Criminal case number 22-000056-0454-PE brought against [Nombre 001], also known as “[Nombre 002],” born in Buenos Aires on December 30, 1974, child of [Nombre 003] and [Nombre 004], single, contractor, resident of [...], holder of identity card number [Valor 001], of age, for the offense of Exploitation of Forest Products (Aprovechamiento de Productos Forestales), to the detriment of Natural Resources. The Court is composed of Judges Maureen Sancho González and Susana Wittmann Stengel, as well as Judge Christian Fernández Mora. Attorney José Humberto Fernández González, criminal counsel for the State, appeared at the appellate stage as the State’s representative in its capacity solely as private prosecutor (querellante) and civil plaintiff (actor civil); and, BACKGROUND
I.By a decision issued at ten hours on April twenty-fifth, two thousand twenty-four, by the Criminal Court of the Second Judicial Circuit of the Southern Zone (Osa seat), the following was decided: “POR TANTO: In accordance with the foregoing, as well as sections 39 and 41 of the Political Constitution; 7 and 8 of the American Convention on Human Rights; 10 and 11 of the American Declaration of Human Rights; 9.2 and 14 of the International Covenant on Civil and Political Rights; 1, 4, 11, 16, 18 to 20, 30, and 45 of the Criminal Code; 1 through 6, 9, 16, 142, 177, 178, 184, 266 through 268, 341 through 359, 360, 361, and 363 through 366 of the Code of Criminal Procedure, Articles 58 and 61(a) and (b), Ley Forestal 7575; this judge hereby renders a final decision in these judicial proceedings and therefore ACQUITS [Nombre 001] OF ALL PUNISHMENT AND LIABILITY for the OFFENSES OF VIOLATION OF LEY FORESTAL, in the forms of EXPLOITATION OF FOREST RESOURCES ON LANDS BELONGING TO THE STATE’S NATURAL HERITAGE AND IN PROTECTION AREAS, EXPLOITATION OF FOREST PRODUCTS ON PRIVATE PROPERTY, and ACQUISITION OR PROCESSING OF FOREST PRODUCTS, to the detriment of NATURAL RESOURCES.

II.Attorney José Humberto Fernández González, criminal counsel for the State, acting as the State’s representative in its capacity as private prosecutor and civil plaintiff, filed an appeal against the aforementioned judgment.
III.The legally prescribed notice to appear (emplazamiento) was issued by a decision entered at 14:52 hours by the Criminal Court of the Second Judicial Circuit of the Southern Zone, Osa seat.
IV.Following the deliberation required by law pursuant to section 465 of the Code of Criminal Procedure, this chamber considered the issues raised in the appeal.
GROUNDS
After analyzing the admissibility requirements, the Court finds that the appeal satisfies them from an objective standpoint, since it challenges the judgment on the merits and was filed within the legally prescribed period, namely, within the fifteen-day period provided by law following the issuance of the judgment, which was delivered orally on April 25, 2024; the deadline for filing the appeal expired on May 17, 2024. The appellate brief was filed on May 16, 2024. From a subjective standpoint, it is likewise confirmed that the appellant has standing to appeal because he is the representative of the State, which appeared as a party to the proceedings as private prosecutor and civil plaintiff, pursuant to sections 458, 459, 460, and 462 of the Code of Criminal Procedure.
In the first ground of appeal, the appellant argues that there was “improper and erroneous reasoning in the judgment because it merely states that the acts alleged by the prosecuting parties do not constitute any forestry offense, since they not only fail to fall within the criminal offenses, but are also neither clear, precise, nor detailed as to their circumstances” (sic). He reproduces the alleged facts and maintains that the statutory elements of the attributed criminal conduct are fully set forth in the private criminal complaint (querella). He states that the conduct he considers to fall within the statutory definition—processing forest products—must be analyzed based on the definition of forest exploitation (aprovechamiento forestal) contained in section 3 of Ley Forestal, with processing understood as the utilization of fallen trees. He objects that the court below (a quo) found that the charging document did not meet the requirements established in section 303 of the Code of Criminal Procedure, when in fact clear, precise, and circumstantially detailed facts were alleged describing a criminal act, namely, the exploitation of timber.
In support of his position, he cites decisions 572-2016 of this Criminal Judgment Appeals Court and 259-2016 of the Criminal Judgment Appeals Court of the Second Judicial Circuit of San José. He also objects that the judgment denied the civil claim for damages on the ground that, like the private criminal complaint, it did not allege a criminal act and that there was therefore no causal nexus (nexo causal), which he considers incorrect. He requests that the judgment be reversed and that a retrial (juicio de reenvío) be ordered for new proceedings. The second ground alleges an “Error in procedendo due to improper reasoning arising from the failure to assess evidence of decisive value.” He states that the adversarial proceedings (contradictorio) established that the accused was “cutting a trunk into sections,” and therefore exploitation occurred when he converted the logs into smaller pieces.
This is shown in the SINAC report and the incorporated records, which describe finding the accused actively processing the wood with a chainsaw and state that the location was private property containing forest and a protection area. The SINAC official stated this in his testimony, and the accused admitted it. He explains that the trees were processed without any permit from the State Forestry Administration (Administración Forestal del Estado) and that the forfeiture (comiso) of the chainsaw and the wood should therefore have been ordered, since the intended benefit was not only obtaining timber but also firewood; however, no analysis of the evidence was conducted, nor was the foregoing addressed. According to the appellant, the admitted prosecution evidence was not assessed to determine the accused’s degree of participation, even though it was decisive in establishing his criminal and civil liability.
In a third ground of appeal, the State’s representative alleges an “Error in iudicando: violation of substantive law, failure to observe section 61(b) in relation to Article 3 of Ley Forestal and the cited civil-law provisions concerning the civil claim for damages, and failure to analyze criminal and civil liability.” He states that the judgment rejected the civil claim because it was ancillary to the criminal action, but because there was no ruling concerning Article 61(b) of Ley Forestal, the judgment must be reversed and remanded for new proceedings, since the facts alleged in the civil action and the evidence received during the adversarial proceedings were not analyzed. The fourth ground of appeal alleges an “Error in procedendo: contradictory and insufficient reasoning in the judgment concerning the civil claim for damages.” He contends that sections 142 and 369(d) of the Code of Criminal Procedure were violated because the court summarily rejected the civil action on the ground that no offense had been established and that, consequently, no causal nexus existed, without providing persuasive reasons for its decision.
According to the appellant, the court made conclusory assertions from which it is impossible to discern why the civil claim for damages was rejected, since, in his view, the offense was established by the evidence presented. He maintains that the judgment is defective because it failed to explain why the criminal acquittal in this case also entailed dismissal of the civil claim. He requests that the appeal be granted and a new judgment issued, correctly applying the legal rules with respect to which he has identified defects in the judgment.
By a decision entered at 14:52 hours by the Criminal Court of the Second Judicial Circuit of the Southern Zone, Osa seat, the parties were afforded an opportunity to respond to the appeal filed, but none of them submitted a response.
IV.Disposition of the appeal (resolución del recurso): For the majority of this Chamber, composed of Judge Wittmann Stengel and Judge Fernández Mora, the appeal must be denied both with respect to the two grounds challenging the criminal portion and with respect to those challenging the civil acquittal (absolutoria civil) entered in favor of the accused. A review of the oral judgment delivered in these proceedings establishes that the criminal acquittal complies with the application of the procedural rules, more specifically as regards the application of the rules of due process (debido proceso) and the principle of criminal charging (principio de imputación criminal). For greater clarity regarding the decision herein, it is appropriate to reproduce the facts alleged by the appellant: “1. On 13 de enero del 2022, during the morning, on a property located [...], the accused [Nombre 001] felled and harvested two trees of the species known as Chilamate; five trees of the species known as Guaba; nine Guácimo trees; one tree of the species known as Aceituno; four Jobo trees; and 15 Coyol palms, all of which the accused did willfully, without the respective permits from the State Forestry Administration (Administración Forestal del Estado), and to the detriment of the environment and the State’s natural resources. 2.
Through the unlawful acts described, the civil defendant [Nombre 001] harmed the environment by cutting several species of trees in the individual quantities stated, thereby altering the ecosystem of the protected area (área de protección); as a consequence of the civil defendant’s unlawful conduct, the natural resources in the protected area were degraded, disrupting the ecosystem’s natural balance. Accordingly, this representative assessed the sawn timber at the amount of one million seven hundred ninety-six thousand five hundred ninety-seven colones (₡1.796.597,00)” (sic, see folio 63 of the case file). As is apparent from the judgment’s reasoning, the trial judge concluded that the defendant should be acquitted for two reasons. First, neither the charge brought by the Public Prosecutor’s Office (Ministerio Público) nor the one brought by the Procuraduría General de la República established that the defendant had felled the trees described in those charges, to the extent that both State representatives abandoned their request for a conviction for the offense of illegal logging (tala ilegal), because it was determined that the trees the defendant was cutting with a chainsaw had previously been felled.
