595, de las 12:10 horas del 13 de diciembre de 2016, decretando el radio de protección de la naciente. Es decir, la Municipalidad, haciendo uso de sus potestades de imperio, aplicó el principio precautorio y priorizó la protección al ambiente; lo cual si bien afecta claramente las propiedades del amparado, resulta procedente, tal y como se indicó en el considerando VI. Así las cosas, y dado que lo que interesa en materia ambiental es que el Estado realmente asuma una política de protección y garantía efectiva del ejercicio de aquéllos derechos, tanto en un nivel meramente legal como en el nivel técnico operacional, lo procedente es desestimar el recurso en cuanto a este extremo; y si el recurrente mantiene alguna inconformidad con lo dispuesto, deberá demostrar el daño acusado en la vía administrativa o en la jurisdicción común, por ser la verificación del cumplimiento de parámetros técnicos materia de legalidad ordinaria”.

(Sala Constitucional, Resolución N° 06565-2017 de las 9:45 horas de fecha 23 de junio de 2017). Lo anterior en conclusión motiva que esta Cámara de Juzgadores rechacen por no existir mérito tanto la pretensión numerada como 43.1, como las pretensiones 43.2 y 43.3 contenidas en la demanda, en lo que respecta a la existencia de un vacío del derecho fundamental de la propiedad de los actores. - ii) Sobre la no existencia de una la responsabilidad administrativa por Estado Legislador. Otro de los fundamentos que esbozan los accionantes en el libelo de la demanda, es que el Estado es responsable patrimonialmente, transcribiendo los numerales 9 y 41 de la Constitución Política, y 190, 191 y 194 de la Ley General de la Administración Pública. Sin embargo, esa fundamentación parte de dos premisas, primero de ellos es que, con las limitaciones ambientales legalmente establecidas se les vacía su derecho de propiedad, lo cual no logró ser probado como se indicó en la sección anterior, y por el otro que, se está en presencia de una expropiación de facto.

De hecho, se puede colegir que eventualmente, pretende equiparar el justiprecio, esto es, el monto que la Administración paga producto de una expropiación con la indemnización dispuesta en la Ley General de la Administración, lo cual es inexacto. De forma preliminar, se comparte la tesis de los actores que, conforme a la jurisprudencia emitida por la Sala Primera de Justicia anteriormente citada, ha quedado establecido que, en Costa Rica, del artículo 41 de la Constitución Política, en relación con los numerales constitucionales 9, 11 y 33, existe un régimen de responsabilidad preeminentemente objetiva del Estado, donde se desplaza todo el sistema a favor de la persona (administrado), quien ya no debe probar elementos subjetivos del funcionario público para lograr que se le indemnice de una conducta pública que le produjo un daño, de forma tal que ahora la carga de la prueba es de la Administración quien debe descargarse sobre los hechos que se le imputan, así, “En tanto se haya sufrido una lesión como consecuencia de una conducta pública, sea esta activa u omisiva, que no tiene el deber de soportar, se impone el deber de resarcimiento, en virtud del principio de reparación integral del daño que se desprende del numeral 41 de la Constitución Política”.

(Sala Primera de la Corte Suprema de Justicia, Resoluciones N° 138 de las 15:05 horas del 23 de agosto; N° 192 de las 14:15 horas 1 del 06 de noviembre, ambas de 1991; N° 48 de las 14:10 horas del 29 de mayo de 1996 y N° 55 de las 14:30 horas del 4 de julio de 1997). Sin embargo, la aplicación del principio constitucional de reparación integral del daño no es irrestricto e ilimitado, ni tampoco, aplica de manera automática para todas las hipótesis en que sufra una lesión un administrado. Se requiere demostrar por un lado la existencia de un menoscabo patrimonial o lesión extrapatrimonial, y un nexo causal entre el daño alegado y la conducta (omisiva o activa) de la Administración. Al respecto, se ha indicado sobre el nexo causal que, “Establecida en la especie la anormalidad e ilicitud del comportamiento omisivo, resta por establecer si esa indolencia fue o no causa de la lesión reclamada, (…).