The second basis for the criminal acquittal concerns the fact that the judge concluded that the charge did not adequately describe the conduct attributed to the defendant, because it merely alleged that the accused had engaged in conduct identified by a normative concept that was never given sufficient descriptive content to allow him to know what unlawful act was being attributed to him; it stated only that he had “harvested” the twelve trees of the species identified in the charging document (pieza acusatoria). The principle of charging (principio de imputación) derives from the provisions of Articles 8.1 of the American Convention on Human Rights and 14 of the Inter-American Covenant on Civil and Political Rights, which guarantee every person accused of a crime the right to be informed “...in detail of the nature and cause of the accusation against him” and to “have adequate time and means for the preparation of his defense....” These supraconstitutional provisions are reaffirmed in the requirements established in subsection b) of Article 303 of the Code of Criminal Procedure (Código Procesal Penal); it was therefore necessary to adequately describe the manner and circumstances in which the accused allegedly “harvested” the felled trees, as provided in the legal definition under Article 3 of the Ley Forestal, which states: “For the purposes of this law, the following shall be understood as: a) Timber harvesting (Aprovechamiento maderable): The act of cutting or removing standing timber trees, or using fallen trees, carried out on private land not included in Article 1 of this law, which generates or may generate some advantage, benefit, gain, utility, or profit for the person performing it or for the person whom that person represents.” It is contrary to the guarantee of receiving proper notice of the charges (debida imputación de cargos) to expect an accused person to assume or intuit what criminal conduct is being attributed to him merely because a legal definition exists—one that most likely requires technical expertise to determine and is not in common usage, as in the matter before us—for this constitutes what legal scholarship has termed the defect of predetermination of the judgment (vicio de predeterminación del fallo). This defect consists of attributing conduct without precisely identifying the act constituting the offense. In this regard, it has been stated:
“4.3.7. Predetermination of the judgment This is another ground for cassation (casación) included in Article 851.1º of the Criminal Procedure Act, which provides that a procedural defect exists when ‘concepts that, because of their legal nature, entail the predetermination of the judgment are recorded as proven facts.’ “Settled case law has held that a finding of predetermination of the judgment requires the following (STS 777/2014 of 12 de noviembre): ‘a) That the expressions be legal-technical expressions defining or naming the essence of the applicable offense; b) That such expressions generally be understandable only to jurists and not be shared in ordinary language; c) That they have causal significance with respect to the judgment; and d) That, upon removal of such legal concepts, the historical facts be left without any basis whatsoever. Predetermination of the judgment therefore requires the use of technically legal expressions having a causal relationship to the judgment, that is, where the description of the act is replaced by its legal significance.
In a certain sense, the proven facts must predetermine the judgment, because if they describe conduct subsumable within a criminal offense, the logical consequence follows, even though it is set forth in the operative portion or disposition of the judgment; but that is not the meaning intended here. Rather, it occurs exclusively through the use, in the “factum,” of technically legal expressions that define and name the essence of the applicable and applied offense—expressions foreign to ordinary language and having a causal effect on the judgment; in other words, effective and causal predetermination. Thus, if removing those anomalous legal concepts embedded in the narrative does not leave the historical facts without any basis whatsoever, the procedural defect does not exist. In the words of STS 152/2006, of 1 de febrero (and STS 401/2006, of 10 de abril), predetermination of the judgment, as a defect upon which any criminal judgment may be challenged, seeks to prevent the logical structure of the decision-making analysis from replacing description with evaluation. Its application requires the judicial body to maintain a clear separation between the historical assessment and the legal assessment’ (STS 684/2007, of 26 de julio).
Every judgment comprises three consecutive but independent stages (STS 26/2014, of 30 de enero):
“1- It begins with a statement of proven facts, which constitutes the degree of certainty reached by the sentencing court and is the result of its critical assessment of all inculpatory and exculpatory evidence presented.
2- It continues with the grounds or reasoning of the judgment, which has two parts:
3- The judgment then concludes with the disposition or decision adopted, which establishes all consequences arising from the proven act and from the persons deemed responsible, as well as all other matters related to them. Accordingly, the defect of predetermination exists when this framework is disrupted and offenses, rather than facts, are defined within the proven facts.
We have likewise repeatedly stated that this procedural defect has a very limited scope for two reasons:
First, such predetermination would exist only where offenses, rather than facts, were described in the proven facts. In connection with this, it has been held that the use of ordinary-language terms such as ‘intent to traffic,’ ‘purpose of selling,’ ‘intent to kill,’ ‘intended for sale,’ ‘by mutual agreement and for profit,’ etc., does not constitute such a defect, because these terms do not describe offenses; instead, ordinary terms are used to describe the act being adjudicated, or the subjective elements of the act are being described, such as knowledge of and consent to the action undertaken by the person concerned, which must be stated in the proven facts —SSTS 361/2006; 289/2007;685/2009; 436/2011; 1408/2011 or 461/2012—.
The second reason is that it must not be forgotten that the factum, insofar as it forms the basis for the subsequent legal classification of the adjudicated facts—their legal subsumption—must necessarily be compatible and consistent with those facts, absent manifest inconsistency.” (Prat Westerlindh, Carlos; Practical Manual on Criminal Cassation Appeals, Tirant lo blanch, Valencia, 2015, pp. 98-100).
Although the challenged judgment does not set forth these theoretical considerations regarding the defect at issue, it is nevertheless apparent that the decision reached was the direct result of a correct application of the procedural rules and the standards established by the guarantees of due process and the principle of charging. This is clearly evident when the judge states:
“(...) neither the charge brought by the Ministerio Público nor the charge in the private complaint (querella) describes a processing action that was allegedly performed, such as what was mentioned—that you were apparently cutting pieces of wood for firewood—which might possibly resemble an action akin to processing, meaning the transformation of an object physically, chemically, or as stated by the Real Academia. Since these two important elements, the charge and the private complaint, form the foundation and the playing field, as I told you previously, upon which I may assess the conduct in light of the remainder of the evidence, I find no correspondence and do not share the analytical criteria that have been applied. On the contrary, I consider that none of the offenses with which you had been charged—at least those identified here and also described in the charging document and the private complaint—corresponds to the alleged conduct. To use the words of your defense counsel, what is being determined here is not the charges or the legal description provided by the professionals, but rather the facts; and the facts, according to the charge they brought, do not correspond to any of the activities alleged. It is therefore this judge’s determination that, because this basic requirement of the charge and private complaint has not been met, the decision cannot be consistent with their request that you be found responsible for the acts. Accordingly, it is also not appropriate for me to continue analyzing the remaining elements of the theory of the offense (teoría del delito), because the conduct with which you have been charged does not fully correspond to the criminal offenses identified, and under no circumstances could this court, through interpretations that the law does not permit me to make, take certain criminal offenses and certain requirements and construct another.”
Thus, it is abundantly clear that the ruling by the court below (a quo) amounts to nothing more than the application of the requirement that the act constituting the offense be precisely specified, in order to avoid the defect of predetermining the judgment (predeterminación del fallo), as previously discussed, which is also connected to the aforementioned supraconstitutional principle of charging (principio supraconstitucional de imputación). Accordingly, the majority takes the position that the considerations set forth in the challenged judgment are correct, since a violation of due process (debido proceso), such as the failure to provide an adequate statement of the alleged facts, precludes an analysis of the evidentiary record of the kind requested by the appellant; it would be nonsensical to continue analyzing the facts and their statutory classification while knowing that the accused had no genuine opportunity to defend himself against those facts.
The same applies from the perspective of the accused’s civil liability, since the civil damages action (acción civil resarcitoria) alleged the existence of fault-based liability (responsabilidad subjetiva) on the basis of the same factual allegations set forth in the private complaint (querella) and the indictment filed by the Ministerio Público. Indeed, the civil damages action invokes as the event giving rise to civil liability “…the unlawful conduct constituting the offense of Violation of the Ley Forestal contemplated in Ley No. 7575 and its Regulations, provided for in Article 58 subsection b) and Article 61 subsection a) of this body of law, committed by the Civil Defendant herein.” Thus, the trial court’s conclusion that it was necessary to enter judgment for the defendant on the civil claim, as a corollary of the criminal acquittal, was correct, because civil liability is ancillary to criminal liability and, except in special cases of strict liability (responsabilidad objetiva), a civil judgment could not be contemplated without establishing a connection between the unlawful conduct and the harmful event.
A review of the provisions of the Ley Forestal shows that Article 57 thereof establishes only fault-based liability for violations of that law, by providing:
“ARTICLE 57.- Violations Violations of this law, in accordance with this title, constitute criminal offenses.
In the case of the unlawful acts covered by this law, when legal entities are involved, civil liability shall extend to their legal representatives. Likewise, both natural persons and legal entities shall be civilly liable for the ecological damage caused, in accordance with Article 1045 of the Código Civil. Authorities, forestry supervisors, and certifiers responsible for enforcing this law and its regulations shall be tried as accomplices and punished with the same penalties, depending on the offense, when it is proven that, despite being aware of violations thereof, through negligence or acquiescence they failed to seek punishment of the perpetrators and allowed this law and its regulations to be violated. Depending on the seriousness of the act, the Judges hearing matters under this law may impose the penalty of special disqualification (Emphasis supplied).
Accordingly, because the criminal offense could not be proven due to deficiencies in the allegations made, the description of which was identical in the civil action, it was impossible to establish the necessary causal nexus (nexo causal) between the unlawful act and the damages claimed. From that perspective, it must be noted that the civil action alleged exactly the same facts as the private complaint, and therefore the defects in the criminal charge were also reflected in the civil claim, insofar as it was not proven that the accused carried out the logging, while what would have been proven amounted to uncharged criminal conduct, namely the offenses contemplated in Article 61 of the Ley Forestal, because the conduct attributed to the person brought before the court was not described in substantive terms (harvesting, acquisition, or processing of forest products). Consequently, no fault-based liability whatsoever could have been established against the accused, because, as the First Chamber of the Corte Suprema de Justicia stated in ruling 2007-000658 at 8:35 a.m. on September 19, 2007:
“... The case law of this Chamber has consistently held that, as a general rule—with some exceptions—non-contractual liability is fault-based, noting that its foundational statutory provision is Article 1045 of the Código civil. The conduct of the allegedly liable party is assessed after the fact—once the damage has occurred—to determine whether, by act or omission, it was carried out intentionally, culpably, negligently, or recklessly. Such blameworthiness must be established in the defendant’s conduct, and it must be determined whether that conduct caused the damage; that is, whether a causation analysis shows it to be the factual antecedent that gave rise to the losses claimed...” (ruling 001063-F-S1-2009 Sala I); therefore, it was indeed necessary to prove the intentional conduct of the accused and civil defendant in order to establish his fault-based civil liability. However, as the trial judges noted, this was not possible because the witnesses examined could not establish that he was a lifeguard at the “Balneario Patarrá,” together with the testimony of one witness that he was a maintenance worker, which gave rise to reasonable doubt on the part of the court.