Lo anterior debido a que no basta la producción de un daño para que surja el deber de indemnizar, se requiere además que ese efecto haya sido generado por una conducta positiva u omisiva del Estado. Más simple, para imputar a la Administración la responsabilidad se requiere de un daño, una actividad o inactividad administrativa y un nexo causal entre ambos. Demostrado ese ligamen relacional, surge de inmediato el deber de reparación integral que se desprende del numeral 41 de la Constitución Política. En relación cabe señalar que, en la producción del daño, generalmente confluyen una serie de hechos y factores que en diversos grados lo han provocado. Dentro de ellos, es imperioso establecer cuáles de manera directa o indirecta han sido causa adecuada y eficiente del mal originado. Sobre la causa próxima, adecuada y eficiente, puede consultarse la sentencia de esta Sala no. 252-F-01, de las 16 horas 15 minutos del 28 de marzo del 2001.

En esa confluencia de elementos fácticos o jurídicos que rodean la situación dañosa, habrá necesidad de establecer la acción u omisión apta que provocó la consecuencia; desplazando aquéllas que no han tenido ninguna influencia en el resultado (causas extrañas), de las que, de no haber tenido lugar, hubiesen evitado el menoscabo”. (Sala Primera de la Corte Suprema de Justicia, Resolución N° 0074-F-2007 de las 10:15 horas del 02 de febrero de 2007). Pero como vimos, en primer lugar, en la especie la limitación que afecta a las propiedades de los actores no tiene efectos expropiatorios, por lo que no se logra derivar un incumplimiento de una obligación legal alguna, rompiendo el nexo de causalidad entre la conducta omisiva que reclama y los daños causados. En segundo lugar, la responsabilidad administrativa eventualmente, habiendo determinado una situación de que vaciara de contenido su derecho, lo cual se reitera no se da en la práctica, no tendría un efecto de indemnizatoria por responsabilidad, sino que sus efectos de la expropiación son distintos.

En realidad “La actividad expropiatoria va encaminada a privar a un determinado sujeto total o parcialmente de un derecho o interés legítimo, mediante la correspondiente indemnización o pago del justiprecio, para la satisfacción de necesidades públicas. Va de suyo que se impone un sacrifico o singular al expropiado, trato de que no recibe el resto de los sujetos. (…) Es importante señalar que GIANNINI ha denominado ‘medidas ablatorias reales’ a aquella adoptadas por el poder público que buscan la consecución del interés público general. Dentro de las referidas medidas se citan la expropiación, las servidumbres, las ventas y permutas obligadas y, aquellas propias del derecho urbanístico, como puede ser imponer a un sujeto la obligación de no construir el inmueble de su propiedad, en tanto ha sido introducido dentro del patrimonio cultural. Por su parte, la responsabilidad de la administración supone que el ente público está obligado a indemnizar a los particulares, como reparación resarcitoria -ya no como justiprecio-, por el daño que causa su funcionamiento normal, anormal, legítimo o ilegítimo.

La indemnización es un mecanismo creado por la ley para compensar al sujeto por el daño que se le ha infringido por una determinada actuación u omisión administrativa. Ahora bien, debe tenerse presente que, el daño que se produce por responsabilidad administrativa extracontractual, no siempre se concreta en un beneficio social para la colectividad, como sucede con la expropiación que se acuerda por motivos de interés público”. (Rojas Morales (Iris Rocío). Derecho Urbanístico Costarricense. San José, Costa Rica, Editorial Investigaciones Jurídicas S.A., 2010, págs. 461 y 462). Por ende, no pueden equipararse ambas figuras, el justiprecio como su nombre lo indica es el pago que se recibe, es el valor económico de restitución por el despojo del bien que realiza la Administración para ser transformado o destinado a un fin público, en otras palabras, es el pago por la adquisición que se realiza, por lo que dicho monto debe ser razonable y proporcionado, debe ser equivalente, razonable y proporcionado para permitir a la persona física o jurídica poder resarcirse o compensar en el valor integral de la propiedad del bien expropiado.