It was not sufficient for the indictment to allege a de facto duty to act (posición de garante de hecho); that duty also had to be proven. This did not occur, because the prosecution’s testimonial evidence did not establish that circumstance beyond any doubt. It is also appropriate to note that “... For strict non-contractual liability to arise, there must be conduct (a dangerous activity) serving as the basis for attributing liability and an outcome that harms legally relevant interests. In the case of fault-based non-contractual liability, or liability based on fault (which is the type relevant here), its establishment requires the combined presence of three elements: unlawfulness, culpability, and a causal connection between the conduct and the damage caused...” It may be concluded from the foregoing that the challenged ruling properly resolved the criminal and civil liability attributed to the accused, and that no judgment could be entered against him when the parties to the proceedings failed to formulate the charges properly so as to permit the accused and civil defendant to exercise his right of defense adequately. Finding no error in the ruling, the majority of this Chamber holds that the appeal must be denied and the challenged ruling affirmed in all respects. Judge Sancho González dissents.
V.Dissenting opinion (voto salvado) of Judge Sancho González. With the utmost respect, I depart from the position of the majority of this appellate Chamber based on the following considerations: after carefully listening to the trial court judgment, which was delivered orally and appears on the virtual desktop recorded at 10:59:18 on 25 de abril de 2024, file 220000560454PE-25042024101711-2_Multi, I conclude that the trial court’s decision contains a series of defects that render it null and void. As it is absolutely necessary to explain my decision, I must refer again to the allegations in the private complaint (querella) (which are consistent with those asserted in the civil claim and charged by the Prosecutor’s Office): “1. On 13 de enero del 2022, during the morning, on a property located [...], the accused [Nombre 001] felled and harvested two trees of the species known as Chilamate; five trees of the species known as Guaba; nine Guácimo trees; one tree of the species known as Aceituno; four Jobo trees; and 15 Coyol palms, all of which the accused did willfully, without the corresponding permits from the State Forestry Administration (Administración Forestal del Estado), and to the detriment of the environment and the natural resources of the State. 2.
Through the described unlawful acts, the civil defendant [Nombre 001] harmed the environment by cutting several tree species in individual quantities, thereby causing an alteration to the ecosystem of the protection area (área de protección); as a consequence of the civil defendant’s unlawful conduct, the natural resources in the protection area were degraded, altering the natural balance of the ecosystem. Accordingly, this representative valued the sawn timber at one million seven hundred ninety-six thousand five hundred ninety-seven colones (₡1.796.597,00)” (sic, see page 63 of the case file; emphasis added). The judgment finds fault with the fact that the allegations in the charging instrument (pieza acusatoria) do not satisfy the requirements of Article 303 of the Code of Criminal Procedure (Código Procesal Penal) and adds that, for that reason, it was not possible to analyze the evidence to determine whether the accused had engaged in any criminal conduct.
Beginning at timestamp 21:15, the trial judge stated the following, which is reproduced at length because it is essential for purposes of what will be discussed: “The law establishes the principle that the charges brought by both the Public Prosecutor’s Office (Ministerio Público) and the private prosecutor (ente querellante) must specify and satisfy the requirements that the law also establishes regarding what the charging instrument must contain; principally, the facts and circumstances must be entirely clear and established, and must bear a close or complete relationship to the elements established by the provision or the offense with which you are being charged. In this case, those are the forms of conduct described by law in the Ley Forestal, both Article 58, subsection b), and Article 61, subsections a) and b), which are the three types of offense. The first establishes conduct involving the harvesting of forest resources (aprovechamiento de los recursos forestales) on land belonging to the State’s natural heritage (patrimonio natural del Estado) and in protection areas; that was the first form of conduct alleged in the private complaint.
The Public Prosecutor’s Office, like the private complainant, then alleged two other forms of conduct attributed to you: the harvesting of forest products (aprovechamiento de los productos forestales) on private property, which was the offense under subsection a), and the acquisition or processing of forest products (adquisición o procesamiento de productos forestales) set forth in subsection b). Since these were the claims being pursued by these two prosecuting entities, I wish to reiterate that the issue on which I must base my decision is that the charging instrument of which they informed us, and which was read to you, had to contain all the essential elements. I must inform you that these are not limited to the circumstances of manner and time that may have been alleged or that the evidence might establish; rather, the conduct must also correspond to the operative verbs set forth in the law.
To give you an example and make this clearer, the law tells me what acts the person must have performed, and I must verify from the charging instrument and the evidence that those were the acts performed by that person. If the charge alleges that one person caused the death of another, speaking of homicide, the charging instrument must tell me that a person was killed and that the act was carried out to that end. But if the act—excuse me, if the charge—concerns other forms of conduct, such as injuries intended to cause death but which did not cause death, then obviously we would not be dealing with the same offense. I mention this circumstance because here we had the charging instrument filed by the Public Prosecutor’s Office and the private complaint. Among the conduct alleged, and as I informed you, these identified primarily the acts or verbs ‘felled’ and ‘harvested’; likewise, the first allegation in the private complaint stated ‘felled’ and ‘harvested.’ In assessing the requirements of the remaining criminal offenses, as the Prosecutor’s Office clearly noted in its closing arguments, and as the State’s representative, the Attorney General’s Office (Procuraduría), also noted, the conduct consisting of harvesting forest resources on land belonging to the State’s natural heritage and in protection areas, insofar as the felling was concerned, was indeed charged, but it was not supported, at least, by the remainder of the evidence, as they also acknowledged.
Consequently, the only remaining course was to pursue the conduct consisting of harvesting forest products on private property or acquiring or processing such products. The only opportunity when a correction could have been made was available solely to the Public Prosecutor’s Office, and no other correction was made regarding the descriptions of the conduct set forth in the charging instrument or of which you had already been informed during the earlier stages. Moreover, during the investigation, both prosecuting entities could have determined precisely, through the evidence, which forms of conduct would be attributed to you. In that regard, the law also provided an opportunity—which was not exercised today, yesterday, or at any time today—to correct the charging instrument, or even to expand it. The law also allows prosecuting entities to file an alternative charge (acusación subsidiaria), which likewise did not occur in these proceedings.
I make this point because both the Public Prosecutor’s Office and the State, through the Attorney General’s Office, had the option of alleging additional conduct or bringing additional charges against you, since the charges filed here define the playing field on which I, as judge, may act. Accordingly, because I must confine myself to the charges as filed, with no corrections to them and no alternative charge, I may consider only the conduct for which you are being prosecuted: felling and harvesting. Regarding the provision referenced and which I mentioned to you, principally Article 58, which both prosecuting entities have ruled out, the evidence—including both the reports and the testimony of Mr. ... Mr. [Nombre 007], Don [Nombre 007]—did establish that you did not engage in the act of felling, because there was no basis on which to attribute that act to you. Having disposed of the preceding conduct, the next concerns the provision addressing the harvesting of forest resources on land belonging to the State’s natural heritage and in protection areas.
In fact, this provision of the Ley Forestal establishes that the conduct that must be included in the charging instrument is the harvesting of one or more forest products on private property, necessary elements that must appear in the charging instrument or private complaint, without a permit from the forestry administration (administración forestal), or, even where a permit has been granted, in a manner inconsistent with what was authorized. There are, in fact, three principal elements, and in seeking to determine whether all the elements established by law are present so that the charging instrument satisfies all the requirements of a clear, precise, and detailed description of the circumstances (descripción clara, precisa y circunstanciada), this judge finds that, although one of the operative verbs—harvesting—is stated, other requirements are missing, such as the property’s location, which is needed to determine who owns it and whether it is private or public.
That is a necessary element that the charging instrument does not provide, nor did the private complaint establish it. Along the same lines, the claims and interpretations advanced by both prosecuting entities, as I told you, and by your defense counsel, are that the conduct at issue therefore falls within the offense of acquiring or processing forest products. To explain it in basic terms, the operative verbs established for this offense of acquiring and processing forest products are principally the two verbs ‘acquire’ and ‘process.’ Acquisition, or to acquire, must be understood as obtaining ownership of a right or of a thing that belongs to no one, or that is transferred gratuitously, for consideration, or by prescription; that is, it entails a transfer of ownership from one person to another. That circumstance cannot be determined from either the Public Prosecutor’s Office’s charging instrument or the private complaint.
Therefore, considering that this is the offense of acquiring or processing forest products, the verb ‘acquire,’ as used in this criminal offense (tipo penal), is found neither in the charging instrument nor in the private complaint. Accordingly, the only remaining issue is to analyze the next verb, ‘processing’ or ‘to process.’ The RAE, which was the source I used to define acquisition, also provides the definition of processing and offers several definitions relevant to our inquiry: to prepare judicial records and proceedings; to declare and treat someone as suspected of an offense. But the definition relevant to us at this time is ‘to subject something to a process of physical, chemical, or biological transformation.’ In this regard, both the Public Prosecutor’s Office’s charging instrument and the private complaint refer only to the operative verb ‘harvesting.’ Characterizing that harvesting, where they do not describe precisely whether it occurred through processing or how that processing took place, tells us only that there was harvesting; however, ‘harvesting’ is not the same operative verb as ‘processing.’ In its closing arguments, the State’s representative asked this judge to consider what, at a minimum, should be understood by harvesting.
However, this judge does not share the approach taken by the State’s representative, although I fully respect its analysis. I disagree because I consider that the operative verb established by the provision must be described precisely, and in this case that verb is ‘to process.’ Neither the Public Prosecutor’s Office’s charging instrument nor the charge in the private complaint describes an act of processing, such as the alleged cutting of pieces of wood for firewood, which might possibly resemble an act of processing because it involves the physical transformation of an object, or chemical transformation, as stated by the Royal Spanish Academy.
Given that these two important elements, the indictment (acusación) and the private prosecution (querella), constitute the basis and the playing field, as I previously told you, for me to analyze the conduct in light of the remaining evidence, I find that they do not correspond, and I do not share the analytical criteria that have been applied. On the contrary, I consider that none of the offenses with which you had been charged—at least those identified here and also described in the charging document and the private prosecution—corresponds to any of the activities alleged to have been carried out. To borrow the words of your defense counsel, what is being determined here is not the charges or the legal characterization made by the attorneys, but rather the facts; and the facts, as alleged by them, do not correspond to any of the activities alleged to have been carried out. It is therefore this judicial officer’s view that, because this basic requirement of the indictment and the private prosecution has not been met, the decision cannot accord with their request that you be found responsible for the alleged acts.
Accordingly, it is also not for me to continue analyzing the remaining elements of the theory of the offense (teoría del delito), because the conduct with which you have been charged does not fully correspond to the statutory definitions of the offenses (tipos penales) identified, and under no circumstances could this court, through interpretations not permitted by law, take certain statutory definitions and certain elements and construct another offense. In that regard, such a course is entirely foreclosed, because this is a matter of the principle of legality (principio de legalidad), or the principle that I must abide solely by what the law provides and cannot go beyond it. Therefore, the charges and the evidence have not reached the point of overcoming the presumption of innocence (principio de inocencia) that protected you; it has not been overcome […]” (the transcription is faithful).
In my view, the criticism expressed by the trial judge in the judgment is unfounded: it should be noted that those who prosecute criminal actions allege facts, not legal characterizations. This means that, provided the conduct constituting the offense is duly described within the alleged factual framework, the principle of specific accusation (principio de imputación) is respected. According to the case law of the Sala Constitucional, that principle has been conceptualized as “[…] the right to a formal charge. It must necessarily be afforded to anyone whom it is sought to subject to proceedings. It is therefore the duty of the Ministerio Público [or whoever prosecutes the criminal action], initially, and thereafter of both it and the judge, and encompasses the duties to identify the accused, describe in detail, precisely, and clearly the act of which the accused is charged, and provide a clear legal characterization of the act, stating the legal grounds for the charge and the specific request for punishment” (sic, see ruling n.° 1739 of 11:45 hours on 1° de julio de 1992).
A proper charging allegation must therefore contain all the requirements set forth in artículo 303 of the Code of Criminal Procedure (Código Procesal), namely: a) the information necessary to identify the accused, b) a precise and detailed account of the alleged criminal act, c) the grounds for the charge, including the evidentiary elements supporting it, d) citation of the applicable legal provisions, and e) identification of the evidence to be presented at trial. Each of these requirements is essential so that the accused person clearly understands the act attributed to them and, based on a specification of the manner, time, and place of its commission and on the body of evidence gathered and disclosed to them, can devise a defense strategy enabling them to refute the charges brought by the Ministerio Público or by the prosecuting party through the private prosecution, as in the case before us.
The particular circumstances of the investigated act are clearly set out in the allegations contained in the indictment filed by the Procuraduría General de la República, as will be explained a few lines below. According to the court below (a quo), the submissions—both those of the prosecution and those of the State—were unsuitable for assessing whether the accused’s conduct fell within any criminal offense, disregarding the fact that the private prosecution’s description of the facts establishes: i) who was charged—[Nombre 001]—the accused; ii) what he was charged with—cutting down and harvesting—(operative verbs defining the offense) two chilamate trees, five guaba trees, nine guácimo trees, one aceituno tree, four jobo trees, and 15 coyol palms”; iii) where and when the acts occurred—on 13 de enero de 2022, during the morning, on a property located in [...]—; and iv) how the alleged act was carried out—without the respective permits from the State forestry administration—and—to the detriment of the environment—.
It should be observed that the indictment filed by the Procuraduría must be read in light of the legal characterization that the State’s representative gave to the acts, classifying them as an offense of Violation of the Ley Forestal, in the form of the unlawful cutting and harvesting of forest products on private property. artículo 61 of the cited law provides:
“A term of imprisonment of one month to three years shall be imposed on anyone who:
Harvests one or more forest products on private property without a permit from the State Forestry Administration, or who, despite having a permit, fails to comply with what was authorized” (emphasis added).
It is true that, in the legal classification set forth by the complaint (querella) under the heading concerning legal characterization, other substantive provisions are cited that do not apply to this particular case—58 subsection b) and 61 subsection b) of the Ley Forestal—but that is of little relevance because, as stated above, charges concern facts, not legal classifications, and the statement of facts described an act of “felling (tala) and harvesting (aprovechamiento)” a specified number of trees whose species were identified. Thus, the operative verbs attributed were to fell and to harvest, and it was the latter that the judge failed to examine in the reasoning of the judgment; consequently, this is why I believe the judgment must be declared ineffective. Although, when analyzing the inadequacy of the charges, the trial court refers to the substance of the prohibited acts governed by 58 subsection b) and 61 subsection b) of the Ley Forestal, concluding that they are not described in the charging instruments, it does not address the verb “to harvest,” which is a normative concept defined by the Ley Forestal itself.
Article 3 thereof provides: “For the purposes of this law, the following shall be understood as: a) Timber harvesting (Aprovechamiento maderable): The act of cutting or removing standing timber trees, or using fallen trees, carried out on private land not included in article 1 of this law, which generates or may generate any benefit, advantage, utility, or profit for the person performing it or for the person whom that individual represents.” As may be gathered from an examination of the oral judgment, the adjudicator did not consider these issues, having found that the charges brought did not contain the attribution requirements (requisitos de imputación) prescribed by article 303 of the criminal procedural rules. From my perspective, the court’s explanation is confusing and contains arguments outside the context of the specific conduct alleged in both charging instruments (those of the Ministerio Público and the Procuraduría), analyzing circumstances not contemplated within the factual frameworks of the accusatory pleadings and leading the court to the erroneous conclusion that those pleadings failed to satisfy the basic attribution requirements.
In addition, the court below (a quo) faults the complaint (as well as the indictment (acusación)) for failing to state whether the alleged act occurred on public or private property. However, as can be inferred from the literal wording of the facts in the State’s charging instrument, it specifies that the property is a parcel of land (finca) and provides its exact location, meaning that an evidentiary analysis (análisis probatorio), had one been conducted, could have confirmed or ruled out that it was private real property. At no point did the accusatory pleading state that it was State-owned property within the meaning of article 1 of the Ley Forestal, which provides: “the cutting or harvesting of forests in national parks, biological reserves, mangroves, protected zones, wildlife refuges, and State-owned forest reserves is prohibited.” Accordingly, none of the issues raised by the adjudicator finds support in the content of the complaint filed by the Procuraduría General de la República.
On the contrary, it contains the details necessary to determine, based on an examination of the evidence, whether or not the accused engaged in the prohibited conduct. The trial court did not undertake that exercise, as it merely identified purported deficiencies in the charges which, as stated above, do not exist. This leads me to conclude that the judgment must be vacated and a retrial (juicio de reenvío) ordered for new proceedings. Furthermore, because the decision to acquit for the reasons already stated resulted in the dismissal of the civil action for damages (acción civil resarcitoria) brought by the State, without further consideration of the claim—as the court merely transferred the same arguments to that action without assessing the substantive relief sought—the judgment’s ineffectiveness extends in full to both its criminal and civil rulings.
POR TANTO
By majority vote, the appeal filed by the representative of the Procuraduría General de la República is denied, and the challenged judgment is affirmed in all respects. Judge Sancho González dissents, orders that the judgment be declared ineffective in its entirety, and orders a retrial for new proceedings in the matter before a differently constituted panel of the same court. Notice shall be given.

RESULTANDO
I.Que mediante resolución de las diez horas del veinticinco de abril del dos mil veinticuatro del Tribunal Penal del Segundo Circuito Judicial de la Zona Sur (sede Osa), se resolvió: “POR TANTO: De conformidad con lo antes expuesto, además de los numerales 39 y 41 de la Constitución Política; 7 y 8 de la Convención Americana sobre Derechos Humanos; 10 y 11 de la Declaración Americana de Derechos Humanos; 9.2 y 14 del Pacto Internacional de Derechos Civiles y Políticos; 1, 4, 11, 16, 18 a 20, 30, 45 del Código Penal;1, al 6, 9, 16, 142, , 177, 178, 184, 266 al 268, 341 a 359, 360, 361, 363 a 366 del Código Procesal Penal, artículo 58 y 61 incisos a) y b), Ley Forestal 7575; este juzgador resuelve en definitiva el presente proceso judicial, por lo que SE ABSUELVE DE TODA PENA Y RESPONSABILIDAD A [Nombre 001], por LOS DELITOS INFRACCIÓN A LA LEY FORESTAL en sus modalidades de APROVECHAMIENTO DE LOS RECURSOS FORESTALES EN TERRENOS DEL PATRIMONIO NATURAL DEL ESTADO Y EN LAS ÁREAS DE PROTECCIÓN, APROVECHAMIENTO DE LOS PRODUCTOS FORESTALES EN PROPIEDAD PRIVADA y ADQUISICIÓN O PROCESAMIENTO PRODUCTOS FORESTALES, en perjuicio de RECURSOS NATURALES.

II.Que contra el fallo indicado, el licenciado José Humberto Fernández González, procurador penal, como representante del Estado en calidad de querellante y actor civil, interpuso recurso de apelación.
III.Se confirió el emplazamiento de ley mediante resolución de las 14:52 horas del Tribunal Penal del Segundo Circuito Judicial de la Zona Sur, sede Osa.
IV.Realizada la deliberación de ley según lo dispuesto en el numeral 465 del Código Procesal Penal, esta cámara se planteó las cuestiones formuladas en el recurso.
CONSIDERANDO
Analizados los parámetros de admisibilidad, el Tribunal verifica que el recurso de apelación cumple con los mismos, tanto desde la perspectiva objetiva, puesto que se trata de una impugnación incoada en contra de la sentencia de fondo y fue interpuesto dentro del plazo de ley, es decir, dentro de los quince días de plazo previstos legalmente luego del dictado de la sentencia que se emitió de manera oral el 25 de abril de 2024, venciendo el término para su interposición el día 17 de mayo de 2024. El libelo recursivo fue presentado el 16 de mayo de 2024. Desde la subjetiva, igualmente se corrobora que quien impugna, se encuentra legitimado para ello por ser el representante del Estado que se constituyó como parte procesal (querellante y actor civil), de conformidad con los numerales 458, 459, 460 y 462 del Código Procesal Penal.
En el primer motivo del recurso, el recurrente plantea que existe “indebida y errónea fundamentación de la sentencia al solo indicar que los hechos acusados por las partes acusadoras no configuran ningún delito forestal, ya que los mismos no solo no encuadran dentro de las figuras penales sino los mismos no son claros, ni precisos ni circunstanciados” (sic). Transcribe los hechos acusados y sostiene que los requisitos típicos de la delincuencia atribuida se encuentran plenamente contenidos en la querella. Señala que la conducta típica que estima, es la de procesar productos forestales, debe ser analizada con base en la definición de aprovechamiento forestal contenida en el numeral 3 de la Ley Forestal, entendiendo el procesamiento como la utilización de árboles caídos. Reclama que el a quo consideró que la acusación no cumplía con los requisitos establecidos en el numeral 303 del Código Procesal Penal cuando lo cierto es que se atribuyeron hechos claros, precisos y circunstanciados que enuncian un hecho delictivo como lo es el aprovechamiento de la madera.