Por lo que ambos términos, responsabilidad y expropiación, indemnización y justiprecio no resultan ser equivalentes o sinónimos, como erróneamente se deriva de los argumentos de la demanda y consecuentemente debe rechazarse también este argumento. No está de más, señalar que, los accionantes no esbozaron una pretensión tendiente a que se determine la responsabilidad preeminentemente objetiva del Estado, sino que la vinculó con la expropiación y su derecho indemnizatorio, al establecerse en el punto anterior que no aplica el procedimiento expropiatorio en la especie, no genera el derecho al pago alguno (pago del justiprecio), y éste no puede confundirse con la responsabilidad objetiva, se rechazan en todos sus extremos las pretensiones 43.2 y 43.3 y consecuentemente, también la pretensión 43.1. No sin mencionar que, al establecer las condiciones en las que aplica la responsabilidad preeminentemente objetiva por conducta lícita, los accionantes confunden los presupuestos contenidos en el numeral 194 de la Ley General de la Administración Pública para configurar una responsabilidad por conducta lícita como lo es la que, está alegando los accionantes.

Particularmente éstos no logran acreditar un daño especial ni que sean una pequeña proporción de afectados, de hecho, dado que, es inexacto la valoración de que la pequeña proporción de afectados por las restricciones derivadas de la Ley Forestal y Ley de Aguas sea solamente para los señores Padilla Pérez. Veamos, el numeral 194 supra citado enuncia: “Artículo 194.- 1. La Administración será responsable por sus actos lícitos y por su funcionamiento normal cuando los mismos causen daño a los derechos del administrado en forma especial, por la pequeña proporción de afectados o por la intensidad excepcional de la lesión. 2. En este caso la indemnización deberá cubrir el valor de los daños al momento de su pago, pero no el lucro cesante. 3. El Estado será responsable por los daños causados directamente por una ley, que sean especiales de conformidad con el presente artículo”. De forma tal que, los dos presupuestos fundamentales para determinar la existencia de una responsabilidad objetiva por Estado Legislador es cuando exista un daño especial, el cual se produce cuando exista “una pequeña proporción de afectados” o “por la intensidad de la lesión”.

Sobre la intensidad de la lesión sería equiparable a que las limitaciones tengan el efecto de desmembrar los derechos derivados del dominio absoluto de los bienes inmuebles, lo cual ya se ha ahondado a lo largo de la presente exposición que no concurre en el caso de mérito, quedando por analizar la “pequeña proporción de afectados”. Para lograr identificar el alcance del presupuesto, se acude a la discusión en el Congreso por parte del señor Eduardo Ortiz Ortiz uno de los juristas que redactaron el Proyecto de lo que es hoy la Ley General de la Administración Pública. Así el referido tratadista apuntó que: “La expresión (…) hablando nada más que proporción, tiene la ventaja de que el concepto este, de daño especial, se le da su contenido pleno de daño discriminatorio. Esa es la idea porque no es un daño de tipo general, que toda la sociedad debe sufrir, sino que es un daño que sufren unos pocos”.

Ley General de la Administración Pública, concordada y anotada con el debate legislativo y la jurisprudencia constitucional. San José, Costa Rica. Editorial, ASELEX S.A., 1996, página 297). Rescátese de lo transcrito dos conceptos, que corresponde a un daño discriminatorio, de forma tal que aduce a que en condiciones iguales no surte los mismos efectos para todas las personas, y en segundo lugar, que no es un daño general, sino que sólo incide en la esfera de unas pocas personas, el cual es excepcional, puesto que se parte que todas las regulaciones tienen efecto sobre las situaciones jurídicas de las personas, pero no por ello surge el derecho indemnizatorio para todas éstas, por cuanto implicaría cercenar las competencias legislativas derivadas de la base propia de la Constitucional.