Cita en respaldo de su posición las resoluciones 572-2016 de este Tribunal de Apelación de Sentencia y la 259-2016 del Tribunal de Apelación de Sentencia del Segundo Circuito Judicial de San José. También reclama que la sentencia declaró sin lugar la acción civil resarcitoria por sostener que, al igual que la querella, no enunciaba un hecho delictivo y, por ende, no había nexo causal, lo cual estima incorrecto. Solicita que se revoque la sentencia y se disponga del juicio de reenvío para una nueva sustanciación. En el segundo motivo se alega un “Error in procedendo por indebida fundamentación por omisión en la valoración de prueba de valor decisivo”. Señala que durante el contradictorio se demostró que el imputado estaba “troceando un tronco”, por lo que el aprovechamiento se dio, al convertir las trozas en otras más pequeñas, esto se observa en el informe del SINAC y las actas agregadas, que describen que encontraron al imputado en plena labor de procesamiento con una motosierra, que el lugar es una propiedad privada con bosque y zona de protección.
Esto lo indicó el funcionario del SINAC en su deposición y el imputado así lo admitió. Explica que los árboles se procesaron sin ningún permiso de la Administración Forestal del Estado y, por ello, se debió ordenar el comiso de la motosierra y la madera, cuyo beneficio no era solo para la obtención de madera, sino también de leña, pero no se realizó ningún análisis de la prueba, ni se ventiló lo anterior. Para quien recurre, no se realizó valoración de la prueba de cargo admitida para determinar el grado de participación del acusado y que resultaba decisiva para acreditar su responsabilidad penal y civil. En un tercer motivo de impugnación, el representante estatal alega “ Error in iudicando: violación de la ley sustantiva, inobservancia de los numerales 61 inc. b en relación con el artículo 3 de la Ley Forestal y los artículos civiles aludidos en cuanto a la acción civil resarcitoria, analizar la responsabilidad penal y civil”.
Manifiesta que la sentencia rechazó la acción civil por ser accesoria a la penal, pero al no haber pronunciamiento en cuanto al artículo 61 inciso b) de la Ley Forestal, la sentencia debe revocarse y remitirse para una nueva sustanciación porque no se analizó lo relacionado con los hechos imputados por la acción civil y la prueba recibida en el contradictorio. En el cuarto motivo de apelación se alega “Error in procedendo: contradictoria e insuficiente fundamentación de la sentencia, en cuanto a la acción civil resarcitoria”. Considera que se violentaron los numerales 142 y 369 inciso d) del Código Procesal Penal porque el tribunal afirmó de manera sucinta el rechazo de la acción civil, al no determinar que existiera un delito y, por ello, no existía un nexo causal, sin motivar de forma convincente la decisión. Para quien recurre, el tribunal realizó afirmaciones dogmáticas, de las cuales no es posible deducir las razones por las que se rechazó la acción civil resarcitoria, ya que a su juicio el delito se demostró conforme a la prueba evacuada.
Sostiene que la sentencia resulta viciada porque no fundamentó por qué en este caso la absolución penal conllevaba también la civil. Solicita que se acoja el recurso y se dicte un nuevo fallo, aplicando correctamente las normas jurídicas respecto de las cuales ha señalado la existencia de vicios en la sentencia.
Mediante resolución de las 14:52 horas del Tribunal Penal del II Circuito Judicial de la Zona Sur, sede Osa, se confirió audiencia a las partes del recurso planteado, sin que ninguna de ellas se haya pronunciado al respecto.
IV.Resolución del recurso: Para la mayoría de esta Cámara, integrada por la jueza Wittmann Stengel y el juez Fernández Mora, el recurso debe rechazarse tanto en lo relacionado con los dos motivos donde se impugna la parte penal, como respecto de los que cuestionan la absolutoria civil dictada en favor del acusado. La revisión de la sentencia oral dictada en este proceso permite establecer que la decisión absolutoria en lo penal se ajusta a la aplicación de la normativa procesal, más específicamente en cuanto a la aplicación de las reglas del debido proceso y del principio de imputación criminal. Para mayor claridad sobre lo aquí decidido, conviene transcribir los hechos que fueron acusados por el recurrente: “1. En fecha 13 de enero del 2022 en horas de la mañana; en una finca ubicada [...], el imputado [Nombre 001] taló y aprovechó dos árboles de la especie conocida como Chilamate; cinco árboles de la especie conocida como Guaba, nueve árboles de Guácimo; un árbol de la especie conocida como Aceituno, cuatro árboles de Jobo y 15 palmas de Coyol todo lo cual realizó el imputado de forma dolosa sin contar con los respectivos permisos de la Administración Forestal del Estado y en daño del medio ambiente, y los recursos naturales del estado. 2.
Con los hechos descritos e ilícitos, el demandado civil [Nombre 001], dañó el medio ambiente mediante la corta de varias especies de árboles en cantidades individuales, produciendo con su actuar una alteración al ecosistema del área de protección, siendo que como consecuencia del actuar ilícito del demandado civil se causó el deterioro de los recursos naturales en el área de protección, alterando el equilibrio natural del ecosistema, por lo que esta representación valoró la madera aserrada en la suma de un millón setecientos noventa y seis mil quinientos noventa y siete colones (₡1.796.597,00)” (sic, consultar folio 63 del expediente). Según se desprende del fundamento intelectivo de la sentencia, el juzgador de mérito llegó a la conclusión de que debía absolver al justiciable por dos razones: la primera, porque la acusación planteada por el Ministerio Público ni la realizada por la Procuraduría General de la República pudieron acreditar que el justiciable taló los árboles descritos en dichas imputaciones, al extremo que ambas representaciones estatales declinaron de su pretensión de exigir una condena por el delito de tala ilegal, puesto que se determinó que los árboles que el justiciable estaba cortando con una motosierra habían sido talados con anterioridad.
El segundo aspecto de la absolutoria penal tiene que ver con el hecho de el juzgador concluyó que la imputación no describió adecuadamente en qué consistía la conducta atribuida al justiciable, desde que esta simplemente se limitó a enunciar la realización del imputado de un concepto normativo al que nunca se le dotó de contenido descriptivo como para que el acusado pudiera conocer cuál era la acción ilícita atribuida, pues únicamente se indicó que este “aprovechó” los doce árboles de las especies señaladas en la pieza acusatoria. El principio de imputación deriva de lo dispuesto por los numerales 8.1 de la Convención Americana sobre Derechos Humanos y 14 del Pacto Interamericano de Derechos Civiles y Políticos, que garantizan a toda persona acusada de un delito el derecho a ser informada " ...en forma detallada, de la naturaleza y causas de la acusación formulada contra ella" y a "disponer del tiempo y de los medios adecuados para la preparación de su defensa...".
Estas disposiciones supraconstitucionales se encuentran reafirmadas en los requisitos exigidos por el inciso b) del artículo 303 del Código Procesal Penal; y por eso, era necesario que se describieran adecuadamente las circunstancias modales en las que se habría dado ese “aprovechamiento” del imputado de los árboles talados, tal como lo dispone la definición legal del artículo 3 de la Ley Forestal, cuando señala, “Para los efectos de esta ley, se considera: a) Aprovechamiento maderable: Acción de corta-, eliminación de árboles maderables en pie o utilización de árboles caídos, realizada en terrenos privados, no incluida en el artículo 1 de esta ley, que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa”. Resulta contrario a la garantía de contar con una debida imputación de cargos el que se pretenda que la persona acusada suponga o intuya cuál es el accionar delictivo que se le atribuye sólo por el hecho de que exista una definición legal, que muy probablemente requiere de un manejo técnico para su determinación y que no es de uso común, como es el caso que nos ocupa, pues ello constituye lo que ha denominado la doctrina como un vicio de predeterminación del fallo. Dicho vicio consiste en que la atribución de la conducta requiere de una determinación precisa del hecho que constituye la infracción. Al respecto, se ha indicado:
“4.3.7. Predeterminación del fallo Se trata de otro motivo de casación integrado en el art. 851.1º de la Ley de Enjuiciamiento Criminal indicando que existe quebrantamiento de forma cuando “se consignen como hechos probados conceptos que, por su carácter jurídico, impliquen la predeterminación del fallo”.
“Una reiterada jurisprudencia ha declarado que la predeterminación del fallo requiere para su estimación (STS 777/2014 de 12 de noviembre):“a) Que se trate de expresiones técnico-jurídicas que definan o den nombre a la esencia del tipo aplicado; b) Que tales expresiones sean tan sólo asequibles por regla general para los juristas y no sean compartidas en el uso del lenguaje común; c) Que tengan valor causal respecto al fallo, y d) Que suprimidos tales conceptos jurídicos, dejen el hecho histórico sin base alguna. La predeterminación del fallo precisa, pues, la utilización de expresión es técnicamente jurídicas y con situación causal respecto al fallo, o sea, cuando la descripción del hecho se reemplaza por su significación. En un cierto sentido los hechos probados tienen que predeterminar el fallo, pues si en los mismos se describe una conducta subsumible en un tipo penal, la consecuencia lógica se infiere, aunque se describa en la parte dispositiva o fallo de la sentencia, pero no es éste el sentido, sino que se produce exclusivamente por la utilización en el «factum» de expresiones técnicamente jurídicas que definan y den nombre a la esencia del tipo aplicable y aplicado, expresiones ajenas al lenguaje común, con un valor causalista del fallo; o sea predeterminación eficaz y causal, por lo que si suprimidos tales anómalos conceptos jurídicos incrustados en el relato no dejan el hecho histórico sin base alguna, el vicio procesal no existe.
En palabras de la STS 152/2006, de 1 de febrero (y la STS 401/2006, de 10 de abril), la predeterminación del fallo, como vicio impugnable de cualquier sentencia penal, tiende a evitar que la estructura lógica del razonamiento decisorio, sustituya lo descriptivo por lo valorativo. Con su articulación se impone al órgano judicial la necesidad de una nítida separación entre el juicio histórico y el juicio jurídico” (STS 684/2007, de 26 de julio).