Así, Ortiz Ortiz afirmó: “Todas las regulaciones sociales causan de alguna forma algún daño en un grupo. Por ejemplo, una regulación de tránsito eventualmente perjudicaría a una persona que tenía un parqueo frente a su negocio. Ahora, tiene que perder gran tiempo buscándolo. Pero obviamente ese daño no es indemnizable, de fondo que hay que calificar muy especialmente el daño indemnizable en estas hipótesis porque no todo daño es indemnizable, sino nada más que el reviste ciertas características (…)”. Cit, 297) A partir de lo transcrito, no puede inferirse que se esté ante limitaciones que sean discriminatorias, por cuanto aplican para cada una de las personas que estén dentro del radio de acción de una naciente de carácter permanente o intermitente (zona de protección), esto es, el ámbito de aplicación de los presupuestos contenidos en la regulación ambiental tiene un carácter general y no solamente para el caso de los accionantes, como arguyen en su demanda, cuando indican que: “En tercer lugar, tenemos que el actuar del Estado genera un daño especial y anormal a mis Representados.

Por un lado, el daño es especial en cuanto afecta patrimonialmente a un grupo pequeño pero determinable de personas: los actores de este proceso”. Lo anterior, por cuanto se indicó inciden sobre las situaciones jurídicas de todas y cada una de las personas que ostenten una propiedad dentro del rango de acción de una naciente, y no sólo los accionantes. Esto deviene en que tampoco sea discriminatorio, puesto que las condiciones en las que aplica es para aquellas personas que cuenten con un bien inmueble que esté dentro de la zona de protección de una naciente (permanente o intermitente). En otras palabras, sería daño discriminatorio al excluir a personas que están en la misma condición (dentro del radio de acción de la zona de protección del cuerpo de agua), lo cual no ocurre en el caso de mérito. Sin bien de las fotografías que son aportadas por los accionantes, específicamente de los oficios de certificado de uso de suelos emitidos por la Municipalidad de Puriscal se advierte que alrededor del cuadrante donde se encuentran las propiedades de los señores Padilla Pérez, y dentro del radio de la zona de protección que es dibujada por la Corporación Municipal se observan otras propiedades que tienen edificaciones construidas, esto no conlleva a que exista un daño discriminatorio, sino que, habría que analizar cada caso concreto respecto a las condiciones y supuestos que fue conferido el certificado de uso de suelo y la licencia constructiva por parte del Gobierno Local, lo que no obsta para el ejercicio de las potestades de policía en materia ambiental que ostentan las Municipalidades, a fin de determinar sobre su licitud o ilicitud.

Ahora bien, en este caso los efectos de las normas en comentario (Ley Forestal y Ley de Aguas) tienen efectos generales para todos y cada una de las personas que cumplan con los criterios que están definidos en la norma y, por ende, ante esta situación, no puede configurarse en la especie tampoco el elemento de “pequeña proporción de afectados”. De hecho, debe considerarse que el objetivo de estas medidas se encuentran ajustadas al bloque de constitucionalidad en protección al ambiente como un derecho fundamental que ha sido reconocido por la Sala Constitucional en diversos pronunciamientos, verbigracia en la resolución N° 6949 de las 12:55 horas de fecha 27 de mayo de 2011 al señalar que “A partir de lo dispuesto en los artículos 21, 50 y 89 de la Constitución Política, este Tribunal Constitucional ha reconocido, ampliamente, el deber que le atañe al Estado de proteger el derecho a disfrutar de un ambiente sano y ecológicamente equilibrado, con lo cual, el Estado se constituye en garante de la protección y tutela del medio ambiente y los recursos naturales.

Es a tenor de dichas disposiciones, que nace la responsabilidad del Estado de ejercer una función tutelar y rectora en esta materia, función que desarrolla la normativa infraconstitucional ambiental”. Máxime en tratándose al recurso estratégico como lo es el agua, “derivado de los derechos fundamentales a la salud, la vida, al medio ambiente sano, a la alimentación y la vivienda digna, entre otros, tal como ha sido reconocido también en instrumentos internacionales sobre Derechos Humanos aplicables en Costa Rica: así, figura explícitamente en la Convención sobre la Eliminación de todas las formas de discriminación contra la mujer (art. 14) y la Convención sobre los Derechos del Niño (art. 24); además, se enuncia en la Conferencia Internacional sobre Población y el Desarrollo de El Cairo (principio 2), y se declara en otros numerosos del Derecho Internacional Humanitario. En nuestro Sistema Interamericano de Derechos Humanos, el país se encuentra particularmente obligado en esta materia por lo dispuesto en el artículo 11.1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales ("Protocolo de San Salvador" de 1988)”.

(Sala Constitucional de la Corte Suprema de Justicia, Resolución Nº 2004-12263 de las 14:49 horas de fecha 29 de octubre del 2004). Por lo que, como se indicó en líneas precedentes esta Cámara de Juzgadores comparte la postura del Tribunal Constitucional de ponderar a favor del ambiente, y del principio precautorio en pro de asegurar el agua para las presentes y futuras generaciones, de donde, se deriva que las limitaciones ambientales impuestas por el Legislador no producen los daños especiales en los términos contemplados en el numeral 196 de la Ley General de la Administración, ni tampoco fue probado por parte de los acciones, cuando la carga probatoria para determinar tanto la existencia del daño, y los presupuestos regulados en el precepto 196 de comentario se encontraban bajo responsabilidad de los actores. Sin demérito que como se indicó, tampoco fue probado el nexo de causalidad adecuada, en el tanto la premisa para su surgimiento que es el hecho de que las limitaciones vaciaban el derecho de propiedad de los accionantes, no fue acreditado en la especie.

Al respecto, la Sala Primera de la Corte Suprema de Justicia en la Resolución N° 112-1992 de las 14:15 horas de fecha 15 de julio de 1992 (posición que se ha sido reiterada a la fecha), esbozó que: “El daño constituye uno de los presupuestos de la responsabilidad civil extracontractual, por cuanto el deber de resarcir solamente se configura si ha mediado un hecho ilícito dañoso que lesione un interés jurídicamente relevante, susceptible de ser tutelado por el ordenamiento jurídico. El daño, en sentido jurídico, constituye todo menoscabo, pérdida o detrimento de la esfera jurídica patrimonial o extrapatrimonial de la persona (damnificado), el cual provoca la privación de un bien jurídico, respecto del cual era objetivamente esperable su conservación de no haber acaecido el hecho dañoso. Bajo esta tesitura, no hay responsabilidad civil si no media daño, así como no existe daño si no hay damnificado.

Por otra parte, sólo es daño indemnizable el que se llega a probar (realidad o existencia), siendo ello una cuestión de hecho reservada al prudente arbitrio del juzgador. En suma, el daño constituye la brecha perjudicial para la víctima, resultante de confrontar la situación anterior al hecho ilícito con la posterior al mismo. (...)” (Lo resaltado es autoría propia). De ahí que se colija que, sin la existencia de una responsabilidad que pueda ser imputable al Estado no puede derivarse un derecho indemnizatorio. Y como bien se extrae de la referida resolución judicial, y de la jurisprudencia que ha sido desarrollada a lo largo de esta exposición, si no se demuestra una causalidad adecuada, no puede derivarse un derecho a que se le reconozcan los daños, que sería el pago del valor de la totalidad del valor de “las áreas de los inmuebles 1-542449-000 derechos 001, 002 y 003; 1-542450-000 derechos 001, 002 y 003 y 1-542451-000 derechos 001, 002 y 003, que se encentran afectados por el área de protección de la naciente permanente sin nombre, con número de referencia ID 4224-2022, ubicada en las coordenadas Lambert norte: latitud inicial 203.619 longitud inicial 501.995 latitud final: 203.619 longitud final: 501.995, CRTM05: latitud inicial: 1.089.016 longitud inicial: 465.652 latitud final: 1.089.016 longitud final: 465.652.

La cual, es referida igualmente bajo la georreferenciación CRTM05 Este 465652 Norte 1089016. Además, que la finca 1-542449-000 se encuentra doblemente afectada, en el tanto también se encuentra dentro del área de protección de una naciente intermitente sin nombre, ubicada en las coordenadas CRTM05: Este:465592 Norte: 1088960”. Por lo que, tampoco se acoge con lugar su pretensión de pagar indemnización alguna por concepto de las limitaciones impuestas en virtud de la normativa legal cuya finalidad es la protección del recurso hídrico (principio precautorio ambiental), ni tampoco la pretensión de conminar al Estado para que en el plazo de dos meses inicie las diligencias administrativas expropiatorias de las fincas matrículas folios reales N° 542449, derechos 001, 002 y 003; N° 542450, derechos 001, 002 y 003 y N° 542451 todas del Partido de San José. En consecuencia, con respecto a estas dos pretensiones (43.2 y 43.3) y de la primera pretensión al ser genérica “Declarar con lugar la presente demanda en todos sus extremos, en los términos expuestos en la totalidad de este escrito (hechos, fundamento, prueba y pretensiones)” se acoge la falta de derecho interpuesta por el Estado demandado, rechazándose en todos sus extremos la demanda interpuesta por los señores Manuel, Elena Rocío y José Carlos, todos de apellidos Padilla Pérez.