En toda sentencia, hay tres escenarios consecutivos pero independientes(STS 26/2014, de 30 de enero):
“1- Se parte de un relato de hechos probados que constituye el juicio de certeza alcanzado por el Tribunal sentenciador, es el resultado de la valoración crítica de toda la prueba de cargo y de descargo practicada.
2- Se continúa con la fundamentación o argumentación de la sentencia que tiene dos partes:
3- Seguidamente se cierra la sentencia con el fallo o decisión adoptada donde se fijan todas las consecuencias derivadas del hecho probado y de las personas estimadas como responsables, y el resto de las cuestiones relacionadas con ellas. Pues bien, el vicio de predeterminación existe cuando se trastoca este cuadro y en los hechos probados se definen delitos en vez de describir hechos.
Igualmente hemos dicho con reiteración que este vicio procesal tiene una proyección muy limitada por dos razones:
La primera, tal predeterminación solo existiría cuando se describiesen delitos y no hechos, en los hechos probados, y enlazado con ello, se ha dicho que el empleo de términos propios del lenguaje cotidiano tales como “intención de traficar”, “propósito de vender”, “ánimo de matar”, “destinados a la venta”, “de común acuerdo y ánimo de lucro”, etc., no integran tal vicio porque no se describen delitos, sino que se emplean términos usuales para describir la acción que se enjuicia o se están describiendo los elementos subjetivos de la acción como son el conocimiento y el consentimiento en la acción emprendida por la persona concernida, que deben hacerse constar en los hechos probados —SSTS 361/2006; 289/2007;685/2009; 436/2011; 1408/2011 ó 461/2012—.
La segunda razón es porque no puede olvidarse que el factum en cuanto que es la base de la ulterior calificación jurídica de los hechos enjuiciados—la subsunción jurídica— debe ser necesariamente compatible y estar en armonía con los hechos salvo patente incongruencia”. (Prat Westerlindh, Carlos; Manual Práctico del Recurso de Casación Penal, Tirant lo blanch, Valencia, 2015, p. 98-100).
Si bien es cierto, en la sentencia impugnada no se realizan estas consideraciones teóricas sobre el vicio en cuestión, sí se aprecia que la decisión a la que se arribó es consecuencia directa de una correcta aplicación de la normativa procesal, de las pautas establecidas por las garantías del debido proceso y del principio de imputación, lo cual se aprecia claramente cuando el juzgador señala:
“(…) dentro de la acusación, tanto del Ministerio Público como la acusación en la querella no establecen una descripción de que una acción de proceso que se haya realizado, como el que se estaba mencionando de que usted está cortando, en apariencia, trozos de madera para leña, que ese posiblemente sea el que se asimile a una acción parecida a un proceso, que era la forma de transformación de un objeto en forma física, química o como lo dice la Real Academia. Siendo que estos dos elementos importantes, la acusación y la querella, son el fundamento y la cancha, como le dije anteriormente, para poder yo establecer el analizar la conducta a través del resto de la prueba, no me coincide y no comparto los criterios de análisis que se han realizado, por el contrario, considero que ninguno de los delitos que se le venían acusando a su persona, por lo menos de los que están señalados aquí y que están descritos también en la pieza acusatoria y la querella, como haciendo uso de las palabras de su defensora, aquí no se están determinando las acusaciones o la descripción legal que hicieran los profesionales, sino los hechos y de los hechos, según la acusación que han realizado ellos, no coincide en ninguna de las actividades que se vienen desarrollando y es entonces el criterio de este servidor que, no cumpliéndose este requisito meramente de la acusación y de la querella, pues la resolución no podría coincidir en atención a lo que solicitan ellos, en el sentido de que usted se tenga como una persona responsable por hechos y, en ese tanto no me corresponde tampoco seguir analizando el resto de los elementos de lo que es la teoría del delito, porque en realidad las conductas que se le vienen a usted acusando no coinciden completamente a los tipos penales que se están señalando y, de ninguna manera podría este tribunal, a través de interpretaciones que la ley no me permite, poder tomar ciertos tipos penales, ciertos requisitos y armar otro”.
Entonces, se observa con meridiana claridad que lo resuelto por el a quo no es más que la aplicación de la exigencia de determinación precisa del hecho, que constituye la infracción, con el fin de evitar incurrir en el vicio de predeterminación del fallo al que ya se ha hecho referencia, y que se encuentra vinculado con el principio supraconstitucional de imputación también señalado. De acuerdo con lo anterior, esta posición mayoritaria es del criterio que las consideraciones realizadas en el fallo impugnado son correctas, desde que una violación al debido proceso, como lo es la falta de una adecuada imputación de los hechos, impide que se pueda realizar un análisis del material probatorio como el que requiere el recurrente, pues sería un sinsentido proseguir con el análisis de los hechos y de su encuadre típico, sabiendo que la persona acusada no tuvo posibilidad real de defenderse sobre tales hechos.
Lo mismo ocurre desde la perspectiva de la responsabilidad civil del imputado, desde que la acción civil resarcitoria lo que atribuyó fue la existencia de responsabilidad subjetiva a partir de la misma base fáctica planteada por la querella y la acusación del Ministerio Público. De hecho, en la acción civil resarcitoria se invoca como hecho generador de responsabilidad civil “…la conducta ilícita por un delito de Infracción a la Ley Forestal contemplado en la Ley No. 7575 y su Reglamento, previsto en el artículo 58 inciso b) y 61 inciso a), de este cuerpo legal, ejecutado por el aquí Demandado Civil”. Entonces, la conclusión a la que arribó el órgano juzgador sobre la necesidad de absolver en lo civil, como corolario de la absolutoria penal resultaba correcta, puesto que la responsabilidad civil es accesoria a la penal y, salvo en supuestos especiales de responsabilidad objetiva, no podría pensarse en una condena civil sin que se pueda establecerse una vinculación entre la conducta ilícita y el hecho dañoso.
Si se revisan las disposiciones de la Ley Forestal, se aprecia que el artículo 57 de dicha normativa establece únicamente responsabilidad subjetiva por la comisión de infracciones de dicha ley, al establecer que:
“ARTICULO 57.- Infracciones Las infracciones a la presente ley, de acuerdo con este título constituyen delitos.
En el caso de los actos ilícitos comprendidos en esta ley, cuando se trate de personas jurídicas, la responsabilidad civil se extenderá a sus representantes legales. Asimismo, tanto las personas físicas como jurídicas serán responsables, civilmente, por el daño ecológico causado, de acuerdo con lo que establece el artículo 1045 del Código Civil. Las autoridades, regentes forestales y certificadores a quienes les competa hacer cumplir esta ley y su reglamento, serán juzgados como cómplices y sancionados con las mismas penas, según sea el delito, cuando se les compruebe que, a pesar de tener conocimiento de sus violaciones, por negligencia o por complacencia, no procuren el castigo de los culpables y permitan la infracción de esta ley y su reglamento. De acuerdo con la gravedad del hecho, los Jueces que conozcan de esta ley podrán imponerles la pena de inhabilitación especial (Los resaltados son suplidos).
De acuerdo con lo anterior, al no poder demostrarse el ilícito penal por los problemas de imputación de las acusaciones planteadas, cuya descripción es idéntica en la acción civil, resultaba imposible establecer el necesario nexo causal entre el hecho ilícito y el daño reclamado. Desde esa perspectiva, debe apreciarse que la acción civil atribuyó exactamente los mismos hechos que la querella, por lo que los vicios en relación con la imputación penal se ven reflejados en la atribución civil, en el tanto no se logró demostrar la realización de la tala por parte del imputado y lo que se habría demostrado consistió en una conducta delictiva no acusada, como lo fueron los delitos contemplados por el artículo 61 de la Ley Forestal, al no haberse dotado de contenido descriptivo a los comportamientos atribuidos al justiciable (aprovechamiento, adquisición o procesamiento de productos forestales). Es por ello que no podría haberse determinado la existencia de responsabilidad subjetiva alguna del imputado, pues tal como lo ha señalado la Sala Primera de la Corte Suprema de Justicia en el voto 2007-000658 de las 8:35 horas del 19 de setiembre de 2007:
"... La jurisprudencia de esta Sala ha sostenido de manera invariable el carácter subjetivo que por regla general -con algunas excepciones- sigue la responsabilidad extracontractual, al señalar que su presupuesto normativo de partida es el cardinal 1045 del Código civil. La conducta del presunto responsable se juzga a posteriori -cuando ha ocurrido el daño- a fin de valorar si ésta, en modalidad de acción u omisión, se desplegó con dolo, culpa, negligencia o imprudencia. Debe constatarse ese juicio de reproche en el proceder del demandado, debe establecerse si en esa conducta radica la causa de los daños, esto es, si a partir de un análisis de causalidad es el antecedente fáctico que da lugar a los menoscabos reclamados..." (resolución 001063-F-S1-2009 Sala I), por lo que, efectivamente resultaba necesario demostrar el actuar doloso del imputado y demandado civil, para poder sentar su responsabilidad civil subjetiva, sin embargo, como lo apuntan los jueces de juicio, no fue posible porque los testigos evacuados no pudieron determinar que fuera salvavidas del "Balneario Patarrá", aunado a lo declarado por uno de los testigos en el sentido de que era misceláneo, lo que les generó dudas razonable al tribunal.
No basta con que la acusación imputara una posición de garante de hecho, sino que ella debía demostrarse, no obstante ello no ocurrió, ya que la prueba testimonial de cargo no permitió demostrar esa circunstancia sin asomo de dudas. También es oportuno acotar que "... Para que surja la responsabilidad extracontractual objetiva, se requiere de la existencia de un comportamiento (actividad peligrosa) que sirva de criterio de imputación y de un resultado lesivo de intereses, jurídicamente relevantes. En el caso de la responsabilidad extracontractual subjetiva, o por culpa (que es la que al caso interesa) para su configuración se requiere de la presencia conjunta de tres elementos: la antijuridicidad, la culpabilidad y el nexo de causalidad entre la conducta y el daño producido..." De lo expuesto es posible concluir que la resolución impugnada resolvió de manera adecuada lo concerniente a la responsabilidad penal y civil que se le atribuía al sindicado, sin que pudiera establecerse una condena en contra de este cuando los actores procesales no realizaron un correcto ejercicio de las imputaciones, de forma tal que permitieran al imputado y demandado civil ejercer adecuadamente su defensa.
Al no observar incorrección alguna con lo resuelto, para la mayoría de esta Cámara corresponde declarar sin lugar el recurso de apelación planteado y confirmar la resolución impugnada en todos sus extremos. La jueza Sancho González salva su voto.
V.Voto salvado de la Jueza Sancho González. Con acentuado respeto, me aparto del criterio de la mayoría de esta Cámara de apelación con base en las siguientes consideraciones: luego de escuchar de manera detenida el fallo de instancia, el cual fue dictado de manera oral y que consta en el escritorio virtual registrado a las 10:59:18 del 25 de abril de 2024, archivo 220000560454PE-25042024101711-2_Multi, concluyo que la decisión del tribunal de mérito contiene una serie de vicios que conllevan a su nulidad. Siendo absolutamente necesario para explicar mi decisión, debo remitirme de nuevo al contenido de los hechos querellados (que concuerdan con los demandados y acusados por la fiscalía): “1. En fecha 13 de enero del 2022 en horas de la mañana; en una finca ubicada [...], el imputado [Nombre 001] taló y aprovechó dos árboles de la especie conocida como Chilamate; cinco árboles de la especie conocida como Guaba, nueve árboles de Guácimo; un árbol de la especie conocida como Aceituno, cuatro árboles de Jobo y 15 palmas de Coyol todo lo cual realizó el imputado de forma dolosa sin contar con los respectivos permisos de la Administración Forestal del Estado y en daño del medio ambiente, y los recursos naturales del estado. 2.
Con los hechos descritos e ilícitos, el demandado civil [Nombre 001], dañó el medio ambiente mediante la corta de varias especies de árboles en cantidades individuales, produciendo con su actuar una alteración al ecosistema del área de protección, siendo que como consecuencia del actuar ilícito del demandado civil se causó el deterioro de los recursos naturales en el área de protección, alterando el equilibrio natural del ecosistema, por lo que esta representación valoró la madera aserrada en la suma de un millón setecientos noventa y seis mil quinientos noventa y siete colones (₡1.796.597,00)” (sic, consultar folio 63 del expediente, el subrayado es propio). La sentencia reprocha que la imputación de la pieza acusatoria no cumple con los requisitos que exige el artículo 303 del Código Procesal Penal y añade que, por ello, no era posible analizar el contenido de las probanzas para establecer si el imputado había incurrido o no en alguna conducta delictiva.
El juez de instancia dijo en la resolución a partir del contador 21:15, lo que se transcribe en extenso por ser esencial para efectos de lo que se dirá: “La ley establece como principio de que las acusaciones que realiza tanto el Ministerio Público como realiza la que realiza el ente querellante, deben especificar y cumplir los requisitos que establece también la normativa en qué deben de contener esa acusación, principalmente que los hechos y circunstancias deben ser completamente claros, establecidos y que lleven una gran relación o completa relación con lo que son los elementos que establece la norma o el delito que se le viene señalando a usted y, en este caso es las conductas que se vengan describiendo por parte de la ley en la ley forestal, tanto el artículo 58 en el inciso b) como el artículo 61 inciso a, inciso b), que son los 3 tipos de delito, en el primero que se establece que es una conducta en la cual se da un aprovechamiento de los recursos forestales en terrenos del patrimonio natural del Estado y en las áreas de protección, esa era la primer conducta en la cual por parte de la querella se estaba señalando, después, el Ministerio Público, al igual que la querella señalaron otros dos comportamientos que se le vienen achacando a su persona: el aprovechamiento de los productos forestales en propiedad privada, ese era el del inciso a) y la adquisición o procesamiento de productos forestales que constan el inciso b); siendo entonces estas pretensiones que verían que estaban siendo perseguidas por parte de estos dos entes acusadores, quiero retomarle que el tema en el cual yo me tengo que basar es que esa acusación que ellos nos informaron y que le dijeron a su persona en el momento de la lectura, iban a contener todos los elementos esenciales y elementos., le tengo que informar que no son solamente las circunstancias de modo tiempo que pudieran estarse señalando o que la prueba me podría informar, sino que además las conductas deberían de responder a los verbos que establecen la ley.
Para darle un ejemplo y que quede más claro, la ley me dice cuáles son las actividades que tiene que realizar la persona y yo verificar con la acusación y la prueba que esos fueron las acciones que desarrolló la persona, si la acusación viene dirigida a que una persona dio muerte a otra, hablando de un homicidio, la acusación tiene que decirme a mí que se dio muerte de una persona y la acción estaba realizada en ese sentido, pero si la acción, perdón, si la acusación viene referida a que existieron otro tipo de conductas, como que existieron lesiones que estaban dirigidas para la muerte pero que no dieron la muerte, pues obviamente no estaríamos en un mismo delito, circunstancia la cual yo traigo a colación porque aquí tuvimos la acusación por parte de Ministerio Público y la querella. Estas señalaron dentro de los comportamientos y, como le informé, las conductas o los verbos, principalmente de “taló” y “aprovechó” que igual en la querella, refirió en su primer hecho “taló” y “aprovechó”.
Al hacer la valoración en cuanto a los requisitos del resto de los tipos penales, pues obviamente y bien lo demarcó la Fiscalía en sus conclusiones y también lo demarcó la representación del Estado, la Procuraduría, en el tanto de que la conducta de aprovechamiento de los recursos forestales en terreno patrimonial natural del Estado y en áreas de protección en cuanto a la tala, pues se acusó, pero que no estaba contenido por lo menos dentro del resto de la prueba y que así también lo señalaban. Por su parte, entonces solo continuaba el perseguir las conductas del aprovechamiento de los productos forestales de propiedad privada o la adquisición o procesamiento de productos. La única oportunidad en la cual se pudo aprovechar la corrección, únicamente fue por parte de Ministerio Público y no hubo ninguna otra corrección respecto a las descripciones de las conductas que se venían dando en la acusación o que ya usted había sido informado desde las anteriores etapas y que, además, dentro de la investigación, ambos entes acusadores pudieron haber determinado exactamente cuál era a través de la prueba, las conductas que se iban a achacar a su persona y en ese sentido la ley también resultó que la posibilidad, que hoy no se presentó, desde ayer no se presentó ni hoy se presentó la posibilidad de una corrección que se pudiese dar de la acusación, inclusive una ampliación.
También la ley les otorga la posibilidad a los entes acusadores de realizar una acusación subsidiaria, situación que tampoco se presentó en este proceso. Le hago la acotación de estos puntos que tenían tanto el Ministerio Público como el Estado a través de la Procuraduría, las opciones para señalar más conductas o más acusaciones de su persona, porque a partir de las acusaciones que se habían formulado aquí es como la cancha de fútbol que yo como juez puedo jugar. Y en ese, sentido manteniéndome únicamente sin existir correcciones en las acusaciones, sin existir una acusación subsidiaria, únicamente me puedo remitir entonces a que las conductas que se le vienen persiguiendo a su persona es la tala y el aprovechamiento. La norma que se hicieron referencia y que le comenté, principalmente el artículo 58, que ha sido descartado por ambos entes acusadores, en realidad sí se logró determinar de que la prueba, tanto los informes como la declaración de don… el señor [Nombre 007], don [Nombre 007] en el tanto que estaba claro que su persona no realizó una conducta en cuanto la tala porque no había forma de cómo señalarle usted eso.
La siguiente conducta, entonces superada la anterior, es en cuanto a la norma que recoge el tema del aprovechamiento de los recursos forestales en terrenos del patrimonio natural del Estado y en áreas de protección. En realidad, esta norma que nos indica la Ley Forestal, pues establece que la conducta que debe estar contenida dentro de la pieza acusatoria es de que se aproveche uno o varios productos forestales en propiedad privada, elementos necesarios que tienen que constar dentro de la acusación o de la querella, sin el permiso de administración forestal y, aunque cuenten con el permiso, que no se ajuste dentro de lo autorizado. En realidad, son tres elementos principales y de ellos este servidor, pues en procura de analizar la existencia de todos los elementos que establece la ley para que la acusación tenga todos los requisitos de una descripción clara, precisa y circunstanciada, pues, puedo determinar que a pesar de que se establece uno de los verbos —el aprovechamiento—, hay otros requisitos como la ubicación de la finca para poder determinar de quién es, si es privada o es pública, para lo cual es un elemento necesario y que la acusación no la trae, tampoco la querella estableció eso.
En esa misma línea, las pretensiones y las interpretaciones que han realizado tanto los entes acusadores como le dije y su defensora, es que el comportamiento desplegado coincide entonces en lo que el delito de adquisición o procesamiento de productos forestales pueda encajar. De manera básica únicamente informarle los verbos que establece este delito de adquisición y procesamiento de productos forestales, principalmente, interesan los dos verbos de adquisición y procesamiento. La adquisición o adquirir debe entenderse como hacer propio un derecho o una cosa de nadie que a nadie pertenece o que se transmite por título lucrativo, oneroso o por prescripción, sea, que es un traslado de dominio de una persona hacia otra, circunstancia que dentro de la acusación por parte del Ministerio Público ni de la querella se puede determinar, por lo cual entonces el verbo que se está señalando en este tipo penal respecto a la adquisición, considerando de que se trata de un delito de adquisición o procesamiento de productos forestales, pues este primer verbo no se ubica tampoco entre la pieza acusatoria ni tampoco entre la querella y, en ese tanto, entonces lo que resto es analizar el siguiente verbo, que es el de procesamiento y procesar, la misma RAE que fue la fue la fuente la cual utilicé para definir lo que era adquisición, también nos ofrece la definición de lo que es procesar y a lo que nos interesa, da varias definiciones, formar autos y procesos, declarar y tratar a alguien como un presunto de delito.