Sin perjuicio de lo anterior, el Tribunal aclara que el razonamiento señalado lo es al tenor de los autos y frente al cuadro fáctico que ha sido valorado en esta sentencia. Con ello, lo resuelto no pre condiciona o limita de forma alguna que la parte gestione ante autoridades competentes como SENARA y la Dirección de Agua del MINAE los alcances concretos respecto de manejo, determinación y modificación de las restricciones que se reconocen en esta sentencia, ello en el ejercicio de las competencias que poseen tales órganos en el marco de sus competencias, así como la iniciativa que los copropietarios conciban al respecto.-

VII. SOBRE LAS DEFENSAS INTERPUESTAS

La representación del Estado, en la contestación de la demanda, interpuso las excepciones de falta de legitimación pasiva y falta de derecho. Así las cosas, por la forma en cómo se ha resuelto el presente asunto, en cuanto a que esta Cámara Colegiada luego del análisis efectuado de los autos y de la prueba que fue ofrecida por las partes y admitida en el momento procesal oportuno, se rechazan todas las pretensiones, consecuentemente conlleva a declarar sin lugar la demanda interpuesta por los señores MANUEL PADILLA PÉREZ, ELENA ROCÍO PADILLA PÉREZ Y JOSÉ CARLOS PADILLA PÉREZ, con sustento en los argumentos de hecho y de derecho, desarrollados en la presente resolución y por ende, se rechaza la excepción de falta de legitimación pasiva, toda vez que ha sido llamado al proceso el sujeto con respecto al cual se formularon las pretensiones indemnizatorias y expropiatorias, y se acoge la falta de derecho, por cuanto no se logró determinar que el Estado le haya causado el daño alegado por parte de los accionantes proveniente de una responsabilidad de carácter preminentemente objetiva imputable por conducta lícita por las regulaciones legales contenidas en los numerales 33 y 34 de la Ley Forestal y 194 de la Ley de Aguas, en donde se disponen limitaciones ambientales para las propiedades que están ubicadas en las cercanías de cuerpos de agua (nacientes permanentes e intermitentes), con sustento en lo esgrimido en el fallo de marras. -

VIII. SOBRE LAS COSTAS PROCESALES Y PERSONALES

Respecto a las costas de este proceso, de conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena sólo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, considera esta Cámara que, en virtud de haberse acogido la excepción de fondo de falta de derecho interpuesto por el Estado demandado, y no existiendo en los autos prueba alguna que permita dispensar el pago de éstas al vencido (que en este caso serían los actores), en los términos regulados por la normativa vigente legal citada procede la condena de las costas (procesales y personales), más intereses de ley desde la firmeza de la presente resolución y hasta su efectivo pago, extremos que serán liquidados en la fase de ejecución de sentencia. -

POR TANTO

Con base en los fundamentos de hecho y derechos expuestos, se rechaza la falta de legitimación pasiva y se acoge la falta de derecho interpuesta por la representación del Estado, y consecuentemente, SE DECLARA SIN LUGAR la demanda interpuesta por los señores MANUEL PADILLA PÉREZ; ELENA ROCÍO PADILLA PÉREZ, y JOSÉ CARLOS PADILLA PÉREZ en contra del ESTADO. Se resuelve con condenatoria en ambas costas a cargo de los actores, más los correspondientes intereses de ley desde la firmeza de la presente resolución y hasta su efectivo pago, extremos que serán liquidados en la fase de ejecución de sentencia.