Pero el que nos interesa en este momento “someter a un proceso de transformación física, química o biológica”. Y en ese tanto, las acusaciones tanto del Ministerio Público como de la querella refieren únicamente a sus verbos un aprovechamiento. Y calificar ese aprovechamiento, en el tanto de que no nos describen exactamente si el aprovechamiento fue por el procesamiento y de qué manera fue ese proceso, únicamente nos informaron de aprovechamiento, del cual no es el mismo verbo el aprovechamiento al verbo del proceso. La representación del Estado hizo su manifestación en sus conclusiones en cuanto que este servidor pusiera atención a qué era entender, por lo menos el aprovechamiento. Sin embargo, la vertiente que ha tomado la representación del Estado, pues no es compartida por este servidor, pese a que respeto meramente el análisis que realizó, pues no comparto porque considero que sí debe ser la descripción exacta del verbo que establece la norma y en este caso es procesar y dentro de la acusación, tanto del Ministerio Público como la acusación en la querella no establecen una descripción de que una acción de proceso que se haya realizado, como el que se estaba mencionando de que usted está cortando, en apariencia, trozos de madera para leña, que ese posiblemente sea el que se asimile a una acción parecida a un proceso, que era la forma de transformación de un objeto en forma física, química o como lo dice la Real Academia.
Siendo que estos dos elementos importantes, la acusación y la querella, son el fundamento y la cancha, como le dije anteriormente, para poder yo establecer el analizar la conducta a través del resto de la prueba, no me coincide y no comparto los criterios de análisis que se han realizado, por el contrario, considero que ninguno de los delitos que se le venían acusando a su persona, por lo menos de los que están señalados aquí y que están descritos también en la pieza acusatoria y la querella, como haciendo uso de las palabras de su defensora, aquí no se están determinando las acusaciones o la descripción legal que hicieran los profesionales, sino los hechos y de los hechos, según la acusación que han realizado ellos, no coincide en ninguna de las actividades que se vienen desarrollando y es entonces el criterio de este servidor que, no cumpliéndose este requisito meramente de la acusación y de la querella, pues la resolución no podría coincidir en atención a lo que solicitan ellos, en el sentido de que usted se tenga como una persona responsable por hechos y, en ese tanto no me corresponde tampoco seguir analizando el resto de los elementos de lo que es la teoría del delito, porque en realidad las conductas que se le vienen a usted acusando no coinciden completamente a los tipos penales que se están señalando y, de ninguna manera podría este tribunal, a través de interpretaciones que la ley no me permite, poder tomar ciertos tipos penales, ciertos requisitos y armar otro.
En ese sentido, queda completamente alejado pues, es un principio de legalidad o el principio que me tengo que someter a lo que diga la ley nada más, y no puedo avanzar más allá. Y eso, en ese tanto entonces que al extremo de poder considerar a usted, de alguna forma, que las acusaciones y la prueba hayan derribado el principio de inocencia que lo cobijaba a su persona, pues no se ha presentado, no se ha derribado […]” (la transcripción es fiel). El reproche que hace el juzgador en la sentencia, en mi criterio, no encuentra sustento: conviene señalar que quienes ejercen la acción penal acusan hechos y no calificaciones legales, quiere decir esto que, mientras la conducta típica se encuentre debidamente descrita en el marco fáctico imputado, se respeta el principio de imputación que, de acuerdo con la jurisprudencia de la Sala Constitucional, se ha conceptualizado como “[…] el derecho a una acusación formal.
Necesariamente debe cumplirse a cualquiera que se pretenda someter a un proceso. Es, pues, deber del Ministerio Público [o de quien ejerza la acción penal], aún inicialmente, y, después, de éste y del juez, y comprende los de individualizar al imputado, describir detallada, precisa y claramente el hecho de que se le acusa, y hacer una clara calificación legal del hecho, señalando los fundamentos de derecho de la acusación y concreta pretensión punitiva” (sic, ver resolución n.° 1739 de las 11:45 horas de 1° de julio de 1992). Una correcta imputación, entonces, debe contener todos los requisitos que prevé el artículo 303 del Código Procesal, a saber: a) los datos que sirvan para identificar al imputado, b) la relación precisa y circunstanciada del hecho punible que se atribuya, c) la fundamentación de la acusación, con la expresión de los elementos de convicción que la motivan d) la cita de los preceptos jurídicos aplicables, e) el ofrecimiento de la prueba que se presentará en el juicio; cada uno de ellos es esencial para que la persona sindicada conozca claramente el hecho que se le atribuye y a partir de una definición de las circunstancias de modo, tiempo y lugar y del acervo probatorio reunido puesto en su conocimiento, pueda diseñar una estrategia de defensa que le permita refutar los cargos que le atribuye el Ministerio Público o la parte acusadora a través de la querella, como en el caso que nos ocupa.
Las particularidades del hecho investigado se encuentran claramente expuestas en los hechos de la acusación planteada por la Procuraduría General de la República, como se reseñará unas líneas más adelante. Véase que, según el a quo, los requerimientos —tanto de la fiscalía como del Estado— resultaban inidóneos para valorar si la actuación del imputado encuadraba dentro de alguna figura penal, ignorando que, de la descripción de hechos de la querella, se logra establecer: i) a quién se acusó — [Nombre 001]—, que es el imputado; ii) de qué se le acusó —de talar y aprovechar— (verbos típicos) dos árboles de chilamate, cinco árboles de guaba, nueve árboles de guácimo, un árbol de aceituno, cuatro árboles de jobo y 15 palmas de coyol”; iii) en dónde y cuándo ocurrieron los hechos —el 13 de enero de 2022, en horas de la mañana, en una finca ubicada en [...]—; iv) cómo se hizo la acción atribuida —sin contar con los respectivos permisos de la administración forestal del Estado— y —en daño del ambiente—.
Obsérvese que la acusación formulada por la Procuraduría, debe leerse atendiendo la propia calificación legal que la representación del Estado le dio a los hechos, que los encuadró como un delito de Infracción a la Ley Forestal en la modalidad de tala y aprovechamiento ilegal de productos forestales en propiedad privada. Dispone el artículo 61 de la ley de cita:
“Se impondrá prisión de un mes a tres años a quien:
Aproveche uno o varios productos forestales en propiedad privada, sin el permiso de la Administración Forestal del Estado, o a quien, aunque cuente con el permiso, no se ajuste a lo autorizado” (el énfasis es propio).
Es cierto que en la tipicación que da la querella en el acápite de calificación legal, se enuncian otras normas de fondo que, para el caso concreto, no aplican —58 inciso b) y 61 inciso b de la Ley Forestal—, pero ello es poco relevante, porque como se lleva dicho, se acusan hechos y no calificaciones legales y el elenco de hechos daba cuenta de una acción de “tala y aprovechamiento” de una determinada cantidad de árboles de las que se indicó la especie. Entonces, los verbos típicos atribuidos eran talar y aprovechar, y es respecto de este último del cual el señor juez omitió su examen en la fundamentación del fallo y, por ende, la razón por la que estimo que la sentencia debe ser declarada ineficaz. Aunque al analizar la inidoneidad de las acusaciones el tribunal de mérito alude al contenido de las acciones típicas que se regulan en el 58 inciso b) y 61 inciso b) de la Ley Forestal concluyendo que no están descritas en los requerimientos, no aborda el verbo “aprovechar” que es un concepto normativo que desarrolla la misma Ley Forestal, que en su artículo 3, dispone: “Para los efectos de esta ley, se considera: a) Aprovechamiento maderable: Acción de corta, eliminación de árboles maderables en pie o utilización de árboles caídos, realizada en terrenos privados, no incluida en el artículo 1 de esta ley, que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa”.
Como se puede extraer del estudio de la sentencia oral, el juzgador no se planteó estas cuestiones al estimar que las acusaciones formuladas no contenían los requisitos de imputación exigidos en el artículo 303 de la normativa procesal penal. La exposición del fallo, desde mi óptica, es confusa y se extiende con argumentaciones fuera del contexto de las conductas específicas atribuidas en ambos requerimientos (del Ministerio Público y de la Procuraduría) analizando supuestos no contemplados en los marcos fácticos de las piezas acusatorias que lo llevan a la conclusión equivocada de que estas no contemplaban los requisitos básicos de imputación. Adicionalmente, el a quo reclama que la querella (tanto como la acusación) no indican si la acción atribuida se realizó en una propiedad pública o privada, pero como se colige de la literalidad de los hechos del requerimiento del Estado, se da una especificación de que se trata de una finca, se da su ubicación exacta, lo que significa que, del análisis probatorio (de haberse hecho) se podía corroborar o descartar que se trataba de un inmueble privado, no se aludió en la pieza acusatoria en ningún momento que se tratara de una propiedad del Estado en los términos del artículo 1 de la Ley Forestal que señala: “se prohíbe la corta o el aprovechamiento de los bosques en parques nacionales, reservas biológicas, manglares, zonas protectoras, refugios de vida silvestre y reservas forestales propiedad del Estado”; de manera que, ninguno de los cuestionamientos que hace el juzgador, encuentran sustento en el contenido de lo establecido en la querella promovida por la Procuraduría General de la República, antes bien, esta cumple con las especificidades necesarias para valorar si el imputado incurrió o no en la conducta típica a partir del examen de las probanzas, que fue un ejercicio que no llevó a cabo el tribunal de instancia pues se limitó a señalar las supuestas falencias de las acusaciones, las que, como se lleva dicho, son inexistentes.
Esto me permite concluir que la sentencia debe ser anulada y disponerse el juicio de reenvío para una nueva sustanciación y, en razón de que la decisión de absolver por las razones que ya se han apuntado, conllevó a que se declarara sin lugar la acción civil resarcitoria promovida por el Estado sin ulterior análisis de la demanda —pues trasladó los mismos argumentos a esa acción sin valorar las pretensiones de fondo—, la ineficacia del fallo alcanza tanto los extremos penales como los civiles, íntegramente.
POR TANTO
Por mayoría, se declara sin lugar el recurso de apelación promovido por el representante de la Procuraduría General de la República y se confirma la sentencia impugnada en todos sus extremos. La jueza Sancho González salva su voto, dispone la ineficacia integral del fallo y ordena la realización de un juicio de reenvío para nueva sustanciación del asunto ante otra integración del mismo tribunal. Notifíquese.
